Abstract

In 2022, the Biden administration implemented what the New York Times has described as potentially “the most sweeping change to the asylum process in a quarter-century.” This new adjudication system creates unrealistically short deadlines for asylum seekers who arrive over the southern border, the vast majority of whom are people of color. Rather than providing a fair opportunity for those seeking safety to explain and corroborate their persecution claims, the new system imposes unreasonably speedy time frames to enable swift adjudications. Asylum seekers must obtain representation very quickly even though the government does not fund counsel and not enough lawyers offer free or low-cost representation. Moreover, the immigration statute requires that asylum seekers must corroborate their claims with extrinsic evidence if the adjudicator thinks that such evidence is available – a nearly impossible task in the time frames provided by the new rule. As a result, the new rule clashes with every state’s Rules of Professional Conduct 1.1 and 1.3, imposing duties of competence and diligence in every case that a lawyer undertakes. It will be extremely difficult for lawyers to provide competent and diligent representation under the new, excessively short deadlines. For immigration lawyers, the new rule exacerbates a challenge that they share with public defenders and other lawyers working within dysfunctional systems: how to provide even the most basic level of procedural due process for their clients, most of whom are people of color.

This article begins by describing the regular asylum process. It then summarizes the history of expedited removal, a screening system that limits access to that process for asylum seekers who arrive at the southern U.S. border without visas. It then explains and assesses the Biden administration’s first and second versions of the new asylum rule, highlighting the major flaw that will make the current version an unfairly formidable hurdle for asylum seekers subject to it. The article concludes by setting out a way for the Biden administration to create a more fair, accurate and efficient border asylum adjudication system and ensure that the U.S. can comply with domestic and international refugee law.

Expect the Biden Administration to “blow off” the suggestions for improvement at the end of the article. They seem to glory in “tuning out” the views of practical experts who know how to fix the broken asylum adjudication system.

Due-process-denying, representation-killing, arbitrary time limits imposed from above have been tried by Administration after Administration. They have always failed and will continue to do so. So, why are they a key part of the Administration’s so-called “reforms?”

Rather than addressing the representation crisis in a rational, cooperative manner, the Biden Administration’s EOIR farce has driven a huge wedge between the clueless policy makers who operate in the “twilight zone” and the NGO, pro bono, and low bono legal community that they need to succeed on immigration, human rights, and racial justice. Compare the article’s discussion of the importance of representation and the practical and ethical problems caused by the new regulations with the reality of the “nutsos” ways EOIR is mis-treating attorneys currently trying to practice before the Immigration Courts!

Additionally, the unwarranted, yet largely self-fulfilling assumption by the Biden Administration that only 15% of asylum applications would be granted at the “Asylum Office stage” show why this program was designed to fail by the wrong officials. For the system to meaningfully address the Immigration Court asylum backlog, the grant rate would have to be multiples of that — probably at least 50%.

That’s a realistic projection, given the well-documented, atrocious human rights conditions in most “sending countries” and the current artificial limitations on grants imposed by bad precedents and flawed, biased, or incompetent adjudications. When I was at the Arlington Immigration Court from 2003-16, a significant majority of the “referrals” from the Asylum Office were granted asylum, withholding of removal, or CAT protection, often with concurrence or only token opposition by ICE. That suggests that there is a huge unrealized potential for many more timely asylum grants at the Asylum Office. But, success will never be achieved with the current “anti-asylum, afraid to correctly and fairly implement refugee law gang” in charge — committed to retaining the bad attitudes and repeating the mistakes of the past!

Hanging over the whole disaster is the “uncomfortable truth” that I’ve been shouting:

  • The Biden Administration is still operating EOIR and large portions of the immigration bureaucracy at DHS with Trump-era “holdovers” who were improperly “programmed to deny” asylum.

  • There is a dearth of positive precedents from the BIA on gender-based asylum and other types of common asylum applications at the border that are routinely and wrongfully mishandled and denied.

  • There are cosmic problems resulting from failure to provide qualified representation of asylum seekers at the border.

  • Detention continues to be misused as a “deterrent” to legal claims and “punishment” for asserting  them. 

  • Despite “touting” a much larger refugee admissions program beyond the border, the Administration has failed to deliver a robust, realistic, refugee admissions program for Latin America and the Caribbean which would take pressure off the border. 

  • Racism and White Nationalism continue to drive the Administration’s dramatically inconsistent approach to White refugees from Ukraine compared with refugees of color at the Southern Border.

Indeed, this entire “reform effort” is essentially “upside down.” It’s a “designed to fail” attempt to avoid the broken and malfunctioning Immigration Court system without dealing with the REAL problem: EOIR!

Without the necessary progressive personnel and structural reforms at Garland’s EOIR (“clean house” of unqualified, under-qualified, or misplaced administrators and judges from past Administrations), the cultural changes (“out with the anti-asylum, anti-immigrant, racially challenged, too often misogynistic, EOIR culture”) it would bring, and most of all, the substantive changes to align asylum law with due process, best practices, and the generous interpretations that were foreshadowed by the Refugee Act of 1`980 but have been intentionally suppressed by politicos of both parties, there will be neither justice nor stability in our asylum and immigration systems, nor will there be equal justice for all, including racial justice, in America! 

Even my esteemed “RR3” friends understate the debilitating effects of the ever-worsening dysfunction at EOIR and Garland’s failure of leadership on due process and human rights!

Perhaps the most telling statement in their article is this: “Asylum officers are more highly trained in asylum adjudication than immigration judges . . . .”  Why, on earth, would that be? 

Why isn’t the BIA led and comprised of internationally-respected asylum experts like Schrag, Schoenholtz, Ramji-Nogales, and others like them? Why aren’t all Immigration Judges drawn from the ranks of universally-respected “practical scholars” in asylum and human rights?  Plenty of them are out here! Why aren’t they on the bench? Why is the Biden Administration running a “D-Team Judiciary” at EOIR rather than “the world’s best administrative tribunals, guaranteeing fairness and due process for all” as EOIR was once envisioned? What’s the excuse for lousy training at EOIR when top-flight “modulated” asylum training is available from expert sources like Professor Michele Pistone’s innovative VIISTA Villanova program? What’s the excuse for the colossal EOIR failure that threatens lives and our democracy on a daily basis? Why aren’t alarm bells going off at the White House about Garland’s failed stewardship at EOIR?

Reforming the asylum system, starting with EOIR, could also potentially have big societal and economic benefits for America. Asylees gain legal status, can work, get in line for green cards, eventually become citizens, and realize their full potential as productive members of our society. Not incidentally, they also become regular taxpayers and can help bolster essential enterprises and infrastructure improvements.

For example, just yesterday the Portland (ME) Press Herald featured an article about the critical, chronic shortage of workers in Maine. https://www.pressherald.com/2022/10/02/how-can-maine-solve-its-workforce-crisis/ Why isn’t the Biden Administration working with Maine authorities, NGOs, and economic development groups to “fast track” asylum approvals for those who might be persuaded to resettle in Maine to take advantage of these economic opportunities, for everyone’s benefit? Mainers also are suffering from a shortage of affordable housing. I’ll bet that with a little “seed money,” there are enterprising, skilled groups of potential asylees who could help build and maintain affordable housing for communities in need, in Maine and elsewhere in the U.S. Why are they instead “rotting at the border” or being aimlessly “orbited” around America by nativist GOP governors trying to score political points with their White Nationalist base?

By adopting the nativists’ dehumanizing mis-characterization of asylum seekers as a “problem” to be measured in “numbers,” deterred, and held at bay, the Administration is missing a golden opportunity to achieve some much-needed “win-wins.” Why run bone-headed “built to fail, haste makes waste” asylum pilot programs in a few cities rather than trying things that might work to everyone’s advantage, as I have described above?

At a time when many in America are finally learning the truth about our disgraceful failure to offer refuge to Jews during the period leading up to the Holocaust from the Ken Burns documentary, we (our at least some Americans) appear to be committed to making the same mistakes again. We should not undervalue the lives and contributions of refugees because of systemic or structural boas against certain groups!

Claiming to “reform” the U.S. refugee and asylum system without dealing with the ongoing, worsening, disasterous dysfunction at EOIR is a fool’s errand. The way to make the system work more efficiently is to grant the large number of deserving asylum cases in a timely, practical, manner driven by due process, best practices, and best interpretations of asylum law. Unless and until those in charge act on this truth, the awful mess at EOIR will continue to be an existential threat to democracy!

Just as during the Trump administration, RMX immigration court hearings remain a due process farce, with asylum seekers overwhelmingly unable to obtain legal counsel and denied refugee protections. Only five percent of people sent to Mexico under RMX 2.0 have a lawyer. According to analysis by the Syracuse University Transactional Records Access Clearinghouse, this is an even lower representation rate than the eight percent representation rate during the Trump administration’s implementation of RMX. Unsurprisingly, very few people in RMX 2.0 have been granted asylum protection. As of June 30, 2022, only 63 asylum seekers in RMX 2.0 had been granted relief—less than four percent of completed cases. This abysmal asylum grant rate is nearly identical to the 4.1 percent grant rate for completed RMX 1.0 cases. Seventy-five percent of completed RMX 2.0 cases ended with in absentia removal orders, virtually unchanged from the 72 percent in absentia removal order rate for completed RMX cases during the Trump administration. The gauntlet of grave dangers and terrible conditions inherent to RMX, rather than the merits of asylum seekers’ requests for protection, continued to determine the outcome of these cases.

EOIR is where much of the racially motivated Trump/Miller plan to dehumanize migrants, strip them of legal rights, harass their attorneys, and create a “false narrative” of  “manufactured” “failures to appear” and “bogus asylum denials” played out. Many at EOIR either actively supported these outrageous violations of human rights or “went along to get along” with massive abuses and the creation of a hostile environment for due process and legally correct asylum adjudications.

Yet, Garland and his lieutenants have failed to do the necessary “housecleaning” at EOIR and to bring in legitimate expert judges and professional administrators to restore due process and fairly and correctly interpret and apply asylum law! Indeed, many of the same judges and bureaucrats who presided over this farce continue to inflict injustice on migrants and their attorneys at Garland’s EOIR! How and why do Garland and his complicit lieutenants get away with it?

It’s also why, notwithstanding the evil motives behind the “orbiting” of asylum applicants, they are better off almost anywhere than Texas, which continues to operate largely as an “asylum-free and due-process-free zone” under Garland!

Due Process Disaster in Immigration Court

It is not easy to convey the magnitude of the ongoing disaster at EOIR, the Executive Office for Immigration Review, the office that oversees our nation’s Immigration Courts. Simply stated, the agency is rescheduling and advancing hundreds–maybe thousands–of cases without notifying attorneys, checking whether we are available to attend the hearings or checking whether we have the capacity to complete the cases.

On its face, this appears to be a mere scheduling problem. But in effect, it is a vicious and unprecedented assault on immigrants, their attorneys, and due process of law.

“Advancing hearings with no notice and no time to prepare? Why didn’t I think of that?!”

For me at least, the problem started small. A few cases were rescheduled and advanced without anyone at the Immigration Court bothering to inquire about my availability: Your case that was scheduled for two years in the future has been advanced and is now set for two months in the future. I was angry and upset, but I did not want to let my clients down. So I set other work obligations aside. I set family time aside. I put off doctors appointments. And I completed the cases, which were approved. I hoped that these cases were anomalies and that EOIR would stop this unfair and abusive practice. But that was not to be.

Instead, EOIR has dramatically expanded its effort to reschedule cases, often without providing sufficient notice–or any notice–to get the work done for our clients. As best as we can tell, the problem is occurring in California, Colorado, Maryland, and Virginia. I myself have had about a dozen cases rescheduled and advanced (so far). These cases had been scheduled for 2023 or 2024, and suddenly, they are now set for the fall of 2022. Other attorneys have had 20, 30 or more cases advanced, including some that were double booked. One lawyer reported having seven cases scheduled for the same week and 47 cases set for one month. Another lawyer purportedly told a judge that if she had one more case scheduled within the next six months, she would commit suicide.

Here, I want to break down what is happening, so noncitizens in Immigration Court can at least have some idea about EOIR’s disruptive practices.

First, when I say that EOIR is not providing notice of the hearings, that is not entirely accurate. They are not sending us a notice or contacting us in advance. Instead, they are posting the new hearing dates on our portal. What does this mean? Each attorney has access to a portal page with a calendar. We can scroll through the calendar one month at a time. Days with hearings are highlighted, and we can click on those days to see what is scheduled. When I review my calendar, I often find new hearings that were not previously on the schedule. The only way to know whether a new hearing has been scheduled is to scroll through our portals month-by-month and compare what’s there with our existing calendar–a burdensome process that leaves plenty of room to overlook a date. Needless to say, every time I sign on to the portal, I feel a nauseous sense of dread about what I might find.

Once we discover the new date, we need to review the file, contact the client, and determine whether we can complete the case. This all takes time. If we cannot complete the case, or we do not have an attorney available on the scheduled date, we need to ask for a continuance. Of course, clients who have been waiting years for a decision usually want to keep the earlier hearing date. They do not understand why we cannot complete the work or why we are not available that day. Their perspective is perfectly reasonable, but they only have one case, where lawyers have many and we are daily being ambushed by EOIR with additional work. All this can result in conflicts between clients (who want their cases heard) and lawyers (who need time to get the work done). It also makes it difficult to serve our other clients, who must be pushed aside to accommodate the new work randomly being dumped on us.

Even if the client agrees to request a continuance, that does not solve the problem. Motions to continue can be denied. Even when they are granted, the judges tend to reset the date for only a few weeks in the future, which is often not enough time to properly complete the work. Other times, judges simply do not rule on the motion, so we are left to prepare the case, not knowing whether it will go forward or not.

Also, while we sometimes discover a new date that is a few months in the future (and so in theory, we might have time to do the work), other times, the new date is only a few weeks in the future. Since the evidence, witness list, and legal brief are due at least 15 days before the hearing, and since even a “simple” asylum case takes 20 or 30 hours to prepare, this is not nearly enough time. Worse, some cases are randomly advanced and placed on the docket after the evidence is due, and so by the time we have “notice” of the case, our evidence is already late.

Adding insult to injury, another common problem is that cases are still being cancelled at the last minute. And so we drop everything to prepare a case, only to have it postponed once all the work is done. Since this is all utterly unpredictable, it is impossible to prioritize our work or advise our clients.

Again, if this were only a few cases, attorneys could set aside other work and get the job done. But lawyers who do immigration law tend to have many cases, and we are seeing dozens and dozens of cases advanced with no notice. This is such a blatant and obvious abuse of due process that it is impossible to believe it is accidental. I might have expected this policy from the Trump Administration, which was hell-bent on restricting immigration by any means necessary. But as it turns out, President Biden’s EOIR is far worse than President Trump’s. Indeed, the current level of callousness would make even Stephen Miller blush.

The solution to these problems is so basic that it should not need to be said, but here it is anyway: EOIR should stop advancing and rescheduling cases without notice and without consideration for whether we have time to complete the work. Unless something changes, we can expect many noncitizens to be unfairly denied protection, immigration attorneys will leave the profession (or worse), and EOIR will become illegitimate. Let us hope that sanity and decency will soon return to the Immigration Courts.

Ever wonder why Dems struggle to govern and often lose elections they should win?  This is a pretty good example of how the Biden Administration, through cowardice, ignorance, arrogance, and failure to prioritize racial justice and immigrant justice are “shooting themselves in the foot, over and over!”

They are going into midterms where every vote counts. They need “all hands on board” in the human rights community to help bail them out of the gross failures of the White House, Garland, and Mayorkas to reestablish a fair, efficient, and properly robust system for legally admitting refugees and processing asylum claims at the borders and the interior. This, in turn, has empowered disingenuous nativists like DeSantis and Abbott to “play games with human lives.” 

But, the Biden Administration “strategy” is to do everything possible to offend and drive a wedge between them and some of their most loyal and important groups of supporters — the immigration, human rights, and racial justice communities. (Make no mistake: The ongoing disaster at Garland’s EOIR disproportionally targets individuals of color.)

Garland seems to be impervious to his self-inflicted disaster at EOIR.  I think that advocates are going to have to sue to bring his “Stephen Miller Lite” travesty of justice at EOIR to a grinding halt. Those are resources that could and should be used to help asylum seekers “orbited” around the country by DeSantis and Abbott. 

I, for one, have been saying for a long time that Garland’s unfathomably horrible performance at EOIR is a threat to our entire justice system and to the future of our nation. Sadly, every day, Garland proves me right!

The real shame: It was all so preventable with just a modicum of competence and backbone from our failing AG!

The phrase “America First” fell rapidly into disrepute during World War II, largely because the America First Committee (whose most prominent spokesman was Charles Lindbergh) had urged non-intervention and appeasement and been accused of anti-semitism and fascist sympathies. It was then consigned to temporary obscurity, but not everyone forgot. The slogan was periodically recalled to articulate resurgent right-wing nationalism, often explicitly white nationalism, from Gerald L.K. Smith, once known as “America’s most notorious antisemite,” who founded the America First Party in the 1940s, to Barry Goldwater, hailed by his supporters as an “America First” politician and described by the conservative National Review in 1963 as standing for “States’ Rights, strict construction, limited government, private enterprise, and America first, last and always.” It was used to describe David Duke and George Wallace, before being resuscitated by Pat Buchanan (“We are not isolationists. We simply believe in America first, last and always,” he declared in 2000) in his presidential campaigns. A certain Donald Trump flirted with making his own run under Buchanan’s Reform Party banner, then brought the phrase triumphantly back a century after Wilson popularized it.

Now the America First Policy Institute declares that its slogan is “America First, Always” and that its immigration policy will mean no longer putting “America last” — echoing the language of a March 1922 editorial from what was then the nation’s most popular weekly, the Saturday Evening Post, as it harangued its readers about the “immigration problem” caused by “our policy of putting the alien and his interests first, and America last.”

These “America First” initiatives go beyond attempts at excluding the “alien” that were already divisive, and futile, a century ago. One of the most prominent spokesmen for “America First” today is Nicholas Fuentes, a white Christian nationalist who organized the America First Political Action Conference earlier this year. Fuentes was also present at the storming of the Capitol, as were his “Groyper” followers, waving his “AF” flags. Fuentes declared: “It is the American people, and our leader, Donald Trump, against everybody else in this country and this world.” That is certainly what “America First” has meant in the past, as its leaders promise that only they can put America first, by inflaming divisions against nearly every other human being. But it is “America First” that endures, not its erstwhile leaders — and its history offers a pretty good indication of what to expect from Trumpism without Trump.

Immigrants are almost always the first target of this “confederacy of cowards” — because they are most vulnerable. U.S. courts have traditionally been unwilling to effectively enforce the constitutional and legal rights of “the other.” But, as pointed out in the article, the hate and resentment continues to pour out against additional groups and individuals until “almost every other human being” becomes a target. 

We see it today in Virginia Governor Glenn “Junkman” Youngkin’s recent cowardly and unconstitutional “targeting and bullying” of transgender school kids under the ridiculously bogus rubric of “parents rights.” Just where does the “right” of neo-fascist parents to bully the children of others come from? 

The Fourth Circuit Court of Appeals in the Grimm case in 2020 already has found that “Junkman’s” scofflaw attempt to force transgender kids to use the wrong bathroom likely will be held unconstitutional. But, the Constitution and laws have never been anything but “convenient props” for America Firsters!” Compare the courage of the Grimm plaintiff with the ugly cowardice of the “Junkman” and his followers. (This following “Junkman’s” outrageous trip to Maine to campaign for notorious racist GOP gubernatorial candidate Paul LePage).

But, the Fourth Circuit might be an aberration. Often, getting reactionary judges who lack the character and guts to stand up against demonization of their fellow humans helps fuel and protect the “America First” movement from accountability. That’s certainly been at the core modern GOP mis-governance, and the Dems have been painfully “slow on the uptake” in countering it. You have only to look at Merrick Garland’s astounding mis-handling of the reactionary, weaponized, and totally dysfunctional Immigration “Courts” under his control to see just how slow!

In the end, it will be up to the upcoming generation to decide what kind of America they want to live in: An America that respects and honors the dignity, worth, and human potential of all of its inhabitants and serves as a model of tolerance and inclusion for the rest of the world? Or, an America where a minority of extreme right wing authoritarians are at war with the rest of us and, indeed, with humanity itself. Your choice!

But over the airwaves and online, another story is playing out: an absolute torrent of ads meant to frighten and anger voters about immigration.

A new report from the pro-immigration group America’s Voice seeks to document this ongoing phenomenon. One of its key conclusions: “Republicans have made their nativist narrative a top messaging priority.”

In the world of Republican campaign ads, very little has changed since the xenophobic Trump presidency, and some of what’s in these ads is truly repellent.

Three themes dominate these ads, the report finds, and they are all wildly inflammatory and profoundly dishonest: The Biden administration has created “open borders,” undocumented immigrants are responsible for fentanyl overdoses and a full-blown “invasion” is underway.

The borders are anything but open; the Biden administration is pursuing, arresting and deporting people seeking to come to the United States by the thousands. The vast majority of fentanyl that comes in is smuggled through ports of entry in cars, boats and planes, not carried by undocumented immigrants. And as for an “invasion,” that’s no more true now than it was when Trump warned that caravans were about to overrun the country.

But the Republican ads portray horror and chaos — usually with a non-White face. Some ads show pictures of young Black men walking through rivers on their way to “invade” America, with language suggesting this “invasion” brings “terrorists, drugs and crime.”

Other ads say the Biden administration is supposedly “importing 20 million illegals and giving them amnesty” (the image for that one is people in Haiti), which can only be stopped by “a declaration of invasion.”

In some ads it’s not just an open border but a “wide open border” — once again, illustrated with pictures of Haitians. In others we’re told that “human, sex and drug trafficking are out of control because of Democrat governance,” while Democratic candidates “refuse to oppose Biden’s open border policy.”

Of course, there is no open border policy, but why should the fact that it doesn’t exist stop Democrats from opposing it? That just shows how sinister they are, these ads say, because they “want to destroy this country.”

All of this captures something essential about this political moment. For months, Republicans were certain they could spread fears of chaos in order to ride to victory in the midterms. They’d run on crime and immigration, not just to excite the base but also to scare unsettled swing voters.

Yet the dynamic unexpectedly shifted, and now disorder and, dare we say it, crime — as in the potential crimes of Donald Trump and many Jan. 6 defendants — are not necessarily playing in the GOP’s favor. The overturning of Roe v. Wade has unleashed another form of chaos and a host of new dangers threatening women. And all of these things are energizing Democrats.

“Republicans are indulging in the worst kind of White nationalist rhetoric,” Frank Sharry, the executive director of America’s Voice, told us. “And an issue they thought would win over swing voters is at best a base mobilizer for voters they already have.”

What makes this all really ugly, however, is that the messaging remaining under the radar — which Democrats bear some blame for, having gone quiet on the issue — allows it to continue mostly unexamined. This, even though its worst incarnations — such as “great replacement theory” — have inspired recent mass shootings.

Along these lines, it’s worth keeping an eye on Blake Masters, the GOP Senate candidate in Arizona. He has trafficked heavily in great replacement theory and has run truly vile ads on immigration, including one that features machine-gun fire at the border. Yet in a place President Biden won by a whisker that’s also a border state, Masters is trailing by a meaningful margin.

As Sharry told us, Masters’s whole “declare an invasion” line “is not working, in a state where one-third of the voters are independents and border security is a top issue.”

Yet whether it works with independents and swing voters, this foul sewage has been flowing unabated. And it will surely continue to do so.

The idea that individuals seeking to find a U.S. official who will listen to their asylum cases would be trucking along large amounts of fentanyl in their backpacks is facially absurd.

Ending scofflaw Trump failures to follow asylum and refugee laws at the border and beyond would not halt all illegal entries. No policy will do that, nor has there ever been one that even came close, although illegal incursions have risen and fallen over the years.

But, fair refugee and asylum programs that actually interpreted the applicable domestic and international laws correctly (instead of the “any reason to deny, no matter how wrong attitude” still widespread and tolerated at both Mayorkas’s DHS and Garland’s DOJ) and generously granted protection as was the intention behind the UN Refugee Convention in the first place would certainly encourage large segments of those now forced to irregularly cross the border instead to apply abroad or at legal ports of entry. 

It would also facilitate the USG working with NGOs, the UNHCR, states, and localities to get individuals needed assistance so that their legal claims could be processed in a fair, efficient, and timely manner. The latter objectives seem to have totally eluded both Mayorkas and particularly Garland. They continue to “blow off the experts” and flounder with mindless, “designed to fail,” “deterrence-focused” gimmicks. Talk about a lose-lose!

Also to state the obvious, if CBP were less focused on apprehending individuals who pose no real threat to the U.S., but merely want a fair shot at applying for legal protection — something our laws require that Trump annihilated, the Federal Courts have flubbed,  and Biden has done a substandard job of re-instituting — they would have time to focus more resources on drug and human smugglers. 

Instead, in perhaps one of the dumbest and most wasteful juxtapositions in recent American history, the CBP focus is on “apprehending” (a term I use lightly, since many individuals “want” to be “found,” so they can get access to the system otherwise improperly denied to them by CBP) those  merely seeking to comply with the law! To do that, CBP ignores or misses many of those who actually pose threats. At the same time, both DHS and DOJ use methods, attitudes, and legal interpretations that themselves undermine fundamental fairness, the rule of law, and humanity itself.

Immigrants are America’s past, present, and future! Indeed, climate change, rising oceans, drought, starvation, transportation improvements, globalized commerce, wars, religious bigotry, pandemics, and other factors beyond the control of any one government will continue to drive worldwide migration. 

Building walls, prisons, hate, resentment, and constructing bogus “invasion myths” will not change the reality of human migration and the necessity to adopt to and harness it in a smart, humane, realistic manner. Doing the opposite, will only diminish us as a nation and inhibit our own chances for future prosperity. But, in the end, it won’t stop human migration.

Sometimes we write a lot of words on Steady. Today will be an exception. Because for all that there is to say, for all that needs to be said, for all that an accounting for history requires we say, the general sentiments are quite simple:

They knew. They all knew.

It was clear to anyone who had an ounce of appreciation for what the job of the presidency entails, to anyone who respected the constitutional order of our government, to anyone who worried about the health and safety of this nation, to anyone with a moral compass, to anyone who prizes the common sense of purpose that great leaders can summon, that Donald J. Trump had no business anywhere near the presidency.

Now, as he melts down in the face of a serious criminal investigation, as we see pictures of how he stored classified material and his utter disregard for our nation’s most sensitive secrets, as we are left to wonder what he was up to and what damage was done, we should recognize that we would not be where we are today without his enablers, apologists, and hangers-on.

They heralded his outrageousness in a chorus of sycophancy.
They feted his vileness.
They viciously attacked those who pointed out the obvious, that Trump was mentally, emotionally, intellectually, morally, and constitutionally unfit for his office.

And who are they? They are the Republican politicians, the so-called serious ones who expressed their concerns in private even as they used Trump to achieve their desired tax cuts and judges. They are the members of his administration — senior and junior — who jockeyed to maximize their career benefit at the expense of doing the necessary work for the American people. They are the lawyers who twisted themselves into pretzels to try to legalize his inherent lawlessness. They are the media personalities who saw Trump as a printing press for their accrual of wealth and power. They are the capitalists who put corporate earnings ahead of the well-being of the nation.

While Trump’s voters were primed with a toxic stew of hatred, bigotry, and divisiveness, the small cabal playing the inside game didn’t bother with the MAGA hats. They were too busy trading access for favors. The naked self-interest was so rampant that Trump’s West Wing could be considered a nudist colony where decency was shed instead of clothing.

But make no mistake…

In their cowardice, they knew.
In their cynicism, they knew.
In their contempt, they knew.
In their rationalizations, they knew.
In their acquittals of his conduct, even for impeachment, they knew.

They knew when they could have stopped him — before he became president, and once he was president.

But they didn’t stop him. And with their inaction, they encouraged him.

As the Trump bubble begins to pop, all these people who knew what he was all along will likely scurry like cockroaches when the lights go on. They will make all sorts of excuses for their complicity. They will gaslight, lie, and try to rewrite history. You can already see it in many of their so-called tell-all books. Except what they are telling is only the story they want people to hear. It is not the truth.

The truth is that they don’t dare say what we all know. They knew.

As MAGA thugs are wont to do, their reaction to the lawful search at former president Donald Trump’s Mar-a-Lago home, which we now know might have been related to nuclear secrets (which Trump has denied), amounted to an stream of insults and threats designed to whip up unhinged, violent characters.

While the exact motives of the person who attacked FBI offices in Cincinnati on Thursday remain unknown, reports indicate he was in D.C. in the days leading up the Jan. 6 insurrection and might have been at the U.S. Capitol that day. The GOP’s cycle of incitement and violence continues.

FBI Director Christopher A. Wray was properly outraged. “Unfounded attacks on the integrity of the FBI erode respect for the rule of law and are a grave disservice to the men and women who sacrifice so much to protect others,” he said in a written statement on Thursday. “Violence and threats against law enforcement, including the FBI, are dangerous and should be deeply concerning to all Americans. Every day I see the men and women of the FBI doing their jobs professionally and with rigor, objectivity, and a fierce commitment to our mission of protecting the American people and upholding the Constitution. I am proud to serve alongside them.”

Al Otro Lado v. Mayorkas

U.S. District Judge Cynthia Bashant minces no words in blasting both the unlawful, cruel, and unconstitutional policy and the Supreme’s toxic decision to look the other way as immigration enforcement runs roughshod over legal, constitutional, and human rights. 

In its September 2, 2021 decision, this Court held the right to access the U.S. asylum

process conferred vis a vis § 1158(a)(1) applies extraterritorially to noncitizens who are

arriving at Class A POEs along the U.S.-Mexico border, but who are not yet within the

jurisdiction of the United States, and is of a constitutional dimension. (Op. Granting in

Part and Denying in Part Parties’ Cross-Mots. for Summ. J. (“MSJ Opinion”), ECF No.

742.) It further held that Defendants’ systematic turnbacks of asylum seekers arriving at

Class A POEs (the “Turnback Policy”) amounted to an unlawful withholding by

immigration officials of their mandatory ministerial “inspection and referral duties”

detailed in 8 U.S.C. § 1225 (“§ 1225”), in violation of the Administrative Procedures Act,

5 U.S.C. § 706(1) et seq., and the Fifth Amendment Due Process Clause. (MSJ Opinion at

33–34, 37–38); see 8 U.S.C. §§ 1225(a)(3) (mapping out immigration officials’ duty to

inspect asylum seekers), 1225(b)(1)(A)(ii) (mapping out immigration officials’ duty to

refer asylum seekers to the U.S-asylum process).

In casting appropriate equitable relief to rectify the irreparable injury Defendants’

unauthorized and constitutionally violative Turnback Policy has inflicted upon members

of the Plaintiff class,2 this Court ordinarily would be guided by the fundamental principle

that an equitable remedy should be commensurate with the violations it is designed to

vindicate. See Columbus Bd. of Educ. v. Penick, 443 U.S. 449, 465 (1979) (“[It is an]

accepted rule that the remedy imposed by a court of equity should be commensurate with

the violation ascertained.”). Equitable relief should leave no stone unturned: it should

correct entirely the violations it is aimed at vindicating. That cornerstone of Article III

courts’ equitable powers generally is unfaltering, whether the party against whom an

injunction is sought is a private entity, a state actor, or, as here, a federal official. Thus, in

2 Plaintiffs consist of the named Plaintiffs listed in the case caption, along with a certified class

consisting of “all noncitizens who seek or will seek to access the U.S. asylum process by presenting

themselves at a Class A [POE] on the U.S.-Mexico border, and were or will be denied access to the U.S.

asylum process by or at the instruction of [Customs and Border Protection] officials on or after January 1,

2016.” (Class Certification Order at 18, ECF No. 513.) The Court also certified a subclass consisting of

“all noncitizens who were or will be denied access to the U.S. asylum process at a Class A POE on the

U.S.-Mexico border as a result of Defendants’ metering policy on or after January 1, 2016.” (Id.)

the ordinary course of things, this Court would not hesitate to issue broad, programmatic

relief enjoining Defendants from now, or in the future, turning back asylum seekers in the

process of arriving at Class A POEs, absent a valid statutory basis for doing so.

Yet the circumstances with which this Court is presented are not ordinary because

of the extraordinary, intervening decision of the United States Supreme Court in Garland

v. Aleman Gonzalez, 142 S. Ct. 2057 (2022). That decision takes a sledgehammer to the

premise that immigration enforcement agencies are bound to implement their mandatory

ministerial duties prescribed by Congress, including their obligation to inspect and refer

arriving noncitizens for asylum, and that, when immigration enforcement agencies deviate

from those duties, lower courts have authority to issue equitable relief to enjoin the

resulting violations. It does so through unprecedented expansion of a provision of the

Illegal Immigration Reform and Immigrant Responsibility Act of 1989 (“IIRIRA”), 8

U.S.C. § 1252(f)(1) et seq. (“§ 1252(f)(1)”), which for years the Ninth Circuit has

interpreted as placing a relatively narrow limit on injunctive relief. In essence, Aleman

Gonzalez holds that § 1252(f)(1) prohibits lower courts from issuing class-wide injunctions

that “require officials to take actions that (in the Government’s view) are not required” by

certain removal statutes, including § 1225, or “to refrain from actions that (again in the

Government’s view) are allowed” by those same provisions. Id., 142 S. Ct. at 2065.

Federal courts (except for the Supreme Court) now may only issue injunctions enjoining

federal officials’ unauthorized implementation of the removal statutes in the individual

cases of noncitizens against whom removal proceedings have been initiated. See id.

In no uncertain terms, the logical extension of Aleman Gonzalez appears to bestow

immigration enforcement agencies carte blanche to implement immigration enforcement

policies that clearly are unauthorized by the statutes under which they operate because the

Government need only claim authority to implement to immunize itself from the federal

judiciary’s oversight.

With acknowledgment that its decision will further contribute to the human suffering

of asylum seekers enduring squalid and dangerous conditions in Mexican border

communities as they await entry to POEs, this Court finds the shadow of Aleman Gonzalez

inescapable in this case. Even the most narrow, meaningful equitable relief would have

the effect of interfering with the “operation” of § 1225, as that term is construed by the

Aleman Gonzalez Court, and, thus, would clash with § 1252(f)(1)’s remedy bar. Aleman

Gonzalez not only renders uneconomical vindication of Plaintiff class members’

statutorily- and constitutionally-protected right to apply for asylum, those inefficiencies

inevitably will lead to innumerable instances in which Plaintiff class members will be

unable to vindicate their rights at all. Thus, while the majority and dissent in Aleman

Gonzalez hash out their textual disagreements concerning § 1252(f)(1)’s scope in terms of

remedies, make no mistake, Aleman Gonzalez leaves largely unrestrained immigration

enforcement agencies to rapaciously scale back rights. See Tracy A. Thomas, Ubi Jus, Ibi

Remedium: The Fundamental Right to a Remedy Under Due Process, 41 San Diego L.

Rev. 1633, 1634 (2004) (“Disputes over remedies provide a convenient way for dissenters

to resist conformance to legal guarantees. Courts can declare rights, but then default in the

remedy to avoid a politically unpopular result.” (footnote omitted)).

Although it is no substitute for a permanent injunction, class-wide declaratory relief

is both available and warranted here. In lieu of even a circumscribed injunction enjoining

Defendants from again implementing a policy under which they turn back asylum seekers

presenting themselves at POEs along the U.S.-Mexico border, the Court enters a

declaration in accordance with its MSJ Opinion that turning back asylum seekers

constitutes both an unlawful withholding of Defendants’ mandatory ministerial inspection

and referral duties under § 1158 and § 1225 in violation of both the APA and the Fifth

Amendment Due Process Clause. The Court also issues relief as necessary to named

Plaintiff Beatrice Doe.

Meanwhile, Secretary Mayorkas exercised the authority recognized by the Supremes in Biden v. Texas to terminate the reprehensible and illegal “Remain in Mexico” (a/k/a “Let ‘Em Die in Mexico”) program engineered by Trump and Miller. Predictably, the same scofflaw, restrictionist “Red AG’s” who had instituted frivolous litigation to block this long overdue action filed more specious objections with the Trump-appointed US District Judge, as advocacy groups like Justice Action Center (“JAC”) pledged to fight the racist right until this vile (and highly ineffective) program is finally ended.

WASHINGTON, D.C. — In a victory for immigrants’ rights movement, the Remain in Mexico program has been officially terminated after court proceedings following the Supreme Court’s ruling in Biden v. Texas on June 30. Below is a statement from Justice Action Center founder and director Karen Tumlin:

“The official end to shameful Remain in Mexico program is a victory for the immigrants’ rights movement and the right to asylum. RMX is a stain on the country’s history, having harmed tens of thousands of people fleeing for their lives since the Trump Administration instituted the unlawful and immoral program in 2019.

“Since the Supreme Court’s ruling affirming the authority of the Biden Administration to end the RMX program, the #SafeNotStranded campaign has called on the President and DHS to implement a swift and humane wind-down, including halting all new enrollments and allowing everyone in RMX to safely pursue their asylum claims in the U.S. Yesterday, DHS stated its wind-down has begun and new people will not be enrolled in the program, and that it would disenroll individuals with upcoming RMX hearings. These are important first steps to finally redress just some of the immense harm inflicted by the program.

“This commitment by DHS, following such a significant SCOTUS victory, illustrates the strength and resilience of the immigrants’ rights movement. But even after a clear loss, Texas is continuing its hateful attempts to keep this deadly program in place for as long as possible: After the District Court rightfully vacated its injunction of the RMX wind-down yesterday, Texas unfortunately—yet unsurprisingly—filed an amended complaint challenging the second DHS memo rescinding RMX, as well as a motion asking the District Court to stay the memo’s effective date.

“But we will not be deterred: advocates will continue to fight back against ongoing red state efforts to continue Trump’s racist and xenophobic agenda and work towards a world where all people fleeing danger can be safe, not stranded.”

Chief Immigration Judge Email: Taking Cases Off Calendar: Cases may be selected to be taken off the court’s calendar for the following reason(s)…

 

EOIR Schedule: EOIR immigration judges are scheduled for a mandatory training session on Aug. 22, 2022, from 1pm to 5pm EST. The Chicago Immigration Court will re-set all non-detained cases scheduled for that afternoon; detained cases will go forward. It is unclear at this time if/how this affects other courts.

The Officer of the Future: Facial Recognition and the Border-Industrial Complex

Border Chron: Facial recognition has become the primary biometric technology for CBP. Everyone who enters the country has their picture taken, though supposedly people can opt out (that often isn’t obvious, thanks to a lack of signage; I cross the border constantly and have never seen anything about opting out). The surveillance technology has also been deployed at 32 airports for people exiting the country. CBP partners with airports and airlines to add another layer to this private-public nexus.

 

Fact Check: Immigrants are not getting Social Security numbers at the U.S. border

AP: Lara Logan, a former Fox Nation host, recently claimed that U.S. Border Patrol agents are distributing Social Security numbers to immigrants at the border. A video of her comments has circulated widely across social media platforms… No such thing is happening, Rhonda Lawson, a spokesperson for the U.S. Customs and Border Protection, told the AP in an email.

 

NYC Attorney Carlos Moreno Imprisoned For Immigration Fraud

NYCaribNews: Between September 2017 – when Moreno was suspended from the bar – and late September 2018, Moreno took on new clients, practiced law, and gave legal advice to scores of undocumented immigrants. In some instances, even predating his suspension, Moreno defrauded clients by falsely claiming that undocumented immigrants who have resided in the United States for over a decade could secure legal status, a fraud known as the “10-Year Green Card Scam.”

 

DHS Watchdog Reports Understaffing At Afghan ‘Safe Havens’

Law360: The Ninth Circuit ruled that federal funds for criminal justice programs can’t be withheld from states and counties that don’t enforce immigration laws, upholding lower court decisions that found the denial an overreach of the U.S. Department of Justice’s authority.

 

11th Circ. OKs Deportation Of Chilean Convicted Of ‘Whatever’

Law360: A California federal judge ordered the Biden administration to revisit the tens of thousands of visa applications that were denied under Trump-era travel restrictions, finding that targeted foreigners were still bruised from the travel ban, long after its revocation.

EOIR Warns of Scammers Spoofing Agency Phone Number

EOIR: The Executive Office for Immigration Review (EOIR) today announced it has recently been notified of phone calls that spoof the Arlington Immigration Court as part of a misinformation campaign. The callers will often “spoof,” or fake, the immigration court’s main line, 703-305-1300, so the calls appear to be coming from EOIR on the recipient’s caller ID.

Much has been made of the ensuing polarization in our politics, and it’s true that moderates are a vanishing breed. But the problem isn’t primarily polarization. The problem is that one of our two major political parties has ceased good-faith participation in the democratic process. Of course, there are instances of violence, disinformation, racism and corruption among Democrats and the political left, but the scale isn’t at all comparable. Only one party fomented a bloody insurrection and even after that voted in large numbers (139 House Republicans, a two-thirds majority) to overturn the will of the voters in the 2020 election. Only one party promotes a web of conspiracy theories in place of facts. Only one party is trying to restrict voting and discredit elections. Only one party is stoking fear of minorities and immigrants.

Admittedly, I’m partisan — not for Democrats but for democrats. Republicans have become an authoritarian faction fighting democracy — and there’s a perfectly logical reason for this: Democracy is working against Republicans. In the eight presidential contests since 1988, the GOP candidate has won a majority of the popular vote only once, in 2004. As the United States approaches majority-minority status (the White population, 76 percent of the country in 1990, is now 58 percent and will drop below 50 percent around 2045), Republicans have become the voice of White people, particularly those without college degrees, who fear the loss of their way of life in a multicultural America. White grievance and White fear drive Republican identity more than any other factor — and in turn drive the tribalism and dysfunction in the U.S. political system.

Other factors sped the party’s turn toward nihilism: Concurrent with the rise of Gingrich was the ascent of conservative talk radio, followed by the triumph of Fox News, followed by the advent of social media. Combined, they created a media environment that allows Republican politicians and their voters to seal themselves in an echo chamber of “alternative facts.” Globally, south-to-north migration has ignited nationalist movements around the world and created a new era of autocrats. The disappearance of the Greatest Generation, tempered by war, brought to power a new generation of culture warriors.

But the biggest cause is race. The parties re-sorted themselves after the epochal changes of the 1960s, which expanded civil rights, voting rights and immigration. Richard Nixon’s “Southern Strategy” began an appeal to White voters alienated by racial progress, and, in the years that followed, a new generation of Republicans took that racist undertone and made it the melody.

It is crucial to understand that Donald Trump didn’t create this noxious environment. He isn’t some hideous, orange Venus emerging from the half-shell. Rather, he is a brilliant opportunist; he saw the direction the Republican Party was taking and the appetites it was stoking. The onetime pro-choice advocate of universal health care reinvented himself to give Republicans what they wanted. Because Trump is merely a reflection of the sickness in the GOP, the problem won’t go away when he does.

Between 2015 and 2020, about fifty bodies were recovered each year in Brooks County, according to an S.T.H.R.C. report. Then came Title 42, a policy enacted by the Trump Administration at the start of the COVID-19 pandemic that closed ports of entry and blocked most avenues for asylum claims, ostensibly for public-health reasons. The policy, which is still in place in a modified form, has increased business for smuggling cartels and spurred people to cross in more dangerous places. “Before Title 42, the calls we got used to be, like, eighty-per-cent apprehended, twenty-per-cent missing,” Canales said. “Now it’s flipped—it’s more like twenty-per-cent apprehended, eighty-per-cent missing.” So far this year, there have been nearly seventy recoveries of remains in Brooks County, putting 2022 on track to be the deadliest year on record.

So, before the Trump Administration’s bogus, racist “invocation” of Title 42, 80% of migrants came to the border or were easily apprehended close thereto — most probably because they turned themselves in to seek asylum through the legal system. And, lets not forget, this was with an already badly broken, fundamentally unfair, asylum legal adjudication system intentionally biased and “loaded” against legitimate refugees seeking protection!

Smart, honest public policy would have improved asylum adjudication at USCIS and at EOIR to quickly recognize and grant, with the assistance of NGOs and legal assistance groups, the many cases of legitimate refugees so that they could take their rightful, legal places in our society.

Additionally, by taking refugees seeking legal determinations “out of the equation,” enforcement against those seeking to evade legal processing — certainly a much, much smaller “universe” than is “out there now” — would have been enhanced. Business would have declined for smugglers, as those seeking protection would have been motivated to use a humane, fair, functioning legal system rather than being forced into “do it yourself” refuge!

You don’t have a genius to figure this out — just not be motivated solely by racism like Stephen Miller and his Trump regime cronies! Better qualified — non-Jim Crow righty — Federal Judges would also produce more humane, honest, and rational results.

Additionally, by running a legitimate asylum system, and complementing it with an honest, robust, legal refugee system for Latin America, the Caribbean, and Africa, we would finally have sound data on how many of those seeking to enter at the Southern Border are entitled to immigrate as legal refugees and how many are non-refugees. That’s something on which we now have no reliable information  — just myths and anecdotes, many provided by racist restrictionists and nativists with neither expertise in asylum law nor any real interest in the rule of law at the border.

As a result of Title 42, and the unqualified “Jim Crow” Federal Judges, GOP nativist AGs, and their apologists (including some in the media who repeat or republish, without critical examination, GOP racist lies about the border), we now have a deadlier than ever border; the legal immigration system at the border has been functionally abolished and replaced with an underground, extralegal system; the U.S. Government has ceded control of border migration policy to cartels and smugglers; and the job of the Border Patrol — forced to spend time apprehending legal refugees who seek only the protection to which they are legally entitled — has become impossible.

That’s what happens when we let GOP nativist pols, overt racists, and bad, right wing Federal Judges take over the immigration policies that were actually enacted by Congress — a key part of which are legitimate refugee and asylum systems and a fair, functioning, expert Immigration Court. Right now, we have NONE of the foregoing. And, innocent migrants at the border are too often paying the price — with their lives!

“Enforcing the law” does NOT mean unfairly, unwisely, and illegally abrogating the legal asylum system and fair adjudications in Immigration Court at the border. It means fixing the legal asylum system including USCIS Asylum Offices. Perhaps most of all, it means reforming and replacing where necessary the broken, dysfunctional, leaderless, and non-expert Immigration Courts and a BIA that continues to misinterpret asylum and protection laws on a daily basis. We need a BIA of real judges with the expertise and guts to establish fair, humane, correct, positive precedents and to rein in or remove from asylum cases those Immigration Judges who are “programmed to reject, not protect!”

I, along with many others, watched the Brittney Griner travesty unfold. I saw the irony. President Biden was rightfully blasting the outrageous “kangaroo court” show trial that passes for justice in Russia. But, at the same time, he, Harris, and Garland are basically running a farcical “Russian style” dysfunctional immigrant “justice” system at EOIR and calling it a “court!”

Perhaps, in addition to blasting the Griner farce, President Biden, VP Harris, and AG Garland need to take a closer look at the “Russian-style” justice being inflicted on migrants in their wholly-owned Immigration “Courts”  — which particularly target women, children, and migrants of color seeking justice under US laws. Indeed, many are still being arbitrarily returned without ANY process at all! Others get “off the wall” denials of their valid claims. Its this REALLY any way for a self-proclaimed “nation of laws” to operate?

Sorto-Guzman is a life-long Catholic who regularly attended Catholic services in El Salvador. In December 2015, about five members of the Mara 18 gang accosted Sorto- Guzman in the street as she was leaving church. At the time, she was wearing a crucifix medallion around her neck. The gang members tore the chain from her neck, hit and kicked her, and threatened to kill her if she ever wore it or attended church again. Sorto-Guzman stopped attending church after the attack, fearing the gang and their threats.
A few weeks later in January 2016, a group of Mara 18 gang members—including some of the gang members from the December 2015 assault—stopped Sorto-Guzman, along with her sister and Rivas-Sorto, as she was coming home from a shopping trip. One of the men attempted to sexually assault Sorto-Guzman and had started to forcefully kiss her. He only stopped when her screams caught the attention of a neighbor. The gang members threatened to kill Sorto-Guzman and Rivas-Sorto if Sorto-Guzman did not join the gang and start living with them.

On February 13, 2016, some of the gang members from the prior incidents tracked where Sorto-Guzman lived and broke into her house carrying guns. The gang members viciously beat Sorto-Guzman, threatened her life, and robbed her. Sorto-Guzman’s neighbors called the police, but they did not come until several hours after the assault. Sorto-Guzman reported the assault and robbery to the officers who arrived at the scene. She also went to the local police station the next day to report the attack. The police made one attempt to investigate, but Petitioners were not home when the police arrived, and the officers never followed up. The day after, a gang member called Sorto-Guzman, warning her she would regret making the report to the police and that they would soon kill her, her son, and her sister.

Absurdly, an Immigration Judge found that this gross abuse and death threats by a gang with the ability and willingness to carry them out did not amount to “persecution.” Worse yet, on appeal, rather than reversing and directing the judge below to follow the law, the BIA agreed — invoking the outlandish “theory” that the death threats, on top of the savage beating, weren’t so bad because they had never come to “fruition.” In other words, the applicant hadn’t hung around to be killed. Then, to top it off, attorneys from the DOJ’s Office of Immigration Litigation (“OIL”) unethically defended this deadly nonsense before the Fourth Circuit! This is “justice” in Garland’s disgraceful, deadly, and dysfunctional “court” system!

EOIR’s performance is this case, particularly the BIA’s absurdist conclusion that, essentially, death threats must result in death to constitute past persecution, is a contemptuous disregard for binding circuit precedent, a demonstration of gross anti-asylum bias, misogyny, and a clear example of judicial incompetence.

Would a heart transplant surgeon who “forgot” to install a new heart or neglected to sew up the patient’s chest be allowed to continue operating? Of course not! So, why is the BIA still allowed to botch life or death cases — the equivalent of open heart surgery?

If Garland allows his “delegees” to perform in this dangerous and unprofessional manner, in his name, what is he doing as Attorney General? This is a farce, not a “court system?” Those responsible need to be held accountable! And, OIL’s unethical defense of this deadly nonsense is indefensible!

In 2015, a Ghanaian man who goes by the initials M.A. and his gay friend were brutally assaulted by a vigilante group in Accra, Ghana. In Ghana, homosexuality is illegal and carries a prison sentence of up to three years. M.A. was beaten with sticks before escaping through a window. His friend was killed. Fearing the group would find and kill him, he fled to Ecuador and made his way to the U.S. border, where he requested asylum. After being detained for nine months, he was released on bond and lived with a childhood friend in New York while he waited for his case to make it through the legal system.

M.A. clearly faced persecution, but an immigration judge denied his claim. I took M.A.’s appeal to the Board of Immigration Appeals in 2016 as part of the Cornell Law School’s asylum appeals clinic. It took M.A. four years to win asylum in America, but at least he was given the chance to apply in the first place.

Since March 2020, approximately 900,000 people — including over 215,000 parents and children — have been denied the ability to request asylum at all. They’re casualties of Title 42, a pandemic-related policy that paused nearly all asylum proceedings at the border. Some people argue the policy is preventing an influx of migrants. In fact, numbers are up despite the policy, and our refusal to process most of them has led to chaotic and dangerous conditions.

The United States has successfully managed ebbs and flows of asylum seekers for decades. There’s a system in place to manage an influx — and regardless of how hard immigration lawyers like me fight for them to stay, many will lose their case and be deported. Even so, we must let people try. It’s not only the right thing to do, it’s also guaranteed under international and domestic law. We signed a 1967 protocol to the U.N. Refugee Convention to protect the rights of refugees, and we have adopted it and codified it into U.S. asylum law. Right now, we’re violating those obligations. The longer we do, the weaker American rule of law looks to our global partners.

We must immediately reinstate due process for asylum seekers. And once this happens, we must work to make the system more equitable and faster.

I agree that “we must work to make the system more equitable and faster.” But, the answer can’t be just to hire more Immigration Judges in Garland’s dysfunctional, broken, and anti-asylum-biased “court” system. That would just speed the “deportation assembly line” and lead to even more injustice and grotesque inconsistencies. 

According to TRAC, Immigration Judge “asylum denial rates” currently “range” from 5% to 100%. That’s a ridiculous, indefensible variation and a total perversion of the generous standard for granting asylum set forth by the Supremes in Cardoza-Fonseca and adopted by the BIA in Matter of Mogharrabi, but seldom enforced or followed, particularly these days.  Why this very obvious, totally solvable problem is still festering going on two years into a Democratic Administration that pledged to solve it is beyond me! 

Enough of this nonsense, biased, “amateur night at the Bijou” mal-administration of the Immigration Courts at EOIR by Garland’s DOJ! No wonder folks are still complaining about “Refugee Roulette” more than a decade after it was written by my Georgetown Law colleagues Professors Phil Schrag, Andy Schoenholtz, and Jaya Ramji-Nogales (now an Associate Dean at Temple Law). Why not put one of THEM, or for that matter, Professor Yale-Loehr, in charge of kicking tail and cleaning out the deadwood at EOIR?

At a minimum Garland must:

  • Remove the holdover “Asylum Deniers Club” from the BIA and replace them with a real judge as Chair and new Appellate Immigration Judges who are widely recognized as “practical experts” with careers that have demonstrated superior scholarship in immigraton and human rights, an unswerving commitment to due process for individuals, and a passion for racial justice in our legal system; 
  • Have the “New BIA” issue useful precedential guidance on how to document and grant valid asylum cases at both the Asylum Office and the Immigration Court, implement best practices, and identify and remove from future asylum adjudication those unqualified Immigration Judges who basically “make up” reasons to deny and can’t or won’t treat applicants fairly; and
  • Immediately replace with qualified expert judges those Immigration Judges on the “Southern Border docket” who can’t fairly adjudicate asylum cases.

Steve is totally correct about the need for Title 42 to go! But, Garland’s EOIR, particularly the BIA, is just as broken, counterproductive, and out of control as Title 42! In many ways, the illegal abrogation of the rule of law at the Southern Border has somewhat ”hidden” the larger problem that a dysfunctional and incapable EOIR poses for those who do manage to get a hearing!

Without a legitimate, totally reformed and significantly “re-populated” EOIR operating at the “retail level” of our justice system, there will be no rule of law and equal justice under law in America — for anyone!

Tell Garland you have had enough! The deadly and disorderly “EOIR Clown Show” has got to go! Now!

Through our reporting, we exclusively learned that U.S. Customs and Border Protection quietly changed last year how they count deaths on the border to only include deaths in custody, during arrests or when agents were nearby and there were 151 such “CBP-related” deaths in the 2021 fiscal year.
