It wasn’t supposed to end this way for Kevin McCarthy. After all, he had done nearly everything that the far-right faction of his caucus wanted, given in to their every demand. Why ever would that fail to satisfy them? But in the end, his actions recalled the parable of the scorpion and the frog. As Fortune magazine retold it,

A scorpion asks a frog to carry him over a river. The frog is afraid of being stung, but the scorpion argues that if it did so, both would sink and the scorpion would drown. The frog then agrees, but midway across the river the scorpion does indeed sting the frog, dooming them both. When asked why, the scorpion points out that this is its nature.

It is the nature of nihilistic, burn-it-to-the-ground extremists to destroy everything around them, including the very party that once carried them to victory. McCarthy’s mistake was thinking he could ever change that by actually inviting the crazies in and embracing them even closer. Instead, he became the first ever speaker in the 240-year history of the House of Representatives to be ousted. In a period of historic firsts—first president impeached twice, first president to be indicted (and charged 91 times), and now first successful motion to vacate the chair—the GOP seems determined to outdo itself.

As writer Charlotte Clymer colorfully put it, “McCarthy served 270 days, the equivalent of 27 scaramuccis or 0.093 of a pelosi, after giving away his power—and his dignity—to man-toddlers who eventually stabbed him in the back.”

Let’s look at what happened yesterday and then answer some common questions about where things go from here in the GOP’s fractured majority in the House.

Mean Girls Day

October 3rd is a day that sticks in my mind because of my favorite movie, Mean Girls, which is turning out to carry many lessons for the GOP. The Lincoln Project was out with a meme quickly.

“On October 3rd, he asked me what day it was!” exclaims Cady Heron of the dreamy Aaron Samuels.

“It’s Kevin McCarthy’s last day as Speaker,” Cady responds.

Indeed, it was.

After Rep. Matt Gaetz (R-FL) made good on his promise to file a motion to vacate the chair, McCarthy pressed for quick consideration of the motion, rebuffing calls to wait until Thursday when more members were back in Washington. He apparently had hoped to catch a number of Democratic House members away. Nancy Pelosi missed the votes, for example, because she was attending the funeral of her longtime friend, the late Sen. Dianne Feinstein.

No matter. After first losing a procedural vote to table the motion, with 11 Republicans voting “no” along with all the Democrats present, Kevin McCarthy faced a full vote of the House and was removed by a vote of 216 to 210, with eight GOP members joining all of the Democrats. Even Gretchen Wieners—er, I mean, Nancy Mace (R-SC)—who styles herself as a moderate, was a yea on the motion. Et tu, Nancy?

It bears noting that the Democrats had met as a group earlier that day and emerged with a consensus that they would not be helping McCarthy out. There was simply too much bad blood, from his kissing Trump’s ring two weeks after condemning him for January 6; to his reneging on the budget deal struck in May; to his launch of an impeachment inquiry against Joe Biden based on nothing but speculation; to his blaming the Democrats for the near shutdown of the government, when it was Democrats who had kept it open. They simply did not trust him and saw no reason to throw him a lifeline. In fact, he never even asked for help from them directly, though his minions reportedly made a series of calls begging moderate Democrats to save him.

After the vote, several members of the House Republican caucus gathered in a group to pray on the House floor, while Rep. Ann Wagner (R-MO), wept openly. It was quite a fall for Rep. Wagner, who had triumphantly spearheaded two anti-abortion measures earlier in the year with Speaker McCarthy’s blessing.

McCarthy’s loss of the speakership leaves the GOP caucus effectively without leadership, at a time when appropriations remain largely unfinished.

The Speaker pro tempore

The gavel is currently in the hands of a caretaker Speaker pro tempore, Patrick T. McHenry (R-NC), who gaveled out the evening with such ferocity that he damn near cracked the thing. It’s a good thing men aren’t emotional in politics.

McHenry is supposed to hold the position only so long as it takes to elect a new speaker, and to wield the gavel only for purposes of getting this done. But he couldn’t help but act like yet another petulant man-baby, ordering Speaker Emeritus Nancy Pelosi to clear out her office in the Capitol building and relocate to the Cannon Building. Pelosi issued a response:

With all of the important decisions that the new Republican Leadership must address, which we are all eagerly awaiting, one of the first actions taken by the new Speaker Pro Tempore was to order me to immediately vacate my office in the Capitol. Sadly, because I am in California to mourn the loss of and pay tribute to my dear friend Dianne Feinstein, I am unable to retrieve my belongings at this time.

Petty moves aside, McHenry won’t have any real power to push legislation through, and few even inside the GOP would likely stand for him seeking to assert himself in any way except as a momentary caretaker.

So what happens next?

With McCarthy out, the GOP is back to where it was in January, without the numbers to put someone over the top. One key piece of news that already broke: McCarthy won’t be running for the job again.

That leaves a number of possible replacements. The No. 2 in the House is Rep. Steve Scalise (R-LA), who is well liked but faces health challenges, as he is currently undergoing treatment for blood cancer. Other names that have bubbled up include Rep. Jim Jordan (R-OH), Elise Stefanik (R-NY) and the No. 3 guy in charge of this mess, Tom Emmer (R-MN).

There is no consensus candidate as of this moment. The House GOP members scattered to their districts on Tuesday night after the debacle, giving a cooling off period before they regroup next week.

Isn’t the devil we know better?

There is considerable and understandable consternation that we might wind up with someone worse than McCarthy, whose feckless cowardice at least led to predictable capitulations and back to the inevitable point of political equilibrium.

But it’s also fair to say that even someone more extreme, like a Jim Jordan, couldn’t actually do anything with this fractured majority beyond what McCarthy already did with it. A House majority without a Senate in concurrence can accomplish little other than hearings and inquiries, which is what the GOP has been up to for months already with nothing to show for it. Handing the keys to the bus to someone else who doesn’t know how to drive isn’t going to keep the party from catastrophe next November.

It also might take some time before they can coalesce around a new leader. Extremists want someone to the right of McCarthy, but moderates might never support such a candidate. And even assuming they did, the party would quickly find itself exactly where it is now: facing a government shutdown while it tries to renege on a deal already agreed to, and up against a Democratically-controlled Senate ready to get on with the business of governing.

The political fallout

The collapse of GOP leadership in the House likely will become a central talking point for Democrats for the 2024 elections. The GOP brand is already badly tarnished by everything from anti-abortion extremism to election denialism to authoritarian suppression.

One thing is clear, however: It was Trump, acting behind the scenes by pressing extremists to hold the line against the budget, who is in large part to blame for the destruction of the House GOP caucus. He won’t take ownership of that, of course, but the amount of damage he has inflicted upon his own party cannot be overstated.

And in a weird twist, some members of the far-right are moving to nominate Donald Trump as Speaker. Rep. Troy Nehls (R-TX) announced late Tuesday he will file paperwork to nominate the former president to be the next Speaker, who in fact doesn’t have to be a member of the body to preside as Speaker. In the past Trump has said he would not be interested in the job, so it’s unclear whether he would take such a nomination seriously. But it does demonstrate how rudderless and leaderless the House GOP caucus is that they once again turn to their Dear Leader to beg him to rescue them. (Trump of course wouldn’t know the first thing about how to act as Speaker, or move legislation through, or count votes, nor would he have time to learn the ropes given his trial schedule. Perhaps they could recruit his son Eric, who at least is foolish enough to accept and might soon have nothing to do because all his businesses have had their certificates to operate in the state canceled.)

That plan might run smack into the GOP’S own House rules, though, which requires leadership to step aside if indicted for a felony with a punishment of more than two years.

Returning to the scorpion and frog fable, and looking back at his tragic and brief tenure, McCarthy’s political death was inevitable. The moment he began to negotiate with the caucus terrorists in order to secure his seat, he sowed the seeds of his ultimate destruction. After all, under the terms of his parole, a single missed frog step could bring down a motion to vacate by a single member. By May, McCarthy had already committed the giant sin of compromising with the Democrats in a near evenly divided government, and a few months later, a single MAGA scorpion planted its stinger right into his back.

**************************

Of course, it’s supreme irony that about the only responsible leadership action McCarthy took during his short tenure as speaker led to his demise at the hands of the GOP anti-American nihilists whom he coddled and ingratiated himself with to get the job in the first place!

At some point, the anti-American GOP voters who put these dangerous, yet cowardly, spineless, and valueless, nut cases into positions of influence have to be held accountable, if only by history! 🏴‍☠️

Our dedicated team, in collaboration with our remarkable San Diego-based partners, is tirelessly working to continue to welcome migrants with dignity. We have welcomed more than 8500 asylum seekers in 13 days.

Scandalously, rather than looking to solve this humanitarian crisis, the GOP seeks to punish victims of Government dereliction of duty and their humanitarian responders for asserting well-established legal rights! Talk about a party of lawlessness! Sadly, it’s no surprise since they owe homage to an insurrectionist “leader” who is a notorious fraudster, con man, and criminal defendant in multiple cases!

While resisting the GOP’s worst racist/nativist nonsense, the Dems’ approach has been largely to avoid talking about immigration and human rights, apparently believing that pretending like they don’t exist will make them go away. But, migration isn’t going away!

While we can to some extent control, channel, and optimize migration, irresponsible “zero tolerance/uber deterrence” policies will do little to stop reality in the long run. It will, however, eventually force more migration underground and cede policy control to smugglers, cartels, and other criminals.

At the same time, obsessing over deterring and deporting those who merely seek refuge and a chance to contribute to America will actually diminish the harder work of focusing on criminals out to turn border disorder and misplaced priorities to their advantage.

Neither party appears to have a realistic plan for the border, and the GOP actively seeks to make things worse! Meanwhile, not for the first time, NGOs, local communities, and compassionate individuals are left to pick up the slack!

Recently, the San Diego County Board showed the potential for bipartisan cooperation on the border.

But, without a more realistic approach from the Feds — currently blocked by the GOP — local efforts are unlikely to succeed. And, that’s an avoidable humanitarian tragedy!

Courtside Exclusive

October 1, 2023

Saturday, at the 12th hour, GOP Speaker Kevin McCarthy (D-CA) finally did the obvious — reached out to Dems to save America from insurrectionist, anti-American GOP extremists by passing a last-minute continuing resolution that will fund American government until Nov. 17.

All Dems except one (who was protesting the GOP’s pro-Putin defunding of Ukraine aid) voted for the House bill, while 90 GOP insurrectionists voted to tank America and manufacture a needless crisis. The bill passed the nominally Dem-controlled Senate in about 30 seconds, and was signed by President Biden before midnight. The message about which party is serious about governing for the common good is obvious to all real patriots, even if a shocking number of GOP voters have foisted these far-right GOP clowns upon the rest of us.

The mainstream media uses the namby-pamby misnomer “border security,” to refer to the GOP’s proposed racist-nativist attack on immigration, destruction of the long-established right to asylum, and bogus attempts to reinstate “proven to fail,” draconian deterrence measures. As happened when tried unsuccessfully in the past, the GOP would turn over control of border migration policies to cartels, smugglers, and organized crime, while deflecting attention and undermining law enforcement efforts to control human and drug smuggling.

A true accounting for the GOP extremist agenda would clearly show how firmly on the side of Putin and border bandits today’s dangerous, “destroy America” GOP has become. Too bad the so-called “mainstream media” has so little interest in digging beyond the cosmetics on the border issues and Ukraine aid.

The mainstream media is also salivating about the bogus prospect of MAGA-maniac Matt Gaetz (R-Outer Space) unseating McCarthy. The fact that Gaetz is an extremist idiot who has nobody to replace McCarthy with doesn’t seem to have dawned on the “mainstreamers.” (“Matt Gaetz’s Motto is, ‘I’m an Asshole, What are You Going to Do About It?’” https://www.google.com/url?sa=t&rct=j&q=&esrc=s&source=web&cd=&ved=2ahUKEwjnkLH8h9WBAxXPkYkEHcr5CdoQFnoECBIQAQ&url=https://buzzflash.com/articles/matt-gaetz&usg=AOvVaw2XoHad3KzJeQitggMsTve3&opi=89978449).

In perhaps the ultimate example of clueless, Fox News inspired, “mainstream journalism,” CBS’s “This Sunday” saw fit to inflict Gaetz and his bombastic nonsense on hapless viewers today. NBC, on the other hand, maybe still smarting from new-host Kristen Welker’s disastrous, totally uncalled for, “inaugural” interview with a raving, incoherent, lie-spouting Trump, gave us wall-to-wall coverage of the Ryder Cup in place of “Meet the Press.” Honestly!

Look forward to more clownish theatrics and anti-American posturing from the GOP and their “Chief Clown” Trump, and more insipid reporting from the mainstreamers as America careens toward another likely GOP-generated “crisis” in mid-November. It’s NOT a “Washington problem! It’s purely a GOP that lacks any interest whatsoever in responsible governing.

“Petitioner Srecko Pesikan argues that the Board of Immigration Appeals (“BIA”) erred in concluding that his 2018 Pennsylvania conviction for driving under the influence (“DUI”) of marijuana constituted an offense involving a “controlled substance,” as defined in the federal Controlled Substances Act (“CSA”), thereby rendering him removable under the Immigration and Nationality Act of 1952, 8 U.S.C. § 1227(a) (“INA”). We agree and will grant his petition for review. … In sum, because the identity of the specific controlled substance is not an element of the Pennsylvania DUI statute, the state statute of conviction is indivisible and cannot serve as the basis for Pesikan’s removal under the INA. … For the foregoing reasons, we will grant Pesikan’s Petition for Review in case number 21-1262 and will reverse the order for removal.”

These are important cases with high stakes! They deserve expert analysis from expert judges.

Eliminating unnecessary Circuit reversals and remands like this would also help address the backlog-building, due-process-denying phenomenon of “Aimless Docket Reshuffling” at EOIR. Avoidable mistakes at the “retail level” are systemically costly to our justice system in more ways than one!

And, remember, that for every EOIR mistake that gets “caught” by the Article IIIs, dozens of these injustices probably go uncorrected! Circuit review is a luxury that isn’t available to most individuals who lose at the BIA level. Even here, Mr. Pesikan would have had no chance at the Circuit except for court-appointed pro bono counsel Stephen A. Fogdall and his team at Dillworth & Paxon, LLP, another luxury unavailable to litigants at the EOIR level.

Moreover, even when Circuit review does take place, the inappropriately deferential standards established by Congress allow (or even require) some Circuit panels to merely sweep glaring injustices under the rug without grappling with the overall constitutional implications of this shoddy, due–process-denying  system. Why on earth would “deference” be given or review restricted over the “gang that can’t shoot straight” at EOIR?”

Gang that couldn't shoot straight
Would you give “deference” to these guys?

Congress and the Article III Courts appear unlikely to face up to the need for constitutionally-required reforms at EOIR in the near future. 🤡🤯AS AMERICA SUFFERS, THE GOP CLOWN SHOW ROLLS ON TOWARD OBLIVION!

Clown Parade
The GOP, in full regalia, heads for the U.S. House. PHOTO: Public Domain

Dana Milbank writes @ WashPost:

https://www.washingtonpost.com/opinions/2023/09/22/gaetz-mccarthy-shutdown-house-gop-deadlock/

Martin Luther nailed his theses to a church door. Matt Gaetz displayed his in the men’s room.

Specifically, the congressman (or somebody) left a draft of his “Motion to Vacate” on a baby changing table in a restroom downstairs from the House chamber, where it was found by journalist Matt Laslo. “H. Res. __,” it began. “Resolved, that the Office of Speaker of the House of Representatives is hereby declared to be vacant.”

But Gaetz (R-Fla.) doesn’t need a resolution to “vacate the chair,” as a motion to remove Kevin McCarthy as speaker iscalled. For all practical purposes, the chair is already vacant.

It should have been obvious to all this week, if it wasn’t already, that McCarthy (R-Calif.) is speaker in name only, as his leaderless Republican caucus stumbles toward a government shutdown. Review some of the labels House Republicans hurled at each other over the last few days:

“Clown show.” “Clowns.” “Foolishness.” “Weak.” “Terribly misguided.” “Selective amnesia.” “Stupidity.” “Failure to lead.” “Lunatics.” “Disgraceful.” “New low.” “Enabling Chairman Xi.” “People that have serious issues.” “Pathetic.”

Amid the epithets, Republicans brought the House to another standstill. For the second time in as many weeks, hard-liners blocked the House from even considering a bill to fund the troops. Two days later, they blocked it for a third time. They also forced party leaders to pull from the floor their plan to avert a shutdown — a plan that would do nothing to avert a shutdown even if it passed.

Walking into yet another grievance-airing session among House Republicans this week in the House basement, first-term Rep. Richard McCormick (Ga.) remarked to a colleague: “I think we should call this the Dance of the Dragons.” That was a “Game of Thrones” reference to a civil war in which (spoiler alert) both of the aspirants to the Targaryen throne died, along with several of their children and most of the dragons. McCormick later developed the metaphor for me: “We have a lot of powerful people in one room who are ferocious,” he explained in part, and “it’s going to get even uglier.”

Remember, folks, the problem here is NOT “Congress,” as the so-called “mainstream media” would have you believe! No, it’s the GOP — the anti-American party of nihilism, insurrection, lies, and extremism! McCarthy COULD have had an agreement in hand long before now. all it would take is picking up the phone and working with Leader Jeffries and the Dems to come up with a reasonable funding proposal that could actually PASS the Senate! Indeed, McCarthy earlier cut such a deal with President Biden until he violated it under pressure from a few right-wing members of the GOP “wrecking crew” in an act of supreme cowardice (a McCarthy specialty) and total failure to pursue the common good.

Notably, when the House had a REAL Leader, Speaker Pelosi, there was no shutdown during the Trump Administration — even though there were plenty of issues (Dreamers being a key one) that some Dems would have liked her to “go to the mat” on. When the chips are down, Dems believe in governing; the GOP believes in destroying!

Upcoming generations who don’t want to live in a country where conspiracy theories, cruelty, misinformation, hatred, intolerance, false grievances, vengeance, dehumanization, greed, self-aggrandizement, racism, anti-semitism, grotesque fiscal and moral irresponsibility, misogyny, incompetence, and just plain stupidity replace democracy  and governing for the common good had better get energized and busy coming up with a strategy to remove GOP members from every elected position from the national level to local animal control officers. Otherwise, the majority of the next generations will face a bleak future in a nation trying to return to a past that never was with faux “leaders” who demonstrably can’t lead, and don’t even make a pretense of trying to do so.

The “forced birth party” shows little, if any, concern for the well-being of humanity once it has exited the womb!

🏴‍☠️ 🤯 ABSURDIST SCOFFLAW TEX “GOV” ABBOTT BLOWN AWAY IN ROUND I OF “BUOY BATTLE!” — Texas Federal Judge Rejects Ludicrous “Invasion Defense!”

Priscilla Alvarez
CNN Digital Expansion 2019, Priscilla Alvarez
Politics Reporter, CNN

Priscilla Alvarez reports for CNN:

https://www.cnn.com/2023/09/06/politics/texas-mexico-border-water-barriers-migrants/index.html

CNN  —

A federal judge ordered Texas to remove floating barriers in the Rio Grande and barred the state from building new or placing additional buoys in the river, according to a Wednesday court filing, marking a victory for the Biden administration.

Judge David Alan Ezra ordered Texas to take down the barriers by September 15 at its own expense.

The border buoys have been a hot button immigration issue since they were deployed in the Rio Grande as part of Gov. Greg Abbott’s border security initiative known as Operation Lone Star. The Justice Department had sued the state of Texas in July claiming that the buoys were installed unlawfully and asking the judge to force the state to remove them.

In the lawsuit, filed in US District Court in the Western District of Texas, the Justice Department alleged that Texas and Abbott violated the Rivers and Harbors Appropriation Act by building a structure in US water without permission from United States Army Corps of Engineers and sought an injunction to bar Texas from building additional barriers in the river. The Republican governor, meanwhile, has argued the buoys are intended to deter migrants from crossing into the state from Mexico.

Texas swiftly appealed the judge’s order.

. . . .

Ezra also found Texas’ self-defense argument – that the barriers have been placed in the face of invasion – “unconvincing.”

Who knows how this will play out in the 5th Circuit and the Supremes, given the composition of those courts. But, at least for a day, Judge Ezra has brought some common sense and the rule of law to bear on out of control grandstanding Texas “Governor” Greg Abbott.

In addition to being cruel and illegal, Abbott’s $140 million buoy boondoggle is predictably a failure from a deterrence standpoint. See, e.g., https://www.google.com/url?sa=t&rct=j&q=&esrc=s&source=web&cd=&ved=2ahUKEwi-5saEvpiBAxUXpIkEHU1VBwoQFnoECBoQAQ&url=https://www.livemint.com/news/texas-floating-border-wall-fails-to-deter-migrants-11693942981798.html&usg=AOvVaw0TX6bBkO0Fv0MezJLQPJkk&opi=89978449. (Although Abbott and his White Nationalist supporters falsely claim otherwise.) But, as my friends Dan Kowalski and Judge “Sir Jeffrey” Chase often say, effective deterrence isn’t the point — the cruelty and dehumanization is!

We should also remember that the vast majority of those whom Abbott and the nativists bogusly call “invaders” seek only to turn themselves in to U.S. authorities so they can exercise their clear legal rights to apply for asylum — rights that attach regardless of status or manner of entering the U.S. (Rights that also have improperly been diminished and impeded by the Biden Administration’s ill-advised asylum regulations, currently under legal challenge).

If successful (under a legal system intentionally rigged against them), these so-called “invaders” will use their skills and work ethic to expand our economy and help Americans prosper while saving their lives and those of their families. To anybody other than Abbott and other White Nationalists, that sounds like a potential “win-win” that could and should be “leveraged” for everyone’s benefit!

☠️🤯 CAL. PRISONS ILLEGALLY REFERRING U.S. CITIZENS FOR REMOVAL, REPORTS ACLU, LA TIMES!

Andrea Castillo reports for the LA times:

https://www.latimes.com/politics/story/2023-08-29/californa-prisons-ice-records-us-citizens

WASHINGTON —  On Aug. 18, 2022, a records department employee at the California Correctional Center emailed federal immigration authorities a list of people they believed could be subject to deportation. The list noted that most of those named were born outside the U.S. or had an unknown birthplace. But 12 people were listed as having been born in this country.

That email was obtained by the American Civil Liberties Union of Northern California and shared with The Times. The advocacy group says California Department of Corrections and Rehabilitation staff routinely assume people in their custody are deportable immigrants — even when their own records indicate they are U.S. citizens or immigrants who should not be deported — and report those individuals to U.S. Immigration and Customs Enforcement while denying them rehabilitation opportunities.

The records stem from a public records request filed last year by the ACLU NorCal, which sought communications between the California Department of Corrections and Rehabilitation, or CDCR, and ICE. The ACLU and other advocacy groups said they analyzed about 2,500 uniquerecords from August and September 2022, during which the agency transferred more than 200 people from CDCR facilities to immigration custody.

The groups detailed the results in a report to be published Tuesday that they say describes the practices employed by the CDCR in cooperation with ICE and provides examples of alleged actions by department staff that are discriminatory, including against immigrants.

“In their zeal to collude with ICE, CDCR is not only targeting people who have served their time and are set to return home for detention and deportation but is also sweeping up U.S. citizens and Green Card holders, relying on racist assumptions and ignoring their own records,” the report states.

Dear Reader,

America is built on the drive and determination of immigrants. Even though immigration is one of America’s founding principles, it remains one of the most hotly contested social and political issues of modern times. This ongoing debate is fueled by a number of negative myths about immigrants that have taken root in society.

This month, we are committed to busting the common political, economic, and demographic myths about immigration. We examine how these myths have taken root in our society, how they spread, and what can be done to change the narrative on immigration.

For this month’s issue, we spoke with Alex Nowrasteh, the Vice President for Economic and Social Policy Studies at the Cato Institute. Alex is one of the leading voices when it comes to immigration policy.

Alex says there are three things we can do to combat the myths and lies being spread by the nativist/restrictionists:

  • Recognize the humanity of immigrants and their legal rights under our laws;
  • Emphasize that immigrants compliment, rather than compete with, us;
  • Point out that the “border chaos” is largely the result of bad laws and failed deterrence policies rather than the fault of immigrants.

By contrast, you can spot the bogus restrictionist/nativist myths a mile way because they:

  • Dehumanize immigrants by falsely reducing them to “statistics, numbers, apprehensions, beds, costs, graphs, and charts;”
  • Make the bogus claim that our economy is a “zero sum game” where every additional immigrant means “less of the pie” for you or me — a claim which is demonstrably false because people and immigration are what have allowed us historically to expand our economy so there potentially will be more for everyone (provided that those at the top don’t grab a disproportionate share for themselves);
  • Promote the myth of “just get in line” when there in reality is no line for most to get in because of the unduly restrictive nature of our laws and their poor administration by successive Administrations. They ignore the reality that robust migration is here to stay. The real choice is whether or not we want realistic laws and policies that recognize and harness that reality or instead continue to reward smugglers, enrich jailers, and force millions of migrants into the “extralegal” underground economy where they can not contribute fully economically or politically.

As another “myth debunker,” Time’s Haley Sweetland Edwards, said:

These political reactions fail to grapple with a hard truth: in the long run, new migration is nearly always a boon to host countries. In acting as entrepreneurs and innovators, and by providing inexpensive labor, immigrants overwhelmingly repay in long-term economic contributions what they use in short-term social services, studies show. But to maximize that future good, governments must act -rationally to establish humane policies and adequately fund an immigration system equipped to handle an influx of newcomers.

“Governments must act rationally!” Certainly, neither Trump nor any of the GOP clowns 🤡 seeking to be him are “rational actors” on immigration, the economy, infrastructure, education, individual rights, or anything else of importance to our nation. Indeed, the ignorance, indecency, irrationality, and bias exhibited during the so-called “GOP debate” was beyond appalling, despite the media’s pathetic attempts to “normalize” idiocy. Six folks afraid to say “hypothetically” that they would vote for someone OTHER than a convicted felon who made totally baseless claims that he won the 2020 election! Gimmie a break! (I’m certainly not the only one impressed by the disturbingly low quality of  the GOP “field.” See, e.g., https://www.huffpost.com/entry/larry-hogan-gop-candidates-trump-conviction-question_n_64e82302e4b0a2a9abc4bdc0).

Tea Ivanovic — an amazing immigrant entrepreneur and inspirational leader who is on Forbes’s list of “30 under 30” — is a stellar example of how immigrants of all types — from those at the border to those in boardrooms — make America better! See, e.g.,

Clarence Thomas Hikes Price of Supreme Court Decisions to Keep Pace with Inflation

By Andy Borowitz @ The New YorkerThomas

WASHINGTON (The Borowitz Report)—Citing “unfortunate economic realities,” Clarence Thomas is hiking the price of Supreme Court decisions to keep up with inflation.

The jurist disclosed his new rate card in a mass e-mail sent to more than a hundred super-donors.

“I have tried to keep my prices reasonable, but, as inflation proves more stubborn than predicted, I have no choice but to adjust my rates accordingly,” he wrote.

“Sadly, the days of shredding civil rights in exchange for ten private-jet flights are over,” he added.

It remains to be seen whether the billionaires who received Thomas’s e-mail will tolerate his steeper prices or whether they will explore a budget option such as Neil Gorsuch.

************************

Predictably, no public hearings were held on the Justice’s sudden rate hike, which blindsided many right wing billionaires with business before the Court! “We believed in good faith that Clarence & Ginni were bought and paid for at least until the end of the upcoming term,” complained one super donor. “I mean, if the guy demands any more private flights to fancy vacation retreats, we’ll probably have to consider buying him his own private jetliner. Perhaps, he should spend at least a little more time in his chambers in D.C. spouting originalism and obstructing justice! After all, that’s what we’re paying him for!”😨**

Unhappily, in the days of GOP mega-corruption, satire has become almost a lost art.

I know you are in touch with a lot of young lawyers in the NDPA and wanted to let you know about a wonderful trial skills training I’m involved in.  I’ve been teaching for NITA in trainings focused on trial practice in Immigration Court for a few years now, along with Denise, Eliza, Jeff and others.  This upcoming program in New York is for private counsel and is expensive, but totally worth it for new lawyers (and even experienced lawyers) to hone their trial skills.  Judges appreciate it too!  NITA also does public interest trial skills courses in cooperation with the NLGNIP which are more affordable for lawyers working for non-profits.  If you know any young NDPA lawyers working for firms that can afford this program, I highly recommend it!  Please pass this along to anyone you think would benefit.  Here is the info:

**Pre-Program Lecture Online scheduled for Friday, September 22, from 12:00 – 1:30 PM EST.**

WHY YOU SHOULD ATTEND

As an immigration defense lawyer, you know that practicing in immigration court is increasingly rife with changes and complexity. NITA recognizes this reality and, in response, has developed Advocacy in Immigration Matters, a specialized and timely program designed to help you rapidly upgrade your skills in representing those facing removal from the United States.

WHAT YOU WILL LEARN

This is the only trial skills advocacy course available that covers everything you will experience during an immigration trial. From pre-trial to trial, you will receive on-your-feet training and guidance that goes beyond a lecture-focused learning experience. During this three-day program, you will:

  • make and meet objections,
  • conduct direct, cross, and re-direct examinations,
  • accredit a proposed expert witness,
  • obtain the required opinion from an expert witness, and
  • offer a concise yet compelling closing argument.

All of this will be done in small groups of your peers, with feedback and at a pace that will help boost your performance.

The instructors—some of the most experienced immigration trial lawyers and judges in the country—will share constructive feedback and specific ideas on how to refine your skills. As you watch your peers perform, you will also absorb the “teachable moments” from their performance and instructor critique, which means each layer of learning is continually reinforced by what you hear, see, and most importantly, do.

After three days, you will be able to step into the courtroom with the confidence and practical skills you need to be a good advocate for your client.

In addition, to supplement this “learning-by-doing,” you will have access to NITA’s trial skills video lectures and watch the faculty demonstrate skills. Furthermore, NITA will offer a pre-program, one-and-a-half-hour session on case analysis that will be foundational to the rest of the program and will ensure that participants seek and present the information most relevant to the assigned particular social group.

In just three days, this Advocacy in Immigration Matters program—as with the other time-tested, premier programming that NITA is known for—will swiftly refine your trial practice, leaving you with greater skill and confidence that shows up where it matters the most: when you stand shoulder-to-shoulder with your client in the courtroom.

NITA’s LEARNING-BY-DOING METHOD

NITA’s learning-by-doing method allows you to take calculated risks without ever jeopardizing your client’s case or your own reputation. It is a safe space to learn and practice. This course will employ the tried-and-true learning-by-doing method by providing ALL participants the opportunity to apply their learned skills as if they are presenting in court. You get to participate and observe, learning not only from your mistakes and triumphs but those of your fellow participants as well.

Expert faculty will provide you with constructive feedback, and you will have the option of recording yourself on your phone, which allows you to see and hear yourself the way judges and juries do. But unlike in a trial where there are real stakes at risk, at NITA you will have the opportunity to correct your mistakes, eliminate any bad habits you may have developed, and refine your trial skills.

When you return to your office, you will feel empowered by having learned skills that will serve you the rest of your career.

WHO SHOULD ATTEND?

You should!

Although some removal defense cases may not go to trial because of prosecutorial discretion, learning and refining your trial skills will translate into better outcomes for your clients.

Honing your trial skills will improve virtually every aspect of the many things you do as a litigator from negotiating with the OPLA assistant chief counsel to convincing the immigration judge to grant your client relief.

YOUR REGISTRATION INCLUDES

  • One-on-one personalized feedback and coaching from NITA faculty
  • Case materials
  • One credit toward the NITA Advocate Designation.

WHAT ARE PEOPLE SAYING ABOUT THIS COURSE?

“I would highly recommend this course to immigration practitioners. It was especially helpful for me as someone who began practicing during COVID, but I could see that the skills would also be useful to practice for more experienced practitioners. The course was 100% worth it and I came out of it feeling more confident in my ability to do defensive work.” — NITA – NIPNLG “Advocacy in Immigration Matters” course attendee (August 2022)

“This was literally the most useful training I’ve had in the legal field, including law school, internships and many other PD opportunities I’ve tried to take advantage of. I think in the legal profession, there’s such an emphasis on being right and being prepared that we have a hard time taking risks and messing up. Even in trainings and simulations, I participated very little because I felt like there was this very high amount of minimum knowledge that I needed, didn’t have, and didn’t know how to get. I guess I figured everyone had learned this in debate or Model UN, which I never did. But somehow, the instructors created this baseline understanding that we’re there to learn, we can start from zero, and messing up is welcomed because it shows we’re taking risks. I feel much more ready to work on my cases. What’s more, in a field where burnout is so high, I feel excited to prep for trial now.” — Advocacy in Immigration Matters online course attendee (April 2022)

“In the over twenty years I had the honor to serve as an immigration judge, I frequently saw attorneys who, although bright, dedicated and familiar with their clients’ cases, had very limited understanding of evidentiary rules, proper forms of direct and cross-examination, effective storytelling, and the art of closing argument. These basic trial skills are not usually part of a law school curriculum, and once engaged in the practice of law most attorneys do not take the time to develop or hone their skills, other than by “trial and error,” which is, sadly, sometimes at the expense of their clients. The NITA program provides a unique opportunity to develop these extremely important skills. I encourage those who are seeking to represent asylum seekers in Immigration Court to consider taking advantage of this unique and valuable opportunity.” — Hon. Eliza C. Klein, United States Immigration Judge (Ret.)

🇺🇸 BLACK HISTORY: In 1838, The Jesuits Of Georgetown University “Saved” Their School By Literally Selling Their Enslaved African-American Workers “Down The River” (In This Case, Down The Mississippi To Louisiana)! — That Fateful Decision Reverberates Today!

Slavery & Jefferson
Slavery, its wonton cruelty, negative impact on America, and the stories of the enslaved African Americans who persevered can’t ultimately be “swept under the carpet” by GOP white nationalists.

https://www.nytimes.com/2023/06/28/books/review/the-272-rachel-swarns.html?smid=nytcore-ios-share&referringSource=articleShare

David W. Blight reviews Rachel Swarns’s new book “The 272” For The NYT:

. . . .

“The 272,” Rachel L. Swarns’s deeply researched and revelatory new book, is the story of the remarkable Mahoney clan and how their lives, nearly a century and a half after Ann Joice’s, intersected with those of Mulledy, McSherry and the Jesuits in one of American slavery’s most withering tragedies. “The 272” is a fascinating meditation on the meaning of slavery and of people converted to property and commodities — assets of wealth and objects of sale. It’s a book that journeys to slavery’s heart of darkness: to the separation of families, the terror of being sold into the vast unknown and of bodies transformed into profits and investments. But it is also the moving human story of some of the people who endured and survived this ordeal, and who have long awaited rediscovery.

Swarns, a contributing writer for The New York Times and a professor of journalism at N.Y.U., is an African American Catholic who was raised on Staten Island. Beginning with an article in The Times in 2016, she revealed the story of the Jesuits as slaveholders and traders, leading to a stunning reckoning by Georgetown University with its past as well as one within the Jesuit order itself. Swarns writes with a keen eye and distinctive voice both about her Black subjects and about the hypocrisy and brutality of their onetime owners. The Jesuits were no monolith of greed and evil, however; Swarns sustains empathy for some who tried, largely unsuccessfully, to protect the enslaved people they had known so closely from the agony of sale that looms over this story.

. . . .

What comes through most effectively is the sorrow and the determination to survive of the enslaved people whom Swarns brings to light through her sleuthing and resonant prose. (Of Ann Joice, Swarns writes, “She would have no wealth, no land and no savings to leave her family, but she still had her story. … The story would be her legacy.”) Swarns also underscores the importance of Georgetown’s ongoing efforts at serious reparations for the deeds of its early leaders. An independent nonprofit, the Georgetown Memory Project, has identified around 6,000 living descendants of the original 272. In turn, the university has offered descendants formal “legacy” status for admission, sought atonement through a highly publicized apology and created a fund that would dedicate $400,000 a year to community projects, including support for health clinics and schools, likely to benefit descendants. Leaders of the Jesuit conference of priests have also vowed to establish a $100 million trust to benefit descendants and promote racial reconciliation.

No single work of history can remedy the vexing issue of repair for slavery in America, but “The 272” advances the conversation and challenges the collective conscience; without knowing this history in its complexity we are left with only raw, uncharted memory.

David W. Blight is the author of the Pulitzer Prize-winning “Frederick Douglass: Prophet of Freedom” and the forthcoming “Yale and Slavery: A History.”

This is the kind of important, often intentionally buried, history that GOP white nationalists like DeSantis, Trump, and others don’t want read and honestly discussed. But, as with most artificially suppressed works, the truth will out! There are just too many people speaking it these days for even the neo-fascist censors to silence them all.

It also illuminates the heretofore unknown and unheralded stories of enslaved African-Americans like Ann Joice who, against the odds, persevered in a grotesquely unjust and horrible system so that future generations could have a chance at a better life. These are are among the real heroes of  American history who helped make our country what it is today. Their stories deserve to be told and studied.

The Feeling of Freedom

July 3, 2023 by Kelly White, Esq.

I love this country dearly, but not without deep sorrow for the mistakes of my own homeland.  And so, I criticize it because I want this place to mean freedom for everyone.

On July 4th, I will celebrate with my mixed-immigrant, first-generation family, neighbors, and community.  I tell my little one she is an Incan-Viking Warrior (because she is). And that there are places where not everyone is free, including in our own country. But we are working to change that. I try to teach her about refugees and why people flee their homes to come to the United States.

We also talk about family separation. Not long after zero-tolerance began, another child told mine that she “belongs in a cage” after all of us, young and old alike, saw those images. These are the misgivings of small children but also the symptoms of a deeply flawed system and culture. The way the Zero Tolerance Policy desecrated freedom continues to haunt us today.

As the director of CAIR Coalition’s Detained Adult Program, I believe we can help right the path our country is currently on—one that continues to separate families with unrestrained racism and violence.  The family separation crisis is ongoing, senseless, and continues to destroy our communities.

The United States has the largest immigration system in the world and is currently detaining approximately 29,000 immigrants, more than 63 percent of whom have no criminal record.  In addition, the Biden Administration has deported over four million people, the majority for simple civil immigration violations, including not having the correct paperwork.  This should be the least complicated public policy-making decision.

Immigrants’ rights groups need a new platform to stop these inhumane policies.  It should be simple:

  • Stop separating families.
On an annual average, over 1,500 children in the DMV are impacted by a parent’s detention. Over a thousand children put their best forward as they try to move on with their lives without their parents—over a thousand children!
Why policies that harm our own children and communities are allowed to continue is heartbreaking.  Our policies must keep families together.
  • Provide Immigrants in deportation proceedings with government-appointed counsel.
Immigrants in deportation proceedings, including parents, are forced to defend themselves against a government-trained attorney without a right to court-appointed counsel in a language often not their own.  This means children become indefinitely separated from their parents simply because the right to a public-defense counsel is not available in immigration court. One solution would be to support the Fairness to Freedom Act and local programs for the right to counsel.

Being a parent is scary enough because there is very little you have control over in this world, but I know I am free to access the institutions in this country to care for, educate, and protect my child, but not everyone does.

As I celebrate this holiday, I will light fireworks and sparklers and do so as a symbolic spark to action for change and family unity.  I hope you will join me.

Today, a personal essay.

When I was little, my Ba would bring out fireworks for the Fourth of July. He acquired them in places like Maryland, where our family would go summer camping on the state beaches, and brought them across state lines to our little suburban enclave in upstate New York. As soon as it was dark enough out, many of our neighbors would gather, the area kids eager to see what Mr. Kuo had in store that year. Sparklers for sure. Sometimes big noisemakers. And always more than a few showstopper rockets with brilliant flourishes of color. He would hand them out to us to dole out to the other children without a thought to liability.

The 1970s were a crazy time.

Subscribed

It didn’t occur to me until much later that there was some irony here. We were the only Chinese American household in the area. With four kids and a house on the corner of two main streets, our family was the center of activity for Tioga Terrace. And on July 4, Ba would bring the magic, developed centuries ago by people who looked like us, gunpowder mixed carefully with binding and coloring agents, bringing wonder and delight.

I understood we were celebrating the independence of America from the British Crown, and I most clearly remember the bicentennial celebration that took place in 1976. Our schools had focused heavily on American history that year, yet most of my understanding of what had transpired 200 years before still came from watching our Founding Fathers sing about it in the movie 1776.

Musical theatre has always been in my DNA.

In that merry portrayal, the heroes of the revolution were towering figures: debonair, erudite, romantic, able to find gallows humor at the darkest of hours. I remember best the musical number around whether slavery should be condemned in the words of the Declaration. It was a terrifying and bewildering song. What did molasses and rum and Bibles have to do with Roots? And I remember vividly poor Thomas Jefferson, the author of that brilliant document, being called out for still practicing slavery on his property.

“I have already resolved to release my slaves,” said a quietly thoughtful Jefferson.

I sincerely believed that earnest and brave man, who thrilled his colleagues with the playing of his violin, his adoring wife Martha swooning to the tune. He was a noble man, to be admired.

We didn’t learn the real truth about Jefferson, or about any of the Founding Fathers, in class. And it wasn’t taught to me in college either, even though I was a political science major. The first person to challenge my view of our any of the Founders was a Black colleague I met during my RA training, who had brought up that we don’t ever teach real history. She cited the story of Jefferson and Sally Hemings, one of the many slaves he owned—a girl he had raped when she was just 14 years old.

I didn’t want to believe it. The Declaration of Independence, and its famous author, were sacred in my mind. The principles they espoused were of the highest order. And in my mind, July 4th was my favorite holiday, next to Christmas. For one day, Ba was cooler than all the other dads, and at least for that day we were the most popular kids in the neighborhood, even though we were not fully American—at least, that’s how it had always felt.

Once the veil was pierced, however, the truth began to burn holes through my mind. I began to question a great deal of the mythology that had been spoonfed to me, really to all of us. Christopher Columbus, that was a shocker. Manifest Destiny. The Chinese Exclusion Act. The Tulsa Massacre. The internment of Japanese Americans. With each revelation, it was hard not to become deeply and irretrievably cynical about our history and the way our country has always acted toward the most vulnerable in America.

There’s a strange thing that happens when you come out the other end of all that. I began to wonder how they did it. How did people like Frederick Douglass, Dr. Martin Luther King, Jr., and even my own hero George Takei still have anything left of faith and belief in this country, after all it had done to them, their families, their communities?

“We hold these truths to be self-evident.”

That all people are equal. That we all possess “unalienable rights of life, liberty and the pursuit of happiness.”

Those words were revolutionary in their time. And they indeed spawned a revolution. Despite my great disillusionment, they still inspire and hold true for me today. That’s the power of the enduring promise of America. Not that we will always, or even most of the time, get things right, or that we won’t stumble our way into dark and nearly hopeless chapters of genocide, slavery, internment, and yes, growing Christofascism today.

Loving the promise of America isn’t the same as loving what it has done and still does to break that promise, over and over. But I’ve come to appreciate the high value of maintaining our gaze upon that North Star, the one that still shines for liberation, fairness and equality. That the promise has now endured nearly 250 years speaks to our collective and deep desire for hope, even in the face of broad and dehumanizing injustice and inequity.

The America that our white, propertied, slave-holding male Founders envisioned isn’t what we’ve got today. But that’s because we’ve improved upon that vision. For me, the America of tomorrow is a truly multi-racial, multi-denominational, pluralistic democracy, a place of opportunity and prosperity, with no one left behind. That is the vision that sustains me. It’s the one where my Chinese father could hand out fireworks on July 4 to excited, white kids and seem the most American of all the dads.

We inherited both a sacred promise and a big mess from those who came before, and we’re still working on both. The fact that it is so very hard, and we have so very far still to go, is strong evidence of the incredible value of that promise. This is evidenced in great part by how fiercely others will fight with all they have to keep us from it.

But nothing worth fighting for was ever won without a fight. And in the end, the enemies of our unalienable rights will fail. That is the faith I keep.

Happy Independence Day. Our fight continues.

— Jay

***********************

As Jay says, “the fight continues.” And, the patriots quoted above are on the front lines!

Sad historical footnote: Whatever the “musical version of TJ supposedly ‘resolved,’” the real-life version freed only two enslaved workers in his lifetime and five (including two of his own children) at death. The rest of his enslaved workers and their families were sold upon his death to pay off his monumental debts. Thus, these enslaved African-Americans paid a huge personal price for this “Father of Freedom’s” gross financial mismanagement!

Slavery & Jefferson
For African Americans, working and being owned by the primary drafter of the Declaration of Independence was a bad deal! No freedom, no pay, and almost all of those he owned at death got sold to pay off the debts he left, resulting in the permanent separation of families! This is the real history of our nation that Trump, DeSantis, and other GOP White Nationalist “snowflakes” don’t want you to hear or learn.
IMAGE: Public realm

According to Wikipedia:

Thomas Jefferson, the third president of the United States, owned more than 600 slaves during his adult life. Jefferson freed two slaves while he lived, and five others were freed after his death, including two of his children from his relationship with his slave (and sister-in-law) Sally Hemings. His other two children with Hemings were allowed to escape without pursuit. After his death, the rest of the slaves were sold to pay off his estate’s debts.

Stephen Collinson writes at CNN:

. . . .

In recent years, the [GOP’s] blind loyalty to Trump’s radicalism – especially his election lies – has caused it to even challenge the structure of democracy. A sense of national crisis and imminent political extinction, for example, ran through Trump’s rhetoric in the aftermath of the 2020 election, prompting some of his followers to use violence as a way of settling their political grievances on January 6, 2021.

Conservative Supreme Court decisions over the last two years have been especially hard for liberals to accept because they believe that the current majority is ill gotten.

The right’s dominance of the court happened in large part because then-Senate Majority Leader Mitch McConnell refused to even grant a confirmation hearing to Obama’s final pick for the top bench, Merrick Garland, who now serves as attorney general in the Biden administration. This allowed Trump to name Justice Neil Gorsuch as his first Supreme Court nominee in 2017. But McConnell later turned his back on his own questionable principle that Supreme Court nominees should not be elevated in an election year by rushing through the confirmation of Trump’s final pick, Amy Coney Barrett, in 2020 – which enshrined the current 6-3 conservative majority.

The move not only confirmed Trump’s status as a consequential president whose influence will be felt decades after he left office. It cemented McConnell among the ranks of the most significant Republican Party figures in decades and ensured conservative policies will endure even under Democratic presidencies and congressional majorities.

Recent revelations about questionable ethics practices by some of the conservative justices have further fueled fury about the legitimacy of the court among liberals.

But not all of the court’s recent decisions have infuriated the White House and Democrats. Earlier this week, for instance, liberals were hugely relieved when the court rejected a long-dormant legal theory that held that state courts and other state entities have a limited role in reviewing election rules established by state legislatures when it comes to federal elections. The so-called Independent State Legislature Theory, a favorite of the Trump campaign, had led to fears that Republican state legislatures in some states could simply decide how to allocate electoral votes regardless of results.

Still, the broad trajectory of the court – on issues including gun control, race, business, regulation, climate and many other issues – is firmly to the right.

*****************

It’s no coincidence that the Trumpist far-right assault on democracy began during the 2016 campaign with unprovoked attacks on Mexican migrants and bogus claims about the border and immigration. It was skillfully, if corruptly, followed up with weaponization of the immigration bureaucracy and packing of the Immigration Courts by the likes of Miller, Sessions, Barr, and Cooch.

We have seen the GOP’s assault and dehumanization of migrants carry over into attacks on a wide range of disadvantaged groups in American society including African-Americans, Hispanic-Americans, Asian-Americans, Muslim-Americans, women, the LGBTQ+ community, and many others.

Although the Supremes have held that every “person” in the United States is entitled to due process under law, that concept is ludicrous as applied to the U.S. Immigration Courts, where anti-asylum, anti-immigrant, pro-DHS bias still drives much of the decision making, prosecutors appoint the judges and write the rules, the Government can change results that don’t match its political agenda, and individuals are on trial for their lives without a right to appointed counsel or many times even the ability to fully understand the proceedings against them. Predictably, the overwhelming number of individuals stuck in this abusive system are persons of color, many women and children!

This is “colorblind” American justice? Gimmie a break!

Although Dems acknowledged many of these outrageous defects in the Immigration Courts while campaigning for votes in 2020, once in power, they have shown little inclination to correct this unacceptable situation that undermines our democracy.

In particular, given a chance to reform the Immigration Courts, re-compete on a merit basis judicial positions filled under questionable procedures (at best) during the Trump Administration, bring in competent judicial administrators laser-focused on due process and best practices, and remake the Immigration Courts into a bastion of great progressive judging —  driven by due process and equal protection, Garland and the Dems have whiffed. In that way they have largely followed the Obama Administration’s failure to take seriously due process for persons who happen to be in Immigration Court.

The failure of Dems to take immigrant justice seriously, and their inexcusable blown opportunity to reshape the Immigration Courts into a training and proving ground for the best and most qualified candidates for Article III judgeships ties directly into the anti-democracy shift in the Article IIIs and the GOP’s ability to carry out its right-wing agenda through a Supremes majority highly unrepresentative of Americans and our values.

An informed observer might well wonder “If the Dems are unwilling and unable to reform and improve the Federal Courts they do control — and apparently are ashamed of the progressive values they espouse — how will they ever counter the right’s anti-democracy agenda?”

☠️⚰️ DETENTION KILLS: R. Andrew Free Seeks YOUR Help, NDPA, To End The “DHS Detention Death Tax!”

Border Death
Sometimes, even “Detention Until Death” (“DUD”) is insufficient “punishment” for the USG to inflict on those whose “crime” is to assert their legal rights under U.S. law.  Taken at the Tijuana-San Diego border.

END THE DETENTION DEATH TAX

pastedGraphic_1.png

End the Detention Death Tax – a draconian policy that fails to make funds available to the families of people who die in ICE custody for the return and transportation of their loved ones’ remains.

We urge ICE to alter its Detainee Death policies so that Field Office Directors and the Director’s Office have discretion to authorize payment for the prompt return and transport of the remains of people who die in ICE custody.

It is, quite literally, the very least ICE could do when it fails to keep humans alive.

WHY IS THIS IMPORTANT?

US Immigration and Customs Enforcement (ICE) currently has no defined limit on the amount of money it will spend to cage the body of a person in removal proceedings.

When one of ICE’s deadly cages claim the life from that body, the limit ICE will spend to return them to their loved ones is $0.

This Death Tax presents grieving family members with a bill alongside the devastating news that their loved one is gone forever. Forcing families to pay for the retrieval and transportation of loved ones is cruel, inhumane, and unnecessary.

CATEGORIES

REASONS FOR SIGNING

  • Since 2017, we’ve been forced to raise over 100,000 to help families gather their loved ones’ remains, examine those remains using independent forensic pathologists, and return or repatriate those remains to wherever the lost loved one called “home.” This is cruel, inhumane, and unjust. We can end it.

“Detain Until Dead” (“DUD”) seems harsh enough “punishment” to be meted out to “civil” prisoners in DHS’s New American Gulag (“NAG”). But, Andrew points out that the cruel and inhuman treatment doesn’t end, even with death.

😇🙏🏽SANCTUARY, A TIME-HONORED ANTIDOTE TO CRUELTY & STUPIDITY, PUTS AMERICA’S 🇺🇸🗽BEST FOOT FORWARD 👏: “It means treating [migrants] like humans in need rather than pawns.”

From the L.A. Times Editorial Board:

Editorial: Sanctuary cities are working just fine, thank you

When Republican Govs. Greg Abbott of Texas and Ron DeSantis of Florida bused and flew migrants to Los Angeles, New York, Washington, D.C., and other so-called “sanctuary cities,” they might have envisioned they were exporting the same chaos as border states have experienced as they grapple with a historic number of migrants. They wanted leaders in these cities to admit they were wrong about their immigrant-friendly policies.

Earlier this month, Abbott sent migrants on a bus to Los Angeles. And DeSantis has admitted he dispatched migrants on two chartered flights to Sacramento a few days earlier, luring them with false promises of housing, shelter and legal help.

But Abbott and DeSantis are mistaken if they think they are teaching cities with sanctuary polices any lessons with their inhumane political stunts or causing their leaders to rethink their commitment to not treating migrants as criminals.

Those governors and their political allies also seem to be confused about what it means when cities have sanctuary policies. Though policies vary, providing sanctuary means not turning migrants over to federal immigration authorities simply for being in the country illegally. It means treating them like humans in need rather than pawns.

OPINION

Editorial: Migrants flown to Sacramento are human beings, not political pawns

June 5, 2023

That’s what leaders in Los Angeles, Sacramento and other “sanctuary cities” did as buses and planes dumped dozens of tired and often confused migrants on their doorsteps in recent months. They rallied attention and resources, while religious and other nonprofit organizations stepped up to welcome the migrants with shelter, food and clothes. In some instances, these migrants have even found temporary jobs, illustrating the need for their labor.

Abbott and DeSantis may also not realize that sanctuary policies were designed to help law enforcement keep communities safe. Sanctuary policies were developed because police in many cities such as Los Angeles were frustrated because undocumented immigrants were not reporting crimes or stepping forward as witnesses for fear of deportation.

Critics say these sanctuary cities have laws and policies that shield criminals and obstruct federal immigration policies. But cities with sanctuary policies have lower than average crime rates, higher household incomes and lower poverty rates, according to various studies.

Local authorities did not refuse to cooperate with immigration enforcement, as critics claim. They simply limited the role of local law enforcement in immigration cases, for example, by not using local police to do immigration checks or by not holding an undocumented immigrant in custody for a few extra days to serve federal authorities’ schedules.

OPINION

Editorial: There’s a crisis at the border all right, but one created by political posturing

Sept. 20, 2022

Los Angeles is in the midst of transitioning from a “city of sanctuary” to “sanctuary city.” The difference is more than just semantics. The former designation is little more than a statement by city leaders in 2017 that they opposed then-President Trump’s dehumanizing anti-immigrant policies, which included separating young children from their parents. Some of those children have yet to be reunited with their parents years later. Earlier this month, the City Council voted to strengthen the policy by banning city personnel or resources from being used for immigration enforcement.

It’s true that the transports of migrants by the Texas and Florida governors have been inconvenient to cities such as Washington and New York, which have had to scramble to find housing and other resources. But they haven’t done a thing to undermine the foundation on which sanctuary policies were built.

****************************

The money wasted by these GOP nativist neo-fascists could much better be spent on coordinated efforts to help asylum seekers to help themselves and our nation in the process. Obviously, GOP states like Florida and Texas have money to  burn.

Also, to the extent that cities “targeted” by these GOP White Nationalist Governors have persevered in the face of  attempts to sow chaos, it has been largely without the coordination, guidance, and leadership of the Biden Administration. Seems like that should be “low hanging fruit” for progressive Democrats to change!
