The heroes of the 2022 midterm elections were Democratic voters and activists, not the party’s leadership. Those leaders should remember that and not try to distance themselves from the party’s base as they have at times in the past two years.

Though they changed course in the final months before the election, the Biden administration and congressional Democrats spent much of 2021 and 2022 on a flawed strategy. Democratic leaders were determined to boost the party with people who didn’t vote for Joe Biden in 2020, particularly the White voters without college degrees who have shifted sharply to the GOP over the last decade. So Democrats focused largely on economic policy, such as the American Rescue Plan, the infrastructure bill and a law making it easier to manufacture microchips in the United States. They intentionally highlighted how these provisions would help people without college degrees and people in rural areas.

They at times sidelined other issues, such as voting rights, that might not be the priorities of White voters without college degrees. In July, a top White House official, communications director Kate Bedingfield, bashed party activists who complained that the administration wasn’t responding aggressively enough to the U.S. Supreme Court’s Dobbs v. Jackson Women’s Health Organization ruling eliminating the right to an abortion. And Democrats moved to the right on some issues, most notably policing. There were constant efforts to court moderate GOP voters and lawmakers and sideline prominent left-wing figures.

The Democrats didn’t do well in this year’s elections by flipping lots of voters in places that voted Republican in 2020, such as Florida and Ohio. What they did was maintain strength in the congressional districts and states that they won two years ago and four years ago. The party’s base prevented the bottom from falling out.

Party officials are rushing to give credit — to one another. And some of the party’s leaders do deserve praise. Candidates such as Gov. Gretchen Whitmer of Michigan, who easily won reelection, and Pennsylvania Gov.-elect Josh Shapiro early in their campaigns highlighted abortion and democracy, in addition to the economy. Biden rightly ignored some in the party who argued he should not talk about democracy issues in the final days of the campaign.

But in elections, the voters are the actors, the deciders. And this year, millions of Democratic-leaning voters turned out and stuck with the party, looking past sky-high inflation and a leadership team that spent much of its time courting people who would never vote for Democrats while ignoring key priorities of people who always vote for the Democrats.

These voters should be commended and celebrated.

Perry my friend, let’s go back just a bit in time and think about the “original targets” of Trump’s MAGA GOP “platform” of hate, lies, false narratives, and virulent anti- democracy insurrection masquerading as “patriotism!” 

Who’s been out there fighting for truth, justice, and equality before the law since “Day 1” of the MAGA hate movement? Who led the resistance at airports when the first manifestations of the Trump regime’s neo-Nazism in action began just shortly after his inauguration? Who took the legal fight to preserve American democracy all the way to the Supremes before a right-leaning majority still wedded to Dred Scott and the Chinese Exclusion cases tilted in favor of tyranny? A tilt, I might add that has progressively gotten worse over time and has spawned millions of human rights abuses, enabled torture, and actually helped kill some of the vulnerable humans we were sworn to protect?

Historically, migrants of all types, voluntary or involuntary, have constituted the “other” in America — targeted, disadvantaged at law,  and exploited by their fellow Americans even while being the essential ingredient that has built our nation. 

It’s rather odd, considering that 98% of us were “the other” at some point in history. I suppose a reckoning with that “inconvenient truth” is one of a number of reasons why the  MAGA GOP works so hard to “whitewash” American history. 

So, it’s worth thinking about why a talented group, their expertise, and their “learned wisdom” — and the better America for all that they represent and fight for — becomes so expendable and ignored by Dems between election cycles. Also worth reflecting on where American democracy, tenuous as it might be today, would be without them.

If the Biden Administration had honored and “leveraged” the immigration experts who helped elect it in 2016 and preserve it in 2022, we might well have order at the border, many more legal workers, lower inflation, decreasing backlogs, focused immigration enforcement that preserves national security, courts that model equal justice and due process and help develop the Article III Judiciary of the future, creative ideas for helping the economy of rural America, smarter use of taxpayer dollars, the list goes on. Success in these areas might even have enabled Dems to hold onto the House or given them a bigger margin in the Senate.

A federal judge on Tuesday struck down a Donald Trump-era policy used by U.S. border officials to quickly expel migrants because of the covid pandemic, saying the ban had little proven benefit to public health even as it shunted migrants to dangerous places.

U.S. District Judge Emmet G. Sullivan in the District of Columbia vacated the order known as Title 42, effectively restoring asylum seekers’ access to the borders for the first time since the Trump administration issued it during the earliest days of the pandemic.

The decision — which takes effect immediately — knocks down one of the last remaining barriers to asylum from the Trump administration, advocates for immigrants said. It also poses an immediate logistical challenge for the Biden administration after two consecutive years of record apprehensions on the U.S.-Mexico border, with the possibility that the numbers could grow.

Biden officials have long worried about a mass rush to the border creating an emergency similar to the one that occurred in Del Rio, Texas, in Sept. 2021, when thousands of migrants crossed illegally and overwhelmed U.S. agents, creating a squalid camp on the banks of the Rio Grande that embarrassed the Biden administration.

Sullivan’s ruling also comes days after top border official Chris Magnus resigned under pressure after clashing with Homeland Security Secretary Alejandro Mayorkas.

The Justice Department and the Department of Homeland Security had no immediate response to the ruling.

The American Civil Liberties Union, one of the organizations that brought the lawsuit on behalf of migrants, said Sullivan’s decision to vacate the Title 42 policy means the policy ends for all migrants, including families and adults traveling without children.

“Title 42 unfortunately had a long shelf life but has finally been ended, and that will mean enormous relief to desperate asylum seekers,” said ACLU lawyer Lee Gelernt.

Sullivan also made clear that that he would not stay his order pending appeal, leaving it to a higher court to do so if the Biden administration sought more time to address the ruling.

Sullivan wrote that the federal officials knew the order “would likely expel migrants to locations with a ‘high probability’ of ‘persecution, torture, violent assaults, or rape’ ” — and did so anyway.

“It is unreasonable for the CDC to assume that it can ignore the consequences of any actions it chooses to take in the pursuit of fulfilling its goals,” Sullivan wrote. “It is undisputed that the impact on migrants was indeed dire.”

The horrific consequences for lawful asylum seekers subjected to this unlawful policy have indeed been “dire:” rape, assault, kidnapping, beating, torture, extortion, starvation, illness, sickness, death, family separation, despair, to name a few. 

By contrast, there have been NO consequences for Stephen Miller and the other Trump Administration officials who fabricated and directed this ruse on the justice system and attack on humanity and the rule of law! Nor have there been any consequences for lower level officials who “went along to get along” with what they knew or should have known to be deadly abuses of our laws. 

Additionally, Biden officials who continued to violate the law and even concocted ways of expanding its illegal and immoral use have escaped accountability and continue in their jobs. DOJ lawyers who failed to do “due diligence” and defended a policy based on pretext, misrepresentations of fact, racism, and xenophobia have also continued to operate in the “ethical twilight zone” that normally would have serious professional consequences!

Of course the whole history of the Title 42 charade ☠️🤮has been one of one step forward and three steps back. The corrupt decision-making extends to unqualified right-wing zealots with lifetime sinecures on the Federal Article III bench and to equally corrupt GOP state AG’s for their dishonest scheme to force continued illegal Title 42  expulsions. 

So, despite these “crimes against humanity,” don’t expect that “heads will roll!” Given the current sorry state of our Federal Courts and the DOJ, it’s not certain that Judge Sullivan’s order will actually have effect or that asylum seekers will ever get the fundamentally fair and humane treatment to which they are entitled.

But, I am certain that this will eventually go down in history as one of the most disgraceful intentional abrogations of law, with the most drastic consequences for humanity and our nation’s reputation, in 21st Century legal history!

It’s also worthy of note that rather than getting the asylum system properly staffed and trained, bringing in Immigration Judges with the required expertise, installing a BIA of expert judges capable of issuing correct, realistic, generous, practical asylum precedents, working cooperatively with the private bar to facilitate representation, and developing an orderly process for resettlement (away from the border) of asylum applicants who pass credible fear, Garland, Mayorkas, and a White House officials have dithered away two years of time without getting the necessary robust, fair, expert, efficient, timely asylum adjudication system up and running!

The advice and pleas of experts and advocates have been “tuned out” or ignored by those in charge! Now, as all of us predicted, the “chickens have come home to roost” for the Administration’s indifferent, incompetent, and lackadaisical  approach to the biggest racial justice and human rights crisis facing our nation.

Thanks Judge Sullivan! Thanks ACLU! Apologies to the hundreds of thousands of asylum seekers wronged by the cowardly failure of America to uphold our laws, Constitution, and international obligations — that “subset” of victims who are still alive despite our Government’s grotesque misconduct!

MILWAUKEE — Wisconsin Gov. Tony Evers (D) won reelection Tuesday by 3.4 points. That’s a landslide in a state where four of the past six presidential contests were decided by less than one point and the first time since 1990 that a Badger State governor was reelected from the same party that controlled the White House. For a Democrat, it’s the first time since 1962.

Evers, a former schoolteacher who derives pleasure from euchre and polka music, was rewarded by independents for his stalwart defense of voting and abortion rights. “As it turns out,” Evers said in his victory speech, “boring wins.”

The race was a bit more complicated than that. Republican challenger Tim Michels, who won the August primary because of an endorsement from former president Donald Trump, promised to abolish the bipartisan Wisconsin Election Commission, sign nearly 20 restrictive voting bills that Evers had vetoed and opened the door to not certifying the 2024 presidential results. “Republicans will never lose another election in Wisconsin after I’m elected governor,” Michels declared at a campaign stop on Oct. 31.

Evers said some Democratic strategists suggested that he not talk about democracy on the trail because the term is too broad and abstract, but he emphasized voting rights anyway. “I think Wisconsinites get it,” he said. The governor ran as a check and balance on GOP extremism, boasting that he vetoed a record 126 bills over the past two years, and warned that Michels would be a rubber stamp for a Republican legislature.

Independents made up 30 percent of the electorate, according to exit polling, and Evers won them by six points. Several said during interviews that they are uncomfortable with one-party rule at the federal or state level. Gerrymandering has made it virtually impossible for Democrats to win control of the state Assembly or Senate.

Abortion also mattered: An 1849 state law banning the procedure was dormant until the Supreme Court struck down Roe v. Wade in June. With providers fleeing to Illinois, Evers offered clemency to anyone convicted of providing care and called special sessions to (unsuccessfully) pressure Republicans to update the law. Michels said he was unapologetically pro-life and that the 1849 ban mirrored his position. Later, he suggested he would sign a bill to add exemptions for rape and incest.

This issue drove a massive turnout spike in liberal Dane County, home to the University of Wisconsin-Madison. Evers won about 16,000 more votes from the county than in 2018.

Statewide, about one-third of voters identified abortion as their top issue, and Evers won 84 percent of them. According to exit polls, only 8 percent of the electorate said abortion should be illegal in all cases while 62 percent said it should be legal in most or all cases. Evers won women by 13 points.

Democrats benefited from Trump fatigue. While nearly 54 percent of voters disapproved of Biden, 58 percent held an unfavorable view of the former president. In fact, exit polling shows about 30 percent said opposing Trump was a reason for their vote, which is stunning when you consider that he hasn’t been president for two years.

During her victory remarks on Tuesday night, Spanberger spoke of her “deep and abiding love for the country” and a “profound sense of responsibility.” The former CIA agent reiterated that the country was founded on “a dream” that it need not bound by the past or be ruled by kings and queens. Quoting Benjamin Franklin’s admonition that the constitutional convention delivered a republic “if you can keep it,” she declared, “We must all work hard to keep it.”

As a moderate, Spanberger has managed to balance fidelity to Democratic causes such as investment in green energy and the preservation of abortion rights with an independent, reform-minded streak that sometimes put her at odds with party leadership. (Speaker Nancy Pelosi, for example, has not allowed a floor vote on Spanberger’s bill that would ban House members and their spouses from holding individual stocks.)

With this win, Spanberger reaffirms her status as a rising star in the party. Her formula — bipartisan problem solving, strong national security credentials, anti-corruption crusading and support for women’s reproductive rights — has proved successful. But she also had another advantage: a Democratic record of legislative success, including the infrastructure bill, the Chips and Science Act, an expansion of veterans’ health care and measures to reduce prescription drug prices.

By sharp contrast, the GOP has no known values: divide, bully, lie, demean, hate, misinform, blame, deny, discriminate, humiliate, oppress, smear, shame. Those aren’t values: just highly negative attributes!

The GOP did claim concern about inflation and the economy. But, they offered no coherent plan for addressing it in any practical, bi-partisan manner.

Instead, they promised to wreck Government, mindlessly oppose anything Biden proposes, and even threatened to collapse the worldwide economy by “playing chicken” with the artificially-created “debt ceiling.” 

To the extent that any GOP candidate could explain their economic “plan” (most couldn’t or wouldn’t), it was a muddled variation of proven-to-fail “trickle down economics.” Yup, the same nonsense and bureaucratic doublespeak that has destroyed the British economy and led the Conservatives to be a laughingstock of “unstable government by clowns🤡!” Basically slash programs that benefit everybody to reward fat-cats with more un-needed and unfunded tax breaks. 

Do we really need to make guys like Musk, Zuckerberg, Bezos, McConnell, and the “geniuses” who invented “cryptocurrency” richer? Make sense? Of course not! I doubt that there is a shortage of “investment capital” in the U.S. right now. 

Is preventing IRS from processing returns in a timely manner and collecting back-taxes owed really the key to reducing budget deficits? Preposterous! Yet GOP pols say so!

Undoubtedly, we need prudence, responsibility, and focus in government spending — from both parties. As working mothers, Abigail and Hillary know a thing or two about making responsible fiscal decisions and insuring that their constituents get the most bang for each hard-earned tax dollar spent. And neither is afraid to speak out against “fraud, waste, and abuse” in any and all forms!

As former Federal civil servants, they recognize the need for cutting waste and getting more value for each dollar. In that respect, I think that requiring competent management, accountability, expertise, innovative customer service, and focused enforcement in the hugely expensive yet highly wasteful, ineffective, and often counterproductive immigration bureaucracy would be a good starting point for achieving much more without drastic resource increases.

It doesn’t hurt that Abigail and Hillary are really really smart and use their brains to help others and society rather than for self-aggrandizement or to lord it over others. Tough as they are, they are also nice, kind, and compassionate. In other words, non-ideologues.

Go, Abigail and Hillary! Make America the best that we can be: A diverse society and powerful nation where everyone can reach their full potential, independence, and self-sufficiency, not just the “chosen few!”

GRAND RAPIDS, MI — Hillary Scholten will become the first Democrat to represent Grand Rapids in Congress since 1977 after defeating Trump-backed Republican John Gibbs in a race that’s drawn national attention.

Scholten, an immigration attorney from Grand Rapids who worked in the U.S. Department of Justice during the Obama administration, defeated Gibbs 53% to 44%, according to unofficial results from the Associated Press.

The AP called the race for Scholten just before 2 a.m. Wednesday morning, with 63% of votes counted.

Scholten campaigned as a common-sense, problem-solving candidate who supports abortion rights, lowering the cost of health care and prescription drugs, and protecting Social Security and Medicare. Scholten cast Gibbs as an extreme candidate focused overturning the 2020 election results and “doing Donald Trump’s bidding on West Michigan.”

Scholten could not immediately be reached for comment early on Wednesday, Nov. 9. Her campaign spokesperson, Larkin Parker, said Scholten would be live-streaming a speech this morning.

Gibbs took to Twitter after AP called the race, saying “we believe this call is premature.”

“There are plenty more votes outstanding and we expect the vote count to go well into Wednesday,” said Gibbs, who grew up in Lansing and served in the U.S. Department of Housing and Urban Development during Trump’s presidency.

The last time a Democrat was elected to represent Grand Rapids in Congress was 1974. Attorney Richard Vander Veen was elected that year, in what was then the 5th Congressional District. He replaced U.S. Rep. Gerald Ford, who resigned from the seat to become vice president during Richard Nixon’s second term.

After the polls closed Tuesday, Scholten spoke to supporters at Paddock Place, a restaurant and event venue in Grand Rapids. She described her campaign as a unifying effort to draw in voters from both sides of the political spectrum, as opposed to the “divisiveness” of her opponent’s campaign.

“This campaign has, and continues to build, something new here in West Michigan,” Scholten said. “A new political home for people on the right, the left, the center, who are tired of politics as usual, who are ready to cast aside the old frame of division, ‘us versus them,’ and join hands together for a better, brighter West Michigan for all of us.”

🤯 POLITICS: BILL PENZY: WISCONSIN’S LAST ELECTION?

Tuesday, Wisconsin has the chance to reelect a truly kind and decent man who is also a really effective governor, Tony Evers. This week his Republican opponent announced: “Republicans will never lose another election after I’m elected governor.” His people tried to backtrack afterwards and say he will do such a good job everyone will always forever after vote for Republicans all the time. That wasn’t what he was saying. He is a 2020 election denier who plans to abolish Wisconsin’s bipartisan election commission and replace it with one he hand picks. He sold his soul to Donald Trump for his endorsement. He is in Trump’s debt.

After Citizens United unleashed unlimited corporate political spending, Wisconsin became the Republican party’s test grounds for how to turn unlimited money into election wins. What blindsided so many nationally in 2016 with Donald Trump’s election has been ongoing here since 2010. I know some of you want to believe there are some sort of safeguards protecting our democracy or possibly some sort of protective netting preventing Republicans from sinking beyond a certain point. I can tell you there is not.

Wisconsin wasn’t chosen randomly to be the testing ground of unlimited spending. It was our long history of humanity, support for schools, fairness for workers, and leadership on environmental protections that brought us into the Republican party’s focus. Much of what you like about Penzeys has its roots in Wisconsin’s tradition of caring for others. It is our caring that the Republicans seek to end.

Milwaukee’s Journal Sentinel has come around and done a very decent job covering just what a threat both our Republican governor and senator candidates are to the future of democracy. They don’t normally make endorsements, but they’ve realized this one is too important to sit out. Please read their well-reasoned endorsement of Tony Evers’s re-election for Governor and our Lt Governor Mandela Barnes for US Senator editorial here. (Just tap on the highlighted link). Evers and Barnes have earned Wisconsin’s support.

And maybe the root of this Tuesday’s election is to be the wake-up call America needs to save our democracy, but here in Wisconsin 2024 could be too late. Unless you’ve been here these last twelve years, you can’t imagine the depths of corruption that are now accepted as commonplace in our state’s Republican party. I won’t bog this down with the numbers, but Wisconsin is so very corruptly gerrymandered. It is amazing that this year there is still hope, but that hope hangs by a thread.

Please, if you know someone in Wisconsin forward to them this email or at least the link to the Milwaukee Journal Sentinel endorsements. Better yet, give them a call. We are nice people to talk to. Republicans have to cheat here because the majority of us are good and decent people, but after a dozen years of this, some of those good and decent people are exhausted. This cycle’s relentless Republican ads of nonstop lies, anger, and racism have been brutal.

Please do all you can to lift the spirits of anyone you know who lives here in Wisconsin. Against all odds this one’s coming down to the wire. The right wing base of the Republican party has used immigration as a political wedge issue to deflect attention and to deflect media, airwaves, and media space from real issues.

While undoubtedly the Immigration Courts in Atlanta and Charlotte do reflect the type of biased, anti-immigrant approach pushed by GOP politicos, today they are run by Dem AG Merrick Garland. He has failed to make needed reforms and changes at the top, starting with inept leadership from EOIR Headquarters and a precedent setting appellate board (BIA) that does not reflect the best-qualified expert judicial talent available who would implement due process, fundamental fairness, consistency, and best judicial practices nationwide.   

Ironically, these values WERE once part of the “EOIR Vision,” abandoned and trashed by Administrations of both parties over the past two decades. For Dems who believe in the power of immigrants and immigrants’ tights, it’s now basically “Pogoland:” “We have met the enemy, and he is us.”

A number of the public comments in the articles also show gross misconceptions about the nature of migration, the goals of the GOP, the reasons why migrants can’t apply for asylum in a safe, orderly manner at ports of entry, the immense benefits to both the workforce and society brought by family-based immigrants and those seeking to enter as refugees and asylees, and the relationship between an improved economy and a sensible, robust, realistic approach to immigration (eschewed by the GOP; bobbled by the Dems).

Both parties have squandered opportunities to acknowledge truth, make the current system work better, and create order at the border. Neither has a serious plan for reform on its agenda. 

Unlike the Trump “shut the border/build the wall” racist fiasco, Biden’s initial US Citizenship Act of 2021 had some good ideas. But, after quickly “throwing it out there,” apparently as a sop to those who helped elect them, the Administration shoved it in a drawer and forgot about it. Instead, they pursued a mishmash of “built to fail gimmicks,” bureaucratic bungling, broken courts, poor legal positions, lack of vision, inept PR, and weak leadership.

The failure of the world’s leading “nation of immigrants” to discard and disavow the racist nonsense on immigration and come together on realistic, forward looking, generous, welcoming immigration policies makes our nation look bad and robs us of opportunities to improve the economy and build for the future.

The Dems once were the “party of practical problem solvers” — particularly at the local level with great organizations that effectively addressed issues on the minds of the local populace. After all, it was Dem House Speaker, the late Tip O’Neill, who famously said that “All politics is local” (although, perhaps contrary to popular notions, he did not “coin” that phrase.)

It’s not that today’s GOP solves problems. Far from it! Indeed they specialize in division, destruction (“the wrecking crew”), and making things worse. (How would you like to go to GOP Rep. MTG or Virginia GOP Gov. Glenn Youngkin to get help with mistreatment of your trans kid in school? Good luck with the one!)

Yet the GOP does excel in one area. That is channeling and fanning the rage, bitterness, and anger of folks in the community who feel left out or that “the system” has betrayed them. They are also great at using that collective anger and resentment for their own political ends — usually anti-democracy actions or picking on, demonizing, and falsely blaming vulnerable groups in society for all their ills.

Anand says it’s time for Dems to get back to communicating and problem solving: “outcompeting” and “outperforming,” if you will! That’s certainly true on a larger scale. But, it’s also true at Garland’s dysfunctional EOIR. There, bureaucratic nonsense, “built to fail gimmicks,” and false “deterrence rationale” have replaced scholarship, timeliness, and practical problem solving directed at the achievable, yet inexplicably elusive, “common good.” Time for a difference approach at the critical, yet often ignored, “retail level” of democracy!

House Minority Leader Kevin McCarthy (Calif.) and other Republicans have recently backed proposals to make the 2017 Trump tax cuts permanent, as well as to extend or expand several other corporate tax breaks.

Never mind that Americans think corporations already pay too little in taxes, according to many polls. Cutting taxes further is also likely to make inflation worse, for the same reason that Republicans argue that increased government spending can also make inflation worse: Giving people more cash to spend when there’s limited stuff to buy drives prices up.

The scariest part of the recently disclosed GOP economic agenda, however, has largely gone under the radar. It’s the plan to hold the debt ceiling hostage next year, which could easily precipitate a global financial catastrophe.

Republicans have withheld their support from raising the debt limit before, usually framing their hostage-taking as a commitment to fiscal restraint. But the debt ceiling has nothing to do with new spending; rather, it’s a somewhat arbitrary statutory cap on how much the government can borrow to pay off bills that it has already incurred, through tax and spending decisions that Congress has already made. Refusing to raise the debt limit is like going to a restaurant, ordering the lobster and a $500 bottle of wine, and then declaring yourself financially responsible because you skipped out on the check.

Actually, it’s worse than that.

Forcing a debt limit crisis, as the world teeters on the verge of recession, is the opposite of what you would pursue if you cared about strengthening the economy. But no matter: Just look at the context-free polls! Surely, under GOP stewardship, the economy will be in good hands.

“That, my fellow citizens, breaks the republic.”

This was the chilling conclusion of Liz Cheney today at the January 6 hearings over what would have happened if the guardrails of our democracy, exposed for their frailty in 2020, had buckled to an autocrat determined to hold onto power. And the danger remains. “Without accountability, it all becomes normal, and it will recur,” Cheney warned.

Cheney’s statement is striking in its simplicity and its power. Her audience is her “fellow citizens,” the ones who will be going to the polls in less than a month to decide who should lead this nation going forward. Her fellow Republicans have cast Cheney as a pariah for having the courage to state the truth: that their leader wanted to destroy America as we know it.

What the committee presented today shed a spotlight on the authorship of this historic tragedy. It is Trump who is the playwright, conjuring and casting the roles of those who would act out his destructive intentions. It was he who dreamt up and directed a frontal attack on American democracy. But he couldn’t have done it without his willing accomplices.

Today, we saw footage of members of Congress grappling in real time with a deteriorating situation on January 6 that could have ended with more bloodshed and the decimation of governmental order. We could feel a visceral fear in their actions and words, not only for their own personal safety but for the safety of the nation they had sworn an oath to serve. Those who could have intervened, starting with the president but including his top aides inside the White House, were absent. And that is just as the president wanted it. We heard today evidence that Trump knew he had lost, and he didn’t care what it would take to retain power.

This man who shamelessly pounds his chest with protestations of patriotism, who literally wraps himself in the American flag, who demonizes his political opponents as haters of America is really the one who views our imperfect experiment in self-governance with disgust. Elections. The rule of law. Peaceful transfers of power. The will of the people. These are the pillars of our nation’s foundation. But for Trump, that’s all just for suckers. He had the presidency, and he didn’t plan on relinquishing it, no matter what the voters or the Constitution said.

January 6 wasn’t an accident. It wasn’t a rally that spun out of control. It was a dangerous and violent storm threatening our nation’s core principles and our whole system of representative democracy. Stop and ponder that. Then remember that it should have been no surprise. The committee has made clear that the plan had been on the radar for weeks. There was plenty of evidence in advance that Trump and his cronies were planning to disregard the verdict of the election if it went against him.

But details and evidence uncovered since have been stunning, including documentary footage of longtime Trump loyalist Roger Stone played today. Here is what Stone had to say even before Election Day (excuse the language, please): “I say fuck the voting, let’s get right to the violence.” Was what we saw on January 6 a Plan B, or really a Plan A?

One of the great attributes of this committee is expert storytelling, laying out, with gripping detail, a narrative — a true story — about the attempted destruction of our democratic order. They have carefully traced the origins of this horror to before the election. They have shown the rising danger and threats of violence. They have identified villainy, led by the president. They have explained with breathtaking intimacy what took place on January 6. And they have made very clear that that day’s actions, while dramatic, were not a denouement. How this story ends is currently unknowable. We will have a better sense after the midterm elections and with the Department of Justice’s decision if, how, and whom to prosecute.

There is a lot about what we heard today, and in the previous hearings, that is infuriating. It also is hard not to feel a deep sadness about the precariousness of our democracy. But we can find hope in the service of this committee. They are saying to all of us, “This happened. Let us not let it happen again. And let us hold those responsible, accountable.”

They believe that most Americans cherish our self-governance, our stability, and our rule of law. They believe that if we know the truth, that we will do everything in our power, as a people, as a nation, to protect against its recurrence.

Does that belief still hold? Or are we now so divided that we can no longer be sure? This is the overriding question as our beloved America evolves in the first quarter of the 21st century.

When indisputable truth becomes a matter of partisan political “opinion,” we’re all in deep trouble!

The GOP’s cowardly failure to convict Trump twice despite overwhelming evidenced against him was despicable. But, it looks much worse in retrospect. Obviously, lack of accountability encourages the “Trumps of the world!”

Not the January 6th Committee, the Department of Justice, the New York State AG, or investigators down in Georgia.

No amount of scandal, indictments, whistle blowing, bombshells or leaks will make “MAGA” Republicans stay home, or change their minds.

We — I’m speaking to progressives, sane Republicans, independents, and everyone else who values democracy — need to hit the streets. Knocking on doors, dropping literature, waving campaign signs, phone banking, and talking to neighbors, friends, and relatives.

Time is running out to register to vote and to verify that your registration is still valid. (https://www.vote.org can help with both.) Once you are sure you are registered, make a game plan. Know your polling place! Know your options for early voting and voting by mail. Know what you need to vote (IDs, etc.). Make a fool proof game plan for election day.

And HELP OTHERS. Offer rides to polling places.

Border enforcement once again dominates contemporary immigration law debates. Yet many legal practices commonly linked to border control—including policing, relocation, and exclusion—actually have little to do with immigration enforcement. Instead, immigration control provides a justification for surveillance and the erosion of civil liberties deep inside the United States. For instance, the governor of Texas issued an executive order this June, asserting the legal authority to arrest people suspected of unlawfully crossing the border or committing “other violations of federal law.” This executive order is framed as being about expanding the pipeline to deportation and, in particular, shoring up federal efforts to promote border security. Yet the reach of the order goes well beyond issues relating to deportation. It raises the central questions: Who decides who appears to be present in the United States without lawful immigration status, and on what basis?

More recently, certain lawmakers have employed the rhetoric of border control to justify busing or flying migrants to locations inside the United States. Texas Governor Greg Abbott (R) tweeted at the time: “We’re sending migrants to [Vice President Kamala Harris’s] backyard to call on the Biden Administration to do its job & secure the border.” Florida Governor Ron DeSantis (R) employed similar rhetoric to justify sending approximately 50 adults and children to Martha’s Vineyard without any apparent prior notice. This relocation may have violated criminal laws. The individuals who were relocated may have been given false information to induce them to board planes. Lawmakers who frame these relocations as a means of border control make the unjustified assumption that the targeted individuals had no claims to remain in the United States. This approach not only ignores laws permitting people to seek asylum but also treats certain U.S. residents as lacking basic civil liberties inside the United States. When government officials claim the ability to lure people from one state to another on false pretenses, they also claim virtually unlimited power to intrude on individual liberty in stated service of immigration control.

In a variety of settings, ranging from politically motivated relocations of migrant communities to jailhouse immigration screenings, lawmakers present actions that curtail civil liberties as related to deportation. But a deportation-centric perspective, which centers whether and how certain practices might lead to removal, offers too limited a lens to understand the reach and impact of enforcement practices done in stated service of immigration control. It ignores the full costs of enforcement, including unjustified surveillance and policing. Rather than protecting the polity from a foreign threat, government actions purportedly aimed at immigration control undermine core liberties that ought to be protected within the American political community. If the ultimate aim of immigration law is to create an integrated political community, then we need to consider how law could operate to promote integration and inclusion, rather than treating all enforcement actions as a means to deportation.

This is why it’s such a disgraceful mistake for Garland and the Biden Administration to allow the racially-charged, anti-due-process travesty at EOIR to continue, largely unabated!  The misguided idea that migrants are not “real persons” under the Constitution — and to a large extent the related view that their lawyers aren’t entitled to the common professional treatment and courtesies extended in most other parts of our legal system — definitely has  “carryover” into the dehumanization of various categories of the “other” and ignoring the compelling evidence of abuse amassed by those lawyers working to keep the system honest.

For example, the Supreme’s dismissive treatment of women’s rights and humanity is definitely related to the degrading treatment of women’s claims in Immigration Court — an overt misogyny encouraged by Sessions, Miller, and their nativist acolytes!  That Democrats as a whole have failed to “pick up” on the serious attacks on equal justice and due process in Immigration Courts and their carryover effect to other parts of our legal system is a bad sign for the future of American democracy. Once a “person” is treated as “less than a full person” under the Constitution, there is no limit to who can become a “legal nonperson.”

🤮DREAMER DISASTER: America’s Future Hung Out To Dry By GOP Nativists In All Three Branches — From Ridiculous Legislative Roadblocks, To Mindless Executive Attacks, To Absurdist Righty Judges Who Ignore Established Law On Prosecutorial Discretion, Dreamers & American Society Suffer The Consequences Of 21st-Century Insurrectionist Republicanism!

Many immigration issues are divisive. Protecting dreamers is not. Virtually every poll conducted on the subject finds that Americans of all political persuasions favor granting dreamers some form of permanent legal status, including a path to citizenship. Even Trumpers are on board, surveys show. Faith groups, law enforcement officials, employers, national security experts and other major constituencies besides typical bleeding-heart immigration advocates have urged Congress repeatedly to grant these young immigrants greater legal certainty.

Unfortunately — as is the case on so many issues — Congress has abdicated its responsibility to act. Instead, the executive branch has been tasked with devising temporary workarounds.

In 2012, the Obama administration announced a sort of Band-Aid solution, known as the Deferred Action for Childhood Arrivals (DACA) program. DACA offers some of these young immigrants access to (temporary) work permits and protections from deportation, which must be frequently renewed. Eligibility extends only to those who meet certain age and educational requirements, have lived here continuously since 2007 and pose no threat to public safety, among other conditions.

This program was generally expected to be a stopgap while Congress worked on broader immigration reforms or at least a pathway to citizenship for dreamers; so far, neither has materialized.

[As DACA immigrant program turns 10, legal challenges persist]

In the decade since it was introduced, DACA has weathered multiple legal challenges — including from a coalition of red states led by Texas, as well as attempted repeal by President Donald Trump. For now, the program remains mostly intact while the red-state challenge wends its way through the courts. But DACA’s days look numbered.

This is hardly the only immigration issue on which Republican politicians have complained about executive overreach yet been reluctant to exercise their own powers. Other vulnerable, sympathetic populations of immigrants — such as the Afghan allies who were temporarily “paroled” into the United States — are stuck in their own legal limbo unless and until Congress acts.

But it’s always easier for politicians to grandstand over everyone else’s immigration policy choices than to produce solutions of their own.

How stupid and cruel is the GOP’s assault on Dreamers? It’s not like most “Dreamers” are going anywhere. After all, there are already about 2 million individuals (not to mention family members, employers, etc.) backed up on Garland’s dysfunctional Immigration Courts. And, under Garland’s misguided leadership, more judges are actually building more backlog!

But, without DACA’s work authorization, those not eligible for other forms of relief (e.g., asylum, cancellation of removal) will lose their authorization to work. Since many are in critical or essential jobs with employers who can’t afford to be out of compliance with Federal laws, it’s reasonable to assume that Dreamers would lose those jobs. That means that many will have to take lesser jobs in the substantial “underground economy” operating in the U.S., largely as a result of the GOP’s obstinance on sensible immigration policy.

If that appears stupid, it’s because it is! But, what else is new with the GOP’s cruel, xenophobic, and unrealistic approach to immigration.

It’s remarkable that out of touch righty judges on the 5th Circuit, whose jobs and existence actually depend on the systemic non-prosecution of most Federal offenses, would actually have the gall to issue their off the wall ruling dumping on Dreamers! In reality, by necessity, only a small number of violations of Federal statutes are prosecuted. See. e,g., https://prisonprofessors.com/federal-crimes-to-prosecute-or-not/.

How vigorously did the Trump Administration pursue violations of environmental laws, civil rights laws, tax laws, ethics laws, or white collar crime laws, etc? Not very! Indeed, to give one egregious example, under Sessions and Barr, the policy was to turn a “blind eye” to serious Constitutional violations by law enforcement! The Fifth Circuit’s “off the wall” apparent theory that Federal officials lack discretion to redirect prosecution resources toward the most serious offenders is pure “Federalist Society political poppycock!” It’s particularly out of bounds to critique the Feds for taking steps to insure that such discretion is exercised uniformly and reasonably, rather than arbitrarily and capriciously. 

I had lots of experience with “PD” programs over four decades in Federal service. The DACA program is far and away the premier “model” program for the effective and rational exercise of PD. 

The major impediment to the rational immigration law and policy adjustments America needs is today’s nativist-driven GOP. Unless and until enough American voters wise up and throw the GOP out at all levels, America will not achieve it’s full potential!

Migrant workers are flooding-in to help Florida rebuild after Hurricane Ian, even as Governor Ron DeSantis wages a crusade against them.

Three days after Hurricane Ian made landfall in Florida on Sept. 28 as a Category 4 storm, Johnny Aburto arrived in Port Charlotte, a mostly white community of 64,000, popular with retirees, on the state’s southwestern coast. The town suffered extensive damage during the storm: roofs blown off, homes flooded, power lines downed. There is a lot of work to be done.

Aburto, 42, is here to do it. Originally from Nicaragua, he is part of a large, informal, overwhelmingly immigrant workforce that travels the U.S. cleaning up after increasingly frequent climate-related disasters. Once a hurricane hits, these crews are bussed in by contractors desperate for workers, or they drive to the area themselves and wait in Walmart or Home Depot parking lots to be picked up for a day’s work. Aburto, a skilled laborer, was in New Orleans after Katrina in 2005, Baton Rouge after Louisiana’s floods in 2016, Panama City Beach after Michael in 2018, and Lake Charles after Laura in 2020. “These kinds of events really affect people,” he says. “We do our bit to help them.”

In Port Charlotte, Aburto is now busy covering roofs with tarpaulins—a crucial first step to keep homes safe from future rain, so that power can be restored and residents can come back. He’s also cleaning out soaked debris from interiors. When that kind of work is done, he says, many of his colleagues will stay on to make more permanent repairs.

Sadly, America has a long disreputable history of denying the humanity and rights of those whose labor and skills built our nation and made it great. African Americans,  Chinese-Americans, Mexican-Americans, Italian-Americans, Irish-Americans, Japanese-Americans, Filipino-Americans, Haitian-Americans, and many others have all felt the sting of racism, demonizing myths, dehumanization, exploitation, and grotesque ingratitude. 

I happen to be reading UVA Professor Amanda Frost’s outstanding book on “citizenship stripping.” I was struck by this quote about the exploitation of Mexican workers during the “Bracero Program” which was followed by “Operation Wetback” — the Eisenhower Administration’s totally illegal mass removal of Mexicans, including lawful immigrants and U.S. citizens!

It would be nice to think this time will be different — that we have advanced as a nation. But, I wouldn’t bank on it!

Floridians have a golden opportunity to replace DeSantis with a real Governor, Charlie Crist, who would serve all people, use government resources prudently, and govern in the public interest. Polls, however, say that such a “Florida epiphany” is unlikely. But, it’s still possible.

This WashPost article by and sets forth in detail how the courage and perserverance of asylum seekers, the humanity and initiative of the local community in Martha’s Vineyard, timely assistance by the Massachusetts Government, and heroic efforts by pro bono lawyers, came together  to  “redirect” the cruelty behind nativist GOP Govs’ idiotic political stunt.

Nearly two weeks later, though, Jose is one of dozens of migrants who now question Perla’s efforts to entice them onto a flight that unexpectedly ended on the wealthy island of Martha’s Vineyard — a political operation engineered by Florida Gov. Ron DeSantis (R) to gin up outrage over the United States’ border crisis.

Much remains unknown about the effort. While DeSantis has embraced his role in staging the flight, arguing that it protected Florida from “negative ramifications” of a border crossing surge, his office has been less clear about the purpose of nearly $1.6 million paid to a contractor, according to state records, and the role of state officials in developing the plan.

But Post interviews with several migrants directly recruited by Perla, as well as court documents and state records, paint a picture of a carefully orchestrated, taxpayer-funded operation with little apparent concern for the interests of the migrants caught in the middle. Florida officials began researching Texas’s migrant situation weeks before the flights, and a contractor with ties to the DeSantis administration later handled the efforts. Some migrants, meanwhile, say they were misled into signing documents after being lured into the trip with food and hotel stays.

Imagine what could be accomplished if Texas and Florida officials actually worked to HELP resettle individuals in an orderly and reasonable manner that recognized their humanity and respected and facilitated their legal rights to apply for asylum and other protections in the US? What if the Biden Administration actually brought in a team of qualified experts to lead and operate our existing refugee and asylum systems fairly and effectively instead of using stale approaches and personnel who simply lack the skills, vision, and courage to get the job done?

Fortunately, the asylum seekers, NGOs, and state and local officials, and ordinary citizens in welcoming American communities have stepped up to get the job done notwithstanding the glaring failures and counterproductive efforts of the previously-mentioned groups!

The preposterous attempt by DeSantis to link “sanctuary” with asylum seekers! Loosely speaking, “sanctuary jurisdictions” are those that have declined to voluntarily cooperate with certain ICE enforcement activities, primarily directed at so-called “civil” immigration enforcement. 

But, the Venezuelan asylum seekers “orbited” to Martha’s Vineyard had all been examined by DHS and released to pursue their legal requests for asylum in the US! Indeed, most probably turned themselves in to DHS Enforcement after being forced to cross illegally to present claims that the U.S. Government (with the connivence of GOP state Attorneys General and biased right wing Federal Judges) has refused to accept at legal ports of entry as they are supposed to do under our laws. 

These individuals are NOT “wanted” by ICE enforcement. There is no connection whatsoever between any “sanctuary jurisdiction’s” decision not to cooperate with ICE enforcement in rounding up certain individuals for possible deportation and legal asylum seekers from Venezuela (or any other country) pursuing their claims, beyond the fact that sanctuary jurisdictions value human dignity and are more welcoming to migrants of all types and statuses when called upon to provide assistance to them.

Venezuelan asylum seekers are part of the larger forced exodus of 6-7 million Venezuelans escaping the repression of the Maduro regime. 95% of these forced migrants have found refuge in countries OTHER than the U.S. Colombia is the largest destination country with at least 1.7 million Venezuelans, many times more than the U.S.

The vast majority of Venezuelans have found refugee in countries far poorer and less able to resettle them than the U.S. The idea that “sanctuary policies” of Martha’s Vineyard or any other U.S. jurisdiction is driving Venezuelan asylum seekers is beyond absurd. Indeed, it now appears that the Venezuelan asylum seekers “orbited” to Martha’s vineyard as part of the DeSantis scheme neither knew where it was nor had any idea they were being sent there until they were well on their way! 

Indeed, the decision to  send these individuals to an island with neither a DHS Office nor an Immigration Court (as opposed to, say, resettling them in Boston with advance notice), and with few “own site” pro bono lawyers, actually undermined their ability to comply with legal requirements and squandered resources that could and should have been put into getting timely and fair adjudications of their legal asylum applications. But, even in the face of GOP-led efforts to create maximum chaos, these legal asylum seekers and their supporters are committed to making our legal system work — against all odds!
