The “Open Border” Farce

In 2023, there were record contracts for private industry on the world’s deadliest land border.

This article is a collaboration between The Border Chronicle and TomDispatch, a great outlet which has been looking at U.S. foreign policy, the military industrial complex, the “forever wars,” climate change, and many other topics since 2001.

On September 23rd, at about 2:30 a.m., a Border Patrol surveillance camera captured two people crossing the international boundary between Mexico and the United States on the outskirts of Nogales, Arizona. A Border Patrol vehicle arrived quickly, but not before one of them had fled back into Mexico. When an armed agent stepped out, dressed in a forest-green uniform, he found a 16-year-old girl from Mexico softly crying, while holding her month-old baby swaddled in a blanket.

The agent commanded her to get in the vehicle. As they then drove to the Nogales Border Patrol station, the girl, he later reported, tried to speak to him in Spanish through the security partition that separated them. Her tiny daughter, she was telling him, was in distress. Cameras showed that the vehicle stopped for all of 10 seconds before continuing. The agent later claimed he couldn’t understand what she was saying and that he wanted to find a fluent Spanish speaker at the station. He didn’t realize, he insisted, that the infant was struggling to breathe, though the child soon died.

This hellish story of suffering at our border is but one of hundreds of similar tales of horror from 2023. They illustrate a fundamental truth about that border: it neither is, nor ever was, an “open” one in the Biden years, nor does the president faintly have an open-border policy, though prepare yourself to hear otherwise — over and over again — in Trumpublican campaign ads next year. They’ll repeat what party officials are already saying all too repetitively: that “President Biden’s radical open borders policies” have created “the worst border crisis in American history.” (While those are the exact words of House Oversight Committee chair James Comer, similar sentiments are already being offered by countless members of the GOP.)

Comer’s claim is, of course, no less predictable than the hardships migrants like that girl are suffering as they try to reach this country. While such border narratives traffic in the unreal, what is real either isn’t effectively reported or gets lost amid all the politically motivated noise. Loud fantasies are expansively covered, while life-and-death stories, like those of that infant and her mother, are seldom reported and, if they are, quickly disappear.

Barely a week before that 16 year old was desperately trying to communicate to the agent in Spanish, the United Nations International Organization for Migration (IOM) labeled the U.S.-Mexico border the world’s “deadliest migration land route.” In 2022, a record 853 remains of dead border crossers were recovered (and this is the U.S. Border Patrol’s figure, which is even higher than the IOM’s), dwarfing the record of 568 set the previous year. Such numbers, the IOM stresses, are known to be distinct undercounts, leaving all too many families pining for lost loved ones.

But those border fatalities weren’t the only record breaker. Another was confirmed just a week after medical personnel at the Nogales station rushed to treat that girl’s baby. The number of border contracts issued to private industry also set a new record. Like those deaths, such contracts soared in fiscal year 2023 to $9.96 billion, instantly stripping the previous high, also set last year, of $7.5 billion.

And mind you, those gifts to industry were made from the highest budget ever (including in the Trump years) for border and immigration enforcement: $29.8 billion. So, don’t for a second think that the U.S. has an “open” border.  In fact, it’s never been more fortified or — something few even bother to mention — more profitable, if you happen to be part of the border-industrial complex.

Maybe it’s because the victims are “only migrants, mostly people of color” and therefore not considered to be “real human beings” by some in the media; maybe it’s because getting the real story about the border requires intensive digging, intellectual expertise, and perhaps some danger; maybe it’s because editors are in search of alarmist “sky is falling” myths about the “border apocalypse” to attract readers, viewers, and “online hits;” maybe it’s because of a false belief that truth is “boring” and “doesn’t sell!”  

For whatever reason, the non-Fox networks (Fox is a primary purveyor of the “Big Lie” and the “Open Borders Fantasy”) and “mainstream media” do a really poor job on border reporting.

Those with even a passing familiarity with “talking heads” are no-doubt familiar with claims from nativist GOP politicos, righty reporters, and even some Dems about the mythical a “open borders!” None of these folks have recent experience helping asylum seekers trying to exercise their legal rights under domestic laws, international treaties, and our Constitution in a border system specifically designed to “discourage and deter” them, rather than identify and promptly grant the many legally sufficient claims for protection. 

By contrast, when is the last time you saw real experts — folks like Clinical Professor Steve Yale-Loehr, former Deputy UNHCR and Georgetown Law Dean Alex Aleinikoff, CGRS Director Karen Musalo, HRF Refugee Programs Director Eleanor Acer, UC Davis Law Dean Kevin Johnson, NIJC Executive Director Mary Meg McCarthy, Immigrant Defenders Executive Director Lindsay Toczylowski, Rep. Hillary Scholten (D-MI) or any of the other huge numbers of highly articulate, well-recognized, “hands on practical experts” on human rights and asylum appear on the “talking heads” to throw some truth and real light on this important, nearly totally misunderstood and intentionally misconstrued, issue that GOP nativists have thrust to the forefront of the 2024 campaign?

Meanwhile, Dems should NOT be “running away” from the realities and essential benefits provided by robust immigration and the cruel wastefulness and immorality of Trumps’s proposed neo-Nazi “crackdown” on all forms of migration (although, disgracefully, some Dems are doing exactly that, thus playing into the hands of GOP nativists for absolutely NO return).

Trump Goes To War Against Immigration and Immigrants – It’s Another Big 2024 Problem For Republicans – Here at Hopium we talk about how “Abortion and Treason” will make it very hard for Republicans to win in 2024. Former President Donald J. Trump is planning an extreme expansion of his first-term crackdown on immigration if he returns to power in 2025 — including preparing to round up undocumented people already in the United States on a vast scale and detain them in sprawling camps while they wait to be expelled.

The plans would sharply restrict both legal and illegal immigration in a multitude of ways.

Mr. Trump wants to revive his first-term border policies, including banning entry by people from certain Muslim-majority nations and reimposing a Covid 19-era policy of refusing asylum claims — though this time he would base that refusal on assertions that migrants carry other infectious diseases like tuberculosis.

He plans to scour the country for unauthorized immigrants and deport people by the millions per year.

To help speed mass deportations, Mr. Trump is preparing an enormous expansion of a form of removal that does not require due process hearings. To help Immigration and Customs Enforcement carry out sweeping raids, he plans to reassign other federal agents and deputize local police officers and National Guard soldiers voluntarily contributed by Republican-run states.

To ease the strain on ICE detention facilities, Mr. Trump wants to build huge camps to detain people while their cases are processed and they await deportation flights. And to get around any refusal by Congress to appropriate the necessary funds, Mr. Trump would redirect money in the military budget, as he did in his first term to spend more on a border wall than Congress had authorized.

In a public reference to his plans, Mr. Trump told a crowd in Iowa in September: “Following the Eisenhower model, we will carry out the largest domestic deportation operation in American history.” The reference was to a 1954 campaign to round up and expel Mexican immigrants that was named for an ethnic slur — “Operation Wetback.”

The constellation of Mr. Trump’s 2025 plans amounts to an assault on immigration on a scale unseen in modern American history. Millions of undocumented immigrants would be barred from the country or uprooted from it years or even decades after settling here.

Such a scale of planned removals would raise logistical, financial and diplomatic challenges and would be vigorously challenged in court. But there is no mistaking the breadth and ambition of the shift Mr. Trump is eyeing.

Despite being inhumane and jawdroppingly cruel, this plan is now a major political problem for an already struggling Republican Party for at least three main reasons:

Raids and Mass Deportations Are Deeply Unpopular – We have decades of polling on the forced removal of the 10m+ undocumented immigrants (almost all of whom are employed and pay taxes) in the US, and it is wildly unpopular, perhaps even more so than “abortion bans.” One example – in the 2016 exit polls, in the election that gave Trump the Presidency, the American people choose “offer legal status” to “deported to home country” 70%-25%. Republicans may have a slight advantage on immigration issue right now, but mass deportation is seen as an extreme position by the American people (rightly so). It was so unpopular that the anti-immigration movement dropped mass deportation as a goal, moving to the softer “attrition through enforcement,” or “self-deportation,” political strategy more than a decade ago.

Trump’s plan is another sign of how extremism and extremists have overtaken the party of Lincoln and Reagan.

As I document here, since 2005, when the national Republican Party began adopting a far harder line on immigration (Reagan, W. Bush and McCain were all immigration reformers), the 4 battleground states of the Southwest, AZ/CO/NM/NV, have drifted away from the Republican Party, becoming far bluer. In the last 2 elections we’ve seen the best Democratic performance in that region since the 1940s and 1950s, and a reminder that Biden got within 5 points of Trump in Texas in 2020. In the heavily Mexican-American parts of the country in particular raids and mass deportations are wildly unpopular.

It Was A Plan Like This That Caused The Big Hispanic Protests Across the US in 2006 – In 2005 the Republican House of Representatives bucked their President, George W. Bush, and passed a bill that called for the rounding up and mass deportation of the 11m undocumented immigrants in the country. It was the moment when the party of the Sun Belt and the West went from pro-immigration to deeply restrictionist. Over the next year huge protests against this bill and mass deportation erupted across the US, and Republicans became so spooked that we were able to pass a “comprehensive immigration reform” bill through a Republican Senate in 2006. That bill, like the 2013 immigration reform bill we passed through the Senate, was never taken up by the Republican House and it died.

But those protests did something important politically – after years of Republican gains with Hispanics under W. Bush, Hispanics ran back into the arms of Democrats in 2006 and they have essentially stayed there ever since. In the 2006 midterms Democrats won 69% of the Hispanic vote, among our best performances in recent decades.

In the four Presidential elections leading up to 2006 Democrats averaged 47% of the vote, and in 2004 we lost AZ/CO/NM/NV. In the four Presidential elections since 2006 Democrats have averaged 51% and in 2020 we won AZ/CO/NM/NV at the Presidential level for the first time since 1940. As the Hispanic population has grown across the US and in these states, our net vote margin with Hispanic voters keeps increasing, even if we lose a few points in vote share. As I show here, in 2004 the net Hispanic vote margin for Democrats was about 700,000 votes nationally, meaning we won 700,000 more Hispanic votes nationally than Republicans. In 2020 that number was at least 4.5m net votes across the US, with this same dynamic playing out in each state with large Hispanic populations (except Florida of course).

My instinct is that whatever advantage Republicans had on immigration, and whatever small gains they had made with Hispanic voters in recent years, is now gone.

This Plan Will Wreck The American Economy – In a time of existing wide scale worker shortages, removing 10-15m workers from the American economy in a short period of time would be national economic suicide, and will be seen that way by the business community in DC and in the battleground states. It’s just totally insane and extremist policy no matter how you look at it, and I think it could become as much of a drag on the GOP brand as abortion is now.

For a party which has lost the popular vote in 7 of the last 8 elections, lost the popular vote to Democrats 51%-46% over the past 4, lost the 2018/2019/2020/2022 and 2023 elections, has deep performance issues across the country even in red states since Dobbs, embracing mass deportations seems like a colossal political error.

It is another reason why I think our goal in 2024 should be not just to win, but to really go on offense, get to 55, and make this election an historic repudiation of the worst and most dangerous political party in our history. We can do this people!

It’s critical to remember that migrants aren’t the ONLY target of Trump’s neo-Nazism — they might not even be the primary ones! You can guarantee that many US citizens and lawfully present non-citizens of color will be caught up in the dragnet and sent off to deportation concentration camps where due process is non-existent. 

Others will simply avoid certain public places and activities for fear of being accosted. Still others will be forced underground because of fear of drawing attention to undocumented relatives or neighbors. Some U.S. citizens will fear voting, which indeed is a key part of the GOP plan to cement their “out of the mainstream” minority rule by suppressing suffrage! As those of us who adjudicated asylum claims know, many will fear reporting abuses or asserting rights to police who openly identify with their oppressors. Fear, despair, distrust, and resignation are key pillars of any authoritarian regime!

It’s attack on all people of color in America and those who might speak with an accent or dress differently from the GOP’s “White Christian Nationalist norms.” 

How many of us carry around documentation proving that our parents were U.S. citizens? Notably, although occupational status is often menioned on U.S. birth certificates, citizenship status is NOT. It’s not hard to guess who will be “required” to “document” their parents’ citizenship by Trump’s internal security police!

Trump and the GOP are an existential threat to U.S. democracy, human progress, and American leadership on the world stage. Don’t let them destroy OUR country and take away YOUR rights!

Former president Donald Trump denigrated his domestic opponents and critics during a Veterans Day speech Saturday, calling those on the other side of the aisle “vermin” and suggesting that they pose a greater threat to the United States than countries such as Russia, China or North Korea. That language is drawing rebuke from historians, who compared it to that of authoritarian leaders.

“We pledge to you that we will root out the communists, Marxists, fascists and the radical left thugs that live like vermin within the confines of our country that lie and steal and cheat on elections,” Trump said toward the end of his speech, repeating his false claims that the 2020 election was stolen. “They’ll do anything, whether legally or illegally, to destroy America and to destroy the American Dream.”

Trump went on further to state: “the threat from outside forces is far less sinister, dangerous and grave than the threat from within. Our threat is from within. Because if you have a capable, competent, smart, tough leader, Russia, China, North Korea, they’re not going to want to play with us.”

The former president’s speech in Claremont, N.H., echoed his message of vengeance and grievance, as he called himself a “very proud election denier” and decried his legal entanglements, once again attacking the judge in a New York civil trial and re-upping his attacks on special counsel Jack Smith. In the speech, Trump once again portrayed himself as a victim of a political system that is out to get him and his supporters.

Yet Trump’s use of the word “vermin” both in his speech and in a Truth Social post on Saturday drew particular backlash.

“The language is the language that dictators use to instill fear,” said Timothy Naftali, a senior research scholar at Columbia University’s School of International and Public Affairs. “When you dehumanize an opponent, you strip them of their constitutional rights to participate securely in a democracy because you’re saying they’re not human. That’s what dictators do.”

Ruth Ben-Ghiat, a historian at New York University, said in an email to The Washington Post that “calling people ‘vermin’ was used effectively by Hitler and Mussolini to dehumanize people and encourage their followers to engage in violence.”

“Trump is also using projection: note that he mentions all kinds of authoritarians ‘communists, Marxists, fascists and the radical left’ to set himself up as the deliverer of freedom,” Ben-Ghiat said. “Mussolini promised freedom to his people too and then declared dictatorship.”

In 1942, Adolf Hitler described Jews living in Germany as an “inferior race that multiplies like vermin.”

“The Nazis dehumanized the Jews. Nazi propaganda is replete with references to Jews as vermin, rats or parasites,” according to Harriet Over, a researcher in psychology at the University of York.

We are still creating [monsters]. We see it in … Russian attitudes toward Ukrainians, in Hindu Islamophobia, and in American racism against Black people,” psychologist David Livingstone, a professor at the University of New England in Maine, told EL PAÍS.

It wasn’t just Germany.

In 1909, a U.S. satirical magazine, Puck, published a cartoon that showed Uncle Sam as a pied piper leading a group of immigrants from Europe. The immigrants were rats. Sending them off: smiling, well-dressed White men.

Even so, it was only “page 2” news in today’s Post, apparently being of far less concern to her editors than the plans of Middle Eastern countries to “upend global sports!” Harkens back to 1936, when participating in Hitler’s “Aryan Showcase Olympics” was more important to the U.S. and other Western Democracies than protesting and condemning Hitler’s ongoing persecution of Jews!

There was a time in the not too distant past when use of racist, neo-Nazi language like Trump’s would have earned an immediate forceful condemnation from politicians across the political spectrum, from the media, and would have ended a candidacy. Now, it’s “just another day at the office.” Hate, lies, racism, and threats by a powerful national politician, a former President no less, cause barely a ripple in our national political dialogue. Not even front page news! Not covered at all by most “legitimate” news outlets! Yet the threat to our nation is real! Very real!

And, in case anyone still doubts the existential threat to American democracy and civilization itself posed by Trump and his anti-American followers, his “plans” include politicization of government, economic chaos, increasing global warming, and destabilization of the U.S. and world economies. Christian nationalism is a grave threat to the United States and the American republic. There should be no ambiguity or dullness when it comes to understanding what it is — no matter how benign it may present itself. It is what lurks beyond the veneer that is terrifying. There, the evil is revealed and manifested.

The dogma is a perversion of Christ’s teachings that is antithetical to Christianity. More importantly, Christian nationalism is utterly opposed to democracy. Theocrats despise the United States. God‘s laws are beyond the reach of the American state, and Christianity is but one religion in the beautiful mosaic of American faith.  It should always be noted that 600 generations of humans worshipped freely on the North American continent before the first European Christians came and killed them.

The US Constitution is the law of the land in the United States. Within it are the protections that safeguard our liberty. The freedoms of speech, dissent, conscience, worship and expression shall stand untroubled for as long as the great republic endures. We are within one calendar year of its possible end. We have arrived at a moment of grave crisis that cannot be ignored. The abyss that looked distant seven years ago is at hand.

Christian nationalism is incompatible with American democracy and pluralism. When political extremists take power in the name of God there is always death. Always.

The separation of church and state and religious freedom are profoundly important foundational achievements of the American republic. The extremists who seek power in God’s name are not benign men and women. They won’t be deterred by setbacks in Ohio and other places. Let’s call these giant detention and deportation camps what they are intended to be. These are concentration camps. Specifically, they are to be American concentration camps. Dachau was the Nazis’ first camp in Germany.

What will the first American camp look like? There will no doubt be a first, and it will likely be the first to house the political prisoners rounded up under Trump’s invocation of the Insurrection Act. He has promised to invoke it at the instant he returns to power.

Please understand this: Trump is announcing his intentions. He means it. He is surrounded by scores of “little Eichmanns” ready to help him achieve his aims. He should be taken literally and seriously at all times.

The Speaker of the House of Representatives Mike Johnson is second in line to the presidency. He rejects the greatest American idea in history, which is the separation of church and state. The greatest American invention — the peaceful transition of power — is utterly dependent on the separation of church and state in this country.

Johnson denied the 2020 election results, lied about the election results, created the conditions for the insurrection of January 6th, voted to disenfranchise millions of Black votes after the insurrection and continues to insist Trump won the election, despite the claim being a combination of fraud, malice and weapons-grade nuttery. The hostility to democracy is deeply rooted within his religious fanaticism, which is unique amongst the various strains of fanatical faith that have always found a home in America because of our nation’s unique faith protections.

We have churches where people pick up rattlesnakes and kiss them to prove they are protected by God. Proof of sin is a bite to the face and a painful death. Bo and Peep of Heaven’s Gate convinced their followers that they were headed to the Hale-Bopp comet, and Jim Jones took his flock to doom in Guyana. There are cults and fundamentalists all over America, but there is only one strain that wants to control your life by controlling the powers of the state to administer God’s law. They are the American Taliban.

Mike Johnson has invented his own distorted version of history as if the events of the late 1780s-90s occurred 6,000 years ago.

The American Constitution is clear about the founders’ intentions and their descendants’ actions to preserve and expand those intentions. There is no room for theocracy in the American system. While this might seem uniquely cruel, Abbott is closely following the authoritarian playbook of Viktor Orbán, Hungary’s prime minister, and current European thought leader for MAGA Republicans. Donald Trump calls Orbán a friend, and White supremacist Tucker Carlson spent a week covering him for his former show on Fox, later making a “documentary” about Hungary called Hungary vs. Soros: Fight for Civilization. For the last two years, the right-wing Conservative Political Action Conference, founded in the U.S., has held a “Woke Free Zone” conference in Budapest.

By studying Orbán’s crackdown on asylum seekers and its progression over the last several years, you can see exactly where Abbott’s Texas is headed (and DeSantis’s Florida, for that matter).

In a speech in July 2022, Orbán argued that European and non-European people should not mix. Europeans “do not want to become peoples of mixed-race,” he said. After the speech, one of Orbán’s longtime advisers quit in protest. “I don’t know how you didn’t notice that you were presenting a pure Nazi text worthy of Goebbels,” his adviser wrote in her public resignation letter. Orbán’s speech was widely condemned in Europe, and it further alienated him from other Western leaders.

But in Texas, just days after his speech “worthy of Goebbels,” Orbán was welcomed with a standing ovation at the CPAC conference in Dallas, where he touted his “zero migration” and Judeo-Christian nationalism. “The globalists can all go to hell,” he boasted. “I have come to Texas.”

On the same CPAC stage that day, Abbott followed with similar xenophobic talking points. He bragged about Operation Lone Star and encouraged conference-goers to donate to a state-run website to pay for bussing migrants out of Texas. Lieutenant Governor Dan Patrick echoed Orbán’s White Christian nationalism: “The framers did not write the Constitution,” he said. “God wrote the Constitution. We are a Christian nation.”

Unsurprisingly, Orbán’s cruel tactics against asylum seekers, which have included kidnappings and beatings, do not deter people from coming. They are fleeing wars, after all. But Orbán has used his poisonous populism to solidify his power, just as Abbott and DeSantis are trying to do. It began with asylum seekers in 2015, but now in Hungary there is no independent media or judiciary, and the LGBTQ community and immigrants have become targets for persecution as the prime minister has consolidated his control over the government. Antisemitism is also on the rise.

This is the playbook that MAGA Republicans are following in Texas, Florida, and elsewhere. We already know how it ends. Orbán’s “illiberal democracy,” which is being lionized by Trump, Abbott, and others, is nothing new. In fact, it’s very old. It’s called fascism.

Both parties have doubled down on inhumane border policies, but it’s the GOP that is taking it to new depths in its race to the bottom over who can be more deliberately cruel.

It’s like some kind of grotesque Last Supper: In a publicity photo from last week’s press conference, Texas governor Greg Abbott is seated at the center of a long table surrounded by grim-faced White men, most of them elderly, in various postures of mental agita. Next to them is a large illustration on an easel board titled “Live Test of Attempt to Breach.” It shows a man with an inner tube (presumably an asylum seeker) clinging to a floating red buoy. Hundreds of these buoys Abbott announced, will be deployed on the Rio Grande near the town of Eagle Pass. The barrier will be 1,000 feet long, and its netting will extend underwater, catching anyone who tries to swim under it.

“We don’t want anyone to get hurt,” said Steve McCraw, head of Texas’s Department of Public Safety, at the June 9 press conference. “We want to prevent people from drowning.”

The floating buoy barrier will persuade people not to cross, he said. “This is to deter them from even coming in the water.”

But we already know this isn’t true. Both McCraw and Abbott were parroting the same strategy, known as “prevention through deterrence,” introduced in the mid-1990s during the Clinton administration. It has turned our southern border into a graveyard. After nearly three decades of militarized border buildup that has pushed people into increasingly deadly terrain like the Sonoran Desert, people haven’t stopped coming. But thousands of them have died.

As Todd [Miller] recently wrote in his poignant piece about this deadly strategy, “On the cusp of summer, we can predict like clockwork that hundreds of otherwise healthy people will be dead by summer’s end. It has an aura of premeditated murder.”

These floating barriers, which, according to the manufacturer’s website, can also be reinforced with spikes, will only contribute to an already-skyrocketing death count. Abbott’s latest announcement has already spurred many human rights organizations to sound a warning. Jenn Budd, a former Border Patrol agent and now border human rights activist, along with fellow Texas-based activist Marianna Treviño Wright, released a bilingual video warning migrants of the deadly new policy.

All-in on Fascism

Abbott has long toyed with the idea of running for president. While it increasingly looks less likely that he will, Florida governor Ron DeSantis has already joined the fray. And he’s all-in on fascism. When he’s not treating fellow human beings like FedEx packages, he’s modeling himself after Viktor Orbán, Hungary’s authoritarian leader, and darling of the CPAC circuit. Last week DeSantis released “B-roll” of Florida state troopers surveying the Texas-Mexico border as they participate in Abbott’s Operation Lone Star. I suspect they didn’t include any audio in the B-roll because it would humanize the children and adults waving to the troopers from the Mexican side of the river, detracting from DeSantis’s threatening narrative of an invading army.

DeSantis’s campaign video begins with a Texas DPS officer, who sports an official DPS seal on his tactical face covering, unlocking a tiny metal door surrounded by razor wire. This is next-level border security theater, as comical as it is utterly surreal and tragic. Several other Republican-led states are also, once again, sending troopers and National Guard soldiers to the Texas border—as they did before the 2022 midterm—to wage war against the Biden White House before the election. Unfortunately, it’s border communities and migrants who are caught in the crossfire.

For many years, I’ve documented border theater as it has ebbed and flowed depending on the political tide. But as I’ve been documenting in The Border Chronicle, we’ve reached an altogether different and deadly era of disinformation, with the GOP parroting invasion and great replacement rhetoric, and increasingly dehumanizing people, spurring mass shootings and political violence. This behavior is championed by a growing right-wing media ecosystem which in turn promotes more anti-democratic and extremist behavior.

Yes, “deterrence gimmicks” directed at refugees have a decades-long proven record of failure. You can just look at the efforts of the EU to “bar the door” to refugees from Africa and the Middle
East. 

The boats continue to come, some sink, people drown. But, not surprisingly to those other than the “overprivileged and elitist White power class” like Abbott and DeSantis, desperate individuals forced from their homes are going continue to come — at any cost, even their own health, safety, and sometime lives. 

Most would rather “risk it all” on a shot — even a very long shot — at stability and a real life, rather than facing the certainty of wasting away without hope, freedom, or opportunity and having to watch the same thing happening to younger generations. Some, against all odds, continue to believe that rich, powerfu Western countries like the U.S. will eventually live up to their solemn legal obligations to protect refugees and asylum seekers!

While, as Melissa cogently points out, these inane, yet deadly, gimmicks do kill migrants, they don’t do so at a high enough rate to materially affect the flow. It’s just causing pain, suffering, and sometimes death for their own perverted sake.

Apparently, neo-fascists like Abbott, DeSantis, Trump, and their “role model” Stephen Miller just “get off on” watching others suffer unnecessarily. Bullies and cowards often get a kick out of observing the effects of their handiwork.

Meanwhile, the public money being wasted on these cruel, yet ultimately ineffective stunts (remember former AZ Gov. Ducey’s shipping containers arrayed and then disassembled at government expense), could much, much better be spent on providing representation, organized resettlement, and humanitarian assistance to asylum seekers.

As Melissa says, the GOP’s (and sometimes, unfortunately the Dems’) “uber-enforcement/deterrence gimmicks are “as comical as [they are] utterly surreal and tragic.” It’s time for decent Americans to “just say no” to these horrible folks and their failed and deadly policies of dehumanization and degradation!

Executive Director Opening Plenary Remarks CLINIC Convening 2023

Good afternoon, dear friends. My name is Anna Gallagher and I have the honor of leading CLINIC as executive director. It is such a pleasure to be here with you all as we officially begin our first in-person Convening since 2019.

Looking out at the sea of faces in front of me, I am filled with gratitude to finally be able to come together to engage with one another, to listen, learn and gather strength for the work ahead in support of our immigrant brothers and sisters.

Even just being in your presence I feel a sense of renewed hope and energy. I am so looking forward to the next few days, and I am certain that you will be reignited to take on the important work ahead.

In a moment I will welcome our wonderful panel of Affiliate experts, but right now I want to take a moment to recognize this moment we’re facing and my hopes for this year’s CLINIC Convening.

You all, of all people, know that immigrant communities are facing truly unprecedented challenges – and I do not use that word, unprecedented, lightly.

With the lifting of Title 42, and the camps of men, women and children along the border desperate to find welcome on the other side; the proposed USCIS fee increases which threaten to put immigration benefits out of reach for many; the newly announced delays for foreign-born religious workers and special immigrant juveniles; and, perhaps above all, our warming planet and the outbreaks of violence which force many more people to migrate around the world – these are extremely challenging times for migrants in our country and around the world.

Several months ago, the New York Times featured an op-ed that has stuck with me, entitled, “The Rich World Has a Shockingly High Tolerance for Cruelty.”

It was about how rich nations are more willing than ever to let migrants languish at their borders in sub-human conditions rather than create safe pathways for migration or address the conditions causing people to flee.

It was about how the promises that nations made after World War II to respect the dignity and rights of those who are fleeing have been eroded and now, on a practical level, forgotten.

When I read this article, in my mind I was transported back to the time I spent in North Africa several years ago, working with migrants as a representative of Jesuit Refugee Services.

I interviewed migrants who had traveled for 18 months or more to try and find safety in these countries bordering Europe. I got to know some of the migrants, who called me “grandma” – a term of endearment, as my hair was grey.

While I was talking to some of them, they showed me their hands, which were scarred with wounds. When I asked them what happened, they said their hands were repeatedly pierced while climbing barbed wire to get through to safety.

Hearing this, my heart broke – as it has many times over the years.

The idea that we are using barbed wire to keep out our fellow human beings is inconceivable, yet true. Our immigrant brothers and sisters stand at our gates, begging for our aid, and we build barbed wire fences that pierce their hands.

Many wealthy nations are founded on a concept of all human beings being equal in dignity, but we do not act like it.

As we gather in Arizona, I know we are all mindful that these kinds of camps that the op-ed author is speaking of are just several hours away on the border. We also know that immigrant communities’ dignity is denied not only in these camps, but all over the country in the various places we’ve come from.

We must be clear, this is not an “other side of the world problem,” it is our problem. It affects all of us, in our integrity as people of faith and conscience, and as a reflection of our society.

And yet today, as I recall that New York Times op-ed, and the sense of frustration and despair I felt while reading it, I feel a surge of hope.

I want you to look around the room. Look at your neighbor to your left and right. YOU are the hope that fills my heart, and YOU are the hope that reignites me in our work.

As we gather here today, I am in a room full of people who DO act like all human beings are equal. Those who spend their precious time – often too much of their time, working long hours – trying to advance the truth that every person is precious, valuable, and deserving of a safe and dignified life.

That’s why being in your presence gives me such hope. I am reminded that the CLINIC network is full of holy people.

That is why our gathering here together, and throughout this week, is so powerful: we are, to borrow the words of Bishop Seitz of El Paso, working to be a “creative counterexample” to the culture of fear and hostility, to be a network that is slowly creating a new culture of solidarity and hospitality.

At CLINIC, we also are bolstered by our faith that we do not do this hard work alone. The spirit of God is inspiring us and pushing us forward, giving us strength and magnifying our efforts, especially when we are overwhelmed by the need in front of us.

Our faith also acts as a mirror for us, forcing us to keep evaluating whether we are truly reflecting the gospel truth of God’s concern for all people.

To maintain this faith, and to maintain the energy to be this creative counterexample, we need one another. Our network is sustained through the support, advice, and solidarity we demonstrate to one another.

Throughout the next few days, we will take the time to step back, to reflect on our work and learn and share new strategies, information, and tips for the very practical day-to-day work of supporting immigrant clients and communities.

We know that this practical work – the forms, the bureaucracy, the nitty-gritty details – changes and saves lives. So how well we can do it matters, which is why we gather to learn and grow.

We also gather to enjoy one another – to laugh, share stories, and reconnect with beloved colleagues and friends.

So I also hope that over the next few days you will have some fun!

Colfax Massacre
“Gathering the dead after the Colfax massacre, published in Harper’s Weekly, May 10, 1873” — White Nationalist snowflakes like DeSantis feel diminished and threatened by the truth about American history and the role of race.                                                                  

The “anti-woke agenda” touted by DeSantis is a very thinly disguised euphemism for “overtly racist!” That, decades after folks like Gov. George Wallace and Sen. The Dems once were the “party of practical problem solvers” — particularly at the local level with great organizations that effectively addressed issues on the minds of the local populace. After all, it was Dem House Speaker, the late Tip O’Neill, who famously said that “All politics is local” (although, perhaps contrary to popular notions, he did not “coin” that phrase.)

It’s not that today’s GOP solves problems. Far from it! Indeed they specialize in division, destruction (“the wrecking crew”), and making things worse. (How would you like to go to GOP Rep. MTG or Virginia GOP Gov. Glenn Youngkin to get help with mistreatment of your trans kid in school? Good luck with the one!)

Yet the GOP does excel in one area. That is channeling and fanning the rage, bitterness, and anger of folks in the community who feel left out or that “the system” has betrayed them. They are also great at using that collective anger and resentment for their own political ends — usually anti-democracy actions or picking on, demonizing, and falsely blaming vulnerable groups in society for all their ills.

Anand says it’s time for Dems to get back to communicating and problem solving: “outcompeting” and “outperforming,” if you will! That’s certainly true on a larger scale. But, it’s also true at Garland’s dysfunctional EOIR. There, bureaucratic nonsense, “built to fail gimmicks,” and false “deterrence rationale” have replaced scholarship, timeliness, and practical problem solving directed at the achievable, yet inexplicably elusive, “common good.” Time for a difference approach at the critical, yet often ignored, “retail level” of democracy!

The very first chapter of Grant’s book is “Race and Democracy,” in which he contends that democracy is a threat to Nordic supremacy, because democracy leads inevitably to greater immigration and equality between races.

In fascist ideology, true national consciousness is pitted against domestic “enemies,” who are against national forms that are racially, ethnically or religiously homogeneous. These domestic “enemies” are invariably institutions and individuals who champion democracy and its ideals.

The Indian nationalist ideologue M.S. Golwalkar, the ideological founding father of BJP, the right-wing Hindu party of Narendra Modi, argued against the idea that a nation was composed of all of its inhabitants and rejected the idea that every citizen of India had equal rights to freedom. Like Grant, Golwalkar regarded democratic ideals as a clear threat to his vision of the nation.

If enemies are people who either look, think or behave differently, and if their mere existence poses a threat to the imagined homogeneity of the nation, it is not surprising that the most radicalized believer would carry out mass murders, as has happened in the U.S., Europe and New Zealand, and pogroms as in India.

And, of course, we see it in Russia’s invasion of Ukraine. Ideas of replacement are central to Russian extremist, nationalist, antisemitic and fascist traditions. They motivate the nature of its attack in Ukraine, such as wiping out Ukrainian identity culturally and physically. Vladimir Putin also considers liberal democracy as an existential threat to Russian cultural greatness, and by extension, to the Russian nation.

The link between WRT and fascism is not accidental. WRT is a relatively recent label for old fascism. In terms of propaganda, it is a rebranding of the same thing, namely longstanding fascist paranoias and lies about invasion and racial and political replacement. WRT’s logic justifies mass violence. When it is normalized, it poses an existential threat to democracy and its ideals. It targets the very idea of common humanity that underlies them.

  The lie outlasts the liar. 

The idea that Germany lost the First World War in 1918 because of a Jewish “stab in the back” was 15 years old when Hitler came to power. How will Trump’s myth of victimhood function in American life 15 years from now? And to whose benefit?

On Jan. 7, Trump called for a peaceful transition of power, implicitly conceding that his putsch had failed. Even then, though, he repeated and even amplified his electoral fiction: It was now a sacred cause for which people had sacrificed. Trump’s imagined stab in the back will live on chiefly thanks to its endorsement by members of Congress. In November and December 2020, Republicans repeated it, giving it a life it would not otherwise have had. In retrospect, it now seems as though the last shaky compromise between the gamers and the breakers was the idea that Trump should have every chance to prove that wrong had been done to him. That position implicitly endorsed the big lie for Trump supporters who were inclined to believe it. It failed to restrain Trump, whose big lie only grew bigger.

The breakers and the gamers then saw a different world ahead, where the big lie was either a treasure to be had or a danger to be avoided. The breakers had no choice but to rush to be first to claim to believe in it. Because the breakers Josh Hawley and Ted Cruz must compete to claim the brimstone and bile, the gamers were forced to reveal their own hand, and the division within the Republican coalition became visible on Jan. 6. The invasion of the Capitol only reinforced this division. To be sure, a few senators withdrew their objections, but Cruz and Hawley moved forward anyway, along with six other senators. More than 100 representatives doubled down on the big lie. Some, like Matt Gaetz, even added their own flourishes, such as the claim that the mob was led not by Trump’s supporters but by his opponents.

Trump is, for now, the martyr in chief, the high priest of the big lie. He is the leader of the breakers, at least in the minds of his supporters. By now, the gamers do not want Trump around. Discredited in his last weeks, he is useless; shorn of the obligations of the presidency, he will become embarrassing again, much as he was in 2015. Unable to provide cover for their gamesmanship, he will be irrelevant to their daily purposes. But the breakers have an even stronger reason to see Trump disappear: It is impossible to inherit from someone who is still around. Seizing Trump’s big lie might appear to be a gesture of support. In fact it expresses a wish for his political death. Transforming the myth from one about Trump to one about the nation will be easier when he is out of the way.

As Cruz and Hawley may learn, to tell the big lie is to be owned by it. Just because you have sold your soul does not mean that you have driven a hard bargain. Hawley shies from no level of hypocrisy; the son of a banker, educated at Stanford University and Yale Law School, he denounces elites. Insofar as Cruz was thought to have a principle, it was that of states’ rights, which Trump’s calls to action brazenly violated. A joint statement Cruz issued about the senators’ challenge to the vote nicely captured the post-truth aspect of the whole: It never alleged that there was fraud, only that there were allegations of fraud. Allegations of allegations, allegations all the way down.

The big lie requires commitment. When Republican gamers do not exhibit enough of that, Republican breakers call them “RINOs”: Republicans in name only. This term once suggested a lack of ideological commitment. It now means an unwillingness to throw away an election. The gamers, in response, close ranks around the Constitution and speak of principles and traditions. The breakers must all know (with the possible exception of the Alabama senator Tommy Tuberville) that they are participating in a sham, but they will have an audience of tens of millions who do not.

If Trump remains present in American political life, he will surely repeat his big lie incessantly. Hawley and Cruz and the other breakers share responsibility for where this leads. Cruz and Hawley seem to be running for president. Yet what does it mean to be a candidate for office and denounce voting? If you claim that the other side has cheated, and your supporters believe you, they will expect you to cheat yourself. By defending Trump’s big lie on Jan. 6, they set a precedent: A Republican presidential candidate who loses an election should be appointed anyway by Congress. Republicans in the future, at least breaker candidates for president, will presumably have a Plan A, to win and win, and a Plan B, to lose and win. No fraud is necessary; only allegations that there are allegations of fraud. Truth is to be replaced by spectacle, facts by faith.

Trump’s coup attempt of 2020-21, like other failed coup attempts, is a warning for those who care about the rule of law and a lesson for those who do not. His pre-fascism revealed a possibility for American politics. For a coup to work in 2024, the breakers will require something that Trump never quite had: an angry minority, organized for nationwide violence, ready to add intimidation to an election. Four years of amplifying a big lie just might get them this. To claim that the other side stole an election is to promise to steal one yourself. It is also to claim that the other side deserves to be punished.

Informed observers inside and outside government agree that right-wing white supremacism is the greatest terrorist threat to the United States. Gun sales in 2020 hit an astonishing high. History shows that political violence follows when prominent leaders of major political parties openly embrace paranoia.

Our big lie is typically American, wrapped in our odd electoral system, depending upon our particular traditions of racism. Yet our big lie is also structurally fascist, with its extreme mendacity, its conspiratorial thinking, its reversal of perpetrators and victims and its implication that the world is divided into us and them. To keep it going for four years courts terrorism and assassination.

When that violence comes, the breakers will have to react. If they embrace it, they become the fascist faction. The Republican Party will be divided, at least for a time. One can of course imagine a dismal reunification: A breaker candidate loses a narrow presidential election in November 2024 and cries fraud, the Republicans win both houses of Congress and rioters in the street, educated by four years of the big lie, demand what they see as justice. Would the gamers stand on principle if those were the circumstances of Jan. 6, 2025?

To be sure, this moment is also a chance. It is possible that a divided Republican Party might better serve American democracy; that the gamers, separated from the breakers, might start to think of policy as a way to win elections. It is very likely that the Biden-Harris administration will have an easier first few months than expected; perhaps obstructionism will give way, at least among a few Republicans and for a short time, to a moment of self-questioning. Politicians who want Trumpism to end have a simple way forward: Tell the truth about the election.

America will not survive the big lie just because a liar is separated from power. It will need a thoughtful repluralization of media and a commitment to facts as a public good. The racism structured into every aspect of the coup attempt is a call to heed our own history. Serious attention to the past helps us to see risks but also suggests future possibility. We cannot be a democratic republic if we tell lies about race, big or small. We cannot be a democratic republic if we tell lies about race, big or small. Democracy is not about minimizing the vote nor ignoring it, neither a matter of gaming nor of breaking a system, but of accepting the equality of others, heeding their voices and counting their votes.

I still hear GOP politicos falsely claim that “nobody could see this coming.” What total unadulterated BS! 💩 Trump planned and instigated this insurrection of thugs in public, even while his goons Cruz, Hawley, and McCarthy were actively promoting it in Congress and Moscow Mitch was more or less “in his shell” looking the other way. A plague was the check and balance, not the rule of law, not civility. Trump and Republicans showed hubris in the face of a force of nature that cannot be gaslit, bullied, or emotionally manipulated. A virus demands you engage with it truthfully. You can’t bluster your way out of infection. Trump’s lies and arrogance regarding Covid-19 have cost 210,000 Americans their lives. Those lies and arrogance have finally caught up with him, and he may pay a heavy price. Some people think that’s poetic justice. They are being rebuked by those who think you should never be that callous, not even to a fascist.

Fascists know how to weaponize the norms governing civility to gain and maintain control over others. They know how to exploit sympathy. They know if they pretend to play nice sometimes, people believe they’ll begin to adhere to these norms and stop their harm. It’s a con. It works, though. That’s why four years into the Trump regime, reporters and pundits are still, embarrassingly, talking about his change of tone and his becoming more “presidential” any time he displays the barest modicum of decorum. This dynamic lowers the bar all the way down to Hell. Playing along is always the wrong move.

Just look at yesterday’s Courtside posting — kids and legal refugees continue to suffer while Sessions collects his pension, Hamilton continues to plan criminal enterprises on our dollar, and Rosenstein racks up the big bucks pretending like his venture into child abuse and crimes against humanity were just “normal activities of a senior Government official at the DOJ.” Not normal! Not acceptable!

History tells us what happens to those who “play along to get along.” The U.S. Olympic Committee turning an intentionally blind eye to Hitler’s virulent anti-Semitism so that the U.S. could participate in “Hitler’s Big Show” — the 1936 Olympics. British Prime Minister Neville Chamberlain selling out the Czechs, babbling about “peace in our time” on the eve of the bloodiest war in world history, and pretending that Hitler was “just another German politician” with “traditional” nationalist aspirations.

This Fall, vote Trump and the GOP out at all levels of Government. It might be the last chance to save our democracy from fascism and to save more lives from the malfeasance, ignorance, hate, and evil of Trump and his GOP enablers.

Attorney General William P. Barr delivered a scathing critique of his own Justice Department Wednesday night, insisting on his absolute authority to overrule career staff, whom he said too often injected themselves into politics and went “headhunting” for high profile targets.

Speaking at an event hosted by Hillsdale College, a school with deep ties to conservative politics, Barr directly addressed the criticism that has been building for months inside the department toward his heavy hand in politically sensitive cases, particularly those involving associates of President Trump.

“What exactly am I interfering with?” he asked. “Under the law, all prosecutorial power is invested in the attorney general.”

Barr’s comments were remarkable, in that the head of the Justice Department catalogued all of the ways in which he thought his agency had gone astray over the years, and in its current formulation harms the body politic. Barr has drawn considerable criticism for intervening in criminal cases in ways that help benefit the president’s friends.

Barr said it was he, not career officials, who have the ultimate authority to decide how cases should be handled, and derided less-experienced, less-senior bureaucrats who current and former prosecutors have long insisted should be left to handle their cases free from interference from political appointees.

Barr said that argument, in essence, means “the will of the most junior member of the organization” would make decisions, but he insisted he would not “blindly” defer to “whatever those subordinates want to do.”

“Letting the most junior members set the agenda might be a good philosophy for a Montessori preschool, but it is no way to run a federal agency,” Barr said.

The attorney general, the nation’s top law enforcement official, spent much of the speech eviscerating the idea of the Justice Department as a place where nonpolitical career prosecutors should be left to decide how sensitive cases are resolved.

I’m sure this does wonders for morale at the DOJ! But, demoralizing all the career lawyers and pushing them out the door appears to be part of the program. After all, the regime initially tried to “buy out” the holdover members of the BIA. Morale at the Immigration “Courts” is already at an all-time low!

Career civil servants at the DOJ and elsewhere actually work for the people of the U.S., not personally for Billy, other political appointees, or the President. Government employees take an oath to uphold the Constitution, not of loyalty to the President, the AG, or any other political official. 

Billy clearly has been running the Immigration “Courts” as a politically weaponized part of the regime’s White Nationalist, authoritarian, race-driven immigration enforcement agenda. Funny how long it has taken the overall legal community to see that Barr basically considers the entire legal system, including the Article III Courts, as just as subservient as the Immigration “Courts.” And, to date, the Supremes have done little to discourage that view.

So where does Trump’s administration stand as he is nominated for a second term? He earned 47 of a possible 76 Benitos, or 62 percent. He remains the greatest threat to American democracy since the Civil War, but his exercise of power only partly resembles that of real fascists. He still faces checks and balances in Washington. He hasn’t shut down rival parties or uncompliant media.

He has not directed the armed might of the state against citizens on anything like the scale used by Mussolini, let alone Hitler. He does not have his own obedient “squadristi” eager to beat up foes, even if plenty of his followers advocate (and sometimes indulge in) violence against minorities and Trump’s opponents. He has not arranged the murder of prominent political opponents. The cult of violence is integral to fascism but far less central to Trump. He is not ruling like a genuine fascist.

But he has shown pronounced fascistic leanings. In the right circumstances — a crisis he could manage triumphantly, a more sympathetic military — perhaps he would try to extend his rule beyond whatever the voters allow him and convert the United States into a repressive, racist dictatorship. Or perhaps stage phony elections that hand the reins to Ivanka and Jared. At least a few members of Congress would probably support him, just as many parliamentarians voted to give Mussolini and Hitler emergency powers. Those lawmakers did not know at the time just where fascism might lead. We have a clearer idea.

I get that Trump’s maliciousness is somewhat tempered by his overall incompetence. 

But, with due respect to Professor McNeill, I think he presents a “upper class intellectual” view of Trump’s vileness and danger on the “fascism scale.” His pre-existing privilege have largely shielded him, and likely his family and most of his associates, from the true effects of Trump’s White Nationalist fascism. 

However, I think that African Americans who have had family members and friends killed or seriously harmed by police, only to be mocked, threatened, and disenfranchised by the Prez; children and families separated forever; kids and asylum applicants jailed in life-threatening conditions; refugees and other family members stranded forever abroad; lawyers and advocates who risk their health and safety every day to defend the most vulnerable among us; the ghosts of those who have died of COVID-19 in detention; those with family members needlessly lost to COVID-19; ethnic communities who have been terrorized by DHS and who have seen a sharply diminished ability to seek protection from crimes; Asian Americans who have victimized by hate crimes; those who have lost health insurance coverage, jobs, and shelter; Muslims scapegoated for others’ crimes; transgender youth driven to depression and suicide by government endorsed harassment and denial of basic human rights; and a host of others living below McNeill’s radar screen might disagree with his “failed” analysis.

Also, like many academics and intellectuals shielded by the Ivory Tower, McNeill vastly overestimates the effect of “checks and balances.” In fact, Trump has been able to rule lawlessly, if incompetently, without meaningful participation of Congress and with little effective pushback from the Federal Courts. 

He’s made mincemeat of the few in the Executive Branch with the guts and integrity to oppose him, without engendering meaningful and anything approaching effective reactions from the other two Branches. His own party has publicly and fully turned against American democracy and the rights, well being, and humanity of the rest (e.g., the majority) of us. That’s pretty effective fascism in my book, even considering the less than competent implementation.

It’s a mark of just how ineffectual our system of “checks and balances” has been that we are, as a nation, without a functioning immigration system; without functioning Immigration Courts; without a national plan or rational response to a dangerous pandemic; without a plan to protect our precious franchise or to insure safe, free, and fair elections this fall; with a failing postal system that has been politicized; without a plan to address the threat of global warning and, indeed, doing everything in our power to make it worse!

This is not “failed fascism!” Rather it is a fascist state run by malicious incompetents and headed by a  leader without the attention span, intellectual capacity, or ability to fully develop any intellectual doctrine and implement its full range of destruction. But, that only slightly diminishes his danger to our body politic!

That Trump dares to put forth outrageous ideas like not leaving office following defeat, barring U.S. citizens from re-entering their country, sending police to polling stations, and questioning the citizenship of  Kamala Harris shows just how feckless our democratic institutions have been in the face of tyranny and how misguided it is to understate Trump’s fascism.

With his overtly outrageous program of “Dred Scottification” of “the other” — largely and embarrassingly embraced by a Supremes’ majority — Trump has moved our nation as far away from “equal justice for all” as we have been in the supposed “post-Jim-Crow” era!

To rely on the “beneficial effects” of incompetence on malicious would-be fascism is a fool’s errand that could cost us dearly. Indeed, until it was too late, the leaders of Western Democracies rather consistently overplayed the cartoonish characteristics of Hitler’s and Mussolini’s “pseudo-super-macho” personalities and underplayed the potential destructive capacity of their fascism, whether “failed” or not. The threat is real and this is likely to be our last clear chance as a nation to save our democracy!

This November, vote like your life and the future of the world depend on it! Because they do!
