Another day, another extreme cruelty: according to a report in the New York Times, the Trump administration has deported almost 1,000 migrant children and teens during the past two months of the covid-19 pandemic, sending them out of the United States alone and at times putting them on a flight without even telling their family members. Stephen Miller, who is unfortunately still alive, must be thrilled.

Trump’s latest tactic in the service of slashing immigration is, as the New York Times points out, a complete 180 from past policy:

The deportations represent an extraordinary shift in policy that has been unfolding in recent weeks on the southwestern border, under which safeguards that have for decades been granted to migrant children by both Democratic and Republican administrations appear to have been abandoned.

Historically, young migrants who showed up at the border without adult guardians were provided with shelter, education, medical care and a lengthy administrative process that allowed them to make a case for staying in the United States. Those who were eventually deported were sent home only after arrangements had been made to assure they had a safe place to return to.

But now, not even children who are already in the United States with pending asylum cases are safe from deportation. As the Times reported, in addition to the more than 900 children and teens who were deported in March and April shortly after arriving at the border, 60 young people who were already being held in government shelters were also abruptly sent out of the United States, at times “rousted from their beds in the middle of the night.”

According to the Times, even young children have been put on flights by themselves. Take the case of Sandra Rodríguez and her 10-year-old son Gerson, whom she sent across the southern border with the expectation that once Gerson arrived in the United States, he would be able to eventually live with Rodríguez’s brother in Houston. But instead, shortly after entering the U.S., Gerson was sent to Honduras alone.

This incredibly callous treatment of young migrants as well as their families is part of the Trump administration’s attempt to erase any vestige of due process at the border with Mexico. Citing the pandemic, immigration officials have used provisions in the 1944 Public Health Act as justification to essentially close the United States to all asylum seekers who cross the border. The impact has been severe: In an almost two-month period from mid-March to May, only two people seeking protection on humanitarian grounds at the border were allowed to stay within the United States.

“What is happening at the border right now is a tragedy. We are abandoning our legal commitment to provide asylum to people whose lives are in danger in other countries,” Kari Hong, an immigration attorney and Boston College law school professor, told the Washington Post. “By invoking these emergency orders, the Trump administration is simply doing what it’s wanted to do all along, which is to end asylum law in its entirety,” she said.

While Trump administration officials have justified their likely illegal use of emergency orders in the name of public health, the fact that officials have also deported children and teens who were already in the care of the federal government sure indicates that something else is going on here. I wonder what that could be.

For more than a month, under the guise of fighting the coronavirus, the Trump administration has used the nation’s public health laws as a pretext for summarily deporting refugees and children at the border.

This new border policy runs roughshod over legal rights, distracts from meaningful measures to prevent spread of the coronavirus and undermines confidence in the Centers for Disease Control and Prevention, the nation’s top health protection agency, which delivered the directive that imposes these deportations.

The administration has weaponized an arcane provision of a quarantine law first enacted in 1893 and revised in 1944 to order the blanket deportation of asylum-seekers and unaccompanied minors at the Mexican border without any testing or finding of disease or contagion. Legal rights to hearings, appeals, asylum screening and the child-specific procedures are all ignored.

More than 20,000 people have been deported under the order, including at least 400 children in just the first few weeks, according to the administration and news reports. Though the order was justified as a short-term emergency measure, the indiscriminate deportations continue unchecked and the authorization has been extended and is subject to continued renewal.

The deportation policy was issued by the C.D.C. based on an unprecedented interpretation of the public health laws. The policy bears the unmistakable markings of a White House strategy imposed on the C.D.C. and designed to circumvent prior court rulings to achieve the administration’s political goals.

The Border Patrol is carrying out the C.D.C. directive by “expulsion” of anyone who arrives at U.S. land borders without valid documents or crosses the border illegally, not because they are contagious or sick but because they come from Mexico or Canada, regardless of their country of origin. The deportations violate the legal right to apply for asylum and ignore the special procedures for unaccompanied children.

Our immigration laws guarantee that any noncitizen “irrespective” of status, no matter how they arrive, is entitled to an asylum process. U.S. law has adopted the international obligation that refugees cannot be returned “in any manner whatsoever” to a place where they risk persecution. The courts have protected these rights again and again. When the administration tried to impose an asylum ban more than a year ago, the U.S. Court of Appeals for the Ninth Circuit blocked it, calling it an “end-run” around Congress, a decision the Supreme Court refused to overturn.

Now, with the C.D.C. directive, the administration is imposing an even more sweeping prohibition on asylum by exploiting pandemic fears, and U.S. Border and Customs Protection is labeling the policy a public health “expulsion” instead of an immigration deportation.

Despite what the administration says, the order is not part of any coherent plan to stop border travel or prevent introduction or spread of contagious people or the virus, which is already widespread in the United States. Nothing limits travel from Mexico or Canada by truck drivers, those traveling for commercial or educational purposes, and many others, including green card holders and U.S. citizens. And the restrictions that exist do not apply at all to travel if it’s by airplane.

The administration’s order expelling refugees and children tarnishes the C.D.C., does nothing to protect public health, targets the most vulnerable, tramples their rights and cloaks the deportations as fighting the coronavirus in order to escape accountability. “Flattening the curve” should not be an excuse for dismantling the law.

While the authors quite legitimately “out” the CDC for its corrupt performance, the real problem here goes much higher and cuts much more broadly across our failing democratic institutions of government. A feckless Congress, under the control of Moscow Mitch and the GOP, and the “J.R. Why is it only the four “moderate to liberal” justices that have an obligation to cross over and help the conservatives, Charlie, my man? Where was Chief Justice Roberts when the regime carried out the “Miller White Nationalist plan” running roughshod over decades of well-established legal and constitutional rights of refugees, asylum seekers, children, and other migrants, using  rationales so thin, fabricated, and totally dishonest that most high school civics students could have seen right through them. How does a bogus Immigration “Court” system run by uber partisan politicos like Jeff “Gonzo Apocalypto” Sessions and now Billy Barr come anywhere close to complying with the Due Process Clause of the Fifth Amendment?

Pretending like the Supremes aren’t a broken, politicized institution won’t help fix the problem. Even “regime change” in November won’t get the job done overnight. 

The damage is deep, severe, life-tenured, and ultimately life-threatening. But, insuring that corrupt kakistocrats like Trump and Mitch won’t be in charge of future appointments to the Supremes and rest of the Federal Judiciary is an essential starting place. 

A failure to vote this regime out of office in November likely spells the end of American democracy, at least as the majority of us have lived and understand it. And, even though they obviously, and arrogantly, believe themselves to be above the fray and accountability for their actions, the “J.R. Five” eventually would go down in the heap with the rest of our nation.

If nothing else, Trump has made it very clear that HE is the only “judge” he needs, wants, or will tolerate. We have only to look as far as the failed and flailing Immigration “Courts” under Billy Barr to see what the “ideal Trump judiciary” would look and act like.

This November, vote like your life depends on it. Because it does!

Most support staff at the Executive Office of Immigration Review in Falls Church, Va., remain unable to telework even after two floors had to be deep cleaned after an employee exhibited coronavirus symptoms at work last week.

The agency responsible for conducting removal proceedings in immigration courts still is not providing telework for many of its employees, even after an employee exhibited coronavirus symptoms at work.

On April 8, an employee on the 20th floor of the Executive Office of Immigration Review’s office in Falls Church, Va., which the agency shares with the Social Security Administration, had symptoms consistent with COVID-19, although the employee has not been tested for the virus.

As a result, employees on that floor and the 21st and 22nd floors were temporarily sent home on weather and safety leave until contractors could conduct a deep cleaning. The 21st and 22nd floor employees returned to work Friday, while the 20th floor reopened on Monday, except to those who came in contact with the employee, who are now undergoing a 14-day quarantine.

“I want to advise you that an EOIR employee working on the 20th floor of the Skyline Tower Building has displayed symptoms of COVID-19,” wrote Executive Office of Immigration Review Director James McHenry in an email to employees last week. “The employee is now self-quarantined for two weeks and all persons identified as close contacts have been advised of their interaction with the symptomatic employee. We are conducting an enhanced cleaning of the 20th and 21st floors and the building’s common areas in compliance with [Centers for Disease Control and Prevention] guidelines.  The CDC guidance does not indicate that any additional EOIR spaces would require cleaning.”

An agency employee, who requested anonymity out of fear of reprisal, said that employees on the 17th floor were told that if they were uncomfortable continuing to work in the office, they would have to take personal leave. And they said that while the attorneys and paralegals may work remotely, the agency still is not allowing most support staff and clerks to telework, citing a lack of laptops.

“Unlike at the immigration judge level, we’re still fully operational,” the employee said. “There’s been no change, no modification to the way we’re operating. We’re 100% fully staffed and we have attorneys, paralegals and support staff.”

The office remains open despite guidance from the Office of Personnel Management and the Office of Management and Budget urging agencies to “maximize telework” for employees wherever possible. Additionally, Deputy Attorney General Jeffrey Rosen and Assistant Attorney General for Administration Lee Lofthus directed Justice Department components to “move to a posture of maximum telework” in the Washington, D.C., region beginning March 16.

“Components should exploit all flexibilities in their telework policies, including adjusting duties and work to expand availability of telework to employees whose duties did not previously support telework, and even if the employee would only have enough duties to telework for part of a work day,” Lofthus wrote.

The EOIR employee said the agency has been resistant to implementing a continuity of operations plan that would prioritize detainee cases over non-detainee cases, as immigration courts have done to reduce the time needed to be in the office, and said they fear the agency is more concerned with “keeping up production numbers” than employees’ well-being.

“Why can’t we go into COOP status to minimize staff in the office?” the employee said. “We could go into only working detained cases, just like the courts, and we wouldn’t need as many staff. And with a smaller docket, maybe we could introduce rotations or stagger shifts. Right now the only option to stagger shifts is allowing some employees to work from 6 a.m. until 3 and then someone else could work later.”

The employee noted that, by comparison, when there was a positive coronavirus case among the Social Security Administration’s employees in the building, the agency completely evacuated the office, and employees have not returned since.

“Why did we come back to work so much faster [than Social Security]?” they asked. “SSA had one incident and they’re on 17 different floors, and they haven’t been back.”

The agency did not respond to a request for comment.

Interestingly, in past “Government shutdowns,” most EOIR HQ personnel were deemed “nonessential” and told to say home. Now, with a true emergency that could affect employee health and safety, and with the Immigration Courts’ “non-detained docket” — more than 95% of the EOIR workload — shut down, it becomes necessary to drag HQ staff in. To do what? Exactly what “essential services” are being performed that justify risking the health and safety of employees, their families, and their communities? 

But, I suppose it’s no surprise that an agency sitting on a largely self-created backlog of 1.4 million cases, with no plausible plan for dealing with it, would essentially tell its own employees to “show up and hope for the best.”

Since the early days of the Trump administration, an impassioned group of mental health professionals have warned the public about the president’s cramped and disordered mind, a darkened attic of fluttering bats. Their assessments have been controversial. The American Psychiatric Association’s code of ethics expressly forbids its members from diagnosing a public figure from afar.

Enough is enough. As I’ve argued before, an in-person analysis of Donald J. Trump would not reveal any hidden depths — his internal sonar could barely fathom the bottom of a sink — and these are exceptional, urgent times. Back in October, George T. Conway III, the conservative lawyer and husband of Kellyanne, wrote a long, devastating essay for The Atlantic, noting that Trump has all the hallmarks of narcissistic personality disorder. That disorder was dangerous enough during times of prosperity, jeopardizing the moral and institutional foundations of our country.

But now we’re in the midst of a global pandemic. The president’s pathology is endangering not just institutions, but lives.

TWITTER CHATS During these extraordinary times, Opinion columnists and writers will be going live on Twitter every weekday at 1 p.m. Eastern to chat with viewers. This was Jennifer Senior’s conversation.

Anthony Fauci and Deborah Birx, Trump has surrounded himself with a Z-team of dangerously inexperienced toadies and flunkies — the bargain-bin rejects from Filene’s Basement — at a time when we require the brightest and most imaginative minds in the country.

Faced with a historic public health crisis, Trump could have assembled a first-rate company of disaster preparedness experts. Instead he gave the job to his son-in-law, a man-child of breathtaking vapidity. Faced with a historic economic crisis, Trump could have assembled a team of Nobel-prize winning economists or previous treasury secretaries. Instead he talks to Larry Kudlow, a former CNBC host.

Meanwhile, Fauci and Birx measure every word they say like old-time apothecaries, hoping not to humiliate the narcissist — never humiliate a narcissist — while discreetly correcting his false hopes and falsehoods. They are desperately attempting to create a safe space for our president, when the president should be creating a safer nation for all of us.

PRESIDENT TRUMP likens the struggle against the pandemic to a war that will yield a colossal toll in human lives, but refuses to urge states uniformly to issue stay-at-home orders. The president’s equivocations have produced an uncoordinated jumble of policy subverted by foot-dragging governors who treat the coronavirus less as a national emergency and more as a political annoyance. They are guilty of an abdication of leadership whose consequences will be measured in body bags.

Messaging is critical in this crisis. By telling people in the strongest terms to stay at home, even with certain exceptions, most governors have conveyed the gravity of the spreading threat; that is likely to save many lives. By failing to do that, and treating a plague as one interest to be balanced among many, other governors treat the peril with a nod and a wink. Their message, sotto voce, is: Let’s not all get our knickers in a twist.

The nod-and-a-wink governors — in the Dakotas, Missouri, Nebraska, Iowa, Arkansas and elsewhere — pose as powerless to order a lockdown, or note they have already closed schools, restaurants, gyms and other establishments, but won’t order blanket edicts to individuals. They point at other states’ exceptions that allow people to carry on with essential work, or get groceries and pharmaceuticals. In Missouri, Gov. Mike Parson says staying at home is a matter of “individual responsibilities”; in Arkansas, Gov. Asa Hutchinson scoffs there is nothing “magical” about stay-at-home directives; in Iowa, Gov. Kim Reynolds protests that “I can’t lock everybody in their home.”

Those governors, all Republicans, have been enabled by Mr. Trump, who points to states that don’t yet “have the problem,” and remarks that it’s “awfully tough to say, ‘Close it down.’ ” He favors flexibility and is seconded by Vice President Pence, who says the federal government “will defer to state and local health authorities on any measures that they deem appropriate.”

As the White House leads from behind, the effect is to endorse and induce complacency. Faced with a stealthy pathogen that can spread from asymptomatic individuals, or incubate for weeks before a victim falls ill with fever, states are free to delude themselves into thinking the virus has passed them by — until, having bidden its time, it erupts inside their cities and towns. Governors of those states can entertain the illusion of alternative facts, imagining their borders are impermeable. They can, like Georgia’s Republican governor, Brian Kemp, resist a stay-at-home order for weeks until discovering just this week — surprise! — that the virus is “transmitting before people see signs.”

Their magical thinking endangers the nation. It gives people license to minimize the threat — a threat the White House says could kill up to 240,000 people even with effective social distancing. It allows state-to-state gaps in the firewall that will likely encourage a raging disease to erupt in a series of rolling blazes across the country. As many states get tough, even deploying the police to encourage people to stay indoors, their odds of impeding the pandemic’s path of destruction are undercut by their neighbors’ selfishness.

One government lawyer who appeared in a crowded Newark, New Jersey, immigration court last month is in a medically induced coma. A New York immigration lawyer and her client are both sick. Immigration judges are being denied sick leave when they use anxiety or safety as reasons. Migrant children are asking their lawyers if they will fall ill if they go to court, and whether they’ll be deported if they don’t show up.

Sickness, panic, and confusion in the midst of a pandemic: These are the acute side effects of immigration courts continuing to operate as the novel coronavirus races across the country. Despite three weeks of intense pleading to close all 69 courts—across a united front of immigration lawyers, the union representing lawyers for ICE, and the immigration judges’ union—more than two-thirds of them remain open. 

The courts that have been closed by the Executive Office for Immigration Review (EOIR), the federal agency that runs them, have often only been shuttered in reaction to a confirmed case of COVID-19 or suspected exposure. The closures are often last-minute, and not clearly communicated, except on Twitter. This week, several immigration legal associations filed two separate federal lawsuits to close the courts because they fear that the government has put their lives in danger. 

“I think it’s about time the American people woke up to the fact that EOIR’s willingness to perpetuate and extend this pandemic will inevitably bring the virus to their hometown,” Rebecca Press, the legal director at UnLocal in New York, said Thursday via email. She contracted coronavirus two weeks ago and at least one of her clients is sick. “The longer courts remain open even for filing, and the longer the courts require attorneys and immigrants to engage in the work of preparing evidence, the more likely it becomes that the virus will be brought right back to another community.”

Government lawyers are affected, too. Fanny Behar-Ostrow, the president of American Federation of Government Employees Local 511, the union representing ICE lawyers, is getting calls at all hours of the day from members who worry they have been exposed to the virus. “They are panicked, frightened, desperate, upset,” she said. 

In addition to the 36,000 adults in ICE detention facilities, there are some 3,500 migrant children in government custody who are affected by the disarray in the courts. In most courts, children must still attend in-person hearings, putting them at exposure risk. In New York City, the current epicenter of the pandemic, lawyers from Kids in Need of Defense (KIND) have not been told whether EOIR will reschedule cases for next week. They are also unclear about whether the minors even need to come to court at a time when state and city officials have issued stay-at-home orders. 

“We are receiving phone calls from children who had their safety net shaken,” said Maria Odom, vice president for legal services for KIND, which is a nonprofit organization contracted to represent unaccompanied minors. “For us serving vulnerable children, there are so many moving pieces and at a time when we should be able to look to the government, they are just contributing to the chaos.”

Lawyers, judges, and advocates wonder: What will it take for EOIR to close courts nationally?

“I hope that it won’t take a death, but I worry that it will,” said Aaron Reichlin-Melnick, an immigration lawyer and policy counsel for the American Immigration Council. His organization is one of the groups behind a lawsuit filed Monday by the National Immigration Project of the National Lawyers Guild.

Looks like the dead bodies will have to pile up before the Article IIIs and EOIR will take action. As the rest of us know, but to which U.S District Judges & EOIR appear willfully blind, by the time individuals show symptoms and begin dying, it’s too late to stop the spread. The larger community has already been infected.  

I wonder what it is that gives both EOIR officials and Article III Judges such great confidence that they and their families will escape the consequences of their irresponsible behavior? Maybe, it’s that both EOIR Senior Execs and Article III Judges manage to studiously avoid “direct exposure” to Immigration Courts. “Below their pay grade,” so to speak. 

But, according to folks like Dr. Fauci, who possibly knows even more about infectious diseases than EOIR Director McHenry and the Federal Judges who continue to defer to the irresponsible EOIR “guidance,” nobody will be immune. 

So far, the U.S. has done the worst job of any developed country in the world of “flattening the curve.” Inevitably, we eventually will become the “world leader” in coronavirus deaths. After observing the inept response of EOIR and the failure of the U.S. District Courts to promptly intervene on the side of medical knowledge, common sense, and preserving human lives, I can now see why we are failing as a nation to take the extreme measures necessary for self-preservation.

I would think that as lawyers, judges, and other members of the legal community start dying as a result of EOIR’s policies, that the officials responsible eventually will face legal actions brought by surviving family members and colleagues. Life tenure and the judicial doctrine of “absolute immunity” will protect the feckless Federal Judges from legal accountability. But, it won’t protect them and their reputations from moral accountability and the “judgements of history” which are likely to be harsh and as unforgiving as the Trump Immigration Kakistocracy’s treatment of the most vulnerable among us and their brave lawyers.

White House adviser Jared Kushner broke the irony meter as he — not someone qualified, such as Anthony S. Fauci — took over the daily coronavirus briefing on Thursday to inform us: “What a lot of the voters are seeing now is that when you elect somebody … think about who will be a competent manager during the time of crisis.”

Yes, President Trump’s voters, along with those who elected the similarly ignorant and slothful Republican governors in Florida and Georgia who failed to act promptly to stem the coronavirus, should remember that next time. Better to elect someone like California Gov. Gavin Newsom (D) or Ohio Gov. Mike DeWine (R) rather than someone continually pandering to Trump, resisting readily available scientific advice and attacking the media.

One has the sinking feeling that things are going from bad to worse. Trump and the feds declined to act swiftly, in particular failing to get widespread testing up and running. Now they are failing to remedy the dire medical crisis that their negligence brought on. Kushner said the federal stockpile of medical equipment is for the feds to use, not the states. His father-in-law seems allergic to implementing fully the Defense Production Act, so the bidding war among the states for critical equipment continues.

Republican governors in Florida, Georgia, Mississippi and Alabama declined to issue prompt stay-at-home orders. Now? Trump refuses to issue one nationally despite Fauci’s advice. “I don’t understand why that’s not happening,” he said in a CNN interview. “As you said, the tension between federally mandated vs. states’ rights to do what they want is something I don’t want to get into. But if you look at what is going on in this country, I do not understand why we are not doing that. We really should be.” The answer: We have a total lack of federal leadership and competence.

Congress set up a $350 billion fund for small-business loans. Beginning Friday, many banks promptly announced that they could accept applications in the absence of clear federal guidance. The chaos, confusion and delays surrounding the Small Business Administration loans might make the unemployment insurance process seem like a fine-tuned machine. (Thousands, if not millions, of unemployment claims remain unprocessed due to overwhelming demand.)

The Defense Department is no better. Trump jettisoned a career professional serving as defense secretary (James Mattis) for a meek, subservient aerospace executive. The result is predictable. Politico reports: “Defense Secretary Mark Esper is under fire for the Pentagon’s response to the coronavirus pandemic as lawmakers, national security experts and people throughout the Defense Department’s ranks fault him for a slow and uneven approach to the outbreak.” His most notable action: Supporting the firing of the Navy commander whose letter pleading to allow his sailors to disembark from a floating petri dish, the USS Theodore Roosevelt, was leaked. The military under Trump can forgive war crimes, just not pleas to save men and women in uniform from incompetent superiors.

This is as exasperating as it is frightening. Governors, if you are lucky enough to live in a state with a competent one, can do only so much when, for example, there are no ventilators to be had. The Democratic-led House can only churn out its version of remedial legislation, but it cannot withstand Senate and White House efforts to scuttle anti-fraud, anti-cronyism measures. (“Most big companies that take advantage of the $500 billion corporate bailout in last week’s coronavirus relief bill are unlikely to face restrictions against firing workers or giving bonuses to executives, according to officials familiar with the program.”) And while the House can bird-dog the executive branch as it distributes money, the House cannot do the executive branch’s job for it.

The chaos, confusion and incompetence at the federal level magnify our daily anxiety and uncertainty. We have lost control of our lives, and those supposed to lead us through this ordeal are deepening our national trauma. Years of contempt for expertise, for competent government and for truth itself on the right now haunt us all. God help us.

As if on cue, about the time I was reading Jennifer’s op-ed, the Blathering Boor was on TV demonstrating his “malicious incompetence” by telling American that we should wear face masks, but then immediately contradicting the message by emphasizing that it was voluntary, not required, and he wouldn’t be doing it. Because he has to meet with dictators, kings, queens, emperors, tyrants, princes, fairy godmothers, etc. Even life or death matters become mere sick jokes under the “Clown Kakistocracy,” where ignorance and lies reign.

This is what I’ve been saying for a long time now. So much for the mythical “Gang of Generals” who were supposed to save us from Trump’s “malicious incompetence.” Nope. They all “went long to get along” for awhile and then took cover in vain attempts to save what was left of their shredded reputations. Write a “tell nothing” book, give a few disingenuous interviews, hide on the board of directors of a company profiting from child abuse, whatever! Trump corrupts and destroys everything he touches, including our country!

Unlike those guys, I think there is actually gainful employment out there in the real world for someone like Captain Brett Crozier who puts human lives before a maliciously incompetent “chain of command” looking to cover up its malfeasance. 

It’s not like our military hasn’t always had a certain penchant for punishing those who “speak truth to incompetent power!” Just ask the ghost of “Milwaukee Hero” Gen. Billy Mitchell who got court-martialed for being smarter, more creative, and more courageous than his superiors. Who would ever have ever believed that air power, not horse drawn caissons, would win the next World War? Duh! Certainly none of his immediate superiors in the Army after WW I!

UPDATE: While folks like McHenry and the operators of the DHS Gulag provide misleading information, or perhaps outright lies, to Federal Judges, Courtside’s sources say that at least six individuals with some connection to the Immigration Courts have died from coronavirus. While I admittedly have no way of “independently verifying” this information, I’d bet that there are many more Immigration Court or Gulag-related coronavirus deaths and serious infections out there that I do not know about!

Why,  I wonder, would any Federal Judge accept the word of someone like McHenry or officials in the DHS Gulag over affidavits from detainees, filings from experts, and the advice we hear from the Surgeon General, Dr, Fauci, and Dr. Birx every day? Stay home means “stay home!”

Nobody with any understanding of our immigration system could reasonably believe that running one more removal hearing or keeping non-criminals in prison is worth endangering lives and spreading disease! What in the recent public history of DHS Detention and EOIR would lead a Federal Judge to credit any information on “best practices” on public health provided by these inherently unreliable and incompetent organizations?

Here’s an excerpt:

María looked for work as a waitress as soon as she arrived. She knocked on the doors of 15 restaurants and was rejected each time. “Right now, no one is hiring workers, they’re firing people,” María said. Under the lockdown, she has had to put her search on hold.

María’s options in Guatemala are limited, particularly since it is not safe for her to go back to her home town. She and her little girl fled Guatemala for the US in late 2018 after the same gang that murdered María’s entire family over a land dispute, including the little girl’s mother, killed María’s partner and shot at María. Last summer, a US immigration judge found María’s account credible but decided her case did not meet the narrow legal standard for asylum. María filed an appeal but could no longer endure being locked up away from her niece. Because she was not the girl’s biological mother, Ice refused to release her from detention to reunite the family. After nearly a year apart, María requested deportation with the hope she and the girl could return together.

“It was notably easier for Ice to concede the bona fides of the relationship between María and her niece when removal to Guatemala was the goal,” said Suzannah Maclay, María’s attorney.

‘It is beyond cruel’: Ice refuses to reunite girl with the only family she has left

María was craving freedom after so long in detention but still finds herself spending her days inside. She wants her niece to go to school and get the education she never got. She feels restless, unable to start building a better life for them both. “I can’t do anything,” she said.

She believes the gang that murdered her family still wants to kill her, and she is always fearful they will discover she is back. She doesn’t want her niece to grow up alone. She tries to give the girl a sense of security, but the truth is hard to hide. “Why did they send us here?” the girl asked her upon arriving in Guatemala. “It’s too dangerous.”

As María and her child focus on day-to-day survival, they are also trying to heal from the trauma of their separation. Sometimes the girl tells María about foster care in New York. The stories are hard to hear. The girl describes getting her hands slapped when she touched things or being scolded in restaurants. “They humiliated her,” María said.

“Mami, I missed you so much,” the girl tells her. “I don’t ever want to be apart again.” María responds with a promise: “This won’t happen again.”

Now, a real appellate court, with qualified judges acting independently, might have used this as an opportunity to direct that Immigration Court hearings in all “non-criminal” cancellation of removal cases be deferred until such time as we can understand what is actually happening in Guatemala and other countries after the worldwide pandemic is brought under control. 

After all, the situation is rapidly evolving. Or, I should say devolving! What’s the purpose of holding “trials” on conditions in foreign nations that are likely to change materially on a weekly or even daily basis? 

Just look at the difference between the impact of the coronavirus in the United States one month ago and what is happening today. A month ago, folks were strolling the beaches of Florida and our President was basically minimizing the potential impact. Now there are over 10 million Americans out of work, three-fourths of the country under “stay at home” orders (except for Immigration Court), with nearly 200,000 reported cases, and “best case” predictions of several hundred thousand deaths! 

So, why would any rational person think, like the BIA does, that things will be “hunky dory” for those deported to Guatemala, particularly if they choose to take their U.S.C. children? Why would a poor corrupt country with a limited economy and few resources fare better than the world’s richest nation in weathering this crisis? When hospitals are breaking down all over the U.S., why would health care be readily available to recent returnees in Guatemala? With 10 million out of work here, why would jobs to support a family of five be readily available in Guatemala?  The BIA’s decision in this case is as “counterfactual” as it is needlessly cruel!

Looking at it from a factual, legal, public health, or humanitarian viewpoint, the BIA’s timing and decision in this case were totally irresponsible.

We need an independent U.S. Immigration Court with better, more responsible, and more humane judges.

In a country ground to a standstill by the coronavirus pandemic, there is one place normalcy reigns: immigration courts.

Overburdened judges oversee packed proceedings; attorneys shuttle clients and paperwork from room to room, often with interpreters in tow; aspiring legal citizens, or at least residents, follow closely, sitting through hearings famously described as death-penalty cases held in a traffic court.

The courts, along with visa applications, detention hearings and other immigration related bureaucracy, are seemingly the lone part of the federal government still expected to function as if a global pandemic hasn’t upended nearly every facet of American life. But those tasked with keeping the machine running say that they have received little guidance about how to keep the system running in the era of social isolation, and even less protection despite fears that immigration proceedings put some of the most vulnerable people in the country in the impossible position of choosing between their health or their home.

The Trump administration has refused to allow immigration courts and visa hearings to comply with the same social isolation standards followed by nearly every other civil aspect of government, and has not allowed for previously scheduled hearings to be postponed. The administration has also issued little in the way of guidance for judges, immigration attorneys or immigrants, whose hearings—which often take years to schedule—directly conflict with stay-at-home orders across the county.

“The immigration court’s refusal to adopt policies that protect the health of respondents, lawyers, judges and immigration court staff during the current pandemic forces immigrant families and their lawyers to make an impossible decision: endanger public health or risk being deported,” said Nadia Dahab, senior litigation attorney at Innovation Law Lab, one of half a dozen immigrants-rights groups that on Friday filed an emergency order challenging the operation of immigration courts despite the crisis.

“We are in the middle of a global pandemic, but the immigration court system is continuing to operate as if it’s business as usual,” said Melissa Crow, senior supervising attorney with the Southern Poverty Law Center’s Immigrant Justice Project. “The government has turned the court system into a public health hazard.”

With very few exceptions, deportations are hardly “essential” during a worldwide pandemic. Indeed, given that even asymptomatic individuals can and have spread the disease, deportation will certainly spread the risk to other countries that likely won’t be able to control it. 

There is currently no cure, no vaccine, and no known way of controlling the coronavirus other than staying home. While this well-known information might have gone over the heads of EOIR and Article III Judges, you really wouldn’t need a law degree of even be very smart to figure out that Immigration Courts and the DHS Gulag need to be shut down. Now! No Article III Judge would actually want to trust his or her life to operating under the messed up “guidelines” issued by EOIR! So why is it OK for others?

Statistics show that the longer we wait to keep everyone home, the more individuals who will die! Why is that such a hard concept for EOIR officials and Article III Judges to grasp? 

This is a time for “radical prudence” not “criminal recklessness.” The Government should have to demonstrate “clear and convincing” reasons and “best health practices” to go forward with any individual removal case during the pandemic.

Because so many Federal Judges have little understanding of what it means to appear in the Immigration “Courts” (which are not “courts” in any sense of the word) and because they use exceptionally  poor judgement in believing regime bureaucrats who have no credibility on issues of public health or anything else, over experts in the field, individuals will unnecessarily suffer and die.

At some point in the future, there will have to be an accounting for the whole mess that has been allowed to unfold as a result of Trump’s biased and irrational immigration policies. Examination of the unconscionably poor response by the Article III Judiciary must be part of that process. They are a key part of unnecessarily “endangering public health” as described in this article.

The Article III Judges we have now are what we have — they have life tenure. But, going forward we can do better — much better. And, our lives and the future of humanity will depend on it.

Close immigration courts now: A coronavirus necessity to protect public health

You have a case scheduled for trial in immigration court, but you’ve got a cough, a sore throat and shortness of breath. In normal times, you probably would have gone to court for the trial. In current times, you’re worried. We all know what those symptoms mean.

You call your doctor, who tells you that you’re displaying symptoms consistent with COVID-19. The doctor recommends that you self-quarantine.

Your immigrant client is detained by Immigration and Customs Enforcement (ICE) and counting on you to present their asylum case. You’ve been preparing for months. Your client’s ability to avoid being deported to a country where they face torture or death depends on your performance.

Even though most courts around the country are closed in response to the pandemic, your court date is still on. The Justice Department is keeping its detained immigration courts open, ignoring joint letters from the National Association of Immigration Judges, the American Immigration Lawyers Association and the union representing ICE attorneys calling for a shutdown during the pandemic.

As of your trial date, you haven’t been able to meet with your client in person to prepare for at least two weeks. At the time, ICE wouldn’t let you use your regular attorney visit rooms due to disease risk, so you were stuck waiting in line for the one glass-partitioned attorney room at the detention center. You never got to the front of the line for the room, so you were only able to talk to your client through glass and on the telephone.

Then ICE issued a new directive on March 21 requiring all attorneys to bring their own gloves, mask and eye protection for contact visits with clients. Your office doesn’t have any of this gear. Even if you could get protective gear, you wouldn’t take it away from the medical professionals who truly need it.

Despite all of this, you hope the immigration judge will sympathize with your predicament. You file a motion asking for more time to better represent your client after all of this is over. You cite your own illness, your inability to meet with your client to prepare, and local and national public health warnings.

Despite your objections, the immigration judge proceeds with your client’s asylum trial. The judge gives you the choice of abandoning your client to face the fight of his life by himself or proceeding as his attorney via telephone. Reluctantly, you find a folding table to put your file on and try the case from your couch, unable to see or communicate privately with your client. You cannot see anything that is happening in court.

With nearly 3,000 deaths and more than 160,000 infected by COVID-19 in the United States, it’s clear no one will be spared from impacts of the pandemic. In the past week, four children in immigration detention and seven employees of the Office of Refugee Resettlement who work in children’s detention facilities in New Jersey and Texas tested positive for the virus. Doctors working with detained immigrants have warned members of Congress that immigrant detention centers pose a “tinderbox scenario,” where social distancing precautions are impossible.

Two separate lawsuits are asking federal courts to force the release of unaccompanied children as well as families in immigrant detention, citing the grave health risks of contracting the coronavirus and spreading the disease. These risks are particularly serious because of the confluence of factors in family detention centers: crowded quarters, limited cleaning supplies, and the influx of new families into the detention centers. While it is understood children are usually less at risk of serious complications from COVID-19, a handful of children in the U.S. with COVID-19 have died in the past few days, and children may be more likely to more rapidly spread the disease.

Instead of a public health–oriented response to COVID-19 in the immigration legal system, we are seeing political opportunism. The Trump administration is using the virus as an excuse to swiftly deport unaccompanied minors at the border, despite laws that require that children be allowed to have their cases heard first by an immigration judge. Similarly, the Department of Justice is defying public health guidelines by forcing judges, attorneys, and immigrants to appear in select immigration courts across the country, despite positive COVID-19 tests from court personnel and risks inherent to crowded courtrooms, in order to continue deportation proceedings.

This mistreatment of children is not new. Before the outbreak, children were finding themselves in an increasingly punishing immigration legal system—where they had been separated from their parents, detained in record-breaking numbers for longer periods of time, and held in shocking and abusive detention conditions, including “dog cage” holding cells without mattresses, overflowing toilets, and frigid temperatures. Children do not have to be held in these conditions; unaccompanied children can and should be released more expeditiously to live with family in the U.S., and children detained with parents could be released as a family unit to pursue their legal case outside of detention.

Detained children have experienced forced hunger, dehydration, and sleeplessness. Holly Cooper, an attorney representing detained children, stated: “In my 22 years of doing visits with children in detention I have never heard of this level of inhumanity.” One 15-year-old boy, detained at the jail-like Shenandoah Valley facility, wrote “I want us to be treated as human beings.”

As a law professor and immigration attorney for more than a decade, I have seen firsthand how the immigration system mistreats children. In a recent law journal article, I argue adultification bias can help explain the mistreatment of immigrant children, who are largely teenagers of color. Adultification is the phenomenon whereby children of color are perceived as more adultlike and therefore less innocent than white peers. Adultification has created systemic harm for children of color within public systems like educationjuvenile justice, and child welfare. In particular, the disproportionate rates of arrests, adjudications, and sentencing for children of color within the juvenile justice system has been studied closely.

Immigration laws were not designed to protect children. In fact, only a few areas of the law consider the special circumstances of children. The Flores settlement sets minimum standards for detaining minors, limited to children under 18. Under Flores, children should be released as soon as possible to family, when feasible. Furthermore, the Office of Refugee Resettlement, not U.S. Immigration and Customs Enforcement, is tasked with the custody of detained unaccompanied minors. According to legislative history, this is because ORR, under the Department of Health and Human Services, has more expertise in child care. Another child-focused measure is the Trafficking Victims Protection Reauthorization Act of 2008, or TVPRA, which expands legal protections for children including in the areas of asylum law and special immigrant juvenile status, a pathway to legal permanent residence and citizenship available for some children. Lastly, the government has issued guidelines for children’s cases to improve immigration court procedures.

Our “Round Table Brief” is mentioned in the article. Unfortunately, in this case it didn’t get the plaintiffs “over the top.”

The Judge seems to have applied the old “good enough for government work” standard to EOIR’s efforts. In other words “show me the dead bodies.” Assuming that the the Surgeon General and other health exports are right, the worst is yet to come. That doesn’t bode well for anyone caught up in the EOIR system. Also seems inconsistent with the “radical mitigation strategy” that government has been preaching.

Immigrants Jailed by ICE Are Sick, Panicking, and Can’t Get Coronavirus Tests

“They don’t want to die in here.“

José listed off his symptoms: fever, nausea, diarrhea, difficulty breathing. The 38-year-old from Mexico, now detained in an ICE detention center in Southern California, told VICE News he worries he has COVID-19, the potentially deadly disease caused by the novel coronavirus.

But he doesn’t know. His jailers won’t test him.

Instead, José, who is from Mexico and came to the U.S. when he was 15, sleeps in a cell with seven other detained immigrants at the Adelanto detention facility in San Bernardino, Calif, which is run by the for-profit GEO Group. He wakes up in the middle of the night gasping for air, his heart beating wildly. After complaining to a judge, he was taken to the infirmary, where a doctor told him it was just a cold, he said.

“They just tell me to drink a lot of water and eat the food they give us,” said José, who has been incarcerated for five years fighting a deportation order. “There are other guys in here that are also coughing, have a fever. But we have no idea if we have the coronavirus because they won’t give us a test.”

This week, the first immigrants detained by ICE tested positive for COVID-19. It comes after weeks of warnings by public health experts and civil right lawyers that a mass outbreak in detention centers is inevitable, endangering both asylum seekers, those being detained for immigration violations, and staff. They also say an outbreak would strain an already critically low supply of respirators, leading to more deaths in the communities surrounding detention centers as well as among immigrant detainees.

Across the immigration system there appears to be little being done to prevent a spread of the coronavirus, except banning visitors. There are currently some 37,000 detained immigrants in ICE custody, most of them held in for-profit detention centers in the south and California. ICE recently requested 45,000 N95 masks from the federal government for its officers to carry out detentions of undocumented immigrants.

VICE News spoke with six men currently being held in ICE detention facilities in California, and two men released this month from ICE facilities in Louisiana. They described congested living conditions with up to 110 men sleeping in a room and days-long waitlists to be seen by a medical professional.

The New Jersey State Bar Association (NJSBA) is requesting that the Newark and Elizabeth Immigration Courts be closed immediately, in the interest of the health and safety of the residents of NJ and the country. In support of this request, the NJSBA asks you to consider the following:

NEWARK IMMIGRATION COURT:

On March 6, 2020, the Newark Immigration Court, located on the 12th floor of the Rodino Building, 970 Broad Street, Newark, NJ, was temporarily closed for the afternoon because an attorney who had been exposed to COVID-19 and who was experiencing symptoms was present in court.

On March 9, 2020, the Newark Immigration Court reopened, and remained open until March 18, 2020. During that period of time, literally thousands of respondents and their family members were required to appear at master calendar and individual hearings, along with their attorneys, attorneys from the Office of Chief Counsel, Court staff, interpreters, security guards and Immigration Judges.

It was later learned that a second private attorney and an interpreter have tested positive for COVID-19 after being in court on March 11, 2020. The attorney is quite ill. Approximately 70 other cases were heard that morning before the same Immigration Judge, who is currently under self-quarantine. That is only a fraction of the people who were present at court that day. Because of the volume of individuals who must appear at the Newark Immigration Court on any given day, the majority of individuals must wait together, sometimes for hours, in an extremely small waiting room, in which all attorneys, courts staff, interpreters, security guards and judges must also pass.

It was also learned that an attorney from the DHS Office of Chief Counsel, who was present in Court on March 13, has not only tested positive for COVID-19 but is currently in a medically induced coma in ICU fighting for his life. The entire staff of the Office of Chief Counsel, which is primarily located on the 13th Floor of the Rodino Building, has been placed under required quarantine for a period of two weeks.

As a result of this, the US Department of Justice, Executive Office for Immigration Review (EOIR) issued a directive on Twitter and Facebook stating that the Newark Immigration Court would be closed from March 18-April 10, 2020, and that all court filings would be considered timely filed on April 10, when the court reopened.

Last night, March 25, at 9:30 pm, EOIR announced via Twitter and Facebook that Newark Immigration Court would reopen starting TODAY, March 26. No further information was given to the public, or, notably, the Immigration Judges or the court staff. It has been clarified that the Newark Court has reopened for court filings only, because EOIR has now stated that any filings due during the previous days of closure would now be due on March 30, 2020.

Some members of the court staff are now required to be present to accept in-person filings at the court window, as well as to handle filings that have been mailed to the court. The Office of Chief Counsel remains closed under quarantine, and therefore cannot accept filings.

The reopening of the Newark Immigration Court, even for a limited purpose, is in clear violation of Executive Order 107. The functions of the Court at this time are non-essential, because the Court does not handle detained cases. Moreover, the reopening is putting Court staff in jeopardy of not only exposure to the virus themselves, but also of spreading it to others. The City of Newark is under a shelter-in-place restriction, and, this morning, the U.S District Court for the District of New Jersey just issued an order closing the Martin Luther King and Frank R. Lautenberg courthouses because several employees have confirmed positive COVID-19 tests. The courts are closed immediately and will remain closed through April 6, 2020.

It should be noted that the courthouses are located next door to the Rodino building, and the U.S. Attorney’s Office is in the Rodino Building. Staff, attorneys, and members of the public use the same parking facilities, elevators, and even cafeterias located in the buildings.

Therefore, for all of the above reasons, the Newark Immigration Court should be closed immediately and remain closed until its scheduled reopening date of April 10, at the earliest.

ELIZABETH IMMIGRATION COURT:

The Elizabeth Immigration Court is located at 625 Evans Street, Elizabeth, NJ, and is located in the same building as, and in close proximity to, ICE detainees. The Elizabeth Court handles detained cases and is currently open.

On March 13, 2020, a medical staff person who works in the detention center was presumed to have been exposed to COVID-19; this diagnosis was later confirmed. Moreover, because attorneys for the Office of Chief Counsel travel back and forth between the Elizabeth Immigration Court and the Detention Center, where there is an auxiliary OCC office, and the Rodino Building in Newark, the OCC in Elizabeth has been included in the mandatory, two-week quarantine. Numerous private and pro bono

attorneys also routinely appear in both courts, as do interpreters and ICE personnel.

One of the Elizabeth Immigration Judges has been out on leave; an Immigration Judge from Newark, whose husband had been quarantined but tested negative for the virus, is now handling the docket in Elizabeth.

Immigration attorneys are allowed to appear telephonically if they choose; court staff, judges, security guards, interpreters, and, of course, the detainees housed in Elizabeth are there in person. The Office of Chief Counsel is still under quarantine; their attorneys have been appearing telephonically.

On March 24, 2020, at 2:30 pm, EOIR announced, via Twitter and Facebook, that the Elizabeth Immigration Court was closing for the rest of the afternoon because they had received confirmation of “the presence of an individual with a test-confirmed Coronavirus diagnosis.”

The Elizabeth Immigration Court reopened the next day and remains open.

The Elizabeth Immigration Court hears cases for individuals who are housed at Elizabeth Detention Center, as well as at Essex and Hudson County Jails. The individuals housed at those jails are usually seen via tele video. However, a detainee and a senior staff person at Essex County Jail both have positive COVID-19 diagnoses and are experiencing serious symptoms. And ICE detainees at all three locations are engaging in hunger strikes because they are afraid of contracting the virus as well.

Moreover, on March 25, EOIR issued a requirement that all attorneys dealing with inmates in ICE detention centers and courts MUST bring their own personal protective equipment (PPE) in order to be allowed to enter the facilities. Therefore, either attorneys cannot adequately represent their clients, or they must obtain PPE at the expense of health care providers and first responders who desperately need this equipment.

The NJSBA recognizes that it is more difficult to close a court that handles detained cases, as that imposes a reduction of the individuals’ constitutional rights. However, the NJSBA believes that a short- term closure of two weeks, in order to ensure that anyone who has been exposed to COVID-19 does not spread the virus, even unwittingly, is extremely important to protect the health and safety of the individuals who are housed there, who work there, and who must report there, as well as the public at large.

The NJSBA would, at the same time, ask that the State confer with ICE regarding the release of any non-criminal or low-risk immigration detainees. This would further aid in slowing the spread of the virus, as well as protecting the individuals who work at the Elizabeth Immigration Court and Detention Center and would minimize significantly the numbers of detained cases on the court docket. Should ICE forbear from placing new detainees in custody within NJ facilities would also stem the spread of the virus to vulnerable inmate populations. Alternatives to detention, such as ankle-bracelets, or mandatory video or telephonic check-ins would help ensure that ICE’s mission is not curtailed.

It should be noted that the National Association of Immigration Judges (NAIJ), the American Immigration Lawyers Association (AILA) and the American Federation of Government Employees #511 (AFGE/ICE Professionals Union) issued a joint statement on March 22, 2020, asking for the nationwide closure of all immigration courts across the country.

Immigration attorneys, immigration courts staff, and immigration prosecutors are literally having to

make life and death decisions every day because of EOIR’s callous disregard for the health and safety of its employees, immigrants, anyone who must come into contact with the courts, and the

public. Accordingly, NJSBA is asking you to close the NJ immigration courts immediately to preserve the health and safety of the residents of NJ.

To be honest, I’m not sure that a State Governor has authority to close down a Federal Office, even in times of emergency. But, this absurd, yet deadly, situation shows the arrogant disrespect for human life, common sense, and basic decency of Barr and his EOIR toadies.

Normally, you would expect cooperation, coordination, and support from the Feds in time of a health emergency. In the age of Trump and his kakistocracy, not so much. After all, you’re dealing with a regime headed by a maliciously incompetent dude who couldn’t wait to start undermining the best advice of his own doctors and nearly all health care professionals in the U.S. Bad things happen to a country that empowers a kakistocracy!

Conservatives gutted the social safety net. Now, in a crisis, they’re embracing it.

Throughout his term, President Trump has chipped away at the social safety net, proposing budgets that gutted housing assistance, food stamps and health insurance for the poorest Americans. When Congress rejected those cuts, the Trump administration enacted rules to make it harder to access federal benefits, such as requiring recipients to work.

Now, with businesses shuttered, workers laid off, and scores more worrying about buying groceries, being evicted and getting sick, the swelling need for federal assistance has forced even conservative lawmakers to embrace government protections in a series of sweeping stimulus bills.

Under the $2 trillion stimulus deal reached in the Senate early Wednesday, Republicans are proposing sending direct cash payments of $1,200 to individual Americans, an idea that, on the surface, echoes former Democratic presidential candidate Andrew Yang’s universal basic income platform. They want to bolster the unemployment insurance system after many GOP-led states spent years enacting restrictive criteria and reducing benefits.

“Anybody who is a moderate-wage worker who just experienced an economic lockdown in their state is in distress. Most people don’t have savings,” said Robert Rector, a research fellow at the Heritage Foundation, a conservative think tank that guides much of the Trump administration’s policymaking.

Rector, an architect of the 1996 federal welfare overhaul that instituted work requirements under President Bill Clinton, generally opposes safety net measures that do not promote work and marriage. But he would like to see more-generous benefits for individuals and cities in crisis in response to the coronavirus — for a finite period of time.

“Quite frankly, I’m willing to spend more money right now,” he said. “It’s a very different thing in an emergency.”

The $100-billion-plus Families First coronavirus response package Trump signed last week dramatically expands paid sick leave and family medical leave for tens of millions of workers, provisions aimed at blunting the economic impact of the pandemic.

The United States lags behind other developed countries when it comes to providing universal health care as well as paid leave for sick workers and those who have to care for family members.

“Here we had this ‘strong economy’ and all of a sudden the bubble has burst, and policymakers are scrambling to put into place basic protections other societies have,” said Rebecca Vallas, a senior fellow at the left-leaning Center for American Progress.

We recently went through a period of sustained economic growth and high employment that started under Obama and continued under Trump, until now. A wise nation might have used increased tax revenues to shore up the safety net, repair infrastructure, reduce spending on futile wars and defense overruns, invest for the future, and/or reduce deficit. Indeed companies were encouraged to cut benefits to workers to pay out more to shareholders and to their executives, without much regard to the competence or value to the company of the latter.

Now, the embarrassing inadequacies and gaps of our safety net are being exposed every day. Even the GOP has turned, albeit somewhat reluctantly, to throwing several trillion into the breach, as long as it all doesn’t all go to those who need it most. Natural disasters have become the “new normal.” But, under Trump and his kakistocracy, America has consistently been underprepared to meet them. 

That the hardest hit Americans get a substantial chunk of this emergency funding is a tribute to Pelosi, Schumer, and the Dems. Left to their own devices, Trump, Mitch, and the GOP would have basically mailed a modest check (or checks) to most Americans (other than the poorest) and funneled the rest into the pockets of their businesses buddies and state cronies with little oversight or accountability. Can you imagine the Grifter-in-Chief and his toadies being allowed to divvy up the loot, in secret, no less?

This emergency is unusual in nature. But, emergencies come and emergencies go. Presidents come and they (thankfully) go. What doesn’t go away is the need for a strong well-developed safety net that covers basic health care, unemployment, income assistance, and retirement benefits for all Americans, not just the wealthy. History has shown that’s not likely to happen as long as the GOP grifters remain in power.

We have a chance to save America and put ourselves on a better course for the future. Vote Trump and his GOP out in November. Your future and that of future generations will depend on it.
