Republican-led states have been hit the hardest. Last week, Florida and Texas alone made up one out of every three new cases, and now Florida is the center of the pandemic. On Friday, the Centers for Disease Control and Prevention reported 23,903 new cases in Florida that day alone. Hospitals are filling up as unvaccinated Americans need medical care; Austin, Texas, activated an emergency alert this weekend as its hospitals were overwhelmed.
But Republican lawmakers stand against the mask requirements and vaccines that would help stop the spread. Texas governor Greg Abbott has banned mask and vaccine mandates across the state, as has Arkansas governor Asa Hutchinson (who has since said the law was an “error”). South Carolina and Arizona have banned mask mandates in schools.
Today, in just the latest example, Senator Rand Paul (R-KY) said, “It’s time for us to resist. They can’t arrest all of us…. No one should follow the CDC.” He claimed that masking and remote learning was physically and emotionally damaging for children, and there was no reason they should not return to school full time, without masks. He said he would work to defund any school or government agency or school that did not simply resume its pre-pandemic operations.
Instead of trying to stop the spread of the virus, Republicans are blaming Biden for it. They claim that it is sparked by his handling of immigration on our southern border and that infected immigrants are responsible for the spike in the deadly disease.
When Biden asked Republican governors on August 3 to help or get out of the way, Florida governor Ron DeSantis responded: “Joe Biden has the nerve to tell me to get out of the way on COVID while he lets COVID-infected migrants pour over our southern border by the hundreds of thousands. No elected official is doing more to enable the transmission of COVID in America than Joe Biden with his open borders policies,” and claimed: “He’s imported more virus from around the world by having a wide-open southern border.”
DeSantis is not an outlier. Trump has pushed this line, Fox News Channelpersonality Sean Hannity hammers on it, and right-wing publications from the Daily Wire to National Review to the Wall Street Journal’s editorial page all insist that immigrants are to blame for the spread of the virus. Rand Paul has gone so far as to claim that administration officials are deliberately sending infected immigrant children around the country to spread the variant. Yesterday, Trump legal adviser Jenna Ellis called for Biden’s impeachment over the issue.
In fact, the administration continues to reject or expel border crossers under a public health order known as Title 42. It does permit the entry of unaccompanied minors and some vulnerable families. Migrants who cross the border are immediately required to wear masks. They are not tested at Customs and Border Patrol unless they show symptoms, but all are tested if they move into the system, and those who test positive for coronavirus are quarantined. Those slated for deportation are quarantined before they are deported. While infection rates are climbing, because of both the Delta variant and the crowding at Border Patrol, immigrants test positive at a lower rate than the rate of non-immigrants around them.
And yet, Republicans are using the deadly new coronavirus variant to stoke anti-immigrant fires.
It is cynical, it is deadly… and it takes us one more step toward authoritarianism.
As the pandemic revives and spreads, primarily as a result of GOP anti-vaccers and anti-maskers, new infections of children not eligible for the vaccine set records, and schools are about to reopen in the face of incredibly idiotic “mask bans” by magamoron, irresponsible GOP Govs like DeSantis and Abbott, you decide who the real threat is to America’s health, welfare, safety, and future!
However, despite advice from public health experts and condemnation by UNHCR, expulsions under Title 42 continue and the human cost has been devastating. Though refugees come from countries all over the world, the Department of Homeland Security expels them to Mexico, just on the other side of the border.
Reports by Human Rights First document the terrifying realities they face once there: kidnappings, violence, sexual assault, extortion and even murder in border towns where criminal gangs and cartels prey on recently expelled children and families. Just this spring, a 4-year-old Honduran boy and his asylum-seeking mother were kidnapped in Nuevo Laredo immediately after they were expelled under Title 42.
Expulsions don’t just impact migrants from Mexico and Central America. Despite the recent designation of temporary protected status for Haitian migrants within the United States, the Biden administration has sent plane after plane of asylum-seeking families back to Haiti, with some Haitians being expelled to Mexico. The UndocuBlack Network and the Haitian Bridge Alliance, for example, document a Haitian woman expelled to Mexico with her three-day-old baby, where she will face extreme anti-Black discrimination and be at risk of violence and homelessness.
Public health has often been used as a pretext for restrictionist immigration policies. Beginning as early as 1793, when Haitians were blamed for bringing yellow fever to Philadelphia, nativism and xenophobia have long merged with concerns about public health to exclude immigrants and refugees. These concerns were not justified by science then, and they certainly are not justified now.

Thanks, my friends, for speaking out about the continuing outrages perpetrated by the Biden Administration at our Southern Border. So many, many “practical experts” out here in the “real world,” like Lindsay and Sarah, who would be heads and shoulders above current immigration “leadership” at DHS, DOJ, and EOIR and who would bring “real, qualified, expert judging” to the BIA and the Immigration Courts.
The Biden Administration’s failure to actively recruit, attract, and promptly bring on board the “best and the brightest” that American law has to offer for these critical jobs (which do NOT require Senate confirmation) is a disgrace! Betcha Stephen Miller could tell them how to do it! But, curiously, the Biden Immigration Team seems to think that alienating the best progressive minds in the business, the folks who helped them get elected and can fix their immigration problems, is smart politics and great public policy! Go figure!
Suspending the rule of law and international treaty obligations is never “OK” and it’s not something to be “studied.” “Gee whiz, should we comply with the law or continue to violate it; should we continue to send people to possible kidnapping, rape, torture, extortion, and/or death with no process or should we give them fair hearings; should we continue unqualified Trump hacks in key positions and keep defending illegal policies or should we hire qualified experts from the NDPA to restore and promote due process?” These are the “questions” that folks like Garland, Mayorkas, and their “spear carriers” are being paid to “study” while innocent humans are daily being abused and dying in the “real world” that these Biden Cabinet officers appear to have absented themselves from?Gimme a break!
We need an end to the deadly nonsense at DHS, DOJ, and EOIR NOW! Keep the outrage, the op-eds, the law suits, and the exposure and documenting of Mayorkas’s and Garland’s illegal, immoral, and incompetent actions coming until we get change and our Government delivers on the Constitutionally-required promise of due process, equal protection, and racial justice for all persons!

In April 2020, COVID-19 reached the U.S. Immigration and Customs Enforcement (ICE) Detention Center in Eloy, Arizona. Dr. Merlys Rodriguez Hernandez, who had been detained there for six months, said she knew it would spread quickly.
Rodriguez Hernandez is originally from Cuba, where she and her husband, Lazaro, practiced medicine before they were forced to flee government persecution, she said. When they reached the U.S. border, they applied for asylum. Both were detained, in separate facilities, Merlys said. After eight months, Lazaro was granted protection from having to return to Cuba. Merlys’ petition, based on identical circumstances, was tried in a different immigration court – and denied, she said.
Cornell Law School’s Asylum Clinic took her case, under the direction of Stephen Yale-Loehr, professor of immigration law practice, and Ian M. Kysel, visiting assistant clinical professor of law. Law students Conor Bednarski, J.D. ’21, and Michelle Zhu, J.D. ’21, litigated an appeal to the U.S. Board of Immigration Appeals.

Meanwhile, Rodriguez Hernandez was trapped in a detention system raging with COVID-19, she said. She fell ill with the virus in May 2020 and spent 40 days in isolation, suffering from joint pain, body aches and severe diarrhea and confined to a cell she was expected to sanitize herself, she said. Tara Pilato, co-executive director emerita of the Weill Cornell Center for Human Rights at Weill Cornell Medicine, who consulted on the case, observed that “the conditions Merlys reported were not only inhumane, but against all best practices for caring for patients with COVID-19.”

“Watching this preventable tragedy unfold week after week, as we were told to shelter in place, was the hardest part of working on this case,” Bednarski said.
As the pandemic spread, Bednarski and Zhu tried to secure Rodriguez Hernandez’s release, and then supported a collaboration with pro bono counsel who filed a habeas corpus writ in federal court.
Kayleigh Yerdon, J.D. ’21, took the lead on the case during the fall 2020 term. With Spanish interpretation assistance from Cornell doctor of juridical science student Ana Ruival, LLM ’19, Yerdon won her client’s release on bond. Rodriguez Hernandez was released in October 2020, after 13 months in detention, Yerdon said.
“As a law student, being able to step into court for the first time via teleconference and win, knowing my client would walk free as a result, was just an incredible experience,” Yerdon said. She also took on Lazaro’s case, successfully litigating a motion to reopen his case, and eventually securing him asylum, she said. Yerdon was recently honored with the Law School’s Freeman Award for Civil-Human Rights, in part in recognition for her clinical work.
Meryls’ case shows that some of the most harmful flaws in the immigration system can be addressed by applying basic rights principles, Kysel said.
Rodriguez Hernandez and her husband are now living in Kentucky as they work to appeal the denial of her request for asylum. She said she hopes to become an advocate for immigrants who remain detained during the pandemic. Meanwhile, the legal team has continued its efforts to engage in other advocacy and to amplify the impact of their legal work on the doctor’s case, Kysel and Yale-Loehr said.
Recently, Rodriguez Hernandez told her story in a first-person essay in the New England Journal of Medicine, with the support of her Cornell Law clinic team and a team from the Weill Cornell Center for Human Rights, led by Pilato and Dr. Gunisha Kaur, assistant professor of anesthesiology.
“As one of our colleagues in the medical field, Merlys’ harrowing experience deserved attention from a medical-legal perspective,” said Pilato and Kaur. “The inhumane conditions in ICE detention centers have triggered some of the worst COVID-19 outbreaks in the country.”
In the piece, Rodriguez Hernandez wrote, “It is a bitter irony that while the first waves of the pandemic ravaged the U.S., I remained in a detention system when I could have made a difference to patients in a health care system in dire need of providers.”

Note that in the dangerous and defective “court system” being run by Garland, the Respondent continues to struggle with appeals of her asylum denial even though her husband’s identical case wasGRANTED! Worse yet, both cases should have been “no brainer” asylum grants that could have been rapidly granted by the Asylum Office without detention or Immigration Court in a properly functioning system with expert judges setting correct asylum precedents at the BIA.
No wonder this system is continuing to deny justice, threaten lives, waste resources, and create backlogs under Garland! As noted in the above posting, even the New England Journal of Medicine is up in arms about this outrageous situation and mockery of our legal process!
But, Garland and his merry band at DOJ and EOIR seem impervious to criticism, rationality, or the rule of law! And to date, they have shown little or no willingness to engage constructively with progressive human rights and Immigration experts. I guess that’s what “Miller Lite Justice” is all about!

There is simply no excuse for Garland’s continued mishandling of EOIR and asylum law generally! And, bureaucratic “Dedicated Dockets” run from the Falls Church Tower won’t solve the problem. Not by a long shot!
Progressive advocates and members of the NDPA need to stay energized, stay angry, and keep letting the Biden Administration feel the outrage at Garland’s inexcusable continued mishandling of EOIR!These problems will NEVER be solved with the group currently calling the shots at EOIR!
So, the question remains, with all this expertise available and some obvious solutions to some really dumb and life-threatening procedures and policies, why are Garland and Mayorkas “groping in the dark”rather than bringing in and empowering the progressive experts who will solve these problems?

President Biden has put Vice President Harris in charge of border issues and racial justice reforms. Progressive advocates should let her know directly that Garland is NOT getting the job done at Justice, and that they are sick and tired of not being consulted and having their expert candidates for EOIR snubbed in favor of Trump holdovers and non-progressives! I wake every morning to follow news of our sisters and brothers, thinking especially of the children, who have set out from places like El Salvador, Guatemala, Honduras, Venezuela, Cuba, Nicaragua and Haiti–even as far as Cameroon and the Democratic Republic of the Congo–to seek protection at our doorstep. My heart aches for them and I pray for their safety.
Today’s readings remind us of our obligation, as followers of Christ, to speak the truth and follow the light. The truth is that people are suffering, both young and old, and desperately seeking safety and welcome in our country. Yet U.S. authorities and policies are often hostile to receiving them. Their arrival at our doors is deemed a “crisis.” As followers of Christ, we must and we will stand up, act bravely and generously, to speak the truth and welcome them.
The real crisis is not at the border, but within the families forced to make the difficult decision to leave, and in the hearts of those who refuse to follow Jesus’ light. We, as Christians, must walk in the path of light as Jesus instructs, and do the right thing. We must make room at our table and remember that we all belong to each other. We must take Jesus’ words to heart and remember to love the mother, the father and the child at the border as if they were our own.
This is not a crisis for us, although it certainly is for the men, women, and children who are fleeing. For us it is an opportunity to act out our faith precisely as Jesus taught.
As these sojourners leave their homes in search of safety, they may repeat a prayer similar to this: “Even though I walk in the dark valley I fear no evil; for you are at my side.” The rhythm of the words and their meaning must comfort them, knowing that God is their companion. What happens when they arrive here is up to us. We could look to God and ask what He would do, but we already know the answer.

Unfortunately, too many folks promote a bogus picture of what’s at stake at our border. The “alternatives” they trumpet are basically increasing family separation and suffering in Mexico or somewhere else as pointed out in this Politico article by Jack Herrera:
The result is a new form of family separation — but instead of happening at the hands of federal agents in American government facilities, it’s taking place, family by family, in camps like the one Janiana lives in. The fact that minors won’t be expelled like everyone else has rapidly spread by word of mouth across the length of the border. And while many families choose to stick together, the pressure to separate weighs heaviest on the most vulnerable — families who fear death, whether from persecutors who have followed them to the border, or from extreme hunger.
For Janiana, the possibility of being sent back to Honduras reads as a death sentence. She shows me the scars from her torture at the hands of a powerful gang back home that her family got on the wrong side of. Fearing further reprisals, Janiana fled with her sister’s children, a teenage nephew and teenage niece as well as the niece’s several-month-old son. The children haven’t been reconnected with their mother yet, who successfully entered the U.S. to begin the process of claiming asylum in 2019, before the pandemic. Staying in Mexico, Janiana says, was never an adequate long-term solution and increasingly feels intolerable. She says the family already tried to make a new life in the southern state of Oaxaca, but danger pursued them there, where her nephew was murdered.
Today, Janiana says her only hope is that the U.S. will begin to accept asylum seekers again, especially as the country gets a better hold over the pandemic. At the moment, she says with resignation, “all we can do is wait.” Though there is one painful exception on her mind: If she were somehow able send the baby across alone, he might be allowed to stay.
“It breaks my heart to even think about it,” she says.
Why not get the trained Refugee Officers, Asylum Officers, Immigration Judges, ORR child services officers, and pro bono lawyers in place to comply with our legal obligations in a robust, timely, fair, and efficient manner?
Why not put experts, like Wendy Young of Kids in Needs of Defense, who understand how our system should work in charge of the welfare of the children? Why not put someone who understands the practical and legal needs at the border, like former Immigration Judge Ilyce Shugall, in charge of the Immigration Court response? Why not put someone like retired Judge Paul Grussendorf, who has also been an Asylum Officer and a UNHCR representative, in charge of the Asylum Office response? Why not put retired Assistant Chief Immigration Judge Robert Weisel, who worked with the UNHCR after retirement, in charge of coordinating the response with NGOs and the private sector?
Yes, the Trump regime definitely left a dismantled and dysfunctional immigration bureaucracy and structure behind. But, just repeating that time after time sounds more like an excuse than a plan or a solution.
Sure, it won’t happen overnight. But, it won’t happen at all without different folks in charge at the “retail level.” I see little evidence of any progress on a real long-term plan and the short-term response is also an unnecessary mess, given that the Biden Team has had more than four months since the election to get a new structure and new personnel in place.
While there are a few “bright spots,” like Michelle Brané and Katie Tobin, I sincerely doubt that the group in charge right now is capable of solving the practical problems in rebuilding and improving our asylum and immigration systems. Nowhere is that more obvious than at EOIR, where the dysfunctional “clown show” 🤡 stumbles on, for no apparent reason.
Many of us keep trying, to no avail, to warn Judge Garland that he literally is sitting on a powder keg with the fuse lit and burning.💣 I guarantee that the next “manufactured crisis” will be when the current group of asylum cases coming from the border hit the broken, dysfunctional, ridiculously and unnecessarily backlogged, grotesquely mismanaged, ill-prepared, and anti-asylum-biased “Immigration Courts.” Waiting for the inevitable disaster, rather than bringing in a new “A Team” from the NDPA to start solving the problems now, is a monumental mistake by Judge G.
Why not fix the system to run the way it should, rather than spreading myths, throwing spitballs, and ignoring the unfolding human tragedy that can’t be solved with draconian enforcement and lame “don’t come” messages directed at forced migrants fleeing for their lives?

The number of unaccompanied children and asylum-seekers crossing the US-Mexico border in search of protection has increased in recent weeks. The former president, his acolytes, and both extremist and mainstream media have characterized this situation as a “border crisis,” a self-inflicted wound by the Biden administration, and even a failure of US asylum policy. It is none of these things. Rather, it is a response to compounding pressures, most prominently the previous administration’s evisceration of US asylum and anti-trafficking policies and procedures, and the failure to address the conditions that are displacing residents of the Northern Triangle states of Central America (El Salvador, Guatemala, and Honduras), as well as Venezuela, Cuba, Haiti, and other countries…
The real immigration crisis is not at the border, but in the failure to respond effectively to the conditions driving forced migration, to establish orderly and viable legal immigration policies, to legalize the increasingly long-tenured undocumented population, and to reform and invest sufficiently in the US asylum and immigration court systems.

When I was in Mexico reporting on the exodus, I would talk with dozens of migrants who were just a an hour or two away from starting their trek and, to a person, not one of them said they paid any attention to new US laws and regs as they were determined to cross no matter what. Even the WashPost editorial page writers “get” the reality of human migration in a way the nativist fear-mongers never will:
Yet despite fearmongering by Republicans, the current influx is neither a public health emergency nor a national security threat. The vast majority of those allowed to enter the country will join relatives here while their asylum claims plod along. That wait is too long — it can stretch to three years or more — and the administration insists it will shrink the backlog. It has also earmarked $4 billion in aid from the pandemic relief bill for Central America — with strings attached to prevent its misuse — to attack the conditions that make life miserable there and drive migrants to seek refuge in this country.

Still, sadly, facts and reality seem largely irrelevant here.
Despite denials from Secretary Mayorkas, the Biden Administration appears to be believing Kevin McCarthy’s BS on some level.
Thursday, the Administration basically negotiated a “lite version” of Trump’s “Let ‘Em Die in Mexico” — essentially trading AstroZenica vaccine (which wasn’t approved for use in the U.S. anyway) for Mexico’s agreement to step up harsh enforcement measures against migrants crossing their Southern Border and to warehouse families arbitrarily rejected without due process by the U.S. under our bogus CDC directive. We already have seen how well that works out!

Any way you cut it, the realities of human migration, the lives of the desperate individuals involved, the views of human rights experts and advocates, and our supposed commitment to international conventions, the rule of law, and Constitutional Due Process take a back seat when the “bogus border debate” shifts into high gear.
There is actually a very simple truth here: “Forced migration” is not “optional!” In fact, a number of forced migrants prefer “death in the attempt” to “death in place.”
Therefore, all the “deterrents,” “border militarization,” “Baby Jails,” and “stay home statements” won’t ultimately stop the inexorable flow (although they might temporarily divert, modulate, or vary it— usually just enough for the “powers that be” to declare “victory at sea” as a result of their failed policies while ignoring the human carnage and lost opportunities they leave behind).

Sure, there is a timing factor. Weather, the “business plans” and propaganda of smugglers (Trump’s “enforcement only” policies have been a boon for them in more ways than one, not only boosting their fees, but diverting enforcement resources away from the “real” law enforcement problems at the border involving drugs and human exploitation), and Biden’s pledge to restore humanity and the rule of law to America all factor into the equation in some way.
But, they are not the the primary causes of forced migration, except to the extent that climatechange (ignored and worsened by Trump and the GOP) has aggravated the poverty and economic disorder in the Northern Triangle by destroying the livelihoods of many farmers and making their land essentially worthless.
Tone-deaf GOP politicos like McCarthy and Sen. Rob Portman (R-OH) apparently think the solution is to continue to mock the rule of law, violate the Constitution, and simply declare the Southern Border closed forever, al a Stephen Miller. Let families and children “die in place” in their home countries, die on the journey at the hands of other governments, or rot forever in Mexico — “Out of sight, out of mind.” As long as it isn’t happening in our country and being covered by our news outlets, who cares about human lives? That was certainly the Trump approach!
That’s hardly a “solution,” except in neo-Nazi or Soviet-era terms. The harshest and most inhuman approaches will, as they have in the past and continue to do, fail to stop desperate humans who want to survive from doing what’s necessary to save their lives and preserve their families’ futures, even when that interferes with the GOP’s “whitewashed” version of “American greatness.”
The solution involves following Constitutional due process, re-establishing the rule of law (including a radical “reform and replace” of our dysfunctional Immigration Courts), and adhering to our international obligations, both in letter and spirit. It also requires an expanded, much more robust, legal immigration system that reflects the demands of our economy, the needs of migrants, and the realities of human migration, particularly from Latin America. Like it or not, there will be more immigration.
As I have said before: “There are many ways in which we can diminish our own humanity, but none of them will stop human migration.”

Contrary to the GOP blather, immigration, voluntary, forced, coerced, legal, extra-legal, white, non-white, Christian, non-Christian, is what the real America is all about, for better or worse. Overall, immigration is a positive force for America.

Pedro isthe director of the Immigration Law Clinic at the Louisiana State University Law Center, and a former immigration staff attorney at the Bronx Defenders. Still Connected: How Immigrants Can Support Family and Community Back Home
The decision to move to a new nation is complex and emotionally charged. People who do make the decision to emigrate often wish to maintain as much support and connection as possible to reduce the grief of being away from loved ones. Immigrants have many options for staying in touch and supporting their communities and families back home.
Many immigrants struggle with the transition to a new country. Blogs such as Immigration Courtside offer compelling opinion pieces on creating fair immigrant policy. This type of advocacy can influence political change to improve the lives of immigrants. Staying connected and supporting the community and family back home can make a significant difference in the quality of life for immigrants. People who wish to share resources with folks at home can benefit from tips on how to stay in touch and provide varying types of support.
Types of Support to Offer
Support can mean different things to different people. A common way immigrants support family and community back home is through financial assistance. Wages and access to money can vary widely, depending on the area of the world you live in. Often, people emigrate to the United States to have access to greater opportunities for work and income; the money sent home can bring loved ones out of poverty.
Immigrants in the US who wish to assist loved ones back home financially can do so with secure money transfers. If you have relatives in the Philippines, for example, you can send money safely, reliably, and quickly with little to no fees using a remittance service like Remitly. You’ll have greater peace of mind, knowing that the funds you send will arrive without interference from hackers or scammers.

Talk about a favorite meal you’ve tried in the US or share popular songs of your area through YouTube. Use Teleparty to watch Netflix together. Check in with loved ones about their lives back home, including their daily routines and how they are feeling. Try to stay in touch as often as possible, using several means of contact.
Ways to Stay in Touch
Thanks to technological advances, there are many great ways to stay in touch with loved ones back home. Schedule weekly phone calls or video chats to stay caught up in the lives of loved ones, as well as texting and using social media to stay involved. Celebrate home holidays from a distance and introduce new friends to the folks back home through video gatherings. The greater the variety of contact, the better. There are many apps like Zoom or Facebook Messenger that make contact over the miles so much easier and more affordable than ever before.
Being apart does not have to be painful with the evolution of communication apps and features. Immigrants can show love and support for people back home by staying in touch, being involved, and sending financial assistance and packages.

The number of unaccompanied children and asylum-seekers crossing the US-Mexico border in search of protection has increased in recent weeks. The former president, his acolytes, and both extremist and mainstream media have characterized this situation as a “border crisis,” a self-inflicted wound by the Biden administration, and even a failure of US asylum policy. It is none of these things. Rather, it is a response to compounding pressures, most prominently the previous administration’s evisceration of US asylum and anti-trafficking policies and procedures, and the failure to address the conditions that are displacing residents of the Northern Triangle states of Central America (El Salvador, Guatemala, and Honduras), as well as Venezuela, Cuba, Haiti, and other countries…
The real immigration crisis is not at the border, but in the failure to respond effectively to the conditions driving forced migration, to establish orderly and viable legal immigration policies, to legalize the increasingly long-tenured undocumented population, and to reform and invest sufficiently in the US asylum and immigration court systems.

Don has spent his entire career solving migration and human rights problems. The Biden Administration and everyone who believes in American democracy should listen to “practical experts” like Don, rather than ignorant, racially-motivated GOP politicos and White Nationalist nativists spouting the “same old, same old” myths, fear-mongering, and unhelpful “non-solutions.”
If xenophobic rhetoric, cruelty, officially-sanctioned child abuse, evading our own legal and humanitarian responsibilities, and “enforcement only” were the “solutions,” the “problem at the Southern Border” — which has existed in one form or another for over a half century, would long ago have been solved. We can’t solve humanitarian situations that create forced migration with unilateral law enforcement gimmicks and cruelty toward the humans fighting for their lives. Human migration long pre-existed the formation of nation states and establishment of national boundaries.
Administration after administration, of both parties, have squandered time and taxpayer money on unsuccessful efforts to “enforce their way” out of forced migration situations. Contrary to GOP blather, Democratic Administrations have been almost as fixated as the GOP with unsuccessfully “detaining, deterring, and enforcing” their way out of human problems that demand more thoughtful human solutions.
All Administrations at some point prematurely claim that their efforts have “succeeded.” None actually have succeeded in addressing the causes of the migration. Therefore, none of these “false solutions” proves “durable.”
Significantly, Don is one of the few commentators to fully grasp the integral connection between the Trump regime’s complete destruction of the integrity of the Immigration Courts and its lawless, yet highly ineffective, border policies.
Real solutions don’t kill, harm, and maim refugees and forced migrants, encourage criminal cartels and corrupt foreign officials to prey on them, and stack up desperate humans in dangerous conditions just across the border because US Government officials were too biased and incompetent to operate under any semblance of the rule of law.
We can abide by our own laws, international norms, our Constitution, human decency, and common sense. It isn’t rocket science.
But, it does require a combination of expertise, courage, humanity, and practical problem solving that has been conspicuously absent from our governing structure since 2017, and severely undervalued before that.
Also, it’s certainly not that the Biden Administration has suddenly re-established due process and the rule of law at the border. Far from it!
The vast majority of those arriving at the border, even those who are applying at legal ports of entry, are unceremoniously and summarily removed without any process at all, let alone due process of law. This is all based on a largely bogus Trump-initiated exercise of authority by the CDC to use COVID-19 as a pretext to suspend the rule of law and constitutional due process at the border.
Moreover, we shouldn’t forget that even with the Biden Administration’s gradual efforts to re-establish a legal process for asylum seekers, unaccompanied children are still being held in Government detention for far longer than the 72-hours permitted under law. This problem won’t be solved, as some GOP nativists incredibly suggest, by dumping kids back across the Mexican Border, returning them to danger in their home countries without regard to their individual situations, or forcing them to turn to smugglers to make their way to relative safety in the interior of the U.S.
Nor will it be solved by long-term detention in disgraceful and inhumane “Baby Jails!” Ask my Georgetown Law colleague and author Professor Phil Schrag of the CALS Asylum Clinic about that!
Interestingly, some of the biggest complainers spreading the “open borders myth” are Greg Abbott and other Texas GOP politicos who have prematurely “reopened their state” in the middle of a pandemic in blatant contravention of best medical and public health advice. So, you can summarily dismiss their “crocodile tears” and bogus “hand wringing” about public health and safety.
That’s particularly true since the GOP is just coming off a massive example of how their incompetent mis-governance of Texascaused unnecessary misery and loss of life among Texas residents as a result of a highly predictable and long-foreseen “weather emergency.” Why does the mainstream media often continue to treat these “political hacks,” who couldn’t “govern” their way out of a paper bag, as credible spokespersons on anything, let alone human rights situations of which they have no expertise whatsoever?
🇺🇸🗽⚖️Due Process Forever! Re-Establish The Rule Of Law, Including Full, Robust Humanitarian Protections At The Border& In Our Disgracefully Dysfunctional Immigration “Courts.”
Before the inauguration, President Biden pledged a $1.9 trillion COVID-19 relief bill. Then, hours after he entered the Oval Office, he introduced an immigration bill, The U.S. Citizenship Act of 2021, which aims to put millions of undocumented immigrants on a pathway to citizenship. At first glance, these initiatives seem unrelated; in fact, they are deeply connected. Combining them is the best way to help us battle the COVID-19 pandemic and recover from the recession. Here’s why.
In the first wave of the COVID-19 pandemic, the United States and the world over learned a lesson about who was truly essential to the economy: the home health aides and nurses who care for the sick, the grocery and delivery workers who keep our stores and kitchens stocked, and the workers at our farms and food processing plants who keep our food supply chain from collapsing. These and so many other overlooked jobs — classified as “essential and critical” by the Department of Homeland Security — hold our society together, protect us, and make our economy work.
Large numbers of these essential workers are also undocumented immigrants. Over 78 percent of immigrants without legal status work in these fields, according to a report by UCLA’s Latino Policy and Politics Initiative. They’re not just risking their lives to keep American citizens safe and help rebuild our economy, but they do so without legal protections and under the constant fear of deportation. That’s inhumane. But it’s also dangerous for Americans. With hospitalizations of COVID-19 patients surpassing 52,000, Congress must follow the lead of countries like France and give these essential workers a fast track to the citizenship they deserve.
It’s no secret that immigrants are helping to keep us all afloat. Despite being just 13 percent of the population, immigrants make up 37 percent of all home health aides and almost one third of all physicians and psychiatrists. With a very real threat of meat and poultry shortages at the beginning of the pandemic, immigrants filled more than a third of the tough food processing jobs and nearly half of all farm jobs picking our fruits and vegetables. And as parents across the country are placed in the impossible situation of balancing full-time work and parenting during a pandemic, once again immigrants help shoulder the burden, making up more than 20 percent of all childcare workers in day care centers.
And yet, despite all of this, our federal government acted as though we didn’t need these workers. As the pandemic raged, millions of immigrants were explicitly left out of the CARES Act relief efforts, as were millions of their U.S. born children and spouses who were penalized for having an unauthorized immigrant in the family. Meanwhile, the Trump Administration sought to shut the border to immigrant workers and students, all but stopped processing citizenship applications and ended asylum for people fleeing horrific violence. It also fought unsuccessfully all the way to the Supreme Court for the right to end protections for Dreamers, tens of thousands of whom are essential health care workers.
So what would an effective federal response look like?

SAN DIEGO (AP) — The Biden administration on Friday announced plans for tens of thousands of asylum-seekers waiting in Mexico for their next immigration court hearings to be allowed into the United States while their cases proceed.
The first of an estimated 25,000 asylum-seekers in Mexico with active cases will be allowed in the United States on Feb. 19, authorities said. They plan to start slowly with two border crossings each processing up to 300 people a day and a third crossing taking fewer. Administration officials declined to name them out of fear they may encourage a rush of people to those locations.

The move is a major step toward dismantling one of former President Donald Trump’s most consequential policies to deter asylum-seekers from coming to the U.S. About 70,000 asylum-seekers were enrolled in “Remain in Mexico,” officially called “Migrant Protection Protocols,” since it was introduced in January 2019.
On Biden’s first day in office, the Homeland Security Department suspended the policy for new arrivals. Since then, some asylum-seekers picked up at the border have been released in the U.S. with notices to appear in court.

Earlier this week, Press Secretary Jen Psaki appeared to say it would take weeks if not months for the Administration to develop a plan to dismantle “Remain in Mexico.”
These are all individuals who have been previously screened and found to have a “credible fear” of persecution by a USCIS Asylum Officer. Many have been waiting for hearings for more than one year and have had their hearings postponed by EOIR time after time.
Additionally, many ofthe Immigration Judges assigned to the “Remain in Mexico” Program have notoriously high asylum denial rates, some approaching 100% denials.
I sure hope that the Pro Bono Bar is working with USCIS and EOIR to insure that all of these individuals are represented. As we know, that’s the key not only to insuring court appearances, but also to increasing the chances for success on the asylum application.
Vigorous representation of asylum seekers will also be the key to dismantling the aggressive anti-asylum, anti-due-process “jurisprudence” that the defeated regime attempted to implement at a “weaponized” EOIR. Where necessary, these cases must be litigated to the Courts of Appeals and used as examples of the pressing need for reform of the broken, unfair, and dysfunctional U.S. Immigration Courts.
For now, it remains unclear what will happen to newly arriving asylum applicants. Will they receive the “credible fear” screening to which they are legally entitled? (It appears that some families applying for asylum have been screened and released to await hearings in the U.S.) Or, will they be arbitrarily returned to harm’s way with no process at all, pursuant to Stephen Miller’s bogus “CDC border closing order” that has yet to be repealed?
Progress! But still lots of confusion at the border as a result of the defeated regime’s extralegal shenanigans!
Still, dismantling the mess Miller left behind shouldn’t be rocket science. Just common sense and using the existing legal tools to solve human problems, rather than intentionally aggravating them. But, it will take different folks (experts) in charge to make it happen!

After days of confusion about changes along the southern border, the Biden administration on Wednesday said immigrants should not try to enter the US because most will still be turned away under a Trump-era policy that has recently come under legal scrutiny.

Confusion about who was being allowed into the US in recent days forced the administration to issue a stronger warning. Last week, reports of some families being allowed into the US after being apprehended at the border resulted in speculation that immigrants would no longer be immediately expelled and instead be allowed to fight their immigration cases from within the United States. In the Rio Grande Valley in South Texas, immigration advocates have reported seeing about 100 people a day released by Customs and Border Protection. In other parts of Texas, shelters have also seen increasing numbers of immigrant families, but it is not clear why.
Attorneys and advocates who work with immigrants along the border have been bombarded with phone calls and texts about whether they should try their luck at getting into the US. Erika Pinheiro, policy and litigation director with the immigrant advocacy group Al Otro Lado, said it was “incredibly disappointing” that the Biden administration has continued to expel immigrants under the CDC order.
“We know now that the CDC order prohibiting asylum processing at the border did not arise from public health concerns but rather was part of Stephen Miller’s efforts to dismantle the US asylum system and was implemented despite opposition from CDC leadership,” Pinheiro said, referring to one of Trump’s former senior advisers. “US expulsions of asylum-seekers, including infants, constitute plain violations of domestic and international laws meant to protect vulnerable refugees. CBP absolutely has the resources to process asylum-seekers in a safe and humane way.”
The turnbacks, known as expulsions, are legally different from deportations, which would mean an immigrant had actually undergone the immigration process and found to not be legally allowed to stay in the US. Critics say the government is using the public health orders as an excuse to turn back immigrants at the border.

“While we recognize that the Biden administration has been saddled with a lot of bad policy and structural problems, it cannot continue the Trump administration practice of turning away people in danger based on illegal policies, such as the notorious and pretextual Title 42 policy,” said Lee Gelernt, an attorney with the ACLU.

“Go suffer and die somewhere else, out of our sight,” might not be the best message for an Administration trying to re-establish its human rights and humanitarian leadership and credentials.Ever hear of the “St. Louis Incident?” It’s always easy to find a way to “just say no” to refugees — and the consequences are seldom pretty.
Those who won’t learn from history are destined to repeat it. Refugee and forced migration situations happen in the “here and now;” they can’t be “back burnered” — no matter how much policy officials might wish otherwise. In a forced migration situation, “doing nothing” is an action that produces consequences for both the forced migrant and those who ignore their plight.
There are many daily potentially deadly and dehumanizing consequences of continuing to ignore asylum laws and Constitutional due process for asylum seekers at our Southern Border.
One predictable one: Instead of turning themselves in at the border or to the Border Patrol shortly after entry, as had been happening until Miller & co. intervened, those seeking refuge apparently have gotten the message that our legal system is and remains a sham for them. Consequently, increasingly they are simply evading the Border Patrol and disappearing into the interior with no screening whatsoever — health, legal, or background. Also, by intentionally driving people out of the legal system, the Administration is totally blowing a chance to harness and build upon one of the most powerful known facts — represented individuals with asylum hearings scheduled show up for their hearings!
According to an article in today’s Washington Post, the estimated number of so-called “get always” — actually human beings seeking refuge — hit 1,000 on Sunday.
Sure, there are many aspects of this problem. But, it has been “out there” for nearly a year!
Sure seems to me that with the right experts in charge, including folks like Lee Gelernt and Erika Pinhero, this issue could and should have been addressed more constructively and with much more urgency by the Biden Administration by now. Why not harness the expertise and proven problem solving abilities of folks like Lee, Erika, and many other members of the New Due Process Army rather than fighting with and resisting them?
Instead, it looks like time and resources will continue to be wasted on forcing policy changes through litigation. Meanwhile, vulnerable asylum seekers and their families will continue to suffer as illustrated by this recent article from HuffPost about the human consequences for those caught up in the Government’s scofflaw border policies.
NOTE TO PRESIDENTIAL PRESS SECRETARY JEN PSAKI: Sorry, Jen, but those fleeing for their lives don’t generally respond well to “don’t come right now, we don’t want you” messages, particularly from folks who have never been in that situation themselves. It’s actually pretty insulting to think that folks fleeing to the U.S. 1) aren’t smart enough to know the dangers involved; 2) don’t realize that the the U.S. Government doesn’t want them; and/or 3) have choices about their travel as Jen and her buddies might have when planning a summer vacation.
As one of my esteemed colleagues once told me: “Desperate people do desperate things.” What about people who keep repeating the same policy mistakes over and over while expecting different results and failing to grasp either the absolute urgency or the human side of forced migration issues? It’s sort of like going to the emergency room with a burst appendix and being told, “Why don’t you just sit in the waiting room until we doctors figure out what to do? Get back to you later!”
Somewhere out there, Stephen Miller must be gloating about how he totally outsmarted and outflanked the Biden Team!

Make no mistake: Democracy may have survived this year, but President Biden and Vice President Harris were elected despite, not thanks to, weakened electoral systems. Together with the Democratic Congress, they now have the opportunity to implement reforms that reaffirm our nation’s promises that our country represents and works for everyone. We as Democrats must act before it is too late.
Our democratic system faces extraordinary threats today because of sustained attacks from Republican leaders who throw up roadblocks to voting and, among the worst actors, stoke the flames of white supremacy and hyper-nationalism to cling to power. There can be no clearer example than the covid-19 pandemic. The deaths of more than 450,000 people in the richest country in the world are symptomatic of a democracy in crisis and a political system that rewards cronyism over competence. Despite strong public support for the Centers for Disease Control’s work, the Affordable Care Act, and other economic justice and safety-net policies that could save lives, millions nevertheless continue to contract the disease without adequate access to health care.
No thinking person can deny that the communities of color disproportionately suffering and dying from this pandemic are also the people whose votes — and ability to hold failed leaders accountable — have been continuously suppressed.
The pandemic has been a collision of tragedy and corroded institutions, and the challenge is in how we respond. We can either engage in collective amnesia about what we have just lived through, and leave an unaccountable government in place, or we can rise to meet this moment by fixing the broken social compact. Defeating Trump was not enough. Meaningful progress on health care, racial justice and the economy requires aggressive action on voting rights, partisan gerrymandering and campaign finance.
One of the first steps must be an overhaul of the Senate filibuster, which has long been wielded as a cudgel against the needs of millions who struggle. Today, the parliamentary trick creates a more sinister threat to our nation: the ability of a minority of senators, who represent 41.5 million fewer people than the Senate majority, to block progress favored by most Americans.
Democrats in Congress must fully embrace their mandate to fast-track democracy reforms that give voters a fair fight, rather than allowing undemocratic systems to be used as tools and excuses to perpetuate that same system. This is a moment of both historic imperative and, with unified Democratic control of the White House and Congress, historic opportunity.
The agenda to restore democracy also includes passing the For the People Act to protect and expand voting rights, fight gerrymandering and reduce the influence of money in politics; the John Lewis Voting Rights Advancement Act to restore the full protections of the 1965 Voting Rights Act; and the Protecting Our Democracy Act to constrain the corruption of future presidents who deem themselves above the law. These landmark bills have broad-based support, and would have passed long ago were it not for obstructionist leaders who fear losing their own influence if the American people have more power of their own.

The Trump GOP lies, insurrections, and blatantly false claims attempting to undermine the very clear Biden-Harris victory have been a smokescreen for the real voting problems — the unrelenting efforts of the GOP — “The Party of the New Jim Crow” — to suppress the votes of Americans of color. And, as Abrams cogently points out, one reason for the denial, downplaying, and maliciously incompetent mishandling of the pandemic by the Trump regime was that so many of the victims were among communities of color — those they never cared about and whose humanity they continuously tried to deny and disparage. There is a very clear connection between the dehumanization of asylum seekers and other migrants and the disenfranchisement of voters of color. It’s all part of “Dred Scottification” — a disgraceful practice sanctioned by none other than the GOP’s Supremes’ majority!

Tuesday’s directives mandate a review, but do not end, the Remain in Mexico policy, which Biden had said he would rescind on his first day in office. Officially termed the Migrant Protection Protocols, or MPP, it has forced roughly 70,000 asylum seekers back to Mexico to wait in some of the world’s most dangerous cities for immigration court hearings in the U.S. that have been largely suspended since the Trump administration effectively closed the border last March, citing COVID-19.
Human Rights First has recorded at least 1,134 public reports of murder, torture, rape and kidnapping against asylum seekers returned to Mexico under MPP. Thousands have given up.
On Jan. 20, the Homeland Security Department announced that no new asylum seekers would be subjected to MPP, telling some 30,000 migrants left in limbo at the border by Trump that they should “remain where they are, pending further official information from government officials.”
Tuesday’s directives, as described by the officials, provide little additional clarity as to how the Biden administration will process those already subjected to MPP, along with thousands of others waiting.
Ensuring that MPP and other cases are processed “humanely” while safeguarding public health amid a pandemic is “fairly complicated,” one senior official said.
“I can’t tell you exactly how long it will take to have an alternative to that policy,” the other senior official said. Those under MPP will “certainly be taken into account because of the length of time they’ve waited and the conditions they are waiting in.”
On Monday, the administration effectively dropped appeals by the Trump administration in lawsuits against MPP and the diversion of billions in federal funds for border barrier construction. The acting Homeland Security head asked the Supreme Court to remove both cases, scheduled for oral arguments later this month, from its docket.
The Biden administration has not yet said what it will do with the effective closure of the border by the Trump administration under Title 42, which Tuesday’s directives do not address. The officials Monday cited ongoing litigation over the policy for the lack of action.
Under Title 42, Trump officials rapidly expelled hundreds of thousands of migrants, including asylum seekers and unaccompanied children, without due process. Whistleblowers at the Centers for Disease Control and Prevention said the Trump White House pushed the order for political, not public health, reasons.
On Tuesday, Biden also will take steps to restore Obama-era pathways allowing vulnerable groups in Central American to apply for admission to the U.S. from within the region, officials said.

Wonder how many more will be murdered, raped, tortured, kidnapped, robbed, extorted, get sick, or give up while their fate is being studied? Out of sight, (somewhat) out of mind. Five things that could be done immediately, without study:
Vacate all the anti-asylum precedents from the AG and the BIA since 2016;
Assign some Immigration Judges whose “TRAC Record” shows that they understand asylum law and aren’t afraid to grant protection to hear any scheduled MPP cases;
Replace the BIA (or at least create an “MPP Appeals Panel”) with judges who have demonstrated excellence and expertise in asylum law;
Do not go forward with any MPP case involving an unrepresented applicant;
Bar the issuance of “in absentia orders” in MPP cases.
It was the first reported death at the Stewart Gulag since the Trump regime’s final killing in December 2020.
With “Caretaker Bureaucrats” in charge @ DHS & DOJ, the deadly migrant killing, harming, and terrorizing policies continue unabated. Indeed, as far as I can tell, seedy DOJ lawyers are pushing forward with defending the very cruel, stupid, inhumane, and illegal policies and bankrupt legal positions that the Trump immigration kakistocracy made infamous. The same policies that Biden and Harris campaigned against! EOIR continues to crank out skewed anti-immigrant, anti-asylum jurisprudence.
The current policies are killers; the bodies continue to pile up, even if they are (quite intentionally) in obscure places like Lumpkin, GA, the “no persons land” near the Mexican border, and in dangerous and corrupt foreign nations where our Government mindlessly “orbits” other human beings without regard to what it will happen to them.
For now, these stories of death, despair, and unnecessary human suffering are largely “out of sight, out of mind.” But, they are being documented and eventually history will highlight those, from the Roberts’ Court on down, who abjured their duties to their fellow humans and abused their positions of public trust.

Last week, 9000 Hondurans were beaten and tear-gassed in Guatemala as they tried to make their way to the U.S. border. More will be coming. The Biden administration just introduced the most comprehensive immigration bill since Ronald Reagan and also hopes to embark on a new strategy for the Northern Triangle of El Salvador, Honduras and Guatemala.
This is undisputedly good news for a region ravaged by two Category 5 hurricanes in 2 weeks and an economy devastated by the Covid pandemic. But, unless that aid directly addresses the rampant corruption that has taken hold in the region, it will not stop thousands of desperate people from fleeing countries that give them little hope to survive much less flourish.
Make no mistake, it is corruption that has stolen hope from the region. Elites steal from school and hospital budgets to fund political campaigns and line pockets. Politicians give family members and supporters coveted government positions that should go to those most qualified. Police are bribed and threatened to look away while drug traffickers and gangs shatter communities.
Until this staggering systemic corruption is dismantled and the education, health and security institutions strengthened, Central Americans have little reason to hope for a future in their own countries.
During his presidential campaign, Joe Biden issued just one policy position for the Western Hemisphere and it was on Central America. In it he proposed a number of worthy initiatives, but one merits special consideration– a Central American anti-corruption commission that operates outside the control of the elites who are most threatened by its existence.
To be successful, this commission must learn from past experiences in Guatemala (CICIG), Honduras (MACCIH) and El Salvador (CICIES). While the first two enjoyed significant success, as soon as U.S. and local political pressure waned even a little, the local elites joined together to expel them.

Easier said than done. Many of the corrupt governing elites in Central America have close ties to our Government. They aren’t lightly going to let foreign assistance, whether from governments, NGOs, or private agencies go anywhere but their own pockets.
Also, Republicans in Congress have shown no willingness to deal with the overt corruption, grafting, and grafting of the Trump regime.
But the article is spot on about two things. Most Central American migration is driven by political punishment and exploitation of the people by corrupt government elites and those allied with them (gangs, in many instances). Far from being “random violence” or “common crime” as many restrictionists and border bureaucrats claim, it’s simply a variation of classic political, ethnic, and social group persecution. Those fleeing this abuse are refugees. Only by abdicating the law, intentionally skewing it, and too often just overtly violating it (sometimes with the complicity of courts, sometimes in violation of court orders) has our Government been able to avoid granting them the legal protection they deserve.
Second, desperate refugees are going to continue to come as long as they perceive it’s safer here than in their broken home countries or any of the other countries they will have to cross to get there. No walls, prisons, death at the border, violations of domestic and international law, racist rhetoric, illegal deportations, child abuse, misogyny or or other cruel, inhuman, and immoral policies will stop human migration.
We know roughly how many have been illegally returned and imprisoned. We have some “guesstimates” as to how many additional border crossers our failed policies have killed.
But, we have little or no idea how many have taken to heart our message about the falseness of our claim to be a “nation of laws” and the readily apparent bankruptcy of our legal system. Undoubtedly, those who “get it” have or will in the future simply keep crossing the border until they die in process or get to the interior where their chances of melding in and surviving are much better than their chances of getting a asylum or other protections from an EOIR that still appears to be carrying out the Steven Miller White Nationalist agenda.
The “government policies” of actively discouraging and punishing asylum applicants who apply in an orderly way at the border is as insanely stupid as it is cruel and illegal. Actually, allowing individuals to apply for asylum at the border “regardless of status” is a hallmark of the Refugee Act of 1980!
A few thousand desperate refugees who walk here from Central America pose no realistic threat to America or our national security. They merely detract attention from the real threats: armed right wing insurrectionists launching a deadly attack on our Capitol, right wing domestic terrorists energized by Trump, and maskless “magamorons” running around spreading deadly disease.
Process those applying at the border promptly under the appropriate generous legal criteria after giving them access to trained asylum advocates. Admit those who qualify after proper health and security screening. Work with the UNHCR and NGOs on how to handle those who don’t meet refugee criteria. Just aimlessly returning them to danger zones in the middle of a pandemic is obviously a nonstarter. So, we’re going to need smarter people, with real expertise and a humanitarian outlook, working on better solutions. We know lots about what DOESN’T work. Now, we need to come up with what WILL work.
