1924 Act
The 1924 Immigration Act vilified, dehumanized, and barred many of those immigrants who have made America great, like Italian Americans being demeaned in this cartoon. Yet, some descendants of those unfairly targeted appear oblivious to the mistakes of the past and willing to inflict the same immoral lies, harm, and suffering on today’s migrants.

“I think that we have sufficient stock in America now for us to shut the door.”

That sounds like Donald Trump, right? Maybe on one of his campaign stops? It certainly fits the mood of the country. This year, immigration became voters’ “most important problem” in Gallup polling for the first time since Central Americans flocked to the border in 2019. More than half of Americans perceive immigrants crossing the border illegally as a “critical threat.”

Yet the sentiment expressed above is almost exactly 100 years old. It was uttered by Sen. Ellison DuRant Smith, a South Carolina Democrat, on April 9, 1924. And it helped set the stage for a historic change in U.S. immigration law, which imposed strict national quotas for newcomers that would shape the United States’ ethnic makeup for decades to come.

. . . .

The renewed backlash against immigration has little to offer the American project, though. Closing the door to new Americans would be hardly desirable, a blow to one of the nation’s greatest sources of dynamism. Raw data confirms how immigrants are adding to the nation’s economic growth, even while helping keep a lid on inflation.

Anyway, that horse left the stable. The United States is full of immigrants from, in Trump’s memorable words, “s—hole countries.” The project to set this in reverse is a fool’s errand. The 1924 Johnson-Reed immigration law might have succeeded in curtailing immigration. But the restrictions did not hold. From Presidents Johnson to Trump, efforts to circle the wagons around some ancestral White American identity failed.

We are extremely lucky it did. Contra Sen. Ellison DuRant Smith’s 100-year old prescriptions, the nation owes what greatness it has to the many different women and men it has drawn from around the world to build their futures. This requires a different conversation — one that doesn’t feature mass expulsions and concentration camps but focuses on constructing a new shared American identity that fits everyone, including the many more immigrants who will arrive from the Global South for years to come.

https://www.washingtonpost.com/history/2024/05/24/johnson-reed-act-immigration-quotas-trump/

. . . .

Johnson and Reed were in a triumphant mood on the eve of their bill’s enactment. “America of the melting pot will no longer be necessary,” Reed wrote in the Times. He remarked on the new law’s impact: “It will mean a more homogenous nation, more self-reliant, more independent and more closely knit by common properties and common faith.”

The law immediately had its intended effect. In 1921, more than 200,000 Italians arrived at Ellis Island. In 1925, following the bill’s enactment, barely 6,000 Italians were permitted entry.

But there were less intended consequences, too, including on U.S. foreign relations. Although Reed insisted there was nothing personal about the act’s exclusion of Japanese people, the Japanese government took strong exception, leading to an increase in tensions between the two countries. There were riots in Tokyo. The road to Pearl Harbor was laid.

During the 1930s, after the eugenics-driven Nazis seized control of Germany, the quotas established by the act helped close the door to European Jews and others fleeing fascism.

At the same time, the law also inspired a small but determined group of opponents led by Rep. Emanuel Celler (D-N.Y.), who were committed to overturning it. Celler’s half-century-long campaign finally paid off in 1965 at the Statue of Liberty when, as Celler looked on, President Lyndon B. Johnson signed the Immigration and Nationality Act, which ended national origin quotas.

But with anti-immigration sentiment on the rise and quotas once again on the table, it’s clear that a century after its enactment, the ghost of Johnson-Reed isn’t completely gone.

Many thanks to my friend and immigration maven Deb Sanders for alerting me to the Sander article. I strongly urge everyone to read both pieces at the links above.

Perhaps the most poignant comment I’ve received about these articles is from American educator, expert, author, and “practical scholar” Susan Gzesh:

And because of the 1924 Act, my grandparents lost dozens of their siblings, parents, aunts, uncles, nieces, and nephews to the Holocaust in the 1940s because Eastern European Jewish immigration to the US had been cut off. They would have been capable of sponsoring more family to come to the US in the late 1920s and 30s, but there was no quota for them.

I have no words to describe my feelings about so-called experts who would praise the 1924 Act. I know that Asian Americans must feel similarly to my sentiments.

Well said, Susan!

I’ll leave it at that, for you to ponder the next time you hear Trump, DeSantis, Abbott, and the like fear-monger about the bogus “invasion,” spout “replacement theory,” and extoll the virtues of extralegal cruelties and dehumanization inflicted upon “the other” — typically the most vulnerable who are  seeking our legal protection and appealing to our senses of justice and human dignity! And, also you can consider this when the so called “mainstream media” pander to these lies by uncritically presenting them as “the other side,” thereby echoing “alternative facts!”

It’s also worth remembering this when you hear Biden, Harris, Schumer, Murphy, and other weak-kneed Dem politicos who should know better adopt Trumpist White Nationalist proposals and falsely present them as “realistic compromises” — as opposed to what they really are —  tragic acts of political and moral cowardice!

Eventually, as both of the above articles point out, America largely persevered and prospered over its demons of racism, anti-Catholicism, and anti-immigrant nationalism. But, it would be wrong to view this “long arc” analysis as “zeroing out” the sins and horrors of our past.

Susan Gzesh’s relatives died, some horribly and painfully, before their time. That can’t be changed by future progress. Nor can the children they might have had or the achievements they never got to make to our nation and the world be resurrected.

As Susan mentions, the 1924 Act also reinforced long-standing racism and xenophobia against Asian Americans that led to the irreversible harm inflicted by the internment of Japanese American citizens, continuing Chinese Exclusion, and a host of state laws targeting the Asian population and making their lives miserable. Belated recognition of the wrongfulness and immorality of these reprehensible laws and actions does nothing for their past victims.

Many Irish, Italian, and other Catholics and their cherished institutions died, lost property, or were permanently displaced by widespread anti-Catholic riots brought on and fanned by the very type of biased and ignorant thinking that undergirded Johnson-Reed. They can’t be brought back to life and their property restored just by a “magic wave of the historical wand.”

U.S. citizens of Mexican-American heritage were deported and dispossessed, some from property their ancestors had owned long before there was even a United States. Apologizing to their descendants and acknowledging our mistakes as a nation won’t eliminate the injustices done them — ones that they took to their graves!

Despite the “lessons of the Holocaust,” America continues to struggle with anti-Semitism and anti-Islamic phobias and indifference to human suffering beyond our borders.

And, of course, the poisonous adverse impacts of slavery on our nation and our African-American compatriots continue to haunt and influence us despite disingenuous claims to the contrary.

Migrants Are Leading Clean-up Efforts in Florida, Despite DeSantis’ Crusade Against Them

Migrant workers are flooding-in to help Florida rebuild after Hurricane Ian, even as Governor Ron DeSantis wages a crusade against them.

CIARA NUGENT

Three days after Hurricane Ian made landfall in Florida on Sept. 28 as a Category 4 storm, Johnny Aburto arrived in Port Charlotte, a mostly white community of 64,000, popular with retirees, on the state’s southwestern coast. The town suffered extensive damage during the storm: roofs blown off, homes flooded, power lines downed. There is a lot of work to be done.

Aburto, 42, is here to do it. Originally from Nicaragua, he is part of a large, informal, overwhelmingly immigrant workforce that travels the U.S. cleaning up after increasingly frequent climate-related disasters. Once a hurricane hits, these crews are bussed in by contractors desperate for workers, or they drive to the area themselves and wait in Walmart or Home Depot parking lots to be picked up for a day’s work. Aburto, a skilled laborer, was in New Orleans after Katrina in 2005, Baton Rouge after Louisiana’s floods in 2016, Panama City Beach after Michael in 2018, and Lake Charles after Laura in 2020. “These kinds of events really affect people,” he says. “We do our bit to help them.”

In Port Charlotte, Aburto is now busy covering roofs with tarpaulins—a crucial first step to keep homes safe from future rain, so that power can be restored and residents can come back. He’s also cleaning out soaked debris from interiors. When that kind of work is done, he says, many of his colleagues will stay on to make more permanent repairs.

Sadly, America has a long disreputable history of denying the humanity and rights of those whose labor and skills built our nation and made it great. African Americans,  Chinese-Americans, Mexican-Americans, Italian-Americans, Irish-Americans, Japanese-Americans, Filipino-Americans, Haitian-Americans, and many others have all felt the sting of racism, demonizing myths, dehumanization, exploitation, and grotesque ingratitude.

I happen to be reading UVA Professor Amanda Frost’s outstanding book on “citizenship stripping.” I was struck by this quote about the exploitation of Mexican workers during the “Bracero Program” which was followed by “Operation Wetback” — the Eisenhower Administration’s totally illegal mass removal of Mexicans, including lawful immigrants and U.S. citizens!

It would be nice to think this time will be different — that we have advanced as a nation. But, I wouldn’t bank on it!

Floridians have a golden opportunity to replace DeSantis with a real Governor, Charlie Crist, who would serve all people, use government resources prudently, and govern in the public interest. Polls, however, say that such a “Florida epiphany” is unlikely. But, it’s still possible.

Thanks, Ingrid and Steven! Our “Round Table” has used your scholarship in amicus briefs to educate Federal Courts at all levels about the realities of Immigration Court.

It’s particularly critical in an era where the politicized and “ethically challenged” DOJ often puts forth largely fictionalization versions of their self-manufactured “immigration emergency” that is actually little more than the outcome of studied ignorance, White Nationalism, “gonzo” enforcement, and maliciously incompetent administration of the Federal immigration bureaucracy.

And, as I pointed out yesterday, “Gruppenfuhrer Miller” and his gang of neo-Nazi thugs have every intention of “doubling down” on their crimes against humanity and anti-democracy agenda if they retain power after the upcoming election. https://immigrationcourtside.com/2020/10/30/%f0%9f%91%b9%f0%9f%8e%83halloween-horror-%f0%9f%8f%b4%e2%80%8d%e2%98%a0%ef%b8%8f%e2%98%a0%ef%b8%8f%f0%9f%a4%ae%e2%9a%b0%ef%b8%8f%f0%9f%91%8e%f0%9f%8f%bbreichsreport-gruppenfuhrer-miller-reveals/

If we kick out the kakistocracy next week, we could put qualified “practical scholars” like Ingrid and others like her in charge and remake both DHS and the Immigration Courts to actually operate as required by Due Process while also fulfilling legitimate law-enforcement objectives. To state the obvious, neither of these objectives is being realized at present. It’s bad for America and for humanity.

For far too long, the wrong individuals, lacking the necessary expertise in immigration and human rights, and also lacking a firm commitment to equal justice under law, have been “in charge” of the Government’s immigration policy and legal apparatus and appointed to the Federal Courts, at all levels. That’s particularly true at the Supremes where only Justices Sotomayor and (some days) Kagan appear “up to the job.”

We will never end institutionalized racism, achieve equal justice for all, and realize the true human and economic potential of America until we bring our broken immigration and refugee systems and our failing Federal Judicial System into line with our Constitutional and national values. That process must start, but certainly will not end, with this election!

Sahil Kapur reports for NBC News:

WASHINGTON — President Donald Trump‘s senior adviser Stephen Miller has fleshed out plans to rev up Trump’s restrictive immigration agenda if he wins re-election next week, offering a stark contrast to the platform of Democratic nominee Joe Biden.

In a 30-minute phone interview Thursday with NBC News, Miller outlined four major priorities: limiting asylum grants, punishing and outlawing so-called sanctuary cities, expanding the so-called travel ban with tougher screening for visa applicants and slapping new limits on work visas.

The objective, he said, is “raising and enhancing the standard for entry” to the United States.

Some of the plans would require legislation. Others could be achieved through executive action, which the Trump administration has relied on heavily in the absence of a major immigration bill.

Examining Trump’s immigration campaign promises four years later

AUG. 25, 202005:51Some of the plans would require legislation. Others could be achieved through executive action, which the Trump administration has relied on heavily in the absence of a major immigration bill.

“In many cases, fixing these problems and restoring some semblance of sanity to our immigration programs does involve regulatory reform,” Miller said. “Congress has delegated a lot of authority. … And that underscores the depth of the choice facing the American people.”

Miller, who serves in a dual role as an adviser in the White House and to Trump’s re-election campaign, stressed that he was speaking about second-term priorities only in his capacity as campaign adviser.

Immigration has been overshadowed by surging coronavirus case numbers and an economy shattered by a nearly yearlong pandemic, but it was central to Trump’s rise to power in the Republican Party, and Miller has been a driving force for the administration’s often controversial policies to crack down on illegal migration and erect hurdles for aspiring legal immigrants.

Miller has spearheaded an immigration policy that critics describe as cruel, racist and antithetical to American values as a nation of immigrants. He scoffs at those claims, insisting that his only priority is to protect the safety and wages of Americans.

And he said he intends to stay on to see the agenda through in a second term if Trump is re-elected.

In the near term, Miller wouldn’t commit to lifting the freeze on new green cards and visas that’s set to expire at the end of the year, saying it would be “entirely contingent” on governmental analysis that factors in the state of the job market.

Asked whether he would support reinstating the controversial “zero tolerance” policy that led to families’ being separated, Miller said the Trump administration is “100 percent committed to a policy of family unity,” but he described the policy as one that would keep families together in immigration detention by changing what is known as the Flores settlement agreement.

Over the past year, the administration has sought to amend the Flores agreement, which says children can’t be held over 20 days in Immigration and Customs Enforcement detention. If it succeeds, immigrant families could be detained indefinitely as they await their day in immigration court.

Keep asylum down

On Trump’s watch, asylum grants have plummeted. Miller wants to keep it that way. He said a second-term Trump administration would seek to expand “burden-sharing” deals with Honduras, Guatemala and El Salvador that cut off pathways to the U.S. for asylum-seekers.

“The president would like to expand that to include the rest of the world,” Miller said. “And so if you create safe third partners in other continents and other countries and regions, then you have the ability to share the burden of asylum-seekers on a global basis.”

Kids in cages, refugees returned to torture and death, ethnic communities terrorized, lives destroyed, an economy and a society (make no mistake about it, immigrants will be essential to America’s recovery, future prosperity, and competitiveness) in tatters, tens of millions wasted on unnecessary and counterproductive Gulags, walls, and cruel enforcement while the Gruppenfuherer and his fellow human rights criminals remain at large and and an existential threat to our nation and our world!

To state the obvious, this has little or nothing to do with protecting American workers. Trump has shown that he couldn’t care less about the health, safety, and welfare of American workers (or frankly anybody except himself) except at election time. Immigration and immigrants create jobs and economic prosperity for America.

Also, even Miller couldn’t possibly believe that the Democratic House will pass any part of this racist manifesto. Truth is, Trump failed to pass any meaningful immigration legislation in four years, even when the GOP controlled all the political branches! In fact, Miller’s nativist legislative game-plan “poisoned the well” and was soundly defeated in both Houses of Congress! So, he intends to use Executive misrule, bureaucratic corruption, and a fascism-enabling, racially tone-deaf GOP Supremes’ majority to rule without Congress (as has been the case for the last four years.)

But make no mistake: the real “Reichsplan” here is directed at further institutionalizing racism, spreading hate, and targeting Americans of color. That’s what the regime’s “Dred Scottification” is really about. Reducing or eliminating YOUR Constitutional rights! Immigrants are the “usual suspects.” But, by no means will they be the only victims of Gruppenfuhrer Miller’s White Nationalist, racist, hate extravaganza.

As reported at the link above, The Biden-Harris campaign immediately and forcefully condemned the Gruppenfuhrer’s plans for “ethnic cleansing:”

“We are going to win this election so that people like Stephen Miller don’t get the chance to write more xenophobic policies that dishonor our American values,” Molina said. “Unlike Trump, Vice President Biden knows that immigrants make America stronger and helped build this country.”

America is immigration! It’s our past, present, and future! When we deny those truths, we deny ourselves and betray our own humanity!

Get out the vote for Joe, Kamala, and the Dems! Top to bottom of the ballot! Our lives and the future of American Democracy depend on it! Don’t let Gruppenfuhrer Miller and his neo-Nazi agenda, the GOP’s dark vision of the future, destroy our democracy! Vote the party of corruption, hate, and neo-fascism out!

Don’t let the Monster win!👹

https://slate.com/human-interest/2020/10/family-separation-effects-holocaust-children-trump.html

Rebecca Onion reports for Slate:

“They are so well taken care of. … They’re in facilities that were so clean,” President Donald Trump said during last week’s presidential debate, of the children his administration ordered separated from their parents at the southern border. As my colleague Jeremy Stahl points out, this isn’t the first time that an administration official has argued that because the separated children—over 500 of whom are still being kept from their parents—have (supposedly!) been physically taken care of, they should be “just fine.” But if the life histories of children forced to be parted from parents for years of their childhoods are any indication, these periods of separation will have long-lasting, devastating, and unpredictable effects.

I’ve been reading historian Rebecca Clifford’s new book, Survivors: Children’s Lives After the Holocaust, which is a painful history of Jewish kids who somehow made it through World War II when they were very small, and had to figure out how to forge a life afterward. Combining analysis of survivors’ testimonies recorded over the years, documents from the archives of organizations that came into contact with these children, and oral histories Clifford herself collected, the book shows how many of these survivors struggled with the act of making sense of their lives—even the lucky ones, who didn’t witness violence, and whose material needs were well met during the period of conflict and persecution. Clifford calls the work “fundamentally a book about the history of living after, and living with, a childhood marked by chaos.”

Survivors is, of course, about a group of children whose lives were marked by the Nazi regime, not about children fleeing violence in Central America, who were then separated from their families by Border Patrol agents. But it’s also fundamentally concerned with the human consequences of children’s separations from parents. In the group of survivors in Clifford’s history, there are kids who were sent to live with host families, who hid them until the war was over; kids incarcerated in different labor camps from their parents; kids who wandered the forests alone, tended only by older siblings.

Asking the historical record, and the grown-up survivors she interviewed, how this period of separation had affected the children’s lives in the long term, Clifford found things that she described as “not only unexpected, but shocking.” One such finding was the fact that for many of the kids, the war years were fine; it was liberation that was traumatic. “Children are adept at treating the exceptional as normal, and because they had no other life to compare it with, the years of persecution did not necessarily feel dangerous, fraught, or chaotic to young survivors,” Clifford writes. But after liberation, as well-meaning adults did everything they could to bring the kids back together with their surviving family members, or to find them places in Jewish homes, many of the separated survivors were profoundly destabilized. “My war began in 1945, not in 1940,” one such survivor said.

The German Jewish parents of Felice Z., who was born in October 1939, put their 1½-year-old daughter in the hands of aid workers in early 1941, and the girl spent the war years hidden by farmers in France. Felice Z. remembered in later interviews that she loved her host parents, and in particular her host mother, Madame Patoux: “All they were interested in was taking care of me. She basically saved my life. She was always ready to run. … I took it for granted that she was my mother, I called her meme (nana) and it was really the first close relationship that I had with another human being. I became very attached to them. Very.” At the end of the war, Felice got no joy out of being reunited with her sister, who had become a stranger. Soon after that reunion, she was removed from the family where she had grown up; as she remembered it, nobody bothered to explain why.

“Family reunions could be among the most difficult and distressing experiences that children went through after the war,” Clifford writes. “The youngest children might have no memory of their parents or relatives at all, and were effectively returned to strangers. … Not one child in this study who was returned to his or her family found this process easy or joyful.” The reunions brought up feelings of anger and terror—even if, as Clifford points out, the kids could rationally understand the reasons their parents had put them in safer places for the duration of the war. They had spent years suppressing childish impulses—“they had had to be obedient, quiet, and good to stay safe during the war, whether they were in hiding, in ghettos or in camps”—and often became explosive and “difficult to manage” after the separation was over.

So much wanton cruelty; such gross illegality; so little accountability; such glaring lack of integrity in our justice system! What has our country become? How is this “normal” or within the proper scope of “Executive authority.” What is impeachment for if not for “crimes against humanity?”

Vote ‘Em out, vote ‘Em out! Then start re-examining the failed and continuously failing institutions that couldn’t or wouldn’t effectively stand up to Trump, Miller, Sessions, Barr, Wolf, and the rest of their gang of thugs and scofflaws!

That starts, but by no means ends, with the highly politicized Supremes and their systemic failure to uphold our Constitution, the rule of law, and human dignity against an onslaught of White Nationalist, racist-inspired abuses by Trump, Miller, and their GOP cronies. This is a Court that disgracefully has been more interested in carrying out GOP shenanigans overtly intended to suppress votes, remove minority voting rights guaranteed by statute and Constitution, and throw the election to Trump than it has been in enforcing the Constitution and the rule of law to save the lives of refugees and asylum seekers, including women and children!

Better, more courageous, more humane judges for a better America!

• In July 2017, without warning, the Administration implemented a family separation pilot programintheElPasoBorderPatrolSector. Thepilotprogramlastedfivemonthsand resulted in hundreds of additional children being taken from their parents and placed in ORR custody.
• During the pilot program, the Administration discovered that it was unable to track separated family members in a way that would facilitate eventual reunification.
• Knowing this, and without doing anything to address the tracking systems employed by deferral agencies, the Administration chose to expand the policy nationwide in May 2018.
• To make matters worse, the Administration failed to provide advance notice of the policy to front line agents and officers, which caused unnecessary chaos and inconsistent implementation of the policy across border sectors.

• When judicial intervention and political pressure eventually resulted in the end of the policy, the lack of interagency cooperation and preparedness was laid bare by the inability of the Administration to quickly reunite separated parents and children.
As a result of this dark chapter in our nation’s history, hundreds of migrant children may never be reunited with their parents.
Despite considerable stonewalling by Administration officials, Judiciary Committee Members and staff have pushed relentlessly to obtain data and conduct much needed oversight of the agencies responsible for the family separation policy. This report details the Committee’s findings thus far. We remain committed to holding the Trump Administration accountable and continuing to shed light on this dark moment in our country’s history.

As my friend, “Immigration Guru” Ira J. Kurzban would say: “Folks, this is NOT NORMAL!”

As we both say: “This is unacceptable conduct for which there must be accountability if we are to remain a nation under law.”

At this point, there are thousands of examples underscoring the need to remove the president from society, but the most recent is his unhinged response to the New York Times’ 1619 Project, which he wants abolished in schools and replaced with a revisionist history of America that teaches children how white people have only ever had their Black peers’ best interest at heart, including when said white people literally owned slaves.

Speaking at the National Archives Museum on Thursday, Trump announced that he would be signing an executive order establishing the “1776 Commission” to promote a “patriotic education.” Apparently attempting to reach his white nationalist supporters, Trump said that the left is “attempting to destroy [the] beautiful vision” that the founding fathers had for America, and that things like the 1619 Project, which teach children about systemic racism and reframe the country’s history by examining the consequences of slavery, are “toxic propaganda” and “ideological poison” that “if not removed, will dissolve the civic bonds that tie us together” and “will destroy our country.” Then he claimed liberals want to tear down Mount Rushmore . . . .

Trump’s view of America is unrelentingly bogus. racist, unethical, and unpatriotic! This is “Dred Scottification” in action. And, we must never forget the disgraceful failure of Chief Justice John Roberts and the Supremes’ majority to take a strong stand against the very overt White Nationalist racism of Trump, Miller, and the GOP. They are indeed promoters of “Dred Scottification,” racial divisiveness, inequality, and the breakdown of the rule of law and ethical and moral norms that should guide 21st Century  governance.

American democracy is indeed “on the ropes.” But, we still have a chance to save our republic this Fall. Don’t blow it!

This Fall, vote like your life and the future existence of our nation depend on it.  Because they do!

Caitlin reports:

In early 2017, as Immigration and Customs Enforcement prepared to carry out the hard-line agenda on which President Trump had campaigned, agency leaders jumped at the chance to let two filmmakers give a behind-the-scenes look at the process.

But as the documentary neared completion in recent months, the administration fought mightily to keep it from being released until after the 2020 election. After granting rare access to parts of the country’s powerful immigration enforcement machinery that are usually invisible to the public, administration officials threatened legal action and sought to block parts of it from seeing the light of day.

Some of the contentious scenes include ICE officers lying to immigrants to gain access to their homes and mocking them after taking them into custody. One shows an officer illegally picking the lock to an apartment building during a raid.

At town hall meetings captured on camera, agency spokesmen reassured the public that the organization’s focus was on arresting and deporting immigrants who had committed serious crimes. But the filmmakers observed numerous occasions in which officers expressed satisfaction after being told by supervisors to arrest as many people as possible, even those without criminal records.

“Start taking collaterals, man,” a supervisor in New York said over a speakerphone to an officer who was making street arrests as the filmmakers listened in. “I don’t care what you do, but bring at least two people,” he said.

The filmmakers, Christina Clusiau and Shaul Schwarz, who are a couple, turned drafts of their six-part project called “Immigration Nation” over to ICE leadership in keeping with a contract they had signed with the agency. What they encountered next resembled what happened to Mary L. Trump, the president’s niece, who was eventually sued in an unsuccessful attempt to stop her from publishing a memoir that revealed embarrassing details about the president and his associates.

Suddenly, Ms. Clusiau and Mr. Schwarz say, the official who oversaw the agency’s television and film department, with whom they had worked closely over nearly three years of filming, became combative.

The filmmakers discussed their conversations on the condition that the officials they dealt with not be named out of fear that it would escalate their conflict with the agency.

See firsthand how your tax dollars are being largely wasted on cruel, unnecessary terrorizing of ethnic communities and populating the “New American Gulag” — “enforcement” that in too many cases actually harms our economy and our society and certainly diminishes both our integrity and humanity as a nation.

Catlin’s concluding paragraphs are worth keeping in mind:

The filmmakers said they came away with some empathy for the ICE officers, but became convinced that the entire system was harmful to immigrants and their families.

The problem, they said, was summarized in the first episode by Becca Heller, the director of the International Refugee Assistance Project.

“Is a government agency evil? No. Is every single person inside ICE evil? No,” Ms. Heller told the filmmakers. “The brilliance of the system is that their job has been siphoned off in such a way that maybe what they see day to day seems justified, but when you add it up, all of the people just doing their job, it becomes this crazy terrorizing system.”

We have all been harmed by Trump’s racist-driven “weaponization” of DHS and the Immigration Courts, and that includes the DHS employees and the Immigration Court employees who are caught up in this grotesque, often illegal, and overall immoral abuse of government authority and resources.

We should also be concerned about the First Amendment implications of Trump’s attempts to misuse Government authority to manipulate the election in his favor by, once again, suppressing truth in reporting.  Thank goodness we have courageous journalists like Caitlin and these filmmakers to keep exposing the ugly truth about the Trump/Miller/Wolf/Barr ongoing White Nationalist immigration charade.

Caitlin Dickerson and Michael D. Shear report for The NY Times:

From the early days of the Trump administration, Stephen Miller, the president’s chief adviser on immigration, has repeatedly tried to use an obscure law designed to protect the nation from diseases overseas as a way to tighten the borders.
The question was, which disease?
Mr. Miller pushed for invoking the president’s broad public health powers in 2019, when an outbreak of mumps spread through immigration detention facilities in six states. He tried again that year when Border Patrol stations were hit with the flu.
When vast caravans of migrants surged toward the border in 2018, Mr. Miller looked for evidence that they carried illnesses. He asked for updates on American communities that received migrants to see if new disease was spreading there.
In 2018, dozens of migrants became seriously ill in federal custody, and two under the age of 10 died within three weeks of each other. While many viewed the incidents as resulting from negligence on the part of the border authorities, Mr. Miller instead argued that they supported his argument that President Trump should use his public health powers to justify sealing the borders.
On some occasions, Mr. Miller and the president, who also embraced these ideas, were talked down by cabinet secretaries and lawyers who argued that the public health situation at the time did not provide sufficient legal basis for such a proclamation.
That changed with the arrival of the coronavirus pandemic.
Within days of the confirmation of the first case in the United States, the White House shut American land borders to nonessential travel, closing the door to almost all migrants, including children and teenagers who arrived at the border with no parent or other adult guardian. Other international travel restrictions were introduced, as well as a pause on green card processing at American consular offices, which Mr. Miller told conservative allies in a recent private phone call was only the first step in a broader plan to restrict legal immigration.
But what has been billed by the White House as an urgent response to the coronavirus pandemic was in large part repurposed from old draft executive orders and policy discussions that have taken place repeatedly since Mr. Trump took office and have now gained new legitimacy, three former officials who were involved in the earlier deliberations said.
One official said the ideas about invoking public health and other emergency powers had been on a “wish list” of about 50 ideas to curtail immigration that Mr. Miller crafted within the first six months of the administration.

He had come up with the proposals, the official said, by poring through not just existing immigration laws, but the entire federal code to look for provisions that would allow the president to halt the flow of migrants into the United States.
Administration officials have repeatedly said the latest measures are needed to prevent new cases of infection from entering the country.
“This is a public health order that we’re operating under right now,” Mark Morgan, the acting commissioner of Customs and Border Protection, told reporters earlier this month. “This is not about immigration. What’s transpiring right now is purely about infectious disease and public health.”
The White House declined to comment on the matter, but a senior administration official confirmed details of the past discussions.
The architect of the president’s assault on immigration and one of Mr. Trump’s closest advisers inside the White House, Mr. Miller has relentlessly pushed for tough restrictions on legal and illegal immigration, including policies that sought to separate families crossing the southwest border, force migrants seeking asylum to wait in squalid camps in Mexico and deny green cards to poor immigrants.
Mr. Miller argues that reducing immigration will protect jobs for American workers and keep communities safe from criminals. But critics accuse him of targeting nonwhite immigrants, pointing in part to leaked emails from his time before entering the White House in which he cited white nationalist websites and magazines and promoted theories popular with white nationalist groups.

As America suffers, immigrants, both legal and “undocumented,” are on the front lines of those “essential workers” risking their lives to keep us healthy, safe, fed, and clothed.

Meanwhile, neo-Nazi Miller remains “on the dole” — publicly funded for putting out a steady stream of discredited and xenophobic actions designed to exploit, dehumanize, and demean many of the most courageous and necessary among us.

Can it get any more vile and disgusting?

Nearly 55 years after the end of WWII, Trump & Miller are reviving many aspects of the racist ideology and actions that we supposedly fought to end forever. Raises the question of who really won the war.

Always the opportunists, Trump and Miller now see the crisis that their “malicious incompetence” helped to aggravate as a chance to target both “Optional Practical Training” (“OPT”) for foreign students and Chinese students, one of the largest groups of those studying in the U.S. You can read about it in this article by Stuart Anderson in Forbes.https://apple.news/ADkCNTe_gTje__BlQ8c-8pg

OPT unquestionably benefits our country as well as the students, many of whom remain and become important parts of our society. The targeting of Chinese students certainly fits with the far right’s Anti-Asian movement that has helped spike a notable increase in hate crimes directed against Asian Americans during the pandemic. Could the revival of the Chinese Exclusion Act be far beyond on the Trump/Miller Jim Crow agenda?

Here’s an abstract:

Friends,

Happy to share my new article Mistreating Central American Refugees: Repeating History in Response to Humanitarian Challenge (forthcoming Hastings Race and Poverty Law Journal).  The full article can be downloaded here.

Abstract:

In the 1980s, tens of thousands of Central Americans fled to the United States seeking refuge from civil unrest that ravaged their countries. In a largely geopolitical response, the Reagan administration labeled those fleeing Guatemala and El Salvador as “economic migrants,” detained them, and largely denied their asylum claims. The illegal discrimination against these refugees was exposed in a series of lawsuits and through congressional investigations. This led to the reconsideration of thousands of cases, the enlistment of a corps of asylum officers, and an agreement on the conditions under which migrant children could be detained.

Unfortunately, the lessons of the 1980s have been forgotten, or intentionally neglected. Beginning in 2014, once again large numbers of Central American asylum seekers—including women and children—are being detained. Asylum denial rates for migrants fleeing extreme violence are high. The mixed refugee flow continues to be mischaracterized as an illegal immigration problem. Many of the tactics used in the 1980s are the same today, including hampering the ability to obtain counsel. President Trump has taken the cruelty to the next level, by invoking claims of national security in attempting to shut down asylum by forcing applicants to remain in Mexico or apply for asylum in a third country. We should remember the lessons of the past. Spending billions on harsh border enforcement that preys on human beings seeking refuge is wrongheaded. We should be implementing policies and procedures that are cognizant of the reasons migrants are fleeing today, while working on sensible, regional solutions.

Everyone stay safe and sane.

CLEAR AS MUD: Politicized Immigration “Courts” Continue To Bobble The Message In The Time Of Plague, Endangering Their Own Employees, Attorneys, & The Public!  — America’s Clown Courts 🤡☠️ Enter A Deadly New Phase As Feckless Article III Courts Watch The Show Go On! —“I don’t know who’s making the calls, but they’re wrong.” — DUH!

Dara Lind reports for Pro Publica:

Interviews with 10 workers at immigration courts around the country reveal fear, contradictory messages and continuing perils for the employees.

ProPublica is a nonprofit newsroom that investigates abuses of power. Sign up to receive our biggest stories as soon as they’re published.

On Tuesday night — over a day after several Bay Area counties issued shelter-in-place orders barring most people from leaving their homes — the San Francisco immigration court sent an email to staff: Hearings were being postponed nationwide for most immigrants, so the court would be closed starting Wednesday. (The text of the email was provided to ProPublica.)

On Wednesday, however, employees were directed to get onto a conference call, according to two participants. There they were told the Tuesday night email was wrong. The court wasn’t closed. They would have to come into the office — or use their vacation time to stay home. When staff asked about the shelter-in-place orders, the response was that the Department of Justice, which runs immigration courts, took the position that those were local laws and didn’t apply to federal employees.

The Trump administration has reduced immigration court operations in the past week, by postponing hearings for non-detained immigrants and closing a handful of courts to the public. Those actions came after the unions representing immigration prosecutors and judges issued a rare public call for courts to close.

The reduced court operations came after weeks of employees raising concerns privately and, they say, receiving few and unhelpful answers. And because the closures are determined solely by whether a court is hearing cases of detained immigrants, rather than by the level of health peril, employees still feel they’re putting their health at risk every time they come into the office as instructed.

That’s the picture that emerges from interviews with 10 federal employees who work at immigration courts across the country. Most spoke on the condition of anonymity. Many said they had raised concerns internally about their exposure to COVID-19 to their managers or hadn’t been informed of potential exposures.

“When I signed up for this job, I thought it might be morally compromising at times,” one immigration court employee told ProPublica, “but I never thought it would be compromising of my health and safety.”

The Executive Office for Immigration Review, the DOJ agency that oversees immigration courts, told ProPublica that agency headquarters was responsible for deciding when courts closed, but it did not confirm or deny specifics of the employees’ allegations, saying, “We do not comment on internal communications or internal personnel operations.”

In Denver, one prosecutor interviewed by ProPublica was alarmed by a judge’s frequent coughs during a hearing last Friday. “Don’t mind my coughing,” the judge said, according to the prosecutor. “I don’t think it’s coronavirus.” The following Tuesday, the prosecutor noticed that the judge was out for the rest of the week and emailed a court staffer in concern: Was it the coronavirus? Should she be taking precautions? The staffer’s reply: For privacy reasons, the prosecutor’s questions couldn’t be answered.

Only after news broke to the public on Tuesday night that a judge at the Denver immigration court had been diagnosed with COVID-19 (the disease caused by the new coronavirus) did court officials follow up with the prosecutor and confirm her suspicions. Other attorneys the judge had been in close contact with were notified the next day. The court remained open through Thursday, when the entire building it was housed in was shut down for deep cleaning by the General Services Administration. (It’s currently set to reopen Monday.)

In New York, legal aid groups sent a letter to immigration court officials saying that two of their attorneys had symptoms of COVID-19 and a third had been exposed to someone who’d tested positive. All three attorneys had appeared in court the past week, and all had hearings scheduled the following day. The courts didn’t say anything to their employees about the letter, according to multiple sources.

Since taking office, the Trump administration has pressured the immigration courts to process as many immigrants as quickly as possible — pressuring judges to hear more cases and complete them within a year, and making it harder for immigrants or attorneys to postpone hearings. Now, they face a public health crisis that requires everyone to reduce person-to-person contact.

Immigration court workers have two concerns. The first is that the courts are often crowded and require close contact with members of the public. The second is that, like most employees of any type, especially those who take public transit, they are exposed every time they leave their homes to work.

Employees remain concerned about their exposure over the past few weeks, while courts were running as usual. Employees in New York and California — the states hardest hit by the pandemic to date — told ProPublica that their requests for “deep cleaning” were rejected by managers, and that they were bringing their own Clorox wipes and disinfectant spray to the office.

Most immigration court business happens in person. Even trying to postpone an immigration hearing (for example, due to illness) requires an attorney to file a paper form with a clerk. And if an immigrant doesn’t show up for a hearing, they’re at risk of getting ordered deported in absentia. In at least one New York court, according to two people who work there, the chief judge told employees Monday to issue absentia deportation orders if immigrants weren’t showing up, even if the coronavirus was the suspected cause.

Policies the Trump administration introduced before the COVID-19 pandemic put considerable pressure on judges and prosecutors not to allow immigrants to postpone their hearings. Judges face a “performance standard” of completing 80% of their cases within a year — a standard over 90% of judges don’t meet, according to the National Association of Immigration Judges. But the more than 150 judges who have been hired in the past two years are still in their probationary period, where they could be fired for failing to meet performance standards.

While many judges have been lenient in granting coronavirus-related postponements, others have not. Last week, according to one California immigration court employee, a judge took a break from a hearing to tell colleagues that the immigrant’s attorney claimed to be sick, but because he wasn’t coughing, the hearing would move forward.

One email sent by the chief prosecutor at the Miami court Tuesday, read to ProPublica, told prosecutors that if an immigrant or her attorney claimed to be sick, any postponement should be counted against the immigrant (preventing them from requesting another postponement). If the immigrant didn’t want to postpone, and the judge wasn’t willing to hold the hearing by phone, the prosecutor was instructed to contact her manager — who would assess the claim of illness himself before deciding what to do. (A call to the chief prosecutor in Miami was not immediately returned.)

Most communication, though, has been oral. In at least two courts, chief judges were asked to put policies in writing and declined.

Employees have been in the dark about who, exactly, is making the decisions about which courts are open and when employees are allowed to work from home or take leave to stay home. “The word is that it’s out of their hands. Everything is out of everybody’s hands,” Fanny Behar-Ostrow, president of the union representing immigration prosecutors, told ProPublica Wednesday. “I don’t know who’s making the calls, but they’re wrong.”

An email obtained by the Miami Herald, written by the assistant chief immigration judge in charge of the Miami immigration court on Wednesday, said that closure decisions were ultimately being made by “the White House” — something that employees at other courts also said their managers had suggested. But chief judges gave conflicting explanations about which decisions were subject to White House approval; one chief judge told employees that the White House had to be involved in decisions about remote work, while other chief judges made those decisions themselves.

It’s not clear who at the White House is involved or how. Immigration officials told the Herald that the ultimate decision was made by the Office of Management and Budget. However, according to the employees ProPublica spoke to, some immigration court officials used “White House” to refer to policies set by the Office of Personnel Management. The assistant chief immigration judge (the judge in charge of a given immigration court location) for one California court told employees on March 12 that they’d had a phone call with staff for Vice President Mike Pence, who’s running the official coronavirus task force.

But to many employees, the specter of “White House” involvement raised concerns that the administration’s immigration policy priorities were getting in the way of its public health obligations.

The confusion engendered by politicized immigration enforcement in support of a White Nationalist agenda doesn’t end with the Immigration Courts. Despite, or perhaps because of, a number of public statements by DHS political hacks, there’s still plenty of uncertainty and angst about DHS’s enforcement and detention policies. Chloe Hadavas over at Slate sets out what happens when politicos take over law enforcement and justice.

Chloe Havadas

https://slate.com/news-and-politics/2020/03/ice-halts-immigration-enforcement-coronavirus.html

Immigration and Customs Enforcement announced on Wednesday that it will halt most arrests and deportations, focusing only on individuals who are “public safety risks” and who are “subject to mandatory detention based on criminal grounds,” as the coronavirus sweeps across the U.S. and public health officials scramble to limit the virus’ spread.

Undocumented immigrants are often afraid to seek medical care for fear of deportation. And even as state and local officials encouraged anyone who needed medical treatment to seek help, ICE officers continued to make arrests, including in areas hit hard by the virus. But in the temporary change in enforcement, ICE also said that it won’t carry out operations near health care facilities, including hospitals, doctors’ offices, and urgent care facilities, “except in the most extraordinary of circumstances,” the agency said in a statement. “Individuals should not avoid seeking medical care because they fear civil immigration enforcement.”

Immigration experts said ICE’s decision was somewhat unexpected, though they remain cautious about how to interpret it. “I’m always surprised to hear that they’re going to scale back on their efforts,” said Jennifer M. Chacón, a UCLA law professor who focuses on immigration. ICE’s statement marks a distinct shift from the agency’s operations under the Trump administration. Both Chacón and Karla McKanders, a law professor who directs the Immigration Practice Clinic at Vanderbilt University, said that it reminded them of the “felons, not families” immigration policy of the Obama administration. “You read it and it basically looks like the Obama-era enforcement priority statement, and you just wonder why it takes a pandemic to get ICE to think about prioritizing resources and focusing efforts on public safety,” said Chacón.

“I don’t know who’s making the calls, but they’re wrong.” Kind of “says it all” about how the regime treats its own employees and the public good.

Meanwhile, Article III Courts, which have had more than ample opportunity to put an end to the constitutional farce taking place in Immigration Court and also to direct the DHS to take overdue steps to release non-dangerous (that is, most) immigration detainees before the epidemic sweeps chronically health-endangering immigration prisons in their New American Gulag (“NAG”), have once again “swallowed the whistle.” The Gulag, where kids are caged and put in “iceboxes,” families separated, and folks sometimes left to die, all for no reason other than “we can do it and nobody’s going to stop us” will haunt not only those corrupt public servants who established and operated it, but also those like legislators, judges, and public health officials who failed in their duties to end the human rights abuses.

Perhaps the Article IIIs are “running scared” because without the ongoing clown show in the U.S. Immigration Courts, the Article IIIs would be in line for the title of “Americas’s Most Dysfunctional Courts.”

Also, I think it’s time for Slate to take “Intern” off Chloe Hadavas’s title and ink this “up and coming talent” to a full time contract covering immigration and justice issues.

I have also received disturbing, yet credible, reports of continuances for “at risk” attorneys being denied by some Immigration Judges, while other judges have received “no assurances” from their management “handlers” that the regime’s due-process-mocking “production quotas” will be waived during the health emergency! ☠️☠️☠️☠️☠️

From the NY Times:

By Alejandra Gomez and Tomás Robles Jr.

Ms. Gomez and Mr. Robles are co-executive directors of LUCHA, a grass-roots organization in Arizona.

PHOENIX — First there were seven. Then 50. Then thousands of people, mostly Latino and many undocumented, who held a vigil on the lawn outside of the Arizona State Capitol in the spring of 2010, praying that Gov. Jan Brewer would not sign an anti-immigrant bill, the most punitive in generations, which had sailed through the Republican-controlled Legislature.

A dozen undocumented women, the “vigil ladies,” set up tents and a four-foot-high statue of the Virgin Mary, borrowed from a church. Students walked out of their classrooms and marched for miles to the Capitol. Abuelas put out traditional Mexican food: pozole, tamales, frijoles. At night, around 50 people slept on the lawn. In the morning, they pulled grass out of their hair, clasped hands and prayed.

The two of us were part of these protests, and we had good reason to be angry — and afraid. One night, Ku Klux Klan hoods were placed near where people prayed. Anti-immigrant groups patrolled close by. Such menaces had long found a haven under Sheriff Joe Arpaio, who ordered his deputies to target Latinos in traffic stops, workplace raids and neighborhood sweeps. Some were later deported.

Despite the enormous opposition to the “show me your papers” bill, which essentially turned the state’s police officers into immigration agents, Governor Brewer signed it. Arizona Republicans no doubt hoped the law would chase out every immigrant, documented or undocumented. Some did leave. But many more stayed, determined to turn their fear and anger into political power.

In less than a decade, many organizers who first cut their teeth fighting that bill are now lawmakers, campaign managers and directors of civic engagement groups like Mi Familia Vota and the Arizona Dream Act Coalition. While it’s easy to dismiss mass protests as short-lived eruptions of anger, Arizona offers a model for how this energy can become real electoral power: It happens when people learn to work with one another, build deep connections and create something bigger than themselves.

In the wake of the vigil, we built an organization called LUCHA, short for Living United for Change in Arizona, that serves as a political home for people of color. We talk to working-class families about the issues important to them and how to get involved in politics. Civic groups and political parties used to do more of this work, but they have become disconnected from real people, too focused on donors and elite influence.

While the anti-immigrant bill was propelled into law by Republicans, Democrats were also to blame. They have long treated communities of color as instruments of someone else’s power rather than core progressives who should be instruments of their own power. This neglect created the space for the bill to pass so easily.

Contrary to the right-wing propaganda and the beliefs of many Dems, Trump’s cruel, racist, xenophobic, expensive, and counterproductive immigration policies are not popular with the American public outside Trump’s “base.” Democrats should make inclusive, tolerant, humane, and market-sensitive immigration reforms that will stop wasting money on misdirected immigration enforcement and help our now-sagging economy recover, a key and visible part of their program going forward.

Immigrants, of all kinds, also play an outsized role in health care, particularly for senior citizens. Maximizing the potential of all migrants and their tax paying ability will be keys to a healthy future and a robust economy for all Americans.

The needs and ambitions of “core progressives” like the Hispanic and African-American communities have much in common with the bulk of white working-class America that has been left behind by the Trump GOP’s obsession with making the rich richer, the poor poorer, working people less healthy, running up huge deficits, cutting the safety net, destroying valuable government services, letting our infrastructure crumble, undermining education and the environment, imposing harmful tariffs, and promoting hate and racial divisions among our population.

For the sake of America, we need all communities to work together for “regime change” this November!

THE UGLY GOP RACIST MYTH OF THE “ANCHOR BABY” – They Are As “American” As Any Of Us, Perhaps More So Because Of The Nativist-Inspired Bias They Have Had to Overcome — “That practice of targeting people who really are members of your society historically and legally and marking them as different allows you to do incredibly awful things to them.”

Daira García wakes up at 5.50am. She takes out her dog, then tries to eat some breakfast before boarding the bus that gets her to school by 7.26 in the morning.

After class, she heads back home, where her parents, Silvia and Jorge, watch Noticiero and sip mate (she sometimes tries the drink as well but admits she’s never quite gotten used to it). They eat something, talk. When Daira goes off to finish her homework, she forgoes the desk in her room to curl up in her parents’ bed.

“It’s more comfy,” she quips.

Daira, 17, has a fairly standard routine for an American teenager: school, homework, family time. But unlike most kids, the schedule she’s come to rely on each day could easily be disrupted at any point.

Silvia and Jorge traveled from Argentina to the United States as 2001 became 2002, and with a new year came their new life in an unknown country. Daira’s big brother was just an infant then; now a college student, he doesn’t even really remember the place where he was born. And yet he’s only shielded from deportation because of Deferred Action for Childhood Arrivals (Daca), an Obama-era program the Trump administration has been trying to end for years. Silvia and Jorge, meanwhile, have no protection and could be picked up by agents from Immigration and Customs Enforcement (Ice) at any time.

Daira begins to cry just thinking about it.

“We’ve never had a plan for it if it happened,” Silvia says in Spanish. “Maybe we don’t give much thought to that because we think it’s healthier.”

An estimated 4.1 million US-citizen children lived with at least one undocumented parent in recent years, according to the Migration Policy Institute. They’re kids who anti-immigrant groups disparage as “anchor babies”, a derogatory term that insinuates these children are little more than pawns used by their immigrant parents to get a foothold in the US and eventually become citizens themselves.

It’s a narrative trope that completely misrepresents the harsh realities of America’s current immigration laws, as well as just the natural progression of life, experts suggest.

“People have this notion that you have a child in the United States, now you’re a citizen. It’s what people think because it’s the easy way to explain it. So it’s an easy way to make up a myth,” said David Leopold, an immigration attorney and former president of the American Immigration Lawyers Association.

It’s true that children born on US soil have been granted citizenship through the 14th amendment to the US constitution, and that a landmark supreme court decision set the precedent for that right to be extended to almost all children of foreigners. But Americans can’t just immediately safeguard their family members from deportation. In fact, a US citizen must be 21 years oldbefore they can sponsor their parents for a green card. They also must be able to financially support their parents.

Now the Trump administration’s new public charge rule targeting low-income immigrants is adding yet another burden.

Parents who were not inspected and admitted into the US face even more obstacles to changing their immigration status: with limited exceptions, they have to go abroad as part of the legalization process and then often aren’t allowed back into the US for 10 years.

Even if parents do get a green card, they have a five-year holding period before they can finally apply for naturalization.

In the end, the so-called “anchor baby” pathway to citizenship is at least a 26-year endeavor, even for those who entered the US legally.

“It’s ludicrous to think that that’s some sort of a tactic that people use to come here, get citizenship, ’cause it just isn’t true,” said Leopold. “It’s a myth, and it’s a specious talking point.”

A talking point that’s popular among anti-immigrant groups, pundits and the Republican party.

This is what “Dred Scottification” preached by Trump, Miller, Sessions, “Cooch Cooch,” and their White Nationalist allies, and encouraged and enabled by the willfully “tone-deaf” Roberts Court, is all about. Ultimately, their aim is to consciously dump on our fellow citizens and human beings because of the color of their skin or their ethnic origin, or perhaps in some cases, their religion. Utterly disgusting!

The “Beauty of the 14th Amendment” is that it eventually automatically solves the issues that politicians of both parties, but primarily the GOP, have been avoiding for decades. Over time, a generation of so-called “undocumented” residents passes into history; the new generation are full U.S. citizens who will achieve their full potential in America and exercise the political power necessary to put the toxic views, actions, and rhetoric of the “nativist right” behind us as we move forward as a nation. Thus, we avoid creating generations of “perpetually disenfranchised” members of our society.

No, the 14th Amendment doesn’t take the place of a long overdue, sane legalization program and some reality and market-based reforms of our legal immigration system. But, it does provide a “fail safe” against the callous misrule of Trump, the GOP, and the enabling actions of the Roberts Court.

From the LA Times Editorial Board:

The U.S. betrays migrant kids

Kevin Euceda, a 17-year-old Honduran boy, arrived at the U.S.-Mexico border three years ago and was turned over to the custody of the Department of Health and Human Services until his request for asylum could be decided by immigration courts. During that period, he was required, as are all unaccompanied minors in custody, to meet with therapists to help him process what he had gone through.

In those sessions, Kevin was encouraged to speak freely and openly and was told that what he said would be kept confidential. So he poured out his story of a brutalized childhood, of how MS-13 gang members moved into the family shack after his grandmother died when he was 12, of how he was forced to run errands, sell drugs and, as he got older, take part in beating people up. When he was ordered to kill a stranger to cement his position in the gang, Kevin decided to run.

His therapists submitted pages of notes over several sessions to the file on him, as they were expected to do. But then, HHS officials — without the knowledge of the teen or the therapists — shared the notes with lawyers for Immigration and Customs Enforcement, who used them in immigration court to paint the young migrant as a dangerous gang member who should be denied asylum and sent back to Honduras. In sharing those therapy notes, the government did not break any laws. But it most assuredly broke its promise of confidentiality to Kevin, violated standard professional practices — the first therapist involved quit once she learned her notes had been shared — and offended a fundamental expectation that people cannot be compelled to testify against themselves in this country.

Kevin, whose story was detailed by the Washington Post, wasn’t the only unaccompanied minor to fall victim to such atrocious behavior, though how many have been affected is unknown. The government says it has changed that policy and no longer shares confidential therapy notes, but that’s not particularly reassuring coming from this administration. It adopted the policy once; it could easily do so again.

Last week, Rep. Grace F. Napolitano (D-Norwalk) and Sen. Jeff Merkley (D-Ore.) introduced the Immigrants’ Mental Health Act of 2020 to ban the practice, which is a necessary preventive measure. The bill would also create a new training regimen to help border agents address mental health issues among migrants and require at least one mental health expert at each Customs and Border Patrol facility. Both of those steps are worth considering too.

That the government would so callously use statements elicited from unaccompanied minors in therapy sessions to undercut their asylum applications is part of the Trump administration’s broad and inhumane efforts to effectively shut off the U.S. as a destination for people seeking to exercise their right to ask for sanctuary. Jeff Sessions and his successor as attorney general, William Barr, have injected themselves into cases at an unprecedented rate to unilaterally change long-established practices and immigration court precedent.

They have been able to do so because immigration courts are administrative and part of the Justice Department, not the federal court system, and as a result they have politicized what should be independent judicial evaluations of asylum applications and other immigration cases. Advocates argue persuasively that the efforts have undermined due process rights and made the immigration courts more a tool of President Trump’s anti-immigration policies than a system for measuring migrant’s claims against the standards Congress wrote into federal law.

Of course, trampling legal rights and concepts of basic human decency have been a hallmark of the administration’s approach to immigration enforcement — witness, for example, its separation of more than 2,500 migrant children from their parents. Beyond the heartlessness of the separations, the Health and Human Services’ inspector general last week blasted the department for botching the process. Meanwhile, the administration has expanded detention — about 50,000 migrants are in federal custody on any given day, up from about 30,000 a decade ago — and forced about 60,000 asylum seekers to await processing in dangerous squalor on Mexico’s side of the border.

There are legitimate policy discussions to be had over how this government should handle immigration, asylum requests and broad comprehensive immigration reform. In the meantime, no government has the right to treat people with such abject inhumanity. History will remember Trump for this, but it will also remember the people who enable such atrocious acts.

The LA Times is ”on top” of the grotesque perversion of the Immigration “Courts” under nativist zealot Jeff “Gonzo Apocalypto” Sessions and Trump toady Billy Barr to carry out a White Nationalist political agenda:

They have been able to do so because immigration courts are administrative and part of the Justice Department, not the federal court system, and as a result they have politicized what should be independent judicial evaluations of asylum applications and other immigration cases.

Who’a NOT “on top” of what’s happening: The GOP-controlled U.S. Senate, Chief Justice Roberts, a number of his Supremely Complicit colleagues, and a host of Court of Appeals Judges who allow this unconstitutional travesty to continue to mock the Fifth Amendment and the rule of Law, while abusing and threatening the lives of legal asylum seekers every day!

This was even before yesterday’s cowardly, wrong-headed, and totally immoral “Supreme Betrayal” of the most vulnerable among us in Wolf  v. Innovation Law Labhttps://immigrationcourtside.com/2020/03/11/let-the-killing-continue-predictably-supremes-game-system-to-give-thumbs-up-to-let-em-die-in-mexico-brown-lives-dont-matter/ As MLK, Jr., said “Injustice anywhere affects justice everywhere.”

With 2.5 Branches of our Government led by anti-democracy zealots and cowards, House Speaker Nancy Pelosi is our only remaining bulwark against tyranny! Capable as she is, she can’t do it all by herself!

In reality, judges were among those inside Germany who might have effectively challenged Hitler’s authority, the legitimacy of the Nazi regime, and the hundreds of laws that restricted political freedoms, civil rights, and guarantees of property and security. And yet, the overwhelming majority did not. Instead, over the 12 years of Nazi rule, during which time judges heard countless cases, most not only upheld the law but interpreted it in broad and far-reaching ways that facilitated, rather than hindered, the Nazis ability to carry out their agenda.

U.S. DISTRICT JUDGE LYNN S. ADELMAN CHANNELS “COURTSIDE” — BLASTS ROBERTS & COMPANY FOR AIDING THE FORCES SEEKING TO DESTROY OUR DEMOCRACY — “Instead of doing what it can to ensure the maintenance of a robust democratic republic, the Court’s decisions ally it with the most anti-democratic currents in American politics,”

Fred Barbash
Fred Barbash
Legal Reporter
Washington Post

https://www.washingtonpost.com/nation/2020/03/11/lynn-adelman-roberts-trump/

Fred Barbash reports for the WashPost:

Lynn S. Adelman, a U.S. district judge in Milwaukee, has riled conservatives by publishing a blistering critique of the Supreme Court’s record under Chief Justice John G. Roberts Jr., focusing on a string of decisions that he argues have fostered “economic inequality,” “undermined democracy” and “increased the political power of corporations and wealthy individuals” at the expense of ordinary Americans.

Adelman also criticized President Trump, who he wrote ran as a populist but failed to deliver “policies beneficial to the general public. … While Trump’s temperament is that of an autocrat,” Adelman wrote, “he is disinclined to buck the wealthy individuals and corporations who control his party.”

The article by Adelman was all the more unusual because it went after the chief justice directly. Roberts, he said, was “misleading” in his 2005 confirmation hearing testimony when he pledged to be a passive “umpire” calling balls and strikes.

Adelman called that metaphor a “masterpiece of disingenuousness,” saying the court under Roberts “has been anything but passive” as its “hard right majority” has actively participated in “undermining American democracy.”

As president, Donald Trump has repeatedly accused federal judges of being political and beholden to the presidents who appointed them. (JM Rieger/The Washington Post)

The article, entitled “The Roberts Court’s Assault on Democracy,” is scheduled for publication in an unspecified forthcoming issue of the Harvard Law & Policy Review, which describes itself as the official publication of the liberal American Constitution Society. It was published in full at SSRN this month.

Adelman, appointed to the bench by President Bill Clinton in 1997, is a former Democratic state senator in Wisconsin and Legal Aid Society trial lawyer. Perhaps his best-known decision nationally was a 2014 ruling striking down Wisconsin’s voter ID law.

His broad critique of the Roberts court, with particular reference to its decisions on voting rights and campaign finance by corporate interests, is not an uncommon one — coming, that is, from liberal scholars or political leaders, including former president Barack Obama.

But coming from a sitting federal judge in a journal article accompanied by such a blunt attack on Roberts, not to mention Trump, it has attracted uncommon attention.

So I’m not the only one to note the Chiefie’s “Taneyesque” performance, particularly on issues involving the rights of migrants, refugees, Muslims, and other persons of color. He has joined the regime in “Dred Scottifying” those with brown skins who are entitled to the protection of our Constitution and our laws, which Trump has eliminated without legislation, relying largely on transparently fraudulent “national security rationales.”

But, Roberts hasn’t been much good for African Americans or other minorities either, joining his right winger activist colleagues in disingenuously dismantling key parts of civil rights and voting rights protections and turning an intentionally blind eye to partisan gerrymandering carried out by the GOP to disenfranchise minorities. Election results get skewed and folks actually die as a result of these intentional miscarriages of justice to further a toxic right wing agenda aimed at destroying America’s democratic institutions, promoting inequality, and institutionalizing privilege. As Judge Adelman said “the transformation of the Supreme Court from what he described as a defender of ordinary people and ‘subordinated groups’ to an enabler of an ‘anti-democratic’ Republican agenda.” Right on, Judge A!

I also found this comment telling:

Adelman was unapologetic. “I think it’s totally appropriate to criticize the court when there’s a basis for it,” he said. “Judges are encouraged to comment on the law because we have a particular interest, knowledge and familiarity.”

Compare that with the “muzzling” of the Immigration Judiciary by the Executive reported recently on Courtside. https://immigrationcourtside.com/2020/03/03/🤡🤡clown-court-report-as-due-process-goes-into-death-spiral-regime-muzzles-immigration-judges/

And, as I constantly point out, the Immigration Courts aren’t “courts” at all. They are blatantly unconstitutional “star chambers” run by the Executive Branch with the complicity of the Article III Judiciary who see their work daily and know full well that they are often “rubber stamping” final orders sending folks into potentially life-threatening exile with only a transparently thin veneer of “due process.” But, according to Roberts and his gang, brown-skinned refugees aren’t entitled to even access this process in a reasonable manner, let alone receive the fair hearings to which they are entitled before being “orbited” to potential death in foreign lands. What if it were his wife and kids? I’ll bet their lives would get more consideration.

I also appreciate Judge Adelman’s “spotlighting” the disingenuous testimony of Roberts and other right wingers under oath before the Senate when they “feigned impartiality” to disguise their anti-democracy agenda (without, of course, losing the support of the rightest Republicans who were “licking their chops” at finally getting their long-awaited “judicial wrecking crew” in place).

As one of my esteemed Round Table colleagues said recently:  “In the words of Balzac, ‘to distrust the judiciary marks the beginning of the end of society.’”

Unhappily, thanks to Roberts and other complicit Article IIIs, we’re there. Which is exactly how Trump and his supporters want it!
