Between 2015 and 2020, about fifty bodies were recovered each year in Brooks County, according to an S.T.H.R.C. report. Then came Title 42, a policy enacted by the Trump Administration at the start of the COVID-19 pandemic that closed ports of entry and blocked most avenues for asylum claims, ostensibly for public-health reasons. The policy, which is still in place in a modified form, has increased business for smuggling cartels and spurred people to cross in more dangerous places. “Before Title 42, the calls we got used to be, like, eighty-per-cent apprehended, twenty-per-cent missing,” Canales said. “Now it’s flipped—it’s more like twenty-per-cent apprehended, eighty-per-cent missing.” So far this year, there have been nearly seventy recoveries of remains in Brooks County, putting 2022 on track to be the deadliest year on record.

So, before the Trump Administration’s bogus, racist “invocation” of Title 42, 80% of migrants came to the border or were easily apprehended close thereto — most probably because they turned themselves in to seek asylum through the legal system. And, lets not forget, this was with an already badly broken, fundamentally unfair, asylum legal adjudication system intentionally biased and “loaded” against legitimate refugees seeking protection!

Smart, honest public policy would have improved asylum adjudication at USCIS and at EOIR to quickly recognize and grant, with the assistance of NGOs and legal assistance groups, the many cases of legitimate refugees so that they could take their rightful, legal places in our society.

Additionally, by taking refugees seeking legal determinations “out of the equation,” enforcement against those seeking to evade legal processing — certainly a much, much smaller “universe” than is “out there now” — would have been enhanced. Business would have declined for smugglers, as those seeking protection would have been motivated to use a humane, fair, functioning legal system rather than being forced into “do it yourself” refuge!

You don’t have a genius to figure this out — just not be motivated solely by racism like Stephen Miller and his Trump regime cronies! Better qualified — non-Jim Crow righty — Federal Judges would also produce more humane, honest, and rational results.

Additionally, by running a legitimate asylum system, and complementing it with an honest, robust, legal refugee system for Latin America, the Caribbean, and Africa, we would finally have sound data on how many of those seeking to enter at the Southern Border are entitled to immigrate as legal refugees and how many are non-refugees. That’s something on which we now have no reliable information  — just myths and anecdotes, many provided by racist restrictionists and nativists with neither expertise in asylum law nor any real interest in the rule of law at the border.

As a result of Title 42, and the unqualified “Jim Crow” Federal Judges, GOP nativist AGs, and their apologists (including some in the media who repeat or republish, without critical examination, GOP racist lies about the border), we now have a deadlier than ever border; the legal immigration system at the border has been functionally abolished and replaced with an underground, extralegal system; the U.S. Government has ceded control of border migration policy to cartels and smugglers; and the job of the Border Patrol — forced to spend time apprehending legal refugees who seek only the protection to which they are legally entitled — has become impossible.

That’s what happens when we let GOP nativist pols, overt racists, and bad, right wing Federal Judges take over the immigration policies that were actually enacted by Congress — a key part of which are legitimate refugee and asylum systems and a fair, functioning, expert Immigration Court. Right now, we have NONE of the foregoing. And, innocent migrants at the border are too often paying the price — with their lives!

“Enforcing the law” does NOT mean unfairly, unwisely, and illegally abrogating the legal asylum system and fair adjudications in Immigration Court at the border. It means fixing the legal asylum system including USCIS Asylum Offices. Perhaps most of all, it means reforming and replacing where necessary the broken, dysfunctional, leaderless, and non-expert Immigration Courts and a BIA that continues to misinterpret asylum and protection laws on a daily basis. We need a BIA of real judges with the expertise and guts to establish fair, humane, correct, positive precedents and to rein in or remove from asylum cases those Immigration Judges who are “programmed to reject, not protect!”

I, along with many others, watched the Brittney Griner travesty unfold. I saw the irony. President Biden was rightfully blasting the outrageous “kangaroo court” show trial that passes for justice in Russia. But, at the same time, he, Harris, and Garland are basically running a farcical “Russian style” dysfunctional immigrant “justice” system at EOIR and calling it a “court!”

Perhaps, in addition to blasting the Griner farce, President Biden, VP Harris, and AG Garland need to take a closer look at the “Russian-style” justice being inflicted on migrants in their wholly-owned Immigration “Courts”  — which particularly target women, children, and migrants of color seeking justice under US laws. Indeed, many are still being arbitrarily returned without ANY process at all! Others get “off the wall” denials of their valid claims. Its this REALLY any way for a self-proclaimed “nation of laws” to operate?

Sorto-Guzman is a life-long Catholic who regularly attended Catholic services in El Salvador. In December 2015, about five members of the Mara 18 gang accosted Sorto- Guzman in the street as she was leaving church. At the time, she was wearing a crucifix medallion around her neck. The gang members tore the chain from her neck, hit and kicked her, and threatened to kill her if she ever wore it or attended church again. Sorto-Guzman stopped attending church after the attack, fearing the gang and their threats.
A few weeks later in January 2016, a group of Mara 18 gang members—including some of the gang members from the December 2015 assault—stopped Sorto-Guzman, along with her sister and Rivas-Sorto, as she was coming home from a shopping trip. One of the men attempted to sexually assault Sorto-Guzman and had started to forcefully kiss her. He only stopped when her screams caught the attention of a neighbor. The gang members threatened to kill Sorto-Guzman and Rivas-Sorto if Sorto-Guzman did not join the gang and start living with them.

On February 13, 2016, some of the gang members from the prior incidents tracked where Sorto-Guzman lived and broke into her house carrying guns. The gang members viciously beat Sorto-Guzman, threatened her life, and robbed her. Sorto-Guzman’s neighbors called the police, but they did not come until several hours after the assault. Sorto-Guzman reported the assault and robbery to the officers who arrived at the scene. She also went to the local police station the next day to report the attack. The police made one attempt to investigate, but Petitioners were not home when the police arrived, and the officers never followed up. The day after, a gang member called Sorto-Guzman, warning her she would regret making the report to the police and that they would soon kill her, her son, and her sister.

Absurdly, an Immigration Judge found that this gross abuse and death threats by a gang with the ability and willingness to carry them out did not amount to “persecution.” Worse yet, on appeal, rather than reversing and directing the judge below to follow the law, the BIA agreed — invoking the outlandish “theory” that the death threats, on top of the savage beating, weren’t so bad because they had never come to “fruition.” In other words, the applicant hadn’t hung around to be killed. Then, to top it off, attorneys from the DOJ’s Office of Immigration Litigation (“OIL”) unethically defended this deadly nonsense before the Fourth Circuit! This is “justice” in Garland’s disgraceful, deadly, and dysfunctional “court” system!

EOIR’s performance is this case, particularly the BIA’s absurdist conclusion that, essentially, death threats must result in death to constitute past persecution, is a contemptuous disregard for binding circuit precedent, a demonstration of gross anti-asylum bias, misogyny, and a clear example of judicial incompetence.

Would a heart transplant surgeon who “forgot” to install a new heart or neglected to sew up the patient’s chest be allowed to continue operating? Of course not! So, why is the BIA still allowed to botch life or death cases — the equivalent of open heart surgery?

If Garland allows his “delegees” to perform in this dangerous and unprofessional manner, in his name, what is he doing as Attorney General? This is a farce, not a “court system?” Those responsible need to be held accountable! And, OIL’s unethical defense of this deadly nonsense is indefensible!

DHS Fails to File Paperwork Leading to Large Numbers of Dismissals

TRAC: One out of every six new cases DHS initiates in Immigration Court are now being dismissed because CBP officials are not filing the actual “Notice to Appear” (NTA) with the Court. The latest case-by-case Court records obtained and analyzed by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University through a series of Freedom of Information (FOIA) requests show a dramatic increase in these cases.

Fewer Immigrants Face Deportation Based on Criminal-Related Charges in Immigration Court

TRAC:  Over the past decade, the number of criminal-related charges listed on Notices to Appear as the basis for deportation has declined dramatically. In 2010, across all Notices to Appear (NTAs) received by the immigration courts that year, ICE listed a total of 57,199 criminal-related grounds for deportation. It Will Now Be Harder For Unaccompanied Immigrant Children To Languish In Government Custody

Buzzfeed: The US reached a settlement Thursday that establishes fingerprinting deadlines for parents and sponsors trying to get unaccompanied immigrant children out of government custody. Under the settlement, which expires in two years, the government has seven days to schedule fingerprinting appointments and 10 days to finish processing them.

RE: Elizabeth’s “Item #2” under “Litigation” — EOIR, & Garland’s Inexplicable Failure To Fix It, Is What’s Wrong With American Justice!

More than five years ago, an indigenous woman from Guatemala and her disabled son filed “slam dunk” asylum claims. Undoubtedly, “indigenous women in Guatemala” are a “particular social group” — being immutable, particularized, and clearly socially visible within Guatemalan society and beyond. The foregoing sources also clearly illustrate that, with or without past persecution, such indigenous women would have a “reasonable fear” of persecution on account of their status under the generous standards for asylum adjudication articulated by the Supremes more than three decades ago in Cardoza-Fonseca and, shortly thereafter, reaffirmed and supposedly implemented by the BIA in Matter of Mogharrabi (a fear can be “objectively reasonable” even if persecution is significant unlikely to occur). Problem is: Both of these binding precedents favoring many, many more asylum grants are widely ignored by policy makers, USCIS, EOIR, and some Article III Courts — with no meaningful consequences!

Additionally, the respondents appear to have had grantable “racial persecution” claims based on indigenous ethnicity. The son, in addition to being a “derivative” on his mother’s application, also had an apparently grantable case based on disability.

In a functioning system, this case would have been quickly granted, the respondents would be integrating into and contributing to our nation with green cards, and they would be well on their way to U.S. citizenship. Indeed, there would be instructive BIA precedents that would prevent DHS from re-litigating what are essentially frivolous oppositions! 

But, instead, after more than five years and proceedings at three levels of our justice system, the case remains unresolved. Because of egregious, unforced EOIR errors it is still “bouncing around” the 1.8+ million EOIR backlog, following this remand from the Second Circuit. 

Exceptionally poor BIA legal performance, enabling and supporting a debilitating “anti-immigrant/anti-asylum/racially derogatory culture of denial” at EOIR, has led to far, far too many improper asylum denials at the Immigration Judge level and to a dysfunctional system that just keeps on building backlog and producing grotesquely inconsistent, “Refugee Roulette” results! Go to TRAC Immigration and check out the shocking number of sitting IJs with absurd 90% or more “asylum denial rates.” 

It also fuels the continuing GOP nativist blather that denies the truth about what is happening at our Southern Border. We are wrongfully denying legal protection and status to many, many qualified refugees — often without any process at all (let alone due process) and with a deeply flawed, biased, and fatally defective process for those who are able to “get into the system.” (Itself, an arbitrary and capricious decision made by lower level enforcement agents rather than experts in asylum adjudication).

The “unpublished” nature of this particular Second Circuit decision might lead one to conclude that the Article IIIs have lost interest in solving the problem, preferring to sweep it under the carpet as this pathetic attempt at a “below the radar screen” unpublished remand does. But, such timid “head in the sand” actions will not restore fairness and order to a system that now conspicuously lacks both! This dangerous, defective, unfair, and unprofessional abuse of our justice system needs to be “publicly called out!”

“The agency failed to evaluate any of the country conditions evidence relevant to Oliva-Oliva’s CAT claim.” So how is this acceptable professional performance by the BIA? And why is it being “swept under the carpet” by the Second Circuit rather than “trumpeted” as part of a demand that Garland fix his dysfunctional due-process-denying system, NOW? 

Contrary to all the fictional “open borders nonsense” being pushed by the nativist right, the key to restoring order at the borders is generous, timely, efficient, professional granting of refuge to those who qualify, either by the Asylum Office or the Refugee Program. This, in turn, absolutely requires supervision, guidance, and review where necessary by an “different” EOIR functioning as a true “expert tribunal.” 

That would finally tell us who belongs in the legal protection system and who doesn’t while screening and providing accurate profiles of both groups. The latter essential data is totally lacking under the absurdist, racially motivated, “rejection not protection” program of Trump, much of which has been retained by Biden or forced upon him by unqualified righty Federal Judges. But, we’ll never get there without meaningful, progressive, due-process focused EOIR reform!

There will be no justice at the Southern Border or in America as a whole without radical, long overdue, due process reforms at EOIR!

Since the 1990s, U.S. immigration policy has centered the goal of decreasing or “deterring” migration. These policies are designed with one goal in mind – punishing people for the act of migration with such cruelty that the harsh measures themselves will deter future migration.

Not only does this strategy not work, but it has deadly human consequences.

The devastating toll of deterrence programs came into full view with the recent tragedy in San Antonio, Texas, where 53 migrants died in the back of a tractor-trailer after attempting to enter the United States. Human rights experts, including NIJC, responded by emphasizing the urgent need to shift away from programs that block lawful pathways to entry or push people toward dangerous terrain.

Nonetheless, the U.S. government continues to double-down on policies and programs aimed at deterring migration. Some recent examples include continuing the Trump-era Remain in Mexico and Title 42 programs, and increasing the use of criminal prosecutions to punish migrants alleged to enter the country without authorization. Here are updates on each of these programs since we last reached out to you about them, along with ways you can demand that the U.S. government restores access to asylum and stops punishing people for migrating:

➡️ Recently, the Supreme Court ruled that the Biden administration could end the Remain in Mexico program, and it’s now time for the administration to follow through. Also known as the Migrant Protection Protocols (MPP), this program has forced more than 75,000 people to wait in dangerous conditions in Mexico while their claims are pending in U.S. immigration courts. This program defaced basic principles of due process and decades of U.S. commitment to protect people from harm and persecution. NIJC continues to represent dozens of asylum seekers who were subject to the program, including some who are still waiting in Mexico. Sign the petition calling on President Biden to end Remain in Mexico.

➡️ Border Patrol just released new data showing there have been 2,132,711 expulsions of people seeking safety at the U.S. border under Title 42, the vast majority of which happened under the Biden administration. The Trump administration implemented Title 42 under the guise of protecting public health during COVID-19, but the real goal was always to block Black, Brown, and Indigenous people from migrating to the United States. There have been nearly 10,000 documented cases of kidnappings, rape, torture, or other acts of violence against people who were expelled under Title 42. Yet, right now, some members of Congress are trying to pass legislation that continues this policy indefinitely. Tell your members of Congress to end Title 42 and oppose all efforts to continue it indefinitely.

➡️ The Biden administration is ramping up the use of criminal prosecutions to punish migrants arriving at the U.S. border, despite decades of evidence showing these prosecutions don’t work to deter migration and cause widespread harm. The increased use of such prosecutions flies in the face of the administration’s commitments to racial equity and to a more humane approach to migration policy. Criminal prosecutions do not stop people from crossing the border, but instead have caused widespread harm, separated countless families, and undermined asylum rights. Check out NIJC’s latest blog post explaining five ways that immigration prosecutions are deadly and ineffective.

NIJC knows, from years of representing immigrants and asylum seekers, that punitive border policies do not deter people from fleeing violence or seeking to reunite with their families.

Above all, immigration policies focused on deterrence inevitably and tragically cause countless deaths and untold human suffering. The U.S. must abandon a deterrence strategy, reopen ports of entry for asylum screenings, and embrace a humanitarian approach to immigration – it’s the only way to end systemic injustices, reduce mass incarceration, and protect fundamental human rights.

“Maximum deterrence programs” have little empirical support. Human migration, a phenomenon as old as humanity, is largely driven by powerful forces beyond whether a rich country has built walls, prisons, unfair legal systems, and other artificial barriers to “deter” migration. At best (or worst, depending on how one looks at it) these “gimmicks” and the predictable accompanying “rhetoric of hate, dehumanization, and rejection” nibble around the edges of migration patterns.

But, they are deeply rooted in the racial history of the U.S., and play a major role in the White Nationalist mythology that surrounds deterrence.

A smart nation might harness, take advantage of, and direct the flow of human migration. Ultimately, failed deterrence gimmicks will inflict cruelty and cause the death of some migrants. They also diminish the reputation and diminish the humanity of the “destination nation.”

But, they won’t stop folks from leaving intolerable situations to seek a better life elsewhere — no matter what the odds, risks, or hardships. And, they eat up money and resources that could actually be directed into building more realistic legal migration systems that would benefit both the migrants and the receiving countries.

In 2015, a Ghanaian man who goes by the initials M.A. and his gay friend were brutally assaulted by a vigilante group in Accra, Ghana. In Ghana, homosexuality is illegal and carries a prison sentence of up to three years. M.A. was beaten with sticks before escaping through a window. His friend was killed. Fearing the group would find and kill him, he fled to Ecuador and made his way to the U.S. border, where he requested asylum. After being detained for nine months, he was released on bond and lived with a childhood friend in New York while he waited for his case to make it through the legal system.

M.A. clearly faced persecution, but an immigration judge denied his claim. I took M.A.’s appeal to the Board of Immigration Appeals in 2016 as part of the Cornell Law School’s asylum appeals clinic. It took M.A. four years to win asylum in America, but at least he was given the chance to apply in the first place.

Since March 2020, approximately 900,000 people — including over 215,000 parents and children — have been denied the ability to request asylum at all. They’re casualties of Title 42, a pandemic-related policy that paused nearly all asylum proceedings at the border. Some people argue the policy is preventing an influx of migrants. In fact, numbers are up despite the policy, and our refusal to process most of them has led to chaotic and dangerous conditions.

The United States has successfully managed ebbs and flows of asylum seekers for decades. There’s a system in place to manage an influx — and regardless of how hard immigration lawyers like me fight for them to stay, many will lose their case and be deported. Even so, we must let people try. It’s not only the right thing to do, it’s also guaranteed under international and domestic law. We signed a 1967 protocol to the U.N. Refugee Convention to protect the rights of refugees, and we have adopted it and codified it into U.S. asylum law. Right now, we’re violating those obligations. The longer we do, the weaker American rule of law looks to our global partners.

We must immediately reinstate due process for asylum seekers. And once this happens, we must work to make the system more equitable and faster.

I agree that “we must work to make the system more equitable and faster.” But, the answer can’t be just to hire more Immigration Judges in Garland’s dysfunctional, broken, and anti-asylum-biased “court” system. That would just speed the “deportation assembly line” and lead to even more injustice and grotesque inconsistencies. 

According to TRAC, Immigration Judge “asylum denial rates” currently “range” from 5% to 100%. That’s a ridiculous, indefensible variation and a total perversion of the generous standard for granting asylum set forth by the Supremes in Cardoza-Fonseca and adopted by the BIA in Matter of Mogharrabi, but seldom enforced or followed, particularly these days.  Why this very obvious, totally solvable problem is still festering going on two years into a Democratic Administration that pledged to solve it is beyond me! 

Enough of this nonsense, biased, “amateur night at the Bijou” mal-administration of the Immigration Courts at EOIR by Garland’s DOJ! No wonder folks are still complaining about “Refugee Roulette” more than a decade after it was written by my Georgetown Law colleagues Professors Phil Schrag, Andy Schoenholtz, and Jaya Ramji-Nogales (now an Associate Dean at Temple Law). Why not put one of THEM, or for that matter, Professor Yale-Loehr, in charge of kicking tail and cleaning out the deadwood at EOIR?

At a minimum Garland must:

  • Remove the holdover “Asylum Deniers Club” from the BIA and replace them with a real judge as Chair and new Appellate Immigration Judges who are widely recognized as “practical experts” with careers that have demonstrated superior scholarship in immigraton and human rights, an unswerving commitment to due process for individuals, and a passion for racial justice in our legal system; 
  • Have the “New BIA” issue useful precedential guidance on how to document and grant valid asylum cases at both the Asylum Office and the Immigration Court, implement best practices, and identify and remove from future asylum adjudication those unqualified Immigration Judges who basically “make up” reasons to deny and can’t or won’t treat applicants fairly; and
  • Immediately replace with qualified expert judges those Immigration Judges on the “Southern Border docket” who can’t fairly adjudicate asylum cases.

Steve is totally correct about the need for Title 42 to go! But, Garland’s EOIR, particularly the BIA, is just as broken, counterproductive, and out of control as Title 42! In many ways, the illegal abrogation of the rule of law at the Southern Border has somewhat ”hidden” the larger problem that a dysfunctional and incapable EOIR poses for those who do manage to get a hearing!

Without a legitimate, totally reformed and significantly “re-populated” EOIR operating at the “retail level” of our justice system, there will be no rule of law and equal justice under law in America — for anyone!

Tell Garland you have had enough! The deadly and disorderly “EOIR Clown Show” has got to go! Now!

Through our reporting, we exclusively learned that U.S. Customs and Border Protection quietly changed last year how they count deaths on the border to only include deaths in custody, during arrests or when agents were nearby and there were 151 such “CBP-related” deaths in the 2021 fiscal year.

Craig Mousin has been the University Ombudsperson at DePaul since 2001. He received a BS from Johns Hopkins University, a JD from the University of Illinois, Urbana-Champaign, and an M Div from Chicago Theological Seminary. He joined the College of Law faculty in 1990, and served as the Executive Director of the Center for Church/State Studies until 2001, Acting Director until 2003, and co-director from 2004–2007. Mousin co-founded and continues to participate in the Center’s Interfaith Family Mediation Program. He has taught in DePaul’s School of Continuing and Professional Studies, the Religious Studies Department, the Grace School of Applied Diplomacy, and the Peace, Justice and Conflict Studies program. He has also taught as an adjunct faculty member at the University of Illinois College of Law and Chicago Theological Seminary .

Prior to DePaul, he began practicing labor law at Seyfarth, Shaw, Fairweather & Geraldson in 1978. In 1984, Mousin founded and directed the Midwest Immigrant Rights Center, a provider of legal assistance to refugees which has since become the National Immigrant Justice Center. He also directed legal services for Travelers & Immigrants Aid between 1986 and 1990. The United Church of Christ ordained him in 1989. At that time, Wellington Avenue U.C.C. called him as an Associate Pastor. He was a founding co-pastor of the DePaul Ecumenica l Gathering (1996-2001). Mousin serves as a Life Trustee of the Chicago Theological Seminary. In addition, he is a member of the Leadership Council of the National Immigrant Justice Center, a member of the Leadership Council of the Marjorie Kovler Center for Survivors of Torture, a former President and member of the Board of the Eco-Justice Collaborative, and a former President and Board member of the Immigration Project of downstate Illinois. Today’s WashPost Outlook Section contained a highly relevant article by author Dave Eggers about how far-right zealots — many with no real stake in our public schools — have taken over at local levels and apply extreme censorship — even to books and concepts that have been successfully and routinely taught for years. https://www.washingtonpost.com/outlook/2022/06/24/dave-eggers-book-bans-south-dakota/

In this case, it’s driving experienced teachers who believe in truth, freedom, and individual rights to flee in droves. So, what we’re really seeing is a shocking “dumbing down” of American education, libraries, and public discourse driven by far right fear-mongers seeking to impose their lack of values and intolerance on others.

We have seen this week how far-right activist extremists, from the Supremes to local politicians and school boards, have elevated guns that kill while gutting the individual rights to free speech, equal protection,  and fundamental fairness guaranteed by the 1st, 5th, and 14th Amendments. 

Justice Clarence Thomas is certainly a horrible jurist. But, in this instance he might be the only honest GOP appointee on the Supremes. 

When Thomas says that immigrants’ human rights, gay rights, right to conception, marriage rights and most other meaningful individual rights guaranteed by the Constitution are on the chopping block, progressives had better believe him. Remember how “leaving things to the states” worked out for African Americans and other minorities attempting to exercise their fundamental rights, even after the Civil War and the 13th, 14th, and 15th Amendments. And, remember all those paeons to precedent and “not to worry” about Roe statements under oath from GOP Supremes’ candidates before they actually took their seats on the Court and started scheming to undo abortion rights for political, not legal, reasons!

“Social Justice Warriors” like Craig have been fighting the good fight for decades. But, at this point, it’s going to depend on the NDPA and other young progressive groups to take on the extremist right at the ballot box and to take back their individual rights — really all of our individual rights.

Otherwise, they will find themselves as a disempowered counterculture, hiding out and trying to keep ahead of Ray Bradbury’s firemen in Fahrenheit 451!

5,000 Asylum-Seekers Added to the Migrant Protection Protocols 2.0, Few Are Granted Asylum

During the last six months, over 5,000 asylum seekers have been required to remain in Mexico under the current implementation of the Migrant Protection Protocols (MPP)—also known as MPP 2.0—while awaiting their Immigration Court hearings. Cases in MPP are generally being completed within the 180-day time frame set by the administration, but the problem with low rates of access to attorneys and unusually low rates of asylum success that plagued the first implementation of MPP continue this year.

As a result of low representation rates and accelerated hearings, just 27 people out of the 5,100 asylum seekers in MPP 2.0 so far, have received asylum or some other form of relief. These 27 cases account for just 2.4 percent of the 1,109 MPP 2.0 cases which have been completed to date. By contrast, during the same period of FY 2022, fully half of all Immigration Court asylum decisions decided for people inside the United States resulted in a grant of asylum or other relief.

While MPP 1.0 under Trump had also been designed to attempt to expedite processing of these asylum cases, MPP 2.0 is intended to speed case completions even further. Under current guidelines, cases assigned to MPP should be completed within 180 days. The Biden administration has been largely successful in meeting this deadline. During December 2021, a total of 129 asylum seekers were assigned to MPP 2.0, which means that most of these cases are reaching their 180-day deadline now (or soon). For these initial 129 cases, over eight out of ten (81%) were completed at the end of May. Nonetheless, it may be difficult for the Court to maintain this same processing pace as the monthly total of new MPP court filings has steadily grown to over 2,000 in May 2022.

MPP 2.0 cases have not been evenly spread among hearing locations. Cases added to MPP 2.0 in December were primarily heard by the El Paso Immigration Court which received 109 cases. The El Paso MPP court currently has 923 cases assigned to it. By contrast, the MPP Brownsville Immigration Court has now been assigned 2,752 new cases—more than half (54%) of all MPP 2.0 assigned cases as of the end of May. The MPP Laredo, Texas (Port of Entry) Immigration Court has been assigned 404 MPP cases, and an additional 76 cases have been assigned to the Laredo Immigration Court. The MPP Court San Ysidro Port has received 386 cases so far.

It is still early in the implementation of MPP 2.0, and TRAC’s report on MPP 2.0 should be understood as a preliminary analysis However, these findings do raise concerns similar to MPP 1.0. Further detailed analysis will be warranted as more cases are added to the current implementation of the Migrant Protection Protocols.

Garland’s performance on EOIR is disgraceful. Question is, what will advocates do about it?

Curiously, going into difficult midterms where every vote supposedly counts, the Biden Administration appears to have decided that they don’t need the support and votes of their base. They might well be following “Miller Lite” or “Miller Genuine” policies of abusing asylum seekers. But, I doubt they will be getting any votes from the “Miller Right!”

An interesting “strategy” to be sure. We’ll see how it works out!

Human Rights First yesterday submitted a public comment on the Biden administration’s Interim Final Rule that creates a new process for adjudication of some asylum claims.

 

Under the rule, asylum seekers who are placed in the expedited removal process and who establish a credible fear of persecution may be assessed in an initial full asylum interview with the U.S. Citizenship and Immigration Services. Cases not granted by the Asylum Office will be referred to immigration court removal proceedings, as will other asylum cases that are not granted by the Asylum Office.

While Human Rights First welcomes some aspects of the rule, we expressed our concern about unreasonably fast deadlines that would sacrifice fairness, thwart efficiency, and exacerbate backlogs.  We also oppose provisions that threaten asylum seekers’ right to a full and fair hearing on their asylum claims.

 

The rule guts a crucial safeguard in the credible fear process:  it provides that the new asylum process will be conducted after subjecting asylum seekers to the fundamentally flawed expedited removal process, which has been shown to return refugees to persecution and death.

 

In our public comment on the rule and a factsheet on its concerning provisions, we have recommended changes to help asylum seekers receive timely, fair, and accurate adjudications.

As with most Government immigration/civil/human rights programs, a large part of the problem is WHO is making these decisions, WHO is setting precedents, and WHO is overseeing the process and enforcing accountability.

  • The Biden Administration is still operating EOIR and large portions of the immigration bureaucracy at DHS with Trump-era “holdovers” who were improperly “programmed to deny” asylum.
  • There is a dearth of positive precedents from the BIA on gender-based asylum and other types of common asylum applications at the border that are routinely and wrongfully mishandled and denied.
  • There are cosmic problems resulting from failure to provide qualified representation of asylum seekers at the border.
  • Detention continues to be misused as a “deterrent” to legal claims and “punishment” for asserting  them. 
  • Despite “touting” a much larger refugee admissions program beyond the border, the Administration has failed to deliver a robust, realistic, refugee admissions program for Latin America and the Caribbean which would take pressure off the border. 
  • Racism and White Nationalism continue to drive the Administration’s dramatically inconsistent approach to White refugees from Ukraine compared with refugees of color at the Southern Border.

In plain terms, because of what the Biden Administration hasn’t done over the past 17 months, the new asylum regulations are “programmed for failure.”

Lopez-Perez argues here that the IJ erred under Matter of A-R-C-G- by concluding that she had not established a nexus between her persecution and her social group. Further, she argues that the IJ incorrectly decided that the government of El Salvador was willing and able to protect her.2 These issues were identified in her Notice of Appeal and are preserved for our review here.

It is true that the IJ concluded that Lopez-Perez had not demonstrated the requisite nexus and further that she had not shown that the government was unable or unwilling to help her. Although the IJ’s analysis was cursory, we nonetheless conclude that his decision must be upheld because remand would be futile. Jaco, 24 F.4th at 406. The IJ intimated that Lopez-Perez’s proffered social groups — “Salvadoran women in domestic relationships who are unable to leave; or Salvadoran women who are viewed as property by virtue of their position in a domestic relationship” — were cognizable.

2 Lopez-Perez also argues for the first time that we should remand to the IJ for consideration in light of intervening decisions in Matter of A-B-, 27 I. & N. Dec. 316 (Att’y Gen. 2018) and Grace v. We have disagreed, holding that circularly defined social groups are not cognizable. See id. at 405; accord Gonzales-Veliz, 938 F.3d at 226. Indeed, the social groups identified in Jaco are nearly identical to those claimed by Lopez- Perez: “Honduran women who are unable to leave their domestic relationships . . . and Honduran women viewed as property because of their position in a familial relationship.” Jaco, 24 F.4th at 399. Because the IJ is bound to follow the law of this circuit on remand, he would be forced to conclude that Lopez-Perez’s social groups were not cognizable, thus ending the analysis. See In re Ramos, 23 I. & N. Dec. 336, 341 (BIA 2002) (noting that the BIA is “unquestionably bound” to follow circuit court rulings).

We DENY the petition for review.

It’s worthy of note that neither party challenged the propriety of the “particular social group!” So, this panel actually went beyond the issues before them to “stick it to” this abused refugee woman by gratuitously rejecting a well-established formulation of a “particular group” that has been the basis for granting protection in literally thousands of cases going back over two decades. (I note that even before A-R-C-G-, in Arlington the DHS Counsel routinely accepted this formulation of a “PSG” based on the so-called “Martin Memo” from DHS.)

Perhaps, that’s because even this panel acknowledged that the IJ’s “nexus analysis,” the actual ground of denial was “cursory.” In other words, this vulnerable women sought legal protection only to be shafted by poorly qualified Federal Judges at every level — the Immigration Court, the BIA, and the Fifth Circuit!

  • Here’s what Wade Henderson, then President and CEO of the Leadership Conference on Civil and Human Rights had to say about Judge Leslie H. Southwick in opposition to his confirmation:

Given the tremendous impact that federal judges have on civil rights and liberties, and because of the lifetime nature of federal judgeships, no judge should be confirmed unless he or she demonstrates a solid commitment to protecting the rights of all Americans. Because Judge Southwick has failed to meet this burden, we must oppose his confirmation.

  • Here’s what the progressive group “Suit Up Maine” had to say about Judge Andrew Oldham at the time of his confirmation:

ANDREW OLDHAM: Confirmed by the Senate on July 18, 2018. Collins voted YES; King voted NO. Nominated to be federal judge for the 5th Circuit Court of Appeals, Oldham is young, aggressively conservative, and has been involved in controversial litigation that emphasized ideology over the law. Oldham has worked on cases aimed at limiting reproductive rights, challenging the Affordable Care Act, challenging California’s law requiring good cause for concealed carry of firearms, and challenging habeas rights, all of which were ultimately unsuccessful. He defended Texas laws that limited women’s access to abortions that were ultimately determined by the Supreme Court to put “undue burden” on women’s right to choose. His challenge to the Affordable Care Act based on the “Origination Clause” of the Constitution was dismissed by the 5th Circuit for lack of standing. He attempted to barr the use of habeas corpus claims by two plaintiffs, but appeals courts allowed the claims. He also filed an amicus brief on behalf of multiple states (including Maine) using the Second Amendment to challenge a California law requiring good cause for concealed carry of firearms. The 9th Circuit ruled that the Second Amendment does not protect a right to concealed carry of firearms. Additionally, Oldham was involved in challenging the EPA’s greenhouse gas rules under the Clean Air Act, and he defended Texas campaign finance laws that were being challenged by multiple nonprofits and political committees under the First Amendment. His record of unsuccessful attempts to shape the law according to his own conservative ideology suggests that this bias is likely to accompany him to the federal bench.

All these fears, criticisms, and predictions of bias have proved to be all too well-founded in the mal-performance of this “Toxic Trio” of far right ideologues.

  • “So the one BIA precedent in the past 20 years that actually recognized a PSG as valid isn’t worthy of Chevron deference, but A-B- was?!!”
  • “No more judicial restraint? Why is DOJ not changing position and or dropping these cases?”
  • “The 5th Circuit decision claims to direct all IJs in the 5th NOT to apply ARCG. And, most 5th Circuit IJs are high deniers anyway, so they don’t exactly need encouragement.”
  • “Perhaps better IJs could think of creative ways to work around the 5th’s decision. But, they don’t exist in the 5th Circuit in Garland’s EOIR.”
  • “It also shows the problems caused by Garland’s failure to “redo” the BIA and the IJ corps on “Day 1.” By now, it’s too late.”

Unqualified, far-right Federal Judges, egged on and supported by Stephen Miller and GOP State AGs, have basically usurped the power of Congress and the Executive to set immigration policies. There is lots of contempt for humanity, racism, misogyny, religious intolerance, and disrespect for true individual liberty driving their vile and illegal agenda.

The Constitutional rights of all Americans and the future of our democracy is at stake here. Will enough folks wake up and resist this takeover before it ‘s too late? TBD!

After two years of advocacy by Human Rights First and our allies, President Biden announced that his administration would end Title 42 this Monday, May 23.  Instead, a suit by attorneys general mirroring the talking points of the Trump administration blocked the end of this inhumane policy.

 

We will continue to push for the end of the misuse of Title 42 and advocate for fair and just asylum system until we succeed and refugees are welcomed with dignity to the United States.

Taking action on Title 42
The Biden administration had announced a plan to end on May 23 the misuse of Title 42 public health regulations that have barred asylum seekers at the border for the past two years.  On Friday a federal court in Louisiana forced the continuation of this egregiously inhumane policy.

 

Anwen Hughes, Director of Legal Strategy for Refugee Programs responded, “The court’s ruling requires the continuation of a public health policy that public health experts have concluded is not needed, and allows the continued evasion of U.S. immigration and refugee laws.”

 

Human Rights First joined 57 partner organizations in an amicus brief in this case detailing the human costs of using this policy at the border.  Our most recent report, authored with allies Al Otro Lado and Haitian Bridge Alliance, underscored how extending Title 42 escalates dangers to asylum seekers, exacerbates disorder at the border, and magnifies discrimination in the system.

Human Rights First President and CEO Michael Breen joined Rep. Pramila Jayapal, Chair of the Congressional Progressive Caucus, Mary Kay Henry, International President of the Service Employees International Union (SEIU), and Marielena Hincapié, Executive Director of the National Immigration Law Center (NILC), in a press call on Monday, the day that should have marked the end of the use of Title 42.

 

Speakers called for the end of this cruel policy and reiterated the need for a fair and humane asylum system that centers the dignity of all people.

 

“It is encouraging that the Justice Department quickly filed an appeal to the Louisiana court’s ruling, which extends the use of a policy, ostensibly based on public health, that public health experts have concluded is not needed.  Now it is critical that the administration take all necessary steps to defend the CDC’s decision to end the use of Title 42,” said Breen.

Democracy is essentially a system based around two values — freedom and equality. Fascists promoted the idea of replacement as a way of arguing that democracy and its ideals were incompatible with the nation. The very first chapter of Grant’s book is “Race and Democracy,” in which he contends that democracy is a threat to Nordic supremacy, because democracy leads inevitably to greater immigration and equality between races.

In fascist ideology, true national consciousness is pitted against domestic “enemies,” who are against national forms that are racially, ethnically or religiously homogeneous. These domestic “enemies” are invariably institutions and individuals who champion democracy and its ideals.

The Indian nationalist ideologue M.S. Golwalkar, the ideological founding father of BJP, the right-wing Hindu party of Narendra Modi, argued against the idea that a nation was composed of all of its inhabitants and rejected the idea that every citizen of India had equal rights to freedom. Like Grant, Golwalkar regarded democratic ideals as a clear threat to his vision of the nation.

If enemies are people who either look, think or behave differently, and if their mere existence poses a threat to the imagined homogeneity of the nation, it is not surprising that the most radicalized believer would carry out mass murders, as has happened in the U.S., Europe and New Zealand, and pogroms as in India.

And, of course, we see it in Russia’s invasion of Ukraine. Ideas of replacement are central to Russian extremist, nationalist, antisemitic and fascist traditions. They motivate the nature of its attack in Ukraine, such as wiping out Ukrainian identity culturally and physically. Vladimir Putin also considers liberal democracy as an existential threat to Russian cultural greatness, and by extension, to the Russian nation.

The link between WRT and fascism is not accidental. WRT is a relatively recent label for old fascism. In terms of propaganda, it is a rebranding of the same thing, namely longstanding fascist paranoias and lies about invasion and racial and political replacement. WRT’s logic justifies mass violence. When it is normalized, it poses an existential threat to democracy and its ideals. It targets the very idea of common humanity that underlies them.

The United States is in the midst of a massive formula crisis affecting some of the most vulnerable members of the population: babies. A perfect storm of numerous factors—pandemic-related supply chain delays; government bureaucracy; the stranglehold that just a few companies hold on the formula market; the closure of one of the biggest formula-manufacturing plants in the country, following the recall of contaminated batches and the death of two infants—has led to a terrifying reality for parents desperate and scrambling to feed their children. People who have the time—and many don’t—are driving long distances only to find empty shelves. Private sellers are reportedly price gouging, charging customers double or triple the normal amount. Unable to find what they need, some parents have been forced to ration formula as they search, often in vain, for more. One woman told The New York Times she recently found herself “freaking out, crying on the floor,” telling her husband, “Dude, I can’t feed our kids, I don’t know what to do.” The solution from Republicans, many of whom claim to be pro-life? Let the babies of undocumented parents starve. Or, at the very least, use the situation to demonize immigrants and score the cheapest of political points.

 

On Wednesday, Florida representative Kat Cammack tweeted a pair of photos, writing, “The first photo is from this morning at the Ursula Processing Center at the U.S. border. Shelves and pallets packed with baby formula. The second is from a shelf right here at home. Formula is scarce. This is what America last looks like.” Later, on Facebook, she claimed to have obtained the photos from a “border patrol agent” that’s been on the job for “30 years.” In the video, the congresswoman generously acknowledged that while all children deserve to eat, it’s not America’s job to feed the babies it detains.

 

“It is not the children’s fault at all,” Commack told her followers. “But what is infuriating to me is that this is another example of the ‘America Last’ agenda the Biden administration continues to perpetuate.” Cammack claims to be pro-life and only supports abortion in extreme cases in the first trimester, according to Fox News. She is cochair of the House Pro-Life Caucus and, naturally, is thrilled about the news that the Supreme Court is poised to overturn Roe v. Wade.

 

One day after Cammack’s suggestion that the migrant children the U.S. government has locked up should be forced to go hungry, Texas governor Greg Abbott jumped on the bandwagon, issuing a joint statement with the National Border Patrol Council: “While mothers and fathers stare at empty grocery store shelves in a panic, the Biden administration is happy to provide baby formula to illegal immigrants coming across our southern border…. Our children deserve a president who puts their needs and survival first—not one who gives critical supplies to illegal immigrants before the very people he took an oath to serve.” Like Cammack, Abbott would like people to believe he is “pro-life,” and signed a bill last September banning abortions after six weeks, leading to a surge of copycat legislation across the country.

 

Also on Thursday, Texas congressman Troy Nehls tweeted, “Baby formula should go to Americans before illegals.” (You can probably guess where Nehls stands on abortion.) And we’re sure it’ll absolutely shock you to hear that Fox News also believes migrant children should be forced to starve to death. As Media Matters’ Matt Gertz notes, a small selection of commentary from the networks’ stars over the past two days has included: “Why are we feeding illegal babies ahead of American babies?” (Jesse Watters); “These are not people that respected our borders, our laws, and our sovereignty. Why wouldn’t all of the pallets go to American families first?” (Sean Hannity); and “Once they get here, the Biden administration will give them food supplies that you can’t buy. Those would include baby formula…. How much more of this are people going to take, you wonder? It’s too humiliating” (Tucker Carlson). Fox, of course, has been a major voice in the antiabortion movement.

 

The rank hypocrisy of claiming to want to protect the “sanctity of life,” and then casually suggesting that some lives are less important than others aside, the entire situation these conservatives are decrying wouldn‘t actually be an issue if the right wasn’t so obsessed with imprisoning people trying to seek a better life. (While detention is not strictly the domain of Republicans— and both Joe Biden and Barack Obama were and remain happy to lock migrants up—Democrats are not the ones out there suggesting we let migrant children starve.) As the Washington Post’s Glenn Kessler notes, federal law literally requires the government to provide food— as well as other basic human rights— to the people it detains. If conservatives don’t want to have to follow that rule, they should probably stop demanding the government throw migrants in prison, though we have a small, sneaking suspicion they won’t. Because demonizing people who weren‘t born here is quite clearly their thing, and has been for years. As Jezebel’s Caitlin Cruz wrote on Thursday: “Migrants and immigrants of all ages are the perfect boogeymen. First, they take their jobs; now they want to take food out of babies’ mouths, while also forcing women to carry their pregnancies to term. The hypocrisy is so thick I am choking on it.

 

 

Mitch McConnell: It’s the Supreme Court’s job to issue rulings Americans don’t want

 

One of the most outrageous aspects of the news that the Supreme Court is likely to overturn Roe v. Wade is the fact that—despite what some conservatives would have people believe—a majority of Americans believe abortion should be legal in all or most cases and want to see the landmark decision upheld. But according to Senate minority leader Mitch McConnnell? It’s the high court’s job to issue rulings that fundamentally change life in a way Americans don’t want.

 

Speaking to NPR, the Kentucky lawmaker claimed that the whole point of the Supreme Court is to make decisions that most of the country doesn’t agree with. “For the Supreme Court to on any issue, to reach a decision contrary to public opinion it is exactly what the Supreme Court is about,” he argued. “It’s to protect basic rights, even when majorities are in favor of something else, that happens all the time.” McConnell then chose to bizarrely point to the issue of flag burning, the prohibition of which the court ruled in 1989 was a violation of the First Amendment. “If you took public opinion polls on that issue, people would overwhelmingly support a legislative prohibition of flag burning, but the Supreme Court interpreted that as a violation of the First Amendment freedom of speech.”

 

Of course, letting people burn flags is not the same as taking away the constitutional right of millions of people to make medical decisions about their own bodies, but you’ll have to forgive ole Mitchy, who’s currently trying to make people forget he’s one of the key architects of the impending obliteration of reproductive freedoms. In the interview with NPR, he claimed that his yearslong singular focus on installing conservative judges was not specifically about gutting Roe but keeping out “judicial activist[s],” a conservative smear for judges who believe in things like, for example, women having the same bodily autonomy as men. “My interest in this was unrelated to any particular issue,” he said. Naturally, he also blamed the declining trust in the court not on the appointment of people credibly accused of sexual assault (which they deny), or the revelation that at least one of them is married to someone who tried to have the 2020 election overturned, but on the left.

 

“It’s no wonder that by politicizing the Supreme Court, like the political left has, including the Democratic leader of the Senate—it would affect their approval ratings. That needs to stop,” McConnell said. “The president, who knows better, set up a commission to study the composition of the court. The Supreme Court is not broken and doesn’t need fixing.” Unsurprisingly, the GOP leader refused to say what he would do if Republicans take back the Senate and Joe Biden has an opportunity to nominate another justice, though, of course, it should already be clear. “How that plays out on individual confirmations or legislation, I’m not prepared to announce today, but we are going to see where we can cooperate,” he said, unconvincingly.

Texas continues its war on trans kids

In a unanimous ruling on a controversial issue, the Texas Supreme Court on Friday has cleared the way for the state child welfare agency to resume investigating parents and doctors who provide gender-affirming care for trans youth—actions that Governor Greg Abbott has equated to child abuse. It’s a blow to Texas families with transgender children, some of whom are departing the state or considering moves because of the threat of these investigations.

 

The ruling overturns a lower court’s injunction from March 11, barring state officials from pursuing Abbott’s February 22 directive that instructed the Department of Family and Protective Services to investigate “any reported instances” of a range of treatments and procedures, including the administration of hormones and puberty-blocking drugs. The parents of a transgender teen sued to stop the investigations, and in early March, District Judge Amy Clark Meachum issued a temporary order halting an investigation into the parents of the 16-year-old girl. Meachum later issued another order at the statewide level, temporarily blocking all such investigations stemming from Abbott’s directive.

 

In February, after Abbott issued his directive, the White House told The Dallas Morning News: “Conservative officials in Texas and other states across the country should stop inserting themselves into health care decisions that create needless tension between pediatricians and their patients. No parent should face the agony of a politician standing in the way of accessing life-saving care for their child.”

 

Sam Alito’s former Princeton classmate doesn’t think too highly of him

 

Millions of people have that in common with her. Per CNN:

 

Susan Squier, a former classmate of Supreme Court Justice Samuel Alito at Princeton University and who organized a letter protesting a leaked draft opinion that would overturn Roe v. Wade, on Thursday said she was stunned and called it “a greatest hits of misogyny.”

 

“When I read the document—I read all 98 pages of it, and mind you, I’m trained as a scholar of literature and medicine, and I look at nuance. And when I saw that he had smuggled into the document the wording from the Mississippi Gestational Age Act, which, as I understand it—now, I’m not a lawyer—but isn’t even law yet. And he was referring to unborn children rather than fetuses. I was just stunned,” Squier told CNN’s John Berman on New Day. “I mean, I have read a lot of medical history going back for doing literature and medicine, and his is like a greatest hits of misogyny.”

 

“He doesn’t consider the context,” Squier continued. “And this man was a historian at Princeton. He was a double major in history and poli sci. But it is as if he doesn’t believe history actually involves a record of things changing. Instead, it is history as, ‘let’s go back to the Salem witch trials.’ It makes me so angry.”

Of course there is no causal connection between the U.S. nationwide formula shortage and providing the necessities of life to those in the DHS “New American Gulag.”

Nor are these asylum applicants illegally present in the U.S. Most were allowed in to pursue their legal right to asylum, after having been found to have a “credible fear.” Indeed, the “illegality” here is the DHS’s failure to recognize and carry out our legal and moral obligations to give all asylum seekers a fair opportunity to present their claims before impartial expert adjudicators.

Additionally, starving asylum seekers’ children would not in any way address the national shortage of formula. No, it would just be another gratuitous act of cruelty motivated by hate and racism. In other words, standard GOP policies.

How race and religion have always played a role in who gets refuge in the US

In the weeks since Russia invaded Ukraine, millions of Ukrainians have fled the country as refugees. Hundreds of those refugees have now arrived at the southern border of the United States seeking asylum, after flying to Mexico on tourist visas.

At the border, Ukrainians, alongside thousands of other asylum seekers, must navigate two policies meant to keep people out. The first is the “Migrant Protection Protocols,” a U.S. government action initiated by the Trump administration in December 2018 and known informally as “Remain in Mexico.” The second is Title 42, a Centers for Disease Control and Prevention directive crafted in 2020, ostensibly to protect public health during the COVID-19 pandemic. The directive expels all irregular immigrants (those without permanent residency or a visa in hand) and asylum seekers who try to enter the U.S. by land.

On March 11, 2022, however, the Biden administration provided guidance allowing Customs and Border Protection officers to exempt Ukrainians from Title 42 on a case-by-case basis, which has allowed many families to enter. However, this exception has not been granted to other asylum seekers, no matter what danger they are in. It is possible that the administration may lift Title 42 at the end of May 2022, but that plan has encountered fierce debates.

The different treatment of Ukrainian versus Central American, African, Haitian and other asylum seekers has prompted criticism that the administration is enforcing immigration policies in racist ways, favoring white, European, mostly Christian refugees over other groups.

This issue is not new. As scholars of religion, race, immigration, and racial and religious politics in the United States, we study both historical and current immigration policy. We argue that U.S. refugee and asylum policy has long been racially and religiously discriminatory in practice.

Chinese asylum seekers

Race played a major role in who counted as a refugee during the early years of the Cold War. The displacement of millions fleeing communist regimes in Eastern Europe and East Asia created humanitarian crises in both places.

Under significant international pressure, Congress passed the 1953 Refugee Relief Act. According to historian Carl Bon Tempo, in the minds of President Dwight Eisenhower and most lawmakers, “refugee” meant “anticommunist European.” The text and implementation of the act reflected this. Of the 214,000 visas set aside for refugees, the law designated a quota of only 5,000 spots for Asians (2,000 for Chinese and 3,000 for “Far Eastern” refugees). Ultimately, approximately 9,000 Chinese (including 6,862 Chinese wives of U.S. citizens who came as nonquota migrants) were admitted under the 1953 refugee law, compared with nearly 200,000 southern and eastern Europeans, over the next three years.

Racial prejudice impacted the international response to refugees as well. By the late 1940s and early 1950s, United Nations officials had declared the displaced population in Europe a humanitarian crisis and appealed to the international community to relieve these pressures by accepting refugees. Over the next decade, Western nations including the U.S., France and Great Britain received millions of displaced Europeans as part of a larger Cold War public relations strategy to contain the Soviet Union and demonstrate the superiority of Western capitalist societies to life behind the Iron Curtain.

Millions of ethnic Chinese displaced by the 1949 Communist Revolution were not greeted so kindly. In the early 1950s, Hong Kong’s population tripled due to mainland Chinese fleeing civil war and communist rule, triggering a crisis. Most Western countries, however, continued to exclude Chinese and other Asians from immigrating and made few exceptions for refugees.

In the United States, exclusionary provisions that barred Asians from immigrating as “aliens ineligible to citizenship” would not be removed from immigration law until the 1965 Immigration Act.

Haitian asylum seekers

The first Haitian asylum seekers, who are overwhelmingly Black, attempted to reach the U.S. in boats in 1963 during the dictatorship of Francois Duvalier. It was a period of great economic inequality and severe violent repression of political opposition in Haiti.

Between 1973 and 1991, more than 80,000 Haitians tried to seek asylum in the U.S. The U.S., however, consistently attempted to intercept and turn back boats carrying Haitian asylum seekers to avoid having to hear their cases.

In the 1980s and 1990s, nearly every single Haitian who tried to request asylum was either denied or turned away. Some disparities between asylum rates could be explained by political factors, particularly the U.S. government’s interest in prioritizing refugees from communist countries.

However, the U.S. District Court for the Southern District of Florida and the 11th Circuit Court both found, in Haitian Refugee Center v. Civiletti and Jean v. Nelson respectively, that racial discrimination could be the only reason for such strikingly different outcomes for Haitians. In Jean v. Nelson, the 11th Circuit heard evidence from plaintiffs that there was a less than two-in-1 billion chance that Haitians would be denied parole so consistently if immigration policies were applied in racially neutral ways. Both courts also noted the differences in outcomes of asylum claims between Cuban refugees, who were predominantly white, and Haitian refugees.

In the same time period, even while Black Haitian asylum seekers were being turned away, European immigrants, who were primarily white, received preference in the Diversity Visa system created by the Immigration Act of 1990. Northern Ireland, for example, was designated as a separate country from the United Kingdom, and 40% of “diversity transition” visas allocated during 1992 to 1994 were earmarked for Irish immigrants.

Similar accusations of racism and discriminatory treatment have surfaced over the last several months as Haitian asylum seekers at the U.S.-Mexico border have been forced onto flights to Haiti and have faced degrading treatment.

Syrian refugees and the Muslim ban

Beginning in January 2017, President Donald Trump issued a series of executive orders described by many refugee advocates as the “Muslim Ban.” The ban suspended the entry of people from majority-Muslim countries, including Syrians, and limited the number of refugee admissions of several majority-Muslim countries.

Syrian refugees, most of whom fled the Syrian civil war that began in 2011 and violence by the Islamic State, were specifically targeted in the Muslim Ban.

A February 2017 version of the Muslim Ban claimed that Syrian refugees were “detrimental to the interests of the United States and thus suspend[ed]” from admission, with few exceptions. This contributed to a significant decrease in the number of Syrian refugees – from 12,587 to 76 between financial year 2016 to 2018.

Research shows that religion, particularly Islam, is used to create symbolic boundaries of racial distinction in order to promote immigration enforcement goals. Specifically, the government attempted to justify an exclusionary refugee policy based on race and religion by implicating Muslims and refugees in terrorism, as Trump did in speeches, even calling Syrians the “trojan horse” for terrorism.

International agreements for refugees and asylum seekers clearly state that admissions should be based on need. In principle, U.S. law says this as well. But these key moments in United States history show how race, religion and other factors play a role in determining who is in, and who is out.

While refugees from the war in Ukraine deserve support from the United States and other countries, the contrast between the treatment of different groups of refugees shows that the process of gaining refuge in the United States is still far from equitable.

  • Because the polls tell them is “politically expedient” to favor racism?
  • Because racism at the border and in the immigration system are thought to be “below the radar screen?” 
  • Because dead refugees of color “don’t matter?”
  • Or, put another way, because the lives of refugees of color don’t matter?
