Whether or not he is re-elected, Donald Trump will be revered by conservatives for his judicial appointments. As of March, Trump has appointed 193 judges to the federal bench, with another 39 pending on the floor of the Senate or in the Senate judiciary committee. Those nominations will surely be acted on favorably by the Senate before 20 January 2021, when there may be a new president and a new Senate. There are another 38 district court vacancies awaiting nominations. In one presidential term, Trump may appoint up to 270 federal judges, or 31% of the entire federal judiciary. For perspective, Barack Obama appointed 329 in eight years.

There is no doubt that the Senate majority leader, Mitch McConnell, will confirm Trump’s appointments until the very last day of his term. This is of course the same Senate gatekeeper who infamously blocked Obama’s final supreme court nomination, Merrick Garland, for an entire year – on the ground that in the final year of a presidency, the Senate should await “the will of the people” in the upcoming general election. But that was then. The rules have apparently changed. McConnell will pack the courts with “right-thinking” ideologues who will carry out Trump’s agenda long after he has been subjected to the scorn of historical scrutiny.

We now know a lot about Trump’s judicial appointments. Eighty-five per cent are white and 76% are male. This is a significant step backward. Obama’s judicial appointments were 64% white and 58% male. Today, after more than three years of Trump’s appointments, the federal judiciary is 73% white and 66% male, but it will be even more male and pale by the end of his term. Even more troubling is the average age of the Trump judges. According to Brookings, the median age of Trump’s judicial appointments by the beginning of his fourth year in office is 48.2. By the same time in his presidency, the median age of Obama’s appointees was 57.2. This means that Trump judges will serve, on average, for 10 years more than the Obama judges.

Statistics only tell part of the story. More important is the impact of these statistics on the critical issues that face the courts now and in the future. Courts should reflect the people they serve. I served as a federal district judge for 22 years. The vast majority of criminal defendants (in non-white-collar cases) were either African American or Hispanic, as were their family members. Plaintiffs in employment discrimination cases were overwhelmingly women, minorities or persons with disabilities. The same was true in actions involving prisoner rights, voting rights, housing discrimination and public benefits. Not all cases involve big corporations and business disputes.

A diverse bench engenders trust and credibility. Many studies have shown that decision-makers reach better decisions when they bring a variety of experiences to their analysis. A 36-year-old lawyer who has never tried a case, has not represented individual clients, and has not spent years facing life’s challenges is not well-positioned to decide on the length of a prison term, the need for access to healthcare, abortion, food stamps, Medicare or housing, or the impact of pollution or discrimination on working people’s quality of life. It is for this reason the American Bar Association’s standing committee on the federal judiciary insists that a candidate for judicial office have at least 12 years of experience practicing law – not talking about it as a speech writer, lobbyist or media star.

When I was appointed to the bench I was 48. I had been a federal prosecutor, a defense lawyer, and had handled many civil cases in trial and appellate courts. That experience was invaluable. I knew both the substance and procedure of federal practice. The same cannot be said of many of Trump’s nominees, whose only qualifications appear to be their consistently rightwing voting records.

Consider the following four Trump judges, all of whom were appointed in their 30s. What they have in common is not their legal experience, but their outspoken support of Trump’s political agenda. All were members of the Federalist Society or other rightwing organizations, clerked for conservative judges, and have written articles or advocated for legal positions that are vastly out of step with most Americans.

Allison Rushing was 36 when she was confirmed to a seat on the fourth circuit court of appeals, 11 years after graduating from law school, and Trump’s youngest nominee to a circuit court judgeship. She clerked for then-circuit judge Neil Gorsuch and for Justice Clarence Thomas. Her law practice during the remaining nine years was limited to representing big corporations at one of the nation’s largest law firms.

Andrew Brasher was 38 when he was confirmed to a seat on the 11th circuit court of appeals, after serving for only nine months on the district court for the middle district of Alabama. In the years just before his appointment he served as Alabama’s solicitor general, often advocating for rightwing causes.

Justin Walker, best known for his full-throated defense of Brett Kavanaugh (for whom he clerked), was appointed as a district judge in the western district of Kentucky, at 37, just 10 years after graduating law school. He is a protege of Mitch McConnell, who held up debate on a Covid-19 relief bill to attend Walker’s induction ceremony. Less than six months after Walker took the bench, Trump announced that he intended to nominate him for an upcoming vacancy on the DC court of appeals.

Patrick Wyrick was 38 when he was confirmed as a judge for the western district of Oklahoma. Four years after graduating law school he became the solicitor general of Oklahoma. He is a protege of Scott Pruitt, the disgraced former head of the Environmental Protection Agency.

One of these judges could easily end up on the supreme court; two are known to be on the shortlist. All will probably still be on the bench 40 years from now. That alone should make voters think hard about the upcoming presidential election. As the saying goes: elections have consequences.

I’ve been preaching on “Courtside” for some time now about the serious deterioration of America’s Article III Judiciary in the face of Trump’s tyranny. While there are some notable exceptions among appointees of both parties, even some of the “non-Trump appointees” have done a less than heroic job of standing up for Due Process, fundamental fairness, equal justice for all, and human rights, particularly when it comes to vulnerable migrants and asylum seekers, some children, being abused by a system that just no longer cares.  

Witness the clearly unconstitutional and essentially unconscionable abuse and open mockery of the American Justice system, the rule of law, and respect for human dignity going on every day in our broken and dysfunctional U.S. Immigration “Courts” that betray and sometimes mock the most fundamental of American values. 

Any Article III Judge personally subjected to the kind of  intentional dehumanization (a/k/a/ “Dred Scottification”) and disrespect going on daily in Immigration Court would be outraged! But, that outrage seems to disappear when the grotesque abuses are only being inflicted on “the other.” Since, according to Trump and his cronies, the majority of Americans are “the other” — in some way or another — this abdication of judicial integrity has ominous implications far beyond the “world of immigration” — where those mistreated often get deported so their voices can no longer be heard!

While, yes, the Administration frequently gets bashed by some U.S. District Courts and some Circuits, we’re only getting at the “tip of the iceberg” for a system that is allowed to grind out unfair and substandard results and where far too many are simply railroaded out of the country without fair access to lawyers, Article III judicial review, and even time to prepare their cases or understand what they are required to prove to save their lives. 

Emboldened by judicial intransigence and fecklessness, the Administration has now “one-upped” the complicit Article IIIs by simply unilaterally, and without legislation, cutting off access to even the Immigration Courts while the “J.R. Five” nods approval like a bunch of “judicial bobbleheads” gracing Stephen Miller’s mantle. 

No, we can’t change life tenure. But, we can elect a President and a Senate majority committed to a diverse Federal Judiciary that will put excellence, due process, equal justice, human rights, and human understanding and empathy before far-right ideology. That’s an important start on fighting back and taking the challenge directly to those now on the bench who are committed to dehumanizing, degrading, and ignoring the rights of those who comprise the real America.

This November, vote like your life depends on it. Because it does!

[The BIA] added, however, that “[e]ven if [De Pena] had

suffered harm rising to the level of past persecution,” De Pena’s

proposed particular social groups are analogous to those in Matter

of A-R-C-G, 26 I. & N. Dec. 388 (BIA 2014), which the BIA

understood to have been “overruled” by the Attorney General in

Matter of A-B, 27 I. & N. Dec. 316, 319 (A.G. 2018). The BIA read

A-B as “determin[ing] that the particular social group of ‘married

women in Guatemala who are unable to leave their relationship’ did

not meet the legal standards to qualify as a valid particular

social group.”

That conclusion poses two questions to be resolved on

this appeal: First, does A-B categorically reject any social group

defined in material part by its members’ “inability to leave” the

relationships in which they are being persecuted; and, second, if

so, is A-B to that extent consistent with the law?

Is it reasonable to read the law as supporting such a categorical

rejection of any group defined by its members’ inability to leave

relationships with their abusers? A-B itself cites only fiat to

support its affirmative answer to this question. It presumes that

the inability to leave is always caused by the persecution from

which the noncitizen seeks haven, and it presumes that no type of

persecution can do double duty, both helping to define the

particular social group and providing the harm blocking the pathway

to that haven. These presumptions strike us as arbitrary on at

least two grounds.

First, a woman’s inability to leave a relationship may

be the product of forces other than physical abuse. In

Perez-Rabanales v. Sessions, we distinguished a putative group of

women defined by their attempt “to escape systemic and severe

violence” from a group defined as “married women in Guatemala who

are unable to leave their relationship,” describing only the former

as defined by the persecution of its members. 881 F.3d 61, 67

(1st Cir. 2018). In fact, the combination of several cultural,

societal, religious, economic, or other factors may in some cases

explain why a woman is unable to leave a relationship.

We therefore do not see any basis other

than arbitrary and unexamined fiat for categorically decreeing

without examination that there are no women in Guatemala who

reasonably feel unable to leave domestic relationships as a result

of forces other than physical abuse. In such cases, physical abuse

might be visited upon women because they are among those unable to

leave, even though such abuse does not define membership in the group

of women who are unable to leave.

Second, threatened physical abuse that precludes

departure from a domestic relationship may not always be the same

in type or quality as the physical abuse visited upon a woman

within the relationship. More importantly, we see no logic or

reason behind the assertion that abuse cannot do double duty, both

helping to define the group, and providing the basis for a finding

of persecution. An unfreed slave in first century Rome might well

have been persecuted precisely because he had been enslaved (making

him all the same unable to leave his master). Yet we see no reason

why such a person could not seek asylum merely because the threat

of abuse maintained his enslaved status. As DHS itself once

observed, the “sustained physical abuse of [a] slave undoubtedly

could constitute persecution independently of the condition of

slavery.” Brief of DHS at 34 n.10, Matter of R-A, 23 I. & N. Dec.

694 (A.G. 2005).

 

For these reasons, we reject as arbitrary and unexamined

the BIA holding in this case that De Pena’s claim necessarily fails

because the groups to which she claims to belong are necessarily

deficient. Rather, the BIA need consider, at least, whether the

proffered groups exist and in fact satisfy the requirements for

constituting a particular social group to which De Pena belongs.

I’ve heard of the bogus rationale used by the BIA in this case reflected in a number of wrongly decided unpublished asylum denials by both the BIA and Immigration Judges. This should make for plenty of remands, slowing down the “Deportation Railroad,” jacking up the backlog, and once again showing the “substantial downside” of  idiotic “haste makes waste shenanigans” at EOIR and allowing biased, unqualified White Nationalist hacks like Sessions and Barr improperly to interfere with what are supposed to be fair and impartial adjudications consistent with Due Process and fundamental fairness.

 

Great as this decision is, it begs the overriding issue: Why is a non-judicial political official, particularly one with as strong a prosecutorial bias as Sessions or Barr, allowed to intervene in a quasi-judicial decision involving an individual and not only reverse the result of that quasi-judicial tribunal, but also claim to set a “precedent” that is binding in other quasi-judicial proceedings?  Clearly, neither Ms. De Pena-Paniagua nor any other respondent subject to a final order of removal under this system received the “fair and impartial decision by an unbiased decision-maker” which is a minimum requirement under the Due Process Clause of the Fifth Amendment.

 

Let’s put it in terms that an Article III Circuit Court Judge should understand. Suppose Jane Q. Public sues the United States in U.S. District Court in Boston and wins a judgment. Unhappy with the result, Attorney General Billy Barr orders the U.S. District Judge to send the case to him for review. He enters a decision reversing the U.S. District Judge and dismissing Public’s claim against the United States. Then, he orders all U.S. District Judges in the District of Massachusetts to follow his decision and threatens to have them removed from their positions or demoted to non-judicial positions if they refuse.

 

The First Circuit or any other Court of Appeals would be outraged by this result and invalidate it as unconstitutional in a heartbeat! They likely would also find Barr in contempt and refer him to state bar authorities with a recommendation that his law license be revoked or suspended.

 

Yet this is precisely what happened to Ms. A-B-, Ms. De Pena Paniagua, and thousands of other asylum applicants in Immigration Court. It happens every working day in Immigration Courts throughout the nation. It will continue to happen until Article III Appellate Judges live up to their oaths of fealty to the Constitution and stop the outrageous, life-threatening miscarriages of justice and human dignity going on in our unconstitutional, illegal, fundamentally unfair, and dysfunctional Immigration Courts.

Trump’s ‘Deportation Machine’ Keeps Growing Despite Pandemic – Bloomberg

As President Donald Trump prepares to pause immigration into the U.S., the court system that handles the removal of immigrants is projected to issue nearly 60% more deportation orders than last year.

With the rest of the U.S. legal system grinding to a near halt amid the pandemic, at the nation’s 69 federal immigration courts cleaning crews clad in hazmat suits are regularly used to make sure in-person hearings can continue. The courts are moving at speed to reduce a massive backlog of cases despite outdated technology and criticism from advocacy groups and a union representing most of the nation’s 460 immigration judges, who say the pace is putting people at risk of infection.

“The deportation machine has not stopped,” said Florida immigration lawyer Ira Kurzban. “It’s somewhat outrageous given the current circumstances.”

While the number of people deported from the U.S. fell in March, one research group predicts that the total number of deportation orders will rise for the 2020 fiscal year, despite the pandemic. The Transactional Records Access Clearinghouse, a Syracuse University group that tracks government enforcement actions, estimates there will be 340,500 deportation orders in the year ending Sept. 30, 2020, up from 215,535 for the prior year. A spokeswoman for the Justice Department, which oversees immigration courts, declined to comment on the projection, saying it doesn’t certify third-party statistics.

The National Association of Immigration Judges says the continued operation of the courts is unsafe and has called for them to be closed. The Trump administration in 2018 set a quota for each immigration judge to close 700 cases a year, a requirement that remains in force during the pandemic, said Ashley Tabaddor, president of the union.

‘Hobbesian Choice’

U.S. immigration judges are “being forced into this Hobbesian choice of risking their health and having to keep their jobs,” said Tabaddor. She cites a colleague who is trying to meet his quota while minimizing his health risk as a throat cancer survivor.

Along with the judges, 1,200 support staff work in the nation’s immigration courts. Those courts are taking precautionary steps similar to those elsewhere in the federal system “to reduce the likelihood of exposure to Covid-19,” including holding hearings via phone or video conference whenever possible, according to Kathryn Mattingly, a Justice Department spokeswoman. Hearings involving people not in custody have also been suspended until May 15.

But judges and lawyers said it is harder for the immigration courts to operate remotely than other federal courts. While electronic document filing is routine in other federal courts, the immigration courts have struggled to introduce it, leaving most documents in paper form. Though some filings are now accepted by email, the many court employees without laptops need to come into the office to access them.

“The immigration courts are probably 20 years behind federal courts in terms of technology,” said Jeff Chase, a former immigration judge. Moreover, some immigration courts have rules where opting for a phone hearing means giving up the right to object to documents submitted by ICE, he said.

The current situation has immigration lawyers choosing between their personal well-being and a client’s future, Chase said. “Lawyers should not be put in this position.”

Actually, when the “off docket”cases are factored in, the backlog exceeds 1.4 million cases. Even with artificially accelerated production, and if no new cases were filed by DHS (reality check — receipts have been exceeding completions for years) it would take until 2024 to “clear” the existing backlog. But, the reality is that even by speeding up the “Deportation Railroad,” adding new often inadequately trained judges largely from the ranks of prosecutors, eliminating Due Process, demeaning their own employees, and unethically skewing the law against migrants, EOIR has been unable to reduce the backlog by even one case under the Trump regime! 

Indeed, when all of the pending and “off docket” cases are considered, the already large backlog left behind by the Obama Administration has more than doubled, and is well on its way to tripling, under the Trump regime’s “malicious incompetence” and pattern of often illegal and irrational behavior. Many of the “final orders of deportation” being cranked out by EOIR are either legally wrong or counterproductive — deporting harmless individuals who actually are productive members of our society, often with U.S. citizen family members. This system, including the mindless abuse of docket space by DHS Enforcement and “Aimless Docket Reshuffling” by EOIR, is broken! Yet, it’s allowed to continue grinding away, putting lives in danger in more ways than one.

And, speaking of incompetence, whether malicious or not, I was on the initial “E-Filing Group” that submitted comprehensive recommendations and a detailed plan for implementing e-filing to ”EOIR management” back in 2001 or 2002. Since then, successive waves of EOIR “management” have squandered time, money, and public trust without producing a usable product. Meanwhile, almost every other court in America has designed and implemented e-filing systems. This catastrophic failure in and of itself would more than justify eliminating EOIR and replacing it with a judicially-managed, independent, professionally administered court system that would guarantee due process, efficiency, and fundamental fairness for all.

But, that’s by no means the only problem at EOIR. It’s unconstitutional, unfair, dysfunctional, unprofessional, and downright dangerous. I have posted recently about how Courts of Appeals continue to find that the BIA has grossly misinterpreted, distorted, and/or misapplied both law and facts in “life or death cases.” Is “good enough for government work” really OK for human lives? That neither Congress nor the Article III Courts have had the guts and decency to put an end to this life-threatening farce staining our justice system is an unforgivable national disgrace.

Those of us who understand exactly what’s happening at EOIR under the Trump kakistocracy might at the moment be powerless to change it. But, we’re continuing to challenge the unacceptable status quo and making a public record of this grotesque malfeasance and of those in all three branches of Government who are “papering over” (and by doing so enabling) EOIR’s abuses. Eventually, positive change will come. The only question is how many lives and futures will unnecessarily be lost before it does?

BIA: “Lock Them Up!”

In the words of the Supreme Court, “Freedom from imprisonment – from government custody, detention, or other forms of physical restraint – lies at the heart of the liberty that [the Due Process] Clause protects.”1  While imprisonment usually occurs in the criminal context, courts have allowed detention under our immigration laws, which are civil and (purportedly) non-punitive, only to protect the public from danger or to ensure the noncitizen’s appearance at future hearings.2  Case law thus requires a determination that a detained noncitizen does not present a danger to the public, a risk to national security, or a flight risk in order to be eligible for bond under section 236 of the I&N Act.

The Board of Immigration Appeals has acknowledged the complexity of such determinations.  In it’s 2006 decision in Matter of Guerra,3 the Board suggested nine factors that an immigration judge may consider in deciding if bond is warranted.  The list included whether the respondent has a fixed U.S. address; the length of residence, employment history, and family ties in this country (and whether such ties might lead to legal status); the respondent’s criminal record, and their record of appearing in court, fleeing prosecution, violating immigration laws, and manner of entry to the U.S.  But the Board made clear that an immigration judge has broad discretion in deciding what factors to consider and how much weight to afford each factor.The ultimate test is whether the decision was reasonable.

What makes such a decision reasonable?  Given what the Supreme Court has called “an individual’s constitutionally-protected interest in avoiding physical restraint,”4 Guerra’s broad discretion must be interpreted as an acknowledgment of the inadequacy of relying on “one size fits all” presumptions as a basis for overriding such a fundamental constitutional right.  In allowing IJs to consider what factors to consider and how to weigh them, Guerra should be read as directing those judges to delve deeply into the question of whether the noncitizen poses a danger or a flight risk.  Obviously, all recently-arrived immigrants are not flight risks, and all of those charged with crimes don’t pose a threat to society.As the trier of fact, immigration judges are best able to use their proximity to the respondent, the government, and the evidence and witnesses presented to determine what factors are most indicative of the likelihood that the respondent will see their hearings through to the end and abide by the result, or in the case of criminal history, the likelihood of recidivism.

In considering the continued custody of one with no criminal record, the risk to public safety or national security are generally not factors.  And in Matter of R-A-V-P-,5 a case recently decided by the BIA, the immigration judge found that the respondent, an asylum-seeker with no criminal record, presented no risk on either of those counts.  However, the immigration judge denied bond on the belief that the respondent was a flight risk, and it was that determination that the BIA was asked to consider on appeal.

How does one determine whether someone detained upon arrival is likely to appear for their hearings?  It is obviously more complicated than whether one presents a threat to public safety, in which the nature of the criminal record will often be determinative.  In R-A-V-P-, the Board repeated the nine Matter of Guerra factors, and added a tenth: the likelihood that relief will be granted.

As stated above, Guerra made clear that these were suggestions; the immigration judge could consider, ignore, and weigh whatever factors they reasonably found relevant to the inquiry.  Furthermore, many of the listed Guerra factors were not applicable to the respondent.  Guerra involved a respondent found to pose a danger to others.  The nine factors laid out in the decision were not specific to the question of flight risk; clearly, all the listed factors were not meant to apply in all cases.  As to the specific case of R-A-V-P-, obviously, someone who was detained since arrival can have no fixed address, length of residence, or employment history in this country.  The respondent’s history of appearing for hearings also reveals little where all appearances occurred in detention.And the Guerra factors relating to criminal record and history of fleeing prosecution are inapplicable to a respondent never charged with a crime.

The Board’s decision in R-A-V-P- is very short on details that would provide meaningful context.  There is no mention of any evidence presented by DHS to support a flight risk finding.  In fact, the absence of any listing of government counsel in the case caption indicates that DHS filed no brief at all on appeal, a point that doesn’t appear to have made a difference in the outcome.6

The few facts that are mentioned in the decision seem to indicate that the respondent sought asylum from Honduras based on his sexual orientation.  Not mentioned were the facts that the respondent entered as a youth, and that although he entered the U.S. without inspection, he made no attempt to evade immigration authorities after entry.  To the contrary, he immediately sought out such authorities and expressed to them his intention to apply for asylum.These facts would seem quite favorable in considering the Guerra factors of the respondent’s “history of immigration violations,” manner of entry to the U.S., and attempts to “otherwise escape from authorities.”7  And although not mentioned in Guerra, the respondent is also represented by highly competent counsel, a factor that has been demonstrated to significantly increase the likelihood of appearance, and one within the IJ’s broad discretion to consider as weighing in the respondent’s favor.

Regarding the tenth criteria introduced by the Board, i.e., the likelihood of relief being granted, the persecution of LGBTI individuals is well-documented in Honduras, and prominently mentioned in the U.S. Department of State’s country report on human rights practices for that country.  The State Department reported an increase in killings of LGBTI persons in Honduras in 2019, and that 92 percent of hate crimes and acts of violence committed against the LGBTI community went unpunished.  Such asylum claims are commonly granted by asylum officers, immigration judges, and the BIA.

Yet the Board took a very strange approach to this point.  It chose to ignore how such claims actually fare, and instead speak in vague, general terms of how “eligibility for asylum can be difficult to establish,” even for those who were found to have a credible fear of persecution.  The Board next noted only that the immigration judge found that the respondent “did not demonstrate a sufficient likelihood that he would be granted asylum,” without itself analyzing whether such conclusion was proper.

In fact, the immigration judge did deny the asylum claim; a separate appeal form that decision remains pending before the BIA.  But the Board missed an important point.The question isn’t whether the respondent will be granted asylum; it’s whether his application for asylum will provide enough impetus for him to appear for his hearings relating to such relief.  From my experience both as an attorney and an immigration judge, the answer in this case is yes.One with such a claim as the respondent’s who is represented by counsel such as his will almost certainly appear for all his hearings.The author of the Board’s decision, Acting BIA Chair Garry Malphrus, did sit as an immigration judge in a non-detained court for several years before joining the BIA.  I’m willing to bet that he had few if any non-appearances on cases such as the respondent’s.

Yet the Board’s was dismissive of the respondent’s asylum claim, which it termed a “limited avenue of relief” not likely to warrant his appearance in court. Its conclusion is strongly at odds with actual experience.  Early in my career, I represented asylum seekers who arrived in this country in what was then known as “TRWOV” (transit without visa) status, which meant that the airline they traveled on was responsible for their detention.  The airline in question hired private guards to detain the group in a Queens motel.As time passed, the airline calculated that it would be cheaper to let those in their charge escape and pay the fine than to bear the ongoing detention costs.  The airline therefore opened the doors and had the guards leave, only to find the asylum seekers waiting in the motel when they returned hours later.None were seeking to abscond; all sought only their day in court.And that was the determinative factor in their rejecting the invitation to flee; none had employment records, community ties, or most of the other factors held out as more important by the BIA in R-A-V-P-.  They chose to remain in detention rather than jeopardize their ability to pursue their asylum claims.

My clients in the above example had a good likelihood of being granted asylum.  But volunteering in an immigration law clinic three decades later, I see on a weekly basis individuals with much less hope of success nevertheless show up for all of their hearings, because, even in these dark times, they maintain faith that in America, an impartial judge will listen to their claim and provide them with a fair result.  In one case, an unrepresented asylum applicant recently released from detention flew across the country for a preliminary master calendar hearing because the immigration judge had not yet ruled on his motion for a change of venue.

So for what reason did the BIA determine that the respondent in R-A-V-P- would behave to the contrary?  The Board made much of the fact that an individual who promised to pay for the respondent’s bus ticket and provide him with a place to live (an offer which the Board referred to as “laudable”) was a friend and not a family member of the respondent.  But on what basis can it be concluded that living with a cousin rather than a friend increases the chances of his future appearance in court? In the absence of statistics or reports that support such determination, is this fact deserving of such discretionary weight?  The Board felt it could rely on this factor simply because it was mentioned in Matter of Guerra.  But while that decision requires a finding that the IJ’s conclusion was reasonable, the decision in R-A-V-P- appears to be based more on a hunch than a reasoned conclusion, with the Board referencing seemingly random factors in support of its conclusion without explaining why such factors deserve the weight they were afforded, while ignoring other more relevant factors that would weigh in favor of release.

The respondent has now been detained for well over a year, including the seven months his bond appeal lingered before the Board, a very significant deprivation of liberty.  The respondent’s asylum appeal remains to be decided, likely by a different Board Member or panel than that which decided his bond appeal.But now that the majority of the Board has voted to publish the bond denial as a precedent decision, what is the likelihood that any Board member will review that appeal with an unbiased eye?

As a final point, although the drafting of the decision likely began months earlier, the Board nevertheless chose to allow the decision to be published as precedent in the midst of an unprecedented health pandemic that poses a particular threat to those detained in immigration jails.  So at a time when health professionals and numerous other groups are pleading for the government to release as many as possible from immigration detention centers, the BIA chose to instead issue a decision that will likely lead to an opposite result.

Jeffrey and I both get to pretty much the same “bottom line” here. But, as usual, he is more “nuanced” in his approach.

Certainly, the DOJ’s two-decade program, under Bush, Obama, and now Trump, of systematically excluding from the BIA (and also largely from the Immigration Judiciary, with a more than 9-1 government/private sector hiring ratio) any acknowledged immigration and human rights expertise from those who actually represent and work with asylum applicants is paying huge dividends for Trump’s nativist immigration agenda.

A “captive BIA” well-attuned to “not rocking the boat” and “implementing the Attorney General’s priorities” abandons due process and fundamental fairness for individuals. Instead, they crank out an endless stream of one-sided pro-DHS-enforcement “precedents.” 

Led by the Supremes’ “supreme abdication of judicial duties” in Chevron and Brand X, the Courts of Appeals and sometimes the Supremes themselves “defer” to “any old interpretation” by the BIA rather than undertaking the more challenging search for the “best interpretation.” In immigration law, “deference” to the BIA “tilts the playing field” overwhelming in favor of DHS and against individuals and due process. 

And, if the BIA occasionally lets the immigrant “win” or at least not outright “lose,” one or two precedents, Sessions, Whitaker, and Barr have shown a frequent willingness to merely step in and change the results. Sometimes, they do this on cases decided years ago, even when DHS doesn’t ask them to. They openly and aggressively are carrying out a predetermined White Nationalist, nativist agenda. Because, they can!

If this sounds like a parody of due process, that’s because it is! But, the Supremes and the rest of the Article IIIs have been studiously looking away while due process, fundamental fairness, and equal protection are trampled in Immigration Court for more than a half-century. Why step up to the plate now?

Although it’s hard to do under Chevron, the BIA does sometimes so clearly ignore the statute or come up with such “off the wall” interpretations that the Article IIIs occasionally have to distinguish Chevron and intervene. In other words, generally screwing immigrants is OK by the Article IIIs; but, at some point looking totally feckless or downright idiotic by rubber stamping the BIA’s most outlandish anti-immigrant rulings is a “no no.” Bad for their reputations, law school speaking tours, and recruitment of the “best and brightest” clerks that the “Supremos” and other Article IIIs enjoy so much. 

Another “big advantage” of a captive and fundamentally unfair BIA is that its “perversions of justice” become a “self-fulfilling prophecy.” The respondent in R-A-V-P- should not only have been released on bond, but his asylum case could easily have been granted in a “short hearing” in a system committed to a fair interpretation and application of asylum law. That might have led to the release of others and the more efficient granting of other similar cases. That actually would be an huge step forward in a dysfunctional system running a largely self-inflicted backlog of approximately 1.4 million cases.

Instead, denying meritorious cases creates hugely inflated denial rates. This supports the Trump Administration’s intentionally false narrative that all asylum claims are frivolous or fraudulent. 

And, naturally, if the claims are overwhelmingly non-meritorious, who cares if we give asylum applicants any due process or not. Just summarily deny them all and you’ll be right 90% of the time. 

That’s probably why Trump has gotten away with his biggest outrage: Simply eliminating the statutory right to apply for asylum at the border by Executive fiat, confident that the Supremes and the Article IIIs will never have the guts to effectively intervene and hold him accountable merely for arbitrarily inflicting potential death sentences on asylum seekers. After all, they are just “aliens,” not really “humans” or “persons” under the warped views of the Roberts’ Court majority! “Dred Scottification in action.”

Also, by denying meritorious claims for asylum seekers already in the U.S., the BIA  “sends a message” that asylum seekers shouldn’t bother applying — they can’t and won’t win no matter how meritorious their cases. And, what’s more, the BIA will use the manipulated, improperly inflated “denial rates” to show that there is “little likelihood of success” on the merits of any asylum claim. 

Under R-A-V-P, this virtually guarantees punitive DHS detention, serving as both a punishment for asserting rights and a further deterrent to asserting claims in Immigration Court. Heck, in a “best case scenario” for TrumpCOVID-19 will wipe out all detained asylum seekers, thereby eliminating that “problem.”

The system is a farce. But, it is a farce that both Congress and the Article IIIs have enabled. 

Asylum seekers and other migrants deserve justice from America. When they will finally get it from a system intentionally rigged against them, and judges and legislators all too often unwilling to acknowledge or recognize their humanity, remains to be seen.

On behalf of Alliance for Justice (AFJ), a national association representing 120 groups committed to equal justice and civil rights, I write to add our voice to the organizations that have written or testified at the hearing held on January 29, 2020, before the House Committee on the Judiciary, Subcommittee on Immigration and Citizenship, on “The Courts in Crisis: The State of Judicial Independence and Due Process in U.S. Immigration Courts.”
For more than a generation, AFJ has worked to promote equal justice under law. We have fought to ensure a justice system that upholds the rights of all people. That is why we are so deeply troubled by the Department of Justice’s (the “Department”) exploitation of its position as the superintendent of our nation’s immigration courts to advance its anti-immigrant agenda. The Department’s actions have turned should be a fair adjudicatory system into one designed to dictate outcomes favorable to the anti- immigrant zealots in the Administration. The Department has engaged in a range of efforts designed to deprive individuals who have valid claims of asylum of the opportunity to present those claims. It has sought to influence immigration judges by incentivizing them to summarily deny claims. It has urged judges to adopt its conspiratorial views about the immigration lawyers who appear before the courts. Its pursuit of short-term political objectives has increased backlogs, produced vacancies, contributed to the demoralization of the court system, and resulted in widespread and unnecessary suffering.
AFJ writes this letter, moreover, at a time when the nation, and the world, is facing a pandemic and the Administration has indefinitely closed the southern border to asylum-seekers. Attorney General regarding policies and practices that “during these unprecedented times” will cause immigrants and the providers and advocates who help them to “suffer serious hardships that raise due process concerns.” The concerns raised in the letter, and those mentioned below, only reinforce the need for an independent immigration court system.
The current administration has launched a series of efforts to weaponize the immigration courts. The efforts to control immigration judges include:
• The adoption of enforcement-oriented performance metrics, which require judges to complete 700 cases per year, equivalent to approximately three complete cases each business day. These metrics, which immigration judges must see on their computer screens, require judges to adjudicate claims irrespective of the complexity or merit of the cases and impose categorical restrictions on bond cases;
• The creation of a specialized fast docket, built almost exclusively for Central American families applying for asylum, which includes restrictions on the rights of judges to grant continuances;
• Limitations on judges’ authority to administratively close or terminate cases;
• Training sessions that immigration judges have described as indoctrination. As a former Immigration Judge explained: “There isn’t even any attempt at proper training. The whole indoctrination is you’re not judges, you’re really enforcement”1;
• Abusing the Attorney General’s power to act as a final arbiter of contested cases, by taking cases not then pending before the Board of Immigration Appeals to issue sweeping rulings limiting asylum protection for individuals victimized by domestic violence or harm as a result of retaliation based upon their family relationships. In the latter of the two cases, Attorney General William Barr attempted to sweep aside decades of precedent, much of it from federal appellate courts whose decisions are binding on the immigration courts;
• Issuing a final interim rule that would allow the Director of the Executive Office of Immigration Review to issue opinions on his own, on any appeal pending for more than 180 days;
• Seeking to decertify the National Association of Immigration Judges (NAIJ), the union that has represented immigration judges since 1979. NAIJ serves as one of the last bulwarks against a complete and total takeover of the Immigration Court system by our Executive Branch. Without union representation, immigration judges will lose their collective voice and be unable to push back against policies that undermine the fairness and transparency of the system.

In addition to its efforts to turn immigration judges into partisan actors, the Administration’s unceasing efforts to be and appear to be tough on asylum seekers have created disorder, even for those individuals far from the Southern Border. The Administration has repeatedly shuffled Immigration
Judges from jurisdiction to jurisdiction, for example, in a 2017 “surge” of judges to the border, which required the postponement of 23,000 cases. The Attorney General’s decision prohibiting administrative closure will eventually add more than 300,000 cases to its docket. The overall backlog of cases has now doubled, to over one million pending cases. In a number of courts, litigants may wait more than four years before their cases are heard. The disparities in outcomes from jurisdiction to jurisdiction are now worse than ever.
There is also disturbing evidence that the Administration’s attacks on the system may be enabling a culture of impunity. On January 23 of this year, in an unprecedented opinion, the Court of Appeals for the Seventh Circuit chastised the Board of Immigration Appeals for defying the Circuit’s remand order. Relying on what it said was advice from the Attorney General, the Board of Immigration Appeals declared the Seventh Circuit’s decision to be incorrect and declined to obey it. The Circuit stated that it had “never before encountered defiance of a remand order,” adding that members of the Board of Immigration Appeals should count themselves lucky that the immigrant had not asked the

Many of the most respected participants and observers of the immigration court system have called for reform of the current system. Groups as diverse as the American Bar Association, the Federal Bar Association, the National Association of Immigration Judges and the CATO Foundation have long urged the transfer of the immigration courts to a separate Article I CourtThese groups have pointed to the need to professionalize the corps of immigration judges and outlined the threat to judicial independence caused by the placement of the immigration court system under the control of the Department of Justice.
What was previously a threat of political interference is now a reality, and AFJ believes that there can be no lasting solution to this problem without removing the immigration court system from DOJ.

court to hold the Board in contempt.
of deportation to an Iranian student who possessed a valid student visa, was ignored by officials of the Customs and Border Patrol, who deported the student from Logan Airport back to Iran. The federal judge then stated that he believed the case to be moot, saying of the government officials, “I don’t think they’re going to listen to me.” The student’s attorney noted, “I wish I could say we were surprised, but we’ve seen this kind of flagrant defiance of the law from immigration officials before.”3

Our current system of adjudication is utterly broken. The most effective solution to protecting the neutrality of our Immigration Courts is to create an Article I Immigration Court system that is independent of DOJ. Article I of the U.S. Constitution expressly grants Congress the power to establish “tribunals” in addition to those created by Article III, and Congress has done so on many occasions. The establishment of an Article I Immigration Court would create greater transparency in the system. It would also restore the Due Process rights of those who come before the Court.
While moving the immigration court system from the Department of Justice will not solve the ills of the current system, it is desperately needed as a part of the solution. We therefore urge Congress to support to recommendation of the ABA, immigration judges, and immigration lawyers, among others, to establish an Article I Immigration Court system that is independent of Department of Justice.

Establishing an independent U.S. Immigration Court that will finally fulfill the Fifth Amendment requirement of providing “neutral and impartial adjudication” of life or death claims, without the opportunity for political interference or meddling in the individual case process, is an essential part of AFJ’s vision for a better and fairer America. Indeed, an independent Immigration Court that models due process and best practices for the most vulnerable and defenseless among us is the “essential foundation” for our entire justice system all the way up to the Supreme Court.

Also, as Nan and her team recently discussed with our group from the “New Due Process Army” and the “Round Table,” many of the best and most qualified potential candidates for the Federal Judiciary might be talented lawyers who never thought of themselves as “potential Federal Judges” and competing for these critical jobs that shape our justice, system, our nation, and indeed our world. From my extensive observations, in and out of court, in teaching, practice, and community service, folks like clinical professors, NGO advocates, bar association leaders, leaders of charitable and religious organizations, and those who have dedicated large portions of their career to litigating and advising pro bono or “low bono” individuals struggling to find equal justice and be heard in a system that too often wants to shunt them and their rights aside, could all have strong judicial skills. Legal journalists are another group that I have found often possesses stunningly accurate understanding and incisive knowledge of how our justice system works (or doesn’t, in some cases) at every level.

In my view, one of the best potential “entries into judging” is the U.S. Magistrate Judge selection program which generally has been praised as a “merit-based,” apolitical, scholarship-rewarding, and competency focused system administered by the U.S. District Judges, usually in conjunction with the private bar (our son Wick, a private practitioner in Green Bay, WI, served on the Magistrate Selection Committee for the Eastern District of Wisconsin). I would love to see the U.S. Immigration Court become this same type of “merit & scholarship based” depoliticized “hotbed of judicial excellence” and potential “stepping stone” to the higher levels of the Article III Judiciary.

So, to the many members of our “New Due Process Army” who have devoted their careers to fairness, scholarship, timeliness, respect, and teamwork, think about taking on a different role as a Federal Judge in the future. Don’t be surprised if you get a call from one of us at the AFJ or the “New Due Process Army.” Or, better yet, get in touch with us at the AFJ and the NDPA.

Who are these immigration judges? What exactly is detained court? And how is it able to get away with operating outside of what we might call normal law?

Get ready because you’re about to go there, to see the injustice that isn’t being shut down.

Disturbing and infuriating as Sam’s podcast is, I urge everyone to listen, even if you think you know what “really happens” in this godforsaken and deadly “darkest corner of the American ‘justice’ system.” Is this really the way we want to be remembered by generations that follow? As a country with so little collective courage and integrity that we allowed our fellow human beings to be treated this way? Think about it!

Even in this grimmest of worlds, their are true heroes. First and foremost, of course, are  the dedicated attorneys of the New Due Process Army (“NDPA”), many working pro bono or “low bono” to vindicate essential legal, constitutional, and human rights in a system designed to grind them into dust and “dehumanize and demonize the other.” 

Sound familiar? It should to anyone who studied Hitler’s rise to power in Germany. By and large, it wasn’t the “Brown Shirts” and the party faithful who enabled his rule. It was judges, lawyers, ministers, priests, businessmen, doctors, corporate moguls, and the average German who “facilitated” his annihilation of millions. 

And, it started gradually, with laws stripping Jews of citizenship, property, and all legal rights and judges who enthusiastically enforced them, even against their own former judicial colleagues. Once people aren’t “humans” any more (Hitler liked the term “subhumans”) or “persons” before the law, there is no limit to what can be done, particularly when complicit judges join in the “fun and games.”

At a time when too many with knowledge of the travesty of what’s going on in our “Star Chambers” have chosen to look the other way or “go along to get along,” Ilyce and Ashley have consistently “spoken truth to power” in the face of a regime that often abuses its authority by punishing truth, honesty, and decency. Indeed, Billy Barr’s highly unethical move to “decertify” the NAIJ is a blatant attempt to punish and silence Ashley for revealing the truth.

One minor correction. Sam says that the Immigration Judges and the prosecutors both work for the DOJ. Actually, the prosecutors work for DHS. But, it’s largely a “distinction without difference” because the agenda at both DOJ and DHS is set by Trump, Miller, and the rest of the White Nationalist nativist cabal.

Indeed, former AG Sessions told Immigration Judges they were “partners” with the DHS prosecutors in enforcing immigration laws. So, the observation that in many Immigration Courtrooms migrants, including the unrepresented and children, face “two prosecutors” — the “judge” and the DHS Assistant Chief Counsel is accurate. The podcast relates how in some courts the “judge speaks for the prosecution,” the Assistant Chief Counsel is a “potted plant,” and nobody speaks for justice or the rights of the migrants. What’s missing: The impartial “neutral decisionmaker” required by the Due Process Clause of the Fifth Amendment to the Constitution.

Affirming in part, and vacating and remanding in part, the district court’s preliminary injunction ordering the United States to provide bond hearings to a class of noncitizens who were detained and found to have a credible fear of persecution, the panel affirmed the injunction insofar as it concluded that plaintiffs have a due process right to bond hearings, but remanded for further findings and reconsideration with respect to the particular process due to plaintiffs.

The district court certified a nationwide class of all detained asylum seekers who were subject to expedited removal proceedings, were found to have a credible fear of persecution, but were not provided a bond hearing with a record of hearing within seven days of requesting a hearing. Part A of the district court’s modified preliminary injunction provided: 1) bond hearings must take place within seven days of a class member’s request, or the member must be released; 2) the burden of proof is on the government to show why the

member should not be released; and 3) the government must produce recordings or verbatim transcripts of the hearings, as well as written decisions. Part B concluded that the class is constitutionally entitled to bond hearings. A motions panel of this court previously denied the government’s request to stay Part B, but granted the stay as to Part A.

The panel concluded that the district court did not abuse its discretion in concluding that plaintiffs were likely to prevail on their due process claim, explaining that immigration detention violates the Due Process Clause unless a special justification outweighs the constitutionally protected interest in avoiding physical restraint. The panel also concluded that the district court did not abuse its discretion in finding that other processes—seeking parole from detention or filing habeas petitions—were insufficient to satisfy due process. The panel further rejected the government’s suggestion that noncitizens lack any rights under the Due Process Clause, observing the general rule that once a person is standing on U.S. soil—regardless of the legality of entry—he or she is entitled to due process.

The panel next concluded that the district court did not abuse its discretion in its irreparable harm analysis, noting substandard physical conditions and medical care in detention, lack of access to attorneys and evidence, separation from family, and re-traumatization. The panel also concluded that the district court did not abuse its discretion in finding that the balance of the equities and public interest favors plaintiffs, explaining that the district court weighed: 1) plaintiffs’ deprivation of a fundamental constitutional right and its attendant harms; 2) the fact that it is always in the public interest to prevent constitutional violations; and 3) the

government’s interest in the efficient administration of immigration law.

As to Part A of the injunction, the panel concluded that the record was insufficient to support the requirement of hearings within seven days, and that the district court made insufficient findings as to the burdens that Part A may impose on immigration courts. The panel also noted that the number of individuals in expedited removal proceedings may have dramatically increased since the entry of the injunction. Thus, the panel remanded to the district court for further factual development of the preliminary injunction factors as to Part A.

The panel also rejected the government’s argument that the district court lacked authority to grant injunction relief under 8 U.S.C. § 1252(f)(1), which provides: “no court (other than the Supreme Court) shall have jurisdiction or authority to enjoin or restrain the operation of the provisions of [8 U.S.C. §§ 1221–1232], other than with respect to the application of such provisions to an individual alien against whom proceedings under such part have been initiated.” Examining the relevant precedent, statutory scheme, and legislative history, the panel concluded that here, where the class is composed of individual noncitizens, each of whom is in removal proceedings and facing an immediate violation of their rights, and where the district court has jurisdiction over each individual member of that class, classwide injunctive relief is consistent with congressional intent.

Finally, the panel concluded that the district court did not abuse its discretion in granting the injunction as to the nationwide class. However, the panel directed that, on

remand, the district court must also revisit the nationwide scope.

Dissenting, Judge Bade wrote that 8 U.S.C. § 1252(f)(1) barred injunctive relief in this case, concluding that the majority’s opinion does not square with the plain text of § 1252(f)(1), is inconsistent with multiple Supreme Court cases, and needlessly creates a circuit split with the Sixth Circuit. Judge Bade further wrote that, even if the district court had jurisdiction to issue injunctive relief, the preliminary injunction is overbroad and exceeds what the constitution demands. Judge Bade would vacate the preliminary injunction and remand for further proceedings with instructions to dismiss the claims for classwide injunctive relief.

The government also suggests that non-citizens lack any rights under the Due Process Clause. As we have discussed, this position is precluded by Zadvydas and its progeny. The government relies on inapposite cases that address the peculiar constitutional status of noncitizens apprehended at a port-of-entry, but permitted to temporarily enter the United States under specific conditions. See, e.g., Shaughnessy v. United States ex rel. Mezei (“Mezei”), 345 U.S. 206, 208–09, 213–15 (1953) (noncitizen excluded while still aboard his ship, but then detained at Ellis Island pending final exclusion proceedings gained no additional procedural rights with respect to removal by virtue of his “temporary transfer from ship to shore” pursuant to a statute that “meticulously specified that such shelter ashore ‘shall not be considered a landing’”); Leng May Ma v. Barber, 357 U.S. 185 (1958) (noncitizen paroled into the United States while waiting for a determination of her admissibility was not “within the United States” “by virtue of her physical presence as a parolee”); Kaplan v. Indeed, these cases, by carving out exceptions not applicable here, confirm the general rule that once a person is standing on U.S. soil—regardless of the legality of his or her entry—he or she is entitled to due process. See, e.g., Mezei, 345 U.S. at 212 (“[A]liens who have once passed

through our gates, even illegally, may be expelled only after proceedings conforming to traditional standards of fairness encompassed in due process of law.”); Leng May Ma, 357 U.S. at 187 (explaining that “immigration laws have long made a distinction between those aliens who have come to our shores seeking admission . . . and those who are within the United States after an entry, irrespective of its legality,” and recognizing, “[i]n the latter instance . . . additional rights and privileges not extended to those in the former category who are merely ‘on the threshold of initial entry’” (quoting Mezei, 345 U.S. at 212)); Kwai Fun Wong v. United States, 373 F.3d 952, 973 (9th Cir. 2004) (explaining that “the entry fiction is best seen . . .as a fairly narrow doctrine that primarily determines the procedures that the executive branch must follow before turning an immigrant away” because “[o]therwise, the doctrine would allow any number of abuses to be deemed constitutionally permissible merely by labelling certain ‘persons’ as non-persons”). We thus conclude that the district court did not err in holding that plaintiffs are “persons” protected by the Due Process Clause.

This team is it’s own “Special Forces Brigade” of the New Due Process Army (“NDPA”)!

WOW! Persons are “persons” under the Constitution even when they have brown skins and are asylum seekers! How “rad” can you get! What a blow to “business as usual” for the regime and their “Dred Scottification” program of dehumanizing and making non-persons out of migrants and other vulnerable minorities!

Too bad that the Supremes and other Circuit Courts have too often advanced “Dred Scottification,” hiding behind transparently bogus and contrived “national emergencies” and the doctrine of judicial dereliction of duty otherwise known as “Chevron deference.” I guess that’s why the regime has the contempt for both the law and the Article III Courts to press such legally, morally, and Constitutionally “bankrupt” arguments as they did in this case. Never know when you’ll get a “thumbs up” from those who sometimes don’t view oaths of office and their obligations to their fellow humans with enough seriousness!

Significantly, the panel found that “plaintiffs were likely to succeed on their claim that they are constitutionally entitled to individualized bond hearings before a “neutral decisionmaker.” However, in doing so they “papered over” the obvious fact that the constitutional requirement of a “neutral decisionmaker” cannot be fulfilled as long as Billy Barr or other politicos control the Immigration Courts! 

Indeed, the panel decision was a strong rebuke of Barr’s atrocious, unethical, scofflaw decision in Matter of M-S-, 27 I&N Dec. 509 (A.G. 2019) purporting to unilaterally change the rules to eliminate bond for those who had passed “credible fear.” Fact is that no individual appearing in today’s Immigration Courts has access to the constitutionally-required “neutral decisionmaker” because Barr retains the ability to simply unilaterally change any result that doesn’t match his White Nationalist nativist agenda and can hire and fire the so-called “judges” at will.

Indeed, under Barr’s totally illegal and professionally insulting “production quotas,” I’m not sure that the “judges” on the “deportation assembly line” even get “production credit” for bond decisions because they aren’t “final orders of removal.” However, denial of bond is actually an important “whistle stop” on the “deportation express.” Those kept in the “New American Gulag” have difficulty finding attorneys and the systematic mistreatment they receive in detention helps to demoralize them and coerce them into giving up claims or waiving appeals.

When are the Article IIIs finally going to stop “beating around the bush” and hold this whole mess to be unconstitutional, as it most clearly is? 

In some ways, the panel’s decision reminds me of one of my own long-ago concurring/dissenting opinion in Matter of Joseph, 22 I&N Dec. 799, 810 (BIA 1999) (en banc) (“Joseph II”):

However, I do not share the majority’s view that the proper standard in a mandatory detention case involving a lawful permanent resident alien is that the Service is “substantially unlikely to prevail” on its charge. Matter of Joseph, 22 I&N Dec. 3398, at 10 (BIA 1999). Rather, the standard in a case such as the one before us should be whether the Service has demonstrated a likelihood of success on the merits of its charge that the respondent is removable because of an aggravated felony.

Mandatory detention of a lawful permanent resident alien is a drastic step that implicates constitutionally-protected liberty interests. Where the lawful permanent resident respondent has made a colorable showing in custody proceedings that he or she is not subject to mandatory detention, the Service should be required to show a likelihood of success on the merits of its charge to continue mandatory detention. To enable the Immigration Judge to make the necessary independent determination in such a case, the Service should provide evidence of the applicable state or federal law under which the respondent was convicted and whatever proof of conviction that is available at the time of the Immigration Judge’s inquiry.

The majority’s enunciated standard of “substantially unlikely to pre-vail” is inappropriately deferential to the Service, the prosecutor in this matter. Requiring the Service to demonstrate a likelihood of success on the merits of its charge would not unduly burden the Service and would give more appropriate weight to the liberty interests of the lawful permanent res- ident alien. Such a standard also would provide more “genuine life to the regulation that allows for an Immigration Judge’s reexamination of this issue,” as referenced by the majority. Matter of Joseph, supra, at 10.

The Service’s failure to establish a likelihood of success on the merits would not result in the release of a lawful permanent resident who poses a threat to society. Continued custody of such an alien would still be war- ranted under the discretionary criteria for detention.

In conclusion, mandatory detention should not be authorized where the Service has failed to demonstrate a likelihood of success on the merits of its charge. Consequently, while I am in complete agreement with the decision to release this lawful permanent resident alien, and I agree fully that the Service is substantially unlikely to prevail on the merits of this aggravated felony charge, I respectfully dissent from the majority’s enunciation of “substantially unlikely to prevail” as the standard to be applied in all future cases involving mandatory detention of lawful permanent resident aliens.

Concern for Due Process and fundamental fairness have intentionally been eradicated in the Immigration “Courts” by Sessions, Whitaker, and Barr. It’s past time for this constitutional mockery to be put out of its misery (and the unending misery it causes for the humans coming before it) once and for all!

As my late BIA colleague Judge Fred W. Vacca once said, albeit in a different context, “It’s time to put an end to this pathetic imitation of an adjudication.” Fred and I didn’t always agree. In fact, we disagreed much of the time. But, he did know when it was finally time to “stop the nonsense,” even when some of our colleagues just kept the system churning long past the point of reason and sanity.

And, folks, that was back in the days when the BIA actually functioned more or less like an “independent appellate court” until the Ashcroft purge of ’03 forever ended that noble vision. Like the rest of the system and those who enable it to keep churning lives as if they were mere water under the bridge, the BIA and the rest of the Immigration “Courts” have now become a national disgrace — a blot on our national conscience. Human beings seeking justice are neither “numbers” to be achieved for “satisfactory ratings,” nor “enforcement problems” to be exterminated without Due Process.

Dehumanization of the “other”and stripping them of legal and human rights is a key part of fascism. It’s what allowed German judges and most of German society to “look the other way” or actively aid in the holocaust. It has no place in our justice system — now or ever!

WASHINGTON, DC — The American Immigration Council (Council) and the American Immigration Lawyers Association (AILA) filed a lawsuit Tuesday in federal court to compel the Department of Justice’s (DOJ) Office of Information Policy (OIP) to release records about the Executive Office for Immigration Review’s (EOIR) hiring procedures for appellate immigration judges and Board of Immigration Appeals (BIA) Members. The lawsuit seeks to understand current hiring procedures for the BIA—the highest administrative body for interpreting and applying immigration laws—after reports came to light of anti-immigrant bias in the hiring process.

The DOJ—which oversees immigration courts, houses the BIA, and employs immigration judges—has failed to disclose critical information about the hiring policy of appellate immigration judges and BIA Members, who make precedential decisions in the immigration adjudicatory system.

Advocates and policymakers have become concerned that DOJ’s hiring practices for appellate immigration judges and Board Members are improperly influenced by the Trump administration’s anti-immigrant policies. Biased hiring practices for these judges are a concern for the public because these judges can set legal precedent that has the potential to negatively impact thousands of immigrants seeking protection and/or a path to lawful status in the United States.

The lawsuit, filed in the U.S. District Court for the District of Columbia, challenges DOJ’s failure to disclose information in response to a Freedom of Information Act request submitted in October 2019.

“The fairness of the immigration court system depends on the impartiality of judges who are responsible for deciding thousands of cases each year. If appellate judges are not neutral decision-makers, the integrity of our immigration system is compromised,” said Claudia Valenzuela, FOIA senior attorney at the American Immigration Council. “The lack of transparency in this hiring process only serves to undermine public confidence in this system.”

“It’s imperative that the public, policymakers, and stakeholders be provided with the opportunity to review the thus far opaque hiring process at the BIA. Allegations of politicized hiring give rise to the notion that BIA decisions serve the political purposes of the attorney general, rather than adhere to prior case law,” said Laura Lynch, senior policy counsel at the American Immigration Lawyers Association.

The whole idea that a White Nationalist prosecutor and political toady like Billy Barr gets to hire the “judges” for a so-called “appellate tribunal” is as absurd and illogical as it is clearly unconstitutional. The perversion of our humanity and our legal institutions that has allowed this to operate in plain view as if it were “normal” should be a subject for reflection and study. That the Supremes and Congress both took a “dive” on this is beyond question. How they got away with it and continue to do so without any accountability is another story. Hopefully, at some point it will be told in full.

In particular, the anti-asylum bias of the regime has been aggravated by a large dose of anti-Latino racism and misogyny that both Congress and the Article III Courts have enabled and, in the case of the Supremes actively encouraged by rewarding the clearly disingenuous and misleading arguments of Solicitor General Noel Francisco on fabricated “emergencies” and bogus rationales for transparently invidious and irrational actions.

Kevin Euceda, a 17-year-old Honduran boy, arrived at the U.S.-Mexico border three years ago and was turned over to the custody of the Department of Health and Human Services until his request for asylum could be decided by immigration courts. During that period, he was required, as are all unaccompanied minors in custody, to meet with therapists to help him process what he had gone through.

In those sessions, Kevin was encouraged to speak freely and openly and was told that what he said would be kept confidential. So he poured out his story of a brutalized childhood, of how MS-13 gang members moved into the family shack after his grandmother died when he was 12, of how he was forced to run errands, sell drugs and, as he got older, take part in beating people up. When he was ordered to kill a stranger to cement his position in the gang, Kevin decided to run.

His therapists submitted pages of notes over several sessions to the file on him, as they were expected to do. But then, HHS officials — without the knowledge of the teen or the therapists — shared the notes with lawyers for Immigration and Customs Enforcement, who used them in immigration court to paint the young migrant as a dangerous gang member who should be denied asylum and sent back to Honduras. In sharing those therapy notes, the government did not break any laws. But it most assuredly broke its promise of confidentiality to Kevin, violated standard professional practices — the first therapist involved quit once she learned her notes had been shared — and offended a fundamental expectation that people cannot be compelled to testify against themselves in this country.

Kevin, whose story was detailed by the Washington Post, wasn’t the only unaccompanied minor to fall victim to such atrocious behavior, though how many have been affected is unknown. The government says it has changed that policy and no longer shares confidential therapy notes, but that’s not particularly reassuring coming from this administration. It adopted the policy once; it could easily do so again.

Last week, Rep. Grace F. Napolitano (D-Norwalk) and Sen. Jeff Merkley (D-Ore.) introduced the Immigrants’ Mental Health Act of 2020 to ban the practice, which is a necessary preventive measure. The bill would also create a new training regimen to help border agents address mental health issues among migrants and require at least one mental health expert at each Customs and Border Patrol facility. Both of those steps are worth considering too.

That the government would so callously use statements elicited from unaccompanied minors in therapy sessions to undercut their asylum applications is part of the Trump administration’s broad and inhumane efforts to effectively shut off the U.S. as a destination for people seeking to exercise their right to ask for sanctuary. Jeff Sessions and his successor as attorney general, William Barr, have injected themselves into cases at an unprecedented rate to unilaterally change long-established practices and immigration court precedent.

They have been able to do so because immigration courts are administrative and part of the Justice Department, not the federal court system, and as a result they have politicized what should be independent judicial evaluations of asylum applications and other immigration cases. Advocates argue persuasively that the efforts have undermined due process rights and made the immigration courts more a tool of President Trump’s anti-immigration policies than a system for measuring migrant’s claims against the standards Congress wrote into federal law.

Of course, trampling legal rights and concepts of basic human decency have been a hallmark of the administration’s approach to immigration enforcement — witness, for example, its separation of more than 2,500 migrant children from their parents. Beyond the heartlessness of the separations, the Health and Human Services’ inspector general last week blasted the department for botching the process. Meanwhile, the administration has expanded detention — about 50,000 migrants are in federal custody on any given day, up from about 30,000 a decade ago — and forced about 60,000 asylum seekers to await processing in dangerous squalor on Mexico’s side of the border.

There are legitimate policy discussions to be had over how this government should handle immigration, asylum requests and broad comprehensive immigration reform. In the meantime, no government has the right to treat people with such abject inhumanity. History will remember Trump for this, but it will also remember the people who enable such atrocious acts.

The Real Message of Matter of R-A-F-

On February 26, the Attorney General (or more likely, someone authorized to speak on his behalf) issued a precedent decision in Matter of R-A-F-.  My take on the import of this decision seems to be different than most.  Let me first provide some background.

Most people seeking asylum in this country also apply for a lesser form of protection called withholding of removal under Article III of the U.N. Convention Against Torture (“CAT” for short).  Whereas asylum provides a path to U.S. permanent residence, CAT only prevents someone with a deportation order from being sent to a country in which they are likely to suffer torture.  CAT generally only comes into play where the applicant isn’t found eligible for asylum, something which is happening more frequently as the present administration churns out new bars and obstacles to eligibility.

To provide an example, someone who establishes they will likely be murdered or raped if returned to their country may be barred from even applying for asylum if they didn’t file their application within one year of their arrival in this country, or if they did not apply for asylum in a third country they passed through en route to the southern border.  Even if allowed to apply, they may still be denied asylum if the immigration judge does not determine that their persecution would be for the proper motive.  But while our asylum laws as written allow some leeway as to whom the government will afford permanent status in the U.S., the same government is bound by international treaty not to send an individual to a place where they would suffer persecution.  It is often CAT that fills the gap between those who are not permitted to remain permanently but should nevertheless not be repatriated.

The U.S. was one of 154 countries to sign the U.N. Convention Against Torture.  However, it was the only country to add a “specific intent” requirement to its internal regulations implementing the convention, requiring a finding that the torture “be specifically intended to inflict severe…pain and suffering,” and specifically excluding acts that result “in unanticipated or unintended severity of pain or suffering.”1  The specific intent requirement seriously undermines the purpose of the law, as many are forced to rely on CAT specifically because they couldn’t prove the proper intent of their persecutor that is required for asylum.  It is thus necessary for the specific intent provision to be interpreted in the least restrictive manner for CAT to function in its intended way.

In 2002, the BIA had its first chance to interpret how the specific intent requirement should be applied in a case called Matter of J-E-.  At the time, the BIA was comprised of judges holding diverse views of the law.  As a result, the Board was sharply split on the issue.  The more restrictive reading won out, but 6 judges dissented.2  Five of them were no longer on the BIA a year later following then Attorney General John Ashcroft’s infamous purge of Board judges whom he viewed as too liberal.

An important point that was glossed over in the majority opinion in Matter of J-E- and its progeny is that where governments do intentionally maintain horrific conditions in its prisons or mental institutions that are intended to punish those institution’s populations, they tend to be smart enough not to admit to it.  To illustrate this point, I refer to a November 12, 2019 report of the Washington Post finding that although the Trump Administration characterized its outrageous treatment of unaccompanied immigrant children as an unintended consequence of the volume of immigrants seeking asylum at the border, such outcome “also was a result of policy decisions that officials knew would ensnare unaccompanied minors in bureaucratic tangles and leave them in squalid conditions.”

Cognisant of this fact, in his dissenting opinion in Matter of J-E-, Hon. Paul W. Schmidt found the specific intent requirement to be satisfied by a “clearly documented acceptance of extreme mistreatment amounting to torture as a routine aspect of detention in Haiti.”  Concluding that the Haitian government “cannot claim it does not know what happens to detainees in its prisons,” Judge Schmidt found the specific intent requirement to have been met.  Hon. Lory D. Rosenberg began her companion dissenting opinion in the case by quoting from the Second Circuit that “Among the rights universally proclaimed by all nations . . . is the right to be free of physical torture.”3

In late 2018, the BIA again rejected such arguments and reiterated the majority view of J-E- in another precedent decision, Matter of J-G-R-P-.  This time, the BIA did so in a three-judge panel decision in which there were no dissents.  As this decision was published less than 16 months prior to the A.G.’s decision in R-A-F-, there was really no need at the time the A.G. issued R-A-F- for another decision on the topic.

I thus believe the real motive behind issuing the decision was not to give guidance, but rather to serve warning.  While published precedential decisions have always received broad attention, individual BIA appellate judges have felt safe affording relief in sympathetic cases  in unpublished decisions where the outcome is generally known only to the parties involved.

A colleague recently made me aware of a job posting within EOIR for an attorney to work not for the Immigration Courts or the BIA, but rather within the office of EOIR’s director, James McHenry, who has imposed the administration’s political will on the agency’s judges with a heavy hand.  The job description included “review(ing) court cases including appeals cases for adherence to procedural requirements, proper interpretation and application of statutes, regulations and precedents,” and “recommend(ing) action on precedent-setting issues to senior officials.”  In other words, McHenry was looking to hire what is commonly referred to as a “snitch” to sort through decisions that might not pass muster with the likes of Stephen Miller, and flag them for corrective action.  One such shameless staffer apparently flagged R-A-F- in this manner, and through the resulting A.G. certification, the case will serve as a cautionary tale for a group of BIA judges that certainly hasn’t forgotten the fate of the Matter of J-E- dissenters.

The decision in question was issued in September by Appellate Immigration Judge Linda Wendtland, whose retirement party was held this past week.  Judge Wendtland is by no means a liberal, and worked the majority of her career for the Department of Justice; prior to her appointment to the BIA, she had been an assistant director with the DOJ’s Office of Immigration Litigation.  But Judge Wendtland is highly knowledgeable of the law, and is reasonable and fair (all endangered qualities on the present BIA).

Looking to Judge Wendtland’s decision below, it would be difficult to find a more sympathetic applicant than R-A-F-.  The respondent seeking CAT protection is in his 70s, and suffers from Parkinson’s disease, dementia, Major Depressive Disorder, traumatic brain injury, PTSD, and chronic kidney disease.  The evidence of record established that if returned to his native Mexico, R-A-F- faced a significant risk of being institutionalized in a facility in which he could be subject to physical and sexual abuse, physical and chemical restraints, and containment in cages and isolation rooms, all without access to justice.  Judge Wendtland agreed with the Immigration Judge that such treatment rose to the definition of torture.

Based on her reputation and body of work, Judge Wendtland is undoubtedly someone who had earned the right to have her decision in R-A-F- accorded deference.  However, these are different times.  And instead of deference, the A.G. (who, of course, knows next to nothing about immigration law or the specific matter in question) chose to unceremoniously refer to himself and then slam the BIA’s decision.  The legacy of such action will be fully felt the next time a single judge at the BIA has the opportunity to affirm a similarly sympathetic grant of relief, but will instead choose not to do so out of fear and self-preservation.  This is not how justice should be afforded to our country’s most vulnerable population.

I have said before that I always respected Judge Wendtland. She was a scholarly, industrious, fair-minded, “center right” jurist. While I had been exiled from the BIA before she was appointed, she seemed like a judge with whom I would have enjoyed having a continuing dialogue, much like my more conservative, yet thoughtful and scholarly, friend the late Judge Lauri Steven Filppu. And, we probably would have ended up on the same side of a number of issues coming before the BIA. 

It’s both disheartening and enraging to see that even “conscientious conservative” jurists like Judge Wendtland get no real respect and deference from the likes of Billy Barr and his toady colleagues. And, the function of having Director McHenry “ride heard” on the BIA is both unethical and stupid, since he is not an Immigraton Judge himself. Indeed, the gross incompetence with which todays’ EOIR is managed suggests that the Director’s sole role should be to attend to the failing administrative and support structure of the Immigration Courts in a nonpartisan, apolitical manner under the direction of, not overseeing, the BIA Chair and the Chief Immigration Judge. 

This system is broken! Every time an Article III Circuit Court signs off on an order of removal resulting from this unconstitutional, unethical, and grossly mismanaged morass, those Article III Judges enable the regime’s continuing fraud, waste, and abuse, and shirk their sworn constitutional duties.

Senate Democrats Accuse Justice Department Of Politicizing Immigration Courts

Top Senate Democrats warn that the Trump administration is deliberately undermining the independence of immigration courts.

In a bluntly-worded letter to the Justice Department, which oversees the immigration courts, the senators accuse the administration of waging an “ongoing campaign to erode the independence of immigration courts,” including changing court rules to allow more political influence over decisions, and promoting partisan judges to the Board of Immigration Appeals.

“The administration’s gross mismanagement of these courts,” they write, threatens to do “lasting damage to public confidence in the immigration court system.”

The letter was sent Thursday to Attorney General William Barr. It was signed by nine Democratic members of the Senate Judiciary Committee, including Sheldon Whitehouse of Rhode Island, Richard Durbin of Illinois, Mazie Hirono of Hawaii and Amy Klobuchar of Minnesota. They are requesting extensive information about the department’s hiring practices for trial-level and appellate judges, among other documents.

The Justice Department did not immediately respond to a request for comment on the letter.

The senators’ concerns echo those voiced by former and current immigration judges, including the head of the union representing those judges. Ashley Tabaddor, the president of the National Association of Immigration Judges, testified at a House Judiciary Committee hearing last month that immigration courts should no longer be overseen by the Justice Department.

“The only real and lasting solution is the establishment of an independent Immigration Court,” Tabaddor wrote in her testimony. “It must be free from the constantly changing (often diametrically opposed) politicized policy directives of the Department of Justice.”

The judge’s union has pushed back against productivity quotas for immigration judges, which were announced in 2018. The union also opposed new Trump administration rules that gave more power to the director of the Executive Office for Immigration Review, a political appointee.

The Trump administration, for its part, has moved to decertify the judges’ union.

Immigration courts face a massive backlog of more than a million cases. And there’s wide agreement that the court system needs reform. But not everyone believes that removing immigration courts from the Justice Department is the right approach.

“The attorney general and his subordinates are actively working to remedy this problem, by providing the needed resources to the immigration courts,” wrote Andrew Arthur, a former immigration judge who is now a fellow at the Center for Immigration Studies, in his testimony before the House Judiciary Committee last month. “Restructuring the immigration courts … will almost certainly not address the core problems that are facing those courts,” Arthur added.

At a time when caseloads are surging, some immigration judges are quitting, citing frustration and exhaustion. Judge Charles Honeyman retired from the Philadelphia Immigration Court in January after 24 years on the job.

“I would want future administrations and the Congress to think of immigration judges as judges, literally, and give them the autonomy and the independence and the confidence to make decisions without political interference or overreach,” he said in an interview with NPR’s Noel King.

“The only way to do that is to create an independent court where the judge makes a decision and the judge isn’t afraid of how many cases he has to complete for the year or whether some political actor is going to be looking over his shoulder and say, I don’t agree with that decision; we’re going to find a way to put pressure on you,” Honeyman said.

After seeing how Trump attacked an Article III life-tenured U.S. District Judge this week, does anyone seriously think that an Immigration Judge, a mere civil servant, who ruled against the Trump/Miller White Nationalist agenda in a case that came to Trump’s attention would retain their job under Billy Barr? After seeing how Trump treated some career civil servants and military officers after they “spoke truth to power” does anyone seriously think that Billy Barr of any other regime sycophant would defend fair and impartial decision making that Trump didn’t like?
No way! So how can ANY foreign national get a fair hearing before a “fake court system” where the prosecution authorities retain the right to change any result that goes against them and to remove subordinates who are supposed to be exercising independent judgement from their jobs if they don’t like the result.
The entire Immigraton Court system is and has been for some time now a cruel, unconstitutional hoax. Why haven’t the Article III Courts, whose judges are protected by life tenure, done their duty by stepping in and putting an end to this unconstitutional dysfunctional mess that is destroying innocent lives and ruining futures?

Trump administration puts pressure on completing deportation cases of migrant children

(CNN)The Trump administration is reinforcing a tight deadline for immigration cases of unaccompanied migrant children in government custody in an effort to make quicker decisions about deportation, according to an email obtained by CNN.

The message seems designed to apply pressure on immigration judges to wrap up such cases within a 60-day window that’s rarely met and falls in line with a broader effort by the administration to complete immigration cases at a faster speed.

 

Judge Ashley Tabaddor, president of the National Association of Immigration Judges, said deadlines are “putting the judge between a rock and a hard place.”

“The only thing that can get done within 60 days is if someone wants to give up their case or go home or be deported,” Tabaddor told CNN.

 

The Executive Office for Immigration Review, which oversees the nation’s immigration court system, sent the email last month to assistant chief immigration judges, reminding them that unaccompanied children in government custody are to be considered the same as detained adults for purposes of scheduling cases.

 

While the 60-day deadline cited in the email is not new, it’s difficult to meet for cases of unaccompanied kids, in part, because of the time it takes to collect the relevant information for a child who comes to the United States alone. As a result, cases can often take months, if not years, to resolve.

 

Last year, an uptick in unaccompanied children at the US-Mexico border strained the administration’s resources. Over the course of the 2019 fiscal year, Border Patrol arrested around 76,000 unaccompanied children on the southern border, compared to 50,000 the previous fiscal year.

 

Unaccompanied children apprehended at the southern border are taken into custody by the Department of Homeland Security and referred to Health and Human Services. While in care at shelters across the country, case managers work to place a child with a sponsor in the United States, like a parent or relative.

 

Like adults and families who cross the US-Mexico border, unaccompanied children are put into immigration proceedings to determine whether they can stay in the United States.

 

The email from EOIR, dated January 30, says unaccompanied migrant children who are in the care of the government should be on a “60-day completion goal,” meaning their case is expected to be resolved within 60 days. It goes on to reference complaints received by the office of the director, but doesn’t say who issued the complaints or include a punishment for not meeting the completion goal.

 

EOIR spokeswoman Kathryn Mattingly told CNN that she could not comment on internal communications.

 

Golden McCarthy, deputy director at the Florence Immigrant and Refugee Rights Project, which works with unaccompanied migrant children, said “it does take time to reach out to” a child’s caretaker or adults in the child’s life.

 

“We all know that many times the child doesn’t necessarily have the full picture of what happened; it does take time to reach out to caretakers and adults in their lives to understand,” McCarthy said.

 

Initiatives designed to quickly process cases have cropped up before.

 

The Obama administration tried to get cases scheduled more expeditiously but deferred to the judges on the timeline thereafter, whereas the Trump administration’s move seems to be an intent to complete cases within a certain timeframe, according to Rená Cutlip-Mason, chief of Programs at the Tahirih Justice Center and a former EOIR official.

 

The Trump administration also appears to be getting cases scheduled faster. In Arizona, for example, the Florence Immigrant and Refugee Project has begun seeing kids called into immigration court earlier than they had been before.

 

In a statement submitted to the House Judiciary Committee in January, the group detailed the cases of children, one as young as 10 years old, who appeared before an immigration judge within days of arriving to the US.

 

“I think our clients and the kids we would work with are resilient,” McCarthy, the deputy director at the project, said. “But to navigate the complex immigration system is difficult for adults to do, and so to explain to a kid that they will be going to court and a judge will be asking them questions, the kids don’t typically always understand what that means.”

 

It can also complicate a child’s case since he or she may eventually move to another state to reunify with a parent or guardian, requiring the child’s case to move to an immigration court in that state.

 

Under the Trump administration, the Justice Department has rolled out a slew of other policies — such as imposing case quotas — to chip away at the nearly one million pending cases facing the immigration court system. Some of those controversial policies have resulted in immigration judges leaving the department.

In its latest budget request to Congress, the White House called for $883 million to “support 100 immigration judge teams” to ease the backlog.

They cross deserts, rivers, and territories controlled by corrupt governments, violent gangs, and drug cartels. They pass through borders, foreign countries, different languages and dialects, and changing cultures.

I meet them on the final leg of their trip where we ride the elevator together. Wide-eyed toddlers in their best clothes, elementary school students with backpacks and shy smiles, worried parents or sponsors trying to look brave and confident. Sometimes I find them wandering the parking garage or looking confused in the sterile concourse. I tell them to follow me to the second floor, the home of the United States Immigration Court at Arlington, Virginia. “Don’t worry,” I say, “our court clerks and judges love children.”

Many will find justice in Arlington, particularly if they have a lawyer. Notwithstanding the expedited scheduling ordered by the Department of Justice, which controls the Immigration Courts, in Arlington the judges and staff reset cases as many times as necessary until lawyers are obtained. In my experience, retaining a pro bono lawyer in Immigration Court can be a lengthy process, taking at least six months under the best of circumstances. With legal aid organizations now overwhelmed, merely setting up intake screening interviews with needy individuals can take many months. Under such conditions, forcing already overworked court staff to drop everything to schedule initial court hearings for women and children within 90 days from the receipt of charging papers makes little, if any, sense.

Instead of scheduling the cases at a realistic rate that would promote representation at the initial hearing, the expedited scheduling forces otherwise avoidable resetting of cases until lawyers can be located, meet with their clients (often having to work through language and cultural barriers), and prepare their cases. While the judges in Arlington value representation over “haste makes waste” attempts to force unrepresented individuals through the system, not all Immigration Courts are like Arlington.

For example, according to the Transactional Records Clearinghouse at Syracuse University (“TRAC”), only 1% of represented juveniles and 11% of all juveniles in Arlington whose cases began in 2014, the height of the so-called “Southern Border Surge,” have received final orders of removal. By contrast, for the same group of juveniles in the Georgia Immigration Courts, 43% were ordered removed, and 52% of those were unrepresented.

Having a lawyer isn’t just important – it’s everything in Immigration Court. Generally, individuals who are represented by lawyers in their asylum cases succeed in remaining in the United States at an astounding rate of five times more than those who are unrepresented. For recently arrived women with children, the representation differential is simply off the charts: at least fourteen times higher for those who are represented, according to TRAC. Contrary to the well-publicized recent opinion of a supervisory Immigration Judge who does not preside over an active docket, most Immigration Judges who deal face-to-face with minor children agree that such children categorically are incompetent to represent themselves. Yet, indigent individuals, even children of tender years, have no right to an appointed lawyer in Immigration Court.

To date, most removal orders on the expedited docket are “in absentia,” meaning that the women and children were not actually present in court. In Immigration Court, hearing notices usually are served by regular U.S. Mail, rather than by certified mail or personal delivery. Given heavily overcrowded dockets and chronic understaffing, errors by the Department of Homeland Security (“DHS”) in providing addresses and mistakes by the Immigration Court in mailing these notices are common.

Consequently, claims by the Department of Justice and the DHS that women and children with removal orders being rounded up for deportation have received full due process ring hollow. Indeed a recent analysis by the American Immigration Council using the Immigration Court’s own data shows that children who are represented appear in court more than 95% of the time while those who are not represented appear approximately 33% of the time. Thus, concentrating on insuring representation for vulnerable individuals, instead of expediting their cases, would largely eliminate in absentia orders while promoting real, as opposed to cosmetic, due process. Moreover, as recently pointed out by an article in the New York Times, neither the DHS nor the Department of Justice can provide a rational explanation of why otherwise identically situated individuals have their cases “prioritized” or “deprioritized.”

Rather than working with overloaded charitable organizations and exhausted pro bono attorneys to schedule initial hearings at a reasonable pace, the Department of Justice orders that initial hearings in these cases be expedited. Then it spends countless hours and squanders taxpayer dollars in Federal Court defending its “right” to aggressively pursue removal of vulnerable unrepresented children to perhaps the most dangerous, corrupt, and lawless countries outside the Middle East: El Salvador, Guatemala, and Honduras. The Board of Immigration Appeals (“BIA”), the institution responsible for enforcing fairness and due process for all who come before our Immigration Courts, could issue precedent decisions to stop this legal travesty of accelerated priority scheduling for unrepresented children who need pro bono lawyers to proceed and succeed. But, it has failed to act.

The misguided prioritization of cases of recently arrived women, children, and families further compromises due process for others seeking justice in our Immigration Courts. Cases that have been awaiting final hearings for years are “orbited” to slots in the next decade. Families often are spread over several dockets, causing confusion and generating unnecessary paperwork. Unaccompanied

children whose cases should initially be processed in a non-adversarial system are instead immediately thrust into court.

Euphemistically named “residential centers” — actually jails — wear down and discourage those, particularly women and children, seeking to exercise their rights under U.S. and international law to seek refuge from death and torture. Regardless of the arcane nuances of our asylum laws, most of the recent arrivals need and deserve protection from potential death, torture, rape, or other abuse at the hands of gangs, drug cartels, and corrupt government officials resulting from the breakdown of civil society in their home countries.

Not surprisingly, these “deterrent policies” have failed. Individuals fleeing so-called “Northern Triangle” countries of El Salvador, Guatemala, and Honduras have continued to arrive at a steady pace, while dockets in Immigration Court, including “priority cases,” have mushroomed, reaching an astonishing 500,000 plus according to recent TRAC reports (notwithstanding efforts to hire additional Immigration Judges). As reported recently by the Washington Post, private detention companies, operating under highly questionable government contracts, appear to be the only real beneficiaries of the current policies.

It doesn’t have to be this way. We could save lives and short-circuit both the inconsistencies and expenses of the current case-by-case protection system, while allowing a “return to normalcy” for most already overcrowded Immigration Court dockets by using statutory Temporary Protected Status (known as “TPS”) for natives of the Northern Triangle countries. Indeed, more than 270 organizations with broad based expertise in immigration matters, as well as many members of Congress, have requested that the Administration institute such a program.

The casualty toll from the uncontrolled armed violence plaguing the Northern Triangle trails only those from Syria, Afghanistan, and Iraq. TPS is a well- established humanitarian response to a country in crisis. Its recipients, after registration, are permitted to live and work here, but without any specific avenue for obtaining permanent residency or achieving citizenship. TPS has been extended among others to citizens of Syria and remains in effect for citizens of both Honduras who needed refuge from Hurricane Mitch in 1998 and El Salvador who needed refuge following earthquakes in 2001. Certainly, the disruption caused by a hurricane and earthquakes more than a decade ago pales in comparison with the very real and gruesome reality of rampant violence today in the Northern Triangle.

Regardless, we desperately need due-process reforms to allow the Immigration Court system to operate more fairly, efficiently, and effectively. Here are a few suggestions: place control of dockets in the local Immigration Judges, rather than bureaucrats in Washington, as is the case with most other court systems; work cooperatively with the private sector and the Government counsel to docket cases at a rate designed to maximize representation at the initial hearings; process unaccompanied children through the non-adversarial system before rather

than after the institution of Immigration Court proceedings; end harmful and unnecessary detention of vulnerable families; settle ongoing litigation and redirect the talent and resources to developing an effective representation program for all vulnerable individuals; and make the BIA an effective appellate court that insures due process, fairness, uniformity and protection for all who come before our Immigration Courts.

Children are the future of our world. History deals harshly with societies that mistreat and fail to protect children and other vulnerable individuals. Sadly, our great country is betraying its values in its rush to “stem the tide.” It is time to demand an immigrant justice system that lives up to its vision of “guaranteeing due process and fairness for all.” Anything less is a continuing disgrace that will haunt us forever.

The children and families riding the elevator with me are willing to put their hopes and trust in the belief that they will be treated with justice, fairness, and decency by our country. The sole mission and promise of our Immigration Courts is due process for these vulnerable individuals. We are not delivering on that promise.

Tragically, as a nation, we have learned nothing over the past more than three years. Things have actually gotten much, much worse as we have unwisely and unconscionably entrusted the administration of our laws to a cruel, corrupt, scofflaw regime that sees inflicting pain, suffering, and even death on children and other vulnerable seekers of justice as an “end in an of itself.” They actually brag about their dishonesty, racism, selfishness, contempt for human decency, and “crimes against humanity.”

So far, they have gotten away nearly “Scot-free” with not only bullying and picking on vulnerable children and refugee families but with diminishing the humanity of each of us who put up with the horrors of an authoritarian neo-fascist state.

History will, however, remember who stood up for humanity in this dark hour and who instead sided with and enabled the forces of evil, willful ignorance, and darkness overtaking our wounded democracy.

SAN DIEGO IMMIGRATION COURT, COURTROOM #2;
PRESIDING: JUDGE LEE O’CONNOR

Lee O’Connor has been in his courtroom for all of two minutes before a look of annoyance washes over his face.

Eleven children and six adults—all of them from Central America, all of them in court for the first time—sit on the wooden benches before him. They’ve been awake since well before dawn so they could line up at the US-Mexico border to board government buses headed to immigration court in downtown San Diego, Kevlar-vested federal agents in tow. Like the dozens of families jam-packed into the lobby and the six other courtrooms, they’ve been waiting out their asylum cases in Mexico, often for months, as part of the Trump administration’s controversial border policy, the Migrant Protection Protocols.

O’Connor has a docket full of MPP cases today, like every day. Before he gets to them, though, he quickly postpones a non-MPP case to January 2021, explaining to a man and his attorney that he simply doesn’t have time for them today, motioning to the families in the gallery. While he’s doing this, the little girl in front of me keeps asking her mom if she can put on the headphones that play a Spanish translation of the proceedings. A guard motions the little girl to be quiet. 

For months, immigration attorneys and judges have been complaining that there’s no fair way to hear the cases of the tens of thousands of Central Americans who have been forced to remain on the Mexican side of the border while their claims inch through the courts. MPP has further overwhelmed dockets across the country and pushed aside cases that already were up against a crippling backlog that’s a million cases deep, stranding immigration judges in a bureaucratic morass and families with little hope for closure anytime in the near future.

I went last month to San Diego—home to one of the busiest MPP courts, thanks to its proximity to Tijuana and the more than 20,000 asylum seekers who now live in shelters and tent cities there—expecting to see logistical chaos. But I was still surprised at how fed up immigration judges like O’Connor were by the MPP-driven speedup—and by the extent to which their hands were tied to do anything about it.

Once O’Connor is done rescheduling his non-MPP case, he leans forward to adjust his microphone, rubs his forehead, and starts the group removal hearing. The interpreter translates into Spanish, and he asks if the adults understand. “Sí,” they say nervously from the back of the courtroom. O’Connor goes down his list, reading their names aloud with a slight Spaniard accent, asking people to identify themselves when their names are called. He reprimands those who do not speak up loud enough for him to hear.

O’Connor, who was appointed to the bench in 2010, is known for being tough: Between 2014 and 2019, he has denied 96 percent of asylum cases. He explains to the migrants that they have the right to an attorney, although one will not be provided—there are no public defenders in immigration court. O’Connor acknowledges finding legal representation from afar is difficult, but he tells them it’s not impossible. He encourages them to call the five pro bono legal providers listed on a sheet of paper they received that day. The moms sitting in front of me have their eyes locked on the Spanish interpreter, trying to absorb every bit of information. Their kids try their best to sit quietly.

As he thumbs through the case files, O’Connor grows increasingly frustrated: None of them has an address listed. “The government isn’t even bothering to do this,” he grumbles. The documents for MPP cases list people’s addresses as simply “Domicilio Conocido,” which translates to “Known Address.” This happens even when people say they can provide an address to a shelter in Mexico or when they have the address of a relative in the United States who can receive their paperwork. “I’ve seen them do this in 2,000 cases since May,” O’Connor says, and the Department of Homeland Security “hasn’t even bothered to investigate.” He looks up at the DHS attorney with a stern look on his face, but she continues shuffling paperwork around at her desk.

O’Connor picks up a blue form and explains to the group that they have to change their address to a physical location. The form is only in English; many of the adults seem confused and keep flipping over their copies as he tells them how to fill it out. O’Connor tells them they have to file within a week—perhaps better to do it that day, he says—but it’s unclear to me how they could follow his exacting instructions without the help of an attorney. He points out other mistakes in the paperwork filed by DHS and wraps up the hearing after about 45 minutes. The families don’t know that’s typical for a first hearing and seem perplexed when it ends. 

O’Connor schedules the group to come back for their next hearing in five weeks at 8:30 a.m. That will mean showing up at the San Ysidro port of entry at 4:30 a.m.; the alternative, he says, is being barred from entering the United States and seeking forms of relief for 10 years. “Do you understand?” he asks. The group responds with a hesitant “Sí.”

The Trump administration designed MPP to prevent people like them from receiving asylum, and beyond that, from even seeking it in the first place. First implemented in San Diego in late January 2019 to help stem the flow of people showing up at the southern border, the policy has since sent somewhere between 57,000 and 62,000 people to dangerous Mexican cities where migrants have been preyed upon for decades. Their cases have been added to an immigration court that already has a backlog of 1,057,811 cases—up from 600,000 at the time when Obama left office—according to data obtained by the Transactional Records Access Clearinghouse at Syracuse University.

According to immigration judge Ashley Tabaddor, who spoke to me in her capacity as union president of the National Association of Immigration Judges, MPP has constituted a fundamental change to the way courts are run. DHS, she says, is “creating a situation where they’re physically, logistically, and systematically creating all the obstacles and holding all the cards.” The MPP program has left the court powerless, “speeding up the process of dehumanizing the individuals who are before the court and deterring anyone from the right to seek protection” All this while the Department of Justice is trying to decertify Tabbador’s union—the only protection judges have, and the only avenue for speaking publicly about these issues—by claiming its members are managers and no longer eligible for union membership. Tabaddor says the extreme number of cases combined with the pressure to process them quickly is making it difficult for judges to balance the DOJ’s demands with their oath of office.

Immigration attorneys in El Paso, San Antonio, and San Diego have told me they are disturbed by the courtroom disarray: the unanswered phones, unopened mail, and unprocessed filings. Some of their clients are showing up at border in the middle of the night only to find that their cases have been rescheduled. That’s not only unfair, one attorney told me, “it’s dangerous.” Central Americans who speak only indigenous languages are asked to navigate court proceedings with Spanish interpreters. One attorney in El Paso had an 800-page filing for an asylum case that she filed with plenty of time for the judge to review, but it didn’t make it to the judge in time. 

As another lawyer put it, “The whole thing is a fucking disaster that is designed to fail.”

COURTROOM #4; PRESIDING: JUDGE PHILIP LAW

Down the hall, a Honduran woman I’ll call Mari stands up next to her attorney and five-year-old son, raises her right hand, and is sworn in. 

Mari’s hearing isn’t much of a hearing at all. Stephanie Blumberg, an attorney with Jewish Family Service of San Diego, who is working the case pro bono, asks for more time because she only recently took the case; Judge Philip Law says he will consolidate the cases of mother and child into one; and he schedules her next hearing for the following week at 7:30 a.m., with a call time of 3:30 a.m. at the border.

Just as it’s about to wrap up, Bloomberg says her client is afraid to return to Mexico. “I want to know what is going to happen with me. I don’t want to go back to Mexico—it’s terrible,” Mari says in Spanish, an interpreter translating for the judge. “I have no jurisdiction over that,” Law says. “That’s between you and the Department of Homeland Security.” Law then turns to the DHS attorney, who says he’ll flag the case and “pass it along.”

While nine families begin their MPP group hearing, Mari tells me back in the waiting room that she and her son crossed the border in Texas and then asked for asylum. They were detained for two days and then transported by plane to San Diego, where she was given a piece of paper with a date and time for court and then released in Tijuana. She didn’t know anyone, barely knew where she was, and, trying to find safety in numbers, stuck with the group released that day. Two days after US immigration officials sent her to Tijuana, she was raped.

Mari’s voice gets shaky, and she tries to wipe the tears from her eyes, but even the cotton gloves she’s wearing aren’t enough to keep her face dry. I tell her we can end the conversation and apologize for making her relive those moments. She looks at her son from across the room and says she’d like to continue talking.

“I thought about suicide,” she whispers. “I carried my son and thought about jumping off a bridge.” Instead, she ended up walking for a long time, not knowing what to do or what would happen to them because they didn’t have a safe place to go.

“I haven’t talked to my family back home—it’s so embarrassing because of the dream I had coming here, and now look,” she says. “We’re discriminated against in Mexico; people make fun of us and the way we talk.” Her boy was already shy but has become quieter and more distrusting in recent months.

In the last year, I’ve spoken to dozens of migrants in border cities like Ciudad Juárez and Tijuana who share similarly horrific stories. Human Rights First has tracked more than 800 public reports of torture, kidnapping, rape, and murder against asylum seekers sent to Mexico in the last year. A lawsuit brought by the American Civil Liberties Union, Southern Poverty Law Center, and Center for Gender and Refugee Studies is challenging MPP on the grounds that it violates the Immigration and Nationality Act, and the “United States’ duty under international human rights law” not to return people to dangerous conditions.

“The system has not been set up to handle this in any way,” says Kate Clark, senior director of immigration services with Jewish Family Service of San Diego, one of the groups listed on the pro bono sheet Judge O’Connor handed out earlier in the day. They’re the only ones with a WhatsApp number listed, and their phones are constantly ringing because “it’s clear that people don’t know what’s going on or what to expect—and they’re in fear for their lives,” Clark says. Still, her 8-person team working MPP cases can only help a small percentage of the people coming through the courtroom every day.

Later that afternoon, shortly after 5, two large white buses pull up to the court’s loading dock. Guards in green uniforms escort about 60 people out from the loading dock. Moms, dads, and dozens of little kids walk in a straight light to get on a bus. They are driven down to the border and sent back to Tijuana later that night.

A few days later, Mari’s attorney tells me that despite raising a fear of retuning to Mexico in court, US port officials sent Mari back to Tijuana that night.

COURTROOM #2; PRESIDING: JUDGE LEE O’CONNOR

I find myself back in O’Connor’s courtroom for his afternoon MPP hearings. This time, the only people with legal representation is a Cuban family who crossed in Arizona in July 2019 and turned themselves in to Border Patrol agents. This is their first time in court, and their attorney calls in from out of state.

Right away, O’Connor wants to address a different kind of clerical error from the one that bothered him earlier in the day—and one that he thinks matters even more. It involves the first document that DHS issues to “removable” immigrants, known as a Notice to Appear (NTA) form. Although the form allows agents to check a box to categorize people based on how they encountered immigration officials, O’Connor points out that in this case it was left blank—and that “this is fairly typical of the overwhelming majority of these cases.”

He isn’t the first or only judge to notice this; I heard others bring up inconsistent and incomplete NTAs. Border officials are supposed to note on the form if the people taken into custody are “arriving aliens,” meaning they presented at the port of entry asking for asylum, or “aliens present in the United States who have not been admitted or paroled,” meaning they first entered illegally in between ports of entry. Thousands of MPP cases have forms without a marked category. As far as O’Connor is concerned, that’s a crucial distinction. He believes that this Trump administration policy shouldn’t apply to people who entered the country without authorization—meaning countless immigrants who applied for MPP should be disqualified from the get-go.

In the case of the Cuban family, like dozens more that day, the DHS attorney filed an amended NTA classifying them as “arriving aliens.” O’Connor points out is not how they entered the United States. The DHS attorney is unphased by the judge’s stern tone and came prepared with piles of new forms for the other cases of incomplete NTAs. The family’s lawyer says maybe the government made a mistake. O’Connor, unsatisfied, interrupts her: “There was no confusion. I’ve seen 2,000 of theseâ¦the government is not bothering to spend the time.” After a lengthy back-and-forth, a testy O’Connor schedules the family to come back in three weeks.

O’Connor’s stance and rulings on this issue have broader implications. He terminated a case in October because a woman had entered the country illegally before turning herself in and wrote in his decision that DHS had “inappropriately subjected respondent to MPP.” He is among the loudest voices on this issue, saying that MPP is legal only when applied to asylum-seekers presenting at legal ports of entry—though it’s unclear to many lawyers what it might mean for their clients to have their cases terminated in this way. Would these asylum seekers end up in immigration detention facilities? Would they be released under supervision in the United States? Would they be deported back to their home countries?

Since MPP cases hit the courts last March, asylum attorneys have been critical of DHS for not answering these questions. I was present for the very first MPP hearing in San Diego and saw how confused and frustrated all sides were that DHS didn’t seem to have a plan for handling these cases. Now, almost a year later, little has changed.

Tabaddor, the union president, tells me that “there are definitely legal issues that the MPP program has presented” and that judges are having to decide whether the documents “are legally sufficient.” “The issue with DHS—frankly, from what I’ve heard—is that it seems like they’re making it up as they go,” she says.

Last week, Tabaddor testified in front of the House Judiciary Committee and for the independence of immigration courts from the political pressures of federal law enforcement. There are approximately 400 immigration judges across more than 60 courts nationwide, and almost half of those judges have been appointed during the Trump era. (According to a recent story in the Los Angeles Times, dozens of judges are quitting or retiring early because their jobs have become “unbearable” under Trump.)

California Democrat Zoe Lofgren, an immigrants’ rights supporter in Congress, argued during the hearing that the immigration courts are in crisis and the issue requires urgent congressional attention. “In order to be fully effective, the immigration court system should function just like any other judicial institution,” she said. “Immigration judges should have the time and resources to conduct full and fair hearings, but for too long, the courts have not functioned as they should—pushing the system to the brink.”

COURTROOM #1; PRESIDING: JUDGE SCOTT SIMPSON

“I don’t want any more court,” a woman from Guatemala pleads just before lunchtime. “No more hearings, please.”

Unlike many of the people who were there for their first hearing when I observed court in San Diego, this woman has been to court multiple times since mid-2019. No matter how hard she tried, she couldn’t find a lawyer, she tells Judge Scott Simpson. She’s had enough.

“We’ve reached a fork on the road, ma’am,” Simpson says in a warm, calm tone. “You either ask for more time for an attorney to help you or you represent yourself.”

“No, it’d be a loss since I don’t know anything about the law,” the woman responds, her voice getting both louder and shakier. Simpson explains to her again the benefits of taking time to find an attorney.

“It’s been almost a year. I don’t want to continue the case. I want to leave it as is,” she tells him. After more explanation from the judge, the woman says she’d like to represent herself today so that decisions can be made. Simpson asks what she would like to do next, and the woman says, “I want you to end it.”

This woman’s pleas are increasingly common. Tabaddor says MPP has taken “an already very challenging situation and [made] it exponentially worse.” The new reality in immigration courts “is logistically and systematically designed to just deter people from seeking or availing themselves of the right to request protection,” Tabaddor says.

After hearing the Guatemalan woman ask for the case to be closed multiple times, Simpson takes a deep breath, claps his hands, and says there are four options: withdrawal, administrative close, dismissal, or termination. He explains each one, and after 10 minutes the woman asks for her case to be administratively closed. The DHS attorney, however, denies that request. Simpson’s hands are tied.

The judge tells the woman that because DHS filed paperwork on her case that day, and because it’s only in English, that he’s going to give her time to review it, because “as the judge I don’t think it would be fair for you to go forward without the opportunity to object to that.” He schedules her to come back in a month.

“MPP is not a program I created,” he says. “That decision was made by someone else.”

“Malicious incompetence,” “Aimless Docket Reshuffling,” “Man’s Inhumanity to Man” — it’s all there on public display in this deadly “Theater of the Absurd.”

Where, oh where, has our humanity and human decency gone?

And, how do spineless jurists on Article III Courts who continue to “rubber stamp” and overlook the disgraceful abrogation of Due Process and fundamental fairness going on in a grotesquely biased and mismanaged “court system” controlled by a White Nationalist, nativist regime look at themselves in the mirror each morning. Maybe they don’t.

Abuse of the most vulnerable among us might seem to them to be “below the radar screen.” After all, their victims often die, disappear, or are orbited back to unknown fates in dangerous foreign lands. Out of sign, out of mind! But, what if it were their spouses, sons, and daughters sent to Tijuana to be raped while awaiting a so-called “trial.”

Rather than serving its intended purpose, promoting courage to stand up against government tyranny and to defend the rights of individuals, even the downtrodden and powerless, against Government abuse of the law, life tenure has apparently become something quite different. That is, a refuge from accountability and the rules of human decency.

John Roberts, his “Gang of Five,” and the rest of the Article III enablers will escape any legal consequences for their actions and, perhaps more significant, inactions in the face of unspeakable abuses of our Constitution, the rule of law, intellectual honesty, and the obligations we owe to other human beings.

How about those cowardly 9th Circuit Judges who ignored the law, betrayed human decency, and enabled rapes, killings, and other “crimes against humanity” by “green lighting” the unconstitutional and clearly illegal “MPP” — better known as “Let ‘Em Die in Mexico” with their absurdist legal gobbledygook in Innovation Law Lab v. McAleenan. They are enjoying life in the ivory tower while their human victims are suffering and dying.

But, folks like Fernanda and many others are recording their abuses which will live in history and infamy, will forever tarnish their records, and be a blot on their family names for generations to come. 

There is no excuse for what is happening at our borders and in our Immigration Courts today. Constantly Confront Complicit Courts 4 Change! Flood the Article IIIs with examples and constant reminders of their handiwork and dereliction of duty! Let the bodies pile up on their collective doorsteps until the stench is so great that even they can no longer ignore and paper over their own complicity and moral responsibility with legal banalities. Force them to see their own faces and the faces of their loved ones in the scared, tormented faces and ruined lives of those destroyed by our scofflaw regime and its enablers. 

Also, if you haven’t already done so, tell your Congressional representatives that you have had enough of this grotesque circus!

Here’s what I wrote to my legislators, and some from other states, recently:

I hope you will also speak out frequently against the grotesque abuses of human rights, Due Process, and human decency, not to mention the teachings of Jesus Christ and almost all other religious traditions, that the Trump Administration is carrying out against refugees of color, many of them desperate and vulnerable women and children, at our Southern Border.

Additionally, under Trump, the U.S. Immigration Courts, absurdly and unconstitutionally located within a politically biased U.S. Department of Justice, have become a mockery of justice, Due Process, and fundamental fairness. I urge you to join with other legislators in abolishing the current failed (1.1 million case backlog) and unfair system and replacing it with an independent Article I U.S. Immigration Court. It’s time to end the abuse! This must be one of our highest national priorities.

Stop Deporting Salvadorans Who Would Face Risks to Their Safety, Lives

The US government has deported people to face abuse and even death in El Salvador. The US is not solely responsible—Salvadoran gangs who prey on deportees and Salvadoran authorities who harm deportees or who do little or nothing to protect them bear direct responsibility—but in many cases the US is putting Salvadorans in harm’s way in circumstances where it knows or should know that harm is likely.

Of the estimated 1.2 million Salvadorans living in the United States who are not US citizens, just under one-quarter are lawful permanent residents, with the remaining three-quarters lacking papers or holding a temporary or precarious legal status. While Salvadorans have asylum recognition rates as high as 75 percent in other Central American nations, and 36.5 percent in Mexico, the US recognized just 18.2 percent of Salvadorans as qualifying for asylum from 2014 to 2018. Between 2014-2018, the US and Mexico have deported about 213,000 Salvadorans (102,000 from Mexico and 111,000 from the United States).

No government, UN agency, or nongovernmental organization has systematically monitored what happens to deported persons once back in El Salvador. This report begins to fill that gap. It shows that, as asylum and immigration policies tighten in the United States and dire security problems continue in El Salvador, the US is repeatedly violating its obligations to protect Salvadorans from return to serious risk of harm.

Some deportees are killed following their return to El Salvador. In researching this report, we identified or investigated 138 cases of Salvadorans killed since 2013 after deportation from the US. We found these cases by combing through press accounts and court files, and by interviewing surviving family members, community members, and officials. There is no official tally, however, and our research suggests that the number of those killed is likely greater.

Though much harder to identify because they are almost never reported by the press or to authorities, we also identified or investigated over 70 instances in which deportees were subjected to sexual violence, torture, and other harm, usually at the hands of gangs, or who went missing following their return.

In many of these more than 200 cases, we found a clear link between the killing or harm to the deportee upon return and the reasons they had fled El Salvador in the first place. In other cases, we lacked sufficient evidence to establish such a link. Even the latter cases, however, show the risks to which Salvadorans can be exposed upon return and the importance of US authorities giving them a meaningful opportunity to explain why they need protection before they are deported.

The following three cases illustrate the range of harms:

  • In 2010, when he was 17, Javier B. fled gang recruitment and his particularly violent neighborhood for the United States, where his mother, Jennifer B., had already fled. Javier was denied asylum and was deported in approximately March 2017, when he was 23 years old. Jennifer said Javier was killed four months later while living with his grandmother: “That’s actually where they [the gang, MS-13 (or Mara Salvatrucha-13)] killed him.… It’s terrible. They got him from the house at 11:00 a.m. They saw his tattoos. I knew they’d kill him for his tattoos. That is exactly what happened.… The problem was with [the gang] MS [-13], not with the police.” (According to Human Rights Watch’s research, having tattoos may be a source of concern, even if the tattoo is not gang-related).

 

  • In 2013, cousins Walter T. and Gaspar T. also fled gang recruitment when they were 16 and 17 years old, respectively. They were denied asylum and deported by the United States to El Salvador in 2019. Gaspar explained that in April or May 2019 when he and Walter were sleeping at their respective homes in El Salvador, a police patrol arrived “and took me and Walter and three others from our homes, without a warrant and without a reason. They began beating us until we arrived at the police barracks. There, they held us for three days, claiming we’d be charged with illicit association (agrupaciones ilícitas). We were beaten [repeatedly] during those three days.”

 

  • In 2014, when she was 20, Angelina N. fled abuse at the hands of Jaime M., the father of her 4-year-old daughter, and of Mateo O., a male gang member who harassed her repeatedly. US authorities apprehended her at the border trying to enter the US and deported her that same year. Once back in El Salvador, she was at home in October 2014, when Mateo resumed pursuing and threatening her. Angelina recounted: “[He] came inside and forced me to have sex with him for the first time. He took out his gun.… I was so scared that I obeyed … when he left, I started crying. I didn’t say anything at the time or even file a complaint to the police. I thought it would be worse if I did because I thought someone from the police would likely tell [Mateo].… He told me he was going to kill my father and my daughter if I reported the [original and three subsequent] rapes, because I was ‘his woman.’ [He] hit me and told me that he wanted me all to himself.”

As in these three cases, some people deported from the United States back to El Salvador face the same abusers, often in the same neighborhoods, they originally fled: gang members, police officers, state security forces, and perpetrators of domestic violence. Others worked in law enforcement in El Salvador and now fear persecution by gangs or corrupt officials.

Deportees also include former long-term US residents, who with their families are singled out as easy and lucrative targets for extortion or abuse. Former long-term residents of the US who are deported may also readily run afoul of the many unspoken rules Salvadorans must follow in their daily lives in order to avoid being harmed.

Nearly 900,000 Salvadorans living in the US without papers or only a temporary status together with the thousands leaving El Salvador each month to seek safety in the US are increasingly at risk of deportation. The threat of deportation is on the rise due to various Trump administration policy changes affecting US immigration enforcement inside its borders and beyond, changes that exacerbated the many hurdles that already existed for individuals seeking protection and relief from deportation.

Increasingly, the United States is pursuing policies that shift responsibility for immigration enforcement to countries like Mexico in an effort to avoid any obligation for the safety and well-being of migrants and protection of asylum-seekers. As ever-more restrictive asylum and immigration policies take hold in the US, this situation—for Salvadorans, and for others—will only worsen. Throughout, US authorities are turning a blind eye to the abuse Salvadorans face upon return.

Some people from El Salvador living in the United States have had a temporary legal status known as “Temporary Protected Status” or “TPS,” which has allowed those present in the United States since February 2001 (around 195,000 people) to build their lives in the country with limited fear of deportation. Similarly, in 2012, the Obama administration provided some 26,000 Salvadorans with “Deferred Action for Childhood Arrivals” or “DACA” status, which afforded some who had arrived as children with a temporary legal status. The Trump administration had decided to end TPS in January 2020, but to comply with a court order extended work authorization to January 2021. It remains committed to ending DACA.

While challenges to both policies wend their way through the courts, people live in a precarious situation in which deportation may occur as soon as those court cases are resolved (at the time of writing the DACA issue was before the US Supreme Court; and the TPS work authorization extension to January 2021 could collapse if a federal appellate court decides to reverse an injunction on the earlier attempt to terminate TPS).

Salvadoran asylum seekers are also increasingly at risk of deportation and return. The Trump administration has pursued a series of policy initiatives aimed at making it harder for people fleeing their countries to seek asylum in the United States by separating children from their parents, limiting the number of people processed daily at official border crossings, prolonging administrative detention, imposing fees on the right to seek asylum, extending from 180 days to one year the bar on work authorization after filing an asylum claim, barring asylum for those who transited another country before entering the United States, requiring asylum seekers to await their hearings in Mexico, where many face dangers, and attempting to narrow asylum.

These changes aggravated pre-existing flaws in US implementation of its protection responsibilities and came as significant numbers of people sought protection outside of El Salvador. In the decade from 2009 to 2019, according to government data, Mexican and United States officials made at least 732,000 migration-related apprehensions of Salvadoran migrants crossing their territory (175,000 were made by Mexican authorities and just over 557,000 by US authorities).

According to the United Nations’ refugee agency, the number of Salvadorans expressing fear of being seriously harmed if returned to El Salvador has skyrocketed. Between 2012 and 2017, the number of Salvadoran annual asylum applicants in the US grew by nearly 1,000 percent, from about 5,600 to over 60,000. By 2018, Salvadorans had the largest number (101,000) of any nationality of pending asylum applications in the United States. At the same time, approximately 129,500 more Salvadorans had pending asylum applications in numerous other countries throughout the world. People are fleeing El Salvador in large numbers due to the violence and serious human rights abuses they face at home, including one of the highest murder rates in the world and very high rates of sexual violence and disappearance.

Despite clear prohibitions in international law on returning people to risk of persecution or torture, Salvadorans often cannot avoid deportation from the US. Unauthorized immigrants, those with temporary status, and asylum seekers all face long odds. They are subjected to deportation in a system that is harsh and punitive—plagued with court backlogs, lack of access to effective legal advice and assistance, prolonged and inhumane detention, and increasingly restrictive legal definitions of who merits protection. The US has enlisted Mexico—which has a protection system that its own human rights commission has called “broken”—to stop asylum seekers before they reach the US and host thousands returned to wait for their US proceedings to unfold. The result is that people who need protection may be returned to El Salvador and harmed, even killed.

Instead of deterring and deporting people, the US should focus on receiving those who cross its border with dignity and providing them a fair chance to explain why they need protection. Before deporting Salvadorans living in the United States, either with TPS or in some other immigration status, US authorities should take into account the extraordinary risks former long-term residents of the US may face if sent back to the country of their birth. The US should address due process failures in asylum adjudications and adopt a new legal and policy framework for protection that embraces the current global realities prompting people to flee their homes by providing “complementary protection” to anyone who faces real risk of serious harm.

As immediate and first steps, the United States government should adopt the following six recommendations to begin to address the problems identified in this report. Additional medium- and long-term legal and policy recommendations appear in the final section of this report.

  • The Trump administration should repeal the Migration Protection Protocols (MPP); the two Asylum Bans; and the Asylum Cooperation Agreements.
  • The Attorney General of the United States should reverse his decisions that restrict gender-based, gang-related, and family-based grounds for asylum.
  • Congress and the Executive Branch should ensure that US funding for Mexican migration enforcement activities does not erode the right to seek and receive asylum in Mexico.
  • Congress should immediately exercise its appropriation power by: 1) Refraining from providing additional funding to the Department of Homeland Security (DHS) for Immigration and Customs Enforcement (ICE) and US Customs and Border Protection (CBP) unless and until abusive policies and practices that separate families, employ unnecessary detention, violate due process rights, and violate the right to seek asylum are stopped; 2) Prohibiting the use of funds to implement the Migrant Protection Protocols, the “Asylum Bans,” or the Asylum Cooperation Agreements, or any subsequent revisions to those protocols and agreements that block access to the right to seek asylum in the United States.
  • Congress should exercise its oversight authority by requiring the Government Accountability Office and the Office of Inspector General to produce reports on the United States’ fulfilment of its asylum and protection responsibilities, including by collecting and releasing accurate data on the procedural experiences of asylum seekers (access to counsel, wait times, staff capacity to assess claims, humanitarian and protection resources available) and on harms experienced by people deported from the United States to their countries of origin.
  • Congress should enact, and the President should sign, legislation that would broadly protect individuals with Temporary Protected Status (including Salvadorans) and DACA recipients, such as the Dream and Promise Act of 2019, but without the overly broad restrictions based on juvenile conduct or information from flawed gang databases.

History will neither forget nor forgive the many Article III Judges who have betrayed their oaths of office and abandoned humanity by allowing the Trump regime to run roughshod over our Constitution, the rule of law, and simple human decency.

Future generations must inject integrity, courage, and human decency into the process for appointing and confirming Article III Judges. Obviously, there is something essential missing in the legal scholarship, ethical training, and moral integrity of many of our current batch of  shallow “go along to get along” jurists!  Human lives matter!
