White House prepares new immigration limits, using coronavirus as cover

The Trump administration is preparing to roll outanother set of restrictions on legal immigration, citing the impact of the coronavirus pandemic, even as it argues for the reopening of the US economy, according to sources familiar with the deliberations.

Despite a push from President Donald Trump to move past the pandemic, the administration is continuing to usher forward immigration measures, citing the outbreak and its toll on the economy.

One of the key figures behind the push to limit immigration is Stephen Miller, Trump’s lead immigration adviser and the architect of the President’s hardline immigration agenda. In April, Trump signed an executive order barring some immigration to the US after teasing an outright ban on immigration to the country. Trump argued that the order was needed to protect American jobs.

Against the backdrop of the coronavirus pandemic, the administration has pressed forward with a series of immigration measures that, prior to coronavirus, had struggled to break through. Among those changes is the closure of the southern border to migrants, including those seeking asylum, unless certain conditions are met.

After the President’s April proclamation, Miller cast the move as a first step toward reducing the flow of immigrants coming into the United States. That proclamation set up deadlines for review, one of which is approaching this weekend, and left the possibility open for its extension or modification.

The economic argument is expected to be raised again in an anticipated expansion or new immigration executive order. While Trump has touted recent job numbers,unemployment numbers remain high — though businesses have said in a series of letters to the President that continued immigration is important for economic recovery.

Interest groups, businesses and experts are fighting any new restrictions, saying that visas allowing immigrants to temporarily work in the US are critical to the economy.

“Why would he want to cut off critical workforce that will help the economy recover?” said Greg Chen, director of government relations for the American Immigration Lawyers Association.

“It’s not a rational or reasonable approach to the stated goals of what they’re trying to achieve, which only points to the underlying purpose of effectuating the President’s campaign goals of cutting off immigration,” Chen added.

Trump pledged the previous order would “ensure that unemployed Americans of all backgrounds will be first in line for jobs as our economy reopens.”

The White House did not immediately comment for this story.

CNN previously reported that Trump’s political advisers view the immigration steps as motivating for his base supporters at a moment when the President’s key election message — a strong economy — is badly weakened by the pandemic.

Legal immigration, which has already taken a hit during the outbreak, is again in focus in deliberations about an anticipated immigration executive order.

Why Ta-Nehisi Coates is hopeful

The author of Between the World and Me on why this isn’t 1968, the Colin Kaepernick test, police abolition, nonviolence and the state, and more.

The first question I asked Ta-Nehisi Coates during our recent conversation on The Ezra Klein Show was broad: What does he see right now, as he looks out at the country?

“I can’t believe I’m gonna say this,” he replied, “but I see hope. I see progress right now.”

Coates is the author of the National Book Award winner Between the World and Me and The Water Dancer, among others. We discussed how this moment differs from 1968, the tension between “law” and “order,” the contested legacy of Martin Luther King Jr., Donald Trump’s view of the presidency, police abolition, why we need to renegotiate the idea of “the public,” how the consensus on criminal justice has shifted, what Joe Biden represents, the proper role of the state, and much more.

But there’s one particular thread of this conversation that I haven’t been able to put down: There is now, as there always is amid protests, a loud call for the protesters to follow the principles of nonviolence. And that call, as Coates says, comes from people who neither practice nor heed nonviolence in their own lives. But what if we turned that conversation around? What would it mean to build the state around principles of nonviolence, rather than reserving that exacting standard for those harmed by the state?

What do you see right now, as you look out at the country?

I can’t believe I’m gonna say this, but I see hope. I see progress right now, at this moment.

I had an interesting call on Saturday with my dad, who was born in 1946, grew up dirt poor in Philadelphia, lived in a truck, went off to Vietnam, came back, joined the Panther Party, and was in Baltimore for the 1968 riots. Would’ve been about 22 at that time.

I asked him if he could compare what he saw in 1968 to what he was seeing now. And what he said to me was there was no comparison — that this is much more sophisticated. And I say, well, what do you mean? He said it would have been like if somebody from the turn of the 20th century could see the March on Washington.

The idea that black folks in their struggle against the way the law is enforced in their neighborhoods would resonate with white folks in Des Moines, Iowa, in Salt Lake City, in Berlin, in London — that was unfathomable to him in ‘68, when it was mostly black folks in their own communities registering their great anger and great pain.

I don’t want to overstate this, but there are significant swaths of people and communities that are not black, that to some extent have some perception of what that pain and that suffering is. I think that’s different.

Do you think there is more multiethnic solidarity today than there was then?

I do. Within my lifetime, I don’t think there’s been a more effective movement than Black Lives Matter. They brought out the kind of ridiculousness that black folks deal with on a daily basis in the policing in their communities.

George Floyd is not new. The ability to broadcast it the way it was broadcasted is new. But black folks have known things like that were going on in their communities, in their families, for a very long time. You have a generation of people who are out in the streets right now, many of whom only have the vaguest memory of George Bush. They remember George Bush the way I remember Carter. The first real president who they actually grappled with was a black dude. That’s a different type of consciousness.

I was watching the speech Trump gave before tear-gassing the protesters in the park in DC. What so chilled me about that speech was how much he clearly wanted this — like this was the presidency as he had always imagined it, directing men with guns and shields to put down protesters so he could walk through a park unafraid and seem tough.

He’s always seemed so disinterested and annoyed by the actual work of being president, even during coronavirus. But this is the thing that he seems energized and excited by. And that’s been the scary part of it to me — that you have somebody in that role who is eager for escalation.

It is pretty clear that the war-making part of being head of state was the part that most appeals to Donald Trump.

What does this mean for the election? It may be true that Donald Trump will win. Maybe this will lead to some sort of white backlash that ultimately helps him. I can’t really call that. But what I will say is this is a massive denial of legitimacy. Donald Trump may win the election in November, but he will be a ruler and not a president.

I think that those things need to be distinguished. When you’re calling out the military to repress protests that are in cities across the country, not just in ghettos and in hoods, all you have is force at that point. Most likely if he wins, he’ll be someone who won with a minority of the vote two times, which will be a first in American history. And violence will be the tool by which he rules. I think it’s a very different situation to be in.

I’m glad you brought in that word legitimacy. I wrote a piece the other day called “America at the breaking point,” and one of the things that I was imagining as I wrote that was a legitimacy crisis. The stakes have been going higher and higher this year: coronavirus, the entire country locked in houses, upset, angry, scared. Then you add on a series of basically televised lynchings.

And then you think: This is an election year. In some ways, I’m more afraid of the situation you just described. If Donald Trump is reelected in a way that does not feel legitimate to people — if he loses by more votes than he did in 2016, or there’s a contested-vote situation — this could turn out badly. Legitimacy crises are scary things. And I don’t think we’re really well equipped for one right now.

Ta-Nehisi Coates

I agree. But when I look back historically, the alternative to me is 1968.

I think, amongst a large swath to a majority of black people in this country, the police are illegitimate. They’re not seen as a force that necessarily causes violent crime to decline. Oftentimes you see black people resorting to the police because they have no other option, but they’re not seen with the level of trust that maybe Americans in other communities bestow upon the police. They know you could be a victim to lethal force because you used a $20 bill that may or may not have been counterfeit, because you were asleep at night in your home and somebody got a warrant to kick down your door without knocking.

I would argue that [feeling] has been nationalized. I don’t know that everybody in America feels that way, but I think large swaths of Americans now feel that Trump is the police. And they feel about Trump the way we feel about cops: This is somebody that rules basically by power. I would prefer that situation to 1968, where we’re alone in our neighborhoods and we know something about the world and we know what the police do, but other folks can’t really see it — and if they can, they’re unsympathetic. I would prefer now.

The long history of black folks in this country is conflict and struggle, between ourselves and the state and other interests within the society so that we can live free. And this is the first time that I think a lot of us have felt that the battle was legitimately joined, not just by white people but other people of color. When I hear that brother in Minneapolis talk about how his store was burned down and him saying, “Let it burn.” That’s a very different world. It’s a very, very different situation. It’s not a great one. It’s not the one we want. But it’s not ‘68.

Coincidentally, I just finished reading Coates’s novel about slavery and freedom, The Water Dancer, which I highly recommend. 

⭐️⭐️⭐️⭐️⭐️I also found the just-released streaming movie Just Mercy instructive. It’s based on the true story of unjustly convicted Alabama death-row inmate Walter McMillan and his courageous young just-out-of-Harvard African-American attorney Bryan Stevenson, played by Michael B. Jordan. In the movie, as in real life, justice was achieved in the end. 

But, was it really?

Why should justice in America a be so dependent on both the “right lawyer” and the particular location and judges before whom you are tried? Why should it be so difficult, time consuming, painful, and uncertain to obtain? Why weren’t the crooked sheriff and the other perpetrators of deadly fraud held accountable? Why was such a tone-deaf judge on the bench in the first place? Why was a corrupt system not interested in real justice for the murder victim? Why do we still have the death penalty — clearly “cruel and unusual punishment” in violation of the Constitution by any rational definition? 

It’s also worth remembering that one of the greatest advocates of putting African Americans in Alabama to death was none other than White Nationalist prosecutor Jeff “Gonzo Apocalypto” Sessions. Sessions then went on to a further career involving child abuse, squandering of taxpayer funds on “gonzo” prosecutions of legal asylum seekers, and unfairly sentencing Hispanic refugee women to torture, and even death. Yet, Sessions walks free. He even has the audacity to run for public office again based on his perverted, racist views of “justice” in America.

Whether or not he, or the equally repulsive and bigoted other GOP candidate, former football coach Tommy Tuberville, get elected will be a true test of how far we have come as a nation, and in particular, how far Alabama has come in atoning for past wrongs. Anybody who cares about equal justice for all should send at least a few bucks to the re-election campaign of wholly decent, competent, U.S. Senator Doug Jones (D-AL) to help him fight the GOP “forces of darkness, racism, and inequality,” arrayed against him.

I really hope Coates is right. But, based on the “reality of the moment” we still have a long way to go.  True social justice would involve accountability for individuals like Trump, Miller, Sessions, and Barr who have been actors and proponents of injustice toward “the other” in our society. When folks like unapologetic White Nationalist provocateur Sen. Tom Cotton (R-AK) are no longer placed in public office, then, and only then, will social justice and equal justice for all have been achieved.

And, I personally doubt our capacity as a nation for true due process and equal justice under law as long as the “JR Five” rule the Supremes. So far, there haven’t been many racial injustices or “Dred Scottifications” of the other that they have had the courage and integrity to condemn! Better judges, with more humanity and empathy, are a requirement for a truly just nation.

That pandering, maliciously incompetent, willfully ignorant, bigot Donald Trump, with his vile, intentionally racially divisive message of fear still polls at 42% shows just how far we have to go to achieve due process and equal justice for all in America. “Equal Justice For All” isn’t just a “snappy slogan;” it requires leaders who really believe in it! 

Right now, save for Nancy Pelosi, we conspicuously lack such leaders in all three Branches of our National Government. Better results will require change at the top. It will also require a significant minority of voters to stop enabling the intolerant, incompetent, and divisive to rule.

As Dr. Martin Luther King, Jr., once wrote:

“Injustice anywhere is a threat to justice everywhere. We are caught in an inescapable network of mutuality, tied in a single garment of destiny. Whatever affects one directly, affects all indirectly.” 

The quote isn’t just an “abstract concept;” it has “real life” meaning. It’s from King’s Letter From Birmingham Jail, where he was unjustly imprisoned in 1963 for participation in peaceful protests against racial injustice.

“Social Justice” isn’t just an idealistic concept. It’s an absolute necessity for a well-functioning, just, and fully productive society!

This op-ed argues that the terms we use to discuss immigration rely on a lot of anti-immigrant assumptions.

The United States has a long history of hostility toward immigrants, from barringundesirables” (a shifting category that has targeted the nonwhite, the disabled, and women) to turning away desperate asylum seekers who went on to gruesome deaths. Even after these cruel laws have been rolled back (and some haven’t), they’ve fundamentally shaped the way we as a nation think of immigration. A lot of the modern policy we consider “common sense” was directly molded by this history. It means that often the terms of the immigration debate rely on a lot of anti-immigrant assumptions. Even the best-intentioned progressives can fall into these traps, which is why examining how we talk about these issues is so important.

THE NOTION THAT THERE ARE “GOOD” AND “BAD” IMMIGRANTS

One common talking point holds that we should welcome the “good” immigrants while getting rid of the “bad” or “criminal” ones. This framing obscures the realities of the U.S. justice system, which disproportionately arrests, convicts, and incarcerates people of color. Black immigrants make up just 7.2% of the noncitizen population, yet they make up over 20% of people facing deportation on criminal grounds. The “good” vs. “bad” framework also obscures how laws are an expression of class power: Financial crimes committed by wealthy individuals and corporations often go unpunished, while everyday people are often punished for their poverty. And even people convicted of crimes shouldn’t lose their humanity, especially in a system that is incentivized to incarcerate.

Anti-immigration advocates often invoke misleading language and statistics suggesting that immigrants commit more crime, while ignoring a vast legal framework set out to criminalize immigrants for minor infractions. Many studies have found that undocumented immigrants actually commit crimes at lower rates than native-born Americans, but our very definition of what constitutes a crime has grown dramatically over the past few decades. A set of 1996 laws expanded deportable offenses by reclassifying more minor crimes as “aggravated felonies” in the context of immigration. As a result, immigrants can be considered felons for acts like drug possession or failing to appear in court.

DISTINGUISHING “REAL” REFUGEES FROM ECONOMIC MIGRANTS

Another dangerous misconception is the differentiation between “real” refugees (people whose search for safety we consider valid) and “economic migrants,” who are perceived as “gaming the system” to obtain a higher standard of living in America. This is a fundamentally false dichotomy: People, and the systems we live in, are far too complex to fit in these binaries. Who gets to be considered a “real” refugee is significantly informed by America’s ideological attitudes; for decades, the system was based more on Cold War politics than any real concern for the safety of asylum seekers. Those fleeing political or religious persecution are seen as legitimate, while those fleeing violent crime or a lack of economic opportunity — causes that also have political roots — are, too often, not. It’s a pattern that continues today: People coming to the U.S. from countries where America has vested geopolitical interests have historically had a harder time gaining asylum than those from countries the U.S. ideologically opposes, even if they have strong claims of persecution.

This hierarchy has stark consequences. As the bar becomes ever higher for who is a “true” refugee, many who flee certain death are turned away. Meanwhile, those who flee “less serious” violence, like poverty and starvation, often have no avenue for help. Their experiences expose the glaring gaps in our asylum policy. Why should certain types of violence be taken more seriously than others? Who is to say that the fear of gang violence is worse than that of not being able to feed your children?

Whether you accept Uhlmann’s conclusions or not, her point that immigrants’ advocates often accept the terms and framework set forth by nativists and restrictionists is basically valid. One false concept that appears to govern much of the debate is that immigration is fundamentally “negative” and therefore 1) must be limited to those who can provide immediate economic benefits to us (leaving aside the range of human interests of the immigrants themselves), and 2) that any increases in “desirable” immigration must be offset by cuts, restrictions, and/or removals of “undesirables.” 

In many ways, this explains the sad failure of the Obama Administration to adopt more humane and effective immigration policies. They apparently never could get over the idea that they had to “prove their toughness” by deporting record numbers of folks and inflicting some gratuitous cruelty on migrants, particularly helpless asylum seekers, to “establish their creds” and get the GOP to the table to discuss serious immigration reform. No chance!

With restrictionists, even record levels of removals and historically low levels of border apprehensions are “never enough.” That’s because they are coming from a place of ideological nativism which is neither fact nor reality driven. It’s driven by inherent biases and nativist myths.

Overall, immigration is both a human reality — one that actually predated the establishment of “nation-states” — and a plus for both the immigrants and the receiving countries. 

That being said, I personally think that immigration should be robust, legal, humane, and orderly. But, I doubt that “immigration without limits” is politically realistic, particularly in today’s climate.

Generally, global “market forces” affect immigration much more than nativists are willing to admit. When the legal system is too far out of line with the realities of “supply and demand” the excess is simply forced into the “extralegal market.” 

That’s why we have approximately 11 million so-called “undocumented immigrants” residing in the U.S. today. Most are law abiding, gainfully employed, and have helped fuel our recent economic success. Many have formed the backbone of the unheralded “essential workforce” that has gotten us through the pandemic to this point. Many pay taxes now and all could be brought into the tax system by wiser government policies.

That’s why the mass removals touted by Trump and his White Nationalists are both impractical and counterproductive, as well as being incredibly cruel, inhumane, and cost ineffective. 

There is a theory out there that although Trump’s uber-enforcement policies might be doomed to long-term failure, he is “succeeding” in another, much more damaging, way. By attacking the safety net, government, education, science, the environment, worker safety, and the rule of law while spreading racism, xenophobia, divisiveness, and maximizing income inequality, Trump has finally succeeded in making the U.S. a less desirable place for “immigrants with choices” to live. 

As Bill Gelfeld wrote recently in International Policy Digest:

This pandemic has laid bare national weaknesses, and these weaknesses will have not gone unnoticed by potential and future migrants. Where they have a choice, and many skilled and even unskilled migrants do indeed have a choice, they will increasingly opt for those locales that have figured out universal health care, pandemic and crisis response, and unified national action, and these are the nations that now stand to gain from this migratory boon. https://apple.news/AiY6v3tN0SU6ES08RMUe29g

In the “post-pandemic world economy,” as our birthrate continues to go down and we need immigrants to fuel continued economic growth, the U.S. might well find itself losing the international competition for immigrants, particularly those we most want to attract. 

The latter is likely if we give in to the restrictionist demand that we cut legal immigration. That simply forces more immigrants into the “extralegal market.” “Immigrants with choices” are more likely to choose destinations where they can live legally, integrate into society, and fully utilize their skills over a destination that forces them to live underground.

On April 7, 2020, Amnesty International issued a report, ‘We are adrift, about to sink’: The looming COVID-19 disaster in US immigration detention facilities, documenting how the Trump administration was failing to adequately protect tens of thousands of immigrants and asylum- seekers whom the U.S. Department of Homeland Security’s (“DHS”) Immigration and Customs Enforcement (“ICE”) agency was detaining in over 200 detention centers across the United States.1

Three of these facilities detain families, including infants as young as 1-year-old who are still breast-feeding. Deceptively named “family residential centers” (FRC), these detention facilities are: the Berks County Residential Center (“Berks”) in Leesport, Pennsylvania; the South Texas Family Residential Center (“Dilley”) in Dilley, Texas; and the Karnes County Residential Center (“Karnes”) in Karnes City, Texas.

While the dangerous conditions in immigration detention remain little changed since Amnesty International published its April report, ICE has now introduced a new element of harm: family separation. Once again, this administration is weaponizing its public health response to COVID- 19 to punish and deter people seeking safety.

New Jersey Sen. Cory Booker said he is planning to introduce legislation on Wednesday that would expand legal immigrants’ access to health care subsidy programs and allow unauthorized immigrants to buy health plans from federal insurance marketplaces.

The bill, known as the HEAL for Immigrant Women and Families Act, would permit legal immigrants to enroll in Medicaid and the Children’s Health Insurance Program (CHIP), provided that they meet the programs’ income requirements. Rep. Pramila Jayapal introduced the bill in the House in October 2019, but it would be the first time that the Senate would consider the legislation.

The bill isn’t likely to advance in a Republican-controlled Senate, where Senate Majority Leader Mitch McConnell has already rejected relief for unauthorized immigrants. But it’s the latest effort by Democrats to rectify inequalities in access to health care laid bare by the coronavirus pandemic.

Only a fraction of immigrants is eligible for Medicaid and CHIP: naturalized citizens, green card holders who have lived in the US for at least five years, immigrants who come to the US on humanitarian grounds (such as receiving asylum), members of the military and their families, and, in certain states, children and pregnant women with lawful immigration status. But many other categories of immigrants — including temporary visa holders and young immigrants who have been allowed to live and work in the US under the Deferred Action for Childhood Arrivals program — would become eligible under Booker’s bill.

“Covid-19 has shined a punishing light on the unjust health care inequities that exist for communities of color broadly, and immigrant communities in particular,” Booker told Vox. “While we should always be working to expand access to health care for everyone, the dire current situation highlights the urgency of addressing these gaps in health care coverage. Health care is a right, and it shouldn’t depend on immigration status. We’re never going to be able to slow and stop the spread of the virus be if we continue to deny entire communities access to testing, treatment, or care.”

The bill also contains provisions expanding health care options for unauthorized immigrants, who are often uninsured and have so far been largely left out of Congress’s coronavirus relief efforts. Booker’s bill would allow them to buy health insurance on the Affordable Care Act marketplace, from which they’re currently barred. It would also allow unauthorized immigrants to become eligible for health care subsidies if they have purchased such an insurance plan and meet other criteria, including minimum income requirements.

Few groups in America have been as screwed over as migrants, regardless of status, in this pandemic. They perform some of the most difficult and essential jobs that have kept us going through this crisis. But, when it comes to safety, stimulus, health care, unemployment and pretty much anything else they are left out in the cold by the GOP nativists.

Get back to work: no PPE, social distancing, hazard pay, testing, unemployment benefits, home computers, or health care for you! This isn’t the “GOP playing Soup Nazi” – it’s the real deal, the 21st Century version of completely expendable workers and intentional “dehumanization” of the “other.”  Already, xenophobic GOP nativists are whining about the very modest economic emergency money that the State of California has provided to their migrant residents, many “essential workers,” regardless of status.

But, Booker’s HEAL bill is a significant “ready for prime-time marker” if we get regime change! Health care and immigration are huge issues in the Hispanic community. Biden needs to get out the Hispanic vote and having legislation like this “ready to roll” on “Day 1” will be key in energizing voters to “work through the obstacles” and vote Trump & the GOP Senators out in the key states to finally get some much needed aid out to the American Hispanic community and others, including folks in rural areas of so-called “Red States,” and disproportionately adversely affected African-American communities in need who are excluded from “Trump’s America” (except, of course, when the chips are down and we need workers for thankless jobs or when Trump needs votes). You can also add in Asian Americans who have been working hard for America but face a barrage of racist-inspired incidents. There’s a “community of interest” there that the Dems’ should be able to attract and build upon with “good government” that furthers the common interests.

The last time Sandra Rodríguez saw her son Gerson, she bent down to look him in the eye. “Be good,” she said, instructing him to behave when he encountered Border Patrol agents on the other side of the river in the United States, and when he was reunited with his uncle in Houston.

The 10-year-old nodded, giving his mother one last squinty smile. Tears caught in his dimples, she recalled, as he climbed into a raft and pushed out across the Rio Grande toward Texas from Mexico, guided by a stranger who was also trying to reach the United States.

Ms. Rodríguez expected that Gerson would be held by the Border Patrol for a few days and then transferred to a government shelter for migrant children, from which her brother in Houston would eventually be able to claim him. But Gerson seemed to disappear on the other side of the river. For six frantic days, she heard nothing about her son — no word that he had been taken into custody, no contact with the uncle in Houston.

Finally, she received a panicked phone call from a cousin in Honduras who said that Gerson was with her. The little boy was crying and disoriented, his relatives said; he seemed confused about how he had ended up back in the dangerous place he had fled.

Hundreds of migrant children and teenagers have been swiftly deported by American authorities amid the coronavirus pandemic without the opportunity to speak to a social worker or plea for asylum from the violence in their home countries — a reversal of years of established practice for dealing with young foreigners who arrive in the United States.

The deportations represent an extraordinary shift in policy that has been unfolding in recent weeks on the southwestern border, under which safeguards that have for decades been granted to migrant children by both Democratic and Republican administrations appear to have been abandoned.

Historically, young migrants who showed up at the border without adult guardians were provided with shelter, education, medical care and a lengthy administrative process that allowed them to make a case for staying in the United States. Those who were eventually deported were sent home only after arrangements had been made to assure they had a safe place to return to.

That process appears to have been abruptly thrown out under President Trump’s latest border decrees. Some young migrants have been deported within hours of setting foot on American soil. Others have been rousted from their beds in the middle of the night in U.S. government shelters and put on planes out of the country without any notification to their families.

The Trump administration is justifying the new practices under a 1944 law that grants the president broad power to block foreigners from entering the country in order to prevent the “serious threat” of a dangerous disease. But immigration officials in recent weeks have also been abruptly expelling migrant children and teenagers who were already in the United States when the pandemic-related order came down in late March.

Since the decree was put in effect, hundreds of young migrants have been deported, including some who had asylum appeals pending in the court system.

Some of the young people have been flown back to Central America, while others have been pushed back into Mexico, where thousands of migrants are living in filthy tent camps and overrun shelters.

In March and April, the most recent period for which data was available, 915 young migrants were expelled shortly after reaching the American border, and 60 were shipped home from the interior of the country.

During the same period, at least 166 young migrants were allowed into the United States and afforded the safeguards that were once customary. But in another unusual departure, Customs and Border Protection has refused to disclose how the government was determining which legal standards to apply to which children.

“We just can’t put it out there,” said Matthew Dyman, a public affairs specialist with the agency, citing concerns that human smugglers would exploit the information to traffic more people into the country if they knew how the laws were being applied.

On Tuesday, the Trump administration extended the stepped-up border security that allows for young migrants to be expelled at the border, saying the policy would remain in place indefinitely and be reviewed every 30 days.

Chad F. Wolf, the acting secretary of the Department of Homeland Security, said the policy had been “one of the most critical tools the department has used to prevent the further spread of the virus and to protect the American people, D.H.S. front-line officers and those in their care and custody from Covid-19.”

An agency spokesman said its policies for deporting children from within the interior of the country had not changed.

Kids suffer, the law is ignored, corrupt bureaucrats like Chad Wolf continue to wander around spreading lies. There is no evidence that any of those kids “rocketed” out of the country in violation of laws and human rights had coronavirus. 

And if they did, returning them to a poorer nation with even fewer resources to fight the pandemic without taking proper precautions and safeguards would be totally irresponsible, inhumane, and ultimately counterproductive. What goes around, comes around! 

This has absolutely nothing to do with “protecting” the U.S. from coronavirus (something that Trump otherwise largely eschews) and everything to do with advancing a racist, xenophobic, White Nationalist political agenda designed to appeal to a relatively narrow slice of Trump voters. So, how does this pass “legal muster?” Clearly, “It doesn’t!”

How do folks like Trump, Miller, Wolf, and their accomplices get away with it? Easy when GOP legislators and life-tenured Federal Judges look the other way rather than forcing the regime to comply with the rule of law and simple human decency. 

Congressional letters, particularly to a lawless regime, are useless unless accompanied by veto-proof legislation. Courts that fail to take a unified “Just Say No” approach to Trump’s systemic abuses, all the way up to the Supremes, and which rule without holding the officials and lawyers masterminding these abuses legally accountable are basically feckless! 

These are not difficult questions from either a legal or moral standpoint. What the Administration is doing is wrong! Period! Those who say otherwise are wrong! Period!

The Trump regime disguises their vicious attacks on human dignity and the rule of law as bogus “legal issues.” And, the Federal Courts encourage them by going along with the charade. This is no “normal Executive.” It’s a “rogue regime” and must be treated as such!

The failure to end these disgraceful practices and hold those who are abusing their authority accountable says much about the current state of our democratic institutions, justice system, civil servants, and the inadequacy and moral complacency of many of our current GOP legislators and Federal Judges.

The use of executive branch power to wage a war on immigrants is one of the defining legacies of President Trump. He went on the offensive under the disguise of the coronavirus pandemic to advance his policy priority to significantly restrict legal immigration to the United States. This politically motivated maneuver violates federal and international law, and this is also morally reprehensible and disastrous for the domestic economy at home.

It is not just health care that needs immigrants. A recent study found that the majority of economic growth between 2011 and 2016 is due to greater labor supply due to immigration. Immigrants also assist the country with innovation. They are twice as likely to start a business, to receive a Nobel Prize or Academy Award, or to receive a patent than native born workers.

Denying protection to individuals fleeing persecution based on potential public health grounds sends dangerous signals to oppressors and rogue nations that they are free to act with impunity because powerful nations are unwilling to protect their victims. Refugees searching for protection are built in the collective responsibility of the international community, even in any period of public crisis. Efforts by the president to renounce these duties are morally wrong and politically dangerous for the world.

Waging a war on immigrants will not protect us from the coronavirus. It instead puts individuals fleeing harm in further danger and weakens the economy of the United States. Immigrants are part of the solution to the challenges we face today and should be welcomed rather than banned.

WHAT IT COVERS AND HOW IT DISTRACTS FROM EFFECTIVE LEADERSHIP

Who is Barred by the Order?

The Order is relatively short and bars the following foreign nationals from immigrating permanently to the United States:

• Foreign Nationals Overseas Who Lack an Immigrant Visa or Green Card. With the exceptions discussed below, the Order applies to foreign nationals who do not have an immigrant visa or green card. Unless you are covered by an exception, you are barred from entering the United States as an immigrant even if you are processing, or planning to process, an immigrant visa at a US consul abroad. These visas could be through employment sponsorship, family sponsorship, or the Diversity Visa (DV) green card lottery as discussed below.

• Foreign nationals outside the United States. The Order only applies to individuals who were outside the US on April 23d, the date of issuance. Presumably, someone in the United States on that day could go home today, apply for an immigrant visa at the US Consulate there, and not be barred by the Order.

Who is Not Barred by the Order?

• Anyone in the United States on April 23. This bears repeating. If you are in the United States, you remain eligible to adjust your status to lawful permanent residence or, presumably, to apply for an immigrant visa abroad (discussed below).

 confusion among immigrants and their families, US businesses, and the immigration bar. On April

 23d, Mr. Trump issued his Order.1 Now that we’ve had a chance to review it, we want to break it

 down and explain who it does and does not cover, how it does nothing to make us safer or

 strengthen the economy, and how it is another log on the anti-immigrant fire and a thinly-veiled

 distraction from the lack of effective leadership to actually combat the Coronavirus.

  “Proclamation Suspending Entry of Immigrants Who Present Risk to the U.S. Labor Market

 During the Economic Recovery Following the Covid-19 Outbreak

 

 • Nonimmigrants. It is very important to note that the Order does not prevent nonimmigrants from entering the United States. As explained below, nonimmigrants are foreign nationals who enter the United States on a temporary basis and lack intent and permission to remain permanently.

• Anyone with an Immigrant Visa. You can immigrate if you already have an immigrant visa. An explanation of the green card process is helpful to understand this exception.

The Immigrant Visa (Green Card) Process. The process typically begins when the sponsor (e.g. an employer or US Citizen spouse) files an immigrant visa petition in the United States asking the US Citizenship and Immigration Services (USCIS) to find that the foreign national beneficiary satisfies the requirements for classification in a certain immigrant category, such as an outstanding researcher or the spouse of a US Citizen. On approval, when the beneficiary reaches the front of the visa waiting line (or if there is no line), he or she applies for permission to immigrate either through “adjustment of status” or “consular processing.” If the beneficiary is in the United States, in H-1B visa status for instance, s/he can apply to USCIS to “adjust” his or her status to lawful permanent residence. On approval, s/he will receive a green card. If the beneficiary is overseas, however, s/he must apply to the US Consulate in his or her home country for an immigrant visa. On approval, s/he will be granted an immigrant visa, can be physically admitted to the United States as a lawful permanent resident and will soon get a green card in the mail.

Anyone who is overseas and already has received an immigrant visa is exempt from the Order and can immigrate. (But keep in mind that the immigrant visa must be used within 6 months of issuance, which can be a problem given current global travel restrictions).

• Lawful Permanent Residents. The Order also does not apply to you if you already have a green card, lawful permanent residence or, as noted, an immigrant visa.

• US Military Members. If you are a member of the US military (or the spouse or child of a servicemember), the Order doesn’t apply to you.

• Healthcare Workers. The Order doesn’t apply to anyone overseas (and most immediate family members) who seeks an immigrant visa:

 as a doctor, nurse or other healthcare professional

 to perform COVID19 research

 to perform work essential to combating or helping patients with COVID19.

• Job Creation Investors. The Order does not apply to anyone who has an approved “EB-5” petition. This visa category if for foreign nationals who invest $1 million (or less in economically depressed areas) in projects that will create jobs for US workers.

 

 • Special Immigrants. The Order does not apply to anyone certain individuals who see to immigrate under USCIS “Special Immigrant” programs, and their spouses and children:

 Afghanistan or Iraq nationals who supported the US Armed Forces as translators  Iraq nationals who worked for or on behalf of the US Government in Iraq2

• Law Enforcement Aid. The Order does not apply to you if you can satisfy the US Government that your immigration will advance important law enforcement objectives.

• National Interest. The Order doesn’t apply to you if you can show that your entry would be in the national interest.

• Holders of Advance Parole or other Travel Document. The Order does not apply to any foreign national who is overseas but who has Advance Parole or other official travel document.

• Asylees and Refugees. By its terms, nothing in the Order can limit the rights of asylees, refugees and foreign nationals that seek other forms of humanitarian relief. The Trump Administration’s assault on these forms of relief makes this suspect.

• Spouse and Children of US Citizens. The Order does not apply to a spouse, minor child or prospective adoptee of a US Citizen. In an especially harsh stroke, the Order bars from entry the parents of US Citizens and all family members of Lawful Permanent Residents (discussed below).

The Order gives the US Consul the authority to decide if any of the above exemptions applies.

ANALYSIS

The Order is a Harsh and Illusory Distraction from Failed Leadership and Does not Advance its Stated Purpose

A close look at the Order reveals the actual limits of its reach and shows that it fails to promote its stated purpose. This leads to the inescapable conclusion that the Order is primarily a distraction from a failure of leadership in the war on Covid-19 and yet another log on the anti-immigrant fires.

The Order’s Limited Reach. The Trump Administration effectively gutted overseas visa processing more than one month ago when, on March 20, it suspended routine visa services at US Consulates around the world in response to the pandemic.3 Since then, absent an emergency, immigrant visa

applicants have been practically prevented from processing their cases and immigrating to the United States. Thus, although it is not readily apparent, the Order does little if anything to further curtail immigration.

The number of foreign nationals who are NOT affected by the Order also suggests that its surrounding fanfare is a lot of white noise. This is because it only bars “immigrants” but not “nonimmigrants” who comprise the vast majority of foreign nationals who enter the United States. Immigrants, a/k/a lawful permanent residents or green card holders, are those admitted to the United States on a permanent basis. To be eligible, they must meet the highly demanding requirements of a legal visa category. These can be based on a hard-to-fill job offer, extraordinary contributions, a close family relationship to a US Citizen or lawful permanent resident, a US investment that will create jobs, humanitarian considerations or a few other grounds. Nonimmigrants, on the other hand, enter the United States temporarily for a specific purpose. These include highly skilled H-1B professionals, certain investors, business visitors and tourists, and students, and their family members, to name a few.

The number of immigrants to the United States is dwarfed by the number of nonimmigrants who enter temporarily and are allowed to remain for various periods. Just over 1 million immigrants are admitted to the United States annually; more than 186 million nonimmigrants are admitted in a typical year. During the most recent year for which data is available, 90% of nonimmigrants were visitors for business or pleasure, and a small handful were temporary high-skilled workers, some agricultural workers and students, with their families. Currently, about 2.3 million nonimmigrants reside in the United States. i Thus, the exemption of nonimmigrants from the Order underscores its limited reach and its true purpose of distracting from failed leadership and appealing to anti- immigrant sentiment during an election cycle.

The Order is Temporary. Additionally, the Order is limited to 60 days, although it could be extended. By its terms, it was designed to protect job opportunities for marginalized US workers during record unemployment. Whether it will be extended most likely will depend on the state of the US economy, although we fear that political considerations will come into play.

The Order Fails to Promote its Stated Purpose. As its title shows, the Order is designed to protect jobs for US workers. The preamble states that the Order was designed to protect unemployed marginalized Americans, from competing for jobs during high unemployment. However, the Order fails to accomplish this end.

First, the Order shuts the door to the best and the brightest and the most highly educated from around the world and a host of others who will not compete for jobs with marginalized US workers. These include foreign nationals with demonstrated “extraordinary ability,” outstanding researchers, multi-national managers, advanced degree workers and those with exceptional ability and a college- education, all of whom are barred from entering in what are known as the “EB” or employment- based immigrant visa categories. While these workers could boost the economy, they clearly will not take jobs from the marginalized American worker.

  

 Second, the Order assumes that immigrants will seek to work once they get here. While some will, the Trump Administration’s exceedingly onerous “public charge” requirements make this a disingenuous basis for banning their immigration. As a general rule, an immigrant visa applicant must show that s/he will not become a “public charge.” This now requires voluminous evidence that the intending immigrant can support himself or herself and his or her household with an unprecedented degree of assets and income or that the sponsor can provide this level of support. Immigrants who are in a position to meet this high threshold are unlikely to compete with marginalized workers for low-skilled jobs. Accordingly, it is dishonest and cruel to close the doors to all immigrants, including family-based immigrants, based on an outcry for marginalized worker job protection. Rather, in barring all family-based immigrants other than the spouses and children of US Citizens, the Order accomplishes one of Mr. Trump’s long-stated goals of ending what he calls “chain migration.” Parents of US citizens, who have long been a preferred category under US immigration law, are barred by the Order. So are adult children of US Citizens, siblings of US citizens, as well as spouses and children of permanent residents. Congress has passed laws allowing these parents, children, husbands and wives to immigrate to join their families in the United States. The Order eviscerates this law and policy without reason.

Conclusion

Mr. Trump’s Order suspending immigration to protect the US labor market during the coronavirus pandemic is the legal equivalent of ear candling to treat liver disease. Neither works, and both are dangerous.

Fans of ear candling use a hollow candle to drip hot wax in the ear. They claim it creates negative pressure and funnels out unwanted ear wax. But there’s no evidence that it works. Additionally, the FDA warns that it can block the ear canal, puncture the eardrum and cause other injuries. And it has nothing whatsoever to do with liver disease.

Mr. Trump’s new Order, likewise, is unhealthy for us as a nation and economically toxic. It does nothing to protect job opportunities for marginalized Americans, which is its stated purpose. Instead, it closes our borders to the best and the brightest whose very help we need to wrestle the virus to the mat. It also cruelly separates families.

The corona virus does not discriminate on the basis of immigration status. Mr. Trump should behave accordingly.

What we really have here is an “Eternal Reichstag Fire.” 🔥 The Clown in Chief 🤡 continues to use bogus “emergencies,” as “greenlighted” by the “J.R. Five” on the Supremes, to suspend the rule of law and “govern” by Executive decree.

This looks less like the “immigration bar” tweeted by Trump for the benefit of his “base” and more like “Phase  I” of Stephen Miller’s draft White Nationalist rewrite of the permanent immigration system. It’s basically a way of reducing permanent immigration by “picking on” relatives of U.S. green card holders, adult relatives (other than spouses) of US citizens, DV Lottery winners, and limiting “employment-based” permanent immigration to certain medical professionals, researchers, and “big investors.”

The attack on family immigration, at the core of our traditional immigration system and a source of both economic strength and diversity, is basically what has become the racist trope of “eliminating chain migration.” What it really means is attempting to restrict migrants of color for a “whiter, more Christian” America, long a dream of Miller and the White Nationalist hate groups he has been associated with.

Miller’s nativist program was resoundingly rejected by a bipartisan majority of Congress. But now, with the “J.R. Five” firmly in their pocket, and Congress largely in a state of permanent suspension when it comes to anything other than handing out money, Trump and Miller plan to rewrite the legal immigration system, piece by piece, using Executive decrees propped up by a bogus, but never ending, “employment national emergency.” 

On the other hand, by allowing the admission of  “non- immigrants” the order recognizes that we will continue to need migrants and their industry and skills at all levels of our economy as we recover. But, they will be relegated to a more subservient status where they are beholden to employers and can’t qualify to become permanent members of our society and eventually citizens. In other words, insuring that migrants coming to America will remain exploitable and disenfranchised. This fits right in with Stephen Miller’s White Nationalist playbook. 

Once the bogus declaration of “immigration emergency” has been invoked as “temporary,” it never ends. But, with Roberts and his gang of right wing authoritarian enablers determined to “look the other way,” don’t expect any loosening until we stand up and rid ourselves of the Trump kakistocracy at the ballot box (unless Trump gets away with burning that too).

A corrupt and cowardly Supremes’ majority and a feckless Congress led by “Moscow Mitch” are allowing Trump’s “misrule by decree” similar to the Third Reich. And of course “the other” — immigrants — are the primary target.

But, this is also by implication directed at drumming up hate and resentment against Hispanic Americans, all Americans of color, and Muslims, etc. In other words, the “usual suspects” for the White Nationalists. This “Eternal Reichstag Fire” 🔥of hate, lies, scapegoating, and authoritarianism will continue burning and consuming our democracy and its institutions unless and until we get “regime change.”

This November, vote like your life depends on it. Because it does!

They are children who were caught crossing the southwest border without papers and sent to migrant shelters in New York when the coronavirus was silently spreading. Now the city is a pandemic epicenter in lockdown, but the Trump administration is pressing ahead with their deportation cases, forcing the children to fight in immigration court to stay.

In two courthouses in the center of the besieged city, hearings for unaccompanied children—migrants who were apprehended without a parent—are speeding forward. The U.S. Department of Justice, which controls the immigration courts, has said it has no plan to suspend them.

This week an 8-year-old, a 5-year-old, and a teenage single mother with an infant were preparing for imminent court dates and deadlines in New York, lawyers representing them said. With children trapped indoors in shelters and foster-care homes, many young migrants who don’t have lawyers may not even be aware of ongoing court cases that could quickly end with orders for them to be deported.

Hearings for unaccompanied children are also proceeding in courts in other COVID-19 hotspots, including Los Angeles, San Francisco, Seattle, Chicago and Boston.

The Executive Office for Immigration Review, the Justice Department agency in charge of the immigration courts, has rejected calls from judges, prosecutors and immigration lawyers to shut down courts nationwide. Although hearings for immigrants who are not detained have been suspended through May 1, cases of people in detention are going forward at the same accelerated pace as before the pandemic.

That includes many unaccompanied children. Since last year, Trump administration officials have instructed the courts to treat those children as detained if they are in shelters or foster care under the custody of the Office of Refugee Resettlement, or ORR, a federal agency. Immigration judges are under pressure to complete detained cases within 60 days—warp speed in immigration court—with no exception for children.

Across the country, about 3,100 unaccompanied children are currently in the custody of the refugee agency. Many have run from deadly violence and abuse at home and hope to find safety with family members in the United States. The demands for them to meet fast-moving court requirements are causing alarm among lawyers, caregivers and families.

“It is inexplicable and dangerous that the Trump administration has insisted that detained unaccompanied children are still required to go to court,” said Wendy Young, president of Kids in Need of Defense, or KIND, which helps provide lawyers for unaccompanied children. Unlike in criminal courts, in immigration court children have no right to a lawyer paid by the government if they cannot afford one.

On April 8, the American Immigration Lawyers Association, the immigration bar, and other legal groups asked a federal court for a temporary restraining order to force the Justice Department to suspend in-person hearings of detained immigrants during the pandemic.

Justice Department officials say they are holding hearings for immigrants in detention, including for children, so they can get their cases decided and perhaps be freed quickly.

The idea, as DOJ claims, that this is being done to facilitate the “freeing” of kids is preposterous on its face.

First, there is nothing stopping them from arranging placements for children without the Immigration Court hearings being completed. It used to be done all the time.

Second, the DOJ has intentionally and unethically rewritten asylum laws through “precedents” aimed primarily at making it harder to qualify for asylum. This abuse of process particularly targets those fleeing persecution resulting from various types of systematic government and societal violence in Central America. The approval rates for these types of cases have fallen to minuscule levels under Trump.

Third, no child has any chance of succeeding in Immigration Court without a lawyer. Almost all lawyers who represent children in Immigration Court serve “pro bono” — or work for NGOs who can only provide minimal salaries. 

Yet, the Administration is making these lawyers risk their health and safety, while artificially accelerating the process, all of which actively and aggressively discourages representation. 

Added to that is the constant “Aimless Docket Reshuffling,” with Immigration Courts closing, reopening, and re-closing on a moment’s notice and dockets constantly being rearranged as judges, court support staff, interpreters, and DHS lawyers fall ill.

The Administration could work with groups like KIND and other NGOs to arrange placements, and schedule hearings in a manner that promotes health and safety for everyone while maximizing due process. But, the Administration refuses to do this. 

Instead, those seeking to inject sanity, common sense, best practices, and human decency into the process are forced to sue the Administration in Federal Court. This further dissipates and diverts already scarce legal resources that could have been used to actually represent children in Immigration Court and arrange safe placements for them.

Finally, as I have noted previously, the Administration has simply suspended the operation of the Constitution and the rule of law at the borders. This means that thousands, including unaccompanied children, are “orbited into the void” without any process whatsoever or any effort to ascertain their situations or best interests.

All of this gives lie to the Administration’s bogus claim that this is about looking out for the best interests of these kids. No, it’s about maximizing cruelty, destroying lives (considered an effective and acceptable “deterrent” in nativist circles), and carrying out a noxious racist White Nationalist restrictionist immigration agenda.

And, to date, Congress and the Federal Courts, both of which have the power to put an end to this disgraceful, unlawful, and unconstitutional conduct have been largely “MIA.”

Nevertheless, thanks to courageous and dedicated journalists like Julia and organizations like KIND, a public record is being made. While those responsible for implementing and enabling these abuses directed at the “most vulnerable of the vulnerable” among us are likely to escape legal accountability, they will eventually be tried and found wanting in the “court of history.”

No case in the Supreme Court’s current docket has higher stakes for human life in the era of COVID-19 than its upcoming ruling on the fate of so-called Dreamers—young undocumented immigrants brought to the United States as children through no fault of their own, and who remain shielded from deportation thanks to a program President Barack Obama instituted in 2014.

A highly unusual letter made its way to the justices late last month, after the case had already been briefed, argued, and for which a decision is already in the works. Lawyers for a group of beneficiaries of the Deferred Action for Childhood Arrivals program, known colloquially as DACA, wrote to the justices to warn about the dire consequences that a ruling in favor of Trump would have on the roughly 27,000 health care workers who happen to be DACA recipients. Among them are doctors, nurses, paramedics, and others on the front lines of combating the rapid spread of COVID-19 across the country. “Termination of DACA during this national emergency would be catastrophic,” the lawyers wrote.

The letter wasn’t just an appeal to the justices’ humanity and sense of fairness—after all, like the rest of us, they themselves have had to cancel public hearings, practice social distancing, and adjust to telework. But the filing also brought to bear a legal requirement the Trump administration had to weigh, but didn’t, when the Department of Homeland Security first announced the wind-down of DACA: the multitude of “reliance interests” that the government had created when it instituted the program—not just for recipients who have built their livelihoods around it, but the scores of local governments, businesses, and institutions that rely on so-called Dreamers for their own day-to-day functioning. “The public health crisis now confronting our nation illuminates the depth of those interests as borne by employers, civil society, state, and local governments, and communities across the country, and especially by health care providers,” the lawyers wrote in their letter, which also listed examples of health care workers who would be at risk of losing it all if the Supreme Court somehow agreed with the arguments the Trump administration has made in its years-long bid to terminate DACA.

A pair of recent analyses by the Center for Migration Studies and the Center for American Progress broadened the lens and found that the number of DACA recipients who qualify as essential workers during the pandemic could reach hundreds of thousands, as many of them also work in the health industry as food preparers, custodians, or in administrative roles, or otherwise in the fields of education, manufacturing, transportation, food retail, or the hard-hit restaurant industry. Some of these health care professionals, like others in the trenches, have begun to speak up. “I am treating people suspected of having COVID-19, and all I’m asking is to stay in this country and provide that care,” Veronica Velasquez, a 27-year-old physical therapist at a Los Angeles community hospital, told USA Today. “We’re definitely helping them stay alive.” Speaking to the New York Times in the middle of his shift, Aldo Martinez, a 26-year-old paramedic in Florida who was brought to the U.S. when he was 12, seemed to make a direct appeal to the justices. “It’s imperative that the Supreme Court take account of conditions that did not exist back in November,” he said. “It seems nonsensical to invite even more chaos into an already chaotic time.”

The pandemic was unforeseen at the time the justices considered the DACA dispute in November and could well change the calculus for how the Supreme Court ultimately rules in the case. But the issue of “reliance,” which federal agencies promulgating or rolling back policy are required to consider under administrative law, is not new to the case. The words reliance or reliance interests came up dozens of times at the oral argument in November, with some justices appearing rightly concerned that the Trump administration did not engage in the due diligence federal law demands when rescinding a policy on which people’s lives, the economy, and other third parties depend. At the hearing, Justice Stephen Breyer articulated what the law expects in these circumstances. “When an agency’s prior policy has engendered serious reliance interests,” Justice Breyer said, quoting from a decade-old opinion by the late conservative stalwart Justice Antonin Scalia, “it must be taken into account.” Justice Scalia added in his original 2009 opinion “that a reasoned explanation is needed for disregarding facts and circumstances that underlay or were engendered by the prior policy.” In other words, explain to the public why the current reality doesn’t affect your thinking for what you’re trying to do.

But when one reads the 2017 memorandum that rescinded DACA, or a later one that purported to better explain the termination, there’s no indication anywhere that the Trump administration took into account the human, economic, and social costs of leaving so many people—many of them with jobs, small businesses, American families, and ties to the community—unprotected. Later reporting by the New York Times revealed that a key actor in the deliberations to end DACA, then Acting Homeland Security Secretary Elaine Duke, was herself deeply conflicted with signing her name to the anti-immigrant rationales that the White House, Stephen Miller, and then Attorney General Jeff Sessions advanced for rolling back the program—none of whom, it would seem, took into consideration the myriad harms that would flow from that decision.

Courts in California, New York, and Washington, D.C., took notice of these self-inflicted flaws and allowed DACA to remain in the books. “As a practical matter,” wrote a Brooklyn federal judge in early 2018, “it is obvious that hundreds of thousands of DACA recipients and those close to them planned their lives around the program.” United States District Judge John Bates, an appointee of President George W. Bush, wrote in an opinion leaving DACA in place that the Trump administration showed “no true cognizance of the serious reliance interests at issue here”—and worse, that “it does not even identify what those interests are.”

The Trump administration’s evident failure to own up to the human cost of its policy choices and to spell them out clearly has now given the Supreme Court an opportunity to fix the mess. But as Joe Biden suggested in a statement shortly after the DACA letter was filed, the justices cannot just close their eyes to a reality that was not before them when they first took up the case: a pandemic that has touched every single one of us—and that has fallen hardest on those providing needed medical care. “If the Supreme Court upholds President Trump’s termination of DACA in the midst of a national public health emergency, it will leave a gaping hole in our health care system that is liable to cost American lives,” Biden said.

At the very least, the justices could discard the bare-bones justifications offered by the Trump administration for doing away with DACA and make him and his administration show their work. In the letter filed with the Supreme Court at the end of March, the lawyers suggest a sort of middle ground: a new round of legal arguments in writing addressing “whether remand to the agency for reconsideration of its decision to terminate DACA is appropriate in light of the extraordinary public health emergency.” In an interview, Muneer Ahmad, a Yale law professor who is a signatory to the letter, suggested that New York, where his clients reside, is a kind of ground zero that would be instructive for the justices. “New York is both an epicenter for Dreamers and DACA recipients and an epicenter of the pandemic,” he told me.

Trump may not want to take full responsibility for the federal response to the coronavirus. But the DACA controversy, at its very core, is about political accountability—about how the law requires the president and his government to take ownership of their policy choices, even those that harm others. During the hearing to consider DACA’s fate, Justice Sonia Sotomayor alluded to the realpolitik dimensions of ending the program when she asked Noel Francisco, Trump’s chief Supreme Court lawyer, to articulate the administration’s rationale for trying to end the program. “Where is the political decision made clearly?” she asked. “That this is not about the law; this is about our choice to destroy lives.”

Here’s an excerpt from Linda’s analysis of the Supreme mockery of justice in the recent Wisconsin voter case, RNC v. DNC:

In more than four decades of studying and writing about the Supreme Court, I’ve seen a lot (and yes, I’m thinking of Bush v. Gore). But I’ve rarely seen a development as disheartening as this one: a squirrelly, intellectually dishonest lecture in the form of an unsigned majority opinion, addressed to the four dissenting justices (Need I name them? Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor and Elena Kagan), about how “this court has repeatedly emphasized that lower federal courts should ordinarily not alter the election rules on the eve of an election.”

Let’s think about that. “Ordinarily not alter”?

There are quite a few things that should not ordinarily be happening these days. People shouldn’t ordinarily be afraid of catching a deadly virus when exercising their right to vote. Half the poll-worker shifts in the city of Madison are not ordinarily vacant, abandoned by a work force composed mostly of people at high risk because of their age.

Milwaukee voters are not ordinarily reduced to using only five polling places. Typically, 180 are open. (Some poll workers who did show up on Tuesday wore hazmat suits. Many voters, forced to stand in line for hours, wore masks.) And the number of requests for absentee ballots in Milwaukee doesn’t ordinarily grow by a factor of 10, leading to a huge backlog for processing and mailing.

I wonder how Chief Justice John Roberts and Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh understand the word “ordinarily.” And I wonder why the opinion was issued per curiam — “by the court.” Did none of the five have the nerve to take ownership by signing his name?

Interesting that in this and other areas, the “professional commentators” are picking up on and reinforcing things I have been saying on Courtside for a long time. And, much of the shabby performance of America’s life tenured judiciary begins with failing to stand up to Trump’s racist assault on migrants and his unconstitutional dismantling of justice in our overtly biased Immigration Courts. 

Justice Sotomayor said it very clearly at oral argument in the DACA case:  “That this is not about the law; this is about our choice to destroy lives.” The same can be said about much of the J.R. Five’s one-sided immigration jurisprudence in the “Age of Trump.”

UPDATE: While folks like McHenry and the operators of the DHS Gulag provide misleading information, or perhaps outright lies, to Federal Judges, Courtside’s sources say that at least six individuals with some connection to the Immigration Courts have died from coronavirus. While I admittedly have no way of “independently verifying” this information, I’d bet that there are many more Immigration Court or Gulag-related coronavirus deaths and serious infections out there that I do not know about!

Why,  I wonder, would any Federal Judge accept the word of someone like McHenry or officials in the DHS Gulag over affidavits from detainees, filings from experts, and the advice we hear from the Surgeon General, Dr, Fauci, and Dr. Birx every day? Stay home means “stay home!”

Nobody with any understanding of our immigration system could reasonably believe that running one more removal hearing or keeping non-criminals in prison is worth endangering lives and spreading disease! What in the recent public history of DHS Detention and EOIR would lead a Federal Judge to credit any information on “best practices” on public health provided by these inherently unreliable and incompetent organizations?

LOS ANGELES — Concerned that thousands of migrant children in federal detention facilities could be in danger of contracting the coronavirus, a federal judge in Los Angeles late on Saturday ordered the government to “make continuous efforts” to release them from custody.

The order from Judge Dolly M. Gee of the United States District Court came after plaintiffs in a long-running case over the detention of migrant children cited reports that four children being held at a federally licensed shelter in New York had tested positive for the virus.

“The threat of irreparable injury to their health and safety is palpable,” the plaintiffs’ lawyers said in their petition, which called for migrant children across the country to be released to outside sponsors within seven days, unless they represent a flight risk.

There are currently about 3,600 children in shelters around the United States operated under license by the federal Office of Refugee Resettlement, and about 3,300 more at three detention facilities for migrant children held in custody with their parents, operated by the Immigration and Customs Enforcement agency.

Advocates for immigrants have tried for decades to limit the government’s ability to detain children apprehended after crossing the border, arguing that it is psychologically harmful, violates their rights and undermines their long-term health.

Now, some say, the coronavirus represents an even more immediate threat.

In addition to the four children who tested positive in New York, at least one child is in quarantine and awaiting results of a test for the virus at a detention facility operated by ICE, according to documents filed with the court.

Interviews with 10 workers at immigration courts around the country reveal fear, contradictory messages and continuing perils for the employees.

On Tuesday night — over a day after several Bay Area counties issued shelter-in-place orders barring most people from leaving their homes — the San Francisco immigration court sent an email to staff: Hearings were being postponed nationwide for most immigrants, so the court would be closed starting Wednesday. (The text of the email was provided to ProPublica.)

On Wednesday, however, employees were directed to get onto a conference call, according to two participants. There they were told the Tuesday night email was wrong. The court wasn’t closed. They would have to come into the office — or use their vacation time to stay home. When staff asked about the shelter-in-place orders, the response was that the Department of Justice, which runs immigration courts, took the position that those were local laws and didn’t apply to federal employees.

The Trump administration has reduced immigration court operations in the past week, by postponing hearings for non-detained immigrants and closing a handful of courts to the public. Those actions came after the unions representing immigration prosecutors and judges issued a rare public call for courts to close.

The reduced court operations came after weeks of employees raising concerns privately and, they say, receiving few and unhelpful answers. And because the closures are determined solely by whether a court is hearing cases of detained immigrants, rather than by the level of health peril, employees still feel they’re putting their health at risk every time they come into the office as instructed.

That’s the picture that emerges from interviews with 10 federal employees who work at immigration courts across the country. Most spoke on the condition of anonymity. Many said they had raised concerns internally about their exposure to COVID-19 to their managers or hadn’t been informed of potential exposures.

“When I signed up for this job, I thought it might be morally compromising at times,” one immigration court employee told ProPublica, “but I never thought it would be compromising of my health and safety.”

The Executive Office for Immigration Review, the DOJ agency that oversees immigration courts, told ProPublica that agency headquarters was responsible for deciding when courts closed, but it did not confirm or deny specifics of the employees’ allegations, saying, “We do not comment on internal communications or internal personnel operations.”

In Denver, one prosecutor interviewed by ProPublica was alarmed by a judge’s frequent coughs during a hearing last Friday. “Don’t mind my coughing,” the judge said, according to the prosecutor. “I don’t think it’s coronavirus.” The following Tuesday, the prosecutor noticed that the judge was out for the rest of the week and emailed a court staffer in concern: Was it the coronavirus? Should she be taking precautions? The staffer’s reply: For privacy reasons, the prosecutor’s questions couldn’t be answered.

Only after news broke to the public on Tuesday night that a judge at the Denver immigration court had been diagnosed with COVID-19 (the disease caused by the new coronavirus) did court officials follow up with the prosecutor and confirm her suspicions. Other attorneys the judge had been in close contact with were notified the next day. The court remained open through Thursday, when the entire building it was housed in was shut down for deep cleaning by the General Services Administration. (It’s currently set to reopen Monday.)

In New York, legal aid groups sent a letter to immigration court officials saying that two of their attorneys had symptoms of COVID-19 and a third had been exposed to someone who’d tested positive. All three attorneys had appeared in court the past week, and all had hearings scheduled the following day. The courts didn’t say anything to their employees about the letter, according to multiple sources.

Since taking office, the Trump administration has pressured the immigration courts to process as many immigrants as quickly as possible — pressuring judges to hear more cases and complete them within a year, and making it harder for immigrants or attorneys to postpone hearings. Now, they face a public health crisis that requires everyone to reduce person-to-person contact.

Immigration court workers have two concerns. The first is that the courts are often crowded and require close contact with members of the public. The second is that, like most employees of any type, especially those who take public transit, they are exposed every time they leave their homes to work.

Employees remain concerned about their exposure over the past few weeks, while courts were running as usual. Employees in New York and California — the states hardest hit by the pandemic to date — told ProPublica that their requests for “deep cleaning” were rejected by managers, and that they were bringing their own Clorox wipes and disinfectant spray to the office.

Most immigration court business happens in person. Even trying to postpone an immigration hearing (for example, due to illness) requires an attorney to file a paper form with a clerk. And if an immigrant doesn’t show up for a hearing, they’re at risk of getting ordered deported in absentia. In at least one New York court, according to two people who work there, the chief judge told employees Monday to issue absentia deportation orders if immigrants weren’t showing up, even if the coronavirus was the suspected cause.

Policies the Trump administration introduced before the COVID-19 pandemic put considerable pressure on judges and prosecutors not to allow immigrants to postpone their hearings. Judges face a “performance standard” of completing 80% of their cases within a year — a standard over 90% of judges don’t meet, according to the National Association of Immigration Judges. But the more than 150 judges who have been hired in the past two years are still in their probationary period, where they could be fired for failing to meet performance standards.

While many judges have been lenient in granting coronavirus-related postponements, others have not. Last week, according to one California immigration court employee, a judge took a break from a hearing to tell colleagues that the immigrant’s attorney claimed to be sick, but because he wasn’t coughing, the hearing would move forward.

One email sent by the chief prosecutor at the Miami court Tuesday, read to ProPublica, told prosecutors that if an immigrant or her attorney claimed to be sick, any postponement should be counted against the immigrant (preventing them from requesting another postponement). If the immigrant didn’t want to postpone, and the judge wasn’t willing to hold the hearing by phone, the prosecutor was instructed to contact her manager — who would assess the claim of illness himself before deciding what to do. (A call to the chief prosecutor in Miami was not immediately returned.)

Most communication, though, has been oral. In at least two courts, chief judges were asked to put policies in writing and declined.

Employees have been in the dark about who, exactly, is making the decisions about which courts are open and when employees are allowed to work from home or take leave to stay home. “The word is that it’s out of their hands. Everything is out of everybody’s hands,” Fanny Behar-Ostrow, president of the union representing immigration prosecutors, told ProPublica Wednesday. “I don’t know who’s making the calls, but they’re wrong.”

An email obtained by the Miami Herald, written by the assistant chief immigration judge in charge of the Miami immigration court on Wednesday, said that closure decisions were ultimately being made by “the White House” — something that employees at other courts also said their managers had suggested. But chief judges gave conflicting explanations about which decisions were subject to White House approval; one chief judge told employees that the White House had to be involved in decisions about remote work, while other chief judges made those decisions themselves.

It’s not clear who at the White House is involved or how. Immigration officials told the Herald that the ultimate decision was made by the Office of Management and Budget. However, according to the employees ProPublica spoke to, some immigration court officials used “White House” to refer to policies set by the Office of Personnel Management. The assistant chief immigration judge (the judge in charge of a given immigration court location) for one California court told employees on March 12 that they’d had a phone call with staff for Vice President Mike Pence, who’s running the official coronavirus task force.

But to many employees, the specter of “White House” involvement raised concerns that the administration’s immigration policy priorities were getting in the way of its public health obligations.

Immigration and Customs Enforcement announced on Wednesday that it will halt most arrests and deportations, focusing only on individuals who are “public safety risks” and who are “subject to mandatory detention based on criminal grounds,” as the coronavirus sweeps across the U.S. and public health officials scramble to limit the virus’ spread.

Undocumented immigrants are often afraid to seek medical care for fear of deportation. And even as state and local officials encouraged anyone who needed medical treatment to seek help, ICE officers continued to make arrests, including in areas hit hard by the virus. But in the temporary change in enforcement, ICE also said that it won’t carry out operations near health care facilities, including hospitals, doctors’ offices, and urgent care facilities, “except in the most extraordinary of circumstances,” the agency said in a statement. “Individuals should not avoid seeking medical care because they fear civil immigration enforcement.”

Immigration experts said ICE’s decision was somewhat unexpected, though they remain cautious about how to interpret it. “I’m always surprised to hear that they’re going to scale back on their efforts,” said Jennifer M. Chacón, a UCLA law professor who focuses on immigration. ICE’s statement marks a distinct shift from the agency’s operations under the Trump administration. Both Chacón and Karla McKanders, a law professor who directs the Immigration Practice Clinic at Vanderbilt University, said that it reminded them of the “felons, not families” immigration policy of the Obama administration. “You read it and it basically looks like the Obama-era enforcement priority statement, and you just wonder why it takes a pandemic to get ICE to think about prioritizing resources and focusing efforts on public safety,” said Chacón.

Meanwhile, Article III Courts, which have had more than ample opportunity to put an end to the constitutional farce taking place in Immigration Court and also to direct the DHS to take overdue steps to release non-dangerous (that is, most) immigration detainees before the epidemic sweeps chronically health-endangering immigration prisons in their New American Gulag (“NAG”), have once again “swallowed the whistle.” The Gulag, where kids are caged and put in “iceboxes,” families separated, and folks sometimes left to die, all for no reason other than “we can do it and nobody’s going to stop us” will haunt not only those corrupt public servants who established and operated it, but also those like legislators, judges, and public health officials who failed in their duties to end the human rights abuses.

Perhaps the Article IIIs are “running scared” because without the ongoing clown show in the U.S. Immigration Courts, the Article IIIs would be in line for the title of “Americas’s Most Dysfunctional Courts.”

The U.S. betrays migrant kids

Kevin Euceda, a 17-year-old Honduran boy, arrived at the U.S.-Mexico border three years ago and was turned over to the custody of the Department of Health and Human Services until his request for asylum could be decided by immigration courts. During that period, he was required, as are all unaccompanied minors in custody, to meet with therapists to help him process what he had gone through.

In those sessions, Kevin was encouraged to speak freely and openly and was told that what he said would be kept confidential. So he poured out his story of a brutalized childhood, of how MS-13 gang members moved into the family shack after his grandmother died when he was 12, of how he was forced to run errands, sell drugs and, as he got older, take part in beating people up. When he was ordered to kill a stranger to cement his position in the gang, Kevin decided to run.

His therapists submitted pages of notes over several sessions to the file on him, as they were expected to do. But then, HHS officials — without the knowledge of the teen or the therapists — shared the notes with lawyers for Immigration and Customs Enforcement, who used them in immigration court to paint the young migrant as a dangerous gang member who should be denied asylum and sent back to Honduras. In sharing those therapy notes, the government did not break any laws. But it most assuredly broke its promise of confidentiality to Kevin, violated standard professional practices — the first therapist involved quit once she learned her notes had been shared — and offended a fundamental expectation that people cannot be compelled to testify against themselves in this country.

Kevin, whose story was detailed by the Washington Post, wasn’t the only unaccompanied minor to fall victim to such atrocious behavior, though how many have been affected is unknown. The government says it has changed that policy and no longer shares confidential therapy notes, but that’s not particularly reassuring coming from this administration. It adopted the policy once; it could easily do so again.

Last week, Rep. Grace F. Napolitano (D-Norwalk) and Sen. Jeff Merkley (D-Ore.) introduced the Immigrants’ Mental Health Act of 2020 to ban the practice, which is a necessary preventive measure. The bill would also create a new training regimen to help border agents address mental health issues among migrants and require at least one mental health expert at each Customs and Border Patrol facility. Both of those steps are worth considering too.

That the government would so callously use statements elicited from unaccompanied minors in therapy sessions to undercut their asylum applications is part of the Trump administration’s broad and inhumane efforts to effectively shut off the U.S. as a destination for people seeking to exercise their right to ask for sanctuary. Jeff Sessions and his successor as attorney general, William Barr, have injected themselves into cases at an unprecedented rate to unilaterally change long-established practices and immigration court precedent.

They have been able to do so because immigration courts are administrative and part of the Justice Department, not the federal court system, and as a result they have politicized what should be independent judicial evaluations of asylum applications and other immigration cases. Advocates argue persuasively that the efforts have undermined due process rights and made the immigration courts more a tool of President Trump’s anti-immigration policies than a system for measuring migrant’s claims against the standards Congress wrote into federal law.

Of course, trampling legal rights and concepts of basic human decency have been a hallmark of the administration’s approach to immigration enforcement — witness, for example, its separation of more than 2,500 migrant children from their parents. Beyond the heartlessness of the separations, the Health and Human Services’ inspector general last week blasted the department for botching the process. Meanwhile, the administration has expanded detention — about 50,000 migrants are in federal custody on any given day, up from about 30,000 a decade ago — and forced about 60,000 asylum seekers to await processing in dangerous squalor on Mexico’s side of the border.

There are legitimate policy discussions to be had over how this government should handle immigration, asylum requests and broad comprehensive immigration reform. In the meantime, no government has the right to treat people with such abject inhumanity. History will remember Trump for this, but it will also remember the people who enable such atrocious acts.

And yet, the overwhelming majority did not. Instead, over the 12 years of Nazi rule, during which time judges heard countless cases, most not only upheld the law but interpreted it in broad and far-reaching ways that facilitated, rather than hindered, the Nazis ability to carry out their agenda.
