COVID-19 has exploded at migrant detention centers nationwide, infecting detainees and employees alike and seeding the disease aboard deportation flights to countries ill-equipped to respond, especially in Latin America. The facilities, run by U.S. Immigration and Customs Enforcement, are petri dishes of contagion, and the residents — many of whom have no serious criminal record — are sitting ducks in the crosshairs of an inhumane policy.
A federal judge has ordered the release of migrant children at two ICE family detention centers in Texas and one in Pennsylvania, having found them at risk to the virus and to spotty enforcement of safety measures. But across the country, scores more facilities have been hit hard by the pandemic, and ICE has been unable to contain it.

Roughly 1,000 new covid-19 cases have been diagnosed in ICE facilities since early July, bringing the number who have tested positive for the disease since March to roughly 4,000. That’s roughly a fifth of all those who have been tested, though some were infected before ICE took them into custody.
Courts have ordered more than 500 at-risk detainees released, and ICE has released an additional 900 at its own initiative. Those reductions, along with ongoing deportations, have cut the detainee population by 40 percent since March, to roughly 22,000 now. That’s good, but it is clear that the agency’s steps to mitigate the outbreak have been inadequate. It is also clear that testing at the facilities has lagged, proper distancing at some is insufficient, and health care is not equal to the task of containment. At the Farmville Detention Center in Virginia, west of Richmond, nearly two-thirds of 400 detainees have tested positive for the virus in recent weeks.
Moreover, ICE has been complicit in accelerating the pandemic’s reach into Central America, the Caribbean and elsewhere, by deporting tens of thousands of migrants since the spring, including some who were infected. At least a dozen countries assert that deportees arrived with the virus.
Many were not tested before boarding the flights. On one deportation flight to India in May, 22 passengers — about 15 percent of those onboard — tested positive upon arriving in India. In Guatemala, authorities say more than 160 deportees who have arrived since April tested positive for the virus. “We understand the United States wants to deport people,” said Guatemalan President Alejandro Giammattei in May. “What we don’t understand is why they send us all these contaminated flights.”

Advocates and public health officials have urged ICE to accelerate the release of at-risk detainees, who can be fitted with ankle monitors to encourage their appearance at immigration court proceedings. ICE has done some of that; it is critical that it do more.
To continue detaining nonviolent detainees as the virus tightens its grip on ICE facilities is pointless and dangerous — for detainees and for employees, scores of whom have been infected with covid-19. It’s past time for ICE to intensify the fight against covid-19, and reassess a policy that has failed to contain a pandemic behind bars.

When our nation is experiencing massive and deadly institutional failure and a failure of legal and moral leadership, we must start looking at the qualifications and values (or in some cases the rather obvious lack thereof) of the folks in those failing institutions! In a democracy, bad leadership doesn’t “drop out of the sky.” It’s a product of bad decisions and apathy among those with the power to select our leaders. That means all of us who can vote or encourage others to vote.

This November, vote like your life and the future of our democracy depend on it! Because they do!

Federal agents are expelling asylum seekers as young as 8 months from the border, citing COVID-19 risks

Thousands of migrant children have been expelled by the Trump administration since March. Some have been held in hotels without access to lawyers or family. Advocates say many are now “virtually impossible” to find.

A teenage girl carrying her baby arrived at the U.S. border this summer and begged for help. She told federal agents that she feared returning to Guatemala. The man who raped her she said had threatened to make her “disappear.”

Then, advocates say, the child briefly vanished — into the custody of the U.S. government, which held her and her baby for days in a hotel with almost no outside contact before federal officers summarily expelled them from the country.

Similar actions have played out along the border for months under an emergency health order the Trump administration issued in March. Citing the threat of COVID-19, it granted federal agents sweeping powers to almost immediately return anyone at the border, including infants as young as 8 months. Children are typically entitled to special protections under the law, including the right to have their asylum claims adjudicated by a judge.

Under this new policy, the administration is not deporting children — a proceeding based on years of established law that requires a formal hearing in immigration court.

It is instead expelling them — without a judge’s ruling and after only a cursory government screening and no access to social workers or lawyers, sometimes not even their family, while in U.S. custody. The children are not even granted the primary registration number by which the Department of Homeland Security tracks all immigrants in its care, making it “virtually impossible” to find them, Efrén C. Olivares, a lawyer with the Texas Civil Rights Project, wrote in a court declaration arguing that the practice is illegal.

Little is known about how the process works, but published government figures suggest almost all children arriving at the border are being rapidly returned.

A sense of deja vu

Thirty-five years ago, a 15-year-old Salvadoran girl fleeing a civil war in her homeland was also imprisoned in an American hotel under the care of unlicensed private security guards. Jenny Flores’ case forced the most significant overhaul yet of how U.S. authorities can detain migrant children. In fact, the 1997 federal settlement is named for her.

Carlos Holguín, who began litigating that case in 1985, said there is now a sense of “deja vu … but the degree of lawlessness is even beyond what was going on then.”

Since taking office, the Trump administration has tried to end the Flores Settlement, arguing that it and a 2008 trafficking law work as “loopholes” encouraging families to send children here alone. The government has attempted to undo the settlement through regulations and requested Congress curtail the Trafficking Victims Protection Reauthorization Act, which requires certain safeguards for children arriving alone at the border.

So far, both efforts have failed.

The administration tried separating parents and children at the border, but a federal judge largely ruled against the practice in 2018, allowing it only in narrow circumstances such as if the adult poses a danger.

U.S. District Judge Dolly Gee, who is in charge of the Flores Settlement, has determined the administration must quickly release children locked up with their parents in immigrant detention centers, most recently citing the risk of coronavirus spreading.

“The family residential centers are on fire and there is no more time for half measures,” she wrote in a June 26 order.

The government is now arguing it can force detained parents to choose between freeing their children or staying indefinitely imprisoned with them.

But none of the administration’s attempts to undo either the settlement or the law have been as effective as the expulsion order, which is “eviscerating every single protection mechanism outlined by Congress and the courts with one sweeping gesture,” said Podkul of KIND.

Late last month, the ACLU sued to allow its lawyers access to children detained in the McAllen Hampton Inn after a video went viral showing a Texas Civil Rights Project lawyer forcibly pushed away.

“The children are in imminent danger of unlawful removal,” the attorneys wrote.

Facing a public relations scandal, Hilton quickly announced that all three hotels had canceled reservations with MVM.

“We expect all Hilton properties to reject business that would use a hotel in this way,” a Hilton spokesperson said.

Government attorneys agreed to pause the expulsion of the migrants who they said remained in the McAllen hotel on the date of the lawsuit — once again, ACLU attorneys said, mooting litigation on the broader policy. A separate suit involving a 13-year-old Salvadoran girl who was expelled this summer is still pending in a Washington, D.C., federal court.

By the time the administration stopped the removal of the migrants detained at the Hampton Inn, most who had been held there had already been expelled or transferred elsewhere — some, advocates said, just before the ACLU filed its lawsuit. Only 17 family members, including one unaccompanied child, remained in that hotel.

What happened to the rest? No one would say.

As you watch, ask this question: What does most of the enforcement you see have to do with any legitimate notion of “homeland security” except in the sense that abusing, terrorizing, separating, and removing individuals of color evidently makes some folks in the U.S., particularly Trump supporters, feel “more secure?”

No, it’s not “just enforcing the law!” No law is enforced 100% and most U.S. laws are enforced to just a limited extent due to priorities, funding, and sensible prosecutorial discretion used by every law enforcement agency. 

How much does the Trump Administration “enforce” environmental protection laws, civil rights laws, laws protecting the LGBTQ community from discrimination, fair housing laws, financial laws, health and safety laws, tax laws, or for that matter ethics laws, whistleblower protections, or anti-corruption laws?

Although domestic violence hasn’t decreased in ethnic communities, prosecutions have gone down as a result of the Administration’s “terror tactics” as illustrated in Immigration Nation. Jeff “Gonzo Apocalypoto” Sessions’s racially-motivated prosecutions of minor immigration violators, intended to promote family separation and “deter” others from asserting legal rights, actually diverted Federal prosecutorial resources from real crimes like drug trafficking and white collar crimes.

Remember, Jeff Sessions walks free (his biggest “trauma” being a well-deserved primary defeat in Alabama); his victims aren’t so lucky; some of their trauma is permanent; their lives changed for the worse, and in some cases eradicated, forever! Where’s the “justice” and the “rule of law” in this?

Prosecutions are always prioritized and “targeted” in some way or another, sometimes rationally, reasonably, and prudently, and other times with bias and malice. So, as you watch this and hear folks like former Acting ICE Director Tom Homan and other Government officials pontificate about “just enforcing the law” or “required by law,” you should recognize it for the total BS that it is!

The Trump Administration’s immigration enforcement program is clearly designed by folks like Stephen Miller, Sessions, and others to be invidiously motivated and to terrorize communities of color including U.S. citizens and lawful residents who are part of those communities. They are an affront to the concepts of “equal justice under law” and eliminating “institutional racism.” 

The Administration’s policies are actually “Dred Scottification” or “dehumanization of the other.” You can see and hear it in the voices of DHS enforcement officials, a number of whom eventually view other humans as “numbers,” “priorities,” “quotas,” “missions,” “ops” (“operations”), “beds,” or “collateral damage.” 

That’s exactly how repressive bureaucracies in Germany, the Soviet Union, China, and other authoritarian states have worked and prospered, at least for a time. By breaking dehumanization into “little bureaucratic steps” individuals are relieved of moral responsibility and lulled into losing sight of the “big picture.” 

Did the folks repairing the tracks and switches for the German railroads focus on where the boxcars were heading and what eventually would happen to their passengers? Did they even know, wonder, or care what was in those boxcars?

And, in case you wonder, family and child separations, supposedly eventually abandoned by Trump, might have diminished as a result of court cases, but they still regularly occur. Only now they are kept largely “below the radar screen” and disingenuously disguised under the bureaucratic rubric “binary choice.”

What has really diminished is less the abuses and more the national and international outrage about those abuses. Dishonesty, immorality, and cruelty have simply become “normalized” under Trump as long it’s largely “out of sight, out of mind.”

What do you imagine happens to those turned away at our borders without any meaningful process and “orbited” to the Northern Triangle — essentially “war zones?” (Preliminary studies show that many die or disappear.) A majority of the Supremes don’t care, and apparently most Americans don’t either as long as the carnage and tears aren’t popping up on their TV screens.

And, in many cases, the “removals” and denials of fair process, both the ones you see in Immigration Nation and the ones you don’t, are actually detrimental to our nation, our values, our society, and our future. The series mentions “being one on the wrong side of history;” that’s precisely where the DHS is under Trump. But, so is the rest of our nation for having allowed an evil charlatan like Trump to have power over our humanity.

This November, vote like your life and the future of our nation depend on it! Because they do! We can’t undo the past! But, we can make Trump part of that past and change our future for the better!

(CNN)Attorney General Bill Barr’s written opening statement to the House Judiciary Committee was replete with mischaracterizations, fallacies and unnerving stereotypes that run afoul of the principle of equal justice — and which, taken together, show how he has transformed the Department of Justice that enforces the law to a department that undermines the rule of law.

These are but a few lines that should evoke a visceral reaction to the views of a man who sits at the helm of the most powerful prosecutorial office in the country.

1. “Ever since I made it clear that I was going to do everything I could to get to the bottom of the grave abuses involved in the bogus ‘Russiagate’ scandal, many of the Democrats on this Committee have attempted to discredit me by conjuring up a narrative that I am simply the President’s factotum who disposes of criminal cases according to his instructions.”

No, Attorney General Barr, you are not being accused of being a factotum, colloquially defined as a handyman. You stand accused of being a henchman who acts not only under the President’s instructions but, perhaps more nefariously, exclusively in the President’s interests. And what conveys this impression is not a deceptive narrative crafted by the Democratic members of the House Judiciary Committee, but rather your own conduct.

Case in point: undermining career prosecutors in what appears to clearly be the interests of President Donald Trump. Not once can I recall an attorney general weighing in on a career prosecutor’s sentencing recommendations for a defendant convicted of multiple felonies by a jury. Yet, this appears to be an increasingly frequent endeavor by this Attorney General on behalf of Trump associates, including, most recently former National Security Adviser Michael Flynn and the President’s long-time friend Roger Stone.

The disturbing trend is underscored by the fact that the one convicted felon who has fallen out of the President’s favor, Trump’s former lawyer Michael Cohen, felt the knife twisted rather than removed when the Justice Department recently, albeit briefly, sent him back to prison under questionable 

And Barr’s misuse of terms continues with the use of the term “Russiagate.” The use of the suffix “gate” insinuates that it is conspiratorial, farcical and worthy of derision. And yet, the Attorney General has confirmed, as recently as today’s colloquy with Louisiana Rep. Cedric Richmond, that Russia did interfere with the past presidential election and will presumably continue to interfere with our upcoming presidential election. Perhaps the nod to conspiracy theorists was inadvertent in light of overwhelming evidence he fails to dispute.

2. “Like his predecessors, President Trump and his National Security Council have appropriately weighed in on law-enforcement decisions that directly implicate national security or foreign policy, because those decisions necessarily involve considerations that transcend typical prosecutorial factors.”

No one doubts the propriety of the President of the United States and members of his National Security Council to get involved in cases that directly implicate the national security of this nation or those matters that directly relate to our foreign policy interests. What is in doubt is whether Barr’s defense of deploying federal agents to US cities is anything more than a pretextual reason to infringe upon the constitutional rights of Americans, namely their First Amendment rights to assemble and to protest their grievances with the government. A bald assertion of a national security interest does not absolve the executive branch from having to provide an appropriate and lawful justification when constitutional rights are implicated. And yet Barr has offered no compelling reason.

3. “I had nothing to prove and had no desire to return to government. … When asked to consider returning, I did so because I revere the Department and believed my independence would allow me to help steer her back to her core mission of applying one standard of justice for everyone and enforcing the law even-handedly, without partisan considerations.”

This is just laughable. He had no desire to return to the government? I have a June 2018 memo that says otherwise. It was entirely unsolicited, offered Barr’s insight on special counsel Robert Mueller’s handling of an investigation into Russia’s interference in our presidential election and read like a solicitation for a job. And lo and behold, he got his wish. Now, Barr has launched an investigation into the origins of what he calls “Russiagate” that seems to track the very outline he presented when he, ahem, had no desire to put skin in the game.

Barr’s suggestion that he was compelled to return to the helm out of a sincere interest to restore the objectivity and credibility of the Department of Justice is belied by his decision-making. His sentencing decisions that seem to show political favor, his failure to justify the use of force against peaceful protestors and his involvement in the removal of Geoffrey Berman, the former Attorney General for the Southern District of New York, comprise just a handful of the many instances where his conduct has undermined — not restored — the credibility of the Justice Department.

It’s a familiar pattern. After “stonewalling” Congressional oversight, Administration Kakistocrat finally shows up and arrogantly spews lies, misrepresentations, and false narratives under oath. Dems spend their time lecturing and pontificating, but don’t create the factual record for a subsequent perjury prosecution. (Ask yourself: What if Laura Coates were doing the questioning?)

GOP toadies in Congress “circle the wagons” and double down on the lies showing their complete contempt for truth, human decency, and good governance.

We already knew Barr was a shady character and that the GOP is unfit for any office in any branch. So, this hearing didn’t really accomplish much.

But it does demonstrate the absolute necessity for the majority of us who want to save our nation to get out the vote to remove Trump and the GOP at every level 🧹 in November. 

This November, vote like your life depends on it! Because it does! Another four years of Trump’s racist malicious incompetence and the GOP kakistocracy could kill us all (including the truth-impervious Trumpsters and GOP toadies willing to seek the end of our democracy)! Victory for the “good guys” isn’t inevitable —  it will take lots of energy and continuing hard work to save our nation!👍🏼🗽🇺🇸

THE GREAT CLIMATE MIGRATION

Early in 2019, a year before the world shut its borders completely, Jorge A. knew he had to get out of Guatemala. The land was turning against him. For five years, it almost never rained. Then it did rain, and Jorge rushed his last seeds into the ground. The corn sprouted into healthy green stalks, and there was hope — until, without warning, the river flooded. Jorge waded chest-deep into his fields searching in vain for cobs he could still eat. Soon he made a last desperate bet, signing away the tin-roof hut where he lived with his wife and three children against a $1,500 advance in okra seed. But after the flood, the rain stopped again, and everything died. Jorge knew then that if he didn’t get out of Guatemala, his family might die, too.

Even as hundreds of thousands of Guatemalans fled north toward the United States in recent years, in Jorge’s region — a state called Alta Verapaz, where precipitous mountains covered in coffee plantations and dense, dry forest give way to broader gentle valleys — the residents have largely stayed. Now, though, under a relentless confluence of drought, flood, bankruptcy and starvation, they, too, have begun to leave. Almost everyone here experiences some degree of uncertainty about where their next meal will come from. Half the children are chronically hungry, and many are short for their age, with weak bones and bloated bellies. Their families are all facing the same excruciating decision that confronted Jorge.

The odd weather phenomenon that many blame for the suffering here — the drought and sudden storm pattern known as El Niño — is expected to become more frequent as the planet warms. Many semiarid parts of Guatemala will soon be more like a desert. Rainfall is expected to decrease by 60 percent in some parts of the country, and the amount of water replenishing streams and keeping soil moist will drop by as much as 83 percent. Researchers project that by 2070, yields of some staple crops in the state where Jorge lives will decline by nearly a third.

Scientists have learned to project such changes around the world with surprising precision, but — until recently — little has been known about the human consequences of those changes. As their land fails them, hundreds of millions of people from Central America to Sudan to the Mekong Delta will be forced to choose between flight or death. The result will almost certainly be the greatest wave of global migration the world has seen.

In March, Jorge and his 7-year-old son each packed a pair of pants, three T-shirts, underwear and a toothbrush into a single thin black nylon sack with a drawstring. Jorge’s father had pawned his last four goats for $2,000 to help pay for their transit, another loan the family would have to repay at 100 percent interest. The coyote called at 10 p.m. — they would go that night. They had no idea then where they would wind up, or what they would do when they got there.

From decision to departure, it was three days. And then they were gone.

Our modeling and the consensus of academics point to the same bottom line: If societies respond aggressively to climate change and migration and increase their resilience to it, food production will be shored up, poverty reduced and international migration slowed — factors that could help the world remain more stable and more peaceful. If leaders take fewer actions against climate change, or more punitive ones against migrants, food insecurity will deepen, as will poverty. Populations will surge, and cross-border movement will be restricted, leading to greater suffering. Whatever actions governments take next — and when they do it — makes a difference.

The window for action is closing. The world can now expect that with every degree of temperature increase, roughly a billion people will be pushed outside the zone in which humans have lived for thousands of years. For a long time, the climate alarm has been sounded in terms of its economic toll, but now it can increasingly be counted in people harmed. The worst danger, Hinde warned on our walk, is believing that something so frail and ephemeral as a wall can ever be an effective shield against the tide of history. “If we don’t develop a different attitude,” he said, “we’re going to be like people in the lifeboat, beating on those that are trying to climb in.”

During the 2014–2015 school year, Caleigh Wood started to learn about Islam as part of her 11th grade world history class. Upon discovering this, Caleigh’s dad, John, wrote on Facebook that he “just about fucking lost it,” adding in response to a commenter, “A 556 round [of ammunition] doesn’t study Islam and it kills them fuckers everyday.” John told the school’s vice principal that “you can take that fucking Islam and shove it up your white fucking ass,” according to federal court records. After saying that he was going to create a “shit storm like you have never seen,” he got banned from the La Plata, Maryland, high school.

That could have been the end of the story. Instead, Brandon Bolling and other lawyers from the Thomas Law More Center, a right-wing Christian group that declares itself “battle ready to defend America,” represented John as he sued the Charles County public school system for allegedly attempting to indoctrinate his daughter into Islam.

Last week, the Justice Department announced that it had hired Bolling, a former Marine and federal attorney, to be an assistant chief immigration judge in Texas, even though he has no discernible immigration experience. During two stints at the Thomas More Law Center—neither of which is disclosed in his government bio—Bolling worked on numerous cases that pitted his clients against Muslims and the gay community. Now Bolling will help oversee the immigration cases of people detained in El Paso, and could be responsible for deciding whether victims of persecution based on their religions and sexual orientations receive protection under US asylum laws.

Bolling is one of 46 new immigration judges recently hired by the Trump administration. Another is Matt O’Brien, who served as the research director for the Federation for American Immigration Reform, one of the country’s leading anti-immigrant groups. The decision to hire both men is an escalation of the Trump administration’s efforts to select judges sympathetic to its anti-immigration agenda. (The Justice Department’s Executive Office for Immigration Review and the Thomas More Law Center did not respond to requests for comment.)

As part of the Justice Department, immigration courts lack the independence of federal courts. The decisions they make can determine whether immigrants who have been in the United States for decades can remain, or whether asylum seekers will be deported to the countries they fled. Even when immigrants appeal their decisions, they generally stick, since the Trump administration has made a point of filling the Board of Immigration Appeals with judges known for denying nearly all asylum claims.

In 2016, presidential candidate Donald Trump pledged sweeping changes to immigration policy. As president, Trump has succeeded — despite a broad public outcry and many legal roadblocks — in implementing many of his proposed restrictions through a series of executive orders.

Now Congress is pushing back. On Wednesday the House passed the No Ban Act, legislation introduced last year by Sen Chris Coons (D-Del.) and Rep. Judy Chu (D-Calif.). The act aims to repeal Trump’s ban on arrivals from majority-Muslim countries and prevent future presidents from issuing discriminatory bans on foreign nationals or followers of specific religions.

“Throughout the history of the U.S., we’ve had a series of tragic nativist chapters in our history,” Coons told me this week. “Did I think we’d be facing another one? No. But when Donald Trump announced his candidacy, I remember thinking I am so glad I live in a country where a man like this couldn’t be president. I was wrong, and we’ve seen how damaging that has been.”

In recent months, the novel coronavirus pandemic, the associated economic downturn, and protests over police killings of African Americans have diverted public attention from Trump’s immigration policies. But they must not be forgotten.

Trump’s plans for an immigration ban have inspired widespread outrage. Some dismissed Trump’s words as empty threats, noting that they were probably unconstitutional. But Trump pressed ahead as soon as he took office.

The first iteration of what became known as the Muslim ban halted entry into the United States of citizens from seven countries, five of which are majority-Muslim.

Since then we’ve watched as immigration officials have separated kids from their parents in detention centers, with at least one of them dying in custody. The images of children in cages provoked an intense backlash and could end up costing Trump at the polls — to the extent that his policies have led his own voters, especially college-educated white Republican women, to question his xenophobic and racist policies.

Somewhat like Sen. Coons, I originally thought that there would be some institutional integrity and moral courage even among the more conservative members of our Judiciary, particularly among the Supremes. After all, there have been at least a few times in our history when judges across the ideological and political spectrum have stood together against the evils of racism, religious bigotry, and hate.

It’s not like Trump, Miller, Bannon, Sessions, Ross, and their hate-mongering cronies were ever particularly subtle about their invidious intent (although, to be fair, I was at the very beginning willing to give Sessions “the benefit of the doubt,” until I saw that his assurances to the Senate were lies under oath in the face of the deep moral corruption and bigotry that infected his whole being).

Boy was I wrong! Right from the git go, even with the advantage of clear evidence of invidious intent, ridiculously transparent and overtly dishonest “pretexts,” (some publicly contradicted by Trump in mid-stream) and the vast majority of lower Federal Court Judges pointing the way with cogent opinions standing up to the Trump charade and endless parade of hate, the Supremes majority tanked. Where the rights of “the other” particularly Muslims and persons color are concerned, they fully embraced Trump’s unconstitutional and tyrannical program of hate and bias thinly disguised as legitimate exercises of Executive Power.  They became willing “Dred Scottifiers!”

Perhaps just as seriously, the Supremes’ “normalized” demonstrable lies, false narratives, and dishonesty as attributes that were to be expected and tolerated from our Chief Executive. What a crock! Ordinary persons are held to basic standards of honesty and candor when dealing with the Government and with Government tribunals. But the President is above it all. While, later on, the Supremes fecklessly claimed that “nobody is above the law,” their actions have shown a disturbing and intellectually dishonest unwillingness to require Trump and his regime to comply with the basics of the rule of law and to act with even a minimal level of candor and honesty.

We can’t vote the “JR Five” out of their lifetime sinecures. But, our democracy does enable us to take the actions necessary to insure that folks like the “JR Five” and other Federal Judges who embrace racism, bigotry, and political corruption over the “equal justice and real due process for all persons” required by our Constitution are not selected to serve in the future in positions requiring legal experiences and moral qualifications that they so obviously lack.

Better judges for a better America. This November, vote like the future of humanity depends on it. Because it does!

Back before the 2016 election, GOP backbench Jim Crow hate monger Senator Jeff “Gonzo Apocalypto” Sessions saw a kindred spirit who would help him realize his whitewashed, faux Christian view of America: Donald Trump. Becoming the first Senator to endorse Trump got Gonzo a ticket to the U.S. Attorney General’s Office, where he quickly established himself as probably the worst inhabitant after the Civil War and before Billy Barr ( a period that notably includes “John the Con” Mitchell).

During his tenure, Gonzo separated families, caged kids, targeted vulnerable Latino refugee women for abuse, illegally punished “sanctuary cities,” expanded the “New American Gulag,” diverted prosecutorial resources from real crimes to minor immigration violations, expanded the “New American Gulag,” advocated discrimination against the LGBTQ community under the guise of religious bigotry, encouraged police brutality against Black Americans, aided efforts to disenfranchise Black and Latino voters, spread false narratives about immigrant crime and asylum fraud, dissed private lawyers, stripped Immigration Judges of their authority to control their own dockets, multiplied the Immigration Court backlogs, illegally tried to terminate DACA while smearing Dreamers, spoke to hate groups, issued unethical “precedent decisions” while falsely claiming to be acting in a quasi-judicial capacity, interfered with asylum grants and judicial independence, put anti-due-process production quotas on Immigration Judges, attempted to dismantle congressionally mandated “know your rights” programs, to name just a few of his gross abuses of public office. Indeed, other than Stephen Miller and Trump himself, how many notorious child abusers get to walk free in America while their victims suffer lifetime trauma?

Despite never being the brightest bulb in the pack, his feeble attempt at “legal opinions” sometimes drawing ridicule from lower court judges, Gonzo is generally credited with doing more than any other Cabinet member to advance Trump’s agenda of hate and White Nationalist bigotry. He actually was dumb enough to believe that his unswerving dedication to a program of promoting the white race over people of color and Christians over all other religions would ingratiate him with Trump. 

That would assume, however, that Trump had some guiding principle, however vile and disgusting, beyond himself. Sessions might be the only person in Washington who thought racism would trump self-protection. I’m not saying that Trump isn’t a committed racist — clearly he is. Just that his commitment to racism is subservient to his only real defining characteristic — narcissism. Just ask his niece, Mary.

Gonzo failed in the only thing that ever counted: Protecting Trump, his family, and his corrupt cronies from the Mueller investigation. It wasn’t, as some have inaccurately claimed, a show of ethics or dedication to the law.

Even Gonzo realized that participating in an investigation involving a campaign organization of which he was a member and therefore both a potential witness and target, would be an egregious ethical violation that could cost him his law license as well as a potential criminal act of perjury, given that he had testified under oath during his Senate confirmation that he intended to recuse himself. Apparently, that was on a day when Trump was too busy tweeting or playing golf to focus on the implications of that particular statement under oath by his nominee.

After Trump fired him, Gonzo’s political fortunes took a sharp downturn. A guy who polled 97% of the vote in running unopposed for the Senate in 2014, polled only 38% of the vote in overwhelmingly losing the GOP primary to former Auburn Football Coach Tommy Tuberville. Tommy, a “Trump loyalist” with extreme far-right views and no known qualifications for the job, is not much of an improvement over Sessions.

Perhaps the only good news is that Alabama currently has a very decent and competent U.S. Senator, Doug Jones (D), who represents all of the people of the state. Everybody should support Doug’s campaign to maintain decency and commitment to equal justice in Government.

More Immigration Judges Leaving the Bench

The latest judge-by-judge data from the Immigration Courts indicate that more judges are resigning and retiring. Turnover is the highest since records began in FY 1997 over two decades ago. These results are based on detailed records obtained by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University under the Freedom of Information Act (FOIA) from the Executive Office for Immigration Review (EOIR) which administers the Courts.

During FY 2019 a record number of 35 judges left the bench. This is up from the previous record set in FY 2017 when 20 judges left the bench, and 27 judges left in FY 2018.

With elevated hiring plus the record number of judges leaving the bench more cases are being heard by judges with quite limited experience as immigration judges.

Currently one of every three (32%) judges have only held their position since FY 2019. Half (48%) of the judges serving today were appointed in the last two and a half years. And nearly two-thirds (64%) were appointed since FY 2017.

While the Court is losing many of its most experienced judges, the backlog of cases continues to balloon. It is now almost three times the level when President Trump assumed office.

Records continue to disappear in the latest data release for updated court records through the end of June 2020. The report provides the latest statement from EOIR Chief Management Officer Kate Sheehey about this matter.

Look folks, I’m not disputing that Susan B. Long and David Burnham of TRAC are smart people. I’m even willing to speculate that they are smarter than most of the folks still in so-called public service (that largely isn’t any more) in all three branches of our failing Government.

But, are they really that much smarter than Supreme Court Justices, Article III Federal Judges, and Legislators who have let this grotesquely unconstitutional, dysfunctional, and deadly Star Chamber masquerading as a “court system” right here on American soil unfold and continue its daily abuses right under their complicit noses? Or, do we have too many individuals in public office lacking both the human decency and moral courage to stand up against institutionalized racism, unnecessarily cruelty, corruption, and pure stupidity, all of which very clearly are prohibited by both the due process and equal protection clauses of our Constitution, not to mention the 13th and 15th Amendments. It’s not rocket science!

Enough with the Congressional and Court-enabled “Dred Scottification” of the other! That’s how we ended up with things like the “Chinese Exclusion Act” and “Jim Crow” and why we have an institutionalized racism problem now.

Instead of standing up for equal justice for all under the Constitution, the Supremes and Congress often have willingly been part of the problem — using the law knowingly and intentionally to undermine constitutionally required equal justice for all and an end to racism. And, we can see those same attitudes today, specifically in the Supremes’ ridiculously wrong, intellectually dishonest, and cowardly decisions “greenlighting” various parts of White Nationalist Stephen Miller’s bogus program of dehumanizing asylum seekers and immigrants of color. This is not acceptable performance from Justices of our highest Court!

We need better, more courageous, and more intellectually honest public officers in all three branches who are willing to stand up for individual rightshuman lives, and the common good over bogus right wing legal doctrines and inhumanity cloaked in legal gobbledygook. It won’t happen overnight. But, a better America starts with throwing a totally corrupt, cruel, and maliciously incompetent President and his GOP enablers out of every public office at every level of government this November.

This November, vote like your life depends on it! Because it does!

INTRODUCTION

In their introduction, the proposed regulations misstate the Congressional intent behind our asylum laws.2 Since 1980, our nation’s asylum laws are neither an expression of foreign policy nor an assertion of the right to protect resources or citizens. It is for this reason that the notice of proposed rulemaking must cite a case from 1972 that did not address asylum at all in order to find support for its claim.

The intent of Congress in enacting the 1980 Refugee Act was to bring our country’s asylum laws into accordance with our international treaty obligations, specifically by eliminating the above- stated biases from such determinations. For the past 40 years, our laws require us to grant asylum to all who qualify regardless of foreign policy or other concerns. Furthermore, the international treaties were intentionally left broad enough in their language to allow adjudicators flexibility to provide protection in response to whatever types of harm creative persecutors might de- vise. In choosing to adopt the precise language of those treaties, Congress adopted the same flexibility. See e.g. Murray v. The Schooner Charming Betsy, 6 U.S. 64 (1804), pursuant to which national statutes should be interpreted in such a way as to not conflict with international laws.

The proposed rules are impermissibly arbitrary and capricious. They attempt to overcome, as opposed to interpret, the clear meaning of our asylum statutes. Rather than interpret the views of Congress, the proposed rules seek to replace them in furtherance of the strongly anti-immigrant views of the administration they serve.3 And that they seek to do so in an election year, for political gain, is clear.

In attempting to stifle clear Congressional intent in service of its own political motives, the ad- ministration has proposed rules that are ultra vires to the statute.

Now that we are deep into protests over racism, inequality and police brutality — protests that I’ve come to see as a revisiting of Freedom Summer —  it is clear that Donald Trump sees the activation of white nationalism and anti-otherness as his path to re-election. We are engaged in yet another national conversation about race and racism, privilege and oppression.

But, as is usually the case, the language we used to describe the moment is lacking. We — the public and the media, including this newspaper, including, in the past, this very column — often use, consciously or not, language that shields anti-Black white supremacy, rather than to expose it and hold it accountable.

We use all manner of euphemisms and terms of art to keep from directly addressing the racial reality in America. This may be some holdover from a bygone time, but it is now time for it to come to an end.

Take for instance the term “race relations.” Polling organizations like Gallup and the Pew Research Center often ask respondents how they feel about the state of race relations in the country.

I have never fully understood what this meant. It suggests a relationship that swings from harmony to disharmony. But that is not the way race is structured or animated in this country. From the beginning, the racial dynamics in America have been about power, equality and access, or the lack thereof.

Protests, and even violence, have erupted when white people felt their hold on those things was threatened or when Black people — or Indigenous people, or Hispanics — rebelled against those things being denied.

So what are the relations here? It is a linguistic sidestep that avoids the true issue: anti-Black and anti-other white supremacy.

Just honesty, courage, and intellectual integrity — things that I once took for granted among Supreme Court Justices, but now see are sorely missing on today’s Court where extreme rightist ideology identified with white supremacy has replaced judicial qualifications as selection criteria when the GOP was in charge.

The Trump administration has proposed a new rule that would allow it to deny asylum to immigrants who are deemed a public health risk.

The soon-to-be published rule would let the Department of Homeland Security and Department of Justice to block immigrants from seeking asylum in the U.S. based on “potential international threats from the spread of pandemics,” according to a notice announcing it Wednesday.

The rule would apply to immigrants seeking asylum and those seeking “withholding of removal” — a protected immigration status for those who have shown they may well face danger if returned to their home countries.

This outrageous, totally pretextual, racist proposal violates the Constitution, asylum laws, international agreements, morality, and human values. The factual basis is absurd since there has been no showing that asylum applicants are a source of COVID spread. To the contrary, unnecessarily detained asylum applicants have been victims of Trump’s failed policies. Moreover, if DHS actually were worried about COVID, they could easily test and quarantine to identify and deal constructively and humanely with the few applicants who might have been infected someplace other than DHS facilities.

This is White Nationalist racism at its worst.

We need better judges, and particularly better Justices on the Supremes, for a better America! Judges who will prevent, rather than encourage, racist-driven “crimes against humanity.” Standing up against such crimes, particularly when they are disgracefully directed by a racist Executive at our most vulnerable humans, should be a “no-brainer” for a unanimous Supremes with Justices qualified for the high offices they hold. For the “JR Five” a “no brainer” has too often been a “non-starter.” So, the regime’s gross abuses of migrants and people of color and the damage, societal disorder, wasted time, squandered resources, and the human misery they cause roll on.

The Supreme Court Doesn’t See Asylum-Seekers as People — One week after saving DACA, the high court proved that its sympathies for immigrants seeking better lives are limited.

Last Thursday, the Supreme Court saved more than 700,000 immigrants from the Trump administration’s nativist buzz saw. The court ensured that these immigrants, who were brought to the United States by their undocumented parents as children, would continue to be protected by an Obama administration policy called Deferred Action for Childhood Arrivals, sparing them from deportation to countries many could not even remember. The court split 5–4, with Chief Justice John Roberts throwing his lot in with the liberals to find that Donald Trump’s rescission of DACA had been unlawful—largely because it had been carelessly effectuated, defended pretextually, but also because hundreds of thousands of young people had altered their lives in reliance on the promise that they would be immune from deportation.

In a key section of the majority opinion, Roberts highlighted the humanity of these young undocumented people, as was the hopes and dreams of their families: “Since 2012, DACA recipients have enrolled in degree programs, embarked on careers, started businesses, purchased homes, and even married and had children, all in reliance” on DACA, Roberts wrote, quoting from briefs in the case. “The consequences of the rescission … would ‘radiate outward’ to DACA recipients’ families, including their 200,000 U.S.-citizen children, to the schools where DACA recipients study and teach, and to the employers who have invested time and money in training them.” The chief justice evinced frustration that the Trump administration seemingly took none of those very human interests into account.

One week later, on Thursday morning, the high court proved that its sympathies for immigrants seeking better lives are limited. In a 7–2 ruling, the justices approved the Trump administration’s draconian interpretation of a federal law that limits courts’ ability to review deportation orders. This time around, the court did not note immigrants’ contributions to the nation or acknowledge their humanity in any way. Having last week treated one class of immigrants like actual people, the court on Thursday pivoted back to callous cruelty. All of the chief justice’s kind words about DACA recipients seemingly do not apply to immigrants who—according to the executive branch—do not deserve asylum.

Thursday’s case, Department of Homeland Security v. Thuraissigiam, involves an asylum-seeker from Sri Lanka named Vijayakumar Thuraissigiam who faces likely death if he is deported because he is Tamil. Thuraissigiam was apprehended by the U.S. Border Patrol while trying to cross at the southern border in 2017. After an asylum officer and immigration judge rejected his claims, Thuraissigiam was slated for “expedited removal.” Federal law bars courts from reviewing that deportation order. But the 9th U.S. Circuit Court of Appeals found the law unconstitutional as applied to Thuraissigiam under the Constitution’s suspension clause, which limits the government’s ability to restrict habeas corpus—the centuries-old right to contest detention before a judge.

At the Trump administration’s request, the Supreme Court reversed the 9th Circuit, with Justice Samuel Alito writing a maximalist majority opinion for the five conservatives and Justices Stephen Breyer and Ruth Bader Ginsburg proffering a narrower concurrence. Justice Sonia Sotomayor penned a lengthy, vivid dissent joined by Justice Elena Kagan that accused the majority of flouting more than a century of precedent and “purg[ing] an entire class of legal challenges to executive detention.” (In his own opinion, Alito dismissed Sotomayor’s criticisms as mere “rhetoric.”)

This outcome strips due process from immigrants seeking asylum, who now have even fewer rights to a fair adjudicatory process under an expedited system that already afforded them minimal protections. It will also embolden the Trump administration to speed up deportations for thousands of people with no judicial oversight. Under this now court-approved system, immigrants fleeing their home country must undergo a “credible fear” interview, at which they must explain to a federal officer why they qualify for asylum. (The Trump administration has allowed Customs and Border Protection agents—not trained asylum officers—to conduct credible fear interviews.) If the officer finds no “credible fear of persecution,” their supervisor reviews the determination, as does an immigration judge (who is not a traditional judge but rather an employee of the executive branch appointed by the attorney general). If these individuals find no credible fear, the immigrant is thrown into “expedited removal”—that is, swiftly deported in a matter of weeks. They may not contest the government’s “credible fear” determination before a federal court. It is this extreme rule that Thuraissigiam challenged as a violation of habeas corpus and due process.

Alito breezily dismissed Thuraissigiam’s individual claims by stripping a broad swath of constitutional rights from unauthorized immigrants. First, he declared that habeas corpus does not protect an immigrant’s ability to fight illegal deportation orders. Sotomayor fiercely contested this claim, citing an “entrenched line of cases” demonstrating that habeas has long protected the right of individuals—including immigrants—to challenge illegal executive actions in court. Second, Alito held that unauthorized immigrants who are already physically present in the United States have not actually “entered the country.” Thus, they have no due process right to challenge the government’s asylum determination. Sotomayor noted that this holding departs from more than a century of precedent by imposing distinctions drawn by modern immigration laws on the ancient guarantee of due process.

Alito not only waved away these galling consequences; he seemed to laugh at them.

The upshot of the decision will mean almost certain death for Thuraissigiam and others like him. Thuraissigiam faced brutal persecution in Sri Lanka, a fact Alito did not seem to understand at oral arguments. Various officials in the executive branch shrugged off that persecution. Thuraissigiam just wants an opportunity to prove to a federal judge that these officials violated the law by denying his asylum claim. Now, thanks to the Supreme Court, he cannot. Nor can the many immigrants thrown into expedited removal by the Trump administration, which has used the process as a tool to speed up deportations across the country. Just two days ago, a federal appeals court cleared the way for the government to expand expedited removal beyond immigrants intercepted near the border to those apprehended anywhere in the nation. The administration has shown little interest in carefully considering whom it’s deporting; now many of those decisions will be rubber-stamped by executive officers and left unscrutinized by the federal judiciary.

Alito not only waved away these galling consequences; he seemed to laugh at them. Not for a moment does he appear to believe that asylum-seekers may be genuinely in fear for their lives. Among the many bon mots dropped by Alito in his opinion, he wrote: “While [Thuraissigiam] does not claim an entitlement to release, the Government is happy to release him—provided the release occurs in the cabin of a plane bound for Sri Lanka.” Given that Thuraissigiam claims he will likely be tortured to death if he is sent back to Sri Lanka, it’s not clear that line means what he thinks it does. Throughout the opinion Alito refers to Thuraissigiam as either “alien” or “respondent” and appears simply incapable of imagining that his claims are truthful.

RECENTLY IN JURISPRUDENCE

It’s easy to miss the massive erosion of asylum-seekers’ rights in the victory last week around the triumph of DACA. But in some ways, it’s the most American outcome in the world to view DACA beneficiaries as more human because they have gone to school here and birthed children here, while scoffing at asylum-seekers, who, as part of a lengthy tradition under both constitutional and international law, simply ask the U.S. government to save their lives. Roberts, who seemed so attuned to the hardships of DACA recipients, joined Alito’s merciless opinion in full; in fact, the chief justice assigned the opinion to Alito, who has become the court’s staunchest crusader against immigrants’ rights.

The court’s split shows that a majority of justices think immigrants like Thuraissigiam are not the productive young people of the DACA case, with financial and familial ties to all that makes America great, but rather faceless masses cynically manipulating America’s generous asylum policy and overwhelming its immigration system. They believe these people do not deserve an iota of sympathy, let alone due process. That is already how many border agents viewed these immigrants: not as humans with rights, but as fraudulent parasites. The Supreme Court has now transformed that vision into law—and, in the process, allowed the executive to send more persecuted people to their deaths without even a meaningful day in court.

Imposing death sentences without fair hearings, or indeed any real hearings at all, is bad stuff. And, Justices who justify this behavior should not be on the bench at all.

Sadly, that applies just as much to the two so-called “liberal icons” who voted with Alito and four other sneering colleagues who seemed to actually glory in being able to dehumanize another soul with the audacity to fight for his life. Frankly, this stuff is right out of the Third Reich. Read a few of the German Judiciary’s opinions of the time and see how quickly, easily, naturally, and often happily Reich jurists “justified the unjustifiable and the unthinkable.”  I have no doubt that Sam Alito and some of his colleagues would have fit right in. How has American Justice gotten to this incredible “low point.”

I don’t know exactly what we can do about life-tenured judges who are unqualified for their jobs. Life tenure is there for a reason — to insure judicial independence overall, even in particular instances like this where it clearly does no such thing. And, with 200+ largely unqualified Trump appointees now on the Federal Bench, essentially “young deadwood,” the problem will get worse before it gets better.

The first step is to replace Trump and oust the GOP from the Senate. Then, methodically appoint only judges committed to equal justice for all, willing to stand up against abuses of justice by both the Executive and the Congress, and whose life experiences and legal work show an unswerving commitment to human rights and the rights of migrants to be treated as persons (fellow humans) under law.

It’s a national disgrace that with immigration and human rights the major issues clogging today’s Federal Courts, few, if any, Federal Judges have any experience representing asylum seekers in the Star Chambers known as “Immigration Courts” nor have they personally experienced the type of dehumanization, racism, torture, grotesque abuses, and unnecessary cruelty that they so unnecessarily, uncourageously, and glibly inflict on migrants and asylum seekers who indeed are the most vulnerable among us. If immigration and human rights are the pivotal issues of American justice, then we need to get Justices and judges on the bench who understand what they are doing and the dire human consequences of their actions (or inactions). 

The situation of today’s asylum seekers of color is not much different from that of others Americans of color whose legal and Constitutional rights were denied, and whose humanity was intentionally degraded, by a corrupt judiciary and a legal system that intentionally failed to make Constitutonal equal justice for all a reality rather than a cruel fiction .

A nation that doesn’t demand better judges will never rise above its own mistakes and failures. And a Federal Judiciary that so obviously and intentionally lacks diversity and humanity can never properly serve the national interest. 

Ditch the clueless, largely white, male “dudocracy” with their Ivy League degrees and not much else to offer. Appoint judges schooled in real life, who know what the law means in human terms and will use it to solve, rather than aggravate, inflame, or avoid, human problems! There are tons of such lawyers out there. We all know them. We need them to move from the “bullpen” to the Federal Benches, before it’s too late for everyone in America!

Folks, what we have here is “judicially-approved murder without trial.” It could also be called “extrajudicial killing.” Ugly, but brutally true! “The upshot of the decision will mean almost certain death for Thuraissigiam and others like him.” We should understand what’s happening, even if seven disingenuous and unqualified members of our highest court claim not to know or care what they are doing and refuse to acknowledge the real life consequences of their deep, dark, and disturbing intellectual corruption and their studied lack of human compassion, empathy, and decency.

‘I Will Not Stand Silent.’ 10 Asian Americans Reflect on Racism During the Pandemic and the Need for Equality

Diseases and outbreaks have long been used to rationalize xenophobia: HIV was blamed on Haitian Americans, the 1918 influenza pandemic on German Americans, the swine flu in 2009 on Mexican Americans. The racist belief that Asians carry disease goes back centuries. In the 1800s, out of fear that Chinese workers were taking jobs that could be held by white workers, white labor unions argued for an immigration ban by claiming that “Chinese” disease strains were more harmful than those carried by white people.

Today, as the U.S. struggles to combat a global pandemic that has taken the lives of more than 120,000 Americans and put millions out of work, President Donald Trump, who has referred to COVID-19 as the “Chinese virus” and more recently the “kung flu,” has helped normalize anti-Asian xenophobia, stoking public hysteria and racist attacks. And now, as in the past, it’s not just Chinese Americans receiving the hatred. Racist aggressors don’t distinguish between different ethnic subgroups—anyone who is Asian or perceived to be Asian at all can be a victim. Even wearing a face mask, an act associated with Asians before it was recommended in the U.S., could be enough to provoke an attack.

Since mid-March, STOP AAPI HATE, an incident-reporting center founded by the Asian Pacific Policy and Planning Council, has received more than 1,800 reports of pandemic-fueled harassment or violence in 45 states and Washington, D.C. “It’s not just the incidents themselves, but the inner turmoil they cause,” says Haruka Sakaguchi, a Brooklyn-based photographer who immigrated to the U.S. from Japan when she was 3 months old.

Since May, Sakaguchi has been photographing individuals in New York City who have faced this type of racist aggression. The resulting portraits, which were taken over FaceTime, have been lain atop the sites, also photographed by Sakaguchi, where the individuals were harassed or assaulted. “We are often highly, highly encouraged not to speak about these issues and try to look at the larger picture. Especially as immigrants and the children of immigrants, as long as we are able to build a livelihood of any kind, that’s considered a good existence,” says Sakaguchi, who hopes her images inspire people to at least acknowledge their experiences.

Amid the current Black Lives Matter protests, Asian Americans have been grappling with the -anti-Blackness in their own communities, how the racism they experience fits into the larger landscape and how they can be better allies for everyone.

“Cross-racial solidarity has long been woven into the fabric of resistance movements in the U.S.,” says Sakaguchi, referencing Frederick Douglass’ 1869 speech advocating for Chinese immigration and noting that the civil rights movement helped all people of color. “The current protests have further confirmed my role and responsibility here in the U.S.: not to be a ‘model minority’ aspiring to be white-adjacent on a social spectrum carefully engineered to serve the white and privileged, but to be an active member of a distinct community that emerged from the tireless resistance of people of color who came before us.”

“I didn’t think that if he shoved me into the tracks I’d have the physical energy to crawl back up,” says Tsui, a registered nurse pursuing a doctorate of nursing practice in psychiatric mental health at Columbia University. Tsui was transferring trains on his way home after picking up N95 masks when he was approached by a man on the platform.

The man asked, “You’re Chinese, right?” Tsui responded that he was Chinese American, and the man told Tsui he should go back to his country, citing the 2003 SARS outbreak as another example of “all these sicknesses” spread by “chinks.” The man kept coming closer and closer to Tsui, who was forced to step toward the edge of the platform.

“Leave him alone. Can’t you see he’s a nurse? That he’s wearing scrubs?” said a bystander, who Tsui says appeared to be Latino. After the bystander threatened to re­cord the incident and call the police, the aggressor said that he should “go back to [his] country too.”

When the train finally arrived, the aggressor sat right across from Tsui and glared at him the entire ride, mouthing, “I’m watching you.” Throughout the ride, Tsui debated whether he should get off the train to escape but feared the man would follow him without anyone else to bear witness to what might happen.

Tsui says the current anti­racism movements are important, but the U.S. has a long way to go to achieve true equality. “One thing’s for sure, it’s definitely not an overnight thing—I am skeptical that people can be suddenly woke after reading a few books off the recommended book lists,” he says.“Let’s be honest, before George Floyd, Breonna Taylor and Ahmaud Arbery, there were many more. Black people have been calling out in pain and calling for help for a very long time.”
