As my friend and former partner at Fragomen Cynthia Lange pointed out at a recent PLI conference, if every attorney or accredited representative who cares about justice saves just one life over the next four years, that’s thousands of lives saved, including family members! And, that will inspire others to do the same. Eventually, it can be tens of thousands or hundreds of thousands, perhaps millions, of lives saved!

As I’ve previously observed:

I hope this email finds you well, with the holiday season upon us.

I wanted to write and tell you again how much the training last spring stands out in my mind as a highlight for 2023.  I received my full accreditation in June and have represented three different clients in proceedings so far.  The judges in San Antonio have been very open to dismissing cases, and two of the three cases were dismissed as an exercise of prosecutorial discretion!  Our clients have been able to apply for asylum affirmatively and hopefully will be successful, even though we anticipate a very long wait for their interviews.  I have also completed U visa filings, a T visa filing, family petitions and lots and lots of work permits.  Mailing every filing fills me with so much hope.

I hope that I will get a chance to see you again at a future VIISTA event!

An immigrant advocacy center found that when their staff were able to provide legal representation or help to immigrants facing credible fear interviews, the immigrant outcomes improved considerably.

Las Americas Immigrant Advocacy Center, a nonprofit based in El Paso, released a report last week detailing challenges the organization’s staff found and recommendations for change and statistical data on individuals seeking asylum in the U.S. The nonprofit initiated a pilot project over eight weeks in the summer of 2023 in two New Mexico immigration detention facilities: The Torrance County Detention Facility and Otero County Processing Center along with the El Paso Processing Center. The project sought to provide participating asylum seekers legal representation or help in preparation prior to the migrant’s credible fear interview. They found that the participating asylum seekers had a 91.6 percent pass rate at the three facilities.

A credible fear interview is an important part of the immigration process for asylum seekers, advocates have said. Often, asylum seekers are placed into detention facilities where there is documented abuse before they are allowed a credible fear interview with an immigration judge. Advocates who work with asylum seekers have said that asylum seekers are often brought to a room to talk to the immigration judge over the phone. The conversation is not private and the asylum seeker is often not given time to prepare. Sometimes the asylum seeker is not provided a translator and not all asylum seekers speak Spanish or English. If the asylum seeker fails to convince an immigration judge of the danger they left behind, the asylum seeker is most likely to face deportation and are often returned to life threatening situations, advocates have told NM Political Report in the past.

One recommendation to help solve the problem is for the creation of scholarship programs for community members with lived experience and building a community accreditation program that would offer community members with free training and job placement.

“This would also provide a cost-effective way of expanding legal services to meet demand, giving organizations like ours a more sustained means of providing quality legal services to a higher number of migrants,” the report states.

Studies like this reflect a reality that experts have long recognized, but few politicos and media figures are willing to admit:

  • Many, probably the majority, of those arriving at the border have credible claims for asylum;
  • They won’t be “deterred” from coming by cruelty, punishment, negative, often racist, rhetoric, and ever more extreme, deadly, yet ultimately ineffective border militarization;
  • With competent representation and better adjudicators —  those with demonstrated, recognized adylum expertise — at both USCIS and EOIR many more asylum claims can and should be granted in a timely manner;
  • Rather than more expensive, ineffective border militarization, harsh imprisonment (“New American Gulag”), and coming up with new immoral and illegal restrictions on asylum, the Federal Government should be investing in more rational and cost-effective measures such as:
    • Training and approving more accredited representatives for arriving asylum seekers through programs like VIISTA Villanova;
    • Assisting localities and NGOs with reception and resettlement services;
    • Implementing better hiring practices and asylum training at the Asylum Office and EOIR;
    • Granting more asylum cases in a timely manner at or near to the “initial encounter” level (something that the Administration empowered itself to do, then inexplicably “suspended” the program just when it was MOST needed);
    • Developing better coordination, skills matching, and job training for those granted asylum;
    • Investing in English Language Learning, vocational training, social work, and other integration and assimilation services in communities where refugees resettle (notably, this would also create good job opportunities — many at the “professional” level — for existing U.S. workers).

It’s past time to move beyond “open border myths” and come up with humane, productive, legal, and effective programs to deal with the realities of human migration at our border!

“Gerardo Caballero-Vega, a Mexican citizen, entered the United States in 1993 without admission or parole by an immigration officer when he was eight years old. He was removed to Mexico in 2019. Shortly after his removal, Caballero-Vega returned to the United States and applied for asylum, withholding of removal, and protection under the Convention Against Torture. Later that year, the Immigration Judge (“IJ”) granted his application for asylum, which the Department of Homeland Security (“DHS”) appealed to the Board of Immigration Appeals (“the BIA”). In 2020, the BIA vacated the IJ’s decision for clear error and ordered Caballero-Vega’s removal to Mexico. The following year, Caballero-Vega filed a petition for review in this court. We reverse the BIA’s vacation of the IJ’s decision and remand the case for further review. … Caballero-Vega became a criminal informant for the San Mateo County District Attorney in 2012. He reported to law enforcement on the drug, firearm, and human trafficking conducted by Nuestra Familia, a California prison gang, as well as the Norteño Gang, Nuestra Familia’s “foot soldiers” in the streets. R. Vol. I at 143. Following his informant work, he testified against Nuestra Familia members in criminal court. Caballero-Vega was placed in a witness protection program during and after his testimony. … On November 13, 2019, the IJ granted Caballero-Vega’s application for asylum, finding that he had established a well-founded fear of future persecution based on his membership in the group of “informants who have testified in court against gangs.” … DHS appealed the decision to the BIA. On December 15, 2020, the BIA sustained DHS’s appeal, vacated the IJ’s grant of Caballero-Vega’s asylum, and ordered Caballero-Vega’s removal to Mexico. Specifically, the BIA found that there was “clear error in the [IJ]’s finding that there’s a reasonable possibility that [Caballero-Vega’s] 2012 status as an informant and his 2013 or 2014 United States testimony against United States gang members will be a central reason for possible future harm to [him] upon removal to Mexico.” … We find insufficient the BIA’s explanation for its finding that the IJ’s decision is clearly erroneous. The fact that Caballero-Vega was not persecuted in Mexico is of little-to-no probative value here because he escaped before he could be identified by cartel members. Likewise, the fact that he was not threatened or harmed in the United States following his time as an informant is unhelpful because he was in witness protection for that entire period. Finally, the expert testimony cited by the IJ demonstrates that Mexican cartel members and United States gang members cooperate extensively, so the fact that Caballero-Vega testified against individuals based in the United States, not Mexico, is not dispositive. Thus, none of the reasons the BIA offers for vacating the IJ’s decision justifies the BIA’s finding of clear error. We remand Caballero-Vega’s case to the BIA to accept the IJ’s decision or to provide further justification for its finding that the IJ’s decision is clearly erroneous.”

Asylum was correctly granted in November 2019. 3.5 years later, the case is still kicking around because the wrong “judges” are on the BIA.

Ever wonder why EOIR has unmanageable backlogs? Even when the system works as it should and protection is granted at the initial level, the BIA and their “partners” at DHS Enforcement combine to screw it up! We need Article I!

Dems keep babbling about “Federal Court reform.” But, they can’t even achieve long-overdue progressive reforms to a court system they totally “own!”

Why won’t the Biden Administration govern in accordance with the humane, practical, legal values they ran upon, when it comes to human rights, immigration, and racial justice? Don’t kid yourself! Rather than being “expendable” or “negotiable,” THESE are the issues on which our democracy will eventually stand or fall! That’s something that the younger generation must focus on!

Sessions and Miller wasted almost no time in co-opting and weaponizing EOIR against asylum seekers, migrants, people of color, and even smearing and attacking those defending them. Evil though they were, they had passion and a plan for dehumanization, destruction, and undermining democracy!

Social justice in America needs passionate, brave, principled advocates and defenders! There are plenty of them “out here!” Indeed, My Round Table colleague Judge Ilyce Shugall and I are surrounded by them here at the VIISTA celebration and training at Villanova!

As Father Donohue said at yesterday’s celebration,  “‘Woke’ means social justice!” Amazing people have come here from the Southern Border where they work with asylum applicants on both sides of the border. Every day, they see the human trauma, racism, pain, and suffering caused by the Administration’s failure to innovate, lead, and stand up for human rights. These are the preventable human dramas and traumas that smug, ill-informed Administration “policy makers” run away from — they don’t have the courage to face and learn from those they abuse!

Values – human rights and legal rights — CAN’T  EVER be “trumped” by “reelection concerns.” I might also add that the “Miller Lite” strategy followed by the Administration hasn’t found supporters or made them friends anywhere on the political spectrum! If you are going to make folks mad, why not at least be doing the right thing? Are competence, innovation, humanity, keeping campaign promises, and following the law REALLY political “losers” as Biden apparently believes? I doubt it!

The Biden Administration and many congressional Dems apparently lack passion and guts! Without the basic governing skills and integrity to undo the horrible human and systemic damage inflicted by Trump and institutionalize due process and fundamental fairness, the Dems are wandering in the social justice wilderness! No passion, no values, no expertise! Doesn’t say much for a party that promised to be a “socially just” alternative to anti-American Trumpist White Nationalism!

The court’s opinion carries the reader along on what purports to be textual analysis and implacable logic. On closer examination, however, it is a startling exercise in judicial imperialism. The opinion seizes on fragments of statutory text, taken out of context, to construct a presumed congressional intent that would be more to the judges’ liking. It ignores contrary indicators in the wording and the historical development of the key provisions. It makes no attempt to reconcile the supposed strict mandate with the historical fact that Congress went 20 years without really noticing—much less objecting to—the absence of implementation. The court also shows an arrogant disregard for the operational realities of border enforcement, including the sensitivity of diplomatic relations with Mexico that sustain cross-border cooperation—on migration issues as well as other policy priorities.

I can bring some special perspective in analyzing the appeals court’s decision.  I have been a scholar and teacher of immigration law for 40 years, and I also was fortunate to hold policy-level positions dealing with immigration in three different departments, under three different Presidents. My years in government gave me close exposure to the operational realities at a level most law professors—and judges—don’t experience. One of those stints consisted of 30 months during the mid-nineties as General Counsel of the Immigration and Naturalization Service (INS) the period when the key reform bills on which the Fifth Circuit relies were introduced, debated, amended, enacted and implemented.

Remarkably, in their 117 pages of snarky, wooden legalese, demeaning of humanity, and willfully misrepresenting reality, these life-tenured righty judges (surprise, two Trumpists, one Bush I) give no serious consideration whatsoever to the well-documented, daily, ongoing abuses of the human and legal rights of those fleeing oppression who are subjected to this heinous White Nationalist program! Just how do asylum applicants exercise their statutory “right” to apply for asylum and other protection under U.S. and international law if they are dead, kidnapped, beaten, extorted, raped, threatened, given inadequate notice of hearing, denied their right to legal assistance, prevented from preparing and documenting their cases, and if they are fortunate enough to finally get a hearing, subjected to an anti-asylum, anti-due-process, non-asylum-expert “faux judiciary” run by a prosecutor with a majority of his “holdover judges” appointed or co-opted by his White Nationalist, asylum-hating predecessors? The Fifth Circuit doesn’t bother to explain. That’s probably because historically their failure to stand up for human rights and racial justice for those in need of protection has been part of the problem.

Also, it’s remarkable how righty judges who couldn’t find any reasons to stop the Trump regime from rewriting asylum law out of existence in unprecedented ways, without legislation, and usually without regard to the APA, suddenly take a much different position when it comes to the Biden Administration’s modest efforts to vindicate human rights and restore some semblance of the rule of law. But, that’s actually less surprising than the Biden Administration’s failure to “see the handwriting on the wall” and have a “Plan B” in operation.

Obviously, these three life-tenured right-wing human rights abusers in robes need to spend a few months “detained” in Mexico or in the “New American Gulag!” But, that’s wishful thinking. Not going to happen! These are ivory tower guys with life tenure, fat salaries, and robes who use their positions to pick on the most vulnerable in the world and deprive them of their legal and human rights based on intentional misconstructions of the law, ignorance of reality, and pandering to a rather overly political racist appeal from GOP AGs who are from “the bottom of humanity’s —  and our legal profession’s — apple barrel!” Doesn’t get much worse than that!

Nevertheless, it should be clear to both advocates and the Biden Administration that “Remain in Mexico” likely is here to stay! Despite the lack of merits to the Fifth Circuit’s decision, and the Supreme’s granting of the Biden Administration’s cert petition, I wouldn’t hold my breath for relief from either the right-wing Supremes or the feckless Dems in Congress.

Given that the program is likely to be judicially imposed, the Administration and advocates can still get together to make it work in compliance with due process. It’s well within their power and not rocket science:

  • Appoint a new BIA with appellate judges who are practical scholars in asylum and will establish coherent, correct legal guidance on domestic violence claims, gender based asylum, gang-based claims, nexus, “failure of state protection,” credibility, corroboration, the operation of the presumption of future persecution, the DHS’s burden of rebutting the presumption, “rise to the level,” right to counsel, fair hearings, and other critical areas where the current “Trump holdover” BIA’s guidance has been lacking, inadequate, and/or defective. They can also insure consistency in asylum adjudications, something that has long escaped EOIR.
  • Get a corps of Immigration Judges with established records and reputations for scholarly expertise, commitment to due-process, practicality, and fairness to asylum seekers to handle these cases.
  • Work with pro bono and advocacy groups and the UNHCR to insure that every person applying under this program has access to competent representation and adequate opportunities to prepare and document cases. Nolan Rappaport and I have recently written about the “largely untapped potential” of a better “qualified representative” program. Professor Michele Pistone at Villanova Law has done some ground-breaking innovative work on training accredited representatives for asylum cases in Immigration Court.   • Work with the Government of Mexico and the UNHCR to guarantee the health, security, safety, and welfare of those waiting in camps in Mexico.

Then, we’ll finally find out how many of those who have already passed credible fear actually qualify for a grant of asylum under a fair, competent, timely system run by experts with individuals who are well-represented! I’ll bet it’s the majority, not the measly 2% who have received grants under EOIR’s “Stephen Miller Lite” approach! 

For example, during 13 years on the trial bench, I found that the majority of those referred to Immigration Court after a positive “credible fear” finding (all of the “Remain in Mexico” applicants fall in that category) qualified for asylum or some other type of protection from removal. And, like my friend and long time-colleague Professor Martin, I’ve been working on asylum issues from enforcement, advocacy, academic, and judicial standpoints, in and out of government, since before there was a Refugee Act of 1980!

So, to me, the “2% asylum grant rate” in Immigration Court for these cases,” particularly in light of some revised intentionally overly restrictive “credible fear” criteria imposed by the Trump regime, appears clearly bogus. Why hasn’t Garland looked into the systemic defects in the EOIR system, as applied to “Remain in Mexico,” that have artificially suppressed the grant rate?

Lack of lawyers, undue hinderances on gathering evidence and presenting cases, poor notice, lack of expertise, inadequate training, and anti-asylum performance by IJs and the BIA, and in some cases kidnapping, assault, rape, extortion, and other well-documented physical harm knowingly inflicted on applicants by placing them in clearly dangerous and unacceptable conditions in Mexico are just the start!

There are lots of creative ways of making our current immigration system work better! You just need the knowledge, motivation, expertise, and guts to make it happen! So, far that’s been lacking at all levels of the Biden Administration, but particularly at Garland’s “brain-dead” DOJ. Gosh, these guys make Stephen Miller look like a “creative genius,” albeit an evil and pathological one! 🤯🤮🏴‍☠️ Come on, man! 

As many of us have pointed out, Garland, Mayorkas, Biden, and Harris could and should have had such a system up and operating by now! Outrageous and disgusting as the conduct of the 5th Circuit has been, it’s hardly unpredictable given past performance. Every day that the Administration continues to waste by not making the necessary changes at EOIR, a court system totally within their control, adds to the human misery and injustice!

So, bottom line: White Nationalist judges get life tenure from the GOP. Meanwhile, back at the ranch of the “Gang That Couldn’t Shoot Straight,” Biden and Garland retain Trump’s White Nationalist appointees and enablers at EOIR and eschew the chance to create a diverse, progressive, expert, practical, due-process-oriented, fundamental-fairness-insistent, racial-justice-committed judiciary to decide life-or-death cases that affect and influence the operation of our entire justice system and our democracy in ways that no other court system in America does! The Administration’s alarming “tone deafness” is blowing perhaps the “last clear chance” to create a “model judiciary!”  Sounds like something only a Dem Administration could do. Go figure!

President Biden promised to reform immigration policy. How has that been going?

Illinois’ law ending immigration detention in 2022 hits snag

WaPo: Three Illinois counties with such federal agreements faced a Jan. 1 deadline to end contracts. While one in downstate Illinois complied last year, two others are involved in a federal lawsuit challenging the law. The case was dismissed last month, but a federal judge on Thursday granted an extension while an appeal is considered. Authorities in McHenry and Kankakee counties now have until Jan. 13.

The problem with “ADR” @ EOIR is chronic! It’s one that Garland seems determined to repeat, despite ample advice to the contrary.

Also, he’s ignored the availability of many “practical experts” on the outside who, if appointed to key EOIR positions, could have helped him solve this without stomping on due process (although, I admit the solution would have been easier in March 2021, when Garland was sworn in as AG, than it is after 9 months of his making it worse — not to mention that his “defiant tone-deafness” has probably “turned off” some of the top-flight talent he needed to “reach out” to). As the KQED article points out:

  • “But there’s a lot of room for improvement, and I don’t know if the people that are being named to supervise this actually know what’s happening in the trenches.”
    • Duh! That’s what all of us have been saying. Truth is, they aren’t the right people, and they don’t know what’s happening. Not by a long shot!
    • I also understand why Torres, who’s trying to maintain a relationship with Garland’s “Clueless Crew” is trying to be charitable.
    • But, as someone not currently “out there in the trenches,” I don’t have to be so reticent. So, I’ll say what she can’t. This is a totally unacceptable and inexcusable performance from Garland! 
  • Another reason why this program is a massive failure is that, like their ADR-promoting, backlog-building predecessors, Garland & Mayorkas started this misguided and mishandled program without seeking the advice, counsel, and support of the pro bono lawyers who have to staff it to make it work!
    • Think of the total absurdity of what Garland is doing here! While a pro bono (or low bono) lawyer is having already prepared cases “orbited” years out on the docket (a process that usually requires re-preparation of the entire case), the phone is ringing off the hook with desperate, perspective new clients given unrealistically expedited hearing dates that should have been used for the cases “orbited” to the end of the docket.
  • Also, having not practiced privately for many years, Garland appears to have forgotten the Code of Ethics.
    • Attorneys are obligated not to take on work (even pro bono work) that they can’t professionally and timely handle.
    • Yet, Garland is pushing them to do exactly that! The choice is let folks try to prepare their own cases (literally tantamount to a “death sentence” in many cases); or 
    • Take on work you can’t handle (a clear ethical violation that could have the same unfavorable result for the client).
  • There actually are ways of working with outside experts to increase pro bono representation. One of the most promising is the the amazing VIISTA Program created and run by Professor Michele Pistone at Villanova Law to train non-attorney “Accredited Representatives” to handle pro bono asylum cases.
    • I have no knowledge that Garland or anyone at EOJ/EOIR has ever reached out to Professor Pistone, despite recommendations that Garland do so.
    • Worse yet, Garland has allowed his “EOIR Clown Show” to also create a “new backlog” in the approval process for Accredited Representatives! Talk about clueless, counterproductive mismanagement!
  • Garland’s mis-handling of EOIR and his new round of “Aimless Docket Reshuffling” raises serious issues about his own performance.
    • Whatever happened to Democratic oversight of EOIR in Congress? Why is Garland getting a “free pass” on mismanagement of EOIR, his further undermining of Due Process in Immigration Court, and his disrespectful treatment of the immigration pro bono and low bono bar?

I am reaching out again to ask for your help in recruiting adjunct professors for VIISTA, the new online certificate program I created at Villanova University to train immigrant advocates.  The program launched in the fall and will start again in May.  We expect to need 3-5 additional adjunct professors to start in May, August and/or January.

The VIISTA certificate program is aimed at people who are passionate about immigrant justice but are not interested in pursuing a law degree at the moment, such as recent college grads, people seeking an encore career, retirees and the many who currently work with migrants and want to understand more about the immigration laws that impact them.  It is also attractive to students seeking to take a gap year or two between college and law school or high school and college.

 

VIISTA is offered entirely online and is asynchronous, allowing students to work at their own pace and at times that are most convenient for them.  I piloted the curriculum during last academic year and the students loved it.  It launches full time in August, and will subsequently be offered each semester, so students can start in August, January, and May.

 

The Adjunct Professors will work with me to teach cohorts of students as they move through the 3-Module curriculum.  Module 1 focuses on how to work effectively with immigrants.  Module 2 is designed to teach the immigration law and policy needed for graduates to apply to become partially accredited representatives.  Module 3 has more law, and a lot of trial advocacy for those who want to apply for full DOJ accreditation.  Each Module is comprised of 2×7-week sessions and students report that they have worked between 10-15 hours/week on the course materials.  As an adjunct professor, you will provide feedback weekly on student work product, conduct live office hours with students and work to build engagement and community among the students in your cohort.  Tuition for each Module is $1270, it is $3810 for the entire 3-Module certificate program.

Michele tells me that the time commitment is approximately 8-10 hrs/week, and significantly, the teaching can be done from anywhere you have an internet connection!

For those of you who haven’t taught law online, I was amazingly pleased by my experience last summer at Georgetown Law. Of course, I attribute that almost all to the remarkable skills of the students in creating dialogue and sharing information. They also did it with humor, creativity, and “presence,” showing that they understood the ”performing artist” aspects of lawyering, judging, and teaching!

I also benefitted from the outstanding technical support, instruction, and patience from the Georgetown Law staff! I know that Michele’s technical support is also some the most talented out there on the internet!

And, the best part of the job would, in my view, be working with Michele who is one of the best, most creative, and most “constructively disruptive” minds in American law, as well as being just a wonderful human being! I learn something new every time I speak with her!

11 Years of Government Data Reveal That Immigrants Do Show Up for Court

WASHINGTON—A new report released today by the American Immigration Council examines 11 years of government data on the rate at which immigrants appear for hearings in U.S. immigration court. The report, “Measuring In Absentia Removal in Immigration Court,” concludes that an overwhelming 83% of immigrants attend their immigration court hearings, and those who fail to appear in court often did not receive notice or faced hardship in getting to court.

As the new administration of President Joe Biden considers how to reform the immigration system, including the immigration courts, this report reveals how reliance on detention, access to legal representation, and immigration judges’ docket management impact immigrants’ appearance rate.

The report draws on government data from 2,797,437 immigration court removal proceedings held between 2008 to 2018. It documents how individuals who were never detained and those who were released from detention proceeded through court and what obstacles they faced in pursuing their immigration cases.

The report finds that people released from immigration detention and individuals with attorneys overwhelmingly attend their hearings. Data also show that immigration judges have a vital role in maintaining due process. The findings further demonstrate that the creation of an independent structure for the immigration courts would help reduce the prevalence of unwarranted in absentia removal orders and give immigration judges more discretion in managing their dockets and individual case decisions.

The main findings of the report include:

  • 83% of nondetained immigrants with completed or pending removal cases attended all of their hearings.
  • 96% of nondetained immigrants represented by a lawyer attended all of their hearings.
  • 15% of those who were ordered deported because they did not appear in court successfully reopened their cases and had their removal orders rescinded. In some years, as many as 20% of all orders of removal for missing court were later overturned.
  • Individuals who apply for relief from removal have especially high rates of appearance.
  • Appearance rates vary strongly based on the immigration court’s location.
  • The Executive Office for Immigration Review’s method for measuring the rate at which immigrants fail to appear in court presents a limited picture of the frequency of missed court appearances.

“The empirical research presented in this report debunks the myth that immigrants don’t show up for court,” said Ingrid Eagly, professor of Law at UCLA School of Law. “Relying on the government’s own immigration court data, co-author Steven Shafer and I find that, since 2008, 83% of all immigrants in nondetained deportation cases have attended all of their court hearings. In addition, over the 11 years of our study, 96% individuals represented by an attorney attended all of their court hearings.”

“Today’s report verifies what those who have worked in the immigration court system already knew: immigrants overwhelmingly show up in court. We hope that this data finally puts to rest a false narrative about immigrants’ appearance rates that past administrations used to justify restrictive and cruel immigration policies,” said Aaron Reichlin-Melnick, policy counsel at the American Immigration Council. “After previous administrations spent years funding immigration enforcement to address a small set of individuals who miss court, the Biden administration has the opportunity change course. To ensure even higher appearance rates, the new administration should focus on updating immigration court technology, providing better resources to orient immigrants, and working to ensure that all immigrants navigating our removal system are represented by counsel. As Congress debates immigration reform, this report shows that it’s time to revisit harsh and punitive laws that require judges to enter deportation orders for a single missed hearing and which limit the ability of the government to appoint counsel.”

“The findings of this timely report confirm what many of us formerly on the immigration bench have known for years: represented asylum seekers appearing before fair, knowledgeable judges show up for virtually all of their immigration court hearings,” said Paul Wickham Schmidt, former immigration judge and board member for the Board of Immigration Appeals. “The findings refute one of the many ‘big lies’ and ‘bogus narratives’ promoted by the last administration to demean and dehumanize asylum seekers and wrongfully deprive them of their legal and constitutional rights. The Biden administration should pursue changes that would provide immigration judges greater independence and discretion and support the creation of an independent structure for the immigration courts.”

Lies promoted by Government officials and turned into cruel, counterproductive, and biased policies cost lives and undermine our system of justice!

A stunning 96% of represented respondents appear for all hearings! The obvious step for the Biden Administration is to “repurpose” resources squandered by the defeated kakistocracy’s cruel, expensive, ineffective “enforcement gimmicks” like detention in the “New American Gulag,” ludicrous Immigration Judge “dashboards,” walls, bogus protocols, and illegal anti-asylum rules and instead invest in public-private partnerships to achieve universal representation. Building on existing programs, it should be possible to get all respondents represented by trained and competent counsel or accredited representatives. 

Notably, Professor Michele Pistone @ Villanova already runs VIISTA, an innovative, first class asylum litigation training program for accredited representatives. Put some Federal grant money into expanding it to meet the need for representation throughout America. These are “obvious steps” ignored by a captive “court system” run by malicious incompetents implementing a White Nationalist agenda.

Combined with a restoration of the rule of law at EOIR and rational DHS enforcement priorities, that’s the way to establish manageable Immigration Court dockets compliant with Due Process and fundamental fairness. Create a model court system that will be a source of pride, rather than a national disgrace. 

Of course a legislatively-enacted, independent, professionally administered expert Article I Immigration Court is absolutely necessary. But, due process and fundamental fairness can’t wait! Lives and futures, not to mention our national values, are at stake. Judge Garland must end the dysfunction and start making urgently needed improvements @ EOIR immediately!

Removing (former) Director McHenry — who promoted the kakistocracy’s anti-immigrant myths, bogus statistics, and “worst management practices” — is a great start. But, it’s certainly not the end of the urgent changes that must be made to implement Due Process and professional court administration at EOIR. In particular, the current BIA is a due process, human rights, and asylum expertise “disaster zone!”

I am thrilled to report that VIISTA is getting rave reviews.  The inaugural class of students is really enjoying the course.  They will be finishing Module 1 next week and will start Module 2 (with its focus on immigration law) in January.  I am really impressed so far with their work product and the quizzes and other assessments confirm that they are learning what we want them to learn.

Students in the inaugural class come from diverse backgrounds.  My current students include a Stanford college senior who aims to work as a paralegal next year, and eventually go to law school.  Other students are recent college grads interested in peace and justice/law/social work who want to make an immediate impact for immigrant families.  Some students are first-generation immigrants, others are children of immigrants.  Some students are retirees or those seeking an encore career, like empty nesters and parents coming back into the workforce. Three PhDs also enrolled in the program.  Many are volunteers with immigrant serving organizations.

Over the past four years, what passes for “management” at DOJ and EOIR has wasted millions of dollars, squandered thousands of hours of time, and kept the private bar on a treadmill with a steady stream of moronic, cruel, and inept “enforcement only” gimmicks, each seemingly stupider and more counterproductive than the last, driven by a White Nationalist nativist agenda. The result is a backlog that has exploded to astounding levels, (even with twice as many judges on the bench, many of them with questionable credentials and little if any expertise in immigration and human rights laws) and a totally dysfunctional mess that threatens to topple the entire Federal judicial system.

As those of us who understand immigration know, the key to a successful EOIR is representation! With an adequate supply of good representation, cases get sorted out at the earliest possible levels, claims are properly documented and presented, individuals show up at their hearings at remarkably high rates, and results are much more likely to be fair. Presto, “Aimless Docket Reshuffling” by EOIR shrinks, parties are encouraged to stipulate and get right to the contested issues, results at trial are more likely to be fair, appeals, petitions for review, and remands decrease, and the backlogs go down as the dockets come under control. Moreover, as the Immigration Court litigation experience improves, more practitioners get the “positive vibes” and are willing to undertake pro bono or low bono cases. Best practices developed to achieve fairness on EOIR’s high-volume docket find their way into other parts of the Federal Court system. It’s an all-around winner! Or, at least it should be!

So, any competent, rational, and knowledgeable “management group” at EOIR would make increasing representation “job # 1.” They would work cooperatively and harmoniously with bar groups, NGOs, states, and localities, to increase availability and improve quality of representation. They would eschew unnecessary detention, which inhibits representation, and insure than courts are reasonably and conveniently located in areas where private representation is abundantly available.

Of course, that’s not what the clowns at EOIR have done! Instead, they have gone out of their way to inflict misery on respondents and their representatives. Far from inspiring more folks to undertake cases, we have all seen stories of how the intentional rudeness and abuse inflicted in Immigration Court and the dysfunctional system actually demoralizes lawyers and causes them to leave the field. Their “stories of woe” are hardly encouraging  for others to donate time and effort.

Fortunately, while EOIR was busy ”kneecapping justice,” someone outside the “EOIR twilight zone” was thinking about how to solve the problem! With help from her friends, Michele designed the VIISTA program to train more non-attorney representatives to represent asylum seekers, convinced folks to fund it, recruited initial classes, and has it up and running. (By contrast, after two decades of wasted resources and incompetent meanderings, EOIR is still without a functioning e-filing system. Think that might have helped or saved some lives during the pandemic?) 

And the training is not only a bargain (with scholarships available), it is beyond first class in substance and content. Essentially, it’s “what you really need to learn in law school in less than a year.” The curriculum would put to shame any training we received at EOIR, even before the current Clown Show. My Round Table colleague Judge Jeffrey Chase (a/k/a “Sir Jeffrey”) has reviewed the curriculum and agrees.

The solution is painfully obvious to anyone who takes the time to think about it. On January 21, 2021, give the hook to the Clown Show in Falls Church, and bring in the scholar/problem solvers like Michele and her NDPA colleagues to lead the due process revolution that will transform EOIR into a place where teamwork and innovation will produce the world’s best court system guaranteeing fairness and due process for all. That was once the “EOIR vision” before “serial mismanagement” transformed it into the ugly, dysfunctional Star Chamber that confronts us today. 

It need not and should not be that way. But, the vision of true due process at EOIR will only be realized if the Biden Administration puts the right people — folks like Michele and others like her from the NDPA — in place immediately upon assuming power.

OLYMPIA — The Northwest detention center in Tacoma holds people in solitary confinement on average more than any other dedicated U.S. Immigration and Customs Enforcement (ICE) facility, according to a new watchdog report.

The report by the University of Washington’s Center for Human Rights also contends that the center — in violation of ICE’s own policies — imposes solitary confinement on inmates with mental-health issues, or who are exercising their First Amendment rights by going on hunger strikes.

The report is based on federal government records and documents by the company that operates the prison, GEO Group, which were obtained by the Center for Human Rights after years of litigation.

The privately run detention center holds as many as 1,575 immigrants accused by the government of living illegally in the U.S. and facing deportation proceedings.

In an interview, Angelina Godoy, director for UW’s Center for Human Rights, said the report “speaks to this existence of a secret prison within a prison.”

“There’s essentially no effective oversight of the practice” of solitary confinement, Godoy added. “And from the data that we were able to gather, there’s really disturbing conclusions about just flagrant violation of international human-rights norms.”

The Biden-Harris Administration must eliminate the “New American Gulag” (NAG”). The money could be “repurposed” for grants to encourage legal representation of migrants and to train more and better Accredited Representatives (non-attorneys) to represent individuals in immigration proceedings. 

Contrary to the bogus narratives spread by DHS and White Nationalist restrictionists, reputable research and studies show that individuals with legal representation appear for hearings at an extraordinarily high level. Thus, punitive private “faux civil” detention in the NAG should, in a rational, properly operating system, be unnecessary.

In those relatively few cases where detention is necessary because the DHS demonstrates a danger to the community or high risk of failure to appear, the Government should provide it in humane, professionally run, closely monitored, and accountable non-punitive facilities.
