The “Open Border” Farce

In 2023, there were record contracts for private industry on the world’s deadliest land border.

This article is a collaboration between The Border Chronicle and TomDispatch, a great outlet which has been looking at U.S. foreign policy, the military industrial complex, the “forever wars,” climate change, and many other topics since 2001.

On September 23rd, at about 2:30 a.m., a Border Patrol surveillance camera captured two people crossing the international boundary between Mexico and the United States on the outskirts of Nogales, Arizona. A Border Patrol vehicle arrived quickly, but not before one of them had fled back into Mexico. When an armed agent stepped out, dressed in a forest-green uniform, he found a 16-year-old girl from Mexico softly crying, while holding her month-old baby swaddled in a blanket.

The agent commanded her to get in the vehicle. As they then drove to the Nogales Border Patrol station, the girl, he later reported, tried to speak to him in Spanish through the security partition that separated them. Her tiny daughter, she was telling him, was in distress. Cameras showed that the vehicle stopped for all of 10 seconds before continuing. The agent later claimed he couldn’t understand what she was saying and that he wanted to find a fluent Spanish speaker at the station. He didn’t realize, he insisted, that the infant was struggling to breathe, though the child soon died.

This hellish story of suffering at our border is but one of hundreds of similar tales of horror from 2023. They illustrate a fundamental truth about that border: it neither is, nor ever was, an “open” one in the Biden years, nor does the president faintly have an open-border policy, though prepare yourself to hear otherwise — over and over again — in Trumpublican campaign ads next year. They’ll repeat what party officials are already saying all too repetitively: that “President Biden’s radical open borders policies” have created “the worst border crisis in American history.” (While those are the exact words of House Oversight Committee chair James Comer, similar sentiments are already being offered by countless members of the GOP.)

Comer’s claim is, of course, no less predictable than the hardships migrants like that girl are suffering as they try to reach this country. While such border narratives traffic in the unreal, what is real either isn’t effectively reported or gets lost amid all the politically motivated noise. Loud fantasies are expansively covered, while life-and-death stories, like those of that infant and her mother, are seldom reported and, if they are, quickly disappear.

Barely a week before that 16 year old was desperately trying to communicate to the agent in Spanish, the United Nations International Organization for Migration (IOM) labeled the U.S.-Mexico border the world’s “deadliest migration land route.” In 2022, a record 853 remains of dead border crossers were recovered (and this is the U.S. Border Patrol’s figure, which is even higher than the IOM’s), dwarfing the record of 568 set the previous year. Such numbers, the IOM stresses, are known to be distinct undercounts, leaving all too many families pining for lost loved ones.

But those border fatalities weren’t the only record breaker. Another was confirmed just a week after medical personnel at the Nogales station rushed to treat that girl’s baby. The number of border contracts issued to private industry also set a new record. Like those deaths, such contracts soared in fiscal year 2023 to $9.96 billion, instantly stripping the previous high, also set last year, of $7.5 billion.

And mind you, those gifts to industry were made from the highest budget ever (including in the Trump years) for border and immigration enforcement: $29.8 billion. So, don’t for a second think that the U.S. has an “open” border.  In fact, it’s never been more fortified or — something few even bother to mention — more profitable, if you happen to be part of the border-industrial complex.

Maybe it’s because the victims are “only migrants, mostly people of color” and therefore not considered to be “real human beings” by some in the media; maybe it’s because getting the real story about the border requires intensive digging, intellectual expertise, and perhaps some danger; maybe it’s because editors are in search of alarmist “sky is falling” myths about the “border apocalypse” to attract readers, viewers, and “online hits;” maybe it’s because of a false belief that truth is “boring” and “doesn’t sell!”  

For whatever reason, the non-Fox networks (Fox is a primary purveyor of the “Big Lie” and the “Open Borders Fantasy”) and “mainstream media” do a really poor job on border reporting.

Those with even a passing familiarity with “talking heads” are no-doubt familiar with claims from nativist GOP politicos, righty reporters, and even some Dems about the mythical a “open borders!” None of these folks have recent experience helping asylum seekers trying to exercise their legal rights under domestic laws, international treaties, and our Constitution in a border system specifically designed to “discourage and deter” them, rather than identify and promptly grant the many legally sufficient claims for protection. 

By contrast, when is the last time you saw real experts — folks like Clinical Professor Steve Yale-Loehr, former Deputy UNHCR and Georgetown Law Dean Alex Aleinikoff, CGRS Director Karen Musalo, HRF Refugee Programs Director Eleanor Acer, UC Davis Law Dean Kevin Johnson, NIJC Executive Director Mary Meg McCarthy, Immigrant Defenders Executive Director Lindsay Toczylowski, Rep. Hillary Scholten (D-MI) or any of the other huge numbers of highly articulate, well-recognized, “hands on practical experts” on human rights and asylum appear on the “talking heads” to throw some truth and real light on this important, nearly totally misunderstood and intentionally misconstrued, issue that GOP nativists have thrust to the forefront of the 2024 campaign?

Meanwhile, Dems should NOT be “running away” from the realities and essential benefits provided by robust immigration and the cruel wastefulness and immorality of Trumps’s proposed neo-Nazi “crackdown” on all forms of migration (although, disgracefully, some Dems are doing exactly that, thus playing into the hands of GOP nativists for absolutely NO return).

Trump Goes To War Against Immigration and Immigrants – It’s Another Big 2024 Problem For Republicans – Here at Hopium we talk about how “Abortion and Treason” will make it very hard for Republicans to win in 2024. Former President Donald J. Trump is planning an extreme expansion of his first-term crackdown on immigration if he returns to power in 2025 — including preparing to round up undocumented people already in the United States on a vast scale and detain them in sprawling camps while they wait to be expelled.

The plans would sharply restrict both legal and illegal immigration in a multitude of ways.

Mr. Trump wants to revive his first-term border policies, including banning entry by people from certain Muslim-majority nations and reimposing a Covid 19-era policy of refusing asylum claims — though this time he would base that refusal on assertions that migrants carry other infectious diseases like tuberculosis.

He plans to scour the country for unauthorized immigrants and deport people by the millions per year.

To help speed mass deportations, Mr. Trump is preparing an enormous expansion of a form of removal that does not require due process hearings. To help Immigration and Customs Enforcement carry out sweeping raids, he plans to reassign other federal agents and deputize local police officers and National Guard soldiers voluntarily contributed by Republican-run states.

To ease the strain on ICE detention facilities, Mr. Trump wants to build huge camps to detain people while their cases are processed and they await deportation flights. And to get around any refusal by Congress to appropriate the necessary funds, Mr. Trump would redirect money in the military budget, as he did in his first term to spend more on a border wall than Congress had authorized.

In a public reference to his plans, Mr. Trump told a crowd in Iowa in September: “Following the Eisenhower model, we will carry out the largest domestic deportation operation in American history.” The reference was to a 1954 campaign to round up and expel Mexican immigrants that was named for an ethnic slur — “Operation Wetback.”

The constellation of Mr. Trump’s 2025 plans amounts to an assault on immigration on a scale unseen in modern American history. Millions of undocumented immigrants would be barred from the country or uprooted from it years or even decades after settling here.

Such a scale of planned removals would raise logistical, financial and diplomatic challenges and would be vigorously challenged in court. But there is no mistaking the breadth and ambition of the shift Mr. Trump is eyeing.

Despite being inhumane and jawdroppingly cruel, this plan is now a major political problem for an already struggling Republican Party for at least three main reasons:

Raids and Mass Deportations Are Deeply Unpopular – We have decades of polling on the forced removal of the 10m+ undocumented immigrants (almost all of whom are employed and pay taxes) in the US, and it is wildly unpopular, perhaps even more so than “abortion bans.” One example – in the 2016 exit polls, in the election that gave Trump the Presidency, the American people choose “offer legal status” to “deported to home country” 70%-25%. Republicans may have a slight advantage on immigration issue right now, but mass deportation is seen as an extreme position by the American people (rightly so). It was so unpopular that the anti-immigration movement dropped mass deportation as a goal, moving to the softer “attrition through enforcement,” or “self-deportation,” political strategy more than a decade ago.

Trump’s plan is another sign of how extremism and extremists have overtaken the party of Lincoln and Reagan.

As I document here, since 2005, when the national Republican Party began adopting a far harder line on immigration (Reagan, W. Bush and McCain were all immigration reformers), the 4 battleground states of the Southwest, AZ/CO/NM/NV, have drifted away from the Republican Party, becoming far bluer. In the last 2 elections we’ve seen the best Democratic performance in that region since the 1940s and 1950s, and a reminder that Biden got within 5 points of Trump in Texas in 2020. In the heavily Mexican-American parts of the country in particular raids and mass deportations are wildly unpopular.

It Was A Plan Like This That Caused The Big Hispanic Protests Across the US in 2006 – In 2005 the Republican House of Representatives bucked their President, George W. Bush, and passed a bill that called for the rounding up and mass deportation of the 11m undocumented immigrants in the country. It was the moment when the party of the Sun Belt and the West went from pro-immigration to deeply restrictionist. Over the next year huge protests against this bill and mass deportation erupted across the US, and Republicans became so spooked that we were able to pass a “comprehensive immigration reform” bill through a Republican Senate in 2006. That bill, like the 2013 immigration reform bill we passed through the Senate, was never taken up by the Republican House and it died.

But those protests did something important politically – after years of Republican gains with Hispanics under W. Bush, Hispanics ran back into the arms of Democrats in 2006 and they have essentially stayed there ever since. In the 2006 midterms Democrats won 69% of the Hispanic vote, among our best performances in recent decades.

In the four Presidential elections leading up to 2006 Democrats averaged 47% of the vote, and in 2004 we lost AZ/CO/NM/NV. In the four Presidential elections since 2006 Democrats have averaged 51% and in 2020 we won AZ/CO/NM/NV at the Presidential level for the first time since 1940. As the Hispanic population has grown across the US and in these states, our net vote margin with Hispanic voters keeps increasing, even if we lose a few points in vote share. As I show here, in 2004 the net Hispanic vote margin for Democrats was about 700,000 votes nationally, meaning we won 700,000 more Hispanic votes nationally than Republicans. In 2020 that number was at least 4.5m net votes across the US, with this same dynamic playing out in each state with large Hispanic populations (except Florida of course).

My instinct is that whatever advantage Republicans had on immigration, and whatever small gains they had made with Hispanic voters in recent years, is now gone.

This Plan Will Wreck The American Economy – In a time of existing wide scale worker shortages, removing 10-15m workers from the American economy in a short period of time would be national economic suicide, and will be seen that way by the business community in DC and in the battleground states. It’s just totally insane and extremist policy no matter how you look at it, and I think it could become as much of a drag on the GOP brand as abortion is now.

For a party which has lost the popular vote in 7 of the last 8 elections, lost the popular vote to Democrats 51%-46% over the past 4, lost the 2018/2019/2020/2022 and 2023 elections, has deep performance issues across the country even in red states since Dobbs, embracing mass deportations seems like a colossal political error.

It is another reason why I think our goal in 2024 should be not just to win, but to really go on offense, get to 55, and make this election an historic repudiation of the worst and most dangerous political party in our history. We can do this people!

It’s critical to remember that migrants aren’t the ONLY target of Trump’s neo-Nazism — they might not even be the primary ones! You can guarantee that many US citizens and lawfully present non-citizens of color will be caught up in the dragnet and sent off to deportation concentration camps where due process is non-existent. 

Others will simply avoid certain public places and activities for fear of being accosted. Still others will be forced underground because of fear of drawing attention to undocumented relatives or neighbors. Some U.S. citizens will fear voting, which indeed is a key part of the GOP plan to cement their “out of the mainstream” minority rule by suppressing suffrage! As those of us who adjudicated asylum claims know, many will fear reporting abuses or asserting rights to police who openly identify with their oppressors. Fear, despair, distrust, and resignation are key pillars of any authoritarian regime!

It’s attack on all people of color in America and those who might speak with an accent or dress differently from the GOP’s “White Christian Nationalist norms.” 

How many of us carry around documentation proving that our parents were U.S. citizens? Notably, although occupational status is often menioned on U.S. birth certificates, citizenship status is NOT. It’s not hard to guess who will be “required” to “document” their parents’ citizenship by Trump’s internal security police!

Trump and the GOP are an existential threat to U.S. democracy, human progress, and American leadership on the world stage. Don’t let them destroy OUR country and take away YOUR rights!

Former president Donald Trump denigrated his domestic opponents and critics during a Veterans Day speech Saturday, calling those on the other side of the aisle “vermin” and suggesting that they pose a greater threat to the United States than countries such as Russia, China or North Korea. That language is drawing rebuke from historians, who compared it to that of authoritarian leaders.

“We pledge to you that we will root out the communists, Marxists, fascists and the radical left thugs that live like vermin within the confines of our country that lie and steal and cheat on elections,” Trump said toward the end of his speech, repeating his false claims that the 2020 election was stolen. “They’ll do anything, whether legally or illegally, to destroy America and to destroy the American Dream.”

Trump went on further to state: “the threat from outside forces is far less sinister, dangerous and grave than the threat from within. Our threat is from within. Because if you have a capable, competent, smart, tough leader, Russia, China, North Korea, they’re not going to want to play with us.”

The former president’s speech in Claremont, N.H., echoed his message of vengeance and grievance, as he called himself a “very proud election denier” and decried his legal entanglements, once again attacking the judge in a New York civil trial and re-upping his attacks on special counsel Jack Smith. In the speech, Trump once again portrayed himself as a victim of a political system that is out to get him and his supporters.

Yet Trump’s use of the word “vermin” both in his speech and in a Truth Social post on Saturday drew particular backlash.

“The language is the language that dictators use to instill fear,” said Timothy Naftali, a senior research scholar at Columbia University’s School of International and Public Affairs. “When you dehumanize an opponent, you strip them of their constitutional rights to participate securely in a democracy because you’re saying they’re not human. That’s what dictators do.”

Ruth Ben-Ghiat, a historian at New York University, said in an email to The Washington Post that “calling people ‘vermin’ was used effectively by Hitler and Mussolini to dehumanize people and encourage their followers to engage in violence.”

“Trump is also using projection: note that he mentions all kinds of authoritarians ‘communists, Marxists, fascists and the radical left’ to set himself up as the deliverer of freedom,” Ben-Ghiat said. “Mussolini promised freedom to his people too and then declared dictatorship.”

“The Nazis dehumanized the Jews. Nazi propaganda is replete with references to Jews as vermin, rats or parasites,” according to Harriet Over, a researcher in psychology at the University of York.

We are still creating [monsters]. We see it in … Russian attitudes toward Ukrainians, in Hindu Islamophobia, and in American racism against Black people,” psychologist David Livingstone, a professor at the University of New England in Maine, told EL PAÍS.

It wasn’t just Germany.

In 1909, a U.S. satirical magazine, Puck, published a cartoon that showed Uncle Sam as a pied piper leading a group of immigrants from Europe. The immigrants were rats. Sending them off: smiling, well-dressed White men.

Even so, it was only “page 2” news in today’s Post, apparently being of far less concern to her editors than the plans of Middle Eastern countries to “upend global sports!” Harkens back to 1936, when participating in Hitler’s “Aryan Showcase Olympics” was more important to the U.S. and other Western Democracies than protesting and condemning Hitler’s ongoing persecution of Jews!

There was a time in the not too distant past when use of racist, neo-Nazi language like Trump’s would have earned an immediate forceful condemnation from politicians across the political spectrum, from the media, and would have ended a candidacy. Now, it’s “just another day at the office.” Hate, lies, racism, and threats by a powerful national politician, a former President no less, cause barely a ripple in our national political dialogue. Not even front page news! Not covered at all by most “legitimate” news outlets! Yet the threat to our nation is real! Very real!

And, in case anyone still doubts the existential threat to American democracy and civilization itself posed by Trump and his anti-American followers, his “plans” include politicization of government, economic chaos, increasing global warming, and destabilization of the U.S. and world economies. Christian nationalism is a grave threat to the United States and the American republic. There should be no ambiguity or dullness when it comes to understanding what it is — no matter how benign it may present itself. It is what lurks beyond the veneer that is terrifying. There, the evil is revealed and manifested.

The dogma is a perversion of Christ’s teachings that is antithetical to Christianity. More importantly, Christian nationalism is utterly opposed to democracy. Theocrats despise the United States. God‘s laws are beyond the reach of the American state, and Christianity is but one religion in the beautiful mosaic of American faith.  It should always be noted that 600 generations of humans worshipped freely on the North American continent before the first European Christians came and killed them.

The US Constitution is the law of the land in the United States. Within it are the protections that safeguard our liberty. The freedoms of speech, dissent, conscience, worship and expression shall stand untroubled for as long as the great republic endures. We are within one calendar year of its possible end. We have arrived at a moment of grave crisis that cannot be ignored. The abyss that looked distant seven years ago is at hand.

Christian nationalism is incompatible with American democracy and pluralism. When political extremists take power in the name of God there is always death. Always.

The separation of church and state and religious freedom are profoundly important foundational achievements of the American republic. The extremists who seek power in God’s name are not benign men and women. They won’t be deterred by setbacks in Ohio and other places. Let’s call these giant detention and deportation camps what they are intended to be. These are concentration camps. Specifically, they are to be American concentration camps. Dachau was the Nazis’ first camp in Germany.

What will the first American camp look like? There will no doubt be a first, and it will likely be the first to house the political prisoners rounded up under Trump’s invocation of the Insurrection Act. He has promised to invoke it at the instant he returns to power.

Please understand this: Trump is announcing his intentions. He means it. He is surrounded by scores of “little Eichmanns” ready to help him achieve his aims. He should be taken literally and seriously at all times.

The Speaker of the House of Representatives Mike Johnson is second in line to the presidency. He rejects the greatest American idea in history, which is the separation of church and state. The greatest American invention — the peaceful transition of power — is utterly dependent on the separation of church and state in this country.

Johnson denied the 2020 election results, lied about the election results, created the conditions for the insurrection of January 6th, voted to disenfranchise millions of Black votes after the insurrection and continues to insist Trump won the election, despite the claim being a combination of fraud, malice and weapons-grade nuttery. The hostility to democracy is deeply rooted within his religious fanaticism, which is unique amongst the various strains of fanatical faith that have always found a home in America because of our nation’s unique faith protections.

We have churches where people pick up rattlesnakes and kiss them to prove they are protected by God. Proof of sin is a bite to the face and a painful death. Bo and Peep of Heaven’s Gate convinced their followers that they were headed to the Hale-Bopp comet, and Jim Jones took his flock to doom in Guyana. There are cults and fundamentalists all over America, but there is only one strain that wants to control your life by controlling the powers of the state to administer God’s law. They are the American Taliban.

Mike Johnson has invented his own distorted version of history as if the events of the late 1780s-90s occurred 6,000 years ago.

The American Constitution is clear about the founders’ intentions and their descendants’ actions to preserve and expand those intentions. There is no room for theocracy in the American system. Those considering abandoning Biden because of his support for Israel should recognize the alternative — a rabidly anti-Muslim authoritarian bigot (who, ironically, has also been soft on those expressing anti-semitism and other purveyors of hate) who would happily try to punish them just for existing! Rep. Mike Johnson, the newly elected House speaker, has repeatedly flirted with what’s known as the “great replacement theory,” the idea that Democrats are scheming to supplant American voters with immigrants. The Louisiana Republican’s views show how fringe conspiracy theories have gone mainstream in the Republican Party at the highest levels of power.

“This is the plan of our friends on this side — to turn all the illegals into voters,” Johnson said at a congressional hearing in May 2022, gesturing at Democrats. “That’s why the border’s open.”

The “open borders” trope is a lie, and while a few municipalities allow voting for noncitizens in local elections, in no sense do national Democrats have any such “plan” for “all the illegals.” As far as I can determine, no House speaker in recent memory has been quite as reckless and incendiary with this kind of language.

Johnson employs it regularly. He reiterated the claim in an interview this year with the right-wing outlet Newsmax, accusing President Biden of “intentionally” encouraging undocumented migration to “turn all these illegals into voters for their side.” On numerous other occasions, he has made similar charges, even declaring that Democrats’ express goal is the “destruction of our country at the expense of our own people.”

On immigration, as well as on abortion and gay rights, Johnson’s elevation is a triumph for the far right. It has been widely noted that Johnson doesn’t come across as a MAGA bomb-thrower, despite his extreme views. That’s true on immigration, too: He voices high-minded platitudes about how providing asylum to the persecuted is a noble ideal, but he’s a big booster of the wildly radical House GOP border bill that would functionally gut asylum entirely.

The pro-immigrant group America’s Voice, which tracks lawmakers’ positions on the issue, has not documented any comparable rhetoric in Johnson’s predecessor, Rep. Kevin McCarthy. “Johnson has gone farther than most of his Republican colleagues in elevating alarmist and dangerous rhetoric,” says Vanessa Cardenas, the group’s executive director.

Other predecessors, such as John A. Boehner and Paul D. Ryan, were supporters — nominally, at least — of reforms that would legalize large numbers of undocumented immigrants, though they ultimately failed to deliver. Not even Newt Gingrich, the most extreme House speaker of the modern era, went as far as Johnson, says Nicole Hemmer, author of a history of conservatism in the 1990s.

“Even at his most anti-immigrant, he spoke largely in fiscal and law-and-order terms,” Hemmer told me, while eschewing the “eliminationist rhetoric” at the core of great replacement theory.

Yet little by little, those more extreme ideas have penetrated GOP leadership circles. In 2021, Rep. Elise Stefanik (N.Y.), a top House Republican, charged Democrats with scheming to replace conservative voters with Democratic-leaning immigrants.

And that’s because so many in the party — elected officials and voters — won’t be led. Republicans have the majority in the House, but it’s a majority in name only. In reality, the House Republicans are an amalgam of competing factions, from right to far-right to extremist, and party members genuinely loathe one another more than they dislike Democrats.

Conservative media and social media stardom have turned even the most junior and otherwise inconsequential figures — say, Florida Rep. Matt Gaetz, the architect of this speaker-less anarchy — into power brokers who insist on having their sway. Like-minded conservative voters — small-dollar donors steeped in Fox News — bankroll the chaos agents; Rep. Marjorie Taylor Greene, that Georgia peach of a provocateur, is among Congress’ most successful fundraisers.

Here’s how insurgent and “Beetlejuice” fan Rep. Lauren Boebert of Colorado explained why House Republicans have failed to agree on a speaker: “There are 224 alpha males and alpha females who are here in the Republican Party. We are here because we convinced hundreds of thousands of people that we are leaders.”

No matter how this speaker mess ends — and it must somehow end — that perverse reward system will remain. And the House under Republican “leadership” will be all but ungovernable through the 2024 election.

Former Speaker Nancy Pelosi had a similarly thin Democratic majority yet managed to keep her party factions united and to shepherd into law major legislation, some of it bipartisan. But here’s the difference: Democrats believe in governance. Too many Republicans do not; their credo has shifted over the last quarter century from small government to anti-government. We’re watching the result.

Again, take it from a Republican: “Frankly, it doesn’t matter who the speaker is,” Rep. Mike Lawler of New York said, “because if we [Republicans] can’t govern as a group, as a conference, it doesn’t matter.”

Jordan, true to his brand as a belligerent, on Friday insisted on a third House vote for speaker. As widely predicted, he lost by even more votes than on the earlier ballots. He and his allies talked of pressing his candidacy through the weekend; after all, McCarthy was elected in January on the 15th ballot. But in a closed-door caucus and with secret ballots, Republicans voted to yank Jordan’s nomination as speaker.

His refusal to accept that he was not going to be speaker until the reality was forced on him was hardly a surprise. Jordan still won’t concede that Donald Trump lost reelection. He declined to do so yet again at a news conference Friday morning. His stubborn opposition to democracy — that’s what it is — only underscored why Jordan should never be the speaker.

The sad fact, however, is that Jordan’s reprehensible role as Trump’s chief congressional lieutenant in the run-up to the Jan. 6, 2021, insurrection wasn’t even much of a factor in opponents’ thinking. Nor was the fact that as speaker, this unrepentant election denier could have sabotaged the certification of the 2024 presidential vote if the Republican lost.

Instead, the reasons Jordan’s foes gave were personal, political or both. Some blamed him for stoking the death threats against them and their families. One, Rep. Drew Ferguson of Georgia, said Republicans don’t “need a bully as the speaker.”

But they need someone — the country needs someone — so Congress can function. Government funding runs out Nov. 17. Biden is sending a request for aid to Ukraine and Israel. Other essential legislation, including agriculture and defense bills, are pending.

Many Republicans are trying to shift the blame for the fiasco onto Democrats because they all opposed McCarthy and then Jordan — as if Republicans would’ve voted to retain Pelosi had an insurgent Democrat ever moved, like Gaetz did against McCarthy, to unseat her.

But they know the blame actually lies with themselves — thus the name-calling and near-fisticuffs.

They need to come together, if only temporarily. And then voters should fire them in 2024.

Totally classless and obstructionist till the end, Jordan forced his colleagues to vote to rescind his never-viable nomination for Speaker after losing three floor votes by increasing margins. By contrast, Scalise, the Conference’s initial nominee over Jordan withdrew without a vote upon determining that he lacked the votes to win the job.

In one of a continuing string of jaw-droppingly poor choices for guests, NBC’s Kristen Walker gave deposed ex-Speaker McCarthy a forum to engage in a “Trumpian liefest” of mythic proportions, outrageously attempting to blame Dems, the Border, Biden, Jeffries, the GOP insurrectionists he empowered, and just about anyone but himself for the debacle he helped engineer and his morally bankrupt party carried out!

Every viewer should have felt dumber after watching Welker fruitlessly try to control the astounding stream of lies, nonsense, doublespeak, and intentional misrepresentations coming out of McCarthy. Honestly, that’s what Fox News, Breitbart, and the Examiner are for! No need to give shallow politicos with absolutely nothing to contribute another forum! I’ve always been a Kristen Welker fan, but her first month as moderator of Meet the Press can only be described as something between tragic and horrible.

As Calmes says, “fire [the GOP] in 2024.” The future of America, the world, and humanity might depend on the n common sense and decency of the majority of voters!

Representative Steve Scalise of Louisiana withdrew on Thursday from consideration for the speakership he was on the cusp of claiming after hard-line Republicans balked at rallying around their party’s chosen candidate, leaving the House leaderless and the G.O.P. in chaos.

After being narrowly nominated for speaker during a Wednesday closed-door secret-ballot contest among House Republicans, Mr. Scalise, their No. 2 leader, found himself far from the 217 votes needed to be elected on the House floor. Many supporters of his challenger, Representative Jim Jordan of Ohio, the right-wing Republican endorsed by former President Donald J. Trump, refused to switch their allegiance.

With no clear end in sight to the G.O.P. infighting that has left one chamber of Congress paralyzed at a time of challenges at home and abroad, Mr. Scalise said he would step aside in hopes that someone else could unite the fractious party.

“I just shared with my colleagues that I was withdrawing my name as a candidate for speaker-designee,” Mr. Scalise said. “If you look at where our conference is, there’s still work to be done. Our conference still has to come together, and it’s not there. There are still some people that have their own agendas.”

With two wars involving our allies raging and the USG on track to run out of funding in a month, the GOP focuses on what’s important to them: THEMSELVES!

The GOP is a national disgrace and an international menace! They have brought the same disorder, callous disregard for the common good, and wacko, selfish, far right minority agenda to national politics that they have to the states they misgovern.

The GOP also also threatens America’s standing and influence on the world stage. The only thing standing between us and disaster is President Biden’s determination to lead and govern despite the GOP’s disgraceful chaos and betrayal of the common good!

And remember, it’s not like Scalise, who has coddled White Supremacists — once comparing himself to Klanster David Duke — and is a lifetime shill for a divisive far/right extremist agenda, was qualified to be Speaker. He was, at best, “slightly less unqualified” than insurrectionist election denier and Trump toady Jim Jordan!

It wasn’t supposed to end this way for Kevin McCarthy. After all, he had done nearly everything that the far-right faction of his caucus wanted, given in to their every demand. Why ever would that fail to satisfy them? But in the end, his actions recalled the parable of the scorpion and the frog. As Fortune magazine retold it,

A scorpion asks a frog to carry him over a river. The frog is afraid of being stung, but the scorpion argues that if it did so, both would sink and the scorpion would drown. The frog then agrees, but midway across the river the scorpion does indeed sting the frog, dooming them both. When asked why, the scorpion points out that this is its nature.

It is the nature of nihilistic, burn-it-to-the-ground extremists to destroy everything around them, including the very party that once carried them to victory. McCarthy’s mistake was thinking he could ever change that by actually inviting the crazies in and embracing them even closer. Instead, he became the first ever speaker in the 240-year history of the House of Representatives to be ousted. In a period of historic firsts—first president impeached twice, first president to be indicted (and charged 91 times), and now first successful motion to vacate the chair—the GOP seems determined to outdo itself.

As writer Charlotte Clymer colorfully put it, “McCarthy served 270 days, the equivalent of 27 scaramuccis or 0.093 of a pelosi, after giving away his power—and his dignity—to man-toddlers who eventually stabbed him in the back.”

Let’s look at what happened yesterday and then answer some common questions about where things go from here in the GOP’s fractured majority in the House.

Mean Girls Day

October 3rd is a day that sticks in my mind because of my favorite movie, Mean Girls, which is turning out to carry many lessons for the GOP. The Lincoln Project was out with a meme quickly.

“On October 3rd, he asked me what day it was!” exclaims Cady Heron of the dreamy Aaron Samuels.

“It’s Kevin McCarthy’s last day as Speaker,” Cady responds.

Indeed, it was.

After Rep. Matt Gaetz (R-FL) made good on his promise to file a motion to vacate the chair, McCarthy pressed for quick consideration of the motion, rebuffing calls to wait until Thursday when more members were back in Washington. He apparently had hoped to catch a number of Democratic House members away. Nancy Pelosi missed the votes, for example, because she was attending the funeral of her longtime friend, the late Sen. Dianne Feinstein.

No matter. After first losing a procedural vote to table the motion, with 11 Republicans voting “no” along with all the Democrats present, Kevin McCarthy faced a full vote of the House and was removed by a vote of 216 to 210, with eight GOP members joining all of the Democrats. Even Gretchen Wieners—er, I mean, Nancy Mace (R-SC)—who styles herself as a moderate, was a yea on the motion. Et tu, Nancy?

It bears noting that the Democrats had met as a group earlier that day and emerged with a consensus that they would not be helping McCarthy out. There was simply too much bad blood, from his kissing Trump’s ring two weeks after condemning him for January 6; to his reneging on the budget deal struck in May; to his launch of an impeachment inquiry against Joe Biden based on nothing but speculation; to his blaming the Democrats for the near shutdown of the government, when it was Democrats who had kept it open. They simply did not trust him and saw no reason to throw him a lifeline. In fact, he never even asked for help from them directly, though his minions reportedly made a series of calls begging moderate Democrats to save him.

After the vote, several members of the House Republican caucus gathered in a group to pray on the House floor, while Rep. Ann Wagner (R-MO), wept openly. It was quite a fall for Rep. Wagner, who had triumphantly spearheaded two anti-abortion measures earlier in the year with Speaker McCarthy’s blessing.

McCarthy’s loss of the speakership leaves the GOP caucus effectively without leadership, at a time when appropriations remain largely unfinished.

The Speaker pro tempore

The gavel is currently in the hands of a caretaker Speaker pro tempore, Patrick T. McHenry (R-NC), who gaveled out the evening with such ferocity that he damn near cracked the thing. It’s a good thing men aren’t emotional in politics.

McHenry is supposed to hold the position only so long as it takes to elect a new speaker, and to wield the gavel only for purposes of getting this done. But he couldn’t help but act like yet another petulant man-baby, ordering Speaker Emeritus Nancy Pelosi to clear out her office in the Capitol building and relocate to the Cannon Building. Pelosi issued a response:

With all of the important decisions that the new Republican Leadership must address, which we are all eagerly awaiting, one of the first actions taken by the new Speaker Pro Tempore was to order me to immediately vacate my office in the Capitol. Sadly, because I am in California to mourn the loss of and pay tribute to my dear friend Dianne Feinstein, I am unable to retrieve my belongings at this time.

Petty moves aside, McHenry won’t have any real power to push legislation through, and few even inside the GOP would likely stand for him seeking to assert himself in any way except as a momentary caretaker.

So what happens next?

With McCarthy out, the GOP is back to where it was in January, without the numbers to put someone over the top. One key piece of news that already broke: McCarthy won’t be running for the job again.

That leaves a number of possible replacements. The No. 2 in the House is Rep. Steve Scalise (R-LA), who is well liked but faces health challenges, as he is currently undergoing treatment for blood cancer. Other names that have bubbled up include Rep. Jim Jordan (R-OH), Elise Stefanik (R-NY) and the No. 3 guy in charge of this mess, Tom Emmer (R-MN).

There is no consensus candidate as of this moment. The House GOP members scattered to their districts on Tuesday night after the debacle, giving a cooling off period before they regroup next week.

Isn’t the devil we know better?

There is considerable and understandable consternation that we might wind up with someone worse than McCarthy, whose feckless cowardice at least led to predictable capitulations and back to the inevitable point of political equilibrium.

But it’s also fair to say that even someone more extreme, like a Jim Jordan, couldn’t actually do anything with this fractured majority beyond what McCarthy already did with it. A House majority without a Senate in concurrence can accomplish little other than hearings and inquiries, which is what the GOP has been up to for months already with nothing to show for it. Handing the keys to the bus to someone else who doesn’t know how to drive isn’t going to keep the party from catastrophe next November.

It also might take some time before they can coalesce around a new leader. Extremists want someone to the right of McCarthy, but moderates might never support such a candidate. And even assuming they did, the party would quickly find itself exactly where it is now: facing a government shutdown while it tries to renege on a deal already agreed to, and up against a Democratically-controlled Senate ready to get on with the business of governing.

The political fallout

The collapse of GOP leadership in the House likely will become a central talking point for Democrats for the 2024 elections. The GOP brand is already badly tarnished by everything from anti-abortion extremism to election denialism to authoritarian suppression.

One thing is clear, however: It was Trump, acting behind the scenes by pressing extremists to hold the line against the budget, who is in large part to blame for the destruction of the House GOP caucus. He won’t take ownership of that, of course, but the amount of damage he has inflicted upon his own party cannot be overstated.

And in a weird twist, some members of the far-right are moving to nominate Donald Trump as Speaker. Rep. Troy Nehls (R-TX) announced late Tuesday he will file paperwork to nominate the former president to be the next Speaker, who in fact doesn’t have to be a member of the body to preside as Speaker. In the past Trump has said he would not be interested in the job, so it’s unclear whether he would take such a nomination seriously. But it does demonstrate how rudderless and leaderless the House GOP caucus is that they once again turn to their Dear Leader to beg him to rescue them. (Trump of course wouldn’t know the first thing about how to act as Speaker, or move legislation through, or count votes, nor would he have time to learn the ropes given his trial schedule. Perhaps they could recruit his son Eric, who at least is foolish enough to accept and might soon have nothing to do because all his businesses have had their certificates to operate in the state canceled.)

That plan might run smack into the GOP’S own House rules, though, which requires leadership to step aside if indicted for a felony with a punishment of more than two years.

Returning to the scorpion and frog fable, and looking back at his tragic and brief tenure, McCarthy’s political death was inevitable. The moment he began to negotiate with the caucus terrorists in order to secure his seat, he sowed the seeds of his ultimate destruction. After all, under the terms of his parole, a single missed frog step could bring down a motion to vacate by a single member. By May, McCarthy had already committed the giant sin of compromising with the Democrats in a near evenly divided government, and a few months later, a single MAGA scorpion planted its stinger right into his back.

Of course, it’s supreme irony that about the only responsible leadership action McCarthy took during his short tenure as speaker led to his demise at the hands of the GOP anti-American nihilists whom he coddled and ingratiated himself with to get the job in the first place!

At some point, the anti-American GOP voters who put these dangerous, yet cowardly, spineless, and valueless, nut cases into positions of influence have to be held accountable, if only by history! 🏴‍☠️

Saturday, at the 12th hour, GOP Speaker Kevin McCarthy (D-CA) finally did the obvious — reached out to Dems to save America from insurrectionist, anti-American GOP extremists by passing a last-minute continuing resolution that will fund American government until Nov. 17. 

All Dems except one (who was protesting the GOP’s pro-Putin defunding of Ukraine aid) voted for the House bill, while 90 GOP insurrectionists voted to tank America and manufacture a needless crisis. The bill passed the nominally Dem-controlled Senate in about 30 seconds, and was signed by President Biden before midnight. The message about which party is serious about governing for the common good is obvious to all real patriots, even if a shocking number of GOP voters have foisted these far-right GOP clowns upon the rest of us.

The mainstream media uses the namby-pamby misnomer “border security,” to refer to the GOP’s proposed racist-nativist attack on immigration, destruction of the long-established right to asylum, and bogus attempts to reinstate “proven to fail,” draconian deterrence measures. As happened when tried unsuccessfully in the past, the GOP would turn over control of border migration policies to cartels, smugglers, and organized crime, while deflecting attention and undermining law enforcement efforts to control human and drug smuggling. 

A true accounting for the GOP extremist agenda would clearly show how firmly on the side of Putin and border bandits today’s dangerous, “destroy America” GOP has become. Too bad the so-called “mainstream media” has so little interest in digging beyond the cosmetics on the border issues and Ukraine aid.

The mainstream media is also salivating about the bogus prospect of MAGA-maniac Matt Gaetz (R-Outer Space) unseating McCarthy. In perhaps the ultimate example of clueless, Fox News inspired, “mainstream journalism,” CBS’s “This Sunday” saw fit to inflict Gaetz and his bombastic nonsense on hapless viewers today. NBC, on the other hand, maybe still smarting from new-host Kristen Welker’s disastrous, totally uncalled for, “inaugural” interview with a raving, incoherent, lie-spouting Trump, gave us wall-to-wall coverage of the Ryder Cup in place of “Meet the Press.” Honestly!

Look forward to more clownish theatrics and anti-American posturing from the GOP and their “Chief Clown” Trump, and more insipid reporting from the mainstreamers as America careens toward another likely GOP-generated “crisis” in mid-November. It’s NOT a “Washington problem! It’s purely a GOP that lacks any interest whatsoever in responsible governing.

Martin Luther nailed his theses to a church door. Matt Gaetz displayed his in the men’s room.

Specifically, the congressman (or somebody) left a draft of his “Motion to Vacate” on a baby changing table in a restroom downstairs from the House chamber, where it was found by journalist Matt Laslo. “H. Res. __,” it began. “Resolved, that the Office of Speaker of the House of Representatives is hereby declared to be vacant.”

But Gaetz (R-Fla.) doesn’t need a resolution to “vacate the chair,” as a motion to remove Kevin McCarthy as speaker iscalled. For all practical purposes, the chair is already vacant.

It should have been obvious to all this week, if it wasn’t already, that McCarthy (R-Calif.) is speaker in name only, as his leaderless Republican caucus stumbles toward a government shutdown. Review some of the labels House Republicans hurled at each other over the last few days:

“Clown show.” “Clowns.” “Foolishness.” “Weak.” “Terribly misguided.” “Selective amnesia.” “Stupidity.” “Failure to lead.” “Lunatics.” “Disgraceful.” “New low.” “Enabling Chairman Xi.” “People that have serious issues.” “Pathetic.”

Amid the epithets, Republicans brought the House to another standstill. For the second time in as many weeks, hard-liners blocked the House from even considering a bill to fund the troops. Two days later, they blocked it for a third time. They also forced party leaders to pull from the floor their plan to avert a shutdown — a plan that would do nothing to avert a shutdown even if it passed.

Walking into yet another grievance-airing session among House Republicans this week in the House basement, first-term Rep. Richard McCormick (Ga.) remarked to a colleague: “I think we should call this the Dance of the Dragons.” That was a “Game of Thrones” reference to a civil war in which (spoiler alert) both of the aspirants to the Targaryen throne died, along with several of their children and most of the dragons. McCormick later developed the metaphor for me: “We have a lot of powerful people in one room who are ferocious,” he explained in part, and “it’s going to get even uglier.”

Remember, folks, the problem here is NOT “Congress,” as the so-called “mainstream media” would have you believe! No, it’s the GOP — the anti-American party of nihilism, insurrection, lies, and extremism! McCarthy COULD have had an agreement in hand long before now. all it would take is picking up the phone and working with Leader Jeffries and the Dems to come up with a reasonable funding proposal that could actually PASS the Senate! Indeed, McCarthy earlier cut such a deal with President Biden until he violated it under pressure from a few right-wing members of the GOP “wrecking crew” in an act of supreme cowardice (a McCarthy specialty) and total failure to pursue the common good.

Notably, when the House had a REAL Leader, Speaker Pelosi, there was no shutdown during the Trump Administration — even though there were plenty of issues (Dreamers being a key one) that some Dems would have liked her to “go to the mat” on. When the chips are down, Dems believe in governing; the GOP believes in destroying!

Upcoming generations who don’t want to live in a country where conspiracy theories, cruelty, misinformation, hatred, intolerance, false grievances, vengeance, dehumanization, greed, self-aggrandizement, racism, anti-semitism, grotesque fiscal and moral irresponsibility, misogyny, incompetence, and just plain stupidity replace democracy  and governing for the common good had better get energized and busy coming up with a strategy to remove GOP members from every elected position from the national level to local animal control officers. Otherwise, the majority of the next generations will face a bleak future in a nation trying to return to a past that never was with faux “leaders” who demonstrably can’t lead, and don’t even make a pretense of trying to do so.

The “forced birth party” shows little, if any, concern for the well-being of humanity once it has exited the womb!

The following post is the final part of my 2017 Black Immigration Primer! I delve into the impact of former President Donald Trump’s early executive orders on Black immigrants, the consequences of which are still being felt today.

It seems like ages since 45 (the former President of the U.S.) issued a volley of executive orders affecting various areas of our lives. Here, I want to talk about the two versions of the Travel Ban (a.k.a. the #MuslimBan) and how they target Black immigrants, Muslim immigrants, and Black Muslim immigrants. The travel bans live at the intersection of anti-Blackness and Islamophobia.

First, some terms and their definitions. Anti-Blackness (also known as anti-Black racism) is what it sounds like: systems, policies, beliefs, and behaviors that are “resistant or antagonistic to Black people or their values or objectives.” We often see anti-Blackness in other communities of color. Some argue that assimilation into American culture is predicated on embracing anti-Blackness (in order to succeed in America, one must separate oneself from Black people and violently oppose Black people’s success). Islamophobia is a “dislike or prejudice against Islam or Muslims, especially as a political force.” It’s important that anti-Blackness and Islamophobia are not merely individual beliefs; they encompass power of the systemic kind. Anti-Blackness and Islamophobia result in harmful, deadly policies and wars.

It’s safe to say that 45 and his administration are a number of things (misogynistic, racist, unethical, evil, and so forth) but they are also distinctly anti-Black and Islamophobic. 45 and his minions’ embrace of anti-Blackness and Islamophobia produced two Travel Bans that harmed hundreds of people. Through my internship at the Florence Immigrant and Refugee Rights Project, I observed master calendar hearings in the detained docket in the Florence Immigration Court. I was back in Florence, Arizona, because the court itself is located within the barbed wire of the detention center. Observing the Florence Immigration Court emphasized how dehumanizing removal proceedings can be for detained immigrants. Master calendar hearings are often immigrants’ first interaction with the Court. To start, a guard brought a group of men in jumpsuits to the courtroom and lined them up. The judge read them their rights and then called them individually to discuss their case. Twice I witnessed the wrong person being brought into court where they sat through proceedings until the guards realized and switched them out for the correct person.

The vast majority of Respondents in removal proceedings are unrepresented. There is a blatant information imbalance in immigration court when the immigrant is unrepresented. Oftentimes, pro se detained immigrants do not have access to the resources represented or released Respondents have during their proceedings. Respondents may not know their legal options unless organizations like the Florence Project can speak to them before their hearing and provide them with pro se information packets or represent them. During the hearing, the men did not even have a pen and paper to take notes. Meanwhile, the immigration judge and government attorney have access to technology and a wealth of experience to pull from to make legal arguments.

This is just one example of many – my colleagues and I also observed translation issues and pushback against some men who wished to continue fighting their case. Above all, I’ll leave with this very simple observation: the judge and guards called each man up by his court docket number before his name. If we are to support and uphold the dignity of all people, we must do so especially in systems that look to strip it from them. Providing immigrants with access to a lawyer, if they’d like one, can ensure that people have access to information that allows them to make informed decisions about their case. The Florence Project is one of the organizations working tirelessly to expand access to representation throughout Arizona, and I hope to continue this work after graduating from Georgetown University Law Center next year. #EJAFellowUpdate | Equal Justice America

Congrats to Lauren Iosue, and thanks for becoming a member of the NDPA! 😎 The scary thing: As an L-3, Lauren appears to have more “hands on” Immigration Court experience and a far deeper appreciation of the material, sometimes fatal, flaws in the EOIR system, than Garland and his other “top brass” in the DOJ responsible for operating and overseeing this tragic mess! 

Why isn’t “real life” immigration/human rights experience representing individuals in Immigration Court were an absolute requirement for appointment to AG, Deputy AG, Associate AG, Solicitor General, and Assistant AG for Civil (in charge of OIL) in any Dem Administration, at least until such time as the Immigration Courts become an Article I Court removed from the DOJ?

30-years ago, when I was at Jones Day, we were budgeting a minimum of 100 hours of professional time for a pro bono asylum case! That was before the “21st century BIA” added more unnecessary, artificial technicalities to make it more difficult for asylum seekers to win. It’s not “rocket science!” 🚀

All Garland would have to do is reach back into his “big law” days at Arnold & Porter (“A&P”). He should pick up his cell phone and call Lucy McMillan, the award-winning Chief Pro Bono Counsel @ A&P.  Ask Lucy what needs to change to get EOIR functioning as a due-process-focused model court system! Better yet, reassign upper “management” at EOIR, and hire Lucy to clean house and restore competence, efficiency, and excellence to his currently disgracefully-dysfunctional “courts!”

As Austin’s posts and the reports he references show, Garland’s indolent, tone-deaf, mal-administration of the Immigration Courts is a national disgrace that undermines democracy and betrays core values of the Democratic Party! How does he get away with it? Thanks to Austin, AILA, Lauren, and others exposing the ongoing “EOIR charade” in a Dem Administration! 

As shown by recent “Courtside” postings about the “Tsunami” 🌊 of Article III “rejections” of lousy BIA decisions, throughout America, many, many more asylum cases could be timely granted with a properly well-qualified, expert BIA setting precedents and forcing judges like those in Omaha to properly and generously apply asylum law or find other jobs! Maximum protection, NOT “maximum rejection,” is the proper and achievable (yet unrealized) objective of asylum laws!

Asylum law, according to the Supremes and even the BIA is supposed to be generously and practically applied — so much so that asylum can and ordinarily should be granted even where the chances are “significantly less” than probable. See Matter of Mogharrabi, 19 I & N Dec. 439, 446 (BIA 1987). 

The problem is that the BIA and EOIR have never effectively implemented and followed the Mogharrabi standard. In recent years, particularly during the Trump debacle, they have moved further than ever away from this proper legal standard while still giving it lip service! Clearly, the IJs in Omaha and other “Asylum Free Zones” are operating outside the realm of asylum law with deadly and destructive consequences. Yet, Garland, a former Federal Judge himself, permits it! Why?

The assumption that most asylum seekers who pass credible fear should ultimately lose on the merits is false and based on intentionally overly restrictive mis-interpretations and mis-applications of asylum law! It’s a particular problem with respect to asylum seekers of color from Latin America and Haiti — a definite racial dimension that DOJ and DHS constantly “sweep under the carpet.” Because of the extraordinarily poor leadership from EOIR, DOJ, and DHS, this “fundamental falsehood of inevitable denial” infects the entire asylum debate and materially influences policies.

A dedicated long-time “hands-on” asylum expert, someone who actually met some of the “Abbott/DeSantis busses,” said that over 70% of those arriving from the border had potentially grantable asylum claims. That’s a far cry from the “nobody from the Southern border will qualify” myth that drives asylum policy by both parties and has even been, rather uncritically, “normalized” by the media.

Fixing EOIR is a prerequisite to an informed discussion of immigration and development of humane, rational, realistic immigration policies. That would be laws and policies based on reality, not myths, distortions, and sometimes downright fabrications.

Competent representation is also an essential part of fixing EOIR. There are ways to achieve it that Garland is ignoring and/or inhibiting. See, e.g., VIISTA Villanova. No excuses!

“The 272,” Rachel L. Swarns’s deeply researched and revelatory new book, is the story of the remarkable Mahoney clan and how their lives, nearly a century and a half after Ann Joice’s, intersected with those of Mulledy, McSherry and the Jesuits in one of American slavery’s most withering tragedies. “The 272” is a fascinating meditation on the meaning of slavery and of people converted to property and commodities — assets of wealth and objects of sale. It’s a book that journeys to slavery’s heart of darkness: to the separation of families, the terror of being sold into the vast unknown and of bodies transformed into profits and investments. But it is also the moving human story of some of the people who endured and survived this ordeal, and who have long awaited rediscovery.

Swarns, a contributing writer for The New York Times and a professor of journalism at N.Y.U., is an African American Catholic who was raised on Staten Island. Beginning with an article in The Times in 2016, she revealed the story of the Jesuits as slaveholders and traders, leading to a stunning reckoning by Georgetown University with its past as well as one within the Jesuit order itself. Swarns writes with a keen eye and distinctive voice both about her Black subjects and about the hypocrisy and brutality of their onetime owners. The Jesuits were no monolith of greed and evil, however; Swarns sustains empathy for some who tried, largely unsuccessfully, to protect the enslaved people they had known so closely from the agony of sale that looms over this story.

What comes through most effectively is the sorrow and the determination to survive of the enslaved people whom Swarns brings to light through her sleuthing and resonant prose. (Of Ann Joice, Swarns writes, “She would have no wealth, no land and no savings to leave her family, but she still had her story. … The story would be her legacy.”) Swarns also underscores the importance of Georgetown’s ongoing efforts at serious reparations for the deeds of its early leaders. An independent nonprofit, the Georgetown Memory Project, has identified around 6,000 living descendants of the original 272. In turn, the university has offered descendants formal “legacy” status for admission, sought atonement through a highly publicized apology and created a fund that would dedicate $400,000 a year to community projects, including support for health clinics and schools, likely to benefit descendants. Leaders of the Jesuit conference of priests have also vowed to establish a $100 million trust to benefit descendants and promote racial reconciliation.

No single work of history can remedy the vexing issue of repair for slavery in America, but “The 272” advances the conversation and challenges the collective conscience; without knowing this history in its complexity we are left with only raw, uncharted memory.

This is the kind of important, often intentionally buried, history that GOP white nationalists like DeSantis, Trump, and others don’t want read and honestly discussed. But, as with most artificially suppressed works, the truth will out! There are just too many people speaking it these days for even the neo-fascist censors to silence them all.

It also illuminates the heretofore unknown and unheralded stories of enslaved African-Americans like Ann Joice who, against the odds, persevered in a grotesquely unjust and horrible system so that future generations could have a chance at a better life. These are are among the real heroes of  American history who helped make our country what it is today. Their stories deserve to be told and studied.

On Saturday, Donald Trump conducted the second formal rally of his campaign — in Pickens, South Carolina, where an estimated 50,000 turned up under the scorching sun to hear him.

There, he advanced his version of patriotism based on White Christian Nationalism.

He began by celebrating the town’s namesake, Francis Pickens, who was governor of South Carolina when it was the first to secede from the Union on the eve of the Civil War. Trump assured the crowd he wouldn’t let “them” change the town’s name.

He commended the Supreme Court for rejecting affirmative action “so someone who has not worked as hard will not take your place.”

He saluted the court’s decision to overrule Roe v. Wade so “radical left Democrats will not kill babies.”

He promised to stop “men competing in women’s sports” and prevent classroom teachers from teaching the “wrong” lessons about sexuality or history.

He condemned foreign governments that “send” over the border “people in jails and insane asylums” and promised to deny entry to “all communists and Marxists.”

And he declared America’s most dangerous opponents not to be Russia, China, or North Korea but “enemies within” America.

Rubbish.

The true meaning of patriotism is the opposite of Trump’s exclusionary White Christian Nationalism.

America’s moral mission has been toward greater inclusion — providing equal rights to women, Black people, immigrants, Native Americans, Latinx, LGBTQ+, Muslim, Jewish, atheist, and agnostic.

True patriots don’t fuel racist, religious, or ethnic divisions. Patriots aren’t homophobic or sexist.

Nor are patriots blind to social injustices — whether ongoing or embedded in American history. They don’t ban books or prevent teaching about the sins of the nation’s past.

True patriots are not uncritically devoted to America. They are devoted instead to the ideals of America — the rule of law, equal justice, voting rights and civil rights, freedom of speech and assembly, freedom from fear, and democracy.

True patriots don’t have to express patriotism in symbolic displays of loyalty like standing for the national anthem and waving the American flag.

They express patriotism in taking a fair share of the burdens of keeping the nation going — sacrificing for the common good.

This means paying taxes in full rather than lobbying for lower taxes or seeking tax loopholes or squirreling away money abroad.

It means refraining from making large political contributions that corrupt American democracy.

It means blowing the whistle on abuses of power even at the risk of losing one’s job.

And volunteering time and energy to improving one’s community and country.

Nor is patriotism found in baseless claims that millions of people vote fraudulently. Or in pushing for laws that make it harder for people to vote based on the Big Lie that the 2020 election was stolen.

Patriotism lies instead in strengthening democracy — defending the right to vote and ensuring more Americans are heard.

Patriots understand that when they serve the public, their responsibility is to maintain and build public trust in the institutions of democracy.

They don’t put loyalty to their political party above their love of America. They don’t support an attempted coup.

They don’t try to hold onto power after voters have chosen not to reelect them. They don’t make money off their offices.

When serving on the Supreme Court, they recuse themselves from cases where they may appear to have a conflict of interest. They don’t disregard precedent to impose their own ideology.

America’s problem is not as described by Trump and his White Christian Nationalism — that the nation is losing its whiteness or dominant religion, that too many foreigners are crossing its borders, that men are competing in women’s sports or teachers are not celebrating the nation’s history.

America’s problem is that too many Americans — including its lawmakers — are failing to understand what patriotism requires.

In recent years, the [GOP’s] blind loyalty to Trump’s radicalism – especially his election lies – has caused it to even challenge the structure of democracy. A sense of national crisis and imminent political extinction, for example, ran through Trump’s rhetoric in the aftermath of the 2020 election, prompting some of his followers to use violence as a way of settling their political grievances on January 6, 2021.

Conservative Supreme Court decisions over the last two years have been especially hard for liberals to accept because they believe that the current majority is ill gotten.

The right’s dominance of the court happened in large part because then-Senate Majority Leader Mitch McConnell refused to even grant a confirmation hearing to Obama’s final pick for the top bench, Merrick Garland, who now serves as attorney general in the Biden administration. This allowed Trump to name Justice Neil Gorsuch as his first Supreme Court nominee in 2017. But McConnell later turned his back on his own questionable principle that Supreme Court nominees should not be elevated in an election year by rushing through the confirmation of Trump’s final pick, Amy Coney Barrett, in 2020 – which enshrined the current 6-3 conservative majority.

The move not only confirmed Trump’s status as a consequential president whose influence will be felt decades after he left office. It cemented McConnell among the ranks of the most significant Republican Party figures in decades and ensured conservative policies will endure even under Democratic presidencies and congressional majorities.

Recent revelations about questionable ethics practices by some of the conservative justices have further fueled fury about the legitimacy of the court among liberals.

But not all of the court’s recent decisions have infuriated the White House and Democrats. Earlier this week, for instance, liberals were hugely relieved when the court rejected a long-dormant legal theory that held that state courts and other state entities have a limited role in reviewing election rules established by state legislatures when it comes to federal elections. The so-called Independent State Legislature Theory, a favorite of the Trump campaign, had led to fears that Republican state legislatures in some states could simply decide how to allocate electoral votes regardless of results.

Still, the broad trajectory of the court – on issues including gun control, race, business, regulation, climate and many other issues – is firmly to the right.

It’s no coincidence that the Trumpist far-right assault on democracy began during the 2016 campaign with unprovoked attacks on Mexican migrants and bogus claims about the border and immigration. It was skillfully, if corruptly, followed up with weaponization of the immigration bureaucracy and packing of the Immigration Courts by the likes of Miller, Sessions, Barr, and Cooch. 

We have seen the GOP’s assault and dehumanization of migrants carry over into attacks on a wide range of disadvantaged groups in American society including African-Americans, Hispanic-Americans, Asian-Americans, Muslim-Americans, women, the LGBTQ+ community, and many others.

Although the Supremes have held that every “person” in the United States is entitled to due process under law, that concept is ludicrous as applied to the U.S. Immigration Courts, where anti-asylum, anti-immigrant, pro-DHS bias still drives much of the decision making, prosecutors appoint the judges and write the rules, the Government can change results that don’t match its political agenda, and individuals are on trial for their lives without a right to appointed counsel or many times even the ability to fully understand the proceedings against them. Predictably, the overwhelming number of individuals stuck in this abusive system are persons of color, many women and children!  

This is “colorblind” American justice? Gimmie a break!

Although Dems acknowledged many of these outrageous defects in the Immigration Courts while campaigning for votes in 2020, once in power, they have shown little inclination to correct this unacceptable situation that undermines our democracy.

In particular, given a chance to reform the Immigration Courts, re-compete on a merit basis judicial positions filled under questionable procedures (at best) during the Trump Administration, bring in competent judicial administrators laser-focused on due process and best practices, and remake the Immigration Courts into a bastion of great progressive judging —  driven by due process and equal protection, Garland and the Dems have whiffed. In that way they have largely followed the Obama Administration’s failure to take seriously due process for persons who happen to be in Immigration Court. 

The failure of Dems to take immigrant justice seriously, and their inexcusable blown opportunity to reshape the Immigration Courts into a training and proving ground for the best and most qualified candidates for Article III judgeships ties directly into the anti-democracy shift in the Article IIIs and the GOP’s ability to carry out its right-wing agenda through a Supremes majority highly unrepresentative of Americans and our values.

An informed observer might well wonder “If the Dems are unwilling and unable to reform and improve the Federal Courts they do control — and apparently are ashamed of the progressive values they espouse — how will they ever counter the right’s anti-democracy agenda?”

The birthright citizenship clause of the 14th Amendment, based on similar language found in the Civil Rights Act of 1866, was a direct response to and a rebuke of [chief Justice] Taney’s reasoning [in Dred Scott]. Having won the argument on the battlefield, the United States would amend its Constitution to establish an inclusive and, in theory, egalitarian national citizenship.

The authors of the 14th Amendment knew exactly what they were doing. In a country that had already seen successive waves of mass immigration, they knew that birthright citizenship would extend beyond Black and white Americans to people of other hues and backgrounds. That was the point.

Asked by an opponent if the clause would “have the effect of naturalizing the children of Chinese and Gypsies born in this country,” Senator Lyman Trumbull, who helped draft the language of birthright citizenship in the Civil Rights Act, replied “Undoubtedly.” Senator John Conness of California said outright that he was “ready to accept the provision proposed in this constitutional amendment, that the children born here of Mongolian parents shall be declared by the Constitution of the United States to be entitled to civil rights and to equal protection before the law with others.”

In 1867, around the time Congress was debating and formulating the 14th Amendment, Frederick Douglass delivered a speech in Boston where he outlined his vision of a “composite nationality,” an America that stood as a beacon for all peoples, built on the foundation of an egalitarian republic. “I want a home here not only for the Negro, the mulatto and the Latin races; but I want the Asiatic to find a home here in the United States, and feel at home here, both for his sake and for ours,” Douglass said. “The outspread wings of the American Eagle are broad enough to shelter all who are likely to come.”

If birthright citizenship is the constitutional provision that makes a multiracial democracy of equals possible, then it is no wonder that it now lies in the cross hairs of men who lead a movement devoted to unraveling that particular vision of the American republic.

Embedded in birthright citizenship, in other words, is the potential for a freer, more equal America. For Donald Trump and Ron DeSantis, that appears to be the problem.

As we know, Congress has failed to address the realities of immigration since the enactment of IRCA in 1986. That has inevitably led to a large, disenfranchised population of undocumented residents — essential members of our society, yet deprived of political power and the ability to reach their full potential by their “status.” Consequently, they are  subject to exploitation.

Nevertheless, this phenomenon would be much more serious without the “genius of the 14th Amendment.” Notwithstanding the failure of the political branches to address immigration in a realistic manner, the overwhelming number of the “next generation” of that underground population are now full U.S. citizens with the ability to participate in our political system and otherwise assert their full rights in our society.

Thus, because of the 14th Amendment we have avoided the highly problematic phenomenon of generations of disenfranchised Americans, essentially “stateless individuals,” forced into an underground existence. It’s not that these individuals born in the U.S., who have known no other country, would be going anywhere else, by force or voluntarily. Nor would it be in our best interests to degrade, dehumanize, and exclude generations of our younger fellow citizens as Trump, DeSantis, and the GOP far right extremist crazies advocate.

Additionally, in contradiction of traditional GOP dogma about limited government, the Trump/DeSantis charade would spawn a huge new and powerful “citizenship determining bureaucracy” that almost certainly would work against the poor, vulnerable, and individuals of color in deciding who “belongs” and who doesn’t and what documentation suffices. How many adult American citizens today who have deceased parents could readily produce definitive documentation of their parents’ citizenship?

So, notwithstanding GOP intransigence, their vile and baseless attacks on the 14th Amendment, and the lack of political will to solve and harness the realities and power of human immigration, the 14th Amendment is at work daily, solving much of the problem for us and making us a better nation, sometimes in spite of our Government’s actions or inactions. And, it performs this essential service in a manner that is relatively transparent and minimally bureaucratic for most.
