TRUMP’S NEXT ATTACK ON AMERICA: LEGAL IMMIGRATION!

“The most public components of Donald Trump’s nativist agenda are also, somewhat reassuringly, the most symbolic. Yes, the president wants to build an expensive wall along the southern border to keep “rapists” and “criminals” from Mexico from illegally entering the country, but as even Republicans have pointed out, building a wall is just about the least effective way to secure the border. Life will go on, regardless of whether the president adds an extra foot or two of barbed wire to the eyesore that already stretches across several hundred miles of Texas, Arizona, and California. Trump also wants a figurative fence around the country, in the form of his executive order banning travel from several Muslim-majority countries, but said ban was always designed to be temporary. The president’s long-term ambitions to curtail immigration, meanwhile, have mostly flown under the radar: a plan dreamt up by the White House’s resident nationalists Steve Bannon and Stephen Miller to crack down on legal immigration.

Now, Trump’s endgame appears to be moving into public view. According to a new report from Politico, Miller and Bannon—the latter of whom apparently keeps reminders to himself to restrict immigration “scribbled on the walls of his office” like other people keep reminders to order more ink for the printer—have been working on a bill with Republican Senators Tom Cotton and David Perdue that would cut the number of legal immigrants coming into the U.S. by half, to 500,000, as of 2027. The bill is said to be a “revised and expanded” version of the RAISE Act that Cotton and Perdue presented in February and discussed with the president in March.

The lawmakers, along with Miller, Bannon, and Trump, argue that allowing lower-skilled immigrants into the country hurts job prospects and suppresses wages for American-born workers. In addition to wanting to restrict the overall number of legal immigrants, they want to shift to a merit-based system in which foreigners who are granted entry, for example, hold advanced degrees or demonstrate a particular “extraordinary ability” in their given field. That dovetails with the White House’s desire to “limit citizenship and migration to those who pay taxes and earn higher wages.” Last month, in a display of his infinite generosity, particularly toward those who haven’t “made a fortune,” Trump promised that legislation banning legal immigrants from coming into the U.S. if they were expected to rely on any kind of welfare would be coming “very shortly.”

The move will likely appeal to Trump’s base. Unfortunately, a restrictionist immigration policy could backfire for the same set of voters. In April, 1,470 economists wrote an open letter to the president explaining that, actually, the economy benefits from immigration, describing it as “not just a good thing” but “a necessity.” Senators like Lindsey Graham and John McCain have also argued that the economy gets a boost from cheaper labor. Mountains of evidence suggest native workers aren’t interested in the kind of grueling, seasonal, low-wage employment that is typically the domain of recent immigrants. Experts have warned that a crackdown on immigration could, for example, destroy the U.S. agriculture industry, whose workforce is disproportionally made up of foreigners.

Of course, wanting to drastically restrict legal immigration and actually getting a bill passed to do so are two very different things, and Team Trump faces a steep uphill battle, given that G.O.P. lawmakers like Graham and McCain are against it. There are also more pressing matters to attend to, including but not limited to: health care, tax reform, and avoiding a government shutdown in September. Building a border wall around the entire country might have to wait.”

This is particularly true with a declining birth rate and an expanding economy. “Sarah Sherman-Stokes is a clinical instructor and the associate director of the Immigrants’ Rights and Human Trafficking Program at Boston University School of Law.

America’s immigration judges have long been overburdened and under-resourced. One immigration judge has compared her job to “doing death-penalty cases in a traffic-court setting.” The stakes are high, while support and procedural protections for noncitizens facing deportation are negligible. It’s no surprise, then, that immigration judges suffer greater stress and burnout than prison wardens or doctors in busy hospitals.

Now, the Trump administration is making a difficult situation almost untenable. In an effort to expand and accelerate the deportation machine, the Trump administration has hit immigration judges with a one-two punch: dramatically increasing their caseloads and, at perhaps the worst time, canceling the annual week-long training conference for immigration judges. The impact on the entire removal system — and, more importantly, on the rights and lives of our most vulnerable noncitizen neighbors — will be devastating.

On average, an immigration judge completes more than 1,500 cases per year, with a ratio of 1 law clerk for every 4 judges, according to a recent report of the National Association of Immigration Judges. By comparison, the typical district court judge trying civil suits has a pending caseload of 400 cases and three law clerks for assistance.

This imbalance is poised to deteriorate even further. In January, the administration issued an executive order that effectively repealed and replaced a tiered system of immigration enforcement and removal priorities crafted by the Obama administration, which focused deportation efforts on the most serious offenders. President Trump’s executive order places a priority on every noncitizen suspected of violating the law. This includes noncitizens who have been charged with (but not convicted of) any offense or who have committed acts that constitute a criminal offense (though they have been neither charged nor arrested). In fact, a recently leaked February 2017 memo from an Immigration and Customs Enforcement official is even more explicit, instructing ICE agents to “take enforcement action against all removable aliens encountered in the course of their duties.” It adds that the agency “will no longer exempt classes or categories of removable aliens from potential enforcement.”

“Confusing civility with comity is a grave mistake in human or international relations. Yes, the Group of 20 summit issued a common communique after the leaders’ meeting. Some see this as an indication that some normality is being restored in international relations between the United States and other countries. The truth is that at no previous G-20 did the possibility occur to anyone that a common statement might not be agreed to by all participants.

Rather than considering agreement on a communique as an achievement, it is more honest and accurate to see its content as a confirmation of the breakdown of international order that many have feared since Donald Trump’s election. And the president’s behavior in and around the summit was unsettling to U.S. allies and confirmed the fears of those who believe that his conduct is currently the greatest threat to American national security.

The existence of the G-20 as an annual forum arose out of a common belief of major nations in a global community with common interests in peace, mutual security, prosperity and economic integration, and the containment of global threats, even as there was competition among nations in the security and economic realms. The idea that the United States should lead in the development of international community has been a central tenet of American foreign policy since the end of World War II. Since the collapse of the Soviet Union, the aspiration to international community has been an aspiration to global community.

All of this is troubling enough. The elephant in the room, however, is the president’s character and likely behavior in the difficult times that come during any presidential term. Biographer Robert Caro has observed that power may or may not corrupt but it always reveals. Trump has yet to experience a period of economic difficulty or international economic crisis. He has not yet had to make a major military decision in a time of crisis. Yet his behavior has been, to put it mildly, erratic.

A corporate chief executive whose public behavior was as erratic as Trump’s would already have been replaced. The standard for democratically elected officials is appropriately different. But one cannot look at the past months and rule out the possibility of even more aberrant behavior in the future. The president’s Cabinet and his political allies in Congress should never forget that the oaths they swore were not to the defense of the president but to the defense of the Constitution.”

“When President Trump spoke of the need to defend Western civilization in Poland last week, many saw an effort by him and some of his top White House advisers to redefine the mission of American foreign policy away from building relationships and spreading democratic principles, to a more protective stance drawing sharp lines between the United States and those perceived as threats.

One emerging flash point in that struggle is the internal administration debate over which part of the government should be in charge of deciding who gets into the United States.

Ever since the passage of the Immigration and Nationality Act in 1952, that mission has been charged to the State Department. Thousands of diplomats not only stamp passports and issue visas, but also craft policy and make recommendations about who gets to visit, work and seek refuge in the United States. That tradition has now come into question.

A document crafted by senior White House advisers, first reported by CNN, includes proposals to move the State Department’s Bureau of Consular Affairs and Bureau of Population, Refugees and Migration over to the Department of Homeland Security. White House policy adviser Stephen Miller, who helped craft the document, has reportedly been pushing Secretary of State Rex Tillerson to get “tougher” on immigration, vetting and refugee policy at the State Department.

That nativist strain in the White House is represented by Miller, who was the principal author of Trump’s travel ban, which targeted six Muslim-majority countries, as well as of Trump’s speech last week in Poland, which cast the mission of U.S. foreign policy as one based on threats, not relationships.

“The fundamental question of our time is whether the West has the will to survive,” Trump said. “Do we have enough respect for our citizens to protect our borders? Do we have the desire and the courage to preserve our civilization in the face of those who would subvert and destroy it?”

Viewing immigration and refugee programs through that lens alone is the opposite of courage. Only through a humane, non-discriminatory approach, led by diplomats and integrated with the rest of American foreign policy, can the United States achieve long-term stability abroad and security at home.”

Sometimes, all you need to know about a “bureaucratic reorganization” is who is sponsoring it. On its face, combining all immigration related functions in one agency could make sense and has been discussed in various forums for years. But, once we know that racist white nationalist Stephen Miller, a disciple of Steve Bannon and Jeff Sessions, is sponsoring the proposal, it’s obvious that it has nothing to do with efficiency or security and everything to do with advancing a racist, xenophobic, white nationalist agenda. That an out of touch, anti-social, extremist like Miller, who has no known positive accomplishments in his life, should be in the White House and shaping national and international policy should be of concern to every American who believes in the tenants of Western liberal democracy.

JAMELLE BOUIE IN SLATE: Trump’s Hypocritical “Defense Of Western Values” Is Really About White Nationalism!

“Thus far, Donald Trump has governed as a typical Republican president, with the usual suite of tax cuts, deregulation, and conservative nominees for the federal bench. The difference is that unlike his predecessors, Trump isn’t rooted in the tenets of conservativism. Indeed, as a man of id and impulse, it’s hard to say he’s rooted in anything. To the extent that he does have an ideology, it’s a white American chauvinism and its attendant nativism and racism. It was the core of his “birther” crusade against Barack Obama—the claim that for reasons of blood and heritage, Obama couldn’t be legitimate—and the pitch behind his campaign for president. Trump would restore American greatness by erasing the racial legacy of Obama’s presidency: the Hispanic immigration, the Muslim refugees, the black protesters.

This is the reason Trump’s campaign attracted, and his administration employs, men like Jeff Sessions, Stephen Bannon, and Stephen Miller. Sessions, a staunch opponent of federal civil rights enforcement and proponent of radical immigration restriction. Miller, his protégé, whose young career is marked by the same contempt for racial pluralism. Bannon, an entrepreneur with intellectual pretensions whose literary touchstones include virulently racist propaganda, and who brought that sensibility to Breitbart, a news website where “black crime” was a vertical and writers churn out stories on dangerous Muslims. Each shares a vision of a (white) America under siege from Hispanic immigration to the South and Islam to the East. All three are influential in the Trump White House as strategists and propagandists, taking the president’s impulses and molding them into a coherent perspective.

That is the key context for President Trump’s recent remarks in Warsaw, Poland, where he made a defense of “Western civilization.” He praised Poland’s resilience in the face of Nazi aggression and Soviet domination (and stayed quiet on Nazi collaboration within Poland), and celebrated the nation as a beacon of Western values. “A strong Poland is a blessing to the nations of Europe, and they know that. A strong Europe is a blessing to the West and to the world.” (It should be said that U.S. allies in Western Europe are less enthusiastic about the current right-wing Polish government.) From here, Trump presented the West as an empire under siege: “We have to say there are dire threats to our security and to our way of life. You see what’s happening out there. They are threats. We will confront them. We will win.”

Although marked by Trump’s characteristic bombast, much of this was in line with past presidential rhetoric, especially during the Cold War when American presidents routinely engaged in this kind of clash of civilizations rhetoric. (It is unclear, though, if previous presidents would have endorsed a narrative that erases victims of Polish anti-Semitism.)

But this isn’t the Cold War. The Soviet Union no longer exists. For Trump then, what are these “dire threats”? The chief one is “radical Islamic terrorism” exported by groups like ISIS. But he doesn’t end there. For Trump, these threats are broader than particular groups or organizations; they are internal as well as external.

“We must work together to confront forces, whether they come from inside or out, from the South or the East, that threaten over time to undermine these values and to erase the bonds of culture, faith, and tradition that make us who we are,” said Trump. “If left unchecked, these forces will undermine our courage, sap our spirit, and weaken our will to defend ourselves and our societies.”

Not content to leave his message understated, Trump hammered home this idea in a subsequent line. “The fundamental question of our time is whether the West has the will to survive,” said the president, before posing a series of questions: “Do we have the confidence in our values to defend them at any cost? Do we have enough respect for our citizens to protect our borders? Do we have the desire and the courage to preserve our civilization in the face of those who would subvert and destroy it?”

In the context of terrorism specifically, a deadly threat but not an existential one, this is overheated. But it’s clear Trump has something else in mind: immigration. He’s analogizing Muslim migration to a superpower-directed struggle for ideological conquest. It’s why he mentions “borders,” why he speaks of threats from “the South”—the origin point of Hispanic immigrants to the United States and Muslim refugees to Europe—and why he warns of internal danger.

This isn’t a casual turn. In these lines, you hear the influence of Bannon and Miller. The repeated references to Western civilization, defined in cultural and religious terms, recall Bannon’s 2014 presentation to a Vatican conference, in which he praised the “forefathers” of the West for keeping “Islam out of the world.” Likewise, the prosaic warning that unnamed “forces” will sap the West of its will to defend itself recalls Bannon’s frequent references to the Camp of the Saints, an obscure French novel from 1973 that depicts a weak and tolerant Europe unable to defend itself from a flotilla of impoverished Indians depicted as grotesque savages and led by a man who eats human feces.

For as much as parts of Trump’s speech fit comfortably in a larger tradition of presidential rhetoric, these passages are clear allusions to ideas and ideologies with wide currency on the white nationalist right.

Defenders of the Warsaw speech call this reading “hysterical,” denying any ties between Trump’s rhetoric in Poland and white nationalism. But to deny this interpretation of the speech, one has to ignore the substance of Trump’s campaign, the beliefs of his key advisers, and the context of Poland itself and its anti-immigrant, ultranationalist leadership. One has to ignore the ties between Bannon, Miller, and actual white nationalists, and disregard the active circulation of those ideas within the administration. And one has to pretend that there isn’t a larger intellectual heritage that stretches back to the early 20^thcentury, the peak of American nativism, when white supremacist thinkers like Madison Grant and Lothrop Stoddard penned works with language that wouldn’t feel out of place in Trump’s address.

“Unless we set our house in order, the doom will sooner or later overtake us all. And that would mean that the race obviously endowed with he greatest creative ability, the race which had achieved most in the past and which gave the richer promise for the future, had passed away, carrying with it to the grave those potencies upon which the realization of man’s highest hopes depends,” wrote Stoddard in his 1920 book The Rising Tide of Color Against White World-Supremacy. Compare this to the crest of Trump’s remarks in Warsaw, which follows his warning of internal threat and his praise of Western civilization:

What we have, what we inherited from our—and you know this better than anybody, and you see it today with this incredible group of people—what we’ve inherited from our ancestors has never existed to this extent before. And if we fail to preserve it, it will never, ever exist again.

Those lines fit comfortably into a long history of white nationalist rhetoric. They in no way resemble Ronald Reagan’s words in Berlin or John Kennedy’s speeches in defense of the “free world.”

To read those previous presidential speeches is to see what makes Trump distinctive. Kennedy and Reagan defined “the West” in ideological terms—a world of free elections and free markets. It’s an inclusive view; presumably, any country that adopts these institutions enters that community of nations. For Trump, “the West” is defined by ties of culture and religion. It’s why a government that disdains democratic institutions, like Poland’s, can still stand as a vanguard of Western civilization, and why Muslim immigration is a chief threat to the integrity of Europe. What makes this racial is its relationship to Trump’s other rhetoric. If Western civilization is defined by religion and culture, then Mexico—with its Catholic heritage and historic ties to European monarchies—is unquestionably an outpost of “the West.” But for Trump and his advisers, it too is a threat to the Western order.

Donald Trump went to Europe and, in keeping with his campaign and influences, gave a speech with clear links to white nationalist thought. To pretend otherwise, to ignore the context of this address—to place Trump in a vacuum of history and politics, divorced from his own persona—is, at best, to cross the line into willful ignorance.”

Trump has clearly shown himself to be a person of no values whatsoever. Although his xenophobic, white nationalist/racist agenda appears to be little more that political opportunism — parroting concepts developed by Sessions, Bannon, Miller & company — that doesn’t make it any less problematic — or dangerous.

“LACKS CREDIBILITY” — That’s A Federal Judge’s Verdict On KRIS KOBACH, The White Nationalist Kansas Elected Official Leading The Trump-Pence Voter Suppression Effort!

“In a Wednesday ruling, [Judge James P.] O’Hara denied Kobach’s request for a motion for reconsideration because he was introducing new arguments he hadn’t used before.

“Significantly, defendant never represented, as he does now, that his misstatements were the result of editing errors. The court declines to grant reconsideration based on this explanation ‘that could have been raised in prior briefing.’ In any event, this new excuse lacks credibility based on its late assertion (which appears to be an attempt at a second bite at the apple) and lack of supporting documentation,” O’Hara wrote.

Kobach is the vice chair of a commission that Trump convened to investigate elections. He is also running for governor of Kansas.”

JUSTICE WATCH: Experts See Sessions’s DOJ Joining Efforts At Voter Suppression!

Former Department of Justice officials and voting advocates are seriously alarmed over a DOJ letter sent to states last week that they say could signal a forthcoming effort to kick people off voter rolls. This comes as national attention focuses on several states blocking a request for voter information from President Donald Trump’s commission to investigate voting fraud, which does occur, but is not a widespread problem.

The DOJ sent the letter to 44 states last Wednesday, the same day the Presidential Advisory Commission on Election Integrity sent a letter controversially requesting personal voter information. The DOJ letter requests that election officials respond by detailing their compliance with a section of the National Voter Registration Act of 1993 (NVRA), which covers 44 states and was enacted to help people register to vote, but also specifies when voters may be kicked off the rolls.

Several experts said it’s difficult not to see the DOJ letter in connection with the commission’s letter as part of a multipronged effort to restrict voting rights.

Former Justice Department officials say that while there’s nothing notable about seeking information about compliance with the NVRA, it is unusual for the department to send out such a broad inquiry to so many states seeking information. Such a wide probe could signal the department is broadly fishing for cases of non-compliance to bring suits aimed at purging the voter rolls.

“These two letters, sent on the same day, are highly suspect, and seem to confirm that the Trump administration is laying the groundwork to suppress the right to vote,” said Vanita Gupta, the CEO of the Leadership Conference on Civil and Human Rights and former head of DOJ’s civil rights division under President Barack Obama. “It is not normal for the Department of Justice to ask for voting data from all states covered by the National Voter Registration Act. It’s likely that this is instead the beginning of an effort to force unwarranted voter purges.”

These two letters, sent on the same day, are highly suspect, and seem to confirm that the Trump administration is laying the groundwork to suppress the right to vote.Vanita Gupta, head of DOJ’s civil rights division under President Barack Obama.

“If this went to any individual states, I don’t think anybody would’ve blinked twice,” said Justin Levitt, a professor at Loyola Law School who served as deputy assistant attorney general in the civil rights division in the Obama administration. The letter asked for public information that was uncontroversial, he added, but what made the letter “really weird” was that it was sent out to so many states.

“The Department of Justice does investigations all the time, but those are usually based on individualized predicates to believe that there’s a problem in a given area, in a given jurisdiction. And I’m not aware of a similar letter being sent to blanket jurisdictions across the country,” he said.”

Perhaps the anti-Trump resistance could tackle the challenge of building a positive vision. “Resist and rebuild” might be the mantra.

The original Independence Day was one of construction. By July 4, work on the Articles of Confederation and state constitutions was already well advanced. Maybe the thing to do is have a competition. Hear ye, hear ye, all Americans, what do you think Democrats should be trying to achieve? Submit your ideas!

I, for one, would love to see somebody stand up on some platform somewhere and say something like the following:

We are better than this, America. Better than this division, disdain and despair. We will chase away the clouds and let the sun shine through. The sun of honor and truth. The sun of freedom, fairness and equality.

We will connect, empower and emancipate Americans.

How? By transforming transportation, housing, criminal justice and health care.

We will get our fiscal house in order — achieving a new social contract across generations to rebalance Social Security and Medicare. With our own resources — and without Saudi infrastructure investments being arranged at the same moment that sales of arms to the kingdom are being hammered out — we’ll rebuild our transportation infrastructure. We’ll reconnect rural America to mobility and break the grip of deadening traffic on the lives of urban and suburban residents. By banishing remoteness, we’ll restore opportunity. With less time in cars, we’ll have more time for neighbors; parents will have more time for kids.

We will tackle the true housing crisis: the high cost of rent and the limited availability of affordable housing in places where there is economic opportunity. While real estate developers get rich on the tax treatment of commercial real estate losses, ordinary Americans keep taking hits. We will address underwater mortgages that continue to trap people in undesirable situations and make moving a threat to one’s retirement. An America on the move is an America empowered, firing up engines of opportunity now stalled out.

We will end the war on drugs, build universal health care and reinvest in education. Criminal justice isn’t the tool for the problem of addiction. Health care is. We can and should fight high-level traffickers, but we should emancipate those who suffer from addiction, by calling on the blessings of medicine. We can and should rally the international community against international trafficking, but we must emancipate young people entrapped as low-level employees in international cartels’ predatory distribution systems. They need pathways out — through education and jobs. And we must emancipate communities of color from mass incarceration’s devastation. We must liberalize our drug laws at last.

The time has also come for universal health care. Where Medicaid has expanded, states are better able to fight opioid addiction. When children go to school healthy, they learn better. As Thomas Paine, author of “Common Sense,” argued, everyone needs a starting kit for life. Congress has proved that our health-care system is a mess — too complicated, too byzantine — for any group of 535 honorable women and men to sort out. Let’s make it simple. Forty percent of the nation’s children are already on Medicaid. We can offer Medicaid to all.

With Medicaid for all, we can secure what most of us now recognize as a basic right: routine access to modern medicine. This should be, for all Americans, like access to our highway system. Sure, some will use toll roads for a superior journey. But the road to good health should be open to all. Empowered with a strong foundation of health and education, all Americans will at last have a shot at the American dream.

America is woven of many strands: religious and secular; black, brown and white; male, female; gay, trans and straight; rural and urban. We would recognize it and let it so remain. We will connect, empower and emancipate all Americans, new and old, the sons and daughters of ancestors who have been here for generations, the sons and daughters of those just arrived.

We ask in return that you begin to speak to each other again with civility and decency, whether online or off, and in the expectation of securing goodwill from one another. We didn’t get to be the richest, freest country in the world on a fuel of mutual disdain. What we have we’ve built with the mutual respect that makes working together possible. We ask that all Americans aspire to prove themselves trustworthy to one another, to stand beside each other, and to hope to guide one another generously, in a spirit of equality, upholding justice for all, with the grace of Lady Liberty.

We will also ask Americans to welcome a set number of new immigrants every year and another set number cycling through on work permits. We will bring order to our immigration system. But remember this: Families coming from distant lands seek us out because we are the country of good hope. This is our pride and joy. To see that hope reflected in the faces of newcomers is an honor indeed. By asking for entrance, new immigrants tell us that we have done well. We have built something of value to all humankind.

Connect. Empower. Emancipate. This is what we will do for the American people. This is what we ask you, the American people, to do for yourselves. Connect. Empower. Emancipate.

We will banish the dark. We will again lift the lamp of human dignity.”

“While many commentators say Trump will have to bring back jobs or vibrancy to places like the Rust Belt if he wants to continue to have the support of people who voted for him, Thompson’s account suggests otherwise. Many if not most Trump supporters long ago gave up on the idea that any politician, even someone like Trump, can change the direction the wind is blowing. Even if he fails to bring back the jobs, Trump can maintain loyalty in another way: As long as he continues to offend and irritate elites, and as long as he refuses to play by certain rules of decorum—heaven forfend, the president-elect says ill-conceived things on Twitter!—Trump will still command loyalty. It’s the ethic, not the policy, that matters most.

Even the racism that was on full display in Trump’s campaign should be understood at least in part in retaliatory terms, as directed at the political elite rather than at struggling minority groups. The Hells Angels, Thompson wrote, did things like get tattoos of swastikas mostly because it visibly scared the members of polite society. The Angels were perfectly happy to hang out at bars with men of different races, especially if those men drove motorcycles, and several insisted to Thompson that the racism was only for show. While I have no doubt (and no one should have any doubt) that there are genuine racists in Trump’s constituency—and the gleeful performance of racism is nothing to shrug off—Thompson suggests we should consider the ways in which racism might not be the core disease of Trumpism but a symptom of a deeper illness.

Thompson would also direct our attention in the early days of the Trump administration to the armed forces and the policies that will mandate what they do. For one great exception to the Angels’ ethos of total retaliation against authority was the military, just as one great exception to the Trump voters’ ethos of total irreverence is the police. Thompson explains that such institutions, which are premised on brute force rather than the more refined rules of intellectual engagement, maintain both a practical and a cultural connection to people like the Angels. The military and the police draw mostly from poor and working-class communities to fill their ranks, and their use of violence is something the motorcycle guys understand. It is one aspect of American life they can easily imagine themselves being a part of.

For his part, Thompson thought that what might prove most dangerous about the ethic of total retaliation was the way it encouraged the distrust of all authority—except for the authority of brute force. The president-elect’s enthusiasm for waterboarding and other forms of torture, his hawkish cabinet choices, and his overtures to strongmen like Vladimir Putin are grave omens. We could end up back where Thompson left off at the end of his book: the Angels, marching with the John Birch Society, on behalf of the Vietnam War.

At the end of Hell’s Angels, having spent months with the motorcycle guys, Thompson finally gets stomped by them. For some offense he doesn’t understand (and which he probably didn’t commit), Thompson gets punched, bloodied, kicked in the face and in the ribs, spat at and pissed on. He limps off to a hospital in the dead of night, alone and afraid. Only in that moment does Thompson realize that as a journalist (and therefore a member of the elite), he could not possibly be a true friend of the Angels. Wear leather and ride a motorcycle though he might, Thompson stood on the side of intellectual and cultural authority. And that finally made him, despite his months of good-timing with the Angels, subject to their retaliatory impulses. The ethic of retaliation is total, Thompson comes to realize. There is nothing partial about it. It ends with violence.

There’s no doubt about it: trouble lies ahead. That Hell’s Angels foresaw all this 50 years ago underscores the depth and seriousness of Thompson as a political thinker and of ours as a singularly dangerous time. Trumpism is about something far more serious than Trump, something that has been brewing and building for generations. Let us take Thompson’s cautions seriously, then, so that this time we Berkeley types are not naive about what we face. Otherwise, we’re all liable to get stomped.”

“Washington (CNN)President Donald Trump has let a controversial Obama-era immigration policy continue — and conservative states are running out of patience.

Texas Attorney General Ken Paxton was joined by his counterparts in nine other states in a letter Thursday warning Attorney General Jeff Sessions that if the Trump administration does not move to end Deferred Action for Childhood Arrivals, they will file a court challenge to the program.
At the heart of the threat is ongoing litigation over a related program — giving the attorneys general an opening to squeeze the administration on DACA.
Despite explicitly pledging during the campaign to “immediately” rescind DACA, a program that gives undocumented immigrants brought to the US as children protection from deportation and the ability to work and study in the US, the Trump administration has continued to honor the program and issue new permits under it.
With its efforts, the administration appears to want to have it both ways, continuing the program and pledging to protect its participants while saying the situation isn’t necessarily permanent and arresting those who officials say have lost their DACA status. But that position has angered activists on both sides of the issue, who in a rare moment of agreement have expressed similar frustrations that the administration won’t clearly articulate its long-term plans for DACA.
At issue is pending litigation in Texas that has challenged an Obama administration program that’s similar to DACA but geared toward parents of childhood arrivals as well as an extension of the childhood arrivals program, both of which were never allowed to go into effect by the courts.
The Trump administration formally abandoned the Deferred Action for Parents of Americans and Lawful Permanent Residents program, known as DAPA, earlier this month to avoid having to defend it in court. But it left DACA on the books despite similar criticism of that program — namely that both programs were an overreach of executive authority.
Asked by CNN about that decision, Homeland Security Secretary John Kelly at the time called it “house cleaning,” saying the program for parents was blocked by the courts while the one for those who came to the US was children wasn’t.
But Paxton wrote that if the administration doesn’t end DACA by September 5, Texas will amend its complaint in the case to include that program — which would force the administration to defend the program in litigation or abandon it.
“We respectfully request that the Secretary of Homeland Security phase out the DACA program,” Paxton wrote in the ultimatum. “Otherwise, the complaint in that case will be amended to challenge both the DACA program and the remaining Expanded DACA permits.”
The Department of Justice and DHS did not respond to a request for comment on the letter. Sessions was asked about it on “Fox and Friends” on Friday and seemingly praised the states.
“The DAPA law has already been withdrawn,” Sessions said when asked what changes could be coming. “That was a big victory, and we’ll be looking at that. But I’ve got to tell you, I like it that our states and localities are holding the federal government to account, expecting us to do what is our responsibility to the state and locals, and that’s to enforce the law.”

Trying to throw 800,000 American young people — basically America’s future — out of the country and sow fear in local ethnic communities has nothing whatsoever to do with law enforcement. But, it has lots to do with racism and white nationalism. The real target here is Hispanic Americans and other ethnic Americans from immigrant roots.

Paxton, Texas Governor Greg Abbott, Kansas Secretary State Kris Kobach and their followers are the George Wallaces, Lester Maddoxes, and Orval Faubuses of our time. Yeah, white racists might be giving it one more go. But, like the Trump victory, it is the last gasp. Eventually, the screw will turn as it did for prior generations of racist politicians.

To point out the obvious, with 600,000 pending cases in U.S. Immigration Court, the Trump Administration could not actually remove another 800,000 individuals any time in the foreseeable future. So, it’s all about meanness, fear, racism, white nationalism, and trying to prevent these young people from fully participating in our society. In other words, to make them a permanent underclass. Sound familiar?

The Dream Act to protect these young people should have become law years ago. But, then Senator Jeff Sessions and other GOP right wingers blocked its passage, even though it had the support of the majority of Senators. So, although legislation would be the logical solution, I wouldn’t count on it under today’s polarized conditions.

And, today’s GOP has become the home of racists and white supremicists. Something that anyone who runs on the GOP ticket or pulls the lever for a GOP candidate should consider.

“Washington (CNN) The House Thursday is expected to pass bills that would hand President Donald Trump key pieces of his immigration agenda, especially efforts targeting sanctuary cities.

The bills, “Kate’s Law” and the No Sanctuary for Criminals Act, would install harsher penalties for repeat illegal entry to the US, and expand US law on sanctuary cities to pressure localities to cooperate with federal immigration enforcement.
But it’s unlikely either would have enough votes to pass the Senate, which struggled with Kate’s Law last year.

Immigration and civil liberties advocates have also come out swinging against the bills, saying they bolster a “deportation force” and anti-immigrant agenda from the Trump administration.
Both bills come from the Judiciary Committee led by Virginia Rep. Bob Goodlatte, a longtime proponent of strict immigration policies like Trump’s and Attorney General Jeff Sessions. Another lead sponsor is Iowa Rep. Steve King, one of the most aggressive Republicans on immigration enforcement who has a history of controversial statements about immigrants.”

“How is it possible in a country that prides itself on having a Bill of Rights, expresses reverence for due process and touts equal protection that a 17-year-old can be arrested, put on trial and sentenced to death, and then spend 13 years being shuttled among death row cellblocks in disgusting jails and prisons with his case under appeal, all for a crime he didn’t commit?

The answer contains some simple prerequisites: He had to be black, live in the Jim Crow South and be accused of committing, as one deputy sheriff put it, a “supreme offense, on the same level of a white woman being raped by a black man” — that is, the murder of a white police officer.

Teenager Caliph Washington, a native of Bessemer, Ala., was on the receiving end of all three conditions. And as such, Washington became a sure-fire candidate to suffer the kind of tyrannical law enforcement and rotten jurisprudence that Southern justice reserved for blacks of any age.

In “He Calls Me by Lightning,” S. Jonathan Bass, a professor at Alabama’s Samford University and a son of Bessemer parents, resurrects the life of Washington, who died in 2001 finally out of prison — but with charges still hanging over his head.

Bass, however, does more than tell Washington’s tale, as Washington’s widow, Christine, had asked him to do in a phone call. Bass dives deeply into the Bessemer society of 1957 where Washington was accused of shooting white police officer James “Cowboy” Clark on an empty dead-end street near a row of run-down houses on unpaved Exeter Alley.

Bessemer-style justice cannot be known, let alone understood, however, without learning about that neo-hardscrabble town 13 miles southwest of Birmingham.

Bessemer served as home to a sizable black majority, an entrenched white power structure and an all-white police department, consisting at the time of a “ragtag crew of poorly paid, ill-trained, and hot-tempered individuals” who earned less than Bessemer’s street and sanitation workers.

Bessemer was a town with its own quaint racial customs, such as forcing black men to “walk in the middle of the downtown streets, not on the sidewalks, after dark — presumably to keep them from any close contact with white women.”

Bessemer was a town where in 1944 the police forced black prisoners to participate in an Independence Day watermelon run. White citizens reportedly cheered as firefighters blasted the inmates with high-pressure hoses to make the race more challenging. Winners, it is said, received reduced sentences and the watermelons.

It was in that town that Caliph Washington was born in 1939, the same year of my birth in Washington, D.C.

Bessemer’s racial climate was no different the year Washington was accused of killing Cowboy Clark. The town’s prevailing attitude on race was captured at the time in a pamphlet distributed by a segregationist group, the Bessemer Citizens’ Council. Black Christians, the white citizens’ council said, should remain content with being “our brothers in Christ without also wanting to become our brothers-in-law.”

If ever there was a place to not get caught “driving while black” — which is what Washington was doing on that fateful night in July 1957 — it was Bessemer. And that night’s hazard appeared in the form of Clark and his partner, Thurman Avery, who were cruising the streets in their patrol car looking for whiskey bootleggers.”

So, when you hear Sessions and his White Nationalist buddies like Bannon, Miller, Kobach, and Pence extolling the virtues of a small Federal Government (except for the migrant-bashing mechanisms) state control of voting, civil rights, police conduct, gender fairness, environmental regulations, labor relations, filling the prisons with maximum sentences, a new war on drugs, etc., it’s just clever code for “let’s make sure that white-dominated state and local governments can keep blacks, hispanics, immigrants, Muslims, and other minorities from achieving power, equality, and a fair share of the pie.” After all, if you believe, as these guys do, that true democracy can be a bad thing if it means diversity and power sharing, then you’re going to abuse the legal and political systems any way you can to maintain your hold on power.

And, of course, right-wing pontificating about the “rule of law” means nothing other than selective application of some laws to the disadvantage of minorities, immigrants, and often women. You can see how selective Sessions’s commitment to the rule of law is when he withdraws DOJ participation in voting rights cases in the face of strong evidence of racial gerrymandering, withdraws support from protections for LGBT individuals, supports imprisonment in substandard prisons, targets legal marijuana, and “green lights” troubled police departments to prioritize aggressive law enforcement over the protection of minority citizens’ rights. Ethics laws, in particular, seems to be far removed from the Sessions/Trump concept of “Rule of Law.” And, sadly, this is only the beginning of the Trump Administration’s assault on our Constitution, our fundamental values, and the “real” “Rule of Law.”

“The crowd rose to its feet and roared its approval as Sen. Jeff Sessions bounded onto the stage at the Breakers, an exclusive resort in Palm Beach, Fla. Stephen Miller, an aide to the Alabama Republican, handed him a glass trophy honoring his bravery as a lawmaker.

“Heyyyy!” Sessions yelled out to the crowd.

The ceremony that day, in November 2014, turned out to be a harbinger: It brought together an array of hard-right activists and a little-known charity whose ideas would soon move from the fringes of the conservative movement into the heart of the nation’s government.

The man behind the event was David Horowitz, a former ’60s radical who became an intellectual godfather to the far right through his writings and his work at a charity, the David Horowitz Freedom Center. Since its formation in 1988, the Freedom Center has helped cultivate a generation of political warriors seeking to upend the Washington establishment. These warriors include some of the most powerful and influential figures in the Trump administration: Attorney General Sessions, senior policy adviser Miller and White House chief strategist Stephen K. Bannon.

As Horowitz mingled, Bannon introduced himself to Ronald Radosh, a prominent conservative intellectual and historian. Radosh had known Horowitz for a half-century and also worked his way through the ranks of the New Left before becoming a conservative.

“I’m Steve Bannon and this is my house,” Bannon said, according to an account that Radosh wrote about for the Daily Beast in August and discussed with The Post.

“I’m a Leninist,” Bannon said, according to Radosh. “Lenin wanted to destroy the state, and that’s my goal, too. I want to bring everything crashing down, and destroy all of today’s establishment.”

A few days later, Horowitz traveled to Palm Beach to host another Restoration Weekend at the Breakers. Bannon was going, too — in part to raise money for a documentary film about Horowitz. Bannon said he needed $1 million and there were few venues better for finding wealthy donors. As it happened, Bannon could not raise the money, according to two attendees who heard his pitch. But he received an unexpected gift.

In March 2014, the center made the first of $175,000 in contributions to the Party for Freedom, a group founded by Geert Wilders, one of Europe’s most ardent anti-Muslim politicians, according to documents released by the Dutch government and originally described by the New York Times and the Intercept. He was campaigning on a platform of preventing the “Islamization of the Netherlands,” proposing a ban on Muslim immigration and the shuttering of mosques.

Later that year, Wilders spoke at Restoration Weekend.

“The truth is that our own Western culture — based on Christianity, based on Judaism and humanism — is far superior, far superior, than the Islamic culture that immigrants have adopted,” Wilders said to applause.

On hand that weekend was Jeff Sessions, a regular at the annual retreat. He was honored with a glass trophy for helping to derail a bipartisan bill aimed at overhauling U.S. immigration law. He acknowledged Horowitz from the stage. “I’ve seen some great people receive this, David. And it’s a special treat and pleasure for me, David, because you know how much I admire you as we battle for right and justice and law,” Sessions said.

Later that night, Sessions and Miller went to a lounge at the resort. Joining them was Ann Coulter, another regular and a contributor to Frontpagemag.com. She was writing a book called “Adios, America: The Left’s Plan to Turn Our Country into a Third World Hellhole.”

As Sessions sipped on a drink, she and Miller batted around ideas about how to crack down on immigration until long after midnight. “There was obviously a major meeting of the minds,” said one person in the lounge at the time who spoke on the condition of anonymity out of fear of repercussions. “They thought immigration was the single most important issue in the country.”

On Dec. 14, 2016, during a videotaped event, Horowitz expressed happiness about Trump’s victory and said Republicans had finally woken up to his approach to politics. He pulled from his suit coat a piece of paper listing Freedom Center supporters already in the administration.
“It’s quite an impressive list,” Horowitz said, rattling off the names: Sessions, Bannon, Vice President Pence, Reince Priebus, Kellyanne Conway and at least six others.

“My personal favorite is Steve Miller, because Steve, who was today appointed the senior policy adviser in the White House . . . is a kind of protege of mine,” he said. “So the center has a big stake in this administration.”

The White House and Justice Department did not respond to requests for comment.

Two weeks later, the Freedom Center named Bannon its Man of the Year.

“Over the years people would refer to my Freedom Center as a ‘think tank’ and I would correct them, ‘No, it’s a battle tank,’ because that is what I felt was missing most in the conservative cause — troops ready and willing to fight fire with fire,” Horowitz wrote in Breitbart in February. “The Trump administration may be only a few weeks old, but it is already clear that the new White House is a battle tank.”

I don’t find Horowitz’s “jump” from the left to the right surprising. He’s an anarchist. He simply went from being a leftist anarchist to being a rightist anarchist. Just a costume change without any fundamental difference.

Somewhere out there, dudes like Karl Marx, Frederich Engels, Vladimir Lenin, Leon Trotsky, and Nikolai Bakunin must be smiling. It looks like capitalism might indeed have sown the seeds of its own destruction.

And Vladimir Putin — he’s just sitting back, enjoying the show, and watching America self-destruct. He’s got to be delighted that America is voluntarily surrendering its world leadership with only a limited number of shots being fired. It’s going to create some really great opportunities for Russia, China, and even India.

“Maryland prosecutors said they will drop rape and sex offense charges against two immigrant teens accused of attacking a 14-year-old classmate in a high school bathroom stall in a case that attracted international and White House attention and stoked the debate about illegal crossings into the United States.

After a court hearing Friday morning, prosecutors said they will drop the sex-assault case against Henry Sanchez Milian, 18, and Jose Montano, 17.

“The facts of this case do not support the original charges filed,” said Montgomery County State’s Attorney John McCarthy.

Defense lawyers had said for weeks that the sex acts were consensual and that text messages and school surveillance videos did not substantiate the girl’s claims she had been pushed from a hallway into a bathroom at Rockville High School on March 16 and that the suspects took turns assaulting her as she tried to break free.

As prosecutors moved to dismiss the rape cases, they began pursuing cases of child pornography charges related to images discovered on cellphones during the course of the investigation, according to court records and defense attorneys.

Prosecutors did not describe the content or path of the exchanges of the images. Defense attorneys said they were willingly shared by the girl with one defendant, who passed them along to the other.

Sanchez Milian’s attorney, Andrew Jezic, called the charges “selective prosecution of elective promiscuity,” adding that “it is hardly uncommon behavior for teenagers.”

Montano’s attorney, Maria Mena, said the child pornography laws are made to go after adults. She called the new charges “egregious.”

The developments Friday stood in stark contrast to the reports that pushed the case onto the national platform.

The severity of the reported assault — the girl originally told police the suspects held her down as she cried and repeatedly told them to stop — and that the two accused teens had entered the United States illegally only months earlier drew heated comments from the White House to the Maryland State House and to activists in the county.

Montano came to the United States from El Salvador, and Sanchez Milian from Guatemala. They were stopped at the border, detained, then allowed to continue on to relatives before they enrolled at Rockville at a ninth-grade level.

White House press secretary Sean Spicer was asked at a daily briefing about the cases in its early days and said, “The idea that this occurred is shocking, disturbing, horrific.”

“Part of the reason that the president has made illegal immigration and crackdown such a big deal is because of tragedies like this. . . . Immigration pays its toll on our people if it’s not done legally, and this is another example,” Spicer said.”

Always a good idea to wait for the legal system to operate before passing judgment. And, the idea that anyone in the Trump Administration would give “two hoots and a holler” about a rape victim is facially absurd.

Nope. It’s all about revving up xenophobia. And, the targets aren’t just those who arrived recently and made claims for protection. Xenophobia, like racism, is an ugly phenomenon. In the end, the Administration’s “white nationalist” agenda threatens all Americans in one way or another (ironically, it even threatens those who think that they stand to benefit from it).
