Even Republicans don’t have the stomach to outsource judgment on all modern constitutional questions to the slaveholding elite of a preindustrial, post-colonial backwater. As Dean of Berkeley Law Erwin Chemerinsky has observed, a ruthless adherence to text and history would require forfeiting judicial protection of “liberties such as the right to marry, the right to procreate, the right to custody of one’s children, the right to keep the family together, the right of parents to control the upbringing of their children, the right to purchase and use contraceptives, the right to abortion, [and] the right to refuse medical care,” none of which are guaranteed by the Constitution.

Amy Coney Barrett herself has acknowledged the undesirability of applying originalism indiscriminately, noting in 2016, “Adherence to originalism arguably requires, for example, the dismantling of the administrative state, the invalidation of paper money, and the reversal of Brown v. Board of Education,” and other institutions that “no serious person would propose to undo,” even if they lack constitutional grounding. Barrett’s proposed solution to this conundrum is for courts to simply avoid ruling on cases where originalism would dictate socially unthinkable overturnings of precedent; she wrote in 2017 that “discretionary jurisdiction generally permits [the Court] to choose which questions it wants to answer.”

But this expedient degrades originalism’s claim to neutrality. If an originalist Supreme Court can apply its doctrine opportunistically — taking only those cases in which its “neutral” juridical method will yield outcomes acceptable to a “serious” person (as they define that adjective) — then originalism isn’t much of a binding restriction on judicial discretion.

What’s more, Barrett’s concession tacitly betrays awareness of a critical fact that originalists love to elide when speaking for a lay audience: Amending the Constitution has become so phenomenally difficult it’s not at all clear that the American people could promptly replace an overturned Brown v. Board of Education with an amendment forbidding school segregation, despite overwhelming popular support for that Supreme Court decision. Originalists like to portray their judicial approach as highly democratic, since they purport to defer to the letter of a democratically enacted Constitution. But once one stipulates that the demos is manifestly no longer capable of passing constitutional amendments with regularity, it becomes clear that the originalist practice of striking down democratically elected laws in deference to the letter of a centuries-old document is profoundly anti-democratic.

Of course, in real life, “originalist” Supreme Court justices haven’t just applied their method opportunistically by selecting cases in which originalism will produce a favored outcome; they’ve also simply declined to abide by their method when they feel like it. On Monday, Barrett named Antonin Scalia as her guiding light on judicial philosophy. But as Georgia State University Law professor Eric J. Segall notes, Scalia voted “for broad rules limiting congressional power to enact campaign finance reform, to commandeer state legislatures and executives to help implement federal law, and to allow lawsuits against the states for money damages by citizens of other states” without “justifying these broad rules from a textual or historical perspective,” presumably because they have no textual or historical basis.

In sum: Amy Coney Barrett’s originalism does not work as a method of safeguarding democracy against an activist, ideologically motivated judiciary. It does, however, function quite well as a means of obscuring a far-right movement’s efforts to impose its unpopular agenda by judicial fiat.

Just think about it: Supposedly a bunch of guys who risked everything on a never-before-realized long shot of defeating the British King and setting up a republic actually  intended that 230 years after the fact the governors of that republic would be so backwards, unimaginative, and intellectually limited that they would still be attempting to divine the “true meaning” of various two-centuries out of date words and concepts that nobody agreed upon in the first place! Preposterous! Not to mention totally intellectually dishonest!

Obviously, if the GOP Senators actually believed that Coney Barrett would be an unbiased judge with an open mind to progressive, liberal, humane, common sense interpretations of law and committed to implementing the Constitutional guarantee of equal protection and due process under the law for all persons, they would be apoplectic. They would be outraged at Trump for foisting such an unreliable and unpredictable jurist on them! 

I’m not necessarily saying that Coney Barrett couldn’t educate herself and “get smarter” on the bench — abandoning her false dogma and actually showing some empathy, courage, independence, and commitment to equal justice for all. She wouldn’t be the first GOP-appointed Judge or Justice to move left on the bench. After all, spending a lifetime mired on the wrong side of history screwing up the lives of your fellow humans can get old, even for well-trained right-wing ideologues.

Also, she will have the benefit of the only current Justice who actually appears up to the job and consistently understands the proper role of a High Court in a democratic republic — Justice Sonia Sotomayor. Sotomayor actually “gets it right” in an amazing number of cases and usually explains her reasoning in coherent, non-legalistic terms that most folks can understand. 

But, sadly, I find relatively little in Coney Barrett’s career to predict that type of self-awareness, intellectual honesty, moral courage, and capacity for human growth. Her family situation shows some capacity for empathy and human understanding. 

But, sadly, to date, she evidently has been unable to “connect the dots” between her kids’ lives and futures and the future of humanity. To understand that but for the grace of God, the refugee she is expelling based on BS non-defects could be someone she actually loves or regards as human. That the benefits that neo-Nazi Stephen Miller is unethically and illegally stripping from deserving immigrants could be the lifeline that, but for life’s quirks, would allow her, her family, or other loved ones to survive and achieve their full human potential. The capacity to function as a real jurist certainly is there, but the will and perspective seem to be largely lacking.

In a way, Coney Barrett’s squandered potential to achieve good is her own human tragedy. But, one for which those “other than Coney Barrett” are likely to pay the ultimate price.

Criticised by challenger Amy McGrath in a debate on Monday night for blocking a new coronavirus relief bill, Mitch McConnell laughed.

“Trying to figure out what he is laughing about,” tweeted Claire McCaskill, a former Democratic senator from Missouri who now works for NBC News.

Nearly 7.8m coronavirus cases and almost 215,000 deaths have been recorded in the US. Amid devastating economic fallout, Congress has not passed a relief package since May, when the Democratic-held House passed a $3tn bill the Republican Senate did not take up. Donald Trump recently dynamited negotiations, which he then tried to restart.

McGrath and McConnell met to debate in Lexington during a rise in cases in Kentucky. The Democrat has raised impressive sums and stayed in touch in the polls – though victory remains unlikely.

“The House passed a bill in May and this Senate went on vacation,” McGrath said.

As McConnell chuckled, she continued: “I mean, you just don’t do that. You negotiate. Senator, it is a national crisis, you knew that the coronavirus wasn’t gonna end at the end of July. We knew that.”

As McConnell tried to interrupt, still chuckling, McGrath said: “If you want to call yourself a leader … you got to get things done and those of us who served in the marines, we don’t just point fingers at the other side. We get the job done.”

McConnell blamed the House speaker, Nancy Pelosi, saying: “Look, I know how to make deals. I made three major deals with Joe Biden during the Obama era. What the problem is here is the unwillingness of the speaker to make a deal.”

On Tuesday, after Trump tweeted “STIMULUS! Go big or go home!!!”, McConnell said the Senate would soon vote on a “skinny” bill, meant to tap into unused funds from previous legislation, a course Pelosi has already rejected.

Dahlia: I wonder what you thought of Barrett’s statement, about how she reads each of her opinions through the eyes of the losing party. As you have written, the losing party tends to be the prisoners, the Black worker, the teen seeking abortion, the asylum seeker. It reminded me of Justice Samuel Alito testifying at his hearings about his great solicitude for immigrants.

Mark: Barrett’s opening statement made me think about one of her worst decisions (so far), in which she approved the deportation of an asylum seeker because there were small, trivial variations in his account of persecution. Over a dissent, Barrett said, yep, this asylum seeker must be sent home to be tortured and murdered because tiny details in his story changed over time. Would a judge who views the case through the eyes of the asylum seeker really dismiss his claims so cavalierly? I doubt it.

So much for intellectual honesty! It also shows Barrett’s fundamental lack of experience and legal understanding of what Immigration “Courts” really are and how they have been politicized and weaponized against asylum seekers by “judges” who report to overtly biased and xenophobic politicos in the Executive Branch. Just how would this “naked farce” satisfy any rudimentary concept of Due Process? Clearly it doesn’t. And just as clearly, intentionally tone-deaf judges like Barrett don’t care!  They lack the guts, relevant experience representing migrants, and the intellectual presence to stand up for the Constitutional and human rights of “the other.” 

How would YOU like to be sentenced to torture and/or death based on trivial inconsistencies found by an Immigration “Judge” working directly for the Attorney General and his regime in a badly flawed assembly line process designed to achieve political policy objectives, not justice?

Also, did anyone else pick up the facial absurdity of Barrett’s disingenuous claim to be “apolitical” while pledging allegiance to GOP “superhero” the late Justice Antonin Scalia, probably the most overtly “political Justice” of modern times?

Better Judges For A Better America! Judge/Justice Barrett is part of the problem, not the solution! The best way to insure that she is among the last, far-right, anti-democracy, inhumane judges given life tenure on the Supremes or anywhere else, vote ‘em out, vote ‘em out! Then, we’ll discover the “true meaning” of Barrett’s “I’m not there to make policy nonsense!” (Indeed, I would submit that the sole reason for her appointment was the GOP’s belief and expectation that she will reliably elevate disingenuous right-wing policies, biases, and prejudices over the Constitutional, individual, and human rights of individuals and that she will be a steadfast opponent of Constitutionally-required equal justice under law.)

Justice for the George Floyds, Breonna Taylors, dehumanized dead asylum seekers, and wrongfully imprisoned migrant kids of the world (e.g., the end of unconstitutional “Baby Jails”) will require a different type of “Justice” than Amy Coney Barrett in the future! Far from being truly “independent” and “apolitical,” Barrett is likely to be the perfect representative of the warped man who appointed her and his anti-democracy party. And, that’s likely to cause problems for all Americans of good will far into the future!

This is no longer the case. Public confidence and public perception that the courts are non-partisan has eroded. The Republican boycott of Garland, together with Trump’s unprecedented nomination of Barrett and her likely confirmation, will seal the Republican theft of two supreme court seats, at least in the eyes of more than half the electorate, and will ensure conservative control of the court for decades to come.

If Barrett’s record is any indication, the court will soon turn its back on its most treasured precedents and turn America into a more regressive country. Before joining the bench just three years ago, she served as a law clerk to Scalia, whose judicial philosophy she has fully embraced. She has also been a longtime member of the rightwing Federalist Society.

 

Public confidence and public perception that the courts are non-partisan has eroded

Her short judicial record, together with her scholarly writings, reveal that she is a rock-solid conservative jurist. Like Scalia, she defines herself as an originalist and textualist, which means that the constitution must be viewed as of the time it was written. From that perspective, there is nothing in the constitution that would explicitly support abortion rights, gay marriage, mandatory school desegregation, or the right to suppress evidence that is illegally seized. By contrast, in one of her most famous opinions, United States v Virginia (1996), Ginsburg wrote that “a prime part of the history of our constitution … is the story of the extension of constitutional rights and protections to people once ignored or excluded.”

In a 2013 article, Barrett repeatedly expressed the view that the supreme court had created, through judicial fiat, a framework of abortion on demand that ignited a national controversy. In an opinion she joined with another judge, she expressed doubt that a law preventing parents from terminating a pregnancy because they did not want a child of a particular sex or one with a disability could be unconstitutional. These writings surely indicate that Barrett will do whatever she can to limit or eliminate abortion rights.

Barrett has also expressed dissatisfaction with the Affordable Care Act and support for a broad interpretation of the second amendment. She has writtenthat Chief Justice John Roberts “pushed the Affordable Care Act beyond its plausible meaning”. She also quoted Scalia, when he wrote that “the statute known as Obamacare should be renamed ‘Scotuscare’” in “honor of the court’s willingness to ‘rewrite’ the statute in order to keep it afloat”. There is little doubt that Barrett would be inclined to find the Affordable Care Act unconstitutional and thereby deprive millions of Americans of affordable healthcare coverage. Similarly, she wrote a dissenting opinion questioning the constitutionality of a statute that prohibited ex-felons from purchasing guns. Thus, she has demonstrated her fealty to the NRA position that the more guns the better – inevitably leading to more Americans dying from gun violence.

When addressing the legal doctrine known as stare decisis, meaning respect for precedent, Barrett wrote that she “tend[ed] to agree with those who say that a justice’s duty is to the constitution and that it is thus more legitimate for her to enforce her best understanding of the constitution rather than a precedent she thinks is clearly in conflict with it”. In other words, she would overturn landmark decisions such as Brown v Board of Education or Roe v Wade if those decisions did not reflect her best understanding of the constitution.

Stunningly, in an interview in 2016, when asked whether Congress should confirm Obama’s nominee during an election year, Barrett responded that confirmation should wait until after the election because an immediate replacement would “dramatically flip the balance of power”. Given that answer, she should decline the nomination, as her confirmation would even more dramatically flip the balance of the court, entrenching a 6-3 conservative majority.

Confirming this nominee before the outcome of the national elections – which will determine both the identity of the next president and the composition of a new Senate – is unprecedented, inexcusable and a threat to many rights that the majority of Americans have embraced. This is a tragedy about to happen.

Compare the courage and fidelity to due process, fundamental fairness, equal justice for all, and defense of human dignity demonstrated by brilliant lawyers like Michelle Mendez, Aimee Mayer Salins (former BIA JLC), and the terrific CAIR litigators with the warped right wing, anti-constitutional, anti-humanity jurisprudence of Trump’s Supreme Court choice, Judge Amy Coney Barrett:

Faced with two plausible readings of a law, fact, or precedent, Barrett always seems to choose the harsher, stingier interpretation. Can job applicants sue employers whose policies have a disproportionately deleterious impact on older people? Barrett said no. Should courts halt the deportation of an immigrant who faced torture at home? Barrett said no. Should they protect refugees denied asylum on the basis of xenophobic prejudice? Barrett said no. Should they shield prisoners from unjustified violence by correctional officers? Barrett said no. Should minors be allowed to terminate a pregnancy without telling their parents if a judge has found that they’re mature enough to make the decision? Barrett said no. Should women be permitted to obtain an abortion upon discovering a severe fetal abnormality? Barrett said no.

There is no question that, if confirmed, Barrett would cast the fifth vote to either hollow out Roe v. Wade or overturn it altogether. Similarly, there is no doubt that Barrett would dramatically expand the Second Amendment, invalidating gun control measures around the country. It’s quite possible, perhaps even likely, that within a year of her confirmation, Americans will be forbidden from terminating a pregnancy in 21 states—but permitted to purchase assault weapons and carry firearms in public in every state.

In other words, guns yes; human rights and human dignity, no! Some lawyers spend their lives saving lives and advancing humanity; others spend them pursuing and spreading anti-humanitarian, right wing dogmas. Why are commitments to cruelty, inhumanity, and a fundamentally unjust society things to “tout” in a judicial candidate? You need to look inside the deep perversity of the GOP minority who control our nation and are running it into the ground to get the answer.

There are thousands of progressive lawyers, many of them women and minorities, committed to standing up for equal justice for all who are better qualified than Judge Barrett. There is something wrong with a system that elevates the wrong people to the judiciary and other high offices.

It’s time to establish meritocracy and save our democracy. Vote to throw the GOP out of office and end the selection of far-right judges whose reactionary views and lack of empathy for the most vulnerable in society are far outside both the reality of our diverse nation and our future as a vibrant, progressive democracy that will promote equal justice and human rights at home and abroad!

Keep the future Judge Barretts where they belong — on the sidelines and in the margins of our legal system, while those with a better view of the Constitution, the rule of law, and human progress take their rightful places in positions of power and progressive influence in all there branches of our Government.

Judge Barrett parrots great admiration for RBG while aiming to trash her legacy of fairness and equality with a far-right, exclusive, intolerant agenda. In the future, we need Federal Judges who will constantly confront Judge Barrett, her soon-to-be-fellow GOP Supremes, and other righty judges bent on taking us back to the darkest corners of our past.  Make them face the truly courageous and enlightened legacy of RBG and others like her. Force the “Barretts of the world” to reckon with their own smugly disingenuous jurisprudence and their lack of commmitment to humanity and true equality before the law for all persons in the U.S.! Constantly confront complicit courts for change!

Better judges for a better, fairer America!

This Fall, vote like your life and the future of humanity depend on it! Because they do!

In fact, McConnell’s actions are totally in keeping with the opportunism with which he has led the Senate. Given a chance, he will always abuse his power. Branding McConnell a hypocrite misses the point. Hypocrisy — coupled with an utter lack of shame — is not a character fault in his eyes. It is a management style, a means to an end.

And would we have expected anything different from Sen. Lindsey O. Graham (R-S.C.), the shape-shifting chairman of the Judiciary Committee?

Back in the days when he pretended to care about something more than sucking up to power, Graham used to say Republicans would have to live with what they had done to Obama’s 2016 nominee, Merrick Garland. In October 2018, shortly before taking the gavel of the committee that will consider Trump’s nomination, Graham promised: “If an opening comes in the last year of President Trump’s term, and the primary process has started, we’ll wait till the next election.”

Now — surprise! — Graham has promised, via Twitter: “I will support President @realDonaldTrump in any effort to move forward regarding the recent vacancy created by the passing of Justice Ginsburg.” His rationale, if you can dignify it by calling it that, is that Democrats did things that offended him. So it’s payback time.

Oh, and let’s consider the sanctimonious and pseudointellectual Sen. Ted Cruz (R-Tex.), whom Trump has said he would consider for future openings on the court. When running for president in early 2016, he loftily declared to NBC’s Chuck Todd: “It has been 80 years since a Supreme Court vacancy was nominated and confirmed in an election year. There is a long tradition that you don’t do this in an election year. And what this means, Chuck, is we ought to make the 2016 election a referendum on the Supreme Court.”

What Cruz said wasn’t true, as is so often the case. There had indeed been instances of presidential nominees being confirmed during election years. In February 1988, a Democratic-led Senate voted 97-0 to put Ronald Reagan’s pick, Anthony M. Kennedy, on the court.

But this was only the beginning for Cruz. When it still appeared that Hillary Clinton would win in 2016, he also suggested that the court could get along just fine with only eight members indefinitely. Now — surprise! — Cruz is warning that having an even number of justices constitutes a “grave danger.”

Hundreds of Americans are dying every day from COVID-19. Unemployment is at 8.4%. Everything is fine.

WASHINGTON ― The Senate is back in session after a month of recess and Republicans’ first order of business isn’t a comprehensive coronavirus relief bill. Or emergency stimulus in response to high unemployment. Or legislation addressing nationwide unrest over police violence targeting Black Americans.

It’s confirming more judges.

Senate Majority Leader Mitch McConnell (R-Ky.), who has long said his top priority is getting President Donald Trump’s nominees settled into lifetime federal court seats, didn’t disappoint on Wednesday. At a time when nearly 190,000 Americans have died from COVID-19 and unemployment is at 8.4%, the Senate kicked off its first full day of business with a vote to confirm a district court judge, procedural votes to advance two more district court nominees, another vote to confirm one of those nominees, and two more procedural votes to advance two more district court nominees.

Democrats and Republicans are in a standoff over coronavirus relief legislation. The House passed a sweeping $3 trillion package in May that has gone nowhere in the Senate, where Democrats are ready to pass the House bill but Republicans don’t even agree with each other on what to do. Some prefer no action at all on another coronavirus package because it would add to the growing federal deficit.

McConnell will try to pass a narrowly focused COVID-19 relief bill this week, but it’s purely a political exercise ― an effort to give vulnerable Republicans something to run on ahead of the November elections. It includes funding for small businesses and schools and enhanced $300-a-week unemployment benefits. It leaves out another round of stimulus checks, which Republicans previously supported, and does not include rental assistance or aid to cities and states, which Democrats have insisted on. And it’s not even clear if a majority of Republicans will support the bill.

The Senate Judiciary Committee also met Wednesday for the first time in more than a month. The panel, led by Sen. Lindsey Graham (R-S.C.), has jurisdiction over a number of issues related to the health and economic fallout from COVID-19. Graham could, for example, hold hearings that looked at the needs of state and local law enforcement on the front lines of the pandemic. He could hold hearings on the health and safety of corrections staff and incarcerated people. He could hold hearings on changes in immigration policy tied to the pandemic.

Instead, the committee held a hearing to advance five more of Trump’s judicial nominees.

One of those nominees isn’t even qualified to be a federal judge, according to the American Bar Association. Just as the hearing got underway, the ABA released an embarrassing “not qualified” rating for Kathryn Kimball Mizelle, Trump’s nominee for a seat on the U.S. District Court for the Middle District of Florida.

“The nominee presently does not meet the requisite minimum standard of experience necessary to perform the responsibilities required by the high office of a federal trial judge,” reads the ABA’s review of Mizelle’s nomination.

Mizelle, 33, is eight years out of law school and has practiced law for four years. She has participated in a total of two trials (as a law student) and has not tried a case, civil or criminal, as lead or co-counsel.

“This nominee has been put forward not only because she is an ultraconservative ideologue, but also because she is a Trump loyalist, having worked in the Trump Justice Department to dismantle many critical civil rights protections,” reads a Tuesday letter to senators from the Leadership Conference on Civil and Human Rights, a coalition of more than 220 national civil rights groups. “The Senate must reject her nomination.”

Trump’s most lasting legacy will arguably be his judges, who will sit on the nation’s courts for decades after he’s left the White House. He has had confirmed a total of 204 Article III judges, including two Supreme Court justices, 53 appeals court judges and 147 district court judges. A common thread among his court picks is that many are young, white, male and hold extreme ideological views on abortion, LGBTQ rights and other civil rights.

Why The Private Sector Immigration Bar Holds The Key To A Better Article III Judiciary For America

Hey, Hey, Ho, Ho, the Trump regime🏴‍☠️ has got to go!

And that includes Moscow Mitch and every GOP Senator on the ballot this Fall. The serious long-term damage they have inflicted on our nation is already catastrophic! Let’s not let it become fatal!

Our sinking “Ship of State,” including the failing Federal Judiciary that is largely unrepresentative of our diverse nation, too often lacks engagement with the “human face” of our justice system, and sometimes demeans our best humane national values, can still be saved and put the on the correct course.

It won’t be easy. It won’t happen overnight, particularly with the life-tenured judiciary. But, it must start in November. Remember, the law is about humanity, fairness, and equatable human relations, as embodied in the due process and equal protection clauses of our Constitution.

It’s not the dusty, musty, wooden, racially tone deaf, sometimes intentionally unfair, anti-civil-rights, anti-human rights, and often contrived “anti-social ideologies of the right” that blind a disproportionate number of Trump-Mitch appointees and enable lawless, fundamentally anti-American tyrants like Trump and his cult of sycophants to run roughshod over our country, our national values, and human decency.

Yesterday, Courtside highlighted the monumental achievements of a real American legal heroine and superstar, Attorney Sarah Owings of Atlanta, Georgia. She could have done other things with her skills and her career. Instead, she devoted herself to “working in the trenches of the law,” laboriously making an intentionally unfair and dysfunctional system fairer, and preserving the rights and saving the lives of some of the most vulnerable among us.

That’s what a real lawyer does. Disgracefully, these are the folks now largely missing from our elitist, out of touch with humanity Federal Bench.

Compare her “real life” qualifications, contributions, and courage with those of a strikingly unqualified, lightweight right wing dilettante like Mizelle. That’s one reason why our nation and our judiciary are in failure right now. Lack of leadership and lack of moral courage and human values. It’s literally killing individuals across our nation, a disproportionate number of them people of color. It must stop. Social justice can no longer be demeaned and demolished by those in charge!

It’s past time to stop “undervaluing and ignoring” the outstanding ”practical scholarship” (see, “Law You Can Use”), great courage to speak truth to power, energy, dedication, “retail level litigation skills,” and creative problem solving abilities of the private sector immigration bar, many serving in pro bono, low bono, clinical, or NGO capacities, in Federal Judicial Selection.

As tell law students, “if you can win an asylum case in today’s conditions, everything else you do in law will be a piece of cake.” There are good reasons why some of the largest law firms in America have found pro bono Immigration Court work to be some of the greatest “real life legal training” out there! Also, good reasons why some of the best legal minds and legal strategists in America are working pro bono on amicus briefs for our Round Table of  Former Immigration Judges!

A new, independent, Article I Immigration Court with a “merit-based” judicial selection system should be the ideal training ground and future selection pool for a better, fairer, more efficient, more diverse, more representative, and more effective Article III Judiciary. One that would have an unswerving commitment to Constitutionally required “equal justice under law.” A judiciary that would fairly and efficiently solve problems rather than avoiding and often aggravating them! An Article III Judiciary that would actually understand and appreciate immigration and human rights laws and their fundamental connection to the goal of equal justice for all!

The talent necessary to stop the bleeding and vastly improve the American justice system is out there. What’s lacking right now is the leadership and political power to make a better future a reality, for all Americans.

We must take back our nation, before it’s too late for humanity!

The following is excerpted from “The Useful Idiot: How Donald Trump Killed the Republican Party with Racism and the Rest of Us with Coronavirus,” by S.V. Dáte.

A pandemic never occurred to them. The idea that Donald Trump would ever be required to sit still, pay attention and make rational decisions that would determine whether hundreds of thousands of Americans would live or die not once crossed the minds of those who put him into the Oval Office.

Oh, they all had their various reasons for wanting him there. For white evangelical Christians, he had explicitly promised to appoint the federal judges they had so longed for to turn back the nation’s cultural clock. For Mitch McConnell, a Trump win — as unlikely as it seemed — was the only real path to making sure Republicans retained control of the Senate and he himself remained majority leader. And for Vladimir Putin, having Trump in the White House — as unlikely as it seemed — would be a dream come true, an opportunity to wreak havoc on his longtime adversary and weaken its historic alliance with Western Europe.

Russia’s dictator, of course, was not remotely interested in what Trump’s ascension might mean for Americans in the event of an actual calamity. If they were dumb enough to vote for him, well, they deserved whatever they got. In any event, it was not his problem.

As for Trump’s American supporters, perhaps so much time had passed since Sept. 11, 2001, that the idea of a genuine national emergency was but a faded memory. Perhaps the quiet competence that President Barack Obama’s team had employed with the 2009 flu pandemic and later with the 2014 West African Ebola outbreak had diminished the perceived threat that a simple virus could present.

For whatever reason, even as they watched the noise and chaos and nonsense generated by candidate Trump for a full year and a half, the consequences of a real crisis requiring real leadership actually happening on the watch of a President Trump had never really dawned on them.

True, there existed then — and continues to exist today — a significant cadre of Republican voters who genuinely believed that the Trump they watched on “The Apprentice” was the real Donald Trump. That he was a real billionaire, based on his own efforts and smarts. That he was capable of making rational, quality decisions based on the facts presented to him.

That excuse, though, does not work for those Republicans from McConnell on down to the congressional candidates who had occasion to speak with Trump in person. As one top Republican National Committee member told me after his first face-to-face encounter with Trump two months before the 2016 election: “OK. Our guy is insane.”

His was not a minority view, by the way. Trump’s incoherence, his temper, his impulsiveness, his breathtaking ignorance — all of it was well-known among the top tiers of the Republican machinery. But for them, it was simply a challenge to overcome, another hurdle that fate had placed between them and their holy grail of judges and tax cuts and regulatory rollbacks. Not once did I ever hear any concern that just maybe they were working to install a useful idiot who truly was an idiot, with absolutely zero leadership qualities one ordinarily looks for in someone aspiring to become the chief executive of the world’s remaining superpower.

It was an abject failure of the Republican Party’s responsibility to the country. In our two-party system, both have a duty to weed out candidates who fail the threshold test of commander-in-chief and, relatedly, emergency-manager-in-chief. Through the summer and fall of 2015 and then the early nominating contests of 2016, it was clear as day that Trump was not credible in those roles, and yet neither the remaining candidates nor the party leadership made a serious effort to ensure his defeat.

True, there were some who voiced warnings. Jeb Bush called Trump a “chaos candidate” who would bring us a “chaos presidency.” But there was also Ted Cruz, who literally praised Trump for the better part of a year, refusing to criticize him in the hopes of one day inheriting his voters. By the time Cruz did unload on him, it was seen as sour grapes. Such was the cynicism and game-playing that put us where we are.

It is entirely fitting that Donald Trump — the least law-abiding president in our history — was renominated at a convention that was itself a seeming cavalcade of crime. Every night featured apparent violations of the 1939 Hatch Act, which prohibits federal employees from engaging in political activities “in any room or building occupied in the discharge of official duties by an individual employed or holding office in the Government of the United States.”

The White House certainly qualifies as such a facility. Yet Trump used it as a convention prop, even going so far as to televise a naturalization ceremony for immigrants — some of whom did not realize they would be shown at the Republican convention — as part of the nightly show. Trump not only flouted the law but also reveled in doing so. During his acceptance speech, he boasted, “We’re here — they’re not,” and the New York Times reported that Trump “relished the fact that no one could do anything to stop him.”

While the president is exempt from the civil provisions of the Hatch Act, he could be subject, once he leaves office, to criminal penalties if he should “intimidate, threaten, command, or coerce … any employee of the Federal Government … to engage in … any political activity.” That is a crime punishable by up to three years in prison.

This is, of course, barely scratching the surface of an administration that should more accurately be described as an ongoing criminal conspiracy. While many of Trump’s awful acts — e.g., confining children in cages or unleashing riot police on peaceful protesters — are merely violations of democratic norms, there is also plentiful evidence of lawbreaking on his part.

The U.S. attorney for the Southern District of New York has identified Trump as “Individual-1” in a conspiracy with his attorney Michael Cohen to violate campaign finance laws by secretly paying off two women with whom Trump allegedly had affairs. Cohen went to prison; Trump, who as president claims immunity from prosecution, wasn’t indicted.

Special counsel Robert S. Mueller III uncovered a great deal more potential illegality. He found 10 instances when Trump might have obstructed justice, and in at least four of those cases he found evidence that Trump’s conduct met all three elements of the obstruction-of-justice statute. Each violation carries a maximum penalty of 20 years in prison. The recent report from the Senate Intelligence Committee suggests that Trump also lied to Mueller when, in written testimony, he claimed not to remember speaking to Roger Stone about WikiLeaks. If he committed perjury, that would subject him to up to five years’ imprisonment.

Trump could try to short-circuit justice by seeking to pardon himself before he leaves office — or even by resigning a few hours early and having Vice President Pence sworn in to issue a pardon (as President Gerald Ford did for Richard Nixon). In that case, the special counsel would be limited to investigating Trump’s accomplices (unless they are also pardoned) and helping state prosecutors. But the special counsel should still issue a comprehensive report on Trump’s lawbreaking. We must expose and root out this ethical rot before it eats away at the foundations of our democracy.

Read the rest of Boot’s article at the link. Actually, Max understates the case. Trump long ago ate the ethical underpinnings of American democracy for lunch, with the “JR Five” providing “table service.”

Under “normal” circumstances, the scenario outlined by Boot in his final paragraph would be beyond preposterous! But, in the failed state of American democracy under Trump, it’s perfectly plausible. Whose going to stop him from the “final abuse and mockery of our republic?” Feckless Congress? The Supremely and Serenely Complicit ones? No way. Trump will exploit the moral cowardice and spinelessness of the other failed two branches of Government until the end!

It started about the time that Roberts and his colleagues threw Muslims, refugees, and migrants under the bus in their ridiculously wrong and intellectually dishonest “Travel Ban Fiasco.” The “Dred Scottification” of migrants and people of color and open corruption, aided and abetted by Roberts and his gang, have continued largely unabated since then. 

Max’s use of the term “rot” brings to mind the refugees from many nations, most people of color, rotting in Mexico, futilely waiting for “asylum hearings” that might never come and where denial without due process has been predetermined. This is what “American Justice” has become under Trump, Billy the Bigot, Wolfman the Illegal, and Roberts the Complicit!

Actually, separating families, misrepresenting the policy to Federal Courts, and long-term “civil” detention of families in life-threatening conditions as a “deterrent” to exercising important, fundamental legal and human rights might well be criminal violations in a functioning justice system. Sadly, America basically lacks the latter these days because of the Supremes’ coddling of the “crimes against humanity” committed by Trump, Miller, Barr, Wolf, Cooch, and their co-conspirators.

As those of us with experience adjudicating asylum cases know, lack of accountability before the courts and failure of the judiciary to exercise independent judgment to control a corrupt and tyrannical executive are hallmarks of failed states and banana republics. 

Let’s see! America’s founders created an independent judiciary to insure the right of the “King” to use the Government as his personal servants to violate the Bill of Rights, exploit the nation for his own gain, and create “alternate Kings’ Courts” where the “judges” are his employees, he makes the rules, the results are largely preordained by the King’s personal biases and the interests of his royal cronies, and the penalty can be “death without due process.” Not likely! 

But, that’s what happens when judges’ fealty to ideology, party, or personality often exceeds their loyalty to the Constitution and to the human rights and human dignity of their fellow men, women, and children. It happens when we create an elitist, right-leaning judiciary, out of step with and non-representative of the majority of Americans, where actual knowledge and experience defending the human rights of individuals against Government overreach, courage to speak truth to power, and demonstrated unswerving commitment to equal justice under law is far, far undervalued, even intentionally ignored. Where practical problem-solving skills and human empathy, perhaps the two most important qualities for fair and honest judging, are all too often disrespected and even demeaned.

Better Federal Judges for a better, fairer, functional America! One where the humanity of all persons is honored and respected, rather than being mocked by those in positions of power and privilege. One where the highest Court finally stands up for and enforces the hard-fought Constitutional right to vote, regardless of skin color or ethnicity, rather than aiding and abetting the blatant schemes of the GOP to suppress voting and deny deserved political power to Americans of color. One where an honest Court enforces to the maximum degree the Voting Rights Act rather than intentionally and disingenuously gutting it at the demand of some in the White power structure. 

These travesties have unfolded right in front of us. Yet, even so called “liberal-progressive” commentators largely shrug them off as somehow “normal” or “just the way the system functions.” That’s BS! It’s “judicial malpractice.” It’s a major reason why two centuries after our founding we have not yet achieved racial justice and why our nation is coming apart at the seams under grotesque misgovernance and judicial complicity.

The current Federal Judiciary has facilitated the takeover of our Government by an ongoing criminal conspiracy, as described by Boot. We need change! Sooner rather than later! And, it can’t and won’t happen with the current cast of characters in the Executive, the Senate majority, and the Article III Judiciary.

She was one of the most recognizable activists in Nicaragua, protesting a government that has jailed and killed its opponents. Her photo ran in national newspapers; one called her the “face of the rebellion.” Her video of police firing at student protesters went viral. Her confrontations with the government were cited by the U.S. State Department.

Valeska Alemán, 22, paid a price for that notoriety. She was detained twice. Interrogators pried off her toenails. When she decided to leave the country, the United States seemed a natural destination: The Trump administration has been vocal in its opposition to Nicaragua’s crackdown — and its support of the country’s young protesters.

But by the time Alemán arrived at the U.S. border in July, the administration had launched a pandemic-era policy that sends Nicaraguans directly back to their country without letting them apply for asylum. Seventeen days after crossing into Texas, she was put on a plane back to Managua with more than 100 other Nicaraguans, almost all of them opponents of President Daniel Ortega.

Her backpack was full of documents to show U.S. immigration officials that the government appeared ready to kill her. The officials wouldn’t look at them. When she landed back in Nicaragua, it felt as if she was carrying a ticking bomb, proof that she was trying to flee and accuse the government of abuse.

“I thought, ‘Okay, so they’re going to throw me straight back in jail,’ ” Alemán said. “ ‘I’m going to be tortured all over again.’ ”

Another expelled asylum seeker, Moises Alberto Ortega Valdivia, 38, swallowed five pages of his asylum paperwork, panicked that Nicaraguan police would find it.

Since taking control in 2017, the Trump administration has narrowed the pool of people who qualify for asylum and sent tens of thousands of applicants back to Mexico to await their hearings from squalid tent camps and shelters.

During the coronavirus pandemic, the administration has gone further, effectively shutting the asylum system down. Most Central American applicants are simply escorted back to Mexico. But Nicaraguans — including political protesters to whom the United States has given rhetorical support — are flown back to the country they tried to escape.

The administration is using a public health order known as 42 U.S.C. that cites “the danger to the public health” of migrants to justify the asylum system’s closure. Mexico has agreed to accept Salvadorans, Guatemalans and Hondurans. Other nations, such as Cuba and Venezuela, have refused to accept chartered U.S. deportation flights of their own citizens.

In the case of Nicaragua, the United States is sending asylum seekers back to a country the State Department describes as violently repressive.

“Throughout Nicaragua, armed and violent uniformed police or civilians in plain clothes acting as police (‘para-police’) continue to target anyone considered to be in opposition to the rule of President Ortega,” the department says in a travel warning. “The government and its affiliated armed groups have been reported to arbitrarily detain pro-democracy protestors, with credible claims of torture and disappearances.”

U.S. Customs and Border Protection did not respond to multiple requests for comment. In a statement, the State Department said it “condemns all forms of political oppression, especially that orchestrated by the corrupt Ortega regime.” But it would not comment on the expulsion of Nicaraguan asylum seekers.

Alemán traveled with a family of Nicaraguan asylum seekers to the Texas border. All were university graduates and students of international affairs. Before they left, they reviewed the asylum laws on a U.S. government website.

Section 208 of the Immigration & Nationality Act says:

Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien’s status, may apply for asylum in accordance with this section or, where applicable, section 1225(b) of this title.

Very clear. What happened to refugee Valeska Alemán and other asylum seekers at the hands of the Trump regime was totally illegal (not to mention immoral); essentially a “crime against humanity” for which Trump, Miller, Wolfman, and the other “perps” should be held accountable.

But, this is Trump’s America where a majority of the Roberts’ Court favors White Supremacy, racism, and crimes against humanity over the Constitutional, statutory, and human rights of people of color. As he seeks a second term, [Trump has] also made it clear that he hasn’t finished. He still wants to end the Obama-era Deferred Action for Childhood Arrivals (DACA) program once and for all, drive out the millions of unauthorized immigrants living in the US and curb their political power, enact what he calls “merit-based” immigration reform, and pursue a slew of restrictive immigration regulations.

The US has already seen the harms of Trump’s first-term immigration policies, which could cut deeper if he’s given another four years: Legal immigration is plummeting, stymying growth in the labor force and threatening the US’s ability to attract global talent and recover from the coronavirus-induced recession. The US has abdicated its role as a model for how a powerful country should support the world’s most vulnerable people. And the millions of immigrants already living in the US, regardless of their legal status, have been left uncertain of their fate in the country they have come to call home.

Other concerns — including the coronavirus, racial justice, and unemployment — have recently eclipsed immigration as a top motivating issue for voters. But for Trump, who currently lags former Vice President Joe Biden in the polls, restricting immigration proved a winning message in 2016, and he will likely try to replicate that strategy again.

“It’s the thing he keeps going back to,” Douglas Rivlin, director of communication at the immigrant advocacy group America’s Voice, said. “It is his comfort zone — to go after people of color and turn them into sort of the specter of scary, violent people as a political strategy.”

Whether any version of that proposal will get traction would largely depend on the makeup of the next Congress and whether Democrats win a majority in the Senate. Most immigration policy experts aren’t convinced that Trump will see success in negotiating with Democrats, but the political calculus could change if Democrats control both chambers of Congress and need Trump to sign their legislation.

It also depends on Republicans acting as a unified front on immigration. So far, pro-business Republicans aren’t challenging the restrictions and travel bans Trump has imposed during the pandemic, and as the US continues to grapple with its worst economic crisis since the Great Depression and more than a million Americans are out of work, they will likely continue to follow the president’s lead. But in the long term, they might find themselves at philosophical odds with the anti-immigrant wing of the party.

“I think the reality of the economics of immigration and the sort of more ideological agenda are going to come into conflict,” Rivlin said.

But if Trump can overcome those hurdles, the prize would be substantial: the ability the leave his mark on the immigration system beyond a series of executive actions that could be reversed by the next Democrat who assumes office.

“Merit-based immigration reform would be a legacy for him on immigration, more so than a border wall,” the Bipartisan Policy Institute’s Cardinal-Brown said. “That would have impacts on the future of immigration for decades.”

Don’t be fooled. In “Trumpspeak” the term “merit-based” means “race-based” (favoring, of course, White guys, preferably rich, English speaking, and prospective GOP toadies). Again, to state the obvious, a “kakistocracy” by definition lacks the ability to recognize and reward true “merit.” That’s why it’s a “kakistocracy,” not a “meritocracy!”

America is a nation of immigrants. To change that, Trump will have to destroy America, which, as this week’s “clown show of hate, fear, loathing, and complete nonsense” (a/k/a “The GOP Convention”) shows, he and his followers are perfectly willing to do. 

This perverted “vision” of America also ties in well with the Trump/GOP approach to racism and social justice: Ignore injustice and double down on violence administered by the largely White power structure against communities of color. Kill, maim, blame, punish, jail, intimidate, disenfranchise, and dehumanize the victims rather than looking for cooperative ways to solve the problems. Sow fear, hate, and division to insure that institutionalized racism and White grievance will be indelibly ingrained in America! As these self-inflicted grievances play out, the Trump family and its cronies will use the ensuing chaos as a diversion to loot the Treasury and use what remains of “government” to further their own personal interests, without regard to the common welfare. Nice folks!

It’s doubtful that America as the majority of us have envisioned it can survive another four years of Trump’s corruption, racism, and malicious incompetence. Despite some liberal wishful thinking, our democratic institutions and apparently overrated “checks and balances” are crumbling before our eyes. 

The “JR Five” on the Supremes and the GOP Senate already have reached “Penceian levels” (“Pence” rhymes with “incompetence”) of mindless sycophantic subservience to the “Clown Prince” and his entourage. None of them would be able to extract their collective heads from the more than ample Presidential rear to see any daylight during a second term. Trump’s re-election would inevitably convert the “City on The Hill” to a “wealthy universally despised third world kleptocracy.” That’s the real “vision” of Trump and the GOP. (I think that Nicole’s “hypothetical” of a Trump victory and a Dem Senate is the “least likely scenario.”)

Trump cabinet officials voted in 2018 White House meeting to separate migrant children, say officials

WASHINGTON — In early May 2018, after weeks of phone calls and private meetings, 11 of the president’s most senior advisers were called to the White House Situation Room where they were asked, by a show-of-hands vote, to decide the fate of thousands of migrant parents and their children, according to two officials who were there.

Trump’s senior adviser, Stephen Miller, led the meeting and, according to the two officials, he was angry at what he saw as defiance by Department of Homeland Security Secretary Kirstjen Nielsen.

It had been nearly a month since then-Attorney General Jeff Sessions had launched the Trump administration’s “zero tolerance” policy, announcing that every immigrant who crossed the U.S. border illegally would be prosecuted, including parents with small children. But so far, U.S. border agents had not begun separating parents from their children to put the plan into action, and Miller, the architect of the Trump administration’s crackdown on undocumented immigrants, was furious about the delay.

Those invited included Sessions, Nielsen, Health and Human Services Secretary Alex Azar and newly installed Secretary of State Mike Pompeo, according to documents obtained by NBC News.

Nielsen told those at the meeting that there were simply not enough resources at DHS, nor at the other agencies that would be involved, to be able to separate parents, prosecute them for crossing the border and return them to their children in a timely manner, according to the two officials who were present. Without a swift process, the children would enter into the custody of Health and Human Services, which was already operating at near capacity.

Two officials involved in the planning of zero tolerance said the Justice Department acknowledged on multiple occasions that U.S. attorneys would not be able to prosecute all parents expeditiously, so sending children to HHS was the most likely outcome.

As Nielsen had said repeatedly to other officials in the weeks leading up to the meeting, according to two former officials, the process could get messy and children could get lost in an already clogged system.

Miller saw the separation of families not as an unfortunate byproduct, but as a tool to deter more immigration. According to three former officials, he had devised plans that would have separated even more children. Miller, with the support of Sessions, advocated for separating all immigrant families, even those going through civil court proceedings, the former officials said.

While “zero tolerance” ultimately separated nearly 3,000 children from their parents, what Miller proposed would have separated an additional 25,000, including those who legally presented themselves at a port of entry seeking asylum, according to Customs and Border Protection data from May and June 2018.

That plan never came to fruition, in large part because DHS officials had argued it would grind the immigration process to a halt. But after Sessions’ announcement that all families entering illegally would be prosecuted, the onus had fallen on DHS to act.

At the meeting, Miller accused anyone opposing zero tolerance of being a lawbreaker and un-American, according to the two officials present.

“If we don’t enforce this, it is the end of our country as we know it,” said Miller, according to the two officials. It was not unusual for Miller to make claims like this, but this time he was adamant that the policy move forward, regardless of arguments about resources and logistics.

No one in the meeting made the case that separating families would be inhumane or immoral, the officials said. Any moral argument regarding immigration “fell on deaf ears” inside the White House, said one of the officials.

“Miller was tired of hearing about logistical problems,” said one of the officials. “It was just, ‘Let’s move forward and staff will figure this out.'”

Frustrated, Miller accused Nielsen of stalling and then demanded a show of hands. Who was in favor of moving forward, he asked?

A sea of hands went up. Nielsen kept hers down. It was clear she had been outvoted, according to the officials.

In the days immediately following the meeting, Nielsen had a conversation with then-CBP Commissioner Kevin McAleenan inside her office at the Ronald Reagan Building, and then signed a memo instructing DHS personnel to prosecute all migrants crossing the border illegally, including parents arriving with their children.

So, separated families and children continue to suffer, much of the harm and trauma irreparable and life-defining. This “policy” was so clearly illegal and unconstitutional that DOJ attorneys conceded its unconstitutionality in Federal Court. 

However, in an ethics-free DOJ, those same lawyers falsely claimed that there was no such policy. Rudimentary “due diligence” on their part, required by professional ethics, would have revealed that their representations on behalf of corrupt institutional “clients” were false.

The article also confirms the complicity of Kevin “Big Mac  With Lies” McAleenan in gross, intentional human rights violations. Courtside exposed “Big Mac” long ago! 

While the victims continue to suffer, Miller, Sessions, Nielsen, Big Mac, and other cowards who planned and carried out these “crimes against humanity,” directed at some of the most vulnerable humans in the world, remain at large. Some, like Miller, actually remain on the “public dole.” Likely, so do the DOJ lawyers who unprofessionally defended and helped obscure this misconduct in Federal Court.

It’s also worth examining the role of U.S. Magistrate Judges and U.S. District Judges along the southern border, most of whom turned a blind eye to the transparent racial and political motives, not to mention the grotesque misallocation of public resources, driving Sessions’s “zero tolerance” misdirection of scarce prosecutorial resources from serious felonies to minor immigration prosecutions. 

As I’ve been saying, “Better Federal Judges for a better America!” And, better Federal Judges start with removal of the Trump regime as well as the ousting of “Moscow Mitch” and the GOP from Senate control. 

Will there ever be accountability? Our national soul and future might depend on the answer!

Collectively, we were told to implement restrictive new policies, expressly designed to deter people from seeking refuge. The Migrant Protection Protocols, for example, resulted in more than 60,000 asylum seekers being sent to Mexico in 2019, after fleeing the extreme brutality of MS-13 and the 18th Street gang in Honduras, Guatemala and El Salvador. Left to live in squalor without any protection, they are preyed upon by cartels and gangs as they wait, sometimes months, for an elusive court date before an immigration judge.

The pandemic put refugees and asylum seekers in even more desperate straits, as the United States paused refugee resettlement. Many already interviewed and accepted for resettlement in the U.S. now live stateless at the margins of cities, towns and villages where they have no rights or legal status, or in overcrowded refugee camps. Around the world, in places including Jordan, Kenya and Bangladesh, refugee camps are bursting at the seams. People there are unable to practice social distancing, and soap and water are limited.

Meanwhile, at our borders, Customs and Border Protection has turned away thousands of vulnerable people since March, without due process. Some applicants showing symptoms of the coronavirus were deported with no regard for safety measures (such as testing), causing outbreaks in the countries from which they had fled. Others languish in crowded detention facilities, even though many of them pose no security threat and Immigration and Customs Enforcement has the discretion to release them. By law, children must be let out after 20 days of incarceration. But rather than release them with their parents, our government has presented these families with an agonizing choice: Either have their children released, indefinitely separated from their parents — or remain locked up together in these facilities, many of which have already witnessed coronavirus outbreaks.

Amid all this, in June, the administration proposed 161 pages of sweeping regulations that would gut asylum and refugee law. Certain provisions, for example, drastically narrow the definitions of persecution and torture; others raise certain burdens of proof to nearly unreachable standards and redefine what constitutes the protected grounds of political opinion and membership in a particular social group. Still others could disqualify applicants if they made a mistake on their tax filings, or took two or more layover flights on their way here. In July, the administration proposed yet another new policy, allowing the United States to deny asylum to applicants if they come from any country with an outbreak of a highly contagious disease. (Public health experts have said this would serve no legitimate public health purpose.) It’s difficult to see how anyone could qualify for protection under this tangle of new rules, once they’re implemented.

Years of tightening restrictions have made it harder to obtain a wide range of legal immigration benefits, causing applications to plummet and, with them, the user fees that fund U.S. Citizenship and Immigration Services operations. Now, the pandemic has placed our agency on the brink of bankruptcy, and 70 percent of our workforce faces an indefinite furlough unless Congress intervenes. Without emergency funding, only a skeleton crew will remain to administer America’s immigration services system — resulting in even greater backlogs in the processing of applications for benefits including asylum, green cards, work permits and citizenship.

Our nation has an ethical and legal responsibility to protect those who seek refuge here. Instead, we have expended vast resources on preventing people from entering the country and deporting people who are already here. If the current administration’s policies continue unchecked, there will no longer be a pathway for refugees to have a new beginning in the United States. Even if a different presidential administration tried to change course, I fear that it would take many years to reverse the damage and rebuild our capacity to protect refugees. Many people will lose their lives before then.

In the closing words of his farewell address, President Ronald Reagan described our country as a “shining city upon a hill”: “If there had to be city walls,” he said in 1989, “the walls had doors, and the doors were open to anyone with the will and the heart to get here.” That is still something most Americans believe in.

We have an opportunity, perhaps our last as a nation, to return to a nobler vision of America. There is no excuse whatsoever for the cowardly, disingenuous, and immoral failure of the Roberts Court to stand against Trump. Why is this judicially-enabled retrogression to the “Hay-day of Jim Crow” acceptable in 21st Century America?

More than twice as many immigrants have died in the custody of Immigration and Customs and Enforcement this fiscal year than last after two detainees died this week. That brought this year’s total to 17, compared with eight deaths last year.

A 72-year-old Canadian man who had tested positive for the coronavirus died in ICE custody on Wednesday night at a Virginia hospital, the agency said Friday in a statement.

James Thomas Hill reported feeling shortness of breath to staff at an ICE detention facility in Farmville, Virginia, on July 10 and was admitted to Centra Southside Community Hospital before being transferred to Lynchburg General Hospital the following day, ICE said.

A COVID-19 test administered by hospital staff came back positive on July 11, the agency said.

Hill entered ICE custody on April 11 following his release from the Rivers Federal Correctional Institute in North Carolina after serving 13 years of a 26-year prison sentence for health care fraud and distributing a controlled substance, according to ICE. An immigration judge had ordered his removal on May 12, ICE said. At the time of his death, Hill was in ICE custody pending his removal to Canada, the agency said.

The agency said it had notified the Department of Homeland Security’s Office of Inspector General, the ICE Office of Professional Responsibility, the Canadian consulate and Hill’s next of kin. His death was first reported by BuzzFeed News.

A 51-year-old Taiwanese man died Wednesday afternoon at a Florida hospital after being a diagnosed with a “massive intercranial hemorrhage,” ICE said in a separate statement Thursday.

Kuan Hui Lee was found unresponsive at the Krome Service Processing Center in Florida on July 31 and taken to the Kendall Regional Medical Center.
