WASH­ING­TON—The Trump ad­min­is­tra­tion moved to al­low the gov­ernment to in­def­i­nitely de­tain fam­i­lies cross­ing the U.S.-Mex­ico bor­der and su­persede a decades-old court set­tle­ment that both lim­its how long mi­grant chil­dren can be held in cus­tody and sets stan­dards for their care.

The new rules are the Re­pub­li­can ad­min­is­tration’s lat­est ef­fort to tighten im­mi­gra­tion laws on its own, with Con­gress long un­able to agree on any le­gal over­haul. Wednesday’s pol­icy change could per­mit au­thor­i­ties to de­tain fam­i­lies through the du­ration of their im­mi­gra­tion pro­ceed­ings, rather than re­lease them or sep­a­rate chil­dren from their detained par­ents.

Im­mi­gra­tion-rights ad­vo­cates are ex­pected to chal­lenge the rules in fed­eral court, where they have blocked the ad­min­istra­tion be­fore. A le­gal chal­lenge would likely keep the pol­icy from tak­ing im­me­di­ate ef­fect.

Ad­min­is­tra­tion of­fi­cials say the new rules are in­tended to dis­cour­age fam­ily mem­bers from at­tempt­ing to cross the bor­der to­gether in the be­lief that they will gain an ad­van­tage in lodg­ing their asy­lum claims be­cause of the cur­rent de­ten­tion lim­its for chil­dren. “No child should be used as a pawn to scheme our im­mi­gra­tion sys­tem,” said act­ing De­partment of Home­land Se­cu­rity Sec­re­tary Kevin McAleenan on Wednes­day.

As Michelle points out, McAleenan and his corrupt DHS flunkies are simply “making it up” as they go along to justify unconstitutional, racist policies intended to target legitimate asylum seekers based on the color of their skin. By continuously doing “in your face” moves, often with little expectation of success in the in the courts, but a great expectation of rallying racial animosity for political gain, Big Mac & Co. are misusing their access to Federal Courts, constantly violating their oaths of office, and making a mincemeat out of Federal and State professional ethics rules.

Contrary to Big Mac’s false blather, the “solution” to the exodus of refugees is straightforward and not prohibitively expensive:

  • Release them to community placements;
  • Help them find pro bono lawyers;
  • Ask judges to schedule court cases at the earliest possible date consistent with the legitimate needs of those pro bono lawyers;
  • See what happens on the merits of their asylum cases in a fairer, non coercive system where applicants are encouraged to fully develop claims assisted by lawyers who understand the complexities of asylum law. (This is actually the way the U.N. Convention-based system is supposed to work, but too often doesn’t).

As I have pointed out before, even with unabashed bias and the open encouragement by the Trump  Administration of blatant anti-asylum adjudications, a significant number of represented Central American applicants continue to win their claims both before the Asylum Office and in Immigration Court.

Without the effects of intentionally coercive detention, and gimmicks intended to limit access to counsel and inhibit preparation, many of those who lose in Immigration Court will have a fair opportunity to exercise their legal rights to pursue their claims before Article III Appellate Courts. While far, far too deferential to flawed agency decision makers, the Article IIIs are much closer to operating as fair, impartial, and unbiased decision-makers than are Immigration Judges working for Barr and his White Nationalist regime. 

Over time, I think many more asylum seekers will win their claims. But, whether that happens or not, the process will have more legitimacy. U.S. asylum law will come to represent more than the Administration’s anti-asylum ideology. Those who lose their cases after exhausting their legal avenues for appeal can be removed in a dignified and humane manner after receiving full Due Process. 

This incident also graphically illustrates the “reward” received by those Democrats who recently worked in good faith with the Administration to pass “emergency border funding.” Rather than returning that good faith by using funds to improve conditions in detention and to explore the many available options to reduce the instances of detention, the Administration is squandering money in an almost certain to be DOA attempt to expand their White Nationalist Gulag to unnecessarily punish more (Hispanic) families for asserting their legal rights to apply for protection under U.S. laws.

I have seen little or no evidence that this “emergency funding” — falsely advertised as “necessary” to put food in kids mouths and provide them medical care — has been used for those purposes. By all reliable accounts, conditions in DHS detention remain intentionally deplorable. Instead of working in good faith with public interest groups and Democrats to solve the problems with border detention, Big Mac & Co. are off wasting time and abusing their publicly funded salaries by spreading lies and insulting the intelligence of Federal Judges. 

Indeed, Big Mac regularly ignores the overwhelming body of medical evidence that any amount of detention has potential lifetime adverse effects upon young people. The idea that the “Flores settlement,” which has been in effect for years prior to the Trump regime, is primarily responsible for fueling a surge of children fleeing the Northern Triangle is beyond absurd. Moreover, as Big Mac is undoubtedly aware, the increase in child refugees is part of a worldwide trend that transcends any particular U.S. court settlement. Actually, it’s the dumb policies of the Trump Administration and their insistence on using gimmicks rather than the legal mechanisms available that has fueled the profits of smugglers.

Enough! This Administration simply cannot be trusted on anything involving immigration and humanitarianism. Democrats need to demand fundamental, demonstrable changes at DHS, including a phase out of most civil detention, and a commitment to fair access to the legal system, as a condition for providing any further funding.

A CONCEPTUAL PROPOSAL FOR AN AUXILIARY IMMIGRATION JUDICIARY

Drawing on our judicial expertise gained over decades of working in both Federal and State judicial system, we respectfully set forth a concept for those working in the legislative, political, legal, and judicial systems to use and further develop to promote better, fairer, and more efficient judicial decision-making and to make better use of existing and future judicial resources both in and outside the U.S. Immigration Court system.

To save time, and since neither of us purports to be a legislative draftsperson, instead of submitting a “draft bill,” or the “outline” of such a bill, we advance an idea and the conceptual and practical justifications for it for your consideration and future use in drafting actual legislation.

 

No knowledgeable individual thinks the current dysfunctional U.S. Immigration Court system can continue without imploding. Just feeding more new, permanent Immigration Judges into an unfair and broken system actually is making things worse as well as outrageously wasting our taxpayer money at a time when deficits are skyrocketing.

 

All too many newly hired Immigration Judges appear to be neither the best qualified to be judges nor, even if qualified on paper, properly trained in how to deliver “full due process with efficiency” under the immigration laws and in strict compliance with the Due Process Clause of our Constitution.

 

On the other hand, many retired judges from other Federal and State systems have proven expertise and track records that would allow a competent judicial administrator (there are, to our knowledge, NONE of these currently in DOJ or EOIR) to determine if they are suitable for emergency service and how they could best be trained to effectively and efficiently use their skills as “Auxiliary Immigration Judges” to augment the current and future Immigration Judiciary. 

 

Moreover, since most retired Federal and State judges already have adequate pensions or other means of support, asking them to volunteer to serve on the basis of limited compensation, or even just reimbursement for out of pocket expenses, would not be unreasonable.

 

We are offering this idea as a way in which those of us with lifetime legal and judicial expertise can use it to improve the delivery of justice in America; it is not intended as a means of enriching or offering alternative full-time employment to current retired judges, from any system.

 

To name just a few areas of “low hanging fruit,” we believe that:

 

      Most bonds;

      Initial “Master Calendars” (arraignments);

      Master Calendar scheduling for Individual Hearings;

      Motions Calendars;

      “Status” Calendars;

      Stipulated Final Order and Withdrawal Calendars;

      Individual Hearings on Cancellation of Removal for long-time lawful and unlawful residents;

      Uncontested Adjustments of Status and other types of equitable waivers; and

      Voluntary Departure as the sole application cases

 

have elements in common with most other types of judicial work.

 

Using Auxiliary Judges for such cases would allow those judges, from any Federal or State system, with sound work records, that is, those with impeccable reputations for fairness, professionalism, judicial efficiency, and impartiality, to handle these types of immigration adjudications with a modest amount of additional training and in close consultation and cooperation with the sitting Immigration Judges in a particular location.

 

In this respect, our emphasis would always be on aiding existing, sitting U.S. Immigration Judges, in cooperation with them and at their request, in the ways those sitting judges deem most helpful, fair, and effective.

 

It would never be on fulfilling inappropriate and unethical “production quotas,” numerical goals, or pandering to interests who want to use the judicial system to fulfill political or law enforcement objectives inconsistent with Due Process, fundamental fairness, or sound judicial administration.

 

We do not propose that “Auxiliary Judges” ever work directly for or under the supervision of non-judicial political officials as is now, disturbingly, the case in our Immigration Court System. Indeed, the current unwarranted attack on the independence and professionalism of Immigration Judges by unqualified political officials seeking to “decertify” the Immigration Judges’ professional association, the National Association of Immigration Judges, is a prime example of the type of counterproductive activity in which “Auxiliary Judges” should never be allowed to participate, in any way.

 

By contrast with the types of more straightforward judicial work described above as potential “low hanging fruit,” Asylum Cases, Withholding of Removal Cases, and applications for protection under the Convention Against Torture involve complex legal and factual issues. These are matters that should NOT be delegated to retired judges from other fields.

 

Indeed, one huge advantage of our proposal is that it would allow existing and future Immigration Judges to spend adequate time (a contested fair hearing on any of these aforementioned protection matters would take a well-trained judge 3-4 hours, minimum) on these types of cases and to receive more and better training on how to fairly and timely adjudicate, consistent with Constitutional Due Process, claims for protection under these laws and International Conventions.

 

Of course, there would be some administrative costs involved with training and maintaining a list of those willing to serve as “Auxiliary Immigration Judges.” But, they pale in relation to the costs of continuing to throw new permanent positions into a badly broken and dysfunctional system.

 

Indeed, some, such as the ABA Commission on Immigration, have observed that additional Immigration Judge hiring under current conditions has demonstrably been a waste of taxpayer money that has actually made the system worse and further impaired the delivery of Due Process to those vulnerable individuals whose lives depend on fair, professional, and efficient administration of Due Process and fundamental fairness in our Immigration Courts.

 

Sadly, we surmise that significant amounts of the “assembly line (in)justice” currently being encouraged and delivered to represented individuals in today’s Immigration Courts will eventually have to be re-adjudicated by orders of the Article III reviewing courts because of legal and/or factual errors. The only reason we don’t include unrepresented individuals in our equation is that these, unfortunately, are often “railroaded” out of our country without realistic access to the Article III Courts.

 

As lawyers with a combined 90 years of experience working in State and Federal justice systems, as prosecutors, judges, private litigators, educators, and government officials, at both the national and local level, we cannot in good conscience watch the continued deterioration of justice in the Immigration Courts while constructive ideas for improvements and efficiency and fairness are ignored or left unaddressed.

 

The concept of using retired State and Federal Judges outside the Immigration System to do certain types of cases to augment justice and relieve the incredible stress on full time Immigration Judges, in times of emergency or workload surges, without all the problems inherent in the current hiring of permanent judges by the DOJ, easily could be incorporated into one of the “Independent Article I Immigration Court” bills being advocated and advanced by groups such as the ABA, FBA, AILA, and the National Association of Immigration Judges (“NAIJ”).

 

The current system is dying before our eyes. We need to “pull out all the stops,” consider “every potential concept,” and utilize “positive professional creativity” (the antithesis of the negative energy devoted to cruel and counterproductive “gimmicks” and outright illegal actions) designed to enhance, rather than denigrate, Due Process, fundamental fairness, and judicial efficiency without sacrificing quality.

 

It is in that spirit that we respectfully request those involved in legislative reform of our Immigration Court system to consider incorporating our concept of an “Auxiliary Immigration Judiciary” into overall legislative proposals for positive reform of the Immigration Courts now being advanced by all of the leading voices in the field.

Note how succinct, straightforward, logical, and well-supported by authority Judge Gagnon’s decision is. Compare that with the nearly incomprehensible 30+ page anti-asylum, lie-filled, intellectually dishonest, and legally incorrect screed written by Sessions in support of his cowardly extralegal attack on some of the most vulnerable and deserving of protection among us in his Matter of A-B- atrocity.

Now think of how the system could work if Judge Gagnon’s correct decision were the precedent and all asylum applicants had access to qualified pro bono counsel.

Many cases could be promptly granted by an honest USCIS Asylum Office committed to properly applying protection law.  They would not even have to reach the backlogged Immigration Courts or be subjected to toxic, counterproductive “gimmicks” like “Let ‘Em Die in Mexico” or absurdities like claiming that everyone should apply in Guatemala, from which this respondent was fleeing for her life and which has neither a functional government nor a credible asylum system.

That, plus perhaps using retired judges from all types of courts and bringing back retired Asylum Officers and adjudicators trained to recognize and quickly grant “slam dunk” asylum cases like this would be the key to establishing a credible, independent, Immigration Court and a reestablishing a functioning asylum system of which we all could be proud.

Instead, our current maliciously incompetent White Nationalist regime continues to ignore our laws, our Constitution, and our international obligations in leading a cowardly and disreputable “race to the bottom” in which the richest and most powerful country in the world conducts itself as a “Banana Republic” led by a tinhorn dictator.

The Supreme Court set forth a generous view of asylum law — even a 10% chance of persecution is enough to qualify — in the 1987 case Cardoza-Fonseca v. INS, discussed in this article. Following the Supreme Court’s directive, the BIA in Matter of Mogharrabi adopted a generous “reasonable person” standard for asylum eligibility, assuring everyone that asylum could be granted “even where persecution is significantly less” than probable.

However, judges like Judge Agnelis Reese have a different idea: treat asylum as a “loophole” and abuse your power over individuals’ lives by looking for bogus ways to deny protection rather than grant it. As pointed out by this article, one of the “best” of these “legal gimmicks” is simply arbitrarily to decide not to believe anyone’s claim or to “nit-pick” memories in a way that would establish Judge Reese and others like her as “inherently not credible” if applied to them. Much like the Trump Administration as a whole.

However, this is about more than just one ill-qualified asylum judge. For 22 years, Judge Reese was allowed to abuse asylum seekers with her one-sided decision making. That spanned two entire Administrations, one of each party, and two partial ones. Yet the BIA, EOIR, the DOJ, and life-tenured Article III Court of Appeals Judges failed to intervene to force Judge Reese, and other like her, to either apply asylum law in the fair, reasonable, and generous manner it was intended or to find other jobs.

There are “other Judge Reeses” out there today screwing the most vulnerable among us with dishonest interpretations of asylum law and facts, particularly in the area of credibility and “nexus” to a “protected ground.” Now, however, instead of being “outliers,” they are the kinds of “shining example” judges who implement the Administration’s White Nationalist false narrative that all asylum seekers from all countries are “gaming the system” and ought to be rejected en masse, without fair and impartial adjudications, in some cases amounting to literately “death sentences” without anything approaching due process.

All this is going on right under the noses of life-tenured Article III Judges who are supposed to be enforcing Due Process and fundamental fairness by insuring that the Immigration Court system provides fair and impartial adjudications (it doesn’t), that the generous criteria set forth in INS v. Cardoza-Fonseca and Matter of Mogharrabi are not just given “lip service” but are actually applied in every case (they aren’t), that credibility determinations are based on the record as a whole and all relevant factors (they aren’t), and that “mixed motive” for acts of persecution is properly considered and applied (it isn’t).

Of course, Congress and to some extent the voters are to blame for the current disgraceful parody of justice in our Immigration Courts. But, careers like that of Judge Reese are proof that the Article III Courts are also failing to live up to their statutory, constitutional, and human obligations and thus have become part of the problem, rather than part of the solution.

I can only hope that some future legal historian will analyze in detail, naming names, the failure of the Article III Courts, up to and including the Supremes, to perform their functions with integrity and thereby to have prevented the legal, constitutional, and human tragedy and mockery of justice taking place every day in our broken Immigration Courts.

Unqualified, yet empowered, judges like Reese are a symptom, rather than the cause of, that broken system.

Just yesterday, four distinguished legal organizations sent a joint letter to Congress calling for the establishment of an independent U.S. Immigration Court in view of the demonstrated catastrophic failure of the current system to provide Due Process to asylum seekers and other migrants:

ABA signs joint letter to Congress on establishing an independent immigration court system

WASHINGTON, D.C., JULY 9, 2019 —The American Bar Association has joined with three other legal organizations to call on Congress to establish a separate immigration court system that is independent of the U.S. Department of Justice.

ABA President Bob Carlson, along with the presidents of the American Immigration Lawyers Association, the Federal Bar Association and the National Association of Immigration Judges, will send a joint letter to Congress on July 11 stating that immigration courts “cannot meet the standards which justice demands” because they are not truly independent. This issue is particularly crucial as immigration courts struggle with crisis-level backlogs of almost 900,000 cases.

Under the current arrangement, immigration courts are part of the U.S. Department of Justice, and the judges in those courts are answerable to the U.S. Attorney General, who is also the nation’s chief prosecutor.

In their joint letter to Congress, the four organizations note that this inherent conflict of interest means that immigration judges are “particularly vulnerable to political pressure and interference.” In addition to the structural issues, the letter said that problems have “resulted in a severe lack of public confidence in the system’s capacity to deliver just and fair decisions in a timely manner.”

The lack of independence in the immigration court system was also addressed in the ABA’s recent updated report, “Reforming the Immigration System.” In the report, the organization urged removing the immigration courts from DOJ to ensure they are given the independence they need to be fair, impartial arbiters.

A telephone media briefing on the letter will be held Thursday, July 11, at 1pm ET/10am PT immediately following submission of the letter to Congress.

Trump administration ending in-person interpreters at immigrants’ first hearings

WASHINGTON — The Trump administration is preparing to replace in-court interpreters at initial immigration court hearings with videos informing asylum seekers and other immigrants facing deportation of their rights, The Chronicle has learned.

The administration portrays the change as a cost-saving measure for an immigration court system bogged down under a growing backlog. But advocates for immigrants are concerned the new procedure could jeopardize their due-process rights, add confusion and potentially make the system less efficient by causing more of them to go underground or appeal cases.

The Justice Department informed the nation’s immigration judges of the change last month at a training session, multiple sources familiar with the situation told The Chronicle.

At issue are “master calendar” hearings where immigration judges meet with undocumented immigrants, usually dozens of them, in rapid succession to schedule their cases and to inform them of their rights. The quick sessions are intended mainly to be sure the immigrants understand what is happening and know when their next hearing will be and what steps they need to take in the interim.

Under the new plan, which the Justice Department told judges could be rolled out by mid-July, a video recorded in multiple languages would play informing immigrants of their rights and the course of the proceedings. But after that, if immigrants have questions, want to say something to the judge or if the judge wants to confirm they understand, no interpreter would be provided.

Many of the immigrants come from Central America, but collectively they speak a diverse range of indigenous languages and sometimes don’t know Spanish. Immigrants from all over the world also come before the court system, which is run by the Justice Department.

The shift would especially affect immigrants who do not have attorneys to explain proceedings. Many immigrants lack representation at the initial hearing, and legal services around the country say they are being stretched thin. The government does not provide attorneys.

Instead of turning to an in-court interpreter, judges would have to rely on any who happen to be in the building for other purposes, or call a telephone service for on-demand translation that judges say can be woefully inadequate or substantially delayed.

“It’s a disaster in the making,” one judge said, speaking on condition of anonymity because the person did not have Justice Department approval to talk publicly. “What if you have an individual that speaks an indigenous language and has no education and is completely illiterate? You think showing them a video is going to completely inform them of their rights? How are they supposed to ask questions of the judge?”

The Justice Department billed the move as a cost-saving measure. Sources familiar with the interpreter situation say there have been ongoing issues with the budget and the contract with the primary interpreter provider, leading the administration to encourage more use of the telephone service and look for other ways to keep costs down.

A Justice Department who was not authorized to speak on the record said the shift away from in-person interpretation was “part of an effort to be good stewards of (the department’s) limited resources.” The official said the direction to judges was not a policy change, but declined to elaborate.

The immigration judges union, the National Association of Immigration Judges, said the change was another in a line of steps the administration has taken to force judges to do more with fewer resources at the risk of fairness.

Asked to comment, union President Ashley Tabaddor, a judge in Los Angeles, said the Justice Department had not given enough notice for the union to raise objections or provide input on the change.

She dismissed budget concerns as a justification.

“Interpreter cost is not a surprise cost — it’s an integral part of every case,” Tabaddor said. “If they actually look at the courts as a real court, they would never be dismissive of the role of an interpreter. But the fact that we are here and have these budget shortfalls means they have prioritized the budget in a way that is dismissive of the integral role of the interpreters, and reflects the flaw of having the courts run by a law enforcement agency.”

The immigration courts have been overwhelmed for years with a burgeoning load that is now approaching 1 million cases. The judges association has advocated for the courts to be removed from the Justice Department and made an independent system.

The Trump administration has made a series of efforts it says are intended to speed up the process and avoid having hundreds of thousands of immigrants build lives in the U.S. while waiting to learn if they will be deported. Critics, including immigration lawyers and advocates and some judges, say many of the changes have actually undermined the system, confusing immigrants and creating grounds for lengthy appeals.

Some judges said it’s common at master calendar hearings for immigrants to misunderstand the advice to find a lawyer. Some conclude that means they should not return for their next hearing if they don’t have a lawyer. Failing to appear is grounds for a deportation order.

The system is “not an assembly line,” said Jeffrey Chase, a former immigration judge and former senior legal adviser to the immigration appeals court who now volunteers for organizations that provide legal assistance to immigrants. He said the master calendar is most immigrants’ first impression ever of a court system, and that a lack of interpreters and interaction with a judge could foster a sense of distrust.

“You’re dealing with people’s lives,” Chase said. “All kinds of crazy issues arise. Sometimes there’s a health issue, and you need to be able to communicate to find this stuff out.

“And also, people come in so afraid,” Chase said. “If they’re able to talk with the judge and realize, ‘This person is a human being and they’re able to work with me’ — being played a tape reinforces this feeling that, ‘I’m dealing with this deportation machine.’ ”

Chase said concerns about the cost and length of the process are legitimate, but he questioned the administration’s way of addressing them.

“You always hear the word ‘efficiency’ from this administration now, and it’s very infrequent that you hear ‘due process’ or ‘justice,’ ” Chase said. “There’s no longer concern about the balance. It’s totally efficiency-heavy these days, and I think it’s being decided by people who haven’t been in the court much and don’t understand the consequences.”

My suggestion: In the future, any legal claims involving Members of Congress or Article III Judges and any members of their immediate families should be tried only in U.S. Immigration Court. The opposing party should be given the ability to:

  • Select the judge;
  • Write or rewrite the rules governing the litigation; 
  • Change any result with which they might disagree; and perhaps most important
  • The proceedings shall be conducted in a language that only the opposing party and the “judge” understand.

That way, these folks would be receiving the same type of “justice” under the Constitution that they are happy to inflict on individuals in today’s Immigration Courts. Seems fair to me.

A Seattle federal judge ruled Tuesday that asylum-seeking migrants detained for being in the U.S. illegally have the right to a bond hearing in immigration court rather than being held until their cases are complete.

U.S. District Judge Marsha Pechman said it is unconstitutional to indefinitely detain migrants who fled to the U.S. seeking asylum protections.

The decision reverses an April directivefrom Attorney General William Barr ordering immigration judges not to release migrants on bail after an applicant successfully establishes “a credible fear of persecution or torture” in the home country — a policy that has been in place since 2005.

“The court finds that plaintiffs have established a constitutionally-protected interest in their liberty, a right to due process, which includes a hearing before a neutral decision maker to assess the necessity of their detention and a likelihood of success on the merits of that issue,” Pechman wrote.

In her ruling, Pechman also took issue with an aspect of Barr’s policy that left open the possibility that migrants, still awaiting a hearing, could be re-detained by ICE after being released on bond.

“The Government’s unwillingness to unconditionally assert that Plaintiffs will not be re-detained means that the specter of re-detention looms and these Plaintiffs and many members of their class face the real and imminent threat of bondless and indefinite detention …,” she said.

The ruling comes amid a widespread shortage of immigration judges that has caused massive delays in processing hearings. The most recent dataavailable from The Transactional Records Access Clearinghouse shows a total of 424 judges nationwide face a backlog of 892,517 cases on the courts’ active dockets as of the end of April.

“The three largest immigration courts were so under-resourced that hearing dates were being scheduled as far out as August 2023 in New York City, October 2022 in Los Angeles, and April 2022 in San Francisco,” TRAC reports

Pechman also modified a preliminary injunction issued earlier this year. The new injunction requires the government to ensure bond hearings are held within seven days after they are requested by eligible asylum-seekers. If the government exceeds that limit, the undocumented immigrant must be released.

Immigrant rights advocates, including the American Civil Liberties Union and the Northwest Immigrant Rights Project, sued to block the policy, which was set to take effect this month.

In a statement, Matt Adams, legal director of Northwest Immigrant Rights Project, said: “The court reaffirmed what has been settled for decades: that asylum seekers who enter this country have a right to be free from arbitrary detention.”

Michael Tan, senior staff attorney for the ACLU’s Immigrants’ Rights Project, added: “Try as it may, the administration cannot circumvent the Constitution in its effort to deter and punish asylum-seekers applying for protection.”

The Department of Justice is expected to appeal the ruling quickly.

Washington (CNN)Acting Customs and Border Protection Commissioner John Sanders is resigning, he said in a message sent to agency employees Tuesday, amid the dramatic increase in the number of undocumented migrants crossing the border, a fight over how to address it and controversy over how children are being treated.

“Although I will leave it to you to determine whether I was successful, I can unequivocally say that helping support the amazing men and women of CBP has been the most fulfilling and satisfying opportunity of my career,” Sanders writes. His resignation is effective July 5.

Acting Immigration and Customs Enforcement Director Mark Morgan is expected to take over as Customs and Border Protection in an acting capacity, according to a Department of Homeland Security official. Sanders’s resignation as acting head of CBP comes amid a crush of migrants at the border that has overwhelmed facilities. Earlier Tuesday, CBP held a call with reporters on squalid conditions at a Border Patrol facility in Clint, Texas.

Officials conceded that children should not be held in CBP custody, noting that the agency’s facilities were designed decades ago to largely accommodate single adults for a short period of time.

The Washington Post first reported Morgan’s move.

Over the weekend, President Donald Trump called off planned raids by US Immigration and Customs Enforcement, saying deportations would proceed unless Congress finds a solution on the US-Mexico border within two weeks. Before it was postponed, Mark Morgan had publicly confirmed an operation targeting migrant families and others with court-ordered removals was in the works.

Morgan, a vocal proponent of the President’s efforts, was another of Trump’s picks to lead ICE after abruptly pulling the nomination of Ron Vitiello.

Morgan briefly served as Border Patrol chief during the Obama administration before leaving the post in January 2017. He previously spent two decades at the FBI. He is expected to return to Customs and Border Protection, which encompasses Border Patrol.

Sanders assumed the post after Kevin McAleenan, the former commissioner, moved up to fill the role of acting homeland security secretary in the wake of Kirstjen Nielsen’s ouster this spring. In his role, Sanders has overseen the agency responsible for policing the US borders and facilitating legal trade and travel. It is also the frontline agency dealing with the surge of migrants at the southern border.

Robert Perez, the highest-ranking career official, is the current deputy commissioner. It is unclear if he will step into the acting commissioner position.

Before becoming acting commissioner, Sanders, served as the Chief Operating Officer at CBP, where he worked with McAleenan to address the operational needs of the agency and work on strategic direction.

As of June 1 this fiscal year, Border Patrol has arrested more than 377,000 family units, over 60,000 unaccompanied children, and over 226,000 single adults.

Sanders did not provide a reason for his departure.

I’ve spent a significant amount of time over the last several days reflecting on my time at CBP. When I began this journey, Commissioner McAleenan charged me with aligning the mission support organizations and accelerating his priorities. Easy enough, I thought. What I didn’t appreciate at the time was how the journey would transform me professionally and personally. This transformation was due in large part to the fact that people embraced and welcomed me in a way that was new to me — in a way that was truly special. To this day, I get choked up when speaking about it and I can’t adequately express my thanks. As a result, let me simply say I will never stop defending the people and the mission for which 427 people gave their lives in the line of duty in defending. Hold your heads high with the honor and distinction that you so richly deserve.

Throughout our journey together, your determination and can-do attitude made the real difference. It allowed CBP to accomplish what others thought wasn’t possible…what others weren’t able to do. And even though there is uncertainty during change, there is also opportunity. I therefore encourage everyone to reflect on all that you have accomplished as a team. Acting Secretary of Homeland Security Kevin McAleenan testified Tuesday that 90 percent of asylum-seekers tracked under a recently instituted program skipped the hearings in which their cases were to be adjudicated.

Testifying before the Senate Judiciary Committee, McAleenan explained that his department is hampered in its efforts to deter illegal immigration by U.S. laws that allow asylum-seekers to remain on U.S. soil under their own recognizance for months or even years while awaiting a hearing that the vast majority of them simply skip.

“Out of those 7,000 cases, 90 received final orders of removal in absentia, 90 percent,” McAleenan told Senator Lindsey Graham (R., S.C.), referring to the results of a recent DHS pilot program that tracks family units applying for asylum.

“90 percent did not show up?” Graham asked.

“Correct. That is a recent sample from families crossing the border,” McAleenan replied.

The latest case-by-case records from the Immigration Courts indicate that as of the end of May 2019 one or more removal hearings had already been held for nearly 47,000 newly arriving families seeking refuge in this country. Of these, almost six out of every seven families released from custody had shown up for their initial court hearing. For those who are represented, more than 99 percent had appeared at every hearing. Thus, court records directly contradict the widely quoted claim that “90 Percent of Recent Asylum Seekers Skipped Their Hearings.”

These findings were based upon a detailed analysis of court hearing records conducted by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University. With rare exception virtually every family attended their court hearings when they had representation. Appearance rates at the initial hearing were 99.9 percent. One reason for these higher rates for represented families is that it is an attorney’s responsibility to keep on top of when and where their client’s hearing is scheduled, and communicate these details to them. Thus, even if the court’s notification system fails, the family still finds out where and when to appear for their hearing.

Under our current system, there is no legal requirement that immigrants actually receive notice, let alone timely notice, of their hearing. Given many problems in court records on attendance that TRAC found, and in the system for notifying families of the place and time of their hearings, these appearance rates were remarkably high. TRAC’s examination of court records also showed that there were nearly ten thousand “phantom” family cases on the court’s books. These were cases entered into the Immigration Court’s database system but with little information apart from a case sequence number. The date of the notice’s filing, charges alleged, and particulars on the family were all blank.

Most courts showed patterns very similar to national appearance rates — with represented families’ appearance rates close to 100 percent, and unrepresented families somewhat lower. Full details by nationality and court are available at:

Obviously, if McAleenan and the Administration were serious about court appearances, rather than spreading lies and creating chaos, they would work with the pro bono bar and NGOs to establish a universal representation program for asylum seekers. That would achieve nearly 100% compliance with hearing notices while promoting the rule of law and Constitutional Due Process. Not to mention that they should be investing in “quality control” in the issuance of the hearing notices, which all too often are erroneously addressed or improperly served. 

Lawyers and improved notice as well as more professional adjudications that actually comply with the generous legal standards for asylum established by Congress and the Supreme Court would be much smarter and better investments than detention, more enforcement officers, bogus in absentia hearings (most based on defective notices), attempting to force asylum seekers to apply or wait in dangerous third countries without functioning asylum systems, and smearing lawful asylum applicants in support of totally unwarranted changes in the law.

Additionally, with lawyers and fair, impartial, and properly trained independent judges, many more of these asylum cases could be granted in short order, thus helping eliminate largely self-created Immigration Court backlogs and unnecessary appeals that burden the system as a result of the Administration’s constant malfeasance (a/k/a “malicious incompetence” resulting in “Aimless Docket Reshuffling”).

In the meantime, McAleenan’s lies, distortions, and misrepresentations under oath should certainly be grounds for a Congressional investigation into why he retains his current position and why DHS is using taxpayer money to falsify data to support a bogus attack on lawful asylum seekers.

President Trump said in a tweet Monday night that U.S. immigration agents are planning to make mass arrests starting “next week,” an apparent reference to a plan in preparation for months that aims to round up thousands of migrant parents and children in a blitz operation across major U.S. cities.

“Next week ICE will begin the process of removing the millions of illegal aliens who have illicitly found their way into the United States,” Trump wrote, referring to U.S. Immigration and Customs Enforcement. “They will be removed as fast as they come in.”

Large-scale ICE enforcement operations are typically kept secret to avoid tipping off targets. In 2018, Trump and other senior officials threatened the mayor of Oakland, Calif., with criminal prosecution for alerting city residents that immigration raids were in the works.

Trump and his senior immigration adviser, Stephen Miller, have been prodding Homeland Security officials to arrest and remove thousands of family members whose deportation orders were expedited by the Justice Department this year as part of a plan known as the “rocket docket.”

In April, acting ICE director Ronald Vitiello and Homeland Security Secretary Kirstjen Nielsen were ousted after they hesitated to go forward with the plan, expressing concerns about its preparation, effectiveness and the risk of public outrage from images of migrant children being taken into custody or separated from their families.

Vitiello was replaced at ICE by former FBI and Border Patrol official Mark Morgan, who had impressed the president with statements on cable television in favor of harsh immigration enforcement measures.In his first two weeks on the job at ICE, Morgan has said publicly that he plans to beef up interior enforcement and go after families with deportation orders, insisting that the rulings must be carried out to uphold the integrity of the country’s legal system.

“Our next challenge is going to be interior enforcement,” Morgan told reporters June 4 in Washington. “We will be going after individuals who have gone through due process and who have received final orders of deportation.

“That will include families,” he said, adding that ICE agents will treat the parents and children they arrest “with compassion and humanity.”

U.S. officials with knowledge of the preparations have said in recent days that the operation was not imminent, and ICE officials said late Monday night that they were not aware that the president planned to divulge their enforcement plans on Twitter.

Executing a large-scale operation of the type under discussion requires hundreds — and perhaps thousands — of U.S. agents and supporting law enforcement personnel, as well as weeks of intelligence gathering and planning to verify addresses and locations of individuals targeted for arrest.

The president’s claim that ICE would be deporting “millions” also was at odds with the reality of the agency’s staffing and budgetary challenges. ICE arrests in the U.S. interior have been declining in recent months because so many agents are busy managing the record surge of migrant families across the southern border with Mexico.

The family arrest plan has been considered even more sensitive than a typical operation because children are involved, and Homeland Security officials retain significant concerns that families will be inadvertently separated by the operation, especially because parents in some households have deportation orders but their children — some of whom are U.S. citizens — might not. Should adults be arrested without their children because they are at school, day care, summer camp or a friend’s house, it is possible parents could be deported while their children are left behind.

Supporters of the plan, including Miller, Morgan and ICE Deputy Director Matthew Albence, have argued forcefully that a dramatic and highly publicized operation of this type will send a message to families that are in defiance of deportation orders and could act as a deterrent.

According to Homeland Security officials, nearly all unauthorized migrants who came to the United States in 2017 in family groups remain present in the country. Some of those families are awaiting adjudication of asylum claims, but administration officials say a growing number are skipping out on court hearings while hoping to live and work in the United States as long as possible.

Publicizing a future law enforcement operation is unheard of at ICE. Trump administration officials blasted Oakland Mayor Libby Schaaf last year for warning immigrants about an impending raid, saying she endangered agents’ safety.

“The Oakland mayor’s decision to publicize her suspicions about ICE operations further increased that risk for my officers and alerted criminal aliens — making clear that this reckless decision was based on her political agenda with the very federal laws that ICE is sworn to uphold,” then-ICE Deputy Director Thomas D. Homan said at the time.

Homan later retired, but last week Trump said Homan would return to public service as his “border czar.” On Fox News, Homan later called that announcement “kind of premature” and said he had not decided whether to accept the job.

Schaaf responded late Monday to the president’s tweet teasing the looming ICE roundups.

“If you continue to threaten, target and terrorize families in my community . . . and if we receive credible information . . . you already know what our values are in Oakland — and we will unapologetically stand up for those values,” she wrote.

The pain, terror, racism, and disregard for human rights is real. But, the ability to summarily remove the “millions” of our fellow humans Trump claims as his objective might be limited by both reality (lack of resources) and the law.

Many of those with so-called “final orders” were tried “in absentia.” Many of those never received legal notice of their hearings. (All reputable studies show that asylum applicants who actually understand the system, have fair access to pro bono lawyers, and receive legally sufficient hearing notices appear at rates close to 100% of the time, even if they lose their cases).

If that is the case, and they can get lawyers, they can file a “motion to reopen” for lack of legal notice and receive a statutory stay of removal while both the Immigration Judge, and if denied, the Board of Immigration Appeals rule on the motion. And, the Immigration Courts are totally screwed up and backlogged due to Trump’s and the DOJ’s “malicious incompetence.” So, good luck with that.

Large numbers of deportees would also further destabilize the already “failed states” of the Northern Triangle thus insuring a continuing outward flow.  Indeed, some of those deported might well “head north” again — only this time they won’t be dumb enough to entrust themselves to the U.S. legal system.

They will just disappear into the interior where their chances of being found again are probably less than their chances of being harmed in the Northern Triangle. No amount of authoritarian militarization of our internal police force is going to locate and remove 10-11 million people, most of them residing quietly and productively in our communities throughout America.

But, Trump has never been about results. (Nor has DHS for that matter). He’s all about White Nationalist hatred, racism, and appealing to a “base” that long ago abandoned the rest of America (the majority of us) and human values.

And let’s not forget the responsibility of Congress and the Article III Courts who for years have mostly overlooked the glaring Constitutional defects and clear incompetence and bias evident in the Immigration Court system as administered by the Department of Justice. It has taken the Article IIIs’ complicity in a legally defective system to produce these so-called “final orders” in the first place. 

Every dead kid, broken family, and new forced gang recruit should be on their collective consciences. And, the primary result of the “New Reign of Terror” will undoubtedly be fear of cooperating with local police in solving crimes, thus making ethnic Americans “perfect victims” who have been abandoned by those who are failing in their legal duties to insure “equal justice for all.”

2020 might be our last chance to save our country and humanity. Don’t blow it! Who knows, the life you save might be your own!

Advocates Launch Immigration Court Watch App to Ensure Greater Accountability, Transparency.

WASHINGTON, DC – The immigration court system has failed to fulfill the constitutional and statutory promise of fair and impartial case-by-case review, according to a new report released today by Innovation Law Lab and the Southern Poverty Law Center, entitled The Attorney General’s Judges: How the U.S. Immigration Courts Became a Deportation Tool.Download the press release here.The report, based on over two years of research and focus group interviews with attorneys and former immigration judges from around the country, links the current crisis of accountability to the Attorney General’s absolute control over the immigration court system.In conjunction with the report, the groups also announced the launch of an Immigration Court Watch app, which enables court observers to record and upload information on immigration judge conduct to create greater judicial accountability.

Under the Immigration and Nationality Act, the attorney general is required to create an immigration court system in which independent judges decide cases by applying law to the evidence on the record following a full and fair hearing. According to the report, however, today’s immigration courts are plagued by systemic bias and neglect.

“Despite the life-and-death stakes of many immigration cases within the current system, case outcomes have less to do with the rule of law than with the luck of the draw,” said Melissa Crow, Southern Poverty Law Center senior supervising attorney. “Under the Trump administration, the attorneys general have gone even further by actively weaponizing the immigration court system against asylum-seekers.”

The report explains how the Office of Attorney General has created an immigration court system that is biased, inconsistent and driven by political whims. It also examines the conflict that arises when immigration judges, who are expected to be neutral arbiters, are supervised by the United States’ chief law enforcement officer who prioritizes deterrence and deportation of immigrants, instead of an impartial review process.

The report recommends removing the immigration courts from the attorney general’s control and recreating them as Article I courts. To ensure that immigration judges are insulated from political pressures, they must be selected based on merit, receive tenure and be removed only for good cause. The immigration courts must also include more effective mechanisms of internal and appellate accountability.

“One of the key factors driving the immigration court crisis is the failure of judicial accountability,” said Stephen Manning, executive director of Innovation Law Lab. “The new Immigration Court Watch app addresses that lack of accountability, ensures greater transparency and will be a valuable resource for collecting and storing usable data on the pervasive abuses in the immigration court system.”

The new tool will allow data on immigration judge conduct to be gathered and stored in both individual and aggregate forms. This will provide advocates with valuable information to fight systemic patterns of bias and other unlawful court practices. This data can be used to bolster policy recommendations, advocacy and legal strategies.

Maybe the “Article III Enablers In Robes” need to start envisioning their kids and grandkids in cages, their daughters and granddaughters being gang raped, and their close relatives and best friends unnecessarily suffering and dying from intentionally life threatening conditions in prison where they are sentenced to indefinite confinement without rights and without being convicted of a crime.

As U.S. immigration policy and its human impact gain popular salience, some have questioned whether immigration courts—often the first-line adjudicators of deportation—are “courts” at all in the American adversarial legal tradition. This Article aims to answer this question through a focus on the role of the immigration judge (IJ). Informed by in-depth interviews with twelve former IJs and three former supervisory officials, I argue that immigration courts present with superficial hallmarks of adversarial courts, but increasingly exhibit core features of a tightly hierarchical bureaucracy. Although not all features of an immigration bureaucracy are inherently unde- sirable, masking a bureaucracy with judicial trappings results in a deceptive facade of process that likely limits scrutiny from federal courts and calms public discontent with harsh immigration laws. In light of this phenomenon, enhancing IJ independence through the creation of an Article I immigration court would solve some problems with immigration adjudication but risk papering over others. Instead, achieving a fair system will require both procedural and substantive reforms.

Yes, I recognize that Amit undercuts my arguments for an immediate halt of this system and change to Article I without waiting for other reforms to “humanize” immigration law and put them more in line with the actual national perception of immigrants (which, as Amit points out, is nowhere near as racist and inhuman as Trump’s White Nationalist restrictionist abomination now being peddled by Trump, Pence, many in the GOP, at DHS, and most disturbingly, at DOJ. For example, most Americans would favor taking care of “Dreamers” now, without all the restrictionist “poison pills” attached). I agree that other practical and humanizing reforms are necessary; but without immediate Immigration Court intervention and reform every other immigration reform becomes meaningless and innocent people will continue to die, be tortured, and be abused “on our watch.”

Immigration Court reform can’t wait! Every day, the statute, our Constitution, international treaties, our national values, and human dignity are being mocked and destroyed by what is happening in our Immigraton Courts under the “Minister of Injustice” Bill Barr and his lawless and spineless sycophants in EOIR Management.

It’s past time for the Article III Courts to stop screwing around, do their Constitutional duty, and put a screeching halt to this abomination and blot on our  national conscience. Stop these “Fake Courts” in their tracks!

No more “removal orders” until Congress creates an independent Immigration Court system that passes legal and Constitutional muster and complies with our treaty obligations. And, until that happens, the DOJ should be forbidden from any further meddling in the Immigration Courts. If the Immigration Court System is to continue to operate on an interim basis, it should be under an “Order of Supervision” from Article III Circuit Judges just as was done with Constitutionally deficient and defiant school systems in the South following Brown.

Either that or the Article III Courts should appoint an active or retired  Article III Judge as a “Special Master” with authority to insure fair, impartial, and legal operation until Congress corrects these flaws.

Allowing human beings to be “degraded and railroaded” back to life threatening situations, often after having been abused, humiliated, threatened and mistreated by so-called “judges” and their White Nationalist overlords is no laughing matter! It’s a national disgrace, the elimination of which should be our highest national priority!

ANALYSIS:  Trump Lays Another Egg On Immigration — Everybody Loses, But It Could Have Been Much, Much Worse

Alexandria, VA, June 9, 2019.  After a week of petulance, threats, and self-created drama, Trump produced a resounding trade and immigration dud. Faced with advisors telling him that he was endangering the economy, the only thing propping up his sagging popularity, a potential rebellion among GOP legislators, and an unexpectedly tough and resolute Mexico, Trump backed off of his insane and blatantly illegal plan to ignore U.S. asylum obligations and thereby rocket the U.S. to the upper echelons of international scofflaws and human rights violators. 

The latter scheme, known as “safe third country,” would have mis-designated Mexico and, incredibly, Guatemala, two clearly “unsafe” countries to do the U.S.’s job by processing tens of thousands of asylum applications from those fleeing the Northern Triangle. Neither of the two countries has a viable, fair, and effective asylum adjudication system and both have major safety and human rights issues.

Instead, Trump accepted a vague compact by which Mexico and the U.S. basically agreed to do what they had already been doing without taking any decisive or effective action to address the actual humanitarian crisis in the Northern Triangle that Trump and his flunkies have consistently mischaracterized as a “law enforcement emergency.” Indeed, the New York Times reported that most of Mexico’s “unprecedented steps” had already been worked out in secret with deposed DHS Secretary Kirstjen Nielsen months ago. https://www.nytimes.com/2019/06/08/us/politics/trump-mexico-deal-tariffs.html. To be sure, desperate and vulnerable asylum seekers, particularly women and children, will continue to abused, raped, beaten, extorted, obscenely tortured, and killed with impunity and little if any recourse as a result of this week’s actions. But, at least for now, the U.S. and Mexico are maintaining much of the basic framework of domestic and international protection laws. 

Contrary to the lies and false narratives spread by Trump and his DHS cronies, U.S. law is not filled with “loopholes.” Rather, it is a fairly straightforward implementation of the international protection regime and treaties that have been in effect since World War II to prevent another holocaust from occurring on our watch. 

If anything, since the enactment of the Refugee Act of 1980, the U.S. has watered down its asylum commitment somewhat by adding a legally tenuous “credible fear” process to “pre-screen” arriving asylum applicants in mass migration situations. However, to date, the DHS under Trump has been too incompetent, misdirected, and frankly downright stupid to utilize this streamlined screening process fairly and efficiently. 

By treating a somewhat predictable humanitarian refugee flow as a bogus “law enforcement problem” and mindlessly shoving cases into a “captive” court system that they already had abused, mismanaged, and destroyed, the Administration lost effective control. In panic, they have tried to blame the refugees, Democrats, Mexico, Obama, judges, the media, and even the truly hapless failed states of the Northern Triangle for their largely self-created human and operational disaster.

The first of the “unprecedented steps,” involves Mexico sending approximately 6,000 National Guard troops to the Guatemalan border to control illegal crossings. Never mind that the Mexican National Guard is a recent creation that exists largely on paper. Also, forget that Mexico has a questionable record of controlling corruption and systematic human rights abuses among its existing police and military forces.

The U.S., a much larger, better organized, and more prosperous country than Mexico, has resorted to militarizing the border, mass incarceration, family concentration camps, kids in cages, malicious criminal prosecutions, family separations, walls, fences, overt political interference in the asylum adjudication system, and violating international protection norms. These “gonzo” enforcement efforts not only failed to stem the tide, but have actually aided smugglers and traffickers and increased the flow of migrants. 

Will newly minted, untrained Mexican troops succeed where the might of the U.S. has failed miserably? Don’t count on it. 

Also, the last time I checked, it appeared that most of the Mexican coast and some parts of the U.S. are reasonably accessible by boat from the Northern Triangle. So, assuming that the Mexicans could “shut down” their land border with Guatemala, why wouldn’t smugglers “take to the sea?” How’s that Mexican Navy?

The second “unprecedented step,” is a continuation and expansion of the existing “Remain in Mexico Program.” This toxic gimmick punishes those who have been legally determined to have a “credible fear” of persecution by making them remain in some of the most dangerous locations in the world where they are intentionally and illegally impeded in many ways from pursuing their U.S. asylum claims from Mexico. To date, this program has only been implemented in a few locations, like San Diego where it has been an unmitigated failure according to a report from Kate Morrissey of the San Diego Union-Tribune. https://immigrationcourtside.com/2019/06/06/cruel-yet-really-stupid-trumps-remain-in-mexico-policy-denies-due-process-while-creating-court-chaos-enfeebled-judges-fume-as-aimless-docket-reshufflin/.

The results of this ill-advised effort by Trump to circumvent U.S. asylum laws reads like a “legal toxicology report:” “Aimless Docket Reshuffling,” mass confusion, lack of information, insufficient and deficient hearing notices, massive violations of the statutory right to be represented by counsel, no opportunity to fairly prepare, document, and present asylum claims, interference with the attorney-client relationship by DHS, and few actual case completions to name just a few of the many abuses. And, how will an already dysfunctional EOIR deal with yet another round of “new priorities” and more “Aimless Docket Reshuffling?”

A Federal District Judge actually enjoined this circus before it could get rolling. But, a “tone-deaf panel” of the Ninth Circuit allowed Trump’s assault on the rule of law to go forward, at least for now. 

Nevertheless, the case remains pending with the Ninth Circuit. As EOIR’s rushed and sloppy work product starts to accumulate on their docket and the bodies and horror stories start to pile up in Mexico, more responsible Circuit Judges might actually force the Administration to comply with the law and the Constitution, not to mention simple human decency.

Mexico has pledged to “accept and protect” those sentenced to remain there. But, the Mexican border locations to which individuals are forced to return are dangerous for a reason. Presumably, if Mexican can’t maintain safety and order for its own citizens, it won’t do any better for vulnerable asylum seekers.

Finally, in third “unprecedented step,” Mexico and the U.S. agreed to promote the “Comprehensive Development Plan launched by the government of Mexico in concert with the governments of El Salvador, Guatemala and Honduras” to create “prosperity, good governance and security in Central America.” This part of the agreement makes the most sense. But “promoting” in this case appears limited to using development funds that were “already in the pipeline” in both countries. In other words, nothing really new here.

This was a golden opportunity for the U.S. to show real leadership by dramatically increasing its investment in bringing stability and prosperity to Mexico and Central America. Additionally, we could have created incentives (rather than threats) and benchmarks for Mexico to improve its asylum adjudication system and human rights performance. Partnering with non-governmental-organizations and legal assistance groups on both sides of the border also would bring much needed expertise in resolving asylum issues to the table.

But, that would have taken a President with vision, empathy, compassion, courage, competency, intelligence, and creative problem solving ability. Trump is the exact antithesis of all of these qualities.

Consequently, sooner or later we can expect Trump’s “latest egg” to fail, like all of his other gimmicks and maliciously incompetent schemes on immigration. Our “child president” will undoubtedly then embark on a new barrage of lies, false narratives, idiotic tweets, idle threats, blame shifting, insults, racist dog whistles, and general nonsense aimed at diverting attention from his own failures as a leader and more critically, as a human being.

Innocent people will be harmed and die, America and Mexico will be embarrassed and diminished, and the world will be a worse place. But, until America figures out how to use its democratic institutions to remove the kakistocracy, the disaster will continue. That it could have been worse, is only small consolation.

Why not strive to be  the “best that we can be,” rather than just “not as bad as we might have been?”

Mexico Border Deal to Avoid Tariffs Would Endanger Lives

New York City—In response to reports that the Mexican government is planning to make a deal with the United States to avoid tariffs threatened by President Trump, Human Rights First’s Eleanor Acer issued the following statement:

President Trump is trying to bully another country into endangering the lives of vulnerable men, women, and children, who want nothing more than to live in freedom and safety. Mexico and Guatemala are not—in a legal or practical sense—safe countries for many refugees. In Mexico too many refugees face kidnapping, assault, and murder.

People seeking refuge are not required to seek asylum in the first country they set foot in. In fact, many face grave dangers in neighboring countries, as well as serious risks that they will be returned to their country of persecution.

Such a plan would not only makes a mockery of U.S. law and treaty commitments, but would also return refugees to places where their lives are in danger. It is yet another abdication of leadership, setting an abysmal example for other countries around the world.

Instead of more attempts to block and punish people seeking refuge, the United States needs real solutions that restore order and uphold America’s refugee laws and treaty commitments, including:

  1. Tackle the root causes pushing people to flee the Northern Triangle countries through a targeted strategy that leverages both diplomacy and aid, focusing on effective programs that reduce violence, combat corruption, strengthen rule of law, protect vulnerable populations and promote sustainable economic development.
  2. Launch a major initiative to enhance the capacity of Mexico and other countries—which are already hosting growing numbers of refugees—to provide asylum, host, protect, and integrate refugees, along with a robust regional resettlement initiative that provides orderly routes to the United States and other countries while safeguarding asylum.
  3. Immediately end the dysfunction at the border, and instead launch a public-private humanitarian initiative and a long overdue case management system to actually manage asylum cases.
  4. Fix the asylum and immigration court adjudication systems to provide fair, non-politicized and timely decisions.

As usual, Trump’s outrageously illegal and immoral proposal relies on:

  • Bullying weaker countries;
  • A gullible public;
  • A cowardly GOP Congress;
  • Complicit courts.

A simple perusal of the country condition materials publicly available on the EOIR and Department of State websites shows that the idea that either Mexico or Guatemala are “safe” countries where refugees “would have access to a full and fair procedure for determining a claim to asylum or equivalent temporary protection,” as required by U.S. law, is preposterous.

Mexico’s asylum adjudication system is plagued by bribery, corruption, and incompetence. It adjudicated only about 10, 000 cases in the last reported period, denying the overwhelming majority. Moreover, gangs and cartels operate freely throughout the Northern Triangle countries and Mexico. Our State Department Report acknowledges that the same organized gangs who force people to leave the Northern Triangle can also harm them in Mexico.

Guatemala is a highly corrupt country basically without a functioning asylum adjudication system.  It is a major sender of asylum applicants to other countries. The Guatemalan Government is unable to maintain order and protect its own citizens, let alone refugees from nearby countries.

Also, we are encouraging Mexico and Guatemala to use troops and military force against asylum seekers — something our own laws do not permit.

Essentially, the Trump Administration seeks to “get away with murder.” In two years they have turned the U.S. from a leading defender of human rights to a major international human rights violator. So, why are we allowing our Government to get away with such dishonest, morally bankrupt, and illegal proposals?

Even if these corrupt proposals go into effect, it seems doubtful that they will stem the follow of refugees in the long run. While there might be a short term downturn, eventually smugglers will adjust to the new policies and desperate individuals will find different routes to the United States. They will be more dangerous, so more will die.

Perhaps we will see  “Central American Boat People” and more deaths at sea. Maybe there will be more “Golden Ventures.” More deaths at the border will be inevitable as smugglers seek to evade the Border Patrol and get to the interior. Perhaps the human smuggling action will switch to the even longer U.S. Canada border. How about a “Northern Wall”  from the Atlantic to the Pacific?

As long as the U.S. stubbornly refuses to acknowledge and address the causes of migration it will continue, in extralegal channels as necessary and as the market “push pull factors” determine. More focus on barring refugees means less focus on drug smugglers and others who present a real threat to our safety and security.

Also, smugglers will be able to change a premium — so those who are willing to take the risk and outsmart the new system will reap even higher profits than the increased ones Trump has already conferred upon them with his maliciously incompetent policies to date.  Finally, walls, jails, cages, abuses, family separations, prosecutions, racist rhetoric, armed violence, tariffs, exploitation, massive violations of our Constitution and international laws, or whatever won’t stop desperate refugees from coming. But we will eventually convince refugees to give up on the U.S. legal system and just find ways to get beyond the border and lose themselves in the interior. No enforcement system, no matter how cruel, repressive, expensive, and lawless will be able to get rid of more than a fraction of those who don’t want to be found after reaching the interior.

Moreover, if Trump’s actions succeed in destabilizing Mexico, then Mexican migration, which has actually been a negative flow recently, will resume in large numbers, also adding to the pressure on our borders. The worse things get in Mexico, the less likely that the Mexican Government will stop their citizens from heading north. So, there is every reason to believe that Trump’s “malicious incompetence” will make things even worse for everyone  — but particularly for those who are most vulnerable — desperate asylum seekers!

Above all else, immigration is about people – not just those who have recently arrived or those yet to come, but the kind of people we choose to be. Since the Founding, the compact we made as a nation was to welcome the oppressed, the persecuted, and the hopeful from all over the world because we recognize that immigrants enrich every aspect of our society with their determination and genius. Each successive generation of Americans has included immigrants, refugees, and asylum seekers, strengthening this nation that we share.
The current administration has chosen to defy this American aspiration, drafted into our Declaration of Independence, welded into the welcome of our Statue of Liberty, and secured by the sacrifices of countless generations. Instead, the current administration is pursuing cruel and cynical policies that aim to sow needless chaos and confusion at our borders. It is manufacturing crises in our communities. And it is seeking to turn us against each other. When this is done in our name, with our tax dollars, and to our neighbors, we not only undermine our laws, hold back our economy, and damage our security – we risk losing ourselves.
But at this moment of peril, we have a chance not only to reverse course but to advance a new vision of immigration that more fully reflects our values. As a fourth-generation El Pasoan, Beto uniquely recognizes the urgency of fixing our broken immigration and naturalization system. Rooted in his experience serving the largest binational community in the Western Hemisphere – one that draws its strength and prosperity from its rich heritage of welcoming immigrants – Beto is proposing a new path forward to ensure we honor our laws, live up to our values, and once again harness the power of a new generation of immigration toward our shared prosperity.
Beto’s plan, which would represent the most sweeping rewrite of our nation’s immigration and naturalization laws in a generation, is built on three key pillars:
1. On day one of his presidency, Beto will use executive authority to stop the inhumane treatment of children, reunite families that have been separated, reform our asylum system, rescind the travel bans, and remove the fear of deportation for Dreamers and beneficiaries of programs like TPS.
2. Beto will also immediately engage with Congress to enact legislation – focused on the key role families and communities play – that will allow America to fully harness the power of economic growth and opportunity that both immigration and naturalization will bring to our country’s future.

I. ENDING THE CRUEL AND CYNICAL POLICIES THAT CREATE CHAOS AT OUR BORDERS AND IN OUR COMMUNITIES ON DAY ONE

The current administration’s cruel and cynical policies are sowing needless chaos and confusion at our borders and in our communities. On day one of his presidency, Beto will take immediate executive action to end these practices and replace them with policies that conform to our laws and values, restore order and process to our asylum and immigration systems, and refocus our tax dollars on smart security. Those executive actions will:
● Reform the asylum system and reunite families. The current asylum system is ineffective, inefficient, illegal, and immoral. Those traveling vast distances to escape extreme violence and crushing poverty are being met by a militarized cruelty and manufactured chaos that separates families, detains children, and deliberately extends the backlog of those who require processing. We must change both the culture and processes for handling asylum claims.
An O’Rourke administration will ensure lawful and humane conditions at U.S. Customs and Border Protection (CBP) facilities, including access to medical treatment, mental health care, social workers, and translators, and restore orderly and prompt processing of people seeking refuge under our nation’s asylum laws. As president, Beto will:
o Rescind the current administration’s executive orders that seek to maximize detention and deportation, including former Attorney General Sessions’ radical re- interpretation of asylum law that seeks to deny protection to women and children fleeing domestic violence and escaping from deadly gangs.
o Mandate an end to family separations at the border and illegal policies like “metering” and “Remain in Mexico.”
o Issue an executive order to require detention only for those with criminal backgrounds representing a danger to our communities and eliminate all funding for private, for-profit prison operators whose incentive is profit, not security.
o Ensure that people have the tools to navigate our immigration court system by scaling up community-based programs and family case management, which is nearly one-tenth the cost of detention and ensures that people attend their courts hearing and that they know what is expected of them.
o ReinstatetheCentralAmericanMinorsprogram–allowingchildrenwithparents in the U.S. to apply for refugee status from their home countries – and other regional refugee resettlement efforts, working with the international community to process cases in the region and commit to resettling in partner countries.
o Take immediate steps to upgrade and increase staffing in the asylum system, streamline how cases move through the process, and provide timely and fair asylum decisions, while laying the foundation for a more fundamental reform to the immigration court system that restores due process and ensures equal access to justice, including by:

▪ Increasing court staff, clerks, interpreters, and judges;
▪ Making the courts independent under Article I, rather than administered
by the U.S. Department of Justice;
▪ Ending policies that prevent judges from managing their dockets in the
most effective way;
▪ Expanding the Legal Orientation Program (LOP) to ensure that everyone
knows how to navigate our immigration system;
▪ Deploying up to 2,000 lawyers to the border and funding a robust right to
counsel; and
▪ Developing approaches to resolve asylum cases outside of the court system,
such as by allowing USCIS Asylum Officers to fully adjudicate cases when conducting Credible Fear Interviews to prevent referring more cases into the backlogged courts.
o Personally lead a public-private initiative to bring humanitarian resources to the border.
● Rescind the discriminatory travel bans, which defy our nation’s Constitution and values.
● Immediately remove the fear of deportation for Dreamers and their parents and Temporary Protected Status (TPS) and Deferred Enforced Departure (DED) beneficiaries, and begin work towards a permanent legislative solution.
● Refocus on smart security. The current administration is distracting CBP and other law enforcement personnel from focusing on actual threats and undermining their efficacy by pulling resources away from them – all in pursuit of a wall that we do not need, does not work, and will not make us safer. As President, Beto will:
o Immediatelyhaltworkontheborderwall–andhisfirstbudget,andeverybudget, will include zero dollars for this unnecessary wall;
o Immediatelybooststaffingtoexpandinspections,reducewaittimes,andincrease our capacity to detect illicit drugs – for instance by pursuing a targeted two-prong strategy that focuses on fentanyl shipments coming through our ports and our mail system – and other contraband, as well as modernizing our ports; and
o Immediately prioritize cracking down on smugglers and traffickers who exploit children and families by working with our regional partners.

II. STRENGTHENING OUR FAMILIES, COMMUNITIES, AND ECONOMY BY REWRITING OUR IMMIGRATION LAWS IN OUR OWN IMAGE
As President, Beto will push to rewrite our nation’s immigration and naturalization laws in our own image. These laws have not been meaningfully modernized in decades, despite the efforts of multiple administrations. But we have the chance to chart a new course that more fully vindicates the promise of this nation of immigrants. Beto will work with Congress to achieve that vision. He will reunite families and ensure they have a chance to contribute more to our economy and our communities – and pursue the American Dream. He will put workers and employers on a level playing field to, together, tap into the opportunity immigration presents for our economic growth and shared prosperity. And he will do that while boosting the security and functionality of our borders.
This is not just right but also essential to our shared prosperity. Immigrants from every corner of the world – those who came here on student visas and those seeking refuge from persecution – have been a key driver of our economic growth. They have been responsible for nearly one-third of all new small business, one-fifth of all Fortune 500 companies. And achieving immigration reform will be critical to unlocking our future success – creating at least 3 million jobs over the next decade, adding $2 billion to state and local tax revenues each year, and cutting the deficit by at least $1 trillion over the next 20 years.
Naturalization, too, promises economic gains. A recent study of 21 U.S. cities found that if all eligible immigrant residents were to naturalize, incomes would increase by $5.7 billion,

homeownership would rise by over 45,000, and tax revenues would grow $2 billion. The same study showed GDP would grow by $37 to 52 billion per year if half of those eligible nationwide naturalized.
In his first hundred days, Beto will put the full weight of the presidency behind passing legislation that:
● Creates an earned pathway to citizenship for 11 million undocumented people that is more efficient than previous proposals and includes an immediate path for Dreamers and beneficiaries of programs like the Temporary Protected Status (TPS) and Deferred Enforced Departure (DED) programs.
● Strengthens our families, communities, and economy by prioritizing family unity – a hallmark of our best traditions – through provisions that:
o Reuniteimmigrantfamiliesseparatedbylengthyvisabacklogs;
o Revisepreferencecategoriesandcapstoprioritizefamilyunity;and o Removebarstore-entryandstatusadjustmenttosupportfamilies.
● Establishes a new, first-of-its-kind community-based visa category. Beto’s proposal will create a brand new category whereby communities and congregations can welcome refugees through community sponsorship of visas. This program will supplement the U.S. Refugee Admissions Program, which will be rebuilt and restored to align with America’s tradition of welcoming vulnerable refugees from around the world.
● Increase the visa caps so that we match our economic opportunities and needs – for work, education, investment, and innovation – to the number of people we allow into this country. This also means legislation that will:
o Ensure that industries that depend on immigrant labor have access to a program that allows workers to legally come here and legally return to their home country with appropriate labor and mobility protections;
o Address the green-card backlog and provide opportunities for those awaiting resolution to work and contribute, while immediately recapturing the over 300,000 green cards that have gone unused due to bureaucratic delays to support our high-growth industries of the future;
o Promote STEM education by granting foreign-born students more flexibility to stay in the U.S. and gain employment after graduating; and

● Make naturalization easier for the nearly 9 million immigrants who are currently eligible for citizenship. If we are to reestablish our reputation as a nation that welcomes immigrants, we must make it easier for those already here to become full-fledged citizens. This means pursuing legislation that:
o Makesnaturalizationfreeforallwhomeetthelegalrequirementsforcitizenship;
o Eliminatesapplicationbacklogs;
o Reforms the application process so that individuals are mailed a pre-filled application form as soon as they meet the legal requirements for citizenship;

o Establishesequaltreatmentofallcitizens–naturalizedandnative-born–rejecting the current administration’s effort to create new barriers to naturalization and stoke fears around de-naturalization.
● Bolster security and functionality of the border where trade and travel occur. Beto will draw on his lived experience at the border to push for legislation that actually supports our law enforcement and our border communities in advancing the nation’s security and protection from all threats. This includes three steps:
o Increasing Personnel: Immediately stop the smuggling of drugs and prevent human trafficking across the border by hiring, training, and assigning additional CBP personnel at land border crossings;

o Create a uniform process for tracking and preventing migrant deaths along the border; and

o Increase accountability from ICE and CBP personnel through improved training and continued education courses.

III. RESTORING OUR STANDING AND ENSURING REGIONAL SECURITY BY BEING A PARTNER FOR PROSPERITY AND SECURITY IN LATIN AMERICA
Consistent with this broad vision, Beto’s plan strengthens our partnership with our neighbors throughout the Western Hemisphere and will be implemented alongside partners in the Northern Triangle and across the region. His foreign policy will increase our engagement within the hemisphere, elevate the importance of Latin America, refocus on supporting democracy and human rights, end our failed war on drugs, and invest in reducing violence and combating climate change, because the only path to regional security runs through a more democratic and prosperous Latin America.
● Join with the people of the Northern Triangle to fight violence and poverty and bolster our shared security and prosperity. Beto will bring a whole of government approach to our investment in the Northern Triangle, recognizing that what we have done in the past is not enough. We must convene our regional partners to do more, faster, if we are serious about reversing the instability that drives forced migration. This means:

o ConveninganewandimprovedPartnershipforProsperityandSecuritybycalling upon our allies and friends across the Americas to form a regional alliance dedicated to creating stability and economic prosperity across the continent, beginning in the most precarious countries;

▪ Providing agricultural technical support to increase adaptation to climate
change and improve the use of natural resources;

On Friday, the New York Times reported that former Virginia attorney general Kenneth Cuccinelli will be tapped for a role in the Trump administration. He will be put in charge of the country’s legal immigration system, as head of U.S. Citizenship and Immigration Services (USCIS). While it had been earlier rumored that Cuccinelli would be placed in a new job as “immigration czar,” both the Times and the Washington Post noted that he now seems set for the top spot at USCIS.

No matter what job Cuccinelli ends up in, he is neither deserving nor qualified to play any role in shaping immigration policy. He is an immigration hardliner with views that are at odds with American values. He has a history of xenophobic, homophobic, and sexist comments. Ironically, one nice thing that can be said about Cuccinelli is that he fosters bipartisanship — he has generated opposition from both sides of the aisle.

Given that Cuccinelli could soon be presiding over USCIS, his comments on immigration are worthy of review. In 2018, he told Breitbart News Daily that states should use “war powers” to turn back migrants: “You just point them back across the river and let them swim for it,” he said. In 2015, appearing on a conservative radio station, he claimed that President Obama was encouraging an “invasion” of undocumented immigrants. In 2012, he compared immigration policy to pest control. He’s called the infamous Rep. Steve King (R-Iowa) “one of my very favorite congressman.” So Cuccinelli is hardly someone who can be trusted to run USCIS in keeping with the agency’s core values, which include “respect” and “integrity.”

Most importantly, Cuccinelli has no significant experience in immigration policy, notwithstanding his failed attempt to end birthright citizenship as a state senator. He is not from a border state, nor has he been a credible voice in the immigration debate. His background is in law enforcement, not immigration law.

Cuccinelli’s prime qualification for his new job seems to be that he has been a tireless defender of the president on cable news. That could almost be seen as laughable if the stakes were not so high. Consider that as head of USCIS, Cuccinelli would wield tremendous power over immigrants like refugees, domestic abuse victims, and asylum-seekers. Or that our legal immigration system is byzantine and complicated, attracting the largest number of immigrants in the world. In FY 2017, the U.S. granted Legal Permanent Resident status to about 1.1 million people, including 120,000 refugees and 25,000 asylum-seekers.

Cuccinelli’s anti-LGBTQ record is especially troubling. As attorney general, he was against policies banning discrimination on the basis of sexual orientation in public colleges and universities. As a state senator, he unsuccessfully fought to criminalize sodomy, calling “homosexual acts… intrinsically wrong.” In 2008, he declared that homosexuality “brings nothing but self-destruction, not only physically but of their soul.” The extreme views matter because LGBTQ people are among our most vulnerable immigrants. The Human Rights Campaign, for example, has documented “the precarious position of transgender immigrants and asylum seekers.” Sadly, it seems unlikely that Cuccinelli would respect their human rights, let alone treat LGBTQ immigrants with kindness and compassion.

There are myriad ways in which Cuccinelli has demonstrated that he is far out of the mainstream, so much so that handing him a huge job would be dangerous. The man who worried about getting his newborn son a social security number because he was concerned about the government tracking his family is probably not the ideal person to put in charge of E-Verify, the federal database that checks employment eligibility.

True, the president can choose whomever he likes for high-level positions. But Cuccinelli isn’t even a smart political pick. In addition to being unpopular with Democrats, he doesn’t have the full support of Republican lawmakers either. According to the website Vox, Sen. Mitch McConnell (R-Ky.) does not want to confirm Cuccinelli (the ill will stems from the fact that Cuccinelli headed up a political action committee that supported primary challenges to incumbent Republicans in 2014). Besides, on immigration most Americans are moving away from Trump. This January, the Pew Center found that 62 percent of Americans believe that immigrants strengthen our country. A restrictionist like Cuccinelli is not what the public wants or needs.

As head of USCIS, Cuccinelli would bring little to the job except a track record as a Trump loyalist. With his outdated and narrow views, he would be a disaster overseeing our legal immigration system.

Francis Cissna was the man who “took the ‘Services’ out of US Citizenship and Immigration Services.” His dismal anti-immigrant polices and undermining of public service have brought unprecedented backlogs to USCIS adjudications that are now under Congressional investigation. He also reportedly “tanked” employee morale at USCIS. Nevertheless, he wasn’t quite nasty enough for Trump and his neo-Nazi White Nationalist advisor Stephen MIller.

As a Virginia resident who suffered through “Cooch Cooch’s”  disastrous tenure as Attorney General and his thankfully unsuccessful bid to become our Governor, I can testify that he is indeed without any redeeming social values. In other words, a perfect fit for the “Trump Immigration Kakistocracy.” But, “Cooch Cooch” has some powerful enemies in the GOP Senate. He pissed off Senate Majority Leader Mitch McConnell, and powerful Senator Chuck Grassley (R-IA) can’t be too pleased with Trump’s treatment of his former staffer Cissna.

In the meantime, it’s “chaos as usual” in the DHS/USCIS kakistocracy.
