A New Report Shows Skyrocketing Deaths in El Paso, New Mexico Border Region

“It’s really just shocking how close to help a lot of people died,” says Bryce, who led the report for the nonprofit No More Deaths.

As safe corridors for migration disappear, more people risk their lives crossing the U.S.-Mexico border. And more people die. A new report by the nonprofit No More Deaths, along with a searchable map and database, documents the increasing number of migrant deaths at the border in New Mexico and far West Texas. Until now, not much research has been done on the deaths of people migrating through this section of the border. The project was led by Bryce, a No More Deaths volunteer (who asked that we not use his last name because the Far Right has recently been targeting the group). He, along with several others, have created the most comprehensive database to date of deaths in the Border Patrol’s El Paso Sector, which includes New Mexico and two counties in Texas, El Paso and Hudspeth. The report covers 15 years, from 2008 to 2023, and it shows many disturbing trends, including the acceleration of deaths that has accompanied “prevention through deterrence,” the U.S. government’s strategy implemented in the 1990s to push migrants into more remote, dangerous crossings. That strategy is now morphing into something all the more tragic as people, increasingly women and children, are barred from accessing asylum and are dying at the doorstep of American cities and towns. In this Q&A, Bryce talks about documenting these deaths, and the discoveries that both shocked and angered him in creating this new report.

Why did you study this particular part of the border in New Mexico and far West Texas?

A couple of years ago, a few of us started getting interested in what’s happening in New Mexico, and whether there’s any need for humanitarian aid out there, just because we hadn’t really heard anything but assumed there must be something happening out there. Quickly, we noticed that there was not much data in general about the area. So I started doing public records requests. And pretty quickly, just with the first batch of data, we got about 20 deaths for 2022. We went to some of those locations to see if we’d see trails. And while we were checking out some of these locations, we found human remains right across the street from a cemetery and about 50 feet from a main road in Sunland Park [New Mexico]. It was not a remote place. It was right in town. So we started looking at the Sunland Park Fire Department’s social media page, and quickly realized that there was a lot happening and quickly. And then 2023 ended up being this record deadly year for the area.

It’s shocking that you found a dead person right there in the middle of Sunland Park. Can you tell me more about this person? Were they identified? How long had the person been there? And how could this have been missed by people who live there?

He was later identified as a man from Colombia. [His name was Johan Orozco Martinez, age 36.] He had been there for a couple of days. I’m not joking when I say he was right across the street from the Memorial Pines Cemetery, and near the shoulder of the road. Many cars drive this road, but I think typically people look toward the cemetery, and I guess they didn’t see him because they were looking in the other direction. He was in his 30s and so older than many of the usually young men you see, for instance, crossing through southern Arizona.

Two findings that really stand out to me from your report are the number of women who have died, and how increasingly people are dying within city limits and no longer just in remote areas that are hard to access. I mean, you found a person in the middle of Sunland Park. What’s going on, do you think?

The dynamics of migration are complex. But one thing that seems pretty clear is that the asylum policies in the last few years have led to an increase in some of these deaths, just from people trying to get asylum and being prevented either by metering or by turnbacks. And then feeling they have no choice but to cross through the desert. A lot of people who are crossing are older, they’re women, they’re people with health problems. The demographics, we found, were much different in the El Paso sector than in southern Arizona, with people being older and more than 50 percent of the deaths in 2023 being of women, which is unusual.

When did the deaths start increasing? And has the increasing militarization of the border and Operation Lone Star in El Paso contributed to these deaths?

Up until 2015, there were very few deaths in this area. But especially since 2018, the deaths have just been ramping up every single year. We were in New Mexico watching Operation Lone Star soldiers put up a barbed-wire fence between New Mexico and El Paso in an area where a lot of people cross. So once you’re in the United States, even crossing into Texas from the New Mexico side has become more deadly. And you can see National Guard in El Paso patrolling and pushing people back. The more enforcement, the more the deaths increase. In El Paso, there are what I call “moats” because if people climb the border wall, there’s an irrigation canal right on the other side, which at times can be moving very quickly. Then beyond that there’s multiple highways and more canals. So if someone is being chased by Border Patrol or Operation Lone Star, there are multiple deadly obstacles.

In 2022 there was a two-week period when 15 people died in the canals, one right after the other. This was during irrigation season in El Paso. Water is released from a reservoir in New Mexico into the canals and the river to irrigate farmland further east of El Paso. When that happens, the water can be going like 20 miles per hour. Unless somebody physically rescues you, there’s no way of getting out once you’ve fallen in. I watched a news broadcast in El Paso where they made a public service announcement about drowning deaths in El Paso, saying like, “Irrigation season is here, stay away from the canals, watch out for drowning.” But if you read all the autopsy reports, it’s almost all migrants dying. Because the medical examiner doesn’t flag whether it’s a migration-related death, you end up getting these weird statistics about drowning deaths being on the rise in El Paso. And so they’re directing these public safety messages toward El Paso residents who are actually in very little danger of drowning. And the people who are in danger of drowning, the migrants, have no idea.

Did you also find an increase in the deaths of children?

Definitely, yes. In 2018, two eight-year-old Guatemalan kids died. There’s a lot of teenagers dying, crossing the border wall, a lot of them drowning in El Paso city itself. For instance, there was a Russian man and his teenage daughter who both fell into a canal and drowned. They were running from Border Patrol agents. I believe that happened in 2021. We saw fewer deaths of younger people in New Mexico.

You also found that Customs and Border Protection is significantly undercounting deaths related to enforcement. Can you talk about this finding?

CBP is supposed to keep track of migrant deaths and CBP enforcement-related deaths, but we found that the agency is severely undercounting them. There’s been a lot of documentation in the past, talking about that fact, but there hasn’t been a whole lot of quantifying that undercount. Aside from the Arizona data that the Pima County Office of the Medical Examiner and Humane Borders have reported. For example, in one year we found 39 deaths, while CBP reported only 10 deaths.

We looked at investigator reports and so we were able to read the narratives, and learn circumstances around the deaths. We were able to see if someone was chased by Border Patrol, either on foot or by vehicle, or if they died in Border Patrol custody. We found that Border Patrol had tried to underplay some of these deaths.

We found that 15 percent of all migrant deaths in the El Paso sector were caused directly by Border Patrol due to chases or use of force, also due to custody deaths, or falls from the border wall. Humane Borders doesn’t track deaths related to Border Patrol enforcement. So this is the first instance that I’m aware of, where we are able to quantify the CBP undercount of Border Patrol-related deaths.

For 2022, for instance, we found 16 deaths that should have been reported by CBP as CBP-related deaths. CBP had only reported six of those deaths. Of the 16 we found, I think it’s still an undercount, because a lot of the investigative reports use vague or passive language about a person “jumping into the canal,” for instance. So you don’t know if the person was actually chased. So we only included cases where it’s very explicit.

What surprised you most in working on this report?

It’s really just shocking how close to help a lot of people died. I’m used to southern Arizona, where the terrain and trails are very remote. But we found people dying across the street from the cemetery, people dying a short walk from the Dollar General store. We’ve had this narrative of “prevention through deterrence” for the last few decades, which has pushed people away from cities into remote areas where they’re more prone to dying from heat exposure or something else. But now the border is militarized to the point where even Sunland Park, this suburb of El Paso, can be as deadly as the middle of nowhere in southern Arizona.

Last June, for instance, something like 40 percent more people died in Doña Ana County in New Mexico than the entire state of Arizona. Most of these deaths were close to the highway or close to a town. It’s a dynamic that has not really been studied. And the fact that it’s been happening for years without anybody really noticing is really scary.

With these findings, are No More Deaths and other humanitarian groups mobilizing to do search-and-rescue and water drops in this area?

Like Texas, much of the land in New Mexico where people are dying is privately owned land, so it’s difficult to access for humanitarian groups.

We’ve been going there about once a month for the past year to try to organize some support. There’s a group that doesn’t have a name yet that we’ve started to work with, that’s putting out water in some of these areas. There’s another group from southern Arizona that has moved over to New Mexico to search for remains in the desert.

We’re hoping the news will spread and that others will join to help. We have some money to help out some groups that are forming. We’re really hoping that groups will form on their own for search-and-rescue and putting out water. Because right now, Border Patrol is the only game in town if you call 911 as a migrant. And Border Patrol has a horrible track record of actually helping anybody.

Too many members of the so-called “mainstream media” are ignoring their moral, professional, and ethical duties to report honestly on the known, preventable “human collateral damage” resulting from both current and proposed anti-asylum “border enforcement” policies!  It’s been going on for years, largely “under the political and media radar screens!” This is a monument for those who have died attempting to cross the US-Mexican border. Two things stand out: 

  1. A complete lack of accountability for the misguided politicos and bureaucrats who are dishonestly pushing these immoral and ineffective policies without “owning up” to both the known deadly consequences and the lack of long-term “deterrent” value (even assuming, as I do not, that effective deterrence could justify immoral and illegal policies) of the actions they are touting; and 
  2. A complete abdication of professional journalistic standards and performance from the many members of the so-called “mainstream media” who fail to include in each report on draconian “border control” proposals and “policies” the deadly, well-documented human consequences of those policies and who provide a toxic forum for politicos and supposed “pundits” spouting myths and  nativist propaganda about “border enforcement,” without presenting experts like Melissa, Todd Miller and many others who have actual experience with the unending trauma and futility caused by our current misguided, often flatly illegal, and clearly immoral approach to “border enforcement.”

Last year, a dangerous and despotic Texas Governor Greg Abbott signed into law SB 4, heralding the legislation as a form of defense in his war against President Biden’s immigration policies that have apparently left Texas unsafe and vulnerable. Obviously, nothing could be further from the truth; in fact, Texas is privileged to be the second state in the union with the largest immigrant population that has contributed over $40 billion in federal and state taxes, with a spending power of more than $110 billion. According to a report by the Immigration Research Initiative and Every Texan:

Once provided a work permit, new immigrants earn an average of $20,000 in their first year, which increases to $29,000 by their fifth year living in Texas. […] For every 1,000 workers, immigrants and asylum seekers contribute $2.6 million to state and local taxes within their first year of eligibility. Far from a burden on Texas communities, newly arrived immigrants and asylum seekers are as essential to our state’s economy as they are to our families and communities.”

Abbott and the state have reaped from the contributions of immigrant families, regardless of immigration status, only to waste millions in taxpayer dollars to cruelly militarize the border against their own border communities and the children and families seeking refuge and safety. With SB 4, Abbott and Texas would make it a felony for any undocumented immigrant to enter the state and empower local law enforcement and state judges to arrest and deport undocumented immigrants.

The proposition, uncritically reported by many in media and mindlessly repeated by politicos of both parties, that effectively eliminating asylum at the border, thereby turning the ability to seek protection in the U.S. over to smugglers, cartels, and thugs, will “enhance security” is beyond preposterous! Obviously, it will do the exact opposite by improperly treating desperate individuals seeking legal protection from the U.S. the same as the small number of actual security threats who might seek to cross the border (at least some of whom are actually caught). 

Just ask yourself the question that the media never presses on Abbott, DeSantis, Trump, GOP nativists, or their spineless Dem enablers: Why would a “real terrorist” spend weeks or months trying to get a “CBP One” appointment to be screened by CBP? Alternatively, why would such an individual risk the irregular border crossing and then turn themselves in to CBP for processing or wait weeks in filthy conditions to be processed by CBP? Answer: Obviously, they wouldn’t.

There are many easier ways for those smuggling or seeking to engage in criminal behavior to enter (think thousands of miles of lightly guarded Northern Border, false visas, entering legally at an airport under false pretenses, or concealing contraband in legitimate commerce — the way most fentanyl enters the U.S.). And, they are all “facilitated” by the USG’s insanely bad policy decision to concentrate “law enforcement” resources overwhelmingly on those who present no realistic threat and want only fair consideration of their legal claims! Sure it generates (largely misleading) “numbers,” but does little to actually enhance security.

Indeed, one might well suspect that the inordinate hoopla and intentionally exaggerated fears focused on asylum seekers is largely a “cover-up” and diversion from the Government’s poor record on dealing with the fentanyl crisis.

 As I have repeatedly said, what if the Feds and states stopped disingenuously wasting unconscionable amounts resources on bogus enforcement and deterrence and instead invested in building a fair and timely asylum reception, screening, adjudication, and resettlement system that encouraged and rewarded those presenting themselves at ports of entry? That would make it easier for law enforcement to concentrate on those actually seeking to avoid our legal system (rather than inanely concentrating on those who merely want our legal system to fairly consider their claims)!

What would happen if the “mainstream media” actually fulfilled their professional, ethical, journalistic responsibilities to research, understand, and report honestly about the right to asylum, those seeking it, and those assisting them in presenting their claims to an intentionally hostile and dysfunctional system! What if the media stopped uncritically and irresponsibly reporting nativist propaganda, such as Abbott’s babbling, as “news,” and began concentrating on informing the public of the truth about asylum seekers, the legitimacy of many of their claims, and their great potential benefits to America!

When we entered the garden, Tomás’s face relaxed. We were at the Casa de la Misericordia de Todas las Naciones in Nogales, Sonora, Mexico, where he had resided for six months with his wife, Cristina, and three children. Before we entered the garden, Cristina and Tomás told me that a criminal group had abducted their 20-year-old son, Carlos, in the small rural community where they lived in the mountains of the Mexican state of Guerrero. Carlos returned to the family, but they knew he was under threat, that the whole family was in danger. As we spoke under the shade of a large tree, children raced around and played on a swing set in front of a yellow building that housed primarily mothers with young children. About 120 people, including entire families, were staying at this shelter, which was designed for people seeking asylum. Cristina did most of the talking, but at the end Tomás asked me if I wanted to see the garden. Cristina had to return to the kitchen, which was her responsibility this week. For his part, Tomás had been the encargado of the garden, in charge of it, he told me, since they arrived.

He showed me the radishes, the calabazas, the zanahoria. He showed me what remained of the tomatoes and chiles that got blasted by the cold. He showed me the lombrices, earthworms burrowing in the composting soil topped with banana peels. As he showed me all the plants, Tomás talked about how much he loved farming, how much he loved planting seeds, how much he liked caring for these plants and watching them grow. In Guerrero he had tended his milpa (small parcel of land) of squash, beans, and corn every day. As he spoke, I tried to envision his rural mountain community; over the years I have met many campesinos, small farmers, across southern Mexico, in his state of Guerrero, in Oaxaca, in Chiapas. Having knelt in the soil of the milpas before, I understood how this small garden in Nogales was like a sanctuary, especially in the face of a scary situation, as Cristina and Tomás had told me, away from home, away from your roots, your child’s life in danger, wondering if you would get asylum. When they arrived six months earlier, they applied for asylum on the glitchy, confusing, and difficult-to-use CBP One app with the help of staff at the Casa, a service they offer to all people staying in the shelter. Tomás told me that when things got stressful, “I come here to the garden. And the stress goes away.” He made a motion with his hand. His hand then touched the soil, searching for the plants. He looked up, and his face was serene.

From where we talked in the garden, we had a sweeping view of Nogales. The Casa is perched on a hill above a working-class neighborhood called Bella Vista, where the bustle often starts in the early morning as maquila workers head to the factories. For line workers making Samsonite suitcases, General Electric lightbulbs, or Masterlocks, the wages are a pittance—giving Nogales a feel of a city in constant strain and struggle.

Also, from the Casa you can look north toward the border with Arizona. Last Thursday, President Joe Biden and Donald Trump came to the border in “dueling visits,” but in faraway Brownsville and Eagle Pass, Texas. People like Tomás and Cristina and family were in the news again, not as their full human selves but as flat numbers and statistics. The “narrative of overwhelm,” as Erika Pinheiro put to The Border Chronicle in an audio interview, was full steam ahead. Alarmist rhetoric filled the airwaves, including the omnipresent “record numbers” of people crossing in every report. In Brownsville, in a proposal that might have seemed like fiction if we went back in time to the 2020 campaign, Biden challenged Trump to “show a little spine” and help him tighten the border by supporting the enforcement-heavy border bill shot down by the Senate in early February. For Trump’s part, he referred to people crossing the border as the “Joe Biden invasion”and as a “vicious violation to our country.” At this point in a heating-up U.S. presidential campaign, the age-old depiction of migrants as either dangerous or a mass of faceless numbers arriving to the benevolent U.S. doorstep was in full effect. More enforcement, both sides were clearly stating, was the solution.

Tomás knelt down to the soil. He showed me the garlic and onions he had planted as an experiment. “Do you want to try a radish?” he asked me in Spanish. “Yes,” I said, “please.” He plucked a radish out of the soil. I wiped off the soil and took a bite. I don’t know if it was because I was hungry (I was), or if it was the force of the stories Tomás and Cristina had shared (probably that too), or just watching Tomás work the soil, tenderly touch the plants, his face soft and concentrated, the perils of asylum-seeker limbo temporarily forgotten, that I knew that this type of care would render something delicious. The radish was so succulent that I finished it too quickly, but I was too bashful to ask for another, even though I wanted one. We could still hear the voices of playing kids coming up from below; there were people from all over Mexico, from Central America, from Peru, Colombia, and from across the world like China, Iran, and Senegal. Before talking with Tomás and Cristina, I visited the tortillería, where three young men worked making tortillas. I visited a workshop where people made weavings and other art projects. 

I visited a gigantic bread oven—where people from different countries baked bread in their own traditions, and I visited the kitchen and dining room where banners celebrating the Chinese New Year hung from the walls. One new year celebratory sign read in English, “Be patient, Be light, Be love, Be you!” Another read in Spanish, “La amabilidad es la llave de todas las fortunas” (Friendliness is the key to all fortune). 

The shelter is run by its director, Alma Angélica Macías, but the effort was a community one, and a binational one. I was there with a small group of people from the Good Shepherd UCC church in Arizona who bring food to the Casa every Thursday. And given that the shelter allows people to stay as long as the asylum process takes, the Casa had a feel of a multinational hub where people of different nationalities had formed deep bonds, and as I stood there with Tomás, I was moved by this beautiful, alternative view of the border that rarely sees the light of day in the media.

Right as I was about to leave the garden, Tomás’s 20-year-old son came to ask him a question. Tomás introduced me to Carlos, and as I looked into his young face, I remembered the threats to his life that had led them there. As I stood waiting, they talked among themselves, and I thought again about the presidential race, the constant push for more border enforcement, the rightward drift of that debate, the talk that the U.S. government was going to clamp down even harder on asylum seekers—all while watching the father and son talk in calm, sweet tones in that lovely garden. When they were finished, there was a pause. One last moment to take in the garden and the sweeping view around us. I used the pause to thank Tomás for showing me the garden, for showing me his gift with the land. I didn’t know what to say except that I thought it was beautiful and that I felt inspired. And then—after a quick, tender, and vulnerable look to young Carlos, who was still by his side—Tomás told me, as if he didn’t want to have to say it, “I hope they give us asylum.”

As I often say, we can diminish ourselves as a nation, (as both Trump and Biden are doing with their “misleading dehumanizing rhetoric” and spineless “scapegoating”), but it won’t stop human migration. Dehumanization and victimization in the end highlight the humanity of the victims while diminishing the dehumanizers.

Notably, this family has spent months trying “to do things the right way” by scheduling an appointment through the woefully inadequate “CBP One App” and appointment system. Yet, it appears that they have not even been given the interview to which they are entitled by law, nor have they been given a date for the fair merits adjudication they deserve! 

The immense backlogs that everyone complains about (and which actually hurt legitimate asylum seekers like Tomás and his family) are largely self-created by years of USG over-investment in ridiculously expensive and ultimately ineffective enforcement accompanied by grotesque “under-investment” in timely, professional, and humane screening and adjudication of claims. 

Both Biden and Trump know or should know that “the app” and the system it engenders are hopelessly defective. Yet, rather than moving to fix it (Biden) or urging supporters to invest in fixing it (Trump), both candidates shamelessly dump on the victims of their joint misfeasance and urge “further punishment” of those victims, apparently to “CTAs” for their own legal and moral failures. 

Such is the “bogus border debate” — actually not a “debate” but rather a “one-sided nationalistic lie-fest” highlighted by obscene finger-pointing and journalistic malpractice on a catastrophic scale. All this happens with human lives and the very future of our democratic republic hanging in the balance!

Eventually, the judgement history on this disingenuous “bipartisan exercise in neofascism” will fall on the shameless politicos, the complicit media, and those who fail to call them out for their lies and misdeeds. Whether that judgement will come in time to save Tomás, Cristina, Carlos, and others like them seeking only justice and humanity from our nation is a different question. Like Tomás, one can only hope!

On January 22, 2021, two days after President Joe Biden’s inauguration, then SF Chron reporter Tal Kopan ran an extensive, well-documented expose of the widespread sexual harassment problems at EOIR, the home of the U.S. Immigration Courts at the USDOJ. The story was picked up by other publications. Also, it was highlighted in that day’s edition of “Courtside,” along with a strong suggestion for immediate action addressed to incoming AG Judge Merrick Garland and AAG Vanita Gupta (a former, now very former, “civil rights maven”), both of whom had been nominated but not yet confirmed. It now appears that Monaco’s efforts at reform have been just as lackadaisical as her implementation of Biden’s Executive order on regulations improving the treatment of gender-based claims at EOIR and elsewhere in Government, and her and her boss’s disturbingly inept approach to EOIR reform generally! 

True, many of the actual incidents covered by the complaint in this case happened before Biden took office. But, the plaintiff’s termination by EOIR and her filing of administrative complaints that appear to have been “brushed off” by DOJ took place in 2021 and 2022, after Garland and Monaco assumed office and well after the endemic problems with sexual harassment at EOIR were public knowledge. 

Yet, even with clear notice of the festering problems and an opportunity to address them in a way that would “change culture,” it required the institution of a Federal lawsuit by the plaintiff to obtain action and an effective remedy, almost three years after her termination.

After years of overt anti-asylum bias and misogyny from Sessions and Barr, long suffering respondents, practitioners, and many EOIR employees expected a “due process/good government renaissance” under former Federal Judge and Supreme Court nominee Merrick Garland. However, despite a few improvements, Garland has “floated above” the chaos and lack of quality control that daily vex and plague those trapped in his dysfunctional, hopelessly backlogged “courts.”

It’s difficult to quantify the actual costs of EOIR mismanagement by Garland and his political lieutenants. After all, how do you put a money value on wrongful deportations, denial of constitutional rights, being subjected to substandard anti-immigrant decision making, bad precedents, “Aimless Docket Reshuffling” (“ADR”) on steroids, poorly trained judges, years stuck in limbo without the relief to which you are entitled, the effect of statistics manipulated to downplay the number of legal refugees stuck in EOIR’s hellish 3 million+ backlog, “courts” intentionally located in obscure inaccessible locations within the “New American Gulag” (“NAG”) run by DHS, and the overall “customer unfriendly” and often intentionally coercive mess to which those who practice before EOIR and those whose fate is in EOIR’s hands are subjected every working day? You can’t!

Nor is the waste of finite USG resources on chronic structural inefficiencies, boneheaded schemes to expedite dockets as “deterrents,” and ill-advised “defenses of the indefensible” in Federal Courts easy to value. But, in this case, we can quantify the cost to taxpayers of Garland’s and Monaco’s poor leadership — $1.2 million!

I wonder how many qualified accredited representatives a real problem solver and due process innovator like Professor Michele Pistone at VIISTA Villanova could train with that kind of money? 

The poor leadership of Garland on immigration matters and the lousy performance of EOIR continue to be drags on the Biden Administration and our justice system. It didn’t have to be this way!

No Longer in the Cast: Former Associate AG Vanita Gupta, who left DOJ after three years of “failing to connect the dots” among civil rights, the rule of law, and the glaring violations of human rights and due process taking place at EOIR and the rest of the immigration bureaucracy. Literally, these abuses took place right under her nose, but apparently below her radar screen!

During Gupta’s tenure, the already horrible treatment of asylum seekers and other migrants of color within EOIR and the immigration bureaucracy actually deteriorated in many ways. Gupta is a sad, yet classic, example of what routinely happens to progressives once they are invited into the “halls of power” within the Government: They get co-opted into defending the status quo and the dangerous fiction of “revolution by evolution.” See, e.g., Perry Bacon, Jr., https://www.washingtonpost.com/opinions/2024/02/06/equity-diversity-inclusion-progressivism-limits/.

Just ask neo-Nazi Stephen Miller how “revolution” really works! He spent every day of his tenure in the Trump Administration single-mindedly working to dehumanize and demonize immigrants, particularly those of color and women, and to strip them of their already overly-limited rights. He paid no attention whatsoever to criticism, naysaying, and resistance from within or without. He took every “defeat” in Federal Court as an invitation to do something even worse and more outrageous.

While Gupta, despite her lofty position and civil right creds, was unable to materially improve the situation of migrants, Miller undid decades of progress on due process, racial justice, gender justice, and good government. Much of the damage he inflicted remains imbedded in the system, at DOJ, DHS, and elsewhere, as do many of those who willingly and enthusiastically assisted him.

The contrast between Gupta’s and Miller’s accomplishments and government “legacies” is a stunning illustration of the difference between Democrats and Republicans when it comes to immigrants’ rights, human rights, and racial justice — the fundamentals of governing. Democrat “political strategists” are belatedly “wondering and wandering” what to do about an “enthusiasm gap” with their core progressive voters who put Biden and Harris in office. The answer is staring them right in the face: Results matter!

The long-awaited bipartisan Senate deal on immigration contains no real reforms, such as a pathway to citizenship for undocumented immigrants. It’s all about “securing” the border.

Biden and Senate Democrats have caved to Senate Republican hardliners. Among other restrictions, the bill would make it much harder for people to apply for asylum.

On Friday evening Biden called the bill “the toughest and fairest set of reforms to secure the border we’ve ever had in our country.”

Then Biden went further — endorsing a full border shutdown. He said the bill “would give me, as President, a new emergency authority to shut down the border when it becomes overwhelmed. And if given that authority, I would use it the day I sign the bill into law.”

I very much doubt Biden would shut the border if he signs this bill into law.

So what’s going on here? The underlying politics here has nothing to do with funding Ukraine. It doesn’t have to do with reforming immigration. It doesn’t even have much to do with the practical challenge of securing the border.

It has everything to do with the 2024 election, in which border security has become a big issue.

The nation does have to take reasonable action to stem the illegal flow of immigrants. But Trump has stoked American’s fears with lies (see below).

Trump and Biden are engaged in a giant pre-election kabuki fight over the border.

Biden wants to take the border issue away from Trump and figures this bill will do it. Which is exactly why Trump doesn’t want the bill enacted. “As the leader of our party, there is zero chance I will support this horrible, open-borders betrayal of America,” Trump said on Saturday. “It’s not going to happen, and I’ll fight it all the way.”

Trump says he welcomes criticism from GOP senators. “Please, blame it on me. Please, because they were getting ready to pass a very bad bill.”

House Speaker Mike Johnson, Trump’s lapdog-in-chief, says the bill is “dead on arrival” in the House. Besides, he now says, it isn’t needed because Biden already has all the authority he needs to close the border.

Um … just last year, Johnson argued that Congress must tighten immigration laws to strengthen the president’s hand. When he was president, Trump sought similar additional authority from Congress.

Meanwhile, House Republicans are about to begin impeachment proceedings against Alejandro Mayorkas, homeland security secretary, for allegedly being too soft on border security — even though Mayorkas worked with Senate Republicans to come up with this hardline border deal.

We need to deal with the border, but Republicans are now the ones sitting on their hands because they’re beholden to Trump. We also need to deal with immigration in a humane way by offering a broad and reasonable path to citizenship, but Democrats seem to have forgotten this basic goal.

The public, meanwhile, is utterly confused by Trump’s demagoguing. Here are Trump’s biggest lies, followed by the truth.

Trump claims Biden doesn’t want to stem illegal immigration and has created an “open border.”

Rubbish. Since he took office, Biden has consistently asked for additional funding for border control.

Republicans have just as consistently refused. They’ve voted to cut Customs and Border Protection funding in spending bills and blocked passage of Biden’s $106 billion national security supplemental that includes border funding.

Trump blames the drug crisis on illegal immigration.

Bull. While large amounts of fentanyl and other deadly drugs have been flowing into the United States from Mexico, 90 percent arrives through official ports of entry, not via immigrants illegally crossing the border. Research by the conservative Cato Institute found that more than 86 percent of the people convicted of trafficking fentanyl across the border in 2021 were U.S. citizens.

Trump claims that undocumented immigrants are terrorists.

Baloney. America’s southern border has not been an entry point for terrorists. For almost a half-century, no American has been killed or injured in a terrorist attack in the United States that involved someone who crossed the border illegally.

Trump says undocumented immigrants are stealing American jobs.

Nonsense. Evidence shows immigrants are not taking jobs that American workers want. The surge across the border is not increasing unemployment. Far from it: Unemployment has been below 4 percent for roughly two years, far lower than the long-term average rate of 5.71 percent. It’s now 3.7 percent.

Trump claims undocumented immigrants are responsible for more crime in America.

More BS. In fact, a 2020 study by the Proceedings of the National Academy of Sciences, cited by the Department of Justice, showed that undocumented immigrants have “substantially” lower crime rates than native-born citizens and legal immigrants. Despite the recent surge in illegal immigration, America’s homicide rate has fallen nearly 13 percent since 2022 — the largest decrease on record. Local law enforcement agencies are also reporting drops in violent crime.

Since he entered politics, Donald Trump has fanned nativist fears and bigotry.

Now he’s moving into full-throttled neofascism, using the actual language of Hitler to attack immigrants — charging that undocumented immigrants are “poisoning the blood of our country” and saying they’re “like a military invasion. Drugs, criminals, gang members and terrorists are pouring into our country at record levels. We’ve never seen anything like it. They’re taking over our cities.” He promises to use the U.S. military to round up undocumented immigrants and put them into “camps.”

The parallels with Nazi Germany are chilling. In 1932, the canny Nazi propagandist Joseph Goebbels called for “a thick wall around Germany,” to protect against immigrants. “Certainly we want to build a wall, a protective wall.”

Trump and his enablers want us to forget that almost all of us are the descendants of immigrants who fled persecution, or were brought to America under duress, or simply sought better lives for themselves and their descendants.

Immigration has been good for America. As the median age of Americans continues to rise, we’ll need more young people from around the world.

The central question shouldn’t be how to secure our borders. It should be how to create an orderly and humane path to citizenship.

Question: Is there anything more absurd than red state governors rejecting federal programs that directly benefit their constituents?

Easy answer: Yes. It’s the explanations they give to make their actions appear to be sober, responsible fiscal decisions.

The Republican governors of Iowa and Nebraska brought us the most recent examples of this phenomenon just before Christmas.

The issue in both states is a summer food program that provides $40 a month per child in June, July and August to families eligible for free or reduced-price school meals.

The program is known as the Summer Electronic Benefit Transfer Program for Children, or Summer EBT. Its purpose is to give the eligible families a financial bridge during the months when their kids aren’t in school.

The governors didn’t see it that way. Here’s how Iowa Gov. Kim Reynolds justified her decision to reject the federal subsidy

for low-income Iowans: “Federal COVID-era cash benefit programs are not sustainable and don’t provide long-term solutions for the issues impacting children and families.”

Nebraska Gov. Jim Pillen’s explanation was,

“I don’t believe in welfare.”

Both governors said their states already had programs in place to address food needs for low-income families, and that was enough.

It’s worth noting that the explanations by both Reynolds and Pillen are fundamentally incoherent. What does Reynolds even mean by calling the program “not sustainable”? It would be sustained as long as Congress continues to fund it, which is almost certain as long as Republicans don’t take control of both houses and kill it.

As for Pillen’s crack about “welfare,” he didn’t bother to explain what he believes is wrong with “welfare” as such; he just uttered the term knowing that it’s a dog whistle for conservative voters aimed at dehumanizing the program’s beneficiaries.

What makes these governors’ refusals so much more irresponsible is that the federal government is picking up 100% of the tab for the benefits; the states only have to agree to pay half the administrative costs. Their shares come to $2.2 million in Iowa and $300,000 in Nebraska, according to those states’ estimates.

In return, 240,000 children in Iowa would receive a total of $28.8 million in benefits over the three summer months, and 150,000 Nebraskans would receive a total of $18 million. Sounds like a massively profitable investment in child health in those states.

The governors’ defenses smack of the same strained plausibility of those statements made by banks, streaming networks and other commercial entities that explain that their price hikes and service reductions are “efforts to serve you better.”

Cowardly, irresponsible GOP governors pick on poor kids and their families.  And, the other things that might lift families out of poverty:  higher wages, shorter hours, more childcare, better health care, educational opportunities, vocational assistance, family planning assistance —   the GOP opposes them all in their totally corrupt and disingenuous “race to the bottom.” 

Just look at the amount of money GOP politicos have wasted on cruel stunts and gimmicks intended and guaranteed to make the humanitarian situation worse!

Elected officials must act to prevent more migrant deaths

The United States has the resources to welcome new neighbors, but it is going to take cooperation, from the White House to the mayor’s office, to prevent further loss of life and improve safety for migrants.

It was heartbreaking to learn of the death of 5-year-old Jean Carlos Martinez Rivero, who had been living with his family at a privately contracted Chicago migrant shelter. This tragedy must be a wakeup call for all levels of government to start working together to protect people’s basic human rights at a time of increasing global humanitarian displacement.

For months, community members raised concerns about conditions inside the city’s shelters and volunteered to help better meet migrants’ basic needs. The accounts of life inside the shelter now coming to light are disturbingly similar to those that my colleagues at the National Immigrant Justice Center hear from clients held in immigration detention centers.

The city and the companies profiting from shelter contracts must be held accountable.

No doubt, the city has been forced to face the unprecedented challenge of welcoming thousands of new neighbors with minimal support from the federal government. The Biden administration and Congress must also be held accountable to repair the broken immigration system, support cities like Chicago that are welcoming migrants, and provide legal pathways so new arrivals have access to employment, secure housing and safety.

Jean Carlos’ death occurred at the same time the Biden administration and some U.S. senators are considering signing off on extreme anti-immigrant legislation in exchange for military aid for Ukraine and Israel.

The proposals under negotiation would create permanent new barriers to asylum protection and put U.S. immigrant communities at heightened risk of mass deportations. The proposals are structured to put Black, Brown and Indigenous communities at most risk.

Biden seems to have lost sight of his prior promises to defend immigrants’ rights, not to mention the U.S. government’s obligations to uphold international human rights law. Chicagoans should be holding our own Sens. Dick Durbin and Tammy Duckworth accountable to loudly oppose these proposals.

Unfortunately, accountability seems unlikely unless it happens at the ballot box.  The GOP has become the party of inhumanity, irresponsibility, and immunity. And, although the Biden Administration and “wobbly” Dems tend to avoid overtly dehumanizing asylum seekers with their language, their actions and attitudes too often mirror those of Trump, Miller, and the GOP nativists. Indeed, quite disgustingly, politicos of both parties appear to expect to harvest political gains from the blood of migrants!   🤮

The Senate is basically engaging in “bipartisan” negations to knowingly and intentionally violate domestic and international protection laws, abrogate constitutional due process, and increase the number of unnecessary deaths of asylum seekers. That arrogant politicos, on both sides of the aisle, although primarily the GOP, openly advocate for such actions shows just how little fear of any type of accountability they have. 

In many ways, that’s precisely the message that Trump and his MAGAmaniacs have been pushing — intentionally hateful and inflammatory language, followed by horrible, sometimes deadly, actions with little or no fear of any type of accountability.  Sadly, the Dems seem to think that a program of cowardly acquiescence, rather than principled opposition, is the key to political success.

Rather than looking for ways to restrict or eliminate asylum, Congress and the Administration should be concerned about quality-control and expertise reforms in asylum adjudication, including a long-overdue independent Article I Immigration Court! Once again, the BIA violates Circuit precedent to deny asylum.

The answer to systemically unfair, (intentionally) unduly restrictive interpretations, and often illegal treatment of asylum seekers by the USG should not be to further punish asylum seekers! It should be fixing the asylum adjudication system to comply with due process, fundamental fairness, best practices, and professionalism!

Here’s a statement from the Tahirih Justice Center about the disgraceful “negotiations” now taking place in Congress:

The Tahirih Justice Center is outraged by the news that the administration appears willing to play politics with human lives. These attacks on immigrants and people seeking asylum represent not simply a broken promise, but a betrayal and we urge the President and Congress to reverse course.

“I am gravely concerned that, if passed, these policies will further trap and endanger immigrant survivors of gender-based violence.  Selling out asylum seekers and immigrant communities under the guise of ‘border security’ in order to pass a supplemental funding package is absolutely unacceptable,” said Casey Carter Swegman, Director of Public Policy at the Tahirih Justice Center. “And we know the impact of these cruel, deterrence-based policies will land disproportionately on already marginalized immigrants of color. I urge the White House and Congress not to sell out immigrants and asylum seekers for a funding deal.”

Every day, people fleeing persecution – including survivors of gender-based violence – arrive at our border having escaped unspeakable violence. Raising the fear standard, enacting a travel ban, putting a cap on asylum seekers, and expanding expedited removal nationwide (to name just a few proposals that have been floated in recent days) will do nothing to solve the challenges at the southern border and serve only to create more confusion, narrow pathways to humanitarian relief, increase the risk of revictimization and suffering, and punish immigrants seeking safety and a life of dignity.

These kinds of proposals double down on the climate of fear that many immigrants in this country already face on a day-to-day basis and will disproportionately impact Black, Brown and Indigenous immigrant communities.Immigrants should not be met with hostile and unmanageable policies that violate their humanity as well as their legal rights. We can and must do better.

These are “negotiations” in which those whose legal rights and humanity are being “compromised” (that is, tossed away) have no voice at the table as politicos ponder what will best suit their own interests.

A federal judge approved a settlement that prohibits U.S. officials from separating migrant families for crossing the U.S.-Mexico border illegally.

The settlement involves a 2018 lawsuit filed by the American Civil Liberties Union to block the Trump administration’s “zero tolerance” policy, which called for separating parents from their children to prosecute the adults for crossing the border illegally. Officials sent parents to detention centers and children to shelters, without a plan to reunite them, under the policy. Some were apart for months, some for years.

“It does represent, in my view, one of the most shameful chapters in the history of our country,” U.S. District Judge Dana M. Sabraw said before he approved the settlement in a hearing that recalled the shock and disbelief surrounding the policy in 2018.

Under the settlement approved Friday, crossing the border illegally will no longer be a reason to separate a family, at least for the next eight years, which is how long that provision will last, lawyers said. The Justice Department has said the government will not prosecute parents for crossing the border without permission, a misdemeanor, or for the felony crime of reentering after being deported.

The settlement also offers aid to once-separated families so that they may apply to stay in the United States permanently. Those who were deported may apply to come back. Their immigration records will be cleared, giving them a fresh start on applying for humanitarian protection such as asylum.

Once they are in the United States, formerly separated families may apply for three-year work permits, six months of housing assistance and one year of medical care, according to the settlement. The families also are eligible for three years of counseling under the settlement.

Sabraw, a Republican nominee, declared the separations unlawful and ordered the families reunited in June 2018, after President Donald Trump halted the policy amid widespread condemnation.

Trump’s zero-tolerance policy ran from May to June 2018. Later, investigations determined that officials separated migrant families throughout Trump’s four-year term, which ended in January 2021.

Biden administration officials said the Trump administration separated more than 4,000 children from their parents, though past estimates have put that figure as high as 5,500. Lawyers for the ACLU, which represented the migrant families in court, estimated that as many as 1,000 children may still be separated from their parents. Advocates are trying to track them down.

The ACLU has called the case the most significant settlement in the organization’s 103-year history.

“This settlement brings much needed help to these brutalized children but there remains significant work to ensure that every family is now reunited and to monitor that no future administration tries to circumvent the agreement and reenact the same horrific policy,” Lee Gelernt, an ACLU lawyer and the lead counsel in the case, said in a statement.

The human and fiscal costs of this illegal policy, developed and implemented by GOP White Nationalist child abusers, is beyond comprehension! Some of the damage can never be repaired!

Notably, there has never been any accountability for the architects of this clearly unconstitutional abuse and the Government attorneys who failed to do “due diligence” and misrepresented the facts surrounding child separation in Federal Court. The truth was only brought out when the ACLU was forced to do the DOJ’s job for it! It’s also curious how a prohibition on clearly unconstitutional conduct could have only an “eight year shelf life.”

But, there are even worse developments on the horizon — immoral, illegal, and unconscionable policies under consideration that will dwarf even this horrible episode in terms of  preventable deaths, disregard for humanity, dereliction of duty, moral cowardice, and degradation of our nation!

Wrong, if you are a Republican in Congress. Here, let Sen. John Cornyn (R-TX) explain: “I think … Schumer will realize we’re serious … and then the discussions will begin in earnest.”

If you are still having trouble with the concept, I’ll translate for you: “Yes, we understand and agree that Russia cannot be allowed to take over Ukraine, and we will fund aid to Ukraine, but in exchange, we insist on fundamental changes to our immigration laws to make sure no more Brown people come to America, starting right effing now.” (“Brown,” in this context, means anyone who is poor, Latin American, Asian, African, non-Anglophone…you get the idea.)

How will this play out in the next few weeks? I see three options: 1) Biden and the Dems cave, so the 1980 Refugee Act is scrapped, Dreamers get deported, the southern border is further militarized, and the economy tanks because a good chunk of the workforce is afraid to come to work; or 2) the GOP does a Tuberville and caves; or 3) the Unknown Unknown.

Thanks for telling it like it is, Dan! There is no validity to the GOP’s attempt to punish asylum seekers by unconscionably returning them to danger and death with no process.

The cruelty and threat to life from forcing desperate seekers to wait in dangerous conditions in Mexico, pushing them to attempt entry in ever more deadly locations along the border, detaining them in inhumane substandard prisons in the U.S., and or returning them without meaningful screening by qualified independent decision-makers is overwhelming. That Congress, the Administration, and much of the “mainstream media” choose to ignore, and often intentionally misrepresent, truth and reality about the horrible human and fiscal wastefulness of “border deterrence” doesn’t change these facts!

Casket makers expect a huge boon from the deadly “border negotiations” going on in the U.S. Congress. But, the bodies of many of the victims of U.S. cruelty and blatant trashing of human and legal rights of asylum seekers might never be located. Those about to be sacrificed for political ends have “no voice at the table.” This is a monument for those who have died attempting to cross the US-Mexican border. The Administration’s three year failure to build a functional, robust asylum system at the border with humane reception centers, access to legal assistance, a rational resettlement system, and sweeping, readily achievable, administrative reforms and leadership changes at EOIR and the Asylum Office (as laid out by experts, whose views were dismissed) is also inexcusable. 

Yet, the media misrepresents this farce as a “debate.” It’s a false “debate” in which neither disingenuous “side” speaks for the endangered humans whose rights and lives they are bargaining away to mask their own failures and immorality.

Anyway, the former Speaker added a new entry to the “What kind of cringey stuff is Kevin up to today” archives on Sunday, when he posted a video to his X account in which he made clear that his knowledge of US history leaves…a lot to be desired!

Appearing in a tuxedo at an unnamed event—possibly a gathering of politicians who had their lips sewn to the worst president in modern history’s ass, possibly not—McCarthy declared: “In every single war that America has fought we have never asked for land afterwards except for enough to bury the Americans who gave the ultimate sacrifice for that freedom we went in for.”

This, of course, is not true at all. After the Revolutionary War, the US doubled in size due to land relinquished by the British. After the Mexican-American war, the US took possession of present-day states California, Nevada, New Mexico, Utah, most of Arizona and Colorado, and parts of Oklahoma, Kansas, and Wyoming. And after the Spanish-American War the US took over Guam, Puerto Rico, and the Philippines.

Is McCarthy’s blunder embarrassing? Hugely! Is basic knowledge of this country’s history, how our government functions, and other lessons children learn in school a prerequisite for being a member of the modern Republican Party? Well, as his colleagues can attest, obviously not.

Some Republican lawmakers are flagging Hamas’ attack on Israel as an example of why more security is needed at the southern U.S. border. Hamas militants breached a border fence and attacked Israeli villages bordering the Gaza Strip on Oct. 7.

“Potential terrorists are attempting to cross our southern border. In September alone, 18 illegal immigrants on the terror watchlist were caught at the border,” U.S. Sen. Marsha Blackburn, R-Tenn., posted Oct. 21 on X. “The attack on Israel should serve as a warning as to why we must secure the border.”

The next day, U.S. Rep. Kevin McCarthy, R-Calif., also mentioned the terrorist watchlist on NBC’s “Meet The Press.”

“We just caught 18 people, just last month, on the FBI terrorist watchlist, coming across our border,” McCarthy said. “More than 160 have done it this year, a record breaking.”

U.S. immigration officials have encountered rising numbers of people on the watchlist. But not everyone on the list is a terrorist, and not everyone encountered is allowed to enter the country.

Terrorism and immigration experts say that the threat of attacks in the U.S. and Israel are incomparable.

“They both involve borders, but the comparison ends there,” David Bier, an immigration expert at the libertarian Cato Institute, previously told us. “People aren’t crossing the border to conduct terrorist attacks or take over parts of the United States. A very small percentage may come to commit ordinary crimes, like selling drugs, but overwhelmingly, they are coming for economic opportunity and freedom.”

McCarthy’s office did not respond to our query for more information. A Blackburn spokesperson pointed us to a Fox News reporter’s post on X. Customs and Border Protection did not confirm whether 18 people were stopped in September.

Of course border security is important! A significant, achievable improvement would be to establish a fair, timely, functional asylum screening and adjudication system at ports of entry so that those seeking asylum will be motivated to use it (rather than attempting  to “punish” and “deter” those who can’t use the current dysfunctional DHS/EOIR “system.”) That would give CBP a chance to concentrate on the real law enforcement challenge: identifying and stopping those who seek to harm the U.S. That’s going to take even better intelligence and more sophisticated efforts.

I also wouldn’t minimize that, as pointed out by the experts, CBP has been able to identify and deny entry to individuals on their list. That’s a sign of success, not failure!

To state the obvious, further cutting or restricting asylum (as many in the GOP disingenuously advocate) would only force even more of those seeking refuge into the hands of smugglers and push them into the dangerous lands between ports of entry. Misdirecting enforcement resources to fruitlessly and improperly trying to “deter” and “apprehend” those legitimately seeking refuge will only further dilute the attention that CBP can pay to any real dangers lurking at the border!

There’s a lot that’s concerning!

On October 25, after several weeks that saw dysfunction, chaos, humiliation, and anonymous threats to at least one lawmaker’s wife, Republicans finally elected a Speaker of the House to succeed Kevin McCarthy: Mike Johnson, a representative from Louisiana who has the distinction of being the least experienced Speaker in more than a century.

At the time of Johnson’s accession, a lot of Americans likely had no idea who he was; actual Republican senator Susan Collins, for one, told a reporter she didn’t know Johnson but planned to remedy that by googling him. And if you weren’t familiar with Johnson, you might’ve assumed that that was maybe even a good thing—that he was just a quiet Republican who hadn’t gotten wrapped up in the insanity plaguing the GOP over the last seven or so years. He didn’t have the name recognition of, say, Jim Jordan or Matt Gaetz, but perhaps that simply spoke to the fact that he wasn’t leading a series of absurd hearings in an attempt to take down Joe Biden; or bragging about being so devoted to Donald Trump that he answered his phone calls during sex. Maybe, you might have thought, he wasn’t someone you’d have to constantly worry about re: undermining democracy or trying to take away people’s rights.

Unfortunately, that is not the case with Johnson, who may not have been well known prior to being given one of the most powerful jobs in government but is very much someone whose extremist views and actions should keep you up at night.

Herein, a running list of the absolute most WTF things the new Speaker has said and done on everything from the 2020 election to abortion to LGBTQ+ rights and more.

Abortion

Johnson is proudly antiabortion. When Roe v. Wade was overturned last year, he called it “a great, joyous occasion,” later writing, “We will get the number of abortions [in Louisiana] to ZERO!!” As an attorney for the Alliance Defense Fund, now known as the Alliance Defending Freedom, he worked on efforts to shut down abortion clinics in the state. In Congress, he cosponsored legislation that would have banned abortions at about six weeks of pregnancy, i.e., a time when many people do not even know they’re pregnant. He’s beloved by the antiabortion organization Susan B. Anthony Pro-Life America, which has given him an A+ rating. In 2015, he blamed school shootings on abortion, telling writer Irin Carmon, “When you break up the nuclear family, when you tell a generation of people that life has no value, no meaning, that it’s expendable, then you do wind up with school shooters.”

In some real Handmaid’s Tale shit, he declared during a House hearing that if women were forced to have more children, a.k.a. “able-bodied” workers, there would be more funding for Social Security and Medicare:

On at least one occasion, he declared that doctors who perform abortions should be sentenced to “hard labor”:

Oh, and like many antiabortion zealots, Johnson doesn’t seem to like contraception either.

LGBTQ+ rights

Hoo boy, where to start? Here are some things that Johnson has said about LGBTQ+ people, same-sex marriage, and gay sex between consenting adults:

In his work as an attorney for the Alliance Defense Fund, Johnson also argued in court that same-sex couples should not receive domestic partnership benefits, and officially opposed the Supreme Court’s decision to decriminalize gay sex between consenting adults. In the Louisiana House of Representatives, he proposed a bill that critics say would have made it easier to discriminate against LGBTQ+ people. (In response, he claimed he was not a “bigot,” adding: “I know that I brought this bill for the right reason.”) Meanwhile, in Congress, he introduced a national bill seemingly modeled after Florida’s “Don’t Say Gay” law; voted against the 2022 bipartisan bill to codify gay marriage; and last year cosponsored a bill making it a crime to provide gender-affirming care to anyone under 18, despite the American Academy of Pediatrics backing such care.

“I would be hard-pressed to think of a worse member to be elected Speaker of the House,” Allen Morris, policy director for the National LGBTQ Task Force, told The 19th.

Separation of church and state

If you guessed that Johnson doesn’t believe in it, you guessed right. In April—as in, just a few months before he was elected Speaker—the congressman railed against what he referred to as the “so-called separation of church and state,” saying, “The founders wanted to protect the church from an encroaching state, not the other way around.”

In 2018, Johnson argued for prayer in public schools.

Evolution

In addition to blaming abortion for mass shootings, Johnson has also claimed that the teaching of evolution has played a part. In a 2016 sermon, he told the audience, “People say, ‘How can a young person go into their schoolhouse and open fire on their classmates?’ Because we’ve taught a whole generation—a couple generations now—of Americans, that there’s no right or wrong, that it’s about survival of the fittest, and [that] you evolve from the primordial slime. Why is that life of any sacred value? Because there’s nobody sacred to whom it’s owed. None of this should surprise us.”

In related news, a year prior, Johnson filed a lawsuit for an organization to receive tax subsidies to build a Noah’s Ark–focused theme park in Kentucky. “When the Ark Project sails, everybody will benefit,” he wrote in an op-ed, “even those who are stubbornly trying to sink it.” The Ark Encounter is operated by a fundamentalist Christian group that believes in creationism.

Climate

Where does Johnson, not exactly a man of science, land on global warming? Well, per The New York Times:

Representative Mike Johnson of Louisiana, the newly elected House Speaker, has questioned climate science, opposed clean energy, and received more campaign contributions from oil and gas companies than from any other industry last year. Even as other Republican lawmakers increasingly accept the overwhelming scientific consensus that human activity is dangerously heating the planet, the unanimous election of Mr. Johnson on Wednesday suggests that his views may not be out of step with the rest of his party.

A former constitutional lawyer, he does not sit on committees that decide the fate of major energy issues. But he has consistently voted against dozens of climate bills and amendments, opposing legislation that would require companies to disclose their risks from climate change and bills that would reduce leaks of methane, a potent greenhouse gas, from oil and gas wells. He has voted for measures that would cut funding to the Environmental Protection Agency.

In 2017, Johnson opined: “The climate is changing, but the question is, is it being caused by natural cycles over the span of the earth’s history? Or is it changing because we drive SUVs? I don’t believe in the latter. I don’t think that’s the primary driver.”

The 2020 election

By now you’ve likely heard that Johnson spent a significant amount of time and energy trying to overturn the 2020 election—an effort that included leading the amicus brief signed by more than 100 GOP lawmakers that asked the Supreme Court to overturn the 2020 election results in Georgia, Michigan, Wisconsin, and Pennsylvania. Johnson also objected to the certification of Biden’s win on January 6; his arguments for doing so were adopted by a significant number of Republicans, leading the Times to call him “the most important architect of the Electoral College objections.” One day prior, per Politico, he told colleagues, “This is a very weighty decision. All of us have prayed for God’s discernment. I know I’ve prayed for each of you individually,” before pressing them to oppose the Electoral College results. Oh, and he was a Dominion truther:

MAGAMike often pretends as if the his interpretation of the Bible, not the Constitution or the Declaration of Independence, were our founding document. 

But, believe it or not, the founding fathers were actually “revolutionaries,” not “reactionaries,” who overthrew tradition to arrive at a different place. In the process they incorporated what in those days were some “enlightenment” ideals to replace “traditionalist” regressive principles like the “divine” right of kings and a purely hierarchical society where there was no escape from the status assigned at birth!

One can debate the exact religious beliefs of the founders. But, they certainly foresaw a non-static society, open to change, and tolerating more than one viewpoint. They weren’t theocrats, and they weren’t wedded to the view that society can’t change and evolve to adapt to new norms and practical realities.

One could read the teachings of Christ as promoting love, kindness, tolerance, forgiveness, perspective, and siding with society’s outcasts. MAGAMike and his zealots appear to have a quite different “take.” That’s their prerogative. But, they shouldn’t be allowed to impose their peculiar, wayward views on the rest of us.

Faced with his first national tragedy, and a chance to show some real guts, leadership, and humane, common-sense principles derived from Christianity, all the self-professed “Man of God” and “protector of the unborn” (but “rejector of the  born”) could muster was the same old trite “hearts and minds” garbage that flows from spineless GOP politicos. Compare MAGAMike with Rep. Jared Golden (D-ME) who apologized and changed his position to favor an assault weapons ban. And that’s because so many in the party — elected officials and voters — won’t be led. Republicans have the majority in the House, but it’s a majority in name only. In reality, the House Republicans are an amalgam of competing factions, from right to far-right to extremist, and party members genuinely loathe one another more than they dislike Democrats.

Conservative media and social media stardom have turned even the most junior and otherwise inconsequential figures — say, Florida Rep. Matt Gaetz, the architect of this speaker-less anarchy — into power brokers who insist on having their sway. Like-minded conservative voters — small-dollar donors steeped in Fox News — bankroll the chaos agents; Rep. Marjorie Taylor Greene, that Georgia peach of a provocateur, is among Congress’ most successful fundraisers.

Here’s how insurgent and “Beetlejuice” fan Rep. Lauren Boebert of Colorado explained why House Republicans have failed to agree on a speaker: “There are 224 alpha males and alpha females who are here in the Republican Party. We are here because we convinced hundreds of thousands of people that we are leaders.”

No matter how this speaker mess ends — and it must somehow end — that perverse reward system will remain. And the House under Republican “leadership” will be all but ungovernable through the 2024 election.

Former Speaker Nancy Pelosi had a similarly thin Democratic majority yet managed to keep her party factions united and to shepherd into law major legislation, some of it bipartisan. But here’s the difference: Democrats believe in governance. Too many Republicans do not; their credo has shifted over the last quarter century from small government to anti-government. We’re watching the result.

Again, take it from a Republican: “Frankly, it doesn’t matter who the speaker is,” Rep. Mike Lawler of New York said, “because if we [Republicans] can’t govern as a group, as a conference, it doesn’t matter.”

Jordan, true to his brand as a belligerent, on Friday insisted on a third House vote for speaker. As widely predicted, he lost by even more votes than on the earlier ballots. He and his allies talked of pressing his candidacy through the weekend; after all, McCarthy was elected in January on the 15th ballot. But in a closed-door caucus and with secret ballots, Republicans voted to yank Jordan’s nomination as speaker.

His refusal to accept that he was not going to be speaker until the reality was forced on him was hardly a surprise. Jordan still won’t concede that Donald Trump lost reelection. He declined to do so yet again at a news conference Friday morning. His stubborn opposition to democracy — that’s what it is — only underscored why Jordan should never be the speaker.

The sad fact, however, is that Jordan’s reprehensible role as Trump’s chief congressional lieutenant in the run-up to the Jan. 6, 2021, insurrection wasn’t even much of a factor in opponents’ thinking. Nor was the fact that as speaker, this unrepentant election denier could have sabotaged the certification of the 2024 presidential vote if the Republican lost.

Instead, the reasons Jordan’s foes gave were personal, political or both. Some blamed him for stoking the death threats against them and their families. One, Rep. Drew Ferguson of Georgia, said Republicans don’t “need a bully as the speaker.”

But they need someone — the country needs someone — so Congress can function. Government funding runs out Nov. 17. Biden is sending a request for aid to Ukraine and Israel. Other essential legislation, including agriculture and defense bills, are pending.

Many Republicans are trying to shift the blame for the fiasco onto Democrats because they all opposed McCarthy and then Jordan — as if Republicans would’ve voted to retain Pelosi had an insurgent Democrat ever moved, like Gaetz did against McCarthy, to unseat her.

But they know the blame actually lies with themselves — thus the name-calling and near-fisticuffs.

They need to come together, if only temporarily. And then voters should fire them in 2024.

Totally classless and obstructionist till the end, Jordan forced his colleagues to vote to rescind his never-viable nomination for Speaker after losing three floor votes by increasing margins. By contrast, Scalise, the Conference’s initial nominee over Jordan withdrew without a vote upon determining that he lacked the votes to win the job.

Yet, inexplicably, some in the “mainstream media”continue to treat the GOP as a “normal” opposition party. In one of a continuing string of jaw-droppingly poor choices for guests, NBC’s Kristen Walker gave deposed ex-Speaker McCarthy a forum to engage in a “Trumpian liefest” of mythic proportions, outrageously attempting to blame Dems, the Border, Biden, Jeffries, the GOP insurrectionists he empowered, and just about anyone but himself for the debacle he helped engineer and his morally bankrupt party carried out!

Every viewer should have felt dumber after watching Welker fruitlessly try to control the astounding stream of lies, nonsense, doublespeak, and intentional misrepresentations coming out of McCarthy. Honestly, that’s what Fox News, Breitbart, and the Examiner are for! No need to give shallow politicos with absolutely nothing to contribute another forum! I’ve always been a Kristen Welker fan, but her first month as moderator of Meet the Press can only be described as something between tragic and horrible.

As Calmes says, “fire [the GOP] in 2024.” The future of America, the world, and humanity might depend on the n common sense and decency of the majority of voters!

Some Republicans Lose Faith In Jim Jordan

Republicans are starting to lose faith in Jordan, several of them told reporters after the Ohio congressman failed to muster enough support during the first round of voting.

Rep. Carlos Gimenez (Fla.), who voted against him, called Jordan’s chances “shaky,” while Rep. Michael McCaul (Texas), who voted for Jordan, said he does not “see how he can recover” with so many defectors on the first round of voting.

Jordan’s supporters also told Fox Newsthat they’re losing confidence in him. “I’m afraid there will be more votes against him,” an unnamed senior Republican told the network.

At least for the moment, the far right/Fox News threats and high pressure campaign appears to have backfired. But, the process isn’t over. And, that 200 Republicans voted for this spectacularly unqualified candidate for Speaker is bad for America.
