A New Report Shows Skyrocketing Deaths in El Paso, New Mexico Border Region

As safe corridors for migration disappear, more people risk their lives crossing the U.S.-Mexico border. And more people die. A new report by the nonprofit No More Deaths, along with a searchable map and database, documents the increasing number of migrant deaths at the border in New Mexico and far West Texas. Until now, not much research has been done on the deaths of people migrating through this section of the border. The project was led by Bryce, a No More Deaths volunteer (who asked that we not use his last name because the Far Right has recently been targeting the group). He, along with several others, have created the most comprehensive database to date of deaths in the Border Patrol’s El Paso Sector, which includes New Mexico and two counties in Texas, El Paso and Hudspeth. The report covers 15 years, from 2008 to 2023, and it shows many disturbing trends, including the acceleration of deaths that has accompanied “prevention through deterrence,” the U.S. government’s strategy implemented in the 1990s to push migrants into more remote, dangerous crossings. That strategy is now morphing into something all the more tragic as people, increasingly women and children, are barred from accessing asylum and are dying at the doorstep of American cities and towns. In this Q&A, Bryce talks about documenting these deaths, and the discoveries that both shocked and angered him in creating this new report.

Why did you study this particular part of the border in New Mexico and far West Texas?

A couple of years ago, a few of us started getting interested in what’s happening in New Mexico, and whether there’s any need for humanitarian aid out there, just because we hadn’t really heard anything but assumed there must be something happening out there. Quickly, we noticed that there was not much data in general about the area. So I started doing public records requests. And pretty quickly, just with the first batch of data, we got about 20 deaths for 2022. We went to some of those locations to see if we’d see trails. And while we were checking out some of these locations, we found human remains right across the street from a cemetery and about 50 feet from a main road in Sunland Park [New Mexico]. It was not a remote place. It was right in town. So we started looking at the Sunland Park Fire Department’s social media page, and quickly realized that there was a lot happening and quickly. And then 2023 ended up being this record deadly year for the area.

It’s shocking that you found a dead person right there in the middle of Sunland Park. Can you tell me more about this person? Were they identified? How long had the person been there? And how could this have been missed by people who live there?

He was later identified as a man from Colombia. [His name was Johan Orozco Martinez, age 36.] He had been there for a couple of days. I’m not joking when I say he was right across the street from the Memorial Pines Cemetery, and near the shoulder of the road. Many cars drive this road, but I think typically people look toward the cemetery, and I guess they didn’t see him because they were looking in the other direction. He was in his 30s and so older than many of the usually young men you see, for instance, crossing through southern Arizona.

Two findings that really stand out to me from your report are the number of women who have died, and how increasingly people are dying within city limits and no longer just in remote areas that are hard to access. I mean, you found a person in the middle of Sunland Park. What’s going on, do you think?

The dynamics of migration are complex. But one thing that seems pretty clear is that the asylum policies in the last few years have led to an increase in some of these deaths, just from people trying to get asylum and being prevented either by metering or by turnbacks. And then feeling they have no choice but to cross through the desert. A lot of people who are crossing are older, they’re women, they’re people with health problems. The demographics, we found, were much different in the El Paso sector than in southern Arizona, with people being older and more than 50 percent of the deaths in 2023 being of women, which is unusual.

When did the deaths start increasing? And has the increasing militarization of the border and Operation Lone Star in El Paso contributed to these deaths?

Up until 2015, there were very few deaths in this area. But especially since 2018, the deaths have just been ramping up every single year. We were in New Mexico watching Operation Lone Star soldiers put up a barbed-wire fence between New Mexico and El Paso in an area where a lot of people cross. So once you’re in the United States, even crossing into Texas from the New Mexico side has become more deadly. And you can see National Guard in El Paso patrolling and pushing people back. The more enforcement, the more the deaths increase. In El Paso, there are what I call “moats” because if people climb the border wall, there’s an irrigation canal right on the other side, which at times can be moving very quickly. Then beyond that there’s multiple highways and more canals. So if someone is being chased by Border Patrol or Operation Lone Star, there are multiple deadly obstacles.

In 2022 there was a two-week period when 15 people died in the canals, one right after the other. This was during irrigation season in El Paso. Water is released from a reservoir in New Mexico into the canals and the river to irrigate farmland further east of El Paso. When that happens, the water can be going like 20 miles per hour. Unless somebody physically rescues you, there’s no way of getting out once you’ve fallen in. I watched a news broadcast in El Paso where they made a public service announcement about drowning deaths in El Paso, saying like, “Irrigation season is here, stay away from the canals, watch out for drowning.” But if you read all the autopsy reports, it’s almost all migrants dying. Because the medical examiner doesn’t flag whether it’s a migration-related death, you end up getting these weird statistics about drowning deaths being on the rise in El Paso. And so they’re directing these public safety messages toward El Paso residents who are actually in very little danger of drowning. And the people who are in danger of drowning, the migrants, have no idea.

Did you also find an increase in the deaths of children?

Definitely, yes. In 2018, two eight-year-old Guatemalan kids died. There’s a lot of teenagers dying, crossing the border wall, a lot of them drowning in El Paso city itself. For instance, there was a Russian man and his teenage daughter who both fell into a canal and drowned. They were running from Border Patrol agents. I believe that happened in 2021. We saw fewer deaths of younger people in New Mexico.

You also found that Customs and Border Protection is significantly undercounting deaths related to enforcement. Can you talk about this finding?

CBP is supposed to keep track of migrant deaths and CBP enforcement-related deaths, but we found that the agency is severely undercounting them. There’s been a lot of documentation in the past, talking about that fact, but there hasn’t been a whole lot of quantifying that undercount. Aside from the Arizona data that the Pima County Office of the Medical Examiner and Humane Borders have reported. For example, in one year we found 39 deaths, while CBP reported only 10 deaths.

We looked at investigator reports and so we were able to read the narratives, and learn circumstances around the deaths. We were able to see if someone was chased by Border Patrol, either on foot or by vehicle, or if they died in Border Patrol custody. We found that Border Patrol had tried to underplay some of these deaths.

We found that 15 percent of all migrant deaths in the El Paso sector were caused directly by Border Patrol due to chases or use of force, also due to custody deaths, or falls from the border wall. Humane Borders doesn’t track deaths related to Border Patrol enforcement. So this is the first instance that I’m aware of, where we are able to quantify the CBP undercount of Border Patrol-related deaths.

For 2022, for instance, we found 16 deaths that should have been reported by CBP as CBP-related deaths. CBP had only reported six of those deaths. Of the 16 we found, I think it’s still an undercount, because a lot of the investigative reports use vague or passive language about a person “jumping into the canal,” for instance. So you don’t know if the person was actually chased. So we only included cases where it’s very explicit.

What surprised you most in working on this report?

It’s really just shocking how close to help a lot of people died. I’m used to southern Arizona, where the terrain and trails are very remote. But we found people dying across the street from the cemetery, people dying a short walk from the Dollar General store. We’ve had this narrative of “prevention through deterrence” for the last few decades, which has pushed people away from cities into remote areas where they’re more prone to dying from heat exposure or something else. But now the border is militarized to the point where even Sunland Park, this suburb of El Paso, can be as deadly as the middle of nowhere in southern Arizona.

Last June, for instance, something like 40 percent more people died in Doña Ana County in New Mexico than the entire state of Arizona. Most of these deaths were close to the highway or close to a town. It’s a dynamic that has not really been studied. And the fact that it’s been happening for years without anybody really noticing is really scary.

With these findings, are No More Deaths and other humanitarian groups mobilizing to do search-and-rescue and water drops in this area?

Like Texas, much of the land in New Mexico where people are dying is privately owned land, so it’s difficult to access for humanitarian groups.

We’ve been going there about once a month for the past year to try to organize some support. There’s a group that doesn’t have a name yet that we’ve started to work with, that’s putting out water in some of these areas. There’s another group from southern Arizona that has moved over to New Mexico to search for remains in the desert.

We’re hoping the news will spread and that others will join to help. We have some money to help out some groups that are forming. We’re really hoping that groups will form on their own for search-and-rescue and putting out water. Because right now, Border Patrol is the only game in town if you call 911 as a migrant. And Border Patrol has a horrible track record of actually helping anybody.

Two things stand out:

A complete lack of accountability for the misguided politicos and bureaucrats who are dishonestly pushing these immoral and ineffective policies without “owning up” to both the known deadly consequences and the lack of long-term “deterrent” value (even assuming, as I do not, that effective deterrence could justify immoral and illegal policies) of the actions they are touting; and
A complete abdication of professional journalistic standards and performance from the many members of the so-called “mainstream media” who fail to include in each report on draconian “border control” proposals and “policies” the deadly, well-documented human consequences of those policies and who provide a toxic forum for politicos and supposed “pundits” spouting myths and nativist propaganda about “border enforcement,” without presenting experts like Melissa, Todd Miller and many others who have actual experience with the unending trauma and futility caused by our current misguided, often flatly illegal, and clearly immoral approach to “border enforcement.”

Last year, a dangerous and despotic Texas Governor Greg Abbott signed into law SB 4, heralding the legislation as a form of defense in his war against President Biden’s immigration policies that have apparently left Texas unsafe and vulnerable. Obviously, nothing could be further from the truth; in fact, Texas is privileged to be the second state in the union with the largest immigrant population that has contributed over $40 billion in federal and state taxes, with a spending power of more than $110 billion. According to a report by the Immigration Research Initiative and Every Texan:

Once provided a work permit, new immigrants earn an average of $20,000 in their first year, which increases to $29,000 by their fifth year living in Texas. […] For every 1,000 workers, immigrants and asylum seekers contribute $2.6 million to state and local taxes within their first year of eligibility. Far from a burden on Texas communities, newly arrived immigrants and asylum seekers are as essential to our state’s economy as they are to our families and communities.”

Abbott and the state have reaped from the contributions of immigrant families, regardless of immigration status, only to waste millions in taxpayer dollars to cruelly militarize the border against their own border communities and the children and families seeking refuge and safety. With SB 4, Abbott and Texas would make it a felony for any undocumented immigrant to enter the state and empower local law enforcement and state judges to arrest and deport undocumented immigrants.

The proposition, uncritically reported by many in media and mindlessly repeated by politicos of both parties, that effectively eliminating asylum at the border, thereby turning the ability to seek protection in the U.S. over to smugglers, cartels, and thugs, will “enhance security” is beyond preposterous! Obviously, it will do the exact opposite by improperly treating desperate individuals seeking legal protection from the U.S. the same as the small number of actual security threats who might seek to cross the border (at least some of whom are actually caught).

Just ask yourself the question that the media never presses on Abbott, DeSantis, Trump, GOP nativists, or their spineless Dem enablers: Why would a “real terrorist” spend weeks or months trying to get a “CBP One” appointment to be screened by CBP? Alternatively, why would such an individual risk the irregular border crossing and then turn themselves in to CBP for processing or wait weeks in filthy conditions to be processed by CBP? Answer: Obviously, they wouldn’t.

There are many easier ways for those smuggling or seeking to engage in criminal behavior to enter (think thousands of miles of lightly guarded Northern Border, false visas, entering legally at an airport under false pretenses, or concealing contraband in legitimate commerce — the way most fentanyl enters the U.S.). And, they are all “facilitated” by the USG’s insanely bad policy decision to concentrate “law enforcement” resources overwhelmingly on those who present no realistic threat and want only fair consideration of their legal claims! Sure it generates (largely misleading) “numbers,” but does little to actually enhance security.

Indeed, one might well suspect that the inordinate hoopla and intentionally exaggerated fears focused on asylum seekers is largely a “cover-up” and diversion from the Government’s poor record on dealing with the fentanyl crisis.

As I have repeatedly said, what if the Feds and states stopped disingenuously wasting unconscionable amounts resources on bogus enforcement and deterrence and instead invested in building a fair and timely asylum reception, screening, adjudication, and resettlement system that encouraged and rewarded those presenting themselves at ports of entry? That would make it easier for law enforcement to concentrate on those actually seeking to avoid our legal system (rather than inanely concentrating on those who merely want our legal system to fairly consider their claims)!

What would happen if the “mainstream media” actually fulfilled their professional, ethical, journalistic responsibilities to research, understand, and report honestly about the right to asylum, those seeking it, and those assisting them in presenting their claims to an intentionally hostile and dysfunctional system! What if the media stopped uncritically and irresponsibly reporting nativist propaganda, such as Abbott’s babbling, as “news,” and began concentrating on informing the public of the truth about asylum seekers, the legitimacy of many of their claims, and their great potential benefits to America!

Multiple news sources report that President Biden is considering implementing executive action to try to close the U.S.-Mexico border, including to asylum seekers. It would be an extreme move, and a violation of the Refugee Act of 1980 and the country’s international obligation to protect those fleeing persecution. Only one other president — Donald Trump — has blatantly breached that obligation before. With the COVID-19 pandemic as a pretext, Trump invoked Title 42 of the U.S. Code, which allowed him to curb migration in the name of public health.

Biden, who came into office harshly criticizing his predecessor’s anti-immigrant policies, now seems poised to resurrect them. Administration sources concede that the president’s border plans are driven by politics, the belief that the immigration situation is “an election liability.”

This view is no surprise. We’ve been fed a narrative that the border is in crisis, overwhelmed by an unprecedented number of immigrants who pose a grave danger to the health and safety of the nation. But that narrative is false: The border is manageable, and rather than being a danger to Americans, immigrants are a net positive economically and socially.

During the week, the term “border crisis” was featured prominently in the national airwaves in both political rhetoric and media coverage. Perhaps the term would be appropriate and accurate if it referred to people freezing in the snow and rain, or dying crossing the desert in the summer. Yet, even though thousands have died crossing the world’s most dangerous land border—including record numbers in the past two years—this is almost never mentioned in media reports on the “border crisis.” Instead, the most prominent “crisis” is the right wing narrative of an overrun, open border. Everything else follows. The Border Patrol is overwhelmed. The enforcement apparatus is overwhelmed. Washington is overwhelmed. An NBC headline alarmingly suggested that ICE and CBP might have budget shortfalls, or entirely run out of money (spoiler: that’s not going to happen). “Border crisis” has been used so frequently that it has become both abstract and mind numbing, a term deployed either to gain political points or to justify more funding for border and immigration enforcement, which has received more than a hefty $400 billion since DHS opened its doors in 2003. “Border crisis” rarely refers to people like the injured, sick, wet, and shivering asylum seekers at the border, who on Saturday included children and pregnant women.

Perhaps instead of portraying the border as in crisis, we should say that the border, by its very design, creates crisis. I thought about this on Monday when I went down with a group of Green Valley Samaritan volunteers to where the asylum seekers had crossed. The snow was gone, but the mud puddles were not. The makeshift camp where many of the 400 people had stayed was empty. I kneeled by a tent made of aluminum blankets where a single kid’s sandal was on the ground. I meditated on that sandal and wondered how many times I’d seen this same scenario over the decades in Arizona—a kid’s Mickey Mouse suitcase, a stuffed animal, a small pair of pants or a shirt—in places where people had camped. How many times had I seen the electrolyte bottles, black bottles, empty tin cans in desolate places of the desert where people couldn’t possibly carry enough water to get where they were going?

The border is designed to create crisis; that is the deterrence strategy. Right next to the camp were two idly parked Caterpillar excavators, presumably used to construct the border wall. Staring at them over the tents and makeshift shelters, I assumed that it was machinery from Spencer Construction—a company that received more than $600 million in contracts from CBP in the summer—for “border maintenance.” Now Spencer construction crews cruise up and down the border road, “filling in the gaps” of the border wall, as the Biden administration puts it. They filled in one such gap much closer to Sasabe several months ago, and now people crossed much farther away. With its focus on enforcement, the now-rejected border bill would have injected $14.4 billion into CBP and ICE (on top of a 2024 budget that was already more than $28 billion), including more funds for wall construction. Also included in the bill was money dedicated to surveillance technology, such as more autonomous towers (in addition to the nearly 400 such towers already installed), and the further digitization of the border, including systems for taking DNA samples from border crossers, and ground and maritime drone systems (yes, boat drones). Detention Watch Network describes the bill’s proposed expansion of ICE’s detention and deportation apparatus as the “largest appropriation of funds for immigration detention custody and surveillance operations in ICE’s history,” which included a daily capacity for detainment rising from 34,000 people to 50,000. Mind you, many of ICE’s detention facilities are run by private companies, so, as with surveillance, the profit motive is always lurking behind the scenes.

In short, the bill was what GOP lawmakers wanted, yet they rejected it. Democrats such as Chuck Schumer and Kyrsten Sinema (or excuse me ex-Democrat, now independent) lamented that Republicans weren’t taking the border seriously—an accurate critique, since the bill was only offering more fortification, including an unprecedented provision that gave Washington the authority to shut down the border (though it was unclear what closing the border meant exactly). Even more confusing was that Donald Trump opposed ramping up enforcement. It all makes sense, however, when the election is considered: Trump wants to run against Biden on this issue, but he can hardly do that if Biden is pounding the iron fist. As ABC News reported, “Trump probably still does benefit politically from a protracted [and manufactured!] border crisis.” However, Senator Chris Murphy, who was the chief Democratic negotiator for the bill, wrote: “Republicans can’t claim that the border is in crisis and then vote against the bipartisan bill, written by their own leadership, that would fix the problem.” He concluded, “Quite simply, we risk losing the 2024 election if we do not seize this opportunity to go on offense on the issue of the border and turn the tables on Republicans on a key fall voting issue.” The Senate Democrats took Murphy’s challenge and went on the offensive with a slick video on Twitter showing Democrats as hardline border enforcers. For his part, Biden stated, “Every day between now and November the American people are going to know the only reason the border is not secure is Donald Trump and his MAGA Republican friends.” In other words, the so-called border crisis has become a race to see which candidate can better fortify the border.

As for the people freezing and in various states of medical distress, this border cold war (and the proposed border bill) only makes matters worse. On top of that, according to a press release by No More Deaths on Saturday, Border Patrol agents told the humanitarian aid organization that they were “informed of the situation,” of people stranded in potentially life-threatening conditions, “but did not plan to drive out to address it.” Volunteers began to transport people from the border wall to the Border Patrol substation, also known as its processing center, so refugees could turn themselves in. Volunteers reported that Border Patrol agents in Sasabe detained and threatened them, and took pictures of their driver’s licenses. At one point there was a “rolling roadblock” of Border Patrol trucks. One volunteer reported a situation in which two agents spoke to them at “yelling volume” that seemed to be “backed with a bunch of anger.” The agents told the volunteers that they were “breaking the law” and threatened to arrest them and impound vehicles. But the volunteers persisted, driving the 15 miles or so back to retrieve more people. More and more asylum seekers assembled in front of the Border Patrol processing center. Eventually, the school in Sasabe was opened as a temporary shelter for the night. By the end of the day, the humanitarian aid organizations evacuated every person from the border. On Sunday morning all migrants were in Border Patrol custody. And as Arizona Public Media reported, “Seemingly at odds with the aid workers’ account, Customs and Border Protection says they prioritized the humanitarian response to the migrants abandoned in the cold.”

By the time I arrived on Monday, the real crisis had come and gone. There was the shoe, the blankets now drying on the mesquite trees, the construction workers driving up and down the road in their vehicles, and a 30-foot border wall meant to push people further into the desert. No More Deaths and Samaritans volunteers cleaned up the mess in the aftermath. What played out was not just a battle between humanitarian aid and the Border Patrol. It was a battle over what the crisis really was.

So, our brave nation and our courageous leaders are “existentially threatened” by a bunch of desperate unarmed people patiently waiting in misery to turn themselves in to the Border Patrol for asylum screening because our Government can’t process them in a fair and timely manner through legal ports of entry as required by law! That’s despite the relative predictability of flows of forced migrants and their slow progress toward the border.

If our “intelligence” services can’t foresee very public flows of forced migrants northward, and our nation can’t prepare to fulfill our legal and moral obligations to our fellow humans, Lord help us!

$600 million for annual “border maintenance,” but not enough trained Asylum Officers to screen asylum seekers at ports of entry? $28 billion for ineffective “deterrence,” but they can’t run resettlement programs that get asylum seekers and those granted asylum to the many places in the U.S. that need their skills? Gimmie a break!

Senate Funding Deal Places the Lives of Immigrants Seeking Safety at Risk

Washington, D.C. (February 5, 2024) – Yesterday, Senate negotiators released language for the supplemental funding bill that would dramatically alter the U.S. asylum system in exchange for foreign aid and humanitarian assistance.

Ayuda joins immigrant communities and advocacy organizations across the country in strongly condemning this proposal that would lead to more families separated, children detained, and asylum seekers sent back to face persecution and even death.

Amongst many of the draconian changes proposed, this legislation would create a new authority, with narrow exceptions, that would allow officials to summarily expel asylum seekers. It would also restrict screening standards for asylum seekers and expedite asylum claims to the extent that many will not be able to access counsel or adequately represent themselves.

Ayuda and our partner organizations believe there are far more effective solutions to immigration policy failures. We call on the Senate to reject this framework, disentangle humanitarian assistance from changes that would eviscerate U.S. asylum law, and recommit themselves to building compassionate and humane immigration system.

The long-awaited bipartisan Senate deal on immigration contains no real reforms, such as a pathway to citizenship for undocumented immigrants. It’s all about “securing” the border.

Biden and Senate Democrats have caved to Senate Republican hardliners. Among other restrictions, the bill would make it much harder for people to apply for asylum.

On Friday evening Biden called the bill “the toughest and fairest set of reforms to secure the border we’ve ever had in our country.”

Then Biden went further — endorsing a full border shutdown. He said the bill “would give me, as President, a new emergency authority to shut down the border when it becomes overwhelmed. And if given that authority, I would use it the day I sign the bill into law.”

I very much doubt Biden would shut the border if he signs this bill into law.

So what’s going on here? The underlying politics here has nothing to do with funding Ukraine. It doesn’t have to do with reforming immigration. It doesn’t even have much to do with the practical challenge of securing the border.

It has everything to do with the 2024 election, in which border security has become a big issue.

The nation does have to take reasonable action to stem the illegal flow of immigrants. But Trump has stoked American’s fears with lies (see below).

Trump and Biden are engaged in a giant pre-election kabuki fight over the border.

Biden wants to take the border issue away from Trump and figures this bill will do it. Which is exactly why Trump doesn’t want the bill enacted. “As the leader of our party, there is zero chance I will support this horrible, open-borders betrayal of America,” Trump said on Saturday. “It’s not going to happen, and I’ll fight it all the way.”

Trump says he welcomes criticism from GOP senators. “Please, blame it on me. Please, because they were getting ready to pass a very bad bill.”

House Speaker Mike Johnson, Trump’s lapdog-in-chief, says the bill is “dead on arrival” in the House. Besides, he now says, it isn’t needed because Biden already has all the authority he needs to close the border.

Um … just last year, Johnson argued that Congress must tighten immigration laws to strengthen the president’s hand. When he was president, Trump sought similar additional authority from Congress.

Meanwhile, House Republicans are about to begin impeachment proceedings against Alejandro Mayorkas, homeland security secretary, for allegedly being too soft on border security — even though Mayorkas worked with Senate Republicans to come up with this hardline border deal.

We need to deal with the border, but Republicans are now the ones sitting on their hands because they’re beholden to Trump. We also need to deal with immigration in a humane way by offering a broad and reasonable path to citizenship, but Democrats seem to have forgotten this basic goal.

The public, meanwhile, is utterly confused by Trump’s demagoguing. Here are Trump’s biggest lies, followed by the truth.

Trump claims Biden doesn’t want to stem illegal immigration and has created an “open border.”

Rubbish. Since he took office, Biden has consistently asked for additional funding for border control.

Republicans have just as consistently refused. They’ve voted to cut Customs and Border Protection funding in spending bills and blocked passage of Biden’s $106 billion national security supplemental that includes border funding.

Trump blames the drug crisis on illegal immigration.

Bull. While large amounts of fentanyl and other deadly drugs have been flowing into the United States from Mexico, 90 percent arrives through official ports of entry, not via immigrants illegally crossing the border. Research by the conservative Cato Institute found that more than 86 percent of the people convicted of trafficking fentanyl across the border in 2021 were U.S. citizens.

Trump claims that undocumented immigrants are terrorists.

Baloney. America’s southern border has not been an entry point for terrorists. For almost a half-century, no American has been killed or injured in a terrorist attack in the United States that involved someone who crossed the border illegally.

Trump says undocumented immigrants are stealing American jobs.

Nonsense. Evidence shows immigrants are not taking jobs that American workers want. The surge across the border is not increasing unemployment. Far from it: Unemployment has been below 4 percent for roughly two years, far lower than the long-term average rate of 5.71 percent. It’s now 3.7 percent.

Trump claims undocumented immigrants are responsible for more crime in America.

More BS. In fact, a 2020 study by the Proceedings of the National Academy of Sciences, cited by the Department of Justice, showed that undocumented immigrants have “substantially” lower crime rates than native-born citizens and legal immigrants. Despite the recent surge in illegal immigration, America’s homicide rate has fallen nearly 13 percent since 2022 — the largest decrease on record. Local law enforcement agencies are also reporting drops in violent crime.

Since he entered politics, Donald Trump has fanned nativist fears and bigotry.

Now he’s moving into full-throttled neofascism, using the actual language of Hitler to attack immigrants — charging that undocumented immigrants are “poisoning the blood of our country” and saying they’re “like a military invasion. Drugs, criminals, gang members and terrorists are pouring into our country at record levels. We’ve never seen anything like it. They’re taking over our cities.” He promises to use the U.S. military to round up undocumented immigrants and put them into “camps.”

The parallels with Nazi Germany are chilling. In 1932, the canny Nazi propagandist Joseph Goebbels called for “a thick wall around Germany,” to protect against immigrants. “Certainly we want to build a wall, a protective wall.”

Trump and his enablers want us to forget that almost all of us are the descendants of immigrants who fled persecution, or were brought to America under duress, or simply sought better lives for themselves and their descendants.

Immigration has been good for America. As the median age of Americans continues to rise, we’ll need more young people from around the world.

The central question shouldn’t be how to secure our borders. It should be how to create an orderly and humane path to citizenship.

More Than 2 in 3 Voters Support Having an Asylum System and Hiring More Immigration Judges and Asylum Officers

Members of Congress are once again engrossed in debate related to immigration and border security, issues that have seen little progress or reform in more than two decades. The current debate particularly focuses on the application process for asylum — a form of legal immigration that protects people who have faced persecution in their home country on account of race, religion, nationality, and/or membership in a particular political or social group.

A new Data for Progress survey asked likely voters in the U.S. about various funding measures and proposed policy changes related to the U.S. immigration system.

First, we find at least 80% of voters think reforming the legal immigration system and securing the border with Mexico should be priorities for the U.S. government. Seventy-one percent of voters also say addressing the root causes of migration from South and Central America through diplomatic relations and humanitarian aid should be a priority.

A strong majority of voters (69%) also support the U.S. having a system for asylum seekers to legally migrate to the U.S. to seek protection. When asked about potential changes to the asylum application process that would allow immigration officials to deport asylum seekers without allowing them to see a judge, voters prefer giving asylum seekers a meaningful opportunity to make their case before a judge rather than a higher standard that could lead to expedited removal.

Along these lines, a majority of voters, including 69% of Democrats and 58% of Independents, don’t think the U.S. should make it harder for asylum seekers to meet with an immigration judge.

When asylum seekers come to the U.S. and fill out an asylum application, they must wait a minimum of six months before they are able to apply for work authorization. Some lawmakers have proposed eliminating this six-month waiting period so that asylum seekers can support themselves instead of relying on others for assistance. Sixty-two percent of voters, including a majority of Democrats (73%), Independents (58%), and Republicans (54%), support eliminating the six-month waiting period for asylum seekers to apply for work authorization.

Since October, President Biden has been lobbying Congress to pass a more than $105 billion spending package for national security purposes that includes additional military aid for Ukraine and Israel, as well as roughly $14 billion for various funding measures related to immigration and border security.

Voters support many of the key immigration-related measures in this proposal, such as enhancing security at ports of entry (82%), increasing personnel and capacity to process immigrants at the U.S.-Mexico border (75%), hiring new immigration judges (67%), and hiring new asylum officers (67%).

Lastly, 79% of voters, including 84% of Democrats, 78% of Independents, and 75% of Republicans, oppose separating migrant children from their parents or caregivers at the border.

These findings underscore that a strong majority of voters want the U.S. government to prioritize reforming the legal immigration system and securing the border, while also providing leniency to asylum seekers in regards to making their case before an immigration judge and being able to apply for work authorization.

As of December 31, 2023, only the first quarter of FY 2024, the Biden Administration had already initiated 696,400 cases at EOIR. That’s more than the highest FULL FY (12 mo.) of the Trump Administration, 2019, in which 694,771 cases were started.

Moreover, in FY 2023, Biden filed an astounding 1,485,769 cases, more than twice the number that Trump did in FY 2019. Biden’s numbers in FY 2023 topped Trump’s other three years (278,218; 356,034; 216,589) BY MULTIPLES. In fact, Biden instituted approximately as many Immigration Court cases in FY 2023 as Trump did in his entire FOUR YEARS and is on a path to greatly exceed his 2023 total in FY 2024!

So the Trump/GOP blather about Biden not enforcing immigration laws is complete BS!

Biden’s muscular immigration enforcement efforts give lie to the GOP’s “open borders” claims, a point seldom made by the “mainstream media.” But, such over the top enforcement is NOT necessarily good news for America.

Even with more Immigration Judges under Biden — going on 700 — the annual decision-making capacity at EOIR is somewhere between 350,000 to 550,000. So, the Immigration Courts will not come close to keeping up with the flow of incoming cases, let alone reducing the backlog that has now mushroomed to more than 3,000,000.

There is no apparent plan for controlling the EOIR backlog and improving the much-criticized quality of decisions, which disproportionately harms legal asylum seekers of color while often adding to the backlog when rejected on review. That makes the Administration’s institution of new cases on a level guaranteed to create additional backlog appear irresponsible.

Moreover, it hasn’t helped that Attorney General Garland ignored pleas from most experts to make EOIR reform one of his highest, ideally his highest, national priority. Nor has Congress paid much attention to the glaring, chronic dysfunction at EOIR, despite pending legislation to create an Article I Immigration Court!

Biden is following in the footsteps of his Dem predecessors Obama and Clinton. In their initial election campaigns they “played to their base” by criticizing harsh GOP enforcement policies and extolling the benefits of immigration. Once in office, however, they became convinced that their credibility, and perhaps manhood, depended on out-enforcing and “out-crueling” their GOP predecessors.

Of course, this naive approach never produces the apparently desired result: That the GOP will acknowledge that Dems are serious about enforcement and strike the long needed “grand bargain” on immigration reform.

Predictably, that always backfires. The GOP just keeps repeating their “open borders” big lies, and the mainstream media provide little, if any, critical analysis or pushback. As long as kids aren’t being proudly exhibited in cages, the “mainstreams” quickly lose interest in the suffering, dehumanization, and death piling up on both sides of the border and in the “New American Gulag” as a result of the disastrously (and predictably) failed “enforcement-only” approach.

What Biden’s effort to “out-Trump Trump” REALLY shows is that more enforcement and attempting to use anti-immigrant legal decisions and a hopelessly backlogged adjudication system that keeps legal asylum seekers waiting indefinitely with a significant chance of wrongful denial if and when they are reached as a “deterrent,” doesn’t work, and in fact never has worked!

What’s needed is actually painfully obvious: A balanced approach that combines a properly generous asylum adjudication system, more avenues for legal immigration (both permanent and temporary), and an independent, functioning, expert, due-process oriented Immigration Court with reasonable, targeted, humane enforcement. That’s a message that both parties and the mainstream media are ignoring, to our national detriment. Too many Americans seem to have forgotten that in the process of dehumanizing and demonizing “the other” we degrade ourselves.

Or, put another way, we can diminish ourselves as a nation, but it won’t stop human migration!

President Biden is asking Congress for $13.6 billion to fund border enforcement operations, a significant portion of which will go to Immigration and Customs Enforcement (ICE) to detain more immigrants. This strategy is reminiscent of President Trump’s administration, which also poured resources into ICE detention in 2018 and 2019, but that effort produced very little change in the number of ICE removals—the stated goal for both Trump and Biden.

In fact, President Biden is proposing to increase ICE detention by only 9,000 beds, from the current 37,000 to 46,000. The federal government should detain and deport individuals who pose national security and public safety threats to the United States, but it should not spend taxpayer dollars on useless anti‐ immigrant theater. Moreover, the Department of Homeland Security’s Office for Civil Rights and Civil Liberties has found that ICE detention sites routinely mistreat their detainees in ways that are “barbaric,” and there is no reason to expose anyone unnecessarily to this type of treatment.

A more effective approach to address the border issue is to facilitate legal immigration: let people come legally. This approach has been demonstrated to work, would reduce government expenditures, and make the immigration process more orderly.

As David points out, the “New American Gulag” is bad for our nation and humanity. Unhappily, though, it’s good for the corporations who run private prisons. They also provide jobs in out of the way places where migrants are stashed. And, they contribute money and lobby politicos of both parties. That’s why human rights lose out almost every time in the immigration debate.

Immigration enforcement is an “industry” where failure = success! The more detention, apprehension, and deportation fail, the greater demand there is by politicos for more of it!

You can bet that when the coming waves of “enhanced” repression and human rights violations predictably fail, there will be demands for even harsher and more expensive enforcement, imprisonment, and deportations to deadly places!

It’s a dangerous, degrading, wasteful cycle that America just can’t seem to break. There are too many interests that see the human and fiscal misery of the “Gulag” as a profit center or a political advantage and therefore are disinterested in what works or the common good.

If you are still having trouble with the concept, I’ll translate for you: “Yes, we understand and agree that Russia cannot be allowed to take over Ukraine, and we will fund aid to Ukraine, but in exchange, we insist on fundamental changes to our immigration laws to make sure no more Brown people come to America, starting right effing now.” (“Brown,” in this context, means anyone who is poor, Latin American, Asian, African, non-Anglophone…you get the idea.)

How will this play out in the next few weeks? I see three options: 1) Biden and the Dems cave, so the 1980 Refugee Act is scrapped, Dreamers get deported, the southern border is further militarized, and the economy tanks because a good chunk of the workforce is afraid to come to work; or 2) the GOP does a Tuberville and caves; or 3) the Unknown Unknown.

Thanks for telling it like it is, Dan! There is no validity to the GOP’s attempt to punish asylum seekers by unconscionably returning them to danger and death with no process.

The cruelty and threat to life from forcing desperate seekers to wait in dangerous conditions in Mexico, pushing them to attempt entry in ever more deadly locations along the border, detaining them in inhumane substandard prisons in the U.S., and or returning them without meaningful screening by qualified independent decision-makers is overwhelming. That Congress, the Administration, and much of the “mainstream media” choose to ignore, and often intentionally misrepresent, truth and reality about the horrible human and fiscal wastefulness of “border deterrence” doesn’t change these facts!

The Administration’s three year failure to build a functional, robust asylum system at the border with humane reception centers, access to legal assistance, a rational resettlement system, and sweeping, readily achievable, administrative reforms and leadership changes at EOIR and the Asylum Office (as laid out by experts, whose views were dismissed) is also inexcusable.

Yet, the media misrepresents this farce as a “debate.” It’s a false “debate” in which neither disingenuous “side” speaks for the endangered humans whose rights and lives they are bargaining away to mask their own failures and immorality.

When someone mentions the so-called “border crisis”…
- There is not a “border crisis,” but rather a humanitarian crisis at our border.
- This humanitarian crisis has worsened over the years because of an overwhelming backlog of cases, resources not being funneled to lawful and humane processing, and harmful policy choices, such as the implementation of the Title 42 expulsion order. These choices have decimated our asylum system, making it almost impossible for people fleeing violence and seeking safety to access their legal right to seek asylum.
When someone starts talking about DACA…
- DACA recipients contribute so much to our communities — they are students, teachers, nurses, doctors, and loved ones who have lived in the U.S. for most of their lives.
- Year after year, in poll after poll, a majority of Americans across party lines support Congress passing a pathway to citizenship for immigrant youth.

It’s hard to imagine any American having faith in government — or its ability to solve a complex problem like immigration — when Congress can barely pass a temporary spending bill without getting mired in controversial issues like border security and coming dangerously close to shutting down the government.

Fortunately, dysfunction is not the story in every part of the country.

While Congress is pointing fingers on immigration, small towns and cities throughout the country are doing the hard work of managing migrants arriving at the U.S. southern border.

I recently visited Arizona with a delegation of immigration attorneys and policy experts and saw the work by government officials, social workers and health care professionals up close.

Every day, federal Customs and Border Protection (CBP) agents take recent arrivals to a church-affiliated shelter in Tucson, which does COVID-19 and other health screenings, provides a hot meal, and finds short-term local shelter, busing or other transportation in a matter of days or hours.

Remarkably, even with increased numbers of people coming into Pima County, the coalition of county administrators and nonprofits has found temporary housing and transport for everyone and avoided having people end up on the streets.

The local collaboration, supported by federal emergency funding, is a model for how migration at the border can be managed effectively.

Read Greg’s complete article at the link. It’s largely what I’ve been saying all along. Although far from perfect (what is perfect these days?), the current law could be made to work if there were the political will to do so.

The GOP’s unrelenting racism, xenophobia, dehumanization, and “doubling down” on failed deterrence and punishment “strategies” are guaranteed to make things worse. Dems need to stand tall for solving the humanitarian issues at Southern Border in a humane, legal, and practical manner, using the tools available under current law!

It can be done! We just need the political will (and political pressure) to make it happen. It’s not rocket science!🚀

⚖️ GIVING CONTEXT TO THE GOP’s OVERHYPED “BORDER TERRORIST” CLAIMS: Experts Set The Record Straight!

Some Republican lawmakers are flagging Hamas’ attack on Israel as an example of why more security is needed at the southern U.S. border. Hamas militants breached a border fence and attacked Israeli villages bordering the Gaza Strip on Oct. 7.

“Potential terrorists are attempting to cross our southern border. In September alone, 18 illegal immigrants on the terror watchlist were caught at the border,” U.S. Sen. Marsha Blackburn, R-Tenn., posted Oct. 21 on X. “The attack on Israel should serve as a warning as to why we must secure the border.”

The next day, U.S. Rep. Kevin McCarthy, R-Calif., also mentioned the terrorist watchlist on NBC’s “Meet The Press.”

“We just caught 18 people, just last month, on the FBI terrorist watchlist, coming across our border,” McCarthy said. “More than 160 have done it this year, a record breaking.”

U.S. immigration officials have encountered rising numbers of people on the watchlist. But not everyone on the list is a terrorist, and not everyone encountered is allowed to enter the country.

Terrorism and immigration experts say that the threat of attacks in the U.S. and Israel are incomparable.

“They both involve borders, but the comparison ends there,” David Bier, an immigration expert at the libertarian Cato Institute, previously told us. “People aren’t crossing the border to conduct terrorist attacks or take over parts of the United States. A very small percentage may come to commit ordinary crimes, like selling drugs, but overwhelmingly, they are coming for economic opportunity and freedom.”

McCarthy’s office did not respond to our query for more information. A Blackburn spokesperson pointed us to a Fox News reporter’s post on X. Customs and Border Protection did not confirm whether 18 people were stopped in September.

Read Maria’s complete article which includes comments from real experts like Professor Stephen Yale Loehr, Professor Denise Gilman, Aaron Reichlin-Melnick, and others in addition to David Bier. They stand in sharp and long overdue contrast with the GOP’s alarmist, out of context, claims.

It’s little wonder that a party of anti-democracy activists, insurrectionists, and election deniers would want to deflect attention from themselves onto folks who are overwhelmingly coming to save their lives and to work hard and contribute to our economic growth!

I have previously “called out” Kristen Welker and NBC’s Meet the Press for giving McCarthy an unnecessary public forum for his alarmist narrative. Many thanks to Maria for setting the record straight and to the experts who were interviewed from her article! You actually did the “due diligence” that Welker and others often brush off when “doing immigration.”

Of course border security is important! A significant, achievable improvement would be to establish a fair, timely, functional asylum screening and adjudication system at ports of entry so that those seeking asylum will be motivated to use it (rather than attempting to “punish” and “deter” those who can’t use the current dysfunctional DHS/EOIR “system.”) That would give CBP a chance to concentrate on the real law enforcement challenge: identifying and stopping those who seek to harm the U.S. That’s going to take even better intelligence and more sophisticated efforts.

I also wouldn’t minimize that, as pointed out by the experts, CBP has been able to identify and deny entry to individuals on their list. That’s a sign of success, not failure!

To state the obvious, further cutting or restricting asylum (as many in the GOP disingenuously advocate) would only force even more of those seeking refuge into the hands of smugglers and push them into the dangerous lands between ports of entry. Misdirecting enforcement resources to fruitlessly and improperly trying to “deter” and “apprehend” those legitimately seeking refuge will only further dilute the attention that CBP can pay to any real dangers lurking at the border!
