Danny’s case illustrates just how difficult the balance between compassion and safety can be. Was he a child who needed help? Or a gang member who shouldn’t have been here?

“Do you close the doors to all law-abiding folks who just want to be here and make a better life . . . and in the process keep out the handful who are going to wreak havoc on our community?” asked one federal prosecutor, who is not permitted to speak publicly and has handled numerous MS-13 cases. “Or do you open the doors and you let in good folks and some bad along with the good?”

“Refugees have been at the center of a political maelstrom, accused of everything from terrorism to being a drain on taxpayers — prompting President Trump, in one of his first official acts, to suspend the country’s four-decade old refugee resettlement program.

But a new study shows that refugees end up paying more in taxes than they receive in welfare benefits after just eight years of living in this country.

By the time refugees who entered the U.S. as adults have been here for 20 years, they will have paid, on average, $21,000 more in taxes to all levels of government than they received in benefits over that time span, according to a working paper released Monday by the National Bureau of Economic Research that examined the economic and social outcomes of refugees in the U.S.

“There was a lot of rhetoric saying these people cost too much, but we didn’t actually know what that number was,” said William N. Evans, an economist at the University of Notre Dame who co-authored the paper.

Trump, in his January executive order temporarily barring refugees from entering the country, had directed the State Department to study the long-term costs of the refugee admissions program to federal, state and local governments.”

THE ASYLUMIST: The Importance Of Courtesy, Professionalism, Respect & Collegiality In Immigration Court

“Unlike perhaps some areas of law, immigration law has a strong ideological component. Many of the attorneys who represent immigrants do so because they believe in human rights and they want to keep families together. For such attorneys—and I include myself among them—our work represents an expression of our moral and/or religious values. In other words, it’s more than just a job; it’s a mission.

Does this make it harder for us to work cooperatively with opposing counsel (DHS)? Is it more urgent that we do so? For me, the answer to both these questions is yes. When our clients’ lives and futures are on the line, it can be very difficult to maintain a cordial relationship with a government attorney who is fighting to have that client deported. But even in the hardest-fought case, there is value in maintaining lines of communication. For example, even where the DHS attorney will not compromise and is fighting all-out for removal, there still exists the possibility of stipulating to evidence and witnesses, and of a post-order stay of removal. Severing the connection does not serve the client (though it may satisfy the ego), and certainly won’t help future clients, and so to me, there is little value in burning bridges, even when I believe DHS’s position is unjust.

All that said, there is no doubt that we will often disagree with our opposing counsel, and that we will fight as hard as we can for our clients. This is also a duty under the Rules of Professional Conduct (zealous advocacy), and for many of us, it is an expression of our deeply held belief in Justice.

With the ascension of the Trump Administration, and its more aggressive approach towards non-citizens, I believe it is more important than ever for us lawyers to keep good relationships with our DHS counterparts. While some government attorneys are glad to be “unleashed” and to step-up deportation efforts, many others are uncomfortable with the Administration’s scorched-Earth strategy. These DHS attorneys (and I suspect they are the majority) take seriously their obligation to do justice; not simply to remove everyone that ICE can get their hands on.

While the environment has become more difficult, I plan to continue my Old School approach. It works for me, it has worked for my clients, and I think it is particularly crucial in the current atmosphere. We lawyers–the immigration bar and DHS–should continue to lead by example, and continue to maintain the high ethical standards that our profession sets for us. In this way, we can help serve as a counter-balance to our country’s leaders, whose divisive, ends-justify-the-means approach has no use for the basic principles of morality or comity that have long served our profession and our democracy.”

Fairness, scholarship, timeliness, respect and teamwork are the things I have tried to promote throughout my career. I found all of them at the Arlington Immigration Court. “No way” I would have lasted 13 years on the trial bench  without lots of help and cooperation from the whole “court team.”

Read Ari Berman’s shocking profile of a minor politician who wields outsized influence within the GOP and is out to put a “White’s Only” sign on the American Dream. For Kobach, the “Jim Crow Era” was the glory day of the “rule of law” in the U.S. When Kobach talks about the “rule of law” it’s code for using the legal system to cement the rule of a disproportionately white GOP minority over the rest of us, and particularly Americans of color. Will the “sleeping majority” wake up before we’re all disenfranchised by this racist in a suit hiding behind his Yale law degree and ability to spin legal gobbledygook? Kobach isn’t just “the ACLU’s worst nightmare,” as he smugly touts himself. He’s American Democracy’s worst nightmare!

Here’s a sample of what Kobach has in store for the rest of us:

“Kobach’s plans represent a radical reordering of American priorities. They would help preserve Republican majorities. But they could also reduce the size and influence of the country’s nonwhite population. For years, Republicans have used racially coded appeals to white voters as a means to win elections. Kobach has inverted the priorities, using elections, and advocating voting restrictions that make it easier for Republicans to win them, as the vehicle for implementing policies that protect the interests and aims of a shrinking white majority. This has made him one of the leading intellectual architects of a new nativist movement that is rapidly gaining influence not just in the United States but across the globe.”

Read Berman’s lengthy article, and think about what YOU can do to put the kibosh on the plans of this self-proclaimed “fanatic” and his dream of turning America into a “White GOP Folks Only Club.” Even Republicans who might remember enough to know that the GOP in the far, far distant past was the “Party of Lincoln” might want to rethink their party’s support of and association with this dangerous extremist. Act before it’s too late and Kobach steals YOUR American Dream and turns it into a nightmare!

THE ATLANTIC: Priscilla Alvarez Analyzes The Trump/GOP Push For “Merit-Based” Immigration!

“President Trump’s proposal to shift towards a “merit-based” immigration system would upend an approach that has existed for half a century.

Since the 1960s, the United States’ immigration system has largely based entry on family ties, giving preference to those with relatives who are citizens. But in his first address to a joint session of Congress in February, Donald Trump proposed moving away from that policy, focusing instead on an immigration system that would prioritize high-skilled immigrants.

Trump and his advisors have argued that the current levels of immigration harm American workers by lowering wages and preventing assimilation. A merit-based system, restrictionist advocates believe, would help lower immigration rates and ensure that the immigrants who do come are high-skilled workers who never need public assistance. “The current, outdated system depresses wages for our poorest workers, and puts great pressure on taxpayers,” Trump said in his speech to Congress.

While the president has yet to offer details, a merit-based system would pose its own challenges to economic prosperity. Critics believe that  a merit-based system that prioritizes high-skilled workers could hurt the economy by harming industries that rely on low-skill immigrant labor, and that fears that immigrants are not assimilating or are overly reliant on the social safety net are overblown.

The first example of the U.S. establishing qualifications for new immigrants was in 1917, when the government imposed a literacy test on those seeking to enter the country. In the 1960s, Congress lifted restrictions that heavily curtailed immigration from non-European nations, and reshaped the immigration system toward prioritizing admission of close relatives of immigrants already living in the United States. The overwhelming majority of immigrants are now admitted through that family-preference system, which significantly changed the ethnic composition of U.S. immigrant population by admitting more Latin American and Asian immigrants.

In 2015, for example, of the more than one million legal permanent residents admitted, “44 percent were immediate relatives of U.S. citizens, [and] 20 percent entered through a family-sponsored preference,” according to the Migration Policy Institute, a nonpartisan think tank. Only 14 percent of those admitted came through a job-based preference. The “merit-based” immigration system, in theory, would increase the latter figure, as it would prioritize those who are highly educated and therefore considered more employable.

Such a policy would likely limit the supply of low-skilled workers, and might allow the administration to filter which immigrants it chooses to admit. And a merit-based immigration system could also help realize a longtime conservative policy goal—a reduction in the number of immigrants admitted overall.

Some Republican lawmakers have already pushed for legislation that would limit legal immigration. Last month, Republican Senators Tom Cotton and David Perdue introduced legislation that would cut the number of immigrants legally admitted to the United States in half. It would do so in part by limiting the number of family members immigrants can sponsor for citizenship, a policy long sought by immigration restrictionist groups.

Dan Stein, the president of the Federation for American Immigration Reform, which supports curtailing immigration, said a merit-based approach could reduce the flow of immigrants coming into the United States. “The merit-system is also a surrogate for moving away from a system that the country doesn’t really get to control and regulate how many come in every year and who they are because of chain migration, the family-preference system,” Stein said, adding that a points system would be one part of the whole.

Nevertheless, assessing “merit” is difficult. A system that deliberately excluded low-skilled workers might raise labor costs in industries that rely on those workers, increasing prices for consumers but boosting wages for workers.”

ANTH 375 @ BELOIT COLLEGE: Professor Jennifer Esperanza & Her Students Blaze Path To Understanding Migration In The Liberal Arts Context — Every College In America Should Be Teaching These Essential Skills!

Back in 1973, when I graduated from the University of Wisconsin Law School and  joined the staff of the Board of Immigration Appeals (“BIA”) at the U.S. Department of Justice, nary a law school in the U.S. taught a course in immigration law. The handful of law school courses on the subject were taught almost entirely by Adjunct Professors. Indeed, shortly after I joined the Board, they sent me to what was then the premier law school immigration course at Georgetown Law taught by none other than Charles Gordon, the legendary General Counsel of the “Legacy” INS.

Today, thanks to a great extent to the efforts of such noted “scholar/public servants” as Professor David Martin of the University of Virginia Law School, Professor Alex Aleinikoff, former Dean of Georgetown Law, and Professor Stephen Legomsky of Washington University Law School, some form of immigration law or immigration clinic is offered at most major U.S. Law Schools.

But, a serious void remains at the most critical level of education: undergraduate institutions. However, at Beloit College in Beloit, Wisconsin, Professor Jennifer Esperanza is blazing the way for the future. Her “ANTH 375: Migrants, Immigrants, and Refugees” Summer Session class is jumping head-on into creating constructive dialogue, understanding, and action on the most important issue facing America today: migration.

I had the pleasure of working with Professor Esperanza and her fourteen “super students” as a “Guest Professor” during three days in late May. The students hailed from different backgrounds and entered the class with varying levels of immigration experience and interest.

Some were there because of their own backgrounds or prior work with migrants; others were there . . . well, just because they were there. But, funny thing, by the end of my three days I couldn’t tell the difference. Everyone pitched in as a team, demonstrated sharp analytical skills, asked incisive questions, showed creativity and originality, and made spectacular group presentations on some very tough subjects. In other words, it was all the things I love: fairness, scholarship, timeliness, respect, and teamwork!

Among our exercises: we watched and discussed the documentary “Credible Fear;” broke the group into two teams which designed and presented their own refugee systems based on competing “Mother Hen” and “Dick’s Last Resort” principles; and read, analyzed, and discussed two cases I had been involved in: the BIA’s landmark precedent Matter of Kasinga, 21 I&N Dec. 357 (BIA 1996) recognizing for the first time “female genital mutilation” (“FGM”) as a basis for asylum in the United States, and another decision (which was published on the internet) from my time at the Arlington Immigration Court where I granted “particular social group” asylum to a family from El Salvador.

I teach as an Adjunct Professor at Georgetown Law, one of the top law schools in the country. To my pleasant surprise, I found that Esperanza’s Beloit students were able to discuss the issues in a manner very similar to the class dialogue produced by some really great second-year, third-year, and graduate law students. Amazing!

I’m reproducing the results of the “Create Your Own Refugee System” exercise below, along with a class picture and some other pictures of my stay at Beloit (where my son-in-law, Daniel Barolsky, is a Professor of Musicology).

I also note that Professor Esperanza’s system and “real-world-oriented” approach to undergraduate education produces results, as in jobs in the real world! As featured in the Fall 2015 issue of Beloit College Magazine, Esperanza’s students were making an immediate difference: Jessica Slattery ’12, as a paralegal for the New York Legal Assistance Group in the Bronx, NY;  Dan Weyl ’10, with the Heartland Alliance, an international human rights organization that provides resources for LGBT refugees resettling in the United States (as a footnote, following retirement I have been helping out the Heartland Alliance Washington, DC, office with various projects); Jane Choi ’14, working on the political team at the British High Commission in Cape Town, South Africa; Key Ishii ’12, working with African refugees in Israel; Angela Martellaro ’10, a licensed real estate agent at Chief Properties in Kansas City, MO, specializing in helping refugee families from Myanmar buy their first home; and Nikki Tourigny ’10, working for Hot Bread Kitchen, a wholesale nonprofit bakery in NYC that trains immigrant and minority women to work in the restaurant industry.  Impressive!

On a personal note, I graduated in 1970 from Lawrence University, just up the road from Beloit in Appleton, WI. Like Beloit, Lawrence is a member of the Associated Colleges of the Midwest.

I majored in History, minored in German, and spent a semester abroad in Germany. I found that a broad research and writing intensive, liberal arts eduction that promoted critical analysis and effective dialogue was the best possible preparation for all that followed: U.W. Law School, government attorney, private practice of immigration law, and several Senior Executive Service positions with the U.S. government, as well as Adjunct Professor positions. I spent the last 21 hears of my career as a U.S. Immigration Judge at the appellate and trial levels and served as Chairman of the BIA for six years. I can’t imagine a better preparation for the global perspective, analytical ability, and research and writing skills needed for judicial work than what I received at Lawrence. I just wish that someone like Professor Esperanza had been teaching her innovative approach to cultural anthropology when I was an undergrad!

Finally, I might add that Professor Esperanza and her husband Paul, who works in Administration at the College, are part of a a group of talented young professionals, which includes my daughter Anna, who teaches middle school English in the Beloit Public Schools, her husband Daniel, and their children, who have chosen to make their homes in Beloit, near the College. They enjoy and actively participate the in Beloit community and are big supporters of the “Beloit Proud” movement.

One thing that caught my eye in Elizabeth’s report is the first item:

“Update from Regina Rau, Acting Court Administrator-NYC:

Effective 7/3/17 Judge Tsankov will be assigned to the Varick Street Court.  Until further notice, any case on her NYC docket from 7/3/17 on will not be going forward.

Judge Chew will be retiring at the end of June. However his future cases will be heard by another Immigration Judge so all of your hearing dates will remain the same.”

In the case of Judge Tsankov’s docket, sure sounds like more “Aimless Docket Reshuffling” (“ADR”) to me.  And, based on my experience and what I’ve been hearing from folks in and dealing with the Immigration Courts, I wouldn’t “bet the farm” on all of Judge Chew’s cases being heard on schedule either.

HOYA LAW REDUX — IMMIGRATION LAW & POLICY — Summer 2017 — Read “Welcome To the Breakfast Club: Introduction To Immigration Law & Policy, Georgetown Law Summer 2017 Edition”

I walked into Room 5020 at Hotung Hall. Windows, daylight! Wow! I felt almost like I had achieved tenure! After a two-year hiatus, I was back as an Adjunct Professor of Law at Georgetown. This time, I was off of the “night shift” and out of the windowless subterranian classroom in McDonough Hall. I think McDonough was where, as a newly hired Attorney Adviser at the Board of Immigration Appeals,  I took “Immigration Law & Procedure” in 1974 from the late Charles Gordon, then General Counsel of the INS and Adjunct Professor. Perhaps in the same classroom.

The students filed in. The energy and brain waves (certainly not mine) zinged around the room. A number of PhDs, a Chemist, a Patent Examiner, a licensed Social Worker, someone with a “big law” job already lined up — some working on second, or even third careers, others just getting started. Bright, curious, engaged. They had already accomplished impressive things, but wanted to achieve more. No “traditional immigration junkies,” but all had some personal connection with immigration and a desire to learn more.

And, they were highly motivated. Everyone did the first assignment and reported on what they had learned. As a teacher, doesn’t get much better.

I wasn’t sure I could make this happen. Although retired from the court, I’m actually more or less “booked” for various family, professional, and educational events through next October! So, when Georgetown contacted me, I initially was hesitant. But, with the help of Tiffany Joly, Director of LLM Academic Services and the incomparable Sarah Kinney, Assistant Director of LLM Academic Services, we were able to “compress” the summer semester into an intensive five weeks. I have always been impressed with the helpfulness and skill of the Georgetown Law administrators. Everyone knows exactly what they are doing, and they always patiently explain the process to, and meet the needs of, Adjunct Professors. It makes Georgetown a great place to teach. I’m also glad that my good friend, Professor Andy Schoenholtz, a Director of the CALS Asylum Clinic at Georgetown, brought me into the “Georgetown family” in 2012 and helped me return this summer.

Here’s the text of my “introductory lecture.” Although some of you have read earlier versions, there is some “new stuff” in here.

“When Roger Ailes died, essays about him ranged from adoring to vilifying. As creator of Fox News, he was perhaps the nation’s most influential political messenger — or propagandist — of the past 50 years.

One aspect of any honest obituary, of course, was his misogyny. Ailes was finally forced out at Fox in 2016 after years of sexual harassing women employees. His 17-year-old son threatened his father’s accusers at the funeral, warning mourners that he wanted “all the people who betrayed my father to know that I’m coming after them, and hell is coming with me.”

But what I found most interesting in immersing myself in analyses of Ailes’ life was how little his craft had to do with liberal versus conservative ideology.

Rather, Ailes was perhaps the master of the dark art of inventing and relentlessly reinforcing hateful caricatures of political opponents — in his case, people of color, bureaucrats, university professors and, of course, the media.

His brilliant execution of that art culminated in Donald Trump.

Ailes, as is widely known, learned from Richard Nixon, for whom he worked as a young television consultant. Nixon launched his political career much earlier by championing “forgotten Americans,” lunch-pail-toting working men whose fortunes, in Nixon’s telling, were stymied by taxes and regulations imposed upon them by far-away elites.

The rest, as they say, is history. Nixon appealed to his “silent majority” to stand against anti-war and civil rights protesters. Democrats opened the floodgates to Republican demagoguery by advancing civil rights. The GOP today has broadened its pool of villains to include Latino and Muslim immigrants.

The 1980s brought jolly Ronald Reagan with his fantastical stories about welfare queens, followed by George H.W. Bush’s law and order and patriotism themes, and so on.

“Individual issues would come and go — acid, amnesty and abortion in 1972, and immigration, political correctness and transgender bathrooms in 2016 — but the attacks on liberals as elite, out of touch and protective of the ‘wrong people’ came from the same playbook,” wrote David Greenberg, a Rutgers professor of history and journalism, in a New York Times op-ed on Ailes.

OK, but why does it always work?

Why are so many — especially older, white, middle-class people — so susceptible to this toxic narrative when it is clear that the trickle-down GOP policies that follow do them so little good?

Maybe, I theorize, it has something to do with how we were all taught.

I’ve talked with many friends about the flag-waving jingoism of our pre-college education, in which our nation was portrayed as perfect, our leaders without fault.

My formal education began when Dwight Eisenhower was president, an era of unfettered national pride. We were a paragon of liberty and justice and never fought in unjust wars. It was as if someone decided that American children could not process the slightest balance or shade of gray.

In this frame, Andrew Jackson was, as Trump likes to say, a glorious “swashbuckler” like himself, not a president who drove Native Americans from their homes, killing thousands in the process. Nor were we ever taught that Jackson, George Washington, Thomas Jefferson and other forefathers owned slaves.

It seems the goal was always to convey “American exceptionalism,” or, more bluntly, reinforce a cultish sense of American superiority.”

Lots of folks don’t like it when we put US history in perspective. For example, during the “glory days” of my childhood in the 1950’s millions of African Americans throughout the nation, and particularly in the South, were deprived of the basic rights of US citizenship. This was notwithstanding the clear dictates of the 14th Amendment, which had been added nearly a century earlier.

The US and many state governments merely decided not to enforce the law of the land. So much for all of the “rule of law” and “nation of laws” malarkey purveyed by right wingers today.

Indeed, many southern states enacted discriminatory laws that were directly contrary to the 14th Amendment. And, amazingly, for the majority of the 19th and 20th Centuries, courts of law at all levels were complicit in enforcing these unconstitutional laws and ignoring the14th Amendment!

NYT: DAVID BROOKS: Our Infant Prez! — “What if there is no there there?”

Brooks writes in this NY Times op-ed:

“At certain times Donald Trump has seemed like a budding authoritarian, a corrupt Nixon, a rabble-rousing populist or a big business corporatist.

But as Trump has settled into his White House role, he has given a series of long interviews, and when you study the transcripts it becomes clear that fundamentally he is none of these things.

At base, Trump is an infantalist. There are three tasks that most mature adults have sort of figured out by the time they hit 25. Trump has mastered none of them. Immaturity is becoming the dominant note of his presidency, lack of self-control his leitmotif.

First, most adults have learned to sit still. But mentally, Trump is still a 7-year-old boy who is bouncing around the classroom. Trump’s answers in these interviews are not very long — 200 words at the high end — but he will typically flit through four or five topics before ending up with how unfair the press is to him.

. . . .

Second, most people of drinking age have achieved some accurate sense of themselves, some internal criteria to measure their own merits and demerits. But Trump seems to need perpetual outside approval to stabilize his sense of self, so he is perpetually desperate for approval, telling heroic fabulist tales about himself.

“In a short period of time I understood everything there was to know about health care,” he told Time. “A lot of the people have said that, some people said it was the single best speech ever made in that chamber,” he told The Associated Press, referring to his joint session speech.

Third, by adulthood most people can perceive how others are thinking. For example, they learn subtle arts such as false modesty so they won’t be perceived as obnoxious.

But Trump seems to have not yet developed a theory of mind. Other people are black boxes that supply either affirmation or disapproval. As a result, he is weirdly transparent. He wants people to love him, so he is constantly telling interviewers that he is widely loved. In Trump’s telling, every meeting was scheduled for 15 minutes but his guests stayed two hours because they liked him so much.

We’ve got this perverse situation in which the vast analytic powers of the entire world are being spent trying to understand a guy whose thoughts are often just six fireflies beeping randomly in a jar.

“We badly want to understand Trump, to grasp him,” David Roberts writes in Vox. “It might give us some sense of control, or at least an ability to predict what he will do next. But what if there’s nothing to understand? —

And out of that void comes a carelessness that quite possibly betrayed an intelligence source, and endangered a country.”

My wife Cathy, a retired preschool teacher, has been saying for some time now that Trump’s behavior reminds her of the four-year-olds that she used to deal with on a daily basis. I guess Brooks has the same impression.
