Trump administration ending in-person interpreters at immigrants’ first hearings

WASHINGTON — The Trump administration is preparing to replace in-court interpreters at initial immigration court hearings with videos informing asylum seekers and other immigrants facing deportation of their rights, The Chronicle has learned.

The administration portrays the change as a cost-saving measure for an immigration court system bogged down under a growing backlog. But advocates for immigrants are concerned the new procedure could jeopardize their due-process rights, add confusion and potentially make the system less efficient by causing more of them to go underground or appeal cases.

The Justice Department informed the nation’s immigration judges of the change last month at a training session, multiple sources familiar with the situation told The Chronicle.

At issue are “master calendar” hearings where immigration judges meet with undocumented immigrants, usually dozens of them, in rapid succession to schedule their cases and to inform them of their rights. The quick sessions are intended mainly to be sure the immigrants understand what is happening and know when their next hearing will be and what steps they need to take in the interim.

Under the new plan, which the Justice Department told judges could be rolled out by mid-July, a video recorded in multiple languages would play informing immigrants of their rights and the course of the proceedings. But after that, if immigrants have questions, want to say something to the judge or if the judge wants to confirm they understand, no interpreter would be provided.

Many of the immigrants come from Central America, but collectively they speak a diverse range of indigenous languages and sometimes don’t know Spanish. Immigrants from all over the world also come before the court system, which is run by the Justice Department.

The shift would especially affect immigrants who do not have attorneys to explain proceedings. Many immigrants lack representation at the initial hearing, and legal services around the country say they are being stretched thin. The government does not provide attorneys.

Instead of turning to an in-court interpreter, judges would have to rely on any who happen to be in the building for other purposes, or call a telephone service for on-demand translation that judges say can be woefully inadequate or substantially delayed.

“It’s a disaster in the making,” one judge said, speaking on condition of anonymity because the person did not have Justice Department approval to talk publicly. “What if you have an individual that speaks an indigenous language and has no education and is completely illiterate? You think showing them a video is going to completely inform them of their rights? How are they supposed to ask questions of the judge?”

The Justice Department billed the move as a cost-saving measure. Sources familiar with the interpreter situation say there have been ongoing issues with the budget and the contract with the primary interpreter provider, leading the administration to encourage more use of the telephone service and look for other ways to keep costs down.

A Justice Department who was not authorized to speak on the record said the shift away from in-person interpretation was “part of an effort to be good stewards of (the department’s) limited resources.” The official said the direction to judges was not a policy change, but declined to elaborate.

The immigration judges union, the National Association of Immigration Judges, said the change was another in a line of steps the administration has taken to force judges to do more with fewer resources at the risk of fairness.

Asked to comment, union President Ashley Tabaddor, a judge in Los Angeles, said the Justice Department had not given enough notice for the union to raise objections or provide input on the change.

She dismissed budget concerns as a justification.

“Interpreter cost is not a surprise cost — it’s an integral part of every case,” Tabaddor said. “If they actually look at the courts as a real court, they would never be dismissive of the role of an interpreter. But the fact that we are here and have these budget shortfalls means they have prioritized the budget in a way that is dismissive of the integral role of the interpreters, and reflects the flaw of having the courts run by a law enforcement agency.”

The immigration courts have been overwhelmed for years with a burgeoning load that is now approaching 1 million cases. The judges association has advocated for the courts to be removed from the Justice Department and made an independent system.

The Trump administration has made a series of efforts it says are intended to speed up the process and avoid having hundreds of thousands of immigrants build lives in the U.S. while waiting to learn if they will be deported. Critics, including immigration lawyers and advocates and some judges, say many of the changes have actually undermined the system, confusing immigrants and creating grounds for lengthy appeals.

Some judges said it’s common at master calendar hearings for immigrants to misunderstand the advice to find a lawyer. Some conclude that means they should not return for their next hearing if they don’t have a lawyer. Failing to appear is grounds for a deportation order.

The system is “not an assembly line,” said Jeffrey Chase, a former immigration judge and former senior legal adviser to the immigration appeals court who now volunteers for organizations that provide legal assistance to immigrants. He said the master calendar is most immigrants’ first impression ever of a court system, and that a lack of interpreters and interaction with a judge could foster a sense of distrust.

“You’re dealing with people’s lives,” Chase said. “All kinds of crazy issues arise. Sometimes there’s a health issue, and you need to be able to communicate to find this stuff out.

“And also, people come in so afraid,” Chase said. “If they’re able to talk with the judge and realize, ‘This person is a human being and they’re able to work with me’ — being played a tape reinforces this feeling that, ‘I’m dealing with this deportation machine.’ ”

Chase said concerns about the cost and length of the process are legitimate, but he questioned the administration’s way of addressing them.

“You always hear the word ‘efficiency’ from this administration now, and it’s very infrequent that you hear ‘due process’ or ‘justice,’ ” Chase said. “There’s no longer concern about the balance. It’s totally efficiency-heavy these days, and I think it’s being decided by people who haven’t been in the court much and don’t understand the consequences.”

My suggestion: In the future, any legal claims involving Members of Congress or Article III Judges and any members of their immediate families should be tried only in U.S. Immigration Court. The opposing party should be given the ability to:

  • Select the judge;
  • Write or rewrite the rules governing the litigation; 
  • Change any result with which they might disagree; and perhaps most important
  • The proceedings shall be conducted in a language that only the opposing party and the “judge” understand.

That way, these folks would be receiving the same type of “justice” under the Constitution that they are happy to inflict on individuals in today’s Immigration Courts. Seems fair to me.

WASHINGTON, DC – On July 2, 2019, Attorney General (AG) Barr published a final rule, further expanding his authority to reshape immigration law. The rule was issued in a highly unusual manner by resurrecting an old proposed regulation from 11 years ago and making it final within 60 days without any opportunity for public comment.

AILA President Marketa Lindt said, “This regulation exemplifies why the immigration courts should not be housed under the Department of Justice (DOJ). Under this administration, the AG has already utilized the certification power in an unprecedented manner to unilaterally strip immigration judges of basic operational authorities, interfere with judicial independence, and even attempt to rewrite asylum and detention laws. The American legal system is designed with fundamental procedural protections, such as briefing by the parties, to ensure the decision maker-here the AG-hears all points of view before deciding an important case. This new rule, however, authorizes the AG to singlehandedly designate Board of Immigration Appeals (Board) decisions as precedent – and do so literally overnight bypassing the necessary legal procedures and without any checks and balances.”

AILA Executive Director Benjamin Johnson added, “This is the most aggressive effort to unify control over the immigration courts in 20 years; I have never seen an administration claw back a discarded rule like this in order to further assert its power. The scope of this power grab could be immense. This rule attempts to shield decisions issued by the Board – including decisions for which the Board didn’t even bother to write an opinion – from federal court review and tries to force the U.S. Courts of Appeals to presume that the Board reviewed all the available information and claims made by the parties even if there’s nothing to show the Board did so. Simply put, the AG will have more power with less oversight, and immigrants’ right to appeal to the federal courts will be far more limited. This attack on the judicial branch proves further that our nation urgently needs an independent immigration court system separate from the Department of Justice. Nothing less will suffice.”

Every Court of Appeals Judge who signs off on one of these constitutionally defective removal orders produced by EOIR, an illegitimate “court” that functions without either fundamental fairness or impartiality under procedures that no such judge would accept if applied to them or their loved ones, should hang his or her head in shame.

Once the Trump nightmare is over, courage and integrity to stand up against Government overreach should be the touchstone for all future Article III judicial appointments. No more “go along to get along” Federal Judges at any level of the system! The Judicial Branch was actually conceived and established as a protector of liberty and justice against tyranny, not as an enabler of, and apologist for, “abuses by the Crown” (or in this case, “the Clown”).

What kind of “judge” stands by and watches while empowered cowards like Trump and Barr unconstitutionally “beat up” on America’s most vulnerable who seek only the basic justice and fairness that our Constitution supposedly guarantees to “all persons.” Judges who allow the dehumanization and “de-personification” of others, in others words “Dred Scottification,” might someday find themselves and those they actually care about becoming “Dred Scott” by their dereliction of duty!

The debate over whether “concentration camps” is the right term for migrant detention centers on the southern border has drawn long-overdue attention to the American government’s dehumanizing treatment of defenseless children. A pediatrician who visited in June said the centers could be compared to “torture facilities.” Having studied mass atrocities for over a decade, I agree.

At least seven migrant children have died in United States custody since last year. The details reported by lawyers who visited a Customs and Border Protection facility in Clint, Tex., in June were shocking: children who had not bathed in weeks, toddlers without diapers, sick babies being cared for by other children. As a human rights lawyer and then as a political scientist, I have spoken to the victims of some of the worst things that human beings have ever done to each other, in places ranging from Cambodia to the Democratic Republic of the Congo to Sri Lanka. What’s happening at the border doesn’t match the scale of these horrors, but if, as appears to be the case, these harsh conditions have been intentionally inflicted on children as part a broader plan to deter others from migrating, then it meets the definition of a mass atrocity: a deliberate, systematic attack on civilians. And like past atrocities, it is being committed by a complex organizational structure made up of people at all different levels of involvement.

Thinking of what’s happening in this way gives us a repertoire of tools with which to fight the abuses, beyond the usual exhortations to call our representatives and donate to border charities.

Those of us who want to stop what’s happening need to think about all the different individuals playing a role in the systematic mistreatment of migrant children and how we can get them to stop participating. We should focus most on those who have less of a personal commitment to the abusive policies that are being carried out.

Testimony from trials and truth commissions has revealed that many atrocity perpetrators think of what they’re doing as they would think of any other day job. While the leaders who order atrocities may be acting out of strongly held ideological beliefs or political survival concerns, the so-called “foot soldiers” and the middle men and women are often just there for the paycheck.

This lack of personal investment means that these participants in atrocities can be much more susceptible to pressure than national leaders. Specifically, they are sensitive to social pressure, which has been shown to have played a huge role in atrocity commission and desistance in the Holocaust, Rwanda and elsewhere. The campaign to stop the abuses at the border should exploit this sensitivity and put social pressure on those involved in enforcing the Trump administration’s immigration policies.

Here is what that might look like:

The identities of the individual Customs and Border Protection agents who are physically separating children from their families and staffing the detention centers are not undiscoverable. Immigration lawyers have agent names; journalists reporting at the border have names, photos and even videos. These agents’ actions should be publicized, particularly in their home communities.

This is not an argument for doxxing — it’s about exposure of their participation in atrocities to audiences whose opinion they care about. The knowledge, for instance, that when you go to church on Sunday, your entire congregation will have seen you on TV ripping a child out of her father’s arms is a serious social cost to bear. The desire to avoid this kind of social shame may be enough to persuade some agents to quit and may hinder the recruitment of replacements. For those who won’t (or can’t) quit, it may induce them to treat the vulnerable individuals under their control more humanely. In Denmark during World War II, for instance, strong social pressure, including from the churches, contributed to the refusal of the country to comply with Nazi orders to deport its Jewish citizens.

The midlevel functionaries who make the system run are not as visibly involved in the “dirty work,” but there are still clear potential reputational consequences that could change their incentives. The lawyer who stood up in court to try to parse the meaning of “safe and sanitary” conditions — suggesting that this requirement might not include toothbrushes and soap for the children in border patrol custody if they were there for a “shorter term” stay — passed an ethics exam to be admitted to the bar. Similar to the way the American Medical Association has made it clear that its members must not participate in torture, the American Bar Association should signal that anyone who defends the border patrol’s mistreatment of children will not be considered a member in good standing of the legal profession. This will deter the participation of some, if only out of concern over their future career prospects.

The individuals running detention centers are arguably directly responsible for torture, which could trigger a number of consequences at the international level. Activists should partner with human rights organizations to bring these abuses before international bodies like the United Nations Human Rights Council. They should lobby for human rights investigations, for other governments to deny entry visas to those involved in the abuses, or even for the initiation of torture prosecutions in foreign courts. For someone who is “just following orders,” the prospect of being internationally shamed as a rights abuser and being unable to travel freely may be significant enough to persuade them to stop participating.

When those directly involved in atrocities can’t be swayed, their enablers are often more responsive. For-profit companies are supplying food and other material goods to the detention centers. Boycotts against them and their parent entities may persuade them to stop doing so. Employees of these companies can follow the example of Wayfair workers, who organized a walkout on Wednesday in protest of their company’s sale of furniture to the contractor outfitting the detention centers. Finally, anyone can support existing divestment campaigns to pressure financial institutions to end their support of immigration abuses.

Many Americans have been asking each other “But what can we DO?” The answer is that we call these abuses mass atrocities and use the tool kit this label offers us to fight them. So far, mobilization against what’s happening on the border has mostly followed standard political activism scripts: raising public awareness, organizing protests, phoning our congressional representatives. These efforts are critical, but they aren’t enough. Children are suffering and dying. The fastest way to stop it is to make sure everyone who is responsible faces consequences.

PRESIDENT DONALD TRUMP:

Separation, President Obama, I took over separation. I’m the one that put it together. What’s happened though are the cartels and all of these bad people, they’re using the kids. They’re, they’re, it’s almost like slavery.

CHUCK TODD:

But let’s not punish the kids more.

PRESIDENT DONALD TRUMP:

No this has been happening —

Aren’t you — the kids are getting punished more.

PRESIDENT DONALD TRUMP:

You’re right. And this has been happening long before I got there. What we’ve done is we’ve created, we’ve, we’ve ended separation. You know, under President Obama you had separation. I was the one that ended it. Now I said one thing, when I ended it I said, “Here’s what’s going to happen. More families are going to come up.” And that’s what’s happened. But they’re really coming up for the economics. But once you ended the separation. But I ended separation. I inherited separation from President Obama.

The Post’s fact-checkers back in April explained: “The Obama administration rejected a plan for family separations, according to Cecilia Muñoz, Obama’s top adviser for immigration. The Trump administration operated a pilot program for family separations in the El Paso area beginning in mid-2017.” Trump’s claim that “Obama did it first” is both morally vapid and completely wrong: “The Trump administration implemented this policy by choice, exercising its discretion to prosecute some crimes over others. But no law or court ruling mandates family separations. In fact, during its first 15 months, the Trump administration released nearly 100,000 immigrants who were apprehended at the U.S.-Mexico border, a total that includes more than 37,500 unaccompanied minors and more than 61,000 family-unit members.” In short, “The zero-tolerance approach is worlds apart from the Obama- and Bush-era policy of separating children from adults at the border only in limited circumstances, such as when officials suspected human trafficking or another kind of danger to the child or when false claims of parentage were made.”

Jake Tapper at CNN showed the right way to confront administration members on Sunday, when he went right after Vice President Pence’s misrepresentations about the dismal condition of children still held. After playing a clip of administration lawyers arguing in the 9th Circuit that there was no responsibility to provide basic necessities to children such as toothbrushes, Pence tried to claim that he didn’t know what the lawyers were saying. Tapper kept after him:

”But this is going on right now,” Tapper said, adding “This is the wealthiest nation in the world. We have money to give toothpaste and soap and blankets to these kids in this facility in El Paso County. Right now, we do.”

“Well, of course — of course we do,” Pence said.

“So why aren’t we?” Taper asked.

Pence again dodged the question with a snicker, replying “My point is — my point is, it’s all a part of the appropriations process.”

Tapper then had to cut Pence off from the lengthy digression that followed in order to force the question again.

“But I’m talking about the kids — I’m talking about the kids our custody right now,” Taper said. “Just listen to this. This is ‘The New Yorker’ citing a team of lawyers who visited a border facility.”

Pence tried to interrupt him again, but Tapper insisted “I just want to quote this.”

“The conditions the lawyers were found were shocking,” Tapper read. “Flu and lice outbreaks were going untreated. Children were filthy, sleeping on cold floors, taking care of each other because of the lack of attention from guards.”

“I know you. You’re a father. You’re a man of faith. You can’t approve of that,” Tapper said.

“Well, I — I — no — no American — no American should approve of this mass influx of people coming across our border,” Pence stammered. It is overwhelming our system at the southern border.

“But how about how we’re treating these children?” Tapper asked, again, and Pence deflected, again.

“I was at the detention center in Nogales just a few short months ago. It is a heartbreaking scene,” Pence said, but then added These are people who are being exploited by human traffickers, who charge them $5,000 a person to entice them to take their vulnerable children…”

“But now these kids are in our custody,” Tapper said.

Pence continued to blame Democrats in Congress, but Tapper again reiterated “But I would say that I’m talking about the kids on our southern border right now.”

He told Pence “you have the power right now to go back to the White House and say, we need to make sure that these kids — first of all, that there are people taking care of them, so it is not 12-year-olds taking care of 3-year-olds, and, second of all, that they have soap, that they have toothbrushes, that they have combs, that we’re taking care so they don’t all get the flu.”

Pence once again tried to blame Democrats, to which Tapper replied “I think Democrats would argue that they want to do a deal with President Trump, but he hasn’t showed any inclination.”

That’s precisely how reporters need to go after Trump and his morally deficient administration. This is the Trump administration’s policy. This is the Trump administration’s doing. This is the Trump administration’s refusal to address basic humanitarian needs (while raiding the Defense Department to build a useless wall that has nothing to do with asylum seekers presenting themselves at the border).

Allowing Trump and his ilk to bluster and flat-out lie their way through interviews might be the path of least resistance when trying to cover a lot of ground. However, if Trump and his teammates are not stopped dead in their tracks, the media become a platform for deceiving voters.

Headlines that echo the president — “Trump says Obama did it first” — are equally reprehensible. (It should be “Trump falsely blames Obama for his own policy.”) Trump, Pence and the rest are accustomed to running through their ridiculous talking points (e.g. the United States has the cleanest water and air in the world) without objection on outlets such as Fox. Other media can and must do better. And when the general-election debates roll around, moderators must be willing to correct misstatements of fact. (Or follow up by asking, “But that’s not true, is it Mr. President?”)

We’re at risk of losing not only a shared set of facts but also a uniform belief that there are such things as facts. That’s straight out of the autocratic playbook — one that the media cannot facilitate.

What is illegal is the Trump Administration’s failure to promptly and fairly process individuals at ports of entry and returning those who have passed the first step of the process, known as  “credible fear,” to Mexico where they are in danger, prevented from getting lawyers of their choice as authorized by statute, and inhibited from fairly and completely presenting their asylum cases before U.S. Immigration Judges (who themselves are not independent, fair, and impartial adjudicators since they work for Attorney General, Trump protector, and self-styled enforcement guru Bill Barr).

Oh, and how about a moratorium on Trump’s Golf Trips and Pence’s religious proselytizing trips on the public dime until every kid in Government custody  has a bed, blanket, toothbrush, and a bar of soap?

No, it isn’t really about Congressional appropriations (although the GOP in Congress certainly bears a major part of the blame for Trump’s audacious violations of human rights). Congress didn’t waste money that could and should have been spent on the welfare of asylum seekers on less important things like walls, tent cities, detention, and other “built to fail” initiatives that have done little or nothing to advance the fair and effective administration of our asylum laws. Nor did Congress make the decision not to be prepared to process the asylum seekers who have been slowly and methodically heading north since before last Thanksgiving. You wouldn’t need the world’s best intelligence service to figure out the rate of flow and predict how many might need processing.

As those of us who understand immigration know, desperate people are likely to continue to leave the failed states of the Northern Triangle until the international community deals with the causes of the migration.

Everything the U.S. has done under the “maliciously incompetent” Trump Administration, from encouraging environmental degradation, to withdrawing refugee programs and aid programs, to dumb, anti-human rhetoric, to egging Mexico on to a militarized rather than a human rights response, to idiotically trying to ”enforce” our way out of a humanitarian crisis notwithstanding decades of experience and data showing it won’t work, to empowering gangs, smugglers, cartels, and corrupt government officials, to intentionally backlogging Immigration Courts while destroying established legal principles that could have led to “fast track grants” of many deserving domestic violence asylum cases, to tying up the Federal Courts with frivolous litigation, to intentional child abuse, has made the situation immeasurably and unnecessarily worse.

Yes, Trump might be able to get away with killing and abusing hundreds, perhaps thousands, in Mexico. But even this predictable bloodbath, which he hopes to keep out of sight as the U.S. media loses interest, won’t solve the problem in the long run.

Every day Trump remains in office we diminish ourselves as a nation; but, that won’t stop human migration. It will just leave us as diminished, dehumanized, shells of humanity. It’s time to “just say no to Trump and his supporters and enablers” as they seek to destroy America!

Justice Department Argues Against Providing Soap, Toothbrushes, Beds To Detained Kids

“I find it inconceivable that the government would say” current conditions are “safe and sanitary,” as required, said a stunned Judge William Fletcher.

A Justice Department attorney this week argued in court that the federal government should not be required to provide soap, toothbrushes or even beds to detained children apprehended at the U.S.-Mexico border.

Government lawyer Sarah Fabian argued Tuesday before the U.S. Court of Appeals for the 9th Circuit that forcing children to sleep on cold concrete floors in cells is both “safe and sanitary.” 

Attorneys for the detained children are arguing that the government is not following the requirements of a 1997 settlement agreement in the case of Jenny Flores that established a framework for the humane treatment and release of detained migrant minors. Children must be housed in “safe and sanitary conditions” under the settlement. A district judge added the specific requirements that children be provided with soap and toothbrushes.

Members of the three-judge appellate panel appeared stunned by Fabian’s arguments, Courthouse News Service reported.

“Are you arguing seriously that you do not read the agreement as requiring you to do something other than what I just described: cold all night long, lights on all night long, sleeping on concrete and you’ve got an aluminum foil blanket?” asked Judge William Fletcher. “I find it inconceivable that the government would say that that is safe and sanitary.”

Judge Marsha Berzon asked Fabian: “You’re really going to stand up and tell us that being able to sleep isn’t a question of ‘safe and sanitary’ conditions?… You can’t be sanitary or safe as a human being if you can’t sleep.” (See the video below at 24:30.)

Fabian was challenging an order by U.S. District Judge Gee in Los Angeles, who appointed an independent monitor to ensure that the federal government complies with the Flores settlement and specifically required such items as soap and toothbrushes. Fabian argued that such requirements are not detailed in the original settlement. (In the video at 26:40.)

“One has to assume … parties couldn’t reach agreement on how to enumerate that or it was left to the agencies to determine,” Fabian argued.

Fletcher responded: “Or it was relatively obvious — at least obvious enough so that if you’re putting people into a crowded room to sleep on a concrete floor with an aluminum foil blanket on top of them, that doesn’t comply with the agreement.”

He added: “It may be they don’t get super-thread-count Egyptian linen, I get that. … I understand at some outer boundary, there may be some definitional difficulty. But no one would argue that this [current situation] is safe and sanitary.”

As for soap, it “wasn’t perfumed soap, it was soap. That sounds like it’s part of ‘safe and sanitary,’” he added. “Are you disagreeing with that?”

Judge A. Wallace Tashima said that such items are “within everybody’s common understanding that if you don’t have a toothbrush, if you don’t have soap, if you don’t have a blanket, it’s not safe and sanitary. Wouldn’t everybody agree to that?” he asked. “Do you agree to that?”

Fabian, who appeared to stumble throughout much of her presentation, responded: “Well … maybe.”

The attorney for the children argued that, although soap and toothbrushes weren’t specifically mentioned in the 1997 settlement, they must be provided because they would be “reasonably interpreted” as part of the agreement under contract law.

The “first thing you do is honor the plain meaning” of words like “safe and sanitary,” said Peter Schey. “Today we have a situation where once a month a child is dying in custody. Certainly the Border Patrol facilities are secure, but they’re not safe and they’re not sanitary.”

It’s not clear when the 9th Circuit, based in San Francisco, will issue a decision in the case.

The federal government earlier this month stopped English language classes, recreational programs like soccer games and legal aid for locked-up children.

Honestly, how does Sarah Fabian sleep at night? If she has kids, what does she tell them about what she does to other people’s kids for a living?

 

And, what can you say about 9th Circuit judges who accept frivolous, totally disingenuous arguments from Government counsel. A private attorney who wasted the court’s time and disrespected its integrity and functions in this matter would almost certainly be disciplined or disbarred in short order.

 

At one time, DOJ attorneys were expected to adhere to higher standards of ethics because of their role in protecting the public interest and aiding the courts in pursuit of justice. Why in the age of Trump, Sessions, Barr, and Solicitor General Noel Francisco are ethical standards no longer enforced against DOJ Attorneys? And that goes right up to the top, as both Barr and Sessions have clearly interfered with and participated in quasi-judicial immigration decisions after showing clear bias against migrants and in favor of DHS Enforcement, in violation of ethical standards.

Folks like Trump and his cronies always depend on complicit subordinates, as well as complicit courts, to carry out their vile and illegal programs.

Trump admin considers temporary courts along the southern border

The Trump administration is considering building temporary courts along the southern border as part of an effort to expand its policy of returning some asylum seekers to Mexico for the duration of their immigration proceedings, according to two administration officials.

The US recently struck an agreement with Mexico that included expanding the policy, which, the administration argues, serves as a deterrent since it keeps migrants waiting in Mexico, instead of within the US.

Site assessments have been completed for almost all the ports of entry to determine where such temporary immigration courts, described by sources as “soft-sided,” would be needed, according to an administration official.

The facilities could be used to conduct hearings via video teleconference, which has previously been used by immigration courts elsewhere in the country, the official said.

The deal to expand the “Remain in Mexico” program across the border earlier this month came amid threats to impose tariffs on Mexico if it didn’t bolster enforcement.

Mexico, the joint declaration said, would authorize the entrance of asylum seekers, and offer jobs, health care and education to those individuals. In return, the US must expedite the asylum adjudication process. Consideration to erect immigration courts, which are overseen by the Justice Department, appears to be a step in that direction.

Migrants who are sent to Mexico to await their court hearings return to the US through a port of entry along the southern border to then be transported to their hearing. The temporary courts would allow migrants to have their hearings near or at the port, rather than being bussed miles away, said the official.

It also would likely help alleviate the caseload at San Diego and El Paso immigration courts, which have been taking these cases.

The Justice Department’s Executive Office of Immigration Review referred questions about the so-called Migrant Protection Protocols program to the Department of Homeland Security. A DHS official confirmed that the temporary structures are being considered, adding that the crisis has strained the immigration courts along the border. The administration has repeatedly requested additional immigration judges to chip away at a massive backlog that’s led to cases being scheduled years down the road.

The “Remain in Mexico” policy began in January and immediately received pushback back from immigrant advocates and lawyers who argue that it puts migrants who are predominantly from Northern Triangle countries of Guatemala, Honduras, and El Salvador and seeking asylum in the US in harm’s way.

As of May, the US had returned around 6,000 people to Mexico to await their court hearings. The number of migrants falling under the policy appears to be doubling over time, but it is unclear how many additional people have been added to the program since the agreement with Mexico was struck.

One of the locations actively working toward implementing the program is the Rio Grande Valley region in Texas, the busiest sector for arrests of people illegally crossing the border, a senior Border Patrol official told CNN.

Before the program can get underway in the region, officials need to first have the infrastructure in place, including logistics for court hearings. The US also needs to engage with Mexico and ensure its government is willing to receive migrants across the border, said the official.

Like other administration immigration policies, returning migrants to Mexico has also been challenged in court.

In May, a federal appeals court allowed the Trump administration to continue returning some asylum seekers to Mexico for the time being. A panel of the 9th US Circuit Court of Appeals, while split on some issues, listed a number of factors that went into the decision, including risk of injury in Mexico and negotiations between the US and Mexico.

Trump is emboldened by a dysfunctional Congress under Mitch McConnell and complicit Article III Courts like the 9th Circuit, unwilling to put an end to this grotesque perversion of our statutory laws, our Constitution, and human rights. GUATEMALA CITY (Reuters) – A U.S. plan to make asylum seekers from Honduras and El Salvador seek refuge in Guatemala instead of the United States would endanger, not protect, refugees, a prominent rights group said on Friday as U.S. negotiators met Guatemalan officials.

U.S. rights group Human Rights First said it was “simply ludicrous” for the United States to assert that Guatemala was capable of protecting refugees, when its own citizens are fleeing violence. 

“The Trump administration is doubling down on its efforts to block, bar and punish refugees for attempting to seek asylum in the United States,” said Eleanor Acer, senior director for refugee protection at Human Rights First.

“These policies put the lives of refugees in great danger.”

Guatemala, like its neighbors Honduras and El Salvador, suffers high levels of violence, driven largely by transnational street gangs including MS-13, which operate across borders in all three countries. Many asylum seekers cite gang threats as the reason they come to the United States for refuge.

Tens of thousands of people have left Guatemala to seek U.S. asylum this year. Nearly 150,000 undocumented Guatemalan families have reached the U.S. border since October, according to U.S. Customs and Border Protection, many of them citing fear of violence in their home country for seeking asylum.

U.S. Vice President Mike Pence said this week the two nations had a deal under which Guatemala would take asylum seekers from neighbors. “They ought to be willing to apply for asylum in the first safe country in which they arrive,” he said.

Details of the plan have not been made public, and Guatemala has not publicly confirmed talks that the U.S. State Department said were taking place in Guatemala on Friday.

The talks were about a range of initiatives aimed at reducing illegal immigration, including “improved asylum processing,” a State Department spokeswoman said on Friday in response to a Reuters question about the Guatemala asylum plan.

The emerging plans flow from a U.S.-Mexican deal struck to avert tariffs threatened by U.S. President Donald Trump to push Mexico to do more to stem immigration through its territory.

That deal included sending 6,000 members of Mexico’s National Guard to the border and expanding a separate asylum program under which U.S. asylum seekers are sent back to Mexico to await U.S. court hearings.

If those measures fail, Mexico has agreed to consider becoming a “safe third country” where all asylum seekers passing through the country would have to apply for refuge, instead of the United States

Mexico’s Foreign Minister Marcelo Ebrard said other countries should share the load, including Guatemala.

Guatemala, one of the poorest countries in the Americas, has little experience receiving large numbers of asylum seekers and a large wave of refugees would strain limited resources. Just 262 people applied for refugee status in Guatemala between January and November 2018, according to data from the U.N. rights agency UNHCR.

By comparison, nearly 155,000 families from El Salvador and Honduras have been apprehended at the U.S. border since October, with many of them requesting asylum.

Guatemala holds presidential elections on Sunday, after a campaign that has highlighted the lack of rule of law in the country, including the influence of drug traffickers on politics in the country.

As pointed out in the article, Guatemala is one of the most dangerous countries in the world for its own citizens.  It doesn’t even have a functioning asylum system. So, how could it provide access to a “full and fair” asylum adjudications to non-citizens as required by our law.  The answer is simple – it can’t, by any stretch of the imagination. After all, living long enough to apply, even if there were a functional asylum adjudication system, would be a prerequisite to a legitimate “Safe Third Country” process.

Seems like clear abuses of authority like this by Trump and Pence that should be enough to remove both of them from office forthwith in a functioning democracy. But, that’s not going to happen before 2021, if then.

In the meantime, Dems should make a note that when responsible Government returns at some point in the future, the law should be amended to require at least Senate ratification of any future “Safe Third Country Agreement” to prevent future Executive abuses like this. Indeed, the failure of this Congress to revoke Trump’s authority to enter into these clearly bogus and ill-intended “Safe Third Country” agreements is an indelible stain upon its reputation.

“Safe Third Country” was intended to be about refugee burden sharing among countries with substantially comparable due process systems for adjudicating claims under the Refugee Convention. It was never intended to allow the U.S. to “outsource” asylum adjudication to dangerous, major human rights violators with dysfunctional asylum adjudication systems. What Trump and Pence are proposing is little more than outright murder and human rights abuses inflicted on asylum seekers in violation of both international and U.S. laws.

Sindy Marilu Alvarez Lagos testified credibly that she and her then-seven-year-old daughter, natives and citizens of Honduras, were threatened with gang rape, genital mutilation, and death if they did not comply with the extortionate demands of a Barrio 18 gang member. Unable to meet those demands and fearing for their lives, Alvarez Lagos and her daughter fled to the United States, where they sought asylum, withholding of removal, and protection under the Convention Against Torture.

Now, almost five years later, an immigration judge and the Board of Immigration Appeals have issued a total of three separate decisions denying Alvarez Lagos’s claims. The government defends none of those decisions, including the most recent, which came after we agreed, at the government’s request, to remand the case for reconsideration. Instead, the government admits that errors remain, but argues that we should leave them unaddressed and simply remand once again so that the agency may have a fourth opportunity to analyze Alvarez Lagos’s claims correctly.

We decline that request. A remand is required here on certain questions that have yet to be answered, or answered fully, by the agency. But we take this opportunity to review the agency’s disposition of other elements of Alvarez Lagos’s claims. For the reasons given below, we reverse the agency’s determination with respect to the “nexus” requirement for asylum and withholding of removal. And so that they will not recur on remand, we identify additional errors in the agency’s analysis of the “protected ground” requirement for the same forms of relief, and in the agency’s treatment of Alvarez Lagos’s claim under the Convention Against Torture.

It’s partially on the Article IIIs. Great decision in many ways. But, this type of injustice occurs daily in our unconstitutional U.S. Immigration Courts. How many Central American asylum applicants get this type of representation—Steve Shulman of Akin Gump for a pro bono lawyer, Tom Boerman as an expert? Not very many.

How many can be this persistent, particularly if detained or sent to Mexico to wait? Almost none! I think that if these respondents were in “Return to Mexico” they would have long ago been forced to give up and accept “Death Upon Return.”

This case should have been a “no brainer grant” five years ago. Could have been done at an Asylum Office (under a more rational system) or by DHS stipulation. THIS abuse of the legal system and gross waste of public resources by DHS and DOJ is the reason why we have unmanageable Immigration Court backlogs, not because asylum applicants and their representatives assert their legal rights.

The Office of Immigration Litigation (“OIL”) didn’t even bother to defend any of the EOIR actions here!  So, after five years why is it “Due Process” for the Fourth Circuit to give the BIA yet another opportunity to come up with bogus reasons to deny asylum.

An Article III Court fulfilling its oath to uphold the laws and Constitution could have ordered this case to be granted and either exercised contempt authority against those at DOJ responsible for this mess or ordered an independent investigation into the judicial incompetence and bias evident here. At the least, the court should have removed any judge having had a role in this abomination from any future proceedings involving these respondents.

Cases such good as this also illustrate the continuing dereliction of duty by Article III Courts who continue to “go along top get along” with the absurdly unconstitutional position that unrepresented asylum applicants can receive “Due Process” in today’s overtly unfair and biased Immigration Courts. The Due Process clause applies to all persons in the U.S., and the right to a fair asylum hearing exceeds the rights at stake in 98% of the civil litigation and most of the criminal litigation in the Federal Courts. If the Article III Courts actually viewed asylum applicants as “persons,” that is “fellow human beings,” rather than dehumanized “aliens,” this farce would have ended decades ago! Folks represented by Steve Schulman and Akin Gump can’t get a “fair shake” from EOIR; what chance does any unrepresented applicant have?

You reap what you sow, and what goes around comes around! If Article III Courts want to be taken seriously and respected, they must step up to the plate and stop the systematic bias against asylum applicants (particularly women and children from Central America) and the abuses like this occurring every day in our unconstitutional U.S. Immigration Courts!

History is watching and making a record, even if those wronged by the Article IIIs all too often don’t survive or aren’t in a position to confront them with their dereliction of legal duties and the obligations human beings owe to each other.

Alexandria, VA, June 9, 2019.  After a week of petulance, threats, and self-created drama, Trump produced a resounding trade and immigration dud. Faced with advisors telling him that he was endangering the economy, the only thing propping up his sagging popularity, a potential rebellion among GOP legislators, and an unexpectedly tough and resolute Mexico, Trump backed off of his insane and blatantly illegal plan to ignore U.S. asylum obligations and thereby rocket the U.S. to the upper echelons of international scofflaws and human rights violators. 

The latter scheme, known as “safe third country,” would have mis-designated Mexico and, incredibly, Guatemala, two clearly “unsafe” countries to do the U.S.’s job by processing tens of thousands of asylum applications from those fleeing the Northern Triangle. Neither of the two countries has a viable, fair, and effective asylum adjudication system and both have major safety and human rights issues.

Instead, Trump accepted a vague compact by which Mexico and the U.S. basically agreed to do what they had already been doing without taking any decisive or effective action to address the actual humanitarian crisis in the Northern Triangle that Trump and his flunkies have consistently mischaracterized as a “law enforcement emergency.” Indeed, the New York Times reported that most of Mexico’s “unprecedented steps” had already been worked out in secret with deposed DHS Secretary Kirstjen Nielsen months ago. https://www.nytimes.com/2019/06/08/us/politics/trump-mexico-deal-tariffs.html. To be sure, desperate and vulnerable asylum seekers, particularly women and children, will continue to abused, raped, beaten, extorted, obscenely tortured, and killed with impunity and little if any recourse as a result of this week’s actions. But, at least for now, the U.S. and Mexico are maintaining much of the basic framework of domestic and international protection laws. 

Contrary to the lies and false narratives spread by Trump and his DHS cronies, U.S. law is not filled with “loopholes.” Rather, it is a fairly straightforward implementation of the international protection regime and treaties that have been in effect since World War II to prevent another holocaust from occurring on our watch. 

If anything, since the enactment of the Refugee Act of 1980, the U.S. has watered down its asylum commitment somewhat by adding a legally tenuous “credible fear” process to “pre-screen” arriving asylum applicants in mass migration situations. However, to date, the DHS under Trump has been too incompetent, misdirected, and frankly downright stupid to utilize this streamlined screening process fairly and efficiently. 

By treating a somewhat predictable humanitarian refugee flow as a bogus “law enforcement problem” and mindlessly shoving cases into a “captive” court system that they already had abused, mismanaged, and destroyed, the Administration lost effective control. In panic, they have tried to blame the refugees, Democrats, Mexico, Obama, judges, the media, and even the truly hapless failed states of the Northern Triangle for their largely self-created human and operational disaster.

The first of the “unprecedented steps,” involves Mexico sending approximately 6,000 National Guard troops to the Guatemalan border to control illegal crossings. Never mind that the Mexican National Guard is a recent creation that exists largely on paper. Also, forget that Mexico has a questionable record of controlling corruption and systematic human rights abuses among its existing police and military forces.

The U.S., a much larger, better organized, and more prosperous country than Mexico, has resorted to militarizing the border, mass incarceration, family concentration camps, kids in cages, malicious criminal prosecutions, family separations, walls, fences, overt political interference in the asylum adjudication system, and violating international protection norms. These “gonzo” enforcement efforts not only failed to stem the tide, but have actually aided smugglers and traffickers and increased the flow of migrants. 

Will newly minted, untrained Mexican troops succeed where the might of the U.S. has failed miserably? Don’t count on it. 

Also, the last time I checked, it appeared that most of the Mexican coast and some parts of the U.S. are reasonably accessible by boat from the Northern Triangle. So, assuming that the Mexicans could “shut down” their land border with Guatemala, why wouldn’t smugglers “take to the sea?” How’s that Mexican Navy?

The second “unprecedented step,” is a continuation and expansion of the existing “Remain in Mexico Program.” This toxic gimmick punishes those who have been legally determined to have a “credible fear” of persecution by making them remain in some of the most dangerous locations in the world where they are intentionally and illegally impeded in many ways from pursuing their U.S. asylum claims from Mexico. The results of this ill-advised effort by Trump to circumvent U.S. asylum laws reads like a “legal toxicology report:” “Aimless Docket Reshuffling,” mass confusion, lack of information, insufficient and deficient hearing notices, massive violations of the statutory right to be represented by counsel, no opportunity to fairly prepare, document, and present asylum claims, interference with the attorney-client relationship by DHS, and few actual case completions to name just a few of the many abuses. And, how will an already dysfunctional EOIR deal with yet another round of “new priorities” and more “Aimless Docket Reshuffling?”

A Federal District Judge actually enjoined this circus before it could get rolling. But, a “tone-deaf panel” of the Ninth Circuit allowed Trump’s assault on the rule of law to go forward, at least for now. 

Nevertheless, the case remains pending with the Ninth Circuit. As EOIR’s rushed and sloppy work product starts to accumulate on their docket and the bodies and horror stories start to pile up in Mexico, more responsible Circuit Judges might actually force the Administration to comply with the law and the Constitution, not to mention simple human decency.

Mexico has pledged to “accept and protect” those sentenced to remain there. But, the Mexican border locations to which individuals are forced to return are dangerous for a reason. Presumably, if Mexican can’t maintain safety and order for its own citizens, it won’t do any better for vulnerable asylum seekers.

Finally, in third “unprecedented step,” Mexico and the U.S. agreed to promote the “Comprehensive Development Plan launched by the government of Mexico in concert with the governments of El Salvador, Guatemala and Honduras” to create “prosperity, good governance and security in Central America.” This part of the agreement makes the most sense. But “promoting” in this case appears limited to using development funds that were “already in the pipeline” in both countries. In other words, nothing really new here.

This was a golden opportunity for the U.S. to show real leadership by dramatically increasing its investment in bringing stability and prosperity to Mexico and Central America. Additionally, we could have created incentives (rather than threats) and benchmarks for Mexico to improve its asylum adjudication system and human rights performance. Partnering with non-governmental-organizations and legal assistance groups on both sides of the border also would bring much needed expertise in resolving asylum issues to the table.

But, that would have taken a President with vision, empathy, compassion, courage, competency, intelligence, and creative problem solving ability. Trump is the exact antithesis of all of these qualities.

Consequently, sooner or later we can expect Trump’s “latest egg” to fail, like all of his other gimmicks and maliciously incompetent schemes on immigration. Our “child president” will undoubtedly then embark on a new barrage of lies, false narratives, idiotic tweets, idle threats, blame shifting, insults, racist dog whistles, and general nonsense aimed at diverting attention from his own failures as a leader and more critically, as a human being.

Innocent people will be harmed and die, America and Mexico will be embarrassed and diminished, and the world will be a worse place. But, until America figures out how to use its democratic institutions to remove the kakistocracy, the disaster will continue. That it could have been worse, is only small consolation.

Why not strive to be  the “best that we can be,” rather than just “not as bad as we might have been?”

Alexandria, VA, June 8, 2019.  The nation’s totally dysfunctional and highly politicized Immigration Court System, known as the Executive Office For Immigraton Review (“EOIR”), has ousted three of its top career senior executives, according to a report filed yesterday by Nicole Narea of Law360. Evidently, Chief Immigration Judge MaryBeth T. Keller, General Counsel Jean King, and Deputy Director Katherine H. Reilly all “got the boot” late this week. They are career civil servants. Keller and King were “holdovers” from the prior Administration, while Reilly was appointed to her recent position by former Attorney General Jeff Sessions. 

Piecing together bits from anonymous sources, it’s likely that the three clashed with EOIR Director James McHenry and Department of Justice (“DOJ”) politicos over some of the more extreme aspects of the Administration’s “master plan” to demean and degrade Immigration Judges and Appellate Immigraton Judges at the Board of Immigration Appeals, strip them of the last vestiges of judicial independence and docket control, and return the Immigration Courts to their pre-EOIR status as perceived appendages of DHS (then INS) enforcement.

Keller supposedly “retired,” an unusual move given her age group and that senior executives are the civil service equivalent of brigadier generals. King was transferred to the Office of the Chief Administrative Hearing Officer (OCAHO”), long known as the “Siberia of EOIR” and a repository for prior senior executives who had fallen out of favor with “EOIR Management” and their DOJ “handlers.” Reilly reportedly transferred to a senior executive position with the U.S. Postal Service (“USPS”), another surprising move for a top senior executive attorney at the DOJ. 

Predictably, there has been no official announcement from EOIR or the DOJ, nor have any replacements been named. Meanwhile, the backlog mushrooms, morale sinks further, conditions continue to deteriorate, and due process and fundamental fairness are mocked every day in the EOIR “courts” and also by life-tenured Article III Judges who are willing to “rubber stamp” the results of this patently illegal and unjust system.

Keller, King, and Reilly have “escaped from the circus.” But, hopefully there someday will be accountability for those throughout government and the Article III Courts who continue to participate in, enable, and further this ongoing farce and the resulting gross perversion of American law and human values.

Mexico Border Deal to Avoid Tariffs Would Endanger Lives

New York City—In response to reports that the Mexican government is planning to make a deal with the United States to avoid tariffs threatened by President Trump, Human Rights First’s Eleanor Acer issued the following statement:

President Trump is trying to bully another country into endangering the lives of vulnerable men, women, and children, who want nothing more than to live in freedom and safety. Mexico and Guatemala are not—in a legal or practical sense—safe countries for many refugees. In Mexico too many refugees face kidnapping, assault, and murder.

People seeking refuge are not required to seek asylum in the first country they set foot in. In fact, many face grave dangers in neighboring countries, as well as serious risks that they will be returned to their country of persecution.

Such a plan would not only makes a mockery of U.S. law and treaty commitments, but would also return refugees to places where their lives are in danger. It is yet another abdication of leadership, setting an abysmal example for other countries around the world.

Instead of more attempts to block and punish people seeking refuge, the United States needs real solutions that restore order and uphold America’s refugee laws and treaty commitments, including:

  1. Tackle the root causes pushing people to flee the Northern Triangle countries through a targeted strategy that leverages both diplomacy and aid, focusing on effective programs that reduce violence, combat corruption, strengthen rule of law, protect vulnerable populations and promote sustainable economic development.
  2. Launch a major initiative to enhance the capacity of Mexico and other countries—which are already hosting growing numbers of refugees—to provide asylum, host, protect, and integrate refugees, along with a robust regional resettlement initiative that provides orderly routes to the United States and other countries while safeguarding asylum.
  3. Immediately end the dysfunction at the border, and instead launch a public-private humanitarian initiative and a long overdue case management system to actually manage asylum cases.
  4. Fix the asylum and immigration court adjudication systems to provide fair, non-politicized and timely decisions.

As usual, Trump’s outrageously illegal and immoral proposal relies on:

  • Bullying weaker countries;
  • A gullible public;
  • A cowardly GOP Congress;
  • Complicit courts.

A simple perusal of the country condition materials publicly available on the EOIR and Department of State websites shows that the idea that either Mexico or Guatemala are “safe” countries where refugees “would have access to a full and fair procedure for determining a claim to asylum or equivalent temporary protection,” as required by U.S. law, is preposterous.

Mexico’s asylum adjudication system is plagued by bribery, corruption, and incompetence. It adjudicated only about 10, 000 cases in the last reported period, denying the overwhelming majority. Moreover, gangs and cartels operate freely throughout the Northern Triangle countries and Mexico. Our State Department Report acknowledges that the same organized gangs who force people to leave the Northern Triangle can also harm them in Mexico.

Guatemala is a highly corrupt country basically without a functioning asylum adjudication system.  It is a major sender of asylum applicants to other countries. The Guatemalan Government is unable to maintain order and protect its own citizens, let alone refugees from nearby countries.

Also, we are encouraging Mexico and Guatemala to use troops and military force against asylum seekers — something our own laws do not permit.

Essentially, the Trump Administration seeks to “get away with murder.” In two years they have turned the U.S. from a leading defender of human rights to a major international human rights violator. So, why are we allowing our Government to get away with such dishonest, morally bankrupt, and illegal proposals?

Even if these corrupt proposals go into effect, it seems doubtful that they will stem the follow of refugees in the long run. While there might be a short term downturn, eventually smugglers will adjust to the new policies and desperate individuals will find different routes to the United States. They will be more dangerous, so more will die.

Perhaps we will see  “Central American Boat People” and more deaths at sea. Maybe there will be more “Golden Ventures.” More deaths at the border will be inevitable as smugglers seek to evade the Border Patrol and get to the interior. Perhaps the human smuggling action will switch to the even longer U.S. Canada border. How about a “Northern Wall”  from the Atlantic to the Pacific?

As long as the U.S. stubbornly refuses to acknowledge and address the causes of migration it will continue, in extralegal channels as necessary and as the market “push pull factors” determine. More focus on barring refugees means less focus on drug smugglers and others who present a real threat to our safety and security.

Also, smugglers will be able to change a premium — so those who are willing to take the risk and outsmart the new system will reap even higher profits than the increased ones Trump has already conferred upon them with his maliciously incompetent policies to date.  Finally, walls, jails, cages, abuses, family separations, prosecutions, racist rhetoric, armed violence, tariffs, exploitation, massive violations of our Constitution and international laws, or whatever won’t stop desperate refugees from coming. But we will eventually convince refugees to give up on the U.S. legal system and just find ways to get beyond the border and lose themselves in the interior. No enforcement system, no matter how cruel, repressive, expensive, and lawless will be able to get rid of more than a fraction of those who don’t want to be found after reaching the interior.

Moreover, if Trump’s actions succeed in destabilizing Mexico, then Mexican migration, which has actually been a negative flow recently, will resume in large numbers, also adding to the pressure on our borders. The worse things get in Mexico, the less likely that the Mexican Government will stop their citizens from heading north. So, there is every reason to believe that Trump’s “malicious incompetence” will make things even worse for everyone  — but particularly for those who are most vulnerable — desperate asylum seekers!

Another future possibility to ponder:  Tired of being publicly bullied, humiliated, and dealing with a dishonest unreliable idiot and his incompetent sycophants, Mexico and Canada will “wise up” and cut a trade deal with China that really gives them leverage and puts the squeeze on the U.S. And, why wouldn’t China love a chance to establish factories just across our Northern and Southern borders that could also serve as “listening posts” and repositories for hijacked U.S. technology? Maybe the EU and India could also be cut into the deal.

We are diminishing ourselves as a nation, but it won’t stop human migration!

SAN DIEGO — The San Diego immigration court has been overwhelmed by the number of cases judges are hearing under a Trump administration program that returns asylum seekers to Mexico while they wait for hearings in the U.S.

Normally, asylum seekers coming to the California border would be distributed to immigration courts across the country, either because they would be held somewhere in the federal government’s national immigration detention system or because they would be released to reunite with family and friends already in the U.S.

Now, the increasing number of people picked for the administration’s Migrant Protection Protocols, known widely as the Remain in Mexico program, across the California border are all being sent to immigration court in downtown San Diego.

“Other than wallow through it, I don’t know what we can do,” said Immigration Judge Lee O’Connor shortly before walking out of his courtroom at 6:21 p.m. one evening last week after hearing a string of MPP cases. Court staff, including security, had left the building long before.

Immigration judges are already working under performance quotas set by the Trump administration to reduce the immigration court backlog, which has grown nationally to nearly 900,000 cases, according to data from the Transactional Record Access Clearinghouse of Syracuse University.

The San Diego court has more than 5,700 cases pending, up from 4,692 cases in fiscal 2018, a 22.4% increase. Nationally, the backlog has grown about 16.2% in fiscal 2019.

“This is a reflection of the constant doublespeak we’ve been highlighting. The agency has internally conflicting priorities,” said Ashley Tabaddor, speaking in her capacity as head of the National Assn. of Immigration Judges. “It creates chaos.”

On a given day, three of San Diego’s seven judges generally have afternoons full of MPP cases. On a recent Tuesday afternoon, 82 people were scheduled to appear before three judges, 28 of those before O’Connor.

“The judges have no control in terms of how many cases are being scheduled,” Tabaddor said.

Border officials who initially receive migrants either requesting protection at a port of entry or after they’re apprehended crossing illegally are responsible for scheduling the first court appearance for returnees.

Customs and Border Protection did not respond to a request for comment. The Department of Homeland Security was unable to respond to questions in time for publication.

Several of the judges assigned to hear cases in San Diego have pushed back on the government for a laundry list of issues that could be violations of the government’s due process responsibilities under immigration law.

Tabaddor said she’s heard a number of concerns from her union members who are trying to make sure “all of the T’s are crossed and all of the i’s are dotted” in implementation of the new program. “That’s what the oath of office is,” Tabaddor said. “You’re supposed to make sure all the rules are followed.”

One that has come up over and over again is the address put down initially on each asylum seeker’s case documents by border officials. Along the California border, Customs and Border Protection and Border Patrol have written some version of “Domicilio conocido,” or “known address.”

Some have “Tijuana, Baja California, Mexico.” Others simply say “Baja California” without the city or the country noted.

Having an accurate address on file is key to showing that immigrants were given proper notice of their court hearings. That proof of notice is a crucial part of a judge’s decision to proceed “in absentia” and order a person deported if he or she doesn’t show up for a hearing.

“This whole program, I don’t understand it,” said Immigration Judge Jesús Clemente on his first day of hearing MPP cases. “How are we ever going to tell this person that he has a hearing?”

Similarly, when an government attorney suggested that it was the asylum seeker’s responsibility to provide an accurate address, Immigration Judge Scott Simpson responded with incredulity. “Are you saying the respondent provided this address?” he asked, referring to the asylum seeker. “Are you saying every respondent in the MPP program provided this address?”

“I can’t speak to that,” the attorney representing ICE responded. “In my experience, the address the respondent provides is what is put down.”

“That’s how it usually works,” Simpson replied. “But I’m not convinced that’s what’s happening now.”

When asked about the address issue recently, San Ysidro Port of Entry Director Sidney Aki said that migrants don’t often know where they will be staying when they’re first returned.

To prevent any miscommunication, Aki said, they’re told to return to the port of entry at a particular date and time.

Normally, if a judge believes that the government violated an asylum seeker’s due process rights, the judge can terminate immigration proceedings against that person, said attorney Lindsay Toczylowski, executive director of Immigrant Defenders Law Center. Then the asylum seeker can apply for protection outside of immigration court in a process that is less adversarial.

For returnees who are ultimately hoping for asylum in the U.S., termination won’t help them because they’ll be returned to Mexico with no access to the U.S. asylum system, she said.

“It essentially removes their ability to vindicate their due process rights,” Toczylowski said.

Among other issues, the dates on instructions given to returnees that explain when to come back to the San Ysidro Port of Entry to be taken to court don’t always match the dates on their hearing notices. Or, the government fails to file the preliminary paperwork in the case and the immigration court doesn’t have a hearing scheduled for the person when he or she shows up.

“I’m sure you’re frustrated,” Simpson said to a man whose paperwork had not properly been filed by the government, resulting in a delay in the start of his case. “I share your frustration.”

Asylum cases typically have several preliminary hearings, known as “master calendar hearings,” before the “merits hearing,” where evidence is presented for the judge to make a decision on the person’s claim. During those master calendar hearings, asylum seekers are given time to look for attorneys, are told their rights in immigration court, and are given applications to fill out and submit.

Juan, a doctor who fled Honduras after facing threats for his participation in political protest, filed his asylum application in mid-May. His merits hearing was scheduled for November.

Where to live and how to sustain themselves in Tijuana is becoming a larger and larger issue as more asylum seekers are returned. Despite its promises at the program’s outset, Mexico has not given many of the returnees permission to work while they wait.

Tijuana’s migrant shelters are already at or near capacity, and most of the people staying in them are not returnees from the program.

One returnee who had become homeless and tried crossing illegally only to be returned again to Tijuana said he was planning on going back to his country in the coming days. It would be better to die there, he said, than to continue living as he’s been living in Tijuana.

Juan is one of the lucky ones. He is staying at a shelter near the border. Still, he’s worried about the long wait ahead.

“The policy’s name is migrant protection, but they send you to the most dangerous city in Mexico,” he said.

The Ninth Circuit had an opportunity to put at least a temporary halt to this blatant denial of the statutory right to counsel and the constitutional right to adequate notice and Due Process. They “swallowed the whistle.” Eventually, these feckless and complicit Article III courts will find their own dockets overwhelmed with the results of their inaction in the face of a Due Process, operational, and human rights disaster of gargantuan proportions in the U.S. Immigration Courts as mal-administered by the DOJ.

Of course, the real culprit is Congress, which has failed to act to require an independent, constitutional U.S. Immigration Court. But, the word “feckless” doesn’t begin to describe a body that under Mitch McConnell has intentionally ceded its constitutional power to govern and oversee in the overall public interest to an unqualified, scofflaw President who respects neither democratic institutions nor the rule of law.

— Hundreds of minors are being held at U.S. facilities at the southern border beyond legal time limits. Abigail Hauslohner and Maria Sacchetti report: “Federal law and court orders require that children in Border Patrol custody be transferred to more-hospitable shelters no longer than 72 hours after they are apprehended. But some unaccompanied children are spending longer than a week in Border Patrol stations and processing centers, according to two Customs and Border Protection officials and two other government officials. … One government official said about half of the children in custody — 1,000 — have been with the Border Patrol for longer than 72 hours, and another official said that more than 250 children 12 or younger have been in custody for an average of six days. …

The McAllen Border Patrol station, a facility near the southern tip of Texas that is routinely overwhelmed, was holding 775 people on Tuesday, nearly double its capacity. The Washington Post this week made a rare visit inside the facility, where adults and their toddler children were packed into concrete holding cells, many of them sleeping head-to-foot on the floor and along the wall-length benches, as they awaited processing at a sparsely staffed circle of computers known as ‘the bubble.’ … Experts say transferring children out of detention facilities as quickly as possible is critical, especially for ‘tender age’ children — those 12 or younger, who face physical and mental health issues even during short periods in detention. They sleep fitfully, do not eat well and suffer anxiety, said Amy Cohen, a child psychiatrist and expert witness in the Flores case.”

— Border agents apprehended 1,036 migrants in a record roundup near El Paso earlier this week. The apprehensions, which included 63 children traveling alone, reflect an uptick in the number of large groups trying to cross the border. Border agents apprehended a group of 424 migrants, the previous record, just last month. (NBC News)

WASHINGTON, May 31, 2019 — The American Bar Association is deeply disturbed by reports that hundreds of unaccompanied children seeking refuge in the United States are being held by the U.S. Border Patrol in violation of the law and federal policies.According to federal law and court orders, immigrant children generally cannot be held by law enforcement for more than 72 hours before being transferred to shelters that are better equipped to care for their physical and psychological needs. Yet news reports cite recent federal data that hundreds of children, many aged 12 and younger, have been held in Border Patrol custody for an average of six days, in facilities that are intended to be short-term processing stations.The current situation is unacceptable. Leaders at every level of the federal government, including the White House and Congress, must immediately find legal and humane alternatives that relieve the suffering of these children – and then work to create and fund comprehensive, long-term solutions.

How “gonzo” has our country become? Our dishonest and unqualified “President” makes idiotic threats against our “friends” because his Administration has been too maliciously incompetent to deal with a relatively predictable flow of individuals merely seeking to exercise their legal rights. Somehow, the mess in Central America, for which we share a great part of the blame, becomes Mexico’s problem to solve. But, while the vast majority of those arriving at our borders are surrendering themselves to apply under our laws, the Trump Administration is violating the law on a grand scale by mistreating children and others in detention.

In a rational country, there would be a massive, bipartisan, expedited movement to remove this unqualified demagogue from office before he does more damage to our country and our world. But not in today’s America.

Sadly, that appears to be the real meaning of “American exceptionalism.”
