“It’s a debate between those who think our openness as a democratic society is an advantage in the struggle with autocracies or a disadvantage,” Malinowski told me. “One of the central lessons of the Cold War was that it is an advantage. I just hope we choose the same strategy that won the Cold War.”

One thing that has changed since the Cold War is that now these skilled workers who are fleeing Russia and Hong Kong have more options. Some reports say 50,000 to 70,000 Russian tech workers fled to places such as Turkey, Georgia and the Baltic countries in the first weeks of the war in Ukraine. Hong Kong business leaders are decamping for Singapore. Canada has already expanded immigration for Hong Kongers with advanced degrees, and thousands are taking advantage.

The whole world is competing for the talents of those who are fleeing from Hong Kong and Putin’s Russia. Republicans’ excessive fear of immigration should not waste a strategic opportunity for the United States to strengthen itself and weaken its rivals at the same time. Congress should work to ensure that China’s and Russia’s losses are America’s gains.

The client’s asylum application was filed on December 3, 2018, his interview at the Asylum Office was on September 3, 2021, and he was granted asylum on May 18, 2022. We received the approval notice yesterday. The above-captioned is what R-A- said upon learning about his asylum grant.

R-A- is a gay man and LGTBQ+ activist. Throughout his entire life, R-A- experienced bullying and threats and had to keep his dating life a secret. However, things got even worse for him once he started an LGTBQ+ online magazine that received international attention. His family disowned him. A former classmate also set him up and he was physically beaten, sexually assaulted, called derogatory names, blackmailed, and outed. Since coming to the U.S., R-A- has continued to work on his online publication and volunteer for other LGBTQ+ initiatives. He hopes to one day attend law school in the U.S.

Thanks for the update and for all you and your student attorneys do for American justice! Once again this shows the effect of expert representation of asylum seekers and the critical importance of winning cases at the first possible level, in this case the USCIS Asylum Office. Who knows what might have happened if this had been sent over to the “EOIR roulette wheel,” where life or death justice for immigrants has become a “high-stakes game of chance?” 🎰

Incredibly, three years ago, during the depths of the Trump regime, EOIR Executives actually misdirected agency resources into assembling bogus claims and misinformation intended to minimize and downplay the importance of representation in Immigration Court as well as to cover up the gross violations of due process that had become routine at EOIR. Perhaps even more remarkably, most of the folks who participated in that “intentional misdirection” remain on the agency payroll under Garland, a number in their same positions.

The lack of an Attorney General who “gets it” (apparently a staple of Dem Administrations) and who is willing to clean house and make the necessary aggressive progressive reforms to restore due process at EOIR and throughout the Immigration bureaucracy is yet another reason why the work of clinics and other battalions of the NDPA remains so critical!  With a Government whose contempt for Due Process is amply illustrated by foot-dragging on Title 42 revocation, bogus, justice-denying “Dedicated Dockets,” and an appellate body that cuts corners while eschewing positive asylum guidance that would save lives, advocates for respondents are the only folks seriously interested in carrying out our Constitution and insuring that the rule of law is honored.

If that sounds like an indictment of Garland’s “leadership” on human rights, racial justice, and immigrant justice, that’s because it is!

Luke Vargas: Coming up, the Biden administration is enlisting citizens, businesses, and nonprofit groups to sponsor Ukrainian refugees in the US. Could it become a new model for helping those fleeing conflict? We’ll have that story after the break. Several weeks ago, the Biden administration introduced a new sponsorship program for Ukrainian refugees. It’s called Uniting for Ukraine, and it expedites the admissions process for Ukrainians once they’ve found a US citizen or group to sponsor them. In the first 10 days, the program received more than 14,500 applications. So, could private sponsorship become a regular feature of the US Refugee Admissions Program? Wall Street Journal immigration reporter, Michelle Hackman, says the government could use all the help it can get, especially after America’s official resettlement system was overwhelmed by more than 76,000 Afghans last year. And Michelle joins us now with more. Hi, Michelle.

Michelle Hackman: Hi. Good to be here.

Luke Vargas: It’s great to have you. So, how is this program different from how refugees are normally admitted to the United States?

Michelle Hackman: Yeah. It’s an interesting trade-off. Refugees typically come through what we call the Refugee Admissions Program, and that is a process that can take years. The most common situation is you have people living in a refugee camp, let’s say in Africa or in somewhere in Southeast Asia, and they apply to the US, they have to go through a refugee interview. They have to be vetted to make sure they have no ties to terrorism or anything like that. And that takes two or three years. They go through medical checks. In exchange, when they come, they get two things, they get a green card and they get a lot of assistance from government and non-government organizations, including help finding a home, help finding a job, temporary access to Medicaid, and food stamps, and English lessons, and all this suite of benefits that you need to adjust to America after living in a really precarious situation.

Luke Vargas: But that is not how this system works for these refugees resettled from Ukraine is it?

Michelle Hackman: That’s right. So, the trade-off that’s being made here is that system obviously has a lot of benefits, but Ukrainians don’t have two or three years. They need homes right now. And so, the US is turning to a different mechanism to allow people in that’s called humanitarian parole, in case any of our listeners have heard that term. And so, the benefit of that is it gets Ukrainians here really quick, maybe a week to get that approval. But on the flip side, it means that they get none of those benefits. They get none of the resettlement support from the government and they don’t get green cards.

Luke Vargas: I understand that under this program, refugees from Ukraine aren’t guaranteed any long term legal status and that humanitarian parole, you mentioned only holds for two years. What exactly happens after that?

Michelle Hackman: Right. And that’s a reason that this program has gotten a lot of criticism from Ukrainian and refugee groups. A lot of Ukrainians probably feel like they don’t have a home to return to in Ukraine. Their city was destroyed. Their apartment building was destroyed, whatever it may be. Or other people may feel like, oh my gosh, if I move to America, and I find a job, and my kids start going to school, I can’t uproot myself again in two years. I just have to have some peace and dignity. But for those people, it’s honestly going to be difficult because as I said, they have these two-year grants of permission. A lot of people are going to be eligible for a really similar program called temporary protected status, which has been granted to Ukrainians and will almost certainly be extended by the Biden administration. But temporary programs are difficult. Republicans are not really in favor of them. If a Republican administration gets elected, they’ll almost certainly come to an end. And there isn’t a direct pathway for these people to get a green card. The main way that you can do it is if you have a parent, sibling, or child, who’s an American citizen, or if you find an employer who’s willing to sponsor you for a green card, which is quite costly, but those are limited options for people.

Luke Vargas: Okay. And yet, despite those potential pitfalls, you report that the Biden administration is looking at this program to see if they could use it as a model that could be scaled up. How exactly would that work?

Michelle Hackman: Yeah, it’s interesting. There are two aspects. There is the temporary nature of the program. And then there is the private sponsorship, which I would suggest you could separate out. And the Biden administration is looking at doing just that. They’re looking at creating a broader private sponsorship model. So, exactly how strangers in America are taking in Ukrainians, they don’t know. They’re trying to get more Americans to step up and do that with more refugees, but the idea would be once they launch that program, which they’re hoping to do by the end of this year, that those people that they’re sponsoring would be coming through the regular refugee program. So, that means those people arriving would get a green card. As permanent residents would get government healthcare, and food stamps, and things like that. But the adjustment to America piece of things, what I was talking about, finding a home, enrolling in school, that would be handled by your private sponsor. And that might be a church, or a synagogue, or a private volunteer organization, or whatever it may be.

🤯 BIDEN’S MUDDLED “NEW” UKRAINIAN REFUGEE POLICY FAVORS WHITE GUYS OVER OTHERS — But, Ukrainian Refugees At Border Will Soon Be Shafted Like Non-Whites! — The Farce Continues As Humanity Suffers!🤮

U.S. officials say a majority of the Ukrainian refugees want to stay in Eastern Europe because they have family fighting in the war and eventually hope to return home.

Advocates have said the U.S. should take far more than 100,000 refugees and do more to expedite the process.

To qualify for admission to the U.S. under the new expedited program, officially known as Uniting for Ukraine, people must have been in Ukraine as of Feb. 11; have a family sponsor in the United States; complete vaccinations and other public health requirements and pass background checks.

Typically, they would start the application process in their home country, but that’s no longer possible because the U.S. pulled its diplomats from Ukraine. The State Department will expand resettlement operations in Eastern Europe under the new program to compensate.

Most will receive two years of residence and authorization to work in the United States under what’s known as humanitarian parole. Those who coming to the U.S. through the formal refugee process, including thousands who will come as members of religious minority groups, will have permanent legal residency.

It will be a streamlined process in Europe, but refugees won’t be able to complete it in Mexico, senior administration officials told reporters, speaking on condition of anonymity to discuss the program before the public announcement.

Instead, Ukrainians who show up at the border will generally be turned away without being able to apply for asylum under a public health order known as Title 42 that has been in place since the start of the pandemic in March 2020.

The Centers for Disease Control and Prevention has said the use of Title 42, which has been used to turn away more than 1.7 million people, is set to end May 23. The agency is under pressure to keep it in place not to control COVID-19, as it was supposedly intended, but to help ease an increase in migrants seeking to cross the border.

Critics of the use of Title 42 at the border have pointed out that it denies people their right under U.S law and international treaty to make claims for asylum and forces migrants to return to dangerous conditions in Northern Mexico and elsewhere.

Actually, although you wouldn’t know it from the Biden Administration’s bizarrely twisted policies, an “asylee” is a “refugee” who shows up at our border and seeks admission. Except that we eliminated our asylum program at the border without any legislative repeal. Got that?

White Ukrainian refugees who came to the border because we had no functioning refugee program in Europe have been admitted over the past few weeks, racing ahead of non-White refugees who have been stuck in Mexico under the Administration’s ill-advised, immoral, and illegal continuation of Stephen Miller’s bogus Title 42 charade aimed at barring refugees of color. Now the Biden Administration proposes to treat Ukranians at the Mexico-U.S. border just as horribly as it does Haitians, Central Americans, and African refugees.  

But, perhaps not quite as badly. They probably won’t be able to “orbit” them back to torture and death in Ukraine because of logistics, if for no other reason.

Ironically, in a relatively short period of time, humanitarian organizations had put together a program for the orderly screening and admission of Ukrainian asylum seekers whom the Administration quickly found a way to “exempt” from their Title 42 charade.

Logic might suggest that such a program could be expanded to non-Ukrainian refugees at the border. But, logic, common sense, courage, and expertise play little role in Biden Administration human rights policies. Instead, the Administration has just mindlessly decided to screw everyone at the border, with some largely unprincipled exceptions, until May 23, when they might, or might not, begin following the law again. 

Wonder how politicos of both parties will react as Ukrainians at the southern border are now left to “twist in the wind” as if they were “mere refugees of color?” That’s likely to lead to some pretty ugly media coverage.

Honestly! Is this any way to “run the railroad” with human lives at stake?

The issue is whether an in absentia removal order can be based on a statutorily defective notice. The panel followed the Supreme’s decision in Niz-Chavez and rejected the BIA’s conflicting decision in Matter of Laparra. In other words, the panel required the Government to follow the statute, a process known as “complying with the law.” This sent some of this most conservative circuit’s most far-right judges over the edge.   • Credit Dan Kowalski over at LexisNexis for the “food fight” characterization.
  • The scofflaw GOP dissenters cited “deference” to the Executive, something they have pointedly refused to apply to Biden Administration precedents and policies favoring migrants. 
  • The majority says: “[The BIA] flies in the face of the Supreme Court’s Pereira decision, which Laparra ignored.” 
  • Incredibly, Garland is on the “wrong side” of this controversy, defending the legally incorrect misinterpretation of his “Trump holdover” BIA!
  • The statutory requirement at issue: That a “Notice to Appear” before the Immigration Court inform the individual of the time and place of the hearing. How difficult does that sound? Not very, unless you are bumbling bureaucrat at DHS and EOIR who chose, even after the Supremes’ initial decision, to  violate that decision and the statute in almost 100% of the cases instituted before the Immigration Courts! 
  • Kudos to the 3 Trump appointees and one Bush II appointee who joined 3 Obama appointees and 2 Clinton appointees to uphold the rule of law and thwart their GOP scofflaw colleagues.
  • Interestingly, and perhaps mildly encouraging, the “Trump appointees” split 3-3 on this one.
  • Apparently nothing drives a wedge between conservative judges like the scary prospect of following the law when it gives immigrants a win!
  • Future ambitious academic study: How much of the current out of control backlog can be traced to the Government’s, and particularly the BIA’s, inept handling of straightforward notice requirements set forth in the statute?
  • There’s a reason why I keep referring to Garland’s out of control EOIR backlogs as “largely self-created,” albeit in fairness not exclusively by him. The Trump Administration, and to a lesser extent the Obama Administration, also “excelled” at “Aimless Docket Reshuffling” driven by “prioritizing” improper political goals over due process, fundamental fairness, quality, and practical scholarship in the Immigration Courts.

He’d punch T-G, force her to have sexual relations, infected her with a STD, and he blamed her for their daughter’s neurological issues. Their daughter contracted Zika but was unable to receive the appropriate treatment because T-G was not a supporter of the Maduro government. Their daughter died at age 14.

Let’s get behind the intentional dehumanization and the chronically misleading “numbers” being thrown around by nativists, some so-called “moderate” Dems, and the DHS. Put a “human face” on our nation’s dereliction of legal duty and abandonment of values at out Southern border.

This case is a compelling example of the types of refugees, many women and children and most people of color, who are stuck at our Southern Border as illegal suspension of asylum laws, based on racially- motivated bogus “public health” grounds grinds on. With some legal assistance and a fair and orderly system in place, many of those waiting could qualify for asylum if given a fair chance under the law. 

Access to the asylum system, representation, and fair and impartial adjudication are essential to success. Right now, the Biden Administration is denying all three.

Now, more amoral and weak-kneed Dems are urging Biden to kill asylum and refugees of color along with it by “delaying” the long overdue resumption of legal asylum processing at the border for another “60 days.” https://www.forbes.com/sites/joewalsh/2022/04/18/more-democrats-criticize-biden-for-plan-to-end-trump-era-border-restrictions/?sh=68b608c251d8  

Make no mistake, this disingenuous action would kill asylum for good! These guys don’t even have the guts to admit that they are now carrying out Stephen Miller’s xenophobic war on immigrants and refugees of color.

  • Biden ran on an elimination of Title 42 and restoration of the legal asylum process. If 18 months after the election they lack a “plan,” there is no reason to believe that 60 more days would make a difference. It’s now or never!
  • 60 days would bring us even closer to the mid-terms. If Dems are scared to follow the law now, that’s not going to improve as the midterms get even closer. 
  • You can be sure that once the midterms are past, particularly if Dems get “blown out” as they fear, they will claim that the time “isn’t right” for any immigration “reform” (although, following the law is hardly a real “reform”) in advance of the 2024 election. If the GOP wins in ’24, the effective elimination of legal immigration — with or without legislation — will be finalized.
  • This has nothing to do with COVID at this point. It never really did. It was always about finding a pretext to close the border and keep it closed — at least to non-White refugees. But, since COVID constantly mutates, there will always be some sort of “COVID emergency” out there for the foreseeable future. 
  • Asylum applicants have NOT been a significant source of COVID. They are far less of a threat to our health, safety, and security than GOP “magamorons” who eschew vaccination and basic public safety precautions. The Biden Administration should have a plan in place to insure that asylum seekers are tested and if necessary vaccinated before admission.
  • If we have no legal asylum system at the border, no functional refugee system abroad, and no hope for the future, the only way for individuals to seek protection will be by using smugglers to enter illegally and then hoping to “lose themselves” in a burgeoning “extralegal population” throughout out America. Once we abandon any pretext of a legal system for asylum seekers, the border will get further and further out of control. That will add to the GOP’s claims that more and more cruel, draconian, and punitive measures are necessary. But, they won’t stop desperate people from attempting entry until they either succeed or die in the process.
  • Contrary to the misguided blather of some Dems, there will never be a better time for Dems to support asylum seekers. They are concentrated in border areas, and eager to have their claims heard. Orderly processing and admitting as many as qualify, in a period of artificially reduced migration, would help the economy, raise tax revenues, and address supply chain issues. If not now, when?
  • Restoring asylum law is a legal requirement, not a “strategy,” “policy,” or “political choice.” If Dems turn their backs on the rule of law, what makes them different from the GOP?

If this divisive nonsense and backsliding on basic constitutional, racial justice, and social justice issues continues, progressive Dems are going to be faced with having to make a decision about the party’s future.

Progressive Dems make up a key part of the party’s core base and a disproportionate amount of the “boots on the ground, grass roots enthusiasm.” Republicans aren’t going to vote for Dems, no matter how xenophobic, hateful, and racist Dems are toward migrants. So-called “independents,” are neither going to fill the Dems coffers nor pound the pavement and work the phone lines to “get out the vote.”

So, arrogant “Title 42 Dems” are assuming that they can “spit on” immigrant justice, racial justice, economic justice, and social justice and that their “core support” among progressives won’t diminish because they will always be preferable to “Trump Republicans.”  

All in all, it’s a “big middle finger” to progressives and their social justice agenda. That’s an agenda that Biden actually successfully ran on. 

If progressives really believe in a pro immigrant, pro rule of law, racial justice agenda, then they need to stand up to the backsliders and let them know that there will be real consequences of yet another “sellout of immigrants’ rights.” We’ll see whether progressive Dems have more backbone and courage than their “Title 42/Miller Lite wing.”

This morning, a WashPost editorial correctly pointed out that Ukrainian refugees “couldn’t afford to wait” for the Biden Administration to get its act together. https://www.washingtonpost.com/opinions/2022/04/19/united-states-ukraine-refugee-effort-slow-start/

But, the Post badly missed the larger point — NO refugee can afford to wait, be they White Ukrainians, Black Haitians, Cameroonians, and Congolese, or Latinos from the Northern Triangle, Venezuela, and Nicaragua! Our obligations to asylees are not supposed to be “race-based!”

The U.S. has had a legal refugee and asylum system for more than four decades. During that time, Congress has made several amendments of the law to allow DHS to rapidly process and summarily remove those appearing at the border who, after prompt expert screening by Asylum Officers, cannot establish a “credible fear” of persecution. 

Restrictionists and shamefully some so-called moderate Democrats, and sometimes CBP, seem to have conveniently “forgotten” that the law was designed to deal fairly and promptly with so-called “mass migrations” long before the advent of the bogus Title 42 charade.

For some periods during the 40 years since the enactment of the Refugee Act of 1980, the U.S. has run functional refugee and asylum programs. Not “perfect” or perhaps even “optimal,” but “functional.”

They have done this by employing experts, cooperating with NGOs (domestic and international), and building resettlement and support systems spearheaded by NGOs, using Government grants, and promoting teamwork and coordination with states and localities.

It has only been when Administrations of both parties have mindlessly turned away from human rights experts and followed the misguided and tone-deaf gimmicks advocated by nativists and apostles of “enforcement only deterrence” that the legal systems for refugees and asylees, and efficient, humane border enforcement, have fallen into disorder.

While refugee and asylum laws could undoubtedly be improved, contrary to the media blather and nativist grandstanding, we have the basic legal framework to deal with the current refugee and asylum situations at our borders and beyond. The question is whether the Biden Administration and Dems have the will, vision, competence, and willingness to cooperate with human rights experts to fix the mess intentionally created by Trump and return human decency, competence, and the rule of law to our borders! If not now, when?

VOA: A U.S. State Department annual report highlighted concerns about continuing human rights abuses in Russia, China, Iran, Venezuela, Egypt and other authoritarian nations, as well as the impact the coronavirus pandemic has had on rights practices around the world.

 

U.S. arrests 210,000 migrants at Mexico border in March, rivaling record highs

Reuters: The 210,000 migrants arrested in March, a figure made public in a court filing on Friday night, is the highest monthly total on record since February 2000, according to U.S. Customs and Border Protection statistics dating back to 2000.

 

Launch of Program for Legal Representation of Detained Immigrants

RAICES: On Monday, April 18th, 2022, immigrant legal services providers, advocates and community members will hold a press conference to announce the launch of the Harris County Immigrant Legal Services Fund (ILSF), which will provide free legal representation for immigrant members of the county who are detained and facing the threat of deportation. As of February 2022, Harris County had the most residents with pending immigration court cases in the country.

 

Democrats intensify fight against Biden immigration policy

CNN: While immigration advocates celebrated the decision to reverse Title 42, many moderate Democrats have sounded the alarm warning that lifting the policy without an adequate plan in place will lead to a rapid influx of migrants at the Southern border, something that Republicans will be quick to seize on the campaign trail.

 

First busload of migrants from Texas arrives in D.C.

WaPo: They were also thankful that Abbott had given them a free ride and trips to McDonald’s, even after being told the governor is calling for them to be expelled from the United States…“The truth is, they helped us. Kansas gov signs bill to ban local ‘sanctuaries’ for immigrants

AP: The bill was filed after Wyandotte County passed a “sanctuary” ordinance in February that would provide local identification cards for immigrants and other residents and would prevent local law enforcement from helping the federal government enforce immigration laws unless public safety is threatened. Lawrence and Roeland Park have similar ordinances.

 

Watchdog Pans ICE For Sole-Sourcing $87M Hotel Deal

Law360: A federal watchdog rebuked U.S. Immigration and Customs Enforcement for an $87 million no-bid contract to house migrant families in hotels, saying the agency hadn’t justified directly awarding the deal to a nonprofit inexperienced in emergency family residential services.

 

Cuba has stopped accepting deportations of its nationals from the US, ICE says

Denver Gazette: The Cuban government has not been accepting deportations of Cuban nationals from the U.S. for more than six months, at a time when tens of thousands are leaving the island to reach the U.S. in the largest exodus since the 1980s Mariel boatlift.

 

Illinois budget expands tax breaks and healthcare for immigrants

WTTW: An expanded class of low-income workers will permanently get a larger tax break via the Earned Income Tax Credit, and that benefit will be extended to those who file taxes with an Individual Taxpayer Identification Number (ITIN), something that Rep. Aaron Ortiz, D-Chicago, said is important to many immigrants who play an important role in the state’s economy. Illinois is allocating $70 million for healthcare for undocumented immigrants. Ukrainians Face New Hurdle at U.S. Border: No Dogs

NYT: Federal health guidelines limit the entry of pets from countries like Ukraine with a high incidence of rabies. For some refugees, the rule has been devastating. See also Poland builds a border wall, even as it welcomes Ukrainian refugees.

4th Circ. Won’t Grant Immigrant Fees, Despite Feds’ Loss

Law360: The Fourth Circuit refused to award attorney fees to a man who convinced the full appeals court that the federal government had arbitrarily rejected him for special immigrant juvenile status, saying the U.S. was justified in fighting the suit.

 

7th Circ. Leery Of Letting States Step Into Public Charge Fight

Law360: The Seventh Circuit seemed unconvinced Wednesday that it should unsettle the dust in a dispute over a Trump-era public charge rule that the Biden administration has already begun redrafting by letting a group of Republican-led states enter the fray.

 

USCIS To Give Veterans Citizenship After Failing To Ax Suits

Law360: U.S. Citizenship and Immigration Services will grant naturalization requests made by two immigrant veterans after federal courts refused to toss the soldiers’ lawsuits alleging the agency unfairly disqualified them from expedited processing of their citizenship bids.

 

DHS Can’t Block Probe Of Detained Migrants’ Counsel Access

Law360: A D.C. federal court has denied the U.S. Department of Homeland Security’s bid to block inspections of detention facilities that immigration advocates say are denying inmates access to counsel, but the government did get its choice of monitor for the probe.

 

18 Additional States Join Suit To Keep Pandemic Border Block

Law360: Eighteen additional states on Thursday signed on to a lawsuit started by Arizona, Louisiana and Missouri to challenge the Biden administration’s decision to wind down a pandemic-related order known as Title 42 that allows the quick expulsion of migrants arriving at U.S. land borders.

 

Immigrant groups sue ICE for information on alternative detention programs

Hill: A coalition of immigrant rights groups filed a lawsuit Thursday seeking information from Immigrations and Customs Enforcement (ICE) about the agency’s Intensive Supervision Appearance Program (ISAP), a so- called alternative to detention program that has ballooned during the Biden administration.

 

Immigration warning not needed in police questioning of undocumented suspects, court rules

NJ Monitor: Police do not have to — and should not — advise crime suspects that their cooperation could impact their immigration status, a New Jersey appeals court ruled Friday.

USCIS: Today, the Department of Homeland Security (DHS) announced the designation of Cameroon for Temporary Protected Status (TPS) for 18 months. Only individuals who are already residing in the United States as of April 14, 2022, will be eligible for TPS.

DHS: The key program areas include: Applying for naturalization; Accessing humanitarian protection during immigration processing

USCIS Releases New Webpage for Lockbox Filing Location Updates

AILA: USCIS announced that its website will now feature a Lockbox Filing Location Updates page, where customers can track when lockbox form filing locations are updated. Updates will also be emailed and announced on social media.

 

EOIR Announces Appointment of Mary Cheng as Deputy Director

EOIR: Since April 2021, Judge Cheng has served as the Regional Deputy Chief Immigration Judge for the Eastern Region at EOIR. She previously served as a Deputy Chief Immigration Judge from 2017 to 2021, and she was the Acting Principal Deputy Chief Immigration Judge from August 2020 to February 2021. Judge Cheng has also served in the New York Immigration Court both as an Assistant Chief Immigration Judge from 2015 to 2017, and as an Immigration Judge from 2009 to 2015. Before joining EOIR, she served as Assistant Chief Counsel for the Department of Homeland Security, Immigration and Customs Enforcement, from 2002 to 2009; and before that, she practiced immigration law in New York from 2000 to 2002.

AILA: EOIR announced the appointment of Beth Liebmann as a member of BIA by Attorney General Merrick B. Garland. Biographical information for Liebmann has been provided.

 

AMICUS INVITATION (Texas Burglary – Crime of Violence)

BIA: Whether, in light of U.S. v. Herrold, 941 F.3d 173 (5th Cir. 2019) (en banc), and regardless of the specific mens rea of an underlying crime, the commission or attempted commission of a felony, theft, or an assault under Texas Penal Code § 30.02(a)(3) necessarily supersedes or implicitly contains generic burglary’s intent element, which requires an “intent to commit a crime” upon entry into a building or habitation. The Bottom Line

The latest guidelines of ICE are welcomed by the American Immigration Lawyers Association (AILA). The memo will allow prosecutors to resolve cases immediately. It will help in reducing the backlog in immigration court proceedings. Thousands of people are waiting in line for years to get asylum or a green card. The Doyle Memorandum offers clear guidelines for prosecutors.

In the past, ICE Prosecutors have not always closely adhered to PD memos issued by OPLA.  In addition, federal courts have, at times, intervened and enjoined prosecutorial discretion policies by ICE.

But one thing is clear.  With nearly 1.7 million cases currently pending in immigration courts and the Board of Immigration Appeals, let’s hope that ICE Prosecutors will “do justice,” conserve scarce administrative resources best used against high priority cases, and remove low priority cases from the deportation process.  This will not only make the U.S. a more safe and equitable nation, but will help keep peaceful and hardworking families together.

On May 12, 2022, ICE Principal Legal Advisor Kerry Doyle and ICE Detroit Chief Counsel Tara Harris will hold a community meeting with interested legal services providers, non-governmental organizations (NGOs), and community stakeholders who work with immigrant communities in Michigan and Ohio.

This meeting presents a unique opportunity to hear directly from PLA Doyle on her recently issued guidance to ICE attorneys on enforcing the civil immigration laws and prosecutorial discretion.  It is anticipated that specific guidance on process will be provided.

It’s critical that Immigration Judges and the BIA take an active role in “encouraging and motivating” parties to maximize the use of PD. One possible tool is proactively closing certain types of cases without waiting for motions.

For example, the modest step of granting TPS to Cameroonians in the U.S. (https://immigrationcourtside.com/2022/04/16/%f0%9f%97%bdbiden-administration-grants-tps-to-cameroonians-a-modest-step-forward-it-also-illustrates-the-horrible-illegality-immorality-of-the-biden-administrations-co) and the just announced TPS for Ukrainians (https://www.lexisnexis.com/LegalNewsRoom/immigration/b/insidenews/posts/tps-for-ukraine-advance-copy) offers EOIR an opportunity to simply close these non-detained cases (except ones with pending criminal charges) without waiting for the parties.  

Either party that wants the case back on the docket can, of course, make a motion to redocket. Based on my experience with several past similar programs at the BIA, I anticipate that such motions would be relatively rare. Moreover, I would be reluctant to “redocket” a case without a joint agreement from the parties that it will be resolved in a “short hearing,” or a compelling reason to proceed in Immigration Court (e.g., the respondent failed to apply, committed a crime, or was denied TPS).

It’s going to take teamwork, cooperation, and creative thinking among the parties and the courts to get dockets back in shape so that Immigration Judges can do their jobs in something “approaching real time.” 

PD could be the key to success; or, it could become just another in the long line of things that looked good on paper but never achieved full potential. Time, and the efforts of all parties concerned to solve the problem in the most constructive and practical ways possible, will tell.

He had been in office only two months and there was already a crisis at the southwest border. Thousands of migrant children were jammed into unsanitary Border Patrol stations. Republicans were accusing Mr. Biden of flinging open the borders. And his aides were blaming one another.

Facing his bickering staff in the Oval Office that day in late March 2021, Mr. Biden grew so angry at their attempts to duck responsibility that he erupted.

Who do I need to fire, he demanded, to fix this?

Mr. Biden came into office promising to dismantle what he described as the inhumane immigration policies of President Donald J. Trump. But the episode, recounted by several people who attended or were briefed on the meeting, helps explain why that effort remains incomplete: For much of Mr. Biden’s presidency so far, the White House has been divided by furious debates over how — and whether — to proceed in the face of a surge of migrants crossing the southwest border.

Not rocket 🚀 science:

  • Note to Susan Rice & Ron Klain: There will be no racial justice in America without immigrant justice.
  • Asylum is the law, NOT a “policy option” or a “strategy.”
  • The Attorney General has an obligation to insist that the law be followed or to resign.
  • How on earth could anyone think that the border can be fixed without addressing the extreme dysfunction and Trump White Nationalist bias in the Immigration Courts?
  • How do you run on a promise to restore asylum at the border without having a plan in hand to do that on Inauguration Day?
  • Ports of entry “reopened” remarkably quickly for White asylum seekers from Ukraine, using cooperation among the DHS, Mexico, and volunteer groups. So, it’s very “doable.” What’s lacking here appears to be the will and the motivation to treat asylum seekers of color fairly and humanely.
  • Is the Civil Rights Division of the DOJ on permanent LOA? What does Kristen Clarke, AAG for Civil Rights, do to earn her paycheck? Whatever happened to Associate AG Vanita Gupta, a former civil rights and racial justice maven, who has turned her back on America’s most glaring and serious racial justice problems, at the border and in her Department’s dysfunctional “courts,” and disappeared into the bowls of Garland’s bureaucracy, never to be heard from again?
  • So, following the law and treating persons of color fairly and humanely at our borders will create “chaos” (it should do nothing of the sort, with competent leadership and personnel) and might be “bad politics” for “moderate Dems.” Gimmie a break! 
  • Why not just consider all asylum applicants to be “constructively White persons” and proceed accordingly?
  • Why is appeasing GOP White Nationalist nativists, who wouldn’t support Biden no matter what he does at the border, more important to the Administration than keeping promises to supporters who actually worked to put Biden, Harris, and, derivatively, folks like Rice, Klain, Mayorkas, and Garland in office?
  • Repubs do remember who their key supporters are, and act accordingly, even when those actions are illegal, immoral, counterproductive, and often unpopular. Dems, by contrast, are afraid to follow the law and do the right thing to make good on promises to their supporters!
  • America actually needs more legal immigrants. Many of them are waiting at the border for justice long delayed. Perhaps, an Administration who can’t see that and turn it into a “win-win” doesn’t deserve to be in office.

TIJUANA, Mexico (AP) — The United States has sharply increased the number of Ukrainians admitted to the country at the Mexican border as even more refugees fleeing the Russian invasion follow the same circuitous route.

A government recreation center in the Mexican border city of Tijuana grew to about 1,000 refugees Thursday, according to city officials. A canopy under which children played soccer only two days earlier was packed with people in rows of chairs and lined with bunk beds.

Tijuana has suddenly become a final stop for Ukrainians seeking refuge in the United States, where they are drawn by friends and families ready to host them and are convinced the U.S. will be a more suitable haven than Europe.

Word has spread rapidly on social media that a loose volunteer coalition, largely from Slavic churches in the western United States, is guiding hundreds of refugees daily from the Tijuana airport to temporary shelters, where they wait two to four days for U.S officials to admit them on humanitarian parole. In less than two weeks, volunteers worked with U.S. and Mexican officials to build a remarkably efficient and expanding network to provide food, security, transportation and shelter.

Volunteers to the rescue, largely as I predicted!

Why not begin screening, processing, and admitting these refugees now, rather than creating an unnecessary and artificial rush on May 23?

It would take only modest creativity to invoke legal refugee admission procedures and begin processing of Haitians, Central Americans, Ukrainians, and other refugees directly from camps in Mexico and other countries. That would allow immediate legal admission, thus bypassing both the overloaded Asylum Office and Garland’s dysfunctional Immigration Courts. 

Refugee admissions would also facilitate Government grants and other funding for resettlement in communities across America.

Not rocket science!🚀 So, why doesn’t the Biden Administration “get it?” Was VP Harris too busy celebrating the historic, yet largely symbolic, confirmation of soon to be Justice Ketanji Brown Jackson to address the real, life or death problems of immigrants and asylum seekers of color who are being mistreated and abused by White Nationalist programs, policies and “official attitudes” at our borders?

What a mess. Everyone is now openly admitting Title 42 has nothing to do with public health and speaking of it purely in terms of an immigration deterrent—which it isn’t. Title 42 drove up apprehension numbers! There have been 750,000 repeat crossings thanks to Title 42.

The amount of lies and misinformation about Title 42 is hitting a fever pitch. Title 42 has been an abject failure. It’s not about public health and it’s a terrible deterrent.

It’s shut down the asylum system at the ports of entry and forced desperate people into crossing.

García is right. For as long as we can successfully keep this policy from continued use, it should be framed as a huge step forward for U.S. asylum law and a victory for vulnerable people who have been blocked from their U.S. asylum rights for more than two years. Isn’t restoring asylum law, especially in light of Russia’s invasion of Ukraine, undoubtedly a good thing? And why shouldn’t it be a win for the president, too, comporting to his pledge for a more humane immigration system?

Or we can just let Stephen Miller and racist border agents keep controlling the narrative, with his lies that restoring U.S. asylum rights “will mean armageddon,” and the agents’ union claiming supposed “mass chaos.”

It’s past time for ALL Dem pols and EVERYONE in the Biden Administration to stop enabling racist false narratives about refugees and asylum seekers (and, for Garland to stop “defending the indefensible”)! And, that means that one way or another, the Biden Administration needs to get off their tails and put in place a system to “process asylum applications in an orderly, legal, and humane way at the US-Mexico border.” 

It’s very possible! And, it’s no less than what Biden and other Dems promised when they ran in 2020 and solicited the votes of the human/rights, racial justice communities!

Guidance to OPLA Attorneys Regarding the Enforcement of Civil Immigration Laws and the Exercise of Prosecutorial Discretion

ICE: On April 4, 2022, Principal Legal Advisor Kerry E. Doyle issued a memorandum to the OPLA workforce titled Guidance to OPLA Attorneys Regarding the Enforcement of Civil Immigration Laws and the Exercise of Prosecutorial Discretion (Doyle Memorandum), which will take effect on April 25, 2022. The Doyle Memorandum is consistent with DHS Secretary Alejandro N. Mayorkas’ September 30, 2021 memorandum titled Guidelines for the Enforcement of Civil Immigration Law, which took effect on November 29, 2021. Upon its effective date, the Doyle Memorandum rescinds OPLA’s prior PD guidance.

Reuters: The Biden administration on Tuesday released a final rule expanding a program that allows applicants for various employment-related immigration benefits to pay up to $2,500 to speed up the process, in a bid to ease massive backlogs at the agency. Matter Of Wong, 28 I&N Dec. 518 (BIA 2022) on “Conviction”

BIA: A finding of guilt in a proceeding that affords defendants all of the constitutional rights of criminal procedure that are applicable without limitation and that are incorporated against the States under the Fourteenth Amendment is a “conviction” for immigration purposes under section 101(a)(48)(A) of the Immigration and Nationality Act.

 

2nd Circ. Says USCIS Must Revisit Inadmissibility Finding

Law360: The Second Circuit ruled Monday that U.S. Citizenship and Immigration Services failed to weigh the full facts when denying an Afghan national’s application for permanent residence because he fought opposition forces under duress after being abducted by the Taliban.

 

CA3 on Cancellation Remand in Cruz-Garcia V. Garland

Justia: The BIA also did not address Cruz-Garcia’s challenge to the IJ’s alleged failure to permit Lesley to testify, but that may have been because the BIA erroneously concluded that Cruz-Garcia had not challenged the IJ’s discretionary determination and therefore did not “reach . . . the arguments raised on appeal.”… Because the BIA failed to address an exhausted argument that ultimately challenges the IJ’s determination that he was not entitled to cancellation of removal, remand is warranted.

 

CA5 on Credibility & Firm Resettlement

CA5: In his credible-fear  interview,  Muminov  did  not  describe  his  alleged 2016 protest  of  the  confiscation of his passport or the beating that he incurred thereafter… Given these discrepancies, a reasonable factfinder could conclude, as the IJ and BIA did, that Muminov’s testimony about politically motivated attacks “was too inconsistent”… He cites his testimony about extortionate fees that  he  was  forced  to  pay  to  live  in  Moscow  and  the  harassment  and  discrimination that he faced there. This  testimony may  well  support a  restricted-residence  exception, but we cannot say that the IJ and BIA were compelled to conclude that…

 

6th Circ. Tells Mom To Return Kids To Venezuela

Law360: A Venezuelan mom must return her children to South America, the Sixth Circuit ordered in a published but split decision, ruling that an incident of domestic violence she said was committed by the father and witnessed by the children was too minor for the court to refuse a Hague Convention petition for their return.

 

8th Circ. Rejects Christian Somali’s Bid To Fight Deportation

Law360: An Eighth Circuit panel declined Wednesday to review a Somali man’s petition to avoid deportation, saying the immigration judge who looked at the case properly determined that even if the man’s testimony were found credible, he still wouldn’t likely face torture in Somalia due to his Christian beliefs.

 

CA10: Federal appeals court rules trans Honduran woman should have received asylum in U.S.

Washington Blade: “Any reasonable adjudicator would be compelled to find a pattern or practice of persecution against transgender women in Honduras,” reads the 10th Circuit ruling.

 

Court OKs Deal Tying Immigration Bonds To Ability To Pay

Law360: A California federal judge has approved a settlement between a class of unauthorized immigrants and the federal government that prohibits judges from setting unreasonable bond amounts for those detained without considering their ability to pay.

 

U.S. Must Face Suit Over Trump’s Separation of Migrant Kids

An Arizona federal judge on Friday dismissed the families putative Bivens class action regarding family separation against 15 high-ranking Trump Administration officials but rejected the federal government’s motion to dismiss as to the families’ FTCA claims against the United States.

 

DHS Enforcement Memo Still Partly Barred Amid Appeal

Law360: An Ohio federal judge refused to shelve his earlier ruling blocking the U.S. Department of Homeland Security from following a Biden administration mandate narrowing immigration enforcement priorities when making custody decisions while DHS appeals his order.

 

Honduran Migrant’s Rape Case Against ICE Agent Too Late

Law360: A Connecticut federal judge dismissed a Honduran immigrant’s claims that an Immigration and Customs Enforcement officer raped and blackmailed her with the threat of deportation for seven years, finding that her claims are all time-barred.

 

CDC Provides Public Health Determination and Order on Termination of Title 42

AILA: CDC released an order to terminate its Title 42 public health order on May 23, 2022. The document assesses the current state of the COVID-19 pandemic, provides legal considerations, and describes plans for DHS to mitigate COVID-19, provide vaccinations to migrants, and resume use of Title 8.

 

USCIS Announces Actions to Reduce Backlogs, Expand Premium Processing, and Provide Relief to Work Permit Holders

AILA: USCIS announced actions to reduce caseloads and processing times. These include setting new internal cycle time goals, creating premium processing availability of Form I-539, Form I-765 and Form I-140 in FY2022, and working toward a temporary final rule for streamlining EAD processes.

 

Concerns about the Immigration Judge and Board Member hiring process

DOJ OIG: In May 2018, eight members of Congress asked the DOJ Office of the Inspector General (OIG) to investigate allegations that after January 2017, offers for Immigration Judge and Board Member positions were withdrawn or delayed for political or ideological reasons. While we were engaged in assessing these allegations, we received additional allegations that other candidates may have been favored in the hiring process because of their connections to the Trump administration, or perceived political affiliation or ideology. The DOJ OIG did not find sufficient evidence based on an assessment of the allegations to warrant opening a full investigation. However, during the course of our assessment, we identified concerns about the Immigration Judge and Board Member hiring process.

On its face, the “Doyle Memo” on PD looks good. But, as is always the case with ICE, it all depends on how it is interpreted, used, and applied on the “Field Office Level” and before the Immigration Courts.

On Title 42, interestingly, GOP states that were fine with the Trump regime’s racist attacks on the rule of law now are apoplectic about the Biden’s Administration’s long overdue effort to restore law, order, and human rights to the border.

It will also be telling to see how Federal Courts (particularly the 5th Circuit) that happily facilitated the Executive’s scofflaw, racist assaults on the Constitution and immigrants’ rights during the Trump era react to the Biden Administration’s efforts to restore at least some semblance of asylum laws and due process.

Experts like Blaine Bookey, Legal Director of the Center for Gender & Refugee Studies; Eleanor Acer, Director of Refugee Protection, Human Rights First; Lee Gelernt, Deputy Director, ACLU Immigrants’ Rights Project, and many others have pointed out that the “Trump/Miller Title 42 Blockade” was an illegal (not to mention immoral) pretext “from the git go.”

We can only hope that Garland does a better job of defending the termination of Title 42 than he did with the equally illegal and immoral “Remain in Mexico” program. However, having made the bad decision to rely upon and defend Title 42 for the last year, and fecklessly standing by while it was illegally invoked by the Biden Administration over a million times to deny migrants their legal rights, Garland might find some of his best legal arguments foreclosed by his own actions.

It’s also possible that given the unconscionable delay, lack of enthusiasm, and lack of effective planning within the Biden Administration for the termination of Title 42 and for vindicating the rights of immigrants of color in general, some of those in influential positions would not be unhappy if a “Trumpist Federal Court” forced them to keep illegally turning back refugees at our border forever!

Tijuana was often indifferent to the iterations of migrants and refugees who arrived here. But the support for Ukrainians was immediate.

“We will work together so you can achieve your dream,” said the city’s mayor, Montserrat Caballero, when she visited the encampment on Thursday. “Welcome to Tijuana.”

On Friday evening, one woman serenaded the refugees while strumming an acoustic guitar. An inebriated American man handed hundreds of dollars in cash to a Ukrainian American volunteer, cursing out Russian President Vladimir Putin as he distributed the money.

“I love Ukrainians,” he slurred.

No. 319 was 21-year-old Svyastoslav Urusky, from Lviv, whose grandparents lived in Sacramento and were waiting for him on the other side of the border crossing.

Like many of the Ukrainians in Tijuana, Urusky had visited U.S. embassies and consulates in European capitals after leaving Ukraine, inquiring about a path to refugee status in the United States.

“They told us, ‘Sorry, we don’t have any options for you yet,’ ” Urusky recounted an embassy official in Poland saying.

So he and his family, after reading the guidance on a Telegram channel, booked flights to Mexico. At 1 p.m. on Friday afternoon, his number was called.

At the Tijuana border crossing, U.S. officials have given orders that only Ukrainians can be put on the list. A policy known as Title 42, due to be lifted in May, has prevented asylum seekers from crossing the border to make their claims since the beginning of the pandemic. It has been used in about 1.7 million migrant expulsions over the past two years.

On Friday, a family of Honduran asylum seekers, turned away at the border, passed by the Ukrainian encampment to ask for small change.

U.S. officials have carved out an exemption to Title 42 for Ukrainians. But many Russians are fleeing simultaneously, including some with Ukrainian relatives. No. 939 was a Ukrainian woman whose 18-year-old son had a Russian passport.

“Will they let us across?” she asked a volunteer. No one could answer.

I’m in favor of fair, humane, generous, and dignified treatment of all refugees and asylum seekers! That’s actually what our laws and international treaties to which we are party require. 

Sadly, under Trump, the U.S. Government, aided to a large extent by feckless and often right-leaning Federal Courts, simply “normalized” racism-driven violations of legal and human rights. So far has our political system and the rule of law deteriorated that the Biden Administration, and even some Dem pols (e.g., Joe Manchin, Henry Cuellar), speak of illegal racist treatment of refugees and migrants as “options” and “strategies” rather than legal and moral perversions. 

According to these folks, we should check the polls, keep an eye on the midterms, and heed the chatter on Sunday talk shows before deciding whether it’s “good policy” to treat persons of color as human beings entitled to seek legal protection or whether to keep knowingly and intentionally violating the law by treating their lives as expendable because it might “play better” at the polls. (It actually won’t).

Perhaps the “low point” of the recent discussion of the long-overdue, still well in the future, elimination of the “illegal Title 42 ruse” came on Meet the Press with Chuck Todd. There, Chuck quipped that an anonymous Biden Administration source had said something to the effect of: “It’s a long time till May 23, perhaps we’ll have a ‘new strain’ of COVID by then.” 

In other words, perhaps not surprisingly given their scofflaw, racist, demeaning, and dehumanizing actions at the border to date, some within the Biden Administration are secretly (or not so secretly) “hoping” for another “fake emergency.” That will allow them to continue to violate the legal and human rights of Haitians, Latin Americans, and other persons of color while offering preferential treatment to their White Brothers & Sisters (“folks just like us”) fleeing Ukraine!

Once you violate our law 1.7 million times, with deadly, disastrous human consequences, it’s hard to stop! It’s also hard to talk credibly about “equal justice” and the “rule of law” when your actions repeatedly are contrary to both. That’s a problem that the Biden Administration, and particularly Garland and his complicit group at DOJ, have yet to come to grips with!

On  Garland’s watch:

    • Racism runs rampant in immigration enforcement and policy;
    • Backlogs continue to grow and fester across the immigration system;
    • Immigration Courts remain dysfunctional, inept, and biased toward DHS Enforcement; and
    • There is no accountability for anything.

Maybe Trump did win that second term, at least as far as Garland’s DOJ is concerned!

After more than a year of not getting the job done, politicos and some border legislators of both parties are debating whether to continue to violate the law, the Constitution, and human rights of asylum seekers of color because Garland and Mayorkas have failed to get a legal asylum system in place at the border — despite having a number of “blueprints” on how it could successfully be done.

Clearly, there is NO public health justification whatsoever for the continued Title 42 farce — it has become an obvious pretext for violating the law because some politicos think it’s convenient and expedient to do so. Those like Garland, Monaco, Gupta, and Clarke who are supposed to stand up for equal justice, racial justice, the rule of law, and protections for the most vulnerable among us have “taken a dive!”

A glaring double standard on refugees

The portrayal and treatment of Ukrainians fleeing war and of Haitian, Central American and Mexican asylum seekers also fleeing deadly violence could not be more different

Over the course of that weekend, I watched how the Ukrainian refugee crisis grew day by day. I read that Airbnb was paying for thousands of refugees to stay in their rooms. Thousands of Europeans in dozens of countries opened their doors to Ukrainians. I was encouraged but bothered at the same time. Media outlets all over the world from the left, right and center praised the courage of these refugees, and some reporters called them heroes.

An overwhelming majority of my students in my classes at UCR are Latino. Several of them are refugees from Latin America, and a few are “Dreamers.” I asked if any of them noticed anything with this growing refugee crisis in Eastern Europe, and several were quick to point out the double standard.

A few weeks before Putin’s invasion of Ukraine started, my class watched interviews about the forced sterilization of Latina refugees at an immigration detention center in Georgia. We discussed the Latino children fleeing Honduras, El Salvador and Guatemala who are being held in U.S. Immigration and Custom Enforcement detention centers to this day. The double standard in the me-dia’s portrayal of the Ukrainian refugees in Europe compared with the images of Haitian, Central American and Mexican migrants at the Mexican border was obvious to everyone in my class.

I thought about the tens of thousands of refugees fleeing Ukraine and the tens of thousands of refugees who have had to flee their homes in Central America, Mexico and other parts of Latin America because of wars, dictatorships, gang warfare and cartel terrorism. Refugees and migrants who are uprooted from their homes all go through trauma whether they come from Latinoamérica or Eastern Europe.

The images of people fleeing Ukraine shook me as I remembered my family’s histories from Ukraine and Mexico, with both sides leaving their homelands for a better life.

Ukraine and Mexico came together to form my family in the borderland of Los Angeles. My Chicano-Mexican-Russian-Ukrainian border-crossing identity hurts as I watch Putin’s war unfold while more waves of Latin American and, very recently, Ukrainian refugees arrive at the Tijuana-U.S. border. My hope is that out of this tragedy, future refugees that come to the Mexican border, whether they are from Honduras or Ukraine, are treated with equal dignity — which all of them deserve.

Ukrainian refugees are “courageous heroes.” Meanwhile, equally brave and deserving refugees of color from Haiti, Latin America, and Africa are dehumanized, degraded, and removed to potential death or danger without a thought and in violation of law. 

They are often called by the misnomer “illegal migrants” — or worse! Ironically, however, the refugees arriving at Southern Border, even if not “invited,” are exercising internationally and domestically recognized legal rights to apply for asylum and other legal protections from involuntary return, some mandatory!

Of course, as intelligent humans, they don’t wait in vain or line up for “imaginary invitations” that will never come! We have no viable refugee programs for Haiti, Africa, and Latin America. Indeed, after four years of Trump and one of Biden we barely have any refugee programs anywhere! Even worse, we have immorally and illegally closed legal ports of entry to asylum seekers. So, having left refugees no viable legal avenues for seeking refuge in the U.S., a right guaranteed by both statute and international convention, we dehumanize and degrade them for using the only “self-help” methods available! Talk about chutzpah!  

It’s actually folks like Vice President Harris, Secretary Mayorkas, AG Garland, and his band of scofflaw lawyers at the DOJ who are the “illegals” in this  scenario. The Biden Administration is hardly the first to turn refugee and asylum laws as well as the Due Process and Equal Protection Clauses of our Constitution on their heads.

The Trump regime gloried in violating the law and mistreating refugees simply for the cruelty, racism, and hate involved. Shockingly, with a some exceptions, life-tenured Federal Judges gave them a pass — particularly at the Supremes which developed their own “special double standard” to dehumanize and “Dred Scottify” immigrants of color!

The Biden Administration sweeps their own gross misconduct and racially charged “double standards” under the rug! Under Garland, the DOJ has “gone along to get along” and even disgracefully defended illegal, immoral, and deadly removals without any process at all. In doing so, they have advanced some of the same discredited myths and disingenuous pretexts developed by Miller, Sessions, Barr and the Jim Crow White Nationalist nativists!

The “mainstream media” give excruciatingly detailed coverage of the humanitarian plight of Ukrainian refugees. Meanwhile, the similar humanitarian plight of vulnerable equally deserving refugees of color, like Ukrainians many of them desperate women and children, gets little coverage outside of a few specialized reporters. 

Of course, beyond the rhetoric, the Biden Administration has actually done very little to help even Ukrainian refugees beyond hollow expressions of sympathy and using them as “props” in the “war of words” with Putin. Leadership is a combination of rhetoric backed with action! 

Our refugee and asylum systems are in shambles, without the leadership and expertise in place to respond to either predictable refugee flows or humanitarian catastrophes in a practical and effective way. That needs to end! But, unfortunately, its hard to see the current, spineless (non) leadership from Harris, Mayorkas, Garland, and others in this Administration getting the job done!
