PRESIDENT BIDEN has served notice that his ambitious immigration plan is in the first rank of his priorities. Some of his program will be immediately implementable; some may get bogged down in Congress, where many Republicans will regard it as an occasion to brandish the word “amnesty,” red meat for their bases. No matter. Mr. Biden’s plan is in keeping with the United States’ best traditions. It responds to the challenge of population stagnation. It would reverse his predecessor’s extravagantly cruel policies. And it is now clear that when it comes to immigration, Mr. Biden is all in.
That courageous stance was not necessarily expected or politically expedient. Unity was the new president’s campaign theme and inaugural touchstone, yet few issues are as divisive as immigration. His evident readiness to tap his modest reserves of political capital for a slugfest on immigration is a signal that the United States has returned to its roots as a beacon for refugees and a humanitarian role model among nations.
The plan is also smart. The U.S. population growth rate in the just-ended decade was the lowest since the first national census in 1790, according to the Brookings Institution — lower even than during the Great Depression of the 1930s. The number of Americans below the age of 18 actually shrank in the 2010s, by more than 1 million.
That stagnation, the product of an aging population and historically low fertility rates, cannot be reversed by immigration alone. But it will certainly be exacerbated, and has been in the past four years, by a policy hostile to newcomers. In President Donald Trump’s penultimate year in office, annual net immigration fell below 600,000, the lowest level in decades; it was more than 1 million in the final years of the Obama presidency.
What’s more, by proposing an eight-year path to citizenship for most of the nation’s 11 million unauthorized migrants — the centerpiece of his plan — Mr. Biden is attempting to align law and reality. By 2029, when they would be eligible for citizenship, most will have been in the United States for more than a quarter-century. At least 4 million are essential workers in construction, food processing, groceries, restaurants, agriculture and transportation — doing jobs critical to practically every American.
Mr. Biden is moving quickly where he can — fully reinstating the Obama-era program providing work permits and deportation protection for “dreamers,” young migrants brought to this country by their parents; rescinding Mr. Trump’s 2017 travel ban from majority-Muslim countries; halting construction of the southern border wall; and reining in the Trump administration’s aggressive deportation policies. He has also signaled he will increase annual refugee admissions, which Mr. Trump poleaxed, and scrap a Trump administration rule that denies green cards to immigrants deemed likely to use public benefits such as food stamps.
Other measures will require congressional action. Under legislation Mr. Biden is sending to Congress, green cards conferring legal permanent residency would be granted to dreamers as well as to immigrants from strife- and disaster-wracked nations who have been here for years.
The president is also pushing tougher border security — in recognition that the new administration is not inviting a wave of new migrants, still less amid a pandemic — though not as a precondition for his immigration reforms. His more impactful, long-term strategy to dissuade new waves of illegal immigrants is a concerted aid effort to boost economies and contain crime in Central America.
Mr. Biden has laid out an immigration program that would genuinely put America first.

12:01 PM: Biden administration installs host of acting leaders to run Justice Department as president’s nominees await confirmation
The Biden administration has installed a host of acting leaders to run the Justice Department while the president’s nominees await confirmation, according to an internal memo sent out Wednesday.
Monty Wilkson, a department human resources official, will serve as acting attorney general, while John Carlin, a former head of the Justice Department’s national security division, will serve as acting deputy attorney general. The acting No. 3 official will be Matthew Colangelo, who most recently worked in the New York State Attorney General’s Office and, before that, in the Obama White House and Justice Department’s civil rights division.
Elizabeth Prelogar, who had worked on special counsel Robert S. Mueller III’s team before leaving the department for private practice, will serve as the acting solicitor general, who represents the department in matters before the Supreme Court.
Here are some of the rest of those tapped to serve in acting capacities: Regina Lombardo, acting ATF director; Darrell C. Evans, acting administrator of the Drug Enforcement Administration; Brian Boynton, Acting Assistant Attorney General for the Civil Division; Gerri Ratliff, Acting Director of the Community Relations Service.

Three resettlement agencies responsible for sponsoring refugees challenged the new policy. The agencies work with the State Department to welcome adults and children who have fled war and persecution in other countries. They connect refugees to housing, jobs and English classes needed to start their new lives in the United States.
Melanie Nezer, a senior vice president of the Silver Spring, Md.-based HIAS, one of the agencies behind the lawsuit, applauded the court’s decision.
“Especially right now, at this moment in history, it is really affirming and validating to see the court affirm the importance of the program,” Nezer said Friday.
“It will take a lot of work to rebuild a system that the Trump administration has broken down over the last four years,” she said.

Trump issued the order after he set the annual national refugee cap for fiscal 2020 at a historic low of 18,000, down from 110,000 in 2016.
Texas was the first state to publicly refuse to resettle new refugees, with Gov. Greg Abbott (R) saying the state has “carried more than its share.” The vast majority of other governors, however, signed letters saying they would accept refugees.
Nezer said the incoming Biden administration has committed to admitting refugees at levels more in line with historical figures.
A spokesman for the Justice Department did not immediately respond to a request for comment.

The appeals court upheld a nationwide injunction issued last year by U.S. District Judge Peter J. Messitte, who concluded that the requirement gave state and local governments veto power that he said is “arbitrary and capricious as well as inherently susceptible to hidden bias.”
The 4th Circuit agreed. The policy, the court said, would also impose an “extreme burden” on the nonprofit agencies required to obtain consent from local officials. The court warned that the policy would erode community relationships and was likely to result in the closure of some offices.
“The record is clear that the resettlement agencies were not designed for this role and have been forced to divert enormous resources from their core social service missions to their new lobbying responsibilities,” according to the 4th Circuit.

The 4th Circuit comes through for America! The court pointed out the malicious stupidity of the regime’s policy that dismantled and wasted the resources of the NGOs who conduct refugee resettlement, one of the most effective and beneficial programs in America. Additionally, I have proposed that the type of cooperation, expertise, and organization that has succeeded in refugee resettlement could be applied creatively to screening, obtaining representation, adjudicating, and resettling asylum seekers and those granted asylum. The Biden Administration should build on and expand things that work, particularly public private partnerships and grants to NGOs and state and local governments.
They must stop squandering money and resources on racist, “built to fail” enforcement gimmicks and unconstitutional, unnecessary, inhumane, expensive, and immoral detention! “Repurpose” the funds wasted on the “stunt wall” and devote them to getting asylum seekers processed in a fair, humane, and timely manner that complies with due process and our statutory and international obligations.
Greg Abbott is another sleazy White Nationalist who should be removed from office for lies, false narratives, religious bias, and overt racism.
For the women of the WNBA, the push to expel one of their league’s owners from office — and ultimately help tip the balance of the U.S. Senate — started with two words on a plain black T-shirt.
It was summer. Amid nationwide protests against racial injustice, Sen. Kelly Loeffler (R-Ga.), co-owner of the Atlanta Dream, had sent a letter to the league that denounced its support of the Black Lives Matter movement, parroting President Trump’s rhetoric as she fought to keep her seat.
Loeffler’s embrace of Trumpism had shocked those who had known her as an inclusive boss in a league dominated by Black women. But it appeared to be working: She was leading the crowded race, while one of her opponents, the Rev. Raphael Warnock (D), polled at only 9 percent.
Then WNBA players responded. They rejected Loeffler’s letter. And in early August, players from across the league, including those from her own team, wore shirts that read “VOTE WARNOCK.”

In the three days that followed, Warnock’s campaign raised more than $236,000 and added nearly 4,000 followers on Twitter. His support grew from there, catapulting him into a runoff with Loeffler. Jon Ossoff’s win in a race called Wednesday gave Democrats slim control over the Senate, with Vice President-elect Kamala D. Harris as the tiebreaking vote.
WNBA players, many of whom are overseas with international teams, spent Wednesday celebrating their assist — and wondering what it means for Loeffler’s future in the league.
“It’s a special moment for us because we’re constantly at the forefront of every issue, but we don’t get the respect we deserve,” said Washington Mystics guard Natasha Cloud, who opted out of this past season to focus on social justice causes. “Whether it’s on the court or off the court in our influence. You have a moment like this where you can’t say we didn’t help determine the outcome.”

The great virtue of President Trump’s smoking subversion tape is that it clarifies the goals of all concerned.
The president’s stated objective is not to expose abuses in the electoral system. It is to pressure the Georgia secretary of state into manipulating the electoral system to squeeze out 11,780 additional votes — Trump specifies the exact number — in his favor. His cynical, delusional justifications are beside the point. He would say anything — invent any lie, allege any conspiracy, defame any opponent, spread any discredited rumor — to perpetuate his power.
This, in turn, illuminates the motives of his congressional enablers. In light of Trump’s clarifying call, the term “enablers” now seems too weak. When Sen. Josh Hawley (R-Mo.), Sen. Ted Cruz (R-Tex.) and their GOP colleagues try to disrupt and overturn a free and fair election, they are no longer just allies of a subversive; they become instruments of subversion. They not only help a liar; they become liars. They not only empower conspiracy theories; they join a conspiracy against American democracy. They not only excuse institutional arson; they set fire to the Constitution and dance around the flame.
Their pathetic motivations no longer matter. Some are simple cowards, frightened by angry people wearing red hats. Are we supposed to indulge their cravenness out of pity? Are we supposed to sympathize with people who want to keep their jobs at the cost of their country? Others eventually want the angry people in red hats to support their political ambitions. Are we supposed to humor people who seek the presidency by spitting on the institution of the presidency? Are we supposed make allowances for a selfishness so comprehensive that it eclipses duty, loyalty and love of country?
We are witnessing what happens when treacherous politicians run in packs. A solitary betrayal of the constitutional order by a member of Congress is a source of shame and, perhaps, a cause for expulsion. When 100 and more Republicans join hands and betray the constitutional order, it is a populist cause. They gain the confidence, even the thrill, of shared disloyalty. But their oath of office — in every single case — has been dishonored. They have demonstrated their unfitness for office and called their own patriotism into question.
So maybe it is for the best that they stand up and be counted. Maybe it is best for Americans to know who will “support and defend the Constitution of the United States against all enemies, foreign and domestic” — and who will not. By all means, let’s engrave their names into a marble slab — a roll call of those who failed the most important test of self-government in our lifetimes. There are a lot of monuments honoring bravery. Let’s have one dedicated to abject cowardice.

It is fortunate for the country that Trump is a clownish figure. In his subversion tape, he ricochets between ominous threats and pathetic lunacy. He is not capable of an organized thought, much less an organized coup. Any revolution with Rudolph W. Giuliani, Sidney Powell and Lin Wood in the vanguard is likely to end in the joke bin of history.
And yet: Trump and his congressional implementers have purposely placed a virus in the public order. A significant portion of the country has expressed support for the triumph of anger over institutions. These are potential recruits for anarchy. Trump, Hawley, Cruz and the others may be laying the path for a rougher beast slouching toward Washington. They are shredding the careful work of America’s founders. And they deserve nothing but contempt.

As our eyes fall upon the familiar manger scenes scattered throughout our churches and homes this Christmas season, it is hard not to think about the millions of people from that same manger land who are seeking refuge from terror and oppression now 2,000 years later.
Where will they go? Who will give them shelter?
As Oliver Willis with Media Matters tweeted: “if only we had a seasonally appropriate story about middle eastern people seeking refuge being turned away by the heartless.”
This less-than-140-character comment has inspired thousands of words in response, many of them from conservative Christians attacking Willis for committing a grave offense against the Christmas story. “Christmas is about Christ,” they insist, “not Syrian refugees. The holy family was simply returning to Bethlehem for a census.” Factually, these critics are right. But they miss the much larger point of the
The Christmas story is not about a refugee family, but it is about a family seeking refuge. Ordered by an occupying government to travel by foot for days on end so that Caesar Augustus could count the number of people under his order, an expectant mother at the peak of her pregnancy is forced to undergo the single most dangerous experience of a first-century woman’s life not at home, but away in a manger.
It was a fiercely political environment through which they wandered. Why should we pretend like it wasn’t?

I believe the Christmas story should open our eyes and our hearts to those most vulnerable in our midst. To those whose only hope is to travel by foot and inflatable raft for days in search of a livable life—many of whom look very much like the Middle Eastern Mary, Jesus’ mother.

When Jesus is asked how one inherits eternal life, he responds with the story of the Good Samaritan. The most startling part of the story is that in Jesus’ time Samaritans were perceived similarly to American Muslims today.
Imagine the Pope, when asked how one gets into heaven, answering with a story about a young Muslim from Syria. This is the story Jesus tells.
Jesus tells us to welcome the stranger, to feed the hungry, to go and sell all your possessions and give the money to the poor. Jesus asks that we treat all of humanity with the same love, kindness and generosity that he modeled throughout his life.
The Christmas story reminds us of a family struggling under the yoke of an oppressive regime. Of a God who became human to take on our struggles and strife and to embody divine love, whose light shines on all. As he tells us, whatever we have done for the least among us we have done to him.
As followers of Jesus we are called to welcome the strangers of our time. To return the care shown by the Good Samaritan to today’s marginalized communities. And to open our hearts and our doors to those seeking refuge this Christmas season, whatever their religion.

Rev. Jones’s words are as true today, even in the middle of a pandemic, as they were in 2015 when she wrote them.
According to this specious reasoning, that justifies an indefinite extension of the current regime’s cruel, bogus, and illegal refugee bans, including “Let ‘Em Die in Mexico” by the new Administration while it “cautiously figures things out” (something the Obama Administration never managed to do over eight painful years of botched asylum policies). I call BS! In this situation, every day of unnecessary delay in ending the regime’s racist policies endangers human lives and mocks our claim to be a “nation of laws.”
I repeat the words of my Round Table friend & colleague Judge Paul Grussendorf, a man who has first-had experience with refugees at all levels of our system and who, unlike the Editorial Board and the nativists, has “walked the walk and talked the talk:”
In the early days of this administration there was much hype over the “migrant caravans” composed mostly of Central Americans from the “northern triangle” countries, El Salvador, Honduras and Guatemala, that were “invading” our country — the old “barbarian hordes” trope that is a favorite of every totalitarian regime. In fact the numbers of each such “caravan” for the most part would easily fit inside a typical college stadium. (Current demographics demonstrate that even if we admitted all of them as potential workers and residents, the U.S. would still experience labor shortfalls in the near future and they would not supplant the decline of our native-born population.)

Judge Grussendorf has forgotten more about asylum and refugee law and practice, and the humanity they serve, than the Editorial Board or the nativist alarmists (“modern day chicken🐥 littles”) they mimic will ever know.
We’ve survived four years of a maliciously incompetent regime that thrives on disorder, lies, corruption, promoting human misery, inequality, racism, and has intentionally sought to undermine our democracy. Refugees actually bring to the table hope, courage, skills, self-sacrifice, values, and the same ideals on which our country was founded. We actually have both the legal tools and the professional expertise readily available to treat asylum seekers and other migrants fairly. The last two Administrations have basically either failed to use existing mechanisms properly or, as in the case of the regime, actively worked to disassemble that which works.
Reversing these disgraceful trends isn’t rocket science. We can institute and apply the correct legal standards in a fair and reasonable manner. There are loads of folks out there, many in them in the private or NGO sector, who know how to work with refugees, make fair determinations, resettle those who qualify, and institute humane alternatives for those who don’t fit within our current system. Since the regime trashed our international humanitarian obligations, many trained refugee and humanitarian professionals are more than ready to resume using their skills and expertise in refugee matters that was so stupidly, immorally, and improperly “shelved” by the regime.
It might not happen on January 21, 2021, but it could and should happen within a short time thereafter with the right folks in change and a concerted effort on the part of the Biden-Harris Administration to put them in place where they can solve the problems. Getting our asylum, refugee, and Immigration Court systems functioning needs to be a national priority of the highest order, right after COVID relief and economic help! It’s a critical part of the Biden-Harris Administration’s overriding commitment to racial and social justice!
Not surprisingly, refugee crises and the need for a strong, competent, lawful response seldom, if ever, come upon us in “in the best of times” when we are completely prepared. Refugee crises almost always come to a head during times of war, natural disaster, famine, revolution, or worldwide economic depression and disorder. The UN Refugee Convention sprung from the aftermath of WW II and Cold War, hardly stable times in history.
We can and must make carrying through on our legal and humanitarian obligations to the most vulnerable humans in the world, even in difficult and challenging times, part of our obligation to “show Christ-like love in word and deed” regardless of our religious affiliation, if any.
Christ never asked his followers to do what was easy, profitable, ego-satisfying, or non-threatening — he asked others to follow him in unselfishly taking risk, believing in a better world to come, and “putting it all on the line” for humanity. Those are noble principles that all should be able to agree and act upon.
“Bill Barr’s Christmas Resignation” is one of the worst pieces of holiday content I have ever consumed! A letdown on every level. First, the title is not a pun. Second, the ending comes out of nowhere.
This story of a deceptively affable-seeming attorney general and how he decides to leave the Trump administration for good to spend the holidays with his family at first seems like it’s going to be standard Christmas fare. A 70-year-old man overly devoted to his occupation who feels no guilt about any of his past deeds and seems deficient in sympathy for his fellow man — what could possibly be a more classic Christmas movie setup? That is why what followed was so disappointing and jarring.
We open with Bill in his office, merrily redacting away at some document that probably should not have been redacted. He is visited by a malicious-looking elf who has messages for him. (Correction: I totally misread what was going on; this was actually senior presidential adviser Jared Kushner. I regret the error.)
We see a picture on Bill’s desk of his boss, Donald Trump, and he keeps going on and on about how excited he is to enact Donald Trump’s agenda. We also learn about all the executions he has scheduled after reinstating the death penalty for federal crimes. This seems incredibly brutal and dark but does establish a character who is going to grow a lot and learn he needs to change his ways.
He leaves the office and drives home past several signs expressing negative sentiments about Donald Trump. He passes Lafayette Square and remembers giving the go-ahead to fire pepper balls at peaceful protesters. He smiles his affable smile. Lights reflect off the window of his secure vehicle. A holiday song plays.

At this point you, the viewer, glance at your watch. This has been a lot of setup, you think. But it’s called “Bill Barr’s Christmas Resignation”! It ends with him leaving his job as the head of the Justice Department to be with his family. He wouldn’t just do that randomly, would he? There’s got to be an inciting incident of some kind. Perhaps when the clock strikes midnight he will be switched with his secret twin and forced to replicate the White House in fondant for a baking contest. Maybe he will get a call from the head of what claims to be a little-known European country — a perfect call, asking him to spend his holiday season there.
He arrives home and flicks on the TV, where he can see several sinister cronies of Donald Trump (whom he has personally allowed to avoid the consequences of their actions) roaming freely around the city inciting mobs of Proud Boys and even urging their followers to call for martial law. And then he goes to bed and — sleeps peacefully, on a MyPillow.
At this point a commercial for MyPillow came on — the whole thing was sponsored by MyPillow — and I quickly checked to make sure I was watching the right thing, because we were halfway through “Bill Barr’s Christmas Resignation” and he was still going about his life like he didn’t think he’d done anything wrong or needed to change his ways at all. He hadn’t even been assigned to a project he didn’t want to work on with a co-worker who loved Christmas a little too much.
After the commercial, we see Bill is having a dream. It seemed as though this would be when things turned around. In the dream, he walks through a populous city. He sees Want and Ignorance and gives them a thumbs-up. He sees his own tombstone with “Servant of Donald Trump” on it and smiles cheerily at it. He sees a little girl lighting match after match to keep herself warm and — adds the city to his list of Anarchist Jurisdictions.

CRUELTY TO migrant children, a trademark of the Trump administration’s immigration policy, did not cease when officials reversed course in the face of public outrage two years ago and stopped wrenching toddlers, tweens and teens from their parents — with no plan or process to reunite them. It has continued apace under cover of the pandemic, which the White House has used as an all-purpose pretext for ignoring child-protection laws and diplomatic agreements governing asylum, and, without even a nod to due process, expelling unaccompanied children who cross the border seeking refuge.
A federal judge has now halted that practice even as he acknowledged the administration’s far-reaching powers in the midst of a public health emergency. Those powers are broad, U.S. District Judge Emmet G. Sullivan ruled, but do not enable the government to send minors packing without affording them a chance to have their asylum claims heard.
At least 13,000 children have been detained by Border Patrol officers and swiftly thrown out of the country under an emergency decree that has effectively sealed off the southern border to most migrants since the spring. Administration officials justified the measure in the name of protecting the country from a potential influx of migrants carrying the coronavirus — but performed no testing, and provided no data, to substantiate their stance.
Given infection rates in Mexico and Central America, it may be reasonable to assume that some migrants, including unaccompanied minors, might have contracted covid-19. It may also be the case, however, as the ACLU argued in court, that the practice of expelling young migrants actually exposes U.S. border authorities to more risk — in the course of holding them while flights are arranged to their home countries in Central America or elsewhere — than they would otherwise face if the migrants were placed in shelters that have the capacity to adopt social distancing and other precautions. Judge Sullivan, for his part, said the government had asserted its “scientific and technical expertise” to justify its policy of evicting young migrants — but provided none by way of actual evidence.
As it happens, it occurred to at least some administration officials, early on in the pandemic, that migrant children deserved some special consideration. When the policy of suspending asylum was first rolled out, children who crossed the border were exempted. That was quickly reversed, however, with a spokesman saying that minors would be returned to their countries of origin on a “case by case basis.” In the ensuing months, however, virtually all have been expelled.
Anti-trafficking and other laws provide for protections for unaccompanied minors who arrive in this country. The administration has seized on the pandemic to disregard those, along with other long-standing measures and practices that set procedures for migrants seeking refuge here. A more humane approach, in line with American traditions and values, would have established a process for testing and quarantining, at least for migrant children, as they pursued asylum claims. But humane policy is anathema to the Trump administration, and the result is thousands of children who have been subjected to unwarranted hardship and risk.

We owe our existence as a nation less to any “structural integrity” and much more to a relatively few courageous, smart, highly motivated members of the resistance: immigration, human rights, and civil rights lawyers; African American women; non-right-wing journalists; Democratic legislators; scientists and medical professionals; a limited number of Federal Judges, mostly at the District Court and Immigration Court levels (and specifically excluding any current BIA Member, EOIR “Manager,” or Supreme Court Justice not named Sotomayor, Kagan, and (sort of) Breyer); courageous DACA kids; and some Federal Career Civil servants not working at ICE or CBP.
The “resilience of American institutions” view is largely that of a privileged minority who haven’t been deported to possible torture or death without any process at all (let alone “due” process), haven’t been illegally separated from beloved family members, aren’t rotting in private prisons (the “New American Gulag”) for the “crime” of seeking justice, aren’t struggling with unemployment or difficulty putting food on the table while Moscow Mitch and his elites focus on confirming unqualified Federal Judges, haven’t had family members shot by the police, haven’t had family members unnecessarily suffer and die because of the worst President in U.S. history’s maliciously incompetent failure to provide leadership and any systematic strategy for controlling a pandemic, and haven’t had to put their lives and professional reputations on the line in a failing Justice system that has enabled grotesque abuses by the likes of Jeff “Gonzo Apocalypto” Sessions, Billy the Bigot Barr, Noel Francisco, and the rest of their band of unethical Government lawyers.
The Biden Administration must do a thorough housecleaning of the corrupt DHS and DOJ bureaucracies that carried out the illegal, immoral, racist, White Nationalist agenda developed by neo-Nazi Stephen Miller and his cowardly gang of brownshirts!
And, as a nation, we need to think carefully about the implications of a life-tenured Supreme Court majority that, since their initial feckless performance on the “Muslim Ban” cases, time and time again failed to forcefully and unanimously stand up for our democracy, human decency, and those defending them in the face of overt, racism and hate driven, Executive tyranny! A Supremes’ majority that has disgracefully and spinelessly embraced the “Dred Scottification” of “the other” (mostly immigrants and those of color). It’s not rocket science! And some of our “elite law schools” seemed to have forgotten to teach “Con Law 101” and “Basic Ethics” to aspiring right wing judges!
It’s less about institutions than it is about the courageous individuals who uphold them! And, our future depends on the Biden-Harris Administration putting these folks “in the game” to insure that an unmitigated disaster like the Trump regime, it’s rampant illegality and inhumanity, and its “malicious incompetence” can never, ever, happen again! And, we must at least start the process of developing a better and more courageous Federal Judiciary for the future!

Last week, as the White House digested news of a defeat at the polls, Trump administration officials were greeted with reports of troubling setbacks on two fronts in the country’s long-simmering conflict with Iran.
First came a leaked U.N. document showing yet another sharp rise in Iran’s stockpile of enriched uranium. Then, satellites tracked an Iranian oil tanker — the fourth in recent weeks — sailing toward the Persian Gulf after delivering Iranian petroleum products to Venezuela.
The first item was further proof of Iran’s progress in amassing the fissile fuel used to make nuclear energy and, potentially, nuclear bombs. The second revealed gaping holes in President Trump’s strategy for stopping that advance. Over the summer, the administration made a show of seizing cargo from several other tankers at sea in a bid to deter Iran from trying to sell its oil abroad. Yet Iran’s oil trade, like its nuclear fuel output, is on the rise again.
The Trump administration is entering its final months with a flurry of new sanctions intended to squeeze Iran economically. But by nearly every measure, the efforts appear to be faltering. The tankers that arrived in Venezuela in recent weeks are part of a flotilla of ships that analysts say is now quietly moving a million barrels of discounted Iranian oil and gas a day to eager customers from the Middle East to South America to Asia, including China.
The volume represents a more than tenfold increase since the spring, analysts say, and signals what experts see as a significant weakening of the “maximum pressure” sanctions imposed by the Trump administration since it withdrew from the Iran nuclear deal in 2018.
Other countries, many of them scornful of Trump’s unilateralism on Iran, are showing increasing reluctance to enforce the restrictions, even as Iran embarks on a new expansion of its uranium stockpile, according to industry analysts and intelligence officials, some of whom spoke on the condition of anonymity to discuss sensitive assessments.

As a result, Trump is widely expected to leave President-elect Joe Biden with a crisis that is worse, by nearly every measure, than when he was elected four years ago: an Iranian government that is blowing past limits on its nuclear program, while Washington’s diplomatic and economic leverage steadily declines.
“The Tehran regime has met ‘maximum pressure’ with its own pressure,” said Robert Litwak, senior vice president of the Washington-based Woodrow Wilson International Center for Scholars and the author of “Managing Nuclear Risks,” a book on countering proliferation threats. Far from halting Iran’s nuclear advances, Litwak said, the administration’s policies have “diplomatically isolated the United States, not Iran.”
The weakening of sanctions pressure gives Iran more time to deal with its still formidable economic challenges, without losing a step in its bid to re-create uranium assets it had given up under the terms of the nuclear accord, the intelligence officials and industry experts said. Last week, the International Atomic Energy Agency reported to member states in a confidential document that Iran’s stockpile of low-enriched uranium has swollen to nearly 8,000 pounds, more than 12 times the limit set by the 2015 nuclear deal. Iranian officials justify the breach by noting that it was Washington, not Tehran, that walked away from the agreement.
Even among staunch U.S. allies in Europe and Asia, dismay over the Trump approach has cooled support for the kind of broadly enforced economic boycott that might push Iran to change its behavior, analysts said.
“Many eyes may be averted now” when it comes to Iranian cheating on sanctions, said Eric Lee, an energy strategist with Citigroup in New York. “Many countries are frustrated with U.S. unilateralism, even those with well-placed misgivings about Iran.”

What kind of people are we? As a society, are we so decadent and insecure that we show “toughness” by deliberately being cruel to innocent children? Is this what our nation has come to? Or are we better than that?
This election demands we answer those questions. The choice between President Trump and Joe Biden is not just political. It is also moral. And perhaps nothing more starkly illustrates the moral dimension of that decision than the Trump administration’s policy of kidnapping children at the southern U.S. border, ripping them away from their families — and doing so for no reason other than to demonstrate Trump’s warped vision of American strength.
We learned this week that some of those separations will probably be permanent. As NBC News first reported, 545 boys and girls taken as many as three years ago — the children of would-be immigrants and asylum seekers, mostly from Central America — have not been reunited with their parents and may never see their families again.
These are not among the nearly 3,000 families separated at the border in 2018, when children were kept in cages like animals or shipped away to facilities across the country, hundreds or thousands of miles from the border. We now know, thanks to the American Civil Liberties Union and other pro bono lawyers, that an additional 1,500 children were torn away from their families beginning in 2017, when the Trump administration conducted a trial run of the separation policy.
Please think about that. The shocking scenes we saw two years ago did not result from a sudden spasm of presidential anger. They didn’t stem from a Fox News segment Trump might have seen one evening. Rather, the administration rehearsed this form of cruelty.
What the administration did not plan for was how to reunite the children taken in 2017 with their families. Many of the parents were deported, and their children were placed in shelters around the country, then ostensibly released to parents or guardians, placements that the ACLU is still trying to confirm.

The ACLU and other organizations have sent investigators to towns and villages in Central America in an attempt to find the kidnapped children’s families — an effort complicated not just by time and distance, but also by the covid-19 pandemic. Parents of 545 children have not been found, the ACLU reported this week.
Disturbingly, the Department of Homeland Security suggested that some of the parents declined to get their children back so they could remain in the United States. Keep in mind that most of these families were seeking asylum from deadly violence in their home countries. The Trump administration changed immigration guidelines to make it unlikely that the families would ultimately be allowed to stay in the United States, but federal law gives them the right to apply for asylum and to have their cases heard. They did nothing wrong. They should never have been asked to choose between parenting their children and getting them to safety — not by their home countries, and not by the United States.
Trump’s racism and xenophobia have been hallmarks of his presidency from the beginning, so perhaps it should be no surprise that he would preside over such an outrage. But he didn’t do this by himself. He had plenty of help.
Former attorney general Jeff Sessions seized an opportunity to make his rabid antipathy toward Hispanic immigration into policy. White House senior adviser Stephen Miller, a former Sessions aide in the Senate, was the architect of Trump’s “zero tolerance” immigration policy. Then-White House Chief of Staff John F. Kelly said in 2018 that the children taken would be “taken care of — put into foster care or whatever.” Former homeland security secretary Kirstjen Nielsen said last year that she regretted that “information flow and coordination to quickly reunite the families was clearly not in place” — but not the separations themselves.
President Donald Trump’s administration started and carried out a policy that took more than 4,000 children from their parents, at least 545 of whom are still split apart years later. But at Thursday’s debate, the president insisted that he did nothing wrong at all ― blaming his Democratic predecessors and even insisting the kids are doing fine.
“They are so well taken care of,” Trump said of the children taken from their parents by his administration. “They’re in facilities that were so clean.”
Trump’s first term was marked by a full-out assault on immigration, both legal and unauthorized. The most dramatic was his “zero tolerance” policy on unauthorized border-crossing, used in a 2017 pilot program and expanded more broadly in 2018, that led to criminal prosecution of parents and locking up their kids separately. Splitting up families was intentional and calculated, according to multiple reports.
Thanks to mass public outrage and a court order, Trump was forced to stop his family separation policy. Most families were reunited, but the American Civil Liberties Union, which was part of the lawsuit against the government that stopped the policy, said this week that at least 545 kids are still away from their parents.
“Their kids were ripped from their arms and separated,” Democratic nominee Joe Biden said during the debate. “And now they cannot find over 500 sets of those parents and those kids are alone. Nowhere to go. Nowhere to go. It’s criminal.”

That is the number of children still separated from their families by the Trump administration — separated deliberately, cruelly and recklessly. They might never be reunited with their parents again. Even if they are, the damage is unimaginable and irreparable.

Even one would be too many. Each one represents a unique tragedy. Imagine being ripped from your parents, or having your child taken from you. Imagine the desperation that the parents feel, the trauma inflicted on their children.

That number represents an indelible stain on President Trump and every individual in his administration who implemented this policy, flawed at the conception and typically, gruesomely incompetent in the execution. It is, perhaps in the technical sense but surely in the broader one, a crime against humanity. It is torture.

That number — I will stop repeating it, yet it cannot be repeated enough — represents a moral challenge and responsibility for the next administration. If Joe Biden is elected president, he must devote the maximum resources of the federal government to fixing this disaster. The United States broke these families; it must do whatever it takes to help them heal.
Nothing like that would happen in a second Trump term, because Trump himself doesn’t care. He doesn’t grasp the horror that he oversaw. He doesn’t comprehend the policy, and he is incapable of feeling the pain it inflicted.
Those truths could not have been clearer cut than during Thursday night’s debate.
Moderator Kristen Welker of NBC News asked the president a simple question: “How will these families ever be reunited?”
First, Trump misstated the situation: “Their children are brought here by coyotes and lots of bad people, cartels, and they’re brought here, and they used to use them to get into our country.”
No. These are children separated from their families, not separated from smugglers. They are children brought by their parents in desperate search of a better life, desperate enough that they would take the risk of the dangerous journey.
Then Trump pivoted to the irrelevant: “We now have as strong a border as we’ve ever had. We’re over 400 miles of brand new wall. You see the numbers. And we let people in, but they have to come in legally.”
Welker persisted: “But how will you reunite these kids with their families, Mr. President?”
Trump responded by pointing his finger at his predecessor: “Let me just tell you, they built cages. You know, they used to say I built the cages, and then they had a picture in a certain newspaper and it was a picture of these horrible cages and they said look at these cages, President Trump built them, and then it was determined they were built in 2014. That was him.”
This is typical Trumpian deflection, bluster undergirded by ignorance. The “cages” are ugly but irrelevant to the topic at hand: the deliberately cruel plan to deter border-crossing by separating children from parents. That was a Trump administration special, implemented with callous sloppiness and so extreme that even the Trump administration abandoned it.
Welker, for the third time: “Do you have a plan to reunite the kids with their families?”
At which point Trump made clear that he did not: “We’re trying very hard, but a lot of these kids come out without the parents, they come over through cartels and through coyotes and through gangs.” The children, he added later, “are so well taken care of, they’re in facilities that were so clean.”
The third and final presidential debate gave Donald Trump and Joe Biden the opportunity to make their final pitch to the American people before the 2020 election. For the Democratic nominee, that meant driving home the point that he believes in science, that he’ll take the COVID-19 pandemic seriously, that climate change is real, and that systemic racism must be dealt with. For Trump, it meant making it clear that in addition to being a science-denying, QAnon-promoting dimwit, he’s also an actual monster who thinks separating small children from their parents, in some cases permanently, is absolutely fine.
Asked by moderated Kristen Welker about the news that parents of 545 children separated at the border—60 of whom are under the age of five—cannot be located, Trump defended the policy and gave no explanation for how the government plans to find these people and reunite their families. “Children are brought here by coyotes and lots of bad people, cartels, and they’re brought here and they used to use them to get into our country,” Trump said, which is objectively false, as they are brought here by their parents, which is why it’s called the family separation policy. “We now have as strong a border as we’ve ever had. We’re over 400 miles of brand new wall. You see the numbers and we let people in but they have to come in legally.”
Noting that Trump hadn’t answered the question, Welker pressed: “But how will you unite these kids with their families?”
“They built cages, they used to say I built cages…that was him,” Trump said, pointing to Biden and referring to the fact that the Obama administration did build temporary enclosures but failing, naturally, to mention that his predecessor did not separate families.
“Do you have a plan to reunite the kids with their parents?” Welker asked a third time. Again, Trump responded by claiming that the children “come without the parents, they come over through cartels and through coyotes and through gangs.”
At this point, Joe Biden was given a chance to weigh in and used his time to describe the policy implemented by Trump as the horror show all non-sociopaths know it to be. “Parents, their kids were ripped from their arms and they were separated and now they cannot find over 500 sets of those parents and those kids are alone, nowhere to go. It’s criminal.”
Then Trump interjected with what he apparently believed was an important point that would cast his administration in a much more favorable light and perhaps might even win it some awards or sainthood by the Catholic church. “Kristen, I will say this,” he told the moderator, of the children stolen from their parents. “They’re so well taken care of. They’re in facilities that are so clean.
With regard to that claim, NBC News reporter Jacob Soboroff weighed in on that after the debate, telling Rachel Maddow: “I was one of the reporters I guess the president mentioned, they invited me to go to the epicenter of this policy…what I saw was little children sitting on concrete floors, covered by mylar blankets, supervised by security contractors in a watchtower, it makes me sick every time I recall it. And Physicians for Human Rights…called this torture…the American Academy of Pediatrics called this state-sanctioned child abuse, and the president of the United States I guess interprets that as children being well taken care of.”

SCOTUSblog: The Supreme Court announced on Monday morning that it would take up two cases arising out of the Trump administration’s effort to stem immigration through the United States’ border with Mexico. The justices granted review to weigh in on the long-running dispute over the funding for President Donald Trump’s border wall, as well as the legality of the Trump administration’s “remain in Mexico” policy, which allows the Department of Homeland Security to return immigrants seeking asylum to Mexico while they wait for an asylum hearing in U.S. immigration court. WaPo: ICE officers made the arrests in Denver, Seattle, New York, Baltimore, Washington and in Philadelphia, where authorities chose to announce the results and where officials said 26 immigrants were taken into custody. The agency has averaged about 40,000 “at-large” arrests per year, so the numbers announced Friday did not appear to be a significant increase in enforcement activity. WBUR: On Tuesday, the Boston immigration court will resume what are known as “master calendar hearings.” Even though the court has remained open throughout the pandemic, these proceedings, which bring large crowds of people to court, have been on hold — until now.
WaPo: The five-member Board of Supervisors voted unanimously Tuesday to authorize the payment, mostly to undocumented immigrants arrested on criminal charges and then held after a judge ordered them released so that federal agents could attempt to deport them. The settlement still must be approved by the judge overseeing the case, lawyers for the plaintiffs said.
WaPo: After someone painted a slogan on the sidewalk outside the home of Virginia Attorney General Mark R. Herring during a September protest, Leesburg police launched a criminal investigation into the immigrant rights coalition that organized it, court records state…Authorities asked for virtually all of the Facebook page’s content over a five-day period, a move the group says would give law enforcement access to sensitive information about undocumented immigrants and their families, confidential health reports, and complaints by name about specific law enforcement and immigration officers.
NYT: President Trump has reduced the flow of refugees into the country to a trickle, and even Iraqis and Afghans who risked their lives for American service members have been cut off.
LA Times: California’s immigrant population of 10.3 million in 2019 fell by 642,200, or 6.2%, during the first five months of the pandemic, the analysis found. That figure eclipses both the number of residents in Sacramento and the combined decrease in the nation’s other states, which saw immigrant populations decline by 531,000, or 1.5%, during the same March-through-July period.

Wow, talk about fraud, waste, and abuse! Not only do DHS’s illegal, misdirected, politically-motivated “enforcement” efforts cost taxpayers big bucks, their racism-driven suppression of legal immigration actually reduces job opportunities for Americans!
While the particular illegal detentions on behalf of ICE resulting in the $14 million payout by LA County occurred under the Obama Administration, it’s no secret that Trump’s ICE has “doubled down” on efforts to coerce localities into complying with such “illegal detainers” NOT issued by “neutral and detached magistrates.” Obviously, an independent Article I Immigration Court with “neutral and detached” judges could be authorized to issue detainers where legally appropriate and justified, thus solving the problems in a way that actually complies with the Constitution and common sense.
DHS, a morass of seedy political corruption and gross mismanagement, is now engaged in a full-bore effort to aid Trump’s re-election in derogation of law and of real duties that might protect us all. In particular, they have done a poor job of messaging on the coronavirus threat. They have also separated families and endangered the lives of non-criminal “prisoners” unnecessarily jailed in unsafe conditions in their “New American Gulag.”
It’s a “rogue agency” that needs to be “reorganized, reformed, and repurposed” by a future Administration. In it’s current form, DHS is actually a threat to our national security and welfare, as it continues, under “illegal leadership” to operate as essentially “Trump’s Internal Security Police.”

A federal judge in Maryland has granted an undocumented Indonesian immigrant temporary reprieve from deportation, ruling Friday evening that immigration authorities cannot remove him from the country until he has a chance to pursue religious asylum.
Binsar Siahaan, a 52-year-old father to two U.S. citizens, attracted considerable support from faith-based activists nationwide after he was arrested by U.S. Immigration and Customs Enforcement last month at his home on the grounds of Glenmont United Methodist Church in Silver Spring, Md. He and his wife, also an undocumented Indonesian immigrant, work there as church caretakers.
Siahaan’s attorneys, Elsy Ramos Velasquez and Patrick Taurel, had argued the arrest was made under false pretenses, without a warrant and in violation of ICE’s policy that typically prohibits agents from making arrests on church property. They also argued that Siahaan, who is Christian, should not be deported to majority-Muslim Indonesia until he has a chance to fully pursue religious asylum.
On Friday, U.S. District Judge Paul Grimm agreed, granting Siahaan a preliminary injunction that blocks ICE from removing him from the country until the Board of Immigration Appeals, or a higher federal court, makes a ruling on his pending appeal. Siahaan is being held at a detention center in Georgia, where he was transferred from Baltimore to await deportation. Grimm also ordered ICE to bring him back to Baltimore, where he will remain in custody closer to his family.
“When the ruling came down, we were really relieved,” said the Rev. Kara Scroggins, pastor at Glenmont United Methodist. “We’re glad that he’s closer to home at the detention facility in Baltimore, but we’re going to keep fighting until he’s home with his family.”
ICE could not immediately be reached for comment Saturday but previously said Siahaan was arrested “after he received full due process in the nation’s immigration courts.”

Hats off to the litigation team and to U.S. District Judge Paul Grimm! By ordering ICE to return Siahaan to Maryland, rather than detaining him in Georgia, generally known as one of the worst places in the “New American Gulag,” Judge Grimm took the kind of effective action necessary to stop the abusive actions of ICE and to guarantee real due process!
In a functioning system with an independent U.S. Immigration Court comprised of Judges with expertise in asylum and human rights laws and a commitment to due process and the rule of law, Immigration Judges could take the actions necessary to protect fundamental rights and hold ICE accountable without constant resort to the U.S. District Courts. A “captive” Immigration Court, where Immigration Judges are subservient to Billy the Bigot Barr and pressured to act as “ICE enforcement in robes” ill-serves the national interest! It’s also highly inefficient and wasteful of public resources!

A federal judge has ordered that the 2020 Census count continue until Oct. 31, blocking for now the government’s efforts to complete the survey in time to deliver apportionment data to the president by the end of the year.
The ruling late Thursday night by U.S. District Judge Lucy Koh of the Northern District of California follows a tense week in which the government appeared to try to circumvent a preliminary injunction against ending the count early.
After a surprise announcement Monday that the bureau was moving the end date by just five days, from Sept. 30 to Oct. 5, plaintiffs in the case asked Koh to provide clarification of her earlier order and other sanctions.
Rejecting the government’s argument that the request was “an attempt to radically modify the preliminary injunction,” Koh’s new ruling clarified that the end date for collection must revert to Oct. 31, as the bureau had originally planned.
It also ordered that on Friday, the government must send text messages to all Census Bureau employees notifying them of the Oct. 31 end date, and that Director Steven Dillingham must file a declaration by Monday that “unequivocally confirms Defendants’ ongoing compliance with the Injunction Order and details the steps Defendants have taken to prevent future violations of the Injunction Order.”
The suit, brought by the National Urban League and a group of counties, cities and others, said a truncated schedule would irreparably harm communities that might be undercounted.
On Friday, Kristen Clarke, president and executive director of the Lawyers’ Committee for Civil Rights Under Law, which is arguing the case, said, “Once again, the court has stopped the administration in its tracks.”Noting that some states with significant minority populations still face an undercount, she added, “Much work remains to be done to achieve an accurate census count that satisfies constitutional standards.”
The Justice and Commerce departments did not respond to requests for comment.
The government had appealed Koh’s Sep. 24 injunction to the U.S. Court of Appeals for the 9th Circuit, which denied the appeal Tuesday.
Nevertheless, Koh found that after her injunction, the government continued to tell employees to wind down operations by Sept. 30, and the Census Bureau’s website, “which is updated daily,” continued for four days after her injunction to say that data collection would end that day.

So, when is Judge Koh going to jail Wilber Ross, his census toadies, Billy the Bigot, and the DOJ lawyers who continue to defend clearly lawless, dishonest, and contemptuous actions in court? In fact, McConnell’s actions are totally in keeping with the opportunism with which he has led the Senate. Given a chance, he will always abuse his power. Branding McConnell a hypocrite misses the point. Hypocrisy — coupled with an utter lack of shame — is not a character fault in his eyes. It is a management style, a means to an end.

And would we have expected anything different from Sen. Lindsey O. Graham (R-S.C.), the shape-shifting chairman of the Judiciary Committee?
Back in the days when he pretended to care about something more than sucking up to power, Graham used to say Republicans would have to live with what they had done to Obama’s 2016 nominee, Merrick Garland. In October 2018, shortly before taking the gavel of the committee that will consider Trump’s nomination, Graham promised: “If an opening comes in the last year of President Trump’s term, and the primary process has started, we’ll wait till the next election.”
Now — surprise! — Graham has promised, via Twitter: “I will support President @realDonaldTrump in any effort to move forward regarding the recent vacancy created by the passing of Justice Ginsburg.” His rationale, if you can dignify it by calling it that, is that Democrats did things that offended him. So it’s payback time.
Oh, and let’s consider the sanctimonious and pseudointellectual Sen. Ted Cruz (R-Tex.), whom Trump has said he would consider for future openings on the court. When running for president in early 2016, he loftily declared to NBC’s Chuck Todd: “It has been 80 years since a Supreme Court vacancy was nominated and confirmed in an election year. There is a long tradition that you don’t do this in an election year. And what this means, Chuck, is we ought to make the 2016 election a referendum on the Supreme Court.”
What Cruz said wasn’t true, as is so often the case. There had indeed been instances of presidential nominees being confirmed during election years. In February 1988, a Democratic-led Senate voted 97-0 to put Ronald Reagan’s pick, Anthony M. Kennedy, on the court.
But this was only the beginning for Cruz. When it still appeared that Hillary Clinton would win in 2016, he also suggested that the court could get along just fine with only eight members indefinitely. Now — surprise! — Cruz is warning that having an even number of justices constitutes a “grave danger.”

It’s clearly “the last stand” for American democracy and human decency as we envision it (but also a great opportunity to make America better by voting for Biden/Harris)!
President Trump promised in 2016 that he would protect the Constitution’s “Article I, Article II, Article XII.” (There is no Article XII.) Instead, he has shown how fragile the constitutional order can be when a president does not respect the rule of law. He has not grown into the office; instead, he has learned how to more effectively abuse its powers. The damage of a second term might be irreparable.
Our Democracy in Peril
Part seven of a series of editorials on the damage President Trump has caused — and the danger he would pose in a second term.
A president’s core responsibility is to use the awesome power of his office fairly and with neutrality. Mr. Trump has shown that he has a different understanding: The law is a weapon with which to reward loyalists, punish enemies and frighten everyone else to fall in line.
His distortion of the criminal justice system began within months of his inauguration. When FBI Director James B. Comey tried to explain the proper relationship between the president and the FBI, Mr. Trump demanded loyalty and asked the FBI director to go easy on his former national security adviser Michael Flynn. Mr. Comey declined to promise the former or do the latter, and the president fired him.
The tumult that Mr. Comey’s dismissal elicited might have taught a lesson to a more sensible person: There is substance and expectation behind the presidential oath’s pledge to faithfully execute the laws. Mr. Trump did not learn that lesson. His pick for attorney general, Jeff Sessions, properly recused himself from the federal investigation into Russia’s attack on the 2016 U.S. presidential election — and any coordination with the Trump campaign — leading to the appointment of special counsel Robert S. Mueller III. So Mr. Trump viciously attacked Mr. Sessions, and then fired him, too.
In part because the president’s staff more effectively restrained him back then, the special counsel was allowed to complete his investigation relatively unhindered. But Mr. Trump had no patience for standard Justice Department procedure — recusal when conflicts of interests may exist, special care to avoid even the appearance of impropriety. He reportedly complained that he needed a “Roy Cohn” at the Justice Department — that is, an aggressive protector of his personal interests. So, after firing Mr. Sessions, he hired an attorney general with no apparent concern about the appearance or reality of impropriety, William P. Barr.
Whether out of ideological fervor or fear of Mr. Trump’s wrath, Mr. Barr has aided the president’s friends, hurt his enemies and vociferously attacked anyone who has found these actions untoward. Mr. Barr sicced handpicked prosecutors on the Russia probe, despite independent investigations concluding it was warranted. Then Mr. Barr intervened to lessen the charging recommendation for Trump friend and convicted felon Roger Stone. Mr. Barr also ordered charges against Mr. Flynn, the admitted felon whom Mr. Trump had asked Mr. Comey to help, to be dropped. Yet another Justice Department official, FBI General Counsel Dana Boente, was fired after he opposed cooperating with the plot to clear Mr. Flynn.
Mr. Trump waited until after Senate Republicans voted to dismiss articles of impeachment in February to do more of his own dirty work. His White House already had issued illegal orders to prevent current or former executive branch officers from turning over documents or giving testimony to Congress, betting correctly that lawmakers would not be able to litigate the issue in time for the information they sought to matter. Free of the threat of removal, he committed revenge firings of impeachment witnesses who had only done their jobs and followed the law, including patriots such as Army Lt. Col. Alexander S. Vindman — and, for good measure, Mr. Vindman’s brother, who had nothing to do with impeachment.
Mr. Trump fired intelligence community inspector general Michael Atkinson for forwarding to Congress a whistleblower complaint that had implicated the president in his scheme to use public funds to extract political help from a foreign government. The message was clear: The lawful performance of one’s duties is secondary to protecting the president.
Mr. Trump commuted Mr. Stone’s sentence so that his friend would not have to serve one day, mocking the notion of equal justice before the law. He fired the inspector general tapped to monitor the administration’s coronavirus response programs, for reasons that are unclear, beyond his aversion to authentic oversight. The White House has inquisitors dedicated to rooting out federal staff who are insufficiently loyal to Mr. Trump, and they appear to be planning a broader purge after the November election.
Because the courts move slowly, the president discovered that he can sustain even the most egregious stonewalling and violations for years. The remaining checks would be Congress, but Republicans have almost uniformly chosen subservience to Mr. ‘Trump over fealty to the Constitution, and the executive branch, but Mr. Trump has sought to fire or cow anyone who would stand in the way of his lawlessness.
Last month brought two bright warning signs that the president feels ever-less inhibited. The Government Accountability Office found that Chad Wolf’s appointment as acting director of the Department of Homeland Security is illegal, yet Mr. Wolf is still there, overseeing a department that assisted in Mr. Trump’s alarming overreaction to protesters in Portland, Ore. Mr. Trump then used the White House for his Republican National Convention acceptance speech, which almost certainly resulted in violations of a law that prohibits federal resources from being used for political purposes. The New York Times reported that Mr. Trump “relished the fact that no one could do anything to stop him.”
Americans have long been taught that the U.S. political system has effective checks and balances. But in the past years, a frightening truth has emerged. Much of that balance has depended on the good character of the president, and there are surprisingly few ways to check a malign president from abusing the enormous powers of his office. Mr. Trump is committed to using those powers for his own personal ends, and he has slowly but surely chipped away at any limitations. How many would remain after four more years?

One reason it’s taken some folks so long to raise the alarm is because they lack understanding of our immigration and human rights laws and their foundational relationship to our democracy. Those of us who do, sounded the alarm early on!
The lack of progressive immigration and human rights expertise and influence across all three branches of our Government and in much of the media has been a major factor in the rapid deterioration of our democracy. The progressive talent is out there in abundance; it’s just in the wrong place, outside of the power structure.
While I agree with the Post’s “bottom line,” I disagree somewhat with the analysis of why our Judicial System has failed so miserably when we most needed it. It’s not just an institutional weakness of “slowness;” it’s a defect in the qualifications, ideology, and character of too many GOP-appointed Federal Judges including the majority of our Supremes.
Yes, the wheels of justice can grind slowly. But, there is no institutional bar to integrity, creative emergency responses, or putting ideology aside to “do the right thing” for the rule of law and for human decency and human dignity. It’s happened before; but not this time around, with our nation in peril.
We saw an early example of the lack of legal and moral leadership on our highest Court with the invidious and blatantly unconstitutional and outright fraudulent “Muslim Ban.”
The lower Federal Courts reacted immediately with proper urgency to “just say no” to this invidious, unconstitutional, dishonest political gimmick. Because their answer clearly was correct, the Supremes had only to reinforce that message to the regime — that Trump would be required to operate within the law and to conduct himself with professionalism, honesty, and the same modicum of human decency exhibited by all other Presidents. This should have been “a piece of cake” and a golden moment for the Court to assert its independence and reinforce human decency regardless of ideology.
Rather than upholding and reinforcing this courageous and timely conduct by their subordinate jurists, the Supremes improperly and incorrectly undermined them. Then, after unnecessary delay, they let the Trump bigot/scofflaws/liars off the hook. The rout of honesty, human dignity, and our Constitution was on!
Since then, the Roberts Court has engaged in a “pattern or practice” of improper intervention to disable timely actions by the lower courts and thereby aid the White Nationalist regime’s illegal, racism-driven actions and unethical legal tactics. Nowhere has that been worse than in the gross and deadly erosion of immigrants’ rights and human rights. Real human beings continue to suffer grotesque degradations and die because some Justices wouldn’t do their jobs!
Roberts & Co. should spend some time suffering with their fellow humans in the squalid camps in Mexico they helped create; in dangerous and disgusting DHS detention that falls below standards we would inflict on convicted felons; in “baby jails;” on flights returning refugees to danger after not even taking the time to fairly listen and evaluate their claims; in “safe” third countries that are actually functionally war zones without functioning legal systems, let alone asylum systems, where corrupt regimes have neither the interest nor the ability to protect those being persecuted; or in our “Modern Star Chambers” known as “Immigration Courts” where maliciously incompetent management and a systemic contempt for due process actually threatens the lives of not only migrants, but also lawyers on both sides, the “judges,” and “court” staff.
Too many “righty judges” exist outside the reality of the daily human misery inflicted on others by their intransigence and warped anti-humanity ideology! Even some so-called“liberal” judges too often live in an “intellectual bubble” far removed from the unending ugliness and human despair daily unfolding at the “retail level of our justice system” — known as Immigration “Courts” that these days are nothing remotely resembling actual “courts.”
Those rights of the most vulnerable among us being ground into mush are all of our rights to equal justice and fundamental fairness under law. The failure to stand up for equal justice under law and social justice for all is currently ripping our nation apart and fueling a resurgence of Jim Crow racism.
Life tenure insures that our judiciary will only change over time. But, more anti-democracy, right wing jurists on our Federal Bench will exponentially decrease our chances of saving our republic. And, we can be sure that the Trump/Mitch pick to replace Justice Ruth Bader Ginsburg will push American Justice to the precipice.
We need fundamental changes in what type of persons with what type of values control and comprise all three Branches of our Government. Wemust start now, before it is too late. No system will stand up to the actions of individuals who don’t believe in its fundamental Constitutional guarantees of due process, fundamental fairness, and equal justice for all persons under law!
It’s also long past time for future Democratic Administrations aggressively to embrace and elevate the pool of tremendous legal expertise, administrative talent, moral and intellectual courage, and proven problem solving ability now out there in the private, academic, and NGO human rights and immigrants’ rights community!
These are the “anti-Stephen-Millers,” “anti Billy-the-Bigots,” and “anti-Wolfmans,” who would strive to make our Constitutional promises finally come alive for all Americans, insure equality for all before the law, and make our nation a better place for everyone, not just the privileged and powerful. Government utilizing the skills of smart, practical, humane problem solvers would also be much more efficient in spending our tax dollars than the current Government of bigots and incompetents driven by extreme bias, an exclusive vision, and highly counterproductive ideologies!
This Fall, vote like your life and the future of our Constitutional republic depend on it. Because they most certainly do!
