My favorite quote is from John Washington’s article, #3 on Austin’s list:

In fiscal year 2023, 99.5 percent of all people whose asylum cases were decided by immigration judges showed up to court for their hearings, according to data compiled by Human Rights First. Unlike citizens, people seeking asylum are not entitled to attorneys at government expense. That means that people either pay out of pocket, find willing attorneys to help them pro-bono, or represent themselves in court. According to a January report, only 30% of people in removal proceedings — which means the government is trying to deport them — are represented by attorneys. A 2023 study from Migration Policy Institute shows that having representation improves efficiency, lowers the costs of public resources expended and, for the migrants in court, decreases their chances of being deported.

“The immigration system has been pretty broken— backlogged and needing reform — for 20 years,” [Yael] Schacher [Director of Americas and Europe for Refugees International] said.

Though there are major delays, the overwhelming majority of asylum-seekers follow the system as it is currently functioning, Schacher said.

Not only does this cogently refute the restrictionist myth of asylum seekers “gaming” the system, peddled by politicos of both parties yet primarily a GOP talking point, but it points to what should be the real target of reform! Obviously, what’s actually needed here is professionalization, quality control, innovation, increased staffing, and, perhaps most of all, dynamic, expert, due-process focused leadership in the USG’s asylum adjudication and resettlement programs, with a focus on dramatically increasing representation and orientation resources!

Instead, politicos and pundits focus on eliminating the system, rather than fixing it! It’s basically a cowardly attempt to “destroy evidence” of USG misfeasance and incompetence! At the same time, it would unfairly punish the victims of our Government’s systemic failures.

The political response by both parties is totally irresponsible (not to mention immoral) as well as demonstrably unworkable. Yet, so-called “mainstream media” figures are so ill-informed and disinterested in the human trauma and realities of asylum, migration, and the border, that they present the one-sided, nativist nonsense spouted by both parties as a “debate.” It isn’t! Neither party is interested in actually fixing the problems at the border — just in finger-pointing, posturing, and shifting blame for perceived political gain!

Senate Funding Deal Places the Lives of Immigrants Seeking Safety at Risk

Washington, D.C. (February 5, 2024) – Yesterday, Senate negotiators released language for the supplemental funding bill that would dramatically alter the U.S. asylum system in exchange for foreign aid and humanitarian assistance.

Ayuda joins immigrant communities and advocacy organizations across the country in strongly condemning this proposal that would lead to more families separated, children detained, and asylum seekers sent back to face persecution and even death.

Amongst many of the draconian changes proposed, this legislation would create a new authority, with narrow exceptions, that would allow officials to summarily expel asylum seekers. It would also restrict screening standards for asylum seekers and expedite asylum claims to the extent that many will not be able to access counsel or adequately represent themselves.

Ayuda and our partner organizations believe there are far more effective solutions to immigration policy failures. We call on the Senate to reject this framework, disentangle humanitarian assistance from changes that would eviscerate U.S. asylum law, and recommit themselves to building compassionate and humane immigration system.

Immigration Bill Flops Just Hours After Released

A proposed immigration bill released to the public by a Senate committee on Sunday has already been declared “dead on arrival”.

The Senate finally released the full text of its long-awaited bipartisan immigration bill on Sunday evening.

If passed, the bill would:

  • fund military support for Ukraine and Israel while defunding UNRWA
  • establish new emergency powers that would allow the president to shut down the border
  • create a higher threshold for credible fear interviews and new asylum pathways at the US-Mexico border
  • provide a pathway to green cards for Afghan refugees in the United States
  • expands electronic monitoring and immigrant detention
  • and make a range of other changes to the immigration system—some good for migrants, some bad

It also provides more funding to immigration agencies, including:

  • $440M for IJs
  • $12M to combat smuggling
  • $7B to CBP
  • $8B to ICE
  • $4B to USCIS

I read the bill tonight twice. I am still thinking through not simply the text of the bill, but what the bill represents as a vision for immigration change. What are the values that this bill represents? How would these provisions be implemented in practice? How would we measure the effects of these various changes?

But don’t feel like you need to get too into the weeds here. The likelihood that the bill will live through the night is looking slim as people from across the political spectrum fight over pillows to smother the bill in its sleep tonight.

Prominent conservatives are already up in arms over the fact that the emergency border powers don’t kick in until several thousand encounters per day. They read the text as saying that anything less than 5,000 is, therefore, “acceptable”.

Most of these talking points align closely to Donald Trump’s goal of preventing the bill from moving forward (even though is captures many classic Republican immigration goals and very few of Democrats’) so that he can run on the “immigration crisis” in the next election.

House Speaker Mike Johnson said on a certain website that Shall Not Be Named:

I’ve seen enough. This bill is even worse than we expected, and won’t come close to ending the border catastrophe the President has created. As the lead Democrat negotiator proclaimed: Under this legislation, “the border never closes.” If this bill reaches the House, it will be dead on arrival.

Prominent progressives have also rejected the viability of the bill on grounds that it eviscerates asylum. Las Americas, an immigrant rights advocacy group in El Paso, Texas, released a statement tonight that included the following bleak assessment:

“Closing the border, creating a new ‘metering’ system, and debilitating our asylum laws will do nothing to address the underlying issues that force vulnerable children and families to flee their homes, seeking safety and a better life. Although the bill contains small silver linings, they come at too high a cost. This deal will ultimately subject more families to an unsafe migratory journey. They will be forced to wait on the other side of the border for days or even weeks, which will further expose them to those who will prey upon them as they try to navigate these impossible policies.

I’ve looked for supporters and so far, the only one I can find, are the folks at the Niskanen Center who released a statement tonight praising bipartisan efforts:

We applaud the bipartisan group of Senators who have invested weeks of hard work to negotiate a border security compromise. Despite facing opposition and resistance from their parties and leaders, Senators Chris Murphy, James Lankford, and Kyrsten Sinema have continued to work towards a solution palatable to Members on both sides of the aisle while ensuring that Congress can ultimately unlock much-needed supplemental funding to aid our allies.

I’m sure we’ll see the immigration bill in the news first thing in the morning, although the coverage is likely to be mostly negative.

My suggestion is, if you read this, you’ve probably given the bill as much attention as you need to give it for now. Don’t get too excited or upset. Spend your limited emotional energy on something else, because I don’t think this is going anywhere.

Reading* the news, it appears that many are freaking out about the “crisis” along the U.S. / Mexico border.

In fact, there is no crisis. Yes, there are logistical problems around feeding and housing migrants, and legal problems around sorting out their legal claims in immigration court.

But the numbers are the numbers: “[T]he past decade has seen unusually slow growth in immigration. In fact, the period from 2012 to 2022 saw slower growth in the immigrant share of the population than the 2000s, 1990s, 1980s and 1970s. You have to go all the way back to the 1960s, when the immigrant population actually shrank, to find a lower growth rate.” – David J. Bier, Oct. 3, 2023

America is graying. We need more immigrants, not fewer, and the younger the better. “With the national unemployment rate reaching a historic low of 3.4% in 2023—and states like Massachusetts (2.5%) and Pennsylvania (3.5%) reaching record lows—employers and elected officials have been desperate to find new workers.” – Andrew Kreighbaum, Dec. 29, 2023.

But under current law, it can take many months, if ever, for migrants to obtain work permits. Meanwhile, they are forced to work for cash, under the table, exposed to horrible working conditions, sub-market wages and the continual threat of deportation. Once they have work permits, however, they gain bargaining power.

Hein de Haas, professor of sociology at the University of Amsterdam, and the author of How Migration Really Works, says: “Fundamental choices have to be made. For example, do we want to live in a society in which more and more work – transport, construction, cleaning, care of elderly people and children, food provision – is outsourced to a new class of servants made up mainly of migrant workers? Do we want a large agricultural sector that partly relies on subsidies and is dependent on migrants for the necessary labour? The present reality shows that we cannot divorce debates about immigration from broader debates about inequality, labour, social justice and, most importantly, the kind of society we want to live in.”

Many years ago I was “on the bus” for a border journalism junket. With me was Wall Street Journal editorial writer Jason Riley. His 2008 book, Let Them In: The Case for Open Borders, is still fresh as a daisy.

Look I get it: I was lucky enough to grow up bilingual, enjoy the benefits of “higher ed,” and travel a lot, so I am not afraid of immigrants. Many Americans aren’t so lucky. Still, unless we are OK with China and India eating our economic lunch, we need to face facts and let in more immigrants, stat.

There’s plenty of empirical support for Dan’s view that we are largely creating a “crisis” while missing a golden opportunity. Indeed, while the U.S. is the world’s richest and most powerful nation, many smaller and poorer countries are able to resettle more asylum seekers, refugees, and other types of forced migrants, by both absolute numbers and proportion. What we appear to have is more of a politically-driven crisis of lack of confidence, political will, and basic competence to manage a humanitarian situation that is predictable, largely inevitable, and an opportunity to harness the human capital of migration — the same energy that actually built our nation and made it great. We’ve wasted huge amounts of money, resources, and time on cruel, failed, counterproductive enforcement gimmicks, while underfunding and failing to creatively update adjudication and resettlement functions. 

Sadly and disturbingly, politicos of both parties and the Administration are basically pledging and scheming to ignore the advice of experts and creative problem-solvers and to do an even worse job next year and into the future. They will certainly leave a scurrilous trail of fraud, waste, abuse, cruelty, futility, failure, death, and missed oportunities in their wake — if we let them get away with it!

Dan’s essay also reminds me of another recent Substack essay from immigration expert and statistical guru, Professor Austin Kocher. Austin’s theory is that backlogs in and of themselves might not be as bad as we often portray them — particularly in light of the alternatives and the intentional failures to make obvious reforms to improve the “robustness” and fairness of our immigraton system. Here’s the core of what Austin says:

First, it is worth questioning our basic assumptions about whether the “backlog”, as it is somewhat sensationally referred to, is actually a bad thing. Unlike the Obama administration, when the rapid growth of court cases was more attributable to people who lived in the U.S. for a long time getting caught up in interior enforcement, the recent growth is almost entirely due to the arrival of asylum seekers into the country. If you believe that asylum seekers deserve an opportunity to have their cases heard, then these numbers might be a positive sign. More people will have at least a nominal opportunity to apply for asylum instead of being turned away outright at the border.

Second, it remains absurd to me that the current practice in the U.S. is to force recently arrived asylum seekers into court in front of an immigration judge rather than to direct their cases toward asylum officers at USCIS who are trained for precisely this purpose. Immigration courts were designed to adjudicate cases of non-citizens who are suspected of violating U.S. immigration laws. The courts are adversarial environments that, as far as I can tell, require far more taxpayer resources and migrant resources than non-adversarial asylum interviews do. The fact that there are 3 million cases in court is, to me, an indictment of a system that treats humanitarian crises through the lens of quasi-criminalization.

Third, since no real change is likely forthcoming, I think we should rethink our sensationalization of the backlog number and simply accept the growing immigration court backlog much like we accept the U.S. national debt ticker in New York City.2 It’s just going to keep going up unless something absolutely fundamental changes about the world we live in. Get over it. This is how things work now. We need to end the delusional thinking that reforms—even much-needed reforms, such as the creation of an independent court system—are going to “solve” the backlog. The U.S. immigration system either needs radically rethought or we need to simply accept that the number of pending cases will reach 4 million, 5 million, or 6 million cases in the next few years.

Lastly, if we really want to solve the backlog, the easiest way to resolve the backlog is for Congress to give everyone with an NTA (i.e., everyone with a pending court case) and who meets certain minimal criteria a special visa that regularizes their status and puts them on a path to citizenship just like other lawful permanent residents. Yes, yes—I know that not everyone will like that solution for political reasons, but at least admit that you don’t like it for political reasons, not because it wouldn’t solve the backlog (because it would). After all, the US Census Bureau is already forecasting absolute population decline in the US within our lifetimes. Three million new citizens now wouldn’t solve that problem, but it might not hurt in the long run.

I was struck by his second point. One of the positive regulatory changes made by the Biden Administration was to confer authority on USCIS Asylum Officers to grant asylum immediately, at the border or in reception centers, rather than referring all arriving asylum seekers who pass credible fear to the Immigration Courts. Nevertheless, as I among many pointed out, the Administration had neither the personnel nor the training in place to make this change effective.

I also argued that without a new BIA of expert Appellate Judges and exceptionally-well-qualified asylum expert Immigration Judges assigned to key Immigration Courts to provide dynamic leadership, de facto supervision, and a series of far better positive precedents guiding adjudicators to grant asylum in many repetitive situations, this positive change was doomed to failure.

Sure enough, the Administration botched the implementation — running inept, timid, and minute “pilot programs” that could only be termed “sad jokes.” To make matters worse, when recently faced with a humanitarian situation at the border, where a “surge” of qualified Asylum Officers working with NGOs to screen arrivals could have made a huge difference, the Administration inexplicably “suspended” this most useful part of their regulations. Meanwhile, they opted to keep more problematic provisions in effect.

To compound the problem, nativist GOP State AGs mounted frivolous court challenges to the expanded role of Asylum Officers. Stripped of its legal gobbledygook, they essentially and absurdly argued that the Administration lacked authority to empower statutory Asylum Officers to grant asylum.

Many Americans today worry that our nation is losing its national identity. Yet the core of that identity is not the whiteness of our skin or our religion or our ethnicity. 

It is the ideals we share, the good we hold in common. 

That common good is a set of shared commitments. To the rule of law. To democracy. To tolerance of our differences. To equal political rights and equal opportunity. To participating in our civic life. To sacrificing for the ideals we hold in common. To upholding the truth. 

We cannot have a functioning society without these shared commitments. Without a shared sense of common good, there can be no “we” to begin with. 

If we are losing our national identity, it is because we are losing our sense of the common good. This is what must be restored.

As I’ve argued in these essays, recovering our common good depends on several things:

It depends on establishing a new ethic of leadership based on trusteeship. Leaders must be judged not by whether they score a “win” for their side, but whether they strengthen democratic institutions and increase public trust.

It depends on honoring those who have invested in the common good, and holding accountable those who have exploited it for their own selfish ends. 

It requires that we understand — and educate our children about — what we owe one another as members of the same society. Instead of focusing solely on the rights of citizenship, we need also to focus on the duties of citizenship. 

And it requires a renewed commitment to truth.

Some of you may feel such a quest to be hopeless. The era we are living in offers too many illustrations of greed, narcissism, brutality, and hatefulness.

I, however, firmly believe this quest is not hopeless. 

Almost every day, I witness or hear of the compassion and generosity of ordinary Americans. Their actions rarely make headlines, but they constitute much of our daily life together. 

The challenge is to turn all this into a new public spiritedness extending to the highest reaches in the land — a public morality that strengthens our democracy, makes our economy work for everyone, and revives trust in the major institutions of the nation.

The moral fiber of our society has been weakened but it has not been destroyed. 

We can recover the rule of law and preserve our democratic institutions by taking a more active role in politics. 

We can fight against all forms of bigotry. We can strengthen the bonds that connect us to one another by reaching out to one another. We can help resurrect civility by acting more civilly toward those with whom we disagree. 

We can protect the truth by using facts and logic to combat lies. 

We can help restore the common good by striving for it and showing others it’s worth the effort. 

We have never been a perfect union. Our finest moments have been when we sought to live up to our shared ideals. 

I worked for Robert F. Kennedy a half-century ago when the common good was better understood. Resurrecting it may take another half-century, or more. 

But as the theologian Reinhold Niebuhr once said, “Nothing that is worth doing can be achieved in our lifetime; therefore we must be saved by hope. Nothing which is true or beautiful or good makes complete sense in any immediate context of history.”

COMMUNITY OUTREACH IN MAINE

Despite the uncertainty, resettlement agencies in Maine are pushing ahead, preparing to welcome as many refugees as possible. To increase their chances of finding affordable apartments, they’re building a network of landlords willing to rent to newcomers and expanding resettlement efforts beyond Greater Portland, Lewiston-Auburn and Augusta-Waterville to Bangor and Brunswick, Ouattara said.

“We can settle people within 100 miles of Lewiston-Auburn,” said Rilwan Osman, executive director of Maine Immigrant & Refugee Services in Lewiston. “We have settled some families in Augusta, and we are exploring other communities.”

The State Refugee Advisory Council held four quarterly meetings last year to connect and support various community representatives in government, public safety, schools, social services and health care, Ouattara said.

“There are resources that are available from the federal government to assist communities that accept refugees,” he said.

At least half of the new arrivals last year had family ties in Maine, Ouattara said, while the other half were “free cases” that could be resettled more widely in the state but would require more support from agency staff. Transportation continues to be a challenge for many newcomers.

“The public transit system in Maine is still in development, so that can be isolating in some communities,” he said.

Helping refugees find jobs is a top priority for resettlement agencies, which provide financial assistance and case management support for up to 90 days after arrival and limited case management and employment services for up to 60 months.

“All the refugees that are coming have permission to work as soon as they are able,” Osman said. “Some have English skills, some don’t. If they have the necessary language skills, they can at least start entry-level work within 90 days.”

One refugee who is eager to get to work is Ahmed, a recent arrival from Somalia who also declined to give his last name. Ahmed, 58, attended a cultural orientation session Wednesday at the JCA. Through an interpreter, Ahmed said he has been reunited with his wife and six children after being separated from them for 21 years.

He also said he wants to be a good citizen and a taxpayer.

“I’m so grateful to be here,” he said. “My dream is to settle in and get work at a job in my skill range. I am a welder and I would like to work in the same industry.”

“America is a beautiful country and has a lot to offer the world and the people who come here, and so does Portland,” said Ali, who came to the United States from Ghana more than two decades ago.

Portland’s five mayoral candidates may be more aligned on this issue than any other. They all fundamentally see asylum seekers as an asset to the city, and they all want to see the wait time before they can work made much shorter. They all also feel a little bit helpless.

For years, Portland has welcomed these immigrants, who often undertake dangerous journeys to get here and then go through an arduous, sometimes yearslong process to get visas and work authorization.

Zarro said that if it should turn out to be too big a legal risk to offer asylum seekers paid work before they got federal work authorization, he would like to build a more robust job training program so they would be ready to start work in local businesses as soon as their work authorization comes though.

“We have people who are coming here to better their lives and to better their communities. Maine stands to benefit significantly,” he said.

All the candidates also are keenly aware that Portland is in need of more young workers.

“We’re an aging state without enough people to fill the workforce,” Costa said.

Geographers have begun to explore the concept of ‘immigrant welcome’ as a framework for understanding the tension between spontaneous social support for immigrants and refugees and their subsequent restriction and criminalization by states. Overlooked in the emerging discourse on immigrant welcome is the rich literature in feminist geography that views the everyday practices of endurance, care and social reproduction as essential to, but often hidden within, more traditional, political and economic analyses of power. By focusing on the everyday practices of welcome within sanctuary church activism, I argue for more attention to the energy-intense work that is often excluded from official media and academic accounts, yet which is essential to understanding what makes welcome function or fail. I draw upon one in-depth case study of a sanctuary church in Ohio, where a woman has been living for a year and a half in public defiance of her deportation order. In addition to contextualizing this specific case within the broader policy and immigrant rights landscape, I focus on the spatial, material and relational processes that participants implemented to construct a ‘welcoming’ environment as well as observe the ways in which welcome fails to live up to its imagined potential. The case study provides important grounded insights into the material, relational and emotional processes of enduring sanctuary as a form of resistance to the US deportation regime and enduring sanctuary itself as an intensive socio-spatial form of existence.

If someone NOT Merrick “What Me Worry” Garland (the “Alfred E. Neumann of Biden’s immigration bureaucracy”) took a look at the data, one major thing would jump out! There are likely more than 400,000 refugees entitled to asylum sitting in Garland’s 770,000 case asylum backlog (52% x 770,000). (The asylum backlog at EOIR is a “subset” of Garland’s largely self-inflicted, ever mushrooming, nearly 2 million case EOIR backlog — more judges have produced more backlog, so that’s likely NOT the answer here). 

And, this is in a system currently governed by skewed anti-asylum BIA “precedents” and a chronic “anti-asylum culture” actively encouraged and fed by the Trump Administration. In a properly staffed and functioning court system with qualified, due-process oriented, judges and an expert BIA that enforced some decisional consistency and properly and generously interpreted asylum law, a “grant rate” of 75% or more would be a plausible expectation.

Given the obvious (and I would argue intentional) lack of reliable data on how a legitimate asylum system, one consisting at all levels of judges with well-recognized expertise in asylum law and human rights, and overseen by competent, due-process-oriented judicial administrators, might function, the 75% figure is just an “educated guesstimate.” But, it matches my own personal experience over 13 years on the bench in the (now defunct) Arlington Immigration Court. 

It’s also in line with my recent conversations with the head of one of the largest NGOs in the DMV area involved in meeting busses and counseling those “orbited” from the Southern border by the racist/nativist GOP Govs that Biden, curiously, has chosen to run our domestic refugee resettlement program. This is a person who, unlike Garland, his lieutenants, and most of the other politicos and nativist blowhards participating in the “border travesty,” actually spent years of a career representing individuals in Immigration Court. They estimated that “at least 70%” of the “arriving bus riders” had very viable asylum claims. 

This is a far cry from the nativist, restrictionist myths promoted by both the Trump and Biden Administrations — obviously to cover up their gross human rights violations in knowingly and illegally returning hundreds of thousands of legal refugees to danger zones! Many human rights experts would consider such gross misconduct to be “crimes against humanity.” Consequently, it doesn’t take much imagination to see why self-interested scofflaw officials like Garland, Mayorkas, and White House advisors seek to manipulate the system to keep the asylum grant rates artificially low while eschewing proper, realistically robust use of the overseas refugee program to take the pressure off the border — by acting legally rather than illegally! 

Almost all the EOIR asylum backlog consists of “regular docket” (I use this term lightly with EOIR where “normalcy” is unknown) cases. Those are refugees who have had time to get lawyers, adequately prepare, document their cases, but are stuck in Garland’s chronically dysfunctional system. Consequently, they are “denied by delay” legal immigration status, a chance to get green cards, and to eventually qualify for citizenship. The American economy is denied an important source of legal workers who should be part of our permanent workforce and well on their way to full participation in our political system and society!  

An expert looking at this system would see a “golden opportunity” to move most of the backlogged “easily grantable” asylum cases out of the system with stipulated grants or short hearings (the kind you actually might be able to do 3-4 a day without stepping on anyone’s due-process rights or driving the private bar nuts). These cases would also avoid the BIA’s appellate backlog, as well as eliminating unnecessary workload in the U.S. Circuit Courts (which already have their own inconsistency, rubber stamp, and bias issues in the human rights/racial justice area that seem to be getting worse, not better).

Knocking 400,000+ cases off the backlog wouldn’t completely solve Garland’s 2 million case backlog problem — only a complete “house cleaning” at EOIR, replacing many of the current bureaucrats with competent leaders and expert Immigration Judges well-versed in asylum law, will do that. But, cutting EOIR’s backlog by 20% (and the asylum backlog by over 50%) without stomping on anyone’s rights, while bolstering much-needed legal immigration, and harnessing the strengths of the private/pro bono bar, is nothing to “sneeze at!” That’s particularly true in comparison with Garland’s two years of mindless “designed to fail” gimmicks and astounding mismanagement, which have produced exactly the opposite results!

How bad has Garland’s leadership been at on human rights, due process, and racial justice at DOJ. A number of seasoned asylum practitioners have told me that today’s EOIR, also suffering from a tidal wave of Garland’s  “Aimless Docket Reshuffling” — is actually significantly worse than it was under Trump! That’s right, Garland’s tone-deaf incompetence has exceeded the disorder and systemic unfairness caused by overt xenophobia, anti-asylum bias, misogyny, “dumbing down,” and enforcement-biased “weaponization” of the Sessions/Barr years. 

As for Dr. Kocher’s cogent observation that input from the Immigration Judges who actually decide these cases is a “missing ingredient,” good luck with that, my friend! Perhaps understandably in light of his unseemly failures at EOIR, Garland has taken EOIR’s traditional opaqueness and “muzzling” of Immigration Judges to new heights — even barring their participation in CLE events aimed at improving the level of practice before his courts.

Apparently, “studied incompetence” in a Democratic Administration can be even worse than the “malicious incompetence” of the Trump Kakistocracy — at least where immigrants rights/human rights/racial justice/ women’s rights are concerned at EOIR. That’s an astounding observation! One that I actually never thought I’d hear from practitioners! 

The only way for human rights and racial justice experts and advocates to “communicate” with Garland in his “ivory tower” is to ‘“sue his tail” in court! Judge Sullivan’s recent opinion finding Title 42 illegal incorporates the very facts and law used by human rights experts and advocates in years of fruitless pleading and begging Garland to “cease and desist” his support for unlawful conduct and “just follow the law.” The latter seems like a modest “no-brainer” request to a guy once nominated by an Dem President for the Supremes.  

Waiting for Merrick Garland to fix the mess at EOIR to provide even a bare minimum of due process and rational administration is like waiting for the guy pictured below. Frustrated and “Garland-weary” as they might be, human rights advocates should take it to heart and act accordingly!

Waiting for Merrick Garland and his “clueless crew” at DOJ to fix the dysfunctional Immigration Courts will be an exercise in futility. He only pays attention when ordered by a Federal Judge, which, somewhat ironically, he used to be. But, he’s proven “beyond a reasonable doubt” that he is unqualified to run one of the most important and life-determining Federal Judiciaries — one where due process has been buried beneath an avalanche of expediency, incompetency, intellectual dishonesty, and dumb gimmicks. When will “enough be enough?”

Immigration court backlog has nearly doubled under Trump

The nation’s backlog of active  immigration court cases has surpassed the 1 million mark and has nearly  doubled since President Donald Trump took office, a new analysis shows.  In Ohio, 12,851 cases are pending in Cleveland’s immigration court,  which includes Columbus-area cases. That’s up from 3,295 in 2009.

While most people might look a few weeks into the future when scheduling appointments for work, Amy Bittner has put court dates on her calendar for 2022.

The Columbus-based immigration lawyer already knows she’ll have to make the 280-mile round trip to Cleveland to represent a client at a hearing in three years.

“The backlog is a victim of this administration’s priorities. There did not used to be this backlog,” Bittner said.

Nationwide, the backlog has almost doubled, from 542,411 pending cases when  President Donald Trump took office in January 2017 to just over 1  million as of Sept. 30, according to an October report by TRAC, a Syracuse Universityclearinghouse that gathers and analyzes immigration data from government agencies.

In Ohio, 12,851 cases are pending in Cleveland Immigration Court, the state’s only such court. That is up significantly from 3,295 in 2009. It’s also double the 6,184 in 2016.

Hearings are scheduled in the Cleveland court through Dec. 30, 2022.

Trump administration policies have not helped temper the rise in the country’s immigration court backlog, the TRAC report says.

Austin Kocher, a faculty fellow at TRAC and an Ohio State alumnus , said such backlogs result when “the government focuses concern on  immigrants and puts enforcement ahead of due process and civil rights.”  

“Very little resources actually go to the immigration court system and judges” compared with enforcement efforts, Kocher said.

Although the judges in northeastern Ohio stay busy, the backlog at Cleveland’s  immigration court isn’t the worst in the country. In areas such as New  York, Chicago and Philadelphia, immigrants are waiting an average of  1,450 days, or just under four years, to see a judge.

Part of the reason for the backlog, TRAC says, is that then-U.S. Attorney General Jeff Sessions in May 2018 ordered the nation’s immigration judges to end their practice of removing cases from their dockets without issuing decisions. That resulted in formerly closed cases being reopened, according to TRAC.

“The decision to reopen previously closed cases has single-handedly  exacerbated the immigration court crisis, yet it has not received  sufficient attention,” the TRAC report states. “This single policy  decision has caused a much greater increase in the court’s backlog than  have all currently pending cases from families and individuals arrested  along the southwest border seeking asylum.”

Others blamed the delays in part on one of Trump’s earliest executive orders, from January 2017, when he made every immigrant who was in the country  illegally a priority for deportation. The norm had been to prioritize  those who had committed crimes.

“It is a senseless waste of  taxpayer money to attempt to remove people who are not criminals and who are well-integrated into our community,” Bittner, the Columbus  immigration lawyer, told The Dispatch in an email.

She said U.S. Immigration and Customs Enforcement should close deportation cases involving long-term U.S. residents who are not dangerous.

The Executive Office for Immigration Review, the Department of Justicebranch that supervises the federal immigration court system, did not respond to requests by The Dispatch for comment.

The backlog has grown despite the Trump administration having given the  immigration courts “the greatest amount of resources,” said Judge Ashley Tabaddor, president of the National Association of Immigration Judges, a union.

The nation has 442 immigration judges, according to TRAC.  Although about 220 judges have been hired in the past three years, about 100 others have left, Tabaddor said. She said that many of those who  have left have expressed feeling like the Trump administration doesn’t  allow them to do their jobs properly while adding quotas and  micromanaging their work.

Each judge has about 2,000 cases, according to TRAC.

In 2016, when Cleveland’s immigration court had three judges, Bittner went to the court only twice. Now it has six judges, and she goes more than  once a month.

Hiring more judges hasn’t fixed the backlog, Bittner said.

“It is very frustrating because justice delayed is justice denied, and  while foreign nationals wait years for the adjudication of their cases,  they are putting down roots here and having families, which makes  removal from the United States even crueler if their case is ultimately denied,” Bittner wrote in the email.

She said some of her clients  are grateful for the wait because they have more time to build a life  here. Others, however, are frustrated, Bittner said, because they feel  that they are constantly in limbo, and once they’ve built a life, it  could all come crashing down when their day in court finally arrives.

A few of her clients who had waited years to make their asylum case in the U.S. court left for Canada instead, hoping things would go more smoothly up north.

“It just seems to be getting worse,” Bittner said.

Actually, this article significantly understates the true scope of the backlog. Because, as noted in the article, in Castro-Tum, Sessions unethically, mindlessly, and unlawfully created a situation that, if not halted by the Congress or the Appellate Courts (note the 4th Circuit Court of Appeals has “just said no” to Session’s bogus ruling), will require that over 300,000 low priority, properly “administratively closed” cases be restored to the docket. They vast majority of these are (absurdly) themselves backlogged, “awaiting re-docketing” (more than a clerical process in the antiquated, non-automated, paper heavy Immigration Courts). That makes the total backlog well over 1.4 million and still growing every day.” “Aimless Docket Reshuffling” at its worst!

And, because of the almost guaranteed legal and quality control problems with the Regime’s “cutting corners to deny due process” approach, many of these will end up in the Circuit Courts of Appeals in a condition that requires “return to sender.”

It doesn’t take a legal scholar or much of a judge to recognize that today’s Immigration “Courts” being run by biased, maliciously incompetent DOJ prosecutors don’t satisfy the basic requirement for “fair and impartial adjudications” to conform to Fifth Amendment Due Process. Moreover, the incompetent, “bad faith” mis-management of the Immigration Courts basically “throws garbage” into the higher courts and precludes effective, timely judicial review.

The solution: recognize that this travesty is unconstitutional and require a court-approved “special master” to run the Immigration Courts in place of the DOJ until Congress fixes the glaring Due Process and court management problems with an independent Article I U.S. Immigration Court as recommended by almost all experts!

We also must remember the DOJ’s & EOIR’s concerted White Nationalist attacks on foreign nationals and their legal and Due Process rights in the Immigration Courts is also a vicious, unprovoked assault on the courageous attorneys representing the most vulnerable among us and trying, against the odds, to make the system function for everyone’s good. By failing to aid and support “officers of the court” in this dire situation, the Federal Judiciary basically undermines our entire justice system and brings it into disrepute!
