“Bill Barr’s Christmas Resignation” is one of the worst pieces of holiday content I have ever consumed! A letdown on every level. First, the title is not a pun. Second, the ending comes out of nowhere.

This story of a deceptively affable-seeming attorney general and how he decides to leave the Trump administration for good to spend the holidays with his family at first seems like it’s going to be standard Christmas fare. A 70-year-old man overly devoted to his occupation who feels no guilt about any of his past deeds and seems deficient in sympathy for his fellow man — what could possibly be a more classic Christmas movie setup? That is why what followed was so disappointing and jarring.

We open with Bill in his office, merrily redacting away at some document that probably should not have been redacted. He is visited by a malicious-looking elf who has messages for him. (Correction: I totally misread what was going on; this was actually senior presidential adviser Jared Kushner. I regret the error.)

We see a picture on Bill’s desk of his boss, Donald Trump, and he keeps going on and on about how excited he is to enact Donald Trump’s agenda. We also learn about all the executions he has scheduled after reinstating the death penalty for federal crimes. This seems incredibly brutal and dark but does establish a character who is going to grow a lot and learn he needs to change his ways.

He leaves the office and drives home past several signs expressing negative sentiments about Donald Trump. He passes Lafayette Square and remembers giving the go-ahead to fire pepper balls at peaceful protesters. He smiles his affable smile. Lights reflect off the window of his secure vehicle. A holiday song plays.

At this point you, the viewer, glance at your watch. This has been a lot of setup, you think. But it’s called “Bill Barr’s Christmas Resignation”! It ends with him leaving his job as the head of the Justice Department to be with his family. He wouldn’t just do that randomly, would he? There’s got to be an inciting incident of some kind. Perhaps when the clock strikes midnight he will be switched with his secret twin and forced to replicate the White House in fondant for a baking contest. Maybe he will get a call from the head of what claims to be a little-known European country — a perfect call, asking him to spend his holiday season there.

He arrives home and flicks on the TV, where he can see several sinister cronies of Donald Trump (whom he has personally allowed to avoid the consequences of their actions) roaming freely around the city inciting mobs of Proud Boys and even urging their followers to call for martial law. And then he goes to bed and — sleeps peacefully, on a MyPillow.

At this point a commercial for MyPillow came on — the whole thing was sponsored by MyPillow — and I quickly checked to make sure I was watching the right thing, because we were halfway through “Bill Barr’s Christmas Resignation” and he was still going about his life like he didn’t think he’d done anything wrong or needed to change his ways at all. He hadn’t even been assigned to a project he didn’t want to work on with a co-worker who loved Christmas a little too much.

After the commercial, we see Bill is having a dream. It seemed as though this would be when things turned around. In the dream, he walks through a populous city. He sees Want and Ignorance and gives them a thumbs-up. He sees his own tombstone with “Servant of Donald Trump” on it and smiles cheerily at it. He sees a little girl lighting match after match to keep herself warm and — adds the city to his list of Anarchist Jurisdictions.

Lawsuit Seeks to Uncover Secretive Expansion of Judicial Black Sites for Immigration Cases

WASHINGTON, DC — Immigration groups filed a lawsuit today in the United States District Court for the District of Columbia against the Executive Office for Immigration Review (EOIR)—which oversees immigration courts—and the General Services Administration (GSA) requesting information on the expansion and creation of immigration adjudication centers, which were established as part of EOIR’s Strategic Caseload Reduction plan designed to accelerate removal proceedings at the expense of due process.

The lawsuit—filed by the American Immigration Council, American Immigration Lawyers Association, the Chicago AILA Chapter, and the National Immigrant Justice Center— seeks the disclosure of records on the obscure procedural rules for immigration adjudication centers. The centers are a new initiative created under the Trump administration where immigration judges adjudicate immigration cases from around the country in remote-only settings that are closed to the public.

Immigration adjudication centers appear to have been created to address immigration court backlogs, but attorneys and immigrants facing deportation have little instruction on the procedures for appearing before these centers. Immigration lawyers and advocates have expressed concerns after public reports indicate the potential expansion of immigration adjudication centers across the country.

The lawsuit challenges EOIR’s failure to disclose information in response to a Freedom of Information Act request submitted in March 2020. EOIR and GSA have failed to disclose critical information about what immigration courts presently exist, immigration court expansion, and contracts governing this expansion.

“Immigration lawyers and advocates have an interest in pressing for more transparency in the immigration courts, helping ensure the due process rights of all who appear in court, and providing guidance to the lawyers representing people before these courts,” said Claudia Valenzuela, FOIA senior attorney at the American Immigration Council.

“Transparency is essential to a fair day in court. Unfortunately, the secretive creation and expansion of immigration adjudication centers where immigration judges conduct remote-only proceedings in facilities closed to the public demonstrate how opaque an already complex immigration court system has become at the hands of this administration. While the Department of Justice regulations require immigration hearings to generally be open to the public, this administration has imposed significant new barriers to the public’s ability to observe these proceedings and has led to some hearings being conducted in secret, calling into question whether the fundamental elements of due process are being met. We are proud to stand alongside our partners in this effort,” said Laura Lynch, senior policy counsel at the American Immigration Lawyers Association.

“Everyone deserves a fair day in court. The lack of transparency in EOIR operations compromises the integrity of our immigration system and undermines public confidence in this system,” said Nell Barker, chair of the American Immigration Lawyers Association’s Chicago Chapter. “The secretive expansion of immigration courts is a blow to due process and adds a layer of unnecessary unpredictability to a system that struggles to inform stakeholders about changing procedures. We are concerned about the increasing inaccessibility of immigration courtrooms to lawyers, clients, and the public.”

“The secretive and inaccessible immigration adjudication centers, where judges determine whether noncitizens will be deported to persecution and torture or permanent family separation, are a disturbing example of the manner in which this administration has developed and expanded numerous policies and procedures intended to expedite the deportation of noncitizens without due process,” said Sarah Thompson, senior litigation attorney at the National Immigrant Justice Center. “EOIR must make public its plan for future adjudication centers and the procedures under which these centers operate.”

And yet another story from the day: a third career prosecutor from the Department of Justice resigned after publicly attacking Attorney General William Barr for abusing his power to get Trump reelected. “After 36 years, I’m fleeing what was the U.S. Department of Justice,” Phillip Halpern wrote. “[T]he department’s past leaders were dedicated to the rule of law and the guiding principle that justice is blind. That is a bygone era, but it should not be forgotten.” Noting that “Barr has never actually investigated, charged or tried a case,” Halpern expressed deep concern over Barr’s “slavish obedience to Donald Trump’s will.” “This career bureaucrat seems determined to turn our democracy into an autocracy,” he warned.

Georgetown Law Professor Paul Butler, who worked as a federal prosecutor under Barr when he was George H. W. Bush’s Attorney General, told Katie Benner of the New York Times that such criticism is “unprecedented,” and reflects Trump’s pressure on the AG. “I have never seen sitting prosecutors go on the record with concerns about the attorney general,” he said.

And yet, Barr’s willingness to bend the Justice Department to Trump’s personal will may, in the end, not be enough to keep Trump’s favor. Angry that Barr did not produce a report attacking the Russia investigation before the election, Trump just yesterday said he wasn’t happy with Barr’s performance, and might not keep him on as AG if he wins a second term.

Justice Department cancels diversity training, including for immigration judges

WASHINGTON — The U.S. Justice Department has suspended all diversity and inclusion training and events for its employees, according to a memo obtained by The Chronicle, which would include judges in San Francisco and elsewhere hearing cases of immigrants seeking to avoid deportation.

The memo, dated Oct. 8, is in response to an executive order issued by President Trump last month that labeled racial bias training as “offensive and anti-American race and sex stereotyping and scapegoating.” It was issued by Lee Lofthus, the assistant attorney general for administration.

“To ensure compliance with requirements specific to Diversity and Inclusion (D&I) training for employees, DOJ Components are instructed to suspend all D&I related training, programs, activities, and events that employees are required or permitted to attend while on Government-paid time,” Lofthus wrote.

Any new diversity training must be approved by the federal Office of Personnel Management, Lofthus said. He offered no timeline for resuming training.

The suspension applies to all divisions of the Justice Department, but could be of particular importance to the immigration courts.

Unlike the independent federal judiciary, immigration judges who hear the cases of asylum seekers and others trying to stay in the U.S. are employees of the Justice Department, hired by the attorney general.

Those cases often include some of the most sensitive stories of trauma from around the world, including many from women who say they have been raped, trafficked or abused in countries that frequently do not punish men who commit such acts. Asylum seekers also include people who say they have been persecuted because of their religious beliefs and LGBTQ individuals from countries where such identities are criminalized.

The Justice Department did not immediately respond to a request for comment.

Rep. Zoe Lofgren, D-San Jose, who chairs the House Judiciary subcommittee on immigration, said the Justice Department, like other workplaces, “should always aim for more diversity, not less.”

“The suspension of this training will also apply to our nation‘s immigration courts and could lead to less inclusive and fair-minded judges,” Lofgren said in a statement to The Chronicle. “This is yet another reason why the immigration court system should be an independent body, separate from DOJ and free from the political whims of the Executive branch.”

The union that represents immigration judges noted that they interact with a diverse group of people in court, which it said makes such training important.

“The National Association of Immigration Judges values diversity and inclusion in the workplace as it ensures that the Immigration Judges can meet the needs of the diverse group of stakeholders with whom we interface.” Mimi Tsankov, the chair of the group’s committee on gender equity and a judge in New York, said in a statement. “Immigration Court workplace training on diversity and inclusion reflects a commitment to its importance and ensures a judicial bench ready to respond to the needs that our cases demand.”

President Trump’s attorneys general have paid particular attention to the immigration courts as part of their efforts to restrict immigration to the United States, by implementing policies that have reduced judges’ discretion and made it harder for immigrants to claim asylum.

Glaring, intentional lack of diversity on the bench along with racial, gender, religious, and ethnic insensitivity have become an endemic problem at EOIR. But, given a regime and a DOJ that pride themselves on racism, misogyny, xenophobia, along with disdain for professionalism, expertise, ethics, humanity, and the Constitution, that’s not surprising.

Representative Lofgren and the NAIJ’s Judge Tsankov are absolutely correct. It’s time to put an end to the disgraceful abomination at EOIR and create a real, independent court system dedicated to due process, fundamental fairness, and promoting human dignity!

A federal judge on Thursday ordered the Trump administration not to release a report by the Presidential Commission on Law Enforcement and the Administration of Justice, finding that the group ― comprised entirely of current and former members of law enforcement ― had been “far from transparent.”

Senior U.S. District Judge John Bates, a George W. Bush appointee, issued a 45-page ruling finding that commission ― which President Donald Trump announced with fanfare at a police conference last year ― had violated the Federal Advisory Committee Act (FACA), which requires that committees be “fairly balanced” in the viewpoints represented.

Attorney General William Barr said there was a need to hear from a “diversity of backgrounds and perspectives,” but the commission was full of law enforcement officials. Bates’ order requires Barr “to ensure the Commission has a fairly balanced membership.”

Last month, as HuffPost previously reported, an elected prosecutor quit one of the commission’s working groups because he worried that it was “providing cover” for a predetermined law-and-order agenda that “will only widen the divisions in our nation.”

Bates wrote that the commission’s membership “consists entirely of current and former law enforcement officials” and that no commissioner “has a criminal defense, civil rights, or community organization background.”

“Especially in 2020, when racial justice and civil rights issues involving law enforcement have erupted across the nation, one may legitimately question whether it is sound policy to have a group with little diversity of experience examine, behind closed doors, the sensitive issues facing law enforcement and the criminal justice system in America today,” he wrote.

Jim Clyburn got right to the point when asked about Attorney General William Barr’s comment on Wednesday that calls for a nationwide lockdown to stem the spread of the novel coronavirus were the “greatest intrusion on civil liberties” in US history “other than slavery.”

Speaking with CNN’s John Berman on “New Day,” the House majority whip distilled the absurdity at the heart of Barr’s words.

“I think that that statement by Mr. Barr was the most ridiculous, tone-deaf, God-awful thing I’ve ever heard,” Clyburn, longtime Black leader from South Carolina, said on Thursday. “It is incredible, as chief law enforcement officer in this country, to equate human bondage to expert advice to save lives. Slavery was not about saving lives. It was about devaluing lives.”

Or as the author Isabel Wilkerson puts it in her new book, “Caste: The Origins of Our Discontents”: “The institution of slavery was, for a quarter of a millennium, the conversion of human beings into currency, into machines who existed solely for the profit of their owners, to be worked as long as the owners desired, who had no rights over their bodies or loved ones.”

In this system, African captives “could be mortgaged, bred, won in a bet, given as wedding presents, bequeathed to heirs, sold away from spouses or children to cover an owner’s debt or to spite a rival or to settle an estate,” Wilkerson writes.

That Barr painted a few months of being told — or as it was in many cases, asked — to stay home during a global pandemic as being even remotely in the same category as the practice of enslavement is ridiculous. (To say nothing of the fact that he skipped over, among other things, Jim Crow, Japanese internment during World War II and the slaughter of Native Americans.)

But even during a summer that’s been seized by a racial reckoning, the attorney general’s comment was the furthest thing from surprising.

Attorney General William P. Barr delivered a scathing critique of his own Justice Department Wednesday night, insisting on his absolute authority to overrule career staff, whom he said too often injected themselves into politics and went “headhunting” for high profile targets.

Speaking at an event hosted by Hillsdale College, a school with deep ties to conservative politics, Barr directly addressed the criticism that has been building for months inside the department toward his heavy hand in politically sensitive cases, particularly those involving associates of President Trump.

“What exactly am I interfering with?” he asked. “Under the law, all prosecutorial power is invested in the attorney general.”

Barr’s comments were remarkable, in that the head of the Justice Department catalogued all of the ways in which he thought his agency had gone astray over the years, and in its current formulation harms the body politic. Barr has drawn considerable criticism for intervening in criminal cases in ways that help benefit the president’s friends.

Barr said it was he, not career officials, who have the ultimate authority to decide how cases should be handled, and derided less-experienced, less-senior bureaucrats who current and former prosecutors have long insisted should be left to handle their cases free from interference from political appointees.

Barr said that argument, in essence, means “the will of the most junior member of the organization” would make decisions, but he insisted he would not “blindly” defer to “whatever those subordinates want to do.”

“Letting the most junior members set the agenda might be a good philosophy for a Montessori preschool, but it is no way to run a federal agency,” Barr said.

The attorney general, the nation’s top law enforcement official, spent much of the speech eviscerating the idea of the Justice Department as a place where nonpolitical career prosecutors should be left to decide how sensitive cases are resolved.

I’m sure this does wonders for morale at the DOJ! But, demoralizing all the career lawyers and pushing them out the door appears to be part of the program. After all, the regime initially tried to “buy out” the holdover members of the BIA. Morale at the Immigration “Courts” is already at an all-time low!

Career civil servants at the DOJ and elsewhere actually work for the people of the U.S., not personally for Billy, other political appointees, or the President. Government employees take an oath to uphold the Constitution, not of loyalty to the President, the AG, or any other political official.

Billy clearly has been running the Immigration “Courts” as a politically weaponized part of the regime’s White Nationalist, authoritarian, race-driven immigration enforcement agenda. Funny how long it has taken the overall legal community to see that Barr basically considers the entire legal system, including the Article III Courts, as just as subservient as the Immigration “Courts.” And, to date, the Supremes have done little to discourage that view.

He is carrying out a personal agenda of replacing representative democracy with an authoritarian state where everybody and everything is subservient to an all-powerful totally unconstitutional “Unitary Executive” (actually a bogus right-wing “invented concept” with no actual legitimate basis in American political history, as cogently “debunked” by Ayer in his podcast). That certainly makes him one of the two most dangerous men in America!

Billy did say one thing I agree with. Politicos, particularly hacks like Billy and Trump, can be held accountable at the ballot box. Indeed, given the feckless performance of the GOP Senate and the overall failure of the Federal Courts to stand up to tyranny, that appears to be the very last hope for our democracy.

This is merely the latest example of Trump’s leveraging of the powers of the presidency to avoid legal accountability. Over the past four years, he has deployed the Justice Department to try to stop a New York grand jury from conducting a criminal investigation into the president’s businesses; Congress from investigating his financial entanglements; and several litigants from requiring the president to divest his financial stake in hotels and businesses that create conflicts of interest — investments that may even violate the Constitution. Now, Trump is using a federal agency to try to ensure that he faces no consequences for — if Carroll’s account is true — lying about an incident that she describes as rape.

The legal theory that the Justice Department is pursuing now is also at odds with another theory that the department has advanced to help the president avoid accountability, in a case involving whether Trump can block critics on Twitter. In that instance, the department has argued that the president can block people on the social media site because his Twitter feed amounts to purely private speech, not official actions. That’s a bold claim — made bolder when the department insists that Trump’s comments about a private citizen, about an episode from the 1990s, constitute actions within the scope of his duties as president.

The goal is the same, though the methods vary: Protect Trump at all costs. It’s one thing for lawyers in private practice to pursue contradictory and outlandish tactics like these. It’s quite another for the Justice Department to do so, at taxpayers’ expense.

Says it all about Billy the Bigot. His “downward sprint to the finish” has rocketed him past “John the Con” Mitchell and Jeff “Gonzo Apocalypto” Sessions as the most corrupt AG in modern American history.

That’s, of course, not to minimize or trivialize the crimes committed by either of the other contenders. I suspect we’ll still be unpacking the full extent of Gonzo’s “crimes against humanity” decades from now, as the uglier and uglier truth about this “21st Century Jim Crow” dribbles out a bit at a time

Gee, even the “Afternoon Neighborhood Dog Walking Club” — comprised of neither lawyers nor hard core liberals, can’t understand why Barr, this walking, talking ethics cesspool is 1) still in office; 2) not in jail; and 3) still licensed to practice the law. Here’s hoping that all three of these unfathomable mysteries are resolved favorably to the public interest in the near future! In the meantime, Billy serves as a stark reminder of what’s wrong with legal ethics and our justice system at present.

With all the hard-working, talented, pro bono lawyers out there working overtime to save lives and our democracy, it’s simply a national disgrace and a travesty that unqualified, corrupt, unethical creeps like Billy and Gonzo have been “rewarded” with the an office that is supposed to function as “The People’s Lawyer.”

The Don’s felons and fellow conspirators against America get free passes; meanwhile, Americans of color can’t catch a break from a system loaded against them. Go figure!
