All of these particularities matter, because once all available options have been exhausted, cases generally end up inside an immigration court before an immigration judge. The administrative snarls that predate a case before it arrives in immigration court are thus a result of policy from the top, for better or worse.

On paper, courts are supposed to be independent bodies. They are supposed to be immune from the political agendas of other government operatives or serve as independent mediators that can rectify previous errors.

But immigration courts are not. As a part of the Justice Department, at the end of the day, they work under the attorney general. While other courts function under a de jure practice of independence, immigration courts are held to the same standard despite not possessing the same protections that allow other judges to carry out their basic job functions. This creates an impossible work environment for immigration judges to fairly adjudicate every case with the attention it deserves. Instead, their measurements of success are based on accomplishing the president’s goals, which are translated into quotas for immigration courts. For example, Biden administration officials touted removing 1.3 million migrants last year.

As the Prospect has previously reported, immigration judges have long pointed out the tenuous environment they must work in.

But later this month, the Federal Labor Relations Authority (FLRA) will be hearing from the National Association of Immigration Judges (NAIJ) over whether or not their union will be reinstated. The FLRA will now have a majority of Biden appointees.

A dysfunctional immigration system can only start to work with independent courts. But that change can only happen through congressional action. In the meantime, a never-ending crisis at the border can be exploited by one party, as the other expands the needlessly punitive immigration practices of the previous administration.

There is consensus among experts that an independent Article I Immigration Court is urgently needed and long overdue. There is also a consensus that the chance of achieving this critical legislative change with a GOP-controlled House is zero. At the same time, we must remember that Dems didn’t exactly give any priority to this essential and far-reaching reform when they had “unified control” over the political branches.

There is also consensus that in the absence of Article I there are things that Garland and the Biden Administration could and should have done administratively that would have drastically improved the due process, expertise, quality, efficiency, “customer service,” and professionalism of EOIR. 

Gee whiz, a Harvard Law student figured it out! They have  constructive suggestions for administrative reforms to change culture, improve training, place docket control in the hands of judges not politicos and bureaucrats, increase independence, improve quality, and insulate IJs from the political whims and enforcement agendas of each Administration. But, a Harvard Law grad, long-time Federal Judge, and Supremes’ nominee, and his band of supposedly smart and high-powered political lieutenants couldn’t or wouldn’t get it done for a Dem Administration? Gimmie a break! 

A Dem Administration that was supposed to get us beyond the cruelty, White Nationalism, xenophobia, and “malicious incompetence” of the Trump Administration falls flat on its face on a critical and achievable part of immigration reform and racial justice in America! Go figure! 

Meanwhile, the cries of pain keep coming from those subjected to Garland’s dystopian “courts!”

  • Had an “interesting” IH today with this IJ. [IJ] denied my motion to continue the case by email the evening before the 8:30 am hearing, even though I had four IHs scheduled in the same time slot and had filed a motion to continue a month before the hearing. [IJ] refused to grant me a few minutes to speak with OPLA counsel before the hearing to narrow issues, saying that discussion should have already taken place.  [IJ] spent an inordinate amount of time on housekeeping issues. [IJ] read a list of “rules.” [IJ] would insist that counsel stand when they spoke. [IJ] would routinely deny motions for webex hearings. [IJ] went through the biographical information excruciatingly slowly, including having the respondent spell the names of all the riders, provide their birth dates, etc. 

    • It was a case where DHS had stipulated to 42b and the only issue would’ve been discretion but the IJ didn’t care. [IJ] told me to let everyone know that [IJ] reads each and every single document submitted in . . . court from back to front and . . . has a lot of questions . . . . [IJ] went on to conduct a full hearing, chastised DHS for stipulating, made a big deal of every little thing, asked irrelevant questions about medicaid forms that [client] may have filled for her children (not included as part of evidence), insinuated that she committed medicaid fraud, and made the ACC change position on each and every issue.

  • [The IJ] denied the asylum application of a young gay man from El Salvador. This is a first for me, in my 20+ years of asylum practice. We’ve never lost such a case that I can recall.

    • The facts are pretty typical – the kid lived a life of humiliation and abuse in El Salvador due to his sexual orientation; tried to commit suicide several times; and ultimately left the country when the Mara 18 tried to get him to deliver marijuana for them. Arguably, not a strong case for past persecution, but such cases typically prevail where a judge fairly evaluates a claim of well-founded fear of future persecution and considers the country condition reports and articles about the horrendous human rights abuses against the LGBT community in El Salvador. This didn’t fly with IJ. [IJ] simply said “there is no meaningful evidence in the record to demonstrate that the Respondent would experience harm amounting to persecution in El Salvador” and then went on to say that the client would likely experience more bullying and discrimination, but that doesn’t mean it would be persecution. [IJ] did not mention any country conditions report or article from the record to support his ruling.

    • [T]he DHS attorney called me directly after the hearing to empathize and tell me that it’s well-known even on their side that this judge is a piece of work and it’s always a good idea to take PD if offered.

    • [T]his judge is a menace. I don’t know what to do to protect my clients from [IJ] other than prepare strong BIA appeals.

  • This is the third email I have received to schedule MORE cases. No one will tell me what the goal is. I’ve put them on notice of the health issues this is/has been causing me.

    • Please tell the higher ups that this practice of overscheduling the private bar is taking a serious toll on practitioners’ health. Medical documentation is below and attached. I’m really not sure why the court has felt the need to overschedule practitioners to this level, but it is really taking a serious toll on everyone.  Can someone please shed light on this urgent need to overwhelm the limited number of defense attorneys we have in the area?

  • Another outstanding Immigration Court practitioner told me that they had left courtroom practice and taken a “research and writing” position because the EOIR courtroom “experience” under Garland was so dehumanizing, demoralizing, stressful, and life consuming!

 

  • A different attorney called me with concerns that an IJ’s “over the top” abuse of pro bono counsel would discourage others from taking cases in Immigration Court.

IJ’s wasting time; discouraging negation and stipulation by parties; taking over hearings; abusing continuance discretion; failing to abide by Cardoza & Mogharrabi; showing bias; producing wildly inconsistent anti-immigrant results; showing thin knowledge of law; rudely treating counsel and clients; over-scheduling; abusing power; endangering the health of those appearing before them; driving practitioners to leave the EOIR courtrooms; discouraging pro bono!

Everything that is NOT what a fair, independent, court of law should be is present and allowed, perhaps even encouraged, in Garland’s broken EOIR! Why is this type of grotesque mismanagement, bad judging, unprofessional conduct, and disregard of fundamental due process “business as usual” under a Dem Administration? 

This “star chamber” system needs new, expert, progressive, due-process-focused, free from political hackery and inane gimmicks, “kick-ass” management! Garland isn’t getting the job done!

Meanwhile, the Biden Administration’s incredibly short-sighted and legally flawed “Miller Lite” asylum and border policies, of which Garland’s broken EOIR and unwillingness to stand up for human rights are a critical part, have “gone over like a lead balloon” with younger progressive Dems in Congress. Alas, no surprise to “Courtside” readers! The question is what can and will human rights supporters, progressives, and racial justice advocates DO about the consistent betrayal of humanitarian values values and the rule of law by Dems; not to mention Dems trashing their own campaign promises!

Trump’s nativist racism and Biden’s incompetence have actually moved our nation’s approach to legal refugee and asylum status BACK more than four decades! In place of the international framework put in place by Congress in the Refugee Act of 1980, we now have a hodgepodge of arbitrary, ad hoc, actions by the Biden Administration, relying to an unacceptable (and prima facie illegal) extent on the use of “emergency parole” authority as a partial substitute for legal refugee and asylee admissions!

This favors some non-refugees with “sponsors” over those who meet the accepted international definition of “refugee.” It promotes Executive and political favoritism over the needs of legal refugees. It stands on its head the normal refugee definition requiring an individual to be OUTSIDE their country of nationality to apply.

Congress did give the President extraordinary authority to admit those who otherwise meet the “refugee” definition directly from their native countries in conflict. However, rather than using this legal authority, Biden has chosen to misuse parole to EVADE it.

Even for those Venezuelans, Nicaraguans, Haitians, and Cubans fortunate enough to be chosen for parole, the first three groups will be left in limbo with no clear way of obtaining permanent immigration status after the expiration of their two-year “parole.” This obviously converts them into “political footballs” — particularly if the GOP were to regain the Presidency in 2024!

Paroled Cubans, on the other hand, might qualify for green cards under the “Cuban Adjustment Act of 1966” after one year. This creates yet another arbitrary inconsistency among those similarly situated, based solely on nationality.

The Refugee Act of 1980 creates a screening and adjustment process for those admitted as refugees thereunder, similar to the Cuban Adjustment Act. It also creates a similar process for those refugees granted asylum at the border or in the interior.

But, Biden’s choice NOT to use the existing legal provisions established by the Refugee Act of 1980, recreates exactly the type of disorder, arbitrariness, and uncertainty that the Refugee Act of 1980 was intended to end! And, they did in fact more or less end for nearly four decades, prior to the Trump-initiated fiascos that began in 2017 and which Biden, despite pledges to the contrary, has lacked the competence, expertise, and will to end and restore the rule of law!

If properly staffed with human rights experts and dynamic, visionary “practical scholars” as leaders, our legal refugee and asylum systems could not only be restored, but could also be dramatically improved and made fairer! That’s basically what Biden promised during the 2020 campaign.

Outrageously, once in office those promises have been trashed and, predictably, chaos and incompetence reigns. That’s a deadly combination for asylum seekers patiently waiting for our nation to honor its laws and international obligations!

It shouldn’t be like “waiting for Godot!” But, it is!

President Biden on Thursday will announce new immigration restrictions, including the expansion of programs to remove people quickly without letting them seek asylum, in an attempt to address one of his administration’s most politically vulnerable issues at a time when the nation’s attention is focused on Republican disarray in the U.S. House.

The measures will expand Biden’s use of “parole” authority to allow 30,000 migrants from Cuba, Nicaragua, Haiti and Venezuela to come to the United States each month, as long as a U.S. sponsor applies for them first. But those who attempt to migrate through the region without authorization will risk rapid expulsion to Mexico, as the administration plans to expand its use of the pandemic-era Title 42 public health policy. Mexico has agreed to take back 30,000 border-crossers from those nations each month, U.S. officials told reporters during a briefing Thursday morning.

The measures, which are likely to draw legal challenges from immigration advocacy groups,”will expand and expedite legal pathways for orderly migration and result in new consequences for those who fail to use those legal pathways,” the White House announced.

Biden, who has said he will seek reelection in 2024, is contending with the political and operational fallout of two consecutive years of record numbers of migrants taken into custody at the Mexican border, in part because of his more welcoming policies.

Before taking office, Biden said he wanted an orderly system, not “2 million people on our border.” The number of border apprehensions jumped to 1.7 million during his first year in the White House, however, and soared to nearly 2.4 million in his second year. Biden campaigned on the promise that his administration’s immigration system would be “safe, orderly and humane”; his pivot toward amped up enforcement suggests the White House sees immigration as a 2024 liability.

The administration’s solution is legally thorny and will likely anger immigration advocates and even some Democrats — and will probably do little to silence Biden’s Republican critics.

  • Biden’s plan effectively imposes arbitrary geographic and ideological restrictions on those seeking protection — something that Congress specifically intended to eliminate when enacting the Refugee Act of 1980;
  • Biden’s plan leaves out asylum seekers and refugees from the Northern Triangle, some of those most in need of protection;
  • It imposes arbitrary and illegal numerical limits on those who might otherwise seek asylum;
  • It continues the illegal and expanded use of Title 42 as a border enforcement mechanism having nothing whatsoever to do with public health — a position that the Administration itself has refuted in Federal Court all the way up to the Supremes;
  • It leaves those “paroled” in limbo with no clear path to legalization in the U.S., other than perhaps eventually applying for asylum in overloaded and often biased system with a backlog of many years;
  • Any future path to legal status for these parolees would require legislation agreed to by the GOP — not likely to happen — thus making these individuals “bargaining chips” for nativists seeking further restrictions on legal immigration and the right of asylum;
  • The “mass use” of parole at a rate of 30,000/month appears a direct violation of section 212(d)(5) of the INA, as amended by the Refugee Act of 1980, which specifically intended to end the “mass use” of parole as a substitute for admitting refugees under the legal framework set up by the Refugee Act of 1980, as amended.

Before craziness and chaos engulfed the House of Representatives in the saga of electing a new speaker, a Kodak moment provided a vivid portrait of the relative health of our two major political parties and our nation as a whole.

There stood Nancy Pelosi raising the gavel for the last time as speaker in front of the imposing scroll-back chair from which she had wielded power. Her job at that moment was purely ceremonial — closing the 117th Congress — but the symbolism was poignant. It marked an end to a Congress of action and accomplishment and the beginning of an era of performative pandemonium. The gavel stood there in mid-air like a baton with no one to accept it.

In the reporting on Kevin McCarthy’s travails for gaining the speakership, many have noted how small his majority is, how he can afford to lose only a few votes, and that therein lies his major problem. But as others have pointed out, Pelosi had a small majority in the last Congress — yet she maintained unity in her party and ran the House with efficiency and precision, and to great effect.

The dumpster fire we are witnessing now has been smoldering for years, if not decades. It is what happens when people elect representatives who actively hate the idea of governance. It is what happens when people rack up victories with Fox News rants and not legislation. It is what happens when a quest for power means you’re willing to yield and appease everyone and everything that can help you secure it.

To be sure, crooks, cranks, and malevolent embarrassments have not been the exclusive purview of any one political party over the years. The nature of democracy is that it can be very messy; in moments of passion, fear, or even apathy, it can sweep into office all manner of men and women who have no business being there. The idea of a legislature, however, is that the whims, idiosyncrasies, and destructive instincts of a few can be tempered by the many. Obviously that is not what is happening now.

There is a tendency among some in the beltway press to frame this as a battle of the political extremes, how the far right is undermining Republican initiatives. In this analysis there is often a perfunctory “both sides” mention of the political left, which also supposedly threatens the “center” and the ability to govern.

This simplistic framing misses the mark at this moment. On the Republican side, it is not clear what the renegades want, other than to figuratively burn down the house (or House). Some have specific demands, and McCarthy has caved more than a spelunker. But it’s still not good enough. Furthermore, these demands are almost exclusively about process and not policy. It’s about allowing a nihilistic minority to foment perpetual mayhem, thereby undercutting the debate and responsible compromise that should be the business of Congress. Ultimately, it’s about accommodating Steve Bannon and not delivering for constituents.

There is no analogous movement on the left. Even if one disagrees with the policy positions of the so-called progressive wing of the Democratic Party, ultimately those members of Congress are almost all institutionalists — in that they believe in the idea and work of the legislative branch of government. They understand that you need a speaker for the House to function, so they backed Pelosi. They left the debates and disagreements for individual bills and votes. That, by the way, is how the Founders envisioned it.

But this isn’t just about Pelosi, as formidable as her leadership skills were. The Democrats also have rallied around her successor, Hakeem Jeffries of New York, who occupies more of the moderate middle of the party. As Republicans embarrass themselves on the national stage with rounds and rounds of votes, the Democrats have held steady in unity behind Jeffries. It’s an impressive show of discipline for a political party that was once mocked (including by Democratic members of Congress) for having all the herding instincts of cats.

As much as this spectacle is gaining the attention of the American people, make no mistake that it is being watched with keen eyes around the world — by our friends and foes alike. Our allies wonder, especially in the wake of the last administration, whether they can count on America. Will these renegades blow up the world economy by defaulting on American debt? Will they pass a budget? Will they support Ukraine? Will they actively continue to undermine America’s democratic traditions?

Meanwhile, in places like Moscow, Beijing, Tehran, and Pyongyang, despots, autocrats, and dictators are cheering our divisions and the distance they create between our national ideals and our political reality. In moments of instability in Washington, the entire world becomes more dangerous. Not that the Republican holdouts care.

The public debasement of House Republicans may make for great schadenfreude viewing for Democrats. Some literally broke out the popcorn in the House chamber. But ultimately this is a sad moment for our country. We need strong political parties that believe in negotiating, legislating, and governing. We need individual congresswomen and men of decency and integrity. We need strength and thoughtfulness to tackle our myriad problems.

We need a Congress, not a circus.

Here are some relevant portions of Judge Sullivan’s opinion in Huisha-Huisha v. Mayorkas, D.D.C., Nov. 22, 2022, to keep in mind as the bogus claims and misleading reporting continue to mushroom ahead of the Dec. 22 (Wednesday) date for re-establishing the rule of law @ our Southern Border:

  • It is unreasonable for the CDC to assume that it can ignore the consequences of any actions it chooses to take in the pursuit of fulfilling its goals, particularly when those actions included the extraordinary decision to suspend the codified procedural and substantive rights of noncitizens seeking safe harbor. See Huisha-Huisha, 27 F.4th at 724-25 (describing the “procedural and substantive rights” of aliens, such as asylum seekers, “to resist expulsion”); cf. Regents, 140 S. Ct. at 1914-15 (holding that agency should have considered the effect rescission of DACA would have on the program’s recipients prior to the agency making its decision). As Defendants concede, “a Title 42 order involving persons will always have consequences for migrants,” Defs.’ Opp’n, ECF No. 147 at 42, and numerous public comments during the Title 42 policy rulemaking informed CDC that implementation of its orders would likely expel migrants to locations with a “high

probability” of “persecution, torture, violent assaults, or rape.” See Pls.’ Mot., ECF No. 144-1 at 27; see also id. at 27- 28 (listing groups subject to expulsion under Title 42, including “survivors of domestic violence and their children, who have endured years of abuse”; “survivors of sexual assault and rape, who are at risk of being stalked, attacked, or murdered by their persecutors in Mexico or elsewhere”; and “LGBTQ+ individuals from countries where their gender identity or sexual orientation is criminalized or for whom expulsion to Mexico or elsewhere makes them prime targets for persecution” (citing AR, ECF No. 154 at 28-29, 47, 153) (cleaned up)). It is undisputed that the impact on migrants was indeed dire. See, e.g., Huisha-Huisha, 27 F.4th at 734 (finding Plaintiffs would suffer irreparable harm if expelled to places where they would be persecuted or tortured).

The CDC “has considerable flexibility in carrying out its responsibility,” Regents, 140 S. Ct. at 1914, and the Court is mindful that it “is not to substitute its judgment for that of the agency,” FCC v. Fox Television Stations, Inc., 556 U.S. 502, 513 (2009). But regardless of the CDC’s conclusion, its decision to ignore the harm that could be caused by issuing its Title 42 orders was arbitrary and capricious.

3. The Title 42 Policy Failed to Adequately

Consider Alternatives

Plaintiffs also argue that the Title 42 policy is arbitrary and capricious because CDC failed to adequately consider alternatives and the policy did not rationally serve its stated purpose. See Pls.’ Mot., ECF No. 144-1 at 10-11.

  • However, despite the above, Defendants have not shown that the risk of migrants spreading COVID-19 is “a real problem.” District of Columbia v. U.S. Dep’t of Agric., 444 F. Supp. 3d 1, 27 (D.D.C. 2020) (citing Nat’l Fuel Gas Supply Corp. v. FERC, 468 F.3d 831, 841 (D.C. Cir. 2006)). “Professing that an agency action ameliorates a real problem but then citing no evidence demonstrating that there is in fact a problem is not reasoned decisionmaking.” Id. (cleaned up); see Huisha-Huisha, 27 F.4th at 735 (“[W]e would be sensitive to declarations in the record by CDC officials testifying to the efficacy of the § 265 Order. But there are none.”). As Plaintiffs point out, record evidence indicates that “during the first seven months of the Title 42 policy, CBP encountered on average just one migrant per day who tested positive for COVID-19.” Pls.’ Mot., ECF No. 144-1 at 22 (citing Sealed AR, ECF No. 155-1 at 23). In addition, at the time of the August 2021 Order, the rate of daily COVID-19 cases in the United States was almost double the incidence rate in Mexico and substantially higher than the incidence rate in Canada. See 86 Fed. Reg. at 42831 (noting 137.9 daily cases per 100,000 people in the United States, compared to 68.6 in Mexico and 8.0 in Canada). The lack of evidence regarding the effectiveness of the Title 42 policy is especially egregious in view of CDC’s previous conclusion that “the use of quarantine and travel restrictions, in the absence of evidence of their utility, is detrimental to efforts to combat the spread of communicable disease,” Control of Communicable Diseases, 82 Fed.

Reg. 6890, 6896; as well as record evidence discussing the “recidivism” created by the Title 42 policy, which actually increased the number of times migrants were encountered by CBP, see AR, ECF No. 154 at 45 (commenter describing recidivism); AR, ECF No. 155-1 at 4 (January/February 2021 statistics showing nearly 40% of family units DHS encountered in January-February 15, 2021 were migrants who had attempted to cross at least once before).

  • Particularly in view of the harms Plaintiffs face if summarily

expelled to countries they may be persecuted or tortured, the Court

therefore vacates the Title 42 policy. Cf. Nat. Res. Def. Council v. EPA, 489 F.3d 1250, 1262–64 (D.C. Cir. 2007) (Randolph, J., concurring) (“A remand-only disposition is, in effect, an indefinite stay of the effectiveness of the court’s decision and agencies naturally treat it as such.”).

  • Meanwhile, Plaintiffs have presented evidence demonstrating that the rate of summary expulsions pursuant to the Title 42 policy has nearly doubled since September 2021. See Pls.’ Mot., ECF No. 144-1 at 30 (“At the time of this Court’s original decision, approximately 14% of

families encountered at the southwest border were being summarily expelled pursuant to the Title 42 policy. . . . Now, the rate of expulsions is nearly twice as high, reaching 27%.”); see also Pls.’ Reply, ECF No. 149-1 at 31 (“[I]n the month of July 2022 alone, 9,574 members of family units encountered at the southern border were summarily expelled pursuant to the Title 42 policy.”). And “[i]n Mexico alone, recorded incidents” of “kidnapping, rapes, and other violence against noncitizens subject to Title 42” have “spiked from 3,250 cases in June 2021 to over 10,318 in June 2022.” Pls.’ Mot., ECF No. 144-1 at 30 (citing Neusner Decl., ECF No. 118-4; Human Rights First, The Nightmare Continues: Title 42 Court Order Prolongs Human Rights Abuses, Extends Disorder at U.S. Borders, at 3-4 (June 2022)). Accordingly, even if the Court accepts Defendants’ unsupported statement that the “situation for class members has improved,” the evidence demonstrates that Plaintiffs continue to face irreparable harm that is beyond remediation. See Huisha-Huisha, 27 F.4th at 733 (“[T]he record is replete with stomach-churning evidence of death, torture, and rape.”).

  • Because “there is an overriding public interest . . . in the general importance of an agency’s faithful adherence to its statutory mandate,” Jacksonville Port Auth. v. Adams, 556 F.2d 52, 59 (D.C. Cir. 1977); the Court concludes that an injunction in this case would serve the public interest, see A.B.-B. v. Morgan, No. 20-cv-846, 2020 WL 5107548, at *9 (D.D.C. Aug. 31, 2020) (“[T]he Government and public can have little interest in executing removal orders that are based on statutory violations . . . .”).

Moreover, Defendants do not contend that issuing a

permanent injunction would cause them harm or be inconsistent

with the public health. Indeed, “CDC recognizes that the current

public health conditions no longer require the continuation of

the August 2021 order,” Defs.’ Opp’n, ECF No. 147 at 44; see also Pls.’ Mot., ECF No. 144-1 at 30, in view of the “less burdensome measures that are now available,” 87 Fed Reg. at 19944; id. at 19949–50. The parties also do not dispute that Plaintiffs continue to face substantial harm if they are returned to their home countries, notwithstanding the availability of USCIS screenings. See, e.g., Human Rights First, The Nightmare Continues: Title 42 Court Order Prolongs Human Rights Abuses, Extends Disorder at U.S. Borders, at 3-4 (June 2022). As the Supreme Court has explained, the public has a strong interest in “preventing aliens from being wrongfully removed, particularly to countries where they are likely to face substantial harm.” Nken, 556 U.S. at 436.

So, when you hear guys like Abbott, Ducey, DeSantis, Manchin, Cuellar, Gonzales, GOP nativist AGs, and the like use this holiday season during which we are supposed to be celebrating messages of hope, faith, mercy, and “goodwill toward men” to extol the virtues of illegal expulsions under Title 42, remember what their are REALLY saying: 

“I want the US to continue violating domestic and international laws protecting refugees and asylum seekers, to continue to knowingly violate the human rights and human dignity of asylum seekers, and to place our fellow humans in danger zones where they will suffer stomach-churning episodes of death, torture, and rape. I don’t believe our nation is capable of complying with our duly-enacted laws to protect refugees and asylum seekers that have been in effect since 1981 until 2020 when they were illegally suspended by the Trump Administration using a public health pretext, as found by a Federal Judge. I urge the Biden Administration, which has already illegally expelled hundreds of thousands of migrants with no due process, to continue committing grotesque violations of the law and human rights and to increase the violations so that more men, women, and children will suffer rape, torture, an dearth as a consequence. This is my holiday season message to America and humanity: Peace on earth and goodwill toward all mankind, EXCEPT those seeking legal asylum by applying at our Southern Border. To them: rape, torture, and death without due process!

Title 42 expulsions of asylum seekers are a clear violation of Judeo-Christian ethics. To be advocating for its continuing application at any time, let alone during this season, is the height of hypocrisy; so is characterizing the largely self-inflicted mess at the Southern Border as a “humanitarian emergency” and then proposing to “solve” it by sending legal asylum seekers back to rape, torture, kidnapping, robbery, extortion, and death in Mexico and other nations in turmoil without any type of process to determine whether they have a “credible fear” of persecution, as required by law.

Justice Clarence Thomas has openly flouted the federal law that requires all federal judges, including Supreme Court justices, to recuse themselves from cases in which they cannot be impartial: He has participated in a case in which his wife, Ginni, undeniably has an interest. For a long time, it has felt like there is nothing to be done about this—conventional wisdom says that short of impeachment, Supreme Court justices are immune from penalties for their misconduct. But that is wrong.

Thomas’ eight colleagues have the tools to protect the court’s integrity: They can publicly censure him, bar him from being the decisive vote in cases in which he should have recused, and take away his power to author majority opinions. Whether they will take action is a different story, which may explain why the court’s reputation is at a historic low.

But Thomas, who has long played fast and loose with recusal laws, has finally gone too far. The issue came to a head last month, when the Supreme Court refused to block the House committee investigating the Jan. 6 attack on the Capitol from obtaining Arizona GOP Chair Kelli Ward’s phone records. In January 2021, Ward had orchestrated an alternative slate of electors (which included herself) in an effort to subvert the election of Joe Biden as president. Thomas participated in the court’s decision, casting a dissenting vote, even though his wife was intimately involved in these events.

Chances are you heard nothing about this. That’s because the decision was part of the court’s “shadow docket”—orders issued without hearing or written decision—and so it garnered little public attention.

But it should have, because Thomas’ participation in the case was a flagrant violation of the federal law requiring recusal from cases in which it is “known by the judge” that his spouse “ha[s] an interest that could be substantially affected by the outcome.” His vote also transgressed that statute’s broader provision requiring disqualification in “any proceeding in which [a judge’s] impartiality might reasonably be questioned.”

Ginni Thomas’ connection to the case is not in question. She has actively tried to overturn Biden’s election in Arizona and other states. In December 2020, Ginni Thomas sent letters to 29 Arizona lawmakers urging them to “fight back against fraud” and select a “clean slate of Electors” after Biden won the election. She also sent numerous text messages to President Trump’s chief of staff demanding he overturn the election, and attended the rally on the Ellipse on Jan. 6, though she left before the attack on the Capitol. This past September, the Jan. 6 committee subpoenaed and interviewed Ginni Thomas, and she repeated then her unfounded belief that the 2020 presidential election was stolen.

Without question, Ginni Thomas has an “interest that could be substantially affected by the outcome” of the Jan. 6 committee’s subpoena of Ward’s phone records. Also, without question, Justice Thomas knew it when he cast his dissenting vote to bar disclosure.

The eight other justices know it, too. Yet so far, they have done nothing about a fellow justice’s blatant violation of a federal law designed to protect the integrity of the court on which they serve. Understandably, the justices are reluctant to police their colleagues. But Justice Thomas’ extraordinary conduct calls for an extraordinary response.

But special master appointments are rare, and judges at the U.S. Court of Appeals for the 11th Circuit expressed concern at oral arguments that Cannon’s decision set a troubling precedent: allowing the target of a search warrant to go into court and request a special master that could interfere with an executive branch investigation before an indictment is ever issued.

The judges did not back down from that stance in their written opinion Thursday, saying they could not issue an order that would “allow any subject of a search warrant to block government investigations after the execution of the warrant.”

“Nor can we write a rule that allows only former presidents to do so,” the Thursday opinion read. “Either approach would be a radical reordering of our caselaw limiting the federal courts’ involvement in criminal investigations. And both would violate bedrock separation-of-powers limitations.

I imagine every criminal defendant in America would be delighted to have the benefit of “Judge Loose’s” incredible ruling that the subject of a criminal investigation, basically caught “red handed” with contraband after a lawfully executed search warrant, could block an ongoing  criminal investigation.

It’s notable that all three 11th Circuit panel judges were GOP appointees, two of them Trump appointees like Judge “Loose!” Unlike “Loose,” they actually take the Constitution and their oaths of office to uphold it seriously, at least in this case!

The saga of Trump’s frivolous abuse of our justice system isn’t yet over. He can request review from the Supremes. However, since he lost to Biden, the Supremes’ GOP majority has shown less willingness to bail out the insurrectionist ex-Prez in his dilatory personal battles to avoid accountability for his actions!

A Trump judge seized control of ICE, and the Supreme Court will decide whether to stop him

Judge Drew Tipton’s order in United States v. Texas is completely lawless. Thus far, the Supreme Court has given him a pass.

In July, a Trump appointee to a federal court in Texas effectively seized control of parts of Immigration and Customs Enforcement (ICE), the federal agency that enforces immigration laws within US borders. Although Judge Drew Tipton’s opinion in United States v. Texas contains a simply astonishing array of legal and factual errors, the Supreme Court has thus far tolerated Tipton’s overreach and permitted his order to remain in effect.

Nearly five months later, the Supreme Court will give the Texas case a full hearing on Tuesday. And there’s a good chance that even this Court, where Republican appointees control two-thirds of the seats, will reverse Tipton’s decision — his opinion is that bad.

The case involves a memo that Secretary of Homeland Security Alejandro Mayorkas issued in September 2021, instructing ICE agents to prioritize undocumented immigrants who “pose a threat to national security, public safety, and border security and thus threaten America’s well-being” when making arrests or otherwise enforcing immigration law.

A federal statute explicitly states that the homeland security secretary “shall be responsible” for “establishing national immigration enforcement policies and priorities,” and the department issued similar memos setting enforcement priorities in 2005, 2010, 2011, 2014, and 2017.

Nevertheless, the Republican attorneys general of Texas and Louisiana asked Tipton to invalidate Mayorkas’s memo. And Tipton defied the statute permitting Mayorkas to set enforcement priorities — and a whole host of other, well-established legal principles — and declared Mayorkas’s enforcement priorities invalid. This is not the first time that Tipton relied on highly dubious legal reasoning to sabotage the Biden administration’s immigration policies.

Even when the law offers no support for the GOP’s preferred policies, in other words, the Court permits Republicans to manipulate judicial procedures in order to get the results they want. The Texas attorney general’s office can handpick judges who they know will strike down Biden administration policies, and once those policies are declared invalid, the Supreme Court will play along with these partisan judges’ decisions for at least a year or so.

Once the GOP got the upper hand on the Federal Bench, the “traditional” conservative case for “judicial restraint” went straight down the tubes under an assault by righty ideologues eager to “do in” precedents, laws, and Executive policies that don’t fit their “out of the mainstream” political agenda, no matter how thinly reasoned or often counterfactual their “cover” might be.

And, as usual, Dems have been slow on the uptake about getting younger, staunch defenders of democracy and our Constitution on the bench to counteract the right-wing’s Article III takeover. 

As this article points out, the Supremes’ questionable “shadow docket” is manipulated by the Court’s righty majority improperly to favor GOP scofflaw tactics, even where they ultimately can’t concoct a legal basis to uphold them on the merits.

Let’s look at this in perspective. Biden ran in 2020 on a platform of ending Title 42 and restoring asylum processing at the border. Almost two years later, after illegally returning hundreds of thousands of asylum seekers without any process at all, his Administration still lacks a coherent, transparent plan to implement asylum law at the border. This wasn’t “rocket science” as there had been an operating asylum system at the border for approximately four decades, since the enactment of the  Refugee Act of 1980, until Trump illegally ended it.

After more than a year of dawdling, the Administration eventually, reluctantly, set a May 23, 2022 date to “lift” the illegal Title 42 “blockade,” giving GOP nativists more than ample time to block it.

In the meantime, they squandered time, money, and goodwill thinking of ways to actually extend the illegal removals. Their “defense” of  lifting Title 42 was, predictably, half-hearted and inept. Not surprisingly, they were enjoined by nativist right wing judges. Reportedly, many Administration officials breathed a “sigh of relief” that the GOP nativists and their “wholly owned judges” had “bailed them out” from having to actually restore the asylum system and make good on their campaign promises.

Now, another six months have gone by. Garland and Mayorkas still are “not ready for prime time.” Sounds like they thought their “regime of illegal returns” would last forever!

Casts doubt on the good faith of their claim that they wanted to end Title 42 in the first place. Almost all Administrations, once in office, get enamored of the idea that “because it’s only immigrants” they don’t have to treat them as humans. What’s another month of law violations after two years and hundreds of thousands of human rights abuses?

I have little confidence that there will be a functional, due process compliant, asylum system on Dec. 22 at the border. I’m not aware that DHS and EOIR even have the properly trained qualified personnel to correctly and efficiently apply asylum law. There is no known plan for working with the pro bono bar to insure representation and prioritize the many potentially grantable cases.

There is certainly a mind-boggling “leadership void” at both DHS and DOJ on refugee, asylum, and human rights issues. The ill-advised “gimmicks” and “corner-cutting” that Garland and Mayorkas have substituted for competence and expertise in “recently arrived” asylum cases have resulted in elevated denials, hindered representation, and alienated the pro bono bar and human rights NGOs. The latter have far more expertise in asylum law and better ideas on how to efficiently and fairly process refugees and asylees than anyone at either DHS or EOIR. Yet, the experts have intentionally been “frozen out” of the decision-making process.

Additionally, and stunningly, Garland has gone out of his way to alienate and demoralize the already stressed and overextended immigration bar with a insane dose of  “Aimless Docket Reshuffling.” Setting “D-Day” for reinstating the law, three days before the Christmas holiday, also seems highly problematic. What could possibly go wrong with a system run by politicos who have spent two years avoiding providing fair hearings to asylum seekers?

In the vacuum created by the Biden Administration’s incompetence and lack of leadership, racist GOP governors have taken control of “asylum resettlement” and conducted it in ways calculated to cause the most disruption, cruelty, and suffering for the political pawns (actually humans) that Biden has abandoned.

This does not sound like a “dressed for success” plan to restore a fair and efficient asylum system. But, after two years of adapting and using clearly illegal methods instead of competently handling human rights issues, the Biden group has gotten very used to  “programmed failure” and shifting the blame to Trump (out of office since Jan. 20, 2021), the hapless victims, and their lawyers.

I hope I’m wrong. But, I strongly suspect that it’s going to take more than Judge Sullivan’s order to end the disingenuous “Miller Lite” approach to immigration within the Biden Administration and usher in an era of expertise, competence, integrity, and courage in addressing human rights.

EUREKA, Calif. —  Beauty drew Brieanne Mirjah D’Souza to Eureka.

In 2018, she and her husband — Michigan natives who had been living for a spell in the Bay Area — moved up to this chilly old timber town to build a life beneath the redwoods and by the sea.

But last winter, pregnant with her first child, D’Souza began reflecting on this pretty place she would bring her son into.

D’Souza, a 32-year-old digital marketer, is of Chinese and West Indian descent. And Humboldt County is very white.

As D’Souza’s belly grew and the headlines told of a dramatic surge in anti-Asian hate crimes amid the COVID-19 pandemic, D’Souza set out to find other people who looked like her.

A fledgling group started meeting over Zoom and trading emails. They learned there had once been a Chinatown in Eureka. Maybe they could commemorate it with a plaque, they figured.

But where had it gone?

In the late 19th century, Chinatown occupied a single block in the middle of the remote, misty port town.

A few hundred Asian immigrants — mostly men — lived in Eureka after a federal law barred immigration from China in 1882.

They toiled in redwood logging camps, laundries and restaurants. They were nannies and household servants and vegetable growers. They were former gold prospectors priced out of the work because of a predatory state tax on foreign miners.

When the economy soured in the 1880s, white people blamed them, claiming they stole jobs. Newspapers whipped up anti-Chinese sentiment.

“There were a lot of stereotypes: that Chinese people were diseased, they were morally corrupt, they would not assimilate to the rest of American society at the time,” said Katie Buesch, a former director and curator at the Clarke Historical Museum in Eureka.

That sentiment was par for the course in the Golden State at the time.

Some California city officials are now acknowledging the ugly past — a counter-movement to red-state politicians pushing to ban books and limit the teaching of history that involves race.

Antioch and San Jose apologized last year for burning their Chinatowns in the late 1800s. San Francisco apologized for barring Chinese children from public schools.

Los Angeles is working on a memorial to commemorate an 1871 massacre in which at least 18 Chinese people were fatally shot or hanged. And in Pacific Grove earlier this year, organizers canceled a pageant that had long featured performers in yellowface.

In Humboldt County, Buesch, who had put together a small museum exhibit on Eureka’s Chinese community just before the pandemic, was struck by an 1885 article in the Daily Times-Telephone newspaper about Chinatown.

“The time has come when these plague spots should be removed,” the newspaper wrote.

On Feb. 5, 1885, the newspaper, which called the Chinese neighborhood a violent, drug-addled “leper’s colony,” wrote that it would probably be “goodbye to Chinatown” if an “unoffending white man” were killed there.

The very next day, a white Eureka city councilman who lived near Chinatown was walking past. Shots rang out between what is said to be two Chinese men, although details are scant. A stray bullet killed the councilman.

An angry mob of more than 600 white people — loggers, fishermen, miners and merchants — filled the streets, said Jean Pfaelzer, author of “Driven Out: The Forgotten War Against Chinese Americans.”

A gallows was erected. An effigy of a Chinese man swung from a noose.

Someone suggested slaughtering the Chinese, but that was deemed un-Christian, Pfaelzer said. Others said they should burn Chinatown, but its scrap wood buildings belonged to a white man, since the Chinese were not allowed to own property.

They instead appointed a committee of 15 men to go into Chinatown and order everyone to leave. The sheriff commissioned wagons to gather their belongings. Armed vigilantes roamed on horseback.

The next morning, about 300 Chinese people were marched to the wharf and eventually loaded onto two steamships: The Humboldt and The City of Chester.

They were shipped to San Francisco, where no one knew they were coming, Pfaelzer said. They disembarked and fled.

A few dozen sued the city of Eureka, but a judge tossed out their lawsuit.

The purge, which became known as the “Eureka method,” was copied in other towns across California and hailed by white people as nonviolent.

By 1890, the business directory for Humboldt County was boasting that it was “the only county in the state containing no Chinamen.” A Eureka law, in effect until the mid-20th century, banned Chinese people from working in the city.

In the spring of 2021, a gunman killed eight people, including six women of Asian descent, at three Atlanta-area spas.

The shootings sparked an outpouring of activism and calls to #StopAsianHate. They followed months of heightened attacks on Asian Americans amid a political climate in which then-President Trump was calling the coronavirus the “Chinese virus” and “kung flu.”

Around that time, D’Souza had set up an Instagram account she called APA Humboldt.

D’Souza quickly heard from a local group of Asian Americans who had organized a series of Japanese taiko drum performances before the pandemic.

They began meeting virtually. Their numbers grew. There was a real hunger for community in this county where only 3% of the population is Asian or Pacific Islander.

The group delved into local history, poring through legal briefs, census data, letters, maps and journals to piece together the little-known story of Eureka’s Chinatown, which had been told mostly from a white perspective.

“We all had an awakening of sorts,” D’Souza said. “There was no awareness that there was once a thriving Chinese community here … and they faced the same kind of discrimination and racism that we’re still facing today.”

D’Souza figured they would install a plaque before her baby came, and that would be that.

But what became known as the Eureka Chinatown Project — the work of the group now called Humboldt Asians & Pacific Islanders in Solidarity — blossomed.

With support from the city, they erected signs describing the expulsion in Historic Chinatown — which, today, is a downtown business district with banks, parking lots and no trace of the neighborhood that once stood.

There are plans for a monument.

And — with a mural and a renamed roadway — the Eureka Chinatown Project honored two local Chinese American pioneers whose legacies were too little known.

Democrats were projected to retain control of the Senate on Saturday, clinching a narrow majority as they showed strength in battleground races in a daunting midterm year that handed President Biden a major victory as he looks to his next two years in office.

The final blow to Republican hopes of retaking the chamber came in Nevada, where on Saturday Sen. Catherine Cortez Masto (D) was projected to win reelection, edging past Adam Laxalt (R), a former state attorney general. Cortez Masto’s projected win ensures Democrats a 50th seat, with a runoff election still to come in Georgia on Dec. 6. Vice President Harris is empowered to cast tiebreaking votes in the Senate.

Control of the House was still up in the air on Saturday, as vote counting continued days after an election in which Democrats overperformed expectations in many contested areas across the country. Democratic control of the Senate dashes GOP hopes of a full takeover on Capitol Hill.

That’s welcome news for Biden, who was staring down the possibility of humbling defeats as the election neared. Now, the Senate, which oversees the confirmation of executive branch personnel and federal judges, will stay in his party’s corner. A Senate majority will also give the president and his party more say over legislative debates on domestic and foreign spending and other major issues.

Senate Majority Leader Charles E. Schumer (D-N.Y.) called the results a “vindication” for Democrats and their agenda, and said Republicans had turned off voters with extremism and “negativity,” including some candidates’ false insistence that the 2020 election had been stolen. “America showed that we believed in our democracy,” he told reporters in New York, while praising the quality of Democratic incumbents.

Cortez Masto announced she would deliver a victory speech on Sunday.

In Nevada, Cortez Masto’s win was part of a perfect record so far by incumbent senators seeking reelection in the midterms, as voters tilted strongly against upending the established order in the chamber. It was part of a strong showing by Democrats in battleground areas where Republicans fell short after emphasizing rising prices and concerns about crime during an era of one-party control in Washington.

Importantly, Biden & Sen. Chuck Schumer will retain authority to appoint better qualified, progressive, Federal Judges from diverse backgrounds, schools, and experiences to counteract the toxic influx of poorly qualified far-right jurists, many ideologues hand-picked by the Federalist Society and the Heritage Foundation for their extremist, anti-democracy, far right views that threaten the credibility and the legitimacy of the Federal Judiciary. 

Biden’s & Schumer’s attention and success at timely appointing and advancing exceptionally well-qualified Article III judges whose views support and advance the rule of law, equal justice for all, and reasonable legal interpretations has been one of the “under the radar” success stories of his first two years. For once, if perhaps a little late in the game, the Dems have treated Federal Judicial appointments with the same urgency, strategic thinking, and determination to fundamentally reshape the judiciary as the GOP!

If only Garland had paid the same attention to reforming, improving, and reshaping the Immigration Judiciary to make expertise, due process, fundamental fairness, and best judicial practices paramount after four years of highly questionable judicial appointments and “packing” of the BIA  by Sessions and Barr in support of their nativist, anti-immigrant agenda!

Senator Cortez Masto’s victory also saves America from another round of Sen. Mitch McConnell (R-TN) as majority leader. Additionally, it’s a well-deserved setback for arrogant GOP Senate campaign honcho Rick Scott (R-FL) — a guy whose idea of America is to block all progress, steal from the poor, give to the rich, and never give an honest answer.

All and all, it’s a good night for American democracy, although the narrowness of Dem victories despite the obvious superiority of Dem candidates should serve as a warning sign that our nation is not out of the “far-right woods” by any means. Next, it remains critically important for the Dems to re-elect Sen. Raphael Warnock (D-GA, an outstanding and articulate spokesperson for democratic values over the spectacularly incoherent and unqualified Trump-backed GOP challenger Herschel Walker in December’s Georgia runoff. A one-vote “cushion” is critical in the event of death or incapacity of any of the Dem Senators.

Importantly, voters across America rejected every corrupt Trump election denier running on the GOP ticket for positions that would have given them control over state elections.

During her victory remarks on Tuesday night, Spanberger spoke of her “deep and abiding love for the country” and a “profound sense of responsibility.” The former CIA agent reiterated that the country was founded on “a dream” that it need not bound by the past or be ruled by kings and queens. Quoting Benjamin Franklin’s admonition that the constitutional convention delivered a republic “if you can keep it,” she declared, “We must all work hard to keep it.”

As a moderate, Spanberger has managed to balance fidelity to Democratic causes such as investment in green energy and the preservation of abortion rights with an independent, reform-minded streak that sometimes put her at odds with party leadership. (Speaker Nancy Pelosi, for example, has not allowed a floor vote on Spanberger’s bill that would ban House members and their spouses from holding individual stocks.)

With this win, Spanberger reaffirms her status as a rising star in the party. Her formula — bipartisan problem solving, strong national security credentials, anti-corruption crusading and support for women’s reproductive rights — has proved successful. But she also had another advantage: a Democratic record of legislative success, including the infrastructure bill, the Chips and Science Act, an expansion of veterans’ health care and measures to reduce prescription drug prices.

By sharp contrast, the GOP has no known values: divide, bully, lie, demean, hate, misinform, blame, deny, discriminate, humiliate, oppress, smear, shame. Those aren’t values: just highly negative attributes!

The GOP did claim concern about inflation and the economy. But, they offered no coherent plan for addressing it in any practical, bi-partisan manner.

Instead, they promised to wreck Government, mindlessly oppose anything Biden proposes, and even threatened to collapse the worldwide economy by “playing chicken” with the artificially-created “debt ceiling.” 

To the extent that any GOP candidate could explain their economic “plan” (most couldn’t or wouldn’t), it was a muddled variation of proven-to-fail “trickle down economics.” Yup, the same nonsense and bureaucratic doublespeak that has destroyed the British economy and led the Conservatives to be a laughingstock of “unstable government by clowns🤡!” Basically slash programs that benefit everybody to reward fat-cats with more un-needed and unfunded tax breaks. 

Do we really need to make guys like Musk, Zuckerberg, Bezos, McConnell, and the “geniuses” who invented “cryptocurrency” richer? Make sense? Of course not! I doubt that there is a shortage of “investment capital” in the U.S. right now. 

Is preventing IRS from processing returns in a timely manner and collecting back-taxes owed really the key to reducing budget deficits? Preposterous! Yet GOP pols say so!

Undoubtedly, we need prudence, responsibility, and focus in government spending — from both parties. As working mothers, Abigail and Hillary know a thing or two about making responsible fiscal decisions and insuring that their constituents get the most bang for each hard-earned tax dollar spent. And neither is afraid to speak out against “fraud, waste, and abuse” in any and all forms!

As former Federal civil servants, they recognize the need for cutting waste and getting more value for each dollar. In that respect, I think that requiring competent management, accountability, expertise, innovative customer service, and focused enforcement in the hugely expensive yet highly wasteful, ineffective, and often counterproductive immigration bureaucracy would be a good starting point for achieving much more without drastic resource increases.

It doesn’t hurt that Abigail and Hillary are really really smart and use their brains to help others and society rather than for self-aggrandizement or to lord it over others. Tough as they are, they are also nice, kind, and compassionate. In other words, non-ideologues.

Go, Abigail and Hillary! Make America the best that we can be: A diverse society and powerful nation where everyone can reach their full potential, independence, and self-sufficiency, not just the “chosen few!”

Hillary Scholten (D) and John Gibbs (R) face off for Michigan 3rd Congressional District seat

GRAND RAPIDS, MI — Hillary Scholten will become the first Democrat to represent Grand Rapids in Congress since 1977 after defeating Trump-backed Republican John Gibbs in a race that’s drawn national attention.

Scholten, an immigration attorney from Grand Rapids who worked in the U.S. Department of Justice during the Obama administration, defeated Gibbs 53% to 44%, according to unofficial results from the Associated Press.

The AP called the race for Scholten just before 2 a.m. Wednesday morning, with 63% of votes counted.

Scholten campaigned as a common-sense, problem-solving candidate who supports abortion rights, lowering the cost of health care and prescription drugs, and protecting Social Security and Medicare. Scholten cast Gibbs as an extreme candidate focused overturning the 2020 election results and “doing Donald Trump’s bidding on West Michigan.”

Scholten could not immediately be reached for comment early on Wednesday, Nov. 9. Her campaign spokesperson, Larkin Parker, said Scholten would be live-streaming a speech this morning.

Gibbs took to Twitter after AP called the race, saying “we believe this call is premature.”

“There are plenty more votes outstanding and we expect the vote count to go well into Wednesday,” said Gibbs, who grew up in Lansing and served in the U.S. Department of Housing and Urban Development during Trump’s presidency.

The last time a Democrat was elected to represent Grand Rapids in Congress was 1974. Attorney Richard Vander Veen was elected that year, in what was then the 5th Congressional District. He replaced U.S. Rep. Gerald Ford, who resigned from the seat to become vice president during Richard Nixon’s second term.

After the polls closed Tuesday, Scholten spoke to supporters at Paddock Place, a restaurant and event venue in Grand Rapids. She described her campaign as a unifying effort to draw in voters from both sides of the political spectrum, as opposed to the “divisiveness” of her opponent’s campaign.

“This campaign has, and continues to build, something new here in West Michigan,” Scholten said. “A new political home for people on the right, the left, the center, who are tired of politics as usual, who are ready to cast aside the old frame of division, ‘us versus them,’ and join hands together for a better, brighter West Michigan for all of us.”

NBC: The Biden administration is weighing options to respond to what could soon be a mass exodus of migrants from Haiti, including temporarily holding migrants in a third country or expanding capacity at an existing facility at the U.S. prison at Guantánamo Bay, Cuba, according to two U.S. officials and an internal planning document reviewed by NBC News.

 

Thousands of Venezuelans are stranded in Mexico after the U.S. shut doors to them

NPR: Tens of thousands of Venezuelans are stranded south of the U.S.-Mexico border. The U.S. recently shut the door to them and is returning most Venezuelans who arrive seeking asylum to Mexico. See also Venezuelans struggle with new reality in Tijuana after expulsions from United States.

 

At least 853 migrants died crossing the U.S.-Mexico border in past 12 months — a record high

CBS: The figure, which far exceeded the previous record of 546 migrant deaths recorded by Border Patrol in fiscal year 2021, is likely an undercount due to data collection limits, migration policy analysts said.

Report: Abuse reports by Black immigrant detainees are disproportionately high

LA Times: After analyzing the records of nearly 17,000 calls between 2016 and 2021 from its national immigrant detention hotline, Freedom for Immigrants released a report Wednesday that it and other advocacy groups say indicates a pattern of racism and abuse toward Black migrants.

 

Hundreds of Thousands at Imminent Risk of Deportation and Family Separation After Negotiations in Ramos v. Mayorkas Collapse

ACLU: After 16 months of negotiations, settlement talks between the Biden administration and plaintiffs in Ramos v. Mayorkas officially collapsed yesterday afternoon, leaving more than 260,000 people at risk of deportation. Beneficiaries of Temporary Protected Status (TPS) and their US citizen children first brought the lawsuit in 2018 after Trump revoked protections for individuals from El Salvador, Haiti, Nicaragua, Sudan, and later for Nepal and Honduras.

 

U.S. removes Trump-era barriers to citizenship-test waivers for disabled immigrants

NPR: After months of public feedback, the federal agency has shortened and simplified its disability waiver, which is used to exempt immigrants with physical, mental or learning disabilities from the English and civics test requirements.

 

Arizona Gov. Doug Ducey Defies Biden With Border Wall Made of Shipping Containers

Intercept: On Monday, Gov. Doug Ducey began dropping the first of thousands of shipping containers along a 10-mile stretch of national forest in open defiance of federal authorities. Poll finds broad support in battleground states for legalizing unauthorized immigrants

CBS: Seventy-three percent of surveyed voters in Arizona, Georgia, Nevada, Pennsylvania and Wisconsin said they backed giving immigrants living in the U.S. without legal permission an opportunity to “earn” lawful status and ultimately citizenship if they meet certain requirements, including passing background checks.

Law360: A split Ninth Circuit declined to revive the asylum bid of a Salvadoran man ordered deported after traveling through Guatemala and Mexico before entering the U.S., saying its hands were tied when it came to reviewing expedited removal orders.

 

Split 9th Circ. Orders New Look At Guatemalan’s Torture Claim

Law360: A split Ninth Circuit has ordered the U.S. Board of Immigration Appeals to reconsider a Guatemalan man’s deportation relief bid, saying the agency wrongly ruled out government acquiescence in the man’s account of being tortured by Guatemalan police officers.

 

10th Circ. Declines Review Of 1999 Deportation Order

Law360: The Tenth Circuit declined to review a former conditional green card holder’s challenge of a 1999 deportation order, saying his chances of tossing the decades-long order stopped at the immigration courts due to his unlawful reentries into the U.S.

 

USCIS Retracts T Visa Denial After Judge’s Rebuke

Law360: U.S. Citizenship and Immigration Services approved a Mexican woman’s application for a T visa, designated for sex trafficking victims, after an Illinois federal judge faulted the agency’s earlier refusal to accept an immigration judge’s waiver of inadmissibility, the woman said.

 

Juvenile Migrants Differ From Trafficking Victims, Judge Says

Law360: A California federal judge tossed an equal protection claim brought by young immigrants who were abused or neglected by their parents, dismissing on Wednesday their argument that the government was unfairly treating them differently from trafficking victims in doling out work authorization.

 

Florida judge orders DeSantis to hand over migrant flights records

Politico: The governor’s office did not immediately respond to a request for comment, but lawyers representing the Florida Center for Government Accountability said they anticipated there would be an appeal.

Law360: Senate Democrats called on the Biden administration to broaden Haitian immigration protections to cover Haitians who have fled political and economic turmoil over the past year, saying Wednesday that conditions in Haiti have only worsened since the administration last offered relief

 

EOIR Announces 32 New Immigration Judges

EOIR: The Executive Office for Immigration Review (EOIR) announced the appointment of 32 immigration judges to courts in California, Florida, Georgia, Illinois, Maryland, New York, Tennessee, Texas, and Virginia.

When all else fails, picking on vulnerable Black Haitian refugees is always a popular way to buff up your “restrictionist creds” for Administrations of both parties. But, the GOP already has the White Nationalist/nativist vote locked up. So, what the Biden folks hope to get by throwing Haitians “under the bus” and driving back and forth over their bodies is a mystery to me.

Hey, I’m only a retired Immigration Judge, not a political wonk. But, I can’t see what Biden and Harris stand to gain with their cruel, anti-Haitian policies. 

Why not set up viable refugee programs in Haiti, as we did for Cubans, if we don’t want more refugees taking to the sea in leaky boats? Why not prioritize immigrant visa processing for qualified immigrants from Haiti, Cuba, Venezuela, the Northern Triangle, and other Western Hemisphere countries? Migration from these nations to the U.S. is a reality that benefits both the migrants and our nation. Why not use the tools at hand to channel legal immigration rather than flailing around with questionable built to fail “deterrents.”
