On Monday, the Supreme Court lifted an injunction that had prevented the Border Patrol from cutting and removing concertina razor wire that the state of Texas had installed along a migrant crossing at the Rio Grande.

Federal officials view the razor wire as exceedingly dangerous because it could trap bodies in rapid flowing waters, leading to drownings. According to officials, last week three family members—a mother and her two children—died at the river in part because Texas guard and state troopers prevented the Border Patrol from reaching them.

The conservative Fifth Circuit had ordered the injunction put in place pending its final decision, keeping the razor wire intact. But a slim majority of the Supreme Court, with Chief Justice John Roberts and Justice Amy Coney Barrett joining the three liberals, overruled the panel.

At stake is more than whether the Border Patrol can safely do its job and help prevent deaths like those that occurred last week. Our entire federal system is premised upon the principle that the federal government has exclusive authority to enforce border policy. States like Texas should not have the right to run interference or act as if they are the border patrol.

And yet, four extremist justices—Alito, Thomas, Gorsuch and Kavanaugh—would have left the federal government powerless for now to remove a dangerous barrier illegally erected by Texas.

The latest battle over the border should be viewed within the broader question of what is the proper role of the states when it comes to immigration. And this isn’t the only battle that Texas Governor Greg Abbott and extremist Texas Attorney General Ken Paxton have picked to try and claim more of that power for the states.

Today, I’ll discuss how the Supreme Court came to review this case about the cutting and removal of razor wire at the border. Then I’ll zoom out so we can see how this fits into a larger challenge to federal authority over immigration.

Razor wire and the Texas federal courts

When Texas first erected razor wire at the river—the kind designed to catch clothing and tear flesh—it was roundly condemned by human rights organizations, and legal scholars quickly pointed out that Texas was acting extrajudicially. After all, at the border, it is the federal government that oversees enforcement, including what kinds of barriers to erect and how to treat and handle migrants. Many of the border crossings are by asylum seekers, and they are therefore there legally in accordance with international law.

Allowing Texas to insert itself as a state actor would upend all traditional notions of federalism and the limit of states’ rights when it comes to questions of homeland security. But a federal district judge and later the Fifth Circuit didn’t see it that way. On December 19, 2023, a panel in New Orleans temporarily barred Border Patrol agents from cutting or removing the wire in the area around Eagle Pass, with an exception for “medical emergencies.” This was a shocking opinion given its apparent disregard of settled law establishing exclusive federal power over immigration policies and execution.

U.S. Solicitor General Elizabeth Prelogar argued that the injunction barred border agents from doing their jobs, specifically, from having clear access to the U.S.-Mexico border and “reaching migrants who have already entered U.S. territory.” Moreover, the exception for medical emergencies was insufficient because it takes time to cut through the wire, and while the clock is ticking there is a “very real” risk of serious injury or death for those trapped.

Texas claimed that federal border agents were not actually apprehending and processing migrants even after they passed through the gaps in the wire that had been cut by the feds some twenty times. The state had property rights of its own, Texas argued, as well as an interest in stopping “deadly fentanyl,” human trafficking,” and to “minimize the risks to people, both U.S. citizens and migrants, of drowning while making perilous journeys to and through illegal points of entry.” (The fentanyl argument is a red herring; the vast percentage of fentanyl entering the country arrives not via migrants crossing the river at the border, which would be a decidedly foolish way to try and transport drugs, but through smuggling by U.S. citizens and legal residents.)

In January, Texas upped the stakes by moving to block federal agents entirely from the area where they normally launch patrol boats and conduct mobile surveillance. This contributed to the three family members’ deaths because fedeal agents had no clear access to the river. In fact, they couldn’t even determine whether a “medical emergency” was occurring, as Prelogar pointed out.

Prelogar won her appeal for the U.S. government and got the injunction lifted by the High Court, but by only a single vote.

The State of Texas keeps trying to enforce national border policy

Governor Abbott has a multi-billion dollar program in place called “Operation Lone Star” that includes massive allocation of personnel to the border, the erecting of illegal and often dangerous barriers, and most recently a new law that authorizes state and local law enforcement to arrest migrants crossing from Mexico.

This has set up yet another showdown with the federal government. That law goes into effect in March, and it is seen as a test case to challenge a 2012 case, Arizona v. United States, that narrowly left the power to determine immigration policy to the federal government, not the states.

Texas and Louisiana already lost a case where they had challenged the Biden administration’s immigration guidelines and its deportation policies. Those guidelines had been halted nationwide by a federal judge in Texas, who ruled they violated federal law. In that case, by a 5-4 decision, the Supreme Court initially and rather alarmingly had allowed the injunction to remain in place. But ultimately it ruled 8-1 in June of 2023 against Texas and Louisiana, with only Justice Alito in dissent, reaffirming the federal government’s central role on matters of immigration policy.

Where things go from here

Governor Abbott and state Attorney General Paxton remain keen to find where the new conservative majority on SCOTUS might rule their way. So they keep pushing and testing the limits. In the razor wire case, while there’s no way to know why four extremist justices dissented from the lifting of the injunction—and it conceivably could have been because the full matter will be taken up shortly anyway by the Fifth Circuit in February—the impression it has left is unmistakable.

As CNN legal analyst and University of Texas law professor Steve Vladeck observed, “Whatever one thinks of current immigration policy, it ought not to be that controversial that states cannot prevent the federal government from enforcing federal law—lest we set the stage for Democratic-led states to similarly attempt to frustrate the enforcement of federal policies by Republican presidents.” He added, “That four justices would still have left the lower-court injunction in place will be taken, rightly or wrongly, as a sign that some of those longstanding principles of constitutional federalism might be in a degree of flux.”

In response to the loss before the Supreme Court, a spokesman for Abbott put out a statement claiming that the “absence of razor wire and other deterrence strategies encourages migrants to make unsafe and illegal crossings between ports of entry.” He added that the governor “will continue fighting to defend Texas’ property and its constitutional authority to secure the border.”

But this assertion about unsafe crossings was disputed by federal officials, underscoring the need for a single government policy. Said a White House spokesperson, “Enforcement of immigration law is a federal responsibility. Rather than helping to reduce irregular migration, the State of Texas has only made it harder for frontline personnel to do their jobs and to apply consequences under the law. We can enforce our laws and administer them safely, humanely, and in an orderly way.”

This was for now only a battle over a temporary injunction. The Fifth Circuit will next consider the full case in February, incluing whether to lift the injunction permanently. But it will do so with an understanding that five SCOTUS justices view Texas as unlikely to succeed on the merits. An appeal back up to the Supreme Court is likely, no matter which side prevails at the appellate level.

On October 25, after several weeks that saw dysfunction, chaos, humiliation, and anonymous threats to at least one lawmaker’s wife, Republicans finally elected a Speaker of the House to succeed Kevin McCarthy: Mike Johnson, a representative from Louisiana who has the distinction of being the least experienced Speaker in more than a century.

At the time of Johnson’s accession, a lot of Americans likely had no idea who he was; actual Republican senator Susan Collins, for one, told a reporter she didn’t know Johnson but planned to remedy that by googling him. And if you weren’t familiar with Johnson, you might’ve assumed that that was maybe even a good thing—that he was just a quiet Republican who hadn’t gotten wrapped up in the insanity plaguing the GOP over the last seven or so years. He didn’t have the name recognition of, say, Jim Jordan or Matt Gaetz, but perhaps that simply spoke to the fact that he wasn’t leading a series of absurd hearings in an attempt to take down Joe Biden; or bragging about being so devoted to Donald Trump that he answered his phone calls during sex. Maybe, you might have thought, he wasn’t someone you’d have to constantly worry about re: undermining democracy or trying to take away people’s rights.

Unfortunately, that is not the case with Johnson, who may not have been well known prior to being given one of the most powerful jobs in government but is very much someone whose extremist views and actions should keep you up at night.

Herein, a running list of the absolute most WTF things the new Speaker has said and done on everything from the 2020 election to abortion to LGBTQ+ rights and more.

Abortion

Johnson is proudly antiabortion. When Roe v. Wade was overturned last year, he called it “a great, joyous occasion,” later writing, “We will get the number of abortions [in Louisiana] to ZERO!!” As an attorney for the Alliance Defense Fund, now known as the Alliance Defending Freedom, he worked on efforts to shut down abortion clinics in the state. In Congress, he cosponsored legislation that would have banned abortions at about six weeks of pregnancy, i.e., a time when many people do not even know they’re pregnant. He’s beloved by the antiabortion organization Susan B. Anthony Pro-Life America, which has given him an A+ rating. In 2015, he blamed school shootings on abortion, telling writer Irin Carmon, “When you break up the nuclear family, when you tell a generation of people that life has no value, no meaning, that it’s expendable, then you do wind up with school shooters.”

In some real Handmaid’s Tale shit, he declared during a House hearing that if women were forced to have more children, a.k.a. “able-bodied” workers, there would be more funding for Social Security and Medicare:

Oh, and like many antiabortion zealots, Johnson doesn’t seem to like contraception either.

LGBTQ+ rights

Hoo boy, where to start? Here are some things that Johnson has said about LGBTQ+ people, same-sex marriage, and gay sex between consenting adults:

In his work as an attorney for the Alliance Defense Fund, Johnson also argued in court that same-sex couples should not receive domestic partnership benefits, and officially opposed the Supreme Court’s decision to decriminalize gay sex between consenting adults. In the Louisiana House of Representatives, he proposed a bill that critics say would have made it easier to discriminate against LGBTQ+ people. (In response, he claimed he was not a “bigot,” adding: “I know that I brought this bill for the right reason.”) Meanwhile, in Congress, he introduced a national bill seemingly modeled after Florida’s “Don’t Say Gay” law; voted against the 2022 bipartisan bill to codify gay marriage; and last year cosponsored a bill making it a crime to provide gender-affirming care to anyone under 18, despite the American Academy of Pediatrics backing such care.

“I would be hard-pressed to think of a worse member to be elected Speaker of the House,” Allen Morris, policy director for the National LGBTQ Task Force, told The 19th.

Separation of church and state

If you guessed that Johnson doesn’t believe in it, you guessed right. In April—as in, just a few months before he was elected Speaker—the congressman railed against what he referred to as the “so-called separation of church and state,” saying, “The founders wanted to protect the church from an encroaching state, not the other way around.”

In 2018, Johnson argued for prayer in public schools.

Evolution

In addition to blaming abortion for mass shootings, Johnson has also claimed that the teaching of evolution has played a part. In a 2016 sermon, he told the audience, “People say, ‘How can a young person go into their schoolhouse and open fire on their classmates?’ Because we’ve taught a whole generation—a couple generations now—of Americans, that there’s no right or wrong, that it’s about survival of the fittest, and [that] you evolve from the primordial slime. Why is that life of any sacred value? Because there’s nobody sacred to whom it’s owed. None of this should surprise us.”

In related news, a year prior, Johnson filed a lawsuit for an organization to receive tax subsidies to build a Noah’s Ark–focused theme park in Kentucky. “When the Ark Project sails, everybody will benefit,” he wrote in an op-ed, “even those who are stubbornly trying to sink it.” The Ark Encounter is operated by a fundamentalist Christian group that believes in creationism.

Climate

Where does Johnson, not exactly a man of science, land on global warming? Well, per The New York Times:

Representative Mike Johnson of Louisiana, the newly elected House Speaker, has questioned climate science, opposed clean energy, and received more campaign contributions from oil and gas companies than from any other industry last year. Even as other Republican lawmakers increasingly accept the overwhelming scientific consensus that human activity is dangerously heating the planet, the unanimous election of Mr. Johnson on Wednesday suggests that his views may not be out of step with the rest of his party.

A former constitutional lawyer, he does not sit on committees that decide the fate of major energy issues. But he has consistently voted against dozens of climate bills and amendments, opposing legislation that would require companies to disclose their risks from climate change and bills that would reduce leaks of methane, a potent greenhouse gas, from oil and gas wells. He has voted for measures that would cut funding to the Environmental Protection Agency.

In 2017, Johnson opined: “The climate is changing, but the question is, is it being caused by natural cycles over the span of the earth’s history? Or is it changing because we drive SUVs? I don’t believe in the latter. I don’t think that’s the primary driver.”

The 2020 election

By now you’ve likely heard that Johnson spent a significant amount of time and energy trying to overturn the 2020 election—an effort that included leading the amicus brief signed by more than 100 GOP lawmakers that asked the Supreme Court to overturn the 2020 election results in Georgia, Michigan, Wisconsin, and Pennsylvania. Johnson also objected to the certification of Biden’s win on January 6; his arguments for doing so were adopted by a significant number of Republicans, leading the Times to call him “the most important architect of the Electoral College objections.” One day prior, per Politico, he told colleagues, “This is a very weighty decision. All of us have prayed for God’s discernment. I know I’ve prayed for each of you individually,” before pressing them to oppose the Electoral College results. Oh, and he was a Dominion truther:

MAGAMike often pretends as if the his interpretation of the Bible, not the Constitution or the Declaration of Independence, were our founding document. 

But, believe it or not, the founding fathers were actually “revolutionaries,” not “reactionaries,” who overthrew tradition to arrive at a different place. In the process they incorporated what in those days were some “enlightenment” ideals to replace “traditionalist” regressive principles like the “divine” right of kings and a purely hierarchical society where there was no escape from the status assigned at birth!

One can debate the exact religious beliefs of the founders. But, they certainly foresaw a non-static society, open to change, and tolerating more than one viewpoint. They weren’t theocrats, and they weren’t wedded to the view that society can’t change and evolve to adapt to new norms and practical realities.

One could read the teachings of Christ as promoting love, kindness, tolerance, forgiveness, perspective, and siding with society’s outcasts. MAGAMike and his zealots appear to have a quite different “take.” That’s their prerogative. But, they shouldn’t be allowed to impose their peculiar, wayward views on the rest of us.

Faced with his first national tragedy, and a chance to show some real guts, leadership, and humane, common-sense principles derived from Christianity, all the self-professed “Man of God” and “protector of the unborn” (but “rejector of the  born”) could muster was the same old trite “hearts and minds” garbage that flows from spineless GOP politicos. Compare MAGAMike with Rep. Jared Golden (D-ME) who apologized and changed his position to favor an assault weapons ban. Rep. Mike Johnson, the newly elected House speaker, has repeatedly flirted with what’s known as the “great replacement theory,” the idea that Democrats are scheming to supplant American voters with immigrants. The Louisiana Republican’s views show how fringe conspiracy theories have gone mainstream in the Republican Party at the highest levels of power.

“This is the plan of our friends on this side — to turn all the illegals into voters,” Johnson said at a congressional hearing in May 2022, gesturing at Democrats. “That’s why the border’s open.”

The “open borders” trope is a lie, and while a few municipalities allow voting for noncitizens in local elections, in no sense do national Democrats have any such “plan” for “all the illegals.” As far as I can determine, no House speaker in recent memory has been quite as reckless and incendiary with this kind of language.

Johnson employs it regularly. He reiterated the claim in an interview this year with the right-wing outlet Newsmax, accusing President Biden of “intentionally” encouraging undocumented migration to “turn all these illegals into voters for their side.” On numerous other occasions, he has made similar charges, even declaring that Democrats’ express goal is the “destruction of our country at the expense of our own people.”

On immigration, as well as on abortion and gay rights, Johnson’s elevation is a triumph for the far right. It has been widely noted that Johnson doesn’t come across as a MAGA bomb-thrower, despite his extreme views. That’s true on immigration, too: He voices high-minded platitudes about how providing asylum to the persecuted is a noble ideal, but he’s a big booster of the wildly radical House GOP border bill that would functionally gut asylum entirely.

The pro-immigrant group America’s Voice, which tracks lawmakers’ positions on the issue, has not documented any comparable rhetoric in Johnson’s predecessor, Rep. Kevin McCarthy. “Johnson has gone farther than most of his Republican colleagues in elevating alarmist and dangerous rhetoric,” says Vanessa Cardenas, the group’s executive director.

Other predecessors, such as John A. Boehner and Paul D. Ryan, were supporters — nominally, at least — of reforms that would legalize large numbers of undocumented immigrants, though they ultimately failed to deliver. Not even Newt Gingrich, the most extreme House speaker of the modern era, went as far as Johnson, says Nicole Hemmer, author of a history of conservatism in the 1990s.

“Even at his most anti-immigrant, he spoke largely in fiscal and law-and-order terms,” Hemmer told me, while eschewing the “eliminationist rhetoric” at the core of great replacement theory.

Yet little by little, those more extreme ideas have penetrated GOP leadership circles. In 2021, Rep. Elise Stefanik (N.Y.), a top House Republican, charged Democrats with scheming to replace conservative voters with Democratic-leaning immigrants.

Saturday, at the 12th hour, GOP Speaker Kevin McCarthy (D-CA) finally did the obvious — reached out to Dems to save America from insurrectionist, anti-American GOP extremists by passing a last-minute continuing resolution that will fund American government until Nov. 17. 

All Dems except one (who was protesting the GOP’s pro-Putin defunding of Ukraine aid) voted for the House bill, while 90 GOP insurrectionists voted to tank America and manufacture a needless crisis. The bill passed the nominally Dem-controlled Senate in about 30 seconds, and was signed by President Biden before midnight. The message about which party is serious about governing for the common good is obvious to all real patriots, even if a shocking number of GOP voters have foisted these far-right GOP clowns upon the rest of us.

The mainstream media uses the namby-pamby misnomer “border security,” to refer to the GOP’s proposed racist-nativist attack on immigration, destruction of the long-established right to asylum, and bogus attempts to reinstate “proven to fail,” draconian deterrence measures. As happened when tried unsuccessfully in the past, the GOP would turn over control of border migration policies to cartels, smugglers, and organized crime, while deflecting attention and undermining law enforcement efforts to control human and drug smuggling. 

A true accounting for the GOP extremist agenda would clearly show how firmly on the side of Putin and border bandits today’s dangerous, “destroy America” GOP has become. Too bad the so-called “mainstream media” has so little interest in digging beyond the cosmetics on the border issues and Ukraine aid.

The mainstream media is also salivating about the bogus prospect of MAGA-maniac Matt Gaetz (R-Outer Space) unseating McCarthy. In perhaps the ultimate example of clueless, Fox News inspired, “mainstream journalism,” CBS’s “This Sunday” saw fit to inflict Gaetz and his bombastic nonsense on hapless viewers today. NBC, on the other hand, maybe still smarting from new-host Kristen Welker’s disastrous, totally uncalled for, “inaugural” interview with a raving, incoherent, lie-spouting Trump, gave us wall-to-wall coverage of the Ryder Cup in place of “Meet the Press.” Honestly!

Look forward to more clownish theatrics and anti-American posturing from the GOP and their “Chief Clown” Trump, and more insipid reporting from the mainstreamers as America careens toward another likely GOP-generated “crisis” in mid-November. It’s NOT a “Washington problem! It’s purely a GOP that lacks any interest whatsoever in responsible governing.

On Saturday, Donald Trump conducted the second formal rally of his campaign — in Pickens, South Carolina, where an estimated 50,000 turned up under the scorching sun to hear him.

There, he advanced his version of patriotism based on White Christian Nationalism.

He began by celebrating the town’s namesake, Francis Pickens, who was governor of South Carolina when it was the first to secede from the Union on the eve of the Civil War. Trump assured the crowd he wouldn’t let “them” change the town’s name.

He commended the Supreme Court for rejecting affirmative action “so someone who has not worked as hard will not take your place.”

He saluted the court’s decision to overrule Roe v. Wade so “radical left Democrats will not kill babies.”

He promised to stop “men competing in women’s sports” and prevent classroom teachers from teaching the “wrong” lessons about sexuality or history.

He condemned foreign governments that “send” over the border “people in jails and insane asylums” and promised to deny entry to “all communists and Marxists.”

And he declared America’s most dangerous opponents not to be Russia, China, or North Korea but “enemies within” America.

Rubbish.

The true meaning of patriotism is the opposite of Trump’s exclusionary White Christian Nationalism.

America’s moral mission has been toward greater inclusion — providing equal rights to women, Black people, immigrants, Native Americans, Latinx, LGBTQ+, Muslim, Jewish, atheist, and agnostic.

True patriots don’t fuel racist, religious, or ethnic divisions. Patriots aren’t homophobic or sexist.

Nor are patriots blind to social injustices — whether ongoing or embedded in American history. They don’t ban books or prevent teaching about the sins of the nation’s past.

True patriots are not uncritically devoted to America. They are devoted instead to the ideals of America — the rule of law, equal justice, voting rights and civil rights, freedom of speech and assembly, freedom from fear, and democracy.

True patriots don’t have to express patriotism in symbolic displays of loyalty like standing for the national anthem and waving the American flag.

They express patriotism in taking a fair share of the burdens of keeping the nation going — sacrificing for the common good.

This means paying taxes in full rather than lobbying for lower taxes or seeking tax loopholes or squirreling away money abroad.

It means refraining from making large political contributions that corrupt American democracy.

It means blowing the whistle on abuses of power even at the risk of losing one’s job.

And volunteering time and energy to improving one’s community and country.

Nor is patriotism found in baseless claims that millions of people vote fraudulently. Or in pushing for laws that make it harder for people to vote based on the Big Lie that the 2020 election was stolen.

Patriotism lies instead in strengthening democracy — defending the right to vote and ensuring more Americans are heard.

Patriots understand that when they serve the public, their responsibility is to maintain and build public trust in the institutions of democracy.

They don’t put loyalty to their political party above their love of America. They don’t support an attempted coup.

They don’t try to hold onto power after voters have chosen not to reelect them. They don’t make money off their offices.

When serving on the Supreme Court, they recuse themselves from cases where they may appear to have a conflict of interest. They don’t disregard precedent to impose their own ideology.

America’s problem is not as described by Trump and his White Christian Nationalism — that the nation is losing its whiteness or dominant religion, that too many foreigners are crossing its borders, that men are competing in women’s sports or teachers are not celebrating the nation’s history.

America’s problem is that too many Americans — including its lawmakers — are failing to understand what patriotism requires.

In recent years, the [GOP’s] blind loyalty to Trump’s radicalism – especially his election lies – has caused it to even challenge the structure of democracy. A sense of national crisis and imminent political extinction, for example, ran through Trump’s rhetoric in the aftermath of the 2020 election, prompting some of his followers to use violence as a way of settling their political grievances on January 6, 2021.

Conservative Supreme Court decisions over the last two years have been especially hard for liberals to accept because they believe that the current majority is ill gotten.

The right’s dominance of the court happened in large part because then-Senate Majority Leader Mitch McConnell refused to even grant a confirmation hearing to Obama’s final pick for the top bench, Merrick Garland, who now serves as attorney general in the Biden administration. This allowed Trump to name Justice Neil Gorsuch as his first Supreme Court nominee in 2017. But McConnell later turned his back on his own questionable principle that Supreme Court nominees should not be elevated in an election year by rushing through the confirmation of Trump’s final pick, Amy Coney Barrett, in 2020 – which enshrined the current 6-3 conservative majority.

The move not only confirmed Trump’s status as a consequential president whose influence will be felt decades after he left office. It cemented McConnell among the ranks of the most significant Republican Party figures in decades and ensured conservative policies will endure even under Democratic presidencies and congressional majorities.

Recent revelations about questionable ethics practices by some of the conservative justices have further fueled fury about the legitimacy of the court among liberals.

But not all of the court’s recent decisions have infuriated the White House and Democrats. Earlier this week, for instance, liberals were hugely relieved when the court rejected a long-dormant legal theory that held that state courts and other state entities have a limited role in reviewing election rules established by state legislatures when it comes to federal elections. The so-called Independent State Legislature Theory, a favorite of the Trump campaign, had led to fears that Republican state legislatures in some states could simply decide how to allocate electoral votes regardless of results.

Still, the broad trajectory of the court – on issues including gun control, race, business, regulation, climate and many other issues – is firmly to the right.

It’s no coincidence that the Trumpist far-right assault on democracy began during the 2016 campaign with unprovoked attacks on Mexican migrants and bogus claims about the border and immigration. It was skillfully, if corruptly, followed up with weaponization of the immigration bureaucracy and packing of the Immigration Courts by the likes of Miller, Sessions, Barr, and Cooch. 

We have seen the GOP’s assault and dehumanization of migrants carry over into attacks on a wide range of disadvantaged groups in American society including African-Americans, Hispanic-Americans, Asian-Americans, Muslim-Americans, women, the LGBTQ+ community, and many others.

Although the Supremes have held that every “person” in the United States is entitled to due process under law, that concept is ludicrous as applied to the U.S. Immigration Courts, where anti-asylum, anti-immigrant, pro-DHS bias still drives much of the decision making, prosecutors appoint the judges and write the rules, the Government can change results that don’t match its political agenda, and individuals are on trial for their lives without a right to appointed counsel or many times even the ability to fully understand the proceedings against them. Predictably, the overwhelming number of individuals stuck in this abusive system are persons of color, many women and children!  

This is “colorblind” American justice? Gimmie a break!

Although Dems acknowledged many of these outrageous defects in the Immigration Courts while campaigning for votes in 2020, once in power, they have shown little inclination to correct this unacceptable situation that undermines our democracy.

In particular, given a chance to reform the Immigration Courts, re-compete on a merit basis judicial positions filled under questionable procedures (at best) during the Trump Administration, bring in competent judicial administrators laser-focused on due process and best practices, and remake the Immigration Courts into a bastion of great progressive judging —  driven by due process and equal protection, Garland and the Dems have whiffed. In that way they have largely followed the Obama Administration’s failure to take seriously due process for persons who happen to be in Immigration Court. 

The failure of Dems to take immigrant justice seriously, and their inexcusable blown opportunity to reshape the Immigration Courts into a training and proving ground for the best and most qualified candidates for Article III judgeships ties directly into the anti-democracy shift in the Article IIIs and the GOP’s ability to carry out its right-wing agenda through a Supremes majority highly unrepresentative of Americans and our values.

An informed observer might well wonder “If the Dems are unwilling and unable to reform and improve the Federal Courts they do control — and apparently are ashamed of the progressive values they espouse — how will they ever counter the right’s anti-democracy agenda?”

Unfortunately, the ridiculously short 30-day comment period and that this major reversal of the positions and values that Biden and Harris campaigned upon, without meaningful input and discussion with experts who actually understand the borders and have been present there, indicates that the the comments are likely to be largely ignored. That’s going to lead to big time litigation — from both progressives and GOP nativist/restrictionists. 

But, discouragingly, the Biden Administration has shown itself to be willing to tie up time and resources insanely (and not necessarily successfully) doing battle with its own would-be supporters rather than fighting the right! Just who they think is going to be the “winner” here — other than, perhaps, Donald Trump and Jim Crow  — is beyond me!

House Republicans, led by loudest maniac Jim Jordan, had high hopes of stealing some of President Joe Biden’s thunder after his historic surprise trip to Kyiv, Ukraine. “Oh, yeah,” you could hear them squeaking. “We’ll show him.” So in the best tradition of nativist, isolationist know-nothingism, they headed for the southern border to put on a show of hunting for the crisis of the hordes invading “our” country. What they got was … not that.

“As they rumbled along the entry port of San Luis, a dam along the Colorado River and more desolate sections of the U.S. border between Arizona and Mexico, though, their search came up empty,” a reporter on the scene described. “Hours later, immigration officials would spot a group crossing north, but it was long after Congress members had retired for the night.”

This was part of what they’re calling a “field hearing” by the House Judiciary Committee, explaining Jordan’s, ahem, leadership. (Seriously, they need to rethink having this guy as their mascot. Does anyone, could anyone, find this guy compelling?) The “convoy” included “more than a dozen congressional Republicans, a large contingent of staffers and a handful of reporters.” Having turned the trip into some kind of sick safari, the group thwarted their own goal.

“Jordan’s group was told that around 4,000 immigrants cross the U.S. border near Yuma each day, but its conspicuous presence thwarted the expedition’s goal of spotting immigrants attempting an unobtrusive entry.” You don’t say. They did spot a bus parked across the border, however. No one came out of it to make a run for the border.

No Democrats participated in what ranking committee Democrat Jerry Nadler called a “stunt hearing,” though he did say that some Democrats from the committee would go to the border next month to to “hear from the community and government officials on the ground.”

The big convoy also help put the lie to the GOP’s government spending obsession. This is the third trip to the border by some contingent of GOP House members in the new Congress, with Barely Speaker Kevin McCarthy having already gone to try to score points, as well as members of the Energy and Commerce Committee.

The Homeland Security Committee has what they’re calling a “border bootcamp” for Republican freshmen members, and the Oversight Committee has plans to go in the near future, too. That’s one way to stop illegal crossings: Just keep sending down convoys of GOP representatives to play border patrol.

All that’s pretty expensive. The GOP Judiciary Committee alone has requested $262,400 for travel this session. In 2022, with Democrats in charge of the committee, they spent $7,986.

When it comes to actual border policy rather than publicity and preening, they’ve got nothing. Or rather they’ve got an interparty fight, as Gabe Ortiz reported. Their first go at an immigration bill “was so extreme it derailed itself, after so-called moderates refused to sign on.”

If the GOP were really serious about cutting wasteful spending, they could “ground” Jordan and his traveling White Nationalist circus!

Notably, however, JJ is one of the few politicos in either party to endorse (somewhat tepidly) Biden’s totally ill-advised proposal to “deter” refugees from fleeing their countries (actually, that’s what refugees “do”) and invoking their right to seek asylum. Why would a Dem President curry favor for his border policies from an anti-democracy, White Nationalist, election-denying blowhard, eschewing the rule of law, human decency, and the expert advice of many who voted for him in the process? Got me on that one! 

“The White House must be really proud of getting endorsements from guys like Jordan and Chad Wolf (a/k/a “Wolfman”),” one human rights wag reportedly quipped!

Democrats! Has there ever been a more frustrating party when it comes to human rights, backbone, and carrying out promises, not to mention using the brainpower and resources available to solve problems, rather than lamely “gimmicking” them? Honestly!🤯

In a (perhaps unexpectedly) shrewd move, House Judiciary Dems took a pass on this GOP clown show. It would be a good idea, however, for Dems to go to the border, without the Ringling Bros, Barnum & Bailey act, observe the human carnage caused by the wrong-headed (not to mention illegal) approach of the last two Administrations, and interact with some of those humans affected, including asylum seekers, local officials, residents, dedicated advocates, and NGO personnel. The latter two have been about the ONLY ones trying to uphold the rule of law and to inject some common sense and much needed humanity into this unnecessarily chaotic situation caused by our Government’s abandoning our legal and moral obligations toward those fleeing persecution — over two Administrations.

Before craziness and chaos engulfed the House of Representatives in the saga of electing a new speaker, a Kodak moment provided a vivid portrait of the relative health of our two major political parties and our nation as a whole.

There stood Nancy Pelosi raising the gavel for the last time as speaker in front of the imposing scroll-back chair from which she had wielded power. Her job at that moment was purely ceremonial — closing the 117th Congress — but the symbolism was poignant. It marked an end to a Congress of action and accomplishment and the beginning of an era of performative pandemonium. The gavel stood there in mid-air like a baton with no one to accept it.

In the reporting on Kevin McCarthy’s travails for gaining the speakership, many have noted how small his majority is, how he can afford to lose only a few votes, and that therein lies his major problem. But as others have pointed out, Pelosi had a small majority in the last Congress — yet she maintained unity in her party and ran the House with efficiency and precision, and to great effect.

The dumpster fire we are witnessing now has been smoldering for years, if not decades. It is what happens when people elect representatives who actively hate the idea of governance. It is what happens when people rack up victories with Fox News rants and not legislation. It is what happens when a quest for power means you’re willing to yield and appease everyone and everything that can help you secure it.

To be sure, crooks, cranks, and malevolent embarrassments have not been the exclusive purview of any one political party over the years. The nature of democracy is that it can be very messy; in moments of passion, fear, or even apathy, it can sweep into office all manner of men and women who have no business being there. The idea of a legislature, however, is that the whims, idiosyncrasies, and destructive instincts of a few can be tempered by the many. Obviously that is not what is happening now.

There is a tendency among some in the beltway press to frame this as a battle of the political extremes, how the far right is undermining Republican initiatives. In this analysis there is often a perfunctory “both sides” mention of the political left, which also supposedly threatens the “center” and the ability to govern.

This simplistic framing misses the mark at this moment. On the Republican side, it is not clear what the renegades want, other than to figuratively burn down the house (or House). Some have specific demands, and McCarthy has caved more than a spelunker. But it’s still not good enough. Furthermore, these demands are almost exclusively about process and not policy. It’s about allowing a nihilistic minority to foment perpetual mayhem, thereby undercutting the debate and responsible compromise that should be the business of Congress. Ultimately, it’s about accommodating Steve Bannon and not delivering for constituents.

There is no analogous movement on the left. Even if one disagrees with the policy positions of the so-called progressive wing of the Democratic Party, ultimately those members of Congress are almost all institutionalists — in that they believe in the idea and work of the legislative branch of government. They understand that you need a speaker for the House to function, so they backed Pelosi. They left the debates and disagreements for individual bills and votes. That, by the way, is how the Founders envisioned it.

But this isn’t just about Pelosi, as formidable as her leadership skills were. The Democrats also have rallied around her successor, Hakeem Jeffries of New York, who occupies more of the moderate middle of the party. As Republicans embarrass themselves on the national stage with rounds and rounds of votes, the Democrats have held steady in unity behind Jeffries. It’s an impressive show of discipline for a political party that was once mocked (including by Democratic members of Congress) for having all the herding instincts of cats.

As much as this spectacle is gaining the attention of the American people, make no mistake that it is being watched with keen eyes around the world — by our friends and foes alike. Our allies wonder, especially in the wake of the last administration, whether they can count on America. Will these renegades blow up the world economy by defaulting on American debt? Will they pass a budget? Will they support Ukraine? Will they actively continue to undermine America’s democratic traditions?

Meanwhile, in places like Moscow, Beijing, Tehran, and Pyongyang, despots, autocrats, and dictators are cheering our divisions and the distance they create between our national ideals and our political reality. In moments of instability in Washington, the entire world becomes more dangerous. Not that the Republican holdouts care.

The public debasement of House Republicans may make for great schadenfreude viewing for Democrats. Some literally broke out the popcorn in the House chamber. But ultimately this is a sad moment for our country. We need strong political parties that believe in negotiating, legislating, and governing. We need individual congresswomen and men of decency and integrity. We need strength and thoughtfulness to tackle our myriad problems.

We need a Congress, not a circus.

Don’t expect the “Party of Insurrection & Putin” to come around. Even assuming that McCarthy eventually prevails (not by any means a “safe bet”), he is totally compromised as a leader. Any other candidate would be in a similar weak position.

MILWAUKEE — Wisconsin Gov. Tony Evers (D) won reelection Tuesday by 3.4 points. That’s a landslide in a state where four of the past six presidential contests were decided by less than one point and the first time since 1990 that a Badger State governor was reelected from the same party that controlled the White House. For a Democrat, it’s the first time since 1962.

Evers, a former schoolteacher who derives pleasure from euchre and polka music, was rewarded by independents for his stalwart defense of voting and abortion rights. “As it turns out,” Evers said in his victory speech, “boring wins.”

The race was a bit more complicated than that. Republican challenger Tim Michels, who won the August primary because of an endorsement from former president Donald Trump, promised to abolish the bipartisan Wisconsin Election Commission, sign nearly 20 restrictive voting bills that Evers had vetoed and opened the door to not certifying the 2024 presidential results. “Republicans will never lose another election in Wisconsin after I’m elected governor,” Michels declared at a campaign stop on Oct. 31.

Evers said some Democratic strategists suggested that he not talk about democracy on the trail because the term is too broad and abstract, but he emphasized voting rights anyway. “I think Wisconsinites get it,” he said. The governor ran as a check and balance on GOP extremism, boasting that he vetoed a record 126 bills over the past two years, and warned that Michels would be a rubber stamp for a Republican legislature.

Independents made up 30 percent of the electorate, according to exit polling, and Evers won them by six points. Several said during interviews that they are uncomfortable with one-party rule at the federal or state level. Gerrymandering has made it virtually impossible for Democrats to win control of the state Assembly or Senate.

Abortion also mattered: An 1849 state law banning the procedure was dormant until the Supreme Court struck down Roe v. Wade in June. With providers fleeing to Illinois, Evers offered clemency to anyone convicted of providing care and called special sessions to (unsuccessfully) pressure Republicans to update the law. Michels said he was unapologetically pro-life and that the 1849 ban mirrored his position. Later, he suggested he would sign a bill to add exemptions for rape and incest.

This issue drove a massive turnout spike in liberal Dane County, home to the University of Wisconsin-Madison. Evers won about 16,000 more votes from the county than in 2018.

Statewide, about one-third of voters identified abortion as their top issue, and Evers won 84 percent of them. According to exit polls, only 8 percent of the electorate said abortion should be illegal in all cases while 62 percent said it should be legal in most or all cases. Evers won women by 13 points.

Democrats benefited from Trump fatigue. While nearly 54 percent of voters disapproved of Biden, 58 percent held an unfavorable view of the former president. In fact, exit polling shows about 30 percent said opposing Trump was a reason for their vote, which is stunning when you consider that he hasn’t been president for two years.

This California town ran its Chinese residents out. Now the story is finally being told

EUREKA, Calif. —  Beauty drew Brieanne Mirjah D’Souza to Eureka.

In 2018, she and her husband — Michigan natives who had been living for a spell in the Bay Area — moved up to this chilly old timber town to build a life beneath the redwoods and by the sea.

But last winter, pregnant with her first child, D’Souza began reflecting on this pretty place she would bring her son into.

D’Souza, a 32-year-old digital marketer, is of Chinese and West Indian descent. And Humboldt County is very white.

As D’Souza’s belly grew and the headlines told of a dramatic surge in anti-Asian hate crimes amid the COVID-19 pandemic, D’Souza set out to find other people who looked like her.

A fledgling group started meeting over Zoom and trading emails. They learned there had once been a Chinatown in Eureka. Maybe they could commemorate it with a plaque, they figured.

But where had it gone?

In the late 19th century, Chinatown occupied a single block in the middle of the remote, misty port town.

A few hundred Asian immigrants — mostly men — lived in Eureka after a federal law barred immigration from China in 1882.

They toiled in redwood logging camps, laundries and restaurants. They were nannies and household servants and vegetable growers. They were former gold prospectors priced out of the work because of a predatory state tax on foreign miners.

When the economy soured in the 1880s, white people blamed them, claiming they stole jobs. Newspapers whipped up anti-Chinese sentiment.

“There were a lot of stereotypes: that Chinese people were diseased, they were morally corrupt, they would not assimilate to the rest of American society at the time,” said Katie Buesch, a former director and curator at the Clarke Historical Museum in Eureka.

That sentiment was par for the course in the Golden State at the time.

Some California city officials are now acknowledging the ugly past — a counter-movement to red-state politicians pushing to ban books and limit the teaching of history that involves race.

Antioch and San Jose apologized last year for burning their Chinatowns in the late 1800s. San Francisco apologized for barring Chinese children from public schools.

Los Angeles is working on a memorial to commemorate an 1871 massacre in which at least 18 Chinese people were fatally shot or hanged. And in Pacific Grove earlier this year, organizers canceled a pageant that had long featured performers in yellowface.

In Humboldt County, Buesch, who had put together a small museum exhibit on Eureka’s Chinese community just before the pandemic, was struck by an 1885 article in the Daily Times-Telephone newspaper about Chinatown.

“The time has come when these plague spots should be removed,” the newspaper wrote.

On Feb. 5, 1885, the newspaper, which called the Chinese neighborhood a violent, drug-addled “leper’s colony,” wrote that it would probably be “goodbye to Chinatown” if an “unoffending white man” were killed there.

The very next day, a white Eureka city councilman who lived near Chinatown was walking past. Shots rang out between what is said to be two Chinese men, although details are scant. A stray bullet killed the councilman.

An angry mob of more than 600 white people — loggers, fishermen, miners and merchants — filled the streets, said Jean Pfaelzer, author of “Driven Out: The Forgotten War Against Chinese Americans.”

A gallows was erected. An effigy of a Chinese man swung from a noose.

Someone suggested slaughtering the Chinese, but that was deemed un-Christian, Pfaelzer said. Others said they should burn Chinatown, but its scrap wood buildings belonged to a white man, since the Chinese were not allowed to own property.

They instead appointed a committee of 15 men to go into Chinatown and order everyone to leave. The sheriff commissioned wagons to gather their belongings. Armed vigilantes roamed on horseback.

The next morning, about 300 Chinese people were marched to the wharf and eventually loaded onto two steamships: The Humboldt and The City of Chester.

They were shipped to San Francisco, where no one knew they were coming, Pfaelzer said. They disembarked and fled.

A few dozen sued the city of Eureka, but a judge tossed out their lawsuit.

The purge, which became known as the “Eureka method,” was copied in other towns across California and hailed by white people as nonviolent.

By 1890, the business directory for Humboldt County was boasting that it was “the only county in the state containing no Chinamen.” A Eureka law, in effect until the mid-20th century, banned Chinese people from working in the city.

In the spring of 2021, a gunman killed eight people, including six women of Asian descent, at three Atlanta-area spas.

The shootings sparked an outpouring of activism and calls to #StopAsianHate. They followed months of heightened attacks on Asian Americans amid a political climate in which then-President Trump was calling the coronavirus the “Chinese virus” and “kung flu.”

Around that time, D’Souza had set up an Instagram account she called APA Humboldt.

D’Souza quickly heard from a local group of Asian Americans who had organized a series of Japanese taiko drum performances before the pandemic.

They began meeting virtually. Their numbers grew. There was a real hunger for community in this county where only 3% of the population is Asian or Pacific Islander.

The group delved into local history, poring through legal briefs, census data, letters, maps and journals to piece together the little-known story of Eureka’s Chinatown, which had been told mostly from a white perspective.

“We all had an awakening of sorts,” D’Souza said. “There was no awareness that there was once a thriving Chinese community here … and they faced the same kind of discrimination and racism that we’re still facing today.”

D’Souza figured they would install a plaque before her baby came, and that would be that.

But what became known as the Eureka Chinatown Project — the work of the group now called Humboldt Asians & Pacific Islanders in Solidarity — blossomed.

With support from the city, they erected signs describing the expulsion in Historic Chinatown — which, today, is a downtown business district with banks, parking lots and no trace of the neighborhood that once stood.

There are plans for a monument.

And — with a mural and a renamed roadway — the Eureka Chinatown Project honored two local Chinese American pioneers whose legacies were too little known.

We can’t build for a better future on the positive foundations of America without honestly acknowledging, discussing, and addressing the racism and injustices of the past. The GOP “history deniers” are hamstringing our nation!

DeSantis is every bit the charlatan, flim-flam man, would-be theocrat, and purveyor of a whitewashed version of US “history that never was” as Trump. (Concededly, unlike Trump, he actually has won the popular vote in elections.) Under our system, if Floridians have the colossal bad judgement to elect him, that’s their call (although at some point, it could get tiresome for the rest of us to keep bailing them out). But, they have no right to inflict him on the rest of our nation. For the sake of democracy, humanity, and integrity, the rest of us must insure that DeSantis remains where he belongs — below the “Florida-Georgia line.”

During her victory remarks on Tuesday night, Spanberger spoke of her “deep and abiding love for the country” and a “profound sense of responsibility.” The former CIA agent reiterated that the country was founded on “a dream” that it need not bound by the past or be ruled by kings and queens. Quoting Benjamin Franklin’s admonition that the constitutional convention delivered a republic “if you can keep it,” she declared, “We must all work hard to keep it.”

As a moderate, Spanberger has managed to balance fidelity to Democratic causes such as investment in green energy and the preservation of abortion rights with an independent, reform-minded streak that sometimes put her at odds with party leadership. (Speaker Nancy Pelosi, for example, has not allowed a floor vote on Spanberger’s bill that would ban House members and their spouses from holding individual stocks.)

With this win, Spanberger reaffirms her status as a rising star in the party. Her formula — bipartisan problem solving, strong national security credentials, anti-corruption crusading and support for women’s reproductive rights — has proved successful. But she also had another advantage: a Democratic record of legislative success, including the infrastructure bill, the Chips and Science Act, an expansion of veterans’ health care and measures to reduce prescription drug prices.

By sharp contrast, the GOP has no known values: divide, bully, lie, demean, hate, misinform, blame, deny, discriminate, humiliate, oppress, smear, shame. Those aren’t values: just highly negative attributes!

The GOP did claim concern about inflation and the economy. But, they offered no coherent plan for addressing it in any practical, bi-partisan manner.

Instead, they promised to wreck Government, mindlessly oppose anything Biden proposes, and even threatened to collapse the worldwide economy by “playing chicken” with the artificially-created “debt ceiling.” 

To the extent that any GOP candidate could explain their economic “plan” (most couldn’t or wouldn’t), it was a muddled variation of proven-to-fail “trickle down economics.” Yup, the same nonsense and bureaucratic doublespeak that has destroyed the British economy and led the Conservatives to be a laughingstock of “unstable government by clowns🤡!” Basically slash programs that benefit everybody to reward fat-cats with more un-needed and unfunded tax breaks. 

Do we really need to make guys like Musk, Zuckerberg, Bezos, McConnell, and the “geniuses” who invented “cryptocurrency” richer? Make sense? Of course not! I doubt that there is a shortage of “investment capital” in the U.S. right now. 

Is preventing IRS from processing returns in a timely manner and collecting back-taxes owed really the key to reducing budget deficits? Preposterous! Yet GOP pols say so!

Undoubtedly, we need prudence, responsibility, and focus in government spending — from both parties. As working mothers, Abigail and Hillary know a thing or two about making responsible fiscal decisions and insuring that their constituents get the most bang for each hard-earned tax dollar spent. And neither is afraid to speak out against “fraud, waste, and abuse” in any and all forms!

As former Federal civil servants, they recognize the need for cutting waste and getting more value for each dollar. In that respect, I think that requiring competent management, accountability, expertise, innovative customer service, and focused enforcement in the hugely expensive yet highly wasteful, ineffective, and often counterproductive immigration bureaucracy would be a good starting point for achieving much more without drastic resource increases.

It doesn’t hurt that Abigail and Hillary are really really smart and use their brains to help others and society rather than for self-aggrandizement or to lord it over others. Tough as they are, they are also nice, kind, and compassionate. In other words, non-ideologues.

Go, Abigail and Hillary! Make America the best that we can be: A diverse society and powerful nation where everyone can reach their full potential, independence, and self-sufficiency, not just the “chosen few!”

🤯 POLITICS: BILL PENZY: WISCONSIN’S LAST ELECTION?

Tuesday, Wisconsin has the chance to reelect a truly kind and decent man who is also a really effective governor, Tony Evers. This week his Republican opponent announced: “Republicans will never lose another election after I’m elected governor.” His people tried to backtrack afterwards and say he will do such a good job everyone will always forever after vote for Republicans all the time. That wasn’t what he was saying. He is a 2020 election denier who plans to abolish Wisconsin’s bipartisan election commission and replace it with one he hand picks. He sold his soul to Donald Trump for his endorsement. He is in Trump’s debt.

After Citizens United unleashed unlimited corporate political spending, Wisconsin became the Republican party’s test grounds for how to turn unlimited money into election wins. What blindsided so many nationally in 2016 with Donald Trump’s election has been ongoing here since 2010. I know some of you want to believe there are some sort of safeguards protecting our democracy or possibly some sort of protective netting preventing Republicans from sinking beyond a certain point. I can tell you there is not.

Wisconsin wasn’t chosen randomly to be the testing ground of unlimited spending. It was our long history of humanity, support for schools, fairness for workers, and leadership on environmental protections that brought us into the Republican party’s focus. Much of what you like about Penzeys has its roots in Wisconsin’s tradition of caring for others. It is our caring that the Republicans seek to end.

Milwaukee’s Journal Sentinel has come around and done a very decent job covering just what a threat both our Republican governor and senator candidates are to the future of democracy. They don’t normally make endorsements, but they’ve realized this one is too important to sit out. Please read their well-reasoned endorsement of Tony Evers’s re-election for Governor and our Lt Governor Mandela Barnes for US Senator editorial here. (Just tap on the highlighted link). Evers and Barnes have earned Wisconsin’s support.

And maybe the root of this Tuesday’s election is to be the wake-up call America needs to save our democracy, but here in Wisconsin 2024 could be too late. Unless you’ve been here these last twelve years, you can’t imagine the depths of corruption that are now accepted as commonplace in our state’s Republican party. I won’t bog this down with the numbers, but Wisconsin is so very corruptly gerrymandered. It is amazing that this year there is still hope, but that hope hangs by a thread.

Please, if you know someone in Wisconsin forward to them this email or at least the link to the Milwaukee Journal Sentinel endorsements. Better yet, give them a call. We are nice people to talk to. Republicans have to cheat here because the majority of us are good and decent people, but after a dozen years of this, some of those good and decent people are exhausted. This cycle’s relentless Republican ads of nonstop lies, anger, and racism have been brutal.

Please do all you can to lift the spirits of anyone you know who lives here in Wisconsin. Against all odds this one’s coming down to the wire. Victory, and with it the survival of democracy, here is still very much within our reach. Your encouragement can make all the difference. Wisconsin isn’t Las Vegas. Nothing stays here. What happens in Wisconsin first happens to all of America next. Please don’t sit on the sidelines while Republicans end our democracy. Please help.
