Attached is the decision of U.S. District Judge Alison J. Nathan of the Southern District of New York ordering ICE to present detained noncitizens before an immigration judge within 10 days of their arrest.  It was not unusual as recently as early last year for noncitizens detained by ICE who were eligible for release to wait weeks or months to see an IJ for the first time.

Sarah Burr filed a declaration in support of the litigation that counsel acknowledged was critical to the outcome. Congrats, Sarah, and thanks for your extraordinary efforts on behalf of due process!

Whether as individuals or a group, we continue to make a difference in important decisions.

OLYMPIA — The Northwest detention center in Tacoma holds people in solitary confinement on average more than any other dedicated U.S. Immigration and Customs Enforcement (ICE) facility, according to a new watchdog report.

The report by the University of Washington’s Center for Human Rights also contends that the center — in violation of ICE’s own policies — imposes solitary confinement on inmates with mental-health issues, or who are exercising their First Amendment rights by going on hunger strikes.

The report is based on federal government records and documents by the company that operates the prison, GEO Group, which were obtained by the Center for Human Rights after years of litigation.

The privately run detention center holds as many as 1,575 immigrants accused by the government of living illegally in the U.S. and facing deportation proceedings.

In an interview, Angelina Godoy, director for UW’s Center for Human Rights, said the report “speaks to this existence of a secret prison within a prison.”

“There’s essentially no effective oversight of the practice” of solitary confinement, Godoy added. “And from the data that we were able to gather, there’s really disturbing conclusions about just flagrant violation of international human-rights norms.”

The Biden-Harris Administration must eliminate the “New American Gulag” (NAG”). The money could be “repurposed” for grants to encourage legal representation of migrants and to train more and better Accredited Representatives (non-attorneys) to represent individuals in immigration proceedings. 

Contrary to the bogus narratives spread by DHS and White Nationalist restrictionists, reputable research and studies show that individuals with legal representation appear for hearings at an extraordinarily high level. Thus, punitive private “faux civil” detention in the NAG should, in a rational, properly operating system, be unnecessary.

In those relatively few cases where detention is necessary because the DHS demonstrates a danger to the community or high risk of failure to appear, the Government should provide it in humane, professionally run, closely monitored, and accountable non-punitive facilities.

BELOW THE RADAR SCREEN: Career Prosecutor Jonathan Fahey Quietly Installed As Head Of Office Of Principal Legal Advisor (“OPLA”) @ ICE

According to the ICE website, Jonathan Fahey is now the Principal Legal Advisor (“PLA”) at ICE. The “PLA” selects and supervises hundreds of ICE Chief and Assistant Chief Counsel who represent DHS in Immigration Courts nationwide as well as advises the Director of ICE and the Secretary of DHS on ICE legal matters.

Curiously, the prior PLA, Tony H. Pham is listed on the ICE website as “Senior Official Performing the Duties of The Director.” That’s bureaucratic gobbledygook for “Acting Director.” However, Fahey is not listed as “acting” in the PLA position. That leaves the question of exactly what Pham’s “official” position is these days.

Of course, it’s all part of a Trump regime “policy” of using “actings” and various related gimmicks to evade the Senate confirmation process and accompanying public scrutiny of senior political leadership at DHS. It also makes it easier for the White House to “lean on” and threaten, remove, or transfer senior officials because they lack the legitimacy and “political constituency” that comes from Senate confirmation. The ICE Director (formerly known as “Assistant Secretary”) requires Senate confirmation, the PLA does not. Incredibly, notwithstanding its “high visibility,” ICE has not had a duly appointed and confirmed Director during this Administration.

This ICE website doesn’t list Fahey’s bio. But, he’s no stranger to lawyers practicing in Northern Virginia. Here’s what Politico had to say when he joined ICE in April 2020:

Historical footnote: The DHS Chief Counsel program is the “direct descendent” of the “Legacy INS” Chief Legal Officer and later District Counsel programs that I helped establish as INS Deputy General Counsel (and occasionally Acting General Counsel) under the leadership of then INS General Counsel (now Immigration Judge) Dave Crosland and his successor the late Maurice C. “Iron Mike” Inman, Jr. Prior to that, INS Trial Attorneys were selected by the General Counsel, but were supervised and evaluated by the District Directors, actually their “clients.”

This ushered in the era of “independent legal advice” at INS, patterned on the “U.S. Attorney model.” Among other changes, it resulted in the appointment of many additional “Special Assistant U.S. Attorneys” (“SAUSAs”) from INS to assist with both civil and criminal litigation in the U.S. District Courts. It also resulted in the assignment of “Sector Counsel” to advise Border Patrol Chiefs. Additionally, a “failed power move” by the “Nelson/Inman/Schmidt Cabal” to take over the U.S. Circuit and District Court litigation from the DOJ Criminal Division, prompted the creation of the Office of Immigration Litigation (“OIL”) in the DOJ Civil Division, as well as the creation of EOIR as a separate entity to house the Immigration Courts and the BIA in 1983.

But, institutional change never comes easily, particularly at a place like the “Legacy INS.” I remember the first “Annual Commissioner’s Conference” during the tenure of the late Commissioner Al Nelson, held during the early months of the Reagan Administration. Perhaps the location was at the Federal Law Enforcement Training Center (“FLETC”) in Glynco, Georgia. In any event, it was in a “classroom-type setting.”

I found myself “in the pit” of an “amphitheater-type” classroom, the seats filled with super-irate INS District Directors and Regional Commissioners screaming that I had “stolen their attorneys.” Of course it’s always a bad idea to scream at the “loudest voice in the room” — me! So, I was shouting back at a decibel level that must of carried halfway to Atlanta!

Meanwhile, my “new boss,” “Iron Mike” was sitting in the first row alternately guffawing and shaking his head as I “aggressively defended” our policies and tried to explain how it would be a “win-win” for everyone. (It was! Eventually, almost everyone in the room was “lobbying” me for more lawyers, SAUSAs, and “personal assistance” in handling their never-ending legal problems).

Afterwards, Mike came up to me and said “Jesus, Schmidt, you managed to piss off and out-yell every manager in the country. Great job!”

Of course, “Iron Mike” was no slouch when it came to the “strategic yell” — once in a “Bobby Knight moment” sending one of our budget analysts into a fainting spell. “GENCO” in the “Time Iron Mike” wasn’t a place for the faint of heart!

And, of course his “favorite tactic” was to yell at me: “What did they teach you at that lefty law school in Madison?” No “Legal Executive Council” meeting was complete without us getting into least one “knock down drag ‘em out” in front of the “troops.” But, the relationship worked. We actually complemented each other and got a lot accomplished.

So, for better or worse (mostly seems like the latter, these days), I was one of the “Founding 
Fathers” of the modern DHS Chief Counsel/Assistant Chief Counsel system.

I am pleased to report that we, along with co-counsel SPLC, DRA, Orrick, and Willkie, just got the attached order on our motion to enforce our Fraihat COVID preliminary injunction. We are working on developing guidance for detained folks, their families, advocates and allies. We encourage you to read it through if you’re interested because there are a lot of gems in there, but did want to flag these four big takeaways ASAP:

 

  1. Defendants shall mandate more widespread and regular testing of medically vulnerable people, consistent with CDC guidelines and above the level provided by the BOP and state prisons.
  2. Defendants shall mandate that medical isolation and quarantine are distinct from solitary, segregated, or punitive housing, that extended lockdowns as a means of COVID-19 prevention are not allowed, and that access to diversion and to telephones must be maintained to the fullest extent possible.
  3. Defendant shall provide more protective, and more concrete, transfer protocols to protect medically vulnerable people, including a suspension of transfers with a narrow and well defined list of exceptions consistent with CDC guidance.
  4. On custody redeterminations, blanket or cursory release denials are prohibited. Only in rare cases should a medically vulnerable detained individual who is not subject to mandatory detention remain detained, and any exceptions must be supported by specific justifications. With respect to people who are subject to mandatory detention, defendants must perform an individualized assessment, and should only continue to be detained after consideration of the risk of severe illness or death, with due regard to the public health emergency.

What if we had an independent U.S. Immigration Court with judges who had demonstrated due process and human rights expertise? Such a court could require ICE to comply with the law, take appropriate corrective action against contemptuous non-compliance, and relieve US District Judges from the responsibility to supervise ICE.

Thank you for your prayers and support this week. In the days leading up to Binsar’s habeas hearing on Friday, we are continuing to build momentum and raise our voices to God and to the people who hold secular power.

Today we gathered at the ICE Field Office in Baltimore and held a demonstration. Three of us were able to gain entry into the building and pressed the staff until they agreed to deliver our bix box of printed petitions to the Field Office Director. The District Commander that I spoke to said he had read about the case in the papers, and we should take it to the National Headquarters in DC. So we will (see below.)

Tomorrow, we are driving calls to elected representatives. Our Maryland Congressional Delegation has said that they are on board, yet in the last two weeks they have been reluctant to speak out publicly on Binsar’s behalf. We are asking them to put their names on the line and to stand with our church, regardless of whether they personally think it will affect meaningful change. I have pasted a script below. You can pass this on to other people, as the phone number lets people enter their zip codes and connect to their own state’s congresspeople.

Thursday, we are planning a faith march from Christ UMC in Southwest DC to the ICE National Headquarters. It is a 1 mile walk. We are inviting ecumenical and multifaith people to join us as we deliver four petitions with a combined total of more than 15,000 signatures. We’ll meet at 8:30am at Christ UMC and will leave for the walk at 9am, and will conclude by 10am.

Friday, Binsar’s habeas hearing is at 2:30pm. I implore you to fast and pray with me from sundown on Thursday through the hearing time on Friday. I have invited the Bishop and other conference leaders to do the same. We cannot be there physically because of the court’s restrictions, but we can be in absolute, focused solidarity.

Under the maliciously incompetent, illegal “leadership” of “Wolfman,” ICE continues to make a strong case for its dissolution and reassignment of those duties that are actually necessary (excludes much of what they have done as Trump’s “Not So Secret Police”) to other entities that will operate professionally and within the law.

Yes, there are some good folks at ICE. I knew many of them in “prior incarnations.” But, ICE’s participation in Trump’s racist, often illegal, and highly counterproductive policies and actions certainly raises some “red flags” that I previously had not seen.

In early 2017, as Immigration and Customs Enforcement prepared to carry out the hard-line agenda on which President Trump had campaigned, agency leaders jumped at the chance to let two filmmakers give a behind-the-scenes look at the process.

But as the documentary neared completion in recent months, the administration fought mightily to keep it from being released until after the 2020 election. After granting rare access to parts of the country’s powerful immigration enforcement machinery that are usually invisible to the public, administration officials threatened legal action and sought to block parts of it from seeing the light of day.

Some of the contentious scenes include ICE officers lying to immigrants to gain access to their homes and mocking them after taking them into custody. One shows an officer illegally picking the lock to an apartment building during a raid.

At town hall meetings captured on camera, agency spokesmen reassured the public that the organization’s focus was on arresting and deporting immigrants who had committed serious crimes. But the filmmakers observed numerous occasions in which officers expressed satisfaction after being told by supervisors to arrest as many people as possible, even those without criminal records.

“Start taking collaterals, man,” a supervisor in New York said over a speakerphone to an officer who was making street arrests as the filmmakers listened in. “I don’t care what you do, but bring at least two people,” he said.

The filmmakers, Christina Clusiau and Shaul Schwarz, who are a couple, turned drafts of their six-part project called “Immigration Nation” over to ICE leadership in keeping with a contract they had signed with the agency. What they encountered next resembled what happened to Mary L. Trump, the president’s niece, who was eventually sued in an unsuccessful attempt to stop her from publishing a memoir that revealed embarrassing details about the president and his associates.

Suddenly, Ms. Clusiau and Mr. Schwarz say, the official who oversaw the agency’s television and film department, with whom they had worked closely over nearly three years of filming, became combative.

The filmmakers discussed their conversations on the condition that the officials they dealt with not be named out of fear that it would escalate their conflict with the agency.

Catlin’s concluding paragraphs are worth keeping in mind:

The filmmakers said they came away with some empathy for the ICE officers, but became convinced that the entire system was harmful to immigrants and their families.

The problem, they said, was summarized in the first episode by Becca Heller, the director of the International Refugee Assistance Project.

“Is a government agency evil? No. Is every single person inside ICE evil? No,” Ms. Heller told the filmmakers. “The brilliance of the system is that their job has been siphoned off in such a way that maybe what they see day to day seems justified, but when you add it up, all of the people just doing their job, it becomes this crazy terrorizing system.”

We have all been harmed by Trump’s racist-driven “weaponization” of DHS and the Immigration Courts, and that includes the DHS employees and the Immigration Court employees who are caught up in this grotesque, often illegal, and overall immoral abuse of government authority and resources. 

We should also be concerned about the First Amendment implications of Trump’s attempts to misuse Government authority to manipulate the election in his favor by, once again, suppressing truth in reporting.  Thank goodness we have courageous journalists like Caitlin and these filmmakers to keep exposing the ugly truth about the Trump/Miller/Wolf/Barr ongoing White Nationalist immigration charade.

At the end of April, Florida federal Judge Marcia Cooke ruled that Immigration and Customs Enforcement prisons were such a tinderbox for the novel coronavirus that ICE had to begin efforts at letting people out. The dangers of the pandemic inside three immigrant-detention centers in the state threatened to put ICE on the wrong side of constitutional prohibitions on cruel and unusual punishment. 

Thousands of miles away, in Arizona, several lawsuits on behalf of people detained by ICE were in various stages of advancement. One, brought in April by the Florence Immigrant and Refugee Rights Project, sought to release at least eight people at risk of contracting COVID-19 into sponsor custody.

But instead of preparing to release migrants in detention, ICE did something both the Centers for Disease Control and the Justice Department’s Bureau of Prisons had warned against. They transferred 74 detainees to a for-profit prison in central Virginia called ICA Farmville.

Both medical staff and already-overtaxed employees at ICA Farmville, according to court documents and interviews, had warned ICE against taking in new detainees. ICE had even assured Farmville staff it would use a different Virginia prison as a way-station to quarantine people should transfers have to go through.

Instead, in early June, ICE sent the 74 people—from Arizona’s Florence and Eloy detention centers and Florida’s Krome—directly to ICA Farmville. Staff fears manifested almost immediately. Fifty-one detainees tested positive for COVID-19.

A month later, ICA Farmville is in crisis. It has at least 268 out of around 360 detained people positive for the virus, making the jail by far the most stricken facility in ICE’s network of lockups. While ICA Farmville is claiming that vanishingly few are symptomatic, detainees, backed by medical records seen by The Daily Beast, say in dire terms that isn’t true.

“We think we’re going to die at any time. The help we need we’re not getting,” said a man detained at ICA Farmville whom The Daily Beast will call Michael. “We think we’re going to die without seeing our families. A lot of people here are suffering.”

Former employees say the coronavirus has exposed longstanding failings at ICA Farmville—namely, a company that values making money over protecting either detainees or its staff. At least 22 guards have contracted the coronavirus; others have responded to desperate, panicked and agitated detainees with at least three incidents of violence between June 20 and July 1. “There was no reason to intake any more detainees,” one former employee said, “but it’s all about profit.”

To immigration attorneys and advocates, the cause of the disaster unfolding at ICA Farmville is clear: ICE’s decision to transfer detainees into the facility rather than releasing them in accordance with current and likely future judicial rulings.

ICE “appears to be shifting people around to avoid having to let people out, through being forced in lawsuits,” said Jesse Franzblau, a senior policy analyst at the National Immigrant Justice Center.

“In my opinion, to avoid releases, they’re shifting people around the country or moving them to other detention facilities outside of south Florida,” said Heriberto Hernandez, a Florida immigration attorney who had a client at Krome in Miami, one of the jails cited in Judge Cooke’s ruling, moved into ICA Farmville.

Hernandez said his client at Farmville has tested positive for COVID-19 and “all they did was give him cold medicine.”

“There’s no question whatsoever that this [transfer] was the result of the lawsuits,” said Marc Van Der Hout, an Arizona attorney who sued ICE to release a husband and wife from the “tremendous outbreak” at the Eloy detention center. “There are four lawsuits I’m personally aware of, and possibly more. There’s no doubt in my mind they were doing this to avoid the repercussions of the lawsuits.”

ICE denies conducting any legal shell game over the detainees, and says its motivations were about the health of the detainees.

Of course, this a is a shell game! You don’t need a law degree to figure that out. And, the claim that this is all about detainee heath is patently absurd. The best interests and health of detainees never enter into it except to the minimal extent necessary to avoid wrongful death suits (not very difficult given the Supreme’s tilt in favor of protecting officials who kill people of color).

There is an even more serious problem: The failure of the Federal Judiciary to throw scofflaws like DHS Acting Secretary Chad Wolf and ICE Acting Director Matt Albence in jail for contempt for their agency’s overt efforts to avoid lawful court orders while endangering the health and safety of both the detainees and the public. 

What  ICE is doing in the “New American Gulag” is essentially a “crime against humanity.” We need better Federal Judges and Justices who will take their oaths to uphold our Constitution in the face of such grotesque and obvious Executive abuses seriously!

In our most recent story (https://reut.rs/2ZFjksB) about the dangers of coronavirus in U.S. immigration detention centers. Using immigration court records and ICE data we found 268 transfers of detainees between detention centers in April, May and June, half that involved detainees who were either moved from centers with COVID-19 cases to centers with no known cases, or from centers with no cases to those where the virus had spread.

At least one transfer resulted in a super-spreading event. On June 2, 74 detainees were transferred to a detention center in Farmville, Virginia from three detention centers in Florida and Arizona, two of which had confirmed COVID-19 cases.  Before the transfer the center only had only 2 positive cases (also from transferees from another nearby detention center). After the transfer, more than half of the detainees moved tested positive for the virus. Now Farmville is the hardest hit detention center in the country, with 315 cases.

 

Previously we reported on how hospital resources are scarce in many rural areas where detainees are held, and how some asylum seekers are giving up their claims because they fear catching the virus in detention and how one couple faced double jeopardy both inside and outside of immigration lock up.

GAO Says Customs and Border Protection Spent Migrant Medical Funds on Dirt Bikes

McCord Pagan for Law360 reports that U.S. Customs and Border Protection (CBP) violated the law by taking funds designated by Congress for consumables and medical care for migrants and instead used some of the money for its canine program, dirt bikes and upgrades to its computer system, according to the U.S. Government Accountability Office (GAO).

While CBP spent some of the designated funds on baby products, food, defibrillators, and masks, CBP violated the law by spending certain funds meant for such migrant care on canines, boats, dirt bikes, ATVs, a vaccine program for its employees, and upgrades to its computer network, sewer system, as well as janitorial services, according to the GAO report.

The 2019 law providing supplemental funds to CBP to help address a surge of migrants crossing the U.S.-Mexico border designated about $112 million to CBP for “consumables and medical care.”

“We conclude that CBP violated the purpose statute when it obligated amounts expressly appropriated for consumables and medical care and establishing and operating migrant care and processing facilities for other purposes,” according to the GAO opinion. The Congressional watchdog is conducting an audit of CBP and the U.S. Department of Homeland Security on the care of the adults and children in its custody, it said.

In response to GAO’s findings, a CBP spokesperson sent Law360 a statement calling the violations “technical in nature” and said it will take prompt remedial action.

District Court Halts ICE Enforcement Operations at New York Courthouses

For several years, the Chief Justice of California has sought to keep Immigration and Customs Enforcement (ICE) away from the California courts.  Last year, a federal judge in Massachusetts blocked ICE courthouse arrests there.

CNN reports the latest skirmish between the state courts and federal immigration enforcement.

U.S. District Judge Jed S. Rakoff issued an order yesterday blocking ICE from making arrests in New York courts, finding that the practice is illegal.  The introductory paragraph of his ruling reads as follows:

 

“Recent events confirm the need for freely and fully functioning state courts, not least in the State of New York. But it is one thing for the state courts to try to deal with the impediments brought on by a pandemic, and quite another for them to have to grapple with disruptions and intimidations artificially imposed by an agency of the federal government in violation of long-standing privileges and fundamental principles of federalism and of separation of powers.”

 

State and local officials argue that when ICE officers apprehends immigrants at courthouses — where they are making appearances as defendants, witnesses or victims — it endangers public safety by making it harder to prosecute crimes.

 

ICE has defended the arrests, saying apprehending people in controlled settings is safer than arresting them on the streets.

And, the high ranking legislators and judges who have watched and enabled Trump’s scurrilous attacks on our Constitution and human values ultimately bear much of the responsibility! As my friend Ira Kurzban would say, “this is not normal.” “Normalizing” and “enabling” illegal, unethical, and racist-driven behavior is obscene. If “watchdogs” and U.S. District Court Judges can speak out against lawless actions and corruption, how is it that Mitch, Roberts, and the rest of the GOP have “swallowed the whistle?”

One government lawyer who appeared in a crowded Newark, New Jersey, immigration court last month is in a medically induced coma. A New York immigration lawyer and her client are both sick. Immigration judges are being denied sick leave when they use anxiety or safety as reasons. Migrant children are asking their lawyers if they will fall ill if they go to court, and whether they’ll be deported if they don’t show up.

Sickness, panic, and confusion in the midst of a pandemic: These are the acute side effects of immigration courts continuing to operate as the novel coronavirus races across the country. Despite three weeks of intense pleading to close all 69 courts—across a united front of immigration lawyers, the union representing lawyers for ICE, and the immigration judges’ union—more than two-thirds of them remain open. 

The courts that have been closed by the Executive Office for Immigration Review (EOIR), the federal agency that runs them, have often only been shuttered in reaction to a confirmed case of COVID-19 or suspected exposure. The closures are often last-minute, and not clearly communicated, except on Twitter. This week, several immigration legal associations filed two separate federal lawsuits to close the courts because they fear that the government has put their lives in danger. 

“I think it’s about time the American people woke up to the fact that EOIR’s willingness to perpetuate and extend this pandemic will inevitably bring the virus to their hometown,” Rebecca Press, the legal director at UnLocal in New York, said Thursday via email. She contracted coronavirus two weeks ago and at least one of her clients is sick. “The longer courts remain open even for filing, and the longer the courts require attorneys and immigrants to engage in the work of preparing evidence, the more likely it becomes that the virus will be brought right back to another community.”

Government lawyers are affected, too. Fanny Behar-Ostrow, the president of American Federation of Government Employees Local 511, the union representing ICE lawyers, is getting calls at all hours of the day from members who worry they have been exposed to the virus. “They are panicked, frightened, desperate, upset,” she said. 

In addition to the 36,000 adults in ICE detention facilities, there are some 3,500 migrant children in government custody who are affected by the disarray in the courts. In most courts, children must still attend in-person hearings, putting them at exposure risk. In New York City, the current epicenter of the pandemic, lawyers from Kids in Need of Defense (KIND) have not been told whether EOIR will reschedule cases for next week. They are also unclear about whether the minors even need to come to court at a time when state and city officials have issued stay-at-home orders. 

“We are receiving phone calls from children who had their safety net shaken,” said Maria Odom, vice president for legal services for KIND, which is a nonprofit organization contracted to represent unaccompanied minors. “For us serving vulnerable children, there are so many moving pieces and at a time when we should be able to look to the government, they are just contributing to the chaos.”

Lawyers, judges, and advocates wonder: What will it take for EOIR to close courts nationally?

“I hope that it won’t take a death, but I worry that it will,” said Aaron Reichlin-Melnick, an immigration lawyer and policy counsel for the American Immigration Council. His organization is one of the groups behind a lawsuit filed Monday by the National Immigration Project of the National Lawyers Guild.

Looks like the dead bodies will have to pile up before the Article IIIs and EOIR will take action. As the rest of us know, but to which U.S District Judges & EOIR appear willfully blind, by the time individuals show symptoms and begin dying, it’s too late to stop the spread. The larger community has already been infected.  

I wonder what it is that gives both EOIR officials and Article III Judges such great confidence that they and their families will escape the consequences of their irresponsible behavior? Maybe, it’s that both EOIR Senior Execs and Article III Judges manage to studiously avoid “direct exposure” to Immigration Courts. “Below their pay grade,” so to speak. 

But, according to folks like Dr. Fauci, who possibly knows even more about infectious diseases than EOIR Director McHenry and the Federal Judges who continue to defer to the irresponsible EOIR “guidance,” nobody will be immune. 

So far, the U.S. has done the worst job of any developed country in the world of “flattening the curve.” Inevitably, we eventually will become the “world leader” in coronavirus deaths. After observing the inept response of EOIR and the failure of the U.S. District Courts to promptly intervene on the side of medical knowledge, common sense, and preserving human lives, I can now see why we are failing as a nation to take the extreme measures necessary for self-preservation.

I would think that as lawyers, judges, and other members of the legal community start dying as a result of EOIR’s policies, that the officials responsible eventually will face legal actions brought by surviving family members and colleagues. Life tenure and the judicial doctrine of “absolute immunity” will protect the feckless Federal Judges from legal accountability. But, it won’t protect them and their reputations from moral accountability and the “judgements of history” which are likely to be harsh and as unforgiving as the Trump Immigration Kakistocracy’s treatment of the most vulnerable among us and their brave lawyers.

Immigrants Jailed by ICE Are Sick, Panicking, and Can’t Get Coronavirus Tests

“They don’t want to die in here.“

José listed off his symptoms: fever, nausea, diarrhea, difficulty breathing. The 38-year-old from Mexico, now detained in an ICE detention center in Southern California, told VICE News he worries he has COVID-19, the potentially deadly disease caused by the novel coronavirus.

But he doesn’t know. His jailers won’t test him.

Instead, José, who is from Mexico and came to the U.S. when he was 15, sleeps in a cell with seven other detained immigrants at the Adelanto detention facility in San Bernardino, Calif, which is run by the for-profit GEO Group. He wakes up in the middle of the night gasping for air, his heart beating wildly. After complaining to a judge, he was taken to the infirmary, where a doctor told him it was just a cold, he said.

“They just tell me to drink a lot of water and eat the food they give us,” said José, who has been incarcerated for five years fighting a deportation order. “There are other guys in here that are also coughing, have a fever. But we have no idea if we have the coronavirus because they won’t give us a test.”

This week, the first immigrants detained by ICE tested positive for COVID-19. It comes after weeks of warnings by public health experts and civil right lawyers that a mass outbreak in detention centers is inevitable, endangering both asylum seekers, those being detained for immigration violations, and staff. They also say an outbreak would strain an already critically low supply of respirators, leading to more deaths in the communities surrounding detention centers as well as among immigrant detainees.

Across the immigration system there appears to be little being done to prevent a spread of the coronavirus, except banning visitors. There are currently some 37,000 detained immigrants in ICE custody, most of them held in for-profit detention centers in the south and California. ICE recently requested 45,000 N95 masks from the federal government for its officers to carry out detentions of undocumented immigrants.

VICE News spoke with six men currently being held in ICE detention facilities in California, and two men released this month from ICE facilities in Louisiana. They described congested living conditions with up to 110 men sleeping in a room and days-long waitlists to be seen by a medical professional.

IN EARLY March, U.S. Immigration and Customs Enforcement seemed to have not yet gotten the memo that a deadly virus was threatening the country. The deportation agency was mustering hundreds of additional special agents, normally busy with long-term investigations, to surge into so-called sanctuary cities and round up undocumented immigrants by the thousands. Operation Palladium, as it was called — Operation Pandemonium would have been more apt — was already terrifying migrants and forcing them deeper into the shadows. That was exactly the wrong thing to do as a deepening public health crisis gripped society.

Better late than never, the Trump administration has now backed off its ramped-up immigration crackdown. It remains unclear how many lives — of immigrants and native-born Americans alike — will have been risked in the meantime as a result of the administration’s scare tactics.

Those tactics have been embedded not only in sweeps through major cities but also in policy. The so-called public charge rule, imposed last year by the administration, discourages legal immigrants from seeking care at public hospitals and clinics, lest they be deemed a burden on society and, as a result, denied legal permanent residence when they apply for green cards. That was true even before anyone had heard the words novel coronavirus or covid-19.

Similarly, many undocumented immigrants have been equally reluctant to seek health care, fearing that ICE agents will grab them when they do. The agency said it didn’t generally stake out medical facilities, but it didn’t forbid it either.

The anxieties and behaviors arising from those policies are baked into immigrant communities. Now the administration, mindful that they are antithetical to fighting a pandemic, is trying to unbake them.

Last Wednesday, ICE announced it would limit enforcement operations to detaining unauthorized migrants who are actual criminals or threats to society. U.S. Citizenship and Immigration Services, which handles green card applications for legal permanent residence, said last week that applicants might not be rejected on the basis of having sought free medical attention arising from the coronavirus crisis, if they could “provide an explanation and relevant supporting documentation.”

Will those announcements, buried in the avalanche of pandemic news and the fine print of government regulations, be too late to change migrants’ habits? Having scared the wits out of legal and undocumented immigrants for the past three years, can the administration now un-scare them — at least enough to seek medical care if they need it?

Those are pressing questions because immigrant and native-born communities are closely integrated in this country, even if the Trump administration has been loath to acknowledge it. As a public health matter, it is disastrous to erect policy barriers to impede any community’s access to care, because contagious diseases make no such distinctions. That is precisely what the administration has done.

It has long been President Trump’s contention that immigrants are vectors for disease. Until now, there has been little evidence for that. In the current circumstances, it may become a self-fulfilling prophecy if migrants, frightened by the administration’s relentlessly hostile policies, fail to seek the medical attention they need just as critically as their U.S.-born neighbors, colleagues and relatives.

The regime couldn’t have pulled off this disaster without the help and support of J.R. & his Supremes. Time after time, they have ignored overwhelming evidence of White Nationalist bias and intentional factual misrepresentations driving so-called “policies,” looked the other way as the regime abused the concepts of “national security” and “emergency” as a pretext for invidious actions, abandoned their duty to our Constitution, mocked the rule of law, and shown a deep and abiding disrespect for human values and human decency.
