People talk frequently about forward and backward movement in one’s career, but less so about the gift of lateral moves. I have been lucky enough to make at least one facially “lateral” move that drastically changed the scope and reach of my immigration advocacy work: as the first Policy Counsel for Immigration at The Leadership Conference on Civil and Human Rights!

Through the work of incredible jacks-of-all-trades on staff like Rob Randhava, The Leadership Conference has played an integral role in a number of major moments in the immigration space and maintained an Immigration Task Force. The organization wanted to concretize this work by hiring a full-time staffer, and on the heels of my work at the UndocuBlack Network, I felt this role was the right fit. I grew up in a distinctly Jamaican household, visiting our home country most of my childhood summers, but I also sought a sterling education in the Black American experience.

One of my proudest moments at The Leadership Conference was also one of the most complex, challenging moments of my career—trying to connect the dots between seemingly disparate, painful topics to highlight the interconnectivity of our racial justice and immigrant justice movements. For me, the line between the so-called “Great Replacement Theory,” the targeting of Black Americans in Buffalo in May 2022, and the deleterious, disproportionate effects of Title 42 on Black asylum seekers couldn’t have been brighter. I felt The Leadership Conference was perfectly poised to connect those dots in a public way, by co-leading a sign-on letter to the Biden Administration. But I had to make my case with both internal and external partners with care and finesse, drawing on all of my education and experiences to guide me. No community wants to feel as though another community is opportunistically seizing a moment to elevate its interests while riding on the backs of others. I am proud to say that I persuaded a number of skeptics, many of whom were rightfully protective of their communities and civil rights legacies, to see the urgency of drawing these connections for those in power. Through this effort I was reminded that the work of connecting the Black diaspora is arduous, but can bear powerful fruit.

I’ve said it many times: There will be neither racial justice nor equal justice for all in America without justice for migrants!

Breanne obviously “gets it!” So do leaders like Cory Booker (D-NJ). 

Sadly, however, many Democrats, including notable African-American leaders like President Barack Obama, Vice President Kamala Harris, AAG Civil Rights Kristen Clarke, and former AGs Eric Holder and Loretta Lynch don’t! They all blew or are squandering opportunities to make due process and equal justice for asylum seekers and other migrants a reality, rather than a hollow, unfulfilled promise!

In particular, the “intentional tone-deafness” of the Biden Administration on treatment of asylum seekers and other migrants of color has been astounding and shocking! Speaking out for justice for George Floyd and others while denying due process and the very humanity of Blacks and other people of color seeking legal asylum at the Southern Border is totally disingenuous and counterproductive!

Additionally, while there recently have been some improvements in merit-based selections by AG Garland, the U.S. Immigration Courts, including the BIA, are still glaringly unrepresentative of the communities affected by their decisions and the outstanding potential judicial talent that could and should be actively recruited from those communities. An anti-immigrant, pro-enforcement, uber-bureaucratic “culture” at EOIR, which metastasized during the Trump Administration, discouraged many well-qualified experts, advocates, and minorities from competing for positions at EOIR.

The inexplicable failure of Vice President Harris to establish herself as the “front person” to actively encourage and promote service in the Immigration Courts among minorities and women is highly perplexing. Additionally, the failure of the Biden Administration to recognize the potential of the Immigration Courts as a source of exceptionally-well-qualified, diverse, progressive, practical scholars for eventual Article III judicial appointments has been stunning! 

Meanwhile, for an “upgrade” of the struggling EOIR, one couldn’t do better than Breanne Palmer: brilliant practical scholar, forceful advocate, courageous, creative innovator, and inspirational role model. As Breanne says on her website:

I try to live by one of Audre Lorde’s creeds:

“I am deliberate and afraid of nothing.”

A new Biden administration policy has dramatically lowered the percentage of migrants at the southern border who enter the United States and are allowed to apply for asylum, according to numbers revealed in legal documents obtained by The Times. Without these new limits to asylum, border crossings could overwhelm local towns and resources, a Department of Homeland Security official warned a federal court in a filing this month.

The new asylum policy is the centerpiece of the Biden administration’s border efforts. 

Under the new rules, people who cross through a third country on the way to the U.S. and fail to seek protections there are presumed ineligible for asylum. Only people who enter the U.S. without authorization are subject to this new restriction.

The number of single-adult migrants who are able to pass initial screenings at the border has dropped from 83% to 46% under the new policy, the Biden administration said in the court filing. The 83% rate refers to initial asylum screenings between 2014 and 2019; the new data cover the period from May 12, the first full day the new policy was in place, through June 13.

Since the expiration of Title 42 rules that allowed border agents to quickly turn back migrants at the border without offering them access to asylum, the administration has pointed to a drop in border crossings as proof that its policies are working.

But immigrant advocates and legal groups have blasted Biden’s new asylum policy, arguing that it is a repurposed version of a Trump-era effort that made people in similar circumstances ineligible for asylum. (Under Biden’s policy, certain migrants can overcome the presumption that they are ineligible for asylum.) The ACLU and other groups have sought to block the rule in federal court in San Francisco, in front of the same judge who stopped the Trump policy years ago.

The new filing provides the first look at how the Biden administration’s asylum policy is affecting migrants who have ignored the government’s warnings not to cross the border. 

“This newly released data confirms that the new asylum restrictions are as harsh as advocates warned,” said Aaron Reichlin-Melnick, policy director at the American Immigration Council. “The data contradicts conservative attacks on the rule for being too lenient. Less than 1 in 10 people subject to the rule have been able to rebut its presumption against asylum eligibility.”

None of the statistics cited in the article actually give a full picture, since the don’t account for 1) families, 2) children, and 3) those processed at ports of entry using the highly controversial “CBP One App.” Nor do they give insights into what happens to those denied access to the asylum adjudication system.

As Aaron Reichlin-Melnick points out, increased rejections of legal access are exactly what experts, including our Round Table of Former Immigration Judges, predicted in vigorously opposing the Administration’s ill-advised regulatory changes. In the article, DHS official Blas Nuñez-Neto babbles on about the wonders of mindless extralegal enforcement as a “deterrent.” In a classic example of disingenuous misdirection, Nuñez-Neto appears to suggest that “success” in implementing asylum laws should be measured in terms of the number of individuals denied access or discouraged from applying. 

Actually, success in implementing asylum laws should be measured solely by whether 1) all asylum applicants regardless of status or where they apply are treated fairly and humanely; and 2) those eligible for asylum under a properly generous, protection-focused application of asylum laws are actually granted asylum in a timely manner complying with due process. By those measures, there is zero (O) evidence that the Biden Administration’s approach is “successful.” 

Moreover, Nuñez-Neto’s comments and much of the media focus skirt the real issue here. Border apprehensions have decreased because asylum seekers in Northern Mexico appear to be “waiting to see” if the “CBP One App System” at ports of entry actually offers them a fair, viable, orderly way of applying for asylum. In other words, does the Biden Administration’s legal asylum processing system have “street credibility?” 

So far, CBP One and DHS appear determined to “flunk” that test; the App continues to be plagued with technical and access glitches, and the numbers of appointments available is grossly inadequate to meet the well-known and largely predictable demand.

If the border lurches out of control in the future, it probably will be not the fault of legal asylum seekers. Rather, it will be caused by poorly-conceived and legally questionable Biden “deterrence policies” and the restrictionist politicians (in both parties, but primarily the GOP) who are “egging them on.”  That is, an Administration unable to distinguish its friends from its enemies and unwilling to develop a comprehensive strategy for dealing with the inevitably of refugee flows by creatively and positively using and “leveraging” the ample (if imperfect) existing tools under our legal system.

ADMINISTRATION’S FLUBBED RESETTLEMENT (NON) EFFORT EMPOWERS GOP WHITE NATIONALISTS, VEXES PROGRESSIVE DEMS

NEW YORK — On the fourth day of his new life in New York City, Antony Reyes set out from the opulent lobby of Manhattan’s Roosevelt Hotelwith an empty wallet and the address of a juice bar on Broadway possibly offering some work.

Reyes had been staying at the crowded hotel-turned-emergency service center, hunting odd jobs during the day along with other newly arrived Venezuelans who navigated the streets of midtown using “Las Pantallas”— the Screens (a.k.a. Times Square) as a landmark.

“I just want to work,” Reyes said in Spanish. “I didn’t come here to be a burden on anyone.”

Reyes, 23, was among the tens of thousands of migrants who rushed to cross the U.S.-Mexico border ahead of May 11, when the Biden administration lifted the pandemic policy known as Title 42. The largest group were Venezuelans, who have been arriving to the United States in record numbers since 2021.

Unlike previous waves of Latin American immigrants who gravitated to communities where friends and family could receive them, the most recent Venezuelan newcomers tend to lack those networks in the United States. Many have headed straight to New York, whose shelter system guarantees a bed to anyone regardless of immigration status.

City officials say they are housing more than 48,000 migrants across an array of hotels, dormitories and makeshift shelters that now spans 169 emergency sites.

New York has spent $1.2 billion on the relief effort since last summer. The ballooning costs have left Mayor Eric Adams feuding with local leaders upstate over who should take responsibility for the migrants, and he has also called out President Biden, a fellow Democrat, for not sending more aid.

Other U.S. cities are struggling with the influx too. Denver, Philadelphia and Washington — all cities with Democratic mayors — have received migrants bused from Texas as part of a campaign by Republican Gov. Greg Abbott to denounce Biden administration border policies. In Chicago, migrants have slept in police stations while awaiting shelter beds.

Officials in those cities are scrambling to find bed space and clamoring for more federal assistance. But the ad hoc nature of the humanitarian effort raises questions about the ability of New York City and other jurisdictions to receive and resettle so many newcomers.

The flow of Venezuelans crossing the southern border has dropped since the Title 42 policy ended, even as many continue arriving in cities in northern Mexico in hopes of reaching the United States. The Biden administration is tightening border controls and urging Venezuelans and others to apply for legal U.S. entry using a mobile app, while expanding the number of slots available for asylum seekers to make an appointment at an official border crossing.

The number of people requesting appointments, however, far outstrips supply.

The influx of migrants in New York has pushed the city’s total shelter population to 95,000, up from 45,000 when Adams took office in January 2022.

“We have reached a point where the system is buckling,” Anne Williams-Isom, deputy mayor for health and human services, told reporters at a news conference in late May.

This Administration has been in office more than two years, with knowledge of the inevitable flow of asylum seekers, particularly from Venezuela and access to some of the best and most innovative human rights experts in the private sector.

Yet, this Administration has failed to 1) put in place an orderly nationwide resettlement system in partnership with the many NGOs and some localities “already in the business;” 2) construct “regional reception centers” to provide food, shelter, representation, and support to asylum seekers during the legal process, as recommended by many experts, and 3)  restore functionality and timeliness to the legal asylum systems at USCIS and EOIR by a) cleaning out the “deadwood” (or worse) accumulated during the Trump Administration, and b) hiring experts, not afraid to properly use asylum and other laws to “protect rather than reject” and to replace the anti-asylum culture and legal regimes installed and encouraged at DHS and EOIR under Tump.

Additionally, most Venezuelans can’t be returned anyway, and the Administration’s apparent hope to “orbit” many of them to Mexico, a country far less able to absorb them than than the U.S., is ill-advised at best. 

Consequently, updating TPS for Venezuelans and others, thus providing employment authorization and keeping them out of the already dysfunctional asylum system, should have been a “no brainer” for this Administration.

This is a truly miserable absence of creative, practical problems-solving by a group that ran on promises to do better. Given the shortage of affordable housing in NY and other areas, why not “replicate and update” the CCC, WPA, and other public works projects from FDR’s “New Deal?” 

Give those arriving individuals with the skill sets opportunities to construct affordable housing for anyone in need, with an chance to live in the finished product as an added incentive! Let migrants be contributors and view their presence as an opportunity to be built upon rather than as a  “problem” that can’t be solved. 

Not rocket science! 🚀 But, evidently “above the pay grade” for Biden Administration immigration policy wonks!

Then he buried his head into his mother’s stomach as they embraced, tears welling in both their eyes. “Don’t cry,” his mother told him softly, with one arm around Dominick, and the other holding her two-month-old son who whined on her shoulder.

The family, from Guatemala, was at the Broadway immigration court in Lower Manhattan last week for an initial hearing in Dominick’s immigration case. Dominick had crossed the U.S.-Mexico border alone in March of 2022, and was designated as an unaccompanied minor. 

Dominick’s mother, Nelly Herrera, told Documented the ordeal began when they were both  kidnapped in Mexico and separated. She said Dominick escaped their captors and reached the U.S. border. Malnourished and thin from weeks of little food, he managed to squeeze through a wall into California, although she’s not sure where. He was only eight years old, and had no idea where his mother was.

“He doesn’t talk about all that a lot because he says it’s something he doesn’t want to be reminded of anymore,” she said.

After authorities helped Herrera escape her captors in Mexico, she and Dominick were reunited last year. Now, without a lawyer, they are fighting for a chance for Dominick to stay with her in the U.S.

At a time when immigration courts are struggling to manage the high volume of migrants coming to New York City, another section of the system is facing a high volume of deportation cases: those of unaccompanied minors – children who entered the U.S. when they were under the age of 18, without a parent. Many of them show up to court without an attorney, and advocates are concerned that there aren’t enough resources to reach all of them.

“We are definitely seeing an uptick in the numbers,” said Sierra Kraft, executive director of a coalition called the Immigrant Children Advocates Relief Effort (ICARE).

Kraft said she observed the juvenile docket several times this year and found hundreds of children had come to court without legal representation.

“There was a little two year old that was sitting there with a sponsor, and they had no representation and really no idea what to do next. So it’s a real crisis,” Kraft said.

At a Senate hearing on the safety of unaccompanied migrant children in Congress last week, Lorie Davidson, Vice President of Children and Family Services at Lutheran Immigration and Refugee Service, testified that most unaccompanied children do not have an attorney to represent them.

“I do not know of any other circumstances in which a three-year-old would have to represent themselves in court. It is indefensible,” Davidson said at the hearing.

Administrations of both parties have employed and disgracefully defended this clearly unconstitutional, due-process-denying process. The “low point” was probably during the Obama Administration when an EOIR Assistant Chief Immigration Judge infamously claimed that he could “teach asylum law to toddlers” — touching off an avalanche of internet satire. But, the Executive has had plenty of help from Congress and the Article III Courts, who both have failed to end this mockery of constitutional due process as well as common sense. It’s hard to imagine a more glaring, depressing example of failure of public officials to take their oaths of office seriously!

On the other hand, NY Immigration Judge Olivia Cassin, mentioned in the full article, is the right person for the job of handling the so-called “juvenile docket” at EOIR. A true expert in immigration and human rights laws, she came to the job several decades ago with deep experience and understanding gained from representing individuals pro bono in Immigration Court. 

She is a model of what should be the rule, not the exception, for those sitting on the Immigration Bench at both the trial and appellate levels. Although AG Garland has done somewhat better than his predecessors in “balancing” his appointments, EOIR still skews far too much toward those with only prosecutorial experience or lacking ANY previous immigration and human rights qualifications.  

Consequently, poor, inconsistent, and uneven judicial performance remains endemic at EOIR and not sufficiently addressed by Garland in his two plus years in office. Just another reason why Garland’s failing courts are running a 2 million case backlog and are unable to provide the nationwide due process, guidance, leadership, and consistency that EOIR was supposedly created to furnish.

Brilliant, well-qualified, and committed as individuals like Judge Cassin are, they are not going to be able to solve this problem without some help and leadership from above. Sadly, this doesn’t appear got be on the horizon.

For people fleeing violence and persecution, nothing is more important than finding safety. For more than 40 years, U.S. asylum law has guaranteed asylum seekers the right to access legal protections enabling them to stay in the United States and avoid being returned to danger. But since the Refugee Act was signed into law in 1980, the laws on asylum eligibility have grown into a maze of convoluted requirements and pitfalls, like the children’s game “Chutes and Ladders,” with potentially deadly consequences. 

Because of the complexity and requirements of asylum law, it takes time to prepare an asylum application. In my 25 years of practice, I have prepared and filed hundreds of asylum applications. Based on my experience, it takes time to get an accurate account of someone’s life when there’s violence and trauma involved. It takes time to find evidence of torture and persecution. When you read this report, I encourage you to try to imagine navigating the complex legal steps in the asylum process. Then, imagine doing it without an attorney, a nearly impossible task as extensive research and data has shown.1 

This report comes at a critical moment when increased migration to the U.S. southern border and intense political pressure are pushing lawmakers to process asylum seekers faster. Faster can be accomplished, but it must also be fairer. If the system is fair, people meriting protection will receive it and those not eligible can and must depart. Toward that end, this report includes several recommendations that improve asylum processing so that it is both fair and more efficient. It is our hope that this report will contribute to policy reforms that are grounded in the realities of asylum law and the system that implements it.

Executive summary and recommendations 

The heightened levels of migration worldwide are drawing intense political and media attention to the United States’ southern border, including radical calls for blocking access to asylum seekers that would undo longstanding American humanitarian principles. More balanced, smarter approaches are available. In fact, since taking office, the Biden Administration has implemented several such policies, including the scale-up of resources to screen asylum seekers at the border and the expansion of existing legal pathways for people to obtain protection. 

Unfortunately, the President is also accelerating and truncating the asylum system in an attempt to speed up the process with policies like the 2022 asylum processing rule and the dedicated dockets program.ii AILA has forcefully opposed these recent policies because they are restricting or blocking asylum access and, as a result, deeply compromising the integrity and fairness of the U.S. system.iii 

This report on the asylum process draws principally upon the expertise of AILA’s membership of more than 16,000 immigration attorneys and law professors nationwide who provided more than 300 detailed responses to a survey about the critical steps and time required to prepare an asylum case.iv The report’s principal conclusion is that the minimum time required for an attorney to properly prepare an asylum case is 50 to 75 hours. While this estimate accounts for some complications, an asylum case can take much longer. For example, the attorney may need to find evidence of torture in a country that is still wracked by political violence or devote extensive interview time to obtain sensitive information from the asylum applicant while they are still suffering from trauma. See Appendix I. 

The government can greatly increase the efficiency of the asylum process by increasing agency resources and capacity and by eliminating existing delays within the system. Some of those steps are being taken, but further action is urgently needed . AILA recommends the Biden Administration use a systemwide, all-of-government approach to implement a range of solutions that will improve asylum processing and the management of migration at the U.S. southern border. 

America needs an asylum system that is in line with the nation’s commitments to protect asylum seekers and ensure a fair legal process while also meeting the urgent demand for greater efficiency and capacity. The country’s immigration system must be able to quickly identify who has a legitimate claim for humanitarian protection and who does not. Those not eligible should be required to depart. But imposing strict, arbitrary timelines for asylum that do not allow for adequate preparation will result in eligible asylum seekers being denied protection and sent back to face persecution or death.

Ultimately, systemwide changes can only be accomplished through congressional action to appropriate the funding required to meet these systemic demands. After three decades of inaction, Congress must pass immigration laws that ensure America’s immigration system is ready for the future. 

Key findings 

  • The basic steps of preparing an asylum application takes an estimated minimum of 50 to 75 hours. This work cannot be done in one continuous period; instead, it is carried out over the course of several months. Cases with significant complexity can take far more time than this estimate.
  • Most asylum cases are not straightforward. Complicating factors that add time to an asylum case may include detention, past trauma experienced by the applicant, language barriers, and procuring evidence from foreign countries or expert witnesses such as medical testimony.
  • It is extremely difficult for an asylum seeker represented by counsel to sufficiently develop their asylum application within the mandatory deadlines established in the May 2022 asylum processing rule or the expedited family court “dedicated dockets.”

    Ensure asylum timelines do not undermine fairness
  • When setting asylum processing deadlines, allow adequate time for an asylum seeker to obtain counsel and for the attorney to prepare for the case. Timelines should not rush trauma survivors who may need more time to recount their experience. Reasonable continuances should be allowed to obtain an attorney or for attorney preparation.
  • Waive or exempt asylum seekers from deadlines if the reason the deadline was not met is outside of their control.
  • Do not hold asylum seekers to the same evidentiary standards when they are subject to expedited adjudication timelines, such as the shortened deadlines of the 2022 asylum processing rule.
    Reduce government delays and inefficiency
  • Establish uniform policies, centralized systems, and appropriate information sharing between immigration agencies. Agencies should centralize and digitize address changes across all agencies and simplify access to a noncitizen’s immigration record. These steps will enhance communication and data sharing, which will in turn reduce backlogs, avoid delays, and increase efficiency and fairness.
  • Reduce the immigration court backlog. Executive Office for Immigration Review (EOIR) should continue expanding initiatives to remove cases from the docket or facilitate the resolution of cases through pretrial conferencing. Immigration judges should administratively close or terminate appropriate cases, such as those eligible for a benefit with U.S. Citizenship and Immigration Service (USCIS).2
  • Do not expend finite prosecutorial resources on cases that can be resolved more expeditiously. Immigration and Customs Enforcement’s (ICE) Office of the Principal Legal Advisor (OPLA) attorneys should engage in pretrial negotiations and exercise prosecutorial discretion to avoid unnecessary litigation.

Legal access and representation improve fairness and government efficiency 

  • Ensure asylum seekers and other migrants being processed rapidly at the U.S. southern border have access to legal information, advice, and full counsel during credible fear interviews (CFIs), Customs and Border Protection (CBP) inspections, and immigration court proceedings.
  • Congress should Fund the Department of Justice (DOJ) to provide legal representation for all immigrants. Everyone needs access to an attorney to provide legal advice and information prior to any hearings, including the CFI. Congress should appropriate DOJ funding to provide full legal representation to those in removal proceedings who cannot afford it.
  • Ensure access to counsel in all detention facilities. Detention facilities must be held accountable to policies that ensure attorneys have reliable confidential contact visits with clients, as well as access to free and confidential phone calls and video conferences. The government must monitor access to counsel at ICE facilities and impose penalties for violations of standards.
    Reduce immigration detention

Reduce immigration detention. Detention delays asylum cases because it creates barriers to obtaining counsel and makes case preparation far more difficult. The Department of Homeland Security (DHS) should reduce its use of immigration detention. 

Improve the asylum process 

  • The Biden administration should publish the long-awaited regulation on particular social group (PSG) asylum cases. On February 20, 2021, President Biden issued an executive order to promulgate this regulation by November 17, 2021,3 but it has not been published. A regulation would aid in consistency of application of asylum law and would reduce USCIS referrals to immigration court.
  • Increase transparency in adjudications by making DHS’s asylum officer training materials publicly available.
  • Establish an interagency task force to develop a trauma-informed adjudication system. Experts in development, mental health, welfare, and trauma science should all be involved in this process. A trauma-informed adjudication process will help ensure accurate adjudications in the first instance, which in turn will decrease appeals.
  • Fund additional asylum officers. Congress should appropriate funds to increase the capacity of USCIS to adjudicate asylum applications.

A year ago, I wanted to cite something in a regulatory comment, but the cite I needed didn’t exist yet.

Today, the American Immigration Lawyers Association released a report on asylum timelines, High-Stakes Asylum: How Long an Asylum Case Takes and How We Can Do Better. The report is based on a survey of over 300 asylum attorneys about how much time it takes to prepare an asylum application, and what complications add significant time. High-Stakes Asylum also includes recommendations on how to inject efficiency into the existing asylum process and ensure the integrity of a system that has life-and-death consequences.

Three decades ago, when I was practicing business immigration at Jones Day, we also did a robust pro bono Immigration Court BIA practice in which I played an advisory role. Even then, we allocated a minimum of 100 hours of attorney/paralegal prep time for an asylum case in Immigration Court and 40 hours for a BIA appeal. 

And, at that time, the system probably wasn’t as “intentionally user unfriendly” as it is now. On some occasions, we were responding to requests for pro bono representation from Immigration Judges who believed that without representation certain previously unrepresented detained cases would “be lost and linger in the system forever.” That was long before 2 million case backlogs!

Representation is essential for due process at EOIR! This fundamental truth is neither new nor is it “rocket science!” That politicians of both parties and Article III Judges have swept this truth under the carpet doesn’t make it less true! If lives of persons who didn’t have the bad fortune to be immigrants were at issue, this intentionally due-process-denying system would have been held unconstitutional by the Supremes decades ago!

Unfortunately, A.G. Garland has fashioned a “highly, unnecessarily, and intentionally user unfriendly system” that actually discourages and impedes pro bono and low bono representation.

Incredibly, the Biden Administration “blew off” recommendations by experts that Professor Pistone or one of her colleagues be recruited to “shake up” EOIR and radically reform and improve training in asylum and other forms of protection.

Lack of fundamental expertise and private sector expedience representing asylum seekers is a key reason why EOIR under Garland continues to “wander in the wilderness” of legal dysfunction with no way out! So unnecessary! So damaging to democracy!

Both parties have doubled down on inhumane border policies, but it’s the GOP that is taking it to new depths in its race to the bottom over who can be more deliberately cruel.

It’s like some kind of grotesque Last Supper: In a publicity photo from last week’s press conference, Texas governor Greg Abbott is seated at the center of a long table surrounded by grim-faced White men, most of them elderly, in various postures of mental agita. Next to them is a large illustration on an easel board titled “Live Test of Attempt to Breach.” It shows a man with an inner tube (presumably an asylum seeker) clinging to a floating red buoy. Hundreds of these buoys Abbott announced, will be deployed on the Rio Grande near the town of Eagle Pass. The barrier will be 1,000 feet long, and its netting will extend underwater, catching anyone who tries to swim under it.

“We don’t want anyone to get hurt,” said Steve McCraw, head of Texas’s Department of Public Safety, at the June 9 press conference. “We want to prevent people from drowning.”

The floating buoy barrier will persuade people not to cross, he said. “This is to deter them from even coming in the water.”

But we already know this isn’t true. Both McCraw and Abbott were parroting the same strategy, known as “prevention through deterrence,” introduced in the mid-1990s during the Clinton administration. It has turned our southern border into a graveyard. After nearly three decades of militarized border buildup that has pushed people into increasingly deadly terrain like the Sonoran Desert, people haven’t stopped coming. But thousands of them have died.

As Todd [Miller] recently wrote in his poignant piece about this deadly strategy, “On the cusp of summer, we can predict like clockwork that hundreds of otherwise healthy people will be dead by summer’s end. It has an aura of premeditated murder.”

These floating barriers, which, according to the manufacturer’s website, can also be reinforced with spikes, will only contribute to an already-skyrocketing death count. Abbott’s latest announcement has already spurred many human rights organizations to sound a warning. Jenn Budd, a former Border Patrol agent and now border human rights activist, along with fellow Texas-based activist Marianna Treviño Wright, released a bilingual video warning migrants of the deadly new policy.

All-in on Fascism

Abbott has long toyed with the idea of running for president. While it increasingly looks less likely that he will, Florida governor Ron DeSantis has already joined the fray. And he’s all-in on fascism. When he’s not treating fellow human beings like FedEx packages, he’s modeling himself after Viktor Orbán, Hungary’s authoritarian leader, and darling of the CPAC circuit. Last week DeSantis released “B-roll” of Florida state troopers surveying the Texas-Mexico border as they participate in Abbott’s Operation Lone Star. I suspect they didn’t include any audio in the B-roll because it would humanize the children and adults waving to the troopers from the Mexican side of the river, detracting from DeSantis’s threatening narrative of an invading army.

DeSantis’s campaign video begins with a Texas DPS officer, who sports an official DPS seal on his tactical face covering, unlocking a tiny metal door surrounded by razor wire. This is next-level border security theater, as comical as it is utterly surreal and tragic. Several other Republican-led states are also, once again, sending troopers and National Guard soldiers to the Texas border—as they did before the 2022 midterm—to wage war against the Biden White House before the election. Unfortunately, it’s border communities and migrants who are caught in the crossfire.

For many years, I’ve documented border theater as it has ebbed and flowed depending on the political tide. But as I’ve been documenting in The Border Chronicle, we’ve reached an altogether different and deadly era of disinformation, with the GOP parroting invasion and great replacement rhetoric, and increasingly dehumanizing people, spurring mass shootings and political violence. This behavior is championed by a growing right-wing media ecosystem which in turn promotes more anti-democratic and extremist behavior.

I spoke with Sergio Muñoz, vice president of Media Matters for America, a nonprofit that has tracked conservative media for nearly two decades. I quoted Muñoz in a recent article, and wanted to include my full Q&A with him here. As Muñoz warns, the U.S. is in a “dangerous moment” as it approaches the 2024 presidential election.

Yes, “deterrence gimmicks” directed at refugees have a decades-long proven record of failure. You can just look at the efforts of the EU to “bar the door” to refugees from Africa and the Middle
East. 

The boats continue to come, some sink, people drown. But, not surprisingly to those other than the “overprivileged and elitist White power class” like Abbott and DeSantis, desperate individuals forced from their homes are going continue to come — at any cost, even their own health, safety, and sometime lives. 

Most would rather “risk it all” on a shot — even a very long shot — at stability and a real life, rather than facing the certainty of wasting away without hope, freedom, or opportunity and having to watch the same thing happening to younger generations. Some, against all odds, continue to believe that rich, powerfu Western countries like the U.S. will eventually live up to their solemn legal obligations to protect refugees and asylum seekers!

While, as Melissa cogently points out, these inane, yet deadly, gimmicks do kill migrants, they don’t do so at a high enough rate to materially affect the flow. It’s just causing pain, suffering, and sometimes death for their own perverted sake.

Apparently, neo-fascists like Abbott, DeSantis, Trump, and their “role model” Stephen Miller just “get off on” watching others suffer unnecessarily. Bullies and cowards often get a kick out of observing the effects of their handiwork.

Meanwhile, the public money being wasted on these cruel, yet ultimately ineffective stunts (remember former AZ Gov. Ducey’s shipping containers arrayed and then disassembled at government expense), could much, much better be spent on providing representation, organized resettlement, and humanitarian assistance to asylum seekers.

As Melissa says, the GOP’s (and sometimes, unfortunately the Dems’) “uber-enforcement/deterrence gimmicks are “as comical as [they are] utterly surreal and tragic.” It’s time for decent Americans to “just say no” to these horrible folks and their failed and deadly policies of dehumanization and degradation!

On May 11th, I was with a group of people at the bottom of the Paso del Norte bridge in Ciudad Juárez, Mexico. Suddenly, I realized that I didn’t have the small change needed to cross the bridge and return to El Paso, Texas, where I was attending the 16th annual Border Security Expo. Worse yet, this was just three hours before Title 42, the pandemic-era rapid-expulsion border policy instituted by the Trump administration, was set to expire. The media was already in overdrive on the subject, producing apocalyptic scenarios like one in the New York Post reporting that “hordes” of “illegals” were on their way toward the border.

While I searched for those coins, a woman approached me, dug 35 cents out of a small purse — precisely what it cost! — and handed the change to me. She then did so for the others in our group. When I pulled a 20-peso bill from my wallet to repay her, she kept her fist clenched and wouldn’t accept the money.

Having lived, reported, and traveled in Latin America for more than two decades, such generosity didn’t entirely surprise me, though it did contradict so much of the media-generated hype about what was going on at this historic border moment. Since Joe Biden took office in 2021, the pressure on his administration to rescind Trump’s Title 42 had only grown. Now, it was finally going to happen — and hell was on the horizon.

But at that expo in El Paso that brought together top brass from the Department of Homeland Security (DHS), its border and immigration enforcement agencies, and private industry, I was learning that preparations for such a shift had been underway for years and — don’t be shocked! — the corporations attending planned to profit from it in a big-time fashion.

Seeing the phase-out of Title 42 through the lens of a growing border-industrial complex proved grimly illuminating. Border officials and industry representatives continued to insist that just on the other side of the border was a world of “cartels,” “adversaries,” and “criminals,” including, undoubtedly, this woman forcing change on me. By then, I had heard all too many warnings that, were the United States to let its guard down, however briefly, there would be an infernal “border surge.”

As I later stood in the halls of that expo, however, I became aware of another type of surge not being discussed either there or in the media. And I’m not just thinking about the extra members of the National Guard and other forces the Biden administration and Texas Governor Greg Abbott only recently sent to that very border. What I have in mind is the surge of ever higher budgets and record numbers of Customs and Border Protection (CBP) and U.S. Immigration and Customs Enforcement (ICE) contracts guaranteed to ensure that those borderlands will remain one of the most militarized and surveilled places on planet Earth.

At $29.8 billion, the CBP/ICE portion of the DHS budget he praised was not just the highest ever but a $3 billion jump above 2022, including $2.7 billion for “new acquirements in our southwestern border.” In other words, the coming surge at the border was distinctly budgetary.

For context, when Donald Trump took office in 2017 his CBP/ICE budget was $21.2 billion. By 2020, it had gone up to $25.4 billion. In other words, it took him four years to do what the Biden administration essentially did in one. The last time there had been such a jump was from $9.4 billion in 2005 to $12.4 billion in 2007, including funding for huge projects like the Secure Fence Act that built nearly 650 miles of walls and barriers, SBInet which aimed to build a virtual wall at the border (with special thanks to the Boeing Corporation), and the largest hiring surge ever undertaken by the Border Patrol — 8,000 agentsin three years.

But if that’s what $3 billion meant in 2005-2007, what does it mean in 2023 and beyond? Gone was the Trump-era bravado about that “big, beautiful wall.” Hysen’s focus was on the Department of Homeland Security’s launching of an Artificial Intelligence Taskforce. A technocrat, Hysen spoke of harnessing “the power of AI to transform the department’s mission,” assuring the industry audience that “I follow technology very closely and I am more excited by the developments of AI this year than I have been about any technology since the first smartphones.”

Robo-Dog
This cuddly robo version of “man’s best friend” can be fully outfitted to “go into barracks and blow a motherfucker’s face off.” And, it can be triggered by an agent 30 miles away! How great is that! Sadly, in the midst of all this techno-warfare at the border, the Biden Administration can’t scrape together the resources to humanely resettle and fairly and timely process those asylum seekers they DO let into the country. It’s a question of priorities.

That robo-dog in front of me caught the state of the border in 2023 and the trends that went with it perfectly. It could, after all, be controlled by an agent up to 33 miles away, according to the vendor, and apparently could even — thank you, AI — make decisions on its own.

The vendor showed me a video of just how such a dog would work if it were armed. It would use AI technology to find human forms. A red box would form around any human it detects on a tablet screen held by an agent. In other words, I asked, can the dog think?

I had in mind the way Bing’s Chatbox, the AI-powered search engine from Microsoft, had so infamously professed its love for New York Times reporter Kevin Roose. A human, using an Xbox-like controller, the vendor told me, will be able to target a specific person among those the dog detects. “But,” he reassured me, “it’s a human who ultimately pulls the trigger.”

In Mexico, when I walked to a spot where the Rio Grande flowed between the two countries, I ran into a small group of migrants camped out at the side of the road. Near them was a fire filled with charred wood over which a pot was cooking. A pregnant Colombian woman told me they were providing food to other migrants passing by. “Oh,” I asked, “so you sell food?” No, she responded, they gave it away for free. Before they had been camped out for months near the immigration detention center in Ciudad Juárez where a devastating fire in March killed 40 people. Now, they had moved closer to the border. And they were still waiting, still hoping to file applications for asylum themselves.

Behind where they sat, I could see the 20-foot border wall with coiling razor wire on top. There was nothing new about a hyper-militarized border here. After all, the El Paso build-up had begun 30 years ago with Operation Hold the Line in 1993. A desert camo Humvee sat below the wall on the U.S. side and a couple of figures (Border Patrol? National Guard?) stood at the edge of the Rio Grande shouting to a Mexican federal police agent on the other side.

The clock for the supposed Title 42 Armageddon was ticking down as I then crossed the bridge back to El Paso, where more barriers of razor wire had only recently been emplaced. There was also a slew of blue-uniformed CBP agents and several jeeps carrying camouflaged members of border units. Everyone was heavily armed as if about to go into battle.

At the Border Security Expo, Hysen pointed out that fear of a Title 42 surge had resulted in an even more fortified border, hard as that might be to imagine. Fifteen hundred National Guard troops had been added to the 2,500 already there, along with 2,000 extra private security personnel, and more than 1,000 volunteers from other agencies. Basically, he insisted, they had everything more than under control, whatever the media was saying.

At the Edge of Everything — and Nothing At All

On the morning of May 12th, I was with border scholar Gabriella Sanchez at the very spot where the borders of Texas, New Mexico, and Chihuahua meet near El Paso. Title 42 had expired the night before and I asked her what she thought. She responded that she considered this the border norm: we’re regularly told something momentous and possibly terrible is going to happen and then nothing much happens at all.

And she was right, the predicted “surge” of migrants crossing the border actually decreased — and yet, in some sense, everything keeps happening in ways that only seem grimmer. Perhaps 100 yards from where we were standing, in fact, we soon noticed a lone man cross the international boundary and walk into the United States as if he were taking a morning stroll. Thirty seconds later, a truck sped past us kicking up gravel. For a moment, I thought it was just a coincidence, since it wasn’t an official Border Patrol vehicle.

Then, I noted an insignia on its side that included the U.S. and Mexican flags. The truck came to a skidding stop by the man. A rotund figure in a gray uniform jumped out and ran toward him while he raised his hands. Just then, a green-striped Border Patrol van also pulled up. I was surprised — though after that Border Security Expo I shouldn’t have been — when I realized that the initial arrest was being made by someone seemingly from a private security firm. (Remember, Hysen said that an extra 2,000 private security agents had been hired for the “surge.”)

In truth, that scene couldn’t have been more banal. You might have seen it on any May 12th in these years. That banality, by the way, included a sustained violence that’s intrinsically part of the modern border system, as geographer Reece Jones argues in his book Violent Borders: Refugees and the Right to Move. In the days following Title 42’s demise, an eight-year-old Honduran girl died in Border Patrol custody and a Tohono O’odham man was shot and killed by the Border Patrol. In April, 11 remains of dead border crossers were also recovered in Arizona’s Pima County desert alone (where it’s impossible to carry enough water for such a long trek).

In the wake of Donald Trump, everything on the border has officially changed, yet nothing has really changed. Nothing of note is happening, even as everything happens. And as Hysen said at that border expo meeting, big as the record 2023 border budget may be, in 2024 it’s likely to go “even further” into the stratosphere.

Put another way, at the border, we are eternally at the edge of everything — and nothing at all.

From Ike’s “Military-Industrial Complex” to Biden’s “Border-Industrial Complex” — my life has spanned it all! But, while Ike was trying to warn us about the dangers ahead, Biden (and the GOP) are trying to lull us into accepting unending and largely unaccountable border militarization as the inevitable wave of the future — even a good thing!

I’ve got nothing against technology! But, it should employed to make humanity better, not just for its own sake.  As I suggest below, the “Armed Robot-Dogs v. CBP One” (or EOIR’s venture into the virtual world) strongly suggest the lack of a healthy balance! 

Human migration is even older and more permanent than never-ending border militarization, industrialized cruelty, and dehumanization. The latter are now routinely practiced by the very Western nations who once, long ago, fought against Nazism and vowed, apparently somewhat disingenuously, “never again!”

Human migration was in motion long before the creation of the modern nation-state. It will be with us as long and there is life on earth.

Moreover, the realities of climate change and the future migrations and political reckonings it will force go well-beyond our already overly restrictive legal refugee regimes. Like it or not — and those of us fortunate to live in potential “receiving countries” shouldn’t fear it — there will be more, not less, human migration in the future.

In this context, I’m highly skeptical that “armed robo-dogs” — even those miracles of modern technology fully weaponized to “go into barracks and blow a motherfucker’s face off” — are the durable solutions to inevitable events that we need. 

It struck me that the woman who insisted that Todd keep her 35 cents, and the patient folks camped out around a wood cooking fire just south of the fence, waiting for appointments and hearings that might never come from the poor technology (how would an armed robo-dog react to the badly flawed “CBP One App” inflicted on human asylum seekers — state of the art technology seems rather one-sided at DHS, as most advocates would tell you) and our broken asylum legal system, probably are closer to having the answers to the future than any of the “hot air” politicos calling the shots or aspiring to do so.

With clothing, food and shelter, church groups aid people flown to California on chartered flights arranged by Florida officials, which many in this state call a political stunt

SACRAMENTO — On the same day that Florida Gov. Ron DeSantis’ administration took responsibility for sending dozens of migrants seeking asylum to California, the volunteers and organizers inside the Trinity Episcopal Cathedral of Sacramento refused to say the Republican politician’s name.

Instead, they wanted to talk about the 36 men and women they’ve cared for this week, who they say were left exhausted, confused and afraid at the doorstep of a local church in what California officials have called a political stunt.

Gabby Trejo, executive director of Sacramento Area Congregations Together, said the migrants she took to church with her on Sunday — some who had walked thousands of miles over the course of several months from Venezuela to the U.S. — reached into their pockets to offer a dollar for the collection plate.

“I said, no, you need it more than our church does today. But they didn’t care. They still put it in the plate,” Trejo said. “In that moment, our new neighbors showed me what it means for them to also be able to contribute to our community.”

Cecila Flores, who has supported the migrants since the first group arrived by plane on Friday, wiped away tears at a news conference on Tuesday.

In their 20s and 30s, most of the migrants are the first in their families to make it to the U.S. and are eager to work, she said. Some are married. One brought along a dog named Gieco.

When she asks them simple questions like what they want for dinner, they are timid. Anything is fine, they always say.

“It’s been years since I’ve been able to pick my own clothes,” one man told Flores, an organizer at Sacramento ACT, after a volunteer took him to the thrift store.

The identities of the migrants, who also came from countries including Colombia and Guatemala, remain undisclosed as the California Department of Justice investigates the incident. Meanwhile, Democratic Gov. Gavin Newsom has threatened conservative presidential hopeful DeSantis with kidnapping charges.

Organizers said Tuesday that the migrants had arrived at the Texas border, where they were met by people claiming to be with a relocation program, promising housing and jobs. They were then shuttled to New Mexico and flown to Sacramento on a chartered plane.

The people working on the ground with them in Sacramento said that the migrants had no idea where they were headed. Their “American dream” quickly became “a nightmare,” Trejo said, adding they were deceived.

Along with city and county officials, local church leaders and nonprofits have scrambled to help them.

Where is the leadership, competence, and “good government” the Biden Administration promised during the 2020 campaign?

California needs affordable housing and workers, particularly in agriculture, child care, and health care. Migrants can help with this. They are eager to contribute.

The key is to get them represented, through the system with grants of asylum or other protection that many are eligible for, work authorized, and on their way to durable legal status. 

Stunts like De Santis’s, misplaced “deterrence,” lack of creativity, and poor leadership by the Administration and Dems in DC are wasting resources and time that could be used to solve problems, not aggravate them! 

Once again, the Biden Administration has left the job of making the flawed immigration system work to individuals without sufficient Federal support or coordination. Yet, they disdain the advice and counsel of these “grass roots experts” in favor of mindless, half-baked deterrence gimmicks derived from Stephen Miller and other GOP neo-fascists! Why?

I started my post-law school immigration law career at ProBAR in Harlingen, Texas, as an Equal Justice Works Fellow from September 1999 to September 2001.  In May, 2023, I had the privilege of returning to ProBAR as a volunteer with the ABA Commission on Immigration (COI) to engage in a week of pro bono service.  I have been a Commission member for almost three years.  My return, over twenty years after I left the Rio Grande Valley, provided me perspective, and caused me to reflect on the many changes as well as the constants in the South Texas border region, where I learned how to be a fierce immigration advocate.  I was privileged to spend the week with welcoming ProBAR staff, COI colleagues, and the COI director, Meredith Linsky, who was my boss and mentor at ProBAR, a hero to the immigrants’ rights movement, and is someone I am proud to call a colleague and friend.

Our first day of our pro bono week began at the new ProBAR office.  When I walked into the office, I felt like I was in a different world!  ProBAR’s new office space is large, spacious, beautiful, and inviting.  It is clear that much thought went into the design and structure of the office, considering the need for private office space, open collaborative space, large quiet spaces, conference rooms, outdoor space, and a gym and yoga room to ensure staff can decompress and energize before, during, or after long, challenging, and emotionally draining days.  The office is a sharp contrast to the ProBAR office where I worked—two rooms on the second floor of an old, pest-infested house.  The new office is equipped with state-of-the-art technology, another contrast from my experience, where we used dial up internet and unplugged the fax machine before we could access the internet.  We learned that ProBAR now has a staff of 270 people.  In 1999 when I started, we were a staff of three—the ProBAR director, the volunteer paralegal, and me.  I am thrilled to see the investment in the staff through hiring and creating a livable workspace.  Comfortable, functional, supportive workspace is crucial to the sustainability of the demanding work.

Our schedule for the week included meeting with partner organizations in Brownsville and Matamoros, meeting with individuals detained at the Port Isabel Detention Center (PIDC), touring children’s shelters, and visiting La Posada Providencia, a welcoming shelter for many immigrants and refugees.  I was impressed by the resiliency and responsiveness of organizations in the region.  The increase in resources for noncitizens in the Rio Grande Valley was striking and is unquestionably due to necessity.  The humanitarian crisis at the border is unlike anything I saw between 1999 and 2001 and the need has increased exponentially.  I was impressed by the partnerships established by the ProBAR team.  The increased staffing has allowed ProBAR to form and maintain crucial partnerships throughout the Rio Grande Valley.  During my time at ProBAR, we relied on trusted partnerships; however, due to our limited staffing, we were unable to engage in outreach or foster relationships with many organizations.  The current partnerships with shelters and other social services organizations are crucial to ProBAR’s ability to meet the needs to the community they serve.

ProBAR’s presence in Brownsville is remarkable.  We utilized ProBAR’s small office close to the border.  This space was crucial when the Migrant Protection Protocols (MPP) program was still in place, as ProBAR staff served clients facing removal proceedings in the tent courts.  The office space on the border continues to provide essential access to clients and the social services agencies that serve them.  It allows the ProBAR staff to do outreach, education, and intake at the non-legal organizations that serve mutual clients.  For example, while in Brownsville, we provided legal consultations to numerous individuals staying at a Brownsville shelter.  We also visited one of the unaccompanied children’s shelters in Brownsville, where ProBAR staff provide services.

During our pro bono week, we had the opportunity to travel to PIDC twice to provide consultations to recently arrived asylum seekers.  It was bittersweet to return to the detention center I frequented from 1999 to 2001, when I traveled daily to what was then called Port Isabel Service Processing Center (PISPC) – PIDC is a more appropriate name.  PIDC has not changed much.  The entrance, lobby, attorney visitation area, and court space have been remodeled.  I recall a dingy dirty lobby with a pay phone I used regularly to call the ProBAR office after long afternoons of presentations and consultations.  The lobby is now clean, spacious, and the pay phone is gone.  However, the interior of the detention center remains the same- a jail with razor wire, barbed wire, and no freedom of movement.  Also similar was ProBAR’s access to the facility due to the reputation the agency has built over the years.  When I went to PISPC daily, I felt respected by guards and government officials.  I learned the importance of building those relationships to ensure access to those who needed the services.  ProBAR’s reputation endures, and the relationships remain strong.  ProBAR’s continued ability to provide Know Your Rights presentations and consultations in the facility is crucial to serving the needs of thousands of individuals every year.

In the two days I conducted consultations with noncitizens at PIDC, I met men from Venezuela, Honduras, and Guatemala.  The nationalities of individuals detained have shifted over the years, but the reasons they have fled their homes remains constant.  They are fleeing political violence and oppression, gang violence, cartel violence, and government instability.  The men detained at PIDC endured exceptional hardship, danger, and suffering to arrive at the United States border to seek refuge.  While United States detention policies and conditions were cruel when I worked at ProBAR, they are exponentially worse today.  Currently, noncitizens are forced to stay in unsanitary and unsafe refugee camps in Matamoros often for months while trying to request protection in the United States.  They face disease, kidnapping, rape, and torture in Matamoros while the United States and Mexican governments turn a blind eye and collaborate to keep them from crossing the bridge into Brownsville.  When those lucky enough to find a way into the United States arrive, many are forced to remain detained in Customs and Border Protection custody for weeks, sleeping on the floor with limited to no access to showers and in freezing rooms or cells.  They then must navigate the new confusing and complex asylum rule without counsel.  While we were unable to provide representation, the men we met with were grateful for our explanation of the legal process, as well as the pro bono legal consultations we provided.

As part of our trip, we also had the opportunity to go to Matamoros and meet with partners at the Sidewalk School.  The plan to walk over the bridge, meet with Sidewalk School staff, and tour one of the refugee shelters took much time and coordination on the part of ProBAR and ABA staff.  Unlike when I lived and worked in Harlingen, when going to Matamoros was often a spur of the moment decision to have dinner or go shopping, today, numerous considerations must be assessed.  Matamoros was a safe city when I crossed regularly.  However, today, due to the United States’ and Mexico’s war on drugs, Matamoros is often dangerous, particularly for refugees hoping to reach the United States.  I appreciate the care, planning, and coordination that went into our day in Matamoros.  Witnessing the situation at the base of the bridge as well as the refugee camp was crucial to gaining a true understanding of the consequences of United States immigration law and policy changes over the last several years.  Photos of the bridge and the camp provide a glimpse into the reality that refugees are living.  However, the photos did not prepare me for what I saw and experienced.  Walking into and around the shelter full of makeshift tents, no sanitation, no services, in 90+ degree temperatures with soaring humidity was horrifying.  People approached us for information and help, desperate to access medical care and safety.  I fought back tears the entire time we were in the camp.  No one should live in these conditions, and no one who lives in the camps is there by choice.  Refugees tolerate the dangerous, unsanitary conditions that are making them sick because they were forced to leave their homes.  Their flight was not voluntary.  Seeing the camp provided me even greater perspective on the situations they fled.  I left feeling sad, horrified, and angry at the United States government policies that created the humanitarian crisis in Matamoros.  It is avoidable.  It can be changed for the better.  Instead, the United States government recently finalized a rule to make it harder for those seeking protection to access the United States asylum system.  This rule will exacerbate the problems in Matamoros and has caused and will continue to cause greater human suffering on both sides of the border.

I am thankful for my week with ProBAR.  I appreciated starting my days as I started many days when I lived in Harlingen decades ago, running on the path along the Arroyo Colorado in the heat and humidity, among the beautiful lush green plants, chirping birds, and adorable bunnies.  I found peace and energy running on the path, which carried me through the days of the harsh realities of human suffering and unfair laws and policies.  My time at ProBAR reminded me why I continue to work as an immigration attorney, why I work at another amazing nonprofit, Immigrant Legal Defense, to provide free legal services to underserved communities, including noncitizens in ICE detention.

Ilyce is currently a Managing Attorney at ILD and Senior Counsel in the Immigration Program at Community Legal Services in East Palo Alto (CLSEPA).  She was an adjunct professor in the Villanova Interdisciplinary Immigration Studies Training for Advocates from January 2021 to December 2021.  She was previously the Director of the Immigrant Legal Defense Program at the Justice and Diversity Center of the Bar Association of San Francisco. Prior to joining JDC, Ilyce served for 18 months as an immigration judge in the San Francisco Immigration Court. Prior to serving as an immigration judge, Ilyce was the Directing Attorney of the Immigration Program at CLSEPA from 2012-2017. Under Ilyce’s leadership, CLSEPA’s immigration staff grew from four to twenty.  Ilyce also served temporarily as the first legal director for the San Francisco Immigrant Legal Defense Collaborative at the Bar Association of San Francisco in 2015. For 10 years, Ilyce was an attorney at Van Der Hout, LLP. Three of those years she spent as a partner. Before joining the private sector, she worked at the South Texas Pro Bono Asylum Representation Project (ProBAR) as a National Association of Public Interest Law/Equal Justice Fellow. Ilyce received the 2016 National Pro Bono Services Award from the American Immigration Lawyers Association; and was a 2015 Silicon Valley Business Journal’s “Women of Influence” awardee.  Ilyce is a commissioner on the American Bar Association’s Commission on Immigration and previously served as a commissioner on the State Bar of California Commission on Immigration and Nationality Law. I was detailed to the Port Isabel Detention Center shortly before my retirement. I remember it pretty much as Ilyce describes it today.

The facility and court personnel were nice and helpful. But, there was an aura of grimness, despair, and wastefulness hanging over everything that just couldn’t be dispelled. Leaving the facility every night have me a sense of relief.

I think that all so-called policy makers in the Biden Administration should be required to experience a week in one of their immigration prisons as a prerequisite for obtaining or retaining their jobs. Sadly, and inexcusably, we now have folks making life or death decisions about immigration and human rights policy and the future of our nation who know less and have less perspective than Ilyce and others had after completing their one-year EJW Fellowships! The lack of expertise, compassion, creativity, and common sense in the Biden Administration’s immigration hierarchy/bureaucracy shows!

To quote Ilyce, about the largely self-created “humanitarian crisis” at the border: “It is avoidable.  It can be changed for the better.” My question is why isn’t a Democratic Administration that many voted for to solve problems and make things better at the border getting the job done?

The lifting of Title 42 — the policy that shut down the U.S. asylum system for three years — should have been an inflection point leading to a more humane and orderly system for processing asylum seekers. Instead, the Biden administration doubled down on the politics of exclusion, introducing new restrictive measures, including an asylum ban, that keep asylum out of reach for those who need protection the most.

When asylum seekers are finally able to ask for protection, they are often met not with compassion but with cruelty. Just days ago in San Ysidro, I saw mothers with children sleeping on dirt while in Customs and Border Protection custody, sharing one port-a-potty for more than 500 people. Good Samaritans handed out supplies because CBP did not provide sufficient food, water or medicine.

President Biden has perpetuated these failed deterrence policies despite his campaign promises to restore humanity at our border. The administration has turned its back on asylum seekers. These are real people. They deserve our protection. They deserve to be safe.

These cruel, unnecessary, cowardly, and illegal policies are a disgrace to America and an embarrassment to the Democratic Party!

Meanwhile, dangerous lies are being promoted by Gov. Glenn “Junkman” Youngkin (R-VA) and other GOP Governors responding to Texas Gov. Greg Abbott’s racist/nativist call for further National Guard infusions to militarize the border. You don’t have to be either an immigration expert or very smart to recognize that desperate individuals trying to turn themselves in to CBP agents at or near the border, to exercise their legal rights to seek protection, are NOT going to be a meaningful source of fentanyl smuggling. That trade is controlled by cartels who basically smuggle product through ports of entry in large quantities disguised as or mingled with legitimate commercial commerce. 

Indeed, the preoccupation of CBP with improperly “deterring,” “discouraging,” and “punishing” legal asylum seekers not only empowers cartels, but significantly detracts from actual law enforcement against drug smugglers. And, the millions of dollars being misappropriated and wasted by Junkman and others on bogus National Guard deployments could much better and more appropriately be spent on humanitarian aid, coordinated, orderly resettlement programs for asylum seekers and asylees, and securing them legal representation to aid in the fair and timely processing of asylum claims. 

However, the repetition of bogus and deliberately fabricated narratives like the “Junkman’s” latest wasteful stunt creates a “guilt by repetition” syndrome that feeds and enables the racist agenda of today’s GOP as well as the spineless “rollover” response of the Biden Administration, and, sadly, some other so-called Democrats.

Executive Director Opening Plenary Remarks CLINIC Convening 2023

Good afternoon, dear friends. My name is Anna Gallagher and I have the honor of leading CLINIC as executive director. It is such a pleasure to be here with you all as we officially begin our first in-person Convening since 2019.

Looking out at the sea of faces in front of me, I am filled with gratitude to finally be able to come together to engage with one another, to listen, learn and gather strength for the work ahead in support of our immigrant brothers and sisters.

Even just being in your presence I feel a sense of renewed hope and energy. I am so looking forward to the next few days, and I am certain that you will be reignited to take on the important work ahead.

In a moment I will welcome our wonderful panel of Affiliate experts, but right now I want to take a moment to recognize this moment we’re facing and my hopes for this year’s CLINIC Convening.

You all, of all people, know that immigrant communities are facing truly unprecedented challenges – and I do not use that word, unprecedented, lightly.

With the lifting of Title 42, and the camps of men, women and children along the border desperate to find welcome on the other side; the proposed USCIS fee increases which threaten to put immigration benefits out of reach for many; the newly announced delays for foreign-born religious workers and special immigrant juveniles; and, perhaps above all, our warming planet and the outbreaks of violence which force many more people to migrate around the world – these are extremely challenging times for migrants in our country and around the world.

Several months ago, the New York Times featured an op-ed that has stuck with me, entitled, “The Rich World Has a Shockingly High Tolerance for Cruelty.”

It was about how rich nations are more willing than ever to let migrants languish at their borders in sub-human conditions rather than create safe pathways for migration or address the conditions causing people to flee.

It was about how the promises that nations made after World War II to respect the dignity and rights of those who are fleeing have been eroded and now, on a practical level, forgotten.

When I read this article, in my mind I was transported back to the time I spent in North Africa several years ago, working with migrants as a representative of Jesuit Refugee Services.

I interviewed migrants who had traveled for 18 months or more to try and find safety in these countries bordering Europe. I got to know some of the migrants, who called me “grandma” – a term of endearment, as my hair was grey.

While I was talking to some of them, they showed me their hands, which were scarred with wounds. When I asked them what happened, they said their hands were repeatedly pierced while climbing barbed wire to get through to safety.

Hearing this, my heart broke – as it has many times over the years.

The idea that we are using barbed wire to keep out our fellow human beings is inconceivable, yet true. Our immigrant brothers and sisters stand at our gates, begging for our aid, and we build barbed wire fences that pierce their hands.

Many wealthy nations are founded on a concept of all human beings being equal in dignity, but we do not act like it.

As we gather in Arizona, I know we are all mindful that these kinds of camps that the op-ed author is speaking of are just several hours away on the border. We also know that immigrant communities’ dignity is denied not only in these camps, but all over the country in the various places we’ve come from.

We must be clear, this is not an “other side of the world problem,” it is our problem. It affects all of us, in our integrity as people of faith and conscience, and as a reflection of our society.

And yet today, as I recall that New York Times op-ed, and the sense of frustration and despair I felt while reading it, I feel a surge of hope.

I want you to look around the room. Look at your neighbor to your left and right. YOU are the hope that fills my heart, and YOU are the hope that reignites me in our work.

As we gather here today, I am in a room full of people who DO act like all human beings are equal. Those who spend their precious time – often too much of their time, working long hours – trying to advance the truth that every person is precious, valuable, and deserving of a safe and dignified life.

That’s why being in your presence gives me such hope. I am reminded that the CLINIC network is full of holy people.

That is why our gathering here together, and throughout this week, is so powerful: we are, to borrow the words of Bishop Seitz of El Paso, working to be a “creative counterexample” to the culture of fear and hostility, to be a network that is slowly creating a new culture of solidarity and hospitality.

At CLINIC, we also are bolstered by our faith that we do not do this hard work alone. The spirit of God is inspiring us and pushing us forward, giving us strength and magnifying our efforts, especially when we are overwhelmed by the need in front of us.

Our faith also acts as a mirror for us, forcing us to keep evaluating whether we are truly reflecting the gospel truth of God’s concern for all people.

To maintain this faith, and to maintain the energy to be this creative counterexample, we need one another. Our network is sustained through the support, advice, and solidarity we demonstrate to one another.

Throughout the next few days, we will take the time to step back, to reflect on our work and learn and share new strategies, information, and tips for the very practical day-to-day work of supporting immigrant clients and communities.

We know that this practical work – the forms, the bureaucracy, the nitty-gritty details – changes and saves lives. So how well we can do it matters, which is why we gather to learn and grow.

We also gather to enjoy one another – to laugh, share stories, and reconnect with beloved colleagues and friends.

So I also hope that over the next few days you will have some fun!

“Esmelda Ruiz, a native and citizen of Peru, appeals the Board of Immigration Appeals’ determination that she is ineligible for relief under 8 U.S.C. § 1229b(b)(2), a provision whose language was originally adopted as part of the Violence Against Women Act of 1994 and that outlines the conditions under which certain “battered spouse[s] or child[ren]” qualify for discretionary cancellation of removal. As relevant here, it requires a petitioning alien to show that she “has been battered or subjected to extreme cruelty” by her spouse or parent. 8 U.S.C. § 1229b(b)(2)(A)(i). Ruiz contends that the Immigration Judge and the BIA made two errors in refusing her cancellation request. First, she maintains that, as a matter of law, they misinterpreted the statutory term “extreme cruelty” to require proof of physical—as distinguished from mental or emotional—abuse. And second, she asserts that, having misread the law, the IJ and the BIA wrongly concluded that she doesn’t qualify for discretionary relief. We agree with Ruiz that the IJ and the BIA misinterpreted § 1229b(b)(2) and thereby applied an erroneous legal standard in evaluating her request for cancellation of removal. Accordingly, we grant her petition for review and remand to the BIA for further consideration. … For the foregoing reasons, we agree with Ruiz—and hold— that the BIA misinterpreted 8 U.S.C. § 1229b(b)(2). The term “extreme cruelty” does not require a petitioning alien to prove that she suffered physical abuse in order to qualify for discretionary cancellation of removal; proof of mental or emotional abuse is sufficient to satisfy the “extreme cruelty” prong of § 1229b(b)(2)’s five-prong standard. Barometer of whether an asylum system is functioning is not “keeping the numbers low” at the border. We expected as T42 ended to see a temporary uptick due to pent up demand, but seeing the opposite indicates new deterrence measures are making asylum inaccessible to those who need protection the most.

It is obvious to those of us on-the-ground that despite no “lines” at the ports of entry there are many people here in Tijuana desperate to seek protection in the US, as evidenced by crowd at our Immigrant Defenders Law Center legal clinic today. People want to avail themselves of a safe, fair and orderly system.

This is currently impossible.

There were more than 200 people at the shelter, mostly families with small kids. When we asked whether or not people had been able to register with CBPone, most raised their hands that they had. When we asked whether they had an appt, only four had successfully made one. 4 out of 200.

We encountered excruciating cases like this asylum seeking mom & her daughter w/ severe autism. She asked if there is a special process for ppl like her, given her daughter needs medical attn, but we have to tell her to just keep trying the app. She has been waiting for months.

We continue to encounter cases where asylum seekers are unable to register with CBPone app at all. We finally registered a mom traveling alone w/ 2 babies via one of our atty’s phones, and now she can try for an appt. She has family in Los Angeles area who are waiting for her.

For people suffering from PTSD & other mental health conditions related to the horrors they fled, the constant state of anxiety waiting for an appointment is hell. One of the moms told me that every night she & her daughter cry and pray that it will be the day they can finally get help.

I am immensely proud of our San Diego based cross border team for continuing to show up and keep fighting despite the odds.

Ultimately, Title 42 has ended, but the asylum restrictionist approach that it was the apex of has clearly not. For now, there’s no return to normal Title 8 processing — which, as regular readers of our historical analyses know, has never been impartial or apolitical, but at least provided some semblance of access and cursory due process. Title 42 is dead. Long live Title 42.

This version of the transit ban is also, like its predecessor, under acute legal jeopardy. The ACLU has already sued to stop it, and some legal analysts are predicting that, given the precedents and legalities involved here, the administration’s efforts to make it compliant — including the very limited exceptions — won’t be enough. The CBP One exception is, after all, just another version of metering, another policy that was struck down. If there’s an injunction or even a final ruling and the transit ban goes down, then what? There’s at least some likelihood that word will spread and the surge of arrivals that was expected in the immediate aftermath of Title 42 will actually materialize then. How does the administration respond? Does it rush to enact an overlapping asylum restriction, as the Trump administration so often did? It’s hard to say.

A federal judge in Florida recently issued a restraining order blocking a Biden policy that would have allowed the administration to issue parole to some arriving families and instruct them to check in with ICE instead of placing them directly in removal proceedings, removing another option to control the immigration court backlog and avoid detaining families. It seems relatively unlikely that the administration will be happy to accept a defeat of its asylum restrictions that will then force it back into the uncomfortable position of detaining more families. In the meantime, market analysis site Seeking Alpha has upgraded the stock of private detention conglomerate GEO Group to “strong buy” in anticipation of strong profits from growth in detentions, not to mention GEO’s piece of all sorts of surveillance technologies used in the administration’s alternatives to detention programs.

In the meantime, an eight-year-old girl died yesterday in Border Patrol custody after having what is vaguely described as a “medical episode.” The machine churns on.

There’s lots of of “disturbing stuff” here. But, perhaps the worst and most discouraging is the role of the Biden Administration and some Dem pols in aiding, abetting, and even encouraging this 21st Century version of Jim Crow.

The poor and superficial reporting of the “mainstream media” — which performed like an adjunct Fox News — also has had life-threatening consequences. Eliza C. Klein, who left her position as an immigration judge in Chicago in April, said the latest increase in illegal border crossings will strain the understaffed work force as they prioritize migrants who crossed recently.

That will leave some older cases to languish even longer, she said.

“This is a great tragedy because it creates a second class of citizens,” Ms. Klein, who started working as an immigration judge in the Clinton administration, said of those immigrants who have been waiting years for an answer to their case. The oldest case Ms. Klein ever adjudicated had been pending in the court for 35 years, she said.

“It’s a disgrace,” Ms. Klein said. “My perspective, my thought, is that we’re not committed in this country to having a just system.”

While crowds of migrants continued to seek refuge in the United States after the lifting of Title 42, U.S. officials said the border remained relatively orderly. About 10,000 people crossed the border on Thursday, a historically large number, but that dropped significantly to about 6,200 on Friday.

Tens of thousands of migrants continued to wait in makeshift camps on both sides of the border for a chance to request sanctuary in the United States. The administration remained concerned about overcrowding; Border Patrol held more than 24,000 migrants in custody on Friday, well over the agency’s maximum capacity of roughly 20,000 in its detention facilities.

Mimi Tsankov, the president of the National Association of Immigration Judges, said that to truly address the backlog, the Biden administration would need to do more than simply hire more judges. She said that the government should increase funding for better technology and bigger legal teams, and that Congress should reform the nation’s immigration laws.

“The immigration courts are failing,” said Samuel B. Cole, the judge association’s executive vice president. “There needs to be broad systemic change.”

Judge Charles Honeyman, who spent 24 years as an immigration judge and retired in 2020, said he came away from his job believing the United States would need to do a better job of deterring fraud while protecting those who would be harmed in their home country.

When handling an asylum case, Mr. Honeyman said he would assess the person’s application and examine the state of their home country by reading reports from the State Department and nonprofits. Many of the applicants lacked attorneys; he believes some cases that he denied might have turned out differently if the migrants had had legal representation.

In trying to root out fraud, he would compare a person’s testimony with the answers they had given to an asylum officer or Border Patrol agent.

EOIR ABUSES ASYLUM SEEKERS — The Problem Goes Deeper Than The Number Of Judges: Quality & Culture Matter!

While the NYT article notes that the majority of asylum cases are eventually denied on the merits, this data is often presented in a misleading way by the Government, and unfortunately, sometimes the media. According to TRAC Immigration, during the period Oct 2000 to April 2023, approximately 43% of asylum seekers who received a merits decision were granted asylum or some other type of relief. Even in an overall hostile system, where individuals are often required to proceed without lawyers, and grant/denial rates among Immigration Judges vary by astounding levels (so great as to present prima facie due process issues), asylum seekers succeed on the merits of their claims at a very respectable rate. In a properly staffed and administered system where the focus was on due process and fundamental fairness for individuals, that number would almost certainly be substantially higher. 

Moreover, the data suggests that toward the end of the Obama Administration and during the entire Trump Administration, the asylum system was improperly manipulated to increase denials. 

For instance, in FY 2012, approximately 55% of asylum claims decided by EOIR on the merits were granted. https://trac.syr.edu/immigration/reports/306/. While there was no discernible worldwide improvement in human rights conditions in the following years, IJ asylum grant rates cratered during the Trump years, reaching a low of 29% in FY 2020, barely half the FY 2012 level. https://trac.syr.edu/immigration/reports/668/#:~:text=While%20asylum%20grant%20rates%20declined,after%20President%20Biden%20assumed%20office.%20That%E2%80%99s%20a%20decline%20of%20nearly%2050%%20since%20the%20FY%202012%20high.

I think there are three reasons for the precipitous decline in asylum grant rates, largely unrelated to the merits of the claims. First, Attorneys General Jeff Sessions and Bill Barr overruled some of the leading administrative precedents supporting grants of asylum. In the process, they made it crystal clear that they considered Immigration Judges to be their subordinate employees within the political branch of Government and that denial, deportation, and assistance to their “partners” at DHS Enforcement (actually DHS is a party before EOIR, not a “partner”) were the preferred results at EOIR.

Second, in greatly expanding the number of Immigration Judges, Sessions and Barr appointed almost exclusively from the ranks of prosecutors and government attorneys, even elevating an inordinate number of individuals with no immigration and human rights experience whatsoever. Not only were well-qualified individuals with experience representing individuals in Immigration Court largely passed over and discouraged from applying, but some of the best Immigration Judges quit or retired prematurely as a matter of conscience because of the nakedly anti-immigrant pro enforcement “culture” promoted at EOIR. 

Additionally, the nationwide appellate court and precedent setter, the BIA, was expanded and “packed” with some Immigration Judges who denied virtually all of the asylum cases coming before them and had reputations of hostility to the private bar and asylum seekers. Remarkably, Attorney General Garland has done little to address this debilitating situation at the BIA.

Third, since the latter years of the Obama Administration, when a vastly overhyped “border surge” took place, political officials of both parties have improperly “weaponized” EOIR as a “deterrent” to asylum seekers, focusing on expeditious denials of asylum rather than the due process and expert tribunal functions the agency was supposed to serve. The result has been a “culture of denial and deportation” with particular emphasis on finding ways to “say no” to women and individuals of color seeking asylum.

The NYT Article also mentions that asylum merits decisions require a higher standard of proof than “credible fear determinations.” That’s true. But the suggestion that the standards are much higher is misleading. In fact, the standards governing merits grants of asylum before the Asylum Office and EOIR are supposed to be extremely generous. 

In the seminal case, INS v. Cardoza-Fonseca, the Court said that “well-founded fear” is a generous standard, one that could be satisfied by a 10% chance of persecution. In implementing this holding, the BIA found in Matter of Mogharrabi that asylum could be granted even where the chances of persecution were substantially less than probable.

There is as also a regulation, 8 C.F.R. 208.13, issued under the Bush I Administration, that creates a rebuttable presumption of future persecution based on past persecution.

The problem is that none of these generous and remedial provisions relating to asylum has ever been properly, consistently, and uniformly applied within EOIR. As someone who during my time on the bench took these standards to heart, I found that a substantial majority of merits asylum cases coming before me could and should be granted under a proper application of asylum law.

Consequently, I am skeptical of judges who deny virtually all asylum claims. Likewise, I question the claims by political officials of both parties who pretend, without actual knowledge, that almost all asylum applicants at the border are “mere economic migrants” who deserve to be quickly and summarily removed. 

Actually, under some circumstances, severe economic hardships can amount to persecution. Moreover, under the legally required “mixed motive” analysis for asylum, an economic aspect does not automatically obviate other qualifying grounds.

So, at its root, “credible fear” is actually an even more generous application of what is already supposed to be (but often isn’t in reality) a very generous standard for asylum. The alleged “disconnect” between the number of individuals found to have credible fear and the number actually granted asylum on the merits appears to be more a function of defective and overly restrictive decision-making at EOIR than it is of unjustified generosity of Asylum Officers screening for credible fear. It’s also important to remember that at the credible fear stage, individuals haven’t had time to marshal the substantial corroborating evidence eventually required (some would say unrealistically and unreasonably) in formal merits asylum hearings before EOIR.  

Finally, just aimlessly increasing the number of Immigration Judges, without solving the systemic legal, logistical, management, quality control, training, and “cultural” problems infecting EOIR creates its own set of new problems. 

Recently, a veteran practitioner before EOIR wrote the following:

In about eleven years, our local DMV went from twelve (12) judges in Baltimore and Arlington in 2012 to a hundred (100) judges in 2023 (8 BAL, 18 HYA, 30 WAS, 9 FCIAC, 14 RIAC, 21 STE). That’s an increase of 733.33%. This seismic expansion has resulted in many attorneys being overscheduled for individual hearings, which has an adverse effect on our clients, our ethical obligations, due process, and mental health.

Well-prepared attorneys, many serving pro bono or “low bono,” are absolutely essential to due process and fundamental fairness in Immigration Court, particularly in cases involving asylum and other forms of protection. For EOIR to schedule cases in a manner that does not take into consideration the legitimate needs and capacities of those practicing before their courts is nothing short of malpractice on the part of DOJ leadership.

There is a silver lining here. The EOIR judicial hiring program gives NDPA stars a chance to get on the bench at the retail level level, bring much needed balance and perspective, and to develop the credentials for future Article III judicial appointments. Since change isn’t coming “from the top,” we need to make it happen at the “grass roots level!” Keep those applications coming!
