As we recognize the 100th anniversary of the “Tulsa Atrocity” and our failure to properly acknowledge it, teach it, condemn the failures of our legal system, and/or hold the perpetrators accountable, this is a course that every American should view!

Dehumanization of “the other,” grotesque minimization and distortion of their achievements and key contributions to our nation’s prosperity and survival, and legal systems that knowingly and intentionally denied legal, constitutional, and human rights to our fellow Americans are a long and dishonorable part of our history, often denied or intentionally whitewashed by those who fear truth. The long struggle against “America’s original sin” involved fierce resistance by African American slaves as well as concerted cooperative efforts between free African Americans and White opponents of slavery. But, there were also tensions, squabbles, false starts, petty “turf wars,” and fundamental disagreements among slavery’s opponents. Shockingly, but not surprisingly, many slaves found that suicide was their only effective form of protest against, and escape from, this vilest of all American institutions. 

The struggle against slavery’s toxic legacy and its existence in various forms in modern America continues. And, there is a direct connection with America’s continuing mistreatment of immigrants, particularly people of color and asylum seekers, and the failure of our legal system, even today, to protect them rather than abuse and dehumanize them. 

The ongoing struggle is reflected in the Biden Administration’s apparent naive belief that they can effectively address racial injustice in America while continuing to treat asylum seeking migrants, many women, children, and people of color, as “non-persons” or “less than human” under our Constitution and laws. Ending “Dred Scottification of the other” — in all its forms  — is key to America’s getting beyond the mistakes, tragedies, and injustices of our past and creating a better future for all persons in America!

The Biden administration is making a serious mistake in placing the self-interest of the Justice Department ahead of the people’s right to know if former Atty. Gen. William Barr acted to cover up Donald Trump’s possible engagement in obstruction of justice.

A federal judge in Washington, D.C., in early May ordered the release of a crucial Justice Department memo that will shed light on Barr’s conduct and whether he acted inappropriately. Rather than comply with the judge’s command and disclose the document, the Biden Justice Department is appealing the order in an effort to keep the memo secret.

In March 2019, special counsel Robert S. Mueller III delivered his report into Russian interference in the 2016 presidential election to then-Atty. Gen. Barr. While keeping the report secret, Barr sent a letter to congressional leaders purporting to “summarize the principal conclusions.” Barr said that Mueller “did not draw a conclusion — one way or the other — as to whether the examined conduct constituted obstruction,” and that “the evidence developed during the Special Counsel’s investigation is not sufficient to establish that the President committed an obstruction-of-justice offense.” Trump then declared that he was fully exonerated.

Barr said that he had reached his conclusion “in consultation with the Office of Legal Counsel and other Department lawyers.” A Freedom of Information Act request was filed by a watchdog group to obtain the OLC memo that purportedly was the basis for Barr’s judgment that the Mueller report exonerated Trump of obstruction of justice.

A reading of the Mueller report indicates that Barr’s statements were a gross mischaracterization of the evidence it presented. There was substantial evidence that Trump had engaged in obstruction of justice and Mueller said that he offered no conclusion only because Justice Department rules prevented indicting a sitting president.

Federal Judge Amy Berman Jackson reviewed the OLC memo and concluded that there was no legal basis for withholding it from release. Indeed, she was sharply critical of the Justice Department’s arguments for secrecy. She said that the “affidavits” submitted in favor of withholding the document “are so inconsistent with evidence in the record, they are not worthy of credence.” She said that her review of the documents led her to conclude “that not only was the Attorney General being disingenuous then, but DOJ has been disingenuous to this Court with respect to the existence of a decision-making process that should be shielded by the deliberative process privilege.” She said that the agency’s “redactions and incomplete explanations obfuscate the true purpose of the memorandum.”

In plain English, she slammed the Justice Department for misleading the court in trying to keep the document secret.

This issue is central to a government operating under the rule of law: Did the attorney general act to deceive Congress and the American people to protect Trump from being seen as having engaged in obstruction of justice? The OLC memo is key to understanding what happened.

During his Senate confirmation hearings Judge Garland presented himself well and indicated a sound understanding of justice, the proper role of the Attorney General, and the public interest. However, that now appears to have been largely skillful misdirection.

Since actually being sworn in, Garland has, surprisingly and sadly, conducted business largely without regard to progressive values, expert advice, common sense, or the public interest.

DHS and DOJ Announce Dedicated Docket Process for More Efficient Immigration Hearings
WASHINGTON – Today, Secretary of Homeland Security Alejandro N. Mayorkas and Attorney General Merrick B. Garland announced a new Dedicated Docket process to more expeditiously and fairly make decisions in immigration cases of families who arrive between ports of entry at the Southwest Border.  This new process should significantly decrease the amount of time it takes for migrants to have their cases adjudicated while still providing fair hearings for families seeking asylum at the border.

“Families arriving at the border who are placed in immigration proceedings should have their cases decided in an orderly, efficient, and fair manner,” said Secretary of Homeland Security Alejandro N. Mayorkas.  “Families who have recently arrived should not languish in a multi-year backlog; today’s announcement is an important step for both justice and border security.”

“The mission of the Department of Justice’s immigration courts is to decide the cases that come before them promptly and fairly,” said Attorney General Merrick B. Garland.  “This new program for certain newly arriving families will help achieve that critically important goal.”

Under this new process, certain recently arrived families may be placed on the Dedicated Docket.  Families may qualify if they are apprehended between ports of entry on or after Friday, May 28, 2021, placed in removal proceedings, and enrolled in Alternatives to Detention (ATD).  DHS, in partnership with the Department of Justice (DOJ) Executive Office for Immigration Review (EOIR), will make available information services to help families understand the immigration system and refer families to pro bono legal service providers for possible representation.

EOIR has identified immigration courts in 10 cities with established communities of legal services providers and available judges to handle the cases.  The designated cities are Denver, Detroit, El Paso, Los Angeles, Miami, Newark, New York City, San Diego, San Francisco, and Seattle.

Under the Dedicated Docket, EOIR’s immigration judges will work generally to issue a decision within 300 days of the initial master calendar hearing, subject to the unique circumstances of each case including allowing time for families to seek representation where needed.  While the goal of this process is to decide cases expeditiously, fairness will not be compromised.

CGRS Concerned Biden Policies Will Undermine Fairness, Endanger Refugee Families
San Francisco, CA (May 28, 2021) – The Center for Gender & Refugee Studies (CGRS) is deeply concerned by today’s announcement that the Biden administration will begin fast-tracking asylum cases for certain families seeking refuge. By establishing a “dedicated docket” for asylum-seeking families, the administration will sacrifice fairness in the name of speed, adopting a misguided approach that under both the Obama and Trumpadministrations contributed to record backlogs in the immigration system, eroded due process, and endangered lives. Instead of reviving the failed policies of past administrations, the Biden administration should swiftly end cruel and illegal Trump-era policies and fully restore safe asylum processing at the southern border.
Today’s announcement arrives at a time when families seeking asylum face enormous roadblocks to safety and justice. Over four months into its first term, the Biden administration has failed to end myriad Trump-era policies that continue to place refugees at risk of grave violence, and even death. It is shameful that the administration is prioritizing fast-tracked adjudications while continuing to illegally expel asylum seekers to danger under the widelydebunked pretext of the pandemic. So long as the Title 42 policy remains in place, there can be no safe or fair process for asylum seekers.
The Biden administration also has yet to address Trump policies that have gutted protections for people escaping domestic violence and gang brutality, including many of the families impacted by this new policy. Until Attorney General Garlandtakes action to reverse these policies, the asylum system will remain rigged against families fleeing violence in their homes and communities, who will be wrongly denied protection and ordered deported to the very dangers they’ve fled. Rushing adjudications will make it even more difficult for these families to find safety, further undermining any semblance of fairness in the asylum process.
“CGRS and our partners have set forth a clearroadmap for the Biden administration to adjudicate asylum cases in a timely manner and mitigate backlogs, all while improving fairness and protecting due process,” CGRS Legal Director Blaine Bookey said today. “As advocates, we’ve been down this road before. We know policies that rush asylum adjudications fail to keep families and children safe. We implore the administration not to make the mistake of putting speed above justice.”’
Advocates, asylum seekers, and communities are coming together to demand an asylum system that provides every person a safe and fair opportunity to seek protection, with full access to legal representation and community-based support. We Are Home Campaign Deeply Disappointed by Biden’s DHS Budget Request

Calls on Congress to Do Better

 

Washington, DC —President Biden’s FY 2022 budget, released today, requests $2.7 billion from Congress for ICE detention – almost the same amount enacted by Congress last year under the Trump Administration. It includes funds for 2,500 family detention beds. Alongside recent increases in the number of people jailed by ICE, this budget request is an alarming signal that DHS and the President are not heeding the call of the immigrant justice movement to reduce and ultimately end the federal government’s harmful and unnecessary reliance on incarceration for immigration processing.

 

In response to the news, Bridgette Gomez, Director of the We Are Home campaign, said:

 

“We are deeply disappointed to see that DHS plans to continue Trump-era levels of ICE detention. Candidate Biden promised an immigration policy that reflects our highest values as a nation. As president, Biden has repeatedly emphasized his commitment to racial equity. Any plan that doesn’t dramatically shrink ICE’s incarceration system – which mostly jails Black and Brown people – betrays those commitments. We’ll be looking to Congress to do better and cut ICE’s budget significantly.”

 

In March, We Are Home joined the Defund Hate coalition in calling on Congress to cut funding for ICE and CBP by at least 50 percent.

 

In February, the campaign sent comprehensive recommendations to DHS to overhaul enforcement and begin to dismantle the detention and deportation machinery that has devastated millions of families, mostly Black and Brown, and squandered billions of taxpayer dollars. These recommendations included policies to cut detention, including 1) a comprehensive file review of all people in ICE custody, with a presumption of release, and 2) an end to the use of private prisons and state and local jails for ICE detention. The urgency to reduce the detained population is even greater during the pandemic, since people in jails and prisons face particular risk of contracting COVID. ICE has no centralized plan to provide vaccines for people in its custody.”

We Are Home is a nationwide campaign to fight for immigrant communities on three fronts: prioritizing and demanding a pathway to citizenship for the 11 million undocumented immigrants in America; a moratorium and overhaul of interior enforcement; and broad affirmative relief from deportation. The NGOs are quite upset.Note that this comes days after the Fourth Circuit enforced an IJ’s duty to fully develop the record even in represented cases.And yet here is the administration speeding up the assembly line.

In my view, this will lead to more pro se I-589s being filed.And as Sessions vacated Matter of E-F-H-L-, there is now no safeguard in either case law or regs preventing IJs from summarily denying those I-589s for e.g. failing to correctly delineate a PSG.

I can’t for the life of me understand this administration’s determination topreserveTrump’s policies.

Quick takes:

  • Because the system would depend almost entirely on NGOs and pro bono groups to provide counsel, developing policies without consulting those groups or providing grants to increase representation is totally inappropriate, not to mention stupid and insulting;
  • Special expedited asylum dockets have failed in the last two Administrations, so why try a “proven failure” once again?
  • Assigning certain Immigration Judges to these “priority dockets” –  without first removing non-priority cases from the docket, will result in more “Aimless Docket Reshuffling” and increased backlogs;

  • The 10 Immigration Courts selected for this project have widely varying asylum denial rates. For example, for the period 2015-20, according to TRAC, El Paso (an “Asylum Free Zone”) had a denial rate of 90% and New York a denial rate of 32%. How can a system including such extremes be “fair?”
  • As recent litigation has pointed out, Garland’s Immigration Judges are making basic mistakes and failing to develop records in their rush to screw asylum seekers.   • Until that happens, progressives and advocates will have to deal with Garland’s “in your face arrogance and ignorance” the same way they dealt with Sessions and Barr — with massive resistance and unending litigation until Garland’s corrupt, incompetent, biased system grinds to a halt.

Turning potential powerful and helpful friends into motivated and committed enemies! Seems pretty stupid to me. 

Stephen Miller rightfully made lots of enemies with his racist, neo-Nazi shenanigans. But, he did please and energize his nativist, White Nationalist supporters!

By contrast, Garland has rapidly turned progressive supporters into enemies. But, he won’t get one iota of appreciation or support from Miller and his White Nationalist nativist supporters in the GOP.

Creating policies that are universally opposed or panned. That takes some impressive negative leadership and political idiocy!

These aren’t “cases of first impression,” “Circuit splits,” complex questions involving state law, unusual Constitutional issues, or difficult applications of treaties or international law. No, these are the “basics” of fair, competent adjudication in Immigration Court. Things most law students would get correct that IJs and BIA Appellate Judges are getting wrong on a daily basis in their “race to deny.”

Don’t kid yourself! For every one of these “caught and outed” by Circuit Courts, dozens are wrongly railroaded out of America because they are unrepresented, can’t afford to pursue judicial review in the Article IIIs, or are duressed and demoralized by unconstitutional detention and other coercive methods applied by the “unethical partnership” between EOIR and ICE enforcement.

Others have the misfortune to be in the 5th Circuit, the 11th Circuit, or draw Circuit panels who are happy to “keep,the line moving” by indolently “rubber stamping” EOIR’s “Dred Scottification” of “the other.” After all, dead or deported (or both) migrants can’t complain and don’t exercise any societal power! “Dead/deported men or women don’t talk.”☠️⚰️ But, members of the NDPA will preserve and tell their stories of unnecessary human suffering and degradation for them! We will insure that Garland, Monaco, Gupta, and others in the Biden Administration who ignored their desperate moans and tortured screams in their time of direst need are held accountable!🤮

Unfortunately, these decisions are unpublished. They should be published! It’s critically important that the daily gross miscarriages of justice @ EOIR be publicly documented, citable as precedent, and serve as a permanent record of perhaps the most unconstitutional and corrupt episode in modern American legal history.

It’s also essential to keep the pressure on Garland and his so far feckless lieutenants to fix the problem: 

  • Remove the Trump/Miller holdovers @ EOIR;
  • Prune out the “go along to get along” deadwood;
  • Rescind the improper hiring of 17 “Billy the Bigot” judicial selections (including the one absurdist selection by “AG for a Day Monty Python” — talk about a “poke in the eyes with a sharp stick” to progressives);
  • Bring in top notch progressive practical scholars as leaders and REAL judges at both the appellate and trial levels of EOIR –  NOW;
  • Make the “no brainer” changes to eradicate Trump-era unethical, xenophobic “precedents” and inane “rules” and establish due process and fundamental fairness, including, of course, racial and gender equity in decision making.

So far, Garland has pretended that the “Culture of Denial” flourishing under his nose at HIS EOIR doesn’t exist! It does exist — big time — and it continues to get worse, threaten more lives, and squander more resources every day! 

Due process (not to mention simple human decency) requires bold, immediate ACTION. Garland’s continued dawdling and inaction raises the issue of what is the purpose of an Attorney General who allows his “delegees” (basically Stephen Miller’s “judges”) to violate due process every day! There is no more important issue facing the DOJ today. Garland’s silence and inaction raise serious questions about his suitability to serve as the American public’s top lawyer!

With the U.S. “on pace to encounter more individuals on the southwest border than we have in the last 20 years,” as Homeland Security Secretary Alejandro Mayorkas said in a statement March 16, immigration at the U.S.-Mexico border has emerged as one of the toughest challenges facing the Biden Administration. Last week, President Biden put Vice President Kamala Harris in charge of “stemming” the flow of migrants, Biden was questioned about the immigration situation at his first official press conference, immigrant detention centers began to fill up once again, and lawmakers from both sides of the aisle made trips to the border to publicize the issue and propose solutions.

Biden’s attempts to address immigration may be new, but the issue is one that has dogged his predecessors for decades. Since the 1970s, Republicans and Democrats alike have tried to address undocumented immigration by constructing ever more draconian policies of border control, deportation and detention—border theater that grabs headlines and sometimes leads to short-term change, but never actually solves the problem.

There’s a reason why the U.S. government has failed for so many years to “control” the border: none of these policies have addressed the real reasons for migration itself. In migration studies, these are known as “push” and “pull” factors, the causes that drive migrants from one country to another.

Today, the countries sending the most migrants to the U.S.-Mexico border–especially the Central American countries of Guatemala, Honduras and El Salvador–are experiencing a combination of push factors that include poverty and inequality, political instability, and violence. And while the current situation may be unique, it is also deeply rooted in history.

Many countries in Central America have struggled with poverty since the time of independence from Spain in the early 19th century. While they are beautiful countries that are rich in culture and history, that colonial past has meant they have historically been home to large, landless, poor, rural populations, including many indigenous people of Mayan descent. In the years after Spanish control, they were typically ruled by small oligarchies that disproportionately held wealth, land and power, and their economies were primary export-dependent, which brought great riches to landowners but also exacerbated and perpetuated inequality and the poverty of the majority. Those dynamics have carried forward to today. More recently, climate change–in particular, drought and massive storms–has forced the vulnerable rural poor out of the countryside.

And while many Central Americans could indeed qualify for asylum based on their experiences of persecution, the previous administration made every effort to limit their ability to obtain it. Now the Biden Administration must decide whether to restore the asylum framework, which has become the only possible path to legal migration (as well as safety and security) for Central Americans and other migrants who—due to these combined push and pull factors—are desperate to come to the United States.

Given the complicated and deep-rooted reasons behind migration, lawmakers cannot control or “solve” the ongoing crisis at the border by simply pouring money and resources into ever more militaristic border theater. It’s no wonder that decades of such policies have done little to change the underlying dynamics.

Instead, if Americans are serious about changing the situation at the border, we need to address the push and pull factors behind Central American migration. We need to acknowledge the reality of the U.S. economy (in particular, that it demands immigrant labor to work low-wage jobs) and work to construct new legal frameworks that reflect that reality. We need to target financial and logistical support to encourage Central American countries to address the poverty and inequality that fuel migration, rather than cutting foreign aid, as the Trump Administration did. We need to do all we can to end the pervasive gang violence that pushes so many migrants out of their homelands. And of course, we must continue to evaluate our own historical and contemporary role in creating the longstanding problems that are pushing Central Americans to migrate.

One key truth: many more Central American migrants would qualify for asylum and be legally admitted to our society under a fair application of our asylum laws directed and supervised by real expert judges who scrupulously enforce due process and best practices on a now biased, unfair, and dysfunctional system!

“Stemming the tide” might be neither realistic nor possible at this time. But, controlling it, managing it humanely and legally, and regularizing it, while lessening the “push” factors should be achievable.

It would, however, require bold actions:

  • Recognizing the primacy of humanitarian protection laws and insisting on due process in implementing them;
  • Putting experts in humanitarian situations, due process advocates, diplomats, labor economists, and demographers in leadership positions; and
  • Embracing much larger levels of legal immigration, particularly from Latin America.

Unfortunately for Vice President Harris and the rest of us who want humane, realistic immigration policies, there are reasons for our half-century of overall failure on the border.

Bloated government bureaucracies, powerful corporate interests, nativist politicians, and even foreign leaders are heavily invested in expensive and guaranteed to fail “uber enforcement” gimmicks. Failure basically creates a never-ending demand for more: more enforcement agents, “civil prisons,” jailers, deporters, cars, trucks, guns, boats, ammo, walls, fences, technology, courts, judges, prosecutors, lobbyists, “baby jails,” processing centers, foreign aid that goes largely into the pockets of corrupt leaders and their cronies, and a never-ending supply of underground, low-wage, politically neutered workers.

Additionally, we now have an entire political party with an agenda of overt institutionalized racism, dehumanization of the other, and fear-mongering White Nationalist myths driving its bogus populist narrative.

None of these “architects and enablers of border failure and institutionalized racism” are going “quietly into the night.” They will fight tooth and nail to defend their sinecures, profitable empires, and politically useful White Nationalist myths.

The politician who finally breaks the deadly cycle of failure and human misery at our border, while harnessing and realizing the positive power of human migration, will become a hero for future historians and undoubtedly merit a chapter in a new edition of Profiles in Courage.

Sadly, such recognition and adulation is likely to come long after she is gone from the scene. Long term vision and moral courage are not necessarily rewarded with short-term political popularity. Just ask the few Republicans who voted in accordance with the overwhelming, basically uncontested, evidence of Trump’s “high crimes and misdemeanors!” 

That’s why it’s a tough challenge even for someone of Vice President Harris’s undoubted intelligence and abilities. It’s up to those of us who believe in a better America to keep her from getting sidetracked and co-opted by the vested interests of failure and White Nationalist myth-makers and purveyors.

Quick: You’re a lawyer and your client is on trial for inciting a violent insurrection. The problem is, he’s guilty beyond a shadow of a doubt. Literally, there is no question whatsoever that he did what he’s been accused of—none! Whatsoever! And everyone knows it! To wonder if he’s guilty is to look at O.J. Simpson and think, “Well, the glove doesn’t fit, so who knows?” Nevertheless, you’ve been hired to defend him—after basically everyone else in your profession refused—and defend him you will! But how? If you’re Donald Trump’s attorneys, the answer is clearly: Lie, lie, play some Madonna clips, and lie some more.

There were far, far too many lies told over the course of Bruce Castor Jr., David Schoen, and Michael van der Veen’s presentation to catalog them all. In fact, it would be easier to simply point out the rare moments in which they did tell the truth. But, just for posterity’s sake, here were some of the biggest whoppers the defense team told as it claimed that Trump wasn’t responsible for the rally that took place at the Capitol on January 6:

  • Trump never intended for “the joint session [of Congress] be prevented from conducting its business”: This is obviously completely false and the reason we know that is because Trump repeatedly tried to get Mike Pence to stop Congress from doing just that, reportedly telling the V.P., “You can either go down in history as a patriot, or you can go down in history as a pussy.”

 

  • The rioters were mostly antifa, and one of the first people arrested was a member of the left-wing group: This, like virtually all of Trump’s lawyers’ claims are not true. The first person arrested was John E. Sullivan, who has denied being a member of antifa, and the FBI has said there is zero evidence that the supporters’ movements participated in the riot, no matter what Trump’s most shameless loyalists say. (Rep. Matt Gaetz, for instance, falsely claimed, “They were masquerading as Trump supporters and, in fact, were members of the violent terrorist group antifa.”)

 

  • A prior protest in front of the White House was just as bad: Referring to the June protest in front of the White House, van der Veen claimed “violent rioters” attacked officers and “at one point, pierced a security wall, culminating in the clearing of Lafayette Square.” (1) There was no breach; (2) five people didn’t die (3) the people who were hurt were the protesters tear-gassed so that Trump could do a photo shoot with a bible outside a church (an event that, surprisingly, did not result in him bursting into flames).

 

 

  • “The reality is Mr. Trump not in any way shape or form instructing these people to fight or use physical violence. What he was instructing them to do was to challenge their opponents in primary elections, to push for sweeping election reforms, to hold Big Tech responsible—all customary and legal ways to petition your government for redress of grievances which of course is also protected Constitutional speech.” Right, right, sure, sure. Trump totally wasn’t encouraging his supporters to air their grievances via violence, he just wanted them to push for election reforms. He just wanted them to form political action committees, you see! Run for office! Fight ideological differences at the ballot box! It’s actually extremely impressive van der Ween was able to get through this whole thing without bursting into laughter, and for that he should win some kind of award (and then lose his license to practice law).

 

  • “There was no insurrection”: There was! We all saw it! If you missed it, just google “Capitol riot” or “Capitol attack” or “Trump insurrection.”

In addition to the many lies told by Trump’s defense, his legal team also proffered a series of arguments for why he couldn’t possibly be found guilty that sound like something a bunch of stoned college kids came up with shortly before a mock trial they forgot to prepare for, which is actually an insult to stoned college kids unprepared for mock trials. Specifically, we’re talking about the series of clips the defense presented showing various Democrats using the word “fight,“ which they claim means Trump can’t also be held responsible for telling his supporters to “fight,“ because other people have said “fight” before and they weren’t found guilty of inciting insurrections. (Naturally, they left out the part about how, for instance, when Elizabeth Warren told supporters to “fight” they didn’t proceed to storm the Capitol and try to burn down democracy):

Or that, when Chuck Schumer said “fight” he was talking about fighting COVID-19. Yes, this a real thing that actually happened:

Of course, the bald-faced lies and complete lack of convincing arguments will clearly do little to sway the majority of Republicans, who have already decided how they’re going to vote, which we know because they‘ve already said as much and also because during the question-and-answer portion of the day, a typical question posed of the attorneys went something like, “Can you tell us how it’s possible that President Trump has not been named People’s Sexiest Man Alive yet? Is it because the media is in the can for liberals? Because we can’t think of another explanation!”

Just in case there was any question re: whether or not Trump loved the insurrection he personally set into motion…

CNN reports that the ex-president insisted the rioters were patriots in a call with House leader Kevin McCarthy:

In an expletive-laced phone call with House Republican leader Kevin McCarthy while the Capitol was under attack, then President Donald Trump said the rioters cared more about the election results than McCarthy did. “Well, Kevin, I guess these people are more upset about the election than you are,” Trump said, according to lawmakers who were briefed on the call afterward by McCarthy.

McCarthy insisted that the rioters were Trump’s supporters and begged Trump to call them off. Trump’s comment set off what Republican lawmakers familiar with the call described as a shouting match between the two men. A furious McCarthy told the president the rioters were breaking into his office through the windows, and asked Trump, “Who the f–k do you think you are talking to?” according to a Republican lawmaker familiar with the call.

“I think it speaks to the former president’s mindset,” Rep. Anthony Gonzalez, an Ohio Republican who voted to impeach Trump last month, told CNN. “He was not sorry to see his unyieldingly loyal vice president or the Congress under attack by the mob he inspired. In fact, it seems he was happy about it or at the least enjoyed the scenes that were horrifying to most Americans across the country.”

In reality, as others have observed, the “defense team” could have read old copies of the Congressional Record or all the baseball scores from the 2019 season from the podium and it wouldn’t have made any difference to corrupt GOP Sens who had already decided to acquit notwithstanding the overwhelming evidence of guilt. 

The indifference and boredom with the suffering of others and the clear misdeeds of Trump exhibited by scumbags like Cruz (who actually helped prepare the inept “defense”), Hawley, Cotton, et al, was pretty telling. Obviously, they wouldn’t have cared a fig if Trump’s rioters had done in Pence, Romney, or any other of their “colleagues.” 

It’s all about the next election and destroying American democracy. 

My favorite part is when the Trump defense Team kept whining about the rights of 74 million who voted for the The Big Clown. It’s like their attempt to disenfranchise and diss the 81+ million of us who didn’t vote for Putin’s Puppet are irrelevant? But, that’s always been the way the “modern GOP” has “governed.” 

Right now, the GOP is hard at work at the state level trying to disenfranchise as many Black and Brown voters as possible in advance of the 2022 elections. 

Remember all the great “bipartisanship” and concern with the legislative process on the tax giveaway (nobody actually read it, clearly not Trump) or the unsuccessful attempt to “do in” Obamacare. Lots of great “bipartisanship” on display with the Coney Barrett confirmation and the confirmation of a steady stream of Federalist Society judges.

The current GOP is an ongoing threat to the national security and well-being of our nation.

Demeaning rape victims! ☠️🤮👎🏻 So, what else is new @ EOIR? “Gonzo” Sessions 🦹🏿‍♂️ set the tone for anti-asylum, racially motivated misogyny in Matter of A-B- and “his judges” have taken it from there! (I repeat my oft-made observation: What kind of “due process” system lets a characters like Sessions, Whitaker, and Barr “own” judges?  How would you like to be a woman on trial for her life before a “judge” selected, directed, and “owned” by the likes of  these men with clear records of “applied contempt” for equal justice? Sessions, Whitaker, Barr, & Jeffrey Rosen are gone — but their legacy of bias and injustice lives on @ EOIR!)

One of my esteemed Round Table 🛡⚔️ colleagues summed up the latest set of outrageous miscarriages of justice from Falls Church:

All of these decisions demonstrate the degree of careful and detailed analysis that these cases require.And yet the BIA couldn’t keep staff attorneys after McHenry capped them at GS-13 (entry level), and keeps increasing the monthly quotas for BIA staff attorneys.Plus of course the Board Members themselves are now all these types who only review the decisions to make sure they end in the word “dismissed.”

If you were trying to create a recipe for disaster, you couldn’t have planned it better.

I heard the latter comment twice yesterday from immigration/human rights/due process experts on opposite sides of our country who observe and participate in the system at various levels.

To quote Justice Sotomayor’s recent dissent: “This is not justice.”

Historical Footnote:  One of my first actions as BIA Chair in 1995 was to establish a “GS-15 Career Ladder” for all Attorney Advisors at the BIA. This made the BIA competitive with the rest of the DOJ. 

It allowed us to attract and retain not only “top talent” coming from the “DOJ Honors Program” (how I got my first job at the BIA in 1973), but also outstanding career attorneys who wanted an opportunity to do research, writing, and “applied scholarship” that made a difference in individuals’ lives. Indeed, at various times the BIA has had on its staff former Senior Executives seeking a “change of  focus” to a career that allowed them to do the things they liked best about the law.

One of them was a former SES colleague at the “Legacy INS” who found in transferring to a GS-15 BIA Attorney Advisor position a career satisfaction, fulfillment, and sense of meaningful contribution that person had been missing in INS management at that time.

Reducing the top grade for Attorney Advisors is not only professionally and personally demeaning, it also marks the entire organization as “second class” and shows just how stupid and incompetent (and, in recent history, overpaid) EOIR “management” has become! And, as pointed out in my colleague’s comments above, it has not only adversely affected careers but the human lives in the balance on the BIA’s docket.

As I understood my “mission” from then Attorney General Janet Reno in 1995, the BIA was supposed to be about “attracting the best and the brightest judges and supporting them with the best and brightest staff.” Essentially getting it to function like the “12th Circuit” was a description mentioned during my interview process for the Chair job. 

Sadly, now, it has become an assembly line of expediency, injustice, shoddy legal work, mindless “corner cutting,” unprofessional behavior, and human misery.

To repeat my colleague’s comment: “If you were trying to create a recipe for disaster, you couldn’t have planned it better.”

All of these cases should have been resolved in the foreign national’s favor without ever getting to the Courts of Appeals! Bad judging, grossly incompetent administration, and lack of qualified, dynamic, judicial leadership from respected “practical scholars” costs lives, produces unacceptable and unfair inconsistencies, and clogs the Article III Courts with unnecessary litigation.

Indeed, the First Circuit’s decision in Granados basically reveals OIL’s “smorgasbord” of bogus arguments to uphold the BIA’s incorrect decision as “without merit” — actually frivolous! There are deep problems @ DOJ resulting from the ongoing corruption and disregard for ethics and professional leadership from the now-departed kakistocracy! They go far beyond the mess at EOIR!

Sure hope that Judge Garland, Vanita Gupta, and their incoming team @ DOJ have a comprehensive plan for replacing the BIA and reforming EOIR! The human beings suffering in this disgracefully inept and abusive “court system” and their courageous, long suffering attorneys are counting on you! Think of it this way: What if YOUR daughter were the rape victim demeaned, dehumanized, and denied justice by EOIR?

Biden Team Rushes to Take Over Government, and Oust Trump Loyalists

WASHINGTON — When President Biden swore in a batch of recruits for his new administration in a teleconferenced ceremony late last week, it looked like the country’s biggest Zoom call. In fact, Mr. Biden was installing roughly 1,000 high-level officials in about a quarter of all of the available political appointee jobs in the federal government.

At the same time, a far less visible transition was taking place: the quiet dismissal of holdovers from the Trump administration, who have been asked to clean out their offices immediately, whatever the eventual legal consequences.

If there has been a single defining feature of the first week of the Biden administration, it has been the blistering pace at which the new president has put his mark on what President Donald J. Trump dismissed as the hostile “Deep State” and tried so hard to dismantle.

From the Pentagon, where 20 senior officials were ready to move in days before the Senate confirmed Lloyd J. Austin III as defense secretary, to the Voice of America, where the Trump-appointed leadership was replaced hours after the inauguration, the Biden team arrived in Washington not only with plans for each department and agency, but the spreadsheets detailing who would carry them out.

A replacement was even in the works for the president’s doctor: Dr. Sean P. Conley, who admitted to providing a rosy, no-big-deal description of Mr. Trump’s Covid-19 symptoms last year, was told to pack his medical kit. While all presidents eventually bring in their own doctor, Mr. Biden wasted no time bringing back a retired Army colonel, Dr. Kevin O’Connor, who was his doctor when he was vice president.

Ashley Tabaddor, a constant critic of the Trump administration as the former head of the union that represents immigration judges, will take over as chief counsel at U.S. Citizenship and Immigration Services, the federal legal immigration agency.

At the Justice Department — where morale was largely decimated and Biden administration officials are eager to begin reversing Trump policies on civil rights, immigration and police oversight — all of the department’s top incoming acting department heads are alumni, some of whom worked under multiple administrations.

Until Judge Merrick B. Garland is confirmed as attorney general, Monty Wilkinson, a longtime career employee who worked closely with Eric H. Holder Jr. when he was attorney general, is serving in an acting capacity.

The acting deputy attorney general is John P. Carlin, who ran the national security division of the Justice Department during the Obama administration. He is holding the office only until Lisa Monaco, who has worked closely with Mr. Carlin over the years, can be confirmed as deputy attorney general. She served as homeland security adviser under Mr. Obama and, during the Trump years, she and Mr. Carlin ran a group studying the hardest issues in cyberpolicy.

Much as the politicization of the Justice Department angered Mr. Trump’s critics, the neutering of the Environmental Protection Agency prompted outrage from progressives, and it is probably no surprise that the agency is already in the throes of transformation.

WASHINGTON — When Representative Scott Perry joined his colleagues in a monthslong campaign to undermine the results of the presidential election, promoting “Stop the Steal” events and supporting an attempt to overturn millions of legally cast votes, he often took a back seat to higher-profile loyalists in President Donald J. Trump’s orbit.

But Mr. Perry, an outspoken Pennsylvania Republican, played a significant role in the crisis that played out at the top of the Justice Department this month, when Mr. Trump considered firing the acting attorney general and backed down only after top department officials threatened to resign en masse.

It was Mr. Perry, a member of the hard-line Freedom Caucus, who first made Mr. Trump aware that a relatively obscure Justice Department official, Jeffrey Clark, the acting chief of the civil division, was sympathetic to Mr. Trump’s view that the election had been stolen, according to former administration officials who spoke with Mr. Clark and Mr. Trump.

Mr. Perry introduced the president to Mr. Clark, whose openness to conspiracy theories about election fraud presented Mr. Trump with a welcome change from the acting attorney general, Jeffrey A. Rosen, who stood by the results of the election and had repeatedly resisted the president’s efforts to undo them.

Mr. Perry’s previously unreported role, and the quiet discussions between Mr. Trump and Mr. Clark that followed, underlined how much the former president was willing to use the government to subvert the election, turning to more junior and relatively unknown figures for help as ranking Republicans and cabinet members rebuffed him.

Mr. Perry’s involvement is also likely to heighten scrutiny of House Republicans who continue to advance Mr. Trump’s false and thoroughly debunked claims of election fraud, even after President Biden’s inauguration this week and as Congress prepares for an impeachment trial that will examine whether such talk incited the Capitol riot.

It is unclear when Mr. Perry, who represents the Harrisburg area, met Mr. Clark, a Philadelphia native, or how well they knew each another before the introduction to Mr. Trump. Former Trump administration officials said that it was only in late December that Mr. Clark told Mr. Rosen about the introduction brokered by Mr. Perry, who was among the scores of people feeding Mr. Trump false hope that he had won the election.

But it is highly unlikely that Mr. Trump would have known Mr. Clark otherwise. Department officials were startled to learn that the president had called Mr. Clark directly on multiple occasions and that the two had met in person without alerting Mr. Rosen, those officials said. Justice Department policy stipulates that the president initially communicates with the attorney general or the deputy attorney general on all matters, and then a lower-level official if authorized.

As the date for Congress to affirm Mr. Biden’s victory neared, Mr. Perry and Mr. Clark discussed a plan to have the Justice Department send a letter to Georgia state lawmakers informing them of an investigation into voter fraud that could invalidate the state’s Electoral College results. Former officials who were briefed on the plan said that the department’s dozens of voter fraud investigations nationwide had not turned up enough instances of fraud to alter the outcome of the election.

Mr. Perry and Mr. Clark also discussed the plan with Mr. Trump, setting off a chain of events that nearly led to the ouster of Mr. Rosen, who had refused to send the letter.

After The New York Times disclosed the details of the scheme on Friday, the political fallout was swift. Senator Richard J. Durbin, Democrat of Illinois and the incoming chairman of the Judiciary Committee, told the Justice Department in a letter on Saturday that he would investigate efforts by Mr. Trump and Mr. Clark to use the agency “to further Trump’s efforts to subvert the results of the 2020 presidential election.”

So, after their failed coup attempt, the “Party of Treason” 🏴‍☠️☠️is suddenly making bogus calls for “unity” and “healing.” Of course, there is nothing whatsoever stopping any Republican from denouncing Trump and his followers, announcing support for impeachment of the Traitor, and calling for all Americans to unify behind the Biden-Harris Administration. But, that’s not what’s happening.

No, somehow the GOP treasonists outrageously believe it’s Joe Biden’s job to “call off the dogs of justice” and “heal” the country from the unmitigated disaster caused by GOP misrule ending in a failed coup. (Did I mention that due to the totally disgraceful, maliciously incompetent handling of the worst public health emergency in more than a century, one that the GOP consistently downplayed, mocked, and denied, the US has the world’s worst record and is now on the way to over a half a million COVID deaths with millions unemployed!) While admitting no wrongdoing on their part, “traitor twerps” like Graham now think that Biden should absolve them of any wrongdoing and move forward as if the GOP attack on our nation had never happened.

This election was over on November 7, when the major networks finally called it. 

At that point, Biden had not only in insurmountable lead in the electoral college, but also a significant and growing lead in the popular vote. No candidate has ever overcome margins like that to win a Presidential election. All others similarly situated have conceded. Therefore, Trump should have conceded and the GOP congratulated the President Elect and his running mate.

Instead, the GOP lined behind Traitor Trump’s fascist fabricated election fraud claims! (Was it surprising that a “President” who told thousands of bald-faced lies starting from day one would continue to lie?). “Count all the votes” said the GOP treasonists, while actively trying to prevent state and local officials from doing just that. 

Of course all the counts and recounts confirmed all of the Biden wins, some even adding a few votes to his margins. Then, the GOP “battle cry” became “Wait for the courts to rule.” This “process” (actually an outrageous abuse of legal process) resulted in an impressive streak of more than 50 consecutive losses for the Trump frivolous/obstructionist/unethical/conspiracy theory mongering “litigation team” of sleazy lawyers in courts at all levels from judges appointed by both Dems and the GOP, some by Trump himself. 

Then it was “Wait for the states to certify” while again trying to interfere with that process. Once the states, including ones firmly controlled by the GOP, certified the results and Biden’s win, the bogus GOP party line became “Wait for the Electoral College.” Of course, that, in turn, voted for Biden exactly as the states had certified, despite Trump’s attempts to interfere.

But, still the GOP treasonists kept on with their knowingly false narratives. This time, it was “Wait for Congress to accept the results” a purely ceremonial process that has never resulted in a change of outcome. 

Nevertheless, Trump invited, actually urged, his followers to come to D.C. and stage a violent insurrection at the Capitol in a vain attempt to prevent the Congressional process from being completed. He also urged Vice President Pence (usually a reliable, anti-democracy toady) to violate his constitutional oath by throwing the election to Trump. By this time, it was clear that Biden had won the popular vote by more than 7 million — which would have made a Trump “victory” the biggest anti-democracy “steal” and disenfranchisement in American history.

Nevertheless, Cruz, Hawley, McCarthy and a host of other GOP legislators continued to commit treason by pressing Trump’s baseless insurrectionist theories, and pressing to disenfranchise millions of Biden voters across the nation, even as the debris from their failed coup still littered the Capitol. 

Now that their coup has failed, and there is at least a chance, however unlikely, that the Party of Treason 🏴‍☠️and some of its supporters 🦹🏿‍♂️ will be held accountable, these traitors have the absolute audacity to basically demand that Biden “bail them out” in the name of “national unity.”

I call BS! As Steve points out, history shows that failing to hold accountable those responsible for a failed coup merely insures that another coup will take place!

America will not be safe for the majority of us until the GOP is forever disempowered as a political force and Graham, Cruz, Hawley, McCarthy, and rest of the of the GOP traitors are held accountable for their treason.

Hi all:  The lesser asylum regs that were scheduled to take effect tomorrow were just blocked by a TRO and  preliminary injunction granted in D.C. District Court (order to follow). These regs would have required certain respondents to file their I-589s within 15 days of the first Master Calendar hearing, and would have required EOIR to reject any I-589 which left even a single space blank, among other things.

The Acting Attorney General has issued a decision in Matter of A-B-, 28 I&N Dec. 199 (A.G. 2021).

(1) Matter of A-B-, 27 I&N Dec. 316 (A.G. 2018), did not alter the existing standard for determining whether a government is “unwilling or unable” to prevent persecution by non-governmental actors. The “complete helplessness” language used in Matter of A-B- is consistent with the longstanding “unable or unwilling” standard, as the two are interchangeable formulations.

(2) The concept of “persecution” under the Immigration and Nationality Act, 8 U.S.C. §§ ‍1101(a)(42)(A), 1158(b)(1)(a), (b)(i), is premised on a breach of a home country’s duty to protect its citizens. In cases where an asylum applicant is the victim of violence or threats by non-governmental actors, and the applicant’s home government has made efforts to prevent such violence or threats, failures in particular cases or high levels of crime do not establish a breach of the government’s duty to protect its citizenry.

(3) The two-pronged test articulated by the Board of Immigration Appeals in Matter of‍ L-E-A-, 27 I&N Dec. 40, 43–44 (BIA 2017), is the proper approach for determining whether a protected ground is “at least one central reason” for an asylum applicant’s persecution, 8 U.S.C. § 1158(b)(1)(B)(i). Under this test, the protected ground: (1) must be a but-for cause of the wrongdoer’s act; and (2) must play more than a minor role—‍in‍ other words, it cannot be incidental or tangential to another reason for the act.

It’s likely that the movement to hold accountable and remove from Congress traitors like Cruz, Hawley, McCarthy, and the other Republicans who shamelessly and seditiously continued to support the anti-American lies, racist false narratives, and conspiracy theories that fueled Trump’s insurrection and domestic terrorism will die out over time. But, it shouldn’t!

As I write this, the GOP treasonists in the House are blocking what should be a unanimous resolution to invoke the 25th Amendment to remove this dangerous, unhinged, traitor/moron from the office he has abused and disgraced from Day One!

One reason why our democracy is on the ropes is that there hasn’t been any accountability whatsoever for Trump and his kakistocracy of thugs on the public payroll or for the GOP White Nationalist traitors and enablers in Congress who have furthered their grotesque abuses of humanity and our democratic institutions.

The lack of accountability is particularly glaring and disgusting for Trump’s lawyers, both in and out of Government, who have lied, misrepresented, and totally jettisoned ethics and “due diligence” in supporting and furthering Trump’s attacks on our democracy. Why is Rudy Giuliani, who led a coast to coast “conspiracy of lies and treason” in Federal and State Courts, before calling for armed rebellion against our Government, still walking free and “practicing” law? Why are Billy Barr, Gonzo Sessions, Don McGhan, Noel Francisco, and a host of others who lied, misrepresented, and abused their ethical obligations as well as their oaths of office happily ensconced in the private sector rather than being held accountable for their “crimes against humanity?” 

Contrary to all the total BS 💩being spread by GOP Trump toadies, the unconstitutional, racist, illegal, violent, anti-democracy agenda of Trump, Miller, and the rest of of the Thugocracy/Kakistocracy was apparent from the “git go.” 

And, Chief Justice Roberts and the other GOP Justices who helped roll out and encourage “Kristallnacht” by rubber-stamping the “Muslim ban,” “Let ‘Em Die In Mexico,” the “Bogus Wall of Misappropriated Funds,” stripping legal migrants of life-saving and health preserving benefits, helping fuel a DHS “reign of terror” directed at ethnic communities, and other neo-Nazi travesties should also tender their resignations to President Biden as of Jan 21, 2021! Intellectual dishonesty by judges and bad, righty biased (non)jurisprudence have real life consequences! 

Trump and Miller told the Supremes precisely what their invidious racist, religiously biased, politically pandering intent was in all of these cases and the GOP Justices ignored it in favor of bogus, fabricated, right wing, authoritarian, racist driven, anti-democracy agendas thinly camouflaged by legal gobbledygook.

People die and lives are ruined forever when judges who are supposed to protect them instead “take a dive” for the forces of tyranny and cruelty! “Dred Scottification” (“dehumanization”) of Blacks, Latinos, Immigrants, and other People of Color by our highest Court is neither acceptable nor should it be “swept under the rug” as has happened all too often when the Supremes fail democracy and align themselves with anti-democracy racists and authoritarians.

For four years, the GOP Justices on the Supremes have treated due process, democratic institutions, and the lives of asylum seekers and other migrants (and to some extent their pro bono lawyers) as “jokes.” That’s because 1) neither they nor their families are rotting in Mexico or facing torture and death in El Salvador or some other failed state; and 2) this time, the right wing thugs they enable were across the street trashing our Capitol rather than storming the Supremes. Better Justices and Better Federal Judges for a Better America!
