A Victory before the BIA!

Hi All: I hope you are not getting tired of all the winning. Today, the BIA issued a precedent decision on the whole Pereira and Niz-Chavez jurisdictional issue involving service of a defective NTA (link attached) in which our Round Table submitted an amicus brief drafted for us by our own Sue Roy.And the BIA actually agreed with us!!!

The holding:

The Department of Homeland Security cannot remedy a notice to appear that lacks the date and time of the initial hearing before the Immigration Judge by filing a Form I-261 because this remedy is contrary to the plain text of 8 C.F.R. § 1003.30 and inconsistentwith the Supreme Court’s decision in Niz-Chavez v. Garland, 593 U.S. 155 (2021).

Of course, our brief was not acknowledged in the Board’s decision.

A thousand thanks to Sue and to all in this group who have repeatedly signed on in support of due process.

As a reminder, we still await a decision from the Supreme Court on whether Pereira and Niz-Chavez extend to in absentia orders of removal. Oral arguments in that case were heard earlier this month, and our brief was mentioned in response to a question by Chief Justice Roberts.

(RNS) — Chicago was already facing a homelessness crisis before Texas’ Republican governor, Greg Abbott, began directing thousands of migrants entering his state to Democratic bastions that had declared themselves migrant-friendly sanctuary cities.

Since the transfers began in April 2022, more than 20,000 migrants, many of them destitute Venezuelans, have arrived, and many Chicagoans have expressed concerns that the city’s resources are being drained and have accused government officials of failing to communicate about the migrants’ cost and their fates.

At the same time, advocates for the migrants, especially community organizers in more vulnerable neighborhoods, have pushed back against attempts to pit two marginalized groups against each other. These groups have stepped up to support the new arrivals and in many cases have found allies in local faith leaders.

Black said the majority of community residents want to find a way to both support the migrants and build support for a part of Chicago that has been historically underserved and underresourced. At the banquet at First Presbyterian, a speaker from Southside Together Organizing for Power, a community organizing group, talked about what it means to have Black and brown unity.

“It’s basically founded on this idea that there’s no scarcity,” Black said. “Not only is there enough for everybody — for the asylum-seekers, and the historically disenfranchised populations of South Side Chicago.”

He added, “We have so much more to gain from our unity than from the division which is being manufactured and orchestrated by interests that don’t want these communities to get the resources they need.”

I report that today Immigration Clinic student-attorneys Raisa Shah, Jennifer Juang-Korol, and I participated in the Newcomer Fair that the District of Columbia Public Schools sponsored at Langdon Elementary for families who have recently arrived from Texas and Arkansas via bus, primarily Venezuelans living in DC shelters. We shared immigration and social services information, GW swag, and met lots of cute kids. We were the only law school that participated. Please see the attached.

Have been thinking a lot about this statement & questioning how we got here. Anyone who works in this space knows just how complicated our laws & system are, the challenges global crises present, all compounded by recent attempts to totally destroy our immigration system. We know this is hard. However, the President has had at his service very smart ppl, experts, not to mention those in NGO space w decades of experience who have provided him reams of recommendation papers from before he was elected President, all wanting to help him to succeed at making the immigration system more efficient, more fair, but I’d guess most also came out of 4 yrs of Trump wanting to ensure we treat ppl w dignity & respect their basic human rights. If only he would listen.

How did the President go from vowing to “restore asylum” & “stop kids in cages” to essentially trying to out-Trump Trump? I wish we had a President who had the political courage to stand by immigrants, to stand in public & declare why detention, border walls, & summary deportations don’t work, & to invest in humane & smart solutions. The truly enraging thing about this is he will never win in his gross political posturing despite throwing migrants under the bus, or more aptly–literally to the cartels–the Right will never be satisfied & now he has put himself on record as in favor of Trump’s policies. 

Shame. Shame on whoever had a hand in this hateful declaration and shame on the leader who put his name to it.

• Collaborate with Ayuda’s Social Services and Language Access programs to ensure the provision of holistic services.

• Represent Ayuda in meetings with prospective grantors and donors to support Ayuda’ s fundraising efforts.

• Stay informed about legal changes and help to communicate legal changes and their significance to staff.

• Support Communications & Development team by drafting external legal updates and supporting participation in media interviews by legal team.

• Represent Ayuda and its clients at local and regional stakeholder, coalition, and advocacy meetings.

• Participate in Ayuda’s efforts to bring about systemic change on behalf of our clients.

• Represent the legal program as a member of Ayuda’s Senior Management Team, supporting organizational management and strategic planning and implementation.

HOW DO YOU KNOW IF YOU CAN DO THIS JOB?

Eligibility: Must be legally able to work in the United States and maintain proper work authorization throughout employment. Must be able to meet the physical requirements of the position presented in a general office environment.

Education/Experience:

• J.D. or L.L.M. degree from an accredited law school and licensed and in good standing to practice law in any U.S. state or territory.

• 3+ years of experience providing legal services to low-income immigrants (immigration, domestic violence/family law and/or consumer law experience preferred but not required).

• 3+ years of supervisory experience.

• Program management and leadership experience required.

• Experience working with low-income immigrant survivors of domestic violence, sexual assault, human trafficking, child abuse/neglect or other forms of trauma.

Preferred Knowledge & Skills:

• Excellent written and verbal communications skills, flexibility, and good humor.

• Excellent judgment, calm demeanor even under pressure, strong work ethic, resourceful, and able to maintain confidentiality.

• Decisive, with ability to exercise independent judgment.

• Proven ability to develop and maintain and positive team environment and support staff morale and resilience.

• Ability to mentor, train and provide career path guidance to staff.

• Ability to work collaboratively in a team environment and to initiate and follow through on work independently.

• Excellent time management skills and ability to work in a fast-paced environment.

• Ability to adapt to changing priorities.

• Program evaluation and project management skills.

• Knowledge of a second language a plus, with Spanish language skills preferred (examples of other languages commonly spoken by Ayuda’s clients include Amharic, Arabic, Tagalog, French, and Portuguese).

SALARY AND BENEFITS:

The anticipated salary for this position is $125,000 – $140,000, depending on experience.

As I have mentioned before, I am a proud member of AYUDA’s Advisory Council. At our meeting held at AYUDA this week, I was surrounded by talented, dedicated folks, who, unlike the often biased and ill-informed politicos out to destroy our legal immigration framework, are committed to solving problems in a humane, creative, legal manner recognizing the humanity and talents of our migrant communities.

Among other things, I heard:

  • Busses continue to arrive in our area without warning and coordination from either the “sending states” or the Feds;
  • The overwhelming number of those arriving are forced migrants with strong asylum claims;
  • Many of the current arrivals are from Venezuela and Nicaragua, countries with repressive leftist dictatorships with established records of persecution and human rights abuses recognized and condemned by Administrations of both parties; 
  • Many arrivals, because of language problems and haphazard Government processing, do not understand how the asylum system operates;
  • Through information sessions, AYUDA and other NGOs are filling an information gap left by poor Government performance;
  • Despite the monumental efforts of terrific pro bono lawyers from across the DMV area (more needed) there is neither rhyme nor reason to the handling of these cases at EOIR and the Asylum Office;
  • Some cases are expedited, some are placed on slow dockets; 
  • There are no BIA precedents or useful guidance on the many recurring situations that should result in grants;
  • Different results on similar material facts are a continuing problem;
  • Delays and “Aimless Docket Reshuffling” by EOIR hinders pro bono representation.

These are the problems that Congress and the Administration could and should be solving! Instead, outrageously, they are focused on spreading dehumanizing myths and devising even more wasteful “enforcement only” gimmicks that are bound to fail and leave more devastation, trauma, and wasted opportunities in the wake! Human lives and human rights are neither “bargaining chips” nor “political props” in an election year! 

AYUDA
Americans are being bombarded by false messages of hate, fear, resentment, and dehumanization directed at out immigrant communities. That’s a HUGE problem for our nation of immigrants’ future! Fight back by joining AYUDA and becoming part of the solution!

AYUDA and other NGOs offer a chance to be part of the solution, save lives, and stand against the disgraceful failure of our Government to honor our legal commitments to asylum seekers and other migrants. Be a champion of migrants who make our “nation of immigrants” really great!

One-of-a-kind training designed to give attendees a one-of-a-kind experience. The picture below is of the late Judge John O’Malley teaching students at the trial college. He loved the college and taught each year-even while battling cancer. Having served years on the Bench in State Court, he joined the Kansas City Immigration Court in 2009. He became a believer in the power of trial advocacy training for immigration removal defense attorneys. He understood the need for this kind of training to transform immigration attorneys into trial lawyers who were fearless and zealous storytellers for their clients. Judge O’Malley will be missed this year, but I know he will be watching as the next set of students graduate and join the elite group of alums. Alums who are no longer afraid to stand up for justice, demand due process and help their client’s stories come to life in the courtroom. Join us this April.

Paulina Vera supervises GW Law Immigration Clinic students and provides legal representation to asylum-seekers and respondents facing deportation in Immigration Court. She is a Professorial Lecturer In Law and has taught Immigration Law I.

Ms. Vera previously served as the only Immigration Staff Attorney at the Maryland-based non-profit, CASA.

She is a double GW alumna. In 2015, Ms. Vera graduated from the George Washington University Law School. During law school, she was a student-attorney at the Immigration Clinic. In 2012, she graduated from GW with a Bachelor in Arts in International Affairs, concentrating on Latin American Studies and International Politics and a minor in Spanish Language and Literature.

Ms. Vera is involved in a number of professional organizations. She is the President-Elect of the Hispanic Bar Association of DC (HBA-DC), a scholar for the American Bar Association (ABA) YLD Leadership Academy, and a member of the inaugural Hispanic National Bar Association (HNBA) National Task Force on Hispanic Law Professors and Deans. She also serves as the Public Relations Director for the GW Latino Law Alumni Association (LLAA).

Ms. Vera has been recognized locally and nationally; she is the recipient of the GW Latinx Excellence Awards, Alma Award (2019), DC Courts Community Agency CORO Award (2019), Hispanic Bar Association of DC (HBA-DC) Rising Star Award (2019), and the Hispanic National Bar Association (HNBA) Top Lawyers Under 40 Award (2021).

In the 18 months since the Supreme Court’s Dobbs decision, Republican officials have had ample opportunity to prove they’re not merely antiabortion but also pro-child. They keep failing.

GOP politicians across the country have found new and creative ways to deny resources to struggling parents and children. Take, for instance, the summer lunch program.

Under a new federal program, children who are eligible for free or reduced-price school lunches can also receive food assistance during the summer. The policy, created as part of the bipartisan budget deal in 2022, gives eligible families $40 per month per child, or $120 total over the summer. It often works essentially as a top-up for food stamps, since these families must buy more groceries when their children lose access to nutritious school meals when classes go out of session. (It’s similar to a temporary program offered during the pandemic, though it’s much less generous.)

The federal government pays the entire cost of the benefits associated with this new food program and half the administrative costs. The program isn’t automatic, though; states had to opt in by Jan. 1.

Republican governors across 15 states chose not to, as my Post colleague Annie Gowen reported. Up to 10 million kids will be denied access to this grocery aid as a result.

Why have these governors rejected food assistance, even amid soaring grocery prices and pledges to help families strained by inflation?

Some states, such as Texas and Vermont, cited operational or budgetary difficulties with getting a new system running in time for this summer. These obstacles could presumably be surmounted in future years. In other states, GOP politicians expressed outright disdain for the program.

Nebraska Gov. Jim Pillen, for instance, said of the new program, “I don’t believe in welfare.” A spokeswoman for Florida’s Department of Children and Families cited vague unspecified fears about “federal strings attached.”

Iowa Gov. Kim Reynolds suggested there was no point in giving this grocery assistance to food-insecure children “when childhood obesity has become an epidemic.”

Reynolds is apparently unaware that obesity is linked to a lack of reliable access to nutritious food and that children in food-insecure homes face a higher risk of developmental problems. This suggests withholding this nutritional assistance hurts not only the state’s children today but also its workforce tomorrow.

This is hardly the only time GOP politicians have worked to swipe food from the mouths of hungry children — and their moms.

Indeed, if a version of a child tax credit expansion ultimately materializes — and it might in the next few days — that will happen only because Democratic lawmakers explicitly held those corporate tax breaks hostage in exchange for aid to poor kids.

Republicans keep assuring the American public that they really, truly care about helping women forced into bearing children even when they’re not financially or emotionally ready to do so. They claim they want to protect youngsters and invest in their financial future.

Time for the GOP to put its money where its mouth is.

OBIT: Louis Kokonis, 91, Longtime Math Teacher With Alexandria City Public Schools

ALEXANDRIA, VA-Louis Kokonis, a longtime math teacher with Alexandria City Public Schools, passed away Jan. 4, 2024, at the age of 91. He began teaching in 1958 but started with the school system the following year at Frances C. Hammond High School (now Hammond Middle School). For the majority of his six-decade-plus career, Kokonis taught at T.C. Williams High School/Alexandria City High School.

A little more than a year ago, Alexandria City Public Schools (ACPS) celebrated Mr. Kokonis on his 90th birthday, recognizing his dedication to his students and the craft of teaching. A Zebra Press report covering the milestone says he taught algebra, calculus, and geometry, and along the way, enabled many to “overcome math anxiety.”

“I always knew that I wanted to be a teacher,” Mr. Kokonis recalled during an ACPS interview, “I was influenced by many of my high school teachers and for my love of math.”

He is credited as the longest-serving teacher in ACPS history.

John Porter, the principal at T.C. from 1984 to 2006, called him an “amazing man and dedicated educator.”

“The number of students he assisted and who acknowledged the difference he made in their lives numbers in the many thousands,” said Porter, who worked with Kokonis for 27 years in all.

Because Mr. Kokonis had no wife or children, he  considered his students family. Of them, he said, “I hope as they grow older that they will always remain positive and enthusiastic about whatever they are doing and that they will not be discouraged when things get difficult.”

In 2019, he was honored by the Virginia General Assembly with House Joint Resolution No. 727. It stated: “Louis Kokonis has imparted his passion for lifelong learning to his students, many of whom went on to become physicists, engineers, doctors and professors.”

“Like the math he taught for 65 years, Mr. Kokonis was a constant in this ever-changing world. A fixture in the TCW/ACHS halls, he was a Titan in every sense of the word,” Vice Mayor Amy Jackson, a T.C. grad, told The Zebra.

Mr. Kokonis never thought of retiring, saying he would miss his fellow teachers and students.  He lived to teach, and gave his colleagues this advice: “Be enthusiastic about whatever you are teaching. Enjoy being a teacher and always do your best. Try to help every student to achieve the best that they can.”

His legacy is celebrated with the Louis Kokonis Teachers’ Legend Scholarship, sponsored by the Scholarship Fund of Alexandria. At the family’s request, “condolences can be shared through the scholarship,” according to an ACPS press release announcing his death.

This report has been updated. An earlier version said the vice mayor was one of Mr. Kokonis’ students, which was incorrect.

We graduated from UW Law School in 1973. As retired judges we have been searching for ways in which individuals like us and our many retired judicial colleagues can use our unique legal skill sets to aid in addressing the humanitarian crisis at our borders. In that spirit, we propose to Congress, the Administration, and other decision-makers involved, the creation of “Judges Without Borders.” First, here is a brief summary of our respective backgrounds.

 

Paul Wickham Schmidt served as a U.S. Immigration Judge, U.S. Department of Justice (“DOJ”) in Arlington, Virginia (2003-16), after being an Appellate Judge of the Board of Immigration, Appeals (1995-2003), where he was Board Chair for six years. He authored the landmark decision: Matter of Kasinga, extending asylum protection to victims of female genital mutilation. He previously served as Acting General Counsel and Deputy General Counsel (1979-87) of the former Immigration and Naturalization Service, and was instrumental in developing the rules and procedures to implement the Immigration Reform and Control Act of 1986, as well as establishing the modern Immigration Court system in the DOJ. His experience also includes being a partner in two major law firms, Jones Day and Fragomen.

 

Paul is retired, and now is an Adjunct Professor of Law at Georgetown University Law Center. He has authored numerous articles on immigration law and speaks, lectures, and writes in forums throughout the nation on contemporary immigration issues, due process, and U.S. Immigration Court reform. He publishes the blog immigrationcourtside.com and is a member of the Round Table of Former Immigration Judges and BIA Appellate Judges.

 

I am a former district attorney, county corporation counsel, trial lawyer, and circuit court judge.  While serving as a judge, I formed a collaborative justice coordinating council, and received one of only two national multi-year grants designed to create family treatment courts, addressing not only the needs of drug and alcohol dependent individuals, but their families as well through a holistic approach and diversion programming. I worked closely with the Ho-Chunk Nation to help create its Healing to Wellness Courts. Upon retiring, I led a successful litigation effort to stop the proliferation of frac-sand mining in Wisconsin’s Driftless region, utilizing anticipatory private-nuisance doctrine.

 

For the last several years, we have sought to find ways to help those who legally seek to gain asylum in the United States. Initially we proposed an initiative whereby retired State, and Federal judges would volunteer to attend a multi-week program to become trained in the laws and procedures governing eligibility screening; then potentially, aiding the overwhelmed corps of Immigration Judges by pre-filtering hundreds of thousands of potentially meritorious asylum claims, while at the same time advising those who likely will not qualify, that they probably will, potentially after many months of detention, be deported to their native country, or a safer alternative destination. We contemplated that retired judges could also be available to take some of the routine procedural and adjudicative burdens off of Immigration Judges so that they could concentrate on adjudications such as asylum, requiring their specialized training and experience.

 

Most of those seeking asylum at our border have experienced some type of trauma in their home countries. However, because the international refugee definition that the U.S. has adopted covers only harm resulting from race, religion, nationality, political opinion, or membership in a particular social group, and the evidentiary burdens can be daunting, some of those who have been harmed or reasonably fear harm will not be able to meet the legal criteria for asylum in the U.S. In such cases, individuals will have risked their, and perhaps their family’s lives, and their limited resources on a dangerous journey to the U.S. border, that can only end in rejection, perhaps detention, prosecution, separation from family, and ultimately expulsion to their home countries or to potentially dangerous conditions in Mexico.

 

To better and more constructively address this untenable and inhumane situation, we now propose “Judges Without Borders.” This group would consist of trained volunteers with prior judicial experience who are willing to dedicate some time to the task of going into venues south of our border, as well as resettlement centers in the U.S., to meet, consider and screen those claiming a right to asylum, to assess their likelihood of success, and to address and advise them accordingly, humanely, and realistically, regarding what most probably lies ahead for them. We also see an opportunity to be of service to overwhelmed NGOs and legal services providers in the United States in screening potential asylum cases and advising those unlikely to succeed on what, if any, other options they might have in individual circumstances.

 

Ideally, our review panels would consist of three judges: one Democrat, one Republican and one Independent for a balanced, realistic, and comprehensive approach. Interviews would be held in venues that are outside the applicant’s native country, to protect potential asylum seekers from retribution. The information gathered would be confidential, so that it could not be used against the potential applicants.

 

We believe that by using the skills of retired jurists with high level practical experience in assessing legal claims, Judges Without Borders, could go a long way to relieving the swamped immigration system, providing accurate helpful information about the realities of the U.S. asylum and immigration systems so that individuals can make informed life decisions, reducing the flow of immigrants dangerously entering or attempting to enter the U.S. with false hopes, and correcting misinformation about the U.S. system provided by human smugglers and other illegal operatives who exploit the predicament of desperate individuals. Volunteer judges, who generally are on pensions or some other type of pre-existing retirement income, would serve without pay, receiving only travel food, and lodging expenses.

 

If our elected leaders really want to solve the humanitarian crisis at the border, we believe that they ultimately must consider other practical and potentially expansive reforms to deal more realistically and humanely with the realities of 21st century migration, and to constructively reform our currently dysfunctional asylum adjudication system and our legal immigration systems which were developed to deal with past realities in worldwide migration that might no longer apply. However, in the interim, we believe that everything possible, including some new, creative, budget-friendly approaches, must be used to alleviate the humanitarian crisis and unnecessary suffering (even death) at our borders.

 

We recognize that practical solutions will not be easy as there are many corporate interests profiting from private immigration detention, wall-building, river barriers, and all sorts of so-called “border, security technology,” much of which is expensive, yet ultimately ineffective in dealing with the root causes of human migration. The money saved would be better spent on honoring our nation’s solemn pledge to support our allies, with whatever it takes, for as long as it takes, while also honoring our legal and humanitarian commitments to refugees. We must remain a nation that demonstrates humanitarian leadership and can be trusted by the world, to keep our promises, particularly to some of the world’s most vulnerable humans.

I wanted to write and tell you again how much the training last spring stands out in my mind as a highlight for 2023.  I received my full accreditation in June and have represented three different clients in proceedings so far.  The judges in San Antonio have been very open to dismissing cases, and two of the three cases were dismissed as an exercise of prosecutorial discretion!  Our clients have been able to apply for asylum affirmatively and hopefully will be successful, even though we anticipate a very long wait for their interviews.  I have also completed U visa filings, a T visa filing, family petitions and lots and lots of work permits.  Mailing every filing fills me with so much hope.

I hope that I will get a chance to see you again at a future VIISTA event!

This position is in the Executive Office for Immigration Review (EOIR), Office of the Chief Immigration Judge. EOIR seeks highly-qualified individuals to join our team of expert professionals who serve as immigration adjudicators in this important Agency.

EOIR plays a pivotal role in the administration of the Nation’s immigration system. EOIR’s mission is to adjudicate immigration cases fairly, equitably, and efficiently at the trial and appellate level, governed by due process and the rule of law. Under delegated authority from the Attorney General, EOIR conducts immigration court proceedings, appellate reviews, and other administrative hearings, applying the immigration laws while ensuring that adjudicators are impartial, that laws are applied humanely and equitably, that all parties are treated with respect and dignity, and that cases are resolved expeditiously and in accordance with the Administration’s priorities and all applicable laws and regulations.

EOIR consists of three adjudicatory components: the Office of the Chief Immigration Judge, which is responsible for managing the numerous immigration courts located throughout the United States where immigration judges adjudicate individual cases; the Board of Immigration Appeals, which primarily conducts appellate reviews of the immigration judges’ decisions; and the Office of the Chief Administrative Hearing Officer, which adjudicates immigration-related employment cases. EOIR’s Headquarters is located in Falls Church, Virginia, about 10 miles from downtown Washington, DC.

Job Description

Immigration Judges preside in formal, quasi-judicial hearings. Proceedings before Immigration Judges include but are not limited to removal, and bond adjudications, and involve issues of removability as well as applications for relief such as asylum, withholding of removal, protection under the Convention Against Torture, cancellation of removal, and adjustment of status.

Immigration Judges make decisions that are final, subject to appeal to the Board of Immigration Appeals. In connection with these proceedings, Immigration Judges exercise certain discretionary powers as provided by law, and are required to exercise independent judgment in reaching final decisions. Immigration Judges may be required to conduct hearings in penal institutions and other remote locations

Qualifications

In order to qualify for the Immigration Judge position, applicants must meet all of the following minimum qualifications:

  • Education: Applicants must possess a LL.B., J.D., or LL.M. degree. (Provide the month and year in which you obtained your degree and the name of the College or University from which it was conferred/awarded.)

AND

  • Licensure: Applicants must be an active member of the bar, duly licensed and authorized to practice law as an attorney under the laws of any state, territory of the U.S., or the District of Columbia. (Provide the month and year in which you obtained your first license and the State from which it was issued.)

AND

  • Experience: Applicants must have seven (7) years of post-bar admission experience as a licensed attorney preparing for, participating in, and/or appealing court or administrative agency proceedings at the Federal, State or local level. Qualifying trial experience involves cases in which a complaint was filed with a court or administrative agency, or a charging document (e.g., indictment, notice of violation, or information) was issued by a court, administrative entity, a grand jury, or appropriate military authority. Relevant administrative experience includes cases in which a formal procedure was initiated by a governmental administrative body.

Yes, I’ve been highly critical of EOIR, particularly the BIA. But, to change the system for the better, we need the “best and brightest judges” at the “retail level” — the U.S. Immigration Courts!

So, in that spirit, let’s take a “deep dive” into the BIA’s latest misapplication of asylum law, Matter of M-R-M-S-, 28 I&N Dec. 757 (BIA 2023) looking to mine a “Hon. Sir Jeffrey Chase golden nugget” from disaster. In the process of denying asylum to a family targeted by gangs in Mexico, the BIA says: 

The Immigration Judge’s finding that the cartel was motived by a desire to control the respondents’ land rather than their family membership is a permissible view of the evidence and is not clearly erroneous.

This negative finding by the IJ was “permissible,” not “compelled.” That language admits that other fact-findings on the same evidence could also be “permissible.” Much depends on the individual Immigration Judge’s frame of reference and willingness to look for “reasons to protect” rather than defaulting to “reasons to reject.”

So, what if the IJ were able to see and understand asylum from the standpoint of the applicant, rather than defaulting to the EOIR “any reason to deny” approach? Fairer fact-findings below would require more careful review by the BIA. Rather than just being able to mindlessly affirm adverse findings below, the BIA would basically be legally bound to uphold more positive findings unless “clearly erroneous.”

Of course in their haste to deny some BIA panels are prone to violate the “clearly erroneous” standard to “get to no.” But, that increases the chances of Circuit reversal. See, e.g., Crespin Valladares v. Holder, 632 F.3d 117 (4th Cir. 2011) (my case from Arlington).

Additionally, DHS can’t and doesn’t appeal every asylum grant, particularly when they are “fact bound.” I actually had ICE Assistant Chief Counsel say on the record in waiving appeal that while they respectfully disagreed with my fact-findings, they recognized that they were not “clearly erroneous” for purposes of appeal. (Other times they actually agreed after I had stated my detailed findings and analysis, sometimes actually repeating during closing arguments the basic analysis I would have reached on the record we had just made.)

Better judging below can actually cut off and discourage backlog building “let’s spin the bottle” appeals by DHS encouraged by the BIA’s systemic failure to consistently uphold the rights of asylum seekers and their “unduly restrictive” interpretations of asylum law! 

Buried amongst the morass of poor administration and bad appellate judging at EOIR, many “true expert” IJs are making great decisions and saving lives on a daily basis. One of the “best kept secrets” at EOIR — often intentionally obscured by both EOIR and the media (not to mention GOP White Nationalist nativists) — is that as of this summer over half of all those who passed “credible fear” — 55% — received asylum grants if they were actually able to get to merits hearings at today’s backlogged EOIR! That’s an impressive rate, given that the system is stacked against asylum applicants! It also highlights the total insanity of today’s discussions on the Hill of how to artificially heighten standards to bar asylum seekers and promote more arbitrary wrongful denials of life-saving protection. What’s needed is better judging and more realistic and humane policies, NOT more cruelty and misapplications of asylum law!

As I have pointed out along with others, asylum grant rates would be much higher with better judges at EOIR and better precedents from the BIA. Better guidance would mean more cases granted at the Asylum Office and Immigration Court levels and a more timely and efficient system that advances and promotes due process, rather than inhibiting it!

But, it can’t all be done “from the outside!” Better Immigration Judges — true asylum experts with “hands on” experience representing applicants before EOIR and the Asylum Office — are essential to rebuilding EOIR as a functional court system. 

For example, one of the expert recommendations from the very recent Women’s Refugee Commission study of asylum reception, resettlement, and processing was that: “One pro se assistance goal is to incentivize immigration judges to take a closer look at pro se asylum cases.”

But, this laudable goal presupposes Immigration Judges who are experts in asylum law and able to “work their way through” some of the inherent barriers to justice in pro se Immigration Court cases rather than submitting to the “artificial production pressures and any reason to deny culture” that still exists at much of EOIR. Sadly, not all current IJs have this ability. Moreover, the BIA has provided defective leadership and guidance. EOIR judicial training on asylum does not measure up to much of that readily available in the private/NGO sector. See, e.g., VIISTA Villanova.

Many practitioners who have contacted me here at “Courtside” lament that their lives and their client’s futures would be better if they only were appearing before Immigration Judges who actually understood asylum law from a protection standpoint. They are frustrated by having their fine presentations and great arguments “shrugged off” with “predetermined boiler plate denials” citing negative language from the BIA — often ignoring what actually happened or was proved at trials.

Instead of being destined to forever be frustrated by EOIR’s shortcomings, YOU now have a chance to “be that judge” the one who understands asylum law, has seen the defects in EOIR decision-making, who doesn’t view denial as “preordained,” and will require both parties fairly to meet their burdens. (Ironically, there are many places where the asylum regulations still place the burden of proof on DHS, even if many IJs and BIA panels are unwilling to enforce them.)

So, get in those applications for EOIR judgeships! It’s a great way to show leadership by improving the system from the inside while saving lives in the process! Better judges for a better America — starting at the “retail  level!”

As we argue, the BIA’s action here violated their own precedent in Matter of Morales-Morales, 28 I. & N. Dec. 714 (BIA 2023). As stated in our brief:

In Morales-Morales, the case in which the BIA first held that it could equitably toll a notice of appeal deadline, the BIA stated that the quintessential example of an extraordinary circumstance warranting equitable tolling is when “a party uses a guaranteed delivery service, and the service fails to fulfill its guarantee.” See Morales-Morales, 28 I. & N. Dec. at 717. When presented with exactly those facts, however—FedEx’s Priority Overnight service failed to deliver Ms. Diaz-Valdez’s notice of appeal on time, violating its guarantee—the BIA arbitrarily and capriciously refused to equitably toll the deadline. 

One could well ask why Garland is spending Government time and resources defending the BIA’s erroneous and unjust actions. No wonder EOIR can’t help building more and more backlog — much of it through poor quality, anti-immigrant decision-making that causes unnecessary delays, confusion, gross inconsistencies, and contributes to the dreaded “Aimless Docket Reshuffling” — an endemic problem at EOIR!
