Maine Voices: ‘Woke’ should not be a four-letter word

Being aware of how we have treated and still treat other people in our society is so important to our society’s evolving that it should be honored, not vilified.

It is frustrating to see the continuous redefining of words and terms by the extremist conservative element in our society and government. One of these terms is “woke.” According to Merriam-Webster, the definition is “aware of and actively attentive to important societal facts and issues.” I will add in the qualification as well: “especially issues of ABOUT THE AUTHOR

For my entire life I have strived to embrace this philosophy, trying to listen to and understand other opinions, beliefs and religions, whether they agreed with mine or not, understanding that one cannot fully comprehend a point of view without appreciating the counterpoint. This certainly requires personal evolution and maturity. Being aware of the true history of our country, of how we have treated and still treat other people in our society, is so important to our society’s evolving that it should be honored, not vilified.

The term “woke” has now been unjustly transformed into a negative term. Let that sink in: Attention to important facts and issues, the truth, is something to avoid and discredit. Somehow, this makes sense to a significant number of our political leaders and fellow Americans. It appears that what is most troubling for those who would see “woke” as a vile four-letter word is the qualification above, that it applies to “issues of racial and social justice.”

One of the tag lines for objecting to this thought is that it may cause someone to feel uncomfortable or criticized by being confronted with these historical facts. Personally, I strongly desire to know the truth. I am delighted – admittedly, shocked sometimes – by learning about the history we were never taught, which was suppressed to a large extent for so many years by those who perpetrated many injustices. The historical truth has never made me feel bad about myself. In fact, it is enlightening. It expands my understanding of how and why we have come to this place in our evolution. It shows me how to be better and more empathetic, and it suggests the path forward.

I believe I do understand why this can be so threatening and discomforting to so many. I believe that the truth is like a mirror to them. They see their own racist views, their distrust of anyone they perceive as being “different” as a significant threat. I feel so sad for them, since in my life, through being open to other races, ethnicities, religions and thoughts, I have learned so much and have been blessed with a much more beautiful world, life and friends.

It is extremely troubling to see elected officials, the leaders of our political parties, and fellow Americans embracing and endorsing this philosophy of derision, division and hateful rhetoric that has its roots in the cesspool of white supremacist thought.  They are leading us into the abyss of an authoritarian kakistocracy, or government by the worst of us. We must all, every rational one of us, stand and reject this thinking. We must only, and always, embrace truth, the actual facts. These people should not be leading our wonderful country.

Executive Director Opening Plenary Remarks CLINIC Convening 2023

Good afternoon, dear friends. My name is Anna Gallagher and I have the honor of leading CLINIC as executive director. It is such a pleasure to be here with you all as we officially begin our first in-person Convening since 2019.

Looking out at the sea of faces in front of me, I am filled with gratitude to finally be able to come together to engage with one another, to listen, learn and gather strength for the work ahead in support of our immigrant brothers and sisters.

Even just being in your presence I feel a sense of renewed hope and energy. I am so looking forward to the next few days, and I am certain that you will be reignited to take on the important work ahead.

In a moment I will welcome our wonderful panel of Affiliate experts, but right now I want to take a moment to recognize this moment we’re facing and my hopes for this year’s CLINIC Convening.

You all, of all people, know that immigrant communities are facing truly unprecedented challenges – and I do not use that word, unprecedented, lightly.

With the lifting of Title 42, and the camps of men, women and children along the border desperate to find welcome on the other side; the proposed USCIS fee increases which threaten to put immigration benefits out of reach for many; the newly announced delays for foreign-born religious workers and special immigrant juveniles; and, perhaps above all, our warming planet and the outbreaks of violence which force many more people to migrate around the world – these are extremely challenging times for migrants in our country and around the world.

Several months ago, the New York Times featured an op-ed that has stuck with me, entitled, “The Rich World Has a Shockingly High Tolerance for Cruelty.”

It was about how rich nations are more willing than ever to let migrants languish at their borders in sub-human conditions rather than create safe pathways for migration or address the conditions causing people to flee.

It was about how the promises that nations made after World War II to respect the dignity and rights of those who are fleeing have been eroded and now, on a practical level, forgotten.

When I read this article, in my mind I was transported back to the time I spent in North Africa several years ago, working with migrants as a representative of Jesuit Refugee Services.

I interviewed migrants who had traveled for 18 months or more to try and find safety in these countries bordering Europe. I got to know some of the migrants, who called me “grandma” – a term of endearment, as my hair was grey.

While I was talking to some of them, they showed me their hands, which were scarred with wounds. When I asked them what happened, they said their hands were repeatedly pierced while climbing barbed wire to get through to safety.

Hearing this, my heart broke – as it has many times over the years.

The idea that we are using barbed wire to keep out our fellow human beings is inconceivable, yet true. Our immigrant brothers and sisters stand at our gates, begging for our aid, and we build barbed wire fences that pierce their hands.

Many wealthy nations are founded on a concept of all human beings being equal in dignity, but we do not act like it.

As we gather in Arizona, I know we are all mindful that these kinds of camps that the op-ed author is speaking of are just several hours away on the border. We also know that immigrant communities’ dignity is denied not only in these camps, but all over the country in the various places we’ve come from.

We must be clear, this is not an “other side of the world problem,” it is our problem. It affects all of us, in our integrity as people of faith and conscience, and as a reflection of our society.

And yet today, as I recall that New York Times op-ed, and the sense of frustration and despair I felt while reading it, I feel a surge of hope.

I want you to look around the room. Look at your neighbor to your left and right. YOU are the hope that fills my heart, and YOU are the hope that reignites me in our work.

As we gather here today, I am in a room full of people who DO act like all human beings are equal. Those who spend their precious time – often too much of their time, working long hours – trying to advance the truth that every person is precious, valuable, and deserving of a safe and dignified life.

That’s why being in your presence gives me such hope. I am reminded that the CLINIC network is full of holy people.

That is why our gathering here together, and throughout this week, is so powerful: we are, to borrow the words of Bishop Seitz of El Paso, working to be a “creative counterexample” to the culture of fear and hostility, to be a network that is slowly creating a new culture of solidarity and hospitality.

At CLINIC, we also are bolstered by our faith that we do not do this hard work alone. The spirit of God is inspiring us and pushing us forward, giving us strength and magnifying our efforts, especially when we are overwhelmed by the need in front of us.

Our faith also acts as a mirror for us, forcing us to keep evaluating whether we are truly reflecting the gospel truth of God’s concern for all people.

To maintain this faith, and to maintain the energy to be this creative counterexample, we need one another. Our network is sustained through the support, advice, and solidarity we demonstrate to one another.

Throughout the next few days, we will take the time to step back, to reflect on our work and learn and share new strategies, information, and tips for the very practical day-to-day work of supporting immigrant clients and communities.

We know that this practical work – the forms, the bureaucracy, the nitty-gritty details – changes and saves lives. So how well we can do it matters, which is why we gather to learn and grow.

We also gather to enjoy one another – to laugh, share stories, and reconnect with beloved colleagues and friends.

So I also hope that over the next few days you will have some fun!

Thank you for coming here to CLINIC Convening and for your dedication to this work. I am so honored to be alongside all of you this week, and all days.

Now, I am pleased to introduce our panelists for our opening plenary, Preparing for the Lifting of Title 42: Key Insights from our Network. When we decided on “reunited and reignited” for our theme this year, we knew we wanted to do something different for our opening conversation.

This “Network Fireside Chat” will be an opportunity to highlight the work done by our network throughout the United States. During this conversation, you’ll hear how Affiliates in three distinct geographical regions are rising to meet the needs of our immigrant and refugee brothers and sisters – especially during this increased time of uncertainty.

From the Border region, Joel Enriquez-Cazarez will share about the work of Jewish Family Service of San Diego.

As a transit city, Carolina Rivera will share how Catholic Charities of Dallas assists our immigrant brothers and sisters.

How DeSantis and other GOP lawmakers are killing LGBTQ young people

And why they’re doing it

Friends,

Last Wednesday, Florida Governor Ron DeSantis — who is expected to announce his campaign for the presidency as soon as tomorrow — signed a gaggle of bills targeting LGBTQ youth.

In addition to those he had already signed into law — including a “Don’t Say Gay” measure barring teachers from mentioning sexual orientation or gender identity and another prohibiting gender-affirming care — his latest laws expand the state’s prohibition on classroom instruction about sexual orientation and gender identity, require that students use bathrooms associated with their sex assigned at birth, prohibit adults from taking children to see drag shows, and bar teachers from asking students about their preferred pronouns.

Another of the bills DeSantis just signed into law allows the state of Florida to take transgender minors away from parents who help them obtain gender-affirming care.

In raging against gender-affirming care, DeSantis lied that “they’re literally chopping off the private parts of young kids.” In fact, genital surgery is rarely, if ever, done under the age of 18. It’s not even all that common for adults. DeSantis is lying about it to scare people.

Meanwhile, the Republican presidential frontrunner has made it clear that trans people have no place in his vision of America:

“I will sign a new executive order instructing every federal agency to cease all programs that promote the concepts of sex and gender transitions at any age. I will ask Congress to pass a bill establishing that the only genders recognized by the United States government are male and female, and they are assigned at birth.”

My friends, these scare tactics are dangerous. Recent analysis found a 70% increase in hate crimes against LGBTQ Americans between 2020 and 2021, as the surge of these anti-LGBTQ bills began. And that’s only counting hate crimes that get reported. The years 2020 and 2021 each set a new record for the number of trans people murdered in America.

The cruelest irony is that these Republican bills pretending to protect children are putting our most vulnerable children at greater risk.

LGBTQ kids are more than four times likelier than non-LGBTQ kids to attempt suicide, especially transgender young people.

Gender-affirming care reduces that risk. That is why it is life-saving.

“Don’t Say Gay” laws also strip away potentially life-saving support. A teacher who positively and respectfully discusses sexual orientation and gender identity won’t turn a straight kid gay. But such a discussion will make an LGBTQ student 23% less likely to attempt suicide

The tragic truth is that “Don’t Say Gay” laws and bans on gender-affirming care are causing more young lives to be needlessly lost.

Laws that threaten to take transgender minors away from their families if they are receiving gender-affirming care will cause these young people even more trauma.

If Republicans really cared about protecting kids, they’d focus on gun violence, now the leading cause of death for American children.

If they were really worried about children undergoing life-altering medical procedures, they wouldn’t pass abortion bans that force teens to give birth or risk back-alley procedures.

What the GOP’s vendetta against the LGBTQ community really is, is a classic authoritarian tactic to vilify already marginalized people.

This is how fascism takes root.

We need to see DeSantis’s bills and similar bills signed by Republican governors across the land for what they are — attempts to use bigotry and hate to elevate their political standing.

And we need to see this Republican attack on LGBTQ Americans for what it is: a threat to all of our human rights.

“For the first time, I’ve actually started talking to my investment guy about retirement,” Michael Woods, a teacher who has spent decades working in exceptional-student education for public schools in South Florida, tells me. “I’m a 30-year veteran who showed up every day, hardly calls in sick, but now I don’t want to be a teacher in Florida.” Most troubling to Woods—a gay man who teaches science and biology courses—is the ballooning list of laws that police classroom material, discriminate against LGBTQ+ educators and students, and restrict sex education. “They’re all so vague,” he says of DeSantis’s new laws. “Even things that used to be easy like human reproduction [for ninth graders], I now have to check with my co-teacher and ask, ‘Is this okay? Are we still allowed to teach this?’”

On Wednesday, the governor rubber-stamped a batch of four bills restricting LGBTQ+ rights and expanding the Parental Rights in Education Act—or, as critics have dubbed it, the “Don’t Say Gay” law. The new measures, which will be enforced at public and charter schools, ban educators from discussing sexual orientation or gender identity in pre-K through eighth grade, and place new, vague restrictions on sex education, including that such instructions “be age-appropriate or developmentally appropriate for students in accordance with state standards.”

This latest salvo was a bridge too far for many teachers, according to Rebecca Pringle, the president of the National Education Association, the largest labor union in the US. “I just talked to one teacher yesterday who is leaving and she said, ‘I can’t teach like this,’” Pringle tells me. “‘I can’t teach while worrying that they’re coming after my license, or I’m committing a felony.’ They’re leaving in protest.” Pringle says she has tried to convince teachers to stay in Florida, given the dearth of teachers in the state. But that discussion has been difficult to have, she says, with teachers who are facing death threats or harassment.

Case in point: One fifth-grade teacher in West Florida said this month that she was placed under investigation by the Florida Department of Education for showing her class Disney’s Strange World, a children’s movie that features an openly gay character. Jenna Barbee, the teacher at hand, said she played the film to give students a post-exam “brain break.” But when a local school board member learned of the showing, Barbee said, she was reported to state officials. Barbee told CNN that she had already submitted her resignation before the incident, in protest of the “politics and the fear of not being able to be who you are” in Florida public schools.

It appears that no educator has yet been prosecuted or charged under Florida’s “Don’t Say Gay” law or its legislation restricting books in schools. But as fears mount over their future implementation, parents are already witnessing the effects of shorthanded schools and overcrowded classrooms. “Last year, I saw several teachers leave, and we had substitutes for three, four months of the year,” says Reagan Miller, a parent in West Florida whose two children attend public school. “We had a teacher who taught advanced math at our middle school for years and years—he just left to go be a 911 operator,” she tells me, “which blows my mind, that becoming a 911 operator would be less stressful than being a teacher.”

My experience on the bench was that almost all the transgender individuals coming before me had attempted suicide on one or more occasions or expressed suicidal thoughts. To a person, they just wanted to be accepted, protected, and to live their own lives without harassment, interference, or fear. These are all things that today’s cowardly GOP “Brown Shirt Pols” would deny them. 

The next generation is going to have to decide whether they want to live in a Nazi-inspired police “hate state” where individual freedoms are meaningless and cruelty, bullying, suppression, and betrayal are the norms. If not, then they had better get busy removing every GOP politico from every office — from local school boards and city councils to the Presidency.

How soon we forget the lessons of 1939! Perhaps that’s part of the GOP’s war on truth, education, and history!

Before traveling to Florida, please understand that the state of Florida devalues and marginalizes the contributions of, and the challenges faced by African Americans and other communities of color,” the notice issued Saturday states.

The civil rights organization specifically accuses DeSantis, a possible 2024 Republican presidential candidate, of aggressively attempting to erase Black history and restrict diversity, equity, and inclusion programs in Florida schools.”

“Gathering the dead after the Colfax massacre, published in Harper’s Weekly, May 10, 1873” — White Nationalist snowflakes like DeSantis feel diminished and threatened by the truth about American history and the role of race.                                                                  

The “anti-woke agenda” touted by DeSantis is a very thinly disguised euphemism for “overtly racist!” That, decades after folks like Gov. George Wallace and Sen. Strom Thurmond unabashedly made hate, segregation, and racism the “centerpieces” of failed presidential bids, racists like DeSantis are openly campaigning on the same basic platform, and enacting it in their “mini-reichs,” should be deeply disturbing to younger generations of voters who will have to live with the stupidity, ignorance, cynicism, and hate promoted by these immoral GOP pols. It’s a race backwards and to the bottom that can only end in a complete catastrophe for our nation and the world!

Also remember: It all started with the dehumanization and false demonization of migrants. Many, including too many Dems, have been unwilling to stand up against it! That’s how the GOP’s “destroy America” agenda gains traction!

May 8, 2023—The Atlantic’s staff writer Caitlin Dickerson has won the 2023 Pulitzer Prize in Explanatory Journalism for the September 2022 cover story, “‘We Need to Take Away Children,’” an exhaustive investigation that exposed the secret history of the Trump administration’s policy to intentionally separate migrant children from their parents; the incompetence that led the government to lose track of many children; and the intention among former officials to separate families again if Trump is reelected. Her reporting, one of the longest articles in The Atlantic’s history, laid out in painstaking detail one of the darkest chapters in recent U.S. history, exposing not only how the policy came into being and who was responsible for it, but also how all of its worst outcomes were anticipated and ignored. The investigation was edited by national editor Scott Stossel.

In awarding Dickerson journalism’s top honor, the Pulitzer Board cited: “A deeply reported and compelling accounting of the Trump administration policy that forcefully separated migrant children from their parents resulting in abuses that have persisted under the current administration.”

Over 18 months, Dickerson conducted more than 150 interviews––including the first extensive on-the-record interviews on this subject with Kirstjen Nielsen, John Kelly, and others intimately involved in the policy and its consequences at every level of government––and reviewed thousands of pages of internal government documents, some of which were turned over only after a multiyear lawsuit.

Many congrats and thanks Caitlin! Unfortunately, the message still doesn’t seem to have gotten through to politicos and policy-makers of both parties who continue to promote, tout, and sometimes employ illegal, immoral, and ineffective measures directed at migrant children and families!

On April 4, 1968, I was a senior in high school when Dr. Martin Luther King Jr. was murdered in Memphis, Tennessee. That weekend I had been attending a planning meeting in Richmond, Virginia, for mobilizing white teens from suburban churches to serve in inner-city projects in the District of Columbia and Baltimore.

ABOUT THE AUTHOR

Irv Williams is a native of Baltimore, with family roots in the Northern Neck of Virginia. He moved to Maine in 1973 and is a resident of Peaks Island.

Driving home on Sunday afternoon I arrived at the Baltimore city line, about five miles from my house, to find National Guard troops and tanks blocking off access to the city. I was allowed to pass only on the condition that I drive directly home.

Today I know the real reason I was allowed to pass by those armed soldiers was that my face was white, not Black. Dr. King was only 39 years old when he was murdered.

William Page was only 25 years of age when he was lynched in August 1917 in Lilian, Virginia. My mother would have been a toddler sleeping in her crib at home, just a mile away from the schoolyard in which he was hanged. Newspaper reports state that a mob of about 500 men assembled to commit the murder.

William Page would be the last Black man to be lynched in my mother’s home county of Northumberland, but the lynchings would continue on for another seven years, claiming the lives of nine additional Black men across Virginia.

I am now just a bit older than my mother was when she died. At 72, I look back over a lifetime of witnessing racial injustice through the segregation of schools and other public and private facilities. The false doctrine of “separate but equal” was then in full force throughout Virginia, where both of my parents were born and raised.

I carry childhood memories of seeing “White” and “Colored” water fountains in the county courthouse. Of visiting the family doctor whose small brick office behind his house had separate waiting rooms. Hearing my grandmother talk about “the colored” schools that a neighboring county closed for five full years rather than integrate, meanwhile taking public funds to open white academies. Knowing that nearby was a “colored beach” that was a small sliver of sand allotted to Black children. And knowing that there would never be any Black worshippers or preachers at the church revival meetings where my grandmother played piano.

Looking back at all of those memories, I know full well that the privilege to pass by those National Guard tanks in 1968 had come at the expense of others, sometimes in deadly ways.

In his 1964 book “Why We Can’t Wait,” Dr. King wrote: “Armies of officials are clothed in uniform, invested with authority, armed with the instruments of violence and death and conditioned to believe that they can intimidate, maim or kill Negroes with the same recklessness that once motivated the slaveowner.”

Now, nearly 60 years later, we see that Dr. King is still being proven right with the brutal beating death of Tyre Nichols in Memphis. It wasn’t a rope like they used on William Page, or a bullet like the one that felled Dr. King, but the stun gun, pepper spray, fists and boots of police officers who have been charged with murder in an incident that equals the terror of the August night when 500 men watched William Page die.

Must we wait for another hundred years to pass for this senseless killing to stop? The simple answer is, no, we can’t wait.

On Wednesday’s episode of the show, I spoke with the former immigration attorney–turned–congresswoman about the broader powers she has now that’s she in D.C. and whether she will be able to use them. Our conversation has been condensed and edited for clarity.

Mary Harris: Rep. Hillary Scholten says the nuances of immigration have always been important to her. Before she was an attorney, she worked as a migrant advocate. But once she got her law degree, she took that experience one step forward, joining the DOJ.

You were working on immigration appeals, right?

Yeah, exactly. But the Board of Immigration Appeals also has jurisdiction over dealing with regulations. It’s the highest administrative agency dealing with immigration issues—not only one-off cases, but we set national precedent for things like asylum, dealing with children who are detained in the United States. It’s a very powerful agency. Not a lot of people realize how much influence it has. And so that’s significant because when Trump was elected, we saw such a marked change in the direction of the work, where the focus of the policies seemed to be cruelty for the point of cruelty. And I couldn’t continue to work there and uphold my oath to protect and defend the Constitution, let alone maintain my own moral compass. And so I took a stand and I left.

Scholten soon got a new job at the Michigan Immigrant Rights Center. But almost as soon as she arrived, her work—and the work of many other immigration attorneys across the country—was thrown into chaos. Things got especially bad as it became clear the Department of Homeland Security was separating migrant children from their parents at the border, leaving lawyers and advocates to figure out what to do next. That’s when Hillary Scholten started seriously considering a run for Congress.

At the height of the family separation crisis, our agency was responsible for helping reunite and represent so many children. Imagine a legal services waiting room that turned into a virtual day care center overnight with kids who didn’t know where their parents were. And there were a lot of reasons I raised my hand to run, but no doubt I can pinpoint the moment when I was like, “Oh, hell no, I got to do more.” It’s the height of the summer. My dear husband came to visit me at work. It was going to be a late night, and he brought me an iced coffee. And we were chatting, and we walked through our waiting room. He’s normally a pretty stoic guy, and he fell silent. And I turned and looked at him, and his eyes had just filled with tears. And I realized that we had walked past a set of three siblings, all dressed in their Sunday best, between the ages of 5 and 7. That’s how old our children were at the time. And he just said, “Hill, you see this stuff on the news. It is an entirely different level to look these children in the eye.”

One of our youngest clients was separated from his parents at 4 months old. You’re not just walking away from a parent. You’re being taken from their arms.

Five years later, this investigation by the New York Times has Scholten thinking about different ways to help migrant children. Just this past weekend, she returned to her district to connect with constituents and think about how she can intervene, now that her community’s child labor problem is no longer a secret. She can already see the way the news has rippled outward.

One of the saddest things about the fallout of all of this is that there has continued to be some real discontent within the immigrant communities here, where shining a light on the exploitation of children has also shined a light on the fact that there have been so many other individuals working without authorization in these factories. And as companies have started to look into who’s actually working here, their labor pool has vanished. Hearthside, after the Times ran the investigation, said they were going to be doing inspections on the manufacturing floor, and 75 percent of their workforce didn’t show up the next day.

As Hillary says, the BIA is “a really powerful agency.” That’s exactly why the Trump Administration “packed” it with unqualified restrictionist “Appellate Judges” known for their anti-asylum bias and astronomical asylum denial rates!

That’s also why Biden, Harris, and Garland’s near-complete failure to “clean up the BIA” and the rest of the failed EOIR “judiciary” and bring in the “best legal minds in the business” to establish a model progressive expert judiciary is such a scandal and indicator of the repeated failure of Dem Administrations to take advantage of the transformational opportunities given them.

By contrast, whether we like it or not, the far right extremist GOP knows exactly how important the Immigration Courts are and accordingly acts decisively to weaponize, pack, “dumb down,” and co-opt them in their nativist battle to dehumanize and demonize migrants. This was a key “first step” in the GOP’s attack on all of the “others” in America! Transgender youth, African Americans, women, Asian Americans, Hispanic Americans, and others being targeted by the GOP’s nationwide assault on their rights, humanity, and the truth about our history might look to the Biden Administration’s fecklessness in dealing with immigrants’ rights and human rights to understand how they are being “left out on a limb” by a Dem Administration — more interested in its re-election than in serving those who helped put them in office. 

Hillary had the guts and moral courage to take a stand. Yet, Biden, Harris, Garland, Mayorkas and others in this Administration, not so much! Frankly, that’s appalling! 🤮

“It is an entirely different level to look these children in the eye.” This encapsulates the problems of immigration, human rights, child abuse, and racial injustice! Unlike Hillary, very few legislators, Federal Judges, Biden politicos, or GOP nativist Governors and AGs have ever had to get their “hands dirty” by “looking . . . in the eyes” of children and others whom they abuse, dehumanize, and bully on a regular basis!

Contrast Hillary’s “hands on” experience and search for bipartisan practical solutions with the predictable stupidity and abuse by GOP Arkansas Governor Sarah Huckabee Sanders, a living incarnation of the “Peter Principle,” who recently and gleefully signed into law an insane provision reducing child labor protections in Arkansas while incredibly claiming that protecting children was “burdensome and obsolete!” 

The law eliminates requirements for the state to verify the age of children younger than 16 before they can take a job.

The anti-woke crusade is rooted in fear and ignorance, a mnemonic placeholder for the bigoted things most people wouldn’t dare say aloud. Black Americans have been using the term “woke” since the 1940s to describe a state of awareness toward racist policies and worldviews that negatively impact the Black community. However, many White people now use the term as a derogative slur, a cowardly way of spilling the beans while denying any beans were spilled.

Saying you are anti-woke is a way of admitting you are anti-Black without feeling the backlash many outspoken racists receive. Likewise, anti-woke crusaders are promoting anti-democratic policies by controlling what topics schools and businesses can read and discuss without getting labeled a fascist for circumventing the First Amendment of the Constitution. America was founded by White men interested in securing their rights while denying that same access to Black people, women, and racial and ethnic minority groups. We don’t have to worship the founding fathers blindly, nor should any American. It seems many conservatives are afraid of saying the quiet part out loud, of admitting that their crusade on “woke” is really an attempt to diminish the gains made by the Civil Rights Movement, of framing progress as regressive. Americans should challenge more conservatives to define “woke” on their own terms because the more descriptions they provide, the more we can see through the smoke and mirrors.

There is an enduring pattern in American conservatism in which the right first develops a paranoid interpretation of the liberal Establishment, and then reverse engineers its own version of the monster it has imagined. Conservatives convinced themselves that the mainstream media and universities were mere propaganda organs, then created institutions like the Heritage Foundation and Fox News, warped reflections of their own overheated critique. The January 6 insurrection was, of course, in the mind of its participants, a “response” to the imagined vote-fraud conspiracy and its antifa/BLM shock troops.

John Durham’s investigation is a classic episode in this tradition. The American right first convinced itself that Robert Mueller and the deep state, using the cover of dispassionate professionalism, had launched a partisan witch hunt to smear Donald Trump. In response, it created a right-wing mirror image, as fervently partisan and unhinged as they believed their enemies to be.

The New York Times has a deeply reported narrative showing how Durham’s counter-investigation of the Russia probe, cooked up by William Barr at Donald Trump’s urging, was just as abusive, partisan, and unhinged as Trump’s defenders made Mueller out to be.

The purpose of special counsel is to wall off a politically sensitive investigation from the attorney general. But Durham, reports the Times, was working closely with Barr behind closed doors all along. The two Republicans dined and drank together, and came to share Barr’s Fox News–brained beliefs that Trump had been the victim of a conspiracy.

Rather than preventing Barr from meddling in a politicized investigation, this arrangement inverted that purpose and laundered Barr’s involvement through Durham’s putative independence. “At some point, some particularly ill-informed critic of the administration may try to paint Durham as a right-wing hack or Republican loyalist,” wrote National Review’s Jim Geraghty in a fawning profile, singling out the NAACP’s Sherrilyn Ifill for having the temerity to suggest Durham might have been compromised by serving Trump’s ends.

Durham and Barr kept failing to prove the deep-state conspiracy they imagined, but continued to press forward anyway. At one point they seized upon hacked Russian memos that intelligence analysts deemed obviously fake, instead treating them as a valuable intelligence trove, and tried to prove it out, even harassing one of the targets to obtain his emails (which contained nothing incriminating). It weirdly reflected the Trumpist accusation that Robert Mueller had been tricked into pursuing Russian disinformation.

As Durham kept failing to find support for the conspiracy he was pursuing, and which Barr kept floating in public, his deputies chafed at his obsession. Eventually, one of them resigned in protest when he brought charges against Michael Sussmann, a target of the right. As his former lieutenants expected, Durham’s case was defeated in court.

Immigration advocates didn’t need a NY Times investigation to tell you that Barr was corrupt! Biased anti-immigrant, anti-asylum “AG precedents;” BIA “Appellate Judges” appointed for their unusually high asylum denial rates and known hostility to migrants and their attorneys; Immigration Judges appointed without expertise in immigration and human rights, overwhelmingly from the ranks of prosecutors; busting the IJ union (“NAIJ”) for speaking out against DOJ’s politicized mismanagement; issuing an EOIR “Fact Sheet” full of lies, misrepresentations, and myths; appointing politicized managers at EOIR without judicial or due process qualifications; taking ethically questionable litigating positions in Federal Court; the list of Barr’s abuses of authority on immigration and human rights goes on and on!

AG Merrick Garland has made a few ameliorative changes. Some of the worst precedents have been overruled; some unqualified political senior executives been removed or reassigned; over time, judicial selection has been shifted to a more balanced, merit-based system that has resulted in the appointment as Immigration Judges of some widely-recognized experts, with experience representing individuals, and a demonstrated commitment to due process for all; “numerical quotas” for IJs have been eliminated. (Curiously, however, Garland “honored” 17 “transition” Barr judicial selections made under badly flawed selection criteria!)

Yet, overall, EOIR remains largely the disaster zone that Barr left behind. Trump-era anti-asylum Appellate Judges continue to dominate the BIA; many Trump-era IJs still misapply basic immigration legal standards and operate “asylum free zones;” management is weak; training is inadequate; dockets are out of control; respondents and their attorneys are treated unprofessionally; quality control is largely nonexistent; wildly inconsistent “refugee roulette” asylum adjudication remains; an enforcement-skewed culture of “any reason to deny and deport” continues to infect EOIR at all levels; “numbers” are emphasized over quality and fairness; and the DOJ’s OIL often defends indefensible EOIR decisions in Federal Court on the apparent rationale that “it’s only migrants’ lives at stake, so who cares!”

Unhappily, the Biden Administration has barely “scratched the surface” of the badly needed and long overdue common sense reforms needed at EOIR and the DOJ to put the Sessions/Barr abuses behind us and move forward! Barr was a bad AG; but, his ghost continues to haunt the DOJ and those seeking equal justice for all!

While we welcome the expanded humanitarian parole program to provide a pathway for Cubans, Haitians and Nicaraguans to apply for protection without having to make the dangerous journey to the border, that must not come at the expense of the human right to seek asylum. These new policies will undoubtedly have a disparate impact on Black, Brown, and Indigenous people seeking safety. In fact, Amnesty International previously found that the cruel treatment of Haitians under Title 42 subjected Haitian asylum seekers to arbitrary detention and discriminatory and humiliating ill-treatment that amounts to race-based torture.  The United States has both a legal and moral obligation to uphold the right to seek asylum, and over the holidays, we once again saw communities mobilize to welcome asylum seekers with dignity. This expansion will put vulnerable refugees in harm’s way and exacerbate violence and chaos in border communities.”

Sen. Robert Menendez (D-N.J.), who along with Senate Majority Leader Charles E. Schumer (D-N.Y.) has pushed the Biden administration for months to end Title 42, criticized the administration’s plan, saying it goes too far in restricting migrants’ access to the border.

“The Biden Administration’s decision to expand Title 42, a disastrous and inhumane relic of the Trump Administration’s racist immigration agenda, is an affront to restoring rule of law at the border,” Menendez said in a statement. “Ultimately, this use of the parole authority is merely an attempt to replace our asylum laws, and thousands of asylum seekers waiting to present their cases will be hurt as a result.”

Alas, no surprise to “Courtside” readers! The question is what can and will human rights supporters, progressives, and racial justice advocates DO about the consistent betrayal of humanitarian values values and the rule of law by Dems; not to mention Dems trashing their own campaign promises!

Trump’s nativist racism and Biden’s incompetence have actually moved our nation’s approach to legal refugee and asylum status BACK more than four decades! In place of the international framework put in place by Congress in the Refugee Act of 1980, we now have a hodgepodge of arbitrary, ad hoc, actions by the Biden Administration, relying to an unacceptable (and prima facie illegal) extent on the use of “emergency parole” authority as a partial substitute for legal refugee and asylee admissions!

This favors some non-refugees with “sponsors” over those who meet the accepted international definition of “refugee.” It promotes Executive and political favoritism over the needs of legal refugees. It stands on its head the normal refugee definition requiring an individual to be OUTSIDE their country of nationality to apply.

Congress did give the President extraordinary authority to admit those who otherwise meet the “refugee” definition directly from their native countries in conflict. However, rather than using this legal authority, Biden has chosen to misuse parole to EVADE it.

Even for those Venezuelans, Nicaraguans, Haitians, and Cubans fortunate enough to be chosen for parole, the first three groups will be left in limbo with no clear way of obtaining permanent immigration status after the expiration of their two-year “parole.” This obviously converts them into “political footballs” — particularly if the GOP were to regain the Presidency in 2024!

Paroled Cubans, on the other hand, might qualify for green cards under the “Cuban Adjustment Act of 1966” after one year. This creates yet another arbitrary inconsistency among those similarly situated, based solely on nationality.

The Refugee Act of 1980 creates a screening and adjustment process for those admitted as refugees thereunder, similar to the Cuban Adjustment Act. It also creates a similar process for those refugees granted asylum at the border or in the interior.

But, Biden’s choice NOT to use the existing legal provisions established by the Refugee Act of 1980, recreates exactly the type of disorder, arbitrariness, and uncertainty that the Refugee Act of 1980 was intended to end! And, they did in fact more or less end for nearly four decades, prior to the Trump-initiated fiascos that began in 2017 and which Biden, despite pledges to the contrary, has lacked the competence, expertise, and will to end and restore the rule of law!

If properly staffed with human rights experts and dynamic, visionary “practical scholars” as leaders, our legal refugee and asylum systems could not only be restored, but could also be dramatically improved and made fairer! That’s basically what Biden promised during the 2020 campaign.

Outrageously, once in office those promises have been trashed and, predictably, chaos and incompetence reigns. That’s a deadly combination for asylum seekers patiently waiting for our nation to honor its laws and international obligations!

It shouldn’t be like “waiting for Godot!” But, it is!

President Biden on Thursday will announce new immigration restrictions, including the expansion of programs to remove people quickly without letting them seek asylum, in an attempt to address one of his administration’s most politically vulnerable issues at a time when the nation’s attention is focused on Republican disarray in the U.S. House.

The measures will expand Biden’s use of “parole” authority to allow 30,000 migrants from Cuba, Nicaragua, Haiti and Venezuela to come to the United States each month, as long as a U.S. sponsor applies for them first. But those who attempt to migrate through the region without authorization will risk rapid expulsion to Mexico, as the administration plans to expand its use of the pandemic-era Title 42 public health policy. Mexico has agreed to take back 30,000 border-crossers from those nations each month, U.S. officials told reporters during a briefing Thursday morning.

The measures, which are likely to draw legal challenges from immigration advocacy groups,”will expand and expedite legal pathways for orderly migration and result in new consequences for those who fail to use those legal pathways,” the White House announced.

Biden, who has said he will seek reelection in 2024, is contending with the political and operational fallout of two consecutive years of record numbers of migrants taken into custody at the Mexican border, in part because of his more welcoming policies.

Before taking office, Biden said he wanted an orderly system, not “2 million people on our border.” The number of border apprehensions jumped to 1.7 million during his first year in the White House, however, and soared to nearly 2.4 million in his second year. Biden campaigned on the promise that his administration’s immigration system would be “safe, orderly and humane”; his pivot toward amped up enforcement suggests the White House sees immigration as a 2024 liability.

The administration’s solution is legally thorny and will likely anger immigration advocates and even some Democrats — and will probably do little to silence Biden’s Republican critics.

  • Biden’s plan effectively imposes arbitrary geographic and ideological restrictions on those seeking protection — something that Congress specifically intended to eliminate when enacting the Refugee Act of 1980;
  • Biden’s plan leaves out asylum seekers and refugees from the Northern Triangle, some of those most in need of protection;
  • It imposes arbitrary and illegal numerical limits on those who might otherwise seek asylum;
  • It continues the illegal and expanded use of Title 42 as a border enforcement mechanism having nothing whatsoever to do with public health — a position that the Administration itself has refuted in Federal Court all the way up to the Supremes;
  • It leaves those “paroled” in limbo with no clear path to legalization in the U.S., other than perhaps eventually applying for asylum in overloaded and often biased system with a backlog of many years;
  • Any future path to legal status for these parolees would require legislation agreed to by the GOP — not likely to happen — thus making these individuals “bargaining chips” for nativists seeking further restrictions on legal immigration and the right of asylum;
  • The “mass use” of parole at a rate of 30,000/month appears a direct violation of section 212(d)(5) of the INA, as amended by the Refugee Act of 1980, which specifically intended to end the “mass use” of parole as a substitute for admitting refugees under the legal framework set up by the Refugee Act of 1980, as amended.

On Title 42, the Supreme Court rules for a partisan agenda

COVID-19 is no reason to shut out migrants. Yet it’s used as a political pretext.

The Supreme Court’s ruling last week to keep in place a Trump-era immigration order can only be understood as five conservative justices advancing a conservative political agenda, in violation of clear legal rules.

Without giving reasons or any explanation, the court reversed lower court decisions that allowed the Biden administration to lift a restriction that prevents asylum seekers at the border from entering the country, imposed early during the COVID-19 pandemic.

The federal law — referred to as Title 42 — permits the Centers for Disease Control and Prevention to prohibit people from coming into the U.S. to avert the spread of a “communicable disease” present in a foreign country.

In November, U.S. District Judge Emmet Sullivan, in Washington, D.C., found that the continued use of Title 42 was “arbitrary and capricious in violation of the Administrative Procedure Act.” He ruled that the expulsion policy was no longer justified based in light of the present state of the pandemic, which includes widely available vaccines, treatments and increased travel in the United States.

Nineteen states with Republican attorneys general, however, oppose that ruling and sought the right to appeal to the U.S. Court of Appeals for the District of Columbia Circuit. They were not parties to the lawsuit in the District Court and the law generally does not allow parties to get into a case for the first time at the appeals level. On Dec. 16, the federal Court of Appeals, following its well-established law, refused to allow the states to intervene. The states then sought Supreme Court review of that decision.

On Dec. 27, in Arizona vs. Mayorkas, the Supreme Court, in a 5-4 ruling, not only said that it would hear the states’ appeal, but that it would require that the Biden administration continue to use Title 42 to expel migrants.

The court’s action makes no sense for several reasons. Title 42 provides the government authority to close the borders only if a public health crisis involving a communicable disease requires it. No one in the litigation disputes that COVID no longer warrants restrictions on immigration.

The states are intervening not because they believe that a continuing public health emergency requires Title 42, but because they want to use it as a pretext to close the borders.

In fact, in another case now pending on the Supreme Court’s docket — on whether the Biden administration’s student loan forgiveness program is justified as a response to the pandemic emergency — 12 of the states in the Title 42 case argued in their brief that “COVID-19 is now irrelevant to nearly all Americans.”

The Supreme Court’s order is senseless for another reason: The only issue before the court is whether the states can intervene in the case. It is not about whether the District Court erred in ending the use of Title 42 to expel migrants. Even if the states were allowed to join the case, they can’t plausibly make the case that COVID concerns still justify immigration expulsions at this point.

The five conservative justices based their decision not on the purpose of Title 42, which is to stop the spread of a communicable disease, but on their partisan agreement with conservatives on immigration issues. We should expect better of the court than that.

Having a High Court, with life tenure, where a majority of the Justices enter “senseless orders” — targeting some of the most vulnerable and abused in our society who also happen to be predominantly individuals of color — is in and of itself senseless — from a standpoint of preserving our democracy!

The action of the five GOP Supremes is beyond outrageous! The NDPA CAN turn this gross right-wing minority abuse of our judicial system around!  Likely not in my lifetime!

But, you need to keep pushing Dems to pay attention to judicial appointments and start insisting on meaningful professional expertise in immigration and actual experience representing individuals in Immigration Court as a basic requirement to serve as a Justice. Also we need an Article I Immigration Court and NO MORE Attorneys General without proven “grass roots” immigration and human rights experience! 

Immigration is “where the action is” on the fight to save American democracy! If tone-deaf and spineless Dem politicos keep “running” from the key issue in American law and society, perhaps it’s time for true liberals, progressives, and constitutional humanitarian realists to “run” from the Dem Party!

This Supreme farce also reinforces the disgraceful failure of Garland and the Dems to reform the “Supreme Court of Immigration” — the BIA — by replacing enforcement-tilted Trump holdovers with practical scholar, expert, progressive judges committed to realizing long-denied due process, fundamental fairness, and the best interpretations of immigration and refugee laws! Dems control an important Federal Appellate body and are too clueless and afraid to do the right thing — even with the rule of law, racial justice, and human lives on the line!

Migrants should be welcomed with dignity and compassion—not turned away or treated inhumanely.

Finally, after over two years, a district court has ruled that the Title 42 expulsion policy- which has blocked most migrants from crossing the U.S.-Mexico border to seek asylum- violates U.S. law and ordered the Biden administration to end it.

This anti-immigrant policy has led to hundreds of thousands of people deported back to dangerous conditions or stranded in makeshift camps. Other migrants have been forced to take dangerous routes through deserts, mountains, rivers, and the ocean—facing extreme heat, violence, even death.

The termination of the policy goes into effect at the end of December, unless the administration attempts to delay this. That is why we are calling on the Biden administration to end this policy IMMEDIATELY and to not accompany this with the expansion of detention.

I believe that people fleeing dangerous situations in their home countries should be welcome to the United States with compassion—not dealt overwhelming obstacles to seeking asylum.

That is why I am relieved to hear that after over two years, a district court has ended the cruel and unnecessary use of Title 42. This anti-immigrant policy has led to hundreds of thousands of people deported back to dangerous conditions or stranded in makeshift camps. Under this cruel policy, Black and Brown migrants have suffered disproportionately while some others have been able to seek asylum—evidence of the racism that drives our immigration enforcement policies.

That is why I am calling on the Biden administration to end Title 42 immediately and to not replace it with other inhumane and xenophobic policies that cause similar harm. Additionally, your administration must not accompany this with the expansion of immigration detention. Any efforts to uphold this policy actively supports more family separations, trauma, and violence against Black, Brown, and immigrant communities.

All people—regardless of where they were born, the color of their skin, their culture or religious affiliation—should be able to seek refuge and be welcomed with the compassion, dignity, and respect we all deserve. I urge your administration to do all that you can to end Title 42 immediately—and ensure all migrants can exercise their right to seek asylum.

I dissent. 

I was outraged when I read in this morning’s Washington Post about the horrible “Sinema/Tillis misnamed immigration compromise” (actually a “sellout”) being negotiated during the lame duck session of Congress. In short, that proposal apparently would trade long overdue protection for “Dreamers” for the rights and lives of refugees and asylum seekers.

Incredibly, in the face of U.S. District Judge Emmet Sullivan’s findings that the intentional illegal use of Title 42 had resulted in countless clear violations of the legal rights of asylum seekers, subjecting them to a litany of horrors and abuses that he described as “dire harm,” these legislators would extend those abuses for an indefinite period! That’s notwithstanding evidence not only of the irreparable harm that Title 42 has caused, but also the rather obvious fact that once we “normalize” those abuses, they will never end. 

There will always be another fabricated reason for extending the Title 42 charade. Indeed, once we start mischaracterizing abuse as “law,” we can’t even call it “abuse” and hold the abusers accountable! That’s all part of the dehumanizing or “Dred Scottification” process! 

Additionally, in the place of a functioning working asylum and refugee system, the proposal would eventually substitute so called “processing centers” and “expedited procedures” to railroad asylum seekers out of the country without due process. And, it wouldn’t address the total dysfunction and denial of due process in our Immigration “Courts” by enacting another long overdue provision:  the “Lofgren Article I Immigration court bill!” What a farce!

Let’s be clear about what’s happening here! The legal and human rights of refugees and asylum seekers are not “ours” to trade away for relief for another deserving group that has long been irrationally denied! “Processing centers” are a euphemism for “immigration prisons” — part of the “New American Gulag.” “Expedited processing” is a euphemism for “railroading.” Both detention and artificially expediting dockets have been proven to be ineffective and unjust, over and over. Yet, here we go again! 

My outrage turned to shock and dismay when I learned that some erstwhile defenders of due process, human rights, and racial justice for asylum seekers (incredibly) thought that this type of immoral compromise was a “good idea!” Not me!

Restrictionist/nativist Dems masquerading as “moderates” are a huge problem. They play right into the GOP’s hands. 

When committing crimes against humanity or giving away refugees’ rights becomes a “strategy,” “option,” or “bargaining chip,” we’re lost as a nation. And, that’s exactly where we’re heading with horrible, immoral proposals like this.

Human rights and due process are non-negotiable! And, I guarantee that extending Title 42, building additional Gulag (rather than making the existing legal asylum and refugee systems work), and railroading asylum seekers will empower smugglers and lead to further growth of our underground population. 

Human migration won’t be stopped by ineffective and immoral “deterrence.” And, although many hate the idea, refugees basically “self-select” and are driven by forces beyond our immediate control. 

Refugees are, by definition, folks who can’t return! So, there is no reason to believe that true refugees (of which there are many) are going to be “deterred.” They might be “incentivized” to seek refuge in particular, relatively safe, places; but, nobody seems interested in a “carrot” approach — even though the “stick approach” has failed and continues to do so!

Look at the folks who continue to die in vessels in the Mediterranean even though they are fully aware that they are unwanted and that the EU will stop at no cruelty to keep them out. 

And, examine the wealth of documentation that folks forced to “remain in Mexico” — and apply under what we know to be a corrupt and inadequate system — are systematically abused and exploited. 

This time, we’re not just “pushing the St. Louis out to sea.” We’re torpedoing her and watching the passengers drown. And Dems are a huge part of the problem!

Other (soon to be former) progressive Democrats might choose to “go along to get along” with heaping additional abuses on largely defenseless refugees and asylum seekers. But, not me! I dissent!

WASHINGTON — The Biden administration is considering substantial new limits on the number of migrants who could apply for asylum in the United States, according to people familiar with the proposal, which would expand restrictions similar to those first put in place along the border by former President Donald J. Trump.

The plan is one of several being debated by President Biden’s top aides as the country confronts a high number of illegal crossings at the border. It would prohibit migrants who are fleeing persecution from seeking refuge in the United States unless they were first denied safe harbor by another country, like Mexico.

People familiar with the discussions said the new policy, if adopted, could go into effect as soon as this month, just as the government stops using a public health rule that was put in place at the beginning of the coronavirus pandemic by the Trump administration and became a key policy to manage the spike in crossings during Mr. Biden’s tenure. A federal judge has ordered the administration to stop using the health rule on Dec. 21.

But the idea of broadly prohibiting migrants from seeking asylum strikes directly at the heart of decades of American and international law that has shaped the United States’ role as a place of safety for displaced and fearful people across the globe.

[U.S. District Judge Emmet ]Sullivan wrote that the federal officials knew the order “would likely expel migrants to locations with a ‘high probability’ of ‘persecution, torture, violent assaults, or rape’ ” — and did so anyway.

“It is unreasonable for the CDC to assume that it can ignore the consequences of any actions it chooses to take in the pursuit of fulfilling its goals,” Sullivan wrote. “It is undisputed that the impact on migrants was indeed dire.”

What part of Judge Sullivan’s very clear ruling on their “crimes against humanity” and knowing violations of U.S. and international law doesn’t the “Biden Administration Clown Show” 🤡 understand? Just follow the asylum law and due process, already! If you can’t do that, resign and let folks who can do the job (of which there are plenty out here in the “real world”) take over and do the job you have been failing at for two years!

In any event, the talent is out here in the private/NGO sector and will resist this latest insult to humanity and degradation of the rule of law and due process that Administration officials are “pondering!” “Studying and deciding whether or not to violate the law (again)?” Sounds like a potential criminal conspiracy to me! 

In any event, expert litigators like Lee Gelernt of the ACLU and other NDPA superstars are prepared to “beat the Biden Administration’s brains (if any) out” in court again if they try to implement any more of their illegal and immoral immigration gimmicks!

“If the Biden administration simply substitutes the unlawful and anti-asylum Trump transit ban for Title 42,” Mr. Gelernt said, “we will immediately sue, as we successfully did during the Trump administration.”

The Chair of the Senate Foreign Relations committee was also “not on board” with the Biden Administration’s latest harebrained ideas on diminishing human rights that they have substituted for basic competence over the past two years of disasters, and unforgivable policy screw-ups on immigration, human rights, and racial justice issues:

“If the reported story is true, the Biden administration would further step away from our nation’s commitment to offer refuge to asylum seekers,” Senator Bob Menendez, Democrat of New Jersey and the chairman of the Foreign Relations Committee, said in a statement on Thursday. “I will firmly oppose this misguided attempt to rewrite our asylum laws without congressional approval, just as I firmly opposed the same efforts under President Trump.”

I also have to wonder how Judge Sullivan will react when he learns how Biden Administration officials are using his “reluctantly granted” five weeks of delay in implementing his “cease and desist order.” Instead of, at long last, getting their collective tails in gear to finally put in place a competent legal system for re-establishing legal asylum at the southern border, these disgraceful petty bureaucrats and so-called “policy” officials have been scheming to evade the rule of law and commit yet more “crimes against humanity.”

The NDPA is not going to let them get away with it. Even if it means ripping apart the “so-called Democratic Coalition” going into the 2024 elections!
