The Biden administration has said it may need 6 months to reverse Trump administration asylum policies and bring asylum seekers stranded in Mexico to safety. Tragically, some may not survive that long.
In her newest blog post, Legal Fellow Julia Neusner presents a heartbreaking portrait of the violence, discrimination, and trauma asylum seekers have endured under the Trump administration’s policies.
Julia writes about victims of these policies, including Ana and Jorge, an Afro-Cuban couple who were kidnapped after US border officers expelled them to Mexico under MPP. Armed men robbed them and forced them into a room covered in blood. Other kidnapping victims were moaning on the floor, some with severed body parts.
“They told us [a friend] would have to pay $4,000 for both of us, and if he didn’t, they would cut us up, part by part,” Ana recalled. “I lost control and started crying. My boyfriend pleaded with them, and they hit him with a gun. Then they beat me. It was horrible. We spent these days in hell.”
SETTING THE RECORD STRAIGHT ON ASYLUM
On Wednesday, President Trump travelled to the southern border to tout his immigration record. In response, Human Rights First released a fact sheet outlining the Trump administration’s record on asylum: one defined by chaos, cruelty, and illegality.
From separating over 5,500 families to delivering people to life-threatening danger in Mexico to spurring the spread of COVID-19 by refusing the repeated pleas of epidemiologists to release asylum seekers and immigrants from detention, Trump’s real record is deep damage our asylum system.

A key to “setting the record straight on asylum” is immediate removal of the “EOIR Clown Show” 🤡🦹🏿♂️ in Falls Church, a retraction of the gross lies and misleading anti-asylum, anti-lawyer narratives set forth in their White Nationalist nativist “Bogus Fact Sheets,” immediately cancelling the insane anti-due process, anti-lawyer procedures now in place, and setting the record straight on asylum law, including the toxic, unethical, and unconstitutional role of EOIR in actively undermining the legal rights and humanity of asylum seekers as well as being responsible for gross mismanagement of the Immigration Courts.
There are folks out there in the private/NGO/academic community who can get the job done, starting day one! Yeah, there are many other priorities; that’s a beyond compelling reason for bringing in the experts and empowering them to solve the problems, sooner rather than later! There really is no viable “later” here!
We simply don’t have six months to stop killing people and violating human rights on a daily basis! If we don’t make radical changes and take some calculated risks to end the abuses and mismanagement at EOIR, the SG’s Office, and DHS right off the bat, it will be too late for too many!
Maybe Judge Garland and his Executive Team need to spend a few days with some immigration practitioners and NGOs right now to see what’s happening in the “Star Chambers impersonating courts” that they will “own” in a few weeks. Maybe they should spend some time in the squalid migrant camps in Mexico, seeing what existence is really like for those to whom we have shirked our legal and moral responsibilities.
Ask themselves, would THEY subject THEIR families to such mistreatment? If not, then why hasn’t a plan been announced to end the deadly “EOIR Clown Show” 🤡🦹🏿♀️☠️ immediately and put some legitimate judges and competent managers who understand asylum law and immigration practice in place?
Judge Garland, with all due respect, when the incoming Administration tells lawyers, many working pro bono or low bono, who are risking their lives to save their clients’ lives in the “living Hell” of today’s U.S. Immigration Courtsto “be patient, we’ll get to you soon,” you are giving them a very clear and chilling message: THEIR LIVES, SAFETY, AND SANITY AREN’T YOUR PRIORITY — I/O/W, THEIR LIVES DON’T MATTER!
That’s neither an appropriate nor uplifting message to give to an embattled group whose support, assistance, ideas, creativity, and energy will be absolutely essential to your plans to “restore justice to Justice!”
The sad truth is that time does not, in fact, “heal all wounds,” and failures that kill and damage people for life can’t be “undone,”

CBS: Another federal judge on Friday ruled that Chad Wolf was likely unlawfully appointed to his position at the helm of the Department of Homeland Security (DHS), issuing a decision that blocked a set of broad asylum limits slated to take effect Monday.
WaPo: The U.S. Court of Appeals for the 4th Circuit said the administration’s policy undermines the national resettlement program created four decades ago by Congress.
WaPo: President-elect Joe Biden plans to nominate federal judge Merrick B. Garland, a Democratic casualty of the bitter partisan divide in Washington, to be the next attorney general, tasked with restoring the Justice Department’s independence and credibility, according to people familiar with the decision.
Law360: Democratic victories in Georgia’s heated Senate runoffs gave the party a slim majority in Congress, but without enough votes to end a filibuster.
WaPo: More than 2,500 detainees, most with no serious criminal history, have given up their cases since March, according to records from the Transactional Records Access Clearinghouse, a research group at Syracuse University. Those records also show that detainees put in deportation proceedings in July 2020 were twice as likely to opt for voluntary departure than those from a year before.
WaPo: Over 170 new applicants have become the first individuals in several years to win approval to the Obama-era Deferred Action for Childhood Arrivals program for immigrants brought to the U.S. as young people, the U.S. government revealed in a court filing Monday.

A federal district court in California preliminarily enjoined the government from implementing, enforcing, or applying the 12/11/20 final rule, “Procedures for Asylum and Withholding of Removal; Credible Fear and Reasonable Fear Review.” (Pangea Legal Services, et al. v. EOIR issued a memo (PM 21-13) updating and replacing OPPM 17-01, Continuances, to account for legal and policy developments subsequent to its issuance. The memo provides a non-exhaustive list of legal and policy principles as an aid to adjudicators considering common types of continuance requests. AILA Doc. No. 21011101
Law360: The U.S. Supreme Court on Monday threw out a Ninth Circuit ruling that detained asylum seekers who clear an initial fear screening must be given a prompt bond hearing, sending the case back to the appeals court for reconsideration.
SCOTUSblog: The case asks whether a grant of Temporary Protected Status authorizes eligible noncitizens to obtain lawful-permanent-resident status if those noncitizens originally entered the United States without being “inspected and admitted” – a term of art referring to lawful entry and authorization by an immigration officer.
ImmProf: There are four immigration related cases set to be considered, with three being petitions by the government (more SG petitions on distinct immigration issues than one would usually expect in the course of an entire year), and the other involving a case in which the SG is agreeing that certiorari is appropriate (also a rare position for the SG). The SG’s position in each of these cases shows an unusual aggressiveness towards the role of the Supreme Court.
The BIA found that IJs may find a document to be fraudulent without forensic analysis if it contains obvious defects or readily identifiable hallmarks of fraud, and the party submitting the document is given an opportunity to explain the defects. The court held that a conspiracy or attempt to commit fraud or deceit involving over $10,000 in intended losses is an aggravated felony, and remanded to determine whether petitioner’s convictions under 18 USC §1037(a) reflected over $10,000 in intended losses. The court reversed the district court opinion and disagreed with CA6 and CA9 interpretations of the statute, by holding that a grant of TPS does not constitute an “admission” into the United States under INA §1255. (Sanchez v. Wolf, 7/22/20) AILA Doc. No. 21011100
The court upheld the BIA’s denial of petitioner’s motion to reopen based on changed country conditions in Somalia, finding that the BIA did not fail to consider al-Shabaab’s increase in power or ISIS-Somalia’s emergence and growing violence from 2011 to 2018. The court held that the Vietnamese petitioner had waived review of the BIA’s discretionary denial of asylum relief, and that his proposed social group comprised of “known drug users” was not legally cognizable because it lacked particularity. (Nguyen v. Barr, 12/21/20) AILA Doc. No. 21010503
The court reversed an injunction of PP 9945, which requires IV applicants to demonstrate acquisition of health insurance or ability to pay for future healthcare costs. President Trump issued a memorandum directing the Secretary of State to assess whether to classify Antifa as a terrorist organization under 8 USC §1182(a)(3)(B)(vi), and to take steps to consider listing Antifa in 9 FAM 302.5-4(B)(2)(U), Aliens Who Are Members of an Identified Criminal Organization. I sure hope that Judge Garland and Secretary-Designate Mayorkas are paying close attention!
Because unless they take some immediate forceful action to disable the “regime’s immigration kakistocracy” and make the radical bureaucratic changes necessary to regain control, their “dream jobs” are going to turn into “Nightmare on Elm Street” overnight!
Human rights are being violated and taxpayer funds (in an already “over budget” USG) are being poured down thetoilet 🚽by the minute by the out of control, maliciously incompetent kakistocrats at EOIR, DHS, and in the SG’s Office to name just a few of the most obvious “national disgraces” that need an immediate fix!
The defeated anti-American, neo-Nazi regime was “not normal” and neither Garland nor Mayorkas can afford to treat the wreckage of democracy and human decency and those who did the regime’s bidding at DOJ and DHS as “acceptable” for another minute!
“[W]e conclude that the BIA abused its discretion by denying E.A.’s motion to reopen. E.A.’s mother’s recent childbirth is a serious medical event, which coupled with E.A.’s minor age, her difficulty obtaining transportation, and her difficulty navigating the immigration system without assistance, constitute “exceptional circumstances” necessitating rescission of the in absentia removal order. … The BIA’s decision was also contrary to law, and therefore an abuse of discretion. … First, the BIA improperly considered E.A.’s age separately, rather than considering age alongside other factors, when determining that she had not shown that exceptional circumstances justified her failure to appear. Second, the BIA erred when it dismissed without adequate explanation E.A.’s evidence that she is eligible for SIJS. Finally, the BIA improperly stated that E.A. was required to present prima facie evidence that she was eligible for immigration relief as part of her motion to reopen. … For the foregoing reasons, we GRANT the petition for review, VACATE the removal order, and REMAND for further proceedings consistent with this opinion.”

“Salim Al Amiri, an Iraqi citizen, seeks relief from removal on the grounds of asylum, withholding of removal, and protection under the United Nations Convention Against Torture (“CAT”). He premises his requests for such relief on the harm that he fears that he would be subjected to in Iraq at the hands of members of Iraq’s military or civilian insurgents operating in that country. Al Amiri contends that he has reason to fear he would be subjected to that harm on account of his work as a paid contractor for the United States Army during the war in Iraq, as in that role he educated U.S. soldiers about Iraqi customs and practices as they prepared for their deployment. We vacate and remand the ruling of the Board of Immigration Appeals (“BIA”) denying his claims for asylum and withholding of removal, but we deny his petition insofar as it challenges the BIA’s ruling rejecting his CAT claim.”
Think how much better this system would function with expertjudges who treated asylum applicants fairly from the “git go,” granted protection wherever possible in accordance with the the Refugee Act of 1980 and the (more “woke”) Supremes’ precedent in Cardoza-Fonseca, provided clear, positive guidance on how valid claims could be documented and granted, and promoted and consistently applied best practices to achieve efficiency with maximum due process.
At first glance, although the issue is reopening rather than a continuance, E.A.C.A. undercuts McHenry’s nativist, insanely wasteful, and totally dishonest attempt to “raise the bar” for routine continuances for asylum applicants who need time to properly document and prepare their cases.
The “Deny – Deny Program” — deny due process, deny relief — that infects EOIR’s “Star Chambers” (impersonating “courts”) is a huge backlog builder that kills people and screws up Court of Appeals dockets in the process.
Reopening cases that should be reopened, getting to the merits, and getting the many properly grantable asylum cases represented, documented, and prioritized would be a huge step in reducing EOIR’s largely self-created and unnecessary “bogus backlog.”
Ultimately, many of the clearly grantable asylum cases being mishandled and wrongly denied at EOIR, at great waste of time and resources, not to mention unnecessary human trauma, could, with real expert judges at EOIR setting and consistently enforcing the precedents, be granted more efficiently and expeditiously at the Asylum Office and ultimately shifted to a more robust and properly run Refugee Program.
In the longer run, once EOIR is redesigned and rebuilt as a proper court with real, independent, expert judges, it might be appropriate to place the Asylum Offices under judicial supervision, given the grotesque abuses and corrupt, perhaps criminal, mismanagement of the Asylum Offices by USCIS toadies carrying out the regime’s racist, White Nationalist, unconstitutional agenda of hate and waste.
NOTE TO JUDGE GARLAND👨🏻⚖️:Please fix the EOIR mess, Your Honor, before it brings you and the entire US justice system crashing down with it! This is a national emergency, and a damaging national disgrace, NOT a “back burner” issue!

Greetings,
Sharing this win, E. A. C. A. v. Jeffrey Rosen, out of the CA6 by my amazing colleague Rachel Naggar who manages our BIA Pro Bono Project. This was an appeal of an IJ (Memphis) denial of an in absentia motion to reopen for a 13-year old unaccompanied child.
Interestingly, after oral argument, OIL filed a motion to remand the case (which Rachel opposed) and the CA6 denied that motion. Seems the CA6 really wanted to issue a decision on the merits and we are grateful for the decision. Here are some highlights from the decision:
SIJS
· “Notably, the IJ’s decision does not mention E.A.’s claims that she was eligible for SIJS.”
· FN 1: “As of the December 2020 Visa Bulletin, visas are available for special immigrants (category EB4) from El Salvador to adjust their status if their priority date is prior to February 2018. If DHS removes E.A. prior to approving her visa, she will be unable to apply for adjustment of status. See 8 U.S.C. § 1101(a)(27)(J).”
Totality of the Circumstances
· “Based on the totality of the circumstances, including E.A. mother’s recent childbirth, E.A.’s young age, E.A.’s mother’s failed attempts to obtain counsel to help change the address of E.A.’s hearing, and E.A.’s inability to travel from New York to Memphis for the hearing, we hold that E.A. established exceptional circumstances.”
· “Under the totality of the circumstances, E.A.’s young age is an important factor in determining whether exceptional circumstances exist.”
Exceptional Circumstances
· “E.A.’s mother’s recent childbirth is a serious medical condition that supports reopening. The statute defining ‘exceptional circumstances’ that justify reopening an immigration proceeding lists the ‘serious illness of the alien, or serious illness or death of the spouse, child, or parent of the alien’ as an example. 8 U.S.C. § 1229a(e)(1). Childbirth is a serious medical event that necessitates a recovery period.”
· “Instead of recognizing that childbirth is a serious medical condition, the BIA minimized the seriousness of childbirth and its impact on E.A.’s mother’s ability to bring E.A. to Memphis. […] Recovery from childbirth is exactly the type of circumstance that § 1229a(e)(1) was intended to cover.”
Prima Facie Eligibility
· “Finally, the BIA erred by stating that E.A. was required to prove prima facie eligibility for immigration relief. The BIA’s decision improperly states that E.A. is required to show at this stage prima facie eligibility for relief. The statute governing motions to reopen removal orders entered in absentia provides that the petitioner must ‘demonstrate[] that the failure to appear was because of exceptional circumstances.’ 8 U.S.C. § 1229a(b)(5)(C). In general, we have stated that ‘[a] prima facie showing of eligibility for relief is required in motions to reopen.’ Alizoti, 477 F.3d at 451–52. In the case of a motion to rescind a removal order entered in absentia, however, the BIA has held that ‘an alien is not required to show prejudice in order to rescind an order of deportation” or removal. In re Grijalva-Barrera, 21 I. & N. Dec. 472, 473 n.2 (BIA 1996); see also In re Rivera-Claros, 21 I. & N. Dec. 599, 603 n.1 (BIA 1996). This is consistent with the statute governing motions to rescind removal orders entered in absentia, 8 U.S.C. § 1229a(b)(5)(C), which does not list a showing of prima facie eligibility for relief from removal as a requirement to rescind in absentia removal orders. Rivera-Claros, 21 I. & N. Dec. at 603 n.1; see also Galvez-Vergara v. Gonzales, 484 F.3d 798, 803 n.6 (5th Cir. 2007) (declining ‘to affirm the IJ’s decision on the grounds that [the petitioner] has not shown that he was prejudiced by his counsel’s performance’ because ‘In re Grijalva-Barrera, 21 I. & N. Dec. at 473 n.2, provides that an alien need not demonstrate prejudice for his counsel’s erroneous advice to constitute an ‘exceptional circumstance’ justifying rescission of an in absentia removal order’); Lo v. Ashcroft, 341 F.3d 934, 939 n.6 (9th Cir. 2003) (‘follow[ing] the BIA’s usual practice of not requiring a showing of prejudice’ to rescind an in absentia order of removal). We now join our sister circuits and hold that E.A. is not required to make a prima facie showing of eligibility for relief in order to obtain rescission under 8 U.S.C. § 1229a(b)(5) of the in absentia order of removal.”

HINT TO JUDGE GARLAND:Michelle Mendez would be an outstanding choice to lead the “clean up and rebuild” program at EOIR and the BIA once the “Clown Show” 🤡🦹🏿♂️ is removed!🪠🧹 Put experts with practical experience like Rachel Nagger and Christopher Linas onto the bench, on the BIA, the Immigration Courts, and the Article III Judiciary to get the American Justice system functioning again!
The “judicial selection system” for the Immigration Courts and the Article III Judiciary has failed American democracy — big time — over the past four years. Fixing it must be part of your legacy!
The folks who preserved due process and our Constitution in the face of tyranny are mostly “on the outside looking in.” You need to get them “inside Government” — on the bench and in other key policy positions — and empower them to start cleaning up the ungodly mess left by four years of regime kakistocracy🤮☠️🤡⚰️👎🏻. “Same old, same old” (sadly, a tradition of Dem Administrations) won’t get the job done, now any more than it has in the past! New faces for a new start!
And, it starts with better judges @ EOIR, which is entirely under YOUR control!An EOIR that actually fulfills its noble, one-time vision of “Through teamwork and innovation being the world’s best tribunals guaranteeing fairness and due process for all” will be a model for fixing our failing Federal Courts — all the way up to the leaderless and complicit Supremes who failed, particularly in immigration, human rights, voting rights, and racial justice, to effectively and courageously stand up to the Trump-Miller White Nationalist agenda of hate and tyranny!
We are where we are today as a nation, to a large extent, because of the Supremes’ majority’s gross mishandling of the “Muslim Ban” cases which set a sorry standard for complicity and total lack of accountability for unconstitutional actions, racism, dishonesty, cowardly official bullying, and abandonment of ethics by the Executive that has brought our nation to the precipice! Life tenure was actually supposed to protect us from judges who wouldn’t protect our individual rights. In this case, it hasn’t gotten the job done! Better judges for a better America!
🇺🇸⚖️🗽👍🏼Due Process Forever! The EOIR Clown Show🤡🦹🏿♂️ ☠️⚰️Never!
Check out the lies, false claims, bogus “reasoning,” and mis-statements in McHenry’s attempt to “redefine due process by encouraging judges to deny continuances to respondents.” Meanwhile, the real cause of many, perhaps most, “big time” delays and disorder in Immigration Court — “Aimless Docket Reshuffling” to accommodate improper DHS enforcement initiatives and politically motivated DOJ priorities, is swept under the rug and goes unaddressed.
Here’s an example of some amazing nativist, White Nationalist legal gobbledygook put out by the “Tower Toadies:”
The general standard for a continuance is good cause, 8 C.F.R. § 1003.29. By statute, however, “[i]n the absence of exceptional circumstances, final administrative adjudication of [an] asylum application, not including administrative appeal, shall be completed within 180 days after the date an application is filed.” INA § 208(d)(5)(A)(iii). “Exceptional circumstances” is a higher standard than “good cause.” PM 19-05, Guidance Regarding the Adjudication of Asylum Applications Consistent with INA § 208(d)(5)(A)(iii) (Nov. 19, 2018) at 2-3 (“A continuance does not automatically justify exceeding the 180-day timeline in INA § 208(d)(5)(A)(iii), however, because the statute’s ‘exceptional circumstances’ standard is higher than the ‘good cause’ standard for continuances.”). Thus, “if granting a continuance would result in missing the 180-day deadline, the Immigration Judge may only grant the continuance if the respondent satisfies both the good-cause standard of 8 C.F.R. §1003.29 and also shows the ‘exceptional circumstances’ required by INA § 208(d)(5)(A)(iii).” Id. at 2.
Translation: “Good cause” which is a constitutionally-based standard, actually means “exceptional circumstances” not “good cause” when dealing with asylum seekers, the most vulnerable among us, whose lives are in your hands. Therefore, the Constitution be damned, go ahead and deny the asylum applicant a legitimate continuance but claim that you had “good cause” for not finding “exceptional circumstances.” Oh, and while you’re at it, don’t bother to factor in the ongoing public health crisis and the lives of the individuals, attorneys, staff, and certainly not your own worthless life in reaching your pre-determined decision to deny a continuance. Denying asylum to refugees, for any reason, no matter how specious or disingenuous, outweighs human life and your meaningless oath to uphold the Constitution.
Sort of reminds me of “Gruppenfuhrer Rudy’s” famous “Truth isn’t truth” declaration to Chuck Todd on “Meet the Press!” Only in the kakistocracy is this type of absurdist “logic” considered normal and acceptable.
What a real judge might say: “Good cause” for a continuance exists where failure to grant one would make the proceedings fundamentally unfair or unduly impinge on a full and fair consideration of the respondent’s case. The need to grant a continuance to avoid a denial of constitutionally required due process is obviously an “exceptional circumstance.” This is especially true in dealing with applicants for asylum and others seeking protections from persecution and torture. Additionally, the ongoing public health crisis and the overriding need to protect the health and safety of those coming before you and your dedicated professional court staff should always be paramount in considering continuance requests.
No legitimate court system in America is mismanaged in this grotesque, nonsensical manner without considering the input, or indeed the health, safety, and lives, of either the parties appearing before the court or the judges themselves!
To be frank, Judge Garland, the EOIR Tower Kakistocracy is delivering you “the big middle finger”🖕 in advance. They are acolytes of the racist, White Nationalist, “myth based” xenophobic immigration agenda set forth by Stephen Miller and Gene Hamilton. As far as they are concerned, you and your “return justice and professionalism to Justice” agenda can “go pound sand.”
While the EOIR kakistocracy might be openly contemptuous of your incoming leadership, your supporters our here in the New Due Process Army(“NDPA”) are also aware of what’s happening. For better or worse, your commitment to and effectiveness in restoring justice will be judged initially on the number of hours, minutes, and seconds it takes you to oust the current Clown Show 🤡🦹🏿♂️☠️in Falls Church, including the failed and compromised BIA; replace them with professional, independent judicial administrators and real judges with expertise in immigration, asylum, and human rights and a nationally-recognized, unswerving commitment to due process, best practices, and practical scholarship in support of social justice.
EOIR might not be the most “sexy” item on your incoming agenda, Your Honor. But, the fate of one of the largest, perhaps most important “Federal Court Systems” is probably the most important and consequential item on which your tenure ultimately will be judged. As all of us who have served the public know, many of our “achievements” that occupied so much of our time and attention in office are forgotten or disappear before the door closes behind us at the end of of our tenure. But, being the “Father of the Independent Immigration Court” 👨🏻⚖️⚖️🗽🇺🇸👍🏼😇— bringing in a group of experts to fix the current ungodly mess and then advocating tirelessly for Article I legislation — is the kind of lasting legacy of which you could be proud!
Judge Garland, you don’t want to “own” this national disgrace and mockery of our Constitution, rational, professional court administration, honest, competent civil service, and simple human decency — the obligations that we owe to our fellow humans. Today marks a milestone for the Legal Aid Justice Center.
This morning at 10 A.M., the U.S. Supreme Court will begin oral arguments in Pham v. Chavez, LAJC’s first case before the high court in our 54-year history. It is also the last immigration case to be heard by the Supreme Court during Trump’s presidency, a fitting way to cap the past four years of fighting this administration’s harmful policies, which we kicked off with our 2017 lawsuit Aziz v. Trump challenging Trump’s Muslim ban, filed one week after his inauguration.
It is not uncommon for people who have been previously deported to eventually return to the U.S. seeking protection from new threats to their lives or liberty in their home countries. Today’s case is to decide whether immigrants who illegally reenter the United States after a prior deportation and seek an asylum-like form of protection called “withholding of removal” have the right to ask a judge for release from detention while they fight their cases, which routinely take over a year.
This case will affect more than 3,000 people every year nationwide —a number that will likely grow as those who have been turned away at the border through the current administration’s unjust policies return in desperation to seek help once again.
We thank our pro bono co-counsel Paul Hughes, an experienced Supreme Court practitioner arguing the case for us today, and the team at McDermott Will & Emery and the Yale Law School Supreme Court Clinic who assisted with the briefing. Paul has partnered with us on many of our legal challenges to the Trump administration’s immigration policies, dating back to Aziz v. Trump.
This case began in summer 2017 when we won the release of five individuals being held without bond at the Farmville Detention Center. We quickly recognized that the system needed to be reformed. Our subsequent class action lawsuit has beaten back every challenge to date, and no matter the outcome of today’s hearing, has already won the release of more than 100 people from detention.
We hope the highest court in the land will also acknowledge that these immigrants should have the chance to seek freedom.

As noted in my previous posting, this case is also a good example of the false and misleading narratives pushed by unethical former SolicitorGeneral and leading “Trump Toady” Noel Francisco in defending the regime’s “crimes against humanity” and racist agenda targeting asylum seekers and other migrants.
In fact, as anybody actually familiar with the Immigration Court system knows, holding bond hearings for 3,000 seekers of protection would not be a major burden on the Immigraton Courts. It’s an example of critical, yet routine, duties that should be performed easily, efficiently, fairly, and frequently by any qualified U.S. Immigration Judge.
What has been a “burden on the system” and a fiscal, due process, and management disaster is the improper “Aimless Docket Reshuffling” engaged in by DOJ politicos and their “maliciously incompetent” toadies at EOIR. This mismanagement and total failure of competent judicial leadership and administration has pushed the backlog to over an astounding 1.1 million cases (with many others likely MIA or lost in space in the EOIR mess).
To accomplish this dysfunctional disaster, EOIR has doubled the number of Immigration Judges. This often involves hiring judicial candidates from prosecutorial backgrounds who lack the human rights and immigration expertise, and in some cases the backbone to comply with their oaths to uphold the Constitution, necessary to restore due process to the system, issue prompt bonds to those seeking protection, establish precedents for expeditious granting of asylum and other protection, and, most of all, hold an out of control DHS enforcement kakistocracy accountable.
Judge Garland👨🏻⚖️ take note! As of the date of your confirmation, your name will start appearing on the grossly deficient work product churned out by EOIR and the scofflaw nonsense being presented to the Supremes and other Federal Courts by the SG’s Office and other DOJ lawyers who have forgotten or abandoned their ethical obligations.
I can’t believe that any Federal Judge highly respected enough to be nominated to the Supreme Court by a real President would want his name and legacy tarnished by association with the White Nationalist due process disaster and misuse of public funds currently going on at EOIR.

It’s likely that the movement to hold accountable and remove from Congress traitors like Cruz, Hawley, McCarthy, and the other Republicans who shamelessly and seditiously continued to support the anti-American lies, racist false narratives, and conspiracy theories that fueled Trump’s insurrection and domestic terrorism will die out over time. But, it shouldn’t!
As I write this, the GOP treasonists in the House are blocking what should be a unanimous resolution to invoke the 25th Amendment to remove this dangerous, unhinged, traitor/moron from the office he has abused and disgraced from Day One!
One reason why our democracy is on the ropes is that there hasn’t been any accountability whatsoever for Trump and his kakistocracy of thugs on the public payroll or for the GOP White Nationalist traitors and enablers in Congress who have furthered their grotesque abuses of humanity and our democratic institutions.
The lack of accountability is particularly glaring and disgusting for Trump’s lawyers, both in and out of Government, who have lied, misrepresented, and totally jettisoned ethics and “due diligence” in supporting and furthering Trump’s attacks on our democracy. Why is Rudy Giuliani, who led a coast to coast “conspiracy of lies and treason” in Federal and State Courts, before calling for armed rebellion against our Government, still walking free and “practicing” law? Why are Billy Barr, Gonzo Sessions, Don McGhan, Noel Francisco, and a host of others who lied, misrepresented, and abused their ethical obligations as well as their oaths of office happily ensconced in the private sector rather than being held accountable for their “crimes against humanity?”
Contrary to all the total BS 💩being spread by GOP Trump toadies, the unconstitutional, racist, illegal, violent, anti-democracy agenda of Trump, Miller, and the rest of of the Thugocracy/Kakistocracy was apparent from the “git go.”
And, Chief Justice Roberts and the other GOP Justices who helped roll out and encourage “Kristallnacht” by rubber-stamping the “Muslim ban,” “Let ‘Em Die In Mexico,” the “Bogus Wall of Misappropriated Funds,” stripping legal migrants of life-saving and health preserving benefits, helping fuel a DHS “reign of terror” directed at ethnic communities, and other neo-Nazi travesties should also tender their resignations to President Biden as of Jan 21, 2021! Intellectual dishonesty by judges and bad, righty biased (non)jurisprudence have real life consequences!
Trump and Miller told the Supremes precisely what their invidious racist, religiously biased, politically pandering intent was in all of these cases and the GOP Justices ignored it in favor of bogus, fabricated, right wing, authoritarian, racist driven, anti-democracy agendas thinly camouflaged by legal gobbledygook.
People die and lives are ruined forever when judges who are supposed to protect them instead “take a dive” for the forces of tyranny and cruelty! “Dred Scottification” (“dehumanization”) of Blacks, Latinos, Immigrants, and other People of Color by our highest Court is neither acceptable nor should it be “swept under the rug” as has happened all too often when the Supremes fail democracy and align themselves with anti-democracy racists and authoritarians.
For four years, the GOP Justices on the Supremes have treated due process, democratic institutions, and the lives of asylum seekers and other migrants (and to some extent their pro bono lawyers) as “jokes.” That’s because 1) neither they nor their families are rotting in Mexico or facing torture and death in El Salvador or some other failed state; and 2) this time, the right wing thugs they enable were across the street trashing our Capitol rather than storming the Supremes. Better Justices and Better Federal Judges for a Better America!
The idea that Germany lost the First World War in 1918 because of a Jewish “stab in the back” was 15 years old when Hitler came to power. How will Trump’s myth of victimhood function in American life 15 years from now? And to whose benefit?
On Jan. 7, Trump called for a peaceful transition of power, implicitly conceding that his putsch had failed. Even then, though, he repeated and even amplified his electoral fiction: It was now a sacred cause for which people had sacrificed. Trump’s imagined stab in the back will live on chiefly thanks to its endorsement by members of Congress. In November and December 2020, Republicans repeated it, giving it a life it would not otherwise have had. In retrospect, it now seems as though the last shaky compromise between the gamers and the breakers was the idea that Trump should have every chance to prove that wrong had been done to him. That position implicitly endorsed the big lie for Trump supporters who were inclined to believe it. It failed to restrain Trump, whose big lie only grew bigger.
The breakers and the gamers then saw a different world ahead, where the big lie was either a treasure to be had or a danger to be avoided. The breakers had no choice but to rush to be first to claim to believe in it. Because the breakers Josh Hawley and Ted Cruz must compete to claim the brimstone and bile, the gamers were forced to reveal their own hand, and the division within the Republican coalition became visible on Jan. 6. The invasion of the Capitol only reinforced this division. To be sure, a few senators withdrew their objections, but Cruz and Hawley moved forward anyway, along with six other senators. More than 100 representatives doubled down on the big lie. Some, like Matt Gaetz, even added their own flourishes, such as the claim that the mob was led not by Trump’s supporters but by his opponents.
Trump is, for now, the martyr in chief, the high priest of the big lie. He is the leader of the breakers, at least in the minds of his supporters. By now, the gamers do not want Trump around. Discredited in his last weeks, he is useless; shorn of the obligations of the presidency, he will become embarrassing again, much as he was in 2015. Unable to provide cover for their gamesmanship, he will be irrelevant to their daily purposes. But the breakers have an even stronger reason to see Trump disappear: It is impossible to inherit from someone who is still around. Seizing Trump’s big lie might appear to be a gesture of support. In fact it expresses a wish for his political death. Transforming the myth from one about Trump to one about the nation will be easier when he is out of the way.
As Cruz and Hawley may learn, to tell the big lie is to be owned by it. Just because you have sold your soul does not mean that you have driven a hard bargain. Hawley shies from no level of hypocrisy; the son of a banker, educated at Stanford University and Yale Law School, he denounces elites. Insofar as Cruz was thought to have a principle, it was that of states’ rights, which Trump’s calls to action brazenly violated. A joint statement Cruz issued about the senators’ challenge to the vote nicely captured the post-truth aspect of the whole: It never alleged that there was fraud, only that there were allegations of fraud. Allegations of allegations, allegations all the way down.

The big lie requires commitment. When Republican gamers do not exhibit enough of that, Republican breakers call them “RINOs”: Republicans in name only. This term once suggested a lack of ideological commitment. It now means an unwillingness to throw away an election. The gamers, in response, close ranks around the Constitution and speak of principles and traditions. The breakers must all know (with the possible exception of the Alabama senator Tommy Tuberville) that they are participating in a sham, but they will have an audience of tens of millions who do not.
If Trump remains present in American political life, he will surely repeat his big lie incessantly. Hawley and Cruz and the other breakers share responsibility for where this leads. Cruz and Hawley seem to be running for president. Yet what does it mean to be a candidate for office and denounce voting? If you claim that the other side has cheated, and your supporters believe you, they will expect you to cheat yourself. By defending Trump’s big lie on Jan. 6, they set a precedent: A Republican presidential candidate who loses an election should be appointed anyway by Congress. Republicans in the future, at least breaker candidates for president, will presumably have a Plan A, to win and win, and a Plan B, to lose and win. No fraud is necessary; only allegations that there are allegations of fraud. Truth is to be replaced by spectacle, facts by faith.
Trump’s coup attempt of 2020-21, like other failed coup attempts, is a warning for those who care about the rule of law and a lesson for those who do not. His pre-fascism revealed a possibility for American politics. For a coup to work in 2024, the breakers will require something that Trump never quite had: an angry minority, organized for nationwide violence, ready to add intimidation to an election. Four years of amplifying a big lie just might get them this. To claim that the other side stole an election is to promise to steal one yourself. It is also to claim that the other side deserves to be punished.
Informed observers inside and outside government agree that right-wing white supremacism is the greatest terrorist threat to the United States. Gun sales in 2020 hit an astonishing high. History shows that political violence follows when prominent leaders of major political parties openly embrace paranoia.
Our big lie is typically American, wrapped in our odd electoral system, depending upon our particular traditions of racism. Yet our big lie is also structurally fascist, with its extreme mendacity, its conspiratorial thinking, its reversal of perpetrators and victims and its implication that the world is divided into us and them. To keep it going for four years courts terrorism and assassination.
When that violence comes, the breakers will have to react. If they embrace it, they become the fascist faction. The Republican Party will be divided, at least for a time. One can of course imagine a dismal reunification: A breaker candidate loses a narrow presidential election in November 2024 and cries fraud, the Republicans win both houses of Congress and rioters in the street, educated by four years of the big lie, demand what they see as justice. Would the gamers stand on principle if those were the circumstances of Jan. 6, 2025?
To be sure, this moment is also a chance. It is possible that a divided Republican Party might better serve American democracy; that the gamers, separated from the breakers, might start to think of policy as a way to win elections. It is very likely that the Biden-Harris administration will have an easier first few months than expected; perhaps obstructionism will give way, at least among a few Republicans and for a short time, to a moment of self-questioning. Politicians who want Trumpism to end have a simple way forward: Tell the truth about the election.
America will not survive the big lie just because a liar is separated from power. It will need a thoughtful repluralization of media and a commitment to facts as a public good. The racism structured into every aspect of the coup attempt is a call to heed our own history. Serious attention to the past helps us to see risks but also suggests future possibility. We cannot be a democratic republic if we tell lies about race, big or small. We cannot be a democratic republic if we tell lies about race, big or small. Democracy is not about minimizing the vote nor ignoring it, neither a matter of gaming nor of breaking a system, but of accepting the equality of others, heeding their voices and counting their votes.

Newsflash: It wasn’t the radical left that stormed the doors of the Capitol on Wednesday. It wasn’t the radical left that told a group of known white nationalists to “stand by” during a nationally televised presidential debate. It wasn’t the radical left that addressed the soon-to-be rioters and declared to members of Congress that “we’re coming for you.” It wasn’t the radical left who on the eve of the Capitol siege announced their plans to walk the path to sedition.
The only “radical” elements America sees now are the words and actions of the Republican Party. Yet Republicans have forever gotten away with throwing around the label “radical” to characterize the Democratic Party.
How many times in political ads have Republicans used the words “radical” and “dangerous” to describe their Democratic challengers? How many Fox News segments have Sean Hannity and friends devoted to the Democrats’ “radical extreme socialist agenda”?
What happened on Wednesday was an inevitable culmination of years of extreme and alarmist rhetoric from the Republican Party and their propaganda platforms. Watching Republicans act shocked that the people they have relentlessly and unapologetically pandered to for years is appalling.
With every tweet, every soundbite, every campaign ad, Republicans have been signaling to their supporters that it’s time to take matters in their hands. When you label something as “radical” or “extreme” or “dangerous,” you are telling people they need to defend themselves against a threat. You are telling them they need to be ready to fight. You are telling them their impulse to resort to violence and destruction is justified and righteous.
There is absolutely nothing radical or extreme about protesting racial inequality, social injustice and a culture of police brutality in America. There is nothing radical or extreme about speaking out for gender equality and women’s rights. There is nothing radical or extreme about advocating for universal healthcare coverage. There is nothing radical or extreme about supporting action to address the growing threat of climate change. There is nothing radical or extreme about wanting corporations to pay their fair share of taxes. There is nothing radical or extreme about embracing the need for gun reform in the wake of mass shootings. There is nothing radical or extreme about wearing a mask and social distancing amid a global pandemic that has taken the lives of more than 365,000 Americans.
The extremists are the ones who egged on the insurrectionists with four years of lies. Republicans may be abandoning the sinking Trump ship, but don’t let this 11th-hour maneuver fool you. That even after Wednesday’s events Republicans in Congress and in the media are still clinging to the “radical socialist agenda” narrative shows they haven’t changed — though they are scurrying to launder their tattered reputations.
Don’t believe me?
Just watch how many of them will vote to support articles of impeachment if the Democrats bring those to the House floor next week.

Democrat Jon Ossoff won his tight Senate race, with both Georgia Democrats defeating their Republican runoff opponents in historic victories for a stunning rebuke of President Donald Trump in a state that had been a Republican stronghold for years. With Ossoff joining Democrat Raphael Warnock in the Senate, their party will be able to take total control of Congress.
Warnock is the first Black person elected to represent Georgia in the Senate and will be one of only three Black people in the Senate once his term begins. Ossoff, 33, would be the youngest member of the Senate.
The results are a testament to the decades-long political organizing of Black women in Georgia who worked toward expanding the electorate and protecting voting rights in the state.
“It is with humility that I thank the people of Georgia for electing me to serve you in the United States Senate. Thank you for the trust that you have placed in me,” Ossoff said in a video streamed online on Wednesday morning. Hours before, the campaign of his opponent, Sen. David Perdue, said it “will require time and transparency to be certain the results are fair and accurate.”
It is a close race. Decision Desk HQ has projected Ossoff will win. The vote-counting firm currently has Ossoff leading Republican Perdue by about .4% of the vote — about 16,000 votes — which is within the .5% threshold that allows Perdue to call for a recount. Georgia officials will continue counting the few remaining votes today, which are expected in areas that lean Democrat.
Ossoff’s win would push the Senate into a 50-50 split, with Vice President-elect Kamala Harris serving as a tie-breaking vote. The split would effectively give Democrats control of the Senate, removing the chamber from Sen. Mitch McConnell’s iron grip and dramatically expanding the possibilities for President-elect Joe Biden’s first years in office.
A litany of Black women-led voter registration groups like Stacey Abrams’s New Georgia Project and Black Voters Matter fanned out across the state in recent years to register new voters and to protect voters from being purged from rolls. In the weeks ahead of the runoff, Progressive grassroots groups organizing across the state made the shift toward door knocking and in-person canvassing after the party largely avoided the strategy during the general election because of the coronavirus pandemic.
Trump, on the other hand, spent the intervening two months claiming Georgia’s election was rigged against him — it was not, as the state’s Republican elected leaders frequently reminded him — attacking establishment Republicans in the state, and undermining the Republican base’s faith in the electoral process, and pushing lawsuits that largely focused on invalidating votes in majority Black cities. Perdue and Loeffler, then both serving in the Senate, often echoed Trump’s false claims about election fraud on the campaign trail and in the final days of the race they announced that they would support Senators who objected to certifying the electoral college results.
The runoff was defined by Trump’s meddling in the state’s election results after his loss in November and his failed last-ditch attempt to get more direct aid to people in the coronavirus relief package that passed Congress in December.

This Court is now the fifth federal court to be asked to plow the same ground about Wolf’s authority vel non to change the immigration regulations. If the government had proffered new facts or law with respect to that question, or a hitherto unconsidered argument, this might have been a worthwhile exercise. It did not. The government has recycled exactly the same legal and factual claims made in the prior cases, as if they had not been soundly rejected in well-reasoned opinions by several courts. The government initially appealed two of these decisions, both of which it later voluntarily dismissed, and appears to have only one appeal pending. In the main, the government contents itself simply with saying the prior courts were wrong, with scant explanation. See, e.g., Pangea Dkt. No. 48 at ECF p. 11 (“the various courts that have embraced this argument are mistaken”); Immigration Equality Dkt. No. 37 at 14 (same).
This is a troubling litigation strategy. In effect, the government keeps crashing the same car into a gate, hoping that someday it might break through. To be sure, one court decision alone does not necessarily close the door to any further cases or arguments along similar lines. Our common law system contemplates that more than one judicial examination of facts and issues is often merited. But our system has no room for relitigating the same facts and law in successive district court cases ad infinitum. That is what the government is doing here. The Court took pains at oral argument to discuss this with counsel for the government, and specifically asked how their arguments here are in any way different from the ones made and rejected in the preceding cases.4 Counsel responded mainly with a disparaging comment to the effect that the other district courts had shirked from working their way through the record. That is untrue. Each of the prior decisions conducted a painstaking analysis of the facts with respect to the Acting Secretary

position at DHS, with full attention to the unprecedented efforts to validate Wolf’s claim to the job, irrespective of governing law and procedures.
A good argument might be made that, at this point in time, the government’s arguments lack a good-faith basis in law or fact. But the Court need not reach that conclusion to reject those arguments yet again. The Court’s independent review of the record indicates that Batalla Vidal, 2020 WL 6695076, which is the latest decision before this order, correctly identified and analyzed the salient points vitiating Wolf’s claim of rulemaking authority, and the Court agrees with it in full.

Wolf’s continuing impersonation of a Cabinet Officer and Barr’s knowingly illegal, ultra vires approval of clearly unlawfully promulgated regulations that actually threaten the lives of bona fide asylum seekers should be dealt with as criminal offenses after Jan. 20, 2021. This case also reinforces the absolute necessity of nationwide injunctive relief against Government abuses like this. The “solicitation” of cases challenging and improperly narrowing this necessary form of relief, a corrupt project of the Federalist Society and the former Solicitor General, should raise serious questions of the judicial qualifications of the two “GOP Justices” who recently engaged in this form of rancid, immoral, and legally defective political pandering in their “separate opinion.” Better Justices for a Better America!
What really held the American legal system together for the last four perilous years was the tenacity of lawyers, many of them arguing Immigration or human rights cases pro bono, and the legal scholarship and courage of some U.S. District Judges who stood tall even in the face of a spineless and complicit Supremes’ majority that all too often failed to support them and could barely move fast enough to give a patently lawless, corrupt, racist, treasonous, and clearly unqualified President and his neo-Nazi minions carte blanch to abuse humanity and “Dred Scottify” persons of color. Leadership, moral courage, and integrity count. But for Sotomayor, Kagan, Breyer, and the late RBG, the Supremes came up disastrously short of fulfilling their Constitutional rule in far, far too many cases, and innocent people suffered and died because of it. This is simply unacceptable in our highest level judges.
It’s high time for law schools to reexamine and beef up obviously inadequate ethical training, for a review of the failure of basic ethics throughout Government, and for review and reform of the scurrilous and unacceptable abdication of ethical norms and responsibilities by Federal Judges at every level of our floundering and failing Federal legal system. Yesterday was a deeply troubling day in one of the most challenging times in U.S. history. But make no mistake: We will get through this as a community.
Our nation saw an unprecedented and appalling assault on the rule of law and our deep and enduring democratic traditions. As Congress carried out its constitutional duty of accepting the certified results of the 2020 presidential election, a mob stormed our Capitol. Whatever our political views, we should all condemn such behavior. There is a stark difference between peaceful protest, which is constitutionally protected, and violence designed to undermine democratic processes.
As we process this traumatic challenge to our democracy, please take to heart the observations of Chancellor Gary S. May. He reminds us of something incredibly positive that greeted us all yesterday:

I awoke this morning . . . buoyed by the thoughtful reflection shared by newly elected Georgia Senator Raphael Warnock, who said that the hands of his 82-year-old mother that were once “used to pick somebody else’s cotton” were just used to vote for the first African American senator in the history of his state. I lived much of my adult life in the state of Georgia. . . . I have attended several services in Ebenezer Baptist Church, where he is pastor and Martin Luther King Jr. once was. I always enjoyed his sermons and was uplifted by the progress his story represented. . . .
There are other reasons for optimism. Our institutions are strong. Our commitment to the rule of law, which is more important now than ever, is unwavering. Although yesterday saw an unprecedented challenge to the rule of law, we also witnessed its triumph. After a violent mob stormed our Capitol, the rule of law prevailed. Following the process set forth in the Constitution, Congress accepted the results of the Electoral College. A new president and vice president will be inaugurated in a matter of days. These events demonstrate why the law and what lawyers do matter so much. Let us try to focus moving forward constructively and positively.
I am hopeful that we as a community can schedule a time to discuss the serious issues facing the nation. We will be in touch as plans develop. Please stay healthy and take good care.
For the women of the WNBA, the push to expel one of their league’s owners from office — and ultimately help tip the balance of the U.S. Senate — started with two words on a plain black T-shirt.
It was summer. Amid nationwide protests against racial injustice, Sen. Kelly Loeffler (R-Ga.), co-owner of the Atlanta Dream, had sent a letter to the league that denounced its support of the Black Lives Matter movement, parroting President Trump’s rhetoric as she fought to keep her seat.
Loeffler’s embrace of Trumpism had shocked those who had known her as an inclusive boss in a league dominated by Black women. But it appeared to be working: She was leading the crowded race, while one of her opponents, the Rev. Raphael Warnock (D), polled at only 9 percent.
Then WNBA players responded. They rejected Loeffler’s letter. And in early August, players from across the league, including those from her own team, wore shirts that read “VOTE WARNOCK.”

In the three days that followed, Warnock’s campaign raised more than $236,000 and added nearly 4,000 followers on Twitter. His support grew from there, catapulting him into a runoff with Loeffler. Jon Ossoff’s win in a race called Wednesday gave Democrats slim control over the Senate, with Vice President-elect Kamala D. Harris as the tiebreaking vote.
WNBA players, many of whom are overseas with international teams, spent Wednesday celebrating their assist — and wondering what it means for Loeffler’s future in the league.
“It’s a special moment for us because we’re constantly at the forefront of every issue, but we don’t get the respect we deserve,” said Washington Mystics guard Natasha Cloud, who opted out of this past season to focus on social justice causes. “Whether it’s on the court or off the court in our influence. You have a moment like this where you can’t say we didn’t help determine the outcome.”

At some point on Wednesday, someone clearly told Donald Trump that he needed to act “presidential” or at least give himself some plausible deniability re: inciting the violent mob that stormed Capitol Hill and where at least one person was killed. We know this because he appeared in a video telling his supporters to “go home” and tweeted something to a similar effect. And we know he didn’t mean a word of it, and was clearly loving the domestic terrorism occurring in his honor, because of everything else he said.
In the video, he continued to insist that he won the election and told the angry horde, like only a truly insane person can, “You’re very special” and “we love you.” That is not how a normal person tells a bloodthirsty mob to disperse. In a subsequent tweet, he wrote this historically crazy series of words, as though he was signing the yearbook of his favorite homegrown terrorist: “These are the things and events that happen when a sacred landslide election victory is so unceremoniously & viciously stripped away from great patriots who have been badly & unfairly treated for so long. Go home with love & in peace. Remember this day forever!”

No, no, he totally wants them to leave and definitely isn’t loving or encouraging any of this.

I mean, that’s true of Josh Hawley and Ted Cruz, too. Trump is something worse. He has proven himself to be a national security threat, the most serious one in Washington since the Royal Marines burned the place. He’s a traitor to his oath and to his country. He needs to be forced out, either through the provisions of the 25th Amendment or through an accelerated impeachment process. He is responsible for all of it. He is responsible for the assault on the Capitol and for the incredibly lax response from the Capitol Police.
