As we recognize the 100th anniversary of the “Tulsa Atrocity” and our failure to properly acknowledge it, teach it, condemn the failures of our legal system, and/or hold the perpetrators accountable, this is a course that every American should view!

Dehumanization of “the other,” grotesque minimization and distortion of their achievements and key contributions to our nation’s prosperity and survival, and legal systems that knowingly and intentionally denied legal, constitutional, and human rights to our fellow Americans are a long and dishonorable part of our history, often denied or intentionally whitewashed by those who fear truth. The long struggle against “America’s original sin” involved fierce resistance by African American slaves as well as concerted cooperative efforts between free African Americans and White opponents of slavery. But, there were also tensions, squabbles, false starts, petty “turf wars,” and fundamental disagreements among slavery’s opponents. Shockingly, but not surprisingly, many slaves found that suicide was their only effective form of protest against, and escape from, this vilest of all American institutions. 

The struggle against slavery’s toxic legacy and its existence in various forms in modern America continues. And, there is a direct connection with America’s continuing mistreatment of immigrants, particularly people of color and asylum seekers, and the failure of our legal system, even today, to protect them rather than abuse and dehumanize them. 

The ongoing struggle is reflected in the Biden Administration’s apparent naive belief that they can effectively address racial injustice in America while continuing to treat asylum seeking migrants, many women, children, and people of color, as “non-persons” or “less than human” under our Constitution and laws. Ending “Dred Scottification of the other” — in all its forms  — is key to America’s getting beyond the mistakes, tragedies, and injustices of our past and creating a better future for all persons in America!

I personally don’t make much of Scott’s ability to reason. This is the same man who said in March that “woke supremacy,” whatever that is, “is as bad as white supremacy.” There is no world in which recent efforts at enlightenment can be equated to enslavement, lynching and mass incarceration. It seems to me that the disingenuousness on the question of racism is largely a question of language. The question turns on another question: “What, to you, is America?” Is America the people who now inhabit the land, divorced from its systems and its history? Or, is the meaning of America inclusive of those systems and history?

When people say that America is a racist country, they don’t necessarily mean that all or even most Americans are consciously racist. However, it is important to remember that nearly half the country just voted for a full-on racist in Donald Trump, and they did so by either denying his racism, becoming apologists for it, or applauding it. What do you call a country thus composed?

Historically, however, there is no question that the country was founded by racists and white supremacists, and that much of the early wealth of this country was built on the backs of enslaved Africans, and much of the early expansion came at the expense of the massacre of the land’s Indigenous people and broken treaties with them.

Eight of the first 10 presidents personally enslaved Africans. In 1856, the chief justice of the United States wrote in the infamous ruling on the Dred Scott case that Black people “had for more than a century before been regarded as beings of an inferior order, and altogether unfit to associate with the white race, either in social or political relations; and so far inferior, that they had no rights which the white man was bound to respect.”

The country went on to fight a Civil War over whether some states could maintain slavery as they wished. Even some of the people arguing for, and fighting for, an end to slavery had expressed their white supremacist beliefs.

Abraham Lincoln said during his famous debates against Stephen A. Douglas in 1858 that among white people and Black ones “there must be the position of superior and inferior, and I, as much as any other man, am in favor of the superior position being assigned to the white man.”

Some will concede the historical point and insist on the progress point, arguing that was then and this is now, that racism simply doesn’t exist now as it did then. I would agree. American racism has evolved and become less blunt, but it has not become less effective. The knife has simply been sharpened. Now systems do the work that once required the overt actions of masses of individual racists.

As Mark Twain once put it: “The difference between the almost right word and the right word is really a large matter. ’Tis the difference between the lightning bug and the lightning.”

Being imprecise or undecided with our language on this subject contributes to the murkiness — and to the myth that the question of whether America is racist is difficult to answer and therefore the subject of genuine debate among honest intellectuals.

Saying that America is racist is not a radical statement. If that requires a longer explanation or definition, so be it. The fact, in the end, is not altered.

  • The “history” that most of us in my generation learned in high school was “whitewashed;”
  • The monumental achievements of non-white Americans, women, and children which allowed this country to exist, prosper, and flourish have consistently been ignored or downplayed;

The Republican Party’s biggest problem is that too many people of color are exercising their right to vote. The party’s solution is a massive push for voter suppression that would make old-time Jim Crow segregationists proud.

The Conservative Political Action Conference circus last week in Orlando showed how bankrupt the GOP is — at least when it comes to ideas, principles and integrity. Some might argue that the party, in buying into the lie that last year’s election was somehow stolen, is simply delusional. I disagree. I think Republican leaders know exactly what they’re doing.

The GOP may have lost the White House and the Senate, but it remains strong in most state capitols. So far this year, according to the Brennan Center for Justice, Republicans in 33 states “have introduced, prefiled, or carried over 165 bills to restrict voting access.” The thrust of virtually all these measures is to make it more difficult for African Americans and other minorities to vote.

These efforts at disenfranchisement are more numerous, and more discriminatory, in several of the swing states President Biden carried narrowly: Arizona, Pennsylvania and Georgia. That should come as no surprise. GOP officials who had the temerity to follow the law and count the November vote honestly, such as Georgia Secretary of State Brad Raffensperger, have been all but excommunicated by their state Republican Party organizations.

In Georgia — where not only did Donald Trump lose to Biden by 11,779 votes, but also two incumbent GOP senators were defeated by Democratic challengers — Republicans are using their control of the statehouse to try to eliminate all early voting on Sundays. That would put an end to “Souls to the Polls,” a popular Sunday get-out-the-vote initiative in which Black churches help parishioners get to polling places and cast their ballots.

After a Presidential election that they lost by a substantial majority of votes, the GOP has decided that the solution isn’t to improve on their party’s unpopular messages of shame, blame, intolerance, ignorance, and White privilege. Nor have they chosen to abandon their corrupt and divisive leader. No, the answer, according to the GOP, is to reduce the size of the electorate to keep the will of the majority from prevailing. 

There is not a whit of evidence about widespread voter fraud or any credible reason to believe that the results don’t represent the will of the majority of American voters. Nevertheless, the GOP has introduced slews of bills at the state level to make it more difficult for African Americans, Latinos, and other minorities to vote. Just like the White southern aristocracy after the Civil War, the modern GOP fears that true democratic majority rule will deprive them of their minority power and privilege.

Well, you’ve heard it all before on Courtside. The Voting Rights Act is the cornerstone of modern American democracy. The forces of anti-democracy, including the GOP and their Supremes’ majority, intend to undo it in the name of White Supremacy.

The overt suppression of African-American voting rights that ended Reconstruction ushered in more than four decades of gross violations of the 13th 14th, and 15th Amendments. We should remember that the White-dominated Federal Government and the Federal Courts basically took a cowardly pass on the rights of our African American fellow citizens for generations. 

Eric Lutz summed it up in his recent article on Vanity Fair:

Biden is reluctant to end that filibuster. But at a certain point, failing to do so means failing to reckon with the the severity of the threat to democracy—and the particular peril the GOP’s attacks pose to the rights of Black Americans and other minorities. “The argument that preserving the filibuster is necessary because it’s an important tool in our Democracy falls apart when it’s clearer with every passing day that we won’t have a Democracy without Congress passing voting rights legislation,” the former Obama aide David Plouffe remarked Monday. Republicans are mounting a concerted, relentless attack on democracy. To defend against it, Democrats’ response must be proportional. And that means confronting the reality that Trump leaving office didn’t extinguish his Big Lie, but made it more powerful.

It’s essential that the majority of us unite against the attempt of the corrupt GOP to restore the horrors of White Supremacy and Jim Crow. And, make no mistake — the attack on asylum seekers and migrants of color is an integral part of the White Nationalist program to kneecap American democracy. Under Trump, that effort culminated in the Capitol insurrection. 

As the death of civil rights icon Vernon Jordon this week reminds us, those of us who believe in democracy must unite to fight the right and protect the right of all Americans to vote and the rights of immigrants to be treated as “persons” under the law.

Make no mistake: Democracy may have survived this year, but President Biden and Vice President Harris were elected despite, not thanks to, weakened electoral systems. Together with the Democratic Congress, they now have the opportunity to implement reforms that reaffirm our nation’s promises that our country represents and works for everyone. We as Democrats must act before it is too late.

Our democratic system faces extraordinary threats today because of sustained attacks from Republican leaders who throw up roadblocks to voting and, among the worst actors, stoke the flames of white supremacy and hyper-nationalism to cling to power. There can be no clearer example than the covid-19 pandemic. The deaths of more than 450,000 people in the richest country in the world are symptomatic of a democracy in crisis and a political system that rewards cronyism over competence. Despite strong public support for the Centers for Disease Control’s work, the Affordable Care Act, and other economic justice and safety-net policies that could save lives, millions nevertheless continue to contract the disease without adequate access to health care.

No thinking person can deny that the communities of color disproportionately suffering and dying from this pandemic are also the people whose votes — and ability to hold failed leaders accountable — have been continuously suppressed.

The pandemic has been a collision of tragedy and corroded institutions, and the challenge is in how we respond. We can either engage in collective amnesia about what we have just lived through, and leave an unaccountable government in place, or we can rise to meet this moment by fixing the broken social compact. Defeating Trump was not enough. Meaningful progress on health care, racial justice and the economy requires aggressive action on voting rights, partisan gerrymandering and campaign finance.

One of the first steps must be an overhaul of the Senate filibuster, which has long been wielded as a cudgel against the needs of millions who struggle. Today, the parliamentary trick creates a more sinister threat to our nation: the ability of a minority of senators, who represent 41.5 million fewer people than the Senate majority, to block progress favored by most Americans.

Democrats in Congress must fully embrace their mandate to fast-track democracy reforms that give voters a fair fight, rather than allowing undemocratic systems to be used as tools and excuses to perpetuate that same system. This is a moment of both historic imperative and, with unified Democratic control of the White House and Congress, historic opportunity.

The agenda to restore democracy also includes passing the For the People Act to protect and expand voting rights, fight gerrymandering and reduce the influence of money in politics; the John Lewis Voting Rights Advancement Act to restore the full protections of the 1965 Voting Rights Act; and the Protecting Our Democracy Act to constrain the corruption of future presidents who deem themselves above the law. These landmark bills have broad-based support, and would have passed long ago were it not for obstructionist leaders who fear losing their own influence if the American people have more power of their own.

The Trump GOP lies, insurrections, and blatantly false claims attempting to undermine the very clear Biden-Harris victory have been a smokescreen for the real voting problems — the unrelenting efforts of the GOP — “The Party of the New Jim Crow” — to suppress the votes of Americans of color. And, as Abrams cogently points out, one reason for the denial, downplaying, and maliciously incompetent mishandling of the pandemic by the Trump regime was that so many of the victims were among communities of color — those they never cared about and whose humanity they continuously tried to deny and disparage. Death is a great way of disenfranchising minority voters. Not to mention a little fear and intimidation thrown in for a good measure.

There is a very clear connection between the dehumanization of asylum seekers and other migrants and the disenfranchisement of voters of color. It’s all part of “Dred Scottification” — a disgraceful practice sanctioned by none other than the GOP’s Supremes’ majority!

Our future as a nation depends on Judge Garland, Vanita Gupta, and their incoming team at DOJ “connecting the dots” — beginning with dismantling and replacing the White Nationalist nativist kakistocracy at EOIR. Immigrants’ rights are civil rights are human rights! The GOP actually “gets” that (in a purely negative way)! Will the Dems finally show that they do too!

John Reeves reviews Ty Seidule’s “Robert E. Lee & Me” in WashPost:

January 1872, Jubal Early, a former Confederate corps commander, delivered an address at Washington and Lee University in Lexington, Va., to honor Robert E. Lee, who had recently died. Believing that Lee was one of the finest military leaders in history, Early declared, “Our beloved Chief stands, like some lofty column which rears its head among the highest, in grandeur, simple, pure and sublime, needing no borrowed lustre; and he is all our own.” In subsequent years, Early and several elite ex-officers would deify Lee while creating the Lost Cause interpretation of the Civil War. According to that view, the war wasn’t about slavery but rather states’ rights. And the North won only because of its superior resources. An additional tenet is that Lee was the greatest soldier in the war on either side.

At the same time the Lee myth was being created, former rebels began reinforcing white supremacy all across the South. In Walton County, a rural community in Georgia, the Ku Klux Klan terrorized freedmen after the war. In 1871, Jake Daniels, an African American blacksmith from the county, was killed by 20 disguised men after refusing to repair a buggy for a White man, who still owed him money from previous jobs. The Klansmen showed up at Daniels’s door in the middle of the night. Daniels went outside but quickly recognized the danger. He tried to reenter his house but was shot in the back of the head. The men then shot him five or six more times before leaving the scene.

This type of violence was not uncommon in the South in the 19th and 20th centuries. In Georgia alone, 589 people were lynched between 1877 and 1950. As Ty Seidule writes in his powerful new book, “Robert E. Lee and Me,” “If Lee and Confederate worship created one side of the white supremacy coin, violent terror to enforce racial domination provided the other side.”

Seidule tells the story of his transformation from a believer in the Lost Cause to a critic. Growing up in Virginia and Georgia, he worshiped Lee. It was only later, as the head of the history department at the U.S. Military Academy, that he discovered the truth about Confederate myths. Seidule writes: “I grew up with a lie, a series of lies. Now, as a historian and a retired U.S. Army officer, I must do my best to tell the truth about the Civil War, and the best way to do that is to show my own dangerous history.”

Seidule has written a vital account of the destructiveness of the Lost Cause ideology throughout American history. He shows how films, textbooks and memorials promoted white supremacy by glorifying traitors and enslavers like Lee and other Confederate leaders. Perhaps the best attribute of this fine book is the author’s honesty. When talking of his personal metamorphosis, he vows to “quit hiding behind the impartial, know-it-all historian and open up about the southerner, the boy who grew up on Lee idolatry, and the man who wrapped his identity around the heroes of the Confederacy. Be honest. Be vulnerable. Above all, tell the truth.”

It’s never too late for the truth. 

Lots of White folks still have the audacity to be upset and offended because “their” factionalized account of U.S. history — one that even those of us who grew up in the North were fed to a large extent — is (finally and incrementally) being replaced with a more accurate accounting of the truth, unhappy as facing it sometimes can be. 

“Their” myths and false narratives are more important than the many African-American lives and futures snuffed out by racism. Shows that BLM has it right — the myths and fabricated visions of the past so integral to the White self-esteem of many are more important than the lives and futures of African-Americans snuffed out by institutionalized racism, much of it perpetrated by our Government and our legal system.

A frank accounting of our past, the good, the bad, and the ugly, is a necessary step to our moving forward as a nation.

President-elect Joe Biden will roll out a sweeping overhaul of nation’s immigration laws the day he is inaugurated, including an eight-year pathway to citizenship for immigrants without legal status and an expansion of refugee admissions, along with an enforcement plan that deploys technology to patrol the border.

Biden’s legislative proposal, which will be sent to Congress on Wednesday, also includes a heavy focus on addressing the root causes of migration from Central America, a key part of Biden’s foreign policy portfolio when he served as vice president.

The centerpiece of the plan from Biden and Vice President-elect Kamala D. Harris is the eight-year pathway, which would put millions of qualifying immigrants in a temporary status for five years and then grant them a green card once they meet certain requirements such as a background check and payment of taxes. They would be able to apply for citizenship three years later.

The focus on Central America reflects the message that Biden has relayed to senior officials in the region: that he will advocate for policy changes aimed at what drives scores of migrants there to come to the United States illegally to seek safe harbor.

“Ultimately, you cannot solve problems of migration unless you attack the root causes of what causes that migration,” one official said, pointing to the various reasons — from economic to safety — that drive migrants to flee their home countries. “He knows that in particular is the case in Central America.”

Transition officials are aware of recent reports of the increased numbers of migrants at or heading to the border in anticipation of the end of Trump’s presidency, and urged them to stay in their home countries. They emphasized that newly arriving immigrants would not qualify for the legalization program that Biden proposes.

Biden wants to move the refugee and asylum systems “back to a more humane and orderly process,” the official said. But “it’s also been made clear that that isn’t a switch you flip overnight from the 19th to the 20th, especially when you’re working with agencies and processes that have been so gutted by the previous administration.”

Biden hopes to reinstate a program granting minors from Central America temporary legal residence in the United States. The Trump administration terminated the program in August 2017, officials said. The administration also wants to set up a reunification program for Central American relatives of U.S. citizens that would allow those who have been already approved for U.S. residency to be admitted into the country, rather than waiting at home for an opening. The program would be similar to ones that existed for Cubans and Haitians but also were ended by the Trump administration.

The Biden proposal also would put in place a refugee admissions program at multiple processing centers abroad that would better help identify and screen those who would qualify to be admitted as refugees into the United States.

As for border enforcement, the plan calls on the Department of Homeland Security to develop a proposal that uses technology and other similar infrastructure to implement new security measures along the border, both at and between ports of entry. Biden has long vowed not to expand the border wall Trump has marginally extended.

“This is not a wall; this is not taking money from [the Department of Defense],” a transition official said, referring to how Trump helped to finance his wall after pledging Mexico would pay for it. “It’s a very different approach.”

This is a welcome change from the poorly conceived, often ill-informed approach to immigration by the Obama Administration. It appears that Biden and Harris have actually “listened to the experts” and acted a accordingly.

The concentration on addressing the reality of Central American migration and dealing honestly and constructively with its root causes in a sensible and humane way is also refreshing. Using intelligence and technology to address real border security issues (as opposed to squandering resources on politically manufactured ones) also shows promise.

NBC star reporter Julia Edwards Ainsley just broke a story on how under the Trump regime, DHS wasted lots of time and money “beating up on” and denying the legal rights of migrants and asylum seekers and ripping apart families while ignoring or mishandling the real threats to our national security presented by right wing domestic terrorists. https://www.nbcnews.com/politics/national-security/capitol-riot-exposed-flaws-trump-s-dhs-focused-immigration-not-n1254464

Many of the latter were  energized by the Trump/DHS program of White Nationalist racist fear-mongering and intentionally false anti-immigrant, anti-due-process narratives. That’s what “applied malicious incompetence” looks like — DHS and EOIR are two of the most egregious examples in a regime that raised it to an “art form.” It will take an aggressive and far-reaching “house cleaning” to get these agencies that have abandoned the common good and now operate “on the dark side” back on track.

The immediate “knee-jerk opposition” to rational, practical, fact-based immigration reform by notorious White Nationalist racist Sen. Tom Cotton (R-ARK) shows that Team Biden is on the right track to disavow the toxic institutionalized racism and biased policies of the Trump regime and move America along the path to racial justice and realistic, progressive immigration policies that will further the national interest and lead to a better future for all!

It’s a great, if long overdue, start to getting beyond Jim Crow and “Dred Scottification” and saving and enhancing our democracy! But, the proof will be in the results!

Biden, of course, will also face the formidable challenges of dealing with the human carnage left behind by the Trump regime’s disastrous mis-handling of COVID-19, economic inequality, the environment, racial justice, and foreign policy where American “prestige” has plummeted to levels not seen since the days of the Barbary Pirates.

He also must address a failing Federal Justice System that, particularly at its appellate levels, did not effectively stand up to the Trump regime’s  unrelenting assault on human decency and American democracy. Indeed, Justice Sonia Sotomayor, a consistently competent and courageous Justice among our failing Supremes, offered this final harsh but true assessment of her GOP colleagues’ malfeasance in a death penalty case: “This is not justice.”https://www.nbcnews.com/news/latino/not-justice-justice-sonia-sotomayor-offers-fierce-dissent-death-penalty-n1254554

You could say that about almost everything in the departing, defeated White Nationalist regime!

I’ll note for the record that among other things, the Supremes’ tone-deaf majority has been responsible for letting bona fide asylum seekers rot in squalor in camps in Mexico while waiting for non-existent “due process,” and also authorized the imposition of potential death sentences and torture on asylum seekers within our jurisdiction without any whit of due process.

The GOP majority’s disgraceful failure to stand up for voting rights of African Americans, Latinos, and other voters of color has also deepened racial injustice in America and helped usher in a horrible “Jim Crow Revival” pushed, incited, and enabled by the GOP, “The Party of the Failed Insurrection.”

Any competent first-year law student might ask “How could this happen in America?” That’s a question that Roberts and his gang of fellow Trump enablers and apologists will have to answer before the “court of history!”

WASHINGTON, D.C. – Senator Jeff Merkley of Oregon has called for the investigation and prosecution of current and former Trump administration officials after the Department of Justice Office of the Inspector General released “a disturbing report confirming that the Trump administration knew their zero tolerance policy would lead to family separations,” the Oregon Democrat said in a statement.

“We finally have more answers about how this diabolical plan came to be,” Merkley said. “It is crystal clear that Jeff Sessions, Stephen Miller, Chad Wolf, Kirstjen Nielsen and other senior Trump administration officials were not only fully aware that their policy would have traumatizing impacts on families, but also that their intention was to inflict that trauma as a means to deter people from coming to America in search of a better life.”

The senator added “it’s now confirmed that they committed perjury by lying to Congress about their intentions and actions in order to avoid accountability for their monstrous initiative.”

In June 2018, Merkley traveled to Texas and attempted to enter a child detention center in a former Walmart, calling attention to the practice of separating and detaining children apart from their families.

“The intentional infliction of harm on innocent children is unforgivable and has no place on our soil,” Merkley said Thursday. “The architects should be investigated and prosecuted to the full extent of the law for any crimes connected with both the atrocities and the cover-up.”

Merkley returned to the border 6 more times and advocated for families to be reunited – and for people seeking refuge “from gang violence, murder, rape, and extortion in their home countries” be allowed to make their case – something the senator alleges the Trump adminitration has not allowed in keeping with the law.

“America is at its strongest when we embrace our historic role as a beacon of hope for persecuted people from around the world,” Merkley said. “I am determined to work with the Biden administration to ensure that we turn that vision into a reality, and to hold the perpetrators of the Trump administration’s cruelty fully accountable.”

Also, Judge Garland needs to look into the conduct of the DOJ lawyers who defended the regime’s transparent lies and false claims that there was “no child separation policy.” These turkeys 🦃  took no responsibility for their clients’ ongoing crimes and cover ups. Indeed, outrageously, they got away with making it the burden of the plaintiffs’ lawyers to reunite families the Government intentionally and illegally separated without any plans for reunification.

The invidious racist, unconstitutional motives of criminals like Trump, Miller, Sessions, Hamilton, and Rosenstein was no secret. Except for the degree of Rosenstein’s involvement, it was widely reported at the time. Trump was a well-established liar whose public statements and rationales should have been assumed false until proven true. (Ask yourself what would happen to a corporate lawyer who took at face value and presented to a court as “facts” or a “defense” in a civil suit false statements by a corrupt CEO with a long-standing record of fraud, racism, and dishonesty.)

Also, what was the a racist hack like Sessions (the report also reveals that he was as totally incompetent as a lawyer as he was devoid of human decency) doing running border enforcement programs that had intentionally been removed from the AG’s portfolio by Congress when DHS was created? How does that fit with “Gonzo’s” transparently unethical and unconstitutional actions as a “quasi-judicial officer” in interfering with due process at the EOIR Clown Show🤡/Star Chamber🦹🏿‍♂️?

This IG report is just the “tip of the iceberg” of the institutionalized racism and systemic misconduct that polluted the immigration kakistocracy at DOJ and DHS during the Trump regime. The failings of the U.S. Justice system from top to bottom, starting with the Supremes’  consistent failure to critically examine the regime’s transparent pattern of unconstitutional, racist, biased behavior culminating  in an insurrection can’t be “swept under the carpet.”

Nor can their enabling of the White Nationalist immigration agenda of “Dred Scottification” pushed by unethical SG Noel Francisco! In a well-functioning democracy, the Trumpist thugs’ child abuse should have been stopped in its tracks. Thanks to the failure of legal, ethical, and moral leadership by Roberts and his righty GOP buddies, it wasn’t!

The entire beyond disgraceful and patently illegal “zero tolerance program” instituted by Gonzo was a grotesque misuse of public funds and abuse of prosecutorial discretion. Real crimes (the Trump regime has been an absolute boon to serious criminals from the Oval Office on down) went un-prosecuted and un-investigated. The conduct of U.S. Attorneys, Federal Judges, and U.S. Magistrate Judges along the border who shirked their duties and participated in the legal farce taking place in our criminal justice system also needs to be examined.

Those of us who lived through Watergate can see that this time around, under extraordinarily poor leadership generated by an anti-American GOP, the response of all three branches of our Federal Government to the overt threats to our Constitution and democracy posed by a dishonest Executive fell disturbingly below the bipartisan levels that saved our nation from Nixon.

That’s why the critical democratic standard of a “peaceful and orderly transfer of power” has fallen by the wayside and the Biden-Harris Inauguration will take place in an armed camp. Ironically, the man administering the oath to President Biden, Chief Justice John Roberts and his GOP colleagues on the Supremes bear a major responsibility for democracy’s peril and the pain and suffering of those like separated families whom they failed to protect from Executive abuses!

As I’ve said before, although it won’t happen, the resignations of Roberts and his fellow GOP Justices should be on President Biden’s desk on the morning of January 21. That would be a real start on healing, restoring democracy, and reinstituting human decency and respect for human lives and the rule of law in America.

(Let’s not forget that ethics-challenged Justices Thomas and Coney Barrett showed up at what essentially was a “MAGA campaign rally” at the White House on the eve of the election that eventually resulted in impeachable acts of insurrection and sedition by a patently dishonest and dangerous Chief Executive whose unfitness to govern was more than clear by that time. Honestly, it’s going to take more than a black robe to cover the shame of these dudes who stand for protecting and enabling tyranny and against justice for the people. If nothing else, it’s high time for a Democrat-led Congress to impose at least some minimal ethical standards on the Supremes, since they appear to have none to mention. That’s, of course, after they come to grips with the treason of GOP guys like Cruz and Hawley who should be expelled and barred from public “service” (treason?) for life.)

  The lie outlasts the liar. 

The idea that Germany lost the First World War in 1918 because of a Jewish “stab in the back” was 15 years old when Hitler came to power. How will Trump’s myth of victimhood function in American life 15 years from now? And to whose benefit?

On Jan. 7, Trump called for a peaceful transition of power, implicitly conceding that his putsch had failed. Even then, though, he repeated and even amplified his electoral fiction: It was now a sacred cause for which people had sacrificed. Trump’s imagined stab in the back will live on chiefly thanks to its endorsement by members of Congress. In November and December 2020, Republicans repeated it, giving it a life it would not otherwise have had. In retrospect, it now seems as though the last shaky compromise between the gamers and the breakers was the idea that Trump should have every chance to prove that wrong had been done to him. That position implicitly endorsed the big lie for Trump supporters who were inclined to believe it. It failed to restrain Trump, whose big lie only grew bigger.

The breakers and the gamers then saw a different world ahead, where the big lie was either a treasure to be had or a danger to be avoided. The breakers had no choice but to rush to be first to claim to believe in it. Because the breakers Josh Hawley and Ted Cruz must compete to claim the brimstone and bile, the gamers were forced to reveal their own hand, and the division within the Republican coalition became visible on Jan. 6. The invasion of the Capitol only reinforced this division. To be sure, a few senators withdrew their objections, but Cruz and Hawley moved forward anyway, along with six other senators. More than 100 representatives doubled down on the big lie. Some, like Matt Gaetz, even added their own flourishes, such as the claim that the mob was led not by Trump’s supporters but by his opponents.

Trump is, for now, the martyr in chief, the high priest of the big lie. He is the leader of the breakers, at least in the minds of his supporters. By now, the gamers do not want Trump around. Discredited in his last weeks, he is useless; shorn of the obligations of the presidency, he will become embarrassing again, much as he was in 2015. Unable to provide cover for their gamesmanship, he will be irrelevant to their daily purposes. But the breakers have an even stronger reason to see Trump disappear: It is impossible to inherit from someone who is still around. Seizing Trump’s big lie might appear to be a gesture of support. In fact it expresses a wish for his political death. Transforming the myth from one about Trump to one about the nation will be easier when he is out of the way.

As Cruz and Hawley may learn, to tell the big lie is to be owned by it. Just because you have sold your soul does not mean that you have driven a hard bargain. Hawley shies from no level of hypocrisy; the son of a banker, educated at Stanford University and Yale Law School, he denounces elites. Insofar as Cruz was thought to have a principle, it was that of states’ rights, which Trump’s calls to action brazenly violated. A joint statement Cruz issued about the senators’ challenge to the vote nicely captured the post-truth aspect of the whole: It never alleged that there was fraud, only that there were allegations of fraud. Allegations of allegations, allegations all the way down.

The big lie requires commitment. When Republican gamers do not exhibit enough of that, Republican breakers call them “RINOs”: Republicans in name only. This term once suggested a lack of ideological commitment. It now means an unwillingness to throw away an election. The gamers, in response, close ranks around the Constitution and speak of principles and traditions. The breakers must all know (with the possible exception of the Alabama senator Tommy Tuberville) that they are participating in a sham, but they will have an audience of tens of millions who do not.

If Trump remains present in American political life, he will surely repeat his big lie incessantly. Hawley and Cruz and the other breakers share responsibility for where this leads. Cruz and Hawley seem to be running for president. Yet what does it mean to be a candidate for office and denounce voting? If you claim that the other side has cheated, and your supporters believe you, they will expect you to cheat yourself. By defending Trump’s big lie on Jan. 6, they set a precedent: A Republican presidential candidate who loses an election should be appointed anyway by Congress. Republicans in the future, at least breaker candidates for president, will presumably have a Plan A, to win and win, and a Plan B, to lose and win. No fraud is necessary; only allegations that there are allegations of fraud. Truth is to be replaced by spectacle, facts by faith.

Trump’s coup attempt of 2020-21, like other failed coup attempts, is a warning for those who care about the rule of law and a lesson for those who do not. His pre-fascism revealed a possibility for American politics. For a coup to work in 2024, the breakers will require something that Trump never quite had: an angry minority, organized for nationwide violence, ready to add intimidation to an election. Four years of amplifying a big lie just might get them this. To claim that the other side stole an election is to promise to steal one yourself. It is also to claim that the other side deserves to be punished.

Informed observers inside and outside government agree that right-wing white supremacism is the greatest terrorist threat to the United States. Gun sales in 2020 hit an astonishing high. History shows that political violence follows when prominent leaders of major political parties openly embrace paranoia.

Our big lie is typically American, wrapped in our odd electoral system, depending upon our particular traditions of racism. Yet our big lie is also structurally fascist, with its extreme mendacity, its conspiratorial thinking, its reversal of perpetrators and victims and its implication that the world is divided into us and them. To keep it going for four years courts terrorism and assassination.

When that violence comes, the breakers will have to react. If they embrace it, they become the fascist faction. The Republican Party will be divided, at least for a time. One can of course imagine a dismal reunification: A breaker candidate loses a narrow presidential election in November 2024 and cries fraud, the Republicans win both houses of Congress and rioters in the street, educated by four years of the big lie, demand what they see as justice. Would the gamers stand on principle if those were the circumstances of Jan. 6, 2025?

To be sure, this moment is also a chance. It is possible that a divided Republican Party might better serve American democracy; that the gamers, separated from the breakers, might start to think of policy as a way to win elections. It is very likely that the Biden-Harris administration will have an easier first few months than expected; perhaps obstructionism will give way, at least among a few Republicans and for a short time, to a moment of self-questioning. Politicians who want Trumpism to end have a simple way forward: Tell the truth about the election.

America will not survive the big lie just because a liar is separated from power. It will need a thoughtful repluralization of media and a commitment to facts as a public good. The racism structured into every aspect of the coup attempt is a call to heed our own history. Serious attention to the past helps us to see risks but also suggests future possibility. We cannot be a democratic republic if we tell lies about race, big or small. We cannot be a democratic republic if we tell lies about race, big or small. Democracy is not about minimizing the vote nor ignoring it, neither a matter of gaming nor of breaking a system, but of accepting the equality of others, heeding their voices and counting their votes.

If we kick out the kakistocracy next week, we could put qualified “practical scholars” like Ingrid and others like her in charge and remake both DHS and the Immigration Courts to actually operate as required by Due Process while also fulfilling legitimate law-enforcement objectives. To state the obvious, neither of these objectives is being realized at present. It’s bad for America and for humanity.

For far too long, the wrong individuals, lacking the necessary expertise in immigration and human rights, and also lacking a firm commitment to equal justice under law, have been “in charge” of the Government’s immigration policy and legal apparatus and appointed to the Federal Courts, at all levels. That’s particularly true at the Supremes where only Justices Sotomayor and (some days) Kagan appear “up to the job.”  

We will never end institutionalized racism, achieve equal justice for all, and realize the true human and economic potential of America until we bring our broken immigration and refugee systems and our failing Federal Judicial System into line with our Constitutional and national values. That process must start, but certainly will not end, with this election!

WASHINGTON — President Donald Trump‘s senior adviser Stephen Miller has fleshed out plans to rev up Trump’s restrictive immigration agenda if he wins re-election next week, offering a stark contrast to the platform of Democratic nominee Joe Biden.

In a 30-minute phone interview Thursday with NBC News, Miller outlined four major priorities: limiting asylum grants, punishing and outlawing so-called sanctuary cities, expanding the so-called travel ban with tougher screening for visa applicants and slapping new limits on work visas.

The objective, he said, is “raising and enhancing the standard for entry” to the United States.

Some of the plans would require legislation. Others could be achieved through executive action, which the Trump administration has relied on heavily in the absence of a major immigration bill.

“In many cases, fixing these problems and restoring some semblance of sanity to our immigration programs does involve regulatory reform,” Miller said. “Congress has delegated a lot of authority. … And that underscores the depth of the choice facing the American people.”

Miller, who serves in a dual role as an adviser in the White House and to Trump’s re-election campaign, stressed that he was speaking about second-term priorities only in his capacity as campaign adviser.

Immigration has been overshadowed by surging coronavirus case numbers and an economy shattered by a nearly yearlong pandemic, but it was central to Trump’s rise to power in the Republican Party, and Miller has been a driving force for the administration’s often controversial policies to crack down on illegal migration and erect hurdles for aspiring legal immigrants.

Miller has spearheaded an immigration policy that critics describe as cruel, racist and antithetical to American values as a nation of immigrants. He scoffs at those claims, insisting that his only priority is to protect the safety and wages of Americans.

And he said he intends to stay on to see the agenda through in a second term if Trump is re-elected.

In the near term, Miller wouldn’t commit to lifting the freeze on new green cards and visas that’s set to expire at the end of the year, saying it would be “entirely contingent” on governmental analysis that factors in the state of the job market.

Asked whether he would support reinstating the controversial “zero tolerance” policy that led to families’ being separated, Miller said the Trump administration is “100 percent committed to a policy of family unity,” but he described the policy as one that would keep families together in immigration detention by changing what is known as the Flores settlement agreement.

Over the past year, the administration has sought to amend the Flores agreement, which says children can’t be held over 20 days in Immigration and Customs Enforcement detention. If it succeeds, immigrant families could be detained indefinitely as they await their day in immigration court.

On Trump’s watch, asylum grants have plummeted. Miller wants to keep it that way. He said a second-term Trump administration would seek to expand “burden-sharing” deals with Honduras, Guatemala and El Salvador that cut off pathways to the U.S. for asylum-seekers.

“The president would like to expand that to include the rest of the world,” Miller said. “And so if you create safe third partners in other continents and other countries and regions, then you have the ability to share the burden of asylum-seekers on a global basis.”

Truth is, Trump failed to pass any meaningful immigration legislation in four years, even when the GOP controlled all the political branches! In fact, Miller’s nativist legislative game-plan “poisoned the well” and was soundly defeated in both Houses of Congress! So, he intends to use Executive misrule, bureaucratic corruption, and a fascism-enabling, racially tone-deaf GOP Supremes’ majority to rule without Congress (as has been the case for the last four years.)

But make no mistake: the real “Reichsplan” here is directed at further institutionalizing racism, spreading hate, and targeting Americans of color. That’s what the regime’s “Dred Scottification” is really about. Reducing or eliminating YOUR Constitutional rights! Immigrants are the “usual suspects.” But, by no means will they be the only victims of Gruppenfuhrer Miller’s White Nationalist, racist, hate extravaganza.

America is immigration! It’s our past, present, and future! When we deny those truths, we deny ourselves and betray our own humanity!

Susan Church, an immigration attorney in Boston, ended the first week of the Trump administration arm in arm with protesters at Logan Airport, resisting an executive order banning travel from several predominantly Muslim countries. But what happened the next day, away from the public chants of “Let them stay!” was more typical of what the life of the former chair of the New England chapter of the American Immigration Lawyers Association (AILA) was to become under the Trump administration.

Church and an associate filed an emergency lawsuit to secure the release of immigrants from Customs and Border Protection (CBP) custody. “I got a federal judge on the phone, you know, on a Saturday night at eight o’clock.” The judge told Church to go to court immediately. An hour later, the attorneys were in court defending their clients.

“For me, that was the canary in the coal mine about what the rest of my four years under the Trump administration was going to be like,” Church said. “It’s just a nonstop series of emergency litigation filed to try to rescue one or 10 or 100 or 1,000 people, depending on which issue it is.” Eventually, the speed of the work, and the physical and mental exhaustion it triggered, landed Church in the hospital. “I thought I was having a heart attack,” she said.

Church stayed with the fight to reunite parents with their children. She described the process of taking affidavits from clients, which require she learn every harrowing detail of a client’s trauma. In one instance, CBP ripped away one woman’s eight-year-old daughter at the border. “She had to comb her daughter’s hair and change her daughter’s clothes and put her on a bus and say goodbye to her,” Church said through tears. The two were separated for nearly two months, even after the mother was released from detention.

Church was able to reunite her client with her child, but the episode—like many, many other cases—weighs heavy on her shoulders. “I don’t think I’ll ever be quite the same person that I was beforehand,” she said.

Four years into this migration crisis, there’s a parallel migration under way—of immigration lawyers out of the profession. Survey data and interviews the Prospect conducted with more than a dozen lawyers around the country reveal the physical, mental, and financial toll endured by members of the bar. Given the extreme violence, trauma, and inhumanity their clients often endure, immigration attorneys don’t like to talk about how it affects them. But secondary trauma also leaves a mark, making it impossible to continue for some attorneys. Although numerical data is limited, there is evidence that some attorneys are cutting back on some types of cases, such as deportation defense work, or even leaving immigration law altogether. Removal defense casework is one of the most time-intensive, emotional, and exigent parts of lawyers’ loads. It’s also where the administration has aimed much of its cruelest policymaking, severely limiting lawyers’ efficacy.

Under the Trump administration, immigration law has changed not only profoundly, but also so rapidly that it’s hard for immigration attorneys to keep up. Susan Church—and several other attorneys interviewed for this article—described combating Trump’s policies as a game of whack-a-mole.

Forget all the right wing BS and the “originalist hoax!” This is about “democracy (or the destruction thereof) in action.” 

Remember, all of these cosmic “immigration law changes” have taken place without a single piece of major legislation enacted by Congress! Indeed, the Trump regime’s ham-handed attempt to force it’s nativist agenda down the throats of the Congress as part of the “Dreamer fiasco” fell flat on its face in both Houses!  But, the Supremes have both encouraged and enabled Trump (actually notorious white supremacist Stephen Miller) to rewrite the law through. “Executive fiat.” Totally inappropriate, not to mention glaringly unconstitutional.

The Supremes’ majority has time and again improperly sided with the unethical, immoral, and Constitutionally bankrupt “Dred Scottification” of migrants, particularly asylum seekers. It’s not much different from what has happened to African Americans, Latinos, and other minorities following the Civil War. But, this is supposed to be the 21st Century where we have put “Jim Crow” behind us. Obviously, we haven’t!

Failing to protect “officers of the court” (lawyers) and their clients from a scheme of abuses heaped upon them by a corrupt, biased, out of control, overtly racist Executive and his sycophants is a gross dereliction of duty by the Supremes. It’s basically like allowing, and even encouraging, the badgering of a witness during trial! 

It’s painfully obvious that we have many of the wrong folks on the bench — from the Immigration Courts to the Supremes. Indeed, the nation and the world would be much better served if many more of those courageous lawyers who serve the immigrant community and human rights experts were on the Federal Bench at all levels. 

Trump, Roberts, and the GOP judicial misfits have also shown us first-hand the profiles of individuals who should not be serving in judicial positions. Let them litigate their “originalist,” “unitary Executive,” and other “far out” righty philosophies as lawyers appearing before real judges —“practical scholars” who live in the 21st Century and are committed to problem solving rather than problem creating. As Joe Biden has noted, the entire judicial selection system and particularly the Supremes need a thoughtful re-examination and reform. 

Never again should we have Justices like Amy Coney Barrett and Clarence Thomas performing highly inappropriate and unethical televised “campaign stunts” for an incumbent President during an ongoing election. Geez! What kind of “impartial jurists” are they? 

Most first year law students could tell you that’s a “no-go!” Why have we “normalized” and “accepted” such obvious bias, misbehavior, and lack of sound judgment at the highest levels of our (not Trump’s or Mitch’s personal) Judiciary?

It’s not “Rocket Science!” The fundamental building blocks of our society are immigration, human rights, and equal justice! Any lawyer who who doesn’t embody those virtues and doesn’t publicly embrace them should not in the future be given a lifetime appointment as a Federal Judge — at any level!

We need better judges for a better America! We will never achieve constitutionally-required “equal justice for all” for African Americans, Latinos, or anyone else, nor can we reach our diverse nation’s full potential, if we don’t start “pushing back” against Roberts and the GOP’s right wing judicial oligarchy, their obtuse legal gibberish, and their anti-democratic “jurisprudence.”

It starts with voting to take back our country from the far right. But, that’s just the beginning of the changes needed if equal justice for all is to become a reality, rather than an ever unfulfilled promise, limited to certain privileged (predominantly White) groups within our society!

And, all of society owes a debt of gratitude to Ms. Church and other brave lawyers like her who represent the best our country has to offer and have actually suffered for standing up for the rule of law and the legal and human rights of the most vulnerable among us. In other words, standing up for all of our rights against a tyranny! 

Compare that with the utterly dismal composition of the “Trump kakistocracy” and its “Dred Scottification” of “the other.”

Donald Trump’s re-election campaign poses the greatest threat to American democracy since World War II.

Mr. Trump’s ruinous tenure already has gravely damaged the United States at home and around the world. He has abused the power of his office and denied the legitimacy of his political opponents, shattering the norms that have bound the nation together for generations. He has subsumed the public interest to the profitability of his business and political interests. He has shown a breathtaking disregard for the lives and liberties of Americans. He is a man unworthy of the office he holds.

The editorial board does not lightly indict a duly elected president. During Mr. Trump’s term, we have called out his racism and his xenophobia. We have critiqued his vandalism of the postwar consensus, a system of alliances and relationships around the globe that cost a great many lives to establish and maintain. We have, again and again, deplored his divisive rhetoric and his malicious attacks on fellow Americans. Yet when the Senate refused to convict the president for obvious abuses of power and obstruction, we counseled his political opponents to focus their outrage on defeating him at the ballot box.

Nov. 3 can be a turning point. This is an election about the country’s future, and what path its citizens wish to choose.

And would we have expected anything different from Sen. Lindsey O. Graham (R-S.C.), the shape-shifting chairman of the Judiciary Committee?

Back in the days when he pretended to care about something more than sucking up to power, Graham used to say Republicans would have to live with what they had done to Obama’s 2016 nominee, Merrick Garland. In October 2018, shortly before taking the gavel of the committee that will consider Trump’s nomination, Graham promised: “If an opening comes in the last year of President Trump’s term, and the primary process has started, we’ll wait till the next election.”

Now — surprise! — Graham has promised, via Twitter: “I will support President @realDonaldTrump in any effort to move forward regarding the recent vacancy created by the passing of Justice Ginsburg.” His rationale, if you can dignify it by calling it that, is that Democrats did things that offended him. So it’s payback time.

Oh, and let’s consider the sanctimonious and pseudointellectual Sen. Ted Cruz (R-Tex.), whom Trump has said he would consider for future openings on the court. When running for president in early 2016, he loftily declared to NBC’s Chuck Todd: “It has been 80 years since a Supreme Court vacancy was nominated and confirmed in an election year. There is a long tradition that you don’t do this in an election year. And what this means, Chuck, is we ought to make the 2016 election a referendum on the Supreme Court.”

What Cruz said wasn’t true, as is so often the case. There had indeed been instances of presidential nominees being confirmed during election years. In February 1988, a Democratic-led Senate voted 97-0 to put Ronald Reagan’s pick, Anthony M. Kennedy, on the court.

But this was only the beginning for Cruz. When it still appeared that Hillary Clinton would win in 2016, he also suggested that the court could get along just fine with only eight members indefinitely. Now — surprise! — Cruz is warning that having an even number of justices constitutes a “grave danger.”

President Trump promised in 2016 that he would protect the Constitution’s “Article I, Article II, Article XII.” (There is no Article XII.) Instead, he has shown how fragile the constitutional order can be when a president does not respect the rule of law. He has not grown into the office; instead, he has learned how to more effectively abuse its powers. The damage of a second term might be irreparable.

Our Democracy in Peril

Part seven of a series of editorials on the damage President Trump has caused — and the danger he would pose in a second term.

A president’s core responsibility is to use the awesome power of his office fairly and with neutrality. Mr. Trump has shown that he has a different understanding: The law is a weapon with which to reward loyalists, punish enemies and frighten everyone else to fall in line.

His distortion of the criminal justice system began within months of his inauguration. When FBI Director James B. Comey tried to explain the proper relationship between the president and the FBI, Mr. Trump demanded loyalty and asked the FBI director to go easy on his former national security adviser Michael Flynn. Mr. Comey declined to promise the former or do the latter, and the president fired him.

The tumult that Mr. Comey’s dismissal elicited might have taught a lesson to a more sensible person: There is substance and expectation behind the presidential oath’s pledge to faithfully execute the laws. Mr. Trump did not learn that lesson. His pick for attorney general, Jeff Sessions, properly recused himself from the federal investigation into Russia’s attack on the 2016 U.S. presidential election — and any coordination with the Trump campaign — leading to the appointment of special counsel Robert S. Mueller III. So Mr. Trump viciously attacked Mr. Sessions, and then fired him, too.

In part because the president’s staff more effectively restrained him back then, the special counsel was allowed to complete his investigation relatively unhindered. But Mr. Trump had no patience for standard Justice Department procedure — recusal when conflicts of interests may exist, special care to avoid even the appearance of impropriety. He reportedly complained that he needed a “Roy Cohn” at the Justice Department — that is, an aggressive protector of his personal interests. So, after firing Mr. Sessions, he hired an attorney general with no apparent concern about the appearance or reality of impropriety, William P. Barr.

Whether out of ideological fervor or fear of Mr. Trump’s wrath, Mr. Barr has aided the president’s friends, hurt his enemies and vociferously attacked anyone who has found these actions untoward. Mr. Barr sicced handpicked prosecutors on the Russia probe, despite independent investigations concluding it was warranted. Then Mr. Barr intervened to lessen the charging recommendation for Trump friend and convicted felon Roger Stone. Mr. Barr also ordered charges against Mr. Flynn, the admitted felon whom Mr. Trump had asked Mr. Comey to help, to be dropped. Yet another Justice Department official, FBI General Counsel Dana Boente, was fired after he opposed cooperating with the plot to clear Mr. Flynn.

Mr. Trump waited until after Senate Republicans voted to dismiss articles of impeachment in February to do more of his own dirty work. His White House already had issued illegal orders to prevent current or former executive branch officers from turning over documents or giving testimony to Congress, betting correctly that lawmakers would not be able to litigate the issue in time for the information they sought to matter. Free of the threat of removal, he committed revenge firings of impeachment witnesses who had only done their jobs and followed the law, including patriots such as Army Lt. Col. Alexander S. Vindman — and, for good measure, Mr. Vindman’s brother, who had nothing to do with impeachment.

Mr. Trump fired intelligence community inspector general Michael Atkinson for forwarding to Congress a whistleblower complaint that had implicated the president in his scheme to use public funds to extract political help from a foreign government. The message was clear: The lawful performance of one’s duties is secondary to protecting the president.

Mr. Trump commuted Mr. Stone’s sentence so that his friend would not have to serve one day, mocking the notion of equal justice before the law. He fired the inspector general tapped to monitor the administration’s coronavirus response programs, for reasons that are unclear, beyond his aversion to authentic oversight. The White House has inquisitors dedicated to rooting out federal staff who are insufficiently loyal to Mr. Trump, and they appear to be planning a broader purge after the November election.

Because the courts move slowly, the president discovered that he can sustain even the most egregious stonewalling and violations for years. The remaining checks would be Congress, but Republicans have almost uniformly chosen subservience to Mr. ‘Trump over fealty to the Constitution, and the executive branch, but Mr. Trump has sought to fire or cow anyone who would stand in the way of his lawlessness.

Last month brought two bright warning signs that the president feels ever-less inhibited. The Government Accountability Office found that Chad Wolf’s appointment as acting director of the Department of Homeland Security is illegal, yet Mr. Wolf is still there, overseeing a department that assisted in Mr. Trump’s alarming overreaction to protesters in Portland, Ore. Mr. Trump then used the White House for his Republican National Convention acceptance speech, which almost certainly resulted in violations of a law that prohibits federal resources from being used for political purposes. The New York Times reported that Mr. Trump “relished the fact that no one could do anything to stop him.”

Americans have long been taught that the U.S. political system has effective checks and balances. But in the past years, a frightening truth has emerged. Much of that balance has depended on the good character of the president, and there are surprisingly few ways to check a malign president from abusing the enormous powers of his office. Mr. Trump is committed to using those powers for his own personal ends, and he has slowly but surely chipped away at any limitations. How many would remain after four more years?

One reason it’s taken some folks so long to raise the alarm is because they lack understanding of our immigration and human rights laws and their foundational relationship to our democracy. Those of us who do, sounded the alarm early on! 

The lack of progressive immigration and human rights expertise and influence across all three branches of our Government and in much of the media has been a major factor in the rapid deterioration of our democracy. The progressive talent is out there in abundance; it’s just in the wrong place, outside of the power structure.

While I agree with the Post’s “bottom line,” I disagree somewhat with the analysis of why our Judicial System has failed so miserably when we most needed it. It’s not just an institutional weakness of “slowness;” it’s a defect in the qualifications, ideology, and character of too many GOP-appointed Federal Judges including the majority of our Supremes.

Yes, the wheels of justice can grind slowly. But, there is no institutional bar to integrity, creative emergency responses, or putting ideology aside to “do the right thing” for the rule of law and for human decency and human dignity. It’s happened before; but not this time around, with our nation in peril.

We saw an early example of the lack of legal and moral leadership on our highest Court with the invidious and blatantly unconstitutional and outright fraudulent “Muslim Ban.” 

The lower Federal Courts reacted immediately with proper urgency to “just say no” to this invidious, unconstitutional, dishonest political gimmick. Because their answer clearly was correct, the Supremes had only to reinforce that message to the regime — that Trump would be required to operate within the law and to conduct himself with professionalism, honesty, and the same modicum of human decency exhibited by all other Presidents. This should have been “a piece of cake” and a golden moment for the Court to assert its independence and reinforce human decency regardless of ideology.

Rather than upholding and reinforcing this courageous and timely conduct by their subordinate jurists, the Supremes improperly and incorrectly undermined them. Then, after unnecessary delay, they let the Trump bigot/scofflaws/liars off the hook. The rout of honesty, human dignity, and our Constitution was on!

Since then, the Roberts Court has engaged in a “pattern or practice” of improper intervention to disable timely actions by the lower courts and thereby aid the White Nationalist regime’s illegal, racism-driven actions and unethical legal tactics. Nowhere has that been worse than in the gross and deadly erosion of immigrants’ rights and human rights. Real human beings continue to suffer grotesque degradations and die because some Justices wouldn’t do their jobs! 

Roberts & Co. should spend some time suffering with their fellow humans in the squalid camps in Mexico they helped create; in dangerous and disgusting DHS detention that falls below standards we would inflict on convicted felons; in “baby jails;” on flights returning refugees to danger after not even taking the time to fairly listen and evaluate their claims; in “safe” third countries that are actually functionally war zones without functioning legal systems, let alone asylum systems, where corrupt regimes have neither the interest nor the ability to protect those being persecuted; or in our “Modern Star Chambers” known as “Immigration Courts” where maliciously incompetent management and a systemic contempt for due process actually threatens the lives of not only migrants, but also lawyers on both sides, the “judges,” and “court” staff. 

Too many “righty judges” exist outside the reality of the daily human misery inflicted on others by their intransigence and warped anti-humanity ideology! Even some so-called  “liberal” judges too often live in an “intellectual bubble” far removed from the unending ugliness and human despair daily unfolding at the “retail level of our justice system” — known as Immigration “Courts” that these days are nothing remotely resembling actual “courts.”

Those rights of the most vulnerable among us being ground into mush are all of our rights to equal justice and fundamental fairness under law. The failure to stand up for equal justice under law and social justice for all is currently ripping our nation apart and fueling a resurgence of Jim Crow racism.

Life tenure insures that our judiciary will only change over time. But, more anti-democracy, right wing jurists on our Federal Bench will exponentially decrease our chances of saving our republic. And, we can be sure that the Trump/Mitch pick to replace Justice Ruth Bader Ginsburg will push American Justice to the precipice.

We need fundamental changes in what type of persons with what type of values control and comprise all three Branches of our Government. We  must start now, before it is too late. No system will stand up to the actions of individuals who don’t believe in its fundamental Constitutional guarantees of due process, fundamental fairness, and equal justice for all persons under law! 

It’s also long past time for future Democratic Administrations aggressively to embrace and elevate the pool of tremendous legal expertise, administrative talent, moral and intellectual courage, and proven problem solving ability now out there in the private, academic, and NGO human rights and immigrants’ rights community! 

These are the “anti-Stephen-Millers,” “anti Billy-the-Bigots,” and “anti-Wolfmans,” who would strive to make our Constitutional promises finally come alive for all Americans, insure equality for all before the law, and make our nation a better place for everyone, not just the privileged and powerful. Government utilizing the skills of smart, practical, humane problem solvers would also be much more efficient in spending our tax dollars than the current Government of bigots and incompetents driven by extreme bias, an exclusive vision, and highly counterproductive ideologies!

This Fall, vote like your life and the future of our Constitutional republic depend on it. Because they most certainly do!

At this point, there are thousands of examples underscoring the need to remove the president from society, but the most recent is his unhinged response to the New York Times’ 1619 Project, which he wants abolished in schools and replaced with a revisionist history of America that teaches children how white people have only ever had their Black peers’ best interest at heart, including when said white people literally owned slaves.

Speaking at the National Archives Museum on Thursday, Trump announced that he would be signing an executive order establishing the “1776 Commission” to promote a “patriotic education.” Apparently attempting to reach his white nationalist supporters, Trump said that the left is “attempting to destroy [the] beautiful vision” that the founding fathers had for America, and that things like the 1619 Project, which teach children about systemic racism and reframe the country’s history by examining the consequences of slavery, are “toxic propaganda” and “ideological poison” that “if not removed, will dissolve the civic bonds that tie us together” and “will destroy our country.” Then he claimed liberals want to tear down Mount Rushmore . . . .

Trump’s view of America is unrelentingly bogus. racist, unethical, and unpatriotic! This is “Dred Scottification” in action. And, we must never forget the disgraceful failure of Chief Justice John Roberts and the Supremes’ majority to take a strong stand against the very overt White Nationalist racism of Trump, Miller, and the GOP. They are indeed promoters of “Dred Scottification,” racial divisiveness, inequality, and the breakdown of the rule of law and ethical and moral norms that should guide 21st Century  governance.

American democracy is indeed “on the ropes.” But, we still have a chance to save our republic this Fall. Don’t blow it!

This Fall, vote like your life and the future existence of our nation depend on it.  Because they do!
