PRESIDENT BIDEN has served notice that his ambitious immigration plan is in the first rank of his priorities. Some of his program will be immediately implementable; some may get bogged down in Congress, where many Republicans will regard it as an occasion to brandish the word “amnesty,” red meat for their bases. No matter. Mr. Biden’s plan is in keeping with the United States’ best traditions. It responds to the challenge of population stagnation. It would reverse his predecessor’s extravagantly cruel policies. And it is now clear that when it comes to immigration, Mr. Biden is all in.

That courageous stance was not necessarily expected or politically expedient. Unity was the new president’s campaign theme and inaugural touchstone, yet few issues are as divisive as immigration. His evident readiness to tap his modest reserves of political capital for a slugfest on immigration is a signal that the United States has returned to its roots as a beacon for refugees and a humanitarian role model among nations.

The plan is also smart. The U.S. population growth rate in the just-ended decade was the lowest since the first national census in 1790, according to the Brookings Institution — lower even than during the Great Depression of the 1930s. The number of Americans below the age of 18 actually shrank in the 2010s, by more than 1 million.

That stagnation, the product of an aging population and historically low fertility rates, cannot be reversed by immigration alone. But it will certainly be exacerbated, and has been in the past four years, by a policy hostile to newcomers. In President Donald Trump’s penultimate year in office, annual net immigration fell below 600,000, the lowest level in decades; it was more than 1 million in the final years of the Obama presidency.

What’s more, by proposing an eight-year path to citizenship for most of the nation’s 11 million unauthorized migrants — the centerpiece of his plan — Mr. Biden is attempting to align law and reality. By 2029, when they would be eligible for citizenship, most will have been in the United States for more than a quarter-century. At least 4 million are essential workers in construction, food processing, groceries, restaurants, agriculture and transportation — doing jobs critical to practically every American.

Mr. Biden is moving quickly where he can — fully reinstating the Obama-era program providing work permits and deportation protection for “dreamers,” young migrants brought to this country by their parents; rescinding Mr. Trump’s 2017 travel ban from majority-Muslim countries; halting construction of the southern border wall; and reining in the Trump administration’s aggressive deportation policies. He has also signaled he will increase annual refugee admissions, which Mr. Trump poleaxed, and scrap a Trump administration rule that denies green cards to immigrants deemed likely to use public benefits such as food stamps.

Other measures will require congressional action. Under legislation Mr. Biden is sending to Congress, green cards conferring legal permanent residency would be granted to dreamers as well as to immigrants from strife- and disaster-wracked nations who have been here for years.

The president is also pushing tougher border security — in recognition that the new administration is not inviting a wave of new migrants, still less amid a pandemic — though not as a precondition for his immigration reforms. His more impactful, long-term strategy to dissuade new waves of illegal immigrants is a concerted aid effort to boost economies and contain crime in Central America.

Mr. Biden has laid out an immigration program that would genuinely put America first.

Newsflash: It wasn’t the radical left that stormed the doors of the Capitol on Wednesday. It wasn’t the radical left that told a group of known white nationalists to “stand by” during a nationally televised presidential debate. It wasn’t the radical left that addressed the soon-to-be rioters and declared to members of Congress that “we’re coming for you.” It wasn’t the radical left who on the eve of the Capitol siege announced their plans to walk the path to sedition.

The only “radical” elements America sees now are the words and actions of the Republican Party. Yet Republicans have forever gotten away with throwing around the label “radical” to characterize the Democratic Party.

How many times in political ads have Republicans used the words “radical” and “dangerous” to describe their Democratic challengers? How many Fox News segments have Sean Hannity and friends devoted to the Democrats’ “radical extreme socialist agenda”?

What happened on Wednesday was an inevitable culmination of years of extreme and alarmist rhetoric from the Republican Party and their propaganda platforms. Watching Republicans act shocked that the people they have relentlessly and unapologetically pandered to for years is appalling.

With every tweet, every soundbite, every campaign ad, Republicans have been signaling to their supporters that it’s time to take matters in their hands. When you label something as “radical” or “extreme” or “dangerous,” you are telling people they need to defend themselves against a threat. You are telling them they need to be ready to fight. You are telling them their impulse to resort to violence and destruction is justified and righteous.

There is absolutely nothing radical or extreme about protesting racial inequality, social injustice and a culture of police brutality in America. There is nothing radical or extreme about speaking out for gender equality and women’s rights. There is nothing radical or extreme about advocating for universal healthcare coverage. There is nothing radical or extreme about supporting action to address the growing threat of climate change. There is nothing radical or extreme about wanting corporations to pay their fair share of taxes. There is nothing radical or extreme about embracing the need for gun reform in the wake of mass shootings. There is nothing radical or extreme about wearing a mask and social distancing amid a global pandemic that has taken the lives of more than 365,000 Americans.

The extremists are the ones who egged on the insurrectionists with four years of lies. Republicans may be abandoning the sinking Trump ship, but don’t let this 11th-hour maneuver fool you. That even after Wednesday’s events Republicans in Congress and in the media are still clinging to the “radical socialist agenda” narrative shows they haven’t changed — though they are scurrying to launder their tattered reputations.

Don’t believe me?

Just watch how many of them will vote to support articles of impeachment if the Democrats bring those to the House floor next week.

‘I just want to find 11,780 votes’: In extraordinary hour-long call, Trump pressures Georgia secretary of state to recalculate the vote in his favor

President Trump urged fellow Republican Brad Raffensperger, the Georgia secretary of state, to “find” enough votes to overturn his defeat in an extraordinary one-hour phone call Saturday that election experts said raised legal questions.

The Washington Post obtained a recording of the conversation in which Trump alternately berated Raffensperger, tried to flatter him, begged him to act and threatened him with vague criminal consequences if the secretary of state refused to pursue his false claims, at one point warning that Raffensperger was taking “a big risk.”

Throughout the call, Raffensperger and his office’s general counsel rejected his assertions, explaining that Trump is relying on debunked conspiracy theories and that President-elect Joe Biden’s 12,779-vote victory in Georgia was fair and accurate.

Trump’s conversation with Raffensperger put him in legally questionable territory, legal experts said. By exhorting the secretary of state to “find” votes and to deploy investigators who “want to find answers,” Trump appears to be encouraging him to doctor the election outcome in Georgia.

But experts said Trump’s clearer transgression is a moral one. Edward B. Foley, a law professor at the Ohio State University, said that the legal questions are murky and would be subject to prosecutorial discretion. But he also emphasized that the call was “inappropriate and contemptible” and should prompt moral outrage.

“He was already tripping the emergency meter,” Foley said. “So we were at 12 on a scale of 1 to 10, and now we’re at 15.”

Throughout the call, Trump detailed an exhaustive list of disinformation and conspiracy theories to support his position. He claimed without evidence that he had won Georgia by at least a half-million votes. He floated a barrage of assertions that have been investigated and disproven: that thousands of dead people voted; that an Atlanta election worker scanned 18,000 forged ballots three times each and “100 percent” were for Biden; that thousands more voters living out of state came back to Georgia illegally just to vote in the election.

It seems clear that, with no chance of proving this election fraudulent, Trump is now trying to incite violence. Nonetheless, Republicans who are jockeying for the 2024 presidential nomination want to make sure they can pick up Trump’s voters. While McConnell doesn’t want Senators to have to declare their support either way, those vying to lead the party want to differentiate themselves from the pack.

On Wednesday, Senator Josh Hawley (R-MO) announced he would join the efforts of his House colleagues to challenge Biden electors from Pennsylvania and perhaps other states. This will not affect the outcome of the election, but it will force senators to go on record for or against Trump. In a statement, Hawley listed Trump talking points: the influence of “mega corporations” on behalf of Biden and “voter fraud.” Hawley seems pretty clearly to be angling for a leg up in 2024.

On Wednesday night, Senator Ben Sasse (R-NE) made his own play for the future of the Republican Party. He refuted point by point the idea that Trump won. He scolded his colleagues who are signing on to Trump’s attempt to steal the election, calling them “institutional arsonists.”

“When we talk in private, I haven’t heard a single Congressional Republican allege that the election results were fraudulent – not one,” he wrote on Facebook. “Instead, I hear them talk about their worries about how they will “look” to President Trump’s most ardent supporters.” They think they can “tap into the president’s populist base without doing any real, long-term damage,” he wrote, but they’re wrong. “Adults don’t point a loaded gun at the heart of legitimate self-government.”

Today, Senator Mitt Romney (R-UT), the 2012 Republican presidential nominee, launched his own bid to redefine the Republican Party with an attack on Trump’s apparent botching of the coronavirus vaccine rollout. In a press release, Romney noted “[t]hat comprehensive vaccination plans have not been developed at the federal level and sent to the states as models is as incomprehensible as it is inexcusable.”

But he didn’t stop there. Romney went on to say that he was no expert on vaccine distribution, “[b]ut I know that when something isn’t working, you need to acknowledge reality and develop a plan—particularly when hundreds of thousands of lives are at stake.” He offered ideas of his own, offering them “not as the answer but as an example of the kind of options that ought to be brainstormed in Washington and in every state.” After listing his ideas, he concluded: “Public health professionals will easily point out the errors in this plan—so they should develop better alternatives based on experience, modeling and trial.”

Romney’s statement was about more than vaccine distribution. With its emphasis on listening to experts and experimenting, it was an attack on the rigid ideology that has taken over the Republican Party. Romney has said he comes to his position from his own experience, not his reading, but he is reaching back to the origins of conservative thought, when Irish statesman Edmund Burke critiqued the French Revolution as a dangerous attempt to build a government according to an ideology, rather than reality. Burke predicted that such an attempt would inevitably result in politicians trying to force society to conform to their ideology. When it did not, they would turn to tyranny and violence.

Sasse’s point-by-point refutation of Trump’s arguments– complete with citations—and Romney’s call to govern according to reality rather than ideology are suggestive. They seem to show an attempt to recall the Republican Party to the true conservatism it abandoned a generation ago.

Much as the idea appeals to me, and much as I admire Professor Richardson, it seems like an noble, yet unrealistic, hope rather than a slice of reality. As noted by Professor Richardson, the current GOP abandoned any real values at least a decade ago. They now rely on the “anti-democracy right” to keep them in business as a party that wields political strength out of proportion to the minority of voters it represents.

I find it perversely amusing, yet fundamentally disturbing, to have heard a Trump voter on TV recently claim to have “voted for the GOP platform” not the man in the last election. She was woefully ignorant of the fact that the GOP had no platform in 2020 other than “whatever Trump says.” 

The history of those in the GOP who have been openly critical of Trump and his cult supporters is that they generally either 1) fall into line behind Moscow Mitch and Trump on most issues (e.g., Romney, Collins, et al.) or 2) head for the hills (e.g., Flake, Corker). Unlike the Dems, where spirited opposition is always threatening to rock the boat, true opposition and public dialogue are nearly non-existent in today’s GOP. 

Nor does the lack of GOP soul searching and public recognition of Trump’s toxic, highly dishonest, and fundamentally anti-American “non-leadership” and responsibility for his own defeat, as well as the disastrous course his “maliciously incompetent non-leadership” has set for America, lead me to believe that the GOP will head in a “new direction” any time in the foreseeable future. 

For example, as I’m writing this Cruz and ten other corrupt GOP “Senators” (or “Senators-elect”) are openly spreading lies and preaching sedition 🏴‍☠️ in the U.S. Senate.

That shows where the anti-American “Party of Putin and White Nationalist Extremists” ☠️🤮🤥 is headed these days. They might be the minority in their party, but you can bet that they won’t suffer any censure, much criticism, or real consequences from the rest of the GOP for essentially fomenting treason and seeking to undermine the credibility of an election fairly and overwhelmingly won by Biden and Harris.

The real hope for America’s survival is that under Biden and Harris, the Dems can finally figure our how to turn their numerical advantage in the general elections into actual political power to govern. Remains to be seen. Certainly hasn’t happened to date! That’s why we’re in this position, with Dems having won the popular vote in seven of the last eight elections, but held the Presidency after only five of those seven elections.

While I agree with some of what Romney says these days, he is somewhat unique in the GOP. He is one of the few GOP Senators with sufficient independent standing in his home state to be largely immune to criticism and attacks by Trump and his cronies.

Based on their overwhelming refusal over the past four years to put our national interests above Trump’s personal agenda, I (unfortunately) think that a “loyal opposition” springing from today’s GOP is more of a “Dem pipe dream” than a realistic possibility.

The bipartisan compromise was considered a done deal and won sweeping approval in the House and Senate after the White House assured GOP leaders that Trump supported it.

If he refuses to sign the deal, which is attached to a $1.4-trillion government funding bill, it will force a federal government shutdown, in addition to delaying aid checks and halting unemployment benefits and eviction protections in the most dire stretch of the pandemic.

“Made many calls and had meetings at Trump International in Palm Beach, Florida. Why would politicians not want to give people $2000, rather than only $600?” he tweeted after leaving the golf course Friday afternoon. “It wasn’t their fault, it was China. Give our people the money!”

Trump’s attack on the bill has been seen, at least in part, as punishment for what he considers insufficient backing by congressional Republicans for his push to overturn the Nov. 3 election results with unfounded claims of fraud.

Hey, you know that massive, scary, very likely Russian hack that reportedly breached multiple U.S. government agencies in what may have been the biggest government hack in history? The one that Trump’s former Homeland Security adviser estimates could have affected 18,000 organizations, including most federal government unclassified networks and a number of Fortune 500 companies? The magnitude of which, he says, cannot be overstated? The same one that Donald Trump has said nothing about? Well, no biggie, but apparently hackers also reportedly accessed the networks of the Energy Department and the National Nuclear Security Administration. Which, as you might have guessed, maintain the country’s nuclear weapons stockpile.

Per Politico:

On Thursday, DOE and NNSA officials began coordinating notifications about the breach to their congressional oversight bodies after being briefed by Rocky Campione, the chief information officer at DOE. They found suspicious activity in networks belonging to the Federal Energy Regulatory Commission (FERC), Sandia and Los Alamos national laboratories in New Mexico and Washington, the Office of Secure Transportation at NNSA, and the Richland Field Office of the DOE. The hackers have been able to do more damage at FERC than the other agencies, and officials there have evidence of highly malicious activity, the officials said, but did not elaborate.

The attack on DOE is the clearest sign yet that the hackers were able to access the networks belonging to a core part of the U.S. national security enterprise. The hackers are believed to have gained access to the federal agencies’ networks by compromising the software company SolarWinds, which sells IT management products to hundreds of government and private-sector clients…. NNSA is responsible for managing the nation’s nuclear weapons, and while it gets the least attention, it takes up the vast majority of DOE’s budget. Similarly, the Sandia and Los Alamos National Labs conduct atomic research related to both civil nuclear power and nuclear weapons. The Office of Secure Transportation is tasked with moving enriched uranium and other materials critical for maintaining the nuclear stockpile.

While Joe Biden commented on the issue Thursday, saying “Our adversaries should know that, as president, I will not stand idly by in the face of cyber assaults on our nation,” Trump has remained curiously silent, or at least it would be curious had he not made it explicitly clear the last four years that Vladimir Putin, and really, any of his favorite dictators, can often do whatever they want. (The Russian embassy said on Sunday that it had nothing to do with the hack, though experts believe it almost certainly came from a Russian intelligence agency.)

But hey! There may be an entirely reasonable explanation for why Trump hasn’t bothered to address the issue, and it’s that he’s been extremely busy working on much more important issues. No, not fruitlessly attempting to overturn the results of the 2020 election, though that does take up a decent amount of his time. In this case, it’s something even bigger:

The U.S. Department of Energy on Tuesday finalized a pair of new rules rolling back water efficiency standards on showerheads and other consumer appliances, punctuating President Donald Trump’s long-documented water flow grievances in the final weeks of his administration. The new showerhead rule goes after the two-and-a-half-gallon-per-minute maximum flow rate set by Congress in the 1990s. Under current federal law, each showerhead in a fixture counts toward that limit collectively—but the Energy Department’s new rule means each showerhead individually can reach the limit set by Congress.

The slate of recent changes align with Trump’s larger dismantling of environmental regulations, and, more specifically, his open disdain for poor water flow. Trump claimed late last year that Americans are flushing their toilets “10 times, 15 times, as opposed to once” and are having difficulty washing their hands. “We have a situation where we’re looking very strongly at sinks and showers and other elements of bathrooms where you turn the faucet on—and in areas where there’s tremendous amounts of water, where the water rushes out to sea because you could never handle it, and you don’t get any water,” the president said last December during a roundtable with small business leaders about deregulatory actions. “You turn on the faucet and you don’t get any water. They take a shower and water comes dripping out. Just dripping out, very quietly dripping out,“ the president continued, lowering his voice as he spoke about the drips.

“Today the Trump Administration affirmed its commitment to reducing regulatory burdens and safeguarding consumer choice,” Secretary of Energy Dan Brouillette proudly declared in a statement. “With these rule changes, Americans can choose products that are best suited to meet their individual needs and the needs of their families.” The rollbacks were chastised not only by environmental groups but consumer organizations as well, with Andrew deLaski, executive director of the Appliance Standards Awareness Project, saying, “Changing the rules to address one of President Trump’s pet peeves is simply silly. Thousands of showerhead models on the market today meet the standards that Congress set way back in 1992 and provide a great shower.”

In related news, to date it remains unclear why it takes Trump 15 flushes to clear a toilet.

Look, M. Mitch might be slimy, devious, and intellectually dishonest. But, unlike some in his party, he’s no fool.

He’s enough of a student of history to have known that with a large majority of the popular vote and an insurmountable lead in the Electoral College, well-established within a week of the November 3 election, that Biden would be the next President.

Yet, rather than using his position and his influence to combat Trump & company’s false claims and bogus narratives of voter fraud, designed specifically to destabilize our democracy and create unrest, McConnell continued to mouth platitudes. This was even after Trump and his followers actually threatened the safety, welfare, and political futures of members of the GOP who had to guts to stand up and do their jobs.

The voters of Georgia actually have a final shot at removing Mitch’s pernicious power and getting rid of two of the worst Senators in the process. We can always hope that they come through for the rest of us and for our nation.

Then again, it was only two weeks before Election Day that four of the court’s conservatives announced their potential willingness to throw out votes on the basis of this theory of state legislative supremacy over electoral votes. It is very easy to imagine a world in which the election was a little closer, where the outcome came down to one state instead of three or four, and the court’s conservatives could use the conflict over a narrow margin to hand the president a second term.

With no evidence that Republicans have really thought about the implications of a victory in the courts, I think we can say that these briefs and lawsuits are part of a performance, where the game is not to break kayfabe (the conceit, in professional wrestling, that what is fake is real). Still, we’ve learned something from this game, in the same way we learn something about an audience when it laughs.

We have learned that the Republican Party, or much of it, has abandoned whatever commitment to electoral democracy it had to begin with. That it views defeat on its face as illegitimate, a product of fraud concocted by opponents who don’t deserve to hold power. That it is fully the party of minority rule, committed to the idea that a vote doesn’t count if it isn’t for its candidates, and that if democracy won’t serve its partisan and ideological interests, then so much for democracy.

None of this is new — there is a whole tradition of reactionary, counter-majoritarian thought in American politics to which the conservative movement is heir — but it is the first time since the 1850s that these ideas have nearly captured an entire political party. And while the future is unwritten, the events of the past month make me worry that we’re following a script the climax of which requires a disaster.

Although the GOP right claims to shudder at the threat of ”socialism,” (most probably have little or no idea what that actually means) dangerous clowns 🤡 like Ted Cruz would have been right at home in a Leninist-Stalinist dictatorship, its cult of personality, its utter disdain for the “real will of the people” and the common good, and its brutal suppression of both truth and dissent in favor of a politically fabricated “party line.”

Susan Church, an immigration attorney in Boston, ended the first week of the Trump administration arm in arm with protesters at Logan Airport, resisting an executive order banning travel from several predominantly Muslim countries. But what happened the next day, away from the public chants of “Let them stay!” was more typical of what the life of the former chair of the New England chapter of the American Immigration Lawyers Association (AILA) was to become under the Trump administration.

Church and an associate filed an emergency lawsuit to secure the release of immigrants from Customs and Border Protection (CBP) custody. “I got a federal judge on the phone, you know, on a Saturday night at eight o’clock.” The judge told Church to go to court immediately. An hour later, the attorneys were in court defending their clients.

“For me, that was the canary in the coal mine about what the rest of my four years under the Trump administration was going to be like,” Church said. “It’s just a nonstop series of emergency litigation filed to try to rescue one or 10 or 100 or 1,000 people, depending on which issue it is.” Eventually, the speed of the work, and the physical and mental exhaustion it triggered, landed Church in the hospital. “I thought I was having a heart attack,” she said.

Church stayed with the fight to reunite parents with their children. She described the process of taking affidavits from clients, which require she learn every harrowing detail of a client’s trauma. In one instance, CBP ripped away one woman’s eight-year-old daughter at the border. “She had to comb her daughter’s hair and change her daughter’s clothes and put her on a bus and say goodbye to her,” Church said through tears. The two were separated for nearly two months, even after the mother was released from detention.

Church was able to reunite her client with her child, but the episode—like many, many other cases—weighs heavy on her shoulders. “I don’t think I’ll ever be quite the same person that I was beforehand,” she said.

Four years into this migration crisis, there’s a parallel migration under way—of immigration lawyers out of the profession. Survey data and interviews the Prospect conducted with more than a dozen lawyers around the country reveal the physical, mental, and financial toll endured by members of the bar. Given the extreme violence, trauma, and inhumanity their clients often endure, immigration attorneys don’t like to talk about how it affects them. But secondary trauma also leaves a mark, making it impossible to continue for some attorneys. Although numerical data is limited, there is evidence that some attorneys are cutting back on some types of cases, such as deportation defense work, or even leaving immigration law altogether. Removal defense casework is one of the most time-intensive, emotional, and exigent parts of lawyers’ loads. It’s also where the administration has aimed much of its cruelest policymaking, severely limiting lawyers’ efficacy.

Under the Trump administration, immigration law has changed not only profoundly, but also so rapidly that it’s hard for immigration attorneys to keep up. Susan Church—and several other attorneys interviewed for this article—described combating Trump’s policies as a game of whack-a-mole.

Forget all the right wing BS and the “originalist hoax!” This is about “democracy (or the destruction thereof) in action.” 

Remember, all of these cosmic “immigration law changes” have taken place without a single piece of major legislation enacted by Congress! Indeed, the Trump regime’s ham-handed attempt to force it’s nativist agenda down the throats of the Congress as part of the “Dreamer fiasco” fell flat on its face in both Houses!  But, the Supremes have both encouraged and enabled Trump (actually notorious white supremacist Stephen Miller) to rewrite the law through. “Executive fiat.” Totally inappropriate, not to mention glaringly unconstitutional.

The Supremes’ majority has time and again improperly sided with the unethical, immoral, and Constitutionally bankrupt “Dred Scottification” of migrants, particularly asylum seekers. It’s not much different from what has happened to African Americans, Latinos, and other minorities following the Civil War. But, this is supposed to be the 21st Century where we have put “Jim Crow” behind us. Obviously, we haven’t!

Failing to protect “officers of the court” (lawyers) and their clients from a scheme of abuses heaped upon them by a corrupt, biased, out of control, overtly racist Executive and his sycophants is a gross dereliction of duty by the Supremes. It’s basically like allowing, and even encouraging, the badgering of a witness during trial! 

It’s painfully obvious that we have many of the wrong folks on the bench — from the Immigration Courts to the Supremes. Indeed, the nation and the world would be much better served if many more of those courageous lawyers who serve the immigrant community and human rights experts were on the Federal Bench at all levels. 

Trump, Roberts, and the GOP judicial misfits have also shown us first-hand the profiles of individuals who should not be serving in judicial positions. Let them litigate their “originalist,” “unitary Executive,” and other “far out” righty philosophies as lawyers appearing before real judges —“practical scholars” who live in the 21st Century and are committed to problem solving rather than problem creating. As Joe Biden has noted, the entire judicial selection system and particularly the Supremes need a thoughtful re-examination and reform. 

Never again should we have Justices like Amy Coney Barrett and Clarence Thomas performing highly inappropriate and unethical televised “campaign stunts” for an incumbent President during an ongoing election. Geez! What kind of “impartial jurists” are they? 

Most first year law students could tell you that’s a “no-go!” Why have we “normalized” and “accepted” such obvious bias, misbehavior, and lack of sound judgment at the highest levels of our (not Trump’s or Mitch’s personal) Judiciary?

It’s not “Rocket Science!” The fundamental building blocks of our society are immigration, human rights, and equal justice! Any lawyer who who doesn’t embody those virtues and doesn’t publicly embrace them should not in the future be given a lifetime appointment as a Federal Judge — at any level!

We need better judges for a better America! We will never achieve constitutionally-required “equal justice for all” for African Americans, Latinos, or anyone else, nor can we reach our diverse nation’s full potential, if we don’t start “pushing back” against Roberts and the GOP’s right wing judicial oligarchy, their obtuse legal gibberish, and their anti-democratic “jurisprudence.”

It starts with voting to take back our country from the far right. But, that’s just the beginning of the changes needed if equal justice for all is to become a reality, rather than an ever unfulfilled promise, limited to certain privileged (predominantly White) groups within our society!

And, all of society owes a debt of gratitude to Ms. Church and other brave lawyers like her who represent the best our country has to offer and have actually suffered for standing up for the rule of law and the legal and human rights of the most vulnerable among us. In other words, standing up for all of our rights against a tyranny! 

Compare that with the utterly dismal composition of the “Trump kakistocracy” and its “Dred Scottification” of “the other.”

In 1973, a United States Air Force officer, Major Harold Hering, asked a question that the Air Force did not want asked. Hering, a decorated Vietnam War veteran, was then in training to become a Minuteman-missile crewman. The question he asked one of his instructors was this: “How can I know that an order I receive to launch my missiles came from a sane president?”

The writer Ron Rosenbaum would later call this the “forbidden question.” Missile officers are allowed to ask certain sorts of questions—about the various fail-safe systems built to prevent the accidental launching of nuclear weapons, for instance. But the Air Force would not answer Hering’s question, and it moved to discharge him after determining that officers responsible for launching nuclear weapons did not “need to know” the answer. “I have to say I feel I do have a need to know because I am a human being,” Hering said in response.

Hering’s question was taboo because the national defense strategy of the United States is built on the unstated assumption that the American people will not allow a lunatic to become president. If that assumption is wrong, then no procedural, legal, or technological mechanisms exist that are able to fully protect the human race from such a lunatic. Hering discovered a catastrophic flaw in U.S. nuclear doctrine, and for this he was driven from the Air Force.

In most matters related to the governance and defense of the United States, the president is constrained by competing branches of government and by an intricate web of laws and customs. Only in one crucial area does the president resemble, in the words of the former missile officer and scholar Bruce Blair, an absolute monarch—his control of nuclear weapons. Richard Nixon, who was president when Major Hering asked his question, was reported to have told members of Congress at a White House dinner party, “I could leave this room and in 25 minutes, 70 million people would be dead.” This was an alarming but accurate statement.

When contemplating their ballots, Americans should ask which candidate in a presidential contest is better equipped to guide the United States through a national-security crisis without triggering a nuclear exchange, and which candidate is better equipped to interpret—within five or seven minutes—the ambiguous, complicated, and contradictory signals that could suggest an imminent nuclear attack. These are certainly not questions that large numbers of voters asked themselves in 2016, when a transparently unqualified candidate for president won the support of 63 million Americans.

At the time, Donald Trump had not yet served in public office, so concerns about his ability to protect the United States from harm were hypothetical, though grounded in his long and terrible record as a human being. As The Atlantic stated in its October 2016 endorsement of his opponent, Hillary Clinton, Trump “traffics in conspiracy theories and racist invective; he is appallingly sexist; he is erratic, secretive, and xenophobic; he expresses admiration for authoritarian rulers, and evinces authoritarian tendencies himself … He is an enemy of fact-based discourse; he is ignorant of, and indifferent to, the Constitution; he appears not to read.”

What we have learned since we published that editorial is that we understated our case. Donald Trump is the worst president this country has seen since Andrew Johnson, or perhaps James Buchanan, or perhaps ever. Trump has brought our country low; he has divided our people; he has pitted race against race; he has corrupted our democracy; he has shown contempt for American ideals; he has made cruelty a sacrament; he has provided comfort to propagators of hate; he has abandoned America’s allies; he has aligned himself with dictators; he has encouraged terrorism and mob violence; he has undermined the agencies and departments of government; he has despoiled the environment; he has opposed free speech; he has lied frenetically and evangelized for conspiracism; he has stolen children from their parents; he has made himself an advocate of a hostile foreign power; and he has failed to protect America from a ravaging virus. Trump is not responsible for all of the 220,000 COVID-19-related deaths in America. But through his avarice and ignorance and negligence and titanic incompetence, he has allowed tens of thousands of Americans to suffer and die, many alone, all needlessly. With each passing day, his presidency reaps more death.

But let us lay all of this aside for the moment. Let us even lay aside the extraordinary fact that Donald Trump has been credibly accused of rape. Compelling evidence suggests that his countless sins and defects are rooted in mental instability, pathological narcissism, and profound moral and cognitive impairment. Which returns us to the subject of Major Hering.

Trump’s opponent, Joe Biden, is in many ways a typically imperfect candidate, but if we judge these men on two questions alone—Who is a more trustworthy steward of America’s nuclear arsenal? Which man poses less of a threat to our collective existence?—the answer is spectacularly obvious.

The Atlantic has endorsed only three candidates in its 163-year history: Abraham Lincoln, Lyndon B. Johnson, and Hillary Clinton. The latter two endorsements had more to do with the qualities of Barry Goldwater and Donald Trump than with those of Johnson and Clinton. The same holds true in the case of Joe Biden. Biden is a man of experience, maturity, and obvious humanity, but had the Republican Party put forward a credible candidate for president, we would have felt no compulsion to state a preference. Donald Trump, however, is a clear and continuing danger to the United States, and it does not seem likely that our country would be able to emerge whole from four more years of his misrule. Two men are running for president. One is a terrible man; the other is a decent man. Vote for the decent man.

Even Republicans don’t have the stomach to outsource judgment on all modern constitutional questions to the slaveholding elite of a preindustrial, post-colonial backwater. As Dean of Berkeley Law Erwin Chemerinsky has observed, a ruthless adherence to text and history would require forfeiting judicial protection of “liberties such as the right to marry, the right to procreate, the right to custody of one’s children, the right to keep the family together, the right of parents to control the upbringing of their children, the right to purchase and use contraceptives, the right to abortion, [and] the right to refuse medical care,” none of which are guaranteed by the Constitution.

Amy Coney Barrett herself has acknowledged the undesirability of applying originalism indiscriminately, noting in 2016, “Adherence to originalism arguably requires, for example, the dismantling of the administrative state, the invalidation of paper money, and the reversal of Brown v. Board of Education,” and other institutions that “no serious person would propose to undo,” even if they lack constitutional grounding. Barrett’s proposed solution to this conundrum is for courts to simply avoid ruling on cases where originalism would dictate socially unthinkable overturnings of precedent; she wrote in 2017 that “discretionary jurisdiction generally permits [the Court] to choose which questions it wants to answer.”

But this expedient degrades originalism’s claim to neutrality. If an originalist Supreme Court can apply its doctrine opportunistically — taking only those cases in which its “neutral” juridical method will yield outcomes acceptable to a “serious” person (as they define that adjective) — then originalism isn’t much of a binding restriction on judicial discretion.

What’s more, Barrett’s concession tacitly betrays awareness of a critical fact that originalists love to elide when speaking for a lay audience: Amending the Constitution has become so phenomenally difficult it’s not at all clear that the American people could promptly replace an overturned Brown v. Board of Education with an amendment forbidding school segregation, despite overwhelming popular support for that Supreme Court decision. Originalists like to portray their judicial approach as highly democratic, since they purport to defer to the letter of a democratically enacted Constitution. But once one stipulates that the demos is manifestly no longer capable of passing constitutional amendments with regularity, it becomes clear that the originalist practice of striking down democratically elected laws in deference to the letter of a centuries-old document is profoundly anti-democratic.

Of course, in real life, “originalist” Supreme Court justices haven’t just applied their method opportunistically by selecting cases in which originalism will produce a favored outcome; they’ve also simply declined to abide by their method when they feel like it. On Monday, Barrett named Antonin Scalia as her guiding light on judicial philosophy. But as Georgia State University Law professor Eric J. Segall notes, Scalia voted “for broad rules limiting congressional power to enact campaign finance reform, to commandeer state legislatures and executives to help implement federal law, and to allow lawsuits against the states for money damages by citizens of other states” without “justifying these broad rules from a textual or historical perspective,” presumably because they have no textual or historical basis.

In sum: Amy Coney Barrett’s originalism does not work as a method of safeguarding democracy against an activist, ideologically motivated judiciary. It does, however, function quite well as a means of obscuring a far-right movement’s efforts to impose its unpopular agenda by judicial fiat.

Just think about it: Supposedly a bunch of guys who risked everything on a never-before-realized long shot of defeating the British King and setting up a republic actually  intended that 230 years after the fact the governors of that republic would be so backwards, unimaginative, and intellectually limited that they would still be attempting to divine the “true meaning” of various two-centuries out of date words and concepts that nobody agreed upon in the first place! Preposterous! Not to mention totally intellectually dishonest!

Obviously, if the GOP Senators actually believed that Coney Barrett would be an unbiased judge with an open mind to progressive, liberal, humane, common sense interpretations of law and committed to implementing the Constitutional guarantee of equal protection and due process under the law for all persons, they would be apoplectic. They would be outraged at Trump for foisting such an unreliable and unpredictable jurist on them! 

I’m not necessarily saying that Coney Barrett couldn’t educate herself and “get smarter” on the bench — abandoning her false dogma and actually showing some empathy, courage, independence, and commitment to equal justice for all. She wouldn’t be the first GOP-appointed Judge or Justice to move left on the bench. After all, spending a lifetime mired on the wrong side of history screwing up the lives of your fellow humans can get old, even for well-trained right-wing ideologues.

Also, she will have the benefit of the only current Justice who actually appears up to the job and consistently understands the proper role of a High Court in a democratic republic — Justice Sonia Sotomayor. Sotomayor actually “gets it right” in an amazing number of cases and usually explains her reasoning in coherent, non-legalistic terms that most folks can understand. 

But, sadly, I find relatively little in Coney Barrett’s career to predict that type of self-awareness, intellectual honesty, moral courage, and capacity for human growth. Her family situation shows some capacity for empathy and human understanding. 

But, sadly, to date, she evidently has been unable to “connect the dots” between her kids’ lives and futures and the future of humanity. To understand that but for the grace of God, the refugee she is expelling based on BS non-defects could be someone she actually loves or regards as human. That the benefits that neo-Nazi Stephen Miller is unethically and illegally stripping from deserving immigrants could be the lifeline that, but for life’s quirks, would allow her, her family, or other loved ones to survive and achieve their full human potential. The capacity to function as a real jurist certainly is there, but the will and perspective seem to be largely lacking.

In a way, Coney Barrett’s squandered potential to achieve good is her own human tragedy. But, one for which those “other than Coney Barrett” are likely to pay the ultimate price.

WASHINGTON – The Supreme Court on Tuesday temporarily allowed the Trump administration to end its 2020 census count earlier than planned, a move that could result in undercounting racial and ethnic minorities and others in hard-to-reach communities.

The Commerce Department had asked the justices to block a lower court ruling that barred the administration from stopping the head count on Oct. 5. The administration had sought to stop counting in order to determine the number of House seats and electoral votes each state gets for the coming decade by Dec. 31, before Trump might have to leave office.

While the decision was unsigned, Associate Justice Sonia Sotomayor registered her dissent. She said “meeting the deadline at the expense of the accuracy of the census is not a cost worth paying.”

So, two months wouldn’t be long enough for the USG to get the results to Trump? Gimme a break! And, since when does the most lawless Administration in history lose sleep about missing a statutory deadline? Incredible! But, hardly unexpected from a Court that “belongs” to a political party and makes little attempt to hide it. 

Interestingly, however, Justices Breyer and Kagan also “took the day off” on this one. That left Justice Sotomayor as the sole defender of an honest census count.

Justice Sotomayor’s dissent says it all:

While the decision was unsigned, Associate Justice Sonia Sotomayor registered her dissent. She said “meeting the deadline at the expense of the accuracy of the census is not a cost worth paying.”

“The harms caused by rushing this year’s census count are irreparable,” Sotomayor wrote. “And respondents will suffer their lasting impact for at least the next 10 years.”

Of course, the “irreparable harm” will skew things illegally in favor of the GOP for the coming decade. But, that’s the point of a politically weaponized Supremes! And, you can bet that Justice Barrett will do everything possible to advance the GOP program of shafting communities of color and majority-Democrat jurisdictions while seeking to maintain GOP minority control of government!

Vote ‘Em out, vote ‘Em out! At every level of Government, the GOP and their ideological judges are committed to unrelenting corruption, inequality, destroying democracy, and forcing an extreme right-wing agenda on the majority of Americans!
