John Reeves reviews Ty Seidule’s “Robert E. Lee & Me” in WashPost:

January 1872, Jubal Early, a former Confederate corps commander, delivered an address at Washington and Lee University in Lexington, Va., to honor Robert E. Lee, who had recently died. Believing that Lee was one of the finest military leaders in history, Early declared, “Our beloved Chief stands, like some lofty column which rears its head among the highest, in grandeur, simple, pure and sublime, needing no borrowed lustre; and he is all our own.” In subsequent years, Early and several elite ex-officers would deify Lee while creating the Lost Cause interpretation of the Civil War. According to that view, the war wasn’t about slavery but rather states’ rights. And the North won only because of its superior resources. An additional tenet is that Lee was the greatest soldier in the war on either side.

At the same time the Lee myth was being created, former rebels began reinforcing white supremacy all across the South. In Walton County, a rural community in Georgia, the Ku Klux Klan terrorized freedmen after the war. In 1871, Jake Daniels, an African American blacksmith from the county, was killed by 20 disguised men after refusing to repair a buggy for a White man, who still owed him money from previous jobs. The Klansmen showed up at Daniels’s door in the middle of the night. Daniels went outside but quickly recognized the danger. He tried to reenter his house but was shot in the back of the head. The men then shot him five or six more times before leaving the scene.

This type of violence was not uncommon in the South in the 19th and 20th centuries. In Georgia alone, 589 people were lynched between 1877 and 1950. As Ty Seidule writes in his powerful new book, “Robert E. Lee and Me,” “If Lee and Confederate worship created one side of the white supremacy coin, violent terror to enforce racial domination provided the other side.”

Seidule tells the story of his transformation from a believer in the Lost Cause to a critic. Growing up in Virginia and Georgia, he worshiped Lee. It was only later, as the head of the history department at the U.S. Military Academy, that he discovered the truth about Confederate myths. Seidule writes: “I grew up with a lie, a series of lies. Now, as a historian and a retired U.S. Army officer, I must do my best to tell the truth about the Civil War, and the best way to do that is to show my own dangerous history.”

Seidule has written a vital account of the destructiveness of the Lost Cause ideology throughout American history. He shows how films, textbooks and memorials promoted white supremacy by glorifying traitors and enslavers like Lee and other Confederate leaders. Perhaps the best attribute of this fine book is the author’s honesty. When talking of his personal metamorphosis, he vows to “quit hiding behind the impartial, know-it-all historian and open up about the southerner, the boy who grew up on Lee idolatry, and the man who wrapped his identity around the heroes of the Confederacy. Be honest. Be vulnerable. Above all, tell the truth.”

It’s never too late for the truth. 

Lots of White folks still have the audacity to be upset and offended because “their” factionalized account of U.S. history — one that even those of us who grew up in the North were fed to a large extent — is (finally and incrementally) being replaced with a more accurate accounting of the truth, unhappy as facing it sometimes can be. 

“Their” myths and false narratives are more important than the many African-American lives and futures snuffed out by racism. Shows that BLM has it right — the myths and fabricated visions of the past so integral to the White self-esteem of many are more important than the lives and futures of African-Americans snuffed out by institutionalized racism, much of it perpetrated by our Government and our legal system.

A frank accounting of our past, the good, the bad, and the ugly, is a necessary step to our moving forward as a nation.

On her last day at the justice department in 2017, Vanita Gupta considered taking a picture as she left the agency’s headquarters on Pennsylvania Avenue. But she decided against it. Gupta, the outgoing head of the department’s civil rights division, once described as the “crown jewel” of the agency, didn’t really want to remember the moment, she told a reporter who was shadowing her for the day.

Jeff Sessions, then the incoming attorney general, was poised to unwind much of the painstaking progress Gupta, 46, and her colleagues had spent the last four years building. It was no secret that Sessions opposed the kind of court agreements the justice department used to fix unconstitutional policing policies across the country (“dangerous” and an “exercise of raw power” in Sessions’ eyes). Nor were there any illusions that Sessions would try very hard to enforce the Voting Rights Act, already on its last legs after the supreme court gutted a key provision in 2013 (Sessions described the landmark civil rights law as “intrusive”).

Many of those concerns came to pass. Trump’s justice department not only did little to enforce some of the country’s most powerful civil rights protections for minority groups, but in several cases it opposed them. It filed almost no voting rights cases and defended restrictive voting laws, tried to undermine the census, challenged affirmative action policies, sought to roll back protections for LGBTQ+ Americans, and limited the use of consent decrees to curb illegal policing practices. Gupta took a job as the head of the Leadership Conference on Civil and Human Rights, a coalition of civil rights groups across the country, where she became one of the leading figures pushing back on the Trump administration.

Joining Gupta in that effort was Kristen Clarke, a 47-year-old former justice department lawyer who leads the Lawyers’ Committee for Civil Rights Under Law, founded in 1963 to help attorneys in private practice enforce civil rights. As her group filed voting rights and anti-discrimination lawsuits across the country over the last few years, Clarke spent hours nearly every election day briefing journalists on reports of incoming voting problems. Reports of long lines, voting machine malfunctions, translator issues – no problem was too small. The monitoring sent a message that civil rights groups would move swiftly against any whiff of voter suppression.

Now, after years of leading the fight for civil rights from outside the justice department, both women are poised to return to its top levels, where they can deploy the unmatchable resources of the federal government. Last month, Joe Biden tapped Gupta to serve as his associate attorney general, the No 3 official at the department, and Clarke to lead the civil rights division. If confirmed by the Senate, Gupta would be the first woman of color to be the associate attorney general; Clarke would be the first Black woman in her role.

“They are both independently legit civil rights champions with a long deep history,” said Justin Levitt, who worked with Gupta at the justice department and knows both women well. “They’re going to make a really spectacular, really powerful team.”

Picking two career civil rights lawyers for two of the top positions at the justice department sends an unmistakable signal that civil rights enforcement will be a top priority for the agency over the next four years. Civil rights leaders said they could not remember a prior administration in which two of the department’s highest positions were filled by civil rights attorneys, especially two such as Clarke and Gupta.

“It’s going to be really important and energizing and exciting to be able to be in conversation and discussion with people who understand the department’s role in civil rights enforcement,” said Sherrilyn Ifill, president and director-counsel of the NAACP Legal Defense and Educational Fund (LDF), who has worked closely with both women. “But it’s also going to be exciting, and as a matter of resources, to have the department actually do civil rights enforcement.”

Here are the “keys to success:”

  • There can be neither racial justice nor equal justice in America until migrants are not only fully recognized as “persons” under our Constitution, but actually treated as such (as opposed to the active “dehumanization” and “Dred Scottification” of migrants and persons of color by the Trump regime and the GOP majority on the Roberts’ Court);
  • You can’t possibly “win the game” with the same players who “batted for the White Nationalists” over the past four years.

And, speaking of “Jewel in the Crown.”👑 That’s exactly how many of us in the “Round Table of Former Immigration Judges” 🛡⚔️ once viewed EOIR. The “EOIR Vision” was: “Through teamwork and innovation be the worlds’s best tribunals, guaranteeing fairness and due process for all.” 

So, Vanita, and I hope Kristen also, can imagine the anger and determination to fight with which our Round Table viewed the dismemberment of due process and weaponization of the Immigration Courts under Sessions, Whitaker, and Barr. From aspiring to be the “world’s best tribunals” to “Star Chambers” and a grotesque, dysfunctional national disgrace!

On the plus side: Both Gupta and Clarke are the daughters of immigrants. Both have written and advocated for immigrants’ rights as part of their civil rights leadership.

Caution. Obama Attorneys General Eric Holder and Loretta Lynch were “facially aggressive” on protecting voting rights and police reforms. Yet, at the same time they: helped DHS set deportation records; allowed EOIR to spiral toward dysfunction (to a large extent through failure to procure and properly manage resources and an indolent judicial hiring program that was both “closed and non-diverse in nature” and glacial in operation (2 years to fill an average judicial vacancy!)); supported “baby jails,” the “family gulag,” and toddlers representing themselves on asylum cases in Immigration Court; looked the other way as private prisons treated asylum seekers and migrants worse than convicted criminals; and “went along to get along” with the Administration’s misuse of the Immigration Courts as (a highly ineffective) deterrent to applications for asylum.   

Sessions, Whitaker, and Barr might have been the “Kings of Aimless Docket Reshuffling” at EOIR that helped produce an astounding 1.3 million case plus “backlog.” But, it started in earnest under the Obama Administration.

That’s what I mean by the “two headed policy:” arguing for voting rights for minorities in one courtroom while simultaneously ignoring the human and civil rights of migrants in the next courtroom. Arguing for the right to vote in one case, while arguing (apparently with a straight face) that toddlers who can’t speak English have no right to legal representation in the next case.

Not only that, but with the Biden Administration apparently looking to rapidly fill upcoming Article III vacancies, the Obama DOJ’s mishandling of the Immigration Courts has deprived President Biden of the chance to draw from a diverse group of younger, progressive Immigration Judges whose practical scholarship, commitment to human rights and due process, courage, and proven ability to function in a “high stress” judicial setting would make them strong candidates for the now-reeling Article III Judiciary.

That’s certainly not to say that there aren’t some potential progressive candidates for the Article III Judiciary among today’s present, and particularly recently “retired,” (some essentially “forced out” at relatively young ages as a “matter of conscience”) Immigration Judges. There are! But, only a fraction of the number there would have been if the Obama Administration had taken the Immigration Courts with proper seriousness. 

And, that’s leaving aside the lives that could have been saved and better jurisprudence that could have been “institutionalized” with better, merit-based, judicial selections at EOIR during the Obama Administration!

I sincerely hope that Vanita Gupta and Kristen Clarke can help Judge Garland get the job done at Justice. The “human rights/immigration world” will be cheering for you. Getting some of the folks from the New Due Process Army (“NDPA”) into key positions at EOIR and the rest of the DOJ will be an “early signal” of whether or not “Team Garland gets it.” 

Removing McHenry at EOIR was a good start! But, it’s only a small step in what has to be done to make racial justice and immigrant justice a reality at the DOJ. The “brooms and plungers” 🧹🚽 need to come out, and the sweeping and plunging has to be quick and widespread.    

On the other hand, there is “no patience for another Obama Administration” out here in the real world. Every day, EOIR and DOJ are killing folks, ruining lives, and abusing the brave and dedicated attorneys of the NDPA! If the rhetoric doesn’t produce short term results and drastic improvements, you can expect the same type of aggressive litigation from the NDPA that stopped the defeated regime from completely destroying the U.S. justice system.

JUSTICE SOTOMAYOR, dissenting from the denial of appli- cation for stay.

Alex Francois is a 61-year-old Haitian national who came to the United States unlawfully when he was 19 and has lived here ever since. Francois suffers from severe mental illness, including schizophrenia, bipolar disorder, and psy- chosis. He presents compelling evidence that, if he is re- moved to Haiti, he will be targeted for cruel and dehuman- izing mistreatment because of his mental illness. An Immigration Judge (IJ) therefore granted Francois with- holding of removal in 2019, guaranteeing that he would not be sent to Haiti. That should have been the end of this case.

Instead, Francois now faces imminent removal to Haiti. Rather than deferring to the IJ’s factual findings, as the law requires, the Board of Immigration Appeals (BIA) ig- nored them and remanded the case back to the IJ for fur- ther factfinding. On remand, the IJ reviewed the very same evidentiary record on which it had previously relied to grant Francois relief. This time, however, the IJ denied Francois withholding of removal, contradicting not only its prior decision but also key evidence that the IJ claimed to be crediting. The BIA dismissed Francois’ appeal.

before the Court of Appeals for the Fifth Circuit. The Gov- ernment, however, plans to remove Francois before he can even submit his opening brief. This is exactly the kind of circumstance that calls for a temporary stay of removal. Francois is likely to prevail on appeal; he will suffer irrepa- rable harm absent a stay; and the public interest strongly favors protecting Francois from wrongful removal and the terrible suffering awaiting him in Haiti. Yet, without ex- planation, the Fifth Circuit denied a stay. Today, this Court does the same. I dissent.

I

Francois came to the United States in 1979 to reunite with his father, a Haitian exile who became an American citizen. Francois spent much of his life in New York City, where he worked in construction and raised a family, in- cluding six children. Two of his children went on to serve in the U. S. Army, including one who deployed to Afghanistan.

According to his father, Francois’ struggles with mental illness began in his midforties. He experienced delusions, irritability, and aggression, and as his condition deterio- rated, he engaged in unusual behavior such as eating grass and drinking his own urine. Francois also developed a lengthy criminal history, which appears to stem from the effects of his illnesses. He has been hospitalized numerous times, and he is currently being treated with psychotropic medication.

In 2018, the Government sought to have Francois de- clared removable from the United States because he was not lawfully admitted. The IJ sustained the charge of re- movability. But the IJ also deemed Francois mentally in- competent and allowed his attorney to apply for withhold- ing of removal on his behalf. Withholding of removal prevents the Government from removing a noncitizen to a

country where it is more likely than not that the nonciti- zen’s “life or freedom would be threatened” on account of a protected ground. 8 U. S. C. §1231(b)(3)(A). There is no dispute in this case that Francois’ mental illness is one such protected ground. See App. A to Application for Stay (IJ Decision, p. 5, n. 2).

To prove a likelihood of persecution, Francois submitted an expert declaration explaining that mental illness is poorly understood and stigmatized in Haiti. “[B]izarre, er- ratic and non-compliant behavior is often responded to with extreme physical punishment, torture, and isolation,” in- cluding locking the mentally ill in “crawlspaces or other tiny spaces.” App. K to Application for Stay 10. The IJ placed “great evidentiary weight” on the expert’s assess- ment, concluding that Francois more likely than not will be persecuted on account of his mental illness if removed to Haiti. App. A to Application for Stay (IJ Decision, at 5, n. 3). Specifically, as a deportee with a criminal record, Francois will face detention in an “overcrowded, disease-in- fested” prison “lacking in basic necessities such as plumb- ing and electricity.” Id., at 5. Because of his mental illness, Francois’ suffering will be “made worse” “due to lack of ac- cess to medication or treatment and extreme repressive measures such as physical punishment, torture and isola- tion.” Ibid. Even if Francois is not detained, his symptoms will more likely than not “attract the attention of Haitian authorities or private actors” whom the Haitian Govern- ment is unwilling or unable to control, “who will persecute him on account of ” his mental illness. Id., at 6. Accord- ingly, the IJ granted Francois withholding of removal.

The Government appealed to the BIA, arguing that the IJ “erred in finding” that Francois will likely be persecuted on account of his mental illness. App. B to Application for Stay 3. The BIA may not, however, “engage in de novo re- view of findings of fact determined by an immigration judge.” 8 CFR §1003.1(d)(3)(i) (2020). Instead, the BIA may

review such findings “only to determine whether the find- ings of the immigration judge are clearly erroneous.” Ibid. Under that standard, even if the BIA would interpret the evidentiary record differently, the BIA was required to de- fer to the IJ’s view of the evidence as long as it was “plausi- ble.” Anderson v. Bessemer City, 470 U. S. 564, 574 (1985).

Rather than attempting to find clear error, the BIA side- stepped the standard of review by implausibly concluding that the IJ had failed entirely to make certain critical fac- tual findings. The BIA remanded with instructions for the IJ to determine “whether [Francois] will be singled out in- dividually for persecution,” what “harm [Francois] is likely to suffer in Haiti,” and “whether such harm would be on account of his membership in his proposed particular social group” (i.e., the severely mentally ill). App. B to Application for Stay 2.

In reality, the IJ had already repeatedly concluded that Francois “will more likely than not be persecuted on ac- count of” his mental illness, including through “physical punishment, torture and isolation.” App. A to Application for Stay (IJ Decision, at 5–6, and n. 3). The IJ thus recog- nized the BIA’s order for what it was: an instruction to change those findings. “Reviewing the evidentiary record again, in light of the Board’s decision,” the IJ concluded that Francois would not likely be persecuted on account of his mental illness. App. C to Application for Stay (IJ Decision on Remand, at 4). The IJ admitted no additional evidence to justify its 180-degree turn; it simply recharacterized the old evidence. To take just one example, the IJ claimed on remand that Francois’ expert “opine[d] that future persecu- tion on account of [Francois’] mental health issue is possi- ble, while stopping short of saying that it is probable.” Id., at 6. In fact, as the IJ recognized in its first decision, the expert clearly found that “it is very likely that Mr. Francois will suffer serious and irreparable harm amounting to tor-

ture if deported to Haiti,” and that “both his criminal depor- tee status and mental illness are likely to result in vio- lence.” App. K to Application for Stay 30–31.

Francois appealed to the BIA. The BIA acknowledged “extensive evidence in the record of the mistreatment of the mentally ill [in Haiti,] particularly when detained or hospi- talized.” App. D to Application for Stay 4. It also noted the expert’s use of phrases like “‘often,’” “‘routinely,’” and “‘more likely’” to describe the probability of harm to the mentally ill. Id., at 2–3. But this time, the BIA concluded that it was bound by the clear-error standard to respect the IJ’s findings and dismissed Francois’ appeal.

On December 1, 2020, Francois filed a petition for review with the Fifth Circuit. On December 16, the Government notified Francois that he would be removed to Haiti on De- cember 22, just six days later. Francois requested a stay of removal from the Fifth Circuit so that he could complete his appeal. Without explanation, the Fifth Circuit denied a stay. App. I to Application for Stay. It then set a briefing schedule beginning in February 2021.

Francois now seeks a stay of removal from this Court.

II

“It takes time to decide a case on appeal,” and “if a court takes the time it needs, the court’s decision may in some cases come too late for the party seeking review.” Nken v. Holder, 556 U. S. 418, 421 (2009). This is such a case. If Francois is removed to Haiti as the Government intends, he will suffer extreme harm before any federal court has had an opportunity to address his claims for relief.

Courts have an important tool for addressing such a sit- uation: the power to issue a temporary stay. A stay “allows an appellate court to act responsibly,” preventing the need for “justice on the fly” or, worse, the denial of justice alto- gether. Id., at 427. The decision to issue a stay is guided by four factors: “ ‘(1) whether the stay applicant has made a

strong showing that he is likely to succeed on the merits; (2) whether the applicant will be irreparably injured absent a stay; (3) whether issuance of the stay will substantially in- jure the other parties interested in the proceeding; and (4) where the public interest lies.’” Id., at 434. The first two factors “are the most critical.” Ibid.

Under this standard, Francois is plainly entitled to a stay. Most importantly, he has shown a strong likelihood that his appeal will succeed on the merits. As the IJ origi- nally recognized, the record clearly proves that Francois more likely than not will be persecuted on account of his mental illness if removed to Haiti. In its first decision re- manding the case, the BIA abused its discretion by ignoring the IJ’s findings. See, e.g., Vitug v. Holder, 723 F. 3d 1056, 1064 (CA9 2013) (finding an abuse of discretion where “the BIA ignored factual findings of the IJ that were key to the IJ’s holding”). Exacerbating the BIA’s error, the IJ on re- mand issued a decision that is entirely unsupported by the record. The expert, whom the IJ credited, was clear: Fran- cois “will be specifically targeted for violence by prison and police officials, over and above the usual harsh treatment of Haitian criminal deportees, when—as his psychiatric rec- ords show—he exhibits symptoms of his mental conditions that will be disturbing and disruptive.” App. K to Applica- tion for Stay 31.

For the same reasons, Francois has shown that he will suffer irreparable harm absent a stay. As the BIA acknowl- edged, if removed to Haiti, Francois “will not receive the treatment he needs for his mental illness,” and he “will be detained” in “deplorable” conditions where “extreme repres- sive measures are used against detainees.” App. D to Ap- plication for Stay 1. As his mental condition deteriorates, he will fall prey to the very persecution that entitles him to relief on appeal.

Finally, the public interest weighs heavily in Francois’ fa-

vor. The public has a strong interest in preventing nonciti- zens from being wrongfully removed, “particularly to coun- tries where they are likely to face substantial harm.” Nken, 556 U. S., at 436; see also Yusupov v. Attorney Gen. of U. S., 650 F. 3d 968, 977 (CA3 2011) (explaining that withholding of removal effectuates the United States’ treaty commit- ment to protect refugees). That interest is heightened be- cause Francois is currently receiving medical treatment and is supported here by his family. The Government has offered no compelling reason that Francois should be robbed of these critical lifelines before he has had a chance to be heard in court.

In light of the foregoing, the Fifth Circuit’s decision to deny a stay was an abuse of its discretion. See Dada v. Mukasey, 554 U. Also, this farce is additional evidence that the biased, unfair, legally deficient, and unconstitutional EOIR Clown Show 🤡🦹🏿‍♂️ has got to go on “day one” of the “Garland DOJ.” That’s something that the incoming Administration does have complete power to solve, and must do so! President-elect Joe Biden will roll out a sweeping overhaul of nation’s immigration laws the day he is inaugurated, including an eight-year pathway to citizenship for immigrants without legal status and an expansion of refugee admissions, along with an enforcement plan that deploys technology to patrol the border.

Biden’s legislative proposal, which will be sent to Congress on Wednesday, also includes a heavy focus on addressing the root causes of migration from Central America, a key part of Biden’s foreign policy portfolio when he served as vice president.

The centerpiece of the plan from Biden and Vice President-elect Kamala D. Harris is the eight-year pathway, which would put millions of qualifying immigrants in a temporary status for five years and then grant them a green card once they meet certain requirements such as a background check and payment of taxes. They would be able to apply for citizenship three years later.

The focus on Central America reflects the message that Biden has relayed to senior officials in the region: that he will advocate for policy changes aimed at what drives scores of migrants there to come to the United States illegally to seek safe harbor.

“Ultimately, you cannot solve problems of migration unless you attack the root causes of what causes that migration,” one official said, pointing to the various reasons — from economic to safety — that drive migrants to flee their home countries. “He knows that in particular is the case in Central America.”

Transition officials are aware of recent reports of the increased numbers of migrants at or heading to the border in anticipation of the end of Trump’s presidency, and urged them to stay in their home countries. They emphasized that newly arriving immigrants would not qualify for the legalization program that Biden proposes.

Biden wants to move the refugee and asylum systems “back to a more humane and orderly process,” the official said. But “it’s also been made clear that that isn’t a switch you flip overnight from the 19th to the 20th, especially when you’re working with agencies and processes that have been so gutted by the previous administration.”

Biden hopes to reinstate a program granting minors from Central America temporary legal residence in the United States. The Trump administration terminated the program in August 2017, officials said. The administration also wants to set up a reunification program for Central American relatives of U.S. citizens that would allow those who have been already approved for U.S. residency to be admitted into the country, rather than waiting at home for an opening. The program would be similar to ones that existed for Cubans and Haitians but also were ended by the Trump administration.

The Biden proposal also would put in place a refugee admissions program at multiple processing centers abroad that would better help identify and screen those who would qualify to be admitted as refugees into the United States.

As for border enforcement, the plan calls on the Department of Homeland Security to develop a proposal that uses technology and other similar infrastructure to implement new security measures along the border, both at and between ports of entry. Biden has long vowed not to expand the border wall Trump has marginally extended.

“This is not a wall; this is not taking money from [the Department of Defense],” a transition official said, referring to how Trump helped to finance his wall after pledging Mexico would pay for it. “It’s a very different approach.”

This is a welcome change from the poorly conceived, often ill-informed approach to immigration by the Obama Administration. It appears that Biden and Harris have actually “listened to the experts” and acted a accordingly.

The concentration on addressing the reality of Central American migration and dealing honestly and constructively with its root causes in a sensible and humane way is also refreshing. Using intelligence and technology to address real border security issues (as opposed to squandering resources on politically manufactured ones) also shows promise.

Many of the latter were  energized by the Trump/DHS program of White Nationalist racist fear-mongering and intentionally false anti-immigrant, anti-due-process narratives. That’s what “applied malicious incompetence” looks like — DHS and EOIR are two of the most egregious examples in a regime that raised it to an “art form.” It will take an aggressive and far-reaching “house cleaning” to get these agencies that have abandoned the common good and now operate “on the dark side” back on track.

The immediate “knee-jerk opposition” to rational, practical, fact-based immigration reform by notorious White Nationalist racist Sen. Tom Cotton (R-ARK) shows that Team Biden is on the right track to disavow the toxic institutionalized racism and biased policies of the Trump regime and move America along the path to racial justice and realistic, progressive immigration policies that will further the national interest and lead to a better future for all!

It’s a great, if long overdue, start to getting beyond Jim Crow and “Dred Scottification” and saving and enhancing our democracy! But, the proof will be in the results!

Biden, of course, will also face the formidable challenges of dealing with the human carnage left behind by the Trump regime’s disastrous mis-handling of COVID-19, economic inequality, the environment, racial justice, and foreign policy where American “prestige” has plummeted to levels not seen since the days of the Barbary Pirates.

He also must address a failing Federal Justice System that, particularly at its appellate levels, did not effectively stand up to the Trump regime’s  unrelenting assault on human decency and American democracy. The GOP majority’s disgraceful failure to stand up for voting rights of African Americans, Latinos, and other voters of color has also deepened racial injustice in America and helped usher in a horrible “Jim Crow Revival” pushed, incited, and enabled by the GOP, “The Party of the Failed Insurrection.”

URGING A SPEEDY REVERSAL ON ASYLUM POLICIES

 

The Biden administration has said it may need 6 months to reverse Trump administration asylum policies and bring asylum seekers stranded in Mexico to safety. Tragically, some may not survive that long.

 

In her newest blog post, Legal Fellow Julia Neusner presents a heartbreaking portrait of the violence, discrimination, and trauma asylum seekers have endured under the Trump administration’s policies.

 

Julia writes about victims of these policies, including Ana and Jorge, an Afro-Cuban couple who were kidnapped after US border officers expelled them to Mexico under MPP. Armed men robbed them and forced them into a room covered in blood. Other kidnapping victims were moaning on the floor, some with severed body parts.

 

“They told us [a friend] would have to pay $4,000 for both of us, and if he didn’t, they would cut us up, part by part,” Ana recalled. “I lost control and started crying. My boyfriend pleaded with them, and they hit him with a gun. Then they beat me. It was horrible. We spent these days in hell.”

 

SETTING THE RECORD STRAIGHT ON ASYLUM

 

On Wednesday, President Trump travelled to the southern border to tout his immigration record. In response, Human Rights First released a fact sheet outlining the Trump administration’s record on asylum: one defined by chaos, cruelty, and illegality.

 

From separating over 5,500 families to delivering people to life-threatening danger in Mexico to spurring the spread of COVID-19 by refusing the repeated pleas of epidemiologists to release asylum seekers and immigrants from detention, Trump’s real record is deep damage our asylum system.

A key to “setting the record straight on asylum” is immediate removal of the “EOIR Clown Show” 🤡🦹🏿‍♂️ in Falls Church, a retraction of the gross lies and misleading anti-asylum, anti-lawyer narratives set forth in their White Nationalist nativist “Bogus Fact Sheets,” immediately cancelling the insane anti-due process, anti-lawyer procedures now in place, and setting the record straight on asylum law, including the toxic, unethical, and unconstitutional role of EOIR in actively undermining the legal rights and humanity of asylum seekers as well as being responsible for gross mismanagement of the Immigration Courts.

There are folks out there in the private/NGO/academic community who can get the job done, starting day one! Yeah, there are many other priorities; that’s a beyond compelling reason for bringing in the experts and empowering them to solve the problems, sooner rather than later! There really is no viable “later” here! 

We simply don’t have six months to stop killing people and violating human rights on a daily basis! If we don’t make radical changes and take some calculated risks to end the abuses and mismanagement at EOIR, the SG’s Office, and DHS right off the bat, it will be too late for too many!

Maybe Judge Garland and his Executive Team need to spend a few days with some immigration practitioners and NGOs right now to see what’s happening in the “Star Chambers impersonating courts” that they will “own” in a few weeks. Maybe they should spend some time in the squalid migrant camps in Mexico, seeing what existence is really like for those to whom we have shirked our legal and moral responsibilities. 

Ask themselves, would THEY subject THEIR families to such mistreatment? If not, then why hasn’t a plan been announced to end the deadly “EOIR Clown Show” 🤡🦹🏿‍♀️☠️ immediately and put some legitimate judges and competent managers who understand asylum law and immigration practice in place?

Judge Garland, with all due respect, when the incoming Administration tells lawyers, many working pro bono or low bono, who are risking their lives to save their clients’ lives in the “living Hell” of today’s U.S. Immigration Courts  to “be patient, we’ll get to you soon,” you are giving them a very clear and chilling message: THEIR LIVES, SAFETY, AND SANITY AREN’T YOUR PRIORITY — I/O/W, THEIR LIVES DON’T MATTER! 

That’s neither an appropriate nor uplifting message to give to an embattled group whose support, assistance, ideas, creativity, and energy will be absolutely essential to your plans to “restore justice to Justice!”

The sad truth is that time does not, in fact, “heal all wounds,” and failures that kill and damage people for life can’t be “undone,”

E.A.’s mother’s recent childbirth is a serious medical event, which coupled with E.A.’s minor age, her difficulty obtaining transportation, and her difficulty navigating the immigration system without assistance, constitute “exceptional circumstances” necessitating rescission of the in absentia removal order. … The BIA’s decision was also contrary to law, and therefore an abuse of discretion. … First, the BIA improperly considered E.A.’s age separately, rather than considering age alongside other factors, when determining that she had not shown that exceptional circumstances justified her failure to appear. Second, the BIA erred when it dismissed without adequate explanation E.A.’s evidence that she is eligible for SIJS. “Salim Al Amiri, an Iraqi citizen, seeks relief from removal on the grounds of asylum, withholding of removal, and protection under the United Nations Convention Against Torture (“CAT”). He premises his requests for such relief on the harm that he fears that he would be subjected to in Iraq at the hands of members of Iraq’s military or civilian insurgents operating in that country. Al Amiri contends that he has reason to fear he would be subjected to that harm on account of his work as a paid contractor for the United States Army during the war in Iraq, as in that role he educated U.S. soldiers about Iraqi customs and practices as they prepared for their deployment. We vacate and remand the ruling of the Board of Immigration Appeals (“BIA”) denying his claims for asylum and withholding of removal, but we deny his petition insofar as it challenges the BIA’s ruling rejecting his CAT claim.”

  • Congrats to all involved!
  • Think how much better this system would function with expert  judges who treated asylum applicants fairly from the “git go,” granted protection wherever possible in accordance with the the Refugee Act of 1980 and the (more “woke”) Supremes’ precedent in Cardoza-Fonseca, provided clear, positive guidance on how valid claims could be documented and granted, and promoted and consistently applied best practices to achieve efficiency with maximum due process.
  • At first glance, although the issue is reopening rather than a continuance, E.A.C.A. undercuts McHenry’s nativist, insanely wasteful, and totally dishonest attempt to “raise the bar” for routine continuances for asylum applicants who need time to properly document and prepare their cases.
  • The “Deny – Deny Program” — deny due process, deny relief — that infects EOIR’s “Star Chambers” (impersonating “courts”) is a huge backlog builder that kills people and screws up Court of Appeals dockets in the process. 
  • Reopening cases that should be reopened, getting to the merits, and getting the many properly grantable asylum cases represented, documented, and prioritized would be a huge step in reducing EOIR’s largely self-created and unnecessary “bogus backlog.” 
  • Ultimately, many of the clearly grantable asylum cases being mishandled and wrongly denied at EOIR, at great waste of time and resources, not to mention unnecessary human trauma, could, with real expert judges at EOIR setting and consistently enforcing the precedents, be granted more efficiently and expeditiously at the Asylum Office and ultimately shifted to a more robust and properly run Refugee Program.
  • In the longer run, once EOIR is redesigned and rebuilt as a proper court with real, independent, expert judges, it might be appropriate to place the Asylum Offices under judicial supervision, given the grotesque abuses and corrupt, perhaps criminal, mismanagement of the Asylum Offices by USCIS toadies carrying out the regime’s racist, White Nationalist, unconstitutional agenda of hate and waste.
  • NOTE TO JUDGE GARLAND👨🏻‍⚖️: Please fix the EOIR mess, Your Honor, before it brings you and the entire US justice system crashing down with it! This is a national emergency, and a damaging national disgrace, NOT a “back burner” issue!

Greetings,

 

Sharing this win, E. A. C. A. v. Jeffrey Rosen, out of the CA6 by my amazing colleague Rachel Naggar who manages our BIA Pro Bono Project. This was an appeal of an IJ (Memphis) denial of an in absentia motion to reopen for a 13-year old unaccompanied child.

 

Interestingly, after oral argument, OIL filed a motion to remand the case (which Rachel opposed) and the CA6 denied that motion. Seems the CA6 really wanted to issue a decision on the merits and we are grateful for the decision. Here are some highlights from the decision:

 

SIJS

·       “Notably, the IJ’s decision does not mention E.A.’s claims that she was eligible for SIJS.”

·       FN 1: “As of the December 2020 Visa Bulletin, visas are available for special immigrants (category EB4) from El Salvador to adjust their status if their priority date is prior to February 2018. If DHS removes E.A. prior to approving her visa, she will be unable to apply for adjustment of status. See 8 U.S.C. § 1101(a)(27)(J).”

 

Totality of the Circumstances

·       “Based on the totality of the circumstances, including E.A. mother’s recent childbirth, E.A.’s young age, E.A.’s mother’s failed attempts to obtain counsel to help change the address of E.A.’s hearing, and E.A.’s inability to travel from New York to Memphis for the hearing, we hold that E.A. established exceptional circumstances.”

·       “Under the totality of the circumstances, E.A.’s young age is an important factor in determining whether exceptional circumstances exist.”

 

Exceptional Circumstances

·       “E.A.’s mother’s recent childbirth is a serious medical condition that supports reopening. The statute defining ‘exceptional circumstances’ that justify reopening an immigration proceeding lists the ‘serious illness of the alien, or serious illness or death of the spouse, child, or parent of the alien’ as an example. 8 U.S.C. § 1229a(e)(1). Childbirth is a serious medical event that necessitates a recovery period.”

·       “Instead of recognizing that childbirth is a serious medical condition, the BIA minimized the seriousness of childbirth and its impact on E.A.’s mother’s ability to bring E.A. to Memphis. […] Recovery from childbirth is exactly the type of circumstance that § 1229a(e)(1) was intended to cover.”

 

Prima Facie Eligibility

·       “Finally, the BIA erred by stating that E.A. was required to prove prima facie eligibility for immigration relief. The BIA’s decision improperly states that E.A. is required to show at this stage prima facie eligibility for relief. The statute governing motions to reopen removal orders entered in absentia provides that the petitioner must ‘demonstrate[] that the failure to appear was because of exceptional circumstances.’ 8 U.S.C. § 1229a(b)(5)(C). In general, we have stated that ‘[a] prima facie showing of eligibility for relief is required in motions to reopen.’ Alizoti, 477 F.3d at 451–52. In the case of a motion to rescind a removal order entered in absentia, however, the BIA has held that ‘an alien is not required to show prejudice in order to rescind an order of deportation” or removal. In re Grijalva-Barrera, 21 I. & N. Dec. 472, 473 n.2 (BIA 1996); see also In re Rivera-Claros, 21 I. & N. Dec. 599, 603 n.1 (BIA 1996). This is consistent with the statute governing motions to rescind removal orders entered in absentia, 8 U.S.C. § 1229a(b)(5)(C), which does not list a showing of prima facie eligibility for relief from removal as a requirement to rescind in absentia removal orders. Rivera-Claros, 21 I. & N. Dec. at 603 n.1; see also Galvez-Vergara v. Gonzales, 484 F.3d 798, 803 n.6 (5th Cir. 2007) (declining ‘to affirm the IJ’s decision on the grounds that [the petitioner] has not shown that he was prejudiced by his counsel’s performance’ because ‘In re Grijalva-Barrera, 21 I. & N. Dec. at 473 n.2, provides that an alien need not demonstrate prejudice for his counsel’s erroneous advice to constitute an ‘exceptional circumstance’ justifying rescission of an in absentia removal order’); Lo v. Ashcroft, 341 F.3d 934, 939 n.6 (9th Cir. 2003) (‘follow[ing] the BIA’s usual practice of not requiring a showing of prejudice’ to rescind an in absentia order of removal). We now join our sister circuits and hold that E.A. is not required to make a prima facie showing of eligibility for relief in order to obtain rescission under 8 U.S.C. § 1229a(b)(5) of the in absentia order of removal.”

It’s likely that the movement to hold accountable and remove from Congress traitors like Cruz, Hawley, McCarthy, and the other Republicans who shamelessly and seditiously continued to support the anti-American lies, racist false narratives, and conspiracy theories that fueled Trump’s insurrection and domestic terrorism will die out over time. But, it shouldn’t!

As I write this, the GOP treasonists in the House are blocking what should be a unanimous resolution to invoke the 25th Amendment to remove this dangerous, unhinged, traitor/moron from the office he has abused and disgraced from Day One!

One reason why our democracy is on the ropes is that there hasn’t been any accountability whatsoever for Trump and his kakistocracy of thugs on the public payroll or for the GOP White Nationalist traitors and enablers in Congress who have furthered their grotesque abuses of humanity and our democratic institutions.

The lack of accountability is particularly glaring and disgusting for Trump’s lawyers, both in and out of Government, who have lied, misrepresented, and totally jettisoned ethics and “due diligence” in supporting and furthering Trump’s attacks on our democracy. Why is Rudy Giuliani, who led a coast to coast “conspiracy of lies and treason” in Federal and State Courts, before calling for armed rebellion against our Government, still walking free and “practicing” law? Why are Billy Barr, Gonzo Sessions, Don McGhan, Noel Francisco, and a host of others who lied, misrepresented, and abused their ethical obligations as well as their oaths of office happily ensconced in the private sector rather than being held accountable for their “crimes against humanity?” 

Contrary to all the total BS 💩being spread by GOP Trump toadies, the unconstitutional, racist, illegal, violent, anti-democracy agenda of Trump, Miller, and the rest of of the Thugocracy/Kakistocracy was apparent from the “git go.” 

And, Chief Justice Roberts and the other GOP Justices who helped roll out and encourage “Kristallnacht” by rubber-stamping the “Muslim ban,” “Let ‘Em Die In Mexico,” the “Bogus Wall of Misappropriated Funds,” stripping legal migrants of life-saving and health preserving benefits, helping fuel a DHS “reign of terror” directed at ethnic communities, and other neo-Nazi travesties should also tender their resignations to President Biden as of Jan 21, 2021! Intellectual dishonesty by judges and bad, righty biased (non)jurisprudence have real life consequences! 

Trump and Miller told the Supremes precisely what their invidious racist, religiously biased, politically pandering intent was in all of these cases and the GOP Justices ignored it in favor of bogus, fabricated, right wing, authoritarian, racist driven, anti-democracy agendas thinly camouflaged by legal gobbledygook.

People die and lives are ruined forever when judges who are supposed to protect them instead “take a dive” for the forces of tyranny and cruelty! “Dred Scottification” (“dehumanization”) of Blacks, Latinos, Immigrants, and other People of Color by our highest Court is neither acceptable nor should it be “swept under the rug” as has happened all too often when the Supremes fail democracy and align themselves with anti-democracy racists and authoritarians.

For four years, the GOP Justices on the Supremes have treated due process, democratic institutions, and the lives of asylum seekers and other migrants (and to some extent their pro bono lawyers) as “jokes.” That’s because 1) neither they nor their families are rotting in Mexico or facing torture and death in El Salvador or some other failed state; and 2) this time, the right wing thugs they enable were across the street trashing our Capitol rather than storming the Supremes. Better Justices and Better Federal Judges for a Better America!

  The lie outlasts the liar. 

The idea that Germany lost the First World War in 1918 because of a Jewish “stab in the back” was 15 years old when Hitler came to power. How will Trump’s myth of victimhood function in American life 15 years from now? And to whose benefit?

On Jan. 7, Trump called for a peaceful transition of power, implicitly conceding that his putsch had failed. Even then, though, he repeated and even amplified his electoral fiction: It was now a sacred cause for which people had sacrificed. Trump’s imagined stab in the back will live on chiefly thanks to its endorsement by members of Congress. In November and December 2020, Republicans repeated it, giving it a life it would not otherwise have had. In retrospect, it now seems as though the last shaky compromise between the gamers and the breakers was the idea that Trump should have every chance to prove that wrong had been done to him. That position implicitly endorsed the big lie for Trump supporters who were inclined to believe it. It failed to restrain Trump, whose big lie only grew bigger.

The breakers and the gamers then saw a different world ahead, where the big lie was either a treasure to be had or a danger to be avoided. The breakers had no choice but to rush to be first to claim to believe in it. Because the breakers Josh Hawley and Ted Cruz must compete to claim the brimstone and bile, the gamers were forced to reveal their own hand, and the division within the Republican coalition became visible on Jan. 6. The invasion of the Capitol only reinforced this division. To be sure, a few senators withdrew their objections, but Cruz and Hawley moved forward anyway, along with six other senators. More than 100 representatives doubled down on the big lie. Some, like Matt Gaetz, even added their own flourishes, such as the claim that the mob was led not by Trump’s supporters but by his opponents.

Trump is, for now, the martyr in chief, the high priest of the big lie. He is the leader of the breakers, at least in the minds of his supporters. By now, the gamers do not want Trump around. Discredited in his last weeks, he is useless; shorn of the obligations of the presidency, he will become embarrassing again, much as he was in 2015. Unable to provide cover for their gamesmanship, he will be irrelevant to their daily purposes. But the breakers have an even stronger reason to see Trump disappear: It is impossible to inherit from someone who is still around. Seizing Trump’s big lie might appear to be a gesture of support. In fact it expresses a wish for his political death. Transforming the myth from one about Trump to one about the nation will be easier when he is out of the way.

As Cruz and Hawley may learn, to tell the big lie is to be owned by it. Just because you have sold your soul does not mean that you have driven a hard bargain. Hawley shies from no level of hypocrisy; the son of a banker, educated at Stanford University and Yale Law School, he denounces elites. Insofar as Cruz was thought to have a principle, it was that of states’ rights, which Trump’s calls to action brazenly violated. A joint statement Cruz issued about the senators’ challenge to the vote nicely captured the post-truth aspect of the whole: It never alleged that there was fraud, only that there were allegations of fraud. Allegations of allegations, allegations all the way down.

The big lie requires commitment. When Republican gamers do not exhibit enough of that, Republican breakers call them “RINOs”: Republicans in name only. This term once suggested a lack of ideological commitment. It now means an unwillingness to throw away an election. The gamers, in response, close ranks around the Constitution and speak of principles and traditions. The breakers must all know (with the possible exception of the Alabama senator Tommy Tuberville) that they are participating in a sham, but they will have an audience of tens of millions who do not.

If Trump remains present in American political life, he will surely repeat his big lie incessantly. Hawley and Cruz and the other breakers share responsibility for where this leads. Cruz and Hawley seem to be running for president. Yet what does it mean to be a candidate for office and denounce voting? If you claim that the other side has cheated, and your supporters believe you, they will expect you to cheat yourself. By defending Trump’s big lie on Jan. 6, they set a precedent: A Republican presidential candidate who loses an election should be appointed anyway by Congress. Republicans in the future, at least breaker candidates for president, will presumably have a Plan A, to win and win, and a Plan B, to lose and win. No fraud is necessary; only allegations that there are allegations of fraud. Truth is to be replaced by spectacle, facts by faith.

Trump’s coup attempt of 2020-21, like other failed coup attempts, is a warning for those who care about the rule of law and a lesson for those who do not. His pre-fascism revealed a possibility for American politics. For a coup to work in 2024, the breakers will require something that Trump never quite had: an angry minority, organized for nationwide violence, ready to add intimidation to an election. Four years of amplifying a big lie just might get them this. To claim that the other side stole an election is to promise to steal one yourself. It is also to claim that the other side deserves to be punished.

Informed observers inside and outside government agree that right-wing white supremacism is the greatest terrorist threat to the United States. Gun sales in 2020 hit an astonishing high. History shows that political violence follows when prominent leaders of major political parties openly embrace paranoia.

Our big lie is typically American, wrapped in our odd electoral system, depending upon our particular traditions of racism. Yet our big lie is also structurally fascist, with its extreme mendacity, its conspiratorial thinking, its reversal of perpetrators and victims and its implication that the world is divided into us and them. To keep it going for four years courts terrorism and assassination.

When that violence comes, the breakers will have to react. If they embrace it, they become the fascist faction. The Republican Party will be divided, at least for a time. One can of course imagine a dismal reunification: A breaker candidate loses a narrow presidential election in November 2024 and cries fraud, the Republicans win both houses of Congress and rioters in the street, educated by four years of the big lie, demand what they see as justice. Would the gamers stand on principle if those were the circumstances of Jan. 6, 2025?

To be sure, this moment is also a chance. It is possible that a divided Republican Party might better serve American democracy; that the gamers, separated from the breakers, might start to think of policy as a way to win elections. It is very likely that the Biden-Harris administration will have an easier first few months than expected; perhaps obstructionism will give way, at least among a few Republicans and for a short time, to a moment of self-questioning. Politicians who want Trumpism to end have a simple way forward: Tell the truth about the election.

America will not survive the big lie just because a liar is separated from power. It will need a thoughtful repluralization of media and a commitment to facts as a public good. The racism structured into every aspect of the coup attempt is a call to heed our own history. Serious attention to the past helps us to see risks but also suggests future possibility. We cannot be a democratic republic if we tell lies about race, big or small. We cannot be a democratic republic if we tell lies about race, big or small. Democracy is not about minimizing the vote nor ignoring it, neither a matter of gaming nor of breaking a system, but of accepting the equality of others, heeding their voices and counting their votes.

Republican National Committee Chairwoman Ronna McDaniel was unanimously reelected on Friday for another term. Her message to the party: “I am mad and I’m not going to let socialism rule this country.”

Newsflash: It wasn’t the radical left that stormed the doors of the Capitol on Wednesday. It wasn’t the radical left that told a group of known white nationalists to “stand by” during a nationally televised presidential debate. It wasn’t the radical left that addressed the soon-to-be rioters and declared to members of Congress that “we’re coming for you.” It wasn’t the radical left who on the eve of the Capitol siege announced their plans to walk the path to sedition.

The only “radical” elements America sees now are the words and actions of the Republican Party. Yet Republicans have forever gotten away with throwing around the label “radical” to characterize the Democratic Party.

How many times in political ads have Republicans used the words “radical” and “dangerous” to describe their Democratic challengers? How many Fox News segments have Sean Hannity and friends devoted to the Democrats’ “radical extreme socialist agenda”?

What happened on Wednesday was an inevitable culmination of years of extreme and alarmist rhetoric from the Republican Party and their propaganda platforms. Watching Republicans act shocked that the people they have relentlessly and unapologetically pandered to for years is appalling.

With every tweet, every soundbite, every campaign ad, Republicans have been signaling to their supporters that it’s time to take matters in their hands. When you label something as “radical” or “extreme” or “dangerous,” you are telling people they need to defend themselves against a threat. You are telling them they need to be ready to fight. You are telling them their impulse to resort to violence and destruction is justified and righteous.

There is absolutely nothing radical or extreme about protesting racial inequality, social injustice and a culture of police brutality in America. There is nothing radical or extreme about speaking out for gender equality and women’s rights. There is nothing radical or extreme about advocating for universal healthcare coverage. There is nothing radical or extreme about supporting action to address the growing threat of climate change. There is nothing radical or extreme about wanting corporations to pay their fair share of taxes. There is nothing radical or extreme about embracing the need for gun reform in the wake of mass shootings. There is nothing radical or extreme about wearing a mask and social distancing amid a global pandemic that has taken the lives of more than 365,000 Americans.

The extremists are the ones who egged on the insurrectionists with four years of lies. Republicans may be abandoning the sinking Trump ship, but don’t let this 11th-hour maneuver fool you. That even after Wednesday’s events Republicans in Congress and in the media are still clinging to the “radical socialist agenda” narrative shows they haven’t changed — though they are scurrying to launder their tattered reputations.

Just watch how many of them will vote to support articles of impeachment if the Democrats bring those to the House floor next week.

For the women of the WNBA, the push to expel one of their league’s owners from office — and ultimately help tip the balance of the U.S. Senate — started with two words on a plain black T-shirt.

It was summer. Amid nationwide protests against racial injustice, Sen. Kelly Loeffler (R-Ga.), co-owner of the Atlanta Dream, had sent a letter to the league that denounced its support of the Black Lives Matter movement, parroting President Trump’s rhetoric as she fought to keep her seat.

Loeffler’s embrace of Trumpism had shocked those who had known her as an inclusive boss in a league dominated by Black women. But it appeared to be working: She was leading the crowded race, while one of her opponents, the Rev. Raphael Warnock (D), polled at only 9 percent.

Then WNBA players responded. They rejected Loeffler’s letter. And in early August, players from across the league, including those from her own team, wore shirts that read “VOTE WARNOCK.”

In the three days that followed, Warnock’s campaign raised more than $236,000 and added nearly 4,000 followers on Twitter. His support grew from there, catapulting him into a runoff with Loeffler. Jon Ossoff’s win in a race called Wednesday gave Democrats slim control over the Senate, with Vice President-elect Kamala D. Harris as the tiebreaking vote.

WNBA players, many of whom are overseas with international teams, spent Wednesday celebrating their assist — and wondering what it means for Loeffler’s future in the league.

“It’s a special moment for us because we’re constantly at the forefront of every issue, but we don’t get the respect we deserve,” said Washington Mystics guard Natasha Cloud, who opted out of this past season to focus on social justice causes. “Whether it’s on the court or off the court in our influence. You have a moment like this where you can’t say we didn’t help determine the outcome.”

Perhaps you’ve reserved some optimism for the whole “Barrett’s a mom and a Catholic so there must be some compassion there” thing. Sorry, but no. In her confirmation hearings, she spoke about how the George Floyd video was “very, very personal” for her family, and that she and her children “wept together” over what must have been the zillionth police murder in her history as a lawyer and mother. But her mentor, the late Antonin Scalia, seemed to think it was constitutional to put innocent people to death, despite his ultra-Catholicism. There’s no reason to believe that any sort of ideological consistency will prevail simply because of a judge’s familial status or bizarre metaphysical beliefs, and those factors made no apparent difference in Brad’s case.

Here’s where this gets complicated: In saying that being part of this horrendous decision should disqualify a judge from serving on the Supreme Court, by extension, I’m saying that damn near every federal judge is similarly unqualified. Almost none of them believe that cops should be held accountable for killing mentally ill people who call for help. This sort of thinking, in which cops are extended every benefit of every doubt, feasible or unfeasible, is the norm. Barrett didn’t even write the opinion in Brad’s case. It was written by a liberal judge who, like all her colleagues (of whatever political persuasion), was willing to write the police a blank check. That’s how our courts have operated for decades, and even in a post-BLM society, few of those in robes have the intestinal fortitude to do anything different.

So I am unmoved by Justice Barrett’s faith. I am unmoved by her status as a working mother of seven. I am particularly unmoved by her fake expression of sympathy for George Floyd, whose case she had nothing to do with, when she couldn’t spare any for the people who actually appear before her. I’m unmoved because I’ve seen so little compassion for grieving parents like Matt and Gina throughout my career, from any federal judge, let alone the Federalist Society drones who have lately taken over the judiciary. The basic inability to do what’s right for families like the Kings should be disqualifying. Not just for Amy Coney Barrett, but for the whole lot of ‘em.

This echoes what I’ve been saying on Courtside about the need for a “new breed of better, more progressive Federal Judges” who recognize the compelling human side of the law and why the Constitutional requirements of due process, equal protection, and fundamental fairness are there in the first place. They exist to protect individuals from tyranny and government overreach, not to be ignored, watered down, or woodenly distinguished away to protect government abusers from accountability or to further ideological agendas (primarily, but not exclusively those developed by right wingers) out of touch with the most vulnerable levels of humanity they are supposed to be serving.

Life tenure means that Coney Barrett and the rest of her unqualified colleagues will be around for a long time. But, change needs to start somewhere, now! 

In my experience, internal pushback, dissent, and constant confrontation of the complicit, complacent, judicial status quo with an aggressive implementation of due process, fundamental fairness, and a commitment to human rights and the best interpretations of the law can over time play a critical role in improving the law, changing results, and perhaps most important, saving lives!⚖️🗽👩‍⚖️🧑🏽‍⚖️👨🏻‍⚖️🇺🇸 That, not the hollow ideological agendas of Coney Barrett and others like her, is what “good judging” is really all about!

Intentional lack of compassion, empathy, and humanity (“Dred Scottification” of the “other”) have been themes of Trump, Miller, Wolf, Sessions, Barr, Rosenstein, Nielsen, Pompeo and the other neo-fascist toadies and moral misfits who have gleefully served the regime over the past four years. But, lack of overall resolve and courage to stand up and uniformly and authoritatively “just say no” to these toxic, anti-American, anti-humanity policies and to hold the “perps” accountable for their systemic lawlessness has plagued the Federal Judiciary, with a feckless and often downright complicit Supremes’ majority “leading” the way.

The current sorry state of our democracy, where GOP demagogues, who falsely swore to uphold our Constitution, openly spread lies, knowingly false narratives, and total BS in an attempt to incite violence, undermine our duly elected incoming President, and destroy democratic institutions, including the courts, is in part a reflection of the sad failure of our life-tenured Federal Judiciary to perform its core Constitutional function. That is, to stand up for the Constitution, the rule of law, and individual law human rights in the face failures by the other two branches of Government to uphold their Constitutional responsibilities.

Compare the (finally) unified position of the judiciary on the frivolous election challenges by Trump and his cronies with the failure to stand up for the legal and human rights of asylum seekers, refugees, immigrants, and migrants from the “git go.” Even now, the Courts have failed to sanction Trump and his lawyers for their unethical behavior in bringing frivolous civil suits, with no supporting evidence, for the specific purpose of undermining a free and fair election and using the legal system to attack the legitimacy of the duly elected President-elect and his incoming Administration. “Corruptly weaponizing the law for improper purposes” is clearly inappropriate and unethical. Yet, folks like Rudy and Sydney Powell retain their law licenses and are free to continue to abuse and undermine the system with frivolous litigation.

Dan points to the “ongoing battle between the law and humanity.” That’s the problem! The law should and must be about defending and advancing humanity in the face of tyranny and injustice. We need judges who stand for human justice. For, as MLK, Jr., said “Injustice anywhere is a threat to justice everywhere!”

Better judges for a better America! 🇺🇸Not just a slogan; a requirement for our democracy to survive!

Jacob and his terrific NBC News colleague Julia Edwards Ainsley have been at the forefront of exposing the irreparable human carnage and lasting trauma caused by the regime’s unlawful, racist, White Nationalist immigration policies (some of which were unconscionably “greenlighted” by an immoral and irresponsible Supremes GOP majority that views themselves and their rotten to the core, inhumane, right-wing ideology as above the needless human suffering they further and encourage).

The “perps” like,”Gonzo” Sessions, Grauleiter Miller, Kirstjen Nielsen, “Big Mac With Lies” McAleenan, Noel Francisco, Rod Rosenstein, et al, walk free while the victims continue to suffer and others, like the Christ-like folks at Seneca Family of Agencies, are left to pick up the pieces! How is this “justice?”  

Our national policies  have truly abandoned Christ’s values of self-sacrifice, mercy, generosity in spirit and deed, courage in the face of oppression, human compassion, justice, and assistance  for the most vulnerable among us under the perverted and immoral “leadership” of a man and his party without humane values or respect for truth who stand for absolutely nothing that is decent in the world.

As Americans suffer and die from the pandemic he mocked, downplayed, and mishandled; unemployed Americans are dissed and shortchanged by his party of underachieving, out of touch fat cats, liars, cowards, and truth deniers; asylum seekers needlessly suffer in squalid camps in Mexico; refugees scorned, unlawfully and immorally abandoned and abused by the world’s richest country face persecution, torture, despair, and death; and non-criminals rot in DHS’s “New American Gulag,” the immoral Grifter-in-Chief lives it up at taxpayer expense for one last Christmas at his Florida resort; fumes about a fair and square election that he lost big time; savors a rash of holiday executions; delays bipartisan COVID relief; ferments treason against our republic; and pardons a wide range of scumbags, felons, war criminals, family members, cronies, fraudsters, and other totally undeserving characters. 

But, there is hope for our world at Christmas: 27 days and counting to the end of the kakistocracy, expulsion of the unqualified con-man and his motley crew of criminals and cronies, and the ascension of a real President and Vice President, Joe Biden and Kamala Harris, to lead us, and perhaps our world, out of the current mess to a kinder, brighter future. That might be the best present of all this Christmas.

Immigration Court Case Completion Times Jump as Delays Lengthen

Not surprisingly, Immigration Court closures and delays in hearings for courts that are conducting hearings have drastically reduced the number of completed cases for the first two months of this fiscal year as compared with prior years at the same time.

New cases continue to drastically outpace case completions. In October and November 2020, the Immigration Courts received 29,758 new filings. This is fewer filings than usual, but still almost twice the 15,990 cases they completed.

As a result, the court’s active backlog at the end of November 2020 reached 1,281,586. This is up 18,821 cases in just the last two months. Adding to the court’s workload are not only new filings, but previously closed cases that have been reopened, remanded for reconsideration, or otherwise placed back on the court’s docket.

Disposition times for closed cases have also shot up this year. Cases disposed of in FY 2020 took on average 460 days. During the first two months of FY 2021, the courts disposed of a much smaller number of cases, but the disposition times were much longer at an average of 755 days—or 64 percent longer. The longest disposition times were found in the Cleveland Immigration Court where it took on average 1,617 days.

As mom used to say, “Haste makes waste.” Taking more time to decide cases would be perfectly defensible if it actually produced useful deliberation, thoughtful scholarship, and just and fair results. But, this currently is a system that must limit its intake while it develops the expertise, scholarship, analytical skills, quality control mechanisms, and best practices necessary for judicial efficiency that complies with due process and fundamental fairness (not to mention basic asylum law). That’s a “complete rebuild.”

Then, once that system is running well, it could be methodically and rationally expanded, if actually necessary. But, aimlessly building more assembly lines producing defective products and then ratcheting up the speed will, not surprisingly, produce nothing except more dangerous and defective  products.

Not exactly rocket science that a bunch of hacks implementing racist policies, trying to speed up the assembly line, engaging in “Aimless Docket Reshuffling,” eradicating due process, discouraging fairness and deliberation, eliminating their own jurisdiction to control the dockets, and denying everything while mindlessly throwing more resources into a broken beyond belief “(non)system” at war with its own essential employees and those whom it (dis)serves would produce total chaos and dysfunction. Also, throw in lack of best technology and overt disregard for public health and safety.

And, while this is going on, an undisciplined, out of control, and for all practical purposes worse than useless ICE continues to pour new cases into the maelstrom at twice the rate it can get turn them out! As the late NY Met’s Manager Casey Stengel once said, “Can’t anyone here play this game?”

This is an ongoing and increasingly visible unmitigated national disgrace. It’s also an abuse of public funds and a betrayal of the public trust — fundamentals of sound government.

And, it won’t be “swept under the table” in the finest tradition of incoming Administrations. As I’ve said before, the Biden-Harris Administration either fixes EOIR🤡 immediately with some new faces with real expertise, or it “owns” it. And, the current White Nationalism infested atrocity and den of “malicious incompetence” at EOIR🤡 is not something an Administration striving to achieve equal justice and racial reconciliation should want to own!
