FROM THE HEIGHTS OF KASINGA TO THE DEPTHS OF AMERICA’S DEADLY STAR CHAMBERS: Will The Biden Administration Tap The New Due Process Army To Fix EOIR & Save Our Nation?

By Paul Wickham Schmidt

Retired U.S. Immigration Judge

Courtside Exclusive

Nov. 12, 2020

I.  INTRODUCTION — ABROGATION OF ASYLUM LAWS IN THE FACE OF EXECUTIVE LAWLESSNESS & RACIAL BIAS IS A NATIONAL DISGRACE

In Matter of Kasinga, I applied the generous well-founded fear standard for asylum established by the Supreme Court in Cardoza-Fonseca to reach a favorable result for a female asylum applicant. It was based on a particular social group of women of the tribe who feared persecution in the form of female genital mutilation, or “FGM.” I sometimes think of this as the “high water mark” of asylum law at the BIA.

Since then, proper, generous application of asylum laws to serve their intended purpose of flexibly, fairly, and consistently extending protection to those facing persecution has been steadily declining. The Trump Administration essentially overruled Cardoza-Fonseca and abolished asylum law without legislative change.

Both Congress and the Court have failed to stand up to this egregious abuse of the law, constitutional due process, and simple human decency that presents a “clear and present danger” to our nation’s continued existence.

Indeed, the performance of the Court in the face of the Administration’s overt assault on asylum has been so woeful as to lead me to wonder whether any of the Justices, other than Justice Sonia Sotomayor, have actually read the Cardoza-Fonseca decision. Certainly, most of them have failed to consistently and courageously carry forth its spirit and to grapple with their legal and moral responsibility for letting a lawless Executive trample the constitutional and human rights, as well as the human dignity, of the most vulnerable among us.

How did we get to this utterly deplorable state of affairs and what can the Biden Administration do to save us? Will they act boldly and courageously or continue the tradition of ignoring abuses directed against asylum seekers and the deleterious effect it has on our society and the rule of law?

I guarantee that racial justice and harmony will continue to elude us as a nation unless and until we come to grips with the ongoing abuses in the Immigration Courts — “courts” that no longer function as such in any manner except the misleading name!

II.   BACKGROUND

To understand what has happened since Kasinga, here’s some background. In U.S. asylum law, there generally has been an “inverse relationship” between geography and success. The further your home country is from the U.S., the more generous the treatment is likely to be.

Thus, folks like Kasinga from Togo, or those from Tibet, Ethiopia, China, or Eritrea, with relatively difficult access to our borders, tend to do relatively well. On the other hand, those from Mexico, Haiti, Central America, and South America, who have easier access to our borders, tend to be treated more restrictively.

This reaction has been driven by a hypothesis with limited empirical support, but which has been accepted in some form or another by all Administrations, regardless of party, since the enactment of the Refugee Act of 1980. That is, the belief that human migration patterns are driven primarily by the policies and legal regimes in prosperous so-called “receiving countries” like the U.S.

Thus, generous and humane asylum policies will encourage unwanted flows of asylum seekers across international borders. And, of course, we all know that nothing threatens the national security of the world’s greatest nuclear superpower more than a caravan or flotilla of desperate, unarmed asylum seekers and their families trying to turn themselves in at the border or to the Border Patrol shortly after arrival.

Conversely, restrictive policies including rapid, unfair rejection, border turn-backs, mass detentions, criminal sanctions, family separation, denials of fair hearings, walls, border militarization, and hostile, often racially and religiously charged rhetoric, will cause asylum seekers to “stay put” thus deterring them and reducing the number of applications threatening our national security. In other words, encourage legitimate asylum seekers to “perish in place.” Often, these harsh policies are disingenuously characterized as being, at least partially, “for the benefit of asylum seekers” by discouraging them from undertaking dangerous journeys and paying human smugglers only to be summarily rejected upon arrival.

This “popular hypothesis” largely ignores the effect of conditions in refugee sending countries, including both geopolitical and environmental factors. For example, the current migration flow is affected by the practical difficulties of travel in the time of pandemic and by economic failures and cultural and political changes resulting from unabated climate change, not just by the legal restrictions that might be in place in the U.S. and other far-away countries.

It also factors out the “business narratives” of human smugglers designed to manipulate asylum seekers in ways that maximize profits under a variety of scenarios and to take maximum advantage of mindlessly predictable government “enforcement only” strategies.

Indeed, there is plenty of reason to believe that such policies serve largely to maximize smugglers’ profits, extort more money from desperate asylum seekers, but with little long-term effect on migration patterns. The short-term reduction in traffic, often hastily mischaracterized as “success” by the government, probably reflects in part “market adjustments” as smugglers raise their rates to cover the increased risks and revised planning caused by more of a particular kind of enforcement. That “prices some would-be migrants out of the market,” at least temporarily, and forces others to wait while they accumulate more money to pay smugglers.

It also likely increases the number of asylum seekers who die while attempting the journey. But, there is no real evidence that four decades of various “get tough” and “deterrence policies” — right up until the present — have had or will have a determinative long term effect on extralegal migration to the U.S. It may well, however, encourage more migrants to proceed to the interior of the country and take “do it yourself” refuge in the population, rather than turning themselves in at or near the border to a legal system that has been intentionally rigged against them.

Regardless of its empirically questionable basis, “deterrence theory” has become the primary driving force behind government asylum policies. Thus, the fear of large-scale, out of control “Southern border incursions” by asylum seekers has driven all U.S. Administrations to adopt relatively restrictive interpretations and applications of asylum law with respect to asylum seekers from Central America.

Starting with a so-called “Southern border crisis” in the summer of 2014, the Obama Administration took a number of steps intended to discourage Central American asylum seekers. These included: use of so-called “family detention;” denial of bond; accelerated processing of recently arrived children and adults with children; selecting Immigration Judges largely from the ranks of DHS prosecutors and other Government employees; keeping asylum experts off the BIA; taking outlandish court positions on detention and the right to counsel for unrepresented toddlers in Immigration Court; and dire public warnings as to the dangers of journeying to the U.S. and the likelihood of rejection upon arrival.

These efforts did little to stem the flow of asylum seekers from the Northern Triangle. However, they did result in a wave of “Aimless Docket Reshuffling” (“ADR”) at the Immigration Courts that accelerated the growth of backlogs and the deterioration of morale at EOIR. (Later, Sessions & Barr would “perfect the art of ADR” thereby astronomically increasing backlogs, even with many more judges on the bench, to something approaching 1.5 million known cases, with probably hundreds of thousands more buried in the “maliciously incompetently managed” EOIR (non)system).

Success for Central American asylum applicants thus remained problematic, with more than two of every three applications being rejected. Nevertheless, by 2016, largely through the heroic efforts of pro bono litigation groups, applicants from the so-called “Northern Triangle” – El Salvador, Honduras, and Guatemala – had achieved a respectable approval rate ranging from approximately 20% to 30%.

Many of these successful claims were based on “particular social groups” composed of battered women and/or children or family groups targeted by violent husbands or boyfriends, gangs, cartels, and other so-called “non-governmental actors” that the Northern Triangle governments clearly were “unwilling or unable to control.”

III.   CROSSHAIRS

Upon the ascension of the Trump Administration in 2017, refugee and asylum policies became driven not only by “deterrence theory,” but also by racially, religiously, and politically motivated “institutionalized xenophobia.” The initial target was Muslims who were “zapped” by Trump’s so-called “Muslim ban.” Although initially properly blocked as unconstitutional by lower Federal Courts, the Supreme Court eventually “greenlighted” a slightly watered-down version of the “Muslim ban.”

Next on the hit list were refugees and asylees of color. This put Central American asylum seekers, particularly women and children, directly in the crosshairs.

In something akin to “preliminary bombing,” then Attorney General Jeff Sessions launched a series of false and misleading narratives against asylum seekers and their lawyers directed at an audience consisting of Immigration Judges and BIA Members who worked at EOIR and thus were his subordinates.

Without evidence, Sessions characterized most asylum seekers as fraudulent or mala fide and blamed them as a primary cause for the population of 11 million or so undocumented individuals estimated to be residing in the U.S. He also accused “dirty immigration lawyers” of having “gamed” the asylum system, while charging “his” Immigration Judges with the responsibility of “assisting their partners” at DHS enforcement in stopping asylum fraud and discouraging asylum applications.

IV.    THE ATTACK

While not directly tampering with the “well-founded fear” standard for asylum, with Sessions leading the way, the Administration launched a three-pronged attack on asylum seekers.

First, using his power to review BIA precedents, Sessions reversed the prior precedent that had facilitated asylum grants for applicants who had suffered persecution in the form of domestic abuse. In doing so, he characterized them as “mere victims of crime” who should not be recognized as a “particular social group.” While not part of the holding, he also commented to Immigration Judges in his opinion that very few claimants should succeed in establishing asylum eligibility based on domestic violence.

He further imposed bogus “production quotas” on judges with an eye toward speeding up the “deportation railroad.” In other words, Immigration Judges who valued their jobs should start cranking out mass denials of such cases without wasting time on legal analysis or the actual facts.

Later, Sessions’s successor, Attorney General Bill Barr, overruled the BIA precedent recognizing “family” as a particular social group for asylum. He found that the vast majority of family units lacked the required “social distinction” to qualify.

For example, a few prominent families like the Rockefellers, Clintons, or Kardashians might be generally recognized by society. However, ordinary families like the Schmidts would be largely unknown beyond their own limited social circles. Therefore, we would lack the necessary “social distinction” within the larger society to be recognized as a particular social group.

Second, Sessions and Barr attacked the “nexus” requirement that persecution be “on account of” a particular social group or other protected ground. They found that most alleged acts of domestic violence or harm inflicted by abusive spouses, gangs and cartels were “mere criminal acts” or acts of “random violence” not motivated by the victim’s membership in any “particular social group” or any of the other so-called “protected grounds” for asylum. They signaled that Immigration Judges who found “no nexus” would find friendly BIA appellate judges anxious to uphold those findings and thereby retain their jobs.

Third, they launched an attack on the long-established “nongovernmental actor” doctrine. They found that normally, qualifying acts of persecution would have to be carried out by the government or its agents. For non-governmental actions to be attributed to that government, that government would basically have to be helpless to respond.

They found that the Northern Triangle governments officially opposed the criminal acts of gangs, cartels, and abusers and made at least some effort to control them. They deemed the fact that those governments are notoriously corrupt and ineffective in controlling violence to be largely beside the point. After all, they observed, no government including ours offers “perfect protection” to its citizens.

Any effort by the government to control the actor, no matter how predictably or intentionally ineffective or nominal, should be considered sufficient to show that the government was willing and able to protect against the harm. In other words, even the most minimal or nominal opposition should be considered “good enough for government work.”

V.   THE UGLY RESULTS

Remarkably, notwithstanding this concerted effort to “zero out” asylum grants, some individuals, even from the Northern Triangle, still succeed. They usually are assisted by experienced pro bono counsel from major human rights NGOs or large law firms — essentially the “New Due Process Army” in action. These are the folks who have saved what is left of American justice and democracy. Often, they must seek review in the independent, Article III Federal Courts to ultimately prevail.

Some Article IIIs are up to the job; many aren’t, lacking both the expertise and the philosophical inclination to actually enforce the constitutional and statutory rights of asylum seekers — “the other,” often people of color. After all, wrongfully deported to death means “out of sight, out of mind.”

However, the Administration’s efforts have had a major impact. Systemwide, the number of asylum cases decided by the Immigration Courts has approximately tripled since 2016 – from approximately 20,000 to over 60,000, multiplying backlogs as other, often older, “ready to try” cases are shuffled off to the end of the dockets, often with little or no notice to the parties.

At the same time, asylum grant rates for the Northern Triangle have fallen to their lowest rate in many years 10% to 15%. Taken together, that means many more asylum denials for Northern Triangle applicants, a major erosion of the generous “well-founded fear” standard for asylum, and a severe deterioration of due process protections in American law. Basically, it’s a collapse of our legal system and an affront to human dignity. The kinds of things you might expect in a “Banana Republic.”

VI.  WILL BIDEN FIX EOIR OR REPEAT THE MISTAKES OF THE OBAMA ADMINISTRATION?

The intentional destruction of U.S. asylum law and the weaponization of EOIR in support of the White Nationalist agenda have undermined the entire U.S. justice system. It actively encourages both dehumanization (“Dred Scottification”) and institutionalized racism all the way up to a Supreme Court which has improperly enabled large portions of the unlawful and unconstitutional anti-migrant agenda.

The Biden Administration can reverse the festering due process and human rights disaster at EOIR. Unlike improving and reforming the Article III Judiciary, it doesn’t need Mitch McConnell’s input to do so.

Biden can appoint an Attorney General who will recognize the importance of putting immigration/human rights/due process experts in charge of EOIR. He can replace the current BIA with real appellate judges whose qualifications reflect an unswerving commitment to due process, expert application of asylum laws in the generous manner once envisioned by the Supreme Court in Cardoza-Fonseca, implementing “best” practices, judicial efficiency, and judicial independence.

Biden can return human dignity to an improperly weaponized system designed to “Dred Scottify” the other. He can appoint better qualified Immigration Judges through a merit-based system that would encourage and give fair consideration to the many outstanding candidates who have devoted their professional lives to fighting for due process, fundamental fairness, and immigrants’ rights, courageously, throughout America’s darkest times!

That, in turn, will create the necessary conditions to institutionalize the EOIR reforms through the legislative creation of an independent, Article I Immigration Court that will be the “gemstone” of American justice rather than a national disgrace! One that will eventually fulfill the noble, now abandoned, “EOIR Vision” of “through teamwork and innovation being the world’s best tribunals, guaranteeing fairness and due process for all.”

The Obama Administration shortsightedly choose to “freeze out” the true experts in the private advocacy, NGO, academic, clinical teaching, and pro bono communities. The results have been beyond disastrous.

In addition to killing, maiming, and otherwise harming humans entitled to our legal protection, EOIR’s unseemly demise over the past three Administrations has undermined the credibility of every aspect of our justice system all the way to the Supreme Court as well as destroying our international leadership role as a shining example and beacon of hope for others.

The talent in the private sector is out there! They are ready, willing, and very able to turn EOIR from a disaster zone to a model of due process, innovation, best practices, fair, efficient, and practical judging, and creative judicial administration. One that other parts of the U.S. judicial system could emulate.

Will the Biden Administration heed the call, act boldly, and put the “right team” in place to save EOIR? Or will they continue past Democratic Administrations’ short-sighted undervaluation of the importance of providing constitutionally required due process, equal justice, and fundamental fairness to all persons in the U.S. including asylum applicants and other migrants.

I’ve read a number of papers and proposals on how to “fix” immigration and refugee policies. None of them appears to recognize the overriding importance of making EOIR reform “job one.”

For once, why can’t Democrats “think like Republicans?” When John Ashcroft and Kris Kobach and later Jeff Sessions and Stephen Miller set out to kneecap, politicize, and weaponize the U.S. justice system, what was their “starting point?” EOIR, of course!

The Obama Administration’s abject failure to effectively address and reverse the glaring mess at EOIR left by the “Ashcroft reforms” basically set the table for Sessions’s even more invidious plan to weaponize EOIR into a tool for xenophobia and White Nationalist nativism. The problems engendered by allowing the politicization and weaponization of EOIR have crippled the U.S. justice system far beyond immigration and asylum law.

Without a better EOIR, fully empowered to lead the way legally and insure and enforce compliance, all reforms, from DACA, to detention reform, to restoration of refugee and asylum systems will be less effective, more difficult, and less enduring than they should be. Equal justice for all and an end to institutionalized racism cannot be achieved without bold EOIR reform!

It would also take some of the pressure off the Article III Courts. Time and again they are called upon, with disturbingly varying degrees of both willingness and competence in the results, to correct the endless stream of basic legal errors, abuses of due process, and inane, obviously biased and counterproductive policies regularly flowing from EOIR and DOJ. Indeed, unnecessary litigation and frivolous, ethically questionable, often factually inaccurate or intentionally misleading positions advanced by the DOJ in immigration matters now clog virtually all levels of the Article III Federal Courts right up to the docket of the Supreme Court!

So far, what I haven’t seen is a recognition by anyone on the “Biden Team” that the experts in the private bar who have been the primary fighters in the trenches, almost singlehandedly responsible for preserving American justice and saving our democracy from the Trump onslaught, must be placed where they belong: in charge of the effort to rebuild EOIR and those who will be chosen to staff it!

Continue to ignore the New Due Process Army and their ability to right the listing American ship of state at peril! It’s long past time to unleash the “problem solvers” on government and give them the resources and support necessary to use practical scholarship, technology, best practices, and “Con Law/Human Rights 101” to solve the problems!

No “magic list,” stakeholders committees, or consensus-building groups can take the place of putting expert, empowered, practical problem solvers in charge of the machinery. We can’t win the game with the best, most talented, most knowledgeable, most courageous players forever sitting on the bench!

The future of our republic might well depend on whether the Biden-Harris Administration can get beyond the past and take the courageous, far-sighted actions necessary to let EOIR lead the way to a better future of all Americans! We can only hope that they finally see the light. Before it’s too late for all of us!

Due Process Forever! Complicity & Complacency, Never!

From Heather Cox Richardson’s Letters From An American (10-16-20):

. . . .

And yet another story from the day: a third career prosecutor from the Department of Justice resigned after publicly attacking Attorney General William Barr for abusing his power to get Trump reelected. “After 36 years, I’m fleeing what was the U.S. Department of Justice,” Phillip Halpern wrote. “[T]he department’s past leaders were dedicated to the rule of law and the guiding principle that justice is blind. That is a bygone era, but it should not be forgotten.” Noting that “Barr has never actually investigated, charged or tried a case,” Halpern expressed deep concern over Barr’s “slavish obedience to Donald Trump’s will.” “This career bureaucrat seems determined to turn our democracy into an autocracy,” he warned.

Georgetown Law Professor Paul Butler, who worked as a federal prosecutor under Barr when he was George H. W. Bush’s Attorney General, told Katie Benner of the New York Times that such criticism is “unprecedented,” and reflects Trump’s pressure on the AG. “I have never seen sitting prosecutors go on the record with concerns about the attorney general,” he said.

And yet, Barr’s willingness to bend the Justice Department to Trump’s personal will may, in the end, not be enough to keep Trump’s favor. Angry that Barr did not produce a report attacking the Russia investigation before the election, Trump just yesterday said he wasn’t happy with Barr’s performance, and might not keep him on as AG if he wins a second term.

I might add that the “Courtside network” — with nationwide tentacles — has heard from numerous courageous and dedicated Immigration Judges that they are putting their careers on the line every day to uphold the Constitution and the rule of law against Billy’s corruption, White Nationalist bias, and the institutional pressures to “go along to get along.” But, few think that they can take the stress and abuse for another four years. That’s why this election is absolutely pivotal for the continued existence of our nation as a democratic republic rather than a fascist kakistocracy!

Vote ‘em out, vote em’ out! For our future and the future of the world, vote ‘em out!

BY DEVLIN BARRETT AND MATT ZAPOTOSKY report for WashPost:

Attorney General William P. Barr delivered a scathing critique of his own Justice Department Wednesday night, insisting on his absolute authority to overrule career staff, whom he said too often injected themselves into politics and went “headhunting” for high profile targets.

Speaking at an event hosted by Hillsdale College, a school with deep ties to conservative politics, Barr directly addressed the criticism that has been building for months inside the department toward his heavy hand in politically sensitive cases, particularly those involving associates of President Trump.

“What exactly am I interfering with?” he asked. “Under the law, all prosecutorial power is invested in the attorney general.”

Barr’s comments were remarkable, in that the head of the Justice Department catalogued all of the ways in which he thought his agency had gone astray over the years, and in its current formulation harms the body politic. Barr has drawn considerable criticism for intervening in criminal cases in ways that help benefit the president’s friends.

Barr said it was he, not career officials, who have the ultimate authority to decide how cases should be handled, and derided less-experienced, less-senior bureaucrats who current and former prosecutors have long insisted should be left to handle their cases free from interference from political appointees.

Barr said that argument, in essence, means “the will of the most junior member of the organization” would make decisions, but he insisted he would not “blindly” defer to “whatever those subordinates want to do.”

“Letting the most junior members set the agenda might be a good philosophy for a Montessori preschool, but it is no way to run a federal agency,” Barr said.

The attorney general, the nation’s top law enforcement official, spent much of the speech eviscerating the idea of the Justice Department as a place where nonpolitical career prosecutors should be left to decide how sensitive cases are resolved.

Read the rest of the article at the link.

I’m sure this does wonders for morale at the DOJ! But, demoralizing all the career lawyers and pushing them out the door appears to be part of the program. After all, the regime initially tried to “buy out” the holdover members of the BIA. Morale at the Immigration “Courts” is already at an all-time low!

Career civil servants at the DOJ and elsewhere actually work for the people of the U.S., not personally for Billy, other political appointees, or the President. Government employees take an oath to uphold the Constitution, not of loyalty to the President, the AG, or any other political official.

Billy clearly has been running the Immigration “Courts” as a politically weaponized part of the regime’s White Nationalist, authoritarian, race-driven immigration enforcement agenda. Funny how long it has taken the overall legal community to see that Barr basically considers the entire legal system, including the Article III Courts, as just as subservient as the Immigration “Courts.” And, to date, the Supremes have done little to discourage that view.

As former Deputy AG Don Ayer pointed out in his recent Amicus podcast, featured here on Courtside, Billy is not serving the people of the U.S., for whom he has nothing but contempt unless they happen to share his bigoted right wing views. https://immigrationcourtside.com/2020/09/13/america-on-red-alert%f0%9f%86%98%f0%9f%8f%b4%e2%80%8d%e2%98%a0%ef%b8%8f%f0%9f%a4%ae%e2%98%a0%ef%b8%8f-theocrat-autocrat-liar-race-baiter-anti-democracy-activist-billy-the-bigot-barr-conspires-wit/

He is carrying out a personal agenda of replacing representative democracy with an authoritarian state where everybody and everything is subservient to an all-powerful totally unconstitutional “Unitary Executive” (actually a bogus right-wing “invented concept” with no actual legitimate basis in American political history, as cogently “debunked” by Ayer in his podcast). That certainly makes him one of the two most dangerous men in America!

Billy did say one thing I agree with. Politicos, particularly hacks like Billy and Trump, can be held accountable at the ballot box. Indeed, given the feckless performance of the GOP Senate and the overall failure of the Federal Courts to stand up to tyranny, that appears to be the very last hope for our democracy.

Had enough of the Liar in Chief, Billy the Bigot, Moscow Mitch, & Co? Vote the GOP out of every public office at every level this Fall, while there is still a chance to save our democracy!

This Fall, vote like your life and the continued existence of American democracy depend on it! Because they do!

Says it all about Billy the Bigot. His “downward sprint to the finish” has rocketed him past “John the Con” Mitchell and Jeff “Gonzo Apocalypto” Sessions as the most corrupt AG in modern American history.

That’s, of course, not to minimize or trivialize the crimes committed by either of the other contenders. I suspect we’ll still be unpacking the full extent of Gonzo’s “crimes against humanity” decades from now, as the uglier and uglier truth about this “21st Century Jim Crow” dribbles out a bit at a time

Gee, even the “Afternoon Neighborhood Dog Walking Club” — comprised of neither lawyers nor hard core liberals, can’t understand why Barr, this walking, talking ethics cesspool is 1) still in office; 2) not in jail; and 3) still licensed to practice the law. Here’s hoping that all three of these unfathomable mysteries are resolved favorably to the public interest in the near future! In the meantime, Billy serves as a stark reminder of what’s wrong with legal ethics and our justice system at present.

With all the hard-working, talented, pro bono lawyers out there working overtime to save lives and our democracy, it’s simply a national disgrace and a travesty that unqualified, corrupt, unethical creeps like Billy and Gonzo have been “rewarded” with the an office that is supposed to function as “The People’s Lawyer.”

The Don’s felons and fellow conspirators against America get free passes; meanwhile, Americans of color can’t catch a break from a system loaded against them. Go figure!

Due Process Forever! Billy the Bigot, Never!

🏴‍☠️☠️⚰️👎🏻CRIME & (NO) PUNISHMENT: Not An Administration, An Ongoing Criminal Conspiracy, Says Max Boot!

Columnist
Washington Post
Trump Regime Emoji
Trump Regime

https://www.washingtonpost.com/opinions/2020/08/31/this-isnt-an-administration-its-an-ongoing-criminal-conspiracy/

Max Boot in WashPost:

It is entirely fitting that Donald Trump — the least law-abiding president in our history — was renominated at a convention that was itself a seeming cavalcade of crime. Every night featured apparent violations of the 1939 Hatch Act, which prohibits federal employees from engaging in political activities “in any room or building occupied in the discharge of official duties by an individual employed or holding office in the Government of the United States.”

The White House certainly qualifies as such a facility. Yet Trump used it as a convention prop, even going so far as to televise a naturalization ceremony for immigrants — some of whom did not realize they would be shown at the Republican convention — as part of the nightly show. Trump not only flouted the law but also reveled in doing so. During his acceptance speech, he boasted, “We’re here — they’re not,” and the New York Times reported that Trump “relished the fact that no one could do anything to stop him.”

While the president is exempt from the civil provisions of the Hatch Act, he could be subject, once he leaves office, to criminal penalties if he should “intimidate, threaten, command, or coerce … any employee of the Federal Government … to engage in … any political activity.” That is a crime punishable by up to three years in prison.

This is, of course, barely scratching the surface of an administration that should more accurately be described as an ongoing criminal conspiracy. While many of Trump’s awful acts — e.g., confining children in cages or unleashing riot police on peaceful protesters — are merely violations of democratic norms, there is also plentiful evidence of lawbreaking on his part.

The U.S. attorney for the Southern District of New York has identified Trump as “Individual-1” in a conspiracy with his attorney Michael Cohen to violate campaign finance laws by secretly paying off two women with whom Trump allegedly had affairs. Cohen went to prison; Trump, who as president claims immunity from prosecution, wasn’t indicted.

Special counsel Robert S. Mueller III uncovered a great deal more potential illegality. He found 10 instances when Trump might have obstructed justice, and in at least four of those cases he found evidence that Trump’s conduct met all three elements of the obstruction-of-justice statute. Each violation carries a maximum penalty of 20 years in prison. The recent report from the Senate Intelligence Committee suggests that Trump also lied to Mueller when, in written testimony, he claimed not to remember speaking to Roger Stone about WikiLeaks. If he committed perjury, that would subject him to up to five years’ imprisonment.

. . . .

Trump could try to short-circuit justice by seeking to pardon himself before he leaves office — or even by resigning a few hours early and having Vice President Pence sworn in to issue a pardon (as President Gerald Ford did for Richard Nixon). In that case, the special counsel would be limited to investigating Trump’s accomplices (unless they are also pardoned) and helping state prosecutors. But the special counsel should still issue a comprehensive report on Trump’s lawbreaking. We must expose and root out this ethical rot before it eats away at the foundations of our democracy.

**********

Read the rest of Boot’s article at the link. Actually, Max understates the case. Trump long ago ate the ethical underpinnings of American democracy for lunch, with the “JR Five” providing “table service.”

Under “normal” circumstances, the scenario outlined by Boot in his final paragraph would be beyond preposterous! But, in the failed state of American democracy under Trump, it’s perfectly plausible. Whose going to stop him from the “final abuse and mockery of our republic?” Feckless Congress? The Supremely and Serenely Complicit ones? No way. Trump will exploit the moral cowardice and spinelessness of the other failed two branches of Government until the end!

It started about the time that Roberts and his colleagues threw Muslims, refugees, and migrants under the bus in their ridiculously wrong and intellectually dishonest “Travel Ban Fiasco.” The “Dred Scottification” of migrants and people of color and open corruption, aided and abetted by Roberts and his gang, have continued largely unabated since then.

Max’s use of the term “rot” brings to mind the refugees from many nations, most people of color, rotting in Mexico, futilely waiting for “asylum hearings” that might never come and where denial without due process has been predetermined. This is what “American Justice” has become under Trump, Billy the Bigot, Wolfman the Illegal, and Roberts the Complicit!

Actually, separating families, misrepresenting the policy to Federal Courts, and long-term “civil” detention of families in life-threatening conditions as a “deterrent” to exercising important, fundamental legal and human rights might well be criminal violations in a functioning justice system. Sadly, America basically lacks the latter these days because of the Supremes’ coddling of the “crimes against humanity” committed by Trump, Miller, Barr, Wolf, Cooch, and their co-conspirators.

As those of us with experience adjudicating asylum cases know, lack of accountability before the courts and failure of the judiciary to exercise independent judgment to control a corrupt and tyrannical executive are hallmarks of failed states and banana republics.

Let’s see! America’s founders created an independent judiciary to insure the right of the “King” to use the Government as his personal servants to violate the Bill of Rights, exploit the nation for his own gain, and create “alternate Kings’ Courts” where the “judges” are his employees, he makes the rules, the results are largely preordained by the King’s personal biases and the interests of his royal cronies, and the penalty can be “death without due process.” Not likely!

But, that’s what happens when judges’ fealty to ideology, party, or personality often exceeds their loyalty to the Constitution and to the human rights and human dignity of their fellow men, women, and children. It happens when we create an elitist, right-leaning judiciary, out of step with and non-representative of the majority of Americans, where actual knowledge and experience defending the human rights of individuals against Government overreach, courage to speak truth to power, and demonstrated unswerving commitment to equal justice under law is far, far undervalued, even intentionally ignored. Where practical problem-solving skills and human empathy, perhaps the two most important qualities for fair and honest judging, are all too often disrespected and even demeaned.

Better Federal Judges for a better, fairer, functional America! One where the humanity of all persons is honored and respected, rather than being mocked by those in positions of power and privilege. One where the highest Court finally stands up for and enforces the hard-fought Constitutional right to vote, regardless of skin color or ethnicity, rather than aiding and abetting the blatant schemes of the GOP to suppress voting and deny deserved political power to Americans of color. One where an honest Court enforces to the maximum degree the Voting Rights Act rather than intentionally and disingenuously gutting it at the demand of some in the White power structure.

These travesties have unfolded right in front of us. Yet, even so called “liberal-progressive” commentators largely shrug them off as somehow “normal” or “just the way the system functions.” That’s BS! It’s “judicial malpractice.” It’s a major reason why two centuries after our founding we have not yet achieved racial justice and why our nation is coming apart at the seams under grotesque misgovernance and judicial complicity.

The current Federal Judiciary has facilitated the takeover of our Government by an ongoing criminal conspiracy, as described by Boot. We need change! Sooner rather than later! And, it can’t and won’t happen with the current cast of characters in the Executive, the Senate majority, and the Article III Judiciary.

Due Process Forever!

🏴‍☠️☠️🤮⚰️👎KAKISTOCRACY KORNER: SPOTLIGHT ON AMERICA’S MOST DANGEROUS HATE GROUP: THE RNC!

Paul,

This past weekend, the Republican National Committee caved to white supremacist and other hate groups by adopting a resolution titled Refuting the Legitimacy of the Southern Poverty Law Center to Identify Hate Groups.

The focus of the resolution is that “the SPLC is a radical organization” that harms conservative organizations and voices through our hate group designations.

This attack on our work is an attempt to excuse the Trump administration’s pattern and practice of working with individuals and organizations that malign entire groups of people — immigrants, Muslims and the LGBTQ community — while promoting policies that undermine their very existence. It comes from the same vein as Trump’s claim that there were “very fine people” on both sides of the 2017 Unite the Right rally in Charlottesville.

Simply put, it’s an audacious attempt by Trump and the GOP to paper over the bigotry and racism that has been allowed to infect their policies.

This resolution comes at a moment when Trump will argue at the Republican National Convention that he will combat hate and bigotry, despite welcoming the support of QAnon. It also comes days after the indictment of Stephen Bannon, reminding us that Bannon was once the White House chief strategist and senior counselor and CEO of Trump’s 2016 presidential campaign. And it comes just after our special investigation shined a light on One America News Network’s Jack Posobiec, a reporter at Trump’s favorite network who is aligned with white supremacy and has used his platform to further hate speech and propaganda.

Trump should sever these ties to hate groups and extremists instead of doubling down through this RNC resolution.

The Trump administration has filled its ranks and consulted with alumni and allies from the Federation for American Immigration Reform, an anti-immigrant hate group that has ties to white supremacist groups and eugenicists. They include Julie KirchnerKris KobachJeff Sessions and, most notably, Stephen Miller.

The Trump administration has worked with hate groups like the Family Research Council (FRC) to roll back LGBTQ rights. FRC was designated an anti-LGBTQ hate group for decades of demonizing LGBTQ people and spreading harmful pseudoscience about them. Over the years, the organization has published books, reports and brochures that have linked being LGBTQ to pedophilia, claimed that LGBTQ people are dangerous to children and claimed that LGBTQ people are promiscuous and violent.

Anti-Muslim groups have also been welcomed into the administration, including the Center for Security Policy (CSP)Fred Fleitz, a longtime staffer, was appointed the executive secretary and chief of staff of the National Security Council. For decades, CSP has peddled absurd accusations that shadowy Muslim Brotherhood operatives have infiltrated all levels of government.

These extremists are seeking a license to continue spreading their bigotry and will do anything to undermine those — like the SPLC, which tracks and monitors hate groups — who expose their extremist views and oppose their attacks on communities. With this resolution, Trump and members of the GOP have shown the extent to which they will carry their water.

This past weekend, the RNC also released a resolution titled Resolution to Conserve History and Combat Prejudice – Christopher Columbus. It’s a remarkably transparent statement that hate and bigotry stem from Black Lives Matter protesters. The RNC and Trump did not denounce organizations that promote antisemitism, Islamophobia, neo-Nazis, anti-LGBTQ sentiment or racism. It only criticized the SPLC for challenging those groups.

Outraged? Here are two ways to take action today:

Trump cabinet officials voted in 2018 White House meeting to separate migrant children, say officials

“If we don’t enforce this, it is the end of our country as we know it,” said Trump adviser Stephen Miller, say officials present at a White House meeting.

by Julia Ainsley and Jacob Soboroff | NBC NEWS

WASHINGTON — In early May 2018, after weeks of phone calls and private meetings, 11 of the president’s most senior advisers were called to the White House Situation Room where they were asked, by a show-of-hands vote, to decide the fate of thousands of migrant parents and their children, according to two officials who were there.

Trump’s senior adviser, Stephen Miller, led the meeting and, according to the two officials, he was angry at what he saw as defiance by Department of Homeland Security Secretary Kirstjen Nielsen.

It had been nearly a month since then-Attorney General Jeff Sessions had launched the Trump administration’s “zero tolerance” policy, announcing that every immigrant who crossed the U.S. border illegally would be prosecuted, including parents with small children. But so far, U.S. border agents had not begun separating parents from their children to put the plan into action, and Miller, the architect of the Trump administration’s crackdown on undocumented immigrants, was furious about the delay.

Those invited included Sessions, Nielsen, Health and Human Services Secretary Alex Azar and newly installed Secretary of State Mike Pompeo, according to documents obtained by NBC News.

Nielsen told those at the meeting that there were simply not enough resources at DHS, nor at the other agencies that would be involved, to be able to separate parents, prosecute them for crossing the border and return them to their children in a timely manner, according to the two officials who were present. Without a swift process, the children would enter into the custody of Health and Human Services, which was already operating at near capacity.

Two officials involved in the planning of zero tolerance said the Justice Department acknowledged on multiple occasions that U.S. attorneys would not be able to prosecute all parents expeditiously, so sending children to HHS was the most likely outcome.

As Nielsen had said repeatedly to other officials in the weeks leading up to the meeting, according to two former officials, the process could get messy and children could get lost in an already clogged system.

Miller saw the separation of families not as an unfortunate byproduct, but as a tool to deter more immigration. According to three former officials, he had devised plans that would have separated even more children. Miller, with the support of Sessions, advocated for separating all immigrant families, even those going through civil court proceedings, the former officials said.

While “zero tolerance” ultimately separated nearly 3,000 children from their parents, what Miller proposed would have separated an additional 25,000, including those who legally presented themselves at a port of entry seeking asylum, according to Customs and Border Protection data from May and June 2018.

That plan never came to fruition, in large part because DHS officials had argued it would grind the immigration process to a halt. But after Sessions’ announcement that all families entering illegally would be prosecuted, the onus had fallen on DHS to act.

At the meeting, Miller accused anyone opposing zero tolerance of being a lawbreaker and un-American, according to the two officials present.

“If we don’t enforce this, it is the end of our country as we know it,” said Miller, according to the two officials. It was not unusual for Miller to make claims like this, but this time he was adamant that the policy move forward, regardless of arguments about resources and logistics.

No one in the meeting made the case that separating families would be inhumane or immoral, the officials said. Any moral argument regarding immigration “fell on deaf ears” inside the White House, said one of the officials.

“Miller was tired of hearing about logistical problems,” said one of the officials. “It was just, ‘Let’s move forward and staff will figure this out.'”

Frustrated, Miller accused Nielsen of stalling and then demanded a show of hands. Who was in favor of moving forward, he asked?

A sea of hands went up. Nielsen kept hers down. It was clear she had been outvoted, according to the officials.

In the days immediately following the meeting, Nielsen had a conversation with then-CBP Commissioner Kevin McAleenan inside her office at the Ronald Reagan Building, and then signed a memo instructing DHS personnel to prosecute all migrants crossing the border illegally, including parents arriving with their children.

Read the rest of the report, detailing the full extent of this outrageous, illegal, and immoral conduct by corrupt high-level officials of our Government, at the link. This is what your tax dollars have been used for, while legitimate needs like coronavirus testing, disaster relief (see, Iowa), mail delivery, naturalization services, unemployment relief, etc., go unmet!

So, separated families and children continue to suffer, much of the harm and trauma irreparable and life-defining. This “policy” was so clearly illegal and unconstitutional that DOJ attorneys conceded its unconstitutionality in Federal Court.

However, in an ethics-free DOJ, those same lawyers falsely claimed that there was no such policy. Rudimentary “due diligence” on their part, required by professional ethics, would have revealed that their representations on behalf of corrupt institutional “clients” were false.

The article also confirms the complicity of Kevin “Big Mac  With Lies” McAleenan in gross, intentional human rights violations. Courtside exposed “Big Mac” long ago!

While the victims continue to suffer, Miller, Sessions, Nielsen, Big Mac, and other cowards who planned and carried out these “crimes against humanity,” directed at some of the most vulnerable humans in the world, remain at large. Some, like Miller, actually remain on the “public dole.” Likely, so do the DOJ lawyers who unprofessionally defended and helped obscure this misconduct in Federal Court.

It’s also worth examining the role of U.S. Magistrate Judges and U.S. District Judges along the southern border, most of whom turned a blind eye to the transparent racial and political motives, not to mention the grotesque misallocation of public resources, driving Sessions’s “zero tolerance” misdirection of scarce prosecutorial resources from serious felonies to minor immigration prosecutions.

As I’ve been saying, “Better Federal Judges for a better America!” And, better Federal Judges start with removal of the Trump regime as well as the ousting of “Moscow Mitch” and the GOP from Senate control.

Will there ever be accountability? Our national soul and future might depend on the answer!

Had enough wanton cruelty, neo-Nazism, corruption, illegality, immorality, cowardice, lies, false narratives, racism, stupidity, and squandering of tax dollars on nativist schemes and gimmicks? Get motivated and take action to get our nation back on track to being that “City upon a Hill” that the rest of the world used to admire and respect!

Former Trump Strategist Steve Bannon Indicted In ‘Build The Wall’ Scheme

The former Trump campaign executive was arrested Thursday morning. A grand jury said he used donated funds to cover personal expenses.

By Hayley Miller and Ryan J. Reilly

Steve Bannon, a former chief strategist in President Donald Trump’s White House, was arrested on Thursday after a grand jury indicted him on federal charges for allegedly using hundreds of thousands of dollars from an online “We Build The Wall” fundraiser to cover his personal expenses.

Bannon and three others ― Brian Kolfage, Andrew Badolato and Timothy Shea ― were charged in connection with their roles in “defrauding hundreds of thousands of donors in connection with an online crowdfunding campaign known as ‘We Build the Wall’ that raised more than $25 million,” the U.S. Attorney’s Office for the Southern District of New York announced Thursday morning.

The four defendants are each charged with one count of conspiracy to commit wire fraud and one count of conspiracy to commit money laundering. Each charge carries a maximum penalty of 20 years in prison.

Kolfage, the founder of “We Build the Wall,” had assured donors that all the money would go toward construction of a wall along the U.S.-Mexico border, acting U.S. Attorney for the Southern District of New York Audrey Strauss said in a statement. But the defendants “secretly schemed to pass hundreds of thousands of dollars to Kolfage, which he used to fund his lavish lifestyle,” she said.

Bannon, 66, received over $1 million from the crowdfunding campaign, which he funneled through a nonprofit that he operates, according to prosecutors. Hundreds of thousands of dollars of that money reportedly went toward his personal expenses.

Couldn’t happen to more deserving folks! Although, I’ll have to admit to feeling little sympathy for the alleged “victims” who contributed to Bannon & co’s vile, racist symbolism. Maybe it just illustrates the old saying “no honor among thieves!” No honor among White Nationalists either!

The irony: Immigrants, of all types and statuses, are generally law-abiding, despite the false claims and bogus contrary narratives spread by Trump and his followers. Tump’s White Nationalist buddies: not so much!

🏴‍☠️☠️🤮👎🏻KAKISTOCRACY ON PARADE: “Billy The Bigot Barr” Rips The Heart Out Of the Rule Of Law!

https://apple.news/AKhj9lEQ0T9ucyrOTcSmbxw

Andrew Weissmann writes in The Atlantic:

. . . .

So what does this all mean? It means that if you are personally connected to the president or have information that could hurt the president, or both, you can be treated far more favorably by this attorney general, as he will bend the law and facts to the president’s desired result. His [Billy the Bigot’s] actions in U.S. v. Stone strike at the heart of the Aristotelian principle central to the rule of law, that we treat likes alike. John Locke warned that “where law ends, tyranny begins.” Now, more than three centuries later, that statement applies to the head of the American system of justice.

*********************

Read the rest of the article at the link.

Billy is destroying the rule of law. Look that the absolute disaster he has created in America’s Star Chambers (a/k/a Immigration “Courts” that aren’t).

But he has help. The GOP Senate that signals a refusal to consider impeachment and Federal Judges who fail to call out his totally unethical, corrupt, and often illegal conduct also are to blame! He should have been removed from office, stripped of his law license, and perhaps prosecuted. Instead, he’s free to abuse.

When the career prosecutors resign from a case, that’s a clear sign that something’s wrong! Yet those empowered to stop the misconduct look the other way.

Let’s put this in perspective. This is an regime that has prosecuted individuals and taken their children away from them for the “crime” of entering the U.S., turning themselves in to the Border Patrol, and applying for asylum. Yet, convicted felons with ties to the President are given preferential treatment.

Stone, a felon, gets favorable treatment, allegedly because of COVID-19. Meanwhile, “civil” immigration detainees who have not been convicted of anything, and are merely waiting for a fair hearing process in Barr’s wholly owned “courts” which he has grossly mismanaged into total dysfunctionality, are subjected to COVID-19 as part of DHS’s “Detain Until Dead” (“DUD”) policy.

Due Process Forever! Corrupt AG’s (Like Barr & Sessions), Never Again!

EX-US JUDGE UNLOADS TRUTH IN USDC FILING ABOUT BILLY BARR’S ATTEMPT TO SUBVERT JUSTICE BY UNDOING FLYNN PROSECUTION: Corrupt, Dishonest, Unethical, Unprofessional – DOJ’s Request to Dismiss Flynn Prosecution is “Preposterous” – Our Police Departments Aren’t The Only Part of Our Foundering, Rudderless, & Disturbingly Ineffective, Racially & Morally “Tone-Deaf” Justice System That Needs Substantial & Meaningful Reform!

Pete Williams reports for NBC News:

WASHINGTON — The retired judge appointed to act as a friend of the court in the Michael Flynn case strongly urged the court Wednesday not to let the Justice Department abandon the prosecution.

In a scorching 83-page submission, John Gleeson said the government’s move to drop the case was “riddled with inexplicable and elementary errors of law and fact,” which were contradicted by the positions it has taken in other false statement cases and by its own previous court filings about Flynn’s conduct as well as his decisions to plead guilty twice.

“Even recognizing that the Government is entitled to deference in assessing the strength of its case, these claims are not credible,” the retired judge wrote. “Indeed, they are preposterous. For starters — and most unusually — they are directly and decisively disproven by the Government’s own briefs filed just months ago in this very proceeding.”

Gleeson said judges must ordinarily defer to the wishes of the Justice Department about whether to pursue a prosecution, but not when the motives of the government are suspect. In Flynn’s case, the government’s move to dismiss the case “is based solely on the fact that Flynn is an ally of President Trump.”

Federal District Court Judge Emmet Sullivan of Washington appointed Gleeson to submit arguments about why the government should not be allowed to drop the case, so that Sullivan could consider both sides.

The appointment came after the Justice Department last month asked the judge to dismiss the case, having determined that even if Flynn lied to FBI agents in early 2017 about his phone calls with Russia’s ambassador to the U.S., his lies were not “material” to any investigation and did not, therefore, violate the false statement law at the heart of his case.

Flynn told the FBI that he did talk to Ambassador Sergey Kislyak during the Trump transition but denied that they talked about Russia’s response to the latest Obama sanctions or about a forthcoming UN vote. He later admitted that both those statements were untrue.

Those statements, Gleeson said, were clearly important to the FBI’s investigation into potential connections between the Trump campaign and the Russian government.

“It is hard to conceive of a more material false statement than this one,” Gleeson said.

Gleeson said without any firm legal basis for wanting to drop the case, the only other reason must be Flynn’s relationship with Trump. Wednesday’s brief noted that the president tweeted or re-tweeted about Flynn at least 100 times since March 2017.

Clearly the president is personally invested in ensuring that Flynn’s prosecution ends, Gleeson said, adding, “Everything about this irregular.”

Add this to the absolute legal, ethical, constitutional, and management disaster going in in the U.S. Immigration Courts under Barr’s “maliciously incompetent” management, and the case for removing him from office is overwhelming. Won’t happen. But, it should!

Actually, filing a “preposterous motion” backed by clearly untrue assertions is a clear violation of an attorney’s role as an “officer of the court” owing “candor to the tribunal.” If Barr were a private practitioner, it would likely earn him a referral to his state bar authorities for possible discipline or license revocation.

But, in Federal Courts these days the “undue deference” and unfairly favorable treatment of DOJ attorneys continues. It has actually been institutionalized, and even unjustly rewarded, by the Supremes. Talk about encouraging worst practices and highlighting “negative role models!”

The whole ethical debacle of the Trump Administration DOJ and the overall feckless performance of our Federal Courts, particularly the Supremes and certain Circuit Courts of Appeals, at halting clear Executive abuses and requiring honesty and professionalism (including rejecting racist or religiously bigoted agendas) from the Federal Government before tribunals cries out for a serious re-examination of: 1) who should be sitting on the Federal Bench; 2) what ethical standards they should be held to; and 3) the undue favoritism and leniency traditionally shown by Federal Courts to Government lawyers engaging in misrepresentations, sloppy work, promoting pretexts for overtly racist agendas, and constantly using dilatory litigation tactics intended to punish individual litigants for asserting their legal rights.

The last three years have shown that better Federal Judges and much more courageous, effective judicial leadership committed to guaranteeing due process and fairness for all is absolutely necessary for our nation to achieve “equal justice under law.” The current sorry state of the Article III Judiciary shows that police departments are not the only part of our broken justice system that needs reform and some “different faces” to achieve equal justice under law. As a nation, we can’t achieve social and racial justice with the gang that promoted, enabled, and in some cases even encouraged injustice in charge. And, that goes for all three failed branches of our Federal Government.

George Floyd’s death should never have happened; nor should families be separated, kids put in cages, legal asylum applicants told to rot in Mexico, and Billy Barr be allowed to operate unconstitutional “Star Chambers” masquerading as “courts” (when they are nothing of the sort). The problems in our justice system go much deeper than the Minneapolis Police Department!

Yes, they can be solved! But, not without some new faces, new approaches, and some progressive thinking and input from all of society, particularly our younger generations! You have to believe in equal justice to achieve equal justice! We can’t get there with the current gang of “non-believers” in charge and promoting their failed, and all too often overtly or covertly racially biased, agendas.

Due Process Forever!

This November, vote like your life depends on it! Because it does!

TA-NEHISI COATES IS OPTIMISTIC THAT WE’RE FINALLY AT A MOMENT OF CHANGE IN AMERICA’S APPROACH TO RACE RELATIONS — Read Ezra Klein’s Vox News Interview With Ta-Nehisi to Find Out Why!

Why Ta-Nehisi Coates is hopeful

The author of Between the World and Me on why this isn’t 1968, the Colin Kaepernick test, police abolition, nonviolence and the state, and more.

The first question I asked Ta-Nehisi Coates during our recent conversation on The Ezra Klein Show was broad: What does he see right now, as he looks out at the country?

“I can’t believe I’m gonna say this,” he replied, “but I see hope. I see progress right now.”

Coates is the author of the National Book Award winner Between the World and Me and The Water Dancer, among others. We discussed how this moment differs from 1968, the tension between “law” and “order,” the contested legacy of Martin Luther King Jr., Donald Trump’s view of the presidency, police abolition, why we need to renegotiate the idea of “the public,” how the consensus on criminal justice has shifted, what Joe Biden represents, the proper role of the state, and much more.

But there’s one particular thread of this conversation that I haven’t been able to put down: There is now, as there always is amid protests, a loud call for the protesters to follow the principles of nonviolence. And that call, as Coates says, comes from people who neither practice nor heed nonviolence in their own lives. But what if we turned that conversation around? What would it mean to build the state around principles of nonviolence, rather than reserving that exacting standard for those harmed by the state?

An edited transcript from our conversation follows. The full conversation can be heard on The Ezra Klein Show.

Ezra Klein

What do you see right now, as you look out at the country?

Ta-Nehisi Coates

I can’t believe I’m gonna say this, but I see hope. I see progress right now, at this moment.

I had an interesting call on Saturday with my dad, who was born in 1946, grew up dirt poor in Philadelphia, lived in a truck, went off to Vietnam, came back, joined the Panther Party, and was in Baltimore for the 1968 riots. Would’ve been about 22 at that time.

I asked him if he could compare what he saw in 1968 to what he was seeing now. And what he said to me was there was no comparison — that this is much more sophisticated. And I say, well, what do you mean? He said it would have been like if somebody from the turn of the 20th century could see the March on Washington.

The idea that black folks in their struggle against the way the law is enforced in their neighborhoods would resonate with white folks in Des Moines, Iowa, in Salt Lake City, in Berlin, in London — that was unfathomable to him in ‘68, when it was mostly black folks in their own communities registering their great anger and great pain.

I don’t want to overstate this, but there are significant swaths of people and communities that are not black, that to some extent have some perception of what that pain and that suffering is. I think that’s different.

Ezra Klein

Do you think there is more multiethnic solidarity today than there was then?

Ta-Nehisi Coates

I do. Within my lifetime, I don’t think there’s been a more effective movement than Black Lives Matter. They brought out the kind of ridiculousness that black folks deal with on a daily basis in the policing in their communities.

George Floyd is not new. The ability to broadcast it the way it was broadcasted is new. But black folks have known things like that were going on in their communities, in their families, for a very long time. You have a generation of people who are out in the streets right now, many of whom only have the vaguest memory of George Bush. They remember George Bush the way I remember Carter. The first real president who they actually grappled with was a black dude. That’s a different type of consciousness.

Ezra Klein

I was watching the speech Trump gave before tear-gassing the protesters in the park in DC. What so chilled me about that speech was how much he clearly wanted this — like this was the presidency as he had always imagined it, directing men with guns and shields to put down protesters so he could walk through a park unafraid and seem tough.

He’s always seemed so disinterested and annoyed by the actual work of being president, even during coronavirus. But this is the thing that he seems energized and excited by. And that’s been the scary part of it to me — that you have somebody in that role who is eager for escalation.

Ta-Nehisi Coates

It is pretty clear that the war-making part of being head of state was the part that most appeals to Donald Trump.

What does this mean for the election? It may be true that Donald Trump will win. Maybe this will lead to some sort of white backlash that ultimately helps him. I can’t really call that. But what I will say is this is a massive denial of legitimacy. Donald Trump may win the election in November, but he will be a ruler and not a president.

I think that those things need to be distinguished. When you’re calling out the military to repress protests that are in cities across the country, not just in ghettos and in hoods, all you have is force at that point. Most likely if he wins, he’ll be someone who won with a minority of the vote two times, which will be a first in American history. And violence will be the tool by which he rules. I think it’s a very different situation to be in.

Ezra Klein

I’m glad you brought in that word legitimacy. I wrote a piece the other day called “America at the breaking point,” and one of the things that I was imagining as I wrote that was a legitimacy crisis. The stakes have been going higher and higher this year: coronavirus, the entire country locked in houses, upset, angry, scared. Then you add on a series of basically televised lynchings.

And then you think: This is an election year. In some ways, I’m more afraid of the situation you just described. If Donald Trump is reelected in a way that does not feel legitimate to people — if he loses by more votes than he did in 2016, or there’s a contested-vote situation — this could turn out badly. Legitimacy crises are scary things. And I don’t think we’re really well equipped for one right now.

Ta-Nehisi Coates

I agree. But when I look back historically, the alternative to me is 1968.

I think, amongst a large swath to a majority of black people in this country, the police are illegitimate. They’re not seen as a force that necessarily causes violent crime to decline. Oftentimes you see black people resorting to the police because they have no other option, but they’re not seen with the level of trust that maybe Americans in other communities bestow upon the police. They know you could be a victim to lethal force because you used a $20 bill that may or may not have been counterfeit, because you were asleep at night in your home and somebody got a warrant to kick down your door without knocking.

I would argue that [feeling] has been nationalized. I don’t know that everybody in America feels that way, but I think large swaths of Americans now feel that Trump is the police. And they feel about Trump the way we feel about cops: This is somebody that rules basically by power. I would prefer that situation to 1968, where we’re alone in our neighborhoods and we know something about the world and we know what the police do, but other folks can’t really see it — and if they can, they’re unsympathetic. I would prefer now.

The long history of black folks in this country is conflict and struggle, between ourselves and the state and other interests within the society so that we can live free. And this is the first time that I think a lot of us have felt that the battle was legitimately joined, not just by white people but other people of color. When I hear that brother in Minneapolis talk about how his store was burned down and him saying, “Let it burn.” That’s a very different world. It’s a very, very different situation. It’s not a great one. It’s not the one we want. But it’s not ‘68.

Read the rest of the interview at the link.

Coincidentally, I just finished reading Coates’s novel about slavery and freedom, The Water Dancer, which I highly recommend.

⭐️⭐️⭐️⭐️⭐️I also found the just-released streaming movie Just Mercy instructive. It’s based on the true story of unjustly convicted Alabama death-row inmate Walter McMillan and his courageous young just-out-of-Harvard African-American attorney Bryan Stevenson, played by Michael B. Jordan. In the movie, as in real life, justice was achieved in the end.

But, was it really?

Why should justice in America a be so dependent on both the “right lawyer” and the particular location and judges before whom you are tried? Why should it be so difficult, time consuming, painful, and uncertain to obtain? Why weren’t the crooked sheriff and the other perpetrators of deadly fraud held accountable? Why was such a tone-deaf judge on the bench in the first place? Why was a corrupt system not interested in real justice for the murder victim? Why do we still have the death penalty — clearly “cruel and unusual punishment” in violation of the Constitution by any rational definition?

It’s also worth remembering that one of the greatest advocates of putting African Americans in Alabama to death was none other than White Nationalist prosecutor Jeff “Gonzo Apocalypto” Sessions. Sessions then went on to a further career involving child abuse, squandering of taxpayer funds on “gonzo” prosecutions of legal asylum seekers, and unfairly sentencing Hispanic refugee women to torture, and even death. Yet, Sessions walks free. He even has the audacity to run for public office again based on his perverted, racist views of “justice” in America.

Whether or not he, or the equally repulsive and bigoted other GOP candidate, former football coach Tommy Tuberville, get elected will be a true test of how far we have come as a nation, and in particular, how far Alabama has come in atoning for past wrongs. Anybody who cares about equal justice for all should send at least a few bucks to the re-election campaign of wholly decent, competent, U.S. Senator Doug Jones (D-AL) to help him fight the GOP “forces of darkness, racism, and inequality,” arrayed against him.

I really hope Coates is right. But, based on the “reality of the moment” we still have a long way to go.  True social justice would involve accountability for individuals like Trump, Miller, Sessions, and Barr who have been actors and proponents of injustice toward “the other” in our society. When folks like unapologetic White Nationalist provocateur Sen. Tom Cotton (R-AK) are no longer placed in public office, then, and only then, will social justice and equal justice for all have been achieved.

And, I personally doubt our capacity as a nation for true due process and equal justice under law as long as the “JR Five” rule the Supremes. So far, there haven’t been many racial injustices or “Dred Scottifications” of the other that they have had the courage and integrity to condemn! Better judges, with more humanity and empathy, are a requirement for a truly just nation.

That pandering, maliciously incompetent, willfully ignorant, bigot Donald Trump, with his vile, intentionally racially divisive message of fear still polls at 42% shows just how far we have to go to achieve due process and equal justice for all in America. “Equal Justice For All” isn’t just a “snappy slogan;” it requires leaders who really believe in it!

Right now, save for Nancy Pelosi, we conspicuously lack such leaders in all three Branches of our National Government. Better results will require change at the top. It will also require a significant minority of voters to stop enabling the intolerant, incompetent, and divisive to rule.

As Dr. Martin Luther King, Jr., once wrote:

“Injustice anywhere is a threat to justice everywhere. We are caught in an inescapable network of mutuality, tied in a single garment of destiny. Whatever affects one directly, affects all indirectly.”

The quote isn’t just an “abstract concept;” it has “real life” meaning. It’s from King’s Letter From Birmingham Jail, where he was unjustly imprisoned in 1963 for participation in peaceful protests against racial injustice.

“Social Justice” isn’t just an idealistic concept. It’s an absolute necessity for a well-functioning, just, and fully productive society!

Due Process Forever!

WASHPOST EDITORIAL BOARD:  TRUMP IS “EXACTLY THE WRONG LEADER FOR OUR TIMES” — “The right message would combine an insistence on keeping protest peaceful with assurances that justice will be done in Mr. Floyd’s death and a recognition that righting deeper wrongs is an urgent priority. That message will not come from a White House that has used racial hatred as a wedge and repeatedly made clear its contempt for urban America.”🤮

☠️☠️☠️☠️☠️

As cities burn, Trump’s bullhorn drowns out the voices of our better angels

AS BUILDINGS and businesses burn in many cities across America, state and local officials and community leaders are desperately and at times bravely saluting the justifiable moral outrage of peaceful protesters while seeking to ensure that looters and hooligans whose only agenda is mayhem do not irreparably sully the cause. Meanwhile, President Trump, whose words could matter most, plays his customary role as human flamethrower: exactly the wrong leader for the times.

No magic elixir could extinguish the rage overnight, nor ensure that the fury over George Floyd’s brutal killing in Minneapolis is channeled in a constructive direction. But this much is certain: Words matter, and a commitment to reform matters. Some leaders are trying to deliver both. They recognize the challenges of systemic injustice; the pattern of brutality suffered by African Americans at the hands of white officers; the racism manifested in so many ways, including unequal rates of imprisonment and, now, unequal suffering from the novel coronavirus, both medically and economically.

Meanwhile, Mr. Trump, the divider in chief, fulminates as the nation burns. He does not counsel restraint; nor issue appeals for unity, nor acknowledge the roots and reasons for the fury of black Americans who see white men in uniform as threats to their lives. To his administration, there is no systemic challenge, only “a few bad apples” among police, as Robert C. O’Brien, national security adviser, said Sunday. Even as police train their weapons on journalists doing their jobs by covering the unrest, Mr. Trump attacks the media. As the president vents — warning that “the most ominous weapons” and “the most vicious dogs” would be unleashed on protesters; threatening to deploy the active-duty military; attacking Democrats; relishing the Secret Service’s readiness for “action”; suggesting he may summon his MAGA supporters to the streets — the country’s more emollient voices are muffled.

Live updates on Minneapolis

Wanton destruction, looting and firebombing are unacceptable and unjustified no matter what the provocation, as Rep. John Lewis (D-Ga.) said on Saturday. Responsible leaders are trying to send that message. But against the president’s bullhorn, it becomes harder to hear leaders like Atlanta Mayor Keisha Lance Bottoms, whose anger at destructive rioters in her city was tempered by a heartfelt appeal. “We are better than this as a city, we are better than this as a country,” she said. “Go home. Go home!” It becomes more difficult to focus on the message of Minnesota Gov. Tim Walz (D), who tweeted, “Minnesota consistently ranks highly for our public schools, innovation and opportunity, and happiness – if you’re white. If you’re not, the opposite is true. Systemic racism must be addressed if we are to secure justice, peace, and order for all Minnesotans.”

So much depends right now on moral authority, yet so little of it can break through the chaos of events and the venomous soundtrack from Washington. The right message would combine an insistence on keeping protest peaceful with assurances that justice will be done in Mr. Floyd’s death and a recognition that righting deeper wrongs is an urgent priority. That message will not come from a White House that has used racial hatred as a wedge and repeatedly made clear its contempt for urban America. It is left to other leaders to try to break through the mayhem of the moment, and give voice to our better angels.

Trump, already the worst President in U.S. history, has been a clear and present danger to the welfare, security, and continued existence of our nation since he took office.

His malicious incompetence, corruption, ignorance, racism, meanness, and lack of humanity are now on full display. Trump and his band of grifters, White Nationalists, toadies, and incompetents are a big part of the problem, not the solution!

Indeed, we can’t even get a constructive start on solving the problems of institutional racism, inequality, and failure to take equal justice for all as a serious goal with Trump in office. For example, Trump and the GOP have it very clear that they have the intent and a variety of schemes to suppress African-American and Hispanic-American voting and voting power this November — so far, with no meaningful pushback from the Supremes.

Still, we “are where we are” today because those institutions with a responsibility and the authority to curb his abuses, hold him accountable for his racism and dishonesty, and enforce our Constitution, namely, the U.S. Senate, the Supreme Court, and the GOP have failed to do so. Beyond that, on many occasions they have actually encouraged and joined in his misdeeds.

This November, vote like your life depends on it.  Because it does!

“At Some Point the Country Is Going to Have to Wake Up”: James Clyburn on the Floyd Killing and The Role of Race In The Coming Election

Chris SmithMay 29, 2020

Clyburn, who helped hand Biden his presumptive nomination, talks about Biden’s “you ain’t black” and V.P. possibilities, and why this moment is defined by “raw politics and meanness.”

James Clyburn grew up in a segregated South Carolina. He is now the longest-serving member of the state’s congressional delegation and the highest-ranking black Democrat in the House. In February, Clyburn basically saved Joe Biden’s presidential bid, endorsing Biden three days before South Carolina’s pivotal primary and helping deliver the decisive black vote. On Thursday evening, just after landing in his home state for a weekend visit, the 79-year-old Clyburn talked about holding on to his optimism in the wake of yet another brutal killing of a black man by police.

Vanity Fair: What was your reaction when you saw the video of a Minneapolis cop kneeling on the neck of George Floyd?

James Clyburn: I don’t know that I would describe my emotion as anger. I guess I should be angry. Maybe at my age, and as many of these kinds of things as I’ve experienced, you get to the point where you say, but for the video, I would not have seen it; other people would not have seen it; and the official word would be all anyone knew. I do feel, though, that at some point the country is going to have to wake up to this reality.

What do you tell black Americans, particularly young black male Americans, who say the country is long past the point when it should have awakened, and that the reality is just racism and hatred?

Going back to the student movement and the civil rights movement, I’ve really questioned many times whether or not what we were doing made any real sense. Whether there was any possibility of success. But along with people like John Lewis, who I met in October 1960, he’s held on to his faith in the country, and I’ve held on to mine. I went to jail several times. I ran for office three times before I got elected. You don’t give up. You aren’t going to win by giving up.

pastedGraphic_1.png

The four Minneapolis police officers have been fired. Should they be tried for murder?

They certainly should stand trial. The hand of one is the hand of all, so four people need to be on trial.

In a conference call with House leaders two days after Floyd’s death, you talked about it being a symptom of larger problems that plague minority communities, and that it showed the need for systemic change. What did you mean?

I have been saying for a long time now that so much in this country needs to be restructured. Health care, education, the judicial system. Every time these issues are raised, folks on the Republican side find a way to parse the words and turn it to their agenda, and they get accommodated by too many people in the media. When we first started discussing the CARES Act, I said to my caucus, in a Zoom call, that this was a tremendous opportunity for us to restructure things in our vision. My vision comes from the pledge of allegiance: liberty and justice for all. That remains a vision—but we’re not doing much to make that vision a reality. Mitch McConnell goes on the floor of the Senate and calls me out, as if there’s something nasty about my vision. He never asked me what my vision was. I’ve got it on billboards all over Charleston: “Making America’s Greatness Accessible and Affordable for All.” What’s wrong with that? And that’s been weaponized by the other side as something untoward. It’s ideology, it’s raw politics, and meanness. That’s why we can’t fix these things.

Do you think the Floyd killing will end Minnesota senator Amy Klobuchar’s chances of being picked as Joe Biden’s running mate?

It certainly won’t help. But it’s not just this. Her history with similar situations when she was a prosecutor came up time and again during the campaign. I suspect this incident plays into that.

You said you cringed when Biden told a radio host, “If you have a problem figuring out whether you’re for me or for Trump, then you ain’t black.”

I compare Joe Biden to the alternative, not the Almighty. One of the things I learned early in this business is that one of the worst things you can do in politics is to make a joke out of any serious matter. He would have been better off not doing that.

Senator Tim Scott, a Republican from South Carolina who happens to be black, said that Biden’s remark showed him to be “condescending and arrogant.”

I’ve known Joe Biden for a long, long time. I don’t perceive anything about him to be arrogant. Tim Scott supports [Donald] Trump, and I don’t. If he can reconcile his blackness with Trump, that’s fine. I can’t reconcile mine with Trump. I’ll never ever accept the president of the United States looking into a camera and calling a black woman a dog. I will never get over that. Nothing else he says will matter to me. And he said that not about one of his opponents—that was about one of his staffers! Who supported him! I have three daughters, and I know how I’d feel about any man calling one of them a dog.

With his attacks on former president Barack Obama, among other things, it’s clear that Trump is going to play the race card in his reelection campaign. Do you worry about the tensions becoming dangerous, or is it better to have the issue out in the open?

I think we’re in much better shape for it to be out in the open than for it to be hidden under a bushel. That’s what happened in 2016. The whole thing about African American males responding to Trump saying, “What do you have to lose?” I know from my visits to barber shops that it resonated. But if you fool me once, that’s on you. If you fool me twice, that’s on me. If black men allow themselves to be fooled twice, it’s on them. Four years later, if it ain’t clear what they have to lose, if they can’t count up their losses with Trump, ask them to ask me.

You have said that it isn’t “a must” for Biden to pick a black woman as the vice presidential nominee. Why not?

I remember Sarah Palin. She was fine until it turned out the vetting hadn’t been thoroughly done. I remember Geraldine Ferraro. She was fine. It was her husband that got exposed during the campaign. So if I say it’s a must and something turns up in the vetting, what does that make me? I’m never going to say it’s a must for him to choose a black woman. It would be a plus.

Are you confident that black turnout will be high enough to win no matter whom Biden chooses?

I don’t know about that. Black voters are incentivized already. You can always stimulate the vote. There are picks that could energize the vote.

If Biden said, “Jim, I’ll choose whomever you want,” what would say?

I’m not gonna tell you! But I would tell him.

There’s a tremendous amount of outrage right now about the George Floyd and the Ahmaud Arbery killings. But unfortunately, we’ve seen this cycle many times before, where attention fades after a few weeks.

I think something’s going to be different about this. After the Minneapolis killing, I saw the Minnesota attorney general on TV. For the first time in the state’s history, that attorney general is African American. Also Muslim. That, to me, helps set this whole issue on a different plane. Minneapolis had issues with the former mayor and the police. This mayor says he’s calling for these men to be indicted. To me, that’s progress in something all of us need to work on. You can’t take these things in silos. I’m a history guy. I’ve been studying this country’s history pretty much all my life. It’s pretty sordid in some areas. But that history ought to inform us. Everybody’s not going to learn the lessons. The ones who learn, you hope they change the world.

Our country can’t get to the better future we need with horrible, unqualified, bigoted leaders like Trump, Pence, Mitch, et al.

Lynh Bui and Peter Hermann report in the Washington Post:

“BALTIMORE — After the federal government released a searing 163-page report in August condemning police practices in Baltimore, the police commissioner and mayor stood with Justice Department leaders to promise sweeping reform.

Change was necessary, they all said, not only to prevent riots like those that flared after the fatal injury of Freddie Gray in police custody, but also to repair the long-standing, deep rift between the city’s crime-weary residents and its police.

Nine months later, Baltimore’s mayor and police commissioner again appeared before television cameras committing to overhaul the department.

But this time they stood by themselves.

“I’m asking the citizens of Baltimore to have faith that we will continue this work,” Mayor Catherine E. Pugh (D) said Tuesday. “It’s hard to deny that these kinds of reforms don’t need to take place in the city of Baltimore.”

On January 12, Attorney General Loretta Lynch announced the Justice Dept. reached a deal for sweeping reforms to the Baltimore Police Dept. after a federal review found officers routinely violated residents’ civil rights. (Reuters)

The pledge to move ahead came hours after the Justice Department had asked a federal judge Monday night to postpone the department’s tentative police reform agreement with the city — part of a wider review of pacts nationwide ordered by U.S. Attorney General Jeff Sessions.

The Baltimore consent agreement was announced days before President Trump took office and awaits a federal judge’s approval.

The request for a delay, which a judge has yet to rule on, left some Baltimore leaders and residents worried that momentum will wane and leave the city stuck in a familiar loop of unfulfilled promises.

Interim city solicitor David Ralph would not comment Tuesday on whether the city would file a response to the requested delay.

“It seemed clear that Justice was going ahead with these reforms, and now all of a sudden they don’t want to do it,” said Rebecca Nagle, co-director of the No Boundaries Coalition, a resident-led advocacy group.

The coalition helped organize residents to relay their experiences with city police to the Justice Department team that produced the August report, which concluded that the police department engaged in unconstitutional policing that discriminated against black residents in poor communities through illegal searches, arrests and stops for minor offenses.

“Residents invested two years doing this, and not going forward will destroy the trust that has built up,” Nagle said.

In Sessions’s two-page memo ordering the review of open and pending consent decrees, he said the department wants to guarantee the pacts are in line with Trump administration goals of promoting officer safety and morale while fighting violent crime.

“The Federal government alone cannot successfully address rising crime rates, secure public safety, protect and respect the civil rights of all members of the public, or implement best practices in policing,” the memo stated. “These are, first and foremost, tasks for state, local and tribal law enforcement.”

***********************************

Now, I might only be a retired Immigration Judge, not a civil rights expert. But, even I can tell that if “state and local law enforcement” could solve this problem, it would have been solved long ago.

In fact, until former Attorney General Lynch and the DOJ’s Civil Rights Division intervened, state and local authorities had done their best to cover up the problems and avoid solving them. (And, I’m by no means a fan of Lynch. She was appropriately very interested in vindicating the civil rights of African Americans. But, she wasn’t interested in the human rights of mostly Hispanic women and children fleeing Central America. She aided and abetted a system of detention of such asylum applicants under deplorable conditions and hustling their cases through the U.S. Immigration Courts, in too many cases without full due process or even an opportunity for a fair hearing.)

No, what Sessions really means is that he has no interest whatsoever in helping the African American community vindicate their civil rights if it means clamping down on police abuses. After all, look at the “bang up” job that Session’s home state, Alabama, did on protecting its African American citizens from police abuses for most of the 20th Century. Who could ask for more? Or, perhaps we should get a “second opinion” from Congressman John Lewis (D-GA) who had his head split open by one of Sessions’s “police heroes,” an Alabama State Trooper.

That’s what often happens when the Feds rely on states and localities to vindicate citizen’s constitutional rights against the state’s own abuses. Classic “fox guarding the chicken coop.” Sort of like having Jeff Sessions protecting the rights of minorities and migrants. Yeah, the Birmingham Bridge incident was in 1965. But, Sessions and his gang have every intention of turning the clock back to those “glory days” of state’s rights.

Remember, it wasn’t that long ago that Senator Elizabeth Warren (D-MA) was “silenced” on the Senate floor for “disparaging” a colleague, Senator Sessions, by putting the truth about his tone-deaf record on civil and human rights “in the record.” But, silenced or not, Warren spoke truth about Session’s unsuitability to serve as Attorney General. Sadly, African Americans, Hispanics, members of the LGBT community, and migrants are likely to find out first hand that “he’s still the same ol’ Jeff.”

*********************

The George Floyd tragedy became largely inevitable the day a GOP-controlled Senate approved the stunningly unqualified 21st Century Jim Crow Jeff “Gonzo Apocalypto” Sessions to be Attorney General. The results have been disastrous for America and particularly cruel and tragic for people of color.

The beginning of the solution: Vote Trump and the GOP out of office; make sure Jeff Sessions remains “retired forever;” just say no to equally disgraceful “New Jim Crow” Tommy Tuberville (“birther,” racist, bigot, Trump shill https://www.motherjones.com/politics/2019/08/tommy-tuberville-perfected-his-folksy-trumpism-in-that-great-lab-of-democracy-local-sports-radio/); return Senator Doug Jones (D-AL), an incredibly competent and decent human being, who has been representing all of the people of Alabama in an outstanding manner, to the Senate.

Also, as a nation, we need to come to grips with the failure of our Supreme Court. The Supremes’ GOP majority has enabled, encouraged, and embraced the Trump regime’s “Dred Scottification” of “the other.”

They have disgracefully and improperly failed to set a legal and moral tone condemning racist abuses, kids in cages, gross mistreatment of legal asylum seekers, and blatantly biased and unconstitutional Immigration “Courts” that parody and mock justice every day. The Supremes have enabled GOP schemes to erode minority voting and political power and have shown a willingness bordering on enthusiasm to accept bogus security-related “pretexts” for racism, religious intolerance, and abuse of authority by Trump and his cronies!

Unwarranted favoritism toward unethical Trump Solicitor General Noel Francisco is also a glaring, inexcusable problem. America’s future depends on a more diverse, courageous, humane, and “connected with reality” Supreme Court; a Court that rejects bogus right-wing legal nonsense; a Court that solves problems, upholds individual legal rights, insists on “equal justice for all,” and holds the Executive fully accountable for intentional abuses of authority.

This November, vote like you life and the survival of our democratic republic depend on it! Because they do!

SUPREME COURT OF THE UNITED STATES

Syllabus

UNITED STATES v. SINENENG-SMITH CERTIORARI TO THE UNITED STATES COURT OF APPEALS FOR

THE NINTH CIRCUIT

No. 19–67. Argued February 25, 2020—Decided May 7, 2020

Respondent Evelyn Sineneng-Smith operated an immigration consulting firm in San Jose, California. She assisted clients working without au- thorization in the United States to file applications for a labor certifi- cation program that once provided a path for aliens to adjust to lawful permanent resident status. Sineneng-Smith knew that her clients could not meet the long-passed statutory application-filing deadline, but she nonetheless charged each client over $6,000, netting more than $3.3 million.

Sineneng-Smith was indicted for multiple violations of 8 U. S. C. §1324(a)(1)(A)(iv) and (B)(i). Those provisions make it a federal felony to “encourag[e] or induc[e] an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law,” §1324(a)(1)(A)(iv), and impose an enhanced penalty if the crime is “done for the purpose of commercial advantage or private financial gain,” §1324(a)(1)(B)(i). In the District Court, she urged that the pro- visions did not cover her conduct, and if they did, they violated the Petition and Free Speech Clauses of the First Amendment as applied. The District Court rejected her arguments and she was convicted, as relevant here, on two counts under §1324(a)(1)(A)(iv) and (B)(i).

Sineneng-Smith essentially repeated the same arguments on appeal to the Ninth Circuit. Again she asserted a right under the First Amendment to file administrative applications on her clients’ behalf, and she argued that the statute could not constitutionally be applied to her conduct. Instead of adjudicating the case presented by the par- ties, however, the court named three amici and invited them to brief and argue issues framed by the panel, including a question never raised by Sineneng-Smith: Whether the statute is overbroad under the

2 UNITED STATES v. SINENENG-SMITH Syllabus

First Amendment. In accord with the amici’s arguments, the Ninth Circuit held that §1324(a)(1)(A)(iv) is unconstitutionally overbroad.

Held: The Ninth Circuit panel’s drastic departure from the principle of party presentation constituted an abuse of discretion.

The Nation’s adversarial adjudication system follows the principle of party presentation. Greenlaw v. United States, 554 U. S. 237, 243. “In both civil and criminal cases, . . . we rely on the parties to frame the issues for decision and assign to courts the role of neutral arbiter of matters the parties present.” Id., at 243.

That principle forecloses the controlling role the Ninth Circuit took on in this case. No extraordinary circumstances justified the panel’s takeover of the appeal. Sineneng-Smith, represented by competent counsel, had raised a vagueness argument and First Amendment arguments homing in on her own conduct, not that of others. Electing not to address the party-presented controversy, the panel projected that §1324(a)(1)(A)(iv) might cover a wide swath of protected speech, including abstract advocacy and legal advice. It did so even though Sineneng-Smith’s counsel had presented a contrary theory of the case in her briefs and before the District Court. A court is not hidebound by counsel’s precise arguments, but the Ninth Circuit’s radical trans- formation of this case goes well beyond the pale. On remand, the case is to be reconsidered shorn of the overbreadth inquiry interjected by the appellate panel and bearing a fair resemblance to the case shaped by the parties. Pp. 3–9.

910 F. 3d 461, vacated and remanded.

GINSBURG, J., delivered the opinion for a unanimous Court. THOMAS, J., filed a concurring opinion.

👎Justice Thomas used his concurring opinion as an opportunity to attack the “overbreadth doctrine,” and to solicit future challenges to it, presumably from right-wing advocates and activist conservative judges who agree with him.

It’s interesting how moderate and liberal judges who believe in the Constitution, the rule of law, and standing up for individual rights in the face of government overreach are often forced to deny that they are “activists.” By contrast, right wing judges often make little or no attempt to disguise their activist, often anti-human-rights, “turn back the clock to the bad old days,” agenda and to use their opinions as a forum to critique and solicit challenges to rules of law they don’t like. Often such rules under attack from the judicial right tend to vindicate the rights and humanity of individuals, particularly minorities and other vulnerable individuals, over corporate, government, financial, and other elitist interests.

Additionally, as with Thomas, the the right-wing judicial activists customarily harken back wistfully to a past “golden” age of American Jurisprudence when the exclusively white, male, nearly 100% Christian Supremes were perfectly happy to look the other way and bend the rules to favor ruling elites over African Americans, women, children, the poor, non-Christians, and others who weren’t part of the “ruling elites.” Thomas laments the abandonment of the views and methods of the “18th & 19 century” American judiciary. Most ironically, under those rules and the “world outlook and values” they often embodied, it’s highly unlikely that Thomas himself would have been able to attend Yale, become a Justice, or otherwise be allowed and encouraged to reach his full potential.

Quite contrary to Thomas’s argument, we can’t and shouldn’t take “value judgement” out of judging. Indeed, Thomas’s plea to let the Legislature and the Executive run roughshod over constitutional rights if they choose to do so is, in and of itself, a clear “value judgment” as to what best serves society. Making “value judgments” is at the heart of all judging. That isn’t the problem. No, the real problem is the lack of consistent human (and humane) values, practical experience, and human empathy in too many of today’s Federal Judges, particularly those appointed by Trump and Moscow Mitch.

At least we clearly know what’s coming in the future from the “Trump Judiciary” and their cheerleaders like Thomas. Consequently, it’s critically important that “Democrats and liberals” act accordingly the next time they get control over Federal Judicial appointments.

Due Process Forever!
