PRESIDENT BIDEN has served notice that his ambitious immigration plan is in the first rank of his priorities. Some of his program will be immediately implementable; some may get bogged down in Congress, where many Republicans will regard it as an occasion to brandish the word “amnesty,” red meat for their bases. No matter. Mr. Biden’s plan is in keeping with the United States’ best traditions. It responds to the challenge of population stagnation. It would reverse his predecessor’s extravagantly cruel policies. And it is now clear that when it comes to immigration, Mr. Biden is all in.
That courageous stance was not necessarily expected or politically expedient. Unity was the new president’s campaign theme and inaugural touchstone, yet few issues are as divisive as immigration. His evident readiness to tap his modest reserves of political capital for a slugfest on immigration is a signal that the United States has returned to its roots as a beacon for refugees and a humanitarian role model among nations.
The plan is also smart. The U.S. population growth rate in the just-ended decade was the lowest since the first national census in 1790, according to the Brookings Institution — lower even than during the Great Depression of the 1930s. The number of Americans below the age of 18 actually shrank in the 2010s, by more than 1 million.
That stagnation, the product of an aging population and historically low fertility rates, cannot be reversed by immigration alone. But it will certainly be exacerbated, and has been in the past four years, by a policy hostile to newcomers. In President Donald Trump’s penultimate year in office, annual net immigration fell below 600,000, the lowest level in decades; it was more than 1 million in the final years of the Obama presidency.
What’s more, by proposing an eight-year path to citizenship for most of the nation’s 11 million unauthorized migrants — the centerpiece of his plan — Mr. Biden is attempting to align law and reality. By 2029, when they would be eligible for citizenship, most will have been in the United States for more than a quarter-century. At least 4 million are essential workers in construction, food processing, groceries, restaurants, agriculture and transportation — doing jobs critical to practically every American.
Mr. Biden is moving quickly where he can — fully reinstating the Obama-era program providing work permits and deportation protection for “dreamers,” young migrants brought to this country by their parents; rescinding Mr. Trump’s 2017 travel ban from majority-Muslim countries; halting construction of the southern border wall; and reining in the Trump administration’s aggressive deportation policies. He has also signaled he will increase annual refugee admissions, which Mr. Trump poleaxed, and scrap a Trump administration rule that denies green cards to immigrants deemed likely to use public benefits such as food stamps.
Other measures will require congressional action. Under legislation Mr. Biden is sending to Congress, green cards conferring legal permanent residency would be granted to dreamers as well as to immigrants from strife- and disaster-wracked nations who have been here for years.
The president is also pushing tougher border security — in recognition that the new administration is not inviting a wave of new migrants, still less amid a pandemic — though not as a precondition for his immigration reforms. His more impactful, long-term strategy to dissuade new waves of illegal immigrants is a concerted aid effort to boost economies and contain crime in Central America.
Mr. Biden has laid out an immigration program that would genuinely put America first.

Yesterday, the Supreme Court granted certiorari in Sanchez v. Wolf, which presents the question under the Immigration and Nationality Act whether a Temporary Protected Status (TPS) recipient may adjust his or her status to that of a lawful permanent resident. The Third Circuit held that TPS recipients were not entitled to adjust their status because TPS status was not an “admission,” under 8 U.S.C. § 1255. The Third Circuit decision in Sanchez conflicts with the rulings of the Sixth and Ninth Circuits.

Here’s the government’s position in a nutshell: Notwithstanding the “plain language” of section 244(f)(4) which makes holders of TPS status eligible to adjust status in the U.S. if they meet all of the requirements for legal immigration (usually an an approved visa petition based on family ties or job skills), we have employed legal gobbledygook to refuse to adjust them. Thereby, we mindlessly keep them in “suspended animation” in the U.S. although they are long-time productive members of our society who have resided here with permission and work authorization and now meet our criteria for permanent immigration.
Sound pretty stupid?That’s because it is! I actually had this issue argued before me at the Arlington Immigration Court. Not surprisingly, the ICE Assistant Chief Counsel was unable to come up with any rational reason for circumventing the statutory language to achieve a nonsensical result that actually unnecessarily inflated the case backlog and served no legitimate government purpose. Needless to say, I ruled in the respondent’s favor.
This isn’t “rocket science.” The new SG should join the petitioner’s counsel, JAIME W. APARISI (who regularly appeared before me in Arlington) and LISA S. BLATT (Williams & Connolly LLP) in agreeing that this issue was correctly resolved in the respondents’ favor by the Sixth & Ninth Circuits.
Then, ICE should ask the “new BIA” (real judges with immigration and human rights backgrounds appointed by AG Garland) to adopt this view nationwide.

No more bogus, contrived “circuit split;”
TPSers with adjustment eligibility can be taken out of EOIR’s ridiculous 1.1 – 1.5 million case backlog and returned to USCIS for routine adjustment of status;
Productive, long-time members of our society can become green card holders, get on the path to citizenship, and reach their full productive potential for both their benefit and the benefit of our society;
A win, win, win, instead of wasting time attempting to achieve an illegal, undesirable, yet fundamentally stupid, irrational, and counterproductive result;
And, unlike the stupidity going on now, it actually doesn’t require expenditure of funds (actually will save and perhaps even generate money from adjustment filing fees), major regulatory changes, new legislation, or protracted litigation. It’s “low hanging fruit” that the Trump immigration kakistocracy has let rot on the tree! Rational administration of the immigration laws can actually be quite efficient.
Is it any wonder that the EOIR bogus “court,” whose “guiding principle” is “always construe the law against the individual and in favor of DHS” is building uncontrollable backlog hand over fist, even with double the number of “judges?” This is “fraud, waste, and abuse” in action! 💸🤮 Not something I’d want to “own” if I were Judge Garland (which, of course, I’m not, and never will be)!
That’s how “practical scholarship” @ EOIR, DOJ, and ICE; smarter, better, more ethical progressive leadership at the DOJ; and the private/NGO/academic bar can work together to solve legal problems and stop wasting the time of the Federal Courts and the Supremes. Perhaps, with the time saved, the Williams Connolly LLP team can even take some more pro bono asylum cases, make the system work better at the “retail level,” and save some deserving lives of vulnerable individuals who have been mistreated by Miller and his neo-Nazi gang of thugs and the malicious incompetents now “running” EOIR (into the ground) in the process.
Not rocket science! But, it will require Judge Garland to bring in some members of the NDPA who actually understand the interrelated issues of immigration, human rights, due process, civil rights, equal justice, and practical problem solving to replace the current “Clown Show” 🤡🦹🏿♂️ at EOIR and the DOJ. (Not to mention, a comprehensive “de-clownification” 🦹🏿♂️🤡 of DHS by Secretary-designate Mayorkas and his team). All of those skills have been conspicuously absent from the Executive branch during the last four years of kakistocracy.

President-elect Joe Biden, who pledged to serve all Americans, can respond boldly to address the needs of large swaths of rural America where people feel left behind. In the first 100 days of his administration, he can prove that he wants to see real change and will act to secure broader prosperity.
Drawing on more than 20 years of working in communities across four rural states, we see actionable, specific opportunities for Biden to make federal policy work for rural places. Here’s what we recommend:
• Engage in genuine conversations in rural places about the role of the federal government. The pandemic aside, fundamental economic changes, limited career pathways and crumbling (or non-existent) infrastructure plague many rural places. These challenges require public-private partnerships, directed by local needs and leadership. Many of the federal programs designed to address the underlying issues in rural places fail because they were designed for the rural reality of 1960, not of today. Let’s get current, understand why programs aren’t working and make them better.
• Elevate rural to the level it deserves in the president’s Cabinet. Rural places are currently served through a web of programs spread across numerous federal agencies. One might think this approach would help address policy deficiencies, but in fact, when everyone is in charge, no one is. The Biden administration can send a strong message that it means business by putting someone clearly in charge of its rural agenda and creating a new Department of Rural Development dedicated to improving, centralizing, and deploying the support and services necessary for rural people and places to thrive.
• Invest in doing economic development differently in rural places. Federal employees work diligently on their mission, providing grants and other services to constituents as directed by statute. And yet, the available tools for solving complicated, systemic and immediate issues are limited. To do economic development differently – and better – we need to eliminate programs that have limited utility, expand others that focus on building capacity in rural places, increase the flexible application of federal dollars and move the measurement of economic development outcomes beyond one-dimensional (and fleeting) metrics like job creation.
• Focus on and communicate about rural-urban connections rather than the divide. Rural places don’t benefit from being talked about as a monolith, a backwater or fly-over country. Rather, we as a nation need to raise up narratives and policies that recognize differences in rural places across the country, and that celebrate and support the natural, community, and economic assets that define those communities and their relationship to nearby urban areas. The stereotype of the American dream is changing. We now have a tapestry of rural, suburban and urban, and an opportunity to focus on collective prosperity rather than competition, exclusion and negative trade-offs.
The first hundred days will show how the Biden presidency will serve all Americans. Yes, there is a pandemic raging, but the widening gulf between rural and urban, rich and poor, red and blue requires a new tone, a new path and new solutions. Let’s get to it.

These are great, and timely ideas. They also present an outstanding opportunity to use the power of immigration to make our country a better place for everyone.
Immigrant entrepreneurs, small businesspeople, and investors can pool their ideas, skills, and resources with rural communities. Innovative rural Americans can help redesign and tailor methods that have worked in other countries for the American situation.
Immigrants with experience in agriculture and product marketing can help alleviate some of the labor shortages in rural areas.
Immigrants with tech skills can partner with rural Americans to help insure that, rather than sometimes being left behind, rural areas are on the cutting edge of accessible, high speed, state of the art technology that will integrate many educational and commercial activities with those now centered in “urban hubs.” (For example, why couldn’t a high tech area in rural America where land and housing are cheaper and a skilled (or highly motivated and trainable) workforce is eager for work be just as effective as Crystal City, VA as the next big tech hub?)
Immigrants with health service backgrounds can assist even more rural communities in insuring that first-class healthcare (and the jobs and economic opportunities it creates) is available everywhere in America.
My experience is that immigrants of all types, like rural Americans, highly value education, particularly for future generations. Innovative educational programs can be developed to meet the common needs of immigrant and rural communities.
There are just a few of the opportunities that come to mind. Obviously, I’m not a labor economist. But, I’m sure that if immigrant advocates concentrate on ways to actively engage and integrate immigrants into solving problems and improving the quality of life in rural and small-town America there are many other great opportunities for success out there just waiting to be tapped.
Immigrants have always been “part of the solution” rather than “part of the problem” in America. After four years of counterproductive unrestrained bigotry, false narratives, and hate-driven lies, its time for “truth, justice, and the American way” to come to the forefront again.

Last Wednesday, I broke the news to Heather Cox Richardson that she was the most successful individual author of a paid publication on the breakout newsletter platform Substack.
Early that morning, she had posted that day’s installment of “Letters From an American” to Facebook, quickly garnering more than 50,000 reactions and then, at 2:14 a.m., she emailed it to about 350,000 people. She summarized, as she always does, the events of the day, and her 1,120 words covered a bipartisan vote on a spending measure, President Trump’s surprise attack on that bill, and a wave of presidential pardons. Her voice was, as it always is, calm, at a slight distance from the moment: “Normally, pardons go through the Justice Department, reviewed by the pardon attorney there, but the president has the right to act without consulting the Department of Justice,” she wrote. “He has done so.”
The news of her ranking seemed to startle Dr. Richardson, who in her day job is a professor of 19th century American history at Boston College. The Substack leader board, a subject of fascination among media insiders, is a long way from her life on a Maine peninsula — particularly as the pandemic has ended her commute — that seems drawn from the era she studies. On our Zoom chat, she sat under a portrait that appeared as if it could be her in period costume, but is, in fact, her great-great-grandmother, who lived in the same fishing village, population a bit over 600.
She says she tries not to think too much about the size of her audience because that would be paralyzing, and instead often thinks of what she’s writing as a useful primary document for some future version of her historian self. But there was no ignoring her metrics when her accountant told her how much she would owe in taxes this year, and, by extension, just how much revenue her unexpected success had brought. By my conservative estimate based on public and private Substack figures, the $5 monthly subscriptions to participate in her comments section are on track to bring in more than a million dollars a year, a figure she ascribes to this moment in history.
“We’re in an inflection moment of American politics, and one of the things that happens in that moment is that a lot of people get involved in politics again,” she said.
Many of those newly energized Americans are women around Dr. Richardson’s age, 58, and they form the bulk of her audience. She’s writing for people who want to leave an article feeling “smarter not dumber,” she says, and who don’t want to learn about the events of the day through the panicked channels of cable news and Twitter, but calmly situated in the long sweep of American history and values.
Dr. Richardson’s focus on straightforward explanations to a mass audience comes as much of the American media is going in the opposite direction, driven by the incentives of subscription economics that push newspapers, magazines, and cable channels alike toward super-serving subscribers, making you feel as if you’re on the right team, part of the right faction, at least a member of the right community. She’s not the only one to have realized that a lot of people feel left out of the media conversation. Many of the most interesting efforts in journalism in 2021, some of them nonprofit organizations inspired by last summer’s protests over racism, will be trying to reach people who are not part of that in-group chat. One new nonprofit, Capital B, plans to talk to Black audiences, while another well-regarded model is Detroit’s Outlier Media, which is relentlessly local and often delivered by text message. For Dr. Richardson’s audience, it’s an intimate connection. She spends hours a day answering emails from readers. She spent most of Saturday sending thank-you notes for Christmas presents.
The challenge for many of those efforts, and for nonprofit news organizations in general, has been reaching large numbers of people. Dr. Richardson, whose run of short essays began when she was stunned by the response to one she posted last September, has done that by accident, though she credits her huge audience of older women to the deepening gender gap in American politics.
“What I am doing is speaking to women who have not necessarily been paying attention to politics, older people who had not been engaged,” Dr. Richardson said. “I’m an older woman and I’m speaking to other women about being empowered.”
Dr. Richardson confounds many of the media’s assumptions about this moment. She built a huge and devoted following on Facebook, which is widely and often accurately viewed in media circles as a home of misinformation, and where most journalists don’t see their personal pages as meaningful channels for their work.

Dr. HCR is certainly a favorite at our house! Her writing is very “accessible” — you don’t have to be a scholar or an academic to understand her “info packed” daily letters.
She also illustrates the important role of history and the liberal arts at promoting critical thinking and informed analysis at all levels of our educational system.
“Conspiracy theories,” intentionally false narratives, myths, racial bias, inequality, and hatred all flourish in the dark.
The bipartisan compromise was considered a done deal and won sweeping approval in the House and Senate after the White House assured GOP leaders that Trump supported it.
If he refuses to sign the deal, which is attached to a $1.4-trillion government funding bill, it will force a federal government shutdown, in addition to delaying aid checks and halting unemployment benefits and eviction protections in the most dire stretch of the pandemic.
“Made many calls and had meetings at Trump International in Palm Beach, Florida. Why would politicians not want to give people $2000, rather than only $600?” he tweeted after leaving the golf course Friday afternoon. “It wasn’t their fault, it was China. Give our people the money!”
Trump’s attack on the bill has been seen, at least in part, as punishment for what he considers insufficient backing by congressional Republicans for his push to overturn the Nov. 3 election results with unfounded claims of fraud.

About 11:30 AM yesterday, I was on our screen porch working on Courtside. I heard the first joyful shouts. Simultaneously, my iPad screen told me that Pennsylvania had been called for Biden. I bellowed out a loud, YES! Then, I put up our American flag.
At 5 PM, by arrangement on the neighborhood e-Mail, folks started streaming out their doors, standing on the curb, glasses and champaign bottles in hand, for a toast to Joe Biden, Kamala Harris, the return of democracy, rationality, and human decency. Then we mixed and mingled, of course in a socially distant way. Dogs and kids were welcome. “Finally, able to breathe again” was a common refrain, as was “national nightmare coming to an end.”
Our neighbors are from all backgrounds and many different origins: doctors, lawyers, teachers, techies, designers, consultants, Federal bureaucrats, immigrants, parents, grandparents, singles. One mother had been naturalized just so she could vote in this election. All of us shared relief and joy at the return of sane, humane sound government and informed, reasonable dialogue on how to resolve our pressing national problems.
Later we adjourned to a back yard fire pit and celebrated and chatted some more, before drifting away to our respective homes. Cathy and I left the empty bottles and plastic cups on our lawn, intending to clean up in the daylight. But, by the time we arose, one of the neighbors had already done the job for us.
The aura of optimism still hung in the air today. At least for now, the world looks a lot brighter than it did four years ago.

A new fact sheet by Nina Siulc and Noelle Smart of the Vera Institute of Justice summarizes new evidence showing that most immigrants appear for their immigration court hearings. The report includes data from Vera’s Safety and Fairness for Everyone (SAFE) Initiative that provides free representation through a universal access model of representation. It’s particularly critical in an era where the politicized and “ethically challenged” DOJ often puts forth largely fictionalization versions of their self-manufactured “immigration emergency” that is actually little more than the outcome of studied ignorance, White Nationalism, “gonzo” enforcement, and maliciously incompetent administration of the Federal immigration bureaucracy.

If we kick out the kakistocracy next week, we could put qualified “practical scholars” like Ingrid and others like her in charge and remake both DHS and the Immigration Courts to actually operate as required by Due Process while also fulfilling legitimate law-enforcement objectives. To state the obvious, neither of these objectives is being realized at present. It’s bad for America and for humanity.
For far too long, the wrong individuals, lacking the necessary expertise in immigration and human rights, and also lacking a firm commitment to equal justice under law, have been “in charge” of the Government’s immigration policy and legal apparatus and appointed to the Federal Courts, at all levels. That’s particularly true at the Supremes where only Justices Sotomayor and (some days) Kagan appear “up to the job.”
We will never end institutionalized racism, achieve equal justice for all, and realize the true human and economic potential of America until we bring our broken immigration and refugee systems and our failing Federal Judicial System into line with our Constitutional and national values. That process must start, but certainly will not end, with this election!
WASHINGTON — President Donald Trump‘s senior adviser Stephen Miller has fleshed out plans to rev up Trump’s restrictive immigration agenda if he wins re-election next week, offering a stark contrast to the platform of Democratic nominee Joe Biden.
In a 30-minute phone interview Thursday with NBC News, Miller outlined four major priorities: limiting asylum grants, punishing and outlawing so-called sanctuary cities, expanding the so-called travel ban with tougher screening for visa applicants and slapping new limits on work visas.
The objective, he said, is “raising and enhancing the standard for entry” to the United States.
Some of the plans would require legislation. Others could be achieved through executive action, which the Trump administration has relied on heavily in the absence of a major immigration bill.

“In many cases, fixing these problems and restoring some semblance of sanity to our immigration programs does involve regulatory reform,” Miller said. “Congress has delegated a lot of authority. … And that underscores the depth of the choice facing the American people.”
Miller, who serves in a dual role as an adviser in the White House and to Trump’s re-election campaign, stressed that he was speaking about second-term priorities only in his capacity as campaign adviser.
Immigration has been overshadowed by surging coronavirus case numbers and an economy shattered by a nearly yearlong pandemic, but it was central to Trump’s rise to power in the Republican Party, and Miller has been a driving force for the administration’s often controversial policies to crack down on illegal migration and erect hurdles for aspiring legal immigrants.
Miller has spearheaded an immigration policy that critics describe as cruel, racist and antithetical to American values as a nation of immigrants. He scoffs at those claims, insisting that his only priority is to protect the safety and wages of Americans.
And he said he intends to stay on to see the agenda through in a second term if Trump is re-elected.
In the near term, Miller wouldn’t commit to lifting the freeze on new green cardsand visas that’s set to expire at the end of the year, saying it would be “entirely contingent” on governmental analysis that factors in the state of the job market.
Asked whether he would support reinstating the controversial “zero tolerance” policy that led to families’ being separated, Miller said the Trump administration is “100 percent committed to a policy of family unity,” but he described the policy as one that would keep families together in immigration detention by changing what is known as the Flores settlement agreement.
Over the past year, the administration has sought to amend the Flores agreement, which says children can’t be held over 20 days in Immigration and Customs Enforcement detention. If it succeeds, immigrant families could be detained indefinitely as they await their day in immigration court.
On Trump’s watch, asylum grants have plummeted. Miller wants to keep it that way. He said a second-term Trump administration would seek to expand “burden-sharing” deals with Honduras, Guatemala and El Salvador that cut off pathways to the U.S. for asylum-seekers.
“The president would like to expand that to include the rest of the world,” Miller said. “And so if you create safe third partners in other continents and other countries and regions, then you have the ability to share the burden of asylum-seekers on a global basis.”

Kids in cages, refugees returned to torture and death, ethnic communities terrorized, lives destroyed, an economy and a society (make no mistake about it, immigrants will be essential to America’s recovery, future prosperity, and competitiveness) in tatters, tens of millions wasted on unnecessary and counterproductive Gulags, walls, and cruel enforcement while the Gruppenfuherer and his fellow human rights criminals remain at large and and an existential threat to our nation and our world!
To state the obvious, this has little or nothing to do with protecting American workers. Trump has shown that he couldn’t care less about the health, safety, and welfare of American workers (or frankly anybody except himself) except at election time. Immigration and immigrants create jobs and economic prosperity for America.
Also, even Miller couldn’t possibly believe that the Democratic House will pass any part of this racist manifesto. Truth is, Trump failed to pass any meaningful immigration legislation in four years, even when the GOP controlled all the political branches! In fact, Miller’s nativist legislative game-plan “poisoned the well” and was soundly defeated in both Houses of Congress! So, he intends to use Executive misrule, bureaucratic corruption, and a fascism-enabling, racially tone-deaf GOP Supremes’ majority to rule without Congress (as has been the case for the last four years.)
But make no mistake: the real “Reichsplan” here is directed at further institutionalizing racism, spreading hate, and targeting Americans of color. That’s what the regime’s “Dred Scottification” is really about. Reducing or eliminating YOUR Constitutional rights! Immigrants are the “usual suspects.” But, by no means will they be the only victims of Gruppenfuhrer Miller’s White Nationalist, racist, hate extravaganza.

“They are so well taken care of. … They’re in facilities that were so clean,” President Donald Trump said during last week’s presidential debate, of the children his administration ordered separated from their parents at the southern border. As my colleague Jeremy Stahl points out, this isn’t the first time that an administration official has argued that because the separated children—over 500 of whom are still being kept from their parents—have (supposedly!) been physically taken care of, they should be “just fine.” But if the life histories of children forced to be parted from parents for years of their childhoods are any indication, these periods of separation will have long-lasting, devastating, and unpredictable effects.
I’ve been reading historian Rebecca Clifford’s new book, Survivors: Children’s Lives After the Holocaust, which is a painful history of Jewish kids who somehow made it through World War II when they were very small, and had to figure out how to forge a life afterward. Combining analysis of survivors’ testimonies recorded over the years, documents from the archives of organizations that came into contact with these children, and oral histories Clifford herself collected, the book shows how many of these survivors struggled with the act of making sense of their lives—even the lucky ones, who didn’t witness violence, and whose material needs were well met during the period of conflict and persecution. Clifford calls the work “fundamentally a book about the history of living after, and living with, a childhood marked by chaos.”
Survivors is, of course, about a group of children whose lives were marked by the Nazi regime, not about children fleeing violence in Central America, who were then separated from their families by Border Patrol agents. But it’s also fundamentally concerned with the human consequences of children’s separations from parents. In the group of survivors in Clifford’s history, there are kids who were sent to live with host families, who hid them until the war was over; kids incarcerated in different labor camps from their parents; kids who wandered the forests alone, tended only by older siblings.
Asking the historical record, and the grown-up survivors she interviewed, how this period of separation had affected the children’s lives in the long term, Clifford found things that she described as “not only unexpected, but shocking.” One such finding was the fact that for many of the kids, the war years were fine; it was liberation that was traumatic. “Children are adept at treating the exceptional as normal, and because they had no other life to compare it with, the years of persecution did not necessarily feel dangerous, fraught, or chaotic to young survivors,” Clifford writes. But after liberation, as well-meaning adults did everything they could to bring the kids back together with their surviving family members, or to find them places in Jewish homes, many of the separated survivors were profoundly destabilized. “My war began in 1945, not in 1940,” one such survivor said.
The German Jewish parents of Felice Z., who was born in October 1939, put their 1½-year-old daughter in the hands of aid workers in early 1941, and the girl spent the war years hidden by farmers in France. Felice Z. remembered in later interviews that she loved her host parents, and in particular her host mother, Madame Patoux: “All they were interested in was taking care of me. She basically saved my life. She was always ready to run. … I took it for granted that she was my mother, I called her meme (nana) and it was really the first close relationship that I had with another human being. I became very attached to them. Very.” At the end of the war, Felice got no joy out of being reunited with her sister, who had become a stranger. Soon after that reunion, she was removed from the family where she had grown up; as she remembered it, nobody bothered to explain why.
“Family reunions could be among the most difficult and distressing experiences that children went through after the war,” Clifford writes. “The youngest children might have no memory of their parents or relatives at all, and were effectively returned to strangers. … Not one child in this study who was returned to his or her family found this process easy or joyful.” The reunions brought up feelings of anger and terror—even if, as Clifford points out, the kids could rationally understand the reasons their parents had put them in safer places for the duration of the war. They had spent years suppressing childish impulses—“they had had to be obedient, quiet, and good to stay safe during the war, whether they were in hiding, in ghettos or in camps”—and often became explosive and “difficult to manage” after the separation was over.

While we may never know the full extent of the damage inflicted by the Trump Administration’s family separation policy, it is evident—as a result of this investigation and public reporting—that it was driven by an Administration that was willfully blind to its cruelty and determined to go to unthinkable extremes to deliver on political promises and stop migrants fleeingviolencefromseekingprotectionintheUnitedStates. • Within weeks of President Trump’s inauguration, the Administration began formulating a plan to separate parents from their children as a means to deter migration.
• Before a formal policy had even been developed, the Administration was accelerating familyseparations. ByMarch2017,thenumberofseparatedchildrentransferredtoORR custody had increased by nearly 900 percent, as compared to November 2016.
• In July 2017, without warning, the Administration implemented a family separation pilot programintheElPasoBorderPatrolSector. Thepilotprogramlastedfivemonthsand resulted in hundreds of additional children being taken from their parents and placed in ORR custody.
• During the pilot program, the Administration discovered that it was unable to track separated family members in a way that would facilitate eventual reunification.
• Knowing this, and without doing anything to address the tracking systems employed by deferral agencies, the Administration chose to expand the policy nationwide in May 2018.
• To make matters worse, the Administration failed to provide advance notice of the policy to front line agents and officers, which caused unnecessary chaos and inconsistent implementation of the policy across border sectors.

• When judicial intervention and political pressure eventually resulted in the end of the policy, the lack of interagency cooperation and preparedness was laid bare by the inability of the Administration to quickly reunite separated parents and children.
As a result of this dark chapter in our nation’s history, hundreds of migrant children may never be reunited with their parents.
Despite considerable stonewalling by Administration officials, Judiciary Committee Members and staff have pushed relentlessly to obtain data and conduct much needed oversight of the agencies responsible for the family separation policy. Donald Trump’s re-election campaign poses the greatest threat to American democracy since World War II.
Mr. Trump’s ruinous tenure already has gravely damaged the United States at home and around the world. He has abused the power of his office and denied the legitimacy of his political opponents, shattering the norms that have bound the nation together for generations. He has subsumed the public interest to the profitability of his business and political interests. He has shown a breathtaking disregard for the lives and liberties of Americans. He is a man unworthy of the office he holds.
Since Amy Coney Barrett was nominated to the Supreme Court, Republicans have suggested that one of the reasons she should be given a lifetime appointment on the highest court of the land is that she has seven kids. Barrett is “a remarkable mother” with “seven beautiful children,” Senator Thom Tillissaid during the first day of her confirmation hearing. She’s a “tireless mother of seven,” Senator Chuck Grassley told the room. “She and her husband have seven children,” Senator Lindsey Graham said in his opening remarks, in case anyone hadn’t heard, before giving her two more. “She and her husband have seven children. Two adopted. Nine seems to be a good number,” he said. Obviously, constantly bringing up this part of Barrett’s biography is part of an attempt on Republicans’ part to (1) draw a distinction between Barrett and what they view as childless heathen Democrats, (2) claim that any opposition to her confirmation is anti-mom, and (3) suggest that since she’s a mother, she must be a good person who couldn’t possibly issue rulings that would hurt millions of people.
But, surprise! Despite being a mother, Barrett is expected to help overturn the Affordable Care Act. (After she was asked about this possibility, which would strip health insurance from millions, Grassley raged at his Democratic colleagues that “As a mother of seven, Judge Barrett clearly understands the importance of health care.”) She will also very likely go after Roe v. Wade, if given the chance, which some mothers would point out prevents their daughters—or even women they didn’t give birth to!— from being forced into back alley abortions. And even though she’s a mom of seven children, she apparently thinks the jury is still out on whether or not it’s bad to separate small children from their parents, if they happen to be from another country: . . . .

Just for the record, the Trump DOJ conceded before U.S. District Judge Dana Sabraw (a GOP appointee) that intentional child separation is a violation of Fifth Amendment Due Process.
They also declined to appeal Judge Sabraw’s order to that effect – unusual for a regime that usually pushes the most frivolous, clearly illegal, and unethical positions for as long as possible to the highest levels of the judiciary (knowing that the “Roberts” Five” believes that ethical requirements and disciplinary procedures don’t apply to the Trump legal team assembled on your taxpayer dollars).
Wonder what would happen if we had a more honest and realistic confirmation system that allowed nominees to actually answer truthfully, rather than disingenuously claiming under oath that after a lifetime of intense public involvement in the law, politics, and public policy, they had no real views on anything of any importance whatsoever?
I actually doubt that an honest answer to this question, either way, would have cost Coney Barrett her politically-assured confirmation, nor would it have required recusal in any litigation likely to reach the Supremes’ merits docket. So, Coney Barrett thinks we’re dumb enough to believe that after several days of her GOP sponsors touting the wonderfulness of her bold embrace of their far-right agenda — the first overtly “pro-life woman Justice” — that they are badly mistaken and, in fact, she has no views or opinions on anything.
It kind of reminds me of the “super-disclaimer” I used to give on those occasions when my “EOIR handlers” let me speak in public: “Nothing that I say today represents my view on any case that I decided in the past, is pending before me, or might come before me in the future.”
On the bright side, Coney Barrett was able to (sort of) answer the question of Sen. John “I’m Not JFK” Kennedy (R-LA) about who does the laundry at her home (supposed to be her kids, but apparently they haven’t completely gotten the message. Now, if ACB were before me in Immigration Court, this is the point when I would have turned to the kids and said “Come on kids, Mom’s doing it all for you and others, I want you to give her and your Dad a hand.”)
Seriously, though, Dems, here’s the definition of Justice Amy Coney Barrett: “It’s what you get when lose elections for the White House and the Senate.” If you really want the next woman Justice to be a worthy progressive successor to the legacy of RBG and a “soul mate” for Justice Sonia Sotomayor, then go out and win the elections necessary to make that happen!
Another huge plus: If we Dems could figure out how to translate our national political majority into control of all three political arms, we could shore up health care, address COVID in a rational way, help Americans who have lost livelihoods and confidence because of COVID, and create educational opportunities and jobs that will be durable and serve us well in the Post-COVID world. We could also address the deficit by undoing the revenue shortage resulting from unwarranted tax giveaways to the wealthy, and get “more bang for our tax dollars” by running government wisely, prudently, and efficiently, for the overall public good rather than for the benefit of grifters and their selfish, anti-democracy far-right agenda.
Then, we could see whether Justice Barrett will stick to her word and urge her colleagues to “let the political branches of Government make policy.” That’s something that has been a challenge for past right-wing jurists, including the late Justice Scalia. But, if it actually happened, it would make the issue of “enhancing” the Supremes with progressive Justices largely moot.
Which is probably why Joe & Kamala have wisely refused to “take the GOP bait” on how they might specifically solve a problem that might or might not exist in the future. I do know one thing, however. As reflective, reasonable, and thoughtful public officials who listen to expert advice, they will promote the best possible solution for all Americans under the circumstances. That’s certainly a “quantum leap” over where we are today!
Hillary is an amazing example of how the younger generation of the NDPA is courageously fighting for leadership positions that will change America for the better at all levels!The NDPA has been dominant in courtroom advocacy, scholarship, and clinical teaching. We now need to “take it beyond the courtrooms, classrooms, law journals, and op-ed pages!”
It’s time for the NDPA to make our shared vision of due process, fundamental fairness, and equal justice for all a reality! Take the fight for social justice and America’s heart, soul, and future to the judicial benches, legislatures, and public offices — from the municipalities, to the states, to the highest levels of our Federal System — and beyond to leadership on the world stage!
Dahlia: I wonder what you thought of Barrett’s statement, about how she reads each of her opinions through the eyes of the losing party. As you have written, the losing party tends to be the prisoners, the Black worker, the teen seeking abortion, the asylum seeker. It reminded me of Justice Samuel Alito testifying at his hearings about his great solicitude for immigrants.
Mark: Barrett’s opening statement made me think about one of her worst decisions (so far), in which she approved the deportation of an asylum seeker because there were small, trivial variations in his account of persecution. Over a dissent, Barrett said, yep, this asylum seeker must be sent home to be tortured and murdered because tiny details in his story changed over time. Would a judge who views the case through the eyes of the asylum seeker really dismiss his claims so cavalierly? I doubt it.

So much for intellectual honesty! It also shows Barrett’s fundamental lack of experience and legal understanding of what Immigration “Courts” really are and how they have been politicized and weaponized against asylum seekers by “judges” who report to overtly biased and xenophobic politicos in the Executive Branch. Just how would this “naked farce” satisfy any rudimentary concept of Due Process? Clearly it doesn’t. And just as clearly, intentionally tone-deaf judges like Barrett don’t care!They lack the guts, relevant experience representing migrants, and the intellectual presence to stand up for the Constitutional and human rights of “the other.”
How would YOU like to be sentenced to torture and/or death based on trivial inconsistencies found by an Immigration “Judge” working directly for the Attorney General and his regime in a badly flawed assembly line process designed to achieve political policy objectives, not justice?

Better Judges For A Better America! Judge/Justice Barrett is part of the problem, not the solution! The best way to insure that she is among the last, far-right, anti-democracy, inhumane judges given life tenure on the Supremes or anywhere else, vote ‘em out, vote ‘em out! Then, we’ll discover the “true meaning” of Barrett’s “I’m not there to make policy nonsense!” (Indeed, I would submit that the sole reason for her appointment was the GOP’s belief and expectation that she will reliably elevate disingenuous right-wing policies, biases, and prejudices over the Constitutional, individual, and human rights of individuals and that she will be a steadfast opponent of Constitutionally-required equal justice under law.)
Justice for the George Floyds, Breonna Taylors, dehumanized dead asylum seekers, and wrongfully imprisoned migrant kids of the world (e.g., the end of unconstitutional “Baby Jails”) will require a different type of “Justice” than Amy Coney Barrett in the future! Far from being truly “independent” and “apolitical,” Barrett is likely to be the perfect representative of the warped man who appointed her and his anti-democracy party. And, that’s likely to cause problems for all Americans of good will far into the future!
Last month, a nurse at a federal immigration detention center in Irwin, Georgia, filed a whistleblower complaint detailing the abhorrent treatment of people detained there. She charged that women in detention were subjected to hysterectomies and invasive gynecological exams without their knowledge or consent, and often without assistance from interpreters.
The complaint is heartbreaking, but far from surprising. These atrocities are consistent with practices employed at U.S. detention centers for decades, and they are sadly consistent with our tragic history of forced sterilization of minority women. The implications of the complaint are perfectly clear: we must end the civil detention of immigrants, so fraught with systemic racism that undervalues the lives of Black, Indigenous and other people of color. There is no other option.
With over 200 detention centers, the United States has the largest immigration detention system in the world. Immigration and Customs Enforcement (ICE) has over the past two years detained an average of 40,000 daily, an astonishing number that surpasses the population of Wisconsin cities like Brookfield and Wausau. Yet the detention of immigrants is just a microcosm of the inhumanity that characterizes our immigration system today. Many immigrants come to the U.S. to seek refuge and a better life for themselves and for their families. But when they arrive in this country, they are forced into conditions that violate human rights principles under both international and domestic standards, and that, frankly, violate our moral obligations to each other as human beings.
ICE has the authority to release most people from detention through monetary bonds or parole, and ICE policy requires that people seeking asylum are released from detention when they can establish their identity and demonstrate they are neither a danger nor a or flight risk. Instead of using these tools, though, ICE almost always chooses detention, ostensibly to deter others from coming into the country. But far from showing detention to be an effective deterrent, statistics reveal the opposite: harsher penalties have not reduced the numbers of undocumented migrants crossing U.S. borders. What the data does show is how immigrant detention has become a big business, with taxpayer dollars helping to subsidize a billion-dollar private prison industry that profits from human trauma.
Often located in remote places, immigrant detention facilities are ripe for the abuse of detained migrants. There is no community oversight and little — often no — access to legal representation. People in detention will only have an attorney if they can afford one or are lucky enough to find pro bono representation.

Erin reinforces points that I make often here on Courtside: the real objectives of unnecessary and highly cost-ineffective “civil detention” are to deprive migrants of access to counsel, coerce them into abandoning potentially successful claims, punish them for exercising legal rights, and deter others from asserting legal rights.
All of these are clear violations of Constitutional due process and equal protection! The conditions under which these non-criminals are held to “punish” them for their audacity to assert their legal rights also violate the Eighth Amendment, as some lower Federal Court Judges have found.
Unfortunately, too many Article III Judges have abdicated their oaths to uphold the Constitutional rights of the most vulnerable persons among us in the face of improper political pressure and a regime overtly out to undo American democracy and institute a far-right reactionary, white nationalist kakistocracy.

Erin and others like her are exactly the type of progressive, practical, scholar-problem solvers that we need as Federal Judges and in key Government policy-making positions. We need to replace the reactionary kakistocracy with a progressive, equal justice oriented, practical, problem-solving humanitarian meritocracy.
“Equal Justice For All” isn’t just a “throwaway slogan.” It’s a vision of a better, more efficient, more effective, more tolerant, more inclusive, more diverse, more representative Government that will work with people of good faith everywhere to maximize opportunities for all and promote a brighter future for everyone in America! It’s in our power to make it happen,and the necessary change starts this Fall.
A plague was the check and balance, not the rule of law, not civility. Trump and Republicans showed hubris in the face of a force of nature that cannot be gaslit, bullied, or emotionally manipulated. A virus demands you engage with it truthfully. You can’t bluster your way out of infection. Trump’s lies and arrogance regarding Covid-19 have cost 210,000 Americans their lives. Those lies and arrogance have finally caught up with him, and he may pay a heavy price. Some people think that’s poetic justice. They are being rebuked by those who think you should never be that callous, not even to a fascist.
Fascists know how to weaponize the norms governing civility to gain and maintain control over others. They know how to exploit sympathy. They know if they pretend to play nice sometimes, people believe they’ll begin to adhere to these norms and stop their harm. It’s a con. It works, though. That’s why four years into the Trump regime, reporters and pundits are still, embarrassingly, talking about his change of tone and his becoming more “presidential” any time he displays the barest modicum of decorum. This dynamic lowers the bar all the way down to Hell. Playing along is always the wrong move.

Excellent summary of how fascism works and how the “mainstream” keeps giving it a “pass” and normalizing severely abnormal, anti-social, illegal behavior by Trump and his toadies.
Just look at yesterday’s Courtside posting — kids and legal refugees continue to suffer while Sessions collects his pension, Hamilton continues to plan criminal enterprises on our dollar, and Rosenstein racks up the big bucks pretending like his venture into child abuse and crimes against humanity were just “normal activities of a senior Government official at the DOJ.” Not normal! Not acceptable!
History tells us what happens to those who “play along to get along.” The U.S. Olympic Committee turning an intentionally blind eye to Hitler’s virulent anti-Semitism so that the U.S. could participate in “Hitler’s Big Show” — the 1936 Olympics. British Prime Minister Neville Chamberlain selling out the Czechs, babbling about “peace in our time” on the eve of the bloodiest war in world history, and pretending that Hitler was “just another German politician” with “traditional” nationalist aspirations.
This Fall, vote Trump and the GOP out at all levels of Government. It might be the last chance to save our democracy from fascism and to save more lives from the malfeasance, ignorance, hate, and evil of Trump and his GOP enablers.
