Ayuda’s Film Screening of The Courtroom – Opening Remarks by Paul Wickham Schmidt 

Georgetown University, McCourt School of Public Policy

September 18, 2024


Good evening and welcome everyone! Thanks for coming out to support Georgetown’s partnership with Ayuda.

My name is Paul Wickham Schmidt, and I’ve been given the privilege to introduce this powerful film, The Courtroom. Before I introduce a special guest, who is no stranger to the film and silver screen, I would like to share why this story is so important to me.  My experience has landed me in an interesting corner of many of tonight’s themes and key players in making this event possible.

I was appointed as a federal immigration judge and served for 21 years, at both the trial and appellate levels. During my time as an adjunct professor at Georgetown Law, I’ve written extensively about immigration law. And, I’m currently a proud Advisory Board member for Ayuda, an organization that I truly care about and has deep roots in this community.

In fact, Ayuda helped all of us during my tenure in the “Legacy” Arlington Immigration Court with their superior pro bono representation. You will witness this evening the critical, life-saving and future-determining, role played by great legal representation in Immigration Court.

And, if you don’t already know, you will be astounded to learn that in Immigration Court individuals, including infants and toddlers, face trial for their lives without the right to appointed counsel!  I want you to imagine how this case might have come out if this individual had been required to represent herself throughout her various legal proceedings. Yet, that is the predicament in which far, far too many individuals now find themselves.

I just read a TRAC Syracuse report that fewer than 15% of those ordered deported in Immigration Court in August 2024 were represented. I find that appalling! It’s actually a regressive trend since I left the bench. That’s why the role played by organizations like Ayuda and the teaching function of the CALS Asylum Clinic here at Georgetown Law are so completely essential to American Justice at what I call the “retail level.”

Now, I’m not here to read my resume. Instead, I will share why The Courtroom holds so much significance for us. The late film critic Roger Ebert once said, “the movies are like a machine that generates empathy.” The classic legal dramas like “12 Angry Men,” or “To Kill A Mockingbird,” for example, give us great insight into the devastating experience of being tried for a crime one did not commit.

But never had I seen a filmmaker put the empathy machine to work in Immigration Court. That is, until I learned about The Courtroom from my friend and colleague retired Immigration Judge Jeffrey S. Chase of New York. He actually served as an informal advisor on the production and played an important “cameo role” in the earlier award-winning stage versions of The Courtroom, as did other of our retired judicial colleagues.

Many of us will be fortunate enough never to have to endure a removal proceeding as a subject ourselves. We will never understand what it’s like to face the fear of being separated from our children, our families, our jobs, and our communities: In the words of the Supreme Court “all that makes life worth living!”  (Ng Fung Ho v. White | 259 U.S. 276 (1922)).

The film you’re about to watch tells one woman’s story confronting these terrors, with the utmost compassion. The “script” is a verbatim transcript of an actual immigration case, brought to life by the great actors, directors, and producers at Waterwell.

When the credits roll, I hope you’ll remember that The Courtroom is much more than a story. It’s real-life drama, “living theater” as I used to describe it to my Georgetown Law students – and right now, more than 3 million immigrants undergoing deportation proceedings are living it, along with their families, friends, co-workers, and other community members whom they interact with on a daily basis.

It’s with great honor that I get the opportunity to introduce our next speaker. He’s an actor, director, and the screenplay writer of our feature presentation. He has received two Tony Award nominations and two Primetime Emmy Award nominations, and you might recognize him from Marvel Cinematic Universe. Grateful for the opportunity to support undocumented students at Georgetown University tonight to learn about entrepreneurship options available to them as part of Georgetown’s UndocuHoya Month.

As a Georgetown University Law Center and Georgetown University McCourt School of Public Policy alumna, it was an honor to teach these brilliant students about how to navigate the immigration law, business, finance, and tax systems, so that they can become more financially empowered with the opportunities available to them through entrepreneurship.

If only all universities celebrated their undocumented students, and had people like Jennifer A. Crewalk, Ph.D. supporting them, like Georgetown.

Starting the training, it was surreal to speak about my own great grandparents who came to this country with nothing and survived by starting little candy, liquor, and grocery shops in Georgetown.

If they had been immigrants today, they would have been considered undocumented – there just weren’t the immigration laws in place at the time that labeled them as such.

“The 272,” Rachel L. Swarns’s deeply researched and revelatory new book, is the story of the remarkable Mahoney clan and how their lives, nearly a century and a half after Ann Joice’s, intersected with those of Mulledy, McSherry and the Jesuits in one of American slavery’s most withering tragedies. “The 272” is a fascinating meditation on the meaning of slavery and of people converted to property and commodities — assets of wealth and objects of sale. It’s a book that journeys to slavery’s heart of darkness: to the separation of families, the terror of being sold into the vast unknown and of bodies transformed into profits and investments. But it is also the moving human story of some of the people who endured and survived this ordeal, and who have long awaited rediscovery.

Swarns, a contributing writer for The New York Times and a professor of journalism at N.Y.U., is an African American Catholic who was raised on Staten Island. Beginning with an article in The Times in 2016, she revealed the story of the Jesuits as slaveholders and traders, leading to a stunning reckoning by Georgetown University with its past as well as one within the Jesuit order itself. Swarns writes with a keen eye and distinctive voice both about her Black subjects and about the hypocrisy and brutality of their onetime owners. The Jesuits were no monolith of greed and evil, however; Swarns sustains empathy for some who tried, largely unsuccessfully, to protect the enslaved people they had known so closely from the agony of sale that looms over this story.

What comes through most effectively is the sorrow and the determination to survive of the enslaved people whom Swarns brings to light through her sleuthing and resonant prose. (Of Ann Joice, Swarns writes, “She would have no wealth, no land and no savings to leave her family, but she still had her story. … The story would be her legacy.”) Swarns also underscores the importance of Georgetown’s ongoing efforts at serious reparations for the deeds of its early leaders. An independent nonprofit, the Georgetown Memory Project, has identified around 6,000 living descendants of the original 272. In turn, the university has offered descendants formal “legacy” status for admission, sought atonement through a highly publicized apology and created a fund that would dedicate $400,000 a year to community projects, including support for health clinics and schools, likely to benefit descendants. Leaders of the Jesuit conference of priests have also vowed to establish a $100 million trust to benefit descendants and promote racial reconciliation.

No single work of history can remedy the vexing issue of repair for slavery in America, but “The 272” advances the conversation and challenges the collective conscience; without knowing this history in its complexity we are left with only raw, uncharted memory.

This is the kind of important, often intentionally buried, history that GOP white nationalists like DeSantis, Trump, and others don’t want read and honestly discussed. But, as with most artificially suppressed works, the truth will out! There are just too many people speaking it these days for even the neo-fascist censors to silence them all.

It also illuminates the heretofore unknown and unheralded stories of enslaved African-Americans like Ann Joice who, against the odds, persevered in a grotesquely unjust and horrible system so that future generations could have a chance at a better life. These are are among the real heroes of  American history who helped make our country what it is today. Their stories deserve to be told and studied.

The Let Freedom Ring Celebration is an annual celebration of the legacy of Dr. Martin Luther King, Jr., jointly presented by The John F. Kennedy Center for the Performing Arts and Georgetown University. Following a two-year hiatus prompted by the COVID pandemic, ‘Let Freedom Ring’ returns this weekend to the Kennedy Center Concert Hall with a stellar program headlined by Tony and Grammy winner Leslie Odom, Jr. and music produced by NEWorks Productions CEO, Nolan Williams, Jr.

The program will feature Odom performing a range of selections from the American songbook, Williams leading the Let Freedom Ring Celebration Choir and NEWorks Band, and the presentation of the 21st annual John Thompson Jr. Legacy of a Dream Award to Paula Fitzgerald, executive director of Ayuda.

Other program participants include: Naomi Eluojierior, Georgetown University student; Marc Bamuthi Joseph, VP & Artistic Director of Social Impact, The Kennedy Center; [Cheri Carter, Vice President,] Boeing (LFR Title Sponsor); and John J. DeGioia, President, Georgetown University.

Williams will present two original works as part of the program, performed by the Let Freedom Ring Celebration Choir and Band, Georgetown University student poets Cameren Evans, Isaiah Hodges, and Lucy Lawlor, and community soloists Roy Patten, Jr. and Laura Van Duzer.

The program [opened] with the world premiere of Williams’ “We’re Marching On!,” a work commissioned by Georgetown University. The piece draws inspiration from a 1965 speech by Dr. Martin Luther King, Jr. and features spoken word delivered by Evans, Hodges and Lawlor.

Williams’ second musical contribution is the social-justice-themed ballad, “We are the ones to heal our land.” Commissioned last year by Choral Arts Society and Washington Performing Arts, this work has been adapted for this occasion and will feature Patten and Van Duzer.

The program [closed] with a stirring rendition of Dick Holler’s 1968 classic “Abraham, Martin and John.” The song pays tribute to the memory of Abraham Lincoln, Martin Luther King, Jr., John F. Kennedy, and Robert F. Kennedy, all American icons of social change who were tragically assassinated.

[Odom then brought the audience to its feet one final time with a totally awesome and inspiring encore rendition of “Ave Maria,” to piano accompaniment, in recognition of the “Christ energy” of Dr. King: A characteristic that, to paraphrase Odom’s words, “transcends individual religious beliefs or non-beliefs!”]

[I loved that in his musical selections Odom took pains to showcase the talents of, and share the spotlight with, each member of his amazing band. That shows just the type of teamwork, awareness, humility, and appreciation of those who made and make you what your are that Dr. King preached. It also reminded me of my experiences with Paula, AYUDA, and Georgetown Law (which I’ve also found to be a great team effort.)]

[During the concert, the stage was enveloped in machine-generated (I assume) smoke and fog to emphasize (I assume) the often ambiguous position and perspective of African Americans and other minorities in relation to the “standard — often whitewashed — version” of the “American Dream.” Does that “Dream” really look the same if your family members were denied educational, political, and economic rights, or the entire “pursuit of life, liberty, and happiness” because of their skin color? I doubt it.]

Sometimes the American dream sounds a lot like pitchforks and screams.

“For most of my life, I have been deeply inspired by the scriptural verse, 2 Chronicles 7:14. If the text does not readily come to mind, here it is for your immediate reference:

If my people, who are called by my name, will humble themselves and pray and seek my face and turn from their wicked ways, then I will hear from heaven, and I will forgive their sin and will heal their land. (King James Version)

These words have long embodied for me the profound hope that God will eventually make right the many wrongs that trouble our land.

In recent years, however, I have found myself challenged by the application of this verse. It’s a wonderful award to a terrific person and true American hero who embodies the values and determination of Dr. Martin Luther King, Jr., and John Thompson, Jr., to fight to finally make equal justice in America a reality and to make our world a better place!

Former Georgetown and Princeton Head Basketball Coach John Thompson III and the Thompson Family attended and were recognized for their continuing contributions to social justice in America and for making this great event possible. Cathy and I were honored and thrilled to be in the audience.

I was especially moved by Paula’s highlighting the successful efforts of AYUDA and other community groups to welcome and care for migrants to DC who were bussed here as part of a nativist political stunt by some governors. Certainly, it illustrates who “gets” Dr. King’s spirit, dreams, and messages of hope and who is arrogantly, and cynically, paying his memory and values “lip service,” at best!

Kennedy Center for the Performing Arts and Georgetown University celebrate the legacy of Dr. Martin Luther King Jr. with a free, ticketed musical tribute, the Let Freedom Ring Celebration. The annual program, part of the Center’s Millennium Stage free daily performance series, features Leslie Odom, Jr. and the Let Freedom Ring Choir led by Music Producer Nolan Williams, Jr., on Monday, January 16, 2023 at 6 p.m. in the Kennedy Center Concert Hall.

Georgetown University will present the annual John Thompson Jr. Legacy of a Dream Award to Paula Fitzgerald, executive director of Ayuda. Since 1973, Ayuda has served more than 150,000 low-income immigrants throughout Washington DC, Maryland and Virginia. The award is given by Georgetown University to a local individual who exemplifies the spirit of Dr. Martin Luther King Jr. For more information about this year’s awardee and the Legacy of a Dream Award, please visit: https://www.georgetown.edu/mlk-initiative/

ABOUT LESLIE ODOM, JR.

Leslie Odom, Jr. is a multifaceted, award-winning vocalist, songwriter, author, and actor. With a career that spans all performance genres, he has received recognition with Tony® and Grammy Awards® as well as Emmy® and, most recently, two Academy Award® nominations for his excellence and achievements in Broadway, television, film, and music. Odom most recently starred in and performed the songs of legendary singer Sam Cooke in the critically acclaimed Amazon film adaptation of One Night in Miami…, directed by Regina King. His portrayal of the soul icon was met with widespread praise and critical acclaim, earning him nominations for an Academy Award®, BAFTA Award, Critics’ Choice Award, Golden Globe Awards®, and Screen Actors Guild Awards, among others. He made his Broadway debut in RENT at the age of 17. He also starred opposite Lin-Manuel Miranda and Karen Olivo in a 2014 City Center Encores! revival of Jonathan Larson’s Tick, Tick…Boom! In December 2017, Odom returned to the New York City stage in a solo concert at Jazz at Lincoln Center. The cabaret-style performance was crafted around signature songs and music that shaped this artist’s journey, all performed with a world-class band in front of a live audience. The show was filmed for broadcast as an hour-long PBS special as part of the 17-time Emmy Award®-winning series, Live from Lincoln Center, and premiered in April 2018.

A Grammy Award®-winning recording artist, Odom’s self-titled debut album was part-funded by a successful Kickstarter campaign and released in 2014 by Borderlight Entertainment, Inc. His new label home, S-Curve, re-released an expanded version with additional material in June 2016, and the album reached #1 on the Billboard Jazz charts and charted in the Billboard Top 200. In winter 2017, Odom topped the charts once again with the re-release of his second album and first holiday album, Simply Christmas, as a deluxe edition with new arrangements and new songs. Simply Christmas hit #1 on iTunes and the Billboard Jazz charts, #4 on the Billboard Holiday chart, and #31 on the Billboard Top 200 chart. Odom released his third full-length album and first of original material, Mr, in November 2019, and the following October teamed up with nine-time Grammy-nominated and multi-platinum artist Sia to debut a new version of standout track “Cold.” His critically acclaimed second holiday album, The Christmas Album, was released in November 2020. He has performed at the White House, Super Bowl, and on hallowed stages such as Lincoln Center, Rockefeller Center, and the Macy’s Thanksgiving Day Parade.

In March 2018, Odom added the title of author to his resume with the release of his book—Failing Up: How to Take Risks, Aim Higher and Never Stop Learning. ABOUT THE AWARDEE

Paula Fitzgerald, Esq. is the executive director of Ayuda, a nonprofit that provides legal, social and language services to help low-income immigrants in the Washington, DC, area navigate the immigration and justice systems, heal from trauma and overcome language isolation.

As executive director, Fitzgerald leads Ayuda’s efforts to increase the availability of direct services for more than 8,000 immigrants annually. Under her leadership, Ayuda’s programs have expanded throughout the District of Columbia, Maryland and Virginia to reach more low-income immigrants. She began her work with Ayuda as an immigration staff attorney and quickly advanced to managing attorney of Ayuda’s Virginia office. Prior to joining Ayuda in 2008, Fitzgerald served as an immigration staff attorney at Hogar Hispano of the Catholic Charities of the Diocese of Arlington and as an associate at Hunton & Williams LLP.

Her immigration legal work focused on humanitarian relief for individuals, children and families. She also has extensive experience in family-based immigration matters, consular processing, waivers and NACARA cases. Fitzgerald credits her mother, a Colombian immigrant who was a social worker at a school with a large Latin American immigrant population, and her father, who worked as a psychologist for the mentally ill at Saint Elizabeth’s Hospital, for instilling the values that led to her work.

Fitzgerald earned a certificate in Nonprofit Management from Georgetown in 2016 and a J.D. from the University of Virginia School of Law. She graduated cum laude with a B.A. in psychology from James Madison University. Paula and her family have lived in northern Virginia for more than 40 years.

Hopelessness Continues Driving Hondurans to Migrate

The Associated Press (April 17, 2021)

Last month, US Customs and Border Protection (CBP) reported more than 41,000 encounters with Hondurans along the US-Mexico border, an increase of 12,000 over the same period in 2019. Eugenio Sosa, a sociologist at the National Autonomous University in Honduras, said that pervasive violence, deep-seated corruption, lack of jobs, and the devastation of two hurricanes in November 2020 have contributed to hopelessness among Hondurans. “The people don’t go just because it’s really bad,” Sosa said. “The people go because it’s bad and because they are certain that it is going to continue to be bad and that the country has rotted forever.” The Biden administration continues to expel adults arriving at the border under Title 42, which permits immigration authorities to bar foreign nationals for public health reasons and to prevent them from seeking asylum. The policy has not stopped Hondurans from arriving at the US-Mexico border. According to Sosa, small, positive changes in Honduras would encourage some to stay in their home country.

White House Walks Back Order On Refugee Limits After Backlash

NPR (April 16, 2021)

On April 16, 2021, the White House released a memorandum reallocating the 15,000 refugee admission spots for Fiscal Year (FY) 2021.The historically low admissions ceiling was set by the Trump administration. In the early days of his presidency, Biden promised to raise the cap via a presidential determination (PD) to 125,000 for FY 2022 and a February Department of State report recommended an increase in FY 2021 to 62,500 admissions. Friday’s memo reallocated admissions but did not increase the admissions cap. After backlash from Democratic lawmakers, refugee advocates, and human rights groups, the Biden administration issued a statement saying that its memorandum opened up refugee resettlement to regions that had previously been blocked under the Trump administration. The administration said it will raise refugee admissions for the current fiscal year on May 15th. The fiscal year ends on September 30, 2021. It is uncertain what the new cap will be for FY 2021.

In Tijuana, Desperate Migrants Not Waiting For Godot But For Governments

Crux (April 17, 2021)

The United States government continues to deport from 200 to 500 migrants daily across its southern border under Title 42. Title 42 of the US Code gives US immigration authorities broad power to expel migrants it deems a danger of spreading COVID-19. It has severely curtailed access to asylum. Meanwhile, migrants continue to arrive at the US-Mexico border with the mistaken belief that they will be able to cross the border and receive asylum. The result is a “grim situation,” according to some immigrant advocates. Fr. Pat Murphy, Director of the Casa del Migrante Tijuana, says that US immigration authorities “keep sending more and more people under Title 42, and that means the pressure is on here in Mexico. We’re completely overwhelmed.” Tijuana’s 30 migrant shelters are all full, and approximately 2,000 migrants are camping outside a Mexican immigration facility waiting for the asylum process to resume. Fr. Murphy said that ending Title 42 and a resumption of the asylum process in Mexico would improve the situation. “All people are looking for is a chance,” he said.

Indonesian Asylum Seekers Survived Trump’s Attempt to Deport Them, But Now They’re Facing Off Against Biden

The Biden administration is continuing efforts started by the Trump administration to deport about two dozen Indonesian Christians who have been living in Central New Jersey for decades. The Obama administration protected them from deportation and gave them work authorization, but the Trump administration sought to deport them. In February 2018, a federal judge issued a temporary restraining order, which is still in effect but the order could be lifted any day. Advocates are surprised that the Biden administration is trying to deport the Indonesian asylum seekers because they do not fit the administration’s revised enforcement priorities. Senators Cory Booker and Robert Menendez of New Jersey along with members of the New Jersey congressional delegation submitted a letter to the Secretary of the US Department of Homeland Security (DHS) Alejandro Mayorkas asking that the group not be detained or deported. The letter states, “For nearly 30 years, these Christian refugees have raised families, bought homes, attended church services, and volunteered countless hours to aid neighbors. . . . These New Jerseyans exemplify the best qualities of our state. Their ability to continue living and working safely in New Jersey is critical to the well-being of their U.S. citizen children and to the benefit of their church communities and neighbors they serve.”

Ottawa Opens New Pathway to Permanent Status for Temporary Essential Workers and Graduates

New policy will allow up to 90,000 workers and international graduates to obtain permanent residency.

CBC News (April 14, 2021)

Canadian Immigration Minister Marco Mendicino announced the creation of a new pathway to permanent residence for up to 90,000 foreign nationals. The program is geared toward workers and international graduates with temporary visas and in designated “essential jobs.” Minister Mendicino said, “Since COVID-19 first arrived on our shores, we have charted a course guided by one north star — that immigration is key to Canada’s short term economic recovery and long term prosperity. . . . Fundamentally, we know that by attracting and retaining the best and the brightest … we will add more jobs, growth and diversity to our economy.” To qualify as an essential worker, a foreign national must have at least one year of work experience in one of 40 health-care jobs or 95 other “essential jobs.” Some listed essential occupations include electricians, metal workers, farmworkers, cashiers, home childcare providers, and French immersion teachers. For international graduates to qualify, they must have completed an eligible Canadian post-secondary program within the last four years. Minister Mendicino hopes that the program will encourage immigrants to put down roots in the country. The application period will be from May 6, 2021 through November 5, 2021. The Canadian government will accept up to 20,000 applications from temporary workers in healthcare, 30,000 from temporary workers in essential jobs, and 40,000 from international students.

Venezuelan Military Offensive Sends Thousands Fleeing, Recharging One of the World’s Worst Refugee Crises

The Washington Post (April 1, 2021)

In mid-March, the Venezuelan military launched a campaign against Colombian guerrillas operating in the jungle of the western Venezuelan state of Apure. The guerrilla group, the 10th Front, became a target for interfering in the Venezuelan government’s profitable narco-trafficking business. The Venezuelan government reports that nine camps have been destroyed, 32 people arrested, and nine people killed during the offensive. Thousands of Venezuelans have fled the offensive, crossed into Colombia, and are in makeshift shelters in the border town of Arauquita. As of the beginning of April, nearly 5,000 refugees, 40 percent of them children, arrived in Arauquita. UNHCR employees are providing the refugees with tents, mattresses, hygiene kits, and face masks. Jose Miguel Vivanco, Director for Human Rights Watch’s Americas division, claims that there is “credible evidence” that the Venezuelan military carried out extrajudicial killings of three men and a woman during the offensive. The Venezuelan government, however, claims that every person killed during the offensive is a terrorist.

The American Dream & Promise Act: It Feels Like Deja Vu

Ignatian Solidary Network (March 26, 2021)

On March 18, 2021, the US House of Representatives passed HR 6, the American Dream and Promise Act by 228 to 197 votes. The bill proposes a pathway to citizenship for Temporary Protected Status (TPS) and Deferred Action for Childhood Arrivals (DACA) recipients as well as for certain immigrant youth. In the Senate, there are two separate bills that would open a pathway to citizenship for TPS holders, DACA recipients, and certain immigrant youth. The DREAM Act would legalize DACA recipients and immigrant youth. The SECURE Act would legalize TPS beneficiaries. Each bill needs 60 votes in the Senate to pass, and thus will require bipartisan support. For 20 years, the Dream Act has been introduced in Congress, but has never become law. Although many people were excited by HR 6’s passage, many DACA recipients were not. Instead, their past experience has given them a sense of déjà vu. They are tired of the same story of a bill that progresses and does not become law. DACA recipients have been in limbo with no path to legalize. They continue to fight for a pathway to citizenship for all undocumented immigrants.

The Next Presidential Determination on Refugee Resettlement: The Time to Act is Now

On Friday, April 16, President Biden issued a long-awaited “Memorandum for the Secretary of State on the Emergency Presidential Determination on Refugee Admissions for Fiscal Year 2021.” The presidential determination opened up refugee admissions to regions blocked by the Trump administration but did not raise the historically low cap of 15,000 for the current fiscal year. The White House later stated it would decide on a new admissions ceiling by May 15. In this CMS essay, Susan Martin — Donald G. Herzberg Professor of International Migration Emerita for Georgetown University — outlines how the Biden administration can prepare to admit more refugees and how the United States will benefit from welcoming them.

Daniela Alulema on the Contributions of DACA Recipients

As the Supreme Court heard oral arguments regarding the Trump administration’s efforts to terminate the DACA program, CMS released a paper offering detailed estimates of DACA recipients, their economic contributions, and their deep ties to US communities. The paper, which also features testimonies of several DACA recipients, was published in CMS’s Journal on Migration and Human Security (JMHS). In this episode, Daniela Alulema — who is author of the JMHS paper, CMS’s Director of Programs, and herself a DACA recipient — describes the paper’s findings, shares the stories of the DACA recipients, and outlines potential policy directions for the DACA program.

POLICY UPDATE

On April 16, 2021, President Biden signed an emergency presidential determination that keeps in place the Trump administration’s historically low refugee admissions cap of 15,000 for FY 2021 but returns to allocating refugee admissions based on region. The next day the Biden administration released a statement saying it expects to increase the 2021 refugee ceiling next month but did not specify the number. In February 2021, President Biden proposed welcoming 62,500 refugees to the United States in 2021. Under former President Trump’s directive, stringent restrictions were placed on accepting refugees from certain African and majority-Muslim countries and priority was given to Christians who faced religious persecution and Iraqis who worked for the US military. The new allocations include 7,000 slots for Africa, 1,000 for East Asia, 1,500 for Europe and Central Asia, 3,000 for Latin America/Caribbean, 1,500 for Near East/South Asia, and 1,000 slots that are unallocated.

On April 14, 2021, Washington Governor Jay Inslee signed a bill that will ban for-profit detention centers in the state. Under the bill, one of the largest for-profit immigrant detention centers, the Northwest Detention Center in Tacoma, will be shut down by 2025 when its contract with US Immigration and Customs Enforcement (ICE) expires. Washington is one of the first states to pass legislation that bans private prison companies, including immigration facilities, from operating.

On April 13, 2021, Texas Attorney General Ken Paxton announced that Texas and Missouri filed a lawsuit demanding that the Biden administration reinstate the Migrant Protection Protocols (MPP) program to reduce the influx of migrants at the southwest border. MPP was established by the Trump administration in January 2019. It allowed border officers to send non-Mexicans who sought asylum at the US southern border to Mexico to await their immigration hearings. In January 2021, the Department of Homeland Security (DHS) suspended the MPP program and the Biden administration began admitting program enrollees into the United States in February. The lawsuit alleges that the Biden administration’s decision to suspend the program led to a surge of Central American migrants coming to the southwest border to make asylum claims.

On April 12, 2021, President Biden nominated Chris Magnus to lead Customs and Border Protection (CBP) and Ur Jaddou to head United States Citizenship and Immigration Services (USCIS). Magnus is currently the police chief in Tuscon, Arizona, and Jaddou was head counsel of USCIS under the Obama administration. Biden also nominated John Tien, the former senior director for Afghanistan and Pakistan of the National Security Council, as deputy director of DHS.

On April 12, 2021, the Biden administration secured agreements with Mexico, Honduras, and Guatemala to tighten their borders and stem the flow of migration to the United States. Under the agreements, the countries will put more troops at their own borders to monitor migration and prevent traffickers and cartels from taking advantage of migrants and unaccompanied minors. CBP apprehended a record number of 18,890 unaccompanied minors last month and more than 172,000 people attempting to cross the US-Mexico border. In March 2021 President Biden tasked Vice President Kamala Harris with coordinating efforts with Central American countries to address the root causes of migration.

Biden and Harris campaigned, quite logically and convincingly, on a pledge to do away with the illegality, cruelty and stupidity of the Trump/Miller White Nationalist, racist immigration program.

But, following the inauguration, Biden supporters working at the “retail level” of our failed immigration system have seen few meaningful changes, little if any honest dialogue, and most disturbingly, far, far too few progressive experts who can solve problems in key positions! 

Encouraging Northern Triangle countries notorious for corruption and human rights abuses to stop their nationals from fleeing to safety is NOT a solution. It’s the moral equivalent of having encouraged the Soviet Union and East Germany to machine gun those attempting to flee to the West during the (not so) Cold War!

Basically, the Biden Administration is encouraging and funding some of the most corrupt and repressive nations in the Hemisphere to violate human rights, just as the Trump Administration did. See, “Policy Update,” above. That’s NOT the way to establish positive international leadership on human rights and migration issues!

Two other nuggets particularly worthy of note:

  • “According to [Eigenio] Sosa, small, positive changes in Honduras would encourage some to stay in their home country.” This contradicts the “conventional wisdom” that addressing the roots of the problem in sending countries is either futile or such a long-term project that it can’t be part of addressing today’s flow of forced migrants.
  • “In this CMS essay, Susan Martin — Donald G. Herzberg Professor of International Migration Emerita for Georgetown University — outlines how the Biden administration can prepare to admit more refugees and how the United States will benefit from welcoming them.” Professor Susan Forbes Martin is a long-time friend and a brilliant “practical scholar.” Her point that we should welcome refugees, rather than fearing them, is well taken and the key to better, far more robust, legal immigration laws and policies.

Since taking office, President Trump’s administration has rained a hailstorm of policy actions on refugees and asylees. A newly published analysis identifies three types of policies: those that abandon longstanding U.S. legal principles and policies, most notably non-refoulement and due process; those that block the entry of refugees and asylees; and those that criminalize foreign nationals who attempt to seek asylum in the United States. Simply put, these are the As (abandoning), Bs (blocking) and Cs (criminalizing) of the Trump administration policies on refugees and asylees.

Historical antecedents of Trump’s policies may be found in the refusal to accept Jews fleeing Nazi Germany during World War II (abandoning) and the interdiction of Haitians trying to escape the violent regime of then-dictator Jean-Claude Duvalier that began in 1981 (blocking). The Trump administration’s “zero tolerance” policy of prosecuting even minor immigration offenses (criminalizing) harkens back to the early 20th century when the eugenicists warned of “inferior aliens” who were likely to be insane or criminal; however, now the federal government keeps asylum seekers locked in detention centers, often under contracts with the private prison industry. The criminalization of refugees and asylees in conjunction with the comprehensive sweep of his initiatives abandoning and blocking refugees and asylum seekers has sent U.S. humanitarian protection policy to an unprecedented nadir.

There is little evidence of a policy evolution or maturation over time. The Trump administration opened in 2017 with policies exhibiting all three ABCs: abandoning refugee admissions; blocking Syrian nationals from refugee resettlement; and expanding expedited removal and detention. The administration’s efforts to criminalize asylum seekers reached a crescendo in 2018 with “zero tolerance.” Policy initiatives in 2019 again drew on all three ABCs: A) setting refugee admissions for fiscal year 2020 at the lowest level since the passage of the Refugee Act of 1980; B) allowing state and local officials to refuse placement of refugees; and C) detaining migrant children and families indefinitely, including those arriving to seek asylum.

Generous humanitarian policies require energetic civic engagement and steadfast legislative efforts. Restoring the policies of the past will not be sufficient in the years ahead, because past policies were prone to inequities and bottlenecks that arguably had a magnet effect for migrants with less compelling cases, and most certainly delayed relief for those who qualified. Policymakers would be wise to weigh the advice of researchers, experienced advocates and legal experts who call for the repeal of three particularly harmful provisions: the one-year deadline for filing asylum applications, expedited removal, and “safe third country” agreements.

A sound course of action is for Congress to establish, and the administration to execute, robust and fully funded refugee and asylum policies that are generous in their priorities, thorough in their review, and expeditious in their processing.

We need a progressive, realistic, humane refugee and asylum policy. 

A prerequisite to these efforts is an independent Article I U.S. Immigration Court comprised of judges with real life experience, demonstrated expertise in refugee and human rights laws, an unswerving commitment to guaranteeing due process and fundamental fairness for all, and the courage to stand up for the Constitutional and human rights of the most vulnerable among us, even in the face of abuses and bias from the other branches of Government.

The current legal framework for protection, although in need of forward looking reforms, is nowhere near as unfair, inhumane, dysfunctional, deadly, and counterproductive as the Trump regime has made it. Why? Because, for the most part, the Federal Courts have “gone along to get along” with the regime’s lawless nativist, restrictionist schemes and gimmicks, rather than standing up for due process, equal protection, fundamental fairness, human rights, and human decency. 

That’s a serious problem for democracy. One that demands a critical re-examination of whom we are selecting for our Federal Judiciary and why, as a group, they have performed so poorly in thwarting racist and hate-driven tyranny by an out of control and fundamentally dishonest, bigoted, and biased regime!

The following three papers have been prepared as part of a process, organized jointly by the Center for Migration Studies of New York (CMS) and the Zolberg Institute on Migration and Mobility at the New School, to identify ways to strengthen the US immigration and refugee protection systems through administrative action. Additional papers in this collection will be forthcoming, as well as a distinct set of policy recommendations from the directors of CMS and the Zolberg Institute.
Rebuilding the US Refugee Resettlement Program

This paper offers an historic review of the US refugee resettlement program. It spans the colonial era, to the establishment of the first distinct US admissions policies for persons fleeing persecution in 1917, to the creation of the formal US Refugee Admissions Program (USRAP) in 1980, and to the Trump administrations’ denigration of and attempts to eviscerate the program. It proposes ways that a new administration can rebuild this crucially important program and put it on more secure footing. In particular, it recommends that a new administration:

  • Reframe the discourse on refugee resettlement to emphasize its central importance to the nation’s identity and the way it serves the national interest.
  • Rebuild the capacity of the federal government to administer the program and the badly depleted community-based resettlement infrastructure that is central to the program’s success.
  • Hold emergency consultations with Congress to increase refugee admissions in Fiscal Year (FY) 2021, and consult soon after the inauguration with international, state and local, and non-governmental partners to plan FY 2022 resettlement goals, including a robust admissions ceiling and budget.
  • Reform and reinvigorate federal consultations with states and localities to ensure their receptivity, capacity and support for refugees, and eliminate the current veto power of states and municipalities over resettlement in their jurisdictions.
  • Explore legislative fixes to the refugee admissions process and attempt to depoliticize the process by setting a “normal flow level” that does not require an annual Presidential determination.
  • Join the Global Compact on Refugees, which seeks to expand the availability of durable solutions for refugees, and encourage other nations to follow the US example of resettling larger numbers of refugees.

Border Enforcement Developments Since 1993 and How to Change CBP

Enforcement along the US-Mexico border has intensified significantly since the early 1990s. Social scientists have documented several consequences of border militarization, including increased border-crosser deaths, the killing of more than 110 people by Customs and Border Protection (CBP) agents over the past decade, and expanded ethno-racial profiling in southwestern communities by immigration authorities. Less attention has been paid to the pervasive and routine mistreatment migrants experience on a daily basis in CBP custody.

This paper traces major developments in border enforcement to three notable initiatives: the “prevention-through-deterrence” strategy, the aftermath of the 9/11 terrorist attacks, and the Department of Homeland Security (DHS) Consequence Delivery System, initiated in 2011. Despite the massive buildup in enforcement, CBP has operated with little transparency and accountability to the detriment of migrants. The paper provides an overview of the findings of nongovernmental organizations and social scientists regarding migrant mistreatment while in CBP custody. It then highlights important shifts in migration patterns over the past decade, as well as changes in border enforcement efforts during the Trump administration. It discusses how these transformations affect migrants’ everyday encounters with CBP officials.

The paper concludes by providing specific recommendations for improving CBP conduct. Its core theme is the need to emphasize and inculcate lessons of appropriate police behavior, civil rights, and civil liberties in training and recruiting agents and in setting responsibilities of supervisors and administrators. It offers recommendations regarding important but underrecognized issues, including ending the use of CBP agents/officers as Asylum Officers, as well as better-known issues such as militarization and the border wall.

Strengthening the US Immigration System through Legal Orientation, Screening and Representation: Recommendations for a New Administration

This paper highlights the importance of legal orientation, screening, and representation to the US immigration system. It proposes that a new administration facilitate legal representation in order to establish a fairer and more efficient removal adjudication system and to place more immigrants on a path to permanent residence and citizenship. As is well-documented, legal assistance can:

  • Improve the ability of immigrants to identify and articulate their claims in removal proceedings and produce better-informed case outcomes.
  • Increase the efficiency and contribute to the integrity of the removal adjudication system.
  • Lead to better-prepared applications for immigration benefits, and thus a more just and efficient legal immigration system.
  • Place more non-citizens on a path to permanent residence and naturalization by identifying their potential eligibility for immigration benefits or relief, and, in some cases, their existing US citizenship.

Legal representation and expertise can also contribute to resolving some of the substantial problems that afflict the US immigration system, such as lengthy court and asylum backlogs. In addition, it can identify and help to correct legal and factual errors by immigration adjudicators, and abuses by enforcement officers and private contractors.

The paper’s first section describes federal legal orientation and assistance programs for non-citizens in removal proceedings. The second section discusses the need for large-scale legal screening and representation of US undocumented residents, Deferred Action for Childhood Arrivals (DACA) recipients, and Temporary Protected Status (TPS) beneficiaries. Its third section examines the proliferation of universal representation programs—supported by states, localities, and private funders—for non-citizens in removal proceedings before an immigration judge, and in summary removal processes administered by the US Department of Homeland Security (DHS). The paper concludes with a series of administrative measures that a new administration could take in its first year to strengthen and expand legal representation. It also outlines longer-term policy recommendations that would require legislation.

🏴‍☠️DONALD TRUMP: FAILED FASCIST!  — But, Fascism Doesn’t Doesn’t Have To Be “Successful” On Some “Academic Scale” To Threaten The Downfall Of Our Democracy! — We Ignore Trump’s Fascism At Our Peril!

So where does Trump’s administration stand as he is nominated for a second term? He earned 47 of a possible 76 Benitos, or 62 percent. He remains the greatest threat to American democracy since the Civil War, but his exercise of power only partly resembles that of real fascists. He still faces checks and balances in Washington. He hasn’t shut down rival parties or uncompliant media.

He has not directed the armed might of the state against citizens on anything like the scale used by Mussolini, let alone Hitler. He does not have his own obedient “squadristi” eager to beat up foes, even if plenty of his followers advocate (and sometimes indulge in) violence against minorities and Trump’s opponents. He has not arranged the murder of prominent political opponents. The cult of violence is integral to fascism but far less central to Trump. He is not ruling like a genuine fascist.

But he has shown pronounced fascistic leanings. In the right circumstances — a crisis he could manage triumphantly, a more sympathetic military — perhaps he would try to extend his rule beyond whatever the voters allow him and convert the United States into a repressive, racist dictatorship. Or perhaps stage phony elections that hand the reins to Ivanka and Jared. At least a few members of Congress would probably support him, just as many parliamentarians voted to give Mussolini and Hitler emergency powers. Those lawmakers did not know at the time just where fascism might lead. We have a clearer idea.

I get that Trump’s maliciousness is somewhat tempered by his overall incompetence. 

But, with due respect to Professor McNeill, I think he presents a “upper class intellectual” view of Trump’s vileness and danger on the “fascism scale.” His pre-existing privilege have largely shielded him, and likely his family and most of his associates, from the true effects of Trump’s White Nationalist fascism. 

However, I think that African Americans who have had family members and friends killed or seriously harmed by police, only to be mocked, threatened, and disenfranchised by the Prez; children and families separated forever; kids and asylum applicants jailed in life-threatening conditions; refugees and other family members stranded forever abroad; lawyers and advocates who risk their health and safety every day to defend the most vulnerable among us; the ghosts of those who have died of COVID-19 in detention; those with family members needlessly lost to COVID-19; ethnic communities who have been terrorized by DHS and who have seen a sharply diminished ability to seek protection from crimes; Asian Americans who have victimized by hate crimes; those who have lost health insurance coverage, jobs, and shelter; Muslims scapegoated for others’ crimes; transgender youth driven to depression and suicide by government endorsed harassment and denial of basic human rights; and a host of others living below McNeill’s radar screen might disagree with his “failed” analysis.

Also, like many academics and intellectuals shielded by the Ivory Tower, McNeill vastly overestimates the effect of “checks and balances.” In fact, Trump has been able to rule lawlessly, if incompetently, without meaningful participation of Congress and with little effective pushback from the Federal Courts. 

He’s made mincemeat of the few in the Executive Branch with the guts and integrity to oppose him, without engendering meaningful and anything approaching effective reactions from the other two Branches. His own party has publicly and fully turned against American democracy and the rights, well being, and humanity of the rest (e.g., the majority) of us. That’s pretty effective fascism in my book, even considering the less than competent implementation.

It’s a mark of just how ineffectual our system of “checks and balances” has been that we are, as a nation, without a functioning immigration system; without functioning Immigration Courts; without a national plan or rational response to a dangerous pandemic; without a plan to protect our precious franchise or to insure safe, free, and fair elections this fall; with a failing postal system that has been politicized; without a plan to address the threat of global warning and, indeed, doing everything in our power to make it worse!

This is not “failed fascism!” Rather it is a fascist state run by malicious incompetents and headed by a  leader without the attention span, intellectual capacity, or ability to fully develop any intellectual doctrine and implement its full range of destruction. But, that only slightly diminishes his danger to our body politic!

That Trump dares to put forth outrageous ideas like not leaving office following defeat, barring U.S. citizens from re-entering their country, sending police to polling stations, and questioning the citizenship of  Kamala Harris shows just how feckless our democratic institutions have been in the face of tyranny and how misguided it is to understate Trump’s fascism.

With his overtly outrageous program of “Dred Scottification” of “the other” — largely and embarrassingly embraced by a Supremes’ majority — Trump has moved our nation as far away from “equal justice for all” as we have been in the supposed “post-Jim-Crow” era!

To rely on the “beneficial effects” of incompetence on malicious would-be fascism is a fool’s errand that could cost us dearly. Indeed, until it was too late, the leaders of Western Democracies rather consistently overplayed the cartoonish characteristics of Hitler’s and Mussolini’s “pseudo-super-macho” personalities and underplayed the potential destructive capacity of their fascism, whether “failed” or not. The threat is real and this is likely to be our last clear chance as a nation to save our democracy!

This November, vote like your life and the future of the world depend on it! Because they do!

I believe that I’m the only “survivor” of that illustrious group of “Original Charter Signers” present today. And, whoever now has possession of that sacred Charter can attest that my signature today remains exactly as it was then, boldly scrawling over those of my colleagues and the last paragraph of the document.

 

As the Americas’ Chapter Vice President, welcome and thank you for coming, supporting, and contributing to our organization and this great conference. I also welcome you to the beautiful campus of Georgetown Law where I am on the adjunct faculty.

 

I thank Dean Treanor; my long-time friend and colleague Professor Andy Schoenholtz, and all the other wonderful members of our Georgetown family; the IARMJ; Associate Director Jennifer Higgins, Dimple Dhabalia, and the rest of their team at USCIS; and, of course, our Americas President Justice Russell Zinn and the amazing Ross Patee from the Canadian Immigration and Refugee Board who have been so supportive and worked so hard to make this conference a success.

 

I recognize that this is the coveted “immediately after lunch slot” when folks might rather be taking a nap. But, as the American country singer Toby Keith would say “It’s me, baby, with you wake up call!” In other words, I’m going to give you a glimpse into the “parallel universe” being operted in the United States.

 

In the past, at this point I would give my comprehensive disclaimer. Now that I’m retired, I can skip that part. But, I do want to “hold harmless” both the Association and Georgetown for my remarks. The views I express this afternoon are mine, and mine alone. I’m going to tell you exactly what I think. No “party line,” no “bureaucratic doublespeak,” so “sugar coating.” Just the truth, the whole truth, and nothing but the truth!

 

I have good news and bad news. The good news is that we don’t have an implicit bias problem in the U.S. asylum adjudication system. The bad news: The bias is now, unfortunately, quite explicit.

 

Here’s a quote about refugees: “I guarantee you they are bad. They are not going to be wonderful people who go on to work for the local milk people.”

 

Here’s another one: “We cannot allow all of these people to invade our Country. When somebody comes in, we must immediately, with no Judges or Court Cases, bring them back from where they came. Our system is a mockery to good immigration policy and Law and Order.”

 

Here’s another referencing the presence of an estimated 11 million undocumented residents of the U.S.: “Over the last 30 years, there have been many reasons for this failure. I’d like to talk about just one—the fraud and abuse in our asylum system.”

 

Here’s yet another: “We’ve had situations in which a person comes to the United States and says they are a victim of domestic violence, therefore they are entitled to enter the United States. Well, that’s obviously false but some judges have gone along with that.”

 

You might think that these anti-asylum, and in many cases anti-Latino, anti-female, anti-child, anti-asylum seeker, de-humanizing statements were made by members of some fringe, xenophobic group. But no, the first two are from our President; the second two are from our Attorney General.

 

These are the very officials who should be insuring that the life-saving humanitarian protection purposes of the Refugee Act of 1980 and the Convention Against Torture are fully carried out and that our country fully complies with the letter and spirit of the 1951 Convention Relating to the Status of Refugees which is binding on our country under the 1967 Protocol.

 

Let me read you a quote that I published yesterday on my blog, immigrationcourtside.com, from a young civil servant resigning their position with “EOIR,” otherwise known as our Immigration Court system, or, alternatively, as the sad little donkey from Winnie the Pooh.

 

I was born and raised in a country that bears an indelible and shameful scar—the birth and spreading of fascism. An ideology that, through its different permutations, almost brought the world as we know it to an end. Sadly, history has taught me that good countries do bad things—sometimes indescribably atrocious things. So, I have very little tolerance for authoritarianism, extremism, and unilateral and undemocratic usurpations of Constitutional rights. I believe that DOJ-EOIR’s plan to implement individual annual numerical performance measures—i.e., quotas—on Immigration Judges violates the Due Process clause of the Fifth Amendment of the United States Constitution, and the DOJ’s own mission to “ensure the fair and impartial administration of justice.” This is not the job I signed up for. I strongly believe in the positive value of government, and that the legitimacy of our agency—and any other governmental institution for that matter—is given by “the People’s” belief in its integrity, fairness, and commitment to serve “the People.” But when the government, with its unparalleled might and coercive force, infringes on constitutionally enshrined rights, I only have two choices: (1) to become complicitous in what I believe is a flagrant constitutional violation, or (2) to resign and to hold the government accountable as a private citizen. I choose to resign because I cannot in good conscience continue serving my country within EOIR.

 

Strong words, my friends. But, words that are absolutely indicative of the travesty of justice unfolding daily in the U.S. Immigration Courts, particularly with respect to women, children, and other asylum seekers –- the most vulnerable among us. Indeed, the conspicuous absence from this conference of anyone currently serving as a judge in the U.S. Immigration Courts tells you all you really need to know about what’s happening in today’s U.S. justice system.

 

Today, as we meet to thoughtfully discuss how to save refugees, the reality is that U.S. Government officials are working feverishly at the White House and the U.S. Department of Justice on plans to end the U.S. refugee and asylum programs as we know them and to reduce U.S. legal immigration to about “zero.”

 

Sadly, the U.S. is not alone in these high-level attacks on the very foundations of our Convention and international protection. National leaders in Europe and other so-called “liberal democracies” — who appear to have erased the forces and circumstances that led to World War II and its aftermath from their collective memory banks — have made similar statements deriding the influence of immigrants and the arrival of desperate asylum seekers. In short, here and elsewhere our Convention and our entire international protection system are under attacks unprecedented during my career of more than four decades in the area of immigration and refugee protection.

 

As a result, judges and adjudicators throughout the world, like you, are under extreme pressure to narrow interpretations, expedite hearings, view asylum seekers in a negative manner, and produce more denials of protection.

 

So, how do we as adjudicators remain loyal to the principles of our Convention and retain our own integrity under such pressures? And, more to the point, what can I, as someone no longer involved in the day-to-day fray, contribute to you and this conference?

 

Of course, you could always do what I did — retire and fulfill a longtime dream of becoming an internet “gonzo journalist.” But, I recognize that not everyone is in a position to do that.

 

Moreover, if all the “good guys” who believe in our Convention, human rights, human dignity, and fair process leave the scene, who will be left to vindicate the rights of refugees and asylum seekers to protection? Certainly not the political folks who are nominally in charge of the protection system in the US and elsewhere.

 

So, this afternoon, I’m returning to that which brought this Association together two decades ago in Warsaw: our united commitment to the letter and spirit of the 1951 Convention; additionally, our commitment to fairness, education, international approaches, group problem solving, promoting best practices, and mutual support.

 

In the balance of my presentation, I’m going to tell you four things, taken from our Convention, that I hope will help you survive, prosper, and advance the aims of our Convention in an age of nationalist, anti-refugee, anti-asylum, anti-immigrant rhetoric.

 

 

 

 

BODY

 

Protect, Don’t Reject

 

First, “protect, don’t reject.” Our noble Convention was inspired by the horrors of World War II and its aftermath. Many of you will have a chance to see this first hand at the Holocaust Museum.

 

Our Convention is a solemn commitment not to repeat disgraceful incidents such as the vessel St. Louis, which has also been memorialized in that Museum. For those of you who don’t know, in 1939 just prior to the outbreak of World War II a ship of German Jewish refugees unsuccessfully sought refuge in Cuba, the United States, and Canada, only to be rejected for some of the same spurious and racist reasons we now hear on a regular basis used to describe, deride, and de-humanize refugees. As a result, they were forced to return to Europe on the eve of World War II, where hundreds who should and could have been saved instead perished in the Holocaust that followed.

 

Since the beginning of our Convention, the UNHCR has urged signatory countries to implement and carry out “a generous asylum policy!” Beyond that, paragraphs 26 and 27 of the UN Handbookreiterate “Recommendation E” of the Convention delegates. This is the hope that Convention refugee protections will be extended to those in flight who might not fully satisfy all of the technical requirements of the “refugee” definition.

 

Therefore, I call on each of you to be constantly looking for legitimate ways in which to extend, rather than restrict, the life-saving protections offered by our Convention.

 

Give The “Benefit Of The Doubt”

 

Second, “give the benefit of the doubt.” Throughout our Convention, there is a consistent theme of recognizing the difficult, often desperate, situation of refugees and asylum seekers and attendant difficulties in proof, recollection, and presentation of claims. Therefore, our Convention exhorts us in at least four separate paragraphs, to give the applicant “the benefit of the doubt” in assessing and adjudicating claims.

 

As a sitting judge, I found that this, along with the intentionally generous “well-founded fear” standard, enunciated in the “refugee” definition and reinforced in 1987 by the U.S. Supreme Court and early decisions of our Board of Immigration Appeals implementing the Supreme Court’s directive, often tipped the balance in favor of asylum seekers in “close cases.”

 

 

 

 

Don’t Blame The Victims

 

Third, “don’t blame the victims.” The purpose of our Convention is to protect victims of persecution, not to blame them for all societal ills, real and fabricated, that face a receiving signatory country. Too much of today’s heated rhetoric characterizes legitimate asylum seekers and their families as threats to the security, welfare, heath, and stability of some of the richest and most powerful countries in the world, based on scant to non-existent evidence and xenophobic myths.

 

In my experience, nobody really wants to be a refugee. Almost everyone would prefer living a peaceful, productive stable life in their country of nationality. But, for reasons beyond the refugee’s control, that is not always possible.

 

Yes, there are some instances of asylum fraud. But, my experience has been that our DHS does an excellent job of ferreting out, prosecuting, and taking down the major fraud operations. And, they seldom, if ever, involve the types of claims we’re now seeing at our Southern Border.

 

I’m also aware that receiving significant numbers of refugee claimants over a relatively short period of time can place burdens on receiving countries. But, the answer certainly is not to blame the desperate individuals fleeing for their lives and their often pro bono advocates!

 

The answer set forth in our Convention is for signatory countries to work together and with the UNHCR to address the issues that are causing refugee flows and to cooperate in distributing refugee populations and in achieving generous uniform interpretations of the Convention to discourage “forum shopping.” Clearly, cranking up denials, using inhumane and unnecessary detention, stirring up xenophobic fervor, and limiting or blocking proper access to the refugee and asylum adjudication system are neither appropriate nor effective solutions under our Convention.

 

 

 

 

Give Detailed, Well-Reasoned, Individualized Decisions

 

Fourth, and finally, “give detailed, well-reasoned, individualized decisions.” These are the types of decisions encouraged by our Convention and to promote which our Association was formed. Avoid stereotypes and generalities based on national origin; avoid personal judgments on the decision to flee or seek asylum; avoid political statements; be able to explain your decision in legally sufficient, yet plainly understandable terms to the applicant, and where necessary, to the national government.

 

Most of all, treat refugee and asylum applicants with impartiality and the uniform respect, sensitivity, and fairness to which each is entitled, regardless of whether or not their claim under our Convention succeeds.

 

CONCLUSION

 

In conclusion, I fully recognize that times are tough in the “refugee world.” Indeed, as I tell my Georgetown students, each morning when I wake up, I’m thankful for two things: first, that I woke up, never a given at my age; second, that I’m not a refugee.

 

But, I submit that tough times are exactly when great, independent, and courageous judging and adjudication are necessary to protect both applicants from harm and governments from doing unwise and sometimes illegal and immoral things that they will later regret.

 

I have offered you four fairly straightforward ways in which adhering to the spirit of our Convention can help you, as judges and adjudicators, retain integrity while complying with the law: protect, don’t reject; give the benefit of the doubt; don’t blame the victims; and give detailed, well-reasoned, individualized decisions.

 

Hopefully, these suggestions will also insure that all of you will still be around and employed for our next conference.

Even more critically, Jordan would have been the first person to speak up against the discriminatory intent and language in President Trump’s proposals. In her own words, ‘I believe the fact that America is a nation of immigrants should be a source of pride and not a reason to ignite virulent nationalism.’”

Professor Susan Forbes Martin writes in Center for Migration Studies:

“After years of talking about a broken immigration system, President Trump offered a framework for immigration reform in his State of the Union address. In the lead-up to the address, the White House issued a statement on January 17 honoring Barbara Jordan, the former Chair of the US Commission on Immigration Reform. The White House intimated that Barbara Jordan would have supported the proposals to be championed by the President. The statement is a gross misstatement of Representative Jordan’s views. The President’s position on immigration, and the language he has used, represent all that Jordan decried during her long career and, especially as Chair of the commission. The statement misconstrues the recommendations of the Jordan Commission as justification for deep cuts in immigration that would make it harder for family members, employees and refugees to enter the country. As the Executive Director of the commission, I can attest to the fundamental differences between the Trump policies and Jordan’s and the commission’s recommendations.

In its first report to Congress, the commission did indeed state, as the White House reported, that it is “a right and responsibility of a democratic society to manage immigration so that it serves the national interest.” However, the commission also concluded that “legal immigration has strengthened and can continue to strengthen this country.” Further, the commission “decrie[d] hostility and discrimination against immigrants as antithetical to the traditions and interests of the country.” Its recommendations sought to improve the admission process by ensuring the timely entry of immediate family members of US citizens and legal permanent residents (LPRs) as well as workers and refugees.

The commission’s approach on immigration and refugee policy was considerably at odds with Trump policies—those described in the State of the Union and those already taken through administrative action—in four major areas. First, the Trump administration supports deep cuts in the overall number of family visas, claiming it wants to eliminate “chain migration.” The Commission, on the other hand, viewed family migration as beneficial to the country. It was concerned, however, about the sustainability of the program because of the multiple categories with extremely long backlogs and waiting time. It recommended adding 150,000 visas per year to permit the more rapid admission of the spouses and minor children of LPRs, who faced waiting periods of as much as a decade. To accommodate these additional visas, the Commission recommended re-directing visa numbers currently allocated to adult children and siblings of US citizens and the diversity program after a transition period. The Commission did not see ‘chain migration’ as inherently problematic. Unlike the Trump position, the commission encouraged continued admission as LPRs of the parents of US citizens. As the Executive Director of the Commission, I  understood that it would have been the height of hypocrisy to denounce chain migration, as my own grandmother, like millions of other immigrants before and after, had arranged for the admission of her parents and their younger children after her arrival in the United States as a young woman.

Second, President Trump has made the most significant reduction in the admission of refugees since enactment of the Refugee Act of 1980. The ceiling on admissions was set at 45,000 for the current fiscal year and actual  admissions are not nearly on a pace to meet that low number. By contrast, the commission recommended a floor on admissions of 50,000, stating that foreign policy and humanitarian imperatives necessitated that the United States take a strong leadership role in assisting and protecting refugees worldwide. The commission saw resettlement of refugees as one of the core durable solutions to refugee crises and believed the United States should lead by example. It believed that consultations with Congress, as specified in the Refugee Act of 1980, would be an effective mechanism for increasing admissions beyond the 50,000 floor when necessary. Indeed, the commission recommended that the President have even greater authority to raise the ceiling on admissions in the type of refugee emergencies experienced worldwide today. Jordan and the commission were cognizant of the dire consequences of the inflexibility of US refugee policies in the 1930s when the government rejected thousands of Jewish and other refugees from Nazi Germany who subsequently died in the Holocaust. The Trump policies would bring back those dark days with a hard ceiling on refugee admissions even when crises require flexibility and American leadership. The need for American leadership on these issues seems altogether lost on the administration.

The Commission also supported effective protection of other migrants fleeing life-threatening situations. Jordan was personally active in ensuring protection of asylum seekers from Haiti, a country described by President Trump in highly derogatory terms. In 1994, she approached President Clinton directly to ask him to reverse the policies adopted in the Bush administration that returned Haitian boat people to Haiti without consideration of their claims for asylum. She specifically recommended that they be granted temporary protection, either in Guantánamo or in the United States, until conditions changed significantly inside Haiti or they met the criteria for asylum. She would have been among those denouncing the Trump administration’s abrupt lifting of Temporary Protected Status for Haitians as well as Salvadorans. She understood that TPS was not a perfect solution for those who were unable to return home because of the conditions in their countries and believed in the importance of finding durable solutions for them here or abroad. However, she would never have supported returning TPS recipients to the kinds of conditions that will confront them in Haiti or El Salvador.

Third, the Trump administration has argued that immigration should be based on ‘merit’ as measured by a point system that rewards education and English language skills. The president implied that Norwegians have greater merit than potential immigrants from Africa. Under Jordan’s leadership, the commission explicitly rejected a point system, explaining its decision as follows:

We believe that a system that relies on formulas and bureaucratic procedures for determining which immigrants meet the ability criteria for admission is not as effective in serving the national interest as one that relies on the judgement of American families and employers within a framework that protects US workers from unfair competition.

The Trump administration ignored one of the most important recommendations that the commission made on legal admissions. The commission believed strongly that admission numbers and priorities should not be set in stone as has been the case: the last major reform of the legal immigration system took place in 1990. Rather, it recommended that Congress should revisit admission numbers and categories every three to five years to ensure they still meet the nation’s interests. Proposals by other blue ribbon panels would do the same thing, including through a standing commission which would assess needs and increase or reduce admissions in accordance with current economic conditions. The Trump policies would trap the country with admission ceilings that may be completely inappropriate in the years ahead.

Fourth, the President has chosen to put most of his immigration enforcement eggs into two baskets—a border wall and irresponsible deportation initiatives. The commission, by contrast, called for a comprehensive enforcement strategy that set priorities for deterring unauthorized migration and, when necessary, removing those who were without status or committed particularly serious crimes. The commission was aware that even twenty years ago a large proportion of migrants illegally in the country had overstayed their visas. A border wall would do little to address that problem. Recognizing that most migrants entering without authorization or overstaying their visas did so for jobs, the commission recommended an electronic employment verification system and enhanced labor standards enforcement designed to sanction employers who knowingly hired and exploited undocumented workers. Today, with illegal crossings at the US-Mexico border at historically low levels, expending scarce resources on a border wall makes even less sense. The Trump deportation policies are also problematic. Rather than prioritize the deportation of those who commit serious crimes, as have prior administrations, the administration has chosen to deflect resources towards detaining and attempting to deport those that pose no threat to the security of the country, including people who have registered for such programs as Deferred Action for Childhood Arrivals (DACA) and TPS.

Under Jordan’s leadership, the commission also supported greater cooperation with other countries in managing migration and deterring illegal movements. As part of the comprehensive strategy, the commission recommended negotiation of trade agreements, such as the North American Trade Agreement (NAFTA), that could provide greater economic opportunities in countries of origin while protecting the rights of workers. The commission knew that opening up trade between the US and other countries was not a quick fix to illegal immigration but saw it as a necessary part of a long-term strategy to reduce the push factors causing people to move.

Whether Jordan would have supported DACA is unknowable as she did not address that issue directly. From her views on the importance of citizenship, I feel confident, however, that she would have been a strong supporter of a path to citizenship for the Dreamers. Always seeking bipartisan solutions, she would have applauded President Trump’s proposed pathway to citizenship for about 2.2 million Dreamers. She would have wanted that path to be as expeditious as possible—much shorter than the Trump administration’s proposed 10-year delay. Jordan proposed a new Americanization program that would facilitate naturalization by providing resources to help immigrants more rapidly learn the language and customs of their new home. She would have recognized that the Dreamers have already learned those lessons since they have spent the most formative period of their lives in the United States.

In conclusion, the Trump administration would weaken the United States by placing irresponsible constraints on family reunification, refugee admissions and employment-based admissions while doing little to address the real causes of illegal immigration. The president’s policies are the opposite of Barbara Jordan’s view that a robust level of legal immigration is in the national interest. Even more critically, Jordan would have been the first person to speak up against the discriminatory intent and language in President Trump’s proposals. In her own words, “I believe the fact that America is a nation of immigrants should be a source of pride and not a reason to ignite virulent nationalism.”

Susan is a long-time friend, former client, and “academic superstar” who was my colleague at Georgetown. Indeed, Susan and our good friend Professor Andy Schoenholz were the “originators” of the “Refugee Law and Policy” course that I taught for several years as an Adjunct Professor at Georgetown Law. Small world!

Of course we need a “robust” legal immigration system not the irrational racially inspired cuts and trashing of “family based” immigration being pushed by Trump, Miller, Sessions, Cotton, and the rest of the White Nationalist xenophobic gang. 

We currently have an estimated 10-11 million so-called “undocumented” residents living in the United States. The vast, vast majority of them are productive, law-abiding individuals who provide services that are literally the “foundations” of our economy. Since we are essentially at “full-employment” the idea that these folks are “stealing jobs from Americans” is preposterous.

The problem is not that these folks are here without documents. Rather, it’s that our laws have been so poorly designed that we did not allow for enough legal immigration at the right levels (many more in the so-called “unskilled” and “service” jobs). Consequently, our economy and market forces basically created an “extralegal immigration system” to meet the legitimate needs of U.S. employers and would-be legal immigrants.

Logically, that calls for an expansion, not a contraction, of legal immigration. By allowing U.S. employers to use legal immigration to fill certain positions, we would virtually eliminate the so-called “jobs magnet” for illegal immigration. Moreover, we would insure that those coming have been properly screened, documented, and will pay taxes immediately. At that point there would be fewer individuals crossing the border illegally, and we could be better assured that those coming outside the system did not belong. The system would finally become rationally related to our national interests and the interests of the immigrants, instead of working against these natural market forces! And, we wouldn’t need “the Wall”,” a militarized border, the “New American Gulag,” tens of thousand of additional immigration agents, or thousands of additional U.S. Immigration Judges to make the system work. Imagine how much that might help the national deficit!

ImmProf: Since President Trump took office, immigration arrests are up 42 percent. ICE estimates, nationwide, they make 400 arrests a day. ICE has arrested 37,000 undocumented immigrants without criminal records. That’s a 145 percent increase over fiscal year 2016.

I’m a huge “Elizabeth Gibson Fan.” I’ve known Beth since she was a star student at Georgetown Law (one of the “Best Ever” of my “Refugee Law & Policy” — “RLP” — students), a terrific Legal Intern at the Arlington Immigration Court, and a spectacular Judicial Lw Clerk/Attorney Advisor at the New York Immigration Court before she was selected for the Immigrant Justice Corps (“IJC”) assigned to the New York Legal Assistance Group (“NYLAG”).

For those who don’t know, only the “best and brightest” with an overriding concern for social justice get into the IJC. Beth would excel at ANY legal job in America — “Nonprofit, “Big Law,” judging, teaching, writing, reporting, managing.

I’m inspired that with all these avenues open to her, Beth has chosen to use her “complete package” of talents to make the justice system work for the most vulnerable among us — those who have legal rights that are largely the same as all of us, but who are “bullied” and “intentionally mistreated” by our legal system (and our current Administration, in particular) in an attempt to prevent them from using and realizing those rights.

In  addition to being a weekly contributor to immigrationcourtside.com, Beth has acted as a “clearinghouse” for the vast amount of information and assistance available to the legal community involved in defending the rights of migrants. She has patiently taken many referrals of reporters and lawyers. She also has found time to write articles of her own, in addition to, of course, her main mission of helping her clients.

Beth, thanks for all you do for our country, our world, the cause of justice, and making “Due Process” under our Constitution a reality (at least for some) rather than an “empty promise!” You are truly what serving in the “New Due Process Army” is all about and why, in the end, the forces of darkness threatening our country and democracy will not prevail!
