Recently, I had the privilege of speaking to Judge/Professor “Q” Golparvar’s class on “Legal Drafting for Future Judicial Law Clerks” at GW Law. Here’s my list of tips that’s I discussed with that class:

NOTES FOR JLC CLASS

1) “Make me look smart” (please)

2)  Know and respect the difference between Judge & JLC

3)  Learn your Judge’s style and persona, likes, and “pet peeves”

4)  Know and write for your audience

5) Use outlines if possible

6) Write clearly, succinctly, to the point 

7) Use “active voice” — if your Judge is OK with it

8) Avoid boilerplate, legalisms, and “string citations”

9) Read the cases you cite

10) Be meticulously accurate — know where every “fact” in the fact-finding section came from and double check it

11)  Be respectful to parties, counsel, witnesses, and especially court clerks and other support personnel

12) Avoid stereotypical references

13) Follow “Bluebook” or whatever modified citation system your court uses

14) Don’t be afraid to ask

15) Know and follow applicable precedent

16) Yell before your Judge walks off a cliff

17) Accept criticism with grace, goodwill, and appreciation

18) Be a student and a teacher

19) Never miss a deadline without giving advance notice and asking permission

20) Write “from the issue”

21) Incorporate helpful material and arguments from the parties that the Judge agrees with

22) Proofread, proofread, proofread, and then proofread again

23) Respect confidentiality and ethics

24) Be a good “sounding board”

25) Why I love JLCs, how they changed my court experience for the better, and why they enhance due process!

This was a great class. It reminded me of all the great JLCs and interns who worked at the “Legacy” Arlington Immigration and my former students at Georgetown Law, many of whom have gone on to leadership positions working for social justice, including some who are now Immigration Judges.

While there has been progress in some courts, others remain far below the optimal 1:1 ratio of IJs to JLCs, some far below, as ridiculous as 8:1! Garland has failed to “harvest this low hanging fruit” in improving the quality of justice in his courts!

Congress and the Administration spend billions on cruel and ineffective immigration enforcement. Yet, they fail to invest the much more modest amounts that would improve the quality of justice for immigrants! It’s a national disgrace that somehow “flies below the radar screen” of the media and political pundits!

Attorney General Merrick Garland announced the appointment of 39 new Immigration Judges to EOIR. In somewhat of a “return to the past,” attorneys with primarily government backgrounds and judges from non-immigration systems predominated.

My “quick and dirty” analysis came up with the following groupings:

There should be a process, but there does need to be some space to be able to do this process. For people fleeing violence and persecution, nothing is more important than finding safety. For more than 40 years, U.S. asylum law has guaranteed asylum seekers the right to access legal protections enabling them to stay in the United States and avoid being returned to danger. But since the Refugee Act was signed into law in 1980, the laws on asylum eligibility have grown into a maze of convoluted requirements and pitfalls, like the children’s game “Chutes and Ladders,” with potentially deadly consequences. 

Because of the complexity and requirements of asylum law, it takes time to prepare an asylum application. In my 25 years of practice, I have prepared and filed hundreds of asylum applications. Based on my experience, it takes time to get an accurate account of someone’s life when there’s violence and trauma involved. It takes time to find evidence of torture and persecution. When you read this report, I encourage you to try to imagine navigating the complex legal steps in the asylum process. Then, imagine doing it without an attorney, a nearly impossible task as extensive research and data has shown.1 

This report comes at a critical moment when increased migration to the U.S. southern border and intense political pressure are pushing lawmakers to process asylum seekers faster. Faster can be accomplished, but it must also be fairer. If the system is fair, people meriting protection will receive it and those not eligible can and must depart. Toward that end, this report includes several recommendations that improve asylum processing so that it is both fair and more efficient. It is our hope that this report will contribute to policy reforms that are grounded in the realities of asylum law and the system that implements it.

Executive summary and recommendations 

The heightened levels of migration worldwide are drawing intense political and media attention to the United States’ southern border, including radical calls for blocking access to asylum seekers that would undo longstanding American humanitarian principles. More balanced, smarter approaches are available. In fact, since taking office, the Biden Administration has implemented several such policies, including the scale-up of resources to screen asylum seekers at the border and the expansion of existing legal pathways for people to obtain protection. 

Unfortunately, the President is also accelerating and truncating the asylum system in an attempt to speed up the process with policies like the 2022 asylum processing rule and the dedicated dockets program.ii AILA has forcefully opposed these recent policies because they are restricting or blocking asylum access and, as a result, deeply compromising the integrity and fairness of the U.S. system.iii 

This report on the asylum process draws principally upon the expertise of AILA’s membership of more than 16,000 immigration attorneys and law professors nationwide who provided more than 300 detailed responses to a survey about the critical steps and time required to prepare an asylum case.iv The report’s principal conclusion is that the minimum time required for an attorney to properly prepare an asylum case is 50 to 75 hours. While this estimate accounts for some complications, an asylum case can take much longer. For example, the attorney may need to find evidence of torture in a country that is still wracked by political violence or devote extensive interview time to obtain sensitive information from the asylum applicant while they are still suffering from trauma. See Appendix I. 

The government can greatly increase the efficiency of the asylum process by increasing agency resources and capacity and by eliminating existing delays within the system. Some of those steps are being taken, but further action is urgently needed . AILA recommends the Biden Administration use a systemwide, all-of-government approach to implement a range of solutions that will improve asylum processing and the management of migration at the U.S. southern border. 

America needs an asylum system that is in line with the nation’s commitments to protect asylum seekers and ensure a fair legal process while also meeting the urgent demand for greater efficiency and capacity. The country’s immigration system must be able to quickly identify who has a legitimate claim for humanitarian protection and who does not. Those not eligible should be required to depart. But imposing strict, arbitrary timelines for asylum that do not allow for adequate preparation will result in eligible asylum seekers being denied protection and sent back to face persecution or death.

Ultimately, systemwide changes can only be accomplished through congressional action to appropriate the funding required to meet these systemic demands. After three decades of inaction, Congress must pass immigration laws that ensure America’s immigration system is ready for the future. 

Key findings 

  • The basic steps of preparing an asylum application takes an estimated minimum of 50 to 75 hours. This work cannot be done in one continuous period; instead, it is carried out over the course of several months. Cases with significant complexity can take far more time than this estimate.
  • Most asylum cases are not straightforward. Complicating factors that add time to an asylum case may include detention, past trauma experienced by the applicant, language barriers, and procuring evidence from foreign countries or expert witnesses such as medical testimony.
  • It is extremely difficult for an asylum seeker represented by counsel to sufficiently develop their asylum application within the mandatory deadlines established in the May 2022 asylum processing rule or the expedited family court “dedicated dockets.”
    AILA recommendations
    Ensure asylum timelines do not undermine fairness
  • When setting asylum processing deadlines, allow adequate time for an asylum seeker to obtain counsel and for the attorney to prepare for the case. Timelines should not rush trauma survivors who may need more time to recount their experience. Reasonable continuances should be allowed to obtain an attorney or for attorney preparation.
  • Waive or exempt asylum seekers from deadlines if the reason the deadline was not met is outside of their control.
  • Do not hold asylum seekers to the same evidentiary standards when they are subject to expedited adjudication timelines, such as the shortened deadlines of the 2022 asylum processing rule.
    Reduce government delays and inefficiency
  • Establish uniform policies, centralized systems, and appropriate information sharing between immigration agencies. Agencies should centralize and digitize address changes across all agencies and simplify access to a noncitizen’s immigration record. These steps will enhance communication and data sharing, which will in turn reduce backlogs, avoid delays, and increase efficiency and fairness.
  • Reduce the immigration court backlog. Executive Office for Immigration Review (EOIR) should continue expanding initiatives to remove cases from the docket or facilitate the resolution of cases through pretrial conferencing. Immigration judges should administratively close or terminate appropriate cases, such as those eligible for a benefit with U.S. Citizenship and Immigration Service (USCIS).2
  • Do not expend finite prosecutorial resources on cases that can be resolved more expeditiously. Immigration and Customs Enforcement’s (ICE) Office of the Principal Legal Advisor (OPLA) attorneys should engage in pretrial negotiations and exercise prosecutorial discretion to avoid unnecessary litigation.

Legal access and representation improve fairness and government efficiency 

  • Ensure asylum seekers and other migrants being processed rapidly at the U.S. southern border have access to legal information, advice, and full counsel during credible fear interviews (CFIs), Customs and Border Protection (CBP) inspections, and immigration court proceedings.
  • Congress should Fund the Department of Justice (DOJ) to provide legal representation for all immigrants. Everyone needs access to an attorney to provide legal advice and information prior to any hearings, including the CFI. Congress should appropriate DOJ funding to provide full legal representation to those in removal proceedings who cannot afford it.
  • Ensure access to counsel in all detention facilities. Detention facilities must be held accountable to policies that ensure attorneys have reliable confidential contact visits with clients, as well as access to free and confidential phone calls and video conferences. The government must monitor access to counsel at ICE facilities and impose penalties for violations of standards.
    Reduce immigration detention

Reduce immigration detention. Detention delays asylum cases because it creates barriers to obtaining counsel and makes case preparation far more difficult. The Department of Homeland Security (DHS) should reduce its use of immigration detention. 

Improve the asylum process 

  • The Biden administration should publish the long-awaited regulation on particular social group (PSG) asylum cases. On February 20, 2021, President Biden issued an executive order to promulgate this regulation by November 17, 2021,3 but it has not been published. A regulation would aid in consistency of application of asylum law and would reduce USCIS referrals to immigration court.
  • Increase transparency in adjudications by making DHS’s asylum officer training materials publicly available.
  • Establish an interagency task force to develop a trauma-informed adjudication system. Experts in development, mental health, welfare, and trauma science should all be involved in this process. A trauma-informed adjudication process will help ensure accurate adjudications in the first instance, which in turn will decrease appeals.
  • Fund additional asylum officers. Congress should appropriate funds to increase the capacity of USCIS to adjudicate asylum applications.

A year ago, I wanted to cite something in a regulatory comment, but the cite I needed didn’t exist yet.

Today, the American Immigration Lawyers Association released a report on asylum timelines, High-Stakes Asylum: How Long an Asylum Case Takes and How We Can Do Better. The report is based on a survey of over 300 asylum attorneys about how much time it takes to prepare an asylum application, and what complications add significant time. High-Stakes Asylum also includes recommendations on how to inject efficiency into the existing asylum process and ensure the integrity of a system that has life-and-death consequences.

Three decades ago, when I was practicing business immigration at Jones Day, we also did a robust pro bono Immigration Court BIA practice in which I played an advisory role. Even then, we allocated a minimum of 100 hours of attorney/paralegal prep time for an asylum case in Immigration Court and 40 hours for a BIA appeal. 

And, at that time, the system probably wasn’t as “intentionally user unfriendly” as it is now. On some occasions, we were responding to requests for pro bono representation from Immigration Judges who believed that without representation certain previously unrepresented detained cases would “be lost and linger in the system forever.” That was long before 2 million case backlogs!

Representation is essential for due process at EOIR! This fundamental truth is neither new nor is it “rocket science!” That politicians of both parties and Article III Judges have swept this truth under the carpet doesn’t make it less true! If lives of persons who didn’t have the bad fortune to be immigrants were at issue, this intentionally due-process-denying system would have been held unconstitutional by the Supremes decades ago!

Unfortunately, A.G. Garland has fashioned a “highly, unnecessarily, and intentionally user unfriendly system” that actually discourages and impedes pro bono and low bono representation.

Even worse, he and his subordinates have failed miserably to “fully leverage” the amazing VIISTA Villanova program for training more highly-qualified non-attorney “accredited representatives” to rapidly close the representation gap throughout the nation. The asylum litigation “training modules” put together by VIISTA founder Professor Michele Pistone, with help from the National Institute for Trial Advocacy (“NITA”) puts EOIR/DOJ/DHS asylum training to shame!

Villanova Law  — The founder of VIISTA Villanova, brilliant lawyer, inspirational leader, teacher, scholar, social justice mavan, why isn’t she running and reforming EOIR? Why is Garland afraid of a proven “creative disrupter” driven 100% by a commitment to equal justice for all?

Incredibly, the Biden Administration “blew off” recommendations by experts that Professor Pistone or one of her colleagues be recruited to “shake up” EOIR and radically reform and improve training in asylum and other forms of protection.

Lack of fundamental expertise and private sector expedience representing asylum seekers is a key reason why EOIR under Garland continues to “wander in the wilderness” of legal dysfunction with no way out! So unnecessary! So damaging to democracy!

After more than two years of bumbling around, in the process squandering their access to the ideas and problem-solving skills of an un-precedented “brain trust” of immigration experts, the Biden Administration appears to be in “full panic mode” as the inevitable lifting of the Title 42 charade slowly approaches. Notably, a Federal Court ordered the Administration to make good on its (already delayed) promise to end Title 42 back in November 2022. But, the Supremes unethically blocked that order — granting a stay that NO ACTUAL PARTY to the litigation requested, in a simply mind-boggling exercise of politicized, unconstitutional interference with the Executive. 

Instead of using the time to 1) work with NGOs, 2) hire and train more expert asylum officers, 3) replace the BIA and anti-asylum Immigration Judges with qualified human rights/due process experts, and 4) drastically ramp up the refugee admission system outside the U.S. (not substituting an inadequate and “jury rigged” numerically limited “parole” program for legal refugee and asylum admissions), the Administration frittered away the opportunity with obstructionist/restrictionist nonsense. Now, they are “running scared” from desperate refugees merely seeking to exercise their legal rights that have been illegally and immorally denied to them for years — by successive Administrations.

Ex-judges: Immigration courts should be independent

Two retired immigration judges urged Congress to create an independent immigration court system, removing the courts from under the U.S. Justice Department, where they currently reside.

Panelists on a recent ABA webinar argued that immigration judges are not truly independent as long as they answer to the U.S. attorney general.

The former judges made their call at a panel discussion March 17 — “Adjudicatory Independence: Are Immigration Judges a Warning or a Model?” — organized by the American Bar Association Judicial Division. They and other panelists argued that immigration judges are not truly independent as long as they answer to the U.S. attorney general, who can overturn their decisions, fire them and create new immigration policies that they must follow.

Steven Morley, a retired immigration judge in Philadelphia, talked about a case he handled in 2018, called the Matter of Castro-Tum, which he considered a red flag for judicial independence.

The case involved an unaccompanied minor who illegally entered the United States, was detained by authorities, then released to relatives in the United States pending a hearing to force him to leave the county. Hearing notices were sent to the relatives’ address, but the boy did not appear. Finally, after four postponements, Morley administratively closed — or indefinitely suspended — the case, ruling that the Department of Homeland Security could not show it had a reliable address to notify the boy of his hearing.

At that point, U.S. Attorney General Jeff Sessions referred the case to himself and overturned the judge’s decision. Sessions ruled that immigration judges do not have the authority to administratively close cases as Morley did. The new policy made it harder for immigration judges across the country to indefinitely suspend cases. This caused an uproar among immigration judges and advocates.

Three years later, in 2021, Merrick Garland — a new attorney general in a new administration — overturned Sessions’ action.

Such actions undermine the independence of immigration judges, Morley said. “The flaws in the system allow this to happen, and we should always be concerned for the integrity of the court system.”

Morley said attorneys general under President Donald Trump referred immigration cases to themselves to overturn judges’ decisions 17 times in four years, a large number compared to previous administrations. “This is no way to run immigration policy, to have ping-ponging back and forth of policy, from one attorney general to another attorney general.”

Joan Churchill, a retired immigration judge in Northern Virginia, outside Washington, D.C., also emphasized the importance of maintaining due process in immigration courts, particularly hearing notices to defendants. “Adequate notice of the hearing is on everybody’s list as a requirement of due process,” she said.

Churchill noted that the U.S. Supreme Court, in a decision a few years ago, written by Justice Neil Gorsuch, found that notices in immigration court often were not constitutionally adequate. “Justice Gorsuch said any notices that did not include the time and place of the hearing — which many of them did not; they just said time and place to be determined — those were not adequate notice of the hearing and therefore the cases were defective.”

In 2010, the ABA House of Delegates adopted a policy supporting the creation of an independent Article I system of immigration courts. More than 150 organizations support this position, including the National Association of Immigration Judges and the American Immigration Lawyers Association, Churchill said.

The ordeal of Farooqi, who covers politics and national news for News One in Pakistan, exemplifies a global epidemic of online harassment whose costs go well beyond the grief and humiliation suffered by its victims. The voices of thousands of women journalists worldwide have been muffled and, in some cases, stolen entirely as they struggle to conduct interviews, attend public events and keep their jobs in the face of relentless online smear campaigns.

Stories that might have been told — or perspectives that might have been shared — stay untold and unshared. The pattern of abuse is remarkably consistent, no matter the continent or country where the journalists operate.

Farooqi says she’s been harassed, stalked and threatened with rape and murder. Faked images of her have appeared repeatedly on pornographic websites and across social media. Some depict her holding a penis in the place of her microphone. Others purport to show her naked or having sex. Similar accounts of abuse are heard from women journalists throughout the world.

This article is part of “Story Killers,” a reporting project led by the Paris-based journalism nonprofit Forbidden Stories, which seeks to complete the work of journalists who have been killed. The inspiration for this project, which involves The Washington Post and more than two dozen other news organizations in more than 20 countries, was the 2017 killing of the Indian journalist Gauri Lankesh, a Bangalore editor who was gunned down at a time when she was reporting on Hindu extremism and the rise of online disinformation in her country.

New reporting by Forbidden Stories found that shortly before her slaying, Lankesh was the subject of relentless online attacks on social media platforms in a campaign that depicted her as an enemy of Hinduism. Her final article, “In the Age of False News,” was published after her death.

Until news organizations recognize the purpose of harassment campaigns and learn to navigate them appropriately, experts say, women will continue to be forced from the profession and the stories they would have reported will go untold.

“This is about terrifying female journalists into silence and retreat; a way of discrediting and ultimately disappearing critical female voices,” Posetti said. “But it’s not just the journalists whose careers are destroyed who pay the price. If you allow online violence to push female reporters out of your newsroom, countless other voices and stories will be muted in the process.”

“This gender-based violence against women has started to become normal,” Farooqi said. “I talk to counterparts in the U.S., U.K., Russia, Turkey, even in China. Women everywhere, Iran, our neighbor, everywhere, women journalists are complaining of the same thing. It’s become a new weapon to silence and censor women journalists, and it’s not being taken seriously.”

“Not being taken seriously” aptly describes the attitude and actions of the Biden Administration toward some women seeking asylum on the basis of gender-based violence. Certainly, our Government could and should do better at recognizing and prioritizing refugee and asylum status for this vulnerable group.

Yet, even this “slam dunk” case took nearly six months to adjudicate. Seems like it could and should have been granted at the interview in a well-functioning system. Better yet, most Afghan refugees could have been screened overseas and admitted in legal refugee status, thus avoiding the backlogged asylum system and freeing both USG and private bar resources for more difficult cases.

Yet, I am aware of no guidance, precedent, or directives recognizing refugee status or directing grants of asylum for Afghan women. In the meantime, several European nations have determined that all women who have fled Afghanistan can qualify as refugees. Once, America was in the forefront of setting precedents that protected female refugees. See, e.g., Matter of Kasinga, 21 I&N Dec. 357 (1996) (FGM, opinion by Schmidt, Chair). Now, not so much, despite our nation’s heavy involvement with Afghanistan. Apparently, the “powers that be” are afraid that consistently and aggressively supporting refugee protection for women fleeing Afghanistan and other dangerous countries would “encourage” them to actually seek legal protection here thereby upsetting right-wing nativists and misogynists.

Yet, incredibly, the Biden Administration proposes to send up to 30,000 rejected NON-MEXICAN border arrivals per month to Mexico without fair examination of their potential asylum claims. To date, BIA precedents, regulations, and policy statements have NOT recognized the well-documented, clear and present dangers for journalists, women, and particularly female journalists, in Mexico. Consequently, I’d say that there is about a 100% chance that some female journalists seeking asylum will be illegally returned to death or danger, whether in Mexico or their native countries. 

Just can’t make this stuff up. Yet, it’s happening in a Dem Administration!

AG Merrick Garland did vacate former AG Jeff “Gonzo Apocalypto” Sessions’s lawless and misogynistic decision in Matter of A-B-. That action “restored” the BIA’s 2014 precedent decision in Matter of A-R-C-G-, recognizing that gender-based domestic violence could be a basis for granting asylum. 

However, the BIA didn’t elaborate on the many forms that gender-based persecution can take, nor did they provide binding guidance to Immigration Judges on how these cases should be handled in accordance with due process, fundamental fairness, and best practices.

Garland and his BIA have failed to follow up with any meaningful guidance or amplification of A-R-C-G- for Immigraton Judges. That’s even though many women fleeing Latin America come from countries where gender-based violence is rampant and the governments make little or no effective efforts to control it — sometimes police and other corrupt officials even join in the abuses. 

Consequently, life or death protection for female asylum seekers remains a disgraceful and wholly unacceptable “crap shoot.” Outcomes of well prepared and copiously documented asylum cases often depend more on the attitude of the Immigration Judge or BIA Appellate Judge hearing the case than on the law and facts. 

Also, without a knowledgeable lawyer, which the Government does not provide, an applicant has virtually no chance of winning a gender-based protection case in today’s EOIR. Additionally, those in immigration detention or placed on Garland’s “accelerated/dedicated” dockets are known to have particular difficulty obtaining pro bono counsel.

Anti-asylum IJs, some of whom were known for their negative attitudes toward female asylum seekers — many of those who actually “cheered” Sessions’s biased and wrong reversal of hard-won asylum protection for women in EOIR courts — remain on the bench under Garland at both levels. 

To their credit, some have changed their posture and now grant at least some gender-based cases. But, others continue to show anti-asylum, anti-female bias and deny applications for specious reasons, misconstrue the law, or just plain use “any reason to deny” these claims, without any fear of consequences or meaningful accountability. 

Trial By Ordeal
Many advocates and experts would say that female asylum applicants still face “trial by ordeal” in Garland’s “overly Trumpy” EOIR. Despite campaign promises, the Biden Administration has done little to champion the cause of gender-based refugees and asylum seekers — at the Southern Border or elsewhere.  Woman Being “Tried By Ordeal”

Whether or not such egregious errors and non-uniform applications of asylum law get reversed at the BIA again depends on the composition of the BIA “panel” assigned to the case. (Not all “panels” have three Appellate Judges; some are “single member” panels). Significantly, and inexplicably, a group of Trump-holdover BIA Appellate Judges known for their overt hostility to asylum applicants (with denial rates approaching 100%) and their particular hostility to gender-based claims, remains on the BIA under Garland. There, they can “rubber stamp” wrong denials while sometimes even reversing correct grants of protection by Immigration Judges below! Talk about a broken and unfair system!

With an incredible backlog of 2.1 million cases, approximately 800,000 of them asylum cases, wrongly decided EOIR cases can “kick around the system” among the Immigration Courts, the BIA, and the Circuits for years. Sometimes, a decade or more passes without final resolution! Imagine being a pro bono or “low bono” attorney handling one of these cases! You “win” several times, but the case still has no end. And, you’re still “on the hook” for providing free legal services.  

It’s no wonder that, like his predecessors over the past two decades, Garland builds EOIR backlog exponentially — without systematically providing justice or instituting long overdue personnel and management changes! It’s also painfully clear that, also like their predecessors, Garland and his political lieutenants have never experienced the waste and frustrations of handling pro bono litigation before the dystopian “courts” they are now running into the ground!

Meanwhile, Biden’s promise and directive that his Administration promulgate regulations containing standards for gender-based asylum cases that would promote fairness and uniformity within his OWN courts and agencies remains unfulfilled — nearing the halfway point of this Administration! Apparently, some politicos within the Administration are more fearful of predictable adverse reactions from right-wing nativists and restrictionists than they are anxious to “do the right thing” by listening to the views of the experts and progressives who helped put them in office in the first place! 

Thus, abused women and other refugees and asylum seekers, and their dedicated supporters, many of whom have spent “professional lifetimes” trying to establish the rule of law in these cases, face a difficult conundrum. In America today, neither major political party is willing to stand up for the legal and human rights of refugees, particularly women fleeing gender-based persecution. 

As an “interested observer,” it seems to me that something’s “got to give” between so-called “mainstream Dems” and progressive immigration/human rights advocates. The latter have devoted too much time, energy, courage, and expertise to “the cause” to be treated so dismissively and disrespectfully by those they are “propping up.” And, that includes a whole bunch of Biden Administration politicos who were nowhere to be found while immigration advocates were fighting, often successfully and against the odds, on the front lines to save democracy during the “reign of Trump.” 

That was a time when immigrants, asylum seekers, people of color, and women were the targets for “Dred Scottification” before the law. I have yet to see the Biden Administration, or the Dem Party as a whole, take a strong “active” stand (rhetoric is pretty useless here, as the Administration keeps demonstrating) against those who would use misapplications of the law, ignoring due process, demonization, and refusal to recognize the humanity of migrants as their primary tool to undermine and ultimately destroy American democracy!

Immigrants, including refugees, are overall a “good story” — indeed the real story of America since its founding. That Dems can’t figure out how to tell, sell,  advance, and protect the immigrant experience that touches almost all of us is indeed a national tragedy.

Without any immigration courts, Montana is tough for immigrants looking to build new life

The drive from Billings to Las Vegas is nearly a thousand miles. That’s 14 to 15 hours of windshield time, winding through some of the roughest, most isolated country in the continental U.S.

Imagine that U.S. forces recently evacuated you from Afghanistan, where the advancing Taliban would have killed you as a member of the Afghan military who fought them alongside Americans. You retreated under orders, unable to reach your wife and children, left behind in hiding in Kabul. Now, alone in Montana, struggling to improve your English, you must make the journey to Las Vegas in winter for your first immigration hearing.

You’ve come through war, exile from the only home you’ve ever known, separation from your family, and imprisonment in the first country you arrived in, but the U.S. Customs and Immigration Service still has a few curveballs for you.

You’ve had only a few weeks’ notice of your hearing, barely time to figure out how to make the trip. You’ve managed to borrow a car, but the owner has to work and can’t come with you. Flights are wildly expensive and you’ve survived first on savings and charity, now on a temporary work permit, so the road is the best option, but the drive is risky.

You’re lucky enough to have a pro bono lawyer appearing for you by video, but you’ve never met her in person. For most people in your situation, there is no lawyer. Although your life and those of your family are on the line, you have no right to representation.

This is the situation for dozens, possibly hundreds, of new Montana residents from Afghanistan, Ukraine, Venezuela, and other nations in crisis, including family members of U.S. citizens. The U.S. allows them to enter and remain in this country because they have credible fears of persecution in their home country and therefore a right under U.S. and international law to seek asylum. Montana nonprofits and religious organizations are scrambling to respond.

Since the U.S. pullout from Afghanistan in 2021, more than 76,000 Afghan nationals have arrived in the U.S., the largest wave of wartime evacuees since the fall of Saigon during the Vietnam War. The New York Times recently published a map of the distribution of Afghan refugees, with a few pinpoints in Montana, compared to thousands of arrivals in San Diego, Houston, and D.C. Many more are waiting for permission to come. In most cases, their lives are in danger from the Taliban.

Until 2016, a Montana resident in immigration proceedings could go to Helena, where a traveling immigration court staff heard cases several days a month. Budget cuts eliminated the court toward the end of the Obama administration. There was pressure to shift resources to the southern border, so staff relocated from more northern locations.

“Detailing” judges, as it’s called when judges move to different locations to hear cases, is expensive (travel, hotel, office space). According to the agency, immigration judges handle about 700 cases a year – the backlog is approaching 2 million – so Montana’s relatively light caseload makes the Helena court low on the priority list.

Now, Salt Lake City, Las Vegas, and Denver are common immigration court assignments for Montana residents. Personal appearances are usually mandatory. Travel is a costly burden for displaced people struggling to adapt to a new country. The distance is also a burden for lawyers, who often can’t spare the time to travel for brief hearings that are frequently rescheduled at the last minute. There can be jurisdictional problems, too. Montana is in the Ninth Circuit, a huge appellate region that includes all the states on the west coast, Nevada, and Idaho.

In the 9th Circuit, judges must give greater weight to testimony about what happened in other countries, and case law makes it more difficult to find that an immigration witness isn’t credible. That’s fine if a Montana resident goes to a hearing in Las Vegas, also in the 9th Circuit, but Salt Lake City and Denver are in the 10th Circuit. If a judge rules against a Montana resident using 10th Circuit law, when 9th Circuit law would have given a more favorable result, that’s just bad luck.

Many Montana lawyers may not be familiar with 10th Circuit law, making it that much more difficult for Montana residents to find a qualified attorney.

Montana lawyers with expanding immigration practices are beginning to ask, why Helena’s immigration court couldn’t be restored? Kari Hong, a Missoula attorney with the Florence Project, an immigration rights organization, points out that many clients have trouble finding qualified lawyers where multiple jurisdictions are involved, and differences in appellate law give some Montana residents worse judicial outcomes based on a random court assignment.

As a practitioner, Hong notes, it’s harder to show documents in a remote hearing, or be sure that everyone is looking at the same document. Interpretation is more difficult. Not being in the courtroom with a client makes it hard to establish rapport, and make sure that the judge is hearing everything. Attorneys are legitimately concerned, says Hong, about providing effective counsel in remote hearings that could be located anywhere in the country.

The U.S. Customs and Immigration Service has office space in Helena, where it handles immigration biometrics checks. so the cost of bringing in an itinerant immigration judge to handle Montana residents’ cases might be only a staffing and travel expense. But the appointment of more immigration judges and their assignments have become political issues wrestled over in Washington, D.C.

Paul Wickham Schmidt, a Wisconsin native, served as a career immigration lawyer and judge, chaired the Board of Immigration Appeals in the 1990s, and is now a law professor at Georgetown and formerly at George Mason University. He writes about dysfunction in the U.S. immigration system on his blog, Immigration Courtside. In an interview, he’s outspoken about how immigration courts have become a disgrace to the fundamental American value of justice for all.

“Today’s DOJ has allowed immigration courts to become weaponized as a tool of immigration enforcement,” says Schmidt. “For example, former Attorney General Jeff Sessions unethically and improperly referred to supposedly fair and impartial immigration judges as ‘in partnership’ with DHS enforcement. Attorney General (Merrick) Garland has done little to dispel this notion.”

Schmidt talks about the “Dred Scottification” of refugees, referring to the US Supreme Court’s 1857 decision in Dred Scott v. Sandford, holding that all people of African descent were not U.S. citizens and therefore could not sue for their rights in U.S. federal court.

The current U.S. immigration system, k says, treats refugees as sub-human, unworthy of rights long enshrined in U.S. and international law. It uses the court system to send political messages (for example, “Don’t come”) to refugees, turning the courts into political weapons.

Americans, says Schmidt, should be disgusted.

Part of the problem in maintaining the integrity of immigration courts is that immigration judges are appointed by the Attorney General and serve at his or her pleasure. They don’t have the independence of federal judges confirmed by the U.S. Senate under Article III of the Constitution, or the protections of Article I judges, like bankruptcy judges. They don’t control their dockets. Scheduling is done by non-judicial administrators, who book judges and lawyers so tightly that there’s no way, according to Schmidt, to do their jobs competently.

Immigration courts also lack necessary administrative support.

Hiring court administrators is done through a slow, difficult hiring process, and administrators struggle with inadequate space and tech support, which handicaps the whole immigration court system. In one example of the slow pace of progress in the immigration system, cases handled by the Executive Office for Immigration Review finally went electronic in 2022 – a quarter century after the U.S. federal courts transitioned to electronic filing, using a different system.

Many immigration judges are shouting for reform. Judge Dana Leigh Marks of the San Francisco Immigration Court, a past President of the National Association of Immigration Judges, says: “Immigration judges often feel asylum hearings are ‘like holding death penalty cases in traffic court.’”

Highly qualified people continue to leave the agency rather than uphold a farce.

“There are many of us who just feel we can’t be part of a system that’s just so fundamentally unfair,” said Ilyce Shugall, who quit her job as an immigration judge in San Francisco in 2019 and now directs the Immigrant Legal Defense Program at the Justice & Diversity Center of the Bar Association of San Francisco. “I took an oath to uphold the Constitution.”

Schmidt writes on his blog about the U.S.’s “disgracefully dysfunctional immigration courts,” which offer no right to legal representation. Having an attorney in immigration proceedings makes a huge difference, statistically speaking. For recently arrived women with children fleeing violence, the success rate of represented applicants is 14 times higher.

To fix the major problems with the system, Schmidt has a short list of big changes he’d like to see:

 

  • Create an Article I immigration court system. Article I courts are legislative courts created by Congress, without full judicial power to decide Constitutional questions, but with enough independence not to be controlled by political appointees.
  • The Board of Immigration Appeals needs to become a true appellate court.
  • Reverse reforms put in place by Attorneys General William Barr and John Ashcroft, intended to reduce the capacity of the immigration courts to do the work assigned to them by Congress.
  • Remove judges who deny 100% of asylum applications.
  • At the management level of the agency, hire professional court managers focused on providing due process and making the system work efficiently.
  • Improve automation, e-filing, and information-technology capability.

Montana residents are a tiny constituency of perhaps hundreds in the vast U.S. immigration system, processing millions of people, but they demonstrate what’s broken. Somewhere under the Big Sky is an Afghan evacuee who saved military aircraft from falling into the hands of the Taliban during the U.S. retreat from Kabul. He’s desperately worried about his wife and children trapped in Kabul, where the Taliban have identified them as the family of a soldier who supported the Americans.

They exist in hiding, while the Taliban-controlled passport agency charges thousands of dollars to produce a legal travel document. As his asylum application winds its way through the system, he texts his wife every day.

“All I can think about is making them safe,” he says.

“All I can think of is making them safe.” Given the facts in Carrie’s article, this Afghan case should have been a “no-brainer” asylum grant at the USCIS Asylum Office. Having made it to EOIR, it would be a candidate for a 30 minute “stipulated grant” in a properly functioning and professionally led Immigration Court system.

That cases like this, clear asylum grants that shouldn’t even reach EOIR, linger in the system, is symptomatic of the endemic dysfunction in America’s Immigration Courts. It also illustrates the failure of the Biden Administration and America’s “top lawyer,” A. G. Merrick Garland, to aggressively stand up for the legal rights of immigrants and to apply common sense, expertise,  and practical scholarship to our dysfunctional immigration and human rights bureaucracy.

But, all EOIR can think about is how human lives — and justice —  in Montana and elsewhere really aren’t very important in the overall bureaucratic scheme. And, it’s not not like A.G. Merrick Garland and his minions, safely ensconced in their offices at 10th & Penn in downtown DC, are thinking about the human carnage left in EOIR’s dystopian wake, in Montana and elsewhere!

We all “get” that Montana’s problems are “small potatoes” in the context of EOIR’s ever-expanding 2.1 million case backlog! Yet, EOIR could serve Montana in a way that preserves due process, promotes consistency, encourages representation, and delivers “good public service” without materially affecting their backlogs elsewhere or “breaking the bank.” 

EOIR’s approach to the “real problems” of the “small-population” State of Montana and its very human residents is sadly reflective of Washington’s overall approach to immigration and human rights: We won’t solve the “little problems” that could improve individual lives because we can’t solve the “big problem” of so-called “comprehensive immigration reform.”

I don’t buy it! There are plenty of ways that DOJ/EOIR could successfully address many of the “little problems” that would improve administration and public service in places like Helena. DOJ/EOIR does not have a “stellar record” for competent management or fiscal responsibility, to say the least.

For example, the DOJ Office of Inspector General recently found that EOIR had for years mismanaged multi-million dollar technology contracts.https://wp.me/p8eeJm-87P.

They have also wasted money on so-called “Immigration Judge Dashboards” so that they could monitor IJ “performance” under much-criticized and now abandoned “production quotas.” 

Certainly, with a little administrative ingenuity, EOIR could scrape together the modest amount of resources it would take to conduct periodic hearings in Helena and thereby provide due process to Montanans caught up in EOIR’s dysfunctional system. 

Without affecting overall backlogs or big budget increases, EOIR could:

  • Bring back one or more retired IJ’s as “rehired annuitants” to work part time on the Helena docket; or
  • Designate one or more IJs at the numerous so-called “EOIR Adjudication Centers” to hear cases in Helena by Televideo; or
  • Use Helena for piloting an authorized (but, to my knowledge, never implemented) “phased retirement” program for training and mentoring new IJ’s by those seeking to reduce their work hours as they move toward retirement; or
  • “Slim down,” or better yet eliminate, the unnecessary and duplicative “Office of Policy” created at EOIR HQ under Trump (why would an agency comprised of supposedly independent quasi-judicial officials need a “Bureaucratic Politburo?”) and allocating the resources to case adjudication — supposedly the ”lifeblood of EOIR;” or
  • Reprogram some of the unnecessary, non-adjudicating, fancy-titled “spear carrier” positions wandering the halls of the bloated, yet inept, EOIR bureaucracy in Falls Church.

Those are just for starters. Like its failed counterpart, USCIS, EOIR needs an independent re-examination of processes, quality control, and accountability —all of which currently are failing the public — in Montana and elsewhere! EOIR also needs new, dynamic, professional, problem-solving judicial administration by experts appointed from OUTSIDE the dysfunctional EOIR bureaucracy and the hapless gang of politicos at “Main Justice.” 

The only kind of “equal justice” that seems to be an objective at EOIR today is to make sure that public service is equally bad across America. 

Notably, as shown in Carrie’s article, the EOIR debacle is affecting virtually every county and every nook and cranny in America. No American community is too far removed from the DOJ/EOIR “bureaucracy of pain and failure” to avoid the adverse consequences of this monumental, and unnecessary, meltdown at the “retail level” of American Justice; even those humans residing in “EOIR Flyover Country!”

The esteemed Harvard Law Review does not publish much immigration scholarship.  A student note on the immigration court system may be of interest to blog readers.  The system long has been criticized and, last year, a bill was introduced in Congress that would have brought reform.

Noncitizens in the United States face innumerable obstacles, many of which have now become well known. But even the supposedly neutral court system in which noncitizens’ cases are adjudicated currently functions as an executive tool for removal. This Note argues that the current structure of the immigration adjudication system — and the resulting executive control over it — subjects Immigration Judges to a variety of conditions that, taken together, bias the entire system towards removal. It then surveys existing proposals for structural reform and proposes numerous possible intermediate reforms.

While waiting for Congress to act, however, the executive branch has the authority to implement several crucial reforms that would allow for noncitizens to have their cases heard in fairer proceedings overseen by IJs with true, independent adjudicatory power.

Good News for Harvard Law: Some bright, unidentified, Harvard Law students can cut through the BS and clearly state achievable reforms that could and should have been implemented by the Biden Administration without legislation.

Bad News for Harvard Law: Prominent graduate and Law Review “alum” AG Merrick Garland (‘77), once a step away from a seat on the Supremes, doesn’t “get” it and, in fact, his poor leadership and mis-management are key parts of the problems at EOIR that threaten the stability and credibility of the entire U.S. justice system.

Note to HLR: Follow your own advice to “cut through the noise” and reform yourself. Lose the “historical BS,” move into the 21st century, show some intellectual integrity, and set a better example by clearly identifying and crediting the authorship of this and other student articles, whether by individual(s) or a team. Now, those of you who read my blog immigrationcourtside.com or have heard me speak before, or both, know that I am an outspoken critic of the last four Administrations’ gross mismanagement and misdirection of our Immigration Courts. So, you might well ask why I am here recruiting YOU to become part of a court system that I have consistently lampooned and characterized as dysfunctional, FUBAR, and badly in need of long-overdue reforms.

A better question might be why AG Garland, VP Harris, Deputy AG Lisa Monaco, and Associate AG Vanita Gupta AREN’T here today actively recruiting you to apply to become Immigration Judges in their system. It’s a hugely important court, perhaps the largest in the Federal Government, that cries out for excellence, practical immigration scholarship, and badly needs a much more diverse, representative, and expert judiciary to achieve equal justice for all in America.

The short answer is because I CARE, and THEY DON’T! I have a vision of a model court system unswervingly dedicated to due process, fundamental fairness, great practical scholarship, best judicial practices, fantastic public service, and equal justice for all! THEY DON’T!

After two largely fruitiness and frustrating years of the Biden Administration’s bungling immigration and social justice mis-steps, it’s painfully clear that the needed management, personnel, operational, and expertise reforms needed at EOIR AREN’T going to come from above.

But, if you have been in Immigration Court and thought “Hey, there is a better, more informed, more efficient, more just way to run this railroad, why isn’t it happening,” THIS is YOUR chance to get on board and change the direction of EOIR and the millions of lives and livelihoods that depend on it! See that the next generations of dedicated immigration lawyers won’t face some of the unnecessary and counterproductive roadblocks and bad experiences that you have had to deal with in seeking justice for your clients before EOIR!

Not surprisingly, asylum grant rates dropped precipitously during the Trump years. Although they have rebounded some under Biden, they still remain below the 2012 levels. It’s certainly not that conditions have substantially “improved” in major “sending countries.” If anything, conditions are worse in most of those countries than in the years preceding 2012.

So, if the law hasn’t changed substantially and country conditions haven’t improved, what has caused regression in asylum grant rates at EOIR? It comes down to poor judging, accompanied by inadequate training, too much emphasis on “churning the numbers over quality and correctness,” and a BIA that really doesn’t believe much in asylum law and lacks the expertise and commitment to consistently set and apply favorable precedents and end disgraceful inconsistencies and “asylum free zones” that continue to exist.

Some of the most disgraceful, intentional asylum misinterpretations by Sessions and Barr now have been reversed by Garland. Unfortunately, he failed to follow-up to insure that the correct standards are actually applied, particularly to recurring circumstances. It’s one of many reasons that the Biden Administration struggles to re-establish a fair and efficient legal asylum system at the Southern Border — notwithstanding having two years to address the problems!

But, it doesn’t have to be this way! Recently, as I noted earlier, a number of notable “practical scholar experts” have been appointed to the Immigration Judiciary. When such well-qualified jurists reach a “critical mass” in the expanding EOIR, systemic changes and improvements in practices and results will happen.

The “dialogue” among Immigration Judges from government backgrounds and those from the private/NGO sector will improve. Lives will be saved. Life-threatening inconsistencies and wasteful litigation to correct basic mistakes at all levels of EOIR will diminish. The EOIR system will resume movement toward the former noble, but now long abandoned, vision of “through teamwork and innovation, being the world’s best administrative tribunals, guaranteeing fairness and due process for all!”

So, warriors of the NDPA, check out USA Jobs, make those applications for EOIR judgeships! Storm the tower from below! Make a difference in the lives of others, stand up for due process and fundamental fairness for all persons, and help save our democracy! Become better judges for a better America! To paraphrase Forrest Gump, Immigration Court is like a box of chocolates; you never know what you’re going to get. Also, some of the chocolate is poison.

For many applicants in Immigration Court, the most important factor in determining success is not the person’s story or the evidence or the quality of their lawyer. It is the judge who is randomly assigned to the case. According to TRAC Immigration, a non-profit that tracks asylum approval rates in Immigration Court, Immigration Judge (“IJ”) approval rates vary widely. For the period 2017 to 2022, asylum approval rates ranged from 0% (a judge in Houston) to 99% (a judge in San Francisco). Of the 635 IJs listed on the TRAC web page, 125 granted asylum in less than 10% of their cases. At the other extreme, nine IJs granted asylum more than 90% of the time.

Based solely on these numbers, there is a 20% chance (1 in 5) that your IJ denies at least 90% of the asylum cases that he adjudicates. That’s pretty frightening. But there is much more to the story, which we will explore below.

If Santa were an IJ, it wouldn’t matter whether you were naughty or nice – he would deport you Ho-Ho-Home.

First, the raw TRAC data does not distinguish between represented and unrepresented applicants, and having a lawyer generally makes a difference. Overall, represented applicants were denied asylum in 64% of cases. Unrepresented applicants were denied asylum more frequently–in 83% of cases. So if your IJ sees many cases where the applicant does not have an attorney, her overall denial rate is likely to be higher than if most of her cases have lawyers. To find this information, go to the TRAC website, click on the judge’s name, and scroll almost to the bottom of the IJ’s individual web page. You will see the percentage of cases before that IJ where the asylum applicant had an attorney. If you see that your judge presides over many unrepresented cases, it probably means that her overall denial rate is higher than would be expected if that IJ saw more cases where the applicant had a lawyer. What does this mean? Basically, if you are before such a judge, and you have an attorney, your odds of success are probably better than the judge’s overall denial rate would suggest. Conversely, if you do not have an attorney, your odds of receiving asylum are probably lower than the judge’s overall denial rate would suggest.

A second big factor that is relevant to each IJ’s denial rate is country of origin. People from certain countries are more likely to be denied, and so if your judge sees many people from those countries, his overall denial rate will be pushed up. You can see country-of-origin information if you click on your judge’s name and scroll to the very bottom of his web page. The countries that have had the highest denial rates over the past two decades are: El Salvador, Guatemala, Haiti, Honduras, and Mexico. And so if your IJ has many cases from these countries, his overall denial rate will likely be higher. Meaning that if you are not from one of these countries, your odds of winning asylum are probably better than what your judge’s overall denial rate would suggest.

A third important factor in examining IJ approval rates is the distinction between detained and non-detained asylum applicants. Certain judges have “detained dockets,” meaning that they rule on cases where the applicants are detained. Such people have a much more difficult time winning asylum: Some are barred from asylum due to criminal history or the one-year asylum bar. Others just have a more difficult time preparing their cases because they cannot easily gather evidence while detained. For these reasons, judges who decide many detained cases will generally have a lower overall asylum approval rate. Unfortunately, the TRAC data does not distinguish between detained and non-detained cases, and it is not always easy to know whether an IJ’s record includes detained cases (EOIR has a website that gives some details about each court, including whether that court is located at a detention facility).

While the TRAC data is not perfect (and there is no data on the newest IJs), it is the best source of information we have on Immigration Judge grant rates. Do keep in mind that the numbers only tell part of the story, and it is important to consider the above factors, as well as any other information you can gather from immigration lawyers and asylum applicants about your IJ.

What if you’ve done your research and have concluded that your judge is one of those who denies almost every case she sees? There are a few options.

One: You can go forward with the case and hope for the best. Sometimes a strong case can overcome a judge’s tendency to deny, and after all, even the worst IJs grant cases now and again (except for the 0% guy in Houston).

Two: You can ask for prosecutorial discretion and try to get the case dismissed. Except for cases where the noncitizen has a criminal or security issue, DHS (the prosecutor) is often willing to dismiss. Assuming you can get the case dismissed, you can then re-file for asylum at the Asylum Office (yes, this is a ridiculous waste of resources, but people are now doing it all the time). If you pursue this option, make sure to read the Special Instructions for the form I-589, as you will most likely be required to file your form at the Asylum Vetting Center.

Third: You can move. If you move to a new state (or at least a new jurisdiction within the same state), you can ask the IJ to move your case. Typically, you file a Motion to Change Venue. If the judge agrees, your case will be moved to a different court where you will hopefully land on a better IJ. Judges (and DHS attorneys) do not always agree to allow you change venue, especially if you are close to the date of your Individual Hearing or if you have previously changed venue in the past. And so if you plan to move your case, the sooner you make the move, the better.

Most Immigration Judges will do their best to evaluate the evidence and reach a fair decision. But some IJs seem intent on denying no matter what, and these judges are best avoided, if at all possible. Thanks to TRAC, you can get an idea about whether your IJ is one of these “deniers,” and this will help you decide how best to proceed in your case.

So, at roughly the “halfway point” of the Biden Administration, one of the “best minds in the business,” Jason Dzubow, is expending his awesome brain-power advising lawyers on “strategies” for avoiding unfair “any reason to deny” Immigration Judges who inhabit about one in five Immigration Courtrooms under Garland!  In other words, what steps you have to take to get a “fair hearing” on asylum from an agency whose sole function is SUPPOSED to be providing said “fair hearings” to everyone! See something wrong here? 

One of these “strategies:” Request the ICE prosecutor’s agreement to dismissal of the (probably already long-pending) case in Immigration Court and “refile” before the Asylum Office (which also is hugely backlogged). Jason admits “that this is a ridiculous waste of resources, but people are now doing it all the time.” 

Wonder why we have huge asylum backlogs? Despite what Trump, Biden, and nativist GOP politicos would have you believe, it has less do with those vainly seeking legal justice at our borders and LOTS to do with inept decisions, dumb actions (some of them downright malicious), and inactions by Congress and Administrations of both parties in the 21st Century.

Garland’s job was to fix this broken, unfair, wasteful, and astoundingly inefficient system. That isn’t “rocket science.” But, it requires dynamic, progressive, due process committed new leadership at EOIR and a major “shakeup” among Immigration Judges, at both the trial and appellate levels, so that those who are “looking for any reason to deny” either are get different jobs or start treating asylum seekers fairly and humanely by following Cardoza, Mogharrabi, Kasinga, and 8 CFR! 

Garland hasn’t gotten the job done! And, the applicants and lawyers whose lives and livelihoods are tied up in his beyond dysfunctional system are the ones paying the price for his failure! Also taxpayers see their dollars and resources being poured down the drain at EOIR!

But, they aren’t Garland’s only victims! EOIR’s dysfunction and its failure to provide consistently correct, generous, positive guidance on how to efficiently grant asylum, particularly at the border, drives a whole other series of failures, illegalities, wastefulness, and mis-steps by the Administration. 

Much of the nonsense and legally inappropriate gimmicks being rolled out by President Biden himself at the border this week is an insane attempt to avert the dysfunction at EOIR and USCIS by punishing not the inept politicos and bureaucrats responsible (nor political grandstanding GOP demagogues like Abbott & DeSantis), but the victims!

Improperly taking away the legal right to seek asylum at the border and creating more “jury-rigged” faux refugee programs by misusing parole are NOT the answer! Whatever their short-term impact is, in the long run they will fail just like all the other “deterrents” and “asylum work-arounds” unsuccessfully tried by Administrations of both parties over the past two decades. 

Indeed, for those of us who have been around immigration law and policy for the last half-century, it bears an uncomfortable resemblance to the “ad hoc, highly politicized, unsatisfactory” approach to refugee situations that was superseded by enactment of the Refugee Act of 1980. How little we learn from the past!

What HASN’T been tried is the obvious: Recognizing and vigorously defending the right to asylum and building a fair and efficient adjudication system run and staffed by human rights experts under the existing authority provided by the Refugee Act of 1980, as amended. Why not build a fair, functional, generous legal asylum system under that Act that would encourage applicants to use it and reward those qualified for doing so with timely legal status (including, of course, authorization to work)? 

Existing law already provides for “expedited removal,” without full Immigration Court hearings, of those who fail to establish to a trained USCIS Asylum Officer that they have a “credible fear” of persecution! Draconian as that measure is, and it undoubtedly has resulted in mistakes and injustices to asylum seekers, both the Trump and Biden Administrations have gone even further by wrongfully depriving those fleeing persecution of even this limited statutory right to present their claim to an Asylum Officer! To matters worse, both politicos and so-called “mainstream” media have “normalized” this disgraceful and harmful scofflaw behavior by ignoring the pretextual, racist roots of the Title 42 charade!

In the meantime, given the near total lack of leadership, competence, and courage from above to “do the right thing” and bring the “rule of law” to life, I do have a strong suggestion for NDPA members courageously “fighting in the trenches.” Apply for upcoming Immigration Judge vacancies at EOIR in massive numbers, over and over, until the roadblocks are removed and justice prevails!

As the relative proportion of “expert practical scholars” on the Immigration Bench grows and the “deniers’ club cohort” shrinks, change will emerge “from below” at EOIR, lives will be saved by the thousands, and justice will finally be realized in a system that now tries to resist and twist it! Functionality and “good government” will eventually win out over today’s inexcusable, and preventable, mess!

In July 2018 the BIA vacated the IJ’s grant of CAT relief and ordered Omorodion removed, concluding that Omorodion did not show that she would suffer torture or that public officials would acquiesce in her torture. … First, Omorodion argues that the BIA mischaracterized and ignored key evidence. We agree. … The BIA also erred by failing to apply the clear error standard in its review of the IJ’s “predictive finding that [Omorodion] would suffer torture by or with the acquiescence of the Nigerian government.” … The BIA erred as a matter of law when it overlooked such evidence and rejected the IJ’s predictive finding. To summarize, we grant the petition and remand because the BIA overlooked material components of the record and misconstrued others. See Xiao Kui Lin v. Mukasey, 553 F.3d 217, 220 (2d Cir. 2009). Should the BIA vacate the IJ’s grant of CAT relief on remand, it should explain where it identifies clear error in the IJ’s factfinding based on the totality of the record. If any vacatur is not due to clear error, the BIA must otherwise “provide sufficient explanation to permit proper appellate review” of its decision. Hui Lin Huang, 3 677 F.3d at 137. For the foregoing reasons, the petition for review is GRANTED, the BIA’s decision is VACATED, and the case is REMANDED for further proceedings consistent with this order.”

“We remand for the agency to conduct the required factfinding and analysis regarding the reasonableness of Perez Nagahama’s delay in filing her asylum claim following her changed circumstances. An asylum applicant must file an asylum “application . . . within 1 year after the date of . . . arrival in the United States.” 8 U.S.C. § 1158(a)(2)(B). There is an exception for “changed circumstances which materially affect the applicant’s eligibility for asylum.” Id. § 1158(a)(2)(D). Where there is such a change, the applicant must file an application “within a reasonable period given those ‘changed circumstances.’” 8 C.F.R. § 1208.4(a)(4)(ii). The IJ concluded and the BIA assumed that Perez Nagahama’s circumstances changed materially when she began living as openly gay in April 2015. What is a reasonable period for filing after a changed circumstance is a fact-specific inquiry: IJs should make specific “findings of fact with respect to the particular circumstances involved in the delay of the respondents’ applications” to determine the reasonableness of the delay. Matter of T-M-H- & S-W-C-, 25 I. & N. Dec. 193, 195–96 (B.I.A. 2010). … Perez Nagahama has raised a reviewable question of law that the agency failed to apply the proper standard because it did not consider her specific circumstances before concluding that her delay was unreasonable. … The agency did not conduct the required factfinding and analysis. … Here, the IJ did not make findings of facts regarding the reasonableness of the delay in light of the attendant circumstances. The BIA should have remanded to the IJ to consider whether the delay was reasonable. … Instead, the BIA made its own factual determinations that Perez Nagahama beginning to live as openly gay did not make her delay reasonable and that the other facts she pointed to were not related to this underlying changed circumstance. Compounding this issue, the BIA gave no reasoning for its conclusion that the relevant circumstance made her delay unreasonable.”

Clearly, the BIA’s performance in this and other recent CA remands is far below even the “good enough for government work” mantra that prevails at Garland’s dysfunctional EOIR! Why does Garland think “NOT good enough for government work” is “good  enough for due process for ‘persons’ who happen to be foreign nationals” with the their lives at stake in his “smashed to smithereens” piece of our “justice” system? 

The only way Garland gets to where his EOIR is today is by “Dred Scottification:” That is, intentionally treating “persons” (“humans”) in his Immigration Courts as “non –persons” under the Due Process Clause of our Constitution. If that sounds like a “Stephen Miller wet dream”🤮 (grotesque as that image undoubtedly is), it’s because that’s exactly what it is! How does a Dem Administration get away with this affront to due process, equal protection, and racial justice in America?

Kind of makes me wonder what they taught at Harvard Law (Garland’s alma mater) and other so-called “elite” law schools. I daresay that virtually all law students I have encountered in teaching immigration and refugee law for a number of years at Georgetown Law would have done better than the BIA had these cases been on my final exams. 

The BIA’s inability to fairly and competently apply basic legal standards, honestly and professionally evaluate evidence of record, give asylum applicants the “benefit of the doubt” to which they are entitled under international standards, provide positive practical expert guidance on granting relief, eliminate “asylum free zones,” promote uniform outcomes, and develop and enforce “best judicial practices” is a major factor in the incredible two million case backlog that Garland has built in Immigration Court! His failure to take corrective action by replacing the BIA with competent, expert, unbiased appellate judges is a major breach of both ethical standards and his oath of office! How does he get away with it?

Thousands of asylum applicants at our border are being illegally returned to danger! Individuals with valid claims to be in the United States are routinely being denied relief for specious reasons and clear misapplications of basic legal standards in his “courts” —  powerful indicators of systemic bias that should have been forcefully addressed by Garland on “day one” of his tenure at EOIR, as experts recommended.

Garland’s victims’ lives are irrevocably ruined or even ended! Misery is inflicted on their family, loved ones, and American communities! Dedicated lawyers working overtime to save lives are mistreated by Garland’s courts and traumatized by sharing the horrible consequences to their clients of systemic inferior judging! America is denied legal immigrants we need! 

Our Federal justice system is overwhelmed with wasteful and never-ending litigation of immigration cases that should have been timely granted in the first instance and bad policies that never should have seen the light of day. In this respect, note that the IJ actually got it right in Omorodion! Then, in attempting to accommodate DHS and achieve an illegal removal, the BIA completely botched it on appeal! Even where justice prevails at the “retail” level, the BIA screws it up!

Yet Garland just shows up for work and draws his paycheck as if this were the way “justice” is supposed to work in America and fixing it is “below his pay level!” Gimmie a break!

Meanwhile, back at the ranch, many congrats and much appreciation to NDPA stalwarts Tom Moseley and Genet Getachew!

If someone NOT Merrick “What Me Worry” Garland (the “Alfred E. Neumann of Biden’s immigration bureaucracy”) took a look at the data, one major thing would jump out! There are likely more than 400,000 refugees entitled to asylum sitting in Garland’s 770,000 case asylum backlog (52% x 770,000). (The asylum backlog at EOIR is a “subset” of Garland’s largely self-inflicted, ever mushrooming, nearly 2 million case EOIR backlog — more judges have produced more backlog, so that’s likely NOT the answer here). 

And, this is in a system currently governed by skewed anti-asylum BIA “precedents” and a chronic “anti-asylum culture” actively encouraged and fed by the Trump Administration. In a properly staffed and functioning court system with qualified, due-process oriented, judges and an expert BIA that enforced some decisional consistency and properly and generously interpreted asylum law, a “grant rate” of 75% or more would be a plausible expectation.

Given the obvious (and I would argue intentional) lack of reliable data on how a legitimate asylum system, one consisting at all levels of judges with well-recognized expertise in asylum law and human rights, and overseen by competent, due-process-oriented judicial administrators, might function, the 75% figure is just an “educated guesstimate.” But, it matches my own personal experience over 13 years on the bench in the (now defunct) Arlington Immigration Court. 

It’s also in line with my recent conversations with the head of one of the largest NGOs in the DMV area involved in meeting busses and counseling those “orbited” from the Southern border by the racist/nativist GOP Govs that Biden, curiously, has chosen to run our domestic refugee resettlement program. This is a person who, unlike Garland, his lieutenants, and most of the other politicos and nativist blowhards participating in the “border travesty,” actually spent years of a career representing individuals in Immigration Court. They estimated that “at least 70%” of the “arriving bus riders” had very viable asylum claims. 

This is a far cry from the nativist, restrictionist myths promoted by both the Trump and Biden Administrations — obviously to cover up their gross human rights violations in knowingly and illegally returning hundreds of thousands of legal refugees to danger zones! Many human rights experts would consider such gross misconduct to be “crimes against humanity.” Consequently, it doesn’t take much imagination to see why self-interested scofflaw officials like Garland, Mayorkas, and White House advisors seek to manipulate the system to keep the asylum grant rates artificially low while eschewing proper, realistically robust use of the overseas refugee program to take the pressure off the border — by acting legally rather than illegally! 

Almost all the EOIR asylum backlog consists of “regular docket” (I use this term lightly with EOIR where “normalcy” is unknown) cases. Those are refugees who have had time to get lawyers, adequately prepare, document their cases, but are stuck in Garland’s chronically dysfunctional system. Consequently, they are “denied by delay” legal immigration status, a chance to get green cards, and to eventually qualify for citizenship. The American economy is denied an important source of legal workers who should be part of our permanent workforce and well on their way to full participation in our political system and society!  

An expert looking at this system would see a “golden opportunity” to move most of the backlogged “easily grantable” asylum cases out of the system with stipulated grants or short hearings (the kind you actually might be able to do 3-4 a day without stepping on anyone’s due-process rights or driving the private bar nuts). These cases would also avoid the BIA’s appellate backlog, as well as eliminating unnecessary workload in the U.S. Circuit Courts (which already have their own inconsistency, rubber stamp, and bias issues in the human rights/racial justice area that seem to be getting worse, not better).

Knocking 400,000+ cases off the backlog wouldn’t completely solve Garland’s 2 million case backlog problem — only a complete “house cleaning” at EOIR, replacing many of the current bureaucrats with competent leaders and expert Immigration Judges well-versed in asylum law, will do that. But, cutting EOIR’s backlog by 20% (and the asylum backlog by over 50%) without stomping on anyone’s rights, while bolstering much-needed legal immigration, and harnessing the strengths of the private/pro bono bar, is nothing to “sneeze at!” That’s particularly true in comparison with Garland’s two years of mindless “designed to fail” gimmicks and astounding mismanagement, which have produced exactly the opposite results!

How bad has Garland’s leadership been at on human rights, due process, and racial justice at DOJ. A number of seasoned asylum practitioners have told me that today’s EOIR, also suffering from a tidal wave of Garland’s  “Aimless Docket Reshuffling” — is actually significantly worse than it was under Trump! That’s right, Garland’s tone-deaf incompetence has exceeded the disorder and systemic unfairness caused by overt xenophobia, anti-asylum bias, misogyny, “dumbing down,” and enforcement-biased “weaponization” of the Sessions/Barr years. 

As for Dr. Kocher’s cogent observation that input from the Immigration Judges who actually decide these cases is a “missing ingredient,” good luck with that, my friend! Perhaps understandably in light of his unseemly failures at EOIR, Garland has taken EOIR’s traditional opaqueness and “muzzling” of Immigration Judges to new heights — even barring their participation in CLE events aimed at improving the level of practice before his courts.

Apparently, “studied incompetence” in a Democratic Administration can be even worse than the “malicious incompetence” of the Trump Kakistocracy — at least where immigrants rights/human rights/racial justice/ women’s rights are concerned at EOIR. That’s an astounding observation! One that I actually never thought I’d hear from practitioners! 

The only way for human rights and racial justice experts and advocates to “communicate” with Garland in his “ivory tower” is to ‘“sue his tail” in court! Judge Sullivan’s recent opinion finding Title 42 illegal incorporates the very facts and law used by human rights experts and advocates in years of fruitless pleading and begging Garland to “cease and desist” his support for unlawful conduct and “just follow the law.” The latter seems like a modest “no-brainer” request to a guy once nominated by an Dem President for the Supremes.  

Waiting for Merrick Garland to fix the mess at EOIR to provide even a bare minimum of due process and rational administration is like waiting for the guy pictured below. Frustrated and “Garland-weary” as they might be, human rights advocates should take it to heart and act accordingly!

Waiting for Merrick Garland and his “clueless crew” at DOJ to fix the dysfunctional Immigration Courts will be an exercise in futility. He only pays attention when ordered by a Federal Judge, which, somewhat ironically, he used to be. But, he’s proven “beyond a reasonable doubt” that he is unqualified to run one of the most important and life-determining Federal Judiciaries — one where due process has been buried beneath an avalanche of expediency, incompetency, intellectual dishonesty, and dumb gimmicks. When will “enough be enough?”

In 2015, a Ghanaian man who goes by the initials M.A. and his gay friend were brutally assaulted by a vigilante group in Accra, Ghana. In Ghana, homosexuality is illegal and carries a prison sentence of up to three years. M.A. was beaten with sticks before escaping through a window. His friend was killed. Fearing the group would find and kill him, he fled to Ecuador and made his way to the U.S. border, where he requested asylum. After being detained for nine months, he was released on bond and lived with a childhood friend in New York while he waited for his case to make it through the legal system.

M.A. clearly faced persecution, but an immigration judge denied his claim. I took M.A.’s appeal to the Board of Immigration Appeals in 2016 as part of the Cornell Law School’s asylum appeals clinic. It took M.A. four years to win asylum in America, but at least he was given the chance to apply in the first place.

Since March 2020, approximately 900,000 people — including over 215,000 parents and children — have been denied the ability to request asylum at all. They’re casualties of Title 42, a pandemic-related policy that paused nearly all asylum proceedings at the border. Some people argue the policy is preventing an influx of migrants. In fact, numbers are up despite the policy, and our refusal to process most of them has led to chaotic and dangerous conditions.

The United States has successfully managed ebbs and flows of asylum seekers for decades. There’s a system in place to manage an influx — and regardless of how hard immigration lawyers like me fight for them to stay, many will lose their case and be deported. Even so, we must let people try. It’s not only the right thing to do, it’s also guaranteed under international and domestic law. We signed a 1967 protocol to the U.N. Refugee Convention to protect the rights of refugees, and we have adopted it and codified it into U.S. asylum law. Right now, we’re violating those obligations. The longer we do, the weaker American rule of law looks to our global partners.

We must immediately reinstate due process for asylum seekers. And once this happens, we must work to make the system more equitable and faster.

I agree that “we must work to make the system more equitable and faster.” But, the answer can’t be just to hire more Immigration Judges in Garland’s dysfunctional, broken, and anti-asylum-biased “court” system. That would just speed the “deportation assembly line” and lead to even more injustice and grotesque inconsistencies. 

According to TRAC, Immigration Judge “asylum denial rates” currently “range” from 5% to 100%. That’s a ridiculous, indefensible variation and a total perversion of the generous standard for granting asylum set forth by the Supremes in Cardoza-Fonseca and adopted by the BIA in Matter of Mogharrabi, but seldom enforced or followed, particularly these days.  Why this very obvious, totally solvable problem is still festering going on two years into a Democratic Administration that pledged to solve it is beyond me! 

Enough of this nonsense, biased, “amateur night at the Bijou” mal-administration of the Immigration Courts at EOIR by Garland’s DOJ! No wonder folks are still complaining about “Refugee Roulette” more than a decade after it was written by my Georgetown Law colleagues Professors Phil Schrag, Andy Schoenholtz, and Jaya Ramji-Nogales (now an Associate Dean at Temple Law). Why not put one of THEM, or for that matter, Professor Yale-Loehr, in charge of kicking tail and cleaning out the deadwood at EOIR?

At a minimum Garland must:

  • Remove the holdover “Asylum Deniers Club” from the BIA and replace them with a real judge as Chair and new Appellate Immigration Judges who are widely recognized as “practical experts” with careers that have demonstrated superior scholarship in immigraton and human rights, an unswerving commitment to due process for individuals, and a passion for racial justice in our legal system; 
  • Have the “New BIA” issue useful precedential guidance on how to document and grant valid asylum cases at both the Asylum Office and the Immigration Court, implement best practices, and identify and remove from future asylum adjudication those unqualified Immigration Judges who basically “make up” reasons to deny and can’t or won’t treat applicants fairly; and
  • Immediately replace with qualified expert judges those Immigration Judges on the “Southern Border docket” who can’t fairly adjudicate asylum cases.

Steve is totally correct about the need for Title 42 to go! But, Garland’s EOIR, particularly the BIA, is just as broken, counterproductive, and out of control as Title 42! In many ways, the illegal abrogation of the rule of law at the Southern Border has somewhat ”hidden” the larger problem that a dysfunctional and incapable EOIR poses for those who do manage to get a hearing!

Without a legitimate, totally reformed and significantly “re-populated” EOIR operating at the “retail level” of our justice system, there will be no rule of law and equal justice under law in America — for anyone!

Tell Garland you have had enough! The deadly and disorderly “EOIR Clown Show” has got to go! Now!

9th Circuit Decision in U.S. v. Bastide-Hernandez

Hi all:Attached please find the published, en banc decision of the 9th Circuit issued yesterday in U.S. v. Bastide-Hernandez.As expected, the court held that the absence of a date and time of hearing does not deprive the Immigration Court of jurisdiction.

However, please note the concurring opinion of Judge Friedland, stating that although the court held that the issue is not jurisdictional, “there are strong argument for the contrary position,” adding that the Supreme Court may reach a different conclusion.

Judge Friedland also quoted our Round Table’s amicus brief at length, as follows:

“An amicus brief filed by former immigration judges elaborates on why it better serves clarity, efficiency, and due process to include the time and location of the hearing in an NTA in the first instance. As amici explain, incomplete initial notice documents create uncertainty both for noncitizens, who are left in the dark as to when and where a potentially life-changing proceeding will be held, and for immigration judges, who cannot be sure if a case can proceed. Amici also note that the Government’s notice-by- installment practice creates additional fact-finding obligations for immigration judges, who may need to look to multiple documents to determine whether informational gaps in the initial notice have been filled. And amici caution that, because immigration judges are already overburdened and face pressure to complete cases, ambiguities about notice may lead immigration judges to order noncitizens removed when they fail to show up at their hearings, even if the noncitizens never received notice of those hearings at all.”

I think that this lengthy reference demonstrates the importance of our work.

In the words of Ninth Circuit Judge Michelle Friedland (Obama appointee): “[I]t better serves clarity, efficiency, and due process to include the time and location of the hearing in an NTA in the first instance.” 

What if we had an EOIR where all judges at the trial and appellate levels and all senior administrators were unswervingly committed to due process, fundamental fairness, and best practices?

Instead, we have a dysfunctional organization where DHS’s wishes, perceived expediency, and keeping the “political bosses” happy (thus providing “job security”) triumphs over the public interest and the cause of justice. Currently, we’re “saddled” with a broken system that sees Immigration Court as a “soft deterrent” rather than a dispenser of justice could actually make our immigration, human rights, and justice system run more smoothly by applying fair procedures and “best interpretations.” That would facilitate the legal admission of many more migrants, while starting to “disempower smugglers,” cut backlog, discourage poor practices at DHS Enforcement, promote consistency, and keep many disputes that should be resolved in favor of respondents out of the Article IIIs!

Better, more reasonable administrative precedents that adhered to the proper interpretations of asylum and protection laws and provided positive guidance on how to apply them to recurring situations would also “leverage” the Asylum Office by allowing many more cases to be granted at the first level. As long as the current lousy BIA precedents prevail, far too many cases will just be denied at the AO level and referred to Immigration Court — making it a colossal waste of time. “So-called streamlining” will only work if it results in significantly more AO grants of protection!

We “win some, lose some.” But, our Round Table’s cause is justice; we’re not going to give up until this system makes the long overdue, radical personnel, procedural, attitude, and “cultural” changes necessary to become the “best that it can be!” 

That means fulfilling the Immigration Courts’ once and future vision of “through teamwork and innovation become the world’s best tribunals guaranteeing fairness and due process for all.”

As we can see, eight years out of law school, Lauren has basically “done it all!” When are we going to see Lauren on the Federal Bench?
Like Vice President Kamala Harris, Lauren is a distinguished grad of Howard Law! So, why hasn’t Harris actively recruited her for a judicial or senior management position at EOIR, where due process, racial justice, practical problem solving, and a positive attitude toward human rights are in total tatters and need “big time” change and redirection?
Why are Dems blowing the opportunity to recognize, promote, and empower “the best and the brightest” that the “upcoming generation” of American lawyers has to offer?

Why is EOIR still a “due process wasteland” rather than a model, due process focused, best practices oriented, “progressive judiciary of the future?”

Somebody with some “pipelines” into the Biden Administration should be asking these questions and insisting on positive progressive actions!
