It was the first reported death at the Stewart Gulag since the Trump regime’s final killing in December 2020.

With “Caretaker Bureaucrats” in charge @ DHS & DOJ, the deadly migrant killing, harming, and terrorizing policies continue unabated. Indeed, as far as I can tell, seedy DOJ lawyers are pushing forward with defending the very cruel, stupid, inhumane, and illegal policies and bankrupt legal positions that the Trump immigration kakistocracy made infamous. The same policies that Biden and Harris campaigned against! EOIR continues to crank out skewed anti-immigrant, anti-asylum jurisprudence. 

The current policies are killers; the bodies continue to pile up, even if they are (quite intentionally) in obscure places like Lumpkin, GA, the “no persons land” near the Mexican border, and in dangerous and corrupt foreign nations where our Government mindlessly “orbits” other human beings without regard to what it will happen to them. 

For now, these stories of death, despair, and unnecessary human suffering are largely “out of sight, out of mind.” But, they are being documented and eventually history will highlight those, from the Roberts’ Court on down, who abjured their duties to their fellow humans and abused their positions of public trust.

A better Monday right off the bat, as I had predicted and hoped! But, the work has just begun! 

However welcome the Biden Administration’s immediate actions are, they have barely “touched the tip of the iceberg” on the human rights, civil rights, and human dignity abuses left behind by the just-departed kakistocracy.

There is a mess in the Federal Judiciary, from the lowest levels (EOIR) to the highest levels (Supremes). For example, the Supremes’ totally wrong-headed remand of ICE v. Padilla (described in Elizabeth’s report) shows a deficient Court that overtly fails to uphold the Constitution for asylum seekers and whose false and stilted jurisprudence continues to advance Jim Crow, White Nationalism, and Dred Scottification well into the 21st Century. Totally outrageous!

Let’s think about the Supremes in “real life” terms! The most vulnerable among us — asylum seekers who  are being openly abused by our Government while their lives are being trashed by our legal “system” get the shaft from El Supremos. But, yesterday the same Supremos issued corrupt traitor Prez Trump a “free pass” by going along with a corrupt scheme to “run out the clock” on “emoluments clause cases” that those seeking to uphold the rule of law had won below!

Suffering, death, and unfairness to the most vulnerable; free passes to the powerful and overtly corrupt! The problems with our failing justice system begin at the top and obviously have filtered down to places like EOIR where nobody expects any accountability for “going along to get along” with the Trump-Miller White Nationalist, racist, degradations of humanity!

Quoting Justice Sonia Sotomayor: “This is not justice!” Not even close!

Judge Garland must end the White Nationalist mess at EOIR by replacing (what passes for) administration and the BIA immediately, while quickly developing due process-expert-equal justice-human rights-diversity criteria and meaningful public participation in the judicial appointment process for the Immigration Courts. Then apply those criteria not only to new appointments, but also to retention decisions for the existing judiciary which is the product of a skewed “insider only,” “prosecutor and hard liner biased” defective system. 

Some Immigration Judges are well qualified, fair, and well respected; some are not. Judge Garland needs to figure out quickly who should serve, who shouldn’t, and who the best-qualified, fairest, and most universally respected “experts” are to create “the world’s best administrative judiciary” that will serve as a model for a better Article III Judiciary!

This is also the first step to reform throughout the Federal Judiciary all the way up to the failed Supremes. A functioning due-process-oriented, practical, progressive, independent Immigration Judiciary should become a source of better Article III Judges who handle high volume and promote best practices while actually improving due process and efficiency. A big winner for America!

A “model Immigration judiciary” (in place of the “Star Chambers”) will also be the centerpiece of a new independent legislative Article I Immigration Court that Judge Garland must push aggressively to insure that his reform work is institutionalized and is not destroyed by a future DOJ kakistocracy. 

As one of my esteemed judicial colleagues in the NAIJ said, immediately and radically reforming the current EOIR while pushing forward with Article 1 legislation requires the “ability to walk and chew gum at the same time.” 

Surely, Judge Garland, Vanita Gupta, Lisa Monaco and the rest of the incoming team at Justice have the demonstrated ability to do just that!

It’s up to all of us in the NDPA, the human rights and immigration advocacy community, the civil rights community, and the “good government movement” to keep pressure on Judge Garland and his team to fix EOIR and get the Federal Judicial reform movement moving at full speed. Raise hell if you have to, but don’t let this issue be delayed or “back burnered!”

This is not a “tomorrow” issue! Folks are suffering, dying, and the justice system is deteriorating — from the Supremes to  “America’s Star Chambers” every day that the current EOIR due process and fundamental fairness disaster remains unaddressed. Courageous lawyers who have fought to save our democracy from the “creeping and creepy kakistocracy” are being outrageously abused in “Star Chamber Courts” every day that the Biden Administration fails to take bold corrective action @ EOIR!

As the Migration Policy Institute has shown, the Trump-era changes to the immigration system numbered in the hundreds and consisted of dramatic reinterpretations of the laws alongside seemingly clerical changes, such as revised application forms for visas, higher fees and tighter deadlines in immigration courts — all to advance a maximalist enforcement agenda and slow down the ordinary gears of immigrant admissions. High-level White House advisers, working with knowledgeable allies in the Homeland Security and Justice departments, pushed out regulation after regulation to render asylum laws more restrictive and make it harder for noncitizens to present their case in immigration courts. Trump’s attorneys general exerted unprecedented authority to define asylum laws to severely limit claims by victims of domestic and gang violence, and to constrain immigration judges’ ability to grant relief and manage their dockets in a way that provides a semblance of due process.

And yet, the new administration’s policy agenda will not be complete unless legislative proposals are accompanied by concerted executive action across the administrative state, and not just because ambitious legislation on any issue faces an uphill climb in a Senate with the narrowest of Democratic majorities. Even when it comes to pass, legislation emerges from a bargain, leaving issues unaddressed, introducing new concepts to be interpreted and creating new programs that demand administration. Changing the direction of our government requires not only executive vision, but also multilayered strategies that make their way through the bureaucracy and down to the ground — along with the stamina and patience to see them through.

A “democracy” that doesn’t understand how it came to run prisons for vulnerable kids and star chambers for legal asylum seekers, and how to end them immediately, can expect little success in achieving social justice, promoting economic equality and prosperity for all, or leading and advocating for democracy abroad. 

It all starts with immigration. I can draw a straight line from the Muslim Ban, to the Roberts’ Court’s disgraceful and cowardly abdication of responsibility to stop it in its tracks (grotesquely undermining the many lower court Federal Judges who had courageously “mapped it out for them”), to GOP politicos running around undermining our free and fair elections, to “magamorons” and other traitor/crazies storming the Capitol. Folks “get” the abdication of moral responsibility and legal accountability when it is delivered by those who should be standing up for democracy.

The failure of career civil servants at all levels to “just say no” and rebel against these outrageous failures of Constitutional governance and simple human decency, combined with a horribly deficient Supremes’ majority that abandoned both legal legitimacy and moral leadership, created a beyond dangerous pattern that came very close to toppling two centuries of the “democratic experiment” and still has the future of our democratic republic “on the ropes.” 

Just look at what happened at the DOJ in the final weeks of the regime! Government officials who knew better settled for “heading off” a President’s treasonous acts rather than exposing them to the public, the Vice President, and leaders of Congress (perhaps other than treacherous co-conspirator Kevin McCarthy) who could have taken action for the immediate removal of this “clear and present threat” to our national security from the office for which he was so completely unqualified. Who knows, they might even have stopped the insurrection!

Look at the failed and ethically vapid Solicitor General’s Office (once, but no longer, one of the “Jewels in the Crown” of Government) that time and time again moved forward to defend unethical and unconstitutional policies before a willing Supremes’ majority based on patently false narratives and obvious pretexts (not very convincingly) concealing the overt racist, White Nationalist agenda of Trump, Miller, and the other neo-Nazis who had seized control of large portions of our governing machinery. Who, with the disgraceful complicity of the Supremes, turned American asylum law from the life-saving humanitarian refuge it was intended to be to instead an ugly weapon of racism, xenophobia, misogyny, child abuse, death, torture, unjust imprisonment, and overall dehumanization of the most vulnerable among us! What’s wrong with this picture? Everything!

Checks and balances and the courage and integrity of a professional career civil service are supposed to halt abuses like this, even in the face of failure of one of our two major political parties and our highest Court to act with integrity and adhere to democratic norms! But, with a few exceptions, courageous folks like U.S. Immigration Judge Ashley Tabaddor, Col. Alexander Vindman, and others like them, it did not happen over the past four years. That nearly cost us our country! (Note that Tabaddor, Vindmin, and others like them were punished, with the disgraceful treasonists from the GOP looking on and actually cheerleading, for speaking out and upholding their oaths of office.) 

Buried in the carnage of the departed regime are the many lives unnecessarily lost, futures ruined, and lasting trauma — trauma that will continue to adversely affect our nation far into the future — caused by failure to stop the kakistocracy’s unconstitutional, cruel, and inhuman abuses. From intentionally inept COVID policies, to “politicizing” masks, to deaths in detention, to unlawful deportations to torture, to unfair, clearly political misapplications of the death penalty (basically “legalized murder”), to officially-sanctioned misogyny — this damage can’t be swept away overnight. 

Like legislative and judicial failures, bureaucratic failure comes at a cost — a huge one! The fact that it might be largely “out of sight, out of mind” to the arrogant, largely white, privileged, ruling elites and ivory tower “High Court” jurists doesn’t mean the harm isn’t real. Just that our society has enabled some in power to look away and avoid meaningful contact with the human wreckage and lasting pain and damage they have caused and or tolerated!

Already, we can see how the Biden-Harris Administration’s inexplicable failure to “take charge” at a broken DOJ is undermining the long-overdue and well-thought-out progressive immigration agenda they announced with such fanfare. Here’s what’s come to light in just the past few days at the broken and dysfunctional DOJ:

  • Seeking the illegal deportation to Haiti of a mentally ill individual denied due process by the EOIR kakistocracy;
  • Failure to repudiate scurrilous, misogynist attacks on well-known refugee woman “Ms. A-B-“ by unqualified then “acting” AG Jeffrey Rosen; 
  • Issuance by the “EOIR Clown Show” of more false narratives and anti-migrant “precedents” — basically delivering the “big, public middle finger” to the new Administration and the AG-designate;
  • Release of a blockbuster investigative report on misogyny and misconduct within the Immigration Judiciary — with no response or plan for corrective action from the DOJ;
  • Appointment of a bunch of bureaucratic nobodies to “caretaker” duties at the DOJ — including one quickly found by reporters — but apparently missed by the incoming Administration — to have had ties to the grotesque child abuse program run by White Nationalist former AG “Gonzo” Sessions;
  • Release by the IG of a report showing the role of Sessions, Rosenstein, and other DOJ officials in “official child abuse” –  without any promise of accountability for past or future misconduct;
  • A treasonous plot by the President, a GOP Congressman, and a corrupt DOJ political hack that, although thwarted, went unreported until uncovered by reporters from The NY Times!

To state the obvious, why weren’t folks with known integrity, courage, and ability — professional decision-makers with track records of upholding our Constitution — like Judge Ashley Tabaddor and her colleagues in the leadership of the National Association of Immigration Judges — put in charge of the DOJ debacle to “ride herd”on this mess, restore some integrity, and prevent any more damage until “Team Garland” arrives? Few folks at Justice know as much about the “inept DOJ bureaucracy and failure of justice at Justice” than the NAIJ leadership which has been “at war” with the kakistocracy for years!

The solutions are still out there. But, it will take boldness, courage, and some “quick thinking outside the box” by “Team Garland” to get this completely (and unnecessarily) unacceptable situation under control!

That begins with an immediate clean-up of the “immigration kakistocracy/bureaucracy” throughout Justice — starting with the “EOIR Clown Shown.” Bring in the immigration/human rights/due process experts and let them start fixing the problems! 

Stop defending the unprofessional garbage being aimlessly tossed into the Federal Courts by the EOIR White Nationalist deportation factory still running under orders from Miller and Hamilton. Have all these cases reviewed by experts in immigration/human rights/due process and racial justice! 

Fire anyone in the SG’s office who presents bogus arguments concerning fake “immigration emergencies” and illegally promulgated “regulations” to the Supremes. End the unethical practice of using one-sided “precedents” to develop anti-immigrant “litigating positions” for OIL. 

Stop appointing unqualified individuals to precious Immigration Judgeships. Remove the entire BIA and replace it with real expert appellate judges unswervingly committed to fundamental fairness and due process for all. Replace “worst practices” with “best practices.” Stop the “Aimless Docket Reshuffling” at EOIR. Cut the largely self-created Immigration Court “backlog.”

Bring in Professor Rodriguez, Professor Schrag, Professor Ingrid Eagly, Judge Dana Marks (who argued and won the landmark Cardoza-Fonseca case before the Supremes), Judge (and former BIA Judge and high-ranking DOJ official) Noel Brennan, Judge Amiena Khan, Judge Mimi Tsankov, Marielena Hincapie (NCIJ), Dean Kevin Johnson (UC Davis Law), and a “due process brain trust” of others like them! Let them start “kicking some tail,” fixing the problems, and restoring sanity, humanity, and due process to the broken immigration kakistocracy at DOJ. Now, before any more lives are lost or futures irrevocably ruined! 

Let “practical scholars” like Rodriguez, Schrag, Eagly, and Johnson “turn their research and great thoughts into action.” “A little less talk, and a lot more action,” as Toby Keith would say!

The NDPA has already shown that it can out-litigate and out-strategize the Government immigration kakistocracy. In many ways, only the abject failure of the Supremes’ majority to stand up for the Constitution, rule of law, and human decency has prevented the NDPA from completely annihilating the kakistocracy, wiping out all of its misdeeds by judicial decree, and perhaps even holding criminals like Miller and Wolf accountable for their “crimes against humanity.” 

Judge Garland is a smart person. The “smart thing” would be to get the “NDPA on the inside at Justice,” creating order from chaos and re-establishing justice @ Justice now! 

Otherwise, smart or not, he’s likely to spend the bulk of his tenure as a “caption” on the never-ending avalanche of new legal actions filed against the deadly immigration bureaucracy by the NDPA. Because, I promise that the fight for due process in immigration and human rights isn’t over! It has just begun! 

There is lots to be gained by working together to solve these problems. But if it takes litigation, continuing conflict, and a never-ending political and press crusade against an Administration I otherwise support to get the job done, so be it!

The battle isn’t over until the kakistocracy is removed, at every level, and due process, fundamental fairness, equal justice, and respect for human dignity — all both Constitutional and human rights — become a reality for all persons in America (including those physically present at our borders) rather than just the cruel, unfulfilled promises they have been to date.

President-elect Joe Biden will roll out a sweeping overhaul of nation’s immigration laws the day he is inaugurated, including an eight-year pathway to citizenship for immigrants without legal status and an expansion of refugee admissions, along with an enforcement plan that deploys technology to patrol the border.

Biden’s legislative proposal, which will be sent to Congress on Wednesday, also includes a heavy focus on addressing the root causes of migration from Central America, a key part of Biden’s foreign policy portfolio when he served as vice president.

The centerpiece of the plan from Biden and Vice President-elect Kamala D. Harris is the eight-year pathway, which would put millions of qualifying immigrants in a temporary status for five years and then grant them a green card once they meet certain requirements such as a background check and payment of taxes. They would be able to apply for citizenship three years later.

The focus on Central America reflects the message that Biden has relayed to senior officials in the region: that he will advocate for policy changes aimed at what drives scores of migrants there to come to the United States illegally to seek safe harbor.

“Ultimately, you cannot solve problems of migration unless you attack the root causes of what causes that migration,” one official said, pointing to the various reasons — from economic to safety — that drive migrants to flee their home countries. “He knows that in particular is the case in Central America.”

Transition officials are aware of recent reports of the increased numbers of migrants at or heading to the border in anticipation of the end of Trump’s presidency, and urged them to stay in their home countries. They emphasized that newly arriving immigrants would not qualify for the legalization program that Biden proposes.

Biden wants to move the refugee and asylum systems “back to a more humane and orderly process,” the official said. But “it’s also been made clear that that isn’t a switch you flip overnight from the 19th to the 20th, especially when you’re working with agencies and processes that have been so gutted by the previous administration.”

Biden hopes to reinstate a program granting minors from Central America temporary legal residence in the United States. The Trump administration terminated the program in August 2017, officials said. The administration also wants to set up a reunification program for Central American relatives of U.S. citizens that would allow those who have been already approved for U.S. residency to be admitted into the country, rather than waiting at home for an opening. The program would be similar to ones that existed for Cubans and Haitians but also were ended by the Trump administration.

The Biden proposal also would put in place a refugee admissions program at multiple processing centers abroad that would better help identify and screen those who would qualify to be admitted as refugees into the United States.

As for border enforcement, the plan calls on the Department of Homeland Security to develop a proposal that uses technology and other similar infrastructure to implement new security measures along the border, both at and between ports of entry. Biden has long vowed not to expand the border wall Trump has marginally extended.

“This is not a wall; this is not taking money from [the Department of Defense],” a transition official said, referring to how Trump helped to finance his wall after pledging Mexico would pay for it. “It’s a very different approach.”

This is a welcome change from the poorly conceived, often ill-informed approach to immigration by the Obama Administration. It appears that Biden and Harris have actually “listened to the experts” and acted a accordingly.

The concentration on addressing the reality of Central American migration and dealing honestly and constructively with its root causes in a sensible and humane way is also refreshing. Using intelligence and technology to address real border security issues (as opposed to squandering resources on politically manufactured ones) also shows promise.

Many of the latter were  energized by the Trump/DHS program of White Nationalist racist fear-mongering and intentionally false anti-immigrant, anti-due-process narratives. That’s what “applied malicious incompetence” looks like — DHS and EOIR are two of the most egregious examples in a regime that raised it to an “art form.” It will take an aggressive and far-reaching “house cleaning” to get these agencies that have abandoned the common good and now operate “on the dark side” back on track.

The immediate “knee-jerk opposition” to rational, practical, fact-based immigration reform by notorious White Nationalist racist Sen. Tom Cotton (R-ARK) shows that Team Biden is on the right track to disavow the toxic institutionalized racism and biased policies of the Trump regime and move America along the path to racial justice and realistic, progressive immigration policies that will further the national interest and lead to a better future for all!

It’s a great, if long overdue, start to getting beyond Jim Crow and “Dred Scottification” and saving and enhancing our democracy! But, the proof will be in the results!

Biden, of course, will also face the formidable challenges of dealing with the human carnage left behind by the Trump regime’s disastrous mis-handling of COVID-19, economic inequality, the environment, racial justice, and foreign policy where American “prestige” has plummeted to levels not seen since the days of the Barbary Pirates.

He also must address a failing Federal Justice System that, particularly at its appellate levels, did not effectively stand up to the Trump regime’s  unrelenting assault on human decency and American democracy. You could say that about almost everything in the departing, defeated White Nationalist regime!

I’ll note for the record that among other things, the Supremes’ tone-deaf majority has been responsible for letting bona fide asylum seekers rot in squalor in camps in Mexico while waiting for non-existent “due process,” and also authorized the imposition of potential death sentences and torture on asylum seekers within our jurisdiction without any whit of due process.

The GOP majority’s disgraceful failure to stand up for voting rights of African Americans, Latinos, and other voters of color has also deepened racial injustice in America and helped usher in a horrible “Jim Crow Revival” pushed, incited, and enabled by the GOP, “The Party of the Failed Insurrection.”

Any competent first-year law student might ask “How could this happen in America?” That’s a question that Roberts and his gang of fellow Trump enablers and apologists will have to answer before the “court of history!”

E.A.’s mother’s recent childbirth is a serious medical event, which coupled with E.A.’s minor age, her difficulty obtaining transportation, and her difficulty navigating the immigration system without assistance, constitute “exceptional circumstances” necessitating rescission of the in absentia removal order. … The BIA’s decision was also contrary to law, and therefore an abuse of discretion. … First, the BIA improperly considered E.A.’s age separately, rather than considering age alongside other factors, when determining that she had not shown that exceptional circumstances justified her failure to appear. Second, the BIA erred when it dismissed without adequate explanation E.A.’s evidence that she is eligible for SIJS. Finally, the BIA improperly stated that E.A. was required to present prima facie evidence that she was eligible for immigration relief as part of her motion to reopen. … For the foregoing reasons, we GRANT the petition for review, VACATE the removal order, and REMAND for further proceedings consistent with this opinion.”

He premises his requests for such relief on the harm that he fears that he would be subjected to in Iraq at the hands of members of Iraq’s military or civilian insurgents operating in that country. Al Amiri contends that he has reason to fear he would be subjected to that harm on account of his work as a paid contractor for the United States Army during the war in Iraq, as in that role he educated U.S. soldiers about Iraqi customs and practices as they prepared for their deployment.   • Congrats to all involved!
  • Think how much better this system would function with expert  judges who treated asylum applicants fairly from the “git go,” granted protection wherever possible in accordance with the the Refugee Act of 1980 and the (more “woke”) Supremes’ precedent in Cardoza-Fonseca, provided clear, positive guidance on how valid claims could be documented and granted, and promoted and consistently applied best practices to achieve efficiency with maximum due process.
  • At first glance, although the issue is reopening rather than a continuance, E.A.C.A. undercuts McHenry’s nativist, insanely wasteful, and totally dishonest attempt to “raise the bar” for routine continuances for asylum applicants who need time to properly document and prepare their cases.
  • The “Deny – Deny Program” — deny due process, deny relief — that infects EOIR’s “Star Chambers” (impersonating “courts”) is a huge backlog builder that kills people and screws up Court of Appeals dockets in the process. 
  • Reopening cases that should be reopened, getting to the merits, and getting the many properly grantable asylum cases represented, documented, and prioritized would be a huge step in reducing EOIR’s largely self-created and unnecessary “bogus backlog.” 
  • Ultimately, many of the clearly grantable asylum cases being mishandled and wrongly denied at EOIR, at great waste of time and resources, not to mention unnecessary human trauma, could, with real expert judges at EOIR setting and consistently enforcing the precedents, be granted more efficiently and expeditiously at the Asylum Office and ultimately shifted to a more robust and properly run Refugee Program.
  • In the longer run, once EOIR is redesigned and rebuilt as a proper court with real, independent, expert judges, it might be appropriate to place the Asylum Offices under judicial supervision, given the grotesque abuses and corrupt, perhaps criminal, mismanagement of the Asylum Offices by USCIS toadies carrying out the regime’s racist, White Nationalist, unconstitutional agenda of hate and waste.
  • NOTE TO JUDGE GARLAND👨🏻‍⚖️: Please fix the EOIR mess, Your Honor, before it brings you and the entire US justice system crashing down with it! This is a national emergency, and a damaging national disgrace, NOT a “back burner” issue!

Greetings,

 

Sharing this win, E. A. C. A. v. Jeffrey Rosen, out of the CA6 by my amazing colleague Rachel Naggar who manages our BIA Pro Bono Project. This was an appeal of an IJ (Memphis) denial of an in absentia motion to reopen for a 13-year old unaccompanied child.

 

Interestingly, after oral argument, OIL filed a motion to remand the case (which Rachel opposed) and the CA6 denied that motion. Seems the CA6 really wanted to issue a decision on the merits and we are grateful for the decision. Here are some highlights from the decision:

 

SIJS

·       “Notably, the IJ’s decision does not mention E.A.’s claims that she was eligible for SIJS.”

·       FN 1: “As of the December 2020 Visa Bulletin, visas are available for special immigrants (category EB4) from El Salvador to adjust their status if their priority date is prior to February 2018. If DHS removes E.A. prior to approving her visa, she will be unable to apply for adjustment of status. See 8 U.S.C. § 1101(a)(27)(J).”

 

Totality of the Circumstances

·       “Based on the totality of the circumstances, including E.A. mother’s recent childbirth, E.A.’s young age, E.A.’s mother’s failed attempts to obtain counsel to help change the address of E.A.’s hearing, and E.A.’s inability to travel from New York to Memphis for the hearing, we hold that E.A. established exceptional circumstances.”

·       “Under the totality of the circumstances, E.A.’s young age is an important factor in determining whether exceptional circumstances exist.”

 

Exceptional Circumstances

·       “E.A.’s mother’s recent childbirth is a serious medical condition that supports reopening. The statute defining ‘exceptional circumstances’ that justify reopening an immigration proceeding lists the ‘serious illness of the alien, or serious illness or death of the spouse, child, or parent of the alien’ as an example. 8 U.S.C. § 1229a(e)(1). Childbirth is a serious medical event that necessitates a recovery period.”

·       “Instead of recognizing that childbirth is a serious medical condition, the BIA minimized the seriousness of childbirth and its impact on E.A.’s mother’s ability to bring E.A. to Memphis. […] Recovery from childbirth is exactly the type of circumstance that § 1229a(e)(1) was intended to cover.”

 

Prima Facie Eligibility

·       “Finally, the BIA erred by stating that E.A. was required to prove prima facie eligibility for immigration relief. The BIA’s decision improperly states that E.A. is required to show at this stage prima facie eligibility for relief. The statute governing motions to reopen removal orders entered in absentia provides that the petitioner must ‘demonstrate[] that the failure to appear was because of exceptional circumstances.’ 8 U.S.C. § 1229a(b)(5)(C). In general, we have stated that ‘[a] prima facie showing of eligibility for relief is required in motions to reopen.’ Alizoti, 477 F.3d at 451–52. In the case of a motion to rescind a removal order entered in absentia, however, the BIA has held that ‘an alien is not required to show prejudice in order to rescind an order of deportation” or removal. In re Grijalva-Barrera, 21 I. & N. Dec. 472, 473 n.2 (BIA 1996); see also In re Rivera-Claros, 21 I. & N. Dec. 599, 603 n.1 (BIA 1996). This is consistent with the statute governing motions to rescind removal orders entered in absentia, 8 U.S.C. § 1229a(b)(5)(C), which does not list a showing of prima facie eligibility for relief from removal as a requirement to rescind in absentia removal orders. Rivera-Claros, 21 I. & N. Dec. at 603 n.1; see also Galvez-Vergara v. Gonzales, 484 F.3d 798, 803 n.6 (5th Cir. 2007) (declining ‘to affirm the IJ’s decision on the grounds that [the petitioner] has not shown that he was prejudiced by his counsel’s performance’ because ‘In re Grijalva-Barrera, 21 I. & N. Dec. at 473 n.2, provides that an alien need not demonstrate prejudice for his counsel’s erroneous advice to constitute an ‘exceptional circumstance’ justifying rescission of an in absentia removal order’); Lo v. Ashcroft, 341 F.3d 934, 939 n.6 (9th Cir. 2003) (‘follow[ing] the BIA’s usual practice of not requiring a showing of prejudice’ to rescind an in absentia order of removal). We now join our sister circuits and hold that E.A. is not required to make a prima facie showing of eligibility for relief in order to obtain rescission under 8 U.S.C. § 1229a(b)(5) of the in absentia order of removal.”

It must stop! Justices who won’t treat migrants physically present in the U.S. or at our borders as “persons” under our Constitution — which they clearly are — do not belong on the Supremes! ⚖️🗽🇺🇸

I can also draw the lines connecting George Floyd, institutionalized racial injustice, voter suppression, riots at the Capitol, and the “Dred Scottification” of asylum seekers and other migrants by EOIR! 

HINT TO JUDGE GARLAND: Michelle Mendez would be an outstanding choice to lead the “clean up and rebuild” program at EOIR and the BIA once the “Clown Show” 🤡🦹🏿‍♂️ is removed!🪠🧹 Put experts with practical experience like Rachel Nagger and Christopher Linas onto the bench, on the BIA, the Immigration Courts, and the Article III Judiciary to get the American Justice system functioning again!

The “judicial selection system” for the Immigration Courts and the Article III Judiciary has failed American democracy — big time — over the past four years. Fixing it must be part of your legacy!

The folks who preserved due process and our Constitution in the face of tyranny are mostly “on the outside looking in.”  You need to get them “inside Government” — on the bench and in other key policy positions — and empower them to start cleaning up the ungodly mess left by four years of regime kakistocracy🤮☠️🤡⚰️👎🏻.  “Same old, same old” (sadly, a tradition of Dem Administrations) won’t get the job done, now any more than it has in the past! New faces for a new start!

And, it starts with better judges @ EOIR, which is entirely under YOUR control! An EOIR that actually fulfills its noble, one-time vision of “Through teamwork and innovation being the world’s best tribunals guaranteeing fairness and due process for all” will be a model for fixing our failing Federal Courts  —  all the way up to the leaderless and complicit Supremes who failed, particularly in immigration, human rights, voting rights, and racial justice, to effectively and courageously stand up to the Trump-Miller White Nationalist agenda of hate and tyranny!

It’s likely that the movement to hold accountable and remove from Congress traitors like Cruz, Hawley, McCarthy, and the other Republicans who shamelessly and seditiously continued to support the anti-American lies, racist false narratives, and conspiracy theories that fueled Trump’s insurrection and domestic terrorism will die out over time. But, it shouldn’t!

As I write this, the GOP treasonists in the House are blocking what should be a unanimous resolution to invoke the 25th Amendment to remove this dangerous, unhinged, traitor/moron from the office he has abused and disgraced from Day One!

One reason why our democracy is on the ropes is that there hasn’t been any accountability whatsoever for Trump and his kakistocracy of thugs on the public payroll or for the GOP White Nationalist traitors and enablers in Congress who have furthered their grotesque abuses of humanity and our democratic institutions.

The lack of accountability is particularly glaring and disgusting for Trump’s lawyers, both in and out of Government, who have lied, misrepresented, and totally jettisoned ethics and “due diligence” in supporting and furthering Trump’s attacks on our democracy. Why is Rudy Giuliani, who led a coast to coast “conspiracy of lies and treason” in Federal and State Courts, before calling for armed rebellion against our Government, still walking free and “practicing” law? Why are Billy Barr, Gonzo Sessions, Don McGhan, Noel Francisco, and a host of others who lied, misrepresented, and abused their ethical obligations as well as their oaths of office happily ensconced in the private sector rather than being held accountable for their “crimes against humanity?” 

Contrary to all the total BS 💩being spread by GOP Trump toadies, the unconstitutional, racist, illegal, violent, anti-democracy agenda of Trump, Miller, and the rest of of the Thugocracy/Kakistocracy was apparent from the “git go.” 

And, Chief Justice Roberts and the other GOP Justices who helped roll out and encourage “Kristallnacht” by rubber-stamping the “Muslim ban,” “Let ‘Em Die In Mexico,” the “Bogus Wall of Misappropriated Funds,” stripping legal migrants of life-saving and health preserving benefits, helping fuel a DHS “reign of terror” directed at ethnic communities, and other neo-Nazi travesties should also tender their resignations to President Biden as of Jan 21, 2021! Intellectual dishonesty by judges and bad, righty biased (non)jurisprudence have real life consequences! 

Trump and Miller told the Supremes precisely what their invidious racist, religiously biased, politically pandering intent was in all of these cases and the GOP Justices ignored it in favor of bogus, fabricated, right wing, authoritarian, racist driven, anti-democracy agendas thinly camouflaged by legal gobbledygook.

People die and lives are ruined forever when judges who are supposed to protect them instead “take a dive” for the forces of tyranny and cruelty! “Dred Scottification” (“dehumanization”) of Blacks, Latinos, Immigrants, and other People of Color by our highest Court is neither acceptable nor should it be “swept under the rug” as has happened all too often when the Supremes fail democracy and align themselves with anti-democracy racists and authoritarians.

For four years, the GOP Justices on the Supremes have treated due process, democratic institutions, and the lives of asylum seekers and other migrants (and to some extent their pro bono lawyers) as “jokes.” That’s because 1) neither they nor their families are rotting in Mexico or facing torture and death in El Salvador or some other failed state; and 2) this time, the right wing thugs they enable were across the street trashing our Capitol rather than storming the Supremes. Better Justices and Better Federal Judges for a Better America!

At some point on Wednesday, someone clearly told Donald Trump that he needed to act “presidential” or at least give himself some plausible deniability re: inciting the violent mob that stormed Capitol Hill and where at least one person was killed. We know this because he appeared in a video telling his supporters to “go home” and tweeted something to a similar effect. And we know he didn’t mean a word of it, and was clearly loving the domestic terrorism occurring in his honor, because of everything else he said.

In the video, he continued to insist that he won the election and told the angry horde, like only a truly insane person can, “You’re very special” and “we love you.” That is not how a normal person tells a bloodthirsty mob to disperse. In a subsequent tweet, he wrote this historically crazy series of words, as though he was signing the yearbook of his favorite homegrown terrorist: “These are the things and events that happen when a sacred landslide election victory is so unceremoniously & viciously stripped away from great patriots who have been badly & unfairly treated for so long. Go home with love & in peace. Remember this day forever!”

Shortly thereafter, Twitter deleted both the video and the post:

That followed Facebook’s call, with an executive for the company writing:

Unfortunately, Trump is clearly so far gone that he is still—at this very moment!—claiming he not only won the election but did so in a “landslide,” so we’re sure he’ll find a way to continue getting his message out, even if it means taking a major news network hostage in order to air his incoherent rants, or releasing a series of videos on whitehouse.gov featuring him humming the tune of Frankie Valli and the Four Seasons’ “Can’t Take My Eyes Off of You” to his supporters. No, no, he totally wants them to leave and definitely isn’t loving or encouraging any of this.

Many of us who have witnessed the illegal, immoral, and inhuman treatment inflicted by Trump and his neo-Nazi thugs, both inside and outside government, on migrants and asylum seekers have been sounding the alarm for the past four years. 

Now, everyone is suddenly waking up to the anti-American conduct of the party of thugs, racists, traitors, and cowards that is today’s GOP. 

And, we shouldn’t forget the shameful role of the corrupt, unqualified, and spineless GOP majority of the Supremes, whose disgraceful failure to protect the rights and humanity of the most vulnerable among us from abuse by Trump, Miller, and their group thugs has led to this entirely predictable moment.

Reforming the Supremes will require the disempowerment  of the treasonous GOP and the eventual establishment of a Democratic super majority that can reform the broken Federal Judicial system, starting with the mess on our highest Court.

Almost from day one of this lawless regime, the Supremes’ GOP majority has failed miserably to defend our democracy and humanity from tyranny, racism, and neo-fascism. We need and deserve better from our highest level of life-tenured Federal Judges!

Don’t believe the GOP BS💩 and the disingenuous “fake outrage”from members and enablers of the Party of Treason. Trump’s treason is an entirely predictable, even inevitable, outcome of modern Republicanism and a disgraceful party that gives “cover” to scumbag traitors and instigators like Cruz, Hawley, Johnson, McCarthy and others. ⚖️(IN)JUSTICE IN AMERICA 🇺🇸— Why Justice Amy Coney Barrett & A Whole Bunch Of Other Federal Judges 👨🏻‍⚖️👩‍⚖️Who Have “Tuned Out” Humanity Don’t Belong On The Bench!

Perhaps you’ve reserved some optimism for the whole “Barrett’s a mom and a Catholic so there must be some compassion there” thing. Sorry, but no. In her confirmation hearings, she spoke about how the George Floyd video was “very, very personal” for her family, and that she and her children “wept together” over what must have been the zillionth police murder in her history as a lawyer and mother. But her mentor, the late Antonin Scalia, seemed to think it was constitutional to put innocent people to death, despite his ultra-Catholicism. There’s no reason to believe that any sort of ideological consistency will prevail simply because of a judge’s familial status or bizarre metaphysical beliefs, and those factors made no apparent difference in Brad’s case.

Here’s where this gets complicated: In saying that being part of this horrendous decision should disqualify a judge from serving on the Supreme Court, by extension, I’m saying that damn near every federal judge is similarly unqualified. Almost none of them believe that cops should be held accountable for killing mentally ill people who call for help. This sort of thinking, in which cops are extended every benefit of every doubt, feasible or unfeasible, is the norm. Barrett didn’t even write the opinion in Brad’s case. It was written by a liberal judge who, like all her colleagues (of whatever political persuasion), was willing to write the police a blank check. That’s how our courts have operated for decades, and even in a post-BLM society, few of those in robes have the intestinal fortitude to do anything different.

So I am unmoved by Justice Barrett’s faith. I am unmoved by her status as a working mother of seven. I am particularly unmoved by her fake expression of sympathy for George Floyd, whose case she had nothing to do with, when she couldn’t spare any for the people who actually appear before her. I’m unmoved because I’ve seen so little compassion for grieving parents like Matt and Gina throughout my career, from any federal judge, let alone the Federalist Society drones who have lately taken over the judiciary. The basic inability to do what’s right for families like the Kings should be disqualifying. Not just for Amy Coney Barrett, but for the whole lot of ‘em.

This echoes what I’ve been saying on Courtside about the need for a “new breed of better, more progressive Federal Judges” who recognize the compelling human side of the law and why the Constitutional requirements of due process, equal protection, and fundamental fairness are there in the first place. They exist to protect individuals from tyranny and government overreach, not to be ignored, watered down, or woodenly distinguished away to protect government abusers from accountability or to further ideological agendas (primarily, but not exclusively those developed by right wingers) out of touch with the most vulnerable levels of humanity they are supposed to be serving.

Life tenure means that Coney Barrett and the rest of her unqualified colleagues will be around for a long time. But, change needs to start somewhere, now! 

In my experience, internal pushback, dissent, and constant confrontation of the complicit, complacent, judicial status quo with an aggressive implementation of due process, fundamental fairness, and a commitment to human rights and the best interpretations of the law can over time play a critical role in improving the law, changing results, and perhaps most important, saving lives!⚖️🗽👩‍⚖️🧑🏽‍⚖️👨🏻‍⚖️🇺🇸 That, not the hollow ideological agendas of Coney Barrett and others like her, is what “good judging” is really all about!

Intentional lack of compassion, empathy, and humanity (“Dred Scottification” of the “other”) have been themes of Trump, Miller, Wolf, Sessions, Barr, Rosenstein, Nielsen, Pompeo and the other neo-fascist toadies and moral misfits who have gleefully served the regime over the past four years. But, lack of overall resolve and courage to stand up and uniformly and authoritatively “just say no” to these toxic, anti-American, anti-humanity policies and to hold the “perps” accountable for their systemic lawlessness has plagued the Federal Judiciary, with a feckless and often downright complicit Supremes’ majority “leading” the way.

The current sorry state of our democracy, where GOP demagogues, who falsely swore to uphold our Constitution, openly spread lies, knowingly false narratives, and total BS in an attempt to incite violence, undermine our duly elected incoming President, and destroy democratic institutions, including the courts, is in part a reflection of the sad failure of our life-tenured Federal Judiciary to perform its core Constitutional function. That is, to stand up for the Constitution, the rule of law, and individual law human rights in the face failures by the other two branches of Government to uphold their Constitutional responsibilities.

Compare the (finally) unified position of the judiciary on the frivolous election challenges by Trump and his cronies with the failure to stand up for the legal and human rights of asylum seekers, refugees, immigrants, and migrants from the “git go.” Even now, the Courts have failed to sanction Trump and his lawyers for their unethical behavior in bringing frivolous civil suits, with no supporting evidence, for the specific purpose of undermining a free and fair election and using the legal system to attack the legitimacy of the duly elected President-elect and his incoming Administration. “Corruptly weaponizing the law for improper purposes” is clearly inappropriate and unethical. Yet, folks like Rudy and Sydney Powell retain their law licenses and are free to continue to abuse and undermine the system with frivolous litigation.

Dan points to the “ongoing battle between the law and humanity.” That’s the problem! The law should and must be about defending and advancing humanity in the face of tyranny and injustice. We need judges who stand for human justice. For, as MLK, Jr., said “Injustice anywhere is a threat to justice everywhere!”

Better judges for a better America! 🇺🇸Not just a slogan; a requirement for our democracy to survive!

Susan Church, an immigration attorney in Boston, ended the first week of the Trump administration arm in arm with protesters at Logan Airport, resisting an executive order banning travel from several predominantly Muslim countries. But what happened the next day, away from the public chants of “Let them stay!” was more typical of what the life of the former chair of the New England chapter of the American Immigration Lawyers Association (AILA) was to become under the Trump administration.

Church and an associate filed an emergency lawsuit to secure the release of immigrants from Customs and Border Protection (CBP) custody. “I got a federal judge on the phone, you know, on a Saturday night at eight o’clock.” The judge told Church to go to court immediately. An hour later, the attorneys were in court defending their clients.

“For me, that was the canary in the coal mine about what the rest of my four years under the Trump administration was going to be like,” Church said. “It’s just a nonstop series of emergency litigation filed to try to rescue one or 10 or 100 or 1,000 people, depending on which issue it is.” Eventually, the speed of the work, and the physical and mental exhaustion it triggered, landed Church in the hospital. “I thought I was having a heart attack,” she said.

Church stayed with the fight to reunite parents with their children. She described the process of taking affidavits from clients, which require she learn every harrowing detail of a client’s trauma. In one instance, CBP ripped away one woman’s eight-year-old daughter at the border. “She had to comb her daughter’s hair and change her daughter’s clothes and put her on a bus and say goodbye to her,” Church said through tears. The two were separated for nearly two months, even after the mother was released from detention.

Church was able to reunite her client with her child, but the episode—like many, many other cases—weighs heavy on her shoulders. “I don’t think I’ll ever be quite the same person that I was beforehand,” she said.

Four years into this migration crisis, there’s a parallel migration under way—of immigration lawyers out of the profession. Survey data and interviews the Prospect conducted with more than a dozen lawyers around the country reveal the physical, mental, and financial toll endured by members of the bar. Given the extreme violence, trauma, and inhumanity their clients often endure, immigration attorneys don’t like to talk about how it affects them. But secondary trauma also leaves a mark, making it impossible to continue for some attorneys. Although numerical data is limited, there is evidence that some attorneys are cutting back on some types of cases, such as deportation defense work, or even leaving immigration law altogether. Removal defense casework is one of the most time-intensive, emotional, and exigent parts of lawyers’ loads. It’s also where the administration has aimed much of its cruelest policymaking, severely limiting lawyers’ efficacy.

Under the Trump administration, immigration law has changed not only profoundly, but also so rapidly that it’s hard for immigration attorneys to keep up. Susan Church—and several other attorneys interviewed for this article—described combating Trump’s policies as a game of whack-a-mole.

Forget all the right wing BS and the “originalist hoax!” This is about “democracy (or the destruction thereof) in action.” 

Remember, all of these cosmic “immigration law changes” have taken place without a single piece of major legislation enacted by Congress! Indeed, the Trump regime’s ham-handed attempt to force it’s nativist agenda down the throats of the Congress as part of the “Dreamer fiasco” fell flat on its face in both Houses!  But, the Supremes have both encouraged and enabled Trump (actually notorious white supremacist Stephen Miller) to rewrite the law through. “Executive fiat.” Totally inappropriate, not to mention glaringly unconstitutional.

The Supremes’ majority has time and again improperly sided with the unethical, immoral, and Constitutionally bankrupt “Dred Scottification” of migrants, particularly asylum seekers. It’s not much different from what has happened to African Americans, Latinos, and other minorities following the Civil War. But, this is supposed to be the 21st Century where we have put “Jim Crow” behind us. Obviously, we haven’t!

Failing to protect “officers of the court” (lawyers) and their clients from a scheme of abuses heaped upon them by a corrupt, biased, out of control, overtly racist Executive and his sycophants is a gross dereliction of duty by the Supremes. It’s basically like allowing, and even encouraging, the badgering of a witness during trial! 

It’s painfully obvious that we have many of the wrong folks on the bench — from the Immigration Courts to the Supremes. Indeed, the nation and the world would be much better served if many more of those courageous lawyers who serve the immigrant community and human rights experts were on the Federal Bench at all levels. 

Trump, Roberts, and the GOP judicial misfits have also shown us first-hand the profiles of individuals who should not be serving in judicial positions. Let them litigate their “originalist,” “unitary Executive,” and other “far out” righty philosophies as lawyers appearing before real judges —“practical scholars” who live in the 21st Century and are committed to problem solving rather than problem creating. As Joe Biden has noted, the entire judicial selection system and particularly the Supremes need a thoughtful re-examination and reform. 

Never again should we have Justices like Amy Coney Barrett and Clarence Thomas performing highly inappropriate and unethical televised “campaign stunts” for an incumbent President during an ongoing election. Geez! What kind of “impartial jurists” are they? 

Most first year law students could tell you that’s a “no-go!” Why have we “normalized” and “accepted” such obvious bias, misbehavior, and lack of sound judgment at the highest levels of our (not Trump’s or Mitch’s personal) Judiciary?

It’s not “Rocket Science!” The fundamental building blocks of our society are immigration, human rights, and equal justice! Any lawyer who who doesn’t embody those virtues and doesn’t publicly embrace them should not in the future be given a lifetime appointment as a Federal Judge — at any level!

We need better judges for a better America! We will never achieve constitutionally-required “equal justice for all” for African Americans, Latinos, or anyone else, nor can we reach our diverse nation’s full potential, if we don’t start “pushing back” against Roberts and the GOP’s right wing judicial oligarchy, their obtuse legal gibberish, and their anti-democratic “jurisprudence.”

It starts with voting to take back our country from the far right. But, that’s just the beginning of the changes needed if equal justice for all is to become a reality, rather than an ever unfulfilled promise, limited to certain privileged (predominantly White) groups within our society!

And, all of society owes a debt of gratitude to Ms. Church and other brave lawyers like her who represent the best our country has to offer and have actually suffered for standing up for the rule of law and the legal and human rights of the most vulnerable among us. In other words, standing up for all of our rights against a tyranny! 

Compare that with the utterly dismal composition of the “Trump kakistocracy” and its “Dred Scottification” of “the other.”

“They are so well taken care of. … They’re in facilities that were so clean,” President Donald Trump said during last week’s presidential debate, of the children his administration ordered separated from their parents at the southern border. As my colleague Jeremy Stahl points out, this isn’t the first time that an administration official has argued that because the separated children—over 500 of whom are still being kept from their parents—have (supposedly!) been physically taken care of, they should be “just fine.” But if the life histories of children forced to be parted from parents for years of their childhoods are any indication, these periods of separation will have long-lasting, devastating, and unpredictable effects.

I’ve been reading historian Rebecca Clifford’s new book, Survivors: Children’s Lives After the Holocaust, which is a painful history of Jewish kids who somehow made it through World War II when they were very small, and had to figure out how to forge a life afterward. Combining analysis of survivors’ testimonies recorded over the years, documents from the archives of organizations that came into contact with these children, and oral histories Clifford herself collected, the book shows how many of these survivors struggled with the act of making sense of their lives—even the lucky ones, who didn’t witness violence, and whose material needs were well met during the period of conflict and persecution. Clifford calls the work “fundamentally a book about the history of living after, and living with, a childhood marked by chaos.”

Survivors is, of course, about a group of children whose lives were marked by the Nazi regime, not about children fleeing violence in Central America, who were then separated from their families by Border Patrol agents. But it’s also fundamentally concerned with the human consequences of children’s separations from parents. In the group of survivors in Clifford’s history, there are kids who were sent to live with host families, who hid them until the war was over; kids incarcerated in different labor camps from their parents; kids who wandered the forests alone, tended only by older siblings.

Asking the historical record, and the grown-up survivors she interviewed, how this period of separation had affected the children’s lives in the long term, Clifford found things that she described as “not only unexpected, but shocking.” One such finding was the fact that for many of the kids, the war years were fine; it was liberation that was traumatic. “Children are adept at treating the exceptional as normal, and because they had no other life to compare it with, the years of persecution did not necessarily feel dangerous, fraught, or chaotic to young survivors,” Clifford writes. But after liberation, as well-meaning adults did everything they could to bring the kids back together with their surviving family members, or to find them places in Jewish homes, many of the separated survivors were profoundly destabilized. “My war began in 1945, not in 1940,” one such survivor said.

The German Jewish parents of Felice Z., who was born in October 1939, put their 1½-year-old daughter in the hands of aid workers in early 1941, and the girl spent the war years hidden by farmers in France. Felice Z. remembered in later interviews that she loved her host parents, and in particular her host mother, Madame Patoux: “All they were interested in was taking care of me. She basically saved my life. She was always ready to run. … I took it for granted that she was my mother, I called her meme (nana) and it was really the first close relationship that I had with another human being. I became very attached to them. Very.” At the end of the war, Felice got no joy out of being reunited with her sister, who had become a stranger. Soon after that reunion, she was removed from the family where she had grown up; as she remembered it, nobody bothered to explain why.

“Family reunions could be among the most difficult and distressing experiences that children went through after the war,” Clifford writes. “The youngest children might have no memory of their parents or relatives at all, and were effectively returned to strangers. … Not one child in this study who was returned to his or her family found this process easy or joyful.” The reunions brought up feelings of anger and terror—even if, as Clifford points out, the kids could rationally understand the reasons their parents had put them in safer places for the duration of the war. They had spent years suppressing childish impulses—“they had had to be obedient, quiet, and good to stay safe during the war, whether they were in hiding, in ghettos or in camps”—and often became explosive and “difficult to manage” after the separation was over.

While we may never know the full extent of the damage inflicted by the Trump Administration’s family separation policy, it is evident—as a result of this investigation and public reporting—that it was driven by an Administration that was willfully blind to its cruelty and determined to go to unthinkable extremes to deliver on political promises and stop migrants fleeingviolencefromseekingprotectionintheUnitedStates. Asillustratedinthisreport:
• Within weeks of President Trump’s inauguration, the Administration began formulating a plan to separate parents from their children as a means to deter migration.
• Before a formal policy had even been developed, the Administration was accelerating familyseparations. ByMarch2017,thenumberofseparatedchildrentransferredtoORR custody had increased by nearly 900 percent, as compared to November 2016.
• In July 2017, without warning, the Administration implemented a family separation pilot programintheElPasoBorderPatrolSector. Thepilotprogramlastedfivemonthsand resulted in hundreds of additional children being taken from their parents and placed in ORR custody.
• During the pilot program, the Administration discovered that it was unable to track separated family members in a way that would facilitate eventual reunification.
• Knowing this, and without doing anything to address the tracking systems employed by deferral agencies, the Administration chose to expand the policy nationwide in May 2018.
• To make matters worse, the Administration failed to provide advance notice of the policy to front line agents and officers, which caused unnecessary chaos and inconsistent implementation of the policy across border sectors.

• When judicial intervention and political pressure eventually resulted in the end of the policy, the lack of interagency cooperation and preparedness was laid bare by the inability of the Administration to quickly reunite separated parents and children.
As a result of this dark chapter in our nation’s history, hundreds of migrant children may never be reunited with their parents.
Despite considerable stonewalling by Administration officials, Judiciary Committee Members and staff have pushed relentlessly to obtain data and conduct much needed oversight of the agencies responsible for the family separation policy. SUMMARY:

The Government appeals from a judgment of the United States District Court for the Southern District of New York (Carter, J.), granting Carlos Alejandro Velasco Lopez’s petition for a writ of habeas corpus. Velasco Lopez was detained pursuant to 8 U.S.C. § 1226(a), which provides for discretionary detention of noncitizens during the pendency of removal proceedings. His habeas petition challenged the procedures employed in his bond hearings, which required him to prove, to the satisfaction of an immigration judge, that he is neither a danger to the community nor a flight risk. We hold that the district court correctly granted the petition, and provided the correct remedy by ordering a new bond hearing in which the Government bore the burden of showing by clear and convincing evidence that Velasco Lopez was either a danger or a flight risk.

KEY QUOTE:

The irony in this case is that, in the end, all interested parties prevailed. The Government has prevailed because it has no interest in the continued incarceration of an individual who it cannot show to be either a flight risk or a danger to his community. Velasco Lopez has prevailed because he is no longer incarcerated. And the public’s interest in seeing that individuals who need not be jailed are not incarcerated has been vindicated.

Judge Parker is correct insofar as he cogently states what should be a “win-win-win” under a functioning Government. I wholeheartedly join lead counsel Julie Dona of the Legal Aid Society, NY, in appreciating and recognizing  Judge Parker’s understanding of the grim realities of today’s mal-functioning Immigration Courts and the important Constitutional rights being abridged by DHS & EOIR (essentially one and the same under the Trump kakistocracy).

But, that statement of how Government should be functioning glosses over the unfortunate reality of the Trump regime’s lawless, White Nationalist, nativist immigration agenda. The Trump regime doesn’t seek to create “win-win-win” situations! Instead, they seek to make political statements, dehumanize and degrade “the other,” and promote the biases of their “base” over sound public policy that benefits the common good.

The purpose of imprisonment in the Trump Gulag all too often has little or nothing to do with the legal criteria of danger to the community or flight risk. Rather, detention in the Gulag is used by the Trump regime’s DHS, with the connivence of the DOJ and often the courts, to punish individuals who choose to assert their legal rights; make it more difficult for them to obtain effective representation; and to coerce them into abandoning viable claims for relief, appeals, and judicial review. It’s all about punishment and deterrence, not mainly about the public interest, which is ill-served by most of Trump’s biased and counterproductive immigration policies.

DHS detention in the Trump era primarily serves Trump’s political interests and the interests of those running the for-profit prisons comprising much of Trump’s New American Gulag. Any time Trump’s policies match up with a legitimate national interest, it’s purely happenstance, not part of some overall plan to govern in the public interest.

Miller’s plans are so explosively ugly, overtly racist, and anti-American that they are being kept under wraps (for now) because of a (quite legitimate) fear that they could drive the small, yet potentially significant, minority of voters of color that Trump needs to have any chance of extending his rule to do something rational and in their self-interest: Vote for Biden-Harris. Look for things like eliminating birthright citizenship, eradicating all refugee and asylum laws, making it difficult or impossible for family members and people of color to immigrate legally, a wave of summary deportations, deporting “Dreamers,” and exterminating every last ounce of compassion and humanity from our laws. If you think that Black Lives don’t matter much to Trump and his cronies, just wait until he turns the Gruppenfuhrer loose! Think the Federal Courts will stop him? Just look at Trump’s “wholly owned and proud to brag about it” Supremes’ majority!  And, he’s also “stacked” — effectively “packed” —  the lower Federal Courts with loyalist ideologues.

America can no longer afford life-tenured judges who treat Trump as “normal” and are unwilling or incapable of “connecting the dots” among the dehumanization and demonization of migrants, institutionalized racism, and the end of American democracy. Immigrants’ rights are human rights; human rights are Constitutional rights; dehumanization of “the other” dehumanizes us all!

It’s past time that America stopped granting the privilege and responsibilities of life-tenure to those who won’t publicly adhere to those fundamental truths! Not rocket science! Just basic Constitutional law and human decency! Better judges for a better America! It all starts with a better President and a better Senate! That’s why this election might be our final chance to take back our country and preserve our democracy!

ICE moves to quickly deport more immigrants without court hearings

CBS: U.S. Immigration and Customs Enforcement (ICE) is implementing new rules unveiled in July 2019 that allow agents to expand their use of “expedited removal,” a fast-tracked deportation process created by a 1996 law that bars certain immigrants from seeking relief before an immigration judge.

 

New Trump Administration Rule Further Restricts Asylum Eligibility

USNWR: Under the regulation, having fake identification documents, including a fake ID, will render an immigrant ineligible for asylum in most cases. Unlawfully receiving public benefits will similarly bar someone from being granted asylum, as will a conviction for drug possession or possession of drug paraphernalia, with the single exception of having 30 grams or less of marijuana. An immigrant with two DUI convictions, or a single DUI conviction that resulted in the harm of another person, will be ineligible for asylum protections. The rule also bars immigrants convicted of domestic violence, stalking, child abuse and similar crimes, no matter the severity, from asylum. It also notably deems ineligible for asylum any immigrant whom an asylum officer “knows or has reason to believe” engaged in acts of battery or extreme cruelty – regardless of if the immigrant was arrested for such a crime.

 

‘Stunning’ Executive Order Would Politicize Civil Service

Gov Exec: Positions in the new Schedule F would effectively constitute at-will employment, without any of the protections against adverse personnel actions that most federal workers currently enjoy, although individual agencies are tasked with establishing “rules to prohibit the same personnel practices prohibited” by Title 5 of the U.S. Code. The order also instructs the Federal Labor Relations Authority to examine whether Schedule F employees should be removed from their bargaining units, a move that would bar them from being represented by federal employee unions. MPP Cases Highest Since Start of Pandemic

TRAC: In September 2020, the Immigration Court recorded 1,133 new MPP cases, up from a low of 136 in May, and the highest since the start of the pandemic in March when 2,282 MPP cases were filed. A total of 24,540 MPP cases are currently pending before the Immigration Court.

 

The Pandemic and ICE Use of Detainers in FY 2020

TRAC: Average weekday detainer usage, already trending downward this year, began to show some reduction starting in mid-March when it fell below 400 per weekday, and by the first of April had fallen below 300. By the second week of April the daily weekday average fell to around 240. However, after mid-April usage started climbing back up. By the end of the first week in May it was back up to a weekday average of around 300, and by mid-May usage had recovered completely.

DHS & DOJ need comprehensive leadership changes, major reorganizations, re-examination of missions, effective ethical reforms, and thorough housecleanings to restore American democracy and achieve social justice and racial equality. 

The key, to borrow from “Moscow Mitch,” is political power! “Moscow” and his GOP Senate buddies have just demonstrated in “real time” how they can turn the Supremes into an anti-democracy adjunct of the RNC. Because they can! And “tough noogies” for the majority of Americans they don’t represent! 

Conversely, by voting the Trump regime and the GOP out, we can regain control of our Government and get broken, incompetent, and biased institutions like DHS and EOIR working for the people, rather than a White Nationalist minority with an anti-American, anti-democracy, anti-social-justice, anti-equality agenda!

This is no longer the case. Public confidence and public perception that the courts are non-partisan has eroded. The Republican boycott of Garland, together with Trump’s unprecedented nomination of Barrett and her likely confirmation, will seal the Republican theft of two supreme court seats, at least in the eyes of more than half the electorate, and will ensure conservative control of the court for decades to come.

If Barrett’s record is any indication, the court will soon turn its back on its most treasured precedents and turn America into a more regressive country. Before joining the bench just three years ago, she served as a law clerk to Scalia, whose judicial philosophy she has fully embraced. She has also been a longtime member of the rightwing Federalist Society.

 

Public confidence and public perception that the courts are non-partisan has eroded

Her short judicial record, together with her scholarly writings, reveal that she is a rock-solid conservative jurist. Like Scalia, she defines herself as an originalist and textualist, which means that the constitution must be viewed as of the time it was written. From that perspective, there is nothing in the constitution that would explicitly support abortion rights, gay marriage, mandatory school desegregation, or the right to suppress evidence that is illegally seized. By contrast, in one of her most famous opinions, United States v Virginia (1996), Ginsburg wrote that “a prime part of the history of our constitution … is the story of the extension of constitutional rights and protections to people once ignored or excluded.”

In a 2013 article, Barrett repeatedly expressed the view that the supreme court had created, through judicial fiat, a framework of abortion on demand that ignited a national controversy. In an opinion she joined with another judge, she expressed doubt that a law preventing parents from terminating a pregnancy because they did not want a child of a particular sex or one with a disability could be unconstitutional. These writings surely indicate that Barrett will do whatever she can to limit or eliminate abortion rights.

Barrett has also expressed dissatisfaction with the Affordable Care Act and support for a broad interpretation of the second amendment. She has writtenthat Chief Justice John Roberts “pushed the Affordable Care Act beyond its plausible meaning”. She also quoted Scalia, when he wrote that “the statute known as Obamacare should be renamed ‘Scotuscare’” in “honor of the court’s willingness to ‘rewrite’ the statute in order to keep it afloat”. There is little doubt that Barrett would be inclined to find the Affordable Care Act unconstitutional and thereby deprive millions of Americans of affordable healthcare coverage. Similarly, she wrote a dissenting opinion questioning the constitutionality of a statute that prohibited ex-felons from purchasing guns. Thus, she has demonstrated her fealty to the NRA position that the more guns the better – inevitably leading to more Americans dying from gun violence.

When addressing the legal doctrine known as stare decisis, meaning respect for precedent, Barrett wrote that she “tend[ed] to agree with those who say that a justice’s duty is to the constitution and that it is thus more legitimate for her to enforce her best understanding of the constitution rather than a precedent she thinks is clearly in conflict with it”. In other words, she would overturn landmark decisions such as Brown v Board of Education or Roe v Wade if those decisions did not reflect her best understanding of the constitution.

Stunningly, in an interview in 2016, when asked whether Congress should confirm Obama’s nominee during an election year, Barrett responded that confirmation should wait until after the election because an immediate replacement would “dramatically flip the balance of power”. Given that answer, she should decline the nomination, as her confirmation would even more dramatically flip the balance of the court, entrenching a 6-3 conservative majority.

Confirming this nominee before the outcome of the national elections – which will determine both the identity of the next president and the composition of a new Senate – is unprecedented, inexcusable and a threat to many rights that the majority of Americans have embraced. This is a tragedy about to happen.

Dems need to stop sputtering about Barrett, whom they don’t appear able to stop anyway, and get out the vote to insure that she will be the last GOP far right shill on Supremes for many years! Rebuilding and improving American democracy starts NOW, with THIS ELECTION.  As Willie Nelson says: “Vote ‘Em Out, Vote ‘Em Out!”

 

BTW, “Moscow Mitch” and his GOP toadies have plenty of time to race through the Barrett confirmation during an election, but no time to help Americans thrown out of work or losing their health insurance because of the pandemic!🤮⚰️

Compare the courage and fidelity to due process, fundamental fairness, equal justice for all, and defense of human dignity demonstrated by brilliant lawyers like Michelle Mendez, Aimee Mayer Salins (former BIA JLC), and the terrific CAIR litigators with the warped right wing, anti-constitutional, anti-humanity jurisprudence of Trump’s Supreme Court choice, Judge Amy Coney Barrett:

Faced with two plausible readings of a law, fact, or precedent, Barrett always seems to choose the harsher, stingier interpretation. Can job applicants sue employers whose policies have a disproportionately deleterious impact on older people? Barrett said no. Should courts halt the deportation of an immigrant who faced torture at home? Barrett said no. Should they protect refugees denied asylum on the basis of xenophobic prejudice? Barrett said no. Should they shield prisoners from unjustified violence by correctional officers? Barrett said no. Should minors be allowed to terminate a pregnancy without telling their parents if a judge has found that they’re mature enough to make the decision? Barrett said no. Should women be permitted to obtain an abortion upon discovering a severe fetal abnormality? Barrett said no.

There is no question that, if confirmed, Barrett would cast the fifth vote to either hollow out Roe v. Wade or overturn it altogether. Similarly, there is no doubt that Barrett would dramatically expand the Second Amendment, invalidating gun control measures around the country. It’s quite possible, perhaps even likely, that within a year of her confirmation, Americans will be forbidden from terminating a pregnancy in 21 states—but permitted to purchase assault weapons and carry firearms in public in every state.

In other words, guns yes; human rights and human dignity, no! Some lawyers spend their lives saving lives and advancing humanity; others spend them pursuing and spreading anti-humanitarian, right wing dogmas. Why are commitments to cruelty, inhumanity, and a fundamentally unjust society things to “tout” in a judicial candidate? You need to look inside the deep perversity of the GOP minority who control our nation and are running it into the ground to get the answer.

There are thousands of progressive lawyers, many of them women and minorities, committed to standing up for equal justice for all who are better qualified than Judge Barrett. There is something wrong with a system that elevates the wrong people to the judiciary and other high offices.

It’s time to establish meritocracy and save our democracy. Vote to throw the GOP out of office and end the selection of far-right judges whose reactionary views and lack of empathy for the most vulnerable in society are far outside both the reality of our diverse nation and our future as a vibrant, progressive democracy that will promote equal justice and human rights at home and abroad!

Keep the future Judge Barretts where they belong — on the sidelines and in the margins of our legal system, while those with a better view of the Constitution, the rule of law, and human progress take their rightful places in positions of power and progressive influence in all there branches of our Government.

Judge Barrett parrots great admiration for RBG while aiming to trash her legacy of fairness and equality with a far-right, exclusive, intolerant agenda. In the future, we need Federal Judges who will constantly confront Judge Barrett, her soon-to-be-fellow GOP Supremes, and other righty judges bent on taking us back to the darkest corners of our past.  Make them face the truly courageous and enlightened legacy of RBG and others like her. Force the “Barretts of the world” to reckon with their own smugly disingenuous jurisprudence and their lack of commmitment to humanity and true equality before the law for all persons in the U.S.! Constantly confront complicit courts for change!

Better judges for a better, fairer America!

This Fall, vote like your life and the future of humanity depend on it! Because they do!
