SAN DIEGO (AP) — A 53-year-old union of immigration judges has been ordered to get supervisor approval to speak publicly to anyone outside the Justice Department, potentially quieting a frequent critic of heavily backlogged immigration courts in an election year.

The National Association of Immigration Judges has spoken regularly at public forums, in interviews with reporters and with congressional staff, often to criticize how courts are run. It has advocated for more independence and free legal representation. The National Press Club invited its leaders to a news conference about “the pressures of the migrant crisis on the federal immigration court system.”

The Feb. 15 order requires Justice Department approval “to participate in writing engagements (e.g., articles; blogs) and speaking engagements (e.g., speeches; panel discussions; interviews).” Sheila McNulty, the chief immigration judge, referred to a 2020 decision by the Federal Labor Relations Authority to strip the union of collective bargaining power and said its earlier rights were “not valid at present.”

The order prohibits speaking to Congress, news media and professional forums without approval, said Matt Biggs, president of the International Federation of Professional & Technical Engineers, an umbrella organization that includes the judges’ union. He said the order contradicted President Joe Biden’s “union-friendly” position and vowed to fight it.

“It’s outrageous, it’s un-American,” said Biggs. “Why are they trying to silence these judges?”

Subject: Public Engagements and Speaking Requests

Dear Judges Cole and Tsankov:

From recent awareness of your public engagements, I understand you are of the impression that your positions in the group known as the National Association of Immigration Judges (NAIJ) permit you to participate in writing engagements (e.g., articles; blogs) and speaking engagements (e.g., speeches; panel discussions; interviews) without supervisory approval and any Speaking Engagement Team review your supervisor believes necessary. The agency understands this is a point of contention for you, but any bargaining agreement related to that point that may have existed previously is not valid at present. Please consider this email formal notice that you are subject to the same policies as every EOIR employee. To ensure consistency of application of agency policies—and prevent confusion among our staff—please review the SET policy and work with your supervisor to ensure your compliance with it, effective immediately.

Thank you,

Sheila McNulty

*******************

It’s perhaps no surprise. EOIR is a badly failing agency with an incredible ever-growing backlog of over 3 million cases, no plan for reducing it, antiquated procedures, a disturbing number of questionably-qualified judges (many holdovers from the Trump era), grotesque decisional inconsistencies, poor leadership, a tragic record of ignoring experts’ recommendations for improvements, and that produces a steady stream of sloppy, poorly-reasoned, or clearly erroneous decisions on the “nuts and bolts” of asylum and immigration law that are regularly “roasted” by Circuit Judges across the political spectrum.

In this context, their desire to strangle criticism from those actually trying to provide justice and due process, against the odds — the sitting Immigration Judges who see the management and systemic problems on a daily basis — is perhaps understandable, if not defensible.

At least where immigration is involved, the Biden Administration’s rhetoric and promises on being “labor friendly” and supportive of Federal workers is unfortunately reminiscent of its pledge to treat asylum seekers and immigrants fairly and humanely and to distance themselves from the racially-driven xenophobic policies of the Trump Administration.

While the NAIJ may be “gagged,” the fight about working conditions and the unrelenting dysfunction at EOIR is far from over!

Sources close to the NAIJ’s parent union, the IFPTE, tell me that the “campaign to call out this atrocity” is “just getting started.”

In statement issued yesterday, IFPTE President Matt Biggs expressed outrage and raised the possibility that the Administration could face tough Congressional questioning on the gag order, which also applies to communications with legislators and legislative staff:

“Just because a highly partisan decision by the FLRA’s board, that is likely to be reversed, limited NAIJ’s ability to collectively bargain, doesn’t mean that NAIJ and its national union IFPTE can’t meet and confer with the DOJ, provide legal services to our members, have officers serve on professional committees, speak to the media, offer training and other services a union provides,” says Biggs. “In fact, for the past four years, NAIJ, with assistance from IFPTE, has provided all of that. We give judges a voice. Judge Tsankov regularly speaks to reporters and recently testified before Congress.  This is an attempt to limit what the press and public know by placing a gag over the mouths of the judges on the front lines. The only thing that has changed in the past four years is an overreach by a federal bureaucrat.”

NAIJ has repeatedly sounded the alarm on the size of the backlog, the need for translators, raised courtroom security concerns and other issues related to immigration adjudication. It has been a strong advocate for judicial independence and questioned why the immigration courts are attached to the Department of Justice, rather than being placed in an independent agency. The National Press Club recently invited both Tsankov and Cole to speak at a news conference on “the pressures of the migrant crisis on the federal immigration court system.”

“We believe that this order and un-American, anti-union act of censorship by McNulty will lead to Congressional hearings,” said Biggs. “Until this matter is resolved, the judges’ national union, IFPTE, will act as the voice for the immigration judges. McNulty may try, but the nation’s immigration judges won’t be silenced.”

As noted by Biggs, over the years, NAIJ leadership has frequently been asked to testify before Congress and meet with staff as an independent counterpoint to the “party line, everything is under control” nonsense that has become a staple of DOJ politicos and EOIR bureaucrats in administrations of both parties in dealing with the Hill as the backlog continued to explode in plain view!

Although the Biden Administration has curiously shown little hesitation in throwing asylum seekers, human rights, and advocates who were a key support group in 2020 “under the bus” in an ill-advised attempt to “out-Trump-Trump” on stupidity and inhumanity at the border, the IFPTE could be a different animal. Representing more than 80,000 government professionals, the union endorsed  Biden/Harris in 2020.

With a hotly-contested, close election underway, Biden can ill-afford to alienate more key support groups, particularly among organized labor.  Why the “geniuses” in the White House and the Biden/Harris Campaign think that going to war with your base is a great, “winning” strategy, is beyond me! Even Donald Trump recognizes the benefit of energizing behind him a loyal and committed (although horribly misguided) “base!”

Tellingly, and illustrating this issue’s cosmic importance, the Ohio Immigrant Alliance just released its blockbuster report documenting systemic racism at EOIR entitled “The System Works As Designed: Immigration Law, Courts, & Consequences” —

https://illusionofjustice.org/read/lawcourtsandconsequences

Here’s the Executive Summary:

Executive Summary

This report is based on the experiences of immigrants, lawyers, and immigration court observers, as well as external research. “The System Works as Designed” reveals how U.S. immigration laws, and the courts themselves, were planted on a foundation of white supremacy, power imbalance, and coercive control. For those reasons, they fail to protect human dignity and lives on a daily basis.

While the operations of the immigration courts have frequently been ignored, their outcomes could not be more consequential to immigrants and their loved ones. This report lifts the curtain.

Racism in Immigration Law and Policies

It is clear from the congressional record, and laws themselves, that the Chinese Exclusion Act, Undesirable Aliens Act, Immigration and Nationality Acts of 1924 and 1952, and other laws played on racial and ethnic stereotypes to limit mobility and long-term settlement of non-white immigrants.

The Immigration and Nationality Act of 1965 attempted to address some imbalances, but the Illegal Immigration Reform and Immigrant Responsibility Act basically broke the already contradictory set of laws, making them a landmine for immigrants attempting to seek safety or build new lives here. The REAL ID Act and other post-9/11 laws and policies tightened the vise.

Policy choices made by presidents from every modern administration have attempted to coerce, repress, and reject migration, a basic human survival act, instead of building safe paths people can use.

Death Penalty Consequences, Traffic Court Rules

The U.S. immigration courts were designed to offer the illusion of justice, while failing the people they purport to protect. Dysfunctional elements include:

A quasi-judicial structure that answers to the U.S. Attorney General in the Executive Branch and is not an independent judiciary; is blatantly influenced by ideology; and promotes quantity over quality decision making.

Power imbalances, such as the fact that the government is represented by attorneys 100% of the time, while immigrants often argue their cases without a legal guide. Detained immigrants are forced to “attend” their hearings via grainy video feed, while judges and counsel are together in courtrooms miles away. Yet immigration judges frequently deny requests for expert witnesses to appear remotely, citing challenges with communication and credibility. The deck is stacked.

4

Also, by detaining someone in jail for the duration of their civil immigration case, the government makes it harder for them to get a lawyer to help. The government is also using the psychological, financial, and physical toll of detention to try to break someone’s spirits and get them to give up.

Subjective “credibility determinations,” rife for bias and abuse. A case can be denied based on a judge’s feeling about the immigrant’s testimony, not facts. This is the barn door through which all manner of ignorance, bias, and ideology storm in.

Legal landmines make it harder for people who qualify for asylum to receive it, such as the one-year filing deadline; illogical definition of material support to terrorism; and the Biden asylum ban.

Differing standards of accuracy. Immigrants may be furnished interpreters who speak the wrong dialect. Judges and DHS attorneys may make inaccurate statements about an individual’s evidence or the political conditions of their country. The hearing transcripts can be riddled with gaps instead of key facts. Yet life-altering decisions are made based on this record, and an immigrant has little to no opportunity to object, correct, or explain.

Consider the experience of M.D. a Black Mauritanian man seeking asylum in the U.S. after the late 1980s/early 1990s genocide. An immigration judge questioned his credibility because M.D. did not provide “evidence” that he is Black and Fulani, a persecuted group in Mauritania. M.D. addressed the court, speaking in Fulani, and said, “I am the evidence. I speak Fulani and I am Black.”

The English transcript of M.D.’s hearing is riddled with “(unintelligible)” in place of the names of relatives and locations where important events, such as the murder of his father, took place. There was an interpreter in the room who could have spelled the words out to make the record more accurate and credible. Instead, the record shows big holes in place of material facts, while M.D. was accused of not providing “proof” that he is Black, deemed not credible, denied asylum.

In another case, a Black man seeking asylum was found “not credible” because his interpreter first used the word “canoe” when describing his method of escape, and later said “little boat.” But in his language and, one can argue, in common English, they are the same thing.

Situations like these, memorialized in the case record, are carried into the appeals process where rehearings typically do not take place, compounding the injustices of these mistakes.

Many of the report’s observations echo some aspects my own writings and public speeches over the years since I retired from the bench in June 2016. For example, here’s my speech “JUSTICE BETRAYED: THE INTENTIONAL MISTREATMENT OF CENTRAL AMERICAN ASYLUM APPLICANTS BY THE EXECUTIVE OFFICE FOR IMMIGRATION REVIEW“ from from an FBA Conference in Austin, Texas in May 2019:

https://immigrationcourtside.com/wp-content/uploads/2019/05/FBA-Austin-Central-America-—-Intro.docx

While I was speaking during the Trump Administration, sadly, many of my observations remain equally true today, as the Biden Administration and AG Garland have quite inexcusably failed to rise to the occasion by instituting long-overdue due process and quality control reforms at EOIR. Yet, I am struck by how even then, as today, I found reasons to continue to be proud of the accomplishments of the “New Due Process Army” (“NDPA”) and to urge others to continue to  believe that the “light of due process will eventually be relit” at EOIR and that history will deal harshly with the xenophobic urges and anti-asylum attitudes that too often drive policy in administrations of both parties:

Today, the Immigration Courts have become an openly hostile environment for asylum seekers and their representatives. Sadly, the Article III Courts aren’t much better, having largely “swallowed the whistle” on a system that every day blatantly mocks due process, the rule of law, and fair and unbiased treatment of asylum seekers. Many Article IIIs continue to “defer” to decisions produced not by “expert tribunals,” but by a fraudulent court system that has replaced due process with expediency and enforcement.

But, all is not lost. Even in this toxic environment, there are pockets of judges at both the administrative and Article III level who still care about their oaths of office and are continuing to grant asylum to battered women and other refugees from the Northern Triangle. Indeed, I have been told that more than 60 gender-based cases from Northern Triangle countries have been  granted by Immigration Judges across the country even after Sessions’s blatant attempt to snuff out protection for battered women in Matter of A-B-. Along with dependent family members, that means hundreds of human lives of refugees saved, even in the current age.

Also significantly, by continuing to insist that asylum seekers from the Northern Triangle be treated fairly in accordance with due process and the applicable laws, we are making a record of the current legal and constitutional travesty for future generations. We are building a case for an independent Article I Immigration Court, for resisting nativist calls for further legislative restrictions on the rights of asylum seekers, and for eventually holding the modern day “Jim Crows” who have abused the rule of law and human values, at all levels of our system, accountable, before the “court of history” if nothing else!

Eventually, we will return to the evolving protection of asylum seekers in the pre-2014 era and eradicate the damage to our fundamental values and the rule of law being done by this Administration’s nativist, White Nationalist policies. That’s what the “New Due Process Army” is all about.

That brings me back to two of my “key takeaways” from the Ohio Immigrant Alliance Report.

First: “Withholding is a true limbo status, though better than being sent back to certain death.” Skillfully and aggressively using the system to save lives, in any way possible, is job one. A life saved is always a victory!

Second, as the report concludes:

Solutions exist, but they require policymakers and legislators to listen to the people with direct, personal experience. Ramata, cited earlier in this report, suggests quicker approval of cases found credible at the outset. Aliou wants judges to put more stock in migrants’ testimony, understanding that persecuting governments are not credible sources about their own abuse. Jennifer, one of the immigration lawyers we interviewed, suggested that Black immigrant organizations and the American Immigration Lawyers Association be involved in crafting a new direction, citing their extensive expertise with how the system works—and fails people.

Bill, another immigration lawyer interviewed for this report, suggests taking a page from the refugee resettlement program when it comes to verifying facts about a case. “Social workers and private investigators [could] interview people and research documents and try to … verify whether [they’re] telling the truth or not,” he said. Bill suggests employment counselors, ESL teachers, and others with specialized expertise could also assist in the processing of cases.

Most importantly, the asylum and immigration system must be reoriented toward prioritizing safety and resettlement, rather than deportation as the default outcome. The forthcoming report, “Behind Closed Doors: Black Migrants and the Hidden Injustices of US Immigration Courts,” will explore these and other solutions.

As I have observed many times, despite the “national BS” on asylum and immigration being traded by Trump and Biden, and the legislative gridlock, there are still plenty of readily available, non-legislative solutions out there that would dramatically improve due process, justice, and the life-saving capacity of the EOIR system. While no single one of them is a “silver bullet” that would solve all problems overnight, each is an important step in the right direction. Taken together, they would substantially improve the quality and quality of justice overall in our U.S. legal system and, perhaps, in the process, save our republic from demise.

🏴‍☠️🤮 TRUMP’S & MILLER’S “ZERO TOLERANCE POLICY” IRREPARABLY DAMAGED VULNERABLE FAMILIES & THE AMERICAN PSYCHE — We Can’t Allow Them To Do It Again!

Piper French reports for Intelligencer via Apple News:

Nilu Chadwick recognizes some of the children’s names right away. Chadwick, a lawyer for Kids in Need of Defense, has spent the past five years poring over lists of families separated under the Trump administration’s “zero tolerance” policy whose cases have yet to be resolved. Some of the children’s names stand out because she crossed paths with them back in 2018, when she represented them at their immigration hearings after they were torn from their parents’ side at the southern border. Those names always remind her of what she witnessed that year. The eerie silence of the children’s shelters. The kids so young that they couldn’t even explain who they were or where they came from. The hearing she had to pause in order to soothe a client with a nursery rhyme. Then there are the names that have simply grown familiar through repetition: the children whose cases appeared on the lists years ago and remain open.

The process of reunifying families separated under “zero tolerance” began in June 2018, two months after the policy was officially implemented. The ACLU had filed a class-action lawsuit on behalf of separated families, Ms. L. v. U.S. Immigration and Customs Enforcement, and during the litigation, a federal judge halted Trump’s policy and ordered its victims reunified within 30 days. Some of these reunifications were relatively straightforward. The government had records of around 2,800 separated families, and most of those parents and children were still in the U.S. — maybe they’d been sent to separate ICE facilities or the parents were in detention while their children had been placed in the custody of the Office of Refugee Resettlement. But for about 470 families, the parents had already been deported. When the Trump administration declined to track them down, Lee Gelernt, the head lawyer for the plaintiffs, stood up in court and said the ACLU would do it. A steering committee was put together comprising a team from the New York law firm Paul, Weiss and representatives from three NGOs, including Kids in Need of Defense and the organization Justice in Motion. “Little did I know what we were taking responsibility for,” Gelernt told me.

The first hurdle the committee faced was the total disorganization with which “zero tolerance” had been implemented. “There was no intention of reuniting families, and so they didn’t design the system to be able to keep track,” Nan Schivone, Justice in Motion’s legal director, told me. The agencies involved — Customs and Border Protection, which took families into custody; ICE, which oversaw their detainment; the ORR, which was responsible for the separated children — didn’t have a comprehensive system to share data with one another, nor did they always keep records linking parents with their children. If children were released from ORR custody into the care of family or friends, the government did limited follow-up. “We give you a luggage tag for your luggage,” said Gisela Voss, a former board member of Together & Free, which supports families seeking asylum. “We separated parents from their kids and didn’t give them, like, a number.”

It took two months, until August 2018, for the administration to provide the steering committee with the phone numbers of the deported parents; a quarter of the numbers were missing. The committee began its search, making calls and performing social-media investigations. Then, in January 2019, the HHS Office of Inspector General revealed that more families had been separated than the Trump administration had previously disclosed. Nine months later, the Justice Department finally produced those names. There were 1,500 of them, and the vast majority of the parents had been deported.

. . . .

But the more that people who have dedicated their lives to this task continue to search, the more it becomes apparent that there will never be a clean resolution. There will always be another family. They know, too, that reunification solves only one problem. Families may be together again, but whether they will ever be whole is another question entirely.

No accountability whatsoever for Trump, Miller, Sessions and the other “human rights criminals” responsible for this. As is all too common in immigration and human rights “fails” by our immigration bureaucracy, the private, pro bono and NGO sectors are left to pick up the pieces after having to fight to uphold the rule of law.

The real story here is the blatant failure of our Government to uphold the rule of law for those seeking legal refugee and the irreparable effects of that failure. Somehow we have allowed politicos and the media to reverse that story line!

🇺🇸🗽 BIDEN MUST STOP FUELING THE XENOPHOBIC NARRATIVE ABOUT THE BORDER, SAYS MIGRATION EXPERT PROFESSOR KAREN MUSALO @ LA TIMES — “[T]hat narrative is false: The border is manageable, and rather than being a danger to Americans, immigrants are a net positive economically and socially.”

Karen writes in the LA Times:

http://enewspaper.latimes.com/infinity/article_share.aspx?guid=9f2230a5-0663-484d-ae19-a64bb095d7ac

Multiple news sources report that President Biden is considering implementing executive action to try to close the U.S.-Mexico border, including to asylum seekers. It would be an extreme move, and a violation of the Refugee Act of 1980 and the country’s international obligation to protect those fleeing persecution. Only one other president — Donald Trump — has blatantly breached that obligation before. With the COVID-19 pandemic as a pretext, Trump invoked Title 42 of the U.S. Code, which allowed him to curb migration in the name of public health.

Biden, who came into office harshly criticizing his predecessor’s anti-immigrant policies, now seems poised to resurrect them. Administration sources concede that the president’s border plans are driven by politics, the belief that the immigration situation is “an election liability.”

This view is no surprise. We’ve been fed a narrative that the border is in crisis, overwhelmed by an unprecedented number of immigrants who pose a grave danger to the health and safety of the nation. But that narrative is false: The border is manageable, and rather than being a danger to Americans, immigrants are a net positive economically and socially.

🦸🏻‍♂️ HISTORY: CAPTAIN FRANCIS “FRANK” FOLEY WASN’T A “GO ALONG TO GET ALONG BUREAUCRAT” — He Saved 10,000 Lives! 😇

pastedGraphic.png

William Samuel de Spretter

William Samuel is an accomplished citizen writer publishing with a specific focus on current affairs and military history.

De Spretter writes on Linkedin:

When asked in 1922 what his priorities would be if elected chancellor of Germany, then up-and-coming National Socialist leader, Adolf Hitler, answered candidly:

“Once I’m really in power, my first and foremost task will be the annihilation of the Jews.”

Proclaiming with vitriolic zeal, they’d be “hanged indiscriminately… until all of Germany has been completely cleansed of Jewry”, German Jews, understandably, had no desire to remain when he assumed the chancellorship in 1933…

In desperate hopes of securing safe passage to their ancestral homeland – Eretz Israel – tens of thousands flocked to the British embassy; only to be told on arrival there, “strict limits” had been imposed on the quota of Jews who’d be granted entry.

Although, sadly, the fate of most was thus sealed, countless more would have suffered the same had it not been for the defiant courage of Britain’s Vice-Consul, then-Captain Francis “Frank” Foley.

As a man who, in reality, was using his position as a cover for his long-serving role as an MI6 spymaster, Frank’s intelligence gathering had long confirmed that Hitler’s threats against the Jewish people were far from “empty rhetoric”.

For that reason, Frank was “quite unwilling to toe the line with London…”

Instead, he didn’t just “tear up the rulebook” that dictated whom he could issue lifesaving visas to but, when the “Kristallnacht” pogrom of 1938 was unleashed, he even transformed his place of residence into a safe haven for Jewish families.

From the “Night of Broken Glass” onwards, the number of Jews filing for immigration visas increased dramatically; but still, Frank’s superiors refused to ease the stringent requirements that prevented him from granting them.

Once again, therefore, he not only decided to “bend the rules” by easing them himself but, when he then received an official reprimand for his brave “contravention”, Frank doubled down on his rescue efforts by forging passports for Germany’s beleaguered Jewish citizens.

Despite being fully aware that no level of diplomatic immunity would protect him if the Gestapo had uncovered his clandestine activities, Frank persevered regardless, with no fear or concern for his personal safety.

In so doing, he enabled no fewer than 10,000 Jews to flee Hitler’s Reich; and yet, humble man that he was, Frank never spoke of his selfless deeds during his lifetime…

Incredibly, it was only after his passing, in May 1958, that his heroic exploits were revealed by his beloved wife, Katherine; and, it wasn’t until over four decades later, on this day in 1999, that he was deservedly recognized for having saved so many Jewish lives.

Honored as a posthumous Righteous Gentile by Yad Vashem, the latter paid tribute to Frank – “the British Schindler” –  by describing him as “a man of great faith and conviction…”

Indeed, “as a deeply devout Christian, Frank did nothing more than act upon his sense of justice and compassion.”

Inspiring and timely piece of history. Thanks to Samuel for posting this on LinkedIn!

What if 600 bureaucrats had each made it their business to save 10,000 lives? The course of history would have been changed.

This is worth keeping in mind as our leaders of both parties and the immigration bureaucracy make “bullying the most vulnerable” and dehumanizing asylum seekers their daily mission. And, they brag about their cruelty and intention to violate laws in even more deadly ways! What if the same amount of effort were devoted to addressing humanitarian crises and saving lives?

👏 CORNELL LAW IMMIGRATION CLINICS ARE ON A LIFE-SAVING 🛟 ROLL! 🛼

Professor Stephen Yale-Loehr
Professor Stephen Yale-Loehr
Cornell Law

Two reports from Professor Stephen Yale-Loehr:

1)  Hi all: Our Cornell asylum appeals clinic recently won a difficult withholding/CAT case at the BIA.  On remand, the IJ granted CAT.  And the client won release through habeas.

Pasted in below is a summary of the case.

Kudos go to Eva Charles and Isaac Belenkiy, the two Cornell law students who worked on the case.  Even by the high standards of our clinic, they both went above and beyond for the client.  And as you will see from the summary, pro bono attorneys from Morrison Foerster and the public defender’s office also worked hard to get our client CAT protection and release from detention.  It takes a village to win immigration relief!

The habeas decision is at 2023 U.S. Dist. LEXIS 173280.  The BIA decision is too big to attach.  If anyone wants it, please email me offline.

Thanks, Steve Yale-Loehr

2023 Mexico Withholding and CAT Case Summary [IES]

Stephen Yale-Loehr, Evangeline Charles, Isaac Belenkiy

IES is a 41-year-old man from Mexico who first came to the U.S. when he was 18 years old. As a youth, IES joined a gang. He was arrested in 2005 for possessing a small quantity of drugs and was sentenced to four years in prison for “transporting drugs.” While in prison, IES defected from the gang and, following his release, was removed to Mexico in 2008. There, his tattooed physical appearance caught the attention of gangs and cartels like the Cártel de Jalisco Nueva Generación, who attacked him and his family, prompting him to relocate eight times within Mexico. Unable to find safety in Mexico, IES fled back to the United States in 2010.

In 2022, IES was detained by ICE and held at the Golden State Annex (“GSA”), a private for-profit prison, in McFarland, CA. IES applied for asylum, withholding of removal, and protection under the Convention Against Torture (“CAT”). The Immigration Judge (“IJ”) denied all forms of relief, finding that IES’s 2005 conviction was a “particularly serious crime” (“PSC”) that rendered him ineligible for asylum and withholding of removal.

At this point, the Cornell asylum appeals clinic took on IES’s appeal to the Board of Immigration Appeals (“BIA”). Our brief addressed two main issues: 1) IES warranted relief under withholding of removal because his 2005 conviction was not a PSC; and 2) the IJ erred in analyzing IES’s eligibility for CAT relief.

For the PSC argument, we argued that the IJ improperly analyzed IES’s offense, ignored credible evidence that the drugs were for personal use, and instead relied on boilerplate sentencing documents. As a result, the IJ failed to analyze IES’s motivation and intent at the time of the offense.

For the CAT argument, we focused on 6 errors: 1) the IJ failed to consider that IES’s prolonged mental pain would cause future torture; 2) the IJ did not consider future torture from gangs and cartels despite an expert saying this risk was at 80%; 3) the IJ failed to admit 400 pages of country conditions reports into evidence; 4) the IJ mischaracterized IES’s attempts to flee cartels 8 times as “relocation;” 5) the IJ did not think there was police acquiescence even though the police, the local Attorney General, and the judicial police ignored IES’s complaints; and 6) the IJ did not aggregate IES’s risk of torture.

On June 16, 2023, the BIA sustained our appeal in IES’s favor and remanded the case back to the IJ. Notably, the BIA agreed with our PSC argument, the IJ’s failure to consider all evidence, and the IJ’s failure to aggregate IES’s risk of torture.

After this, IES’s case was transferred to a public defender, who represented him on remand. The clinic team worked closely with the public defender’s office to transfer all files and get them up to speed on the case.

Parallel to our BIA filing, we participated in other advocacy efforts. While at GSA, IES participated in a labor strike in 2022 and a hunger strike in 2023. The aims of these protests were to draw attention to the abysmal conditions at private immigration detention facilities like GSA, to call for a minimum wage for detainee labor, and to demand safe and sanitary living conditions for detained migrants. The 2023 hunger strike was a coordinated effort by detainees and activists, supported by lawyers working for immigration justice. This protest resulted in a class action lawsuit on behalf of the detainees and the submission of release requests on behalf of individual detainees.

During the protests at GSA, our team filed a release request for IES. Our request explained that IES should be released because he was neither a flight risk nor a danger to society. ICE denied the request. IES continued to participate in the hunger strike and was mistreated by ICE personnel and medical officers. This prompted our clinic to file complaints to ICE and DHS about this mistreatment, which violated ICE’s own regulations.  At the same time, we filed FOIA requests asking for IES’s detention, removal, and medical records. We decided to build a record of release requests to show administrative exhaustion so that IES can get a bond hearing. We also found a law firm (Morrison Foerster) to represent IES pro bono for a habeas corpus petition.

On September 27, 2023, the U.S. district court for the Northern District of California granted IES’s habeas petition on the grounds that “his prolonged detention without an individualized hearing violates his procedural due process rights.” A bond hearing was granted to IES. The government appealed this ruling, but their appeal was dismissed.

In fall 2023, IES was released on bond. A week later, the IJ granted him protection under CAT. IES is now back home with his wife and children. He can now get a work permit and cannot be deported to Mexico.

In the triumph of IES’s journey from detention to liberation, our team found a beacon of hope and resilience. The hunger strikes, the legal battles, and the relentless pursuit of freedom for IES were not in vain. As our clinic celebrates his freedom, we are grateful to our partners—advocacy groups in California and lawyers and public defenders who provided advice and guidance on appeal and zealously advocated for IES on remand—and to IES’s family, who never stopped providing support and information despite their own personal struggles.

The clinic’s fight for immigration justice is far from over, but IES’s triumph serves as inspiration to press onward and advocate for other clients who are plagued by inequities in our immigration system.

2) Asylum granted!

Beginning in spring 2023, a group of thirteen 1L and advanced Immigration Law & Advocacy Clinic students worked tirelessly to file individual asylum applications for a family from Afghanistan. The clients had their interviews in April, and the clinic just received the good news that the requests were approved. Congratulations to the team!

Congrats to the “next wave” of the relentless NDPA!

These are outstanding examples of why claims that unrepresented individuals receive constitutionally-required due process in Immigration Court are absolute poppycock! They also illustrate why responsible legislators and policy makers should be investing in representation rather than just spending wildly and fruitlessly on “gonzo” immigration enforcement.

No single nation, no matter how rich and powerful, can unilaterally change 21st century worldwide patterns of forced migration, which is what is generating the humanitarian situation at our Southern Border. But, we can more effectively address due process issues in our Immigration Courts, the “retail level” of the U.S. justice system!

Executive Summary

This paper examines the staffing needs of the US Department of Justice’s Executive Office for Immigration Review (EOIR), as it seeks to eliminate an immigration court backlog, which approached 2.5 million pending cases at the end of fiscal year (FY) 2023. A previous study by the Center for Migration Studies of New York (CMS) attributed the backlog to systemic, long-neglected problems in the broader US immigration system. This paper provides updated estimates of the number of immigration judges (IJs) and “judge teams” (IJ teams) needed to eliminate the backlog over ten and five years based on different case receipt and completion scenarios. It also introduces a data tool that will permit policymakers, administrators and researchers to make their own estimates of IJ team hiring needs based on changing case receipt and completion data. Finally, the paper outlines the pressing need for reform of the US immigration system, including a well-resourced, robust, and independent court system, particularly in light of record “encounters” of migrants at US borders in FY 2022 and 2023.

Wow! This is beyond amazing! Kudos and thanks to Don and Brendan for this incredibly helpful and informative analytical tool. Get the full report and access to all the charts and interactive features at the above link!

Just yesterday, my friend, Arizona “practical humanitarian” Robb Victor, was asking about how legislators and policy makers could do better planning for hiring Immigration Judges and Asylum Officers to reduce the backlog and address processing problems at the border. This is for you, Robb!

As Don and Brendan cogently point out, hiring alone can’t solve the problem! America needs positive, due-process-oriented, reforms to our legal immigration system embracing the reality and the economic power of robust orderly refugee and asylum acceptance and increases in legal immigration of all types.

The longer we ignore the need for these positive changes, and embrace the dangerous and defective myth that we can or should continue the failed program of attempting to enforce our way out of the migration realities and opportunities of the 21st century, the longer the disorder and grotesque waste of human lives and fiscal resources by our nation will continue.

And, of course, the innovative, low budget, potentially high-impact “Judges Without Borders” proposal by Judge Tom Lister and me should be part of any legislative package to improve the asylum system! See https://immigrationcourtside.com/2023/12/13/%F0%9F%91%A9%F0%9F%8F%BD%E2%9A%96%EF%B8%8F%F0%9F%91%A8%F0%9F%8F%BB%E2%9A%96%EF%B8%8F-%E2%9A%96%EF%B8%8F%F0%9F%97%BDjudges-without-borders-an-innovative-op/.

Catherine writes in WashPost:

As the economy has improved and consumers have begun recognizing that improvement, Republicans have pivoted to attacking President Biden on a different policy weakness: immigration. After all, virtually everyone — Democrats included — seems to agree the issue is a serious problem.

But what if that premise is wrong? Voters and political strategists have treated our country’s ability to draw immigrants from around the world as a curse; it could be a blessing, if only we could get out of our own way.

Consider a few numbers: Last week, the nonpartisan Congressional Budget Office released updated 10-year economic and budget forecasts. The numbers look significantly better than they did a year earlier, and immigration is a key reason.

The CBO has now factored in a previously unexpected surge in immigration that began in 2022, which the agency assumes will persist for several years. These immigrants are more likely to work than their native-born counterparts, largely because immigrants skew younger. This infusion of working-age immigrants will more than offset the expected retirement of the aging, native-born population.

. . . .

Instead, GOP lawmakers scaremonger about the foreign-born, characterizing immigration as an invasion. As Rep. Mike Collins (R-Ga.) dog-whistled last week, “Import the 3rd world. Become the 3rd world.”

Alas, the faction working to turn the United States into a developing country is not immigrants but Collins’s own party. It’s Republicans, after all, who have supported the degradation of the rule of law; the return of a would-be dictator; the gutting of public education and health-care systems; the rollback of clean-water standards and other environmental rules; and the relaxation of child labor laws (in lieu of letting immigrants fill open jobs, of course).

America has historically drawn hard-working immigrants from around the world precisely because its people and economy have more often been shielded from such “Third World”-like instability, which Republican politicians now invite in.

Ronald Reagan, the erstwhile leader of the conservative movement, often spoke poignantly of this phenomenon. In one of his last speeches as president, he described the riches that draw immigrants to our shores and how immigrants in turn redouble those riches:

Thanks to each wave of new arrivals to this land of opportunity, we’re a nation forever young, forever bursting with energy and new ideas, and always on the cutting edge, always leading the world to the next frontier. This quality is vital to our future as a nation. If we ever closed the door to new Americans, our leadership in the world would soon be lost.

— https://www.reaganlibrary.gov/archives/speech/remarks-presentation-ceremony-presidential-medal-freedom-5

Reagan’s words reflected the poetry of immigration. Since then, the prose — as we’ve seen in the economic numbers, among other metrics — has been pretty compelling, too.

Read Catherine’s full article at the link. Compare it with the observations that Beatriz Lopez and I recently made in Substack and Courtside about Dem short-sightedness on immigration, particularly in light of all the “good stories” about immigrants that Dems are afraid to tell out here. See  https://immigrationcourtside.com/2024/02/13/🤯dems-miller-lite-strategy-🤮-could-spell-disaster-☠%EF%B8%8F-in-november-time-to-regrow-spines-put-fight/.

Already the media are “at it again,” most attributing Democrat Tom Souzzi’s easy win over his GOP opponent for the House seat vacated by George Santos to his “move right” on immigration. But, as Catherine suggests above, “what if that premise is wrong?”

There is certainly support for a more nuanced view, both anecdotally and in polls.  “Suozzi, [a voter]  said, would ‘protect us but also be fair to those who are seeking asylum.’” https://www.washingtonpost.com/elections/2024/02/13/new-york-district-3-special-election-george-santos/. Sadly, and outrageously, the so-called Senate “compromise” border bill that Souzzi touted and which has become the “darling” of the tone-deaf mainstream media does neither. Not even close!

Yet, supposedly responsible journalists are falling all over themselves touting the benefits to Dems of a horrible “Miller-Lite” bill that essentially would have destroyed the right to asylum while turning the border over to cartels and smugglers to exploit some of the world’s most vulnerable who are victims of our own failings. Today’s wrong-headed WashPost editorial is a particularly egregious piece of such media sophistry. https://www.washingtonpost.com/opinions/2024/02/14/immigration-border-suozzi-mayorkas-special/.

We don’t have to “guess” at the human consequences of the nativist-inspired “bipartisan” non-solution at the border being trumpeted and glorified by Post editorialists safely ensconced in their “ivory tower!” We know! The results of recent half-baked attempts to close the border and eliminate asylum seekers are clear and well documented: death and human carnage inflicted on legal asylum seekers! See, e.g.https://www.google.com/url?sa=t&rct=j&q=&esrc=s&source=web&cd=&ved=2ahUKEwjq1pmw_qWEAxUwL1kFHUbSDMIQFnoECBAQAw&url=https://www.americanimmigrationcouncil.org/research/migrant-protection-protocols#:~:text=According%20to%20Human%20Rights%20First,individuals%20sent%20back%20under%20MPP.&usg=AOvVaw2ehZRBR_jXYoI41NZZN2DK&opi=8997844.

We also know that abuses of forced migrants at our borders fall disproportionately on the who are Black, Hispanic, or other people of color. See, e.g., https://humanrightsfirst.org/library/card-us-discrimination-against-black-migrants-refugees-and-asylum-seekers-at-the-border-and-beyond/ .

So, here’s a more intellectually honest “rewrite” of today’s lead editorial:

POST EDITORIAL BOARD: Death, Murder, Rape, Torture, Assault, Robbery, Extortion, Kidnapping of Hispanics, Blacks, Other Forced Migrants A Small Price To Pay For Bipartisan Deal To Outsource Migration To Gangs, Cartels, and Traffickers!

We Must Not Only “Turn Away The St. Louis,” But Torpedo It So Every Man, Woman, & Child Goes To The Bottom Where They Will Be Effectively Deterred From Ever Again Invoking Our Laws & Moral Obligations!

Nowhere, and I repeat nowhere, are the voices of those with decades of actual hands on experience working with migrants at the border, and the voices of those migrants themselves, being heard and heeded in this “non-debate” that resulted not in a “compromise” but in a “human rights giveaway.” What gives us the right to arrogantly and immorally give away rights and human lives that are NOT ours in the first place as if they were “table favors at a political fundraiser?“

As Beatriz so pointedly said:

Hanging above our heads like a Florida cockroach threatening to fly into our faces was the fact that the Biden administration, Majority Leader Chuck Schumer, Senator Chris Murphy, and Democrats who voted for the bill had officially moved the goalpost on immigration.

Thanks to the moral vapidity of Dem politicos and the Administration the “game” for the lives, rights, future, and human dignity of asylum seekers is now being “played” between the “Good Guys’”goal line and their ten yard line! We are being offered a “choice” between “cruel and stupid” and “crueler and dumber!” Certainly, the Dems and our nation could and should do better!

Supporting fairness, orderly processing, and actions that protect asylum and the community would be a far more prudent choice for Dems than the virulent “death to asylum craze” (the unstated part of which is that it also means “death to asylum seekers”) that currently seems to be “in vogue” with both parties and mindlessly hyped by the media.

It’s quite possible that Souzzi won not because of his extreme position on asylum, but because his position was “less extreme” that that of his GOP opponent and her openly xenophobic party. This conclusion is actually supported by polls that show that while most voters understandably want “order at the border,” they also want to protect the right to claim asylum and a fair process for doing so. See, e.g.https://wp.me/p8eeJm-9hU.

There is opportunity here for Dems to change minds and create a stronger coalition for asylum seekers and other immigrants. NGO experts like Beatriz Lopez need to partner with Congressional Dems who understand asylum and the border (like Rep. Hillary Scholten (D-MI) and Rep. Joaquin Castro (D-TX)) to reach out and meet with Rep. Souzzi and others like him to explain practical solutions and useful changes at the border that would create order while maintaining and enhancing fair and timely asylum processing.

Among these is the low-budget, common sense proposal advanced by retired Wisconsin Judge Thomas Lister and me for “Judges Without Borders,” essentially “leveraging” voluntary service by trained, retired State and Federal Judges to work with groups informing and advising individuals before they make the dangerous journey to our Southern Border. Budget-friendly humane solutions that can reduce the pressure on the border should be a bipartisan winner. Read more about our proposal here! See https://immigrationcourtside.com/2023/12/13/%F0%9F%91%A9%F0%9F%8F%BD%E2%9A%96%EF%B8%8F%F0%9F%91%A8%F0%9F%8F%BB%E2%9A%96%EF%B8%8F-%E2%9A%96%EF%B8%8F%F0%9F%97%BDjudges-without-borders-an-innovative-op/

Beyond that, advocates must explain and model how migrants themselves can help resolve the problems facing Rep. Souzzi’s district and improve the quality of life for all. They must show how migrants are “part of the solution,” perhaps, for example, by establishing public-private partnerships that would involve migrant communities in constructing high-quality, attractive affordable housing that would help the entire community. Working on various civic improvement projects might also be a mutually beneficial option.

Advocates, NGOs, and political supporters of migrants must do more than just point to graphs and cite statistics about the long-term economic and societal benefits of immigration. They must actually model and create practical joint projects and expand opportunities for the benefit of migrants and the communities to which they have been relocated.

Problem-solving needs to be brought into the “here and now” rather than just being presented to U.S. communities as a vague promise of future benefits. My experience is that most people react to what’s before them today rather than than relying on a constructed view of tomorrow, now matter how attractive and statistically supported that future vision might be.

In addition to the misguided “Miller Lite nonsense” from the editorial board and, disappointingly, even the usually responsible and insightful Karen Tumulty, today’s WashPost contained useful observations from Eduardo Porter about the need to get migrants to places in the U.S. where they, their job skills, and their work ethic would be welcomed, appreciated, and useful.

But, both the Biden Administration and Congress have shamefully failed to convert this “low-hanging fruit” into reality. Even worse, that has allowed White Nationalist demagogues like Abbott and DeSantis to waste and divert millions in public funds to make the situation worse and to convert those who want to help America succeed and prosper into hapless “political footballs” being tossed back and forth between GOP nativists and wimpy Dem politicos who long-ago lost their moral bearings. Although NGOs and advocates are weary and overburdened, if they don’t take the initiative to make this happen, on at least some scale, the opportunity will be lost and the nativist myth-makers will prevail.

Only by modeling actual results in real time will we be able to demonstrate the fallacy and counterproductivity of the GOP’s nativist “burden myths.” There’s no time like the present to start!

⚖️ EOIR: WHAT WORKS, WHAT DOESN’T — Why Hasn’t Garland Fixed The Basics? 🤯

1) WHAT WORKS

NDPA “Four Star General” ⭐️⭐️⭐️⭐️ Charles Kuck reports:

My partner Danielle Claffey won yet ANOTHER Russian Asylum case the belly of the beast Atlanta Immigration Court.  THIS is why lawyers are essential in asylum cases!

Danielle says:

Earlier this week, I had the great fortune of securing asylee status for a young Muslim girl from Russia, before an Atlanta immigration judge. Though she is young and was so quiet for the last year I was handling her case, in court, she was strong, confident, and provided vivid detail of what she went through for the entire 19 years of her life in Russia before fleeing for America. After the judge formally granted her asylee status, and the government waived appeal, the judge told her she was sorry for everything she went through in her home country. When the judge granted her case, and the interpreter translated the judge’s words, it was the first time I saw my client smile, followed by a big deep breath. She has carried a lot in her 21 years, but can now rest easy and pursue all of her dreams here in the U.S.

Many congrats, Danielle, and thanks so much for sharing! With great representation, anything is possible, even in Atlanta!

THIS is actually the way Immigration Court could and should work on a regular basis from all involved! Teamwork for justice! Note that:

  • No appeal;
  • No petition for review;
  • No remand;
  • No “aimless docket reshuffling;”
  • No need to keep renewing work authorization;
  • Respondent feels welcomed and understood by U.S. justice system;
  • Respondent leaves courtroom on the way to a green card, eventual U.S. citizenship, and can fulfill full potential in society;
  • Models and rewards best practices and professional cooperation (by EOIR, ICE, and the private bar) in achieving “justice with efficiency;”
  • As Charles says, representation is essential; you bet; so, why hasn’t Garland worked WITH the pro bono bar, NGOs, and clinical educators to facilitate representation in every asylum case? (HINT: “Aimless Docket Reshuffling” and its derivative “Expedited Dockets” — both “Garland specialties” — are major, DOJ-created, impediments to effective representation and are particularly discouraging and problematic for pro bono representatives!

2) WHAT DOESN’T WORK

Dan Kowalski reports for LexisNexis:

https://www.lexisnexis.com/community/insights/legal/immigration/b/insidenews/posts/ca8-on-reasoned-decision-making-davis-v-garland

http://media.ca8.uscourts.gov/opndir/24/02/223262P.pdf

“The BIA erred in affirming the IJ. The entirety of the BIA’s analysis about the motion to reopen was that Davis “has not established that evidence of his mental health issues and of his past and feared harm if returned to Liberia are new, previously unavailable, or would likely change the result in his case.” This one sentence alludes to the elements of a motion to reopen, but does not explain how they apply to Davis’s case. Neither the IJ nor the BIA met the requirements of reasoned decision-making. … Without an adequate explanation, this Court cannot conduct a meaningful review of the BIA’s September 30, 2022 order. … This Court grants Davis’s petition for review in case no. 22-3262, denies the petition for review in case no. 23-1229, and remands for further proceedings consistent with this opinion.”

Congrats to the NDPA team from Immigration and Disability Law Scholars.

But, this is an example of how Merrick Garland’s DOJ is failing the basics of American justice! Note that:

  • Two levels of EOIR flunk “Judging 101” — badly;
  • Inappropriate “defense of the indefensible” (and easily correctable) by Garland’s DOJ (OIL) asserting semi-frivolous jurisdictional argument;
  • Wastes Court of Appeals time on something Garland could and should have corrected and prevented from reoccurring;
  • Failure to follow Circuit precedent by both EOIR and OIL;
  • Failure to apply established standards;
  • Likely use of mindless “any reason to deny boilerplate” at EOIR;
  • Generates needless motion to reconsider;
  • After four years, two IJ hearings, two administrative appeals, a motion to reopen, a motion to reconsider, a trip to the Court of Appeals, case remains unresolved;
  • Competent EOIR Judges could have reopened the case and ruled on the merits in less time and using fewer resources than trying to mindlessly avoid providing the respondent with a reasoned decision;
  • In a system with three million pending cases these types of easily avoidable, sophomoric mistakes from supposedly “expert” judges are repeated over and over again— not always caught and corrected — leading to denials of due process and fundamental fairness and promoting backlog-building “aimless docket reshuffling!”
  • What if the the wonderful team at “Immigraton and Disability Law Scholars” could devote 100% of their time to representing vulnerable individuals at merits hearings in Immigration Court rather than having to correct avoidable mistakes by EOIR and OIL?

After three years in charge of EOIR, why hasn’t Merrick Garland, a former Court of Appeals Judge nominated to the Supremes:

  • Cleaned house at EOIR;
  • Brought in new, expert, dynamic, due-process-focused leadership;
  • Institutionalized best practices (see example 1 above);
  • Attacked system-wide anti-immigrant culture, lack of quality control, and unprofessional decision-making that continues to plague this critical “retail level” of American justice (see example 2 above);
  • Fixed OIL so that it will stop undermining justice in America by raising specious arguments and defending indefensible EOIR mistakes in the Article III Courts?
Alfred E. Neumann
Merrick Garland’s “Alfred E. Neumann Approach” at EOIR: Indolent, inappropriate, ineffective!
PHOTO: Wikipedia Commons

It’s not rocket science; it doesn’t require legislation (although Garland certainly should have been publicly pushing for Article I); it just takes a laser-focused commitment to due process, fundamental fairness, best practices, and efficient delivery of justice from what continues to be America’s worst “court system!”

Why that leadership and action isn’t coming from Garland is a question that everyone who cares about the future of American  🇺🇸⚖️ justice should be asking every day! Fix the fixable! Model the best! That’s “Good Governing 101!”

Border Death
Something is definitely wrong with this deadly “border vision” promoted by pandering politicos and the mainstream media! Could it be reality, humanity, and opportunity? This is a monument for those who have died attempting to cross the US-Mexican border. Each coffin represents a year and the number of dead. It is a protest against the effects of Operation Guardian. COMPREHENSIVE YET SUPERFICIAL: NYTimes History Misses The Point Of Why The Border Continues To Vex U.S. & Kill The Most Vulnerable!

By Paul Wickham Schmidt

Courtside Exclusive

January 31, 2024

Alexandria, VA. This is a long and informative article: https://www.nytimes.com/2024/01/30/us/politics/biden-border-crisis-immigration.html?smid=nytcore-ios-share&referringSource=articleShare. But, it’s not helpful if we want to bring “order to our border.”

So, let’s just focus on the real problem:

People close to Mr. Biden said he had always supported enforcing the law. Some of his top aides, such as Susan E. Rice, who served as his domestic policy adviser until last summer, and Jake Sullivan, his national security adviser, embodied that tough-minded approach.

“Migrants and asylum seekers absolutely should not believe those in the region peddling the idea that the border will suddenly be fully open to process everyone on Day 1,” Ms. Rice had said early on in Mr. Biden’s presidency.

Contrary to these border myths, which the NYT article does not really adequately take on, “the law” requires that individuals be given a chance to apply for asylum regardless of “status” and “entry point.” Congress provided a “quick screening” process called “credible fear” to deal with “mass migration” situations.

Assuming for the sake of argument that “the law” also requires that individuals be “detained” while credible fear screening and adjudication of claims by those who pass takes place, four elements are necessary for the legal system to work in a fair and timely manner.

  1. Humane, NGO-operated reception centers, with on-site representation available, in locations preferably removed from the immediate border for screening to take place;
  2. A huge corps of true expert Asylum Officers to do credible fear screening and outright grant clearly valid cases wherever possible;
  3. A large corps of true expert Immigration Judges and BIA Appellate Judges to guide Asylum Officers, review their work, and, where the case can’t be granted at first instance, conduct timely full adjudication of claims for those who pass credible fear, prioritizing those claims most likely to succeed;
  4. A functional resettlement program for those granted asylum and those whose cases require more in-depth process.

These four steps are the core of what real law enforcement at the border is all about! Prioritize them, accomplish them, and the other pieces will fall in place.

Contrary to Susan Rice, Jake Sullivan, and what the NYT article suggests, a plan to accomplish this 1) isn’t rocket science; 2) does not require legislation; and 3) needed to be “ready to go” with dynamic, courageous, due-process-focused leadership on Day 1 of the Administration or very shortly thereafter.

As always in Government, it’s a question of priorities, courage, and leadership. Despite the “overabundance” of proven, creative legal and administrative talent then in the private sector, most of whom were available to assist Biden, the Administration was not “ready to roll” with this program on Day 1 (as Steven Miller was with his vile “kill asylum and asylum seekers” agenda).

Sadly, even today, the Administration has not come close to putting in place any of these four critical requirements for success. It was highly predictable to any informed expert that forced migrants would continue to arrive at the border in large numbers and that GOP White Nationalists would “leverage” the Administration’s failure to achieve order at the border.

There is something else that’s completely predicable: That, if passed (a big if), the “nativist-driven compromise” now being “debated” by Congress and the Administration will NOT solve the humanitarian issue of forced migration BUT WILL create more death, trauma, and failure at the border and beyond.

Until America elects humanitarian-focused, problem-solving leaders with the vision to regularize fair asylum processing and the courage and skills to implement it, our border will continue to be a godawful mess: Just as GOP White Nationalists want! And, the great opportunity presented by talented asylum seekers who want only to save their and their families’ lives while helping us succeed will be squandered.

Friends,

The long-awaited bipartisan Senate deal on immigration contains no real reforms, such as a pathway to citizenship for undocumented immigrants. It’s all about “securing” the border.

Biden and Senate Democrats have caved to Senate Republican hardliners. Among other restrictions, the bill would make it much harder for people to apply for asylum.

On Friday evening Biden called the bill “the toughest and fairest set of reforms to secure the border we’ve ever had in our country.”

Then Biden went further — endorsing a full border shutdown. He said the bill “would give me, as President, a new emergency authority to shut down the border when it becomes overwhelmed. And if given that authority, I would use it the day I sign the bill into law.”

I very much doubt Biden would shut the border if he signs this bill into law.

So what’s going on here? The underlying politics here has nothing to do with funding Ukraine. It doesn’t have to do with reforming immigration. It doesn’t even have much to do with the practical challenge of securing the border.

It has everything to do with the 2024 election, in which border security has become a big issue.

The nation does have to take reasonable action to stem the illegal flow of immigrants. But Trump has stoked American’s fears with lies (see below).

Trump and Biden are engaged in a giant pre-election kabuki fight over the border.

Biden wants to take the border issue away from Trump and figures this bill will do it. Which is exactly why Trump doesn’t want the bill enacted. “As the leader of our party, there is zero chance I will support this horrible, open-borders betrayal of America,” Trump said on Saturday. “It’s not going to happen, and I’ll fight it all the way.”

Trump says he welcomes criticism from GOP senators. “Please, blame it on me. Please, because they were getting ready to pass a very bad bill.”

House Speaker Mike Johnson, Trump’s lapdog-in-chief, says the bill is “dead on arrival” in the House. Besides, he now says, it isn’t needed because Biden already has all the authority he needs to close the border.

Um … just last year, Johnson argued that Congress must tighten immigration laws to strengthen the president’s hand. When he was president, Trump sought similar additional authority from Congress.

Meanwhile, House Republicans are about to begin impeachment proceedings against Alejandro Mayorkas, homeland security secretary, for allegedly being too soft on border security — even though Mayorkas worked with Senate Republicans to come up with this hardline border deal.

We need to deal with the border, but Republicans are now the ones sitting on their hands because they’re beholden to Trump. We also need to deal with immigration in a humane way by offering a broad and reasonable path to citizenship, but Democrats seem to have forgotten this basic goal.

The public, meanwhile, is utterly confused by Trump’s demagoguing. Here are Trump’s biggest lies, followed by the truth.

Trump claims Biden doesn’t want to stem illegal immigration and has created an “open border.”

Rubbish. Since he took office, Biden has consistently asked for additional funding for border control.

Republicans have just as consistently refused. They’ve voted to cut Customs and Border Protection funding in spending bills and blocked passage of Biden’s $106 billion national security supplemental that includes border funding.

Trump blames the drug crisis on illegal immigration.

Bull. While large amounts of fentanyl and other deadly drugs have been flowing into the United States from Mexico, 90 percent arrives through official ports of entry, not via immigrants illegally crossing the border. Research by the conservative Cato Institute found that more than 86 percent of the people convicted of trafficking fentanyl across the border in 2021 were U.S. citizens.

Trump claims that undocumented immigrants are terrorists.

Baloney. America’s southern border has not been an entry point for terrorists. For almost a half-century, no American has been killed or injured in a terrorist attack in the United States that involved someone who crossed the border illegally.

Trump says undocumented immigrants are stealing American jobs.

Nonsense. Evidence shows immigrants are not taking jobs that American workers want. The surge across the border is not increasing unemployment. Far from it: Unemployment has been below 4 percent for roughly two years, far lower than the long-term average rate of 5.71 percent. It’s now 3.7 percent.

Trump claims undocumented immigrants are responsible for more crime in America.

More BS. In fact, a 2020 study by the Proceedings of the National Academy of Sciences, cited by the Department of Justice, showed that undocumented immigrants have “substantially” lower crime rates than native-born citizens and legal immigrants. Despite the recent surge in illegal immigration, America’s homicide rate has fallen nearly 13 percent since 2022 — the largest decrease on record. Local law enforcement agencies are also reporting drops in violent crime.

Since he entered politics, Donald Trump has fanned nativist fears and bigotry.

Now he’s moving into full-throttled neofascism, using the actual language of Hitler to attack immigrants — charging that undocumented immigrants are “poisoning the blood of our country” and saying they’re “like a military invasion. Drugs, criminals, gang members and terrorists are pouring into our country at record levels. We’ve never seen anything like it. They’re taking over our cities.” He promises to use the U.S. military to round up undocumented immigrants and put them into “camps.”

The parallels with Nazi Germany are chilling. In 1932, the canny Nazi propagandist Joseph Goebbels called for “a thick wall around Germany,” to protect against immigrants. “Certainly we want to build a wall, a protective wall.”

Trump and his enablers want us to forget that almost all of us are the descendants of immigrants who fled persecution, or were brought to America under duress, or simply sought better lives for themselves and their descendants.

Immigration has been good for America. As the median age of Americans continues to rise, we’ll need more young people from around the world.

The central question shouldn’t be how to secure our borders. It should be how to create an orderly and humane path to citizenship.

Kabuki
“Kabuki Theater” with human lives! The REAL “national security threats” — Trump, Abbott, DeSantis, and their MAGA toadies like MAGAMike — subvert our democracy in plain view!
ATTRIBUTION: Creative Commons 2.0

Lost in the overheated and too often misleading media hype of this issue is a simple truth: Congress and Administrations of both parties have failed to fulfill our Government’s duties under international and domestic laws (which are based on international requirements) to establish a fair, generous, expert, timely asylum adjudication system — one that complies with due process and actually gives asylum applicants the required “benefit of the doubt.”

Now, in a show of supreme political cowardice, egged on by the White Nationalist right and their lies, politicos of both parties and in all three branches of Government seek to cover up their failure by punishing and endangering the lives of their victims! The latter are legal asylum seekers — human beings — who overwhelmingly present themselves to authorities at the border in an orderly fashion to get a fair adjudication of their claims. Our Government routinely denies them that fundamental right through ridiculous delays, bad precedents, poor quality adjudications, underfunding, deficient leadership, and coercive gimmicks like bogus prosecutions, imprisonment, denial of access to counsel, and illegal and immoral family separation.

Meanwhile, Dems are failing to stand up for the human and legal right to seek asylum, which is being violated right and left and which the “Senate compromise” promises even more scofflaw violations of human rights and basic human dignity.

We can diminish ourselves as a nation, but it won’t stop human migration — particularly forced migration!

Border Death
Human lives and human dignity at our border have become mere “bargaining chips” and “collateral damage” to cowardly negotiators of both parties. Will history hold them accountable for their outrageous and immoral conduct? This is a monument for those who have died attempting to cross the US-Mexican border. Each coffin represents a year and the number of dead. It is a protest against the effects of Operation Guardian. Taken at the Tijuana-San Diego border.

https://www.nytimes.com/2024/01/23/us/politics/parole-immigration-biden-congress.html?smid=nytcore-ios-share&referringSource=articleShare

Zolan Kanno-Youngs reports for the NYT:

Artem Marchuk needed to escape Ukraine or die. He didn’t see any other options.

He and his wife and children had been living in Bakhmut, the site of the war’s deadliest battle. Even when they made it out of the city, nothing in Ukraine felt safe.

“My kids were very hungry,” Artem’s wife, Yana, said in an interview from the family’s home in Baltimore, where the U.S. government resettled them in 2022. “There was darkness everywhere.”

The Marchuks are among more than a million people whom the Biden administration has allowed into the United States over the past three years under an authority called humanitarian parole, which allows people without visas to live and work in the United States temporarily. Parole has been extended to Ukrainians, Afghans and thousands of people south of the U.S.-Mexico border fleeing poverty and war.

Now the program is at the heart of a battle in Congress over legislation that would unlock billions of dollars in military aid for some of President Biden’s top foreign policy priorities, such as Ukraine and Israel.

Republicans want to see a severe crackdown on immigration in exchange for their votes to approve the military aid — and restricting the number of people granted parole is one of their demands.

For Mr. Marchuk, the fact that a program that saved his family has become a bargaining chip on Capitol Hill feels wrong. Although the latest version of the deal would mostly spare Ukrainians seeking parole, he feels a deep sense of solidarity with other people — regardless of their nationality — who may be left behind if Congress imposes limits on the program.

Americans, he said, should welcome people like his family. Mr. Marchuk, a former technology in Ukraine, said he has found work helping other refugees with the advocacy organization Global Refuge, as well as driving for DoorDash, UPS and Amazon since he arrived in Baltimore.

“Refugees deliver these packages,” said Mr. Marchuk, 36. “American citizens who have an education,” he said, very often don’t want to work as drivers.

. . . .

The particulars of the deal in Congress are still being negotiated. A deal that is being discussed in the Senate seeks to reduce parole numbers by tightening immigration enforcement at the southern border.

That would not have a direct impact on the route that many Ukrainians took to America, since they generally do not arrive by the southern border. (Some Ukrainians do make it to the United States that way, however.)

But there is still deep uncertainty about whether the program will survive without changes.

Even some congressional Democrats who oppose substantially changing the parole program have acknowledged they may need to give in to some Republican demands to limit the program if they have any chance of passing the military aid package.

. . . .

As lawmakers debate the merits of the parole program, some immigrants in the United States say all the political talk glosses over the calamities in their home countries.

“People are dying left and right, being kidnapped and it’s just impossible,” said Valerie Laveus, who came to America from Haiti nearly 20 years ago and became a naturalized U.S. citizen in 2008. “I am concerned because I feel like a lot of times these people are having these conversations and they’re forgetting the human factor. They’re forgetting that they’re talking about lives.”

. . . .

Mr. Biden’s allies say restricting use of parole would very likely backfire.

“It means that people in desperate circumstances, who need protection, who need to leave, who need to flee, their options will be more limited, which increases the likelihood they choose the dangerous option of coming to the border,” said Cecilia Muñoz, one of Mr. Biden’s top immigration officials during the transition and co-chair of Welcome.US, an organization that helps Americans sponsor the resettlement of refugees to the United States.

Karoun Demirjian contributed reporting.

*******************************

Notably, according to this article, Congress appears ready to carve out a “White Guy Exception” for Ukrainians arriving from Europe. So much for the idea that current immigration policy by both parties isn’t “race driven” — with Hispanics and Blacks generally on the short end of the stick.

Remarkably none of the politicos “negotiating” away the lives of others have the guts to bear witness to the human pain, misery, torture, and death they are about to inflict on those seeking refuge at our Southern Border. The GOP recently did a disgusting “dog and pony” show at the border, but refused to meet, despite requests, with their intended human victims, those assisting them, and local humanitarian religious groups and NGOs. See https://immigrationcourtside.com/2024/01/11/%e2%9a%96%ef%b8%8f-expert-to-congress-fix-your-border-mess-stop-picking-on-asylum-applicants-ruth-ellen-wasem-the-messenger-do-they-really-think-that-raising-the-bar-will-dete/.

By contrast, high level politicos of the Biden Administration and Congressional Dems avoid the border like the plague, except for the few who represent border districts. They are not that much different from GOP nativists. They refuse to engage with border experts, those who have devoted their lives to assisting forced migrants at the border, and the migrants themselves, who certainly will face severe harm, even death, due to the cowardly “sellout” by Congressional Dems and the Administration.

Let’s be very clear about the documented consequences of eliminating asylum at the border:

NEW YORK – With Congress considering codifying additional policies that will trap asylum seekers in Mexico, Human Rights First today reports that it has tracked over 1,300 reports of torture, kidnapping, rape, extortion, and other violent attacks on asylum seekers and migrants stranded in Mexico since the administration’s asylum ban was enacted in May.

https://www.google.com/url?sa=t&rct=j&q=&esrc=s&source=web&cd=&ved=2ahUKEwifws7dj_yDAxUSEVkFHUZmC50QFnoECA0QAw&url=https%3A%2F%2Fhumanrightsfirst.org%2Flibrary%2Fhuman-rights-first-details-violence-against-asylum-seekers-at-u-s-border%2F%23%3A~%3Atext%3DNEW%2520YORK%2520%25E2%2580%2593%2520With%2520Congress%2520considering%2Cstranded%2520in%2520Mexico%2520since%2520the&usg=AOvVaw0Q1cbvPBwyaGST5Aww5e_z&opi=89978449

Basically, those pushing to appease the GOP White Nationalist restrictionists at the border are knowingly and intentionally advocating for deadly human rights violations! How is that acceptable?

Foreign-born workers consistently have a higher labor market participation rate than native-born workers. https://usafacts.org/articles/how-many-immigrants-are-in-the-american-workforce/. Consequently, there is little reason to doubt that new waves of migration ultimately will benefit the U.S., particularly the many U.S. cities, large and small, in danger of depopulation and “death.” Ironically, many of the localities with the most to gain from robust migration are in “red” states. https://apple.news/AQkO0JQjKS9aXF-V-RD9-_Q

Instead of planning to avoid these “ghost towns,” using the influx of individuals who seek to help us as an opportunity, we’re “strategizing” and spending huge amounts of money expelling, “deterring,” imprisoning, rejecting, dehumanizing, and even killing those who seek refuge!

There are legitimate issues as to how to “front” services for asylum seekers until they can obtain work authorization and find jobs. THIS, is where bipartisan cooperation, creative solutions, and resources could be focused, rather than exclusively on counterproductive and expensive gimmicks to punish, deter, and deny. But, there’s no chance of that!

Instead, in an example of how far the one-sided debate has departed from reality and human decency, Biden now vows to “shut the border” if Congress will only give him the authority! https://www.washingtonpost.com/politics/2024/01/26/biden-vows-shut-down-an-overwhelmed-border-if-senate-deal-passes/. But, that’s apparently not enough cruelty and xenophobia for MAGAMike and his White Nationalist insurrectionists! They seek eradication of the lives and humanity of anybody with the temerity to seek refuge in the U.S.

Lost in this latest burst of bipartisan xenophobia are the “Dreamers” who are part of our nation’s future. https://www.washingtonpost.com/opinions/2024/01/26/congress-border-deal-daca-immigration-dreamers/. Although already contributing mightily to our nation’s success, they too are victims of the political cowardice and dehumanization that is now par for the course on both sides of the aisle.

And so it goes, ever onward and downward. The media has developed amnesia on the well-documented unmitigated disaster and cascade of human suffering that our nation’s most recent border shutdown generated. As stated by expert Aaron Reichlin-Melnick on “X:”

Will the DC press (not those on the immigration beat) continue to ignore the fact that the last time we “shut down the border” under Title 42, it did not work and in fact led to 15 out of 20 of the highest months for border apprehensions in the 21st century?

We don’t know yet who the “winners” of the 2024 election will be, other than traffickers, cartels, exploiters, private prison corporations, undertakers, and body bag makers! But, we already know the “losers:” asylum seekers, Dreamers, human rights, persons of color, and those brave souls who continue to stand up for truth and equal justice for all!

Dem politicos and the Administration seem to be counting on the view that the Trump GOP is so horrible and antithetic to democracy that Dems can afford to dehumanize migrants, ignore their supporters, and break campaign promises without consequences. Just what they are getting in return isn’t obvious. From an immigrants rights’ and humanitarian standpoint, it’s “zilch.”

With Dems supposedly in charge of the Presidency and the the Senate, why are they ready to gift GOP restrictionists with what many have characterized as a “generational chance” to destroy asylum, hamstring legal immigration avenues, and squander even more money on hyper-cruel, race-driven, “sure to fail” border militarization and human rights violations?

Talk about “selling your soul!” That appears to have become the Democrats’ mantra in 2024. Whether it will prove a successful political strategy, remains to be seen!

“The GOP’s five biggest border lies debunked!” Here’s the video:

Unfortunately, the GOP’s “big lie campaign” works! Truth, by contrast, apparently has little power to persuade.

Heck, 14 so-called “Democrat” Reps voted for the GOP’s disingenuous White Nationalist border agenda! https://www.politico.com/live-updates/2024/01/17/congress/house-gop-biden-border-rebuke-dems-00136221.

That’s something for human rights activists and progressives to remember when some of these same spineless folks pelt your inbox with requests for your hard-earned dollars and your vote to help them save democracy — a democracy that they and their GOP nativist buddies don’t really believe in or defend!

And, it’s not like the Administration can explain their border policies either! They would just like to change the topic. Biden won’t defend his own policies and is looking to cut a deal with the GOP to trade the lives and human rights of asylum seekers for bombs and guns for Israel and Ukraine! See https://www.nbcnews.com/politics/white-house/biden-says-senate-may-come-border-deal-early-week-rcna134832.

Another example of truth losing out: Despite irrefutable evidence to the contrary, a substantial majority of GOP voters believe Trump’s “stolen election” lies. https://www.poynter.org/fact-checking/2022/70-percent-republicans-falsely-believe-stolen-election-trump/. And, whether or not they actually believe Trump’s falsehoods, almost no GOP office-holders, at any level, have the guts to challenge his absurdist claims.

Indeed, in one of the very few documented examples of voting irregularities, a Virginia county shorted President Biden more than 1,000 votes which would have increased his margin of victory over Trump. This is a spectacular chance to work with really dedicated professionals performing a meaningful mission to help migrants adapt, prosper, and obtain legal status in our DMV area while enriching and assisting our communities. It’s about working together to build a better America for everyone!

As I have mentioned before, I am a proud member of AYUDA’s Advisory Council. At our meeting held at AYUDA this week, I was surrounded by talented, dedicated folks, who, unlike the often biased and ill-informed politicos out to destroy our legal immigration framework, are committed to solving problems in a humane, creative, legal manner recognizing the humanity and talents of our migrant communities.

Among other things, I heard:

  • Busses continue to arrive in our area without warning and coordination from either the “sending states” or the Feds;
  • The overwhelming number of those arriving are forced migrants with strong asylum claims;
  • Many of the current arrivals are from Venezuela and Nicaragua, countries with repressive leftist dictatorships with established records of persecution and human rights abuses recognized and condemned by Administrations of both parties;
  • Many arrivals, because of language problems and haphazard Government processing, do not understand how the asylum system operates;
  • Through information sessions, AYUDA and other NGOs are filling an information gap left by poor Government performance;
  • Despite the monumental efforts of terrific pro bono lawyers from across the DMV area (more needed) there is neither rhyme nor reason to the handling of these cases at EOIR and the Asylum Office;
  • Some cases are expedited, some are placed on slow dockets;
  • There are no BIA precedents or useful guidance on the many recurring situations that should result in grants;
  • Different results on similar material facts are a continuing problem;
  • Delays and “Aimless Docket Reshuffling” by EOIR hinders pro bono representation.

These are the problems that Congress and the Administration could and should be solving! Instead, outrageously, they are focused on spreading dehumanizing myths and devising even more wasteful “enforcement only” gimmicks that are bound to fail and leave more devastation, trauma, and wasted opportunities in the wake! Human lives and human rights are neither “bargaining chips” nor “political props” in an election year!

AYUDA
Americans are being bombarded by false messages of hate, fear, resentment, and dehumanization directed at out immigrant communities. That’s a HUGE problem for our nation of immigrants’ future! Fight back by joining AYUDA and becoming part of the solution!

AYUDA and other NGOs offer a chance to be part of the solution, save lives, and stand against the disgraceful failure of our Government to honor our legal commitments to asylum seekers and other migrants. Be a champion of migrants who make our “nation of immigrants” really great!

🗽⚖️ AS CONGRESS & ADMINISTRATION DITHER OVER GOP’S OUTRAGEOUS NATIVIST DEMANDS, LONG OVERDUE DUE PROCESS & STRUCTURAL REFORMS LANGUISH, LEAVING ASYLUM-SEEKING REFUGEES TWISTING IN THE WIND! — A Report On The Ever Growing EOIR Backlog From AP’s Giovanna Dell’Orto!

MIAMI (AP) — Eight months after crossing the Rio Grande into the United States, a couple in their 20s sat in an immigration court in Miami with their three young children. Through an interpreter, they asked a judge to give them more time to find an attorney to file for asylum and not be deported back to Honduras, where gangs threatened them.

Judge Christina Martyak agreed to a three-month extension, referred Aarón Rodriguéz and Cindy Baneza to free legal aid provided by the Catholic Archdiocese of Miami in the same courthouse — and their case remains one of the unprecedented 3 million currently pending in immigration courts around the United States.

Fueled by record-breaking increases in migrants who seek asylum after being apprehended for crossing the border illegally, the court backlog has grown by more than 1 million over the last fiscal year and it’s now triple what it was in 2019, according to government data compiled by Syracuse University’s Transactional Records Access Clearinghouse.

Judges, attorneys and migrant advocates worry that’s rendering an already strained system unworkable, as it often takes several years to grant asylum-seekers a new stable life and to deport those with no right to remain in the country.

. . . .

Experts like retired judge Paul Schmidt, who also served as government immigration counsel while the last major reform was enacted nearly forty years ago, say the broken system can only be fixed with major policy changes. An example would be allowing most asylum cases to be solved administratively or through streamlined processes instead of litigated in courts.

“The situation has gotten progressively worse since the Obama administration, when it really started getting out of hand,” said Schmidt, who in 2016, his last year on the bench, was scheduling cases seven years out.

At the above link, read Giovanna’s excellent full article, based on interviews with those who actually are involved in trying to make this dysfunctional system function. Thanks, Giovanna, for shedding some light on the real, potentially solvable, “human rights crisis” enveloping and threatening the entire U.S. legal system. Contrary to “popular blather,” fulfilling our legal obligations to refugees is not primarily a “law enforcement” issue and won’t be solved by more border militarization and violations of individual rights of asylum seekers and other migrants!

There are lots of ways to start fixing this system! Gosh knows, most of them have been covered here on Courtside, sometimes several times, and they are all publicly available on the internet with just a few clicks. See, e.g.,

The “debate” on the Hill defines “legislative malpractice!” The voices of legal integrity, experience, and practicality aren’t being heard! Also, lots of great ideas from experts on fixing EOIR are stuffed in the “Biden Transition Team” files squirreled away in some basement cubbyhole at Garland’s DOJ.

But most politicos aren’t interested in listening to the experts, nor do they seem motivated to understand the real human problems at the border, in the broken Immigration Courts, and how many of the things they are considering will make the situation worse while empowering smugglers and cartels! Those are real human corpses piling up along the border, carried out of immigration prisons, being abused in Mexico, and floating in the river — mostly due to the brain-dead “enforcement only” policies now being given an overdose of steroids by congressional negotiators.

So, things just keep deteriorating. Many in the backlog who deserve a chance at a permanent place in our society, and the ability to contribute to their full abilities and potential, remain in limbo! That’s bad for them and for us as a society!

🇺🇸 Due Process Forever!
