Groundbreaking Path2Papers Initiative Receives $1.5 Million Grant

Professors Jaclyn Kelley-Widmer and Stephen Yale-Loehr have secured a $1.5 million grant from Crankstart for their groundbreaking initiative, the Path2Papers project. Housed at Cornell Law School, this new nonprofit venture helps DACA recipients in the San Francisco Bay Area pursue work visas and other pathways to legal permanent residency. Cornell DACA recipients can also receive consults through this project.
Since its inception by the Obama administration in 2012, the Deferred Action for Childhood Arrivals (DACA) program has allowed an estimated 600,000 undocumented young migrants who arrived in the United States as children to obtain the right to work and temporary protection from deportation. However, with Congress’s failure to find a legislative solution and legal challenges entangling the program in federal courts, uncertainty looms over DACA’s future.
Path2Papers is one of the only programs in the country that combines experience in employer representation with expertise in evaluating employment-based immigration options for DACA recipients. Coordinated by Kelley-Widmer, Yale-Loehr, and several others, including Dan Berger ’96, an immigration lawyer and nonresident academic fellow at the Law School, the project aims to facilitate the transition of up to 40 percent of the approximately 12,000 Bay Area DACA recipients to alternative lawful immigration statuses. By doing so, it seeks to ensure that even if Congress or the courts terminate DACA, many recipients in the Bay Area can continue to reside legally in the United States, unlocking their full potential.
Path2Papers will employ a multifaceted approach to achieve its objectives. This includes providing personalized legal consultations to DACA recipients, training students and professionals in immigration law, hosting legal information sessions, offering referrals to legal service providers and pro bono attorneys, conducting training sessions for attorneys on handling DACA-related issues, and educating employers about visa options for their DACA employees.
Over the two-year grant period, Path2Papers will establish a robust infrastructure to deliver comprehensive legal assistance to Bay Area DACA recipients. During the first stage of this process, Kelley-Widmer is shifting the focus of her longstanding 1L Immigration Law and Advocacy Clinic to the Path2Papers project. “I’m excited to have the opportunity to build proactive support for DACA recipients through this cutting-edge model while integrating clinical students into the work,” Kelley-Widmer says. “And already, other organizations around the country have reached out about how to replicate this project in their area.” In addition, the project has hired immigration lawyer Krsna Avila ’17, a former clinic student, as a full-time attorney based in the Bay Area.
“This project teaches valuable legal skills to law students while also addressing a real need for a deserving and underserved population,” says Yale-Loehr. “In that sense it fulfills Cornell Law School’s mission of creating ‘lawyers in the best sense.’”

The Senate finally released the full text of its long-awaited bipartisan immigration bill on Sunday evening.
If passed, the bill would:
fund military support for Ukraine and Israel while defunding UNRWA
establish new emergency powers that would allow the president to shut down the border
create a higher threshold for credible fear interviews and new asylum pathways at the US-Mexico border
provide a pathway to green cards for Afghan refugees in the United States
expands electronic monitoring and immigrant detention
and make a range of other changes to the immigration system—some good for migrants, some bad
It also provides more funding to immigration agencies, including:
$440M for IJs
$12M to combat smuggling
$7B to CBP
$8B to ICE
$4B to USCIS
I read the bill tonight twice. I am still thinking through not simply the text of the bill, but what the bill represents as a vision for immigration change. What are the values that this bill represents? How would these provisions be implemented in practice? How would we measure the effects of these various changes?

But don’t feel like you need to get too into the weeds here. The likelihood that the bill will live through the night is looking slim as people from across the political spectrum fight over pillows to smother the bill in its sleep tonight.
Prominent conservatives are already up in arms over the fact that the emergency border powers don’t kick in until several thousand encounters per day. They read the text as saying that anything less than 5,000 is, therefore, “acceptable”.
Most of these talking points align closely to Donald Trump’s goal of preventing the bill from moving forward (even though is captures many classic Republican immigration goals and very few of Democrats’) so that he can run on the “immigration crisis” in the next election.
House Speaker Mike Johnson said on a certain website that Shall Not Be Named:
I’ve seen enough. This bill is even worse than we expected, and won’t come close to ending the border catastrophe the President has created. As the lead Democrat negotiator proclaimed: Under this legislation, “the border never closes.” If this bill reaches the House, it will be dead on arrival.
Prominent progressives have also rejected the viability of the bill on grounds that it eviscerates asylum. Las Americas, an immigrant rights advocacy group in El Paso, Texas, released a statement tonight that included the following bleak assessment:
“Closing the border, creating a new ‘metering’ system, and debilitating our asylum laws will do nothing to address the underlying issues that force vulnerable children and families to flee their homes, seeking safety and a better life. Although the bill contains small silver linings, they come at too high a cost. This deal will ultimately subject more families to an unsafe migratory journey. They will be forced to wait on the other side of the border for days or even weeks, which will further expose them to those who will prey upon them as they try to navigate these impossible policies.
I’ve looked for supporters and so far, the only one I can find, are the folks at the Niskanen Center who released a statement tonight praising bipartisan efforts:
We applaud the bipartisan group of Senators who have invested weeks of hard work to negotiate a border security compromise. Despite facing opposition and resistance from their parties and leaders, Senators Chris Murphy, James Lankford, and Kyrsten Sinema have continued to work towards a solution palatable to Members on both sides of the aisle while ensuring that Congress can ultimately unlock much-needed supplemental funding to aid our allies.
I’m sure we’ll see the immigration bill in the news first thing in the morning, although the coverage is likely to be mostly negative.
My suggestion is, if you read this, you’ve probably given the bill as much attention as you need to give it for now. Don’t get too excited or upset. Spend your limited emotional energy on something else, because I don’t think this is going anywhere.

The long-awaited bipartisan Senate deal on immigration contains no real reforms, such as a pathway to citizenship for undocumented immigrants. It’s all about “securing” the border.
Biden and Senate Democrats have caved to Senate Republican hardliners. Among other restrictions, the bill would make it much harder for people to apply for asylum.
On Friday evening Biden called the bill “the toughest and fairest set of reforms to secure the border we’ve ever had in our country.”
Then Biden went further — endorsing a full border shutdown. He said the bill “would give me, as President, a new emergency authority to shut down the border when it becomes overwhelmed. And if given that authority, I would use it the day I sign the bill into law.”
I very much doubt Biden would shut the border if he signs this bill into law.
So what’s going on here? The underlying politics here has nothing to do with funding Ukraine. It doesn’t have to do with reforming immigration. It doesn’t even have much to do with the practical challenge of securing the border.
It has everything to do with the 2024 election, in which border security has become a big issue.
The nation does have to take reasonable action to stem the illegal flow of immigrants. But Trump has stoked American’s fears with lies (see below).
Trump and Biden are engaged in a giant pre-election kabuki fight over the border.
Biden wants to take the border issue away from Trump and figures this bill will do it. Which is exactly why Trump doesn’t want the bill enacted. “As the leader of our party, there is zero chance I will support this horrible, open-borders betrayal of America,” Trump said on Saturday. “It’s not going to happen, and I’ll fight it all the way.”
Trump says he welcomes criticism from GOP senators. “Please, blame it on me. Please, because they were getting ready to pass a very bad bill.”
House Speaker Mike Johnson, Trump’s lapdog-in-chief, says the bill is “dead on arrival” in the House. Besides, he now says, it isn’t needed because Biden already has all the authority he needs to close the border.
Um … just last year, Johnson argued that Congress must tighten immigration laws to strengthen the president’s hand. When he was president, Trump sought similar additional authority from Congress.
Meanwhile, House Republicans are about to begin impeachment proceedings against Alejandro Mayorkas, homeland security secretary, for allegedly being too soft on border security — even though Mayorkas worked with Senate Republicans to come up with this hardline border deal.
We need to deal with the border, but Republicans are now the ones sitting on their hands because they’re beholden to Trump. We also need to deal with immigration in a humane way by offering a broad and reasonable path to citizenship, but Democrats seem to have forgotten this basic goal.
The public, meanwhile, is utterly confused by Trump’s demagoguing. Here are Trump’s biggest lies, followed by the truth.
Trump claims Biden doesn’t want to stem illegal immigration and has created an “open border.”
Rubbish. Since he took office, Biden has consistently asked for additional funding for border control.
Republicans have just as consistently refused. They’ve voted to cut Customs and Border Protection funding in spending bills and blocked passage of Biden’s $106 billion national security supplemental that includes border funding.
Trump blames the drug crisis on illegal immigration.
Trump claims that undocumented immigrants are terrorists.
Baloney. America’s southern border has not been an entry point for terrorists. For almost a half-century, no American has been killed or injured in a terrorist attack in the United States that involved someone who crossed the border illegally.
Trump says undocumented immigrants are stealing American jobs.
Nonsense. Evidence shows immigrants are not taking jobs that American workers want. The surge across the border is not increasing unemployment. Far from it: Unemployment has been below 4 percent for roughly two years, far lower than the long-term average rate of 5.71 percent. It’s now 3.7 percent.
Trump claims undocumented immigrants are responsible for more crime in America.
More BS. In fact, a 2020 study by the Proceedings of the National Academy of Sciences, cited by the Department of Justice, showed that undocumented immigrants have “substantially” lower crime rates than native-born citizens and legal immigrants. Despite the recent surge in illegal immigration, America’s homicide rate has fallen nearly 13 percent since 2022 — the largest decrease on record. Local law enforcement agencies are also reporting drops in violent crime.
Since he entered politics, Donald Trump has fanned nativist fears and bigotry.
Now he’s moving into full-throttled neofascism, using the actual language of Hitler to attack immigrants — charging that undocumented immigrants are “poisoning the blood of our country” and saying they’re “like a military invasion. Drugs, criminals, gang members and terrorists are pouring into our country at record levels. We’ve never seen anything like it. They’re taking over our cities.” He promises to use the U.S. military to round up undocumented immigrants and put them into “camps.”
The parallels with Nazi Germany are chilling. In 1932, the canny Nazi propagandist Joseph Goebbels called for “a thick wall around Germany,” to protect against immigrants. “Certainly we want to build a wall, a protective wall.”
Trump and his enablers want us to forget that almost all of us are the descendants of immigrants who fled persecution, or were brought to America under duress, or simply sought better lives for themselves and their descendants.
Immigration has been good for America. As the median age of Americans continues to rise, we’ll need more young people from around the world.
The central question shouldn’t be how to secure our borders. It should be how to create an orderly and humane path to citizenship.

Lost in the overheated and too often misleading media hype of this issue is a simple truth: Congress and Administrations of both parties have failed to fulfill our Government’s duties under international and domestic laws (which are based on international requirements) to establish a fair, generous, expert, timely asylum adjudication system — one that complies with due process and actually gives asylum applicants the required “benefit of the doubt.”
Now, in a show of supreme political cowardice, egged on by the White Nationalist right and their lies, politicos of both parties and in all three branches of Government seek to cover up their failure by punishing and endangering the lives of their victims! The latter are legal asylum seekers — human beings — who overwhelmingly present themselves to authorities at the border in an orderly fashion to get a fair adjudication of their claims. Our Government routinely denies them that fundamental right through ridiculous delays, bad precedents, poor quality adjudications, underfunding, deficient leadership, and coercive gimmicks like bogus prosecutions, imprisonment, denial of access to counsel, and illegal and immoral family separation.
Meanwhile, Dems are failing to stand up for the human and legal right to seek asylum, which is being violated right and left and which the “Senate compromise” promises even more scofflaw violations of human rights and basic human dignity.
We can diminish ourselves as a nation, but it won’t stop human migration — particularly forced migration!
On Friday, President Biden put out a statement that had President Ronald Reagan rolling in his grave and Lady Liberty weeping on the New York harbor. He led not with the values of an Irish Catholic whose ancestors emigrated to Seneca Falls, but rather a tyrant who he defeated in 2020: “[The bipartisan bill] would give me, as President, a new emergency authority to shut the border down when it becomes overwhelmed. And if given that authority, I would use it the day I sign the bill into law.”
Biden’s close cadre of advisors, just like the emperor’s tailors, convinced him he should not drape his posture with the ethos and promise of a nation of immigrants, but rather nakedly and shamelessly attempt to scare people with a “tough act.”
As an unwavering Democrat, I have never felt more ashamed to call President Biden my president. That statement was absolutely heart-breaking and goes against everything we stand as a party and country. I refuse to be a bystander in the crowd watching the naked emperor as his tailors wager this deal and statement a political win.
First, let’s start with the so-called bipartisan deal. Let’s call it for what it is: a concession of Trump-era policies in exchange for foreign aid. Yes, Ukraine is important. And yes, addressing the U.S. southern border is equally as important. But none of these two issues should have ever been tied together. But here we are. And since we’re here, what we know through reports and statements by President Biden and Senator Lankford is that the new expulsion authority and other measures in the bill would not only exacerbate the situation at the border – not actually stop people from fleeing dangerous conditions and coming to the border – but also jeopardize the lives of vulnerable children and families while setting a point-of-no-return precedent that will give Trump the keys to Pandora’s box should he be re-elected.
So who is Biden winning over with the promise of shutting the border down? Independents? Democrats? This logic is based on the theory that being equally as “tough” as Republicans is a winning strategy. Trying to out-Republican the Republican on immigration is the most asinine tactic that does nothing to galvanize the base or win over swing voters. And I get it – many pollsters and Democratic operatives are quick to show that their tough messages resonate with swing or moderate voters. It’s easy to come to that conclusion when you’ve probably gone head to head with weak “progressive” messages and dismiss how it demoralizes the base. Here’s a real life example of what happens when you actually try it on for size: check out the muted reaction Biden received when he reiterated he would shut the border down in a speech to Democrats and others.
We’ve got two major problems that Biden’s close advisors are ignoring: bad policies and bad messaging. But I’m going to focus on messaging solutions as it will take big electoral wins and a public narrative shift to deliver a major immigration overhaul in Congress, which is what we really need to address the issue in the 21st century.
Follow the formula: (1) tap into voters’ nostalgia and shared values reminding them what immigration means to them personally and the country (think Reagan’s last speech); (2) pivot to galvanizing, simple and sensible solutions (path to citizenship, orderly and humane border security, smart technology and resources, lawful pathways for those seeking refuge and to meet America’s economic demands, etc.); and (3) directly contrast against Trump and Republicans (define them on the issue as cruel (family separation), impractical (wasteful border wall) and/or unwilling to deal in bipartisan fashion).
Use Trump and Gov. Abbott as your foils. They are gifts to President Biden, his campaign and Democrats in general. These two maniacs, one of whom is openly defying the U.S. Supreme Court ruling, are standing on the wrong side of history, willing to have blood on their hands and soil the values and image of America. This is Biden’s JFK moment who with dignity and courage challenged Governor Wallace even when public sentiment was divided. Bottom line – when you honor our founding principles of freedom, opportunity and the pursuit of happiness and stand up to tyrants, you always end up on the right side of history.
Saturate: repeat, repeat, and repeat the formula in remarks, online, ads and other forms of paid communications. Trump and the GOP are outspending and out-talking Democrats on this issue and it’s why we’re starting at a deficit on the issue.
The promise and action to deliver boldly and big. Immigration will always be a challenge if Biden doesn’t start laying the groundwork and ensure creative and courageous solutions such as (1) offering a path to legal status, within his authority, to Dreamers and long-settled immigrant families in the U.S. and (2) publicly working with willing governors and mayors across the country who either need the federal government’s help or are eager to welcome new immigrants who will invigorate their towns and cities and fill labor shortages. The Biden administration needs to go on offense, publicly and loudly.
Latinos and other mixed-status families are getting a bit exasperated with waiting for a path to citizenship. Biden needs to remind them that he hasn’t forgotten them. And instead of avoiding what’s happening in Democratic-led cities, Biden should embrace it as an opportunity for more bipartisanship and creative problem-solving that’ll meet the demands of cities and states in need of workers and consumers, such as Erie, PA and Utah. It’s a chance to talk “economy” and solutions – Americans love solutions!
It’s never too late to rectify the course. Biden and his tailors need to begin sewing back the fabric that’ll bring together his coalition of progressives, moderates and all those who do not want Trump and MAGA Republicans to return to office.

If you are still having trouble with the concept, I’ll translate for you: “Yes, we understand and agree that Russia cannot be allowed to take over Ukraine, and we will fund aid to Ukraine, but in exchange, we insist on fundamental changes to our immigration laws to make sure no more Brown people come to America, starting right effing now.” (“Brown,” in this context, means anyone who is poor, Latin American, Asian, African, non-Anglophone…you get the idea.)
How will this play out in the next few weeks? I see three options: 1) Biden and the Dems cave, so the 1980 Refugee Act is scrapped, Dreamers get deported, the southern border is further militarized, and the economy tanks because a good chunk of the workforce is afraid to come to work; or 2) the GOP does a Tuberville and caves; or 3) the Unknown Unknown.

Thanks for telling it like it is, Dan! There is no validity to the GOP’s attempt to punish asylum seekers by unconscionably returning them to danger and death with no process.
The cruelty and threat to life from forcing desperate seekers to wait in dangerous conditions in Mexico, pushing them to attempt entry in ever more deadly locations along the border, detaining them in inhumane substandard prisons in the U.S., and or returning them without meaningful screening by qualified independent decision-makers is overwhelming. That Congress, the Administration, and much of the “mainstream media” choose to ignore, and often intentionally misrepresent, truth and reality about the horrible human and fiscal wastefulness of “border deterrence” doesn’t change these facts!
The Administration’s three year failure to build a functional, robust asylum system at the border with humane reception centers, access to legal assistance, a rational resettlement system, and sweeping, readily achievable, administrative reforms and leadership changes at EOIR and the Asylum Office (as laid out by experts, whose views were dismissed) is also inexcusable.
Yet, the media misrepresents this farce as a “debate.” It’s a false “debate” in which neither disingenuous “side” speaks for the endangered humans whose rights and lives they are bargaining away to mask their own failures and immorality.
The stories of child migrant laborers are harrowing. They take on late-night, early-morning or 12-hour shifts that keep them out of school. They work on farms, at garment and food manufacturing factories as well as meat and processing plants, in construction and sawmills — often dangerous jobs with few protections.
Despite media portrayals of this system as a new economy, historian Ivón Padilla-Rodríguez has documented that the success of industries such as agriculture, manufacturing and construction in the Southwest relied on child labor as far back as the early 20th century. My dad arrived in Los Angeles from El Salvador as a 17-year-old in the 1970s. He immediately became a garment worker in denim factories across downtown Los Angeles and later installed carpet for a man who refused to pay him.
Los Angeles remains a center for this problem. My research studies the lives of undocumented young adults who arrived in the U.S. as unaccompanied minors from 2003 through 2013 and now live in L.A. I’ve spoken to children who have worked in garment factories that sew clothes for companies including Forever 21, J. Crew and Old Navy. Others worked in hotels such as the Ritz Carlton downtown or cleaned the homes of the rich and famous as live-in domestic workers.
Given my research focus, I often get asked what the government is doing about this child labor epidemic and what regular people can do about it. My response: It depends how far you want to go.
Perhaps counterintuitively to many Americans, part of the equation is paying attention to these youth before they cross our border by granting them what anthropologist Lauren Heidbrink and other scholars identify as “el derecho a no migrar” — the right not to migrate.
Young people need alternatives to migration to make a living. That shouldn’t mean aiding foreign governments in deporting migrants, as the Biden administration recently pledged to aid Panama’s government. It should mean investing in community-based programming to integrate children into their home society, such as Colectivo Vida Digna in Guatemala, which aims to reduce youth migration by supporting Indigenous teens and their families in reclaiming Indigenous cultural practices and strengthening communities so they can build futures without leaving their home country.
Even with those programs, some children will migrate to the U.S. and need shielding from exploitation. That may sound uncontroversial in theory, but the current policy landscape shows little willingness to widen the social safety net in practice, even for children and youth.
Take, for example, that last month a federal judge ruled illegal, but declined to end, Deferred Action for Childhood Arrivals, a program implemented by executive order in 2012 that offers work authorization and a stay on deportation for undocumented youth brought to the U.S. as children. Courts have debated the policy for more than a decade, and with the Supreme Court expected to review the policy a third time, even these longtime U.S. residents — once touted by President Obama as “talented, driven, patriotic young people” — are left in limbo.
Then there’s the immigration program meant to provide vulnerable immigrant children a path to lawful residence and citizenship: the Special Immigrant Juvenile Status designation created in 1990. A recent report found that it has produced “avoidable delays, inconsistent denial rates, and a growing backlog” of petitioners, putting unaccompanied youth’s lives “on hold” and leaving them vulnerable to exploitation and abuse.
All the while, states across the U.S. are actively moving to weaken child labor laws for all children, immigrants or not.
Children’s futures are under threat in the U.S., and stalled immigration policy is a culprit. Protecting children and child workers requires moving forward on immigration. Failing to do so may haunt us for generations to come.

The figures in the Oct. 20 news article “Child labor violations soar in FY 2023” were staggering and all too familiar in my work with unaccompanied children, who are particularly vulnerable to exploitative labor conditions. Overnight shifts operating heavy machinery at slaughterhouses are not jobs or roles for any child.
To prevent this exploitation of unaccompanied children, we need to ensure existing laws are enforced, including child labor standards put forth by the Labor Department. Additionally, the Department of Health and Human Services should work toward ensuring every unaccompanied child is provided legal counsel as set out in the Fair Day in Court for Kids Act, recently introduced by Sen. Mazie Hirono (D-Hawaii).
As we’ve seen from experience, a lawyer can be one of the few trusted adults in the life of a child who is experiencing exploitation. Attorneys help unaccompanied children understand their rights against abuse and access a fair chance to make their case for U.S. protection, which can lead to the ability to apply for legal and safe employment. Most unaccompanied children do not have this elemental protection.

A federal judge for the second time found the DACA program unlawful, but held back from ordering the deportation of the nearly 600,000 people who remain in the country as “Dreamers.”
The Deferred Action for Childhood Arrivals program, first crafted with a 2012 memo under the Obama administration, was likewise found unlawful by federal District Court Judge Andrew Hanen in a similar ruling in 2021.
“While sympathetic to the predicament of DACA recipients and their families, this Court has expressed its concerns about the legality of the program for some time,” Hanen wrote in the 40-page ruling.
“The solution for these deficiencies lies with the legislature, not the executive or judicial branches. Congress, for any number of reasons, has decided not to pass DACA-like legislation.”
Given earlier challenges to the DACA program’s creation through a memo, the Department of Homeland Security (DHS) in 2022 underwent formal rulemaking to solidify the basis for the program.
But Hanen found while the government followed the law in undergoing notice and comment rulemaking, the new rule essentially carried the 2012 memo into a formal rule without addressing prior issues criticized by the court.
Last year the Fifth Circuit Court of Appeals, before remanding the case to Hanen, found broader issues with DACA, saying the policy was inconsistent with immigration processes laid out under the Immigration and Nationality Act.
Hanen pointed to that in his Wednesday ruling, noting that while the record underlying the new rule showed DACA to be beneficial to both recipients and the U.S. “DHS did nothing to change or resolve the substantive problems found by this court or the fifth circuit.The decision earned swift backlash from immigration advocates and spurred familiar calls for Congress to act.

“Congress has failed to pass a permanent legislative solution, and it is urgent that they act now. We cannot allow court rulings to continue to upend the lives of hundreds of thousands of immigrant youth whose home is here.”
The ruling comes months after a coalition of nine GOP-led states asked Hanen to end the federal program, referring to the program as “unlawful” and “unconstitutional.”

There are not a lot of big wins for Viridiana Chabolla ’13 in her line of work. It’s not for a lack of trying, or a lack of sweat and tears. Her commitment has been tested over the years but she remains determined. Chabolla is an attorney working in immigration law. The landscape is grim, she says. It can be heartbreaking. Demoralizing. She’s not just an attorney. She is an immigrant, too, and for most of her life she was undocumented.
In February, the Los Angeles Times wrote a story about one of her recent clients. Leonel Contreras, a U.S. Army veteran, was a legal permanent resident before being deported to Mexico after serving time for a nonviolent crime. Contreras had grown up in the U.S., but after his deportation he worked and lived in Tijuana for at least a decade before the Immigrant Defenders Law Center in Los Angeles took his case and Chabolla helped him return to his family members in California. He became a U.S. citizen earlier this year.
“It’s really nice to wave an American flag at a naturalization ceremony,” says Chabolla, who began working at the Immigrant Defenders Law Center (ImmDef) in October 2021. “Immigration law is so harsh and when it’s not harsh, it’s just not helpful. It’s hard to have a win. When you have those moments, you have to grab on and make them last.”
Chabolla was born in Guanajuato, Mexico. Her mother came to the U.S. to escape a bad relationship and start a new life. A 2-year-old Chabolla and the rest of her mother’s family joined her soon after. Chabolla grew up with her grandparents, aunts and cousins all living close to each other in East Los Angeles. “I’d remember seeing my mom and aunts getting ready for work at ridiculous hours of the day,” she says of the early-morning hubbub. “I remember always being surrounded by people and conversations. There were a lot of disagreements but a lot of love.”
When she was 11, Chabolla met a group of lawyers who worked in East L.A. Although she didn’t know what exactly they did, she recalls thinking that they seemed to hold a lot of power. They seemed to have some kind of authority to help her and others like her—people who were not born in the U.S.
It was during Chabolla’s junior year at Pomona that the Obama administration established an immigration policy that changed her life. Deferred Action for Childhood Arrivals (DACA) allowed certain immigrants who were brought to the U.S. as children to receive a renewable two-year period of deferred action from deportation and also become eligible for a work permit.
For the first time, Chabolla was able to have a job on campus. She saved her first pay stub. It wasn’t much in terms of money, but it was significant for Chabolla.
With DACA, Chabolla’s future seemed a bit brighter. She could now apply for jobs after graduation. Her first work after Pomona was as an organizer with the pro bono legal services nonprofit Public Counsel, a choice that set her on a course for a win of historic proportions.
For four years, Chabolla took down the stories of plaintiffs for cases being handled by Public Counsel. As time passed, she began to feel more empowered to share her immigration status with her director, Mark Rosenbaum, even as the national political landscape was transitioning from an Obama presidency to a Trump one.
“When Trump was elected, I broke down,” she says. She remembers Rosenbaum calling her to tell her she didn’t have to go to work the next day: “Go be with your family, go through your emotions,” he told her.
“We didn’t know what Trump would do first. We just hit the ground running,” says Chabolla, who worked on the defense case for Daniel Ramirez Medina, the first person to have his DACA permit taken away. “With everything going on, we focused on putting out fires. Trump wasn’t taking out DACA in one go just yet. He was creating all of this panic everywhere first.”
Her time at Public Counsel rekindled Chabolla’s original interest in law.
“I kept thinking of the best way I could help others. I loved the idea of gaining new knowledge, and a degree in law would allow me to have a sense of power,” she says. The attorneys at Public Counsel, like her boss Rosenbaum, not only practiced law and led big cases but they also wrote articles and taught university-level courses.
In September of 2017, the Trump administration announced it was officially rescinding DACA. Chabolla had just started at the UC Irvine School of Law. Her initial response was to focus on school and wait.
Then Chabolla got a call from Rosenbaum. “He called me to be a plaintiff in a case against the United States. I felt terrified.”
Chabolla phoned her mother and her family. “If I shared my story, I would have to share their story,” she says. She also was married by then and discussed the possible ramifications with her husband.
Her family was supportive. Chabolla felt compelled to help.
The Public Counsel lawsuit led by Rosenbaum was filed as Garcia v. United States. As it made its way through the higher courts, it was merged with four other cases and ultimately became known as Department of Homeland Security v. Regents of the University of California by the time it reached the U.S. Supreme Court.
As a plaintiff in the case, Chabolla shared her story with a lawyer for a written declaration. While she never testified before any judges, she did have to share her immigration story multiple times as the case garnered national media attention.
On June 18, 2020, the Supreme Court delivered its 5-4 decision blocking the Trump administration’s elimination of DACA. Chabolla was in Washington for the hearing. “A few of us got to go inside,” she recalls. “Some DACA students were there, too. And it was really powerful. These justices were hearing arguments on this huge case…but I know maybe for them all cases they hear are huge. But we occupied half the room and that was really powerful and really unusual.”
Chabolla took notes during the hearing. “I remember writing down something that Justice [Sonia] Sotomayor said: ‘This is not about the law; this is about our choice to destroy lives.’
“So much of what Trump did was done without following administrative law,” explains Chabolla about how they “won” this case. “Trump didn’t follow procedure,” she says. “If they had taken their time and done it right, it would have passed. But I remember taking the win.”
Chabolla, who had just recently become a U.S. resident through marriage, remembers feeling relief for the DACA community.
“The DACA victory in the Supreme Court is a testament to the vision, commitment and tireless efforts of many, and Viri’s name would surely be at the top of that list,” says Rosenbaum. “I had the privilege of working with Viri at Public Counsel, first as an organizer…and then to come forward as a plaintiff in Garcia to inspire others to do the same and make the case that our nation needs DACA recipients to build a kinder and more inclusive community for all of us.”
Upon returning home, Chabolla once again focused on school—it was her second-to-last semester at UC Irvine. She spent a year as a graduate legal assistant with the Office of the Attorney General for the California Department of Justice. It was a tough gig for a newly graduated lawyer. After one year, she left for her current job as a staff attorney at ImmDef, a legal services nonprofit with a post-conviction unit that drew her interest. “They take on clients who have criminal convictions like possession of marijuana from 40 years ago with deportation orders—deportation is not a fair punishment for everyone.
“Many of our clients have been living here as legal permanent residents for more than 20 years. Most find out they’re getting deported just when they’re going to be released,” she says. “The statistics show that immigrants commit fewer crimes than the general population and our clients have already served their time—in jail, or prison, they’ve paid their dues and they’ve even paid their fines. Adding deportation is a way of saying ‘I don’t like that you’re an immigrant.’ It’s extra punishment.”
The work is tough. “My supervisor has shared that sometimes we have to redefine what a win is,” says Chabolla. “It makes up partially for the times when we have a clinic and all these people show up thinking they can apply for residency when they actually can’t.”
She says that the immigrants she talks to are so full of hope. They believe that an attorney—like herself—can do it all. “Every situation is different. No lawyer has a miracle cure.
“It’s heartbreaking to know how many people are becoming elders who don’t have a nest egg, who paid taxes into the system but they can’t access Social Security, can’t access Medicare,” Chabolla adds. “It’s something I’ve been thinking a lot about in the past two years: How can I help aside from placing my hopes in a Congress that is more concerned about building borders than dealing with these issues?”
In 2021, Chabolla became a U.S. citizen. The day was bittersweet and laden with guilt. “It was one of those moments where I felt I was further abandoning my undocumented community, but I know that’s not true,” she says. Although her mother recently became a U.S. resident, some of her family remains undocumented.
Chabolla says she’s been able to find some balance as an ally who was once directly impacted by immigration policies. “I’m trying to find a place where I can remain hopeful in my job and be a zealous lawyer and advocate.”

For years, the GOP has been mindlessly blocking various versions of DACA, at a great human cost as well as a huge cost to our nation. Dreamers who are able to achieve citizenship, without special help from Congress, and other “New Generation” members of the NDPA must follow the lead of Rep. Hillary Scholten (D-MI) by getting into the “power structure” and forcing long overdue progressive changes.
Thanks to Chief Justice Roberts, the Supremes got this one right, barely 5-4. One vote has made a huge difference in literally hundreds of thousands of lives, and helped to shape American’s future for the better. By contrast, the Trump Administration’s failed attempts to undo this important program was a disgraceful abuse of Government resources! The inability of GOP-controlled states to let this issue go — essentially too keep bullying and threatening some of the most productive and deserving members of our society — is beyond disgusting.

Thanks Craig for speaking truth when so many are spreading false information and advocating trading human rights that aren’t ours to give away for “benefits” that should be conferred on their own merits with no “strings attached.”
Unhappily, even the normally reliable and sensible Greg Sargent @ WashPost is spouting some of this absolute nonsense! He speaks of indefinitely extending massive violations of legal and human rights (“Title 42”), prisons for asylum seekers (“processing centers”), and expedited dockets (“deportation railroads without due process”) as if they are “OK trade-offs” for so-called “immigration reform.”
Notably, there is nothing now stopping the Administration from processing more refugees outside the U.S., providing grants to innovative organizations like “VIISTA Villanova” for training more qualified pro bono asylum representatives without having to rely exclusively on law schools, replacing poorly qualified Asylum Officers and Immigration Judges with asylum and human rights experts, appointing a new expert BIA qualified to establish affirmative precedents to guide Asylum Officers, IJs, and lawyers on both sides in how to recognize, document, and grant asylum in accordance with the generous intent of the law and the U.N. Convention on which it is based, providing grants to NGOs for systemic resettlement of asylees and applicants away from the border, targeting and prosecutinghuman smugglers, and expeditiously removing those arriving at or near the border who can’t establish a “credible fear” of persecution.
That the Administration has failed to bring in the necessary visionary, dynamic, competent leadership to accomplish any of the foregoing, and thata Dem-controlled Congress has failed in its oversight responsibilities and to push the Administration to fulfill its legal obligations to asylum seekers is a question of competence and will, NOT the fault of asylum seekers and their advocates. Nor is it a basis to reduce the already unfairly and illegally compromised rights of asylum seekers

I dissent.
I was outraged when I read in this morning’s Washington Post about the horrible “Sinema/Tillis misnamed immigration compromise” (actually a “sellout”) being negotiated during the lame duck session of Congress. In short, that proposal apparently would trade long overdue protection for “Dreamers” for the rights and lives of refugees and asylum seekers.
Incredibly, in the face of U.S. District Judge Emmet Sullivan’s findings that the intentional illegal use of Title 42 had resulted in countless clear violations of the legal rights of asylum seekers, subjecting them to a litany of horrors and abuses that he described as “dire harm,” these legislators would extend those abuses for an indefinite period! That’s notwithstanding evidence not only of the irreparable harm that Title 42 has caused, but also the rather obvious fact that once we “normalize” those abuses, they will never end.
There will always be another fabricated reason for extending the Title 42 charade. Indeed, once we start mischaracterizing abuse as “law,” we can’t even call it “abuse” and hold the abusers accountable! That’s all part of the dehumanizing or “Dred Scottification” process!
Additionally, in the place of a functioning working asylum and refugee system, the proposal would eventually substitute so called “processing centers” and “expedited procedures” to railroad asylum seekers out of the country without due process. And, it wouldn’t address the total dysfunction and denial of due process in our Immigration “Courts” by enacting another long overdue provision: the “Lofgren Article I Immigration court bill!” What a farce!
Let’s be clear about what’s happening here! The legal and human rights of refugees and asylum seekers are not “ours” to trade away for relief for another deserving group that has long been irrationally denied! “Processing centers” are a euphemism for “immigration prisons” — part of the “New American Gulag.” “Expedited processing” is a euphemism for “railroading.” Both detention and artificially expediting dockets have been proven to be ineffective and unjust, over and over. Yet, here we go again!
My outrage turned to shock and dismay when I learned that some erstwhile defenders of due process, human rights, and racial justice for asylum seekers (incredibly) thought that this type of immoral compromise was a “good idea!” Not me!
Restrictionist/nativist Dems masquerading as “moderates” are a huge problem. They play right into the GOP’s hands.
When committing crimes against humanity or giving away refugees’ rights becomes a “strategy,” “option,” or “bargaining chip,” we’re lost as a nation. And, that’s exactly where we’re heading with horrible, immoral proposals like this.
Human rights and due process are non-negotiable! And, I guarantee that extending Title 42, building additional Gulag (rather than making the existing legal asylum and refugee systems work), and railroading asylum seekers will empower smugglers and lead to further growth of our underground population.
Human migration won’t be stopped by ineffective and immoral “deterrence.” And, although many hate the idea, refugees basically “self-select” and are driven by forces beyond our immediate control.
Refugees are, by definition, folks who can’t return! So, there is no reason to believe that true refugees (of which there are many) are going to be “deterred.” They might be “incentivized” to seek refuge in particular, relatively safe, places; but, nobody seems interested in a “carrot” approach — even though the “stick approach” has failed and continues to do so!
Look at the folks who continue to die in vessels in the Mediterranean even though they are fully aware that they are unwanted and that the EU will stop at no cruelty to keep them out.
And, examine the wealth of documentation that folks forced to “remain in Mexico” — and apply under what we know to be a corrupt and inadequate system — are systematically abused and exploited.
This time, we’re not just “pushing the St. Louis out to sea.” We’re torpedoing her and watching the passengers drown. And Dems are a huge part of the problem!
Other (soon to be former) progressive Democrats might choose to “go along to get along” with heaping additional abuses on largely defenseless refugees and asylum seekers. But, not me! I dissent!
Many immigration issues are divisive. Protecting dreamers is not. Virtually every poll conducted on the subject finds that Americans of all political persuasions favor granting dreamers some form of permanent legal status, including a path to citizenship. Even Trumpers are on board, surveys show. Faith groups, law enforcement officials, employers, national security experts and other major constituencies besides typical bleeding-heart immigration advocates have urged Congress repeatedly to grant these young immigrants greater legal certainty.
Unfortunately — as is the case on so many issues — Congress has abdicated its responsibility to act. Instead, the executive branch has been tasked with devising temporary workarounds.
In 2012, the Obama administration announced a sort of Band-Aid solution, known as the Deferred Action for Childhood Arrivals (DACA) program. DACA offers some of these young immigrants access to (temporary) work permits and protections from deportation, which must be frequently renewed. Eligibility extends only to those who meet certain age and educational requirements, have lived here continuously since 2007 and pose no threat to public safety, among other conditions.
This program was generally expected to be a stopgap while Congress worked on broader immigration reforms or at least a pathway to citizenship for dreamers; so far, neither has materialized.

In the decade since it was introduced, DACA has weathered multiple legal challenges — including from a coalition of red states led by Texas, as well as attempted repeal by President Donald Trump. For now, the program remains mostly intact while the red-state challenge wends its way through the courts. But DACA’s days look numbered.

This is hardly the only immigration issue on which Republican politicians have complained about executive overreach yet been reluctant to exercise their own powers. Other vulnerable, sympathetic populations of immigrants — such as the Afghan allies who were temporarily “paroled” into the United States — are stuck in their own legal limbo unless and until Congress acts.
But it’s always easier for politicians to grandstand over everyone else’s immigration policy choices than to produce solutions of their own.

How stupid and cruel is the GOP’s assault on Dreamers? It’s not like most “Dreamers” are going anywhere. After all, there are already about 2 million individuals (not to mention family members, employers, etc.) backed up on Garland’s dysfunctional Immigration Courts. And, under Garland’s misguided leadership, more judges are actually building more backlog!
But, without DACA’s work authorization, those not eligible for other forms of relief (e.g., asylum, cancellation of removal) will lose their authorization to work. Since many are in critical or essential jobs with employers who can’t afford to be out of compliance with Federal laws, it’s reasonable to assume that Dreamers would lose those jobs. That means that many will have to take lesser jobs in the substantial “underground economy” operating in the U.S., largely as a result of the GOP’s obstinance on sensible immigration policy.
If that appears stupid, it’s because it is! But, what else is new with the GOP’s cruel, xenophobic, and unrealistic approach to immigration.
It’s remarkable that out of touch righty judges on the 5th Circuit, whose jobs and existence actually depend on the systemic non-prosecution of most Federal offenses, would actually have the gall to issue their off the wall ruling dumping on Dreamers! In reality, by necessity, only a small number of violations of Federal statutes are prosecuted. See. e,g., https://prisonprofessors.com/federal-crimes-to-prosecute-or-not/.
The Fifth Circuit’s “off the wall” apparent theory that Federal officials lack discretion to redirect prosecution resources toward the most serious offenders is pure “Federalist Society political poppycock!” It’s particularly out of bounds to critique the Feds for taking steps to insure that such discretion is exercised uniformly and reasonably, rather than arbitrarily and capriciously.
I had lots of experience with “PD” programs over four decades in Federal service. The DACA program is far and away the premier “model” program for the effective and rational exercise of PD.

DHS Announces Extension of Temporary Protected Status for Venezuela
DHS: The 18-month extension of TPS for Venezuela will be effective from September 10, 2022, through March 10, 2024. Only beneficiaries under Venezuela’s existing designation, and who were already residing in the United States as of March 8, 2021, are eligible to re-register for TPS under this extension.
WaPo: Texas Gov. Greg Abbott ordered state National Guard soldiers and law enforcement officers Thursday to apprehend and return migrants suspected of crossing illegally back to the U.S.-Mexico border, testing how far his state can go in trying to enforce immigration law — a federal responsibility.
LATimes: The new effort, called the Trusted Adult Relative Program, is being tested at a Border Patrol station in Texas, according to three sources who were not authorized to speak publicly. A Department of Homeland Security official, who spoke on the condition of anonymity, said a few dozen children have been reunified with family members since the program began in May. Agency officials said the program utilizes existing procedures to unify families in an efficient way.
Documented: ICE is moving New Jersey immigrants like Hercules Aleman – who face charges in criminal or family court – to out-of-state immigration detention facilities. But the agency is usually not notifying the group of immigration legal providers funded by the state to represent these detained immigrants.
CNN: The Biden administration asked the Supreme Court on Friday to stay a court order blocking the Department of Homeland Security from implementing immigration enforcement priorities — potentially setting up Justice Ketanji Brown Jackson’s first vote since joining the court.
Politico: The nine-month investigation, which culminated in a 511-page report by the department, found no evidence that agents used horse reins to strike people during an “unprecedented surge in migration” of about 15,000 Haitians near the international bridge. However, agents acted in unprofessional and dangerous ways, including an instance in which an agent “maneuvered his horse unsafely near a child,” investigators wrote.
TRAC: According to the latest data released by Immigration and Customs Enforcement (ICE), the agency held 23,156 immigrants in detention on July 5, 2022. Of these, 17,116 were arrested by Customs and Border Protection (CBP) while 6,040 were arrested by ICE agents. Detention numbers have increased slightly from about 20,000 in early 2022 to now hovering around 24,000, but have not otherwise seen significant growth that would lead to the large numbers of immigrants that were detained prior to the pandemic when the detained population topped out at more than 60,000.
TRAC: The number of criminal referrals sent by the Border Patrol and other Customs and Border Protection (CBP) officers have recently begun to rise. Detailed case-by-case government records obtained by TRAC after successful litigation show that during April 2022, CBP referred 2,015 individuals for criminal prosecution to federal prosecutors. This is the first time referrals topped the 2,000 mark since the pandemic began slightly more than two years ago. Levels in April 2022 were up 31 percent from one year earlier when in April 2021 there were a total of 1,537 criminal referrals from CBP.

Law360: The Fifth Circuit refused to reinstate the Biden administration’s attempt to narrow the number of immigrants prioritized for removal, splitting sharply from the Sixth Circuit to find that the effort likely violated federal immigration law.
LexisNexis: [T]he agency failed to consider and explain the impact of evidence that the Salvadoran government’s efforts in the “war on the gangs” had not been successful, such that gang members operate with impunity and security forces commit extrajudicial killings of suspected gang members, both of which pose threats to Giron.
LexisNexis: Consistent with our own precedent and that of every other circuit to consider this issue, we hold that the failure of an NTA to include time and date information does not deprive the immigration court of subject matter jurisdiction, and thus Bastide-Hernandez’s removal was not “void ab initio,” as the district court determined.
Law360: The Ninth Circuit on Friday declined to review a Mexican man’s bid to vacate a deportation order, saying he should have applied for a green card before a law preventing inadmissible individuals from becoming lawful permanent residents took effect.
LexisNexis: The BIA affirmed based upon the IJ’s adverse credibility determination. We grant Barseghyan’s petition for review because three out of four inconsistencies relied upon by the BIA are not supported by the record.
LexisNexis: [W]e find that the respondent’s conviction for injury to a child in violation of Texas Penal Code § 22.04(a)(3), does not require “physical force” as defined in 18 U.S.C. § l6(a), and interpreted in Johnson and Stokeling. Thus, the respondent has not been convicted of a crime of violence aggravated felony and is not barred from establishing her eligibility for cancellation of removal.
Law360: Private contractors will no longer be used by U.S. Immigration and Customs Enforcement to make immigration arrests at California jails and prisons, as part of a settlement ICE reached with a detainee represented by the American Civil Liberties Union.
Law360: A 15-year U.S. Department of Homeland Security veteran and an agent who retired from the agency gave secret information to Chinese spies engaged in a harassment and repression campaign against U.S.-based critics of the Chinese government, the U.S. Department of Justice said Thursday.
AILA: The CIS Ombudsman’s Office provides a reminder that USCIS updated the special instructions on its Form I-130, Petition for Alien Relative page to help filers ensure that USCIS sends their form to the correct location after it is approved.

Federal Courts at all levels continue to lose credibility because of their adherence to a biased far-right agenda that is bad for American democracy.
Let’s see, the BIA manufactures inconsistencies to reach a bogus “adverse credibility” ruling in an asylum case(9th Cir.). They also ignore clear evidence of the complicity/total ineptitude of the Salvadoran Government in a CAT case (2d Cir.).
Folks, these aren’t contract cases, property disputes, commercial squabbles, or minor misdemeanors. They are life or death matters — persecution and/or torture can result in extreme pain, suffering, permanent damage, and death.Serious matters require serious judging by qualified exert judges!
Meanwhile, a righty panel of poorly qualified 5th Circuitjudges drives over established law on Executive prosecutorial discretion to uphold Trump toady Judge Drew Tipton’s clearly wrong-headed attempt to wrest control of ICE enforcement away from the Biden Administration. This gross judicial malpractice is nothing short of a national disgrace that impugns the integrity of the entire Article III Judiciary.
There are still far too many examples of how Garland is contributing to the problem by failing to root out the deadwood (and worse) at EOIR. He should be bringing in new judicial talent committed to due process, scholarship, and best practices.
A “Better EOIR” would not only begin fixing many of the legal and practical problems plaguing our immigration, human rights, and racial justice systems in America, but also could “model” a better American judiciary for the future. It would be a training ground for future, better qualified, Article III judicial appointments: Folks who actually understand and respect delivering justice at the “retail level” and are committed to serving humanity, not kowtowing to party bosses or wooden, perverse, retrograde ideologies.
It is possible for good judges to solve problems rather than creating them or making them infinitely worse. But, you sure wouldn’t say that is happening with today’s out of touch, ivory tower, and poorly performing Federal Judiciary. A better EOIR could keep cases out of the Circuits, thereby eliminating the opportunity for right-wing ideologues to screw up immigration and human rights laws in their White nationalist restrictionist crusade!
This is a judiciary now dominated by far too many right wing judges who got their jobs by demonstrating a commitment to far righty ideology and furthering the GOP’s political agenda rather than by distinguished legal careers that exemplified courage and improving humanity by insuring fair and reasonable applications and interpretations of the law.

The entire team at Kids In Need of Defense is devastated by the news that at least 46 people were found dead in an abandoned tractor-trailer in Texas and more than a dozen others in the truck, including children, were taken to local hospitals for treatment. While we wait for more details to emerge, we wanted to share the following statement from our President, Wendy Young.
“As rising violence, natural disasters, and other threats force migrants to make impossible choices in their quest to find safety, our nation’s response cannot be to place families and children in further harm by indefinitely closing our borders to people seeking protection and ignoring the dangers they face in their home countries. This most recent tragedy and the disturbing rise in migrant deaths globally underscore the need to create safer pathways to protection for refugees. The Biden Administration should see this heartbreaking tragedy for what it is, a clarion call to abandon deeply flawed and dangerous immigration policies. It must reinstate humane and orderly processing, including reopening official ports of entry, hiring child welfare experts to care for and screen children, and provide fair adjudication of protection claims. It is time for the United States to regain its footing as a leader in the protection of migrant families and children.”

Denial rates for recent arrivals who manage to get hearings (see, e.g., Garland’s bogus “dedicated dockets,” — actually “dedicated to denial” and nothing else), many of them children and unrepresented, hover around 100%. They are “guided” by a “largely holdover,” anti-asylum BIA that lacks true asylum expertise and issues no positive precedents instructing judges on how to consistently and legally grant asylum. Consequently, there is no “fair adjudication” of asylum claims. That feeds the toxic nativist myth that nobody at the Southern Border is a “legitimate” asylum seeker.
Unless and until Garland tosses the unqualified jurists at EOIR and replaces them with experts committed to due process, fundamental fairness, and correct, generous, practical precedents and proper applications of asylum law, the system will remain in failure. It’s a monumental mistake by the Biden Administration not to fix that which they absolutely control — starting with the Immigration Courts at EOIR.
Refugees will continue to die at the hands of smugglers who were given control of our immigration system by the Trump Administration and remain empowered by Garland’s & Mayorkas’spoor performance combined with biased, White Nationalist, Federal Judges appointed by Trump at all levels of our failing justice system!
Today’s WashPost editorial described how far-right nativists have basically turned our immigration system over to smugglers:
The absence of any workable legal system that would admit migrants systematically, in numbers that would meet the U.S. labor market’s demand, is the original sin of the chaos at the border. That is Congress’s bipartisan failure, a symptom of systemic paralysis for many years. More recently, a public health rule has had the effect of incentivizing unauthorized migrants to make multiple attempts to cross the border. The rule, imposed by the Trump administration, retained for more than a year by the Biden administration, and now frozen in place by Republican judges, allows border authorities to swiftly expel migrants, but with no asylum hearings or criminal consequences for repeated attempts to cross the border. That has been a boon to migrant smuggling networks.
I take issue with the term “bipartisan failure” in the legislative context. It’s true that the Dems inexplicably squandered a golden chance to fix many immigration problems when they had 60 votes in the Senate in Obama’s first two years. But, before and after that time, the failure to achieve realistic, humane, robust legal immigration reform legislation has been on the nativist right of the GOP that now dominates the party. Pretending otherwise is useless and dishonest.
All of these proposals would have made long-overdue, common sense reforms to eliminate hopeless backlogs, benefit our economy, strengthen our legal system, and facilitate better allocation of Government resources. Yet, there has been scant GOP interest in improving the system. The GOP appears to believe that promoting a dysfunctional immigration system, denying human rights, and guaranteeing a large “extralegal population” available as scapegoats and exploitable labor best serves their parochial political interests.

The “good guys” — those committed to due process, fundamental fairness, individual rights, equal justice, scholarship, and human dignity — need to fight back at every level of our political and judicial systems — while they still exist! Because if the GOP has its way, that won’t be for long!🏴☠️

The reality is that immigration debates are often driven more by feelings than facts. And there is often disagreement about basic facts — such as how immigration has evolved over time, how successful immigrants become once they enter the United States and how they affect the communities they enter. The problem is, in part, a lack of accessible empirical evidence on the topic.
Enter “Streets of Gold: America’s Untold Story of Immigrant Success,” a book by economic historians Ran Abramitzky and Leah Boustan that seeks to set the record straight, using an economics tool kit and a treasure trove of data. Their mission is twofold. First, to offer a data-driven account of the history of American immigration. Second, to provide guidance into what research suggests about the design of immigration policy.
The book reflects an ongoing renaissance in the field of economic history fueled by technological advances — an increase in digitized records, new techniques to analyze them and the launch of platforms such as Ancestry — that are breathing new life into a range of long-standing questions about immigration. Abramitzky and Boustan are masters of this craft, and they creatively leverage the evolving data landscape to deepen our understanding of the past and present.
In contrast with the rags-to-riches mythology, a more systematic look at the data shows that low-income immigrants do not tend to catch up to nonimmigrant income levels in their lifetimes. Instead, financially successful immigrants tend to come from more privileged backgrounds. To name a few: the authors point out that the father of Tesla chief executive Elon Musk “co-owned an emerald mine.” EBay founder Pierre Omidyar’s “father is a surgeon who worked at Johns Hopkins University,” and his “mother has a PhD in linguistics.” Google co-founder Sergey Brin’s “father is a professor of mathematics,” and his “mother is a NASA scientist.” Looking at how many companies have been led by high-skilled immigrants, I wonder how much more innovation we are missing out on by not further opening our doors to the world’s talent. Yet these are hardly tales of huddled masses.
The case that lower-income and lower-education immigrants also meet with success rests on assessing not only the fates of immigrants themselves but also those of their children and their children’s children. As it turns out, Abramitzky and Boustan write, “children of poor immigrants from nearly every country in the world make it to the middle of the income distribution.” Immigrants from mainland China, Hong Kong and India do especially well.
The book debunks myths that immigrants dramatically increase crime and displace U.S.-born workers. Much of this work focuses on natural experiments in which sudden shocks to immigration levels have allowed for a better understanding of cause and effect. For instance, the authors point to the 1980 Mariel boatlift, which brought an influx of Cuban immigrants to the United States, especially to Miami, virtually overnight. The surge of low-income immigrants did not lead to large spikes in unemployment for U.S.-born workers. Low-skill immigrants have a history of taking jobs that would otherwise be unfilled or filled by machines. As companies around America were rushing to automate operations, the influx of Cuban immigrants to the Miami area slowed this process, and jobs went to people rather than to machines. Compared with the rest of the country, businesses in high-immigration areas have access to more workers and hence less incentive to invest in further automation.
This has implications for today’s immigration debates: The United States is expected to face a dramatic labor market shortage as baby boomers retire and lower birthrates over time result in fewer young people to replace them. Increased immigration is one approach to avoiding the crunch. Notably, the other way to avert this crisis is through further automation, enabled by rapid advances in artificial intelligence. Immigration policy will help shape the extent to which the economy relies on people vs. machines in the decades to come.
Immigration is, of course, about more than economic activity. Part of its beauty is the cultural richness and diversity that it brings. A multicultural society is greater than the sum of its parts. Miami is exciting not because of assimilation but because of the culture that its diverse population has created. It’s a city where you can find croquettes and Cuban coffees as easily as pizza and burgers. There is a rich history of immigrants bringing new cuisines, which are then adopted and adapted throughout the United States, a journey that can be seen in the evolution of Italian American food.
Drawing on the research, Abramitzky and Boustan weigh in on a number of hot-button policy issues: For instance, should the United States focus on encouraging high-education immigration? They conclude that “policies designed to deter less-educated immigrants from entering the United States are misguided.” Discussing the border wall, they argue that “no one wins from the border fencing policies.” And on the 1.5 million undocumented immigrants who arrived as children, they make a full-throated argument in favor of “providing work permits and a path to citizenship,” noting that “the barriers that undocumented children face are stumbling blocks of our own making.” On this last point, it is hard to disagree. Our treatment of undocumented children is a stain on our nation.
In the end, the authors offer an optimistic message: “Immigration contributes to a flourishing American society.” In a rapidly evolving world, Abramitzky and Boustan urge us to take “the long view, acknowledging that upward mobility takes time, and is sometimes measured at the pace of generations, rather than years.”

The research highlighted by this book clearly refutes the many negative myths about migrants upon which the Trump GOP’s “campaign of hate and misinformation” is based.
But, unfortunately, I wouldn’t expect truth about immigration — no matter how compelling and well-documented — to change many minds on the far right. As Luca says: “The reality is that immigration debates are often driven more by feelings than facts.” Sadly, hate, fear, racism, resentment, and intolerance are “powerful feelings.”
It’s going to take a combination of political power, courage and talent to exercise it boldly, education, and better values from the upcoming generations of younger Americans to overcome White Nationalism and its pernicious effects. I have to hope that there is time for the “long view” and our “better angels” to win the future.
