Hello friends,
As we move deeper into 2023, you may be, like we are, still
processing 2022 (or 2019, let’s be honest). For immigration, the
new year comes with its own challenges as a divided Congress
makes policy decisions difficult and a shift to the 2024 presidential
race takes hold. Nevertheless, we have to remain hopeful that
progress can still be made. And you can be part of that! To remind
yourself of what happened last year and learn what issues our
government can focus on, check out our special edition of Téa’s
Coffee where she goes to the Senate to meet New York Senator
Kirsten Gillibrand.
We hope you enjoy this issue as much as we do,

Several “quick takes” from Tea’s interview with Senator Gillibrand:

  • She has introduced an “Article I Immigration Court Bill” in the Senate and believes it’s the type of bipartisan initiative that might interest enough GOP legislators to form a “working bipartisan majority.” A similar bill introduced by Rep. Zoe Lofgren (D-CA) in the last House received a hearing and was favorably voted out of Committee, but was never taken up by the full House, see, e.g., https://lofgren.house.gov/media/press-releases/house-judiciary-committee-passes-lofgren-s-legislation-reform-us-immigration;
  • Sen. Gillibrand’s biggest fear for American democracy is “demonization and racism” of which immigrants and asylum seekers are prime targets;
  • She thinks the “biggest danger” comes from “White supremacist groups” — basically right-wing domestic terrorists.

Both Tea’s 2022 summary and the interview with Sen. Gillibrnd are well worth the watch and can be accessed at links above.

🤮🤥 “DUH” OF THE DAY: “Billy the Bigot” Barr Is An Unethical, Right-Wing Hack Who Abused His Authority @ DOJ In Service Of Trump Over America! — Durham Investigation Was “Abusive, Partisan, and Unhinged!“

Johnathan Chait @ The Intelligencer:

There is an enduring pattern in American conservatism in which the right first develops a paranoid interpretation of the liberal Establishment, and then reverse engineers its own version of the monster it has imagined. Conservatives convinced themselves that the mainstream media and universities were mere propaganda organs, then created institutions like the Heritage Foundation and Fox News, warped reflections of their own overheated critique. The January 6 insurrection was, of course, in the mind of its participants, a “response” to the imagined vote-fraud conspiracy and its antifa/BLM shock troops.

John Durham’s investigation is a classic episode in this tradition. The American right first convinced itself that Robert Mueller and the deep state, using the cover of dispassionate professionalism, had launched a partisan witch hunt to smear Donald Trump. In response, it created a right-wing mirror image, as fervently partisan and unhinged as they believed their enemies to be.

The New York Times has a deeply reported narrative showing how Durham’s counter-investigation of the Russia probe, cooked up by William Barr at Donald Trump’s urging, was just as abusive, partisan, and unhinged as Trump’s defenders made Mueller out to be.

The purpose of special counsel is to wall off a politically sensitive investigation from the attorney general. But Durham, reports the Times, was working closely with Barr behind closed doors all along. The two Republicans dined and drank together, and came to share Barr’s Fox News–brained beliefs that Trump had been the victim of a conspiracy.

Rather than preventing Barr from meddling in a politicized investigation, this arrangement inverted that purpose and laundered Barr’s involvement through Durham’s putative independence. “At some point, some particularly ill-informed critic of the administration may try to paint Durham as a right-wing hack or Republican loyalist,” wrote National Review’s Jim Geraghty in a fawning profile, singling out the NAACP’s Sherrilyn Ifill for having the temerity to suggest Durham might have been compromised by serving Trump’s ends.

Durham and Barr kept failing to prove the deep-state conspiracy they imagined, but continued to press forward anyway. At one point they seized upon hacked Russian memos that intelligence analysts deemed obviously fake, instead treating them as a valuable intelligence trove, and tried to prove it out, even harassing one of the targets to obtain his emails (which contained nothing incriminating). It weirdly reflected the Trumpist accusation that Robert Mueller had been tricked into pursuing Russian disinformation.

As Durham kept failing to find support for the conspiracy he was pursuing, and which Barr kept floating in public, his deputies chafed at his obsession. Eventually, one of them resigned in protest when he brought charges against Michael Sussmann, a target of the right. As his former lieutenants expected, Durham’s case was defeated in court.

Immigration advocates didn’t need a NY Times investigation to tell you that Barr was corrupt! Biased anti-immigrant, anti-asylum “AG precedents;” BIA “Appellate Judges” appointed for their unusually high asylum denial rates and known hostility to migrants and their attorneys; Immigration Judges appointed without expertise in immigration and human rights, overwhelmingly from the ranks of prosecutors; busting the IJ union (“NAIJ”) for speaking out against DOJ’s politicized mismanagement; issuing an EOIR “Fact Sheet” full of lies, misrepresentations, and myths; appointing politicized managers at EOIR without judicial or due process qualifications; taking ethically questionable litigating positions in Federal Court; the list of Barr’s abuses of authority on immigration and human rights goes on and on!

AG Merrick Garland has made a few ameliorative changes. Some of the worst precedents have been overruled; some unqualified political senior executives been removed or reassigned; over time, judicial selection has been shifted to a more balanced, merit-based system that has resulted in the appointment as Immigration Judges of some widely-recognized experts, with experience representing individuals, and a demonstrated commitment to due process for all; “numerical quotas” for IJs have been eliminated. (Curiously, however, Garland “honored” 17 “transition” Barr judicial selections made under badly flawed selection criteria!)

Yet, overall, EOIR remains largely the disaster zone that Barr left behind. Trump-era anti-asylum Appellate Judges continue to dominate the BIA; many Trump-era IJs still misapply basic immigration legal standards and operate “asylum free zones;” management is weak; training is inadequate; dockets are out of control; respondents and their attorneys are treated unprofessionally; quality control is largely nonexistent; wildly inconsistent “refugee roulette” asylum adjudication remains; an enforcement-skewed culture of “any reason to deny and deport” continues to infect EOIR at all levels; “numbers” are emphasized over quality and fairness; and the DOJ’s OIL often defends indefensible EOIR decisions in Federal Court on the apparent rationale that “it’s only migrants’ lives at stake, so who cares!”

Unhappily, the Biden Administration has barely “scratched the surface” of the badly needed and long overdue common sense reforms needed at EOIR and the DOJ to put the Sessions/Barr abuses behind us and move forward! Barr was a bad AG; but, his ghost continues to haunt the DOJ and those seeking equal justice for all!

🤯 DEMS’ IMMIGRATION & RACIAL JUSTICE FAILURES BEGIN WITH REFUSAL TO BRING PRACTICAL EXPERTISE, INDEPENDENT PROFESSIONAL ADMINISTRATION, & MORE REAL JUDGES COMMITTED TO DUE PROCESS, HIGHEST QUALITY, & RULE OF LAW TO EOIR! — “[A] never-ending crisis at the border can be exploited by one party, as the other expands the needlessly punitive immigration practices of the previous administration.“

JAROD FACUNDO in The American Prospect:

. . . .

All of these particularities matter, because once all available options have been exhausted, cases generally end up inside an immigration court before an immigration judge. The administrative snarls that predate a case before it arrives in immigration court are thus a result of policy from the top, for better or worse.

On paper, courts are supposed to be independent bodies. They are supposed to be immune from the political agendas of other government operatives or serve as independent mediators that can rectify previous errors.

But immigration courts are not. As a part of the Justice Department, at the end of the day, they work under the attorney general. While other courts function under a de jure practice of independence, immigration courts are held to the same standard despite not possessing the same protections that allow other judges to carry out their basic job functions. This creates an impossible work environment for immigration judges to fairly adjudicate every case with the attention it deserves. Instead, their measurements of success are based on accomplishing the president’s goals, which are translated into quotas for immigration courts. For example, Biden administration officials touted removing 1.3 million migrants last year.

As the Prospect has previously reported, immigration judges have long pointed out the tenuous environment they must work in.

But later this month, the Federal Labor Relations Authority (FLRA) will be hearing from the National Association of Immigration Judges (NAIJ) over whether or not their union will be reinstated. The FLRA will now have a majority of Biden appointees.

A dysfunctional immigration system can only start to work with independent courts. But that change can only happen through congressional action. In the meantime, a never-ending crisis at the border can be exploited by one party, as the other expands the needlessly punitive immigration practices of the previous administration.

*******************

Many thanks to prodigious immigration commentator Nolan Rappaport for passing this along to me.

There is consensus among experts that an independent Article I Immigration Court is urgently needed and long overdue. There is also a consensus that the chance of achieving this critical legislative change with a GOP-controlled House is zero. At the same time, we must remember that Dems didn’t exactly give any priority to this essential and far-reaching reform when they had “unified control” over the political branches.

There is also consensus that in the absence of Article I there are things that Garland and the Biden Administration could and should have done administratively that would have drastically improved the due process, expertise, quality, efficiency, “customer service,” and professionalism of EOIR.

Gee whiz, a Harvard Law student figured it out! They have  constructive suggestions for administrative reforms to change culture, improve training, place docket control in the hands of judges not politicos and bureaucrats, increase independence, improve quality, and insulate IJs from the political whims and enforcement agendas of each Administration. See https://wp.me/p8eeJm-8hE?

But, a Harvard Law grad, long-time Federal Judge, and Supremes’ nominee, and his band of supposedly smart and high-powered political lieutenants couldn’t or wouldn’t get it done for a Dem Administration? Gimmie a break!

A Dem Administration that was supposed to get us beyond the cruelty, White Nationalism, xenophobia, and “malicious incompetence” of the Trump Administration falls flat on its face on a critical and achievable part of immigration reform and racial justice in America! Go figure!

Meanwhile, the cries of pain keep coming from those subjected to Garland’s dystopian “courts!”

  • Had an “interesting” IH today with this IJ. [IJ] denied my motion to continue the case by email the evening before the 8:30 am hearing, even though I had four IHs scheduled in the same time slot and had filed a motion to continue a month before the hearing. [IJ] refused to grant me a few minutes to speak with OPLA counsel before the hearing to narrow issues, saying that discussion should have already taken place.  [IJ] spent an inordinate amount of time on housekeeping issues. [IJ] read a list of “rules.” [IJ] would insist that counsel stand when they spoke. [IJ] would routinely deny motions for webex hearings. [IJ] went through the biographical information excruciatingly slowly, including having the respondent spell the names of all the riders, provide their birth dates, etc.

    • It was a case where DHS had stipulated to 42b and the only issue would’ve been discretion but the IJ didn’t care. [IJ] told me to let everyone know that [IJ] reads each and every single document submitted in . . . court from back to front and . . . has a lot of questions . . . . [IJ] went on to conduct a full hearing, chastised DHS for stipulating, made a big deal of every little thing, asked irrelevant questions about medicaid forms that [client] may have filled for her children (not included as part of evidence), insinuated that she committed medicaid fraud, and made the ACC change position on each and every issue.

  • [The IJ] denied the asylum application of a young gay man from El Salvador. This is a first for me, in my 20+ years of asylum practice. We’ve never lost such a case that I can recall.

    • The facts are pretty typical – the kid lived a life of humiliation and abuse in El Salvador due to his sexual orientation; tried to commit suicide several times; and ultimately left the country when the Mara 18 tried to get him to deliver marijuana for them. Arguably, not a strong case for past persecution, but such cases typically prevail where a judge fairly evaluates a claim of well-founded fear of future persecution and considers the country condition reports and articles about the horrendous human rights abuses against the LGBT community in El Salvador. This didn’t fly with IJ. [IJ] simply said “there is no meaningful evidence in the record to demonstrate that the Respondent would experience harm amounting to persecution in El Salvador” and then went on to say that the client would likely experience more bullying and discrimination, but that doesn’t mean it would be persecution. [IJ] did not mention any country conditions report or article from the record to support his ruling.

    • [T]he DHS attorney called me directly after the hearing to empathize and tell me that it’s well-known even on their side that this judge is a piece of work and it’s always a good idea to take PD if offered.

    • [T]his judge is a menace. I don’t know what to do to protect my clients from [IJ] other than prepare strong BIA appeals.

  • This is the third email I have received to schedule MORE cases. No one will tell me what the goal is. I’ve put them on notice of the health issues this is/has been causing me.

    • Please tell the higher ups that this practice of overscheduling the private bar is taking a serious toll on practitioners’ health. Medical documentation is below and attached. I’m really not sure why the court has felt the need to overschedule practitioners to this level, but it is really taking a serious toll on everyone.  Can someone please shed light on this urgent need to overwhelm the limited number of defense attorneys we have in the area?

  • Another outstanding Immigration Court practitioner told me that they had left courtroom practice and taken a “research and writing” position because the EOIR courtroom “experience” under Garland was so dehumanizing, demoralizing, stressful, and life consuming!

  • A different attorney called me with concerns that an IJ’s “over the top” abuse of pro bono counsel would discourage others from taking cases in Immigration Court.

IJ’s wasting time; discouraging negation and stipulation by parties; taking over hearings; abusing continuance discretion; failing to abide by Cardoza & Mogharrabi; showing bias; producing wildly inconsistent anti-immigrant results; showing thin knowledge of law; rudely treating counsel and clients; over-scheduling; abusing power; endangering the health of those appearing before them; driving practitioners to leave the EOIR courtrooms; discouraging pro bono!

Everything that is NOT what a fair, independent, court of law should be is present and allowed, perhaps even encouraged, in Garland’s broken EOIR! Why is this type of grotesque mismanagement, bad judging, unprofessional conduct, and disregard of fundamental due process “business as usual” under a Dem Administration?

This “star chamber” system needs new, expert, progressive, due-process-focused, free from political hackery and inane gimmicks, “kick-ass” management! Garland isn’t getting the job done!

Meanwhile, the Biden Administration’s incredibly short-sighted and legally flawed “Miller Lite” asylum and border policies, of which Garland’s broken EOIR and unwillingness to stand up for human rights are a critical part, have “gone over like a lead balloon” with younger progressive Dems in Congress. See, e.g., https://link.vanityfair.com/click/30312106.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.

These younger progressives are exactly the “core support” that Dems will need to win future elections! How does “dissing” them with inept leadership and ineffective nativist-derived immigration policies help the cause?

Honestly, what a mess! Garland’s dystopian EOIR is the Democratic Party’s shame!

Courts in Name Only: Repairing America’s Immigration Adjudication System

By the Harvard Law Review

The esteemed Harvard Law Review does not publish much immigration scholarship.  A student note on the immigration court system may be of interest to blog readers.  The system long has been criticized and, last year, a bill was introduced in Congress that would have brought reform.

Courts in Name Only: Repairing America’s Immigration Adjudication System
By the Harvard Law Review
Noncitizens in the United States face innumerable obstacles, many of which have now become well known. But even the supposedly neutral court system in which noncitizens’ cases are adjudicated currently functions as an executive tool for removal. This Note argues that the current structure of the immigration adjudication system — and the resulting executive control over it — subjects Immigration Judges to a variety of conditions that, taken together, bias the entire system towards removal. It then surveys existing proposals for structural reform and proposes numerous possible intermediate reforms.

**********************

Key recommendation from HLR article:

While waiting for Congress to act, however, the executive branch has the authority to implement several crucial reforms that would allow for noncitizens to have their cases heard in fairer proceedings overseen by IJs with true, independent adjudicatory power.

Good News for Harvard Law: Some bright, unidentified, Harvard Law students can cut through the BS and clearly state achievable reforms that could and should have been implemented by the Biden Administration without legislation.

Bad News for Harvard Law: Prominent graduate and Law Review “alum” AG Merrick Garland (‘77), once a step away from a seat on the Supremes, doesn’t “get” it and, in fact, his poor leadership and mis-management are key parts of the problems at EOIR that threaten the stability and credibility of the entire U.S. justice system.

Note to HLR: Follow your own advice to “cut through the noise” and reform yourself. Lose the “historical BS,” move into the 21st century, show some intellectual integrity, and set a better example by clearly identifying and crediting the authorship of this and other student articles, whether by individual(s) or a team. See, e,g., Authorship: Giving Credit Where It’s Due, https://www.apa.org/pubs/journals/resources/publishing-tips/giving-credit

It’s not “rocket science!” 🚀 It’s just “Legal & Intellectual Ethics 101” (not to mention standard professional courtesy). As a former judge, albeit only one in the CINOs, I gave little weight to quotations and citations to anonymous or unidentified sources.

🇺🇸⚖️👨🏽‍⚖️👩🏽‍⚖️🗽 I Want YOU To Be A U.S. Immigration Judge! — “A Blueprint for America’s Better Federal Judiciary of the Future!“ — AILA D.C. CHAPTER — 01-11-23

I want you
Don’t just complain about the awful mess @ EOIR! Get on the bench and do something about it!
Public Domain

Excerpts:

Now, those of you who read my blog immigrationcourtside.com or have heard me speak before, or both, know that I am an outspoken critic of the last four Administrations’ gross mismanagement and misdirection of our Immigration Courts. So, you might well ask why I am here recruiting YOU to become part of a court system that I have consistently lampooned and characterized as dysfunctional, FUBAR, and badly in need of long-overdue reforms.

A better question might be why AG Garland, VP Harris, Deputy AG Lisa Monaco, and Associate AG Vanita Gupta AREN’T here today actively recruiting you to apply to become Immigration Judges in their system. It’s a hugely important court, perhaps the largest in the Federal Government, that cries out for excellence, practical immigration scholarship, and badly needs a much more diverse, representative, and expert judiciary to achieve equal justice for all in America.

The short answer is because I CARE, and THEY DON’T! I have a vision of a model court system unswervingly dedicated to due process, fundamental fairness, great practical scholarship, best judicial practices, fantastic public service, and equal justice for all! THEY DON’T!

After two largely fruitiness and frustrating years of the Biden Administration’s bungling immigration and social justice mis-steps, it’s painfully clear that the needed management, personnel, operational, and expertise reforms needed at EOIR AREN’T going to come from above.

But, if you have been in Immigration Court and thought “Hey, there is a better, more informed, more efficient, more just way to run this railroad, why isn’t it happening,” THIS is YOUR chance to get on board and change the direction of EOIR and the millions of lives and livelihoods that depend on it! See that the next generations of dedicated immigration lawyers won’t face some of the unnecessary and counterproductive roadblocks and bad experiences that you have had to deal with in seeking justice for your clients before EOIR!

. . . .

Not surprisingly, asylum grant rates dropped precipitously during the Trump years. Although they have rebounded some under Biden, they still remain below the 2012 levels. It’s certainly not that conditions have substantially “improved” in major “sending countries.” If anything, conditions are worse in most of those countries than in the years preceding 2012.

So, if the law hasn’t changed substantially and country conditions haven’t improved, what has caused regression in asylum grant rates at EOIR? It comes down to poor judging, accompanied by inadequate training, too much emphasis on “churning the numbers over quality and correctness,” and a BIA that really doesn’t believe much in asylum law and lacks the expertise and commitment to consistently set and apply favorable precedents and end disgraceful inconsistencies and “asylum free zones” that continue to exist.

Some of the most disgraceful, intentional asylum misinterpretations by Sessions and Barr now have been reversed by Garland. Unfortunately, he failed to follow-up to insure that the correct standards are actually applied, particularly to recurring circumstances. It’s one of many reasons that the Biden Administration struggles to re-establish a fair and efficient legal asylum system at the Southern Border — notwithstanding having two years to address the problems!

But, it doesn’t have to be this way! Recently, as I noted earlier, a number of notable “practical scholar experts” have been appointed to the Immigration Judiciary. When such well-qualified jurists reach a “critical mass” in the expanding EOIR, systemic changes and improvements in practices and results will happen.

The “dialogue” among Immigration Judges from government backgrounds and those from the private/NGO sector will improve. Lives will be saved. Life-threatening inconsistencies and wasteful litigation to correct basic mistakes at all levels of EOIR will diminish. The EOIR system will resume movement toward the former noble, but now long abandoned, vision of “through teamwork and innovation, being the world’s best administrative tribunals, guaranteeing fairness and due process for all!”

. . . .

So, warriors of the NDPA, check out USA Jobs, make those applications for EOIR judgeships! Storm the tower from below! Make a difference in the lives of others, stand up for due process and fundamental fairness for all persons, and help save our democracy! Become better judges for a better America! If not YOU, then who?

Professor Stephen Yale-Loehr

Expert: “Change Happens From The Ground Up”

Victor Reklaitis, MarketWatch, Dec. 22, 2022

“Federal Reserve chief Jerome Powell showed last week that he’s thinking about how recent lower immigration has factored into the ongoing U.S. labor shortage, but he said it’s not appropriate for the Fed to call for increased legal immigration to help alleviate the shortage. Could his remarks, careful as they were, somehow move the needle on immigration policy? His comments came as one new bipartisan proposal for immigration reform flopped in Congress, and some analysts say they aren’t optimistic about progress on immigration next year in a divided Washington. Still, others see Powell’s remarks having a small effect. … Powell’s answer could be seen as part of a slow process that eventually results in long-awaited fixes to the U.S. immigration system, according to Stephen Yale-Loehr, a professor of immigration law at Cornell Law School. “To me, it’s like water dripping on a rock,” Yale-Loehr told MarketWatch in an interview. “A single drop of water, whether it’s from Fed Chairman Powell or somebody else, won’t make a difference by itself. But if enough drips of water from other people and other studies consistently show that immigration can help our labor shortages and improve our economy, then I hope that will move the needle so that Congress will seriously take up immigration reform in 2023.” … The Cornell professor also suggested that grassroots efforts eventually might end up spurring U.S. lawmakers to do more. “A lot of change happens from the ground up, rather than the top down — if you think about civil-rights legislation in the 60s, the Environmental Protection Act of 1970, the antiwar efforts,” he said. “It was because people really protested the existing framework that they forced Congress to make changes in those areas. And so too, I think that if more Americans stood up and said, ‘We need immigration reform,’ I think that that would help persuade Congress to actually put pen to paper and make some significant changes.””

Compare with my recent post on the need and opportunity to get more NDPA experts on the immigration bench @ EOIR. https://immigrationcourtside.com/2022/12/21/%f0%9f%91%a9%f0%9f%8f%bb%e2%9a%96%ef%b8%8f%f0%9f%91%a8%f0%9f%8f%bd%e2%9a%96%ef%b8%8f-five-attorneys-with-recent-experience-representing-individuals-in-immigration-court-among-garland/

*********************

What better place to start forcing some long overdue changes than by getting more NDPA “practical scholar/experts” onto the EOIR bench where lives are on the line every minute of every working day? There are lots of ways to do justice at the “retail level” despite, or perhaps because of, the indifference of those in charge!

Folks, approximately a decade ago, the asylum grant rate at EOIR exceeded 50%! When grants of withholding (many the result of the 1-year-bar on asylum) and CAT were added in, almost 2/3 of asylum applicants who got a merits determination received some form of legal protection!

The vast majority of these cases were not appealed to the BIA. Slowly, but steadily, the EOIR system “at the retail level” was committing to expertise, sound scholarship, due process, fundamental fairness, faithful application of the generous legal principles established in Cardoza, Mogharrabi, and the regulatory presumption of future future persecution based on past persecution.

For years, those precedents and that regulation were resisted by many EOIR judges who continued, in practice, to apply the higher “more likely than not” standard rejected in Cardoza. But, following a series of savagely critical reversals of EOIR asylum denials by the Courts of Appeals the ground started to shift toward a more generous, proper, and correct interpretation of asylum law. Notably, those Court of Appeals “roastings” came after AG John Ashcroft “purged” the BIA in 2003 of appellate judges who spoke out for a better legal interpretation of asylum laws — one that faithfully followed Cardoza, Mogharrabi, and international standards!

As I used to tell my Georgetown Law students, a quarter century after the Supremes’ landmark decision in INS v. Cardoza-Fonseca, establishing the generous “well-founded fear” standard for asylum (reasonable likelihood = 10% chance) and the BIA’s implementation of that standard in Matter of Mogharrabi (asylum can be granted even where it is significantly unlikely that persecution will occur) the more generous standard was actually achieving “traction” at EOIR!

The law hasn’t changed very much since 2012. But, the progress toward a “Cardoza/Mogharrabi compliant” interpretation and application of asylum law halted and regressed substantially during the last part of the Obama Administration and during the Trump era.

What did change, for the worse, was the attitude of politicos, who have seen the Immigration Courts as captive “tools” to deter asylum seekers and “send negative messages” rather than insuring that they function as due-process-oriented, independent, subject matter expert, courts of law. The qualifications of those selected as Immigration Judges were “watered down” to favor high-volume government prosecutorial experience over demonstrated expertise in immigration and asylum laws and “hands on” experience representing individuals before EOIR.

So, if the law hasn’t changed substantially and conditions haven’t improved, what has caused regression in asylum grant rates at EOIR?

Recently, a number of notable “practical scholar experts” have been appointed to the Immigration Judiciary.

So, warriors ⚔️🛡of the NDPA, make those applications for EOIR judgeships! Storm the tower from below! Make a difference in the lives of others and help save our democracy! If not YOU, then who?👩🏻‍⚖️👨🏽‍⚖️⚖️🗽🇺🇸

👩🏻‍⚖️👨🏽‍⚖️ FIVE ATTORNEYS WITH RECENT EXPERIENCE REPRESENTING INDIVIDUALS IN IMMIGRATION COURT AMONG GARLAND’S ELEVEN NEW JUDICIAL APPOINTMENTS

In addition to these five, two other recently appointed Immigration Judges had private practice experience in immigration before becoming Government attorneys.

Round Table maven (and VERY proud new grandfather 😎) “Sir Jeffrey” S. Chase gave a special “shout out” to Judge Gioia M. Maiellano, now of the NY Federal Plaza Immigration Court.

Gioia M. Maiellano, Immigration Judge, New York – Federal Plaza Immigration Court

Gioia M. Maiellano was appointed as an Immigration Judge to begin hearing cases in December 2022. Judge Maiellano earned a Bachelor of Science in 1994 from Fordham University and a Juris Doctor in 1998 from Brooklyn Law School. From 2021 to 2022, she was a solo practitioner handling immigration cases. From 2017 to 2021, she served as an Administrative Law Judge with the Department of Finance, City of New York. From 2015 to 2016, she served as an asylum officer with U.S. Citizenship and Immigration Services (USCIS), Department of Homeland Security (DHS). In 2015, prior to joining USCIS, she served as pro bono counsel for the Iraqi Refugee Assistance Project. From 2013 to 2015, she worked in private practice with the Law Office of Carmen DiAmore-Siah in Honolulu representing individuals before the immigration courts, the Board of Immigration Appeals, and USCIS. From 2003 to 2013, she served as an assistant chief counsel, U.S. Immigration and Customs Enforcement, DHS, in New York. In 2002, she worked with the Law Office of Amir Alishahi in New York. From 2000 to 2001, she served as a staff attorney with the European Roma Rights Center, in Budapest, Hungary. Prior to that, she served as a law clerk with the Office of the Prosecutor at the United Nations International Criminal Tribunal for the Former Yugoslavia in The Hague, The Netherlands. Judge Maiellano is a member of the New York State Bar.

Here are the bios of all the new judges:

Congrats to all!👏

As experts like my friends Judge Chase, Professor Debbie Anker, and LexisNexis Guru Dan Kowalski say, EOIR is an organization where positive change is more likely to “come from below than from above.” Unfortunately, that makes it a painfully slow process for those still suffering in the substandard conditions that Garland permits in his Immigration Courts.

Nevertheless, as more and more judges join the bench with recent experience actually working their way through this dysfunctional system to obtain justice for their clients, the resistance to mis-applying BIA and Circuit precedents favoring individuals will grow. Additionally, the legal standards will be correctly applied at the “first level,” unrealistic requirements on individuals and their lawyers will diminish, due process, fundamental fairness, and efficiency will advance, and the disgraceful anti-immigrant, anti-asylum, deny, deport, and deter “culture” at EOIR — actively promoted under Sessions and Barr — will diminish over time.

Moreover, when Article I eventually comes, a more diverse and better-qualified group of IJs likely will be initially “grandfathered.” That’s another reason why Garland’s “slow moving train” in improving the quality of EOIR Judges at all levels has been so totally frustrating.

Should have and could have happened over the past two years with better leadership and vision from Garland and his subordinates. But, given the dismal state of immigration institutions and policies over the past six years, I’ll treat anything that isn’t “bad news” as “good news!”

🤯“The words egregious and illegal don’t go far enough!” — LATEST SCREW-UP BY DHS ENDANGERS CUBAN ASYLUM SEEKERS!

Hamed Aleaziz
Hamed Aleaziz
Staff Writer
LA Times

Hamed Aleaziz reports for the LA Times:

https://www.latimes.com/world-nation/story/2022-12-19/cuba-immigrants-deported-asylum-leak

The Department of Homeland Security inadvertently tipped off the Cuban government this month that some of the immigrants the agency sought to deport to the island nation had asked the U.S. for protection from persecution or torture, officials said Monday.

Immigration and Customs Enforcement officials are now scrambling to foreclose the possibility that the Cuban government could retaliate against individuals it knows sought protection here. The agency has paused its effort to deport the immigrants in question and is considering releasing them from U.S. custody.

The accidental disclosure to the Cuban government is an example of any asylum seeker’s “nightmare scenario,” said Robyn Barnard, associate director of refugee advocacy at Human Rights First.

Many immigrants who seek safety in the U.S. fear that gangs, governments, or individuals back home will find out that they did so and retaliate against them or their families. To mitigate that risk, a federal regulation generally forbids the release of personal information of people seeking asylum and other protections without sign-off by top Homeland Security officials.

“The words egregious and illegal don’t go far enough,” Barnard said. “And this is not any foreign government, but a government we have irrefutable evidence routinely detains and tortures those they suspect of being in opposition to them.”

An even larger breach of confidentiality last month led directly to the surprising disclosure to the Cuban government. Less than three weeks ago, Immigration and Customs Enforcement officials accidentally posted the names, birth dates, nationalities and detention locations of more than 6,000 immigrants who claimed to be fleeing torture and persecution to the agency’s website.

. . . .

Anwen Hughes, director of legal strategy at Human Rights First, has years of experience comforting asylum seekers who are worried that their home countries will find out about their applications.

“They come in nervous, shaking and afraid their relatives could get arrested,” Hughes said.

Hughes has long told her clients that they should feel secure that their information would be protected.

But the most recent disclosures have given her pause.

“I don’t want to say things that won’t be true,” she said. “It is important that these assurances be meaningful.”

ICE’s November disclosure of the 6,252 names had already triggered a massive effort by the agency toinvestigate the causes of the error andreduce the risk of retaliation against immigrants whose information was exposed.

Thanks for speaking out so forcefully, Robyn! There is Fourth Circuit case law holding that breaches of confidentiality can give rise to entirely new asylum claims that require evaluation by adjudicators.

As cogently pointed out by Anwen, problems like this also diminish confidence in the system. That, in turn, undermines efforts by advocates to assure asylum applicants that they should use the legal system, rather than being afraid of it.  This is also something that the Government should be doing, but isn’t!

For example, right now at the southern border, thousands of asylum applicants are waiting patiently in Mexico, many in dangerous and substandard conditions, for Title 42 to end so they can appear at legal ports of entry and present their claims in an orderly and legal manner. This right for “any individual, regardless of status” to apply for asylum, is guaranteed by law. Every stay or delay in the lifting of Title 42 undermines the credibility of the entire system.

As cogently found by U.S. District Judge Emmet Sullivan, asylum applicants have been illegally denied this “life or death right” to apply for asylum in an orderly manner at the border since 2020, first by the Trump Administration and now by the Biden Administration. Tellingly, the GOP nativist politicos (and, sadly, some Dems) promoting continuing abuse of Title 42 have abandoned the original Trump claim that it was a “public health measure.” They now openly present it as a “border management tool” something that it clearly was never intended to be!

Contrary to the nativist blather, the unlawful suspension of the legal asylum system at ports of entry has actually driven irregular entries, rather than discouraging them! Additionally, nativists and many member of the media fail to acknowledge that, even without Title 42, the existing law grants DHS extraordinarily authority to “summarily remove” asylum seekers if they can’t establish a “credible fear“ of asylum in an interview by a trained and well-qualified Asylum Officer.

This process was designed to take place within a relatively short period of time, at or near the border, after the individual has indicated a fear of return upon initial encounter with an Immigration Inspector at a port of entry or to a Border Patrol Agent. Those who “fail” the credible fear process can be summarily removed by DHS without formal removal proceedings before an Immigration Judge (although there is a right to request a brief review by an Immigraton Judge of the Asylum Officer’s negative decision).

Additionally, under recently enacted regulations, Asylum Officers can now grant asylum to those who pass credible fear if they find that the generous “well-found fear” standard has been met. This also has the potential of avoiding full Immigration Court hearings. Unfortunately, however, DHS to date has failed to “leverage” this ability to rapidly grant asylum, even though the potential volume of asylum seekers has been evident for many months, if not years!

It’s also notable, in contravention of many nativist politico claims, that individuals crossing the border to seek asylum often voluntarily turn themselves in to the Border Patrol so that they can get the legal screening that the Government has been improperly denying them under Title 42.

Life threatening mistakes, two years without a plan to restore the rule of law for asylum seekers, inaccurate data, bad legal rulings, many poorly qualified judges, inadequate training, failure to use and leverage refugee programs, screwed up priorities, regressive thinking, lack of expertise, no commitment to protection, unending backlogs, absence of inspiring dynamic leadership: The Biden Administration’s inept and morally vapid approach to human rights is a life-threatening mess!

Quality vs Quantity: How Does Sitting on the Dedicated Docket Impact the Judging Process?

TRAC: The outcome for asylum seekers has long been influenced by the identity of the immigration judge assigned to hear their case. This continues to be true as documented by TRAC’s just released judge-by-judge report series, now updated through FY 2022. In Arlington, Virginia, judge denial rates ranged from 15 percent to 95 percent. In Boston, judge denial rates varied from 17 percent to 93.5 percent. In Chicago, they ranged from 16 percent to 90 percent, while in San Francisco one judge denied just 1 percent of the cases while another denied 95 percent.

Miller Lite
After two years of “drinking the koolaid,” the party might be over for Mayorkas & Garland, as McCarthy & his insurrectionist/White Nationalist zanies “move in for the kill.”

Two years of ineptness, failure to clean house at DOJ and DHS, unkept promises to advocates, lack of guts to quickly reverse Trump’s massive scofflaw program of racist-inspired human rights abuses, arrogant “tuning out” of experts, lack of engagement and presence at the border have been largely ignored by Dems in both Houses. Indeed, other than a hearing on the Article 1 bill before Chair Lofgren (at which Garland was not required to appear and explain his due-process-denying mess and abject failure to reform EOIR), Dems failure to conduct meaningful oversight of the Administration’s mishandling of refugee programs, asylum, detention, asylum seeker resettlement, and Immigration Courts will be “coming home to roost” as insurrectionist, racists from the House GOP take aim at “snuffing” humanity and abolishing the rule of law!

Two years of inept, immoral, “Miller Litism” from the Administration leaves Dems with no defense and no supporters of their actions. Nativist restrictionists wanted “100% kill” @ border! Experts wanted a return to the rule of law, orderly processing, and due process. The Biden Administration delivered neither!

We tried to tell them, but they wouldn’t listen! No,  McCarthy and his insurrectionist White Nationalist zany-haters have the floor. Just have to hope that historians are fully documenting the lies and Neo-Nazi views that these GOP hacks will be promoting — to help future generations understand how America “went off the rails” in the 21st century! Understandably, the GOP would rather focus on Biden’s failed immigration policies than on the rampant gun violence, hate crimes, child abuse, forced births, and dumbing down of America at the heart of their vile agenda!

Alfred E. Neumann
Has Alfred E. Neumann been “reborn” as Judge Merrick Garland? “Not my friends or relatives whose lives as being destroyed by my ‘Kangaroo Courts.’ Just ‘the others’ and their immigration lawyers, so who cares, why worry about professionalism, ethics, and due process in Immigration Court?”
PHOTO: Wikipedia Commons

If someone NOT Merrick “What Me Worry” Garland (the “Alfred E. Neumann of Biden’s immigration bureaucracy”) took a look at the data, one major thing would jump out! There are likely more than 400,000 refugees entitled to asylum sitting in Garland’s 770,000 case asylum backlog (52% x 770,000). (The asylum backlog at EOIR is a “subset” of Garland’s largely self-inflicted, ever mushrooming, nearly 2 million case EOIR backlog — more judges have produced more backlog, so that’s likely NOT the answer here).

And, this is in a system currently governed by skewed anti-asylum BIA “precedents” and a chronic “anti-asylum culture” actively encouraged and fed by the Trump Administration. In a properly staffed and functioning court system with qualified, due-process oriented, judges and an expert BIA that enforced some decisional consistency and properly and generously interpreted asylum law, a “grant rate” of 75% or more would be a plausible expectation.

Given the obvious (and I would argue intentional) lack of reliable data on how a legitimate asylum system, one consisting at all levels of judges with well-recognized expertise in asylum law and human rights, and overseen by competent, due-process-oriented judicial administrators, might function, the 75% figure is just an “educated guesstimate.” But, it matches my own personal experience over 13 years on the bench in the (now defunct) Arlington Immigration Court.

It’s also in line with my recent conversations with the head of one of the largest NGOs in the DMV area involved in meeting busses and counseling those “orbited” from the Southern border by the racist/nativist GOP Govs that Biden, curiously, has chosen to run our domestic refugee resettlement program. This is a person who, unlike Garland, his lieutenants, and most of the other politicos and nativist blowhards participating in the “border travesty,” actually spent years of a career representing individuals in Immigration Court. They estimated that “at least 70%” of the “arriving bus riders” had very viable asylum claims.

This is a far cry from the nativist, restrictionist myths promoted by both the Trump and Biden Administrations — obviously to cover up their gross human rights violations in knowingly and illegally returning hundreds of thousands of legal refugees to danger zones! Many human rights experts would consider such gross misconduct to be “crimes against humanity.” Consequently, it doesn’t take much imagination to see why self-interested scofflaw officials like Garland, Mayorkas, and White House advisors seek to manipulate the system to keep the asylum grant rates artificially low while eschewing proper, realistically robust use of the overseas refugee program to take the pressure off the border — by acting legally rather than illegally!

Almost all the EOIR asylum backlog consists of “regular docket” (I use this term lightly with EOIR where “normalcy” is unknown) cases. Those are refugees who have had time to get lawyers, adequately prepare, document their cases, but are stuck in Garland’s chronically dysfunctional system. Consequently, they are “denied by delay” legal immigration status, a chance to get green cards, and to eventually qualify for citizenship. The American economy is denied an important source of legal workers who should be part of our permanent workforce and well on their way to full participation in our political system and society!

An expert looking at this system would see a “golden opportunity” to move most of the backlogged “easily grantable” asylum cases out of the system with stipulated grants or short hearings (the kind you actually might be able to do 3-4 a day without stepping on anyone’s due-process rights or driving the private bar nuts). These cases would also avoid the BIA’s appellate backlog, as well as eliminating unnecessary workload in the U.S. Circuit Courts (which already have their own inconsistency, rubber stamp, and bias issues in the human rights/racial justice area that seem to be getting worse, not better).

Knocking 400,000+ cases off the backlog wouldn’t completely solve Garland’s 2 million case backlog problem — only a complete “house cleaning” at EOIR, replacing many of the current bureaucrats with competent leaders and expert Immigration Judges well-versed in asylum law, will do that. But, cutting EOIR’s backlog by 20% (and the asylum backlog by over 50%) without stomping on anyone’s rights, while bolstering much-needed legal immigration, and harnessing the strengths of the private/pro bono bar, is nothing to “sneeze at!” That’s particularly true in comparison with Garland’s two years of mindless “designed to fail” gimmicks and astounding mismanagement, which have produced exactly the opposite results!

How bad has Garland’s leadership been at on human rights, due process, and racial justice at DOJ. A number of seasoned asylum practitioners have told me that today’s EOIR, also suffering from a tidal wave of Garland’s  “Aimless Docket Reshuffling” — is actually significantly worse than it was under Trump! That’s right, Garland’s tone-deaf incompetence has exceeded the disorder and systemic unfairness caused by overt xenophobia, anti-asylum bias, misogyny, “dumbing down,” and enforcement-biased “weaponization” of the Sessions/Barr years.

As for Dr. Kocher’s cogent observation that input from the Immigration Judges who actually decide these cases is a “missing ingredient,” good luck with that, my friend! Perhaps understandably in light of his unseemly failures at EOIR, Garland has taken EOIR’s traditional opaqueness and “muzzling” of Immigration Judges to new heights — even barring their participation in CLE events aimed at improving the level of practice before his courts.

Apparently, “studied incompetence” in a Democratic Administration can be even worse than the “malicious incompetence” of the Trump Kakistocracy — at least where immigrants rights/human rights/racial justice/ women’s rights are concerned at EOIR. That’s an astounding observation! One that I actually never thought I’d hear from practitioners!

The only way for human rights and racial justice experts and advocates to “communicate” with Garland in his “ivory tower” is to ‘“sue his tail” in court! Judge Sullivan’s recent opinion finding Title 42 illegal incorporates the very facts and law used by human rights experts and advocates in years of fruitless pleading and begging Garland to “cease and desist” his support for unlawful conduct and “just follow the law.” The latter seems like a modest “no-brainer” request to a guy once nominated by an Dem President for the Supremes.

Waiting for Merrick Garland to fix the mess at EOIR to provide even a bare minimum of due process and rational administration is like waiting for the guy pictured below. Frustrated and “Garland-weary” as they might be, human rights advocates should take it to heart and act accordingly!

Waiting for Godot
Waiting for Merrick Garland and his “clueless crew” at DOJ to fix the dysfunctional Immigration Courts will be an exercise in futility. He only pays attention when ordered by a Federal Judge, which, somewhat ironically, he used to be. But, he’s proven “beyond a reasonable doubt” that he is unqualified to run one of the most important and life-determining Federal Judiciaries — one where due process has been buried beneath an avalanche of expediency, incompetency, intellectual dishonesty, and dumb gimmicks. By Maria Sacchetti and Spencer S. Hsu

November 15, 2022 at 4:46 p.m. ET

A federal judge on Tuesday struck down a Donald Trump-era policy used by U.S. border officials to quickly expel migrants because of the covid pandemic, saying the ban had little proven benefit to public health even as it shunted migrants to dangerous places.

U.S. District Judge Emmet G. Sullivan in the District of Columbia vacated the order known as Title 42, effectively restoring asylum seekers’ access to the borders for the first time since the Trump administration issued it during the earliest days of the pandemic.

The decision — which takes effect immediately — knocks down one of the last remaining barriers to asylum from the Trump administration, advocates for immigrants said. It also poses an immediate logistical challenge for the Biden administration after two consecutive years of record apprehensions on the U.S.-Mexico border, with the possibility that the numbers could grow.

Biden officials have long worried about a mass rush to the border creating an emergency similar to the one that occurred in Del Rio, Texas, in Sept. 2021, when thousands of migrants crossed illegally and overwhelmed U.S. agents, creating a squalid camp on the banks of the Rio Grande that embarrassed the Biden administration.

Sullivan’s ruling also comes days after top border official Chris Magnus resigned under pressure after clashing with Homeland Security Secretary Alejandro Mayorkas.

The Justice Department and the Department of Homeland Security had no immediate response to the ruling.

The American Civil Liberties Union, one of the organizations that brought the lawsuit on behalf of migrants, said Sullivan’s decision to vacate the Title 42 policy means the policy ends for all migrants, including families and adults traveling without children.

“Title 42 unfortunately had a long shelf life but has finally been ended, and that will mean enormous relief to desperate asylum seekers,” said ACLU lawyer Lee Gelernt.

Sullivan also made clear that that he would not stay his order pending appeal, leaving it to a higher court to do so if the Biden administration sought more time to address the ruling.

. . . .

Key Quote:

Sullivan wrote that the federal officials knew the order “would likely expel migrants to locations with a ‘high probability’ of ‘persecution, torture, violent assaults, or rape’ ” — and did so anyway.

“It is unreasonable for the CDC to assume that it can ignore the consequences of any actions it chooses to take in the pursuit of fulfilling its goals,” Sullivan wrote. “It is undisputed that the impact on migrants was indeed dire.”

***************

The horrific consequences for lawful asylum seekers subjected to this unlawful policy have indeed been “dire:” rape, assault, kidnapping, beating, torture, extortion, starvation, illness, sickness, death, family separation, despair, to name a few.

By contrast, there have been NO consequences for Stephen Miller and the other Trump Administration officials who fabricated and directed this ruse on the justice system and attack on humanity and the rule of law! Nor have there been any consequences for lower level officials who “went along to get along” with what they knew or should have known to be deadly abuses of our laws.

Additionally, Biden officials who continued to violate the law and even concocted ways of expanding its illegal and immoral use have escaped accountability and continue in their jobs. DOJ lawyers who failed to do “due diligence” and defended a policy based on pretext, misrepresentations of fact, racism, and xenophobia have also continued to operate in the “ethical twilight zone” that normally would have serious professional consequences!

Of course the whole history of the Title 42 charade ☠️🤮has been one of one step forward and three steps back. The corrupt decision-making extends to unqualified right-wing zealots with lifetime sinecures on the Federal Article III bench and to equally corrupt GOP state AG’s for their dishonest scheme to force continued illegal Title 42  expulsions.

So, despite these “crimes against humanity,” don’t expect that “heads will roll!” Given the current sorry state of our Federal Courts and the DOJ, it’s not certain that Judge Sullivan’s order will actually have effect or that asylum seekers will ever get the fundamentally fair and humane treatment to which they are entitled.

But, I am certain that this will eventually go down in history as one of the most disgraceful intentional abrogations of law, with the most drastic consequences for humanity and our nation’s reputation, in 21st Century legal history!

It’s also worthy of note that rather than getting the asylum system properly staffed and trained, bringing in Immigration Judges with the required expertise, installing a BIA of expert judges capable of issuing correct, realistic, generous, practical asylum precedents, working cooperatively with the private bar to facilitate representation, and developing an orderly process for resettlement (away from the border) of asylum applicants who pass credible fear, Garland, Mayorkas, and a White House officials have dithered away two years of time without getting the necessary robust, fair, expert, efficient, timely asylum adjudication system up and running!

The advice and pleas of experts and advocates have been “tuned out” or ignored by those in charge! Now, as all of us predicted, the “chickens have come home to roost” for the Administration’s indifferent, incompetent, and lackadaisical  approach to the biggest racial justice and human rights crisis facing our nation.

Thanks Judge Sullivan! Thanks ACLU! Apologies to the hundreds of thousands of asylum seekers wronged by the cowardly failure of America to uphold our laws, Constitution, and international obligations — that “subset” of victims who are still alive despite our Government’s grotesque misconduct!

⚖️👩🏽‍⚖️  ESTABLISHED “PRACTICAL SCHOLARS” JUDGE SCOTT E. BRATTON (NY — Broadway), JUDGE DENISE HUNTER (Sacramento), & JUDGE BECCA A. NIBURG (Hyattsville) LEAD CLASS OF 32 NEW IMMIGRATION JUDGE APPOINTMENTS — Despite Improved “Balance,” Those With Government Backgrounds Continue To Dominate Garland’s Picks For “Life Or Death” Judgeships! — Bolder Action Required To Stem Dysfunction, Bad Judging Flowing From Garland’s Broken Courts! — Migrant Justice & Racial Justice Can’t Wait!

Judge Scott E. Bratton of the NY Broadway Immigration Court was a “regular” before me when I was assigned to the Cleveland docket. Always well-prepared, collegial, and an outstanding brief writer and oral advocate, he had no hesitation in going to the Article III Courts when necessary on behalf of his clients. He also has a sense of humor and perspective. This great appointment should have come long ago. But, better late than never!

Judge Denise M. Hunter of the Sacramento Immigration Court collaborated with now GW Law Professor Cori Alonso Yoder and me on “hands-on CLE in immigration” for the DC Bar. Following my retirement, she, Cori, and I met for lunch to “strategize” ways to make due process, fundamental fairness, and best practices the “norm” in Immigration Court, rather than the exception it continues to be! She’s now in a position to lead and teach by example to make that happen in a system where justice too often continues to be a mere “afterthought,” if that!

Judge Becca A. Niburg
Hon. Becca A. Niburg
U.S. Immigration Judge
Hyattsville Immigration Court
PHOTO: Linkedin

Judge Becca A. Niburg of the Hyattsville Immigration Court is a “self described immigration nerd” — in other words, a distinguished practical scholar in immigration, human rights, and due process for all! In addition to private practice and serving with two of the premier human rights NGOs in the DMV area, Catholic Charities & Kids in Need of Defense (“KIND”), Becca has a rich background as an immigration adjudicator at the appellate level of USCIS and as a litigator in the Office of Immigration Litigation at DOJ. She combines “insider knowledge” of the failing Government immigration bureaucracy with the skills, courage, determination, and “outside perspective” to make bureaucracy work for the common good, often in spite of itself. Can’t think of an organization more in need of that perspective these days than Garland’s dysfunctional EOIR!

Here’s a complete list of appointments with bios from EOIR:

https://www.justice.gov/eoir/page/file/1546941/download

Here’s the “group profile:”

  • 12 Judges from predominantly private sector backgrounds;

  • 20 Judges from predominantly government sector backgrounds (primarily DHS & DOJ, but also state and local governments and other Federal agencies);

  • 26 Judges with known immigration experience;

  • 6 Judges with no obvious immigration experience on their resumes — all 6 from government sector backgrounds.

This is a marked improvement over the Obama and Trump Administrations where EOIR judicial appointments ran approximately 9:1 in favor of those from government! It’s also a needed improvement over the Trump Administration’s oft-criticized tendency to place too many individuals without significant immigration experience on the EOIR bench in the apparent belief that they would be more willing to “follow orders, shut up, deny, and deport.” The precipitous drop in asylum approvals during the Trump years, despite worsening conditions for refugees worldwide, proved that there was some basis for this anti-asylum assumption.

Nevertheless, Garland’s selections tend to remain significantly “over-weighted” toward those from government. I always believed that the excuse of DOJ officials  for the over-appointments from government given during the Obama Administration — that the applicant pool from government was so much better — was pure unadulterated BS!

Since retiring and having an opportunity to work more closely with super talented private practitioners on Round Table briefs, CLE, articles, litigation strategy, proposals for legislative reform, and clinical and classroom teaching, I can say without a doubt that the talent level out here in the private/NGO/academic section is “through the roof” — astounding — particularly compared with the intellectual and legal output of EOIR! If more of these “leading lights” — of American law (NOT “just Immigration law”) aren’t on the “short list” for the Immigration Court and replacing most of the current BIA, that’s a problem with Garland’s recruiting process, NOT with the non-government “talent pool.”

Did the Federalist Society and the Heritage Foundation just “wait to see who might apply” for Federal Judge positions — starting with the Supremes! Hell no! They “groomed” their “preferred judicial selections” for years, decades even, far in advance of any known vacancies.

If you remember, Brett Kavanaugh believed that a seat on the Supremes was his “birthright” — since about age 10 or something like that. He bemoaned the fact that nasty Dems questioning his qualifications might deprive him of his “preordained destiny.” One can never accuse right-wing zealots of not having a well-developed “sense of entitlement.” They act on it, and apologize to nobody! Compare that with Dems!

By contrast, Dems are absolutely clueless about both the importance and potential of the Immigration Courts — including the BIA, a nationwide appellate court, essentially the “12th or 13th Circuit” depending on how you count. With absolute control of these important “retail level” courts for 10 of the past 14 years, the Dems have done an extraordinarily poor job of filling judgeships with the best-qualified, progressive, most due-process-committed candidates — scholarly, practical judges who would take equal justice and racial justice in America seriously! Additionally, such individuals would be “primed, experienced, and ready” for Article III appointments when the opportunities arose!

By contrast, in the four years they controlled EOIR, Sessions, Barr, and their “acting fill-in flunkies” did an extraordinary job of weaponizing and reshaping the Immigration Courts — starting with the BIA — in “Stephen Miller’s image.” In the process, they created total dysfunction and chaos at EOIR, heaped abuse and injustice on vulnerable asylum seekers ( predominantly individuals of color, many women and children), twisted immigration law into a “Milleresque” anti-immigrant mess, demoralized and punished lawyers, busted the judges’ union, forced some of the best most qualified judges off the bench, and undermined our entire justice system. They even got EOIR to “cook” their statistics to support the nativist myth that “nobody qualifies for asylum” — ergo, all asylum seeks and their lawyers are fraudsters!

I’m on the record, many times over, as being no fan of Stephen Miller! But, his aggressive, energetic, focused, “take no prisoners,” “ignore the opposition” approach to de-constructing our immigration and justice systems certainly was more effective than anything else I have witnessed over my decades in and out of Government! He understood that time could be short, and he had to do as much damage as possible in that allotted to him. He literally was totally engaged in killing asylum and asylum seekers until the exact minute he left the White House! Dems, on the other hand, disturbingly, exhibit no leadership, urgency, sense of purpose, dynamic energy, confidence in the rightness of their cause, or plan when it comes to immigration.

“You can’t do that” was a challenge to Miller — not a deterrent! He not only did it, but got away with it!

He didn’t “study” things or fool around attempting to build support outside his “base.” If nothing else, Miller “gave lie” to the off-repeated “bureaucratic mantra” that “change takes time.”

He undid decades of hard work by those engaged in making the “Refugee Act of 1980” functional in a matter of weeks or months! And, the inept immigration bureaucracy and non-existent immigration leadership under the Biden Administration has been stymied, or simply “contented no-shows,” on undoing much of Miller’s damage!

Faced with this exceptionally well-documented disaster, and it’s undeniable corrosive impact on our democracy, Garland has been largely MIA, or AWOL might be a better term. “Action” isn’t a word readily associated with Merrick Garland.

Garland’s  glacial, largely disengaged, timid, ineffective approach to EOIR reform and reconstruction is perhaps typical of Democrat Administrations and their overall approach to immigration, human rights, and racial justice in the 21st Century. But, that doesn’t make it the RIGHT approach, for the party, the Federal Judiciary, our nation’s future, and, most important, for the individuals seeking justice in Garland’s EOIR wasteland and their long-suffering attorneys.

US border encounters top 2 million in fiscal year 2022

CNN: There were 227,547 migrant encounters along the US-Mexico border in September, up 12 percent from the previous month. The sharp increase in migrants from Venezuela, Cuba, and Nicaragua contributed to the uptick.

Illegal Border Crossings by Venezuelans Plunge in the Face of New Policies

NYT: The number of Venezuelans entering the United States illegally dropped from about 1,200 a day to 150 in the first days after the Biden administration rolled out the new policies.

U.S. grants Temporary Protected Status to Ethiopians fleeing conflict

Reuters: The Ethiopian military and allies including troops from neighboring Eritrea have been battling forces from the northern region of Tigray on and off for two years. The conflict has killed thousands, displaced millions and left hundreds of thousands on the brink of famine.

Coast Guard returns more than 300 migrants to Cuba over weekend

The Hill: The Coast Guard stopped 185 Cubans on Friday, 94 on Saturday and 40 on Sunday. In total, the service says it has intercepted 921 Cubans since Oct. 1.

US Border Patrol sending migrants to offices with no notice

AP: Molina was among 13 migrants who recently arrived in the U.S. who agreed to share documents with The Associated Press that they received when they were released from U.S. custody while they seek asylum after crossing the border with Mexico. The AP found that most had no idea where they were going — nor did the people at the addresses listed on their paperwork.

‘Hail Mary after Hail Mary’: Biden administration struggles with border policy, fueling frustration

CNN: It has been an endless cycle since President Joe Biden took office, according to multiple administration officials and sources close to the White House. Agency officials dream up a plan but then struggle to get White House approval, even as the problem compounds and Republicans step up their criticism. See also Immigrant advocates feel abandoned as they stare at Biden’s first-term checklist.

Nearly 500,000 Immigrants Go Through ICE’s Alternatives to Detention System in Two Years

TRAC: According to new data obtained by TRAC through Freedom of Information Act (FOIA) requests, 480,301 people have been enrolled in ICE’s electronic monitoring program known as Alternatives to Detention (ATD) between August 2020 and June 2022. Many of these individuals, about 196,000, were previously active in ATD but have since ceased to be monitored under ATD, while 284,000 immigrants were still in ATD as of the end of June.

Over 63,000 DHS Cases Thrown Out of Immigration Court This Year Because No NTA Was Filed

TRAC:  As of the end of September 2022, Immigration Court judges dismissed a total of 63,586 cases because Department of Homeland Security officials, chiefly Border Patrol agents, are not filing the actual “Notice to Appear” (NTA) with the Immigration Court. Without a filed NTA, the Court has no jurisdiction to hear the case.

Arrests for unlicensed driving plunge in New York following unauthorized immigrant license law like Mass.’s

GBH: Police in New York arrested about 57,000 unlicensed drivers a year before state lawmakers narrowly approved the Green Light Law in 2019, making most immigrants eligible for licenses regardless of their legal status. In 2021, those arrests declined to about 30,000 and are on a similar pace for this year, according to records obtained by GBH News from the New York State Unified Court System.

An Overwhelmed Immigration System Is Facing A Shortage Of Attorneys Amid A Growing Backlog Of Cases

Block Club: As a major city that attracts immigrants, Chicago specifically has been struggling to support the recent influx of asylum seekers. After dealing with cuts under the Trump administration and then the COVID-19 pandemic, immigrant serving organizations’ resources were already strained before the war in Ukraine and the U.S. withdrawal from Afghanistan and subsequent Taliban takeover sent thousands of refugees and asylum seekers to Chicago. The recent arrival of migrants from Texas has only added to the strain on organizations’ resources, including legal services and representation.

LITIGATION & AGENCY UPDATES

CA1 on Honduras, MS-13, CAT: H.H. v. Garland

LexisNexis: He argues that the immigration judge (“IJ”) applied the incorrect legal standard in assessing whether he would more likely than not be tortured with the “consent or acquiescence” of the Honduran government, and that the BIA erred in its review of the IJ’s decision. He also argues that the BIA failed to consider whether the Honduran government would likely torture him and whether the MS-13 gang is a de facto government actor. We agree that the agency erred in these respects, and we therefore grant his petition for review, vacate the order of the BIA to the extent it denied him CAT relief as to Honduras, and remand for further proceedings consistent with this opinion.

CA1 on El Salvador, CAT, MS-13: Chavez v. Garland

CA1: We  thus  remand  for  the  BIA  to  consider  in  the  first instance  whether  Chavez’s  proposed  social  group  satisfies  the requirements for constituting a particular social group under the INA to which he belongs.  We express no opinion as to the merits of that issue other than to emphasize that the BIA cannot reject such a group based solely on its determination that current or former gang members cannot form a particular social group.

Unpub. CA3 CIMT Victory: King v. Atty. Gen.

LexisNexis: The plain language of the statute, coupled with the reasoning of Mahn and Ramirez-Contreras, persuades us that the Pennsylvania felony fleeing statute does not qualify as turpitudinous. While the failing to stop for a police officer while crossing a state line is conduct that may put another in danger, it does not necessarily do so. The agency therefore erred in its conclusion that King was convicted of a CIMT.

CA9 on CAT, Guatemala: De Leon Lopez v. Garland

LexisNexis: We conclude: (1) the record in this case compels the conclusion that two of De Leon’s attackers were police officers during a July 2011 incident; (2) De Leon showed acquiescence on the part of the Guatemalan government with respect to that incident because government officials— namely, the two police officers—directly participated in the incident; and (3) the record indicates that the IJ and BIA’s conclusion that De Leon is not likely to be subjected to torture with government acquiescence if returned to Guatemala disregards several important circumstances pertinent to evaluating the likelihood of future torture. In light of these errors, we grant the petition and remand for the agency to reconsider De Leon’s application for relief.

Texas Drops Challenge To Biden’s Title 42 Child Migrant Policy

Law360: The state of Texas on Wednesday agreed to drop its challenge to a provision of the pandemic-era Title 42 policy which exempted unaccompanied minor migrants from being expelled from the U.S. during the COVID-19 pandemic.

Ill. Professor, Students Can’t Halt Chinese Student Visa Ban

Law360: An Illinois university professor and students can’t stop the Biden administration from enforcing a Trump-era policy barring student visas to Chinese nationals who are connected to any entity in China that supports its “military-civil fusion strategy,” a federal judge has ruled, denying the plaintiffs’ bid for a temporary restraining order.

Soldiers Forgo $10M Citizenship Dispute Fee For $2.75M

Law360: A class of foreign-born military recruits who sought $10 million in attorney fees after winning back their expedited path to naturalization two years ago have settled for $2.75 million in the interest of conserving resources and avoiding further litigation risks.

Legal Organizations Sue ICE for Illegally Preventing Attorneys from Communicating with Detained Immigrants in Four States

AIC: Several legal services organizations filed a lawsuit today against Immigration and Customs Enforcement (ICE) for unlawfully preventing attorneys from communicating with immigrants detained in four detention facilities in Florida, Louisiana, Texas, and Arizona.

USCIS Implements New Process for Venezuelans

USCIS: On Oct. 12, the Department of Homeland Security (DHS) announced a new process for Venezuelans.

DHS Designates Ethiopia for Temporary Protected Status for 18 Months

USCIS: Only individuals who are already residing in the United States as of October 20, 2022 will be eligible for TPS.

USCIS Extends COVID-19-related Flexibilities

USCIS: U.S. Citizenship and Immigration Services is extending certain COVID-19-related flexibilities through Jan. 24, 2023, to assist applicants, petitioners, and requestors.

From Politico:

. . . .

But immigrant advocates note that some of their demands aren’t contingent on Congress or the courts, which makes it all the more exasperating as to why the administration has failed to deliver.

Some told POLITICO they simply wanted to see the administration remedy the harm caused by the Trump administration’s family separation policies. Others want to see follow-up on early proposals to protect immigrant workers in labor disputes.

The administration further angered the community last week when it announced plans to use the Trump-era pandemic policy, Title 42, to expel Venezuelan migrants crossing the border illegally as part of its new humanitarian parole program for them. Advocates decried the expansion of Title 42, which the Justice Department is fighting in court, as a continuation of the Trump “playbook.”

. . . .

The biggest, most significant “unforced error” by the Biden Administration has been the failure to “clean house” at EOIR and to reform the Immigration Courts to be a model of great, scholarly, humane judging, and a bastion of due process, fundamental fairness, and best judicial practices.

The Federalist Society and the Heritage Foundation set forth a successful “blueprint” for a far-right takeover of not only the Immigration Courts, but the entire Article III Judiciary. The Trump Administration adopted and successfully followed it!

By stark contrast, the Dems have failed to act timely and decisively on the one all-important Federal court system that they completely control! EOIR is a system that probably has more impact on the future of America — or whether there will even be a future America — than any court short of the Supremes!

Garland’s dismissive treatment of the informed views of immigration, human rights, and racial justice experts — who have had “hands on” experience with “America’s most dysfunctional courts” (the Immigration Courts) — has undermined our legal system and hamstrung almost every other progressive social justice initiative — from voting rights to abortion!

Garland’s failure to bring in experienced, dynamic, inspirational, respected, “Tier One” progressive practical scholar/leaders — folks like, for example, Dean Kevin Johnson, Professor Karen Musalo, Marielena Hincapie, Professor Phil Schrag, Margaret Stock, Professor Michele Pistone, and Judge Dana Leigh Marks — to clean up EOIR, kick some tail, and create “the best, fairest, most efficient courts in America” — is beyond inexcusable!

Dems are a self-inflicted mess when it comes to immigration — apparently because those “calling the shots” are more “Stephen Miller Lite” than they are Julian Castro and other Democrats who understand the essential importance of immigrants and of standing up for their rights — starting with the “retail level” of American justice.

As one frustrated experienced practitioner recently told me: “Biden’s entire immigration policies are a train wreck. He didn’t take the action he said he would. The practice of immigration law is soul crushing.”

“Soul crushing!” Those words should be a “wake up call” to the “tone deaf” policy honchos in the Administration. It shouldn’t be this way in a Dem Administration that was elected because they promised to do better and to stand up to the lies, myths, and false narratives of the nativist right! Once in power, Dems don’t seem to be able to distinguish between their friends and their adversaries. That’s proven NOT to be a “formula for success!”

For every immigrant/racial justice advocate that the Biden Administration wears down and demoralizes, two “new recruits” for the NDPA will arise, fully energized to keep litigating, winning, and raising hell until due process, human rights, fundamental fairness, and racial justice get some long overdue ACTION. Based on results to date, that means continuing to “beat Garland’s brains out” in court! The talent and creativity is obviously “out here,” not in Garland’s “Halls of (In)Justice!” Given that the “Stephen Miller Group” is also challenging the Administration in court, Garland will eventually find himself doing nothing but litigating immigration issues and getting walloped by both sides!

Meanwhile, as the Administration daily fails on immigration, human rights, and racial justice within the Executive Branch, my mailbox and message box are overflowing with desperate requests from Dem politicos, from Joe, Kamala, Nancy, and Chuck on down, for more donations of money and time. But, once the election cycle is over, our views are ignored, and we are treated as “PNGs.” Meanwhile, those who actively undermined immigrants’ rights and diminished due process are rewarded or retained in key positions where they continue to heap damage on the most vulnerable among us and frustrate their supporters.

Doesn’t seem like a sustainable future for the Democratic Party or for American democracy! But, hey, I’m just a retired Immigration Judge. Maybe my friends in the social justice movement enjoy being treated as “chopped liver” — frozen out and ignored — once they have helped elect Dems.

Republicans boldly “run on the big lie.” Meanwhile, Dems “run from the truth” about immigrants and their all-important role in America’s future! Go figure!

A quote from a recent NY Times article struck me as aptly summarizing the failure of leaders of both political parties to take an honest, creative, and practical approach to the opportunity presented by continuing human migration:

Immigration in the United States is broken, but one side of the fence wants to study the root causes of the problem, and don’t want to see what’s happening right here,” Mr. [John] Martin [deputy director of the Opportunity Center for the Homeless in El Paso] said, squinting beneath the brim of his cowboy hat. “And the other side wants to build a wall which would become a dam and eventually burst.”

https://www.nytimes.com/2022/10/20/opinion/el-paso-migrant-buses-republicans.html?smid=nytcore-ios-share&referringSource=articleShare

Former AG Jeff “Gonzo Apocalypto” Sessions went to the border to preach his “gospel” of anti-immigrant hate, lies, nativist myths, and to “fire up” officials for one of the biggest unconstitutional abuses of prosecutorial authority in modern American history.  Indeed, that is when one reporter coined the term “Gonzo Apocalypto” to describe the absolute nonsense spewing from Sessions’s mouth.

Sessions orchestrated a vile “strategy” of family separation from which the victims haven’t yet, and may never, fully recover. Interestingly, he has also escaped accountability.

By contrast, Garland, to my knowledge, has never bothered to visit the border and engage first-hand with the human carnage his failed “courts” and abuse of both the Constitution and asylum law inflict on others. He interacts neither with those outside government trying to uphold the rule of law nor the enforcement officials given “mission impossible.” He absolves himself from observing the effect that his failure to carry out orderly, humane, legally compliant refugee and asylum processing — using existing law rather than extralegal “gimmicks” — has on communities on the border and in the interior.

Sessions was a vile, intellectually dishonest, and immoral leader; Garland is simply a failed and disengaged one. But, the difference might not be readily apparent to most practitioners laboring in the foul trenches of Garland’s dysfunctional “court” system.

From my observation, there are folks out here interested in, and capable of, addressing the opportunities, potential benefits, and challenges presented by the inevitability of human migration in the 21st Century. Most of them, unlike “pontificating politicos,” have, at some point, “walked the walk” with those humans caught up in the migration dilemma, on both sides of the border.

But, leaders of neither party are interested in the constructive ideas and solutions developed within the rule of law that these unusually talented and dedicated individuals can offer. As long as that is the case, the realities of human migration, false promises, racially driven bias, and wildly inconsistent application of justice in America will continue to vex both politicians and the voters who put such “non-problem-solvers” in office!

☠️ GARLAND’S QUASI-JUDICIAL TORTURE CHAMBERS — FROM COAST TO COAST, EOIR APPLIES WRONG LEGAL STANDARDS, IGNORES EVIDENCE IN EFFORT TO ILLEGALLY SEND PEOPLE TO TORTURE!

“Sir Jeffrey” Chase reports on H.H. v. Garland, a case in which the Round Table filed an amicus brief in behalf of the respondent. Many thanks to our friends Adam Gershenson, Zachary Sisko, Marc Suskin, Valeria M. Pelet del Toro, Samantha Kirby, and Cooley LLP on the brief for amici curiae Former Immigration Judges and Former Members of the Board of Immigration Appeals.

H.H. V. Garland

For the reasons detailed above, we conclude that the BIA erred by: (1) applying the incorrect standard of review to uphold the IJ’s denial of CAT relief as to Honduras, in a misguided effort to accommodate the IJ’s error of law in requiring a showing of willful acceptance rather than willful blindness; (2) improperly failing to address H.H.’s argument that he would likely be tortured by or at the instigation of Honduran officials; and (3) failing to meaningfully address H.H.’s argument that MS-13 members may act under color of law.21 Accordingly, we grant the petition for review, vacate the BIA’s decision insofar as it denied H.H. deferral of removal to Honduras, and remand the case for further proceedings consistent with this opinion.

CA9 on CAT, Guatemala: De Leon Lopez v. Garland

https://www.lexisnexis.com/LegalNewsRoom/immigration/b/insidenews/posts/ca9-on-cat-guatemala-de-leon-lopez-v-garland#

“Risvin Valdemar De Leon Lopez (“De Leon”), a native and citizen of Guatemala, petitions for review of a Board of Immigration Appeals (“BIA”) decision dismissing his appeal of an Immigration Judge’s (“IJ”) order denying his application for relief under the Convention Against Torture. We conclude: (1) the record in this case compels the conclusion that two of De Leon’s attackers were police officers during a July 2011 incident; (2) De Leon showed acquiescence on the part of the Guatemalan government with respect to that incident because government officials— namely, the two police officers—directly participated in the incident; and (3) the record indicates that the IJ and BIA’s conclusion that De Leon is not likely to be subjected to torture with government acquiescence if returned to Guatemala disregards several important circumstances pertinent to evaluating the likelihood of future torture. In light of these errors, we grant the petition and remand for the agency to reconsider De Leon’s application for relief.”

Almost every time I “feature” the ongoing legal and operational disaster @ EOIR, Garland furnishes me with concrete examples. https://immigrationcourtside.com/2022/10/22/%e2%98%a0%ef%b8%8f%e2%9a%b0%ef%b8%8f%f0%9f%92%80garlands-star-chambers-slow-violence-on-people-of-color%f0%9f%a5%b5-bias-bad-law-bungling-bureaucracy/

These are two “doozies” from last Friday!

These aren’t “minor bureaucratic matters,” no matter how much Garland and his “clueless crew” over @ DOJ might want to treat them that way and hope they will go away! They won’t! Not if the thousands of us involved in the due process, fundamental fairness, and racial justice for all movement have anything to say about it (e.g., the “NDPA”)!

And we will continue to speak out against the parody of justice @ Garland’s EOIR! It’s a disingenuous and disgraceful performance by a Democratic Administration that will have “down the line” consequences!

While the Trump Administration admittedly left EOIR in complete shambles, that doesn’t excuse the Biden Administration’s failure to fix it. It’s not “rocket science!”  But, there is no way that the “Clown Show” 🤡 that Garland has chosen to run and staff EOIR (many inexplicably “held over” from the Sessions/Barr debacle) can fix it!

These are literally life and death cases in which Garland’s “faux expert” BIA “pretzels” the law, misconstrues facts, and “selectively reads” records to reach wrong results that deny protection and decree deportation! How is this acceptable performance from any tribunal, let alone one that is supposed to insure justice for those whose lives are on the line? How is this acceptable performance from a Democratic Administration that claimed fealty to human rights and racial justice, but takes neither seriously when it comes to EOIR?

There are plenty of “practical scholar experts” out here in the non-governmental sectors who would make much better appellate and trial judges, and administrators, than many of those Garland is inflicting on migrants and their attorneys.

What’s wrong with the Biden Administration? What’s “right”  about failed justice @ Justice?”

The poor performance of Garland as the “steward” of the Immigration Courts at EOIR is a threat to humanity, democracy, and a colossal waste of judicial and litigation resources at all levels of our justice system!

Maybe Merrick Garland SHOULD worry about running “America’s worst courts” and inflicting life-threatening injustice on his fellow humans!

🇺🇸🗽POLITICS/COMMUNICATION: Anand Giridharadas Has A Plan For Defeating Fascism!

https://twitter.com/intelligence2/status/1583053222495031297?s=20&t=0qtnWoCtSNnhf3i6nq3hVA

We’re not going to defeat fascism by talking about policy. Nor by issuing grave warnings. Nor by praying for the rain of indictments. Nor by despair.

We are going to defeat it by outcompeting it. Here is a proposal for how we can do that right now.

**********************

Watch the compelling “spot on” video at the above link. Many thanks to my friend Charles Kuck for passing this on!

The Dems once were the “party of practical problem solvers” — particularly at the local level with great organizations that effectively addressed issues on the minds of the local populace. After all, it was Dem House Speaker, the late Tip O’Neill, who famously said that “All politics is local” (although, perhaps contrary to popular notions, he did not “coin” that phrase.)

It’s not that today’s GOP solves problems. Far from it! Indeed they specialize in division, destruction (“the wrecking crew”), and making things worse. (How would you like to go to GOP Rep. MTG or Virginia GOP Gov. Glenn Youngkin to get help with mistreatment of your trans kid in school? Good luck with the one!)

Yet the GOP does excel in one area. That is channeling and fanning the rage, bitterness, and anger of folks in the community who feel left out or that “the system” has betrayed them. They are also great at using that collective anger and resentment for their own political ends — usually anti-democracy actions or picking on, demonizing, and falsely blaming vulnerable groups in society for all their ills.

Anand says it’s time for Dems to get back to communicating and problem solving: “outcompeting” and “outperforming,” if you will! That’s certainly true on a larger scale. But, it’s also true at Garland’s dysfunctional EOIR. There, bureaucratic nonsense, “built to fail gimmicks,” and false “deterrence rationale” have replaced scholarship, timeliness, and practical problem solving directed at the achievable, yet inexplicably elusive, “common good.” Time for a difference approach at the critical, yet often ignored, “retail level” of democracy!
