A Salvadoran attorney who fled death threats in her home country and built a new life in Oakland faces a nearly nine-year wait for her day in immigration court. She’s among hundreds of thousands stuck in the same bureaucratic limbo.

Ana and her son first arrived in Oakland in 2016 with a harrowing story and an urgent case for asylum. They had escaped the same gang that chased her niece out of El Salvador three years earlier. Ana said the gang’s leader had stalked and threatened her niece. When she intervened, Ana said, the gang retaliated with threats of sexual violence and death.

“They pressured me to agree to many things that could be in their favor, which I did not agree to,” Ana told The Chronicle in Spanish. The Chronicle is withholding Ana’s last name in accordance with its policy on anonymous sources because of the dangers she faces if sent back.

At her first appearance in San Francisco immigration court in 2017, Ana was told to return in 2019 to make her asylum case. That court date was postponed to this past November. Then Ana received notice that her hearing had been canceled again — and rescheduled to May 2025.

Ana represents just one of the 670,000 asylum requests in the U.S., a figure that continues to climb due to the complexity of the cases, Trump administration policies that delayed processing times and the federal government’s slow adaptation to the pandemic. According to the Transactional Records Access Clearinghouse at Syracuse University, the average wait time for an asylum hearing is 1,621 days — or nearly four-and-a-half years.

In an attempt to put a dent in the growing backlog, the Biden administration announced a strategy over the summer that previous administrations have tried to expedite cases for certain groups. President Biden’s “dedicated docket” catapults 5,000 migrants who crossed the southwest border of the U.S. after May 28 to the front of the line.

But critics warn the initiative means these recent arrivals have limited time to prepare their immigration cases while migrants who have been waiting for years, like Ana, must wait even longer.

A growing backlog

Immigration Judge Dana Leigh Marks feels constant pressure to avoid getting sick. She is one of 28 judges in a San Francisco court that is fielding 78,992 immigration cases. That means if Marks needs to cancel court for any reason, the ramifications are years-long delays to “people whose lives hang on our decisions,” she said.

“That is the problem of being so overbooked,” added Marks, who spoke in her role as the president emeritus of the National Association of Immigration Judges. “The number of cases assigned to any judge have exponentially exploded in recent years.”

Like other federal immigration courts, San Francisco’s saw its asylum backlog start its sharp ascent in 2017, as the Trump administration began rolling out policy changes that tightened eligibility while increasing evidentiary thresholds, grinding processing to a halt. The court went from more than 25,000 asylum claims that year to nearly 56,000 this year, TRAC figures show.

The pandemic compounded delays by forcing courts to cancel or significantly scale back in-person hearings. Part of the problem is that the Department of Justice, which runs the nation’s immigration court system, was slow to implement video conferencing technology when judges began working from home in March 2020, Marks said.

“Other state and federal courts across the country pivoted much more quickly to the use of remote technology, which allowed them to keep their caseload moving,” Marks said.

This past summer, over a year into the pandemic, immigration hearings began taking place over Webex, a video conferencing platform. Still, only six of San Francisco’s 28 immigration judges have been set up with government-issued laptops and special audio recording capabilities to conduct the video hearings, Marks noted, and the current average wait between asylum hearings has ballooned to 1,715 days.

Ana was not given the option of a video hearing, said Julie Hiatt, Ana’s attorney from Centro Legal De La Raza. Armed with detailed legal briefs and hundreds of pages about conditions in El Salvador, Hiatt said she was ready to present her client’s gender-based persecution claim for asylum in November. But the judge couldn’t be in court that day and the hearing was pushed to the judge’s next available opening — more than three years away.

Despite believing her client has a strong asylum claim, Hiatt said the lengthy wait will make it harder to win Ana’s case, and not because the facts of the case have changed.

“I worry about memory fading, circumstances changing and everything that can happen that could impact on her ability to confidently tell her story when it comes time to do so,” Hiatt said.

Immigration advocates worry President Biden’s dedicated docket plan to cut down processing times could end up hurting asylum seekers, by rushing ill-prepared new arrivals through the process while supplanting immigrants whose cases have languished for years.

An analysis by the Migration Policy Institute shows that in 17,000 expedited docket cases under previous administrations, the majority of immigrants lacked legal representation and 80% of them were ordered removed without even being in court.

History appears to be repeating. Current Justice Department data shows that of San Francisco’s 1,138 dedicated docket cases being heard right now, 1,008 — nearly 90% — do not have legal representation.

“This docket is not fair to asylum seekers,” said Milli Atkinson, an attorney with the Justice & Diversity Center of the Bar Association of San Francisco who has witnessed local dedicated docket hearings. “These expedited dockets make it extremely difficult for respondents to find counsel and puts enormous pressure on them to move forward with their case without an attorney.”

Notably, a 9-year wait for a merits hearing in Immigration Court more than spans the tenure of even a two-term Administration!

The scary thing is that San Francisco probably is by no means the most screwed up Immigration Court in the nation. The 9th Circuit, which reviews some of their cases and establishes precedents for the Circuit, does sometimes “call out” chronically poor performance by EOIR and poorly reasoned, anti-immigrant “precedents” emanating from the BIA and Garland’s predecessors as AG. 

But, with a large number of Trump/McConnell right wing appointees, many of them younger, even the 9th Circuit is moving rightward. So, unless Biden can stem the tide, one of the last “fail safes” in a dysfunctional system might be neutered.

Although Garland has (too slowly) undone some of the worst precedents, he has yet to generate the positive legal guidance necessary to ”move dockets” by granting more cases like Ana’s. Without a new BIA, he lacks the “onboard, progressive, expert, due-process-oriented legal and judicial talent” to fashion and enforce the long overdue and badly needed “enlightened precedents” that will save lives and straighten out the law on a nationwide basis. 

As pointed out by this article and other critics, EOIR is “far behind the eight-ball” in using technology to meet the challenges of justice in the age of COVID. Although EOIR has been using some form of televideo for over a quarter of a century, they fell behind other court systems when it came to adapting to COVID. After more than two decades of largely wasted time and money, the Immigration Courts still lack a functional e-filing system, which greatly compounded both dangers and chaos during COVID.

Worse yet, what limited technology that is available at EOIR appears to be used primarily for the benefit of EOIR and its bureaucrats, not for the convenience of the public it supposedly serves. How does this “practical nonsense,” unfolding on a daily basis, without meaningful engagement with judges and parties before the courts, meet any definition of competent “service to the public?” Garland has ignored aspirational, achievable, visions and progressive goals for a culture of “good enough for Government work” and “who cares, it’s only aliens and their ‘dirty’ attorneys!” 

Moreover, his continuation of the unconscionable, scofflaw use of Title 42 to suspend the asylum process and send legal asylum seekers to danger or death without due process undermines his credibility and integrity as a leader and role model. Although Garland pretends otherwise, judicial, and legal leadership has a moral element that requires a sense of urgency, courage, and demonstrated competence. Garland’s leadership (and that of his “Senior Team” of political appointees at the DOJ) has fallen woefully short!

Judge Dana Leigh Marks is a good example of Garland’s exceptionally poor approach. One of the best judges in America, on any court, including the Supremes, Marks is a proven fearless leader and extraordinary legal mind. Her victory at the Supremes in INS v. Cardoza-Fonseca, establishing the “well-founded-fear” international standards for asylum, is probably the Court’s most important humans rights’ case of the 20th Century. Her dynamic, inspiring leadership of the National Association of Immigration Judges has helped expose the grotesque shortcomings of EOIR @ DOJ while giving rise to the national movement for an Article I independent Immigration Court outside the DOJ.

I daresay that Judge Marks can “move” asylum cases through the system without tromping on anyone’s due process tights. She, and others like her, both currently in and outside the system, could set a new tone and lead the way toward a better, fairer future! 

Too many of her fellow judges, and most members of the BIA not named Saenz, lack the expertise, experience, motivation, and courage to do that. So, cases like Ana’s, which actually might serve as positive precedents for documenting and granting other asylum cases, languish among Garland’s inconceivable backlog while other potentially grantable cases are unfairly pushed to the front of the line without attorneys, adequate preparation time, or accountability for judges programmed to deny rather than stand up for due process and asylum seekers’ legal rights! Much, but by no means all, of this predictably sloppy work product is returned by the Article IIIs for “redos,” thus adding to the backlog, chaos, and “institutionalized arbitrariness” of this approach to “justice!”

Judge Marks is an articulate, energetic experienced public spokesperson for immigration and court reform. She knows where the “bodies are buried” and the “deadwood stored” at EOIR; she has has actual solutions and ideas for addressing many problems now infecting our Immigration Courts. And, unlike past generations of EOIR bureaucrats and “go along to get along judges,” she has no fear and can’t be intimidated!

Judge Marks is already on the payroll. Garland could and should have tapped her on “Day One” to be part of a “Transitional Leadership Group” at EOIR to start “knocking heads and making long overdue due-process-driven changes” while Garland and his Team, with outside input, conducted an expedited emergency, merit-based process to recruit and replace the BIA and Senior Management at EOIR with a diverse team of progressive “practical scholars” as judges and dynamic, progressive, problem-solving leaders and administrators of the Immigration Courts. These sensible recommendations actually were made during the transition period, only to be totally ignored by Garland!

Instead, after a nearly a year, Garland’s tone deaf and dilatory (non)approach to EOIR reform has allowed the system’s continued disintegration, further undermined the credibility of his DOJ, demoralized and “de-enthused” potential supporters in the advocacy community, and continued to degrade and destroy human lives.

Like Judge Marks, these folks would put an end to “Aimless Docket Reshuffling,” the culture of mindless denial, the improper use of Immigration Courts as (failed) deterrence, and start holding the “main perpetrators” at EOIR and at DHS accountable for their disregard and disrespect for the quasi-judicial system. They would also know how to write and apply accessible “practical scholarly” precedents (written in plain English, rather than “opaque judicial gobbledygook”) that would fulfill our legal (not to mention moral) obligations to provide fair and generous treatment of vulnerable asylum seekers and others caught up in this now-disreputable and dysfunctional parody of a court system.

Instead, Garland has countenanced a continuation of “Clown Courts” 🤡 and “star chambers” ☠️ that have become contributing factors in the precipitous and perhaps fatal disintegration of democracy in America.

Undoubtedly, the same White Nationalist “replacement theory” motivation that was behind Trump’s weaponization of the Immigration Courts is a driver of the overall anti-democracy movement on the right.

It’s a shame, that given at least a good shot at making a difference, Dems are too timid, distracted, and frankly, inept to pick off the “low hanging fruit” within their reach!

Paul Schmidt, a former chairman of the Board of Immigration Appeals, doesn’t think so. He claims that Biden could have established due process and the rule of law at the border and expanded refugee programs in potential sending countries but he didn’t, “preferring instead to use modified versions of ‘proven to fail deterrence-only programs’ administered largely by Trump-era holdovers and other bureaucrats insensitive to the rights, needs, and multiple motivations of asylum seekers.”

Predictably, nobody is pleased.

Stern does a “victory lap” over Biden’s 40 great Article III judicial appointments to the lower Federal Courts, closing with the astounding claim that: “Democrats are finally playing hardball with the courts.”

In truth, Dems are only belatedly starting to do what the GOP has been doing over four decades: Get your guys in the positions where they make a difference for better (Dems, in theory) or worse (GOP in practice).

Appointing a diverse, talented, progressive group of 40 out of 870 Article III Judges is an important, necessary, and long, long overdue start; but, it’s not going to make a cosmic difference overnight!

By contrast, there are about 550 Immigration Judges, the majority appointed by GOP restrictionist AGs, many with mediocre to totally inadequate credentials for the job. And, it shows in the consistently substandard performance and mistake-riddled, haphazard “jurisprudence” emanating from Garland’s EOIR.

The main qualifications for a number of these pedestrian to totally outrageous appointments appears to be willingness to carry out former GOP AGs’ restrictionist, nativist policies, or at least to adhere to the DOJ’s enforcement-oriented agenda, while ignoring, distinguishing, or downplaying the due process rights of migrants!

This is “complimented” by an appellate branch (the BIA) with about two dozen judges hand-selected or retained for notorious anti-immigrant records or willingness to “go along to get along” with the wishes of DHS Enforcement. The BIA turns out some truly horrible, almost invariably regressive, “precedents.” A number are so lacking in substance and coherent analysis that they are unceremoniously “stomped” by the Article IIIs despite limitations on judicial review and the travesty of so-called “Chevron deference” that serves as a grotesque example of Supremes-created “judicial task avoidance” by the Article IIIs.

From an informed Dem progressive perspective, it’s an infuriating, ongoing, unmitigated disaster! Only one BIA appellate judge, recently appointed “progressive practical scholar” Judge Andrea Saenz, would appear on any expert’s list of the “best and brightest” progressive legal minds in the field.

Unlike Article III Judges, who are life-tenured, EOIR Judges serve at the pleasure and discretion of the Attorney General and can be replaced and reassigned, including to non-quasi-judicial attorney positions, “at will.” 

Starting with Attorney General John Ashcroft’s notorious “BIA Purge of ‘03,” GOP AGs haven’t hesitated to remove, transfer, “force out,” marginalize, demoralize, discourage from applying, or simply not select EOIR judges who stood for due process and immigrants’ rights in the face of nativist/restrictionist political agendas.

Yet, for eight years of the Obama Administration and now a year into the Biden Administration, Dem AGs have lacked the guts, awareness, and vision to fight back by “de-weaponizing” the regressive GOP-constructed Immigration Judiciary and recruiting replacements from among the “best and the brightest” among the “deep pool” of expert, intellectually fearless “progressive practical scholars.”

Not only that, but Dems have totally blown a unique opportunity to remake and establish the Immigration Judiciary not only as “America’s best judiciary” — a model for better Article IIIs — but also as a training ground for the diverse progressive judiciary of the future! 

Even more significantly, tens of thousands of lives that should have been saved by an expert, due-process-oriented, racially sensitive judiciary have been, and continue to be, sacrificed on the alter of GOP nativism and Dem indifference to quality judging and human suffering in the Immigration Courts!

Compare the diverse, progressive backgrounds and qualifications of “Stern’s 40” with those on the totally underwhelming list of the most recent Garland “giveaways” of precious, life-determining Immigration Judge positions! See, e.g., https://www.justice.gov/eoir/page/file/1457171/download

The progressive talent is definitely out there to change the trajectory of the Immigration Courts for the better! Garland’s failure to inspire, recruit, appoint, and tout the “best and brightest” in American law for his Immigration Courts is a horrible “whiff” with disturbing national and international implications!

Article III Federal Courts deal with the mundane as well as the profound. By contrast, lives and futures are on the line in every single Immigration Court case! Often effective judicial review of EOIR’s haphazard, widely inconsistent, unprincipled, and one-sided decisions is unavailable, either as a legal or practical matter. The exceptionally poor performance of the Immigration Courts that continues under Garland threatens the underpinnings of our entire justice system and American democracy!

Right now, Garland’s broken system has a largely self-created 1.5+ million case ever-expanding backlog! At a very conservative estimate of four family members, co-workers, employees, employers, students, co-religionists, neighbors, and community members whose lives are intertwined with each of those stuck in Garland’s hopelessly broken, biased, and deficient system, at least 6 million American lives hang in the balance — twisting in the wind among Garland’s “backlog on steroids!” Yet, amazingly, it’s “below the radar screen” of Stern and other leading progressive voices!

I doubt that any Federal Court in America, with the possible exception of the Supremes, holds as many human lives and futures in its hands. Not to mention that “dehumanization” and “Dred Scottification” of the other in Immigration Court drifts over into the Article III Courts on a regular basis. Once you start viewing one group of humans as “less than persons” under the Constitution, it’s easy to add others to the “de-personification” process.

Yet, Garland cavalierly treats the Immigration Courts as just another mundane piece of his reeling bureaucratic mess at the DOJ. The long overdue and completely justified “housecleaning” at Trump’s anti-democracy insurrectionist regime seems far from Garland’s serenely detached mind!

For Pete’s sake, even ICE Special Agents understand the need to “rebrand” themselves by escaping the inept and disreputable ICE bureaucracy left over from Trump:

They say their affiliation with ICE’s immigration enforcement role is endangering their personal safety, stifling their partnerships with other agencies and scaring away crime victims, according to a copy of the report provided to The Washington Post.

But, Garland doesn’t understand the well-deserved toxic reputation of EOIR among legal experts? Gimme a break!

Garland also stands accountable for his spineless failure to insist on a dismantling of the bogus, illegal, immoral, and ultimately ineffectual Title 42 abomination at the Southern Border and an immediate return to the rule of law for asylum seekers.

Unless and until the Dems get serious about gutsy, radical progressive reforms of the Immigration Courts, the downward spiral of American justice will continue! Lives will be lost, and many of those who helped put Dems in power will be pissed off and “de-motivated” going into the midterms. That’s a really bad plan for Dems and for America’s future!

That — not a false sense of achievement — should have been the “headliner” for Stern and other progressive voices!

Judge Kacsmaryk was appointed to the bench by Trump & McConnell in 2019. He is a former Federal prosecutor, deputy general counsel of a right wing religious group, and member of the Federalist Society. His nomination was (obviously unsuccessfully) opposed by more than 200 prominent civil rights, religious tolerance, and human rights groups.

Here’s an excerpt from their letter in opposition addressed to the Senate:

On behalf of The Leadership Conference on Civil and Hum­­­­an Rights, a coalition of more than 200 national organizations committed to promoting and protecting the civil and human rights of all persons in the United States, I write in strong opposition to the confirmation of Matthew Kacsmaryk to be a U.S. District Judge for the Northern District of Texas.

Nominees to the federal courts must be committed to respecting the law, Constitution, and core American values of justice, fairness, and inclusivity.  Mr. Kacsmaryk does not meet this standard.  He is an anti-LGBT activist and culture warrior who does not respect the equal dignity of all people.  His record reveals a hostility to LGBT equality and to women’s health, and he would not be able to rule fairly and impartially in cases involving those issues.

Interestingly, the letter was signed by none other than Vanita S. Gupta, then President & CEO of the Leadership Conference on Civil and Human Rights and currently the Associate Attorney General of the U.S. 

Gupta and her colleagues had Judge K “pegged” as an unqualified righty bigot then! But, with the lineup currently in place at the 5th and the Supremes, it remains to be seen whether there is any effective short-term remedy for his grotesque abuses of power and human rights.

Judicial appointments are important! Maybe it’s time for Gupta and others at DOJ to treat Immigration Judge and BIA appointments as such!

We reiterate that “judicial review necessarily requires something to review and, if the agency provides only its result without an explanation of the underlying fact finding and analysis, a court is unable to provide judicial review.” The required review is simply not possible when we are provided with nothing more than the kind of one-line checklist that is relied upon here. We cannot allow an IJ or the BIA to dispense with an adequate explanation of a final decision merely to facilitate or accommodate administrative expediency. Since “the [IJ]’s failure of explanation makes it impossible for us to review its rationale, we [will] grant [Valarezo-Tirado’s] petition for review, vacate the [IJ’s] order, and remand the matter to [the IJ] for further proceedings consistent with this opinion.” … A 2019 study found that “on average each [immigration] judge currently has an active pending caseload of over two thousand cases.” Nevertheless, we cannot allow incredibly difficult logistics to give license to IJs to skirt their responsibilities. This includes the obligation to inform the petitioner of the reasons for the IJ’s decision and provide an adequate explanation of the decision that does not require us to parse through the testimony in search of evidence that supports it. A two-sentence recitation on a bullet-point form will rarely, if ever, provide sufficient reasoning for a decision. A decision, such as the one here, that does not refer to record evidence will never suffice. Because, here, the IJ’s decision was not supported by substantial evidence, we will vacate the decision and order and remand to the IJ for proceedings consistent with this opinion.”

Interestingly, this was a “reasonable fear review” proceeding following “reinstatement” of a removal order. Even before the Trump kakistocracy, Immigration Judges once were told that there was no need for a reasoned decision because their actions were “non-reviewable” by the BIA or the Circuits. Later, in the Obama Administration, as some Circuits took an interest in these cases, judges were encouraged by EOIR HQ to enter brief decisions so that OIL could defend them on appeal, if their “no jurisdiction to review” argument failed.

There is a serious defect in a system that provides no meaningful review or appellate direction in cases with life or death consequences. Obviously, this is a system focused on something other than fairness, scholarship, quality, and justice!

After years of being told  (even forced, through bogus “production quotas’) to “cut corners” and “move ‘em out” by their political “handlers” at the DOJ, neither EOIR “management” nor the current BIA is capable of providing the bold leadership, progressive “fair but efficient” scholarship and direction, quality control, and positive precedents and systemic changes necessary to insure that EOIR’s “once and future vision” of “through teamwork and innovation, becoming the world’s best tribunals guaranteeing fairness and due process for ALL” is finally realized. After four years or intentional degradation and movement in exactly the OPPOSITE direction by Sessions, Barr, and their “Miller Lite” cronies and toadies, it’s time for a change!

Obviously, the due-process-denying and demeaning (to both IJs and those seeking justice) “production quotas” and equally bureaucratic and bogus “performance work plans” should already have been revoked by Garland. They could replaced with a meaningful system of appellate supervision and judicial professional responsibility and training modeled on that of “real courts.”  For example, check out the system used by the DC Court system to maintain professionalism, provide constructive feedback, and make recommendations for tenure decisions on judges, with both public and peer participation.

As the Third Circuit points out, high volume is not an excuse for sloppy work and denial of due process! The backlog can be slashed and justice restored, and even improved, while maintaining high standards of quality and implementing and enforcing best practices. EOIR indeed could become a “model progressive court system.” But, it’s going to take a new team of progressive judges and qualified progressive Administrators, folks with experience in the “horrors of today’s Immigration (not) Courts” and an unswerving commitment to due process and best practices to get the job done!

If Republicans are truly worried about the supposed scourge of undocumented immigrants, they should start building that “big, beautiful door” on our borders that Donald Trump always talked about.

The solution to concerns about “illegal immigration” is creating more legal pathways to immigrate here.

Immigration reform has stalled for decades, despite widespread agreement that the existing system is broken, and occasional bipartisan attempts to fix it. The latest sweeping reform bill, backed by President Biden, has gone nowhere, unlikely to secure enough Republican votes to avoid a filibuster.

So now Senate Democrats are attempting a workaround. They’ve signaled that they’ll include a narrow subset of immigration issues in their forthcoming reconciliation bill, which could be passed with only Democratic votes.

Exact details are still being hashed out, but the bill is expected to contain a pathway to citizenship for certain categories of undocumented immigrants, including “dreamers” (unauthorized immigrants who came to the United States as children), those with temporary protected status (people from countries facing emergencies such as armed conflict or natural disaster), essential workers and farm laborers.

A majority of both Democratic and Republican voters support earned legalization of these groups, according to recent polls.

This legislative strategy is by no means a slam-dunk. Moderate Democratic lawmakers need to get on board, since passing the bill through the reconciliation process would require all 50 Senate Democrats’ votes. The biggest wild card, Sen. Joe Manchin III (D-W.Va.), has already indicated his support, which seems promising.

The bigger hurdle involves legislative rules: The Senate parliamentarian must determine that these immigration measures are sufficiently budget-related to include in the reconciliation process. Legalizing millions of undocumented migrants would have some effect on federal budgets — for example, through more immigration application fees and taxes on legalized immigrants’ earnings. Activists also point to a 2005 reconciliation bill that included different immigration-related provisions. Even so, the parliamentarian may nix these particular measures.

None of this has stopped Republicans from preemptive scaremongering about the “illegal alien” hordes supposedly rushing our “open borders” to seize their “amnesty.”

“Democrats are trying to sneak mass amnesty for millions of illegal immigrants through Congress under the cover of their budget scheme,” warned Rep. Steve Scalise (R-La.).

“The Democrats want to include a massive amnesty in that legislation,” echoed his colleague Sen. Tom Cotton (R-Ark.). “That will simply act as a bigger magnet for more illegal immigration into this country.”

This is nonsense. First and foremost, the population eligible for legalization would likely be restricted to people who’ve already been here for some minimum period of time, rather than those contemplating coming, say, tomorrow. This is how that broader, Biden-backed bill works, and how previous legalization proposals have been structured.

More importantly, though, if these restrictionists are really so concerned about all the immigrants slipping in through the back door, the best solution is a more accessible, clearly monitored front door.

Medina has lived for two years in this city’s El Buen Samaritano shelter, managed by a religious organization, along with his 15-year-old son Nahúm Medina. Their asylum petition was initially rejected in 2019 and he stayed in Ciudad Juárez under the Migrants Protection Protocols, waiting for a second chance.

The MPP or “Remain in Mexico” program was created in 2019 by the Trump administration, which forced people seeking asylum to remain in Mexico. As of May, there were 71,002 active cases.

The Biden administration is making a serious mistake in placing the self-interest of the Justice Department ahead of the people’s right to know if former Atty. Gen. William Barr acted to cover up Donald Trump’s possible engagement in obstruction of justice.

A federal judge in Washington, D.C., in early May ordered the release of a crucial Justice Department memo that will shed light on Barr’s conduct and whether he acted inappropriately. Rather than comply with the judge’s command and disclose the document, the Biden Justice Department is appealing the order in an effort to keep the memo secret.

In March 2019, special counsel Robert S. Mueller III delivered his report into Russian interference in the 2016 presidential election to then-Atty. Gen. Barr. While keeping the report secret, Barr sent a letter to congressional leaders purporting to “summarize the principal conclusions.” Barr said that Mueller “did not draw a conclusion — one way or the other — as to whether the examined conduct constituted obstruction,” and that “the evidence developed during the Special Counsel’s investigation is not sufficient to establish that the President committed an obstruction-of-justice offense.” Trump then declared that he was fully exonerated.

Barr said that he had reached his conclusion “in consultation with the Office of Legal Counsel and other Department lawyers.” A Freedom of Information Act request was filed by a watchdog group to obtain the OLC memo that purportedly was the basis for Barr’s judgment that the Mueller report exonerated Trump of obstruction of justice.

A reading of the Mueller report indicates that Barr’s statements were a gross mischaracterization of the evidence it presented. There was substantial evidence that Trump had engaged in obstruction of justice and Mueller said that he offered no conclusion only because Justice Department rules prevented indicting a sitting president.

Federal Judge Amy Berman Jackson reviewed the OLC memo and concluded that there was no legal basis for withholding it from release. Indeed, she was sharply critical of the Justice Department’s arguments for secrecy. She said that the “affidavits” submitted in favor of withholding the document “are so inconsistent with evidence in the record, they are not worthy of credence.” She said that her review of the documents led her to conclude “that not only was the Attorney General being disingenuous then, but DOJ has been disingenuous to this Court with respect to the existence of a decision-making process that should be shielded by the deliberative process privilege.” She said that the agency’s “redactions and incomplete explanations obfuscate the true purpose of the memorandum.”

In plain English, she slammed the Justice Department for misleading the court in trying to keep the document secret.

This issue is central to a government operating under the rule of law: Did the attorney general act to deceive Congress and the American people to protect Trump from being seen as having engaged in obstruction of justice? The OLC memo is key to understanding what happened.

During his Senate confirmation hearings Judge Garland presented himself well and indicated a sound understanding of justice, the proper role of the Attorney General, and the public interest. However, that now appears to have been largely skillful misdirection.

Since actually being sworn in, Garland has, surprisingly and sadly, conducted business largely without regard to progressive values, expert advice, common sense, or the public interest.

Attorney General Launches Review to Reinvigorate the Justice Department’s Commitment to Access to Justice

U.S. Attorney General Merrick B. Garland today announced that the Justice Department will immediately begin work to reinvigorate its Office for Access to Justice and to restore the Justice Department’s role in leading efforts across government to seek and secure meaningful access to justice.

“Trust in the rule of law – the foundation of American democracy – depends upon the public’s faith that government seeks equal justice for all. That is the Justice Department’s core duty, and the mission upon which it was built. But without equal access to justice, the promise of equal justice under law rings hollow,” wrote Attorney General Garland in a memo to departmental leadership this afternoon.

The Attorney General directed the Justice Department’s leadership offices to immediately begin a review process that will engage all relevant stakeholders, both within the department and beyond. The review will initially explore, among other things, how the Justice Department and partners across federal, state, territorial, and tribal governments can alleviate entrenched disparities in our criminal justice system, address barriers to access in our immigration and civil legal systems, and advance health, economic, and environmental justice efforts. The Attorney General’s memo also charged Deputy Attorney General Lisa M. Monaco and Associate Attorney General Vanita Gupta with developing recommendations regarding the resources that will be required to reinvigorate the department’s Office for Access to Justice including a staffing strategy and placement within the department in light of its responsibilities.

The Attorney General will submit a detailed plan to the President for expanding the department’s role in leading access to justice initiatives across government within 120 days.

The Justice Department first launched an access to justice initiative in 2010. Building upon that important effort, the Office for Access to Justice was formally established in 2016 to plan, develop, and coordinate the implementation of access to justice policy initiatives of high priority to the department and the executive branch, including in the areas of criminal indigent defense and civil legal aid. However, during the prior administration, the office was effectively shuttered.

In addition to leading this strategic review within the Justice Department, Attorney General Garland will also help to lead access to justice initiatives across government as co-chair of the Legal Aid Interagency Roundtable, which the President reconvened today. That initiative will bring together more than two dozen federal departments and agencies to address the most pressing legal services challenges that low-income communities, communities of color, and many others across our country face today.

As always, actions speak louder than words or bureaucratic promises to “think about it, and get back to you!” 

So hopefully somebody will ask Garland how the following things going on in HIS EOIR right now “assist access to justice:”

  • Continuous, ongoing “Aimless Docket Reshuffling“ at EOIR that generates an astounding, unnecessary, growing, unaddressed by Garland 1.3 million case backlog that generally disadvantages and wears down the private bar;  
  • Elimination of reasonable continuances @ EOIR for the express purpose of favoring the DHS and making it more difficult to represent individuals in Immigration Court consistent with ethical requirements relating to adequate preparation and verification of claims; 
  • “Courts” improperly located in obscure, out of the way DHS detention centers where lawyers are seldom readily available and substandard conditions are intentionally used to duress individuals into giving up viable claims;
  • Court schedules controlled by unqualified bureaucrats in Falls Church who arbitrarily and capriciously set cases without regard to the needs of parties for preparation time, ethical guidelines, or their workloads;
  • Unreasonable, shortened, cookie cutter “briefing schedules,” designed to expedite removals at the expense of quality and legal excellence and to artificially “stress out” private attorneys, many serving pro bono or low bono;
  • Kids and other vulnerable individuals forced to “represent” themselves in Immigration Courts;”
  • “Judges” who lack immigration expertise and practical experience, therefore forcing already overburdened immigration counsel to “train” these judges, who never should have been appointed in the first place;
  • Hiring of “judges” at the trial and appellate level renowned for their hostility to asylum seekers (particularly women and those of color) and sometimes with established records of bias, rudeness, hostility, and unprofessional conduct toward the private bar; 
  • Systemic exclusion of private bar immigration, human rights, clinical advocates and experts from the Immigration Judiciary;
  • Bogus, due-process-denying “deportation quotas” that discourage scholarship and thoughtful complete litigation of life or death cases in favor of meeting artificial production requirements and timelines designed to keep the “EOIR deportation railroad” running; 
  • Promulgation of “operating produces” for Immigration Courts by Falls Church bureaucrats who have never appeared in Immigration Court, without prior consultation with either sitting Immigration Judges or “stakeholders” in the private bar; 
  • Failure after two decades of wasted effort and false starts to implement even a rudimentary nationwide e-filing system, thereby increasing the burden on private practitioners; 
  • Wrong-headed, anti-immigrant “precedents” intended to discourage individuals from pursuing claims in Immigration Court and to require advocates to appeal to Courts of Appeals to have any chance of obtaining justice for their clients;
  • Following of “worst practices” designed to abuse and increase the stress for advocates in Immigration Court, including failure to follow best health and sanitation practices;
  • Failure to have any qualified progressive immigration practical scholar “on staff” at DOJ who has actually practiced before the Immigration Courts and could credibly lead the reform effort.

Actually, I’m just getting started! But, I have other things on my agenda today, and you get the point! 

Unless progressive immigration advocates “raise hell” with the higher-up in the Biden Administration and on the Hill about Garland’s gross mismanagement of EOIR to date and his lack or expertise or genuine interest in long overdue, badly needed reforms, this is just another Dem “designed to fail” cosmetic effort; yet another insulting attempt by DOJ to fob off immigrants, the private bar, progressives, and their very legitimate needs with more BS “all talk, no action” ineffective policies and plans where immediate, radical progressive, due process reforms are needed, led by progressive experts! 

To state the painfully obvious, Vanita Gupta has enough knowledge and enough contacts in the human rights/civil rights community to have gotten someone from the outside in to take control of EOIR, empowered to knock heads, transfer the Trump/Miller anti-due-process “denial club” crowd and their enablers out, and start recruiting and hiring competent administrators, well-qualified progressive judges, and instituting due process enhancing procedures. Things should already be operating much better; and, as many of us told the Biden Transition Team, having “due process take hold and start acting” would send much needed “shock waves” throughout the “go along to get along” bureaucracy at EOIR who assisted Trump and Miller in putting the “final nail in the coffin” of the already-reeling Immigration Courts.

Advocates and members of the NDPA, the first step in vindicating your clients’ legal rights is to insist that your rights, professionalism, and expertise be respected by those in power. Team Garland is effectively “giving you the big middle finger!” 🖕 If you don’t stand up to this outrageous, dismissive treatment from a Dem Administration, how can you make things better for your clients?

Meanwhile, government watchdog groups expressed concerns over two people whose initial conversion requests had since been approved.

One such conversion was that of Carl Risch, whose October conversion request to be the deputy director, the No. 2 job, at the Executive Office for Immigration Review within the Department of Justice (a civil service job), was approved in December. Risch had been an assistant secretary for consular affairs at the State Department, a political job. His new job came with a $10,000 raise.

His is at least the second conversion in the last year to land at the EOIR, which conducts removal and deportation proceedings in immigration courts across the country.

“It’s a red flag when there are multiple people being converted to jobs at a single entity. It really raises an even larger concern,” Stier, of the Partnership for Public Service, said. “The process is supposed to be that a political appointee in no way has a leg up on the competition for a career job, but when you see multiple go to the same agency, you really have to wonder how it can be possible that the best qualified individuals are not once, but multiple times, people who are political appointees.”

Risch did not respond to multiple requests for comment. EOIR spokeswoman Kathryn Mattingly said Risch went through the standard pre-hiring review process with the OPM and that the agency had approved his new position.

So, the folks who saved due process and stood up for the Constitution and racial justice while Judge Garland was enjoying his cushy ivory tower job at the D.C. Circuit over the past four years remain on the outside, twisting in the wind ⚰️ while their clients and colleagues suffer daily abuse in “Garland’s Star Chambers!” Nice touch!

Meanwhile, Garland hands out the big bucks and a hideout for a notoriously unqualified Trump/Miller political hack imported from the DOS. What does Risch know about immigrant justice or court management? Nothing? Oh, but why is that a problem at EOIR?

He occupies what is supposed to be a key senior management position in America’s most dysfunctional “court system” — running a simply astounding 1.3 million (known) case, largely self-created backlog, grinding out sloppy, unprofessional, biased opinions regularly rejected by even conservative Courts of Appeals, setting horrible anti-immigrant precedents and endangering the lives, health, and safety of those who are caught up in EOIR’s continuing White Nationalist cesspool of cruelty, mismanagement, and gross incompetence?

Is it any wonder that immigrant justice and racial justice remain in free-fall under Biden and Garland?

Let’s lay it on the line! By now, Garland should have cancelled all the Trump-era precedents (“day 1 stuff”), cleaned house at EOIR HQ, and transferred the entire BIA to somewhere where they can inflict no more damage on the American legal system!

That would also have sent a powerful  “signal” to the many Immigration Judges who have established “asylum free zones” in Immigration Courts throughout the U.S. over the past two Administrations that there will be a return of due process and fundamental fairness for asylum seekers and other immigrants at EOIR. 

Judges can get with the program, start granting asylum and other protection as the law requires, thereby reducing backlogs the “old fashioned way” — consistent with due process and fundamental fairness. Or, they can ship out and sign up with Stephen Miller’s “Aryian Nation Legal Team” — where it appears that many of them would be more at home.

Garland should have brought in folks already on the payroll like Judges Dana Marks, Noel Brennan, & Amiena Khan, all experts in due process, judicial management, immigration, and human rights laws, all of whom have demonstrated true leadership, consistent courage, and independence throughout their distinguished careers, on at least a temporary basis to start restoring justice, rationality, and order in the Immigration Courts. 

They would already have identified qualified sitting judges who know how to grant asylum to serve as Acting Appellate Judges at the BIA to start turning things around by enforcing due process and issuing precedents that advance, rather than retard, due process, fundamental, fairness, and judicial efficiency. 

Meanwhile, they would be developing legitimate merit selection criteria to recruit and hire as judges practical experts who will fairly and efficiently apply due process and fundamental fairness to all asylum seekers and other respondents, regardless of race, color, or creed. These criteria could be used to recruit and  hire a diverse progressive group of permanent Appellate Judges and Immigration Judges, to determine which “probationary IJs” should be retained, and eventually to re-compete all existing IJ positions to insure a real, diverse, independent, due-process focused, Immigration Judiciary comprised of the “best and brightest” American law has to offer! 

Greg Chen (AILA) and Professor Peter Moskowitz (Cardozo Law) should be on the EOIR payroll implementing their very achievable program for drastically slashing the unnecessary backlog without stomping on anyone’s rights.

Garland should already have hired Professor Michele Pistone (Villanova Law, VIISTA) to develop quality, due process oriented training programs for everyone at EOIR.

Instead, Garland is bankrolling the current crew of proven incompetents, holdovers, hangers on, and Trump/Miller White Nationalists. In other words, he’s wasting our taxpayer money, destroying the lives and futures of the most vulnerable (and often most deserving) among us, undermining racial and social justice in America, and abusing and endangering the health and safety of members of the NDPA trying to bring some semblance of the rule of law and human decency into our disgustingly dysfunctional Immigration Courts.

Could it get any worse? How? 

Think about this! Neo-Nazi Stephen Miller and his fellow White Nationalists apparently were so impressed with the effective legal work done by courageous immigration/human rights/due process advocates in blocking many parts of his racist authoritarian agenda — basically the New Due Process Army (“NDPA”) and its “Senior Fighting Division” The Round Table of Former Immigration Judges — that they are forming their very own neo-Nazi legal advocacy group to help GOP AGs stymie any attempt by the Biden Administration to promote racial justice, social justice, and immigrant justice. 

Given the rather incompetent (not to mention ethically questionable) performance of many DOJ attorneys during the Trump regime, Garland is going to need all the help he can get to fend off Miller and the GOP. Rather than enlisting members of the NDPA on his team, letting them solve problems, and actively soliciting their support and alliance on litigation, he is turning them into highly motivated opponents!

How dumb and counterproductive is that! Turn your would-be friends into enemies? Sounds like something only a tone-deaf Dem politico could pull off!

I’m not a politico. But, I do understand the necessity in politics, as in almost any field, of being able to distinguish your friends from your enemies. Perhaps, Judge Garland has spent so much time in the ivory tower that he has forgotten how to play the game out here in the real world.

I’ve been hanging around the Washington legal scene for almost 50 years now. In that time, I might have witnessed a more inept start by an Attorney General of either party. But, really, I can’t remember when!

Quick: You’re a lawyer and your client is on trial for inciting a violent insurrection. The problem is, he’s guilty beyond a shadow of a doubt. Literally, there is no question whatsoever that he did what he’s been accused of—none! Whatsoever! And everyone knows it! To wonder if he’s guilty is to look at O.J. Simpson and think, “Well, the glove doesn’t fit, so who knows?” Nevertheless, you’ve been hired to defend him—after basically everyone else in your profession refused—and defend him you will! But how? If you’re Donald Trump’s attorneys, the answer is clearly: Lie, lie, play some Madonna clips, and lie some more.

There were far, far too many lies told over the course of Bruce Castor Jr., David Schoen, and Michael van der Veen’s presentation to catalog them all. In fact, it would be easier to simply point out the rare moments in which they did tell the truth. But, just for posterity’s sake, here were some of the biggest whoppers the defense team told as it claimed that Trump wasn’t responsible for the rally that took place at the Capitol on January 6:

  • Trump never intended for “the joint session [of Congress] be prevented from conducting its business”: This is obviously completely false and the reason we know that is because Trump repeatedly tried to get Mike Pence to stop Congress from doing just that, reportedly telling the V.P., “You can either go down in history as a patriot, or you can go down in history as a pussy.”

 

  • The rioters were mostly antifa, and one of the first people arrested was a member of the left-wing group: This, like virtually all of Trump’s lawyers’ claims are not true. The first person arrested was John E. Sullivan, who has denied being a member of antifa, and the FBI has said there is zero evidence that the supporters’ movements participated in the riot, no matter what Trump’s most shameless loyalists say. (Rep. Matt Gaetz, for instance, falsely claimed, “They were masquerading as Trump supporters and, in fact, were members of the violent terrorist group antifa.”)

 

  • A prior protest in front of the White House was just as bad: Referring to the June protest in front of the White House, van der Veen claimed “violent rioters” attacked officers and “at one point, pierced a security wall, culminating in the clearing of Lafayette Square.” (1) There was no breach; (2) five people didn’t die (3) the people who were hurt were the protesters tear-gassed so that Trump could do a photo shoot with a bible outside a church (an event that, surprisingly, did not result in him bursting into flames).

 

 

  • “The reality is Mr. Trump not in any way shape or form instructing these people to fight or use physical violence. What he was instructing them to do was to challenge their opponents in primary elections, to push for sweeping election reforms, to hold Big Tech responsible—all customary and legal ways to petition your government for redress of grievances which of course is also protected Constitutional speech.” Right, right, sure, sure. Trump totally wasn’t encouraging his supporters to air their grievances via violence, he just wanted them to push for election reforms. He just wanted them to form political action committees, you see! Run for office! Fight ideological differences at the ballot box! It’s actually extremely impressive van der Ween was able to get through this whole thing without bursting into laughter, and for that he should win some kind of award (and then lose his license to practice law).

 

  • “There was no insurrection”: There was! We all saw it! If you missed it, just google “Capitol riot” or “Capitol attack” or “Trump insurrection.”

In addition to the many lies told by Trump’s defense, his legal team also proffered a series of arguments for why he couldn’t possibly be found guilty that sound like something a bunch of stoned college kids came up with shortly before a mock trial they forgot to prepare for, which is actually an insult to stoned college kids unprepared for mock trials. Specifically, we’re talking about the series of clips the defense presented showing various Democrats using the word “fight,“ which they claim means Trump can’t also be held responsible for telling his supporters to “fight,“ because other people have said “fight” before and they weren’t found guilty of inciting insurrections. (Naturally, they left out the part about how, for instance, when Elizabeth Warren told supporters to “fight” they didn’t proceed to storm the Capitol and try to burn down democracy):

Of course, the bald-faced lies and complete lack of convincing arguments will clearly do little to sway the majority of Republicans, who have already decided how they’re going to vote, which we know because they‘ve already said as much and also because during the question-and-answer portion of the day, a typical question posed of the attorneys went something like, “Can you tell us how it’s possible that President Trump has not been named People’s Sexiest Man Alive yet? Is it because the media is in the can for liberals? Because we can’t think of another explanation!”

CNN reports that the ex-president insisted the rioters were patriots in a call with House leader Kevin McCarthy:

In an expletive-laced phone call with House Republican leader Kevin McCarthy while the Capitol was under attack, then President Donald Trump said the rioters cared more about the election results than McCarthy did. “Well, Kevin, I guess these people are more upset about the election than you are,” Trump said, according to lawmakers who were briefed on the call afterward by McCarthy.

McCarthy insisted that the rioters were Trump’s supporters and begged Trump to call them off. Trump’s comment set off what Republican lawmakers familiar with the call described as a shouting match between the two men. A furious McCarthy told the president the rioters were breaking into his office through the windows, and asked Trump, “Who the f–k do you think you are talking to?” according to a Republican lawmaker familiar with the call.

“I think it speaks to the former president’s mindset,” Rep. Anthony Gonzalez, an Ohio Republican who voted to impeach Trump last month, told CNN. “He was not sorry to see his unyieldingly loyal vice president or the Congress under attack by the mob he inspired. In fact, it seems he was happy about it or at the least enjoyed the scenes that were horrifying to most Americans across the country.”

In reality, as others have observed, the “defense team” could have read old copies of the Congressional Record or all the baseball scores from the 2019 season from the podium and it wouldn’t have made any difference to corrupt GOP Sens who had already decided to acquit notwithstanding the overwhelming evidence of guilt. 

The indifference and boredom with the suffering of others and the clear misdeeds of Trump exhibited by scumbags like Cruz (who actually helped prepare the inept “defense”), Hawley, Cotton, et al, was pretty telling. Obviously, they wouldn’t have cared a fig if Trump’s rioters had done in Pence, Romney, or any other of their “colleagues.” 

It’s all about the next election and destroying American democracy. 

My favorite part is when the Trump defense Team kept whining about the rights of 74 million who voted for the The Big Clown. It’s like their attempt to disenfranchise and diss the 81+ million of us who didn’t vote for Putin’s Puppet are irrelevant? But, that’s always been the way the “modern GOP” has “governed.” 

Right now, the GOP is hard at work at the state level trying to disenfranchise as many Black and Brown voters as possible in advance of the 2022 elections. 

Remember all the great “bipartisanship” and concern with the legislative process on the tax giveaway (nobody actually read it, clearly not Trump) or the unsuccessful attempt to “do in” Obamacare. Lots of great “bipartisanship” on display with the Coney Barrett confirmation and the confirmation of a steady stream of Federalist Society judges.

The current GOP is an ongoing threat to the national security and well-being of our nation.

I hope you have arranged to have a copy of this delivered to Judge Garland, Vanita Gupta, and Lisa Monaco. As you know better than anyone, every day the current BIA remains empowered to grossly distort and intentionally misapply the law and dish out injustice is another day of outrageous abuse for migrants and psychological harm inflicted on their representatives.

It is also essential that the folks in MPP and others applying at our borders are represented and judged according to a properly fair and generous interpretation of our asylum laws (as you point out, no more “99% denial club” assigned to Central American cases). Along with bogus “no show” rates, artificially inflated asylum denial rates have been used as key parts of the false narrative to smear and dehumanize asylum applicants at our Southern Border.

This is part of What We Learned, a series of reflections on the meaning and legacy of the Trump years.

One of the last things the Trump administration did, while it still had the power to do it, was reportedly kidnap a 9-year-old boy from his family. Customs and Border Protection officials at San Francisco International Airport denied entry to 19-year-old Christian Laporte and his younger brother, Vladimir Fardin, traveling from Haiti on U.S.-issued student and tourist visas respectively last Sunday—and then separated them from each other, declared Vladimir to therefore be an unaccompanied minor, and shipped him off to a detention center.

This was, by this point in Donald Trump’s term, not particularly surprising. Child abuse was at the center of the country’s immigration policy for these past four years, part of an intentional effort to scare people away from trying to come here. Hundreds of children disappeared into custody with no effort to keep track of them or reunite them with their families. A regime that had already been inhumane under President Obama, pushing migrants toward deadly desert crossings, turned fully malignant, with federal agents destroying water supplies and prosecutors targeting humanitarian workers. Asylum laws were cast aside.

On one level, this was straightforwardly racist, joining the goals of white nationalist policymakers like Stephen Miller to the daily bigotry of many border patrol officers. Rhetorically and conceptually, though, it was an effort to roll back the consensus that the United States is a nation of immigrants. The attack extended to legally documented immigration and residency, and on to citizenship itself, breaking precedent to strip people of what had seemed like a secure membership in the nation.

As Adam Serwer indelibly wrote, the cruelty of this was the point. The politics of Trumpism were built around white people sharing in rituals of viciousness and exclusion, coming together to follow their leader’s rejection of their designated enemies and to revel in how far things would go.

But the longer the administration wore on, the more the cruelty seemed to have another, horrifyingly practical point behind it. Trumpism was not just testing how hateful the country could be. It was exploring the limits of America’s capacity for indifference.

By the end, there were no limits to be found. The people thrown into detention at the border or deported at random may have been the first to be treated as nonpersons, but they soon had more company than anyone could count. Hurricane Maria hit U.S. territory in Puerto Rico, and the administration simply failed to respond, leaving hundreds and then thousands of people to die. Readers of Courtside over the past few years know all about this: “Dred Scottification” — dehumanization of “the other” — often the most vulnerable among us.

It’s the the basic policy of large numbers of GOP politicos, many Federal Judges (including, disgracefully, GOP-appointed Supremes who routinely hide their inhumanity behind wooden, wrong-headed legalisms and complete gobbledygook designed to screen them from the stench of decaying humanity they have betrayed), lots of bureaucrats, and about 74 million American voters who voted to retain a cruel, incompetent, neo-Nazi and his regime based on 30,500 outrageous lies and false narratives, most of them overtly racist, misogynist, bigoted, dehumanizing, or all all of the foregoing. 

These are NOT “differences of opinion” or “conservative v liberal philosophy.” Not by any means! They are differences in humanity: how we value truth, justice, and the essence of our fellow humans’ right to exist. 

The good news is that there were at least seven million more of those of us willing to give humanity a shot. But, coming to an “equilibrium” in a democracy where nearly half the voting population rejects the basic principles of democracy and indeed the humanity of much of our majority and most of the world beyond us, won’t be easy.

President-elect Joe Biden will roll out a sweeping overhaul of nation’s immigration laws the day he is inaugurated, including an eight-year pathway to citizenship for immigrants without legal status and an expansion of refugee admissions, along with an enforcement plan that deploys technology to patrol the border.

Biden’s legislative proposal, which will be sent to Congress on Wednesday, also includes a heavy focus on addressing the root causes of migration from Central America, a key part of Biden’s foreign policy portfolio when he served as vice president.

The centerpiece of the plan from Biden and Vice President-elect Kamala D. Harris is the eight-year pathway, which would put millions of qualifying immigrants in a temporary status for five years and then grant them a green card once they meet certain requirements such as a background check and payment of taxes. They would be able to apply for citizenship three years later.

The focus on Central America reflects the message that Biden has relayed to senior officials in the region: that he will advocate for policy changes aimed at what drives scores of migrants there to come to the United States illegally to seek safe harbor.

“Ultimately, you cannot solve problems of migration unless you attack the root causes of what causes that migration,” one official said, pointing to the various reasons — from economic to safety — that drive migrants to flee their home countries. “He knows that in particular is the case in Central America.”

Transition officials are aware of recent reports of the increased numbers of migrants at or heading to the border in anticipation of the end of Trump’s presidency, and urged them to stay in their home countries. They emphasized that newly arriving immigrants would not qualify for the legalization program that Biden proposes.

Biden wants to move the refugee and asylum systems “back to a more humane and orderly process,” the official said. But “it’s also been made clear that that isn’t a switch you flip overnight from the 19th to the 20th, especially when you’re working with agencies and processes that have been so gutted by the previous administration.”

Biden hopes to reinstate a program granting minors from Central America temporary legal residence in the United States. The Trump administration terminated the program in August 2017, officials said. The administration also wants to set up a reunification program for Central American relatives of U.S. citizens that would allow those who have been already approved for U.S. residency to be admitted into the country, rather than waiting at home for an opening. The program would be similar to ones that existed for Cubans and Haitians but also were ended by the Trump administration.

The Biden proposal also would put in place a refugee admissions program at multiple processing centers abroad that would better help identify and screen those who would qualify to be admitted as refugees into the United States.

As for border enforcement, the plan calls on the Department of Homeland Security to develop a proposal that uses technology and other similar infrastructure to implement new security measures along the border, both at and between ports of entry. Biden has long vowed not to expand the border wall Trump has marginally extended.

“This is not a wall; this is not taking money from [the Department of Defense],” a transition official said, referring to how Trump helped to finance his wall after pledging Mexico would pay for it. “It’s a very different approach.”

This is a welcome change from the poorly conceived, often ill-informed approach to immigration by the Obama Administration. It appears that Biden and Harris have actually “listened to the experts” and acted a accordingly.

The concentration on addressing the reality of Central American migration and dealing honestly and constructively with its root causes in a sensible and humane way is also refreshing. Using intelligence and technology to address real border security issues (as opposed to squandering resources on politically manufactured ones) also shows promise.

Many of the latter were  energized by the Trump/DHS program of White Nationalist racist fear-mongering and intentionally false anti-immigrant, anti-due-process narratives. That’s what “applied malicious incompetence” looks like — DHS and EOIR are two of the most egregious examples in a regime that raised it to an “art form.” It will take an aggressive and far-reaching “house cleaning” to get these agencies that have abandoned the common good and now operate “on the dark side” back on track.

The immediate “knee-jerk opposition” to rational, practical, fact-based immigration reform by notorious White Nationalist racist Sen. Tom Cotton (R-ARK) shows that Team Biden is on the right track to disavow the toxic institutionalized racism and biased policies of the Trump regime and move America along the path to racial justice and realistic, progressive immigration policies that will further the national interest and lead to a better future for all!

It’s a great, if long overdue, start to getting beyond Jim Crow and “Dred Scottification” and saving and enhancing our democracy! But, the proof will be in the results!

Biden, of course, will also face the formidable challenges of dealing with the human carnage left behind by the Trump regime’s disastrous mis-handling of COVID-19, economic inequality, the environment, racial justice, and foreign policy where American “prestige” has plummeted to levels not seen since the days of the Barbary Pirates.

He also must address a failing Federal Justice System that, particularly at its appellate levels, did not effectively stand up to the Trump regime’s  unrelenting assault on human decency and American democracy. You could say that about almost everything in the departing, defeated White Nationalist regime!

I’ll note for the record that among other things, the Supremes’ tone-deaf majority has been responsible for letting bona fide asylum seekers rot in squalor in camps in Mexico while waiting for non-existent “due process,” and also authorized the imposition of potential death sentences and torture on asylum seekers within our jurisdiction without any whit of due process.

The GOP majority’s disgraceful failure to stand up for voting rights of African Americans, Latinos, and other voters of color has also deepened racial injustice in America and helped usher in a horrible “Jim Crow Revival” pushed, incited, and enabled by the GOP, “The Party of the Failed Insurrection.”

Any competent first-year law student might ask “How could this happen in America?” That’s a question that Roberts and his gang of fellow Trump enablers and apologists will have to answer before the “court of history!”
