“[W]e conclude that the BIA abused its discretion by denying E.A.’s motion to reopen. E.A.’s mother’s recent childbirth is a serious medical event, which coupled with E.A.’s minor age, her difficulty obtaining transportation, and her difficulty navigating the immigration system without assistance, constitute “exceptional circumstances” necessitating rescission of the in absentia removal order. … The BIA’s decision was also contrary to law, and therefore an abuse of discretion. … First, the BIA improperly considered E.A.’s age separately, rather than considering age alongside other factors, when determining that she had not shown that exceptional circumstances justified her failure to appear. Second, the BIA erred when it dismissed without adequate explanation E.A.’s evidence that she is eligible for SIJS. Finally, the BIA improperly stated that E.A. was required to present prima facie evidence that she was eligible for immigration relief as part of her motion to reopen. … For the foregoing reasons, we GRANT the petition for review, VACATE the removal order, and REMAND for further proceedings consistent with this opinion.”

Al Amiri v. Rosen

“Salim Al Amiri, an Iraqi citizen, seeks relief from removal on the grounds of asylum, withholding of removal, and protection under the United Nations Convention Against Torture (“CAT”). He premises his requests for such relief on the harm that he fears that he would be subjected to in Iraq at the hands of members of Iraq’s military or civilian insurgents operating in that country. Al Amiri contends that he has reason to fear he would be subjected to that harm on account of his work as a paid contractor for the United States Army during the war in Iraq, as in that role he educated U.S. soldiers about Iraqi customs and practices as they prepared for their deployment. We vacate and remand the ruling of the Board of Immigration Appeals (“BIA”) denying his claims for asylum and withholding of removal, but we deny his petition insofar as it challenges the BIA’s ruling rejecting his CAT claim.”

  • Congrats to all involved!
  • Think how much better this system would function with expert  judges who treated asylum applicants fairly from the “git go,” granted protection wherever possible in accordance with the the Refugee Act of 1980 and the (more “woke”) Supremes’ precedent in Cardoza-Fonseca, provided clear, positive guidance on how valid claims could be documented and granted, and promoted and consistently applied best practices to achieve efficiency with maximum due process.
  • At first glance, although the issue is reopening rather than a continuance, E.A.C.A. undercuts McHenry’s nativist, insanely wasteful, and totally dishonest attempt to “raise the bar” for routine continuances for asylum applicants who need time to properly document and prepare their cases.
  • The “Deny – Deny Program” — deny due process, deny relief — that infects EOIR’s “Star Chambers” (impersonating “courts”) is a huge backlog builder that kills people and screws up Court of Appeals dockets in the process. 
  • Reopening cases that should be reopened, getting to the merits, and getting the many properly grantable asylum cases represented, documented, and prioritized would be a huge step in reducing EOIR’s largely self-created and unnecessary “bogus backlog.” 
  • Ultimately, many of the clearly grantable asylum cases being mishandled and wrongly denied at EOIR, at great waste of time and resources, not to mention unnecessary human trauma, could, with real expert judges at EOIR setting and consistently enforcing the precedents, be granted more efficiently and expeditiously at the Asylum Office and ultimately shifted to a more robust and properly run Refugee Program.
  • In the longer run, once EOIR is redesigned and rebuilt as a proper court with real, independent, expert judges, it might be appropriate to place the Asylum Offices under judicial supervision, given the grotesque abuses and corrupt, perhaps criminal, mismanagement of the Asylum Offices by USCIS toadies carrying out the regime’s racist, White Nationalist, unconstitutional agenda of hate and waste.
  • NOTE TO JUDGE GARLAND👨🏻‍⚖️: Please fix the EOIR mess, Your Honor, before it brings you and the entire US justice system crashing down with it! This is a national emergency, and a damaging national disgrace, NOT a “back burner” issue!

Greetings,

 

Sharing this win, E. A. C. A. v. Jeffrey Rosen, out of the CA6 by my amazing colleague Rachel Naggar who manages our BIA Pro Bono Project. This was an appeal of an IJ (Memphis) denial of an in absentia motion to reopen for a 13-year old unaccompanied child.

 

Interestingly, after oral argument, OIL filed a motion to remand the case (which Rachel opposed) and the CA6 denied that motion. Seems the CA6 really wanted to issue a decision on the merits and we are grateful for the decision. Here are some highlights from the decision:

 

SIJS

·       “Notably, the IJ’s decision does not mention E.A.’s claims that she was eligible for SIJS.”

·       FN 1: “As of the December 2020 Visa Bulletin, visas are available for special immigrants (category EB4) from El Salvador to adjust their status if their priority date is prior to February 2018. If DHS removes E.A. prior to approving her visa, she will be unable to apply for adjustment of status. See 8 U.S.C. § 1101(a)(27)(J).”

 

Totality of the Circumstances

·       “Based on the totality of the circumstances, including E.A. mother’s recent childbirth, E.A.’s young age, E.A.’s mother’s failed attempts to obtain counsel to help change the address of E.A.’s hearing, and E.A.’s inability to travel from New York to Memphis for the hearing, we hold that E.A. established exceptional circumstances.”

·       “Under the totality of the circumstances, E.A.’s young age is an important factor in determining whether exceptional circumstances exist.”

 

Exceptional Circumstances

·       “E.A.’s mother’s recent childbirth is a serious medical condition that supports reopening. The statute defining ‘exceptional circumstances’ that justify reopening an immigration proceeding lists the ‘serious illness of the alien, or serious illness or death of the spouse, child, or parent of the alien’ as an example. 8 U.S.C. § 1229a(e)(1). Childbirth is a serious medical event that necessitates a recovery period.”

·       “Instead of recognizing that childbirth is a serious medical condition, the BIA minimized the seriousness of childbirth and its impact on E.A.’s mother’s ability to bring E.A. to Memphis. […] Recovery from childbirth is exactly the type of circumstance that § 1229a(e)(1) was intended to cover.”

 

Prima Facie Eligibility

·       “Finally, the BIA erred by stating that E.A. was required to prove prima facie eligibility for immigration relief. The BIA’s decision improperly states that E.A. is required to show at this stage prima facie eligibility for relief. The statute governing motions to reopen removal orders entered in absentia provides that the petitioner must ‘demonstrate[] that the failure to appear was because of exceptional circumstances.’ 8 U.S.C. § 1229a(b)(5)(C). In general, we have stated that ‘[a] prima facie showing of eligibility for relief is required in motions to reopen.’ Alizoti, 477 F.3d at 451–52. In the case of a motion to rescind a removal order entered in absentia, however, the BIA has held that ‘an alien is not required to show prejudice in order to rescind an order of deportation” or removal. In re Grijalva-Barrera, 21 I. & N. Dec. 472, 473 n.2 (BIA 1996); see also In re Rivera-Claros, 21 I. & N. Dec. 599, 603 n.1 (BIA 1996). This is consistent with the statute governing motions to rescind removal orders entered in absentia, 8 U.S.C. § 1229a(b)(5)(C), which does not list a showing of prima facie eligibility for relief from removal as a requirement to rescind in absentia removal orders. Rivera-Claros, 21 I. & N. Dec. at 603 n.1; see also Galvez-Vergara v. Gonzales, 484 F.3d 798, 803 n.6 (5th Cir. 2007) (declining ‘to affirm the IJ’s decision on the grounds that [the petitioner] has not shown that he was prejudiced by his counsel’s performance’ because ‘In re Grijalva-Barrera, 21 I. & N. Dec. at 473 n.2, provides that an alien need not demonstrate prejudice for his counsel’s erroneous advice to constitute an ‘exceptional circumstance’ justifying rescission of an in absentia removal order’); Lo v. Ashcroft, 341 F.3d 934, 939 n.6 (9th Cir. 2003) (‘follow[ing] the BIA’s usual practice of not requiring a showing of prejudice’ to rescind an in absentia order of removal). We now join our sister circuits and hold that E.A. is not required to make a prima facie showing of eligibility for relief in order to obtain rescission under 8 U.S.C. § 1229a(b)(5) of the in absentia order of removal.”

Biased, anti-migrant decision-making in support of bogus enforcement gimmicks and White Nationalist anti-democracy agendas builds backlogs and kills, maims, and tortures “real” people! Migrants are people and persons, not “threats” and “bogus statistics.” 

The “dehumanization” and “de-personification” of migrants, with the connivance of the tone-deaf and spineless GOP Supremes’ majority, is a serious, continuing threat to American democracy! It must stop! Justices who won’t treat migrants physically present in the U.S. or at our borders as “persons” under our Constitution — which they clearly are — do not belong on the Supremes! ⚖️🗽🇺🇸

I can also draw the lines connecting George Floyd, institutionalized racial injustice, voter suppression, riots at the Capitol, and the “Dred Scottification” of asylum seekers and other migrants by EOIR! 

HINT TO JUDGE GARLAND: Michelle Mendez would be an outstanding choice to lead the “clean up and rebuild” program at EOIR and the BIA once the “Clown Show” 🤡🦹🏿‍♂️ is removed!🪠🧹 Put experts with practical experience like Rachel Nagger and Christopher Linas onto the bench, on the BIA, the Immigration Courts, and the Article III Judiciary to get the American Justice system functioning again!

The “judicial selection system” for the Immigration Courts and the Article III Judiciary has failed American democracy — big time — over the past four years. Fixing it must be part of your legacy!

The folks who preserved due process and our Constitution in the face of tyranny are mostly “on the outside looking in.”  You need to get them “inside Government” — on the bench and in other key policy positions — and empower them to start cleaning up the ungodly mess left by four years of regime kakistocracy🤮☠️🤡⚰️👎🏻.  “Same old, same old” (sadly, a tradition of Dem Administrations) won’t get the job done, now any more than it has in the past! New faces for a new start!

And, it starts with better judges @ EOIR, which is entirely under YOUR control! An EOIR that actually fulfills its noble, one-time vision of “Through teamwork and innovation being the world’s best tribunals guaranteeing fairness and due process for all” will be a model for fixing our failing Federal Courts  —  all the way up to the leaderless and complicit Supremes who failed, particularly in immigration, human rights, voting rights, and racial justice, to effectively and courageously stand up to the Trump-Miller White Nationalist agenda of hate and tyranny!

We are where we are today as a nation, to a large extent, because of the Supremes’ majority’s gross mishandling of the “Muslim Ban” cases which set a sorry standard for complicity and total lack of accountability for unconstitutional actions, racism, dishonesty, cowardly official bullying, and abandonment of ethics by the Executive that has brought our nation to the precipice! Check out the lies, false claims, bogus “reasoning,” and mis-statements in McHenry’s attempt to “redefine due process by encouraging judges to deny continuances to respondents.” Meanwhile, the real cause of many, perhaps most, “big time” delays and disorder in Immigration Court — “Aimless Docket Reshuffling” to accommodate improper DHS enforcement initiatives and politically motivated DOJ priorities, is swept under the rug and goes unaddressed. 

Here’s an example of some amazing nativist, White Nationalist legal gobbledygook put out by the “Tower Toadies:”

The general standard for a continuance is good cause, 8 C.F.R. § 1003.29. By statute, however, “[i]n the absence of exceptional circumstances, final administrative adjudication of [an] asylum application, not including administrative appeal, shall be completed within 180 days after the date an application is filed.” INA § 208(d)(5)(A)(iii). “Exceptional circumstances” is a higher standard than “good cause.” PM 19-05, Guidance Regarding the Adjudication of Asylum Applications Consistent with INA § 208(d)(5)(A)(iii) (Nov. 19, 2018) at 2-3 (“A continuance does not automatically justify exceeding the 180-day timeline in INA § 208(d)(5)(A)(iii), however, because the statute’s ‘exceptional circumstances’ standard is higher than the ‘good cause’ standard for continuances.”). Thus, “if granting a continuance would result in missing the 180-day deadline, the Immigration Judge may only grant the continuance if the respondent satisfies both the good-cause standard of 8 C.F.R. §1003.29 and also shows the ‘exceptional circumstances’ required by INA § 208(d)(5)(A)(iii).” Id. at 2.

Translation: “Good cause” which is a constitutionally-based standard, actually means “exceptional circumstances” not “good cause” when dealing with asylum seekers, the most vulnerable among us, whose lives are in your hands. Therefore, the Constitution be damned, go ahead and deny the asylum applicant a legitimate continuance but claim that you had “good cause” for not finding “exceptional circumstances.” Oh, and while you’re at it, don’t bother to factor in the ongoing public health crisis and the lives of the individuals, attorneys, staff, and certainly not your own worthless life in reaching your pre-determined decision to deny a continuance. Denying asylum to refugees, for any reason, no matter how specious or disingenuous, outweighs human life and your meaningless oath to uphold the Constitution.

Sort of reminds me of “Gruppenfuhrer Rudy’s” famous “Truth isn’t truth” declaration to Chuck Todd on “Meet the Press!” Only in the kakistocracy is this type of absurdist “logic” considered normal and acceptable.

What a real judge might say: “Good cause” for a continuance exists where failure to grant one would make the proceedings fundamentally unfair or unduly impinge on a full and fair consideration of the respondent’s case. The need to grant a continuance to avoid a denial of constitutionally required due process is obviously an “exceptional circumstance.” This is especially true in dealing with applicants for asylum and others seeking protections from persecution and torture. Additionally, the ongoing public health crisis and the overriding need to protect the health and safety of those coming before you and your dedicated professional court staff should always be paramount in considering continuance requests. 

No legitimate court system in America is mismanaged in this grotesque, nonsensical manner without considering the input, or indeed the health, safety, and lives, of either the parties appearing before the court or the judges themselves! 

To be frank, Judge Garland, the EOIR Tower Kakistocracy is delivering you “the big middle finger”🖕 in advance. They are acolytes of the racist, White Nationalist, “myth based” xenophobic immigration agenda set forth by Stephen Miller and Gene Hamilton. As far as they are concerned, you and your “return justice and professionalism to Justice” agenda can “go pound sand.”

While the EOIR kakistocracy might be openly contemptuous of your incoming leadership, your supporters our here in the New Due Process Army (“NDPA”) are also aware of what’s happening. For better or worse, your commitment to and effectiveness in restoring justice will be judged initially on the number of hours, minutes, and seconds it takes you to oust the current Clown Show 🤡🦹🏿‍♂️☠️in Falls Church, including the failed and compromised BIA; replace them with professional, independent judicial administrators and real judges with expertise in immigration, asylum, and human rights and a nationally-recognized, unswerving commitment to due process, best practices, and practical scholarship in support of social justice.   

EOIR might not be the most “sexy” item on your incoming agenda, Your Honor. But, the fate of one of the largest, perhaps most important “Federal Court Systems” is probably the most important and consequential item on which your tenure ultimately will be judged. As all of us who have served the public know, many of our “achievements” that occupied so much of our time and attention in office are forgotten or disappear before the door closes behind us at the end of of our tenure. But, being the “Father of the Independent Immigration Court” 👨🏻‍⚖️⚖️🗽🇺🇸👍🏼😇— bringing in a group of experts to fix the current ungodly mess and then advocating tirelessly for Article I legislation — is the kind of lasting legacy of which you could be proud!

Judge Garland, you don’t want to “own” this national disgrace and mockery of our Constitution, rational, professional court administration, honest, competent civil service, and simple human decency — the obligations that we owe to our fellow humans. Please get some real judges and professional administrators over to Falls Church immediately, put the EOIR Clown Show 🤡🦹🏿‍♂️  out of its misery, 🧹🪠 and end the crimes against humanity☠️⚰️ they are visiting on the most vulnerable among us and their attorneys! History (as well as the NDPA) is watching!

Best wishes for a due process⚖️ and best practices 👍🏼filled tenure! Be remembered for the justice you have promoted and the evil ☠️🦹🏿‍♂️⚰️👎🏻you have resisted and eradicated!

⚖️🗽SUPREMES HEAR CASE ON UNNECESSARY DETENTION IN GULAG OF THOSE SEEKING LEGAL PROTECTION FROM PERSECUTION AND TORTUE! — Biden Administration Must End Human Rights Abuses 🏴‍☠️☠️In The “New American Gulag!”

Today marks a milestone for the Legal Aid Justice Center.

This morning at 10 A.M., the U.S. Supreme Court will begin oral arguments in Pham v. Chavez, LAJC’s first case before the high court in our 54-year history. It is also the last immigration case to be heard by the Supreme Court during Trump’s presidency, a fitting way to cap the past four years of fighting this administration’s harmful policies, which we kicked off with our 2017 lawsuit Aziz v. Trump challenging Trump’s Muslim ban, filed one week after his inauguration.

It is not uncommon for people who have been previously deported to eventually return to the U.S. seeking protection from new threats to their lives or liberty in their home countries. Today’s case is to decide whether immigrants who illegally reenter the United States after a prior deportation and seek an asylum-like form of protection called “withholding of removal” have the right to ask a judge for release from detention while they fight their cases, which routinely take over a year.

This case will affect more than 3,000 people every year nationwide —a number that will likely grow as those who have been turned away at the border through the current administration’s unjust policies return in desperation to seek help once again.

We thank our pro bono co-counsel Paul Hughes, an experienced Supreme Court practitioner arguing the case for us today, and the team at McDermott Will & Emery and the Yale Law School Supreme Court Clinic who assisted with the briefing.  Paul has partnered with us on many of our legal challenges to the Trump administration’s immigration policies, dating back to Aziz v. Trump.

This case began in summer 2017 when we won the release of five individuals being held without bond at the Farmville Detention Center. We quickly recognized that the system needed to be reformed. Our subsequent class action lawsuit has beaten back every challenge to date, and no matter the outcome of today’s hearing, has already won the release of more than 100 people from detention.

 

We hope the highest court in the land will also acknowledge that these immigrants should have the chance to seek freedom.

As noted in my previous posting, this case is also a good example of the false and misleading narratives pushed by unethical former Solicitor General and leading “Trump Toady” Noel Francisco in defending the regime’s “crimes against humanity” and racist agenda targeting asylum seekers and other migrants. 

In fact, as anybody actually familiar with the Immigration Court system knows, holding bond hearings for 3,000 seekers of protection would not be a major burden on the Immigraton Courts. It’s an example of critical, yet routine, duties that should be performed easily, efficiently, fairly, and frequently by any qualified U.S. Immigration Judge.

What has been a “burden on the system” and a fiscal, due process, and management disaster is the improper “Aimless Docket Reshuffling” engaged in by DOJ politicos and their “maliciously incompetent” toadies at EOIR. This mismanagement and total failure of competent judicial leadership and administration has pushed the backlog to over an astounding 1.1 million cases (with many others likely MIA or lost in space in the EOIR mess). 

To accomplish this dysfunctional disaster, EOIR has doubled the number of Immigration Judges. This often involves hiring judicial candidates from prosecutorial backgrounds who lack the human rights and immigration expertise, and in some cases the backbone to comply with their oaths to uphold the Constitution, necessary to restore due process to the system, issue prompt bonds to those seeking protection, establish precedents for expeditious granting of asylum and other protection, and, most of all, hold an out of control DHS enforcement kakistocracy accountable. 

Judge Garland👨🏻‍⚖️ take note! As of the date of your confirmation, your name will start appearing on the grossly deficient work product churned out by EOIR and the scofflaw nonsense being presented to the Supremes and other Federal Courts by the SG’s Office and other DOJ lawyers who have forgotten or abandoned their ethical obligations.

I can’t believe that any Federal Judge highly respected enough to be nominated to the Supreme Court by a real President would want his name and legacy tarnished by association with the White Nationalist due process disaster and misuse of public funds currently going on at EOIR.

Immigration Court Case Completion Times Jump as Delays Lengthen

Not surprisingly, Immigration Court closures and delays in hearings for courts that are conducting hearings have drastically reduced the number of completed cases for the first two months of this fiscal year as compared with prior years at the same time.

New cases continue to drastically outpace case completions. In October and November 2020, the Immigration Courts received 29,758 new filings. This is fewer filings than usual, but still almost twice the 15,990 cases they completed.

As a result, the court’s active backlog at the end of November 2020 reached 1,281,586. This is up 18,821 cases in just the last two months. Adding to the court’s workload are not only new filings, but previously closed cases that have been reopened, remanded for reconsideration, or otherwise placed back on the court’s docket.

Disposition times for closed cases have also shot up this year. Cases disposed of in FY 2020 took on average 460 days. During the first two months of FY 2021, the courts disposed of a much smaller number of cases, but the disposition times were much longer at an average of 755 days—or 64 percent longer. The longest disposition times were found in the Cleveland Immigration Court where it took on average 1,617 days.

As mom used to say, “Haste makes waste.” Taking more time to decide cases would be perfectly defensible if it actually produced useful deliberation, thoughtful scholarship, and just and fair results. But, this currently is a system that must limit its intake while it develops the expertise, scholarship, analytical skills, quality control mechanisms, and best practices necessary for judicial efficiency that complies with due process and fundamental fairness (not to mention basic asylum law). That’s a “complete rebuild.”

Then, once that system is running well, it could be methodically and rationally expanded, if actually necessary. But, aimlessly building more assembly lines producing defective products and then ratcheting up the speed will, not surprisingly, produce nothing except more dangerous and defective  products.

Not exactly rocket science that a bunch of hacks implementing racist policies, trying to speed up the assembly line, engaging in “Aimless Docket Reshuffling,” eradicating due process, discouraging fairness and deliberation, eliminating their own jurisdiction to control the dockets, and denying everything while mindlessly throwing more resources into a broken beyond belief “(non)system” at war with its own essential employees and those whom it (dis)serves would produce total chaos and dysfunction. Also, throw in lack of best technology and overt disregard for public health and safety.

And, while this is going on, an undisciplined, out of control, and for all practical purposes worse than useless ICE continues to pour new cases into the maelstrom at twice the rate it can get turn them out! As the late NY Met’s Manager Casey Stengel once said, “Can’t anyone here play this game?”

This is an ongoing and increasingly visible unmitigated national disgrace. It’s also an abuse of public funds and a betrayal of the public trust — fundamentals of sound government.

And, it won’t be “swept under the table” in the finest tradition of incoming Administrations. As I’ve said before, the Biden-Harris Administration either fixes EOIR🤡 immediately with some new faces with real expertise, or it “owns” it. And, the current White Nationalism infested atrocity and den of “malicious incompetence” at EOIR🤡 is not something an Administration striving to achieve equal justice and racial reconciliation should want to own!

Good evening, Houston! Hope you and yours are staying well. Thanks for joining me to help plan the next big battle for our New Due Process Army (“NDPA”).

I’m retired, so I can tell it like it is: no party line, no bureaucratic doublespeak, no BS, just the truth, the whole truth, and nothing but the truth. Nevertheless, I do want to hold AILA, your organizers, you, and anyone else of any importance whatsoever harmless for the following remarks, for which I am solely responsible. To borrow the words of country music superstar Toby Keith, “it’s me baby, with your wakeup call!”

And, perhaps to state the obvious: “Houston, we’ve got a problem!” The problem is EOIR, it’s threatening our entire justice system, and I need your help to fix it!

42 days and counting left in the kakistocracy – governance by the worst among us. We got the job done in November. But, by no means is the fight to preserve our justice system and save our nation over. Indeed, in many ways it’s just beginning!

I’m dividing my presentation this evening into two parts. First, I’m going to take you from one of the highlights of my career, the Kasinga decision in 1996, to the depths of the current unmitigated disaster in our Immigration Courts. I’ll explain how policy-making by myth, inadequate leadership, followed by malicious incompetence snuffed out hope and progress and replaced it with despair and return to the dark days of Jim Crow.

Then, I’m going to tell you what needs to be done to restore and re-energize due process at EOIR, why our time is now, and why your voices as members of our New Due Process Army (“NDPA”) need to be heard loud and clear by the incoming Biden-Harris Administration.

We also need an AG who is advocate for human rights and immigrants’ rights. Additionally, there is a pressing need for immigration/human rights experts from the NDPA in authoritative positions in other parts of the DOJ, like the SG’s Office, OIL, and the Office of Legal Policy, as well as, of course DHS, ORR, State, and even CDC.

Remember: This isn’t “rocket science!” It’s just common sense, “practical scholarship,” best practices, moral courage, humanity, and respect for human dignity! All of which you and other members of the NDPA have in abundance! Most of all, it’s about getting the right practical experts in the key positions within the incoming Administration.

Unlike the Article III Courts, the “EOIR Clown Show” can be removed, replaced, and justice at all levels improved just by putting the right experts from the NDPA in charge right off the bat. Because these are Executive positions that do not require Senate confirmation, Mitch McConnell’s permission is not required.

Democratic Administrations, particularly the Obama Administration, have a history of not getting the job done when it comes to achievable immigration reforms within the bureaucracy. If you don’t want four more years of needless frustration, death, disorder, demeaning of humanity, and deterioration of the most important “retail level” of our justice system, let the incoming Biden Administration know: Throw out the EOIR Clown Show and bring in the experts from the NDPA to turn the Immigration Courts into real, independent courts of equal justice and humanity that will be a source of national pride, not a deadly and dangerous national embarrassment! 

Contrary to all the mindless “woe is me” suggestions that it will take decades to undo Stephen Miller’s racist nonsense, EOIR is totally fixable — BUT ONLY WITH THE RIGHT FOLKS FROM THE NDPA IN CHARGE!  It only becomes “mission impossible” if the Biden-Harris Administration approaches EOIR with the same indifference, lack of urgency, and disregard for expertise and leadership at the DOJ that often has plagued past Democratic Administrations on immigration, human rights, and social justice.

It won’t take decades, nor will it take zillions of taxpayer dollars! With the right folks in leadership positions at EOIR, support for independent problem solving (not mindless micromanagement) from the AG & DOJ, and a completely new BIA selected from the ranks of the NDPA experts, we will see drastic improvements in the delivery of justice at EOIR by this time next year. And, that will just be the beginning!

No more clueless politicos, go along to get along bureaucrats, unqualified toadies, and restrictionist holdovers calling the shots at EOIR, America’s most important, least understood, and “most fixable” court system! No more abuse of migrants and their hard-working representatives! No more ridiculous, “Aimless Docket Reshuffling” generating self-created backlogs! No more vile and stupid White Nationalist enforcement gimmicks being passed off as “policies!” No more “Amateur Night at The Bijou” when it comes to administration of the immigrant justice system at EOIR!

Get mad! Get angry! Stop the nonsense! Tell every Democrat in Congress and the Biden Administration to bring in the NDPA experts to fix EOIR! Now! Before more lives are lost, money wasted, and futures ruined! It won’t get done if we don’t speak out and demand to be heard! Let your voices ring out from banks of the Rio Grande to the shores of the Potomac, from the Gulf Coast to the centers of Government!  

This is our time! Don’t let it pass with the wrong people being put in charge — yet again! Don’t be “left at the station” as the train of immigrant justice at Justice pulls out with the best engineers left standing on the platform and the wrong folks at the controls! Some “train wrecks” aren’t survivable! 

Repeat after me: “Hey hey, ho ho, the EOIR Clown Show has got to go!” Then pass it on to the incoming Administration! Let them know, in no uncertain terms, that you’ve had enough! More than enough!

🤮EOIR’S STUPIDITY IN MOTION: One of the audience questions last night concerned the recent mindless “scheduling orders” issued by EOIR bureaucrats masquerading as “judges.” These were the subject of immediate harsh congressional criticism, as I noted yesterday. https://immigrationcourtside.com/2020/12/09/kakistocracy-korner%f0%9f%8f%b4%e2%80%8d%e2%98%a0%ef%b8%8f-eoirs-latest-maliciously-incompetent-%f0%9f%a4%ae-attack-%e2%98%a0%ef%b8%8f-on-kids-earns-well-deserved-congressional-ire/

Basically, with over 1.3 million backlogged cases already on the docket, EOIR has chosen to expedite and prioritize newer asylum cases where individuals have not had time to obtain attorneys and properly prepare over hundreds of thousands, perhaps one million, of “ready to try” backlogged cases. Some of the latter undoubtedly date back to my time on the bench!

Rather than working with the private bar and ICE on a rational plan to get the cases that are ready to try heard, EOIR has chosen to rush ahead by putting “not ready for prime time” cases in front of those that have been waiting, some for many years. Apparently, the plan is to then dismiss the cases if completed asylum applications aren’t filed by the arbitrary, artificial, and unreasonable deadlines.

Remarkably, attorneys were told that if they couldn’t meet these arbitrary, unreasonable deadlines, they should “file motions.” That will 1) throw more useless paper into an un-automated system already drowning in it; 2) undoubtedly lead to wildly inconsistent adjudications among judges; and 3) generate unnecessary appeals and possible Federal court actions. Some unrepresented individuals likely will be wrongfully deported because they don’t understand what’s happening.

This is “Aimless Docket Reshuffling” in action. A great example of why “The EOIR Clown Show 🤡 has got to go!” Sooner, not later!

Let your voices be heard!

I hear lots of talk about the importance of civil rights from the Biden team. But, as we well know, “immigrants’ rights are civil rights.”

Civil rights reforms and justice for African Americans, Hispanic Americans, and other minorities will continue to be an unrealized dream unless and until we fix the broken and biased Immigration Court system: “The home of ‘Dred Scottification’ and the ‘21st Century Jim Crow.’” As MLK, Jr. once said, “Injustice anywhere is a threat justice everywhere.”

After three decades of abject failure and “deterioration of justice at Justice,” time for some progressive new leadership at the DOJ that takes those words to heart and “connects the dots” between the continuing abuses of Black Americans in the streets and the disgraceful abuses inflicted on immigrants of color and their representatives in our 21st Century “Star Chambers” called Immigration Courts that operate within the DOJ. In my mind, appointing officials who were part of not solving the problem in the past, even if they “know” the DOJ, is not going to get the job done.

We need new faces in leadership at DOJ! That means individuals in leadership positions who have demonstrated a commitment to equal justice for all! Experts in justice rather than political and bureaucratic retreads! Time to value “real life” experiences and achievements over past participation in managing a failed and floundering DOJ bureaucracy that has been “AWOL” on equal justice and immigrant justice for far too long.

Yes, we need a “good manager” at Justice. But, a manager who has seen the problems with the justice system first-hand, through litigation or advocacy against the regime’s abuses, particularly in the Immigration Courts and with racist and unconstitutional immigrant bashing “policies.” A leader familiar with the problems at Justice, but not part of those problems in the past. Sure, that person will need personnel experts and some “bureaucratic insiders” to get the job done. But, they should be part of the team, not driving the train.

There will be no justice for all Americans without justice in our Immigration Courts! So far, I haven’t heard a direct acknowledgement and embracing of that simple fact from the Biden-Harris team. That’s a matter that should be of concern to all of us in the NDPA!

That’s why it’s so important for our voices to be heard now! Before the “train leaves the station” without the NDPA on board, which is precisely what happened in 2008!

When I wasn’t visiting border, I was trying to understand how the U.S. government could put in place a policy that seemed the very antithesis of what seeking asylum was supposed to be, as articulated in Refugee Act of 1980. I had spent my time before coming to Refugees International researching the writing and passage of that law and the development of the contemporary asylum system since 1980. The Remain in Mexico policy is unprecedented. The U.S. government claims the authority for it lies in a provision of the 1996 immigration law that allows for the return of certain applicants for admission to contiguous territory to await processing.  I began researching this provision and it became clear that it was not intended to apply to asylum seekers.

In support of a challenge to the Remain in Mexico program in California federal court, Refugees International and I, with attorneys from Sidley Austin LLP, submitted this brief describing why the Refugee Act forbids the program, a reality that the 1996 law does not change. The argument of the brief is that, when the 1980 Refugee Act was enacted, it was intended to establish a uniform process for consideration of asylum claims that would preclude this return to Mexico approach. A lynchpin in the argument is that there were two versions of the asylum provision of the Refugee Act—one proposed by Congresswoman Holtzman and one by Senator Edward Kennedy. Only the House version provided that asylum seekers at a land border be accorded the same ability to seek asylum as those already in the country. When, in conference, Holtzman’s version was accepted, Congress made a conscious choice in pursuit of uniformity in consideration of asylum requests: that the United States would treat asylum seekers at the border the same as it would all others. And the language mandating uniform treatment of asylum seekers in the 1980 Refugee Act was reiterated in the 1996 immigration law.

deportation-ready provision of the law kicks in. According to the American Immigration Council, fewer than 2% of immigrants who received persecution-based relief in fiscal year 2017 were ultimately deported to a third country.

The Justice Department also raised the possibility that having to scrutinize the practical odds of removal from immigrant to immigrant would be “patently unworkable.”

“A case-by-case approach … would needlessly add to the burdens that are already ‘overwhelming our immigration system,'” the department said, quoting a prior case.

But a coalition of former immigration trial and appeals judges pushed back on that idea with their own amicus brief Thursday.

“Bond hearings in withholding of removal proceedings are no different than bond hearings in other contexts,” the group, representing 34 judges who have cumulatively overseen thousands of cases, wrote. “Contrary to [the administration’s] assertion, bond hearings in withholding of removal proceedings neither lead to a slowdown of cases that ‘thwart Congress’ objectives’ in enacting the immigration laws, nor impose an administrative burden on immigration courts.” The American Civil Liberties Union is represented by its own Michael Tan, Omar Jadwat, Judy Rabinovitz, Cecillia Wang and David D. Cole.

Read the complete article over on Law360. The case comes from the Fourth Circuit. Hopefully, the Biden-Harris Administration will withdraw the SG’s disingenuous petition (if not already denied by the Supremes) and implement the Fourth Circuit’s correct decision nationwide.

This disgraceful performance by the Solicitor General’s Office (once revered, now reviled) has become “the norm” under Trump. Francisco’s arguments are those of an attorney who didn’t do “due diligence,” but doesn’t expect the Court to know or care what really happens in Immigration Court. And, unfortunately, with the exception of Justice Sotomayor and perhaps Justice Kagan, that may well be a correct assumption. But that doesn’t make it any less of a powerful and disturbing indictment of our entire U.S. Justice system in the age of Trump.

Reality check: I routinely did 10-15, sometimes more, bond hearings at a Detained Master Calendar in less than one hour. I treated everyone fairly, applied the correct legal criteria, and set reasonable bonds (usually around $5,000) for everyone legally eligible. Almost all represented asylum seekers and withholding seekers eligible for bond who had filed complete and well-documented asylum or withholding applications were released on bond. About 99% showed up for their merits hearings.

I encouraged attorneys on both sides to file documents in advance, discuss the case with each other, and present a proposed agreed bond amount or a range of amounts to me whenever possible. Bond hearings were really important (freedom from unnecessary restraint is one of our most fundamental rights), but they weren’t “rocket science.” Bond hearings actually ran like clockwork.

Indeed, if the attorneys were “really on the ball,” and ICE managed to find and present all the detainees timely, I could probably do 10-15 bond cases in 30 minutes, and get them all right. My courtroom and my approach weren’t any different from that of my other then-colleagues at Arlington. In thirteen years on the bench, I set thousands of bonds and probably had no more than six appeals to the BIA from my bond decisions. I also reviewed many bond appeals at the BIA. (Although, most bond appeals to the BIA were “mooted” by the issuance of a final order in the detained case before the bond appeal was adjudicated.) Most took fewer than 15 minutes.

Indeed, my past experience suggests that a system led (not necessarily “run”) by competent judicial professionals and staffed with real judges with expertise in immigration, asylum, and human rights and unswervingly committed to due process and fundamental fairness could establish “best practices” that would drastically increase efficiency, cut (rather than mindlessly and exponentially expand) backlogs, without cutting out anyone’s rights. In other words, EOIR potentially could be a “model American judiciary,” as it actually was once envisioned, rather than the slimy mass of disastrous incompetence and the national embarrassment that it is today!

The idea that doing something as straightforward as a bond hearing would tie the system in knots is pure poppycock and a stunning insult to all Immigration Judges delivered by a Solicitor General who has never done a bond case in his life!

Yes the system is overwhelmingly backlogged and dysfunctional! But that has nothing to do with giving respondents due process bond hearings.

It has everything to do with unconstitutional and just plain stupid “politicization” and “weaponization” of the courts under gross incompetence and mismanagement by political hacks at the DOJ who have installed their equally unqualified toadies at EOIR. It also has to do with a disingenuous Solicitor General who advances a White Nationalist political agenda, rather than constitutional rights, fundamental fairness, rationality, and best practices. It has to do with a Supreme Court majority unwilling to take a stand for the legal rights and human dignity of the most vulnerable, and often most deserving, among us in the face of bullying and abuse by a corrupt, would-be authoritarian, fundamentally anti-American and anti-democracy regime.

It has to do with allowing a corrupt, nativist, invidiously-motivated regime to manipulate and intentionally misapply asylum and protection laws at the co-opted and captive DHS Asylum Office; thousands of “grantable” asylum cases are wrongfully and unnecessarily shuffled off to the Immigration Courts, thus artificially inflating backlogs and leading to more pressure to cut corners and dispense with due process.

It also paints an intentionally false and misleading picture that the problem is asylum applicants rather than the maliciously incompetent White Nationalists who have seized control of our system and acted to destroy years of structural development and accumulated institutional expertise.

Good Government matters! Maliciously incompetent Government threatens to destroy our nation! (Doubt that, just look at the totally inappropriate, entirely dishonest, response of the Trump kakistocracy to their overwhelming election defeat by Biden-Harris and the unwillingness of both the GOP and supporters to comply with democratic norms and operate in the real world of facts, rather than false narratives.)

Due process, fundamental fairness, equal justice, simple human decency, and Good Government won’t happen until we get the White Nationalist hacks out of the DOJ and replace the “clown show” at EOIR with qualified members of the New Due Process Army. Problem solvers, rather than problem creators; over-achievers, rather than screw-ups!

The incoming Biden-Harris Administration is left with a stark, yet simple, choice: oust the malicious incompetents and bring in the “competents” from the NDPA to fix the system; or become part of the problem and have the resulting mess forever sully your Administration.

The Obama Administration (sadly) chose the latter. President Elect Biden appears bold, confident, self-aware, and flexible enough to recognize past mistakes. But, recognition without reconstruction (action) is useless! Don’t ruminate — govern! Like your life depends on it!

And, by no means is EOIR the only part of DOJ the needs “big time” reform and a thorough shake up. We must have a Solicitor General committed to following the rules of legal ethics and common human decency and who will insist on her or his staff doing likewise.

The next Solicitor General must also have demonstrated expertise in asylum, immigration, civil rights, and human rights laws and be committed to expanding due process, equal justice, racial justice, and fundamental fairness throughout the Government bureaucracy and “pushing” the Supremes to adopt and endorse best, rather than worst, practices in these areas.

American Justice and our court systems are in “free fall.” This is no time for more “amateur night at the Bijou.”

And here are some thoughts for the future if we really want to achieve “Good Government” and equal justice for all:

  • Every future Supreme Court Justice must have served a minimum of two years as a U.S. Immigration Judge with an “asylum grant rate” that is at or exceeds the national average for the U.S. Immigration Courts;
  • Every future Solicitor General must have done a minimum of ten pro bono asylum cases in U.S. Immigration Court.

30 days to file an application for asylum for an unrepresented, detained, non-English speaking applicant appearing by televideo, huh? “Full and fair hearing?” Only in the “Never Never Land” of EOIR in the 5th Circuit,

I can guarantee that this bogus “30-day-filing standard” will be used to railroad lots of hapless and clueless asylum applicants out without due process.

The good news: Outside the “Judicial Wasteland” of the Fifth Circuit, at least some reviewing Circuits likely will “blow the whistle” on this disingenuous nonsense and abdication of Constitutional duties and send the cases back to the meat packing plant (a/k/a EOIR) for redos, thus adding to the “Aimless Docket Reshuffling” and astronomical backlog.

There is actually a reason why fundamental fairness and competent court management are required by Due Process! In the long run, following the Constitution and the statute, as well as having “judges” with actual expertise, independence, courage, and some “practical common sense,” as opposed to EOIR’s endless “haste makes waste” enforcement gimmicks and one-sided, bias-driven judging, makes for a more efficient justice system for everyone. But, that will require a “full housecleaning” at EOIR.

If Joe Biden is elected president, he promises to overturn President Trump’s aggression against federal employee unions, support regular pay raises for federal employees and protect their workplace rights.

Biden, the Democratic nominee, has pledged to upend Trump’s actions concerning federal labor organizations on Inauguration Day in January. Trump’s assaults were codified in three executive orders he issued in 2018. They systematically undermined the ability of unions to represent not only their members, but all employees in agency collective-bargaining units.

Saying Trump “has loosed a direct attack on our members’ union rights and dignity on the job,” the American Federation of Government Employees (AFGE) questionnaire to Biden outlines policies the largest federal union wants reversed.

“This includes purging lawful representational activity from government worksites and equipment, weaponizing the bargaining process to propose, and in some cases impose, one-sided contracts, attacking our statutory right to collect voluntary dues, crippling our ability to mediate disputes on duty time, and more,” says the questionnaire’s introduction. “Taken together, these attacks constitute more than just a threat to our members’ livelihoods, they threaten the survival of the merit-based civil service system on which our government is built.”

AFGE endorsed Biden last month. In two internal polls, AFGE said its members supported Biden over Trump by more than 30 points.

The first question asked Biden to commit to overturning the executive orders and other directives that weaken employee due process and collective bargaining rights “on your first day in office.” Biden agreed and said “the federal government should serve as a role model for employers to treat their workers fairly.”

“On my first day in office,” he added, “I will restore federal employees’ rights to organize and bargain collectively, restore their right to official time, and direct agencies to bargain with federal employee unions.” Official time allows union leaders to represent employees, including those who are not union members, in grievance procedures and matters involving issues such as workplace safety and productivity, while being paid by the government.

[If he gets a presidential Day 1, Biden has a nearly endless list of ways to spend it]

In addition to Biden’s answers, the Democratic Party Platform promises to “strengthen labor rights for the more than 20 million public-sector employees” at all levels by supporting legislation that would “provide a federal guarantee for public-sector employees to bargain for better pay and benefits and the working conditions they deserve.”

While Trump has been relentless in his federal union offensive, all was not copacetic when Biden served as Barack Obama’s vice president. Government workers vehemently opposed three federal pay freezes imposed under Obama, with congressional approval, during an era of budget tightening.

But the Obama-Biden administration did not seek to fundamentally undermine unions as Trump has done or diminish federal workers. Just another instance where Biden is going to have to separate himself from some misguided, occasionally weak-kneed and shortsighted, Obama-era policies and establish himself as his own man, with a decidedly more practical, aware, and progressive approach. And, as a long-time public servant himself (albeit an elected one) — whose career has in many ways been built and furthered by the skills, expertise, and contributions of civil servants in all branches of Government — I believe he is up to the task. Indeed, he might well be the best-qualified candidate in my lifetime to save and enhance our now reeling and crumbling civil service — one of the “crown jewels” of American democracy now under unrelenting assault from a thoroughly corrupt Trump and his GOP nihilist “wrecking crew.”

For example, look at how the cowardly and totally unethical “Billy the Bigot” Barr tried to “punish” Judge Ashley Tabaddor and the National Association of Immigration Judges (“NAIJ”) (disclosure: I am a proud retired member) for speaking “truth to power.” As the only ones authorized to speak out on behalf of Immigration Judges (regardless of membership in the NAIJ), Judge Tabaddor and other NAIJ officials exposed the massive corruption, gross mismanagement, improper politicization, and medically dangerous working conditions at EOIR! As a result, Billy tried to silence her and the NAIJ by filing a frivolous action to “decertify” the NAIJ based on bogus reasons, many rejected by the FLRA in the past. This abuse of Government resources and process by Billy has since been dismissed after hearing by a FLRA official, as previously reported in “Courtside.”

As a civil servant for more than 35 years, serving in Administrations of both parties, at levels from “worker bee” to “Senior Exec,” and a veteran of 21 years on both levels of the Immigration Bench (when it actually more resembled a “real court” than  the ridiculous parody engineered by Gonzo Apocalypto and Billy the Bigot), I know what I’m speaking about. 

Incidentally, I was one of the “founding brothers and sisters” of the BIA employees’ union in the 1970s, and then went on to battle that same union before the FLRA during my tenure as BIA Chair in the late 1990s. So, like many issues in immigration during my career, I understand both sides.

But, I never questioned the BIA union’s authority to speak for the staff. In most ways, it was a good “focal point” for getting important issues out in the open and resolving them, even if the process was occasionally contentious and frustrating. And, I’d have to admit to getting some good ideas on management improvements from union officials. So good, in fact, that I actually hired some of them to become staff managers at the BIA.

Over my career, I was involved in thousands of asylum and refugee cases, many of them successful. Many were fleeing countries with great progressive “paper constitutions” and sometimes even very “facially reasonable” statutory law. A number of these countries had even signed the U.N. Refugee Convention. What often made these countries “persecutors” as opposed to “protectors” was in the “execution” rather than the “black letter law.” 

Two characteristics that many of these persecutors had in common were: 1) an authoritarian executive who controlled a corrupt civil service usually “on the take,” staffed with family members, tribe members, or “party regulars,” and personally loyal to the leader rather than the constitution and statutes; and 2) “courts” that were either instruments of the leader and his tribe or party or too feckless to stand up against executive tyranny.

Under Trump and his corrupt GOP cronies, the US is well on its way to this type of “banana republic” public service in all three branches. And, don’t thank that a healthy economy or a robust stock market are “proof” against tyranny. Today’s China, as well as Nazi Germany and Imperial Japan, are prime examples of how “economic success and power” do not necessarily equate with good government, equality, or lack of repression.

This November, vote like your life and the future of our democracy depend on it! Because they do!

9th Cir. Sets BIA Straight on ‘Circularity’

On August 7, the U.S Court of Appeals for the Ninth Circuit dealt a blow to the Trump Administration’s attacks on domestic violence-based asylum claims.  In Diaz-Reynoso v. Barr, the petitioner applied for withholding of removal to Guatemala because she had been persecuted by her domestic partner on account of her membership in the particular social group consisting of “indiginous women in Guatemala who are unable to leave their relationship.”1  An immigration judge found her credible, but denied her applications for relief.

While her appeal was pending before the BIA, then-Attorney General Jeff Sessions issued his decision in Matter of A-B-.  The BIA subsequently relied on that decision to reject the Petitioner’s particular social group.

Regarding this sequence of events, it’s important to realize that in 2014, the BIA issued a precedent decision holding that a particular social group consisting of “married women in Guatemala who are unable to leave their relationship” could serve as a basis for asylum.  As a result, domestic violence-based asylum claims relied on this BIA-approved formulation as a model over the next four years.

When Sessions vacated the Board’s decision, many asylum claims relying on the prior precedent were already in the pipeline.  The BIA could have applied Matter of A-B- only prospectively to cases filed after Sessions’ decision.2  Or if it decided to apply the decision retroactively, it could have remanded the cases that had relied on the law at the time of filing to now allow them to modify their record in response to the superseding decision.

However, the Board did neither of these things.  Instead, it denied the pending cases with no individualized analysis, simply dismissing the claim as being too similar to the case that the Attorney General had just disagreed with.

In Diaz-Reynoso, the Ninth Circuit refuted the above approach by affirming the following points that have been raised repeatedly since the issuance of the AG’s decision, but that the BIA has continued to ignore.

First, the court held that Matter of A-B- does not categorically bar the granting of domestic violence-based asylum claims.  In the words of the court: “Far from endorsing a categorical bar, the Attorney General emphasized that the BIA must conduct the ‘rigorous analysis’ set forth in the BIA’s precedents.’”

Second, the court affirmed the commonly-held view that much of the AG’s decision in Matter of A-B- is nonbinding dicta.  In the words of the Ninth Circuit, the AG offered “some general impressions about asylum and withholding claims based on domestic violence and other private criminal activity.”  But the court noted that “despite the general and descriptive observations set forth in the opinion, the Attorney General’s prescriptive instruction is clear: the BIA must conduct the proper particular social group analysis on a case-by-case basis.”

Third, the court held that the particular social group that Sessions rejected in Matter of A-B- was not impermissibly circular.

As the concept of circularity can be confusing, I will offer some explanation.  In order to merit asylum, persecution must be on account of a statutory ground: race, religion, nationality, membership in a particular social group, or political opinion.  Hypothetically, someone with a fear clearly unrelated to one of the necessary grounds could put forth an argument as follows: “I fear persecution.” “Why?” “Because I’m a member of a particular social group.” “What group?” “People who fear persecution.” “But why do they fear persecution?” “Because of their social group.”  “What group?” “People who fear persecution.”  And this could  go on and on, continuing in the same circle.

In a 2006 precedent decision, Matter of C-A-, the BIA cited to UNHCR guidelines on particular social groups as prohibiting this exact scenario, in which a group is defined exclusively by the harm.  The Board repeated the same rule a year later in another precedent, Matter of A-M-E- & J-G-U-, again using the word “exclusively” (although this time without the emphasis).3  However, the BIA in 2014 added language that a particular social group must exist independently of the persecution, without explaining whether this term differed in meaning from the “exclusively defined” prohibition, and if so, to what degree.

In Matter of A-B-, the AG first jumped to the conclusion that the reason an asylum-seeker is  “unable to leave the relationship” is due to persecution.4  And following that assumption, he rejected the particular social group as being impermissibly circular.

As stated above, the particular social group in Diaz-Reynoso was “indiginous women in Guatemala who are unable to leave their relationship.”  The group was thus defined by the group members’ (1) indiginous status; (2) Guatemalan nationality; (3) gender; and (4) inability to leave their relationship.  So the group was clearly not exclusively defined by the persecution.

And yet, as the Ninth Circuit noted, “with almost no analysis, the BIA rejected Diaz-Reynoso’s proposed particular social group because it ‘suffer[ed] from the same circularity problem articulated by the Attorney General in Matter of A-B-.’”

The Ninth Circuit continued: “In the Government’s and dissent’s view, in order to exist independently from the petitioner’s feared harm, a proposed group may not refer to that harm at all. We disagree. The idea that the inclusion of persecution is a sort of poison pill that dooms any group does not withstand scrutiny.”

The court further clarified that a group exists independent of persecution when it “shares an immutable characteristic other than the persecution it suffers.”  As noted above, the particular social group here included three such immutable characteristics: indiginous status, nationality, and gender.  These serve as what the court termed “narrowing characteristics” independent of any harm.

The court further questioned the logic behind the agency’s restrictive view of circularity: “The purpose of asylum and withholding is to provide relief to people who have been persecuted in foreign lands because of their race, religion, nationality, membership in a particular social group, or political opinion…The Government and dissent do not explain why a person seeking relief on the basis of membership in a particular social group should be required to omit any mention of threatened persecution.”

One additional point worth mentioning is that the Ninth Circuit looked to UNHCR materials for guidance, noting that the BIA has found UNHCR’s views to be “a useful interpretive aid.”

The Ninth Circuit’s decision should certainly be applauded by asylum advocates.  The court joined the First and Sixth Circuits in rejecting the reliance on Matter of A-B- as a basis for swiftly dismissing domestic violence claims.

But this litigation could have been avoided through the BIA properly doing its job.  The petitioner in this case endured four years of abuse at the hands of her tormentor.  She was forced by him to work without pay in the coffee fields as well as to have sex with him.  She was further subjected to weekly beatings, suffering bruises that sometimes lasted for 10 days.

The petitioner actually escaped to the U.S., where she was detained for a month and then deported back to Guatemala.  There, she was forced to return to her abuser when he threatened to otherwise kill her and her daughter and harm her mother.  Upon return, she was subjected to even worse abuse for another year.

And yet an appellate immigration judge with the BIA saw in this case an opportunity for a quick denial with no analysis, on the grounds that the particular social group that had been valid for four years now contained a few more words than the AG approved of.  This sadly demonstrates the present philosophy of the BIA, where the goal of achieving quick dismissals has usurped the need for reasoned analysis and due process.

The petitioner was represented by students and supervising counsel with the Hastings Appellate Project, an advocacy clinic of the University of California – Hastings College of Law.  Amicus briefs were filed by the Center for Gender and Refugee Studies, the Round Table of Former Immigration Judges, Harvard Law School’s Immigration and Refugee Clinical Programs, and UNHCR.  Special mention is due to Blaine Bookey at CGRS, who so ably argued the case remotely.

  1. The Petitioner was ineligible to apply for asylum because she was subject to reinstatement of a prior order of removal.
  2. I believe a strong argument can be made that Matter of A-B- more closely  resembled a policy announcement (which should be applied prospectively only) than a judicial interpretation of the law that would apply retroactively.
  3. There is actually an exception to this rule, that we need not go into here.
  4. In De Pena Paniagua v. Barr, the First Circuit in April explained that there may be other reasons one could be unable to leave their domestic relationship that are unrelated to persecution.

While the Supremes and other Federal Courts continue to live in their “alternate universe,” most of the rest of us have noticed that the Trump regime is completely unapologetic and undeterred by their frequent defeats in Federal Court. There are no consequences, and therefore no deterrents, for their lies, misrepresentations, unprofessionalism, racist bias, and contempt for the American justice system. Nobody loses a law license, nobody goes to jail, nobody is required to operate under meaningful court supervision. Appalling misconduct and contemptuous behavior is normalized. “Just commit the same abuse again with a slightly different rationale” has become the watchword. The Supremes have shown they will accept any fraudulent rationale from Trump and his toadies as long as it gives them “some cover” for systemic abuses of people of color.

I’d say that Billy Bigot actually treats the Article IIIs almost like he treats the Immigration Courts – as his toady subordinates. And, he pretty much gets away with it! Contempt for Congress and the Courts is the heart of the “Unitary Executive” pushed by Billy and his neo-fascist cronies. And, until the Article IIIs find the collective backbone to “just say no,” the “Unitary Executive” is going to continue to run roughshod over them while our democracy.

It never hurts to restate the obvious when dealing with the never-ending, always worsening mess at EOIR.

A system that competently selects well-qualified professional judges needs very little “management” at all, since judges are independent decision makers. Qualified judges basically are “self-managing.”

What they do need is competent professional administrators who secure the necessary resources, technology, equipment, and training for those judges to function efficiently and professionally while steering clear of any interference in substantive judicial decision making. Administrators responsible to the judges and public they serve, rather than vice versa as EOIR is now constructed. Indeed, “customer service” at today’s EOIR isn’t just “off the charts” — it never was on the regime’s chart to begin with!

A trial court also needs a competent, functional appellate division that shows leadership in promoting due process, fundamental fairness, and best practices throughout the system through clear, cogent, and intellectually honest precedents.

Right now EOIR has almost nothing it needs and everything it doesn’t. Not surprisingly, this incredibly FUBAR system is a total dysfunctional mess where injustice reigns supreme and “management” squanders taxpayer funds while constantly turning complete disorder into mind-boggling morale killing unrelenting disasters.

The immigration court system lacks independence. An agency within the Department of Justice, the Executive Office for Immigration Review (EOIR) houses the immigration court system, which consists of trial-level immigration courts and a single appellate tribunal known as the Board of Immigration Appeals (BIA). Immigration judges, including appellate immigration judges, are viewed by EOIR “management” not as judges, but as Department of Justice attorneys who serve at the pleasure and direction of the Nation’s prosecutor-in-chief, the Attorney General.

As former immigration judges, we offer the Court our experience and urge that corrective action is necessary to ensure that immigration judges are permitted to function as impartial adjudicators, as required under the Immigration and Nationality Act. The INA and its implementing regulations set forth procedures for the “timely, impartial, and consistent” resolution of immigration proceedings. See 8 U.S.C. §§ 1103, 1230; 8 C.F.R. § 1003.1(d)(1) (charging the Board with appellate review authority to “resolve the questions before it in a manner that is timely, impartial, and consistent with the [INA] and regulations”) (emphasis added); 8 C.F.R. § 1003.10(b) (similarly requiring “immigration judges . . . to resolve the questions before them in a timely and impartial manner”) (emphasis added).

Although housed inside an enforcement agency and led by the Nation’s chief prosecutor, immigration judges must act neutrally to protect and adjudicate the important rights at stake in immigration cases and check executive overreach in the enforcement of federal immigration law. Applying a detached and learned interpretation of those laws, judges must correct overzealous bureaucrats and policy makers when they overstep the bounds of reasonable interpretation and the requirements of due process.

a huge victory today for one of our clients, and hopefully many other folks in our community.

 

in Johnson v. Barr, the 10th circuit ruled that the Colorado statute of possession of a controlled substance is overboard as to the federal schedule and indivisible as to the particular controlled substance within a schedule.

 

the court honed in on the categorical approach, looking first to the plain language of the statute, the penalties assigned under the statute, its unpublished decision in Arellano, and persuasive state case law in deciding in our favor.

 

-this means that no conviction for possession of a schedule I or II CS can support the CS grounds of inadmissibility or deportability. this will hopefully help countless people who were found inadmissible, deportable, subject to mandatory detention, and ineligible for relief to seek redress of those legal errors.

 

-by extension, this decision is likely to apply to simply possession of a schedule III-V because it is also overbroad and structured nearly identically to the possession statute at issue in Johnson. moreover, due to legislative change last year classifying all PCS of schedule I-V CS as a DM1 offense starting in 2020, all future PCS offenses are likely also overbroad and indivisible.

 

this is definitely a day to celebrate. we will see whether the govt seeks rehearing or cert.

As noted by Hans, this decision could have “big-time” impact and result in numerous motions to reopen and “redos.” It’s just another example of how the gimmicks and misinterpretations used and encouraged by the Trump regime as part of their “haste makes waste” deport everyone policies actually create backlogs and waste resources while doing grave injustices.

Back before the 2016 election, GOP backbench Jim Crow hate monger Senator Jeff “Gonzo Apocalypto” Sessions saw a kindred spirit who would help him realize his whitewashed, faux Christian view of America: Donald Trump. Becoming the first Senator to endorse Trump got Gonzo a ticket to the U.S. Attorney General’s Office, where he quickly established himself as probably the worst inhabitant after the Civil War and before Billy Barr ( a period that notably includes “John the Con” Mitchell).

During his tenure, Gonzo separated families, caged kids, targeted vulnerable Latino refugee women for abuse, illegally punished “sanctuary cities,” expanded the “New American Gulag,” diverted prosecutorial resources from real crimes to minor immigration violations, expanded the “New American Gulag,” advocated discrimination against the LGBTQ community under the guise of religious bigotry, encouraged police brutality against Black Americans, aided efforts to disenfranchise Black and Latino voters, spread false narratives about immigrant crime and asylum fraud, dissed private lawyers, stripped Immigration Judges of their authority to control their own dockets, multiplied the Immigration Court backlogs, illegally tried to terminate DACA while smearing Dreamers, spoke to hate groups, issued unethical “precedent decisions” while falsely claiming to be acting in a quasi-judicial capacity, interfered with asylum grants and judicial independence, put anti-due-process production quotas on Immigration Judges, attempted to dismantle congressionally mandated “know your rights” programs, to name just a few of his gross abuses of public office. Indeed, other than Stephen Miller and Trump himself, how many notorious child abusers get to walk free in America while their victims suffer lifetime trauma?

Despite never being the brightest bulb in the pack, his feeble attempt at “legal opinions” sometimes drawing ridicule from lower court judges, Gonzo is generally credited with doing more than any other Cabinet member to advance Trump’s agenda of hate and White Nationalist bigotry. He actually was dumb enough to believe that his unswerving dedication to a program of promoting the white race over people of color and Christians over all other religions would ingratiate him with Trump. 

That would assume, however, that Trump had some guiding principle, however vile and disgusting, beyond himself. Sessions might be the only person in Washington who thought racism would trump self-protection. I’m not saying that Trump isn’t a committed racist — clearly he is. Just that his commitment to racism is subservient to his only real defining characteristic — narcissism. Just ask his niece, Mary.

Gonzo failed in the only thing that ever counted: Protecting Trump, his family, and his corrupt cronies from the Mueller investigation. It wasn’t, as some have inaccurately claimed, a show of ethics or dedication to the law.

Even Gonzo realized that participating in an investigation involving a campaign organization of which he was a member and therefore both a potential witness and target, would be an egregious ethical violation that could cost him his law license as well as a potential criminal act of perjury, given that he had testified under oath during his Senate confirmation that he intended to recuse himself. Apparently, that was on a day when Trump was too busy tweeting or playing golf to focus on the implications of that particular statement under oath by his nominee.

After Trump fired him, Gonzo’s political fortunes took a sharp downturn. A guy who polled 97% of the vote in running unopposed for the Senate in 2014, polled only 38% of the vote in overwhelmingly losing the GOP primary to former Auburn Football Coach Tommy Tuberville. Tommy, a “Trump loyalist” with extreme far-right views and no known qualifications for the job, is not much of an improvement over Sessions.

Perhaps the only good news is that Alabama currently has a very decent and competent U.S. Senator, Doug Jones (D), who represents all of the people of the state. Everybody should support Doug’s campaign to maintain decency and commitment to equal justice in Government.
