She was one of the most recognizable activists in Nicaragua, protesting a government that has jailed and killed its opponents. Her photo ran in national newspapers; one called her the “face of the rebellion.” Her video of police firing at student protesters went viral. Her confrontations with the government were cited by the U.S. State Department.

Valeska Alemán, 22, paid a price for that notoriety. She was detained twice. Interrogators pried off her toenails. When she decided to leave the country, the United States seemed a natural destination: The Trump administration has been vocal in its opposition to Nicaragua’s crackdown — and its support of the country’s young protesters.

But by the time Alemán arrived at the U.S. border in July, the administration had launched a pandemic-era policy that sends Nicaraguans directly back to their country without letting them apply for asylum. Seventeen days after crossing into Texas, she was put on a plane back to Managua with more than 100 other Nicaraguans, almost all of them opponents of President Daniel Ortega.

Her backpack was full of documents to show U.S. immigration officials that the government appeared ready to kill her. The officials wouldn’t look at them. When she landed back in Nicaragua, it felt as if she was carrying a ticking bomb, proof that she was trying to flee and accuse the government of abuse.

“I thought, ‘Okay, so they’re going to throw me straight back in jail,’ ” Alemán said. “ ‘I’m going to be tortured all over again.’ ”

Another expelled asylum seeker, Moises Alberto Ortega Valdivia, 38, swallowed five pages of his asylum paperwork, panicked that Nicaraguan police would find it.

Since taking control in 2017, the Trump administration has narrowed the pool of people who qualify for asylum and sent tens of thousands of applicants back to Mexico to await their hearings from squalid tent camps and shelters.

During the coronavirus pandemic, the administration has gone further, effectively shutting the asylum system down. Most Central American applicants are simply escorted back to Mexico. But Nicaraguans — including political protesters to whom the United States has given rhetorical support — are flown back to the country they tried to escape.

The administration is using a public health order known as 42 U.S.C. that cites “the danger to the public health” of migrants to justify the asylum system’s closure. Mexico has agreed to accept Salvadorans, Guatemalans and Hondurans. Other nations, such as Cuba and Venezuela, have refused to accept chartered U.S. deportation flights of their own citizens.

In the case of Nicaragua, the United States is sending asylum seekers back to a country the State Department describes as violently repressive.

“Throughout Nicaragua, armed and violent uniformed police or civilians in plain clothes acting as police (‘para-police’) continue to target anyone considered to be in opposition to the rule of President Ortega,” the department says in a travel warning. “The government and its affiliated armed groups have been reported to arbitrarily detain pro-democracy protestors, with credible claims of torture and disappearances.”

U.S. Customs and Border Protection did not respond to multiple requests for comment. In a statement, the State Department said it “condemns all forms of political oppression, especially that orchestrated by the corrupt Ortega regime.” But it would not comment on the expulsion of Nicaraguan asylum seekers.

Alemán traveled with a family of Nicaraguan asylum seekers to the Texas border. All were university graduates and students of international affairs. Before they left, they reviewed the asylum laws on a U.S. government website.

Section 208 of the Immigration & Nationality Act says:

Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien’s status, may apply for asylum in accordance with this section or, where applicable, section 1225(b) of this title.

Very clear. What happened to refugee Valeska Alemán and other asylum seekers at the hands of the Trump regime was totally illegal (not to mention immoral); essentially a “crime against humanity” for which Trump, Miller, Wolfman, and the other “perps” should be held accountable.

But, this is Trump’s America where a majority of the Roberts’ Court favors White Supremacy, racism, and crimes against humanity over the Constitutional, statutory, and human rights of people of color. It’s called “Dred Scottification.”  It’s a national and international disgrace that will stain our nation forever!

As he seeks a second term, [Trump has] also made it clear that he hasn’t finished. He still wants to end the Obama-era Deferred Action for Childhood Arrivals (DACA) program once and for all, drive out the millions of unauthorized immigrants living in the US and curb their political power, enact what he calls “merit-based” immigration reform, and pursue a slew of restrictive immigration regulations.

The US has already seen the harms of Trump’s first-term immigration policies, which could cut deeper if he’s given another four years: Legal immigration is plummeting, stymying growth in the labor force and threatening the US’s ability to attract global talent and recover from the coronavirus-induced recession. The US has abdicated its role as a model for how a powerful country should support the world’s most vulnerable people. And the millions of immigrants already living in the US, regardless of their legal status, have been left uncertain of their fate in the country they have come to call home.

Other concerns — including the coronavirus, racial justice, and unemployment — have recently eclipsed immigration as a top motivating issue for voters. But for Trump, who currently lags former Vice President Joe Biden in the polls, restricting immigration proved a winning message in 2016, and he will likely try to replicate that strategy again.

“It’s the thing he keeps going back to,” Douglas Rivlin, director of communication at the immigrant advocacy group America’s Voice, said. “It is his comfort zone — to go after people of color and turn them into sort of the specter of scary, violent people as a political strategy.”

Whether any version of that proposal will get traction would largely depend on the makeup of the next Congress and whether Democrats win a majority in the Senate. Most immigration policy experts aren’t convinced that Trump will see success in negotiating with Democrats, but the political calculus could change if Democrats control both chambers of Congress and need Trump to sign their legislation.

It also depends on Republicans acting as a unified front on immigration. So far, pro-business Republicans aren’t challenging the restrictions and travel bans Trump has imposed during the pandemic, and as the US continues to grapple with its worst economic crisis since the Great Depression and more than a million Americans are out of work, they will likely continue to follow the president’s lead. But in the long term, they might find themselves at philosophical odds with the anti-immigrant wing of the party.

“I think the reality of the economics of immigration and the sort of more ideological agenda are going to come into conflict,” Rivlin said.

But if Trump can overcome those hurdles, the prize would be substantial: the ability the leave his mark on the immigration system beyond a series of executive actions that could be reversed by the next Democrat who assumes office.

“Merit-based immigration reform would be a legacy for him on immigration, more so than a border wall,” the Bipartisan Policy Institute’s Cardinal-Brown said. “That would have impacts on the future of immigration for decades.”

Don’t be fooled. In “Trumpspeak” the term “merit-based” means “race-based” (favoring, of course, White guys, preferably rich, English speaking, and prospective GOP toadies). Again, to state the obvious, a “kakistocracy” by definition lacks the ability to recognize and reward true “merit.” That’s why it’s a “kakistocracy,” not a “meritocracy!”

America is a nation of immigrants. To change that, Trump will have to destroy America, which, as this week’s “clown show of hate, fear, loathing, and complete nonsense” (a/k/a “The GOP Convention”) shows, he and his followers are perfectly willing to do. 

This perverted “vision” of America also ties in well with the Trump/GOP approach to racism and social justice: Ignore injustice and double down on violence administered by the largely White power structure against communities of color. Kill, maim, blame, punish, jail, intimidate, disenfranchise, and dehumanize the victims rather than looking for cooperative ways to solve the problems. Sow fear, hate, and division to insure that institutionalized racism and White grievance will be indelibly ingrained in America! As these self-inflicted grievances play out, the Trump family and its cronies will use the ensuing chaos as a diversion to loot the Treasury and use what remains of “government” to further their own personal interests, without regard to the common welfare. Nice folks!

It’s doubtful that America as the majority of us have envisioned it can survive another four years of Trump’s corruption, racism, and malicious incompetence. Despite some liberal wishful thinking, our democratic institutions and apparently overrated “checks and balances” are crumbling before our eyes. 

The “JR Five” on the Supremes and the GOP Senate already have reached “Penceian levels” (“Pence” rhymes with “incompetence”) of mindless sycophantic subservience to the “Clown Prince” and his entourage. None of them would be able to extract their collective heads from the more than ample Presidential rear to see any daylight during a second term. Trump’s re-election would inevitably convert the “City on The Hill” to a “wealthy universally despised third world kleptocracy.” That’s the real “vision” of Trump and the GOP. (I think that Nicole’s “hypothetical” of a Trump victory and a Dem Senate is the “least likely scenario.”)

If Joe Biden is elected president, he promises to overturn President Trump’s aggression against federal employee unions, support regular pay raises for federal employees and protect their workplace rights.

Biden, the Democratic nominee, has pledged to upend Trump’s actions concerning federal labor organizations on Inauguration Day in January. Trump’s assaults were codified in three executive orders he issued in 2018. They systematically undermined the ability of unions to represent not only their members, but all employees in agency collective-bargaining units.

Saying Trump “has loosed a direct attack on our members’ union rights and dignity on the job,” the American Federation of Government Employees (AFGE) questionnaire to Biden outlines policies the largest federal union wants reversed.

“This includes purging lawful representational activity from government worksites and equipment, weaponizing the bargaining process to propose, and in some cases impose, one-sided contracts, attacking our statutory right to collect voluntary dues, crippling our ability to mediate disputes on duty time, and more,” says the questionnaire’s introduction. “Taken together, these attacks constitute more than just a threat to our members’ livelihoods, they threaten the survival of the merit-based civil service system on which our government is built.”

AFGE endorsed Biden last month. In two internal polls, AFGE said its members supported Biden over Trump by more than 30 points.

The first question asked Biden to commit to overturning the executive orders and other directives that weaken employee due process and collective bargaining rights “on your first day in office.” Biden agreed and said “the federal government should serve as a role model for employers to treat their workers fairly.”

“On my first day in office,” he added, “I will restore federal employees’ rights to organize and bargain collectively, restore their right to official time, and direct agencies to bargain with federal employee unions.” Official time allows union leaders to represent employees, including those who are not union members, in grievance procedures and matters involving issues such as workplace safety and productivity, while being paid by the government.

[If he gets a presidential Day 1, Biden has a nearly endless list of ways to spend it]

In addition to Biden’s answers, the Democratic Party Platform promises to “strengthen labor rights for the more than 20 million public-sector employees” at all levels by supporting legislation that would “provide a federal guarantee for public-sector employees to bargain for better pay and benefits and the working conditions they deserve.”

While Trump has been relentless in his federal union offensive, all was not copacetic when Biden served as Barack Obama’s vice president. Government workers vehemently opposed three federal pay freezes imposed under Obama, with congressional approval, during an era of budget tightening.

But the Obama-Biden administration did not seek to fundamentally undermine unions as Trump has done or diminish federal workers. Obama’s stated effort to “make government cool again” contrasts sharply with Trump’s “drain the swamp” attitude toward government. Trump did not respond to AFGE’s questionnaire.

Just another instance where Biden is going to have to separate himself from some misguided, occasionally weak-kneed and shortsighted, Obama-era policies and establish himself as his own man, with a decidedly more practical, aware, and progressive approach. And, as a long-time public servant himself (albeit an elected one) — whose career has in many ways been built and furthered by the skills, expertise, and contributions of civil servants in all branches of Government — I believe he is up to the task. Indeed, he might well be the best-qualified candidate in my lifetime to save and enhance our now reeling and crumbling civil service — one of the “crown jewels” of American democracy now under unrelenting assault from a thoroughly corrupt Trump and his GOP nihilist “wrecking crew.”

For example, look at how the cowardly and totally unethical “Billy the Bigot” Barr tried to “punish” Judge Ashley Tabaddor and the National Association of Immigration Judges (“NAIJ”) (disclosure: I am a proud retired member) for speaking “truth to power.” As the only ones authorized to speak out on behalf of Immigration Judges (regardless of membership in the NAIJ), Judge Tabaddor and other NAIJ officials exposed the massive corruption, gross mismanagement, improper politicization, and medically dangerous working conditions at EOIR! As a result, Billy tried to silence her and the NAIJ by filing a frivolous action to “decertify” the NAIJ based on bogus reasons, many rejected by the FLRA in the past. This abuse of Government resources and process by Billy has since been dismissed after hearing by a FLRA official, as previously reported in “Courtside.”

As a civil servant for more than 35 years, serving in Administrations of both parties, at levels from “worker bee” to “Senior Exec,” and a veteran of 21 years on both levels of the Immigration Bench (when it actually more resembled a “real court” than  the ridiculous parody engineered by Gonzo Apocalypto and Billy the Bigot), I know what I’m speaking about. 

Incidentally, I was one of the “founding brothers and sisters” of the BIA employees’ union in the 1970s, and then went on to battle that same union before the FLRA during my tenure as BIA Chair in the late 1990s. So, like many issues in immigration during my career, I understand both sides.

But, I never questioned the BIA union’s authority to speak for the staff. In most ways, it was a good “focal point” for getting important issues out in the open and resolving them, even if the process was occasionally contentious and frustrating. And, I’d have to admit to getting some good ideas on management improvements from union officials. So good, in fact, that I actually hired some of them to become staff managers at the BIA.

Over my career, I was involved in thousands of asylum and refugee cases, many of them successful. Many were fleeing countries with great progressive “paper constitutions” and sometimes even very “facially reasonable” statutory law. A number of these countries had even signed the U.N. Refugee Convention. What often made these countries “persecutors” as opposed to “protectors” was in the “execution” rather than the “black letter law.” 

Two characteristics that many of these persecutors had in common were: 1) an authoritarian executive who controlled a corrupt civil service usually “on the take,” staffed with family members, tribe members, or “party regulars,” and personally loyal to the leader rather than the constitution and statutes; and 2) “courts” that were either instruments of the leader and his tribe or party or too feckless to stand up against executive tyranny.

Under Trump and his corrupt GOP cronies, the US is well on its way to this type of “banana republic” public service in all three branches. And, don’t thank that a healthy economy or a robust stock market are “proof” against tyranny. Today’s China, as well as Nazi Germany and Imperial Japan, are prime examples of how “economic success and power” do not necessarily equate with good government, equality, or lack of repression.

This November, vote like your life and the future of our democracy depend on it! Because they do!

New Legal Challenge: CARECEN v. Cuccinelli

Representing the CARECEN and seven people with Temporary Protected Status, CLINIC, Democracy Forward, Montagut & Sobral PC and Debevoise & Plimpton LLP sued the Trump administration to block a policy issued by an unauthorized federal executive, U.S. Citizenship and Immigration Services’ Acting Director Ken Cuccinelli. The lawsuit, filed today in the U.S. District Court for the District of Columbia, seeks to stop the Trump administration from denying access to lawful permanent residency to people with TPS who legally qualify for green cards thanks to their U.S. citizen spouse or child. Cuccinelli’s action, couched as a mere “update” to the agency’s policy manual, eliminates the ability for TPS beneficiaries with prior removal orders to apply to adjust status with USCIS even though they departed the United States and returned with USCIS permission. The suit challenges the policy change as unlawful under the Administrative Procedure Act and the Constitution’s Due Process Clause, and because its author, Ken Cuccinelli, was not legally appointed to direct USCIS.

With LPR status, and eventually US citizenship, they can reach their full potential as humans and as members of our society. That’s a “win-win” that helps us move forward and prosper as a nation.

Yet, “Cooch Cooch” and the rest of the maliciously incompetent kakistocracy at DHS stay up nights thinking of ways to “stiff” our friends and neighbors in the TPS community and to keep them from regularizing their status and achieving their full human and economic potential, not to mention traumatizing US citizen family members. Talk about fraud, waste, and abuse in Government!

Incidentally, current TPS holders would all be entitled to full Immigration Court hearings if the regime attempted to expel them by force after ending TPS. Most have strong claims to relief, from cancellation of removal to asylum and other forms of protection.

Many could apply for adjustment of status in Immigration Court and individually litigate no matter what the USCIS “policy.” With a known backlog of approximately 1.5 million cases and perhaps another 500,000 to 1 million “lost in the docket dysfunction at EOIR,” their Immigration Court dates could easily be a decade, or “2.5 Administrations” from now. So, the Cuccinelli policy is basically a way of inflicting some cruelty and racist harassment on TPS’ers eligible to immigrate, without any realistic chance of “enforced removal.” Wow, talk about using a system already FUBAR’ed, to a major extent by this regime, as an illegal “weapon against humanity!”

Where, or where, have the Article IIIs been in taking a strong, unified stand against racism and stupidity (legal term “unreasonable behavior”) by the Trump immigration regime? Cooch Cooch was determined by a Federal Court to be illegally serving at USCIS! Yet, he contemptuously remains in office inflicting illegal harm and suffering on migrants, chewing up legal resources, and insultingly wasting the time of the Federal Courts.

I sort of understand the feckless performance of the Immigration Courts, wholly owned by “Billy the Bigot.” But, what’s the purpose of an independent Article III Judiciary that performs like it’s the “King’s Court” — unwilling or unable to defend our Constitution, humanity, or even their own prerogatives against the tyranny of a dangerous scofflaw moron like Trump?

What’s their excuse for drawing their salaries? The overall systemic failure of the Article III Judiciary, starting with a tone-deaf, racially insensitive, and often eagerly complicit Supreme’s majority, in the face of Trump’s White Nationalist authoritarianism, demands serious national re-examination of the role, qualities, and character we should expect from our Article III Judiciary, assuming that our nation survives the current legal and moral debacle led by Trump and enabled by judges who failed to do their duties!

That’s the key! With far too many public officials in all three branches spinelessly “tanking” on their constitutional duties to protect our rights and defend humanity from tyranny, the soldiers of the NDPA are among the courageous defenders of democracy and leaders of the long and challenging climb to equal justice and national decency. Support them by throwing the GOP — the anti-American party of bias, hate, lies, racism, institutionalized stupidity, and chaos — out at every level of government!

It is not news that the Republican Party has a stagnant governing agenda cobbled together from the long-discredited dogmas and shibboleths of the conservative movement. “The current iteration of the G.O.P. is indifferent to the substance of government,” Steve Benen, a political writer and producer for The Rachel Maddow Show on MSNBC, writes in “The Impostors: How Republicans Quit Governing and Seized American Politics”:

It is disdainful of expertise and analysis. It is hostile toward evidence and arithmetic. It is tethered to few, if any, meaningful policy preferences. It does not know, and does not care, about how competing proposals should be crafted, scrutinized or implemented.

What is news is the extent to which the Republican Party has embraced the trappings of its leader, which is to say, the trappings of a right-wing cable news network: a nonstop parade of conspiracy, demagogy and grievance, in service to a cult of personality, all for the sake of a politics of plunder, theft and extraction.

My question is why the so-called “mainstream media” (excluding Jamelle and a few others) handles with “kid gloves” folks like Nikki Haley, Tim Scott, and Melania, who go on national TV and present knowingly bogus, totally disingenuous, fabricated portraits of Trump as a benign presence in U.S. politics. This past weekend, the Republican National Committee caved to white supremacist and other hate groups by adopting a resolution titled Refuting the Legitimacy of the Southern Poverty Law Center to Identify Hate Groups.

The focus of the resolution is that “the SPLC is a radical organization” that harms conservative organizations and voices through our hate group designations.

This attack on our work is an attempt to excuse the Trump administration’s pattern and practice of working with individuals and organizations that malign entire groups of people — immigrants, Muslims and the LGBTQ community — while promoting policies that undermine their very existence. It comes from the same vein as Trump’s claim that there were “very fine people” on both sides of the 2017 Unite the Right rally in Charlottesville.

Simply put, it’s an audacious attempt by Trump and the GOP to paper over the bigotry and racism that has been allowed to infect their policies.

This resolution comes at a moment when Trump will argue at the Republican National Convention that he will combat hate and bigotry, despite welcoming the support of QAnon. It also comes days after the indictment of Stephen Bannon, reminding us that Bannon was once the White House chief strategist and senior counselor and CEO of Trump’s 2016 presidential campaign. And it comes just after our special investigation shined a light on One America News Network’s Jack Posobiec, a reporter at Trump’s favorite network who is aligned with white supremacy and has used his platform to further hate speech and propaganda.

Trump should sever these ties to hate groups and extremists instead of doubling down through this RNC resolution.

The Trump administration has filled its ranks and consulted with alumni and allies from the Federation for American Immigration Reform, an anti-immigrant hate group that has ties to white supremacist groups and eugenicists. They include Julie KirchnerKris KobachJeff Sessions and, most notably, Stephen Miller.

The Trump administration has worked with hate groups like the Family Research Council (FRC) to roll back LGBTQ rights. FRC was designated an anti-LGBTQ hate group for decades of demonizing LGBTQ people and spreading harmful pseudoscience about them. Over the years, the organization has published books, reports and brochures that have linked being LGBTQ to pedophilia, claimed that LGBTQ people are dangerous to children and claimed that LGBTQ people are promiscuous and violent.

Anti-Muslim groups have also been welcomed into the administration, including the Center for Security Policy (CSP)Fred Fleitz, a longtime staffer, was appointed the executive secretary and chief of staff of the National Security Council. For decades, CSP has peddled absurd accusations that shadowy Muslim Brotherhood operatives have infiltrated all levels of government.

These extremists are seeking a license to continue spreading their bigotry and will do anything to undermine those — like the SPLC, which tracks and monitors hate groups — who expose their extremist views and oppose their attacks on communities. With this resolution, Trump and members of the GOP have shown the extent to which they will carry their water.

This past weekend, the RNC also released a resolution titled Resolution to Conserve History and Combat Prejudice – Christopher Columbus. It’s a remarkably transparent statement that hate and bigotry stem from Black Lives Matter protesters. The RNC and Trump did not denounce organizations that promote antisemitism, Islamophobia, neo-Nazis, anti-LGBTQ sentiment or racism. It only criticized the SPLC for challenging those groups.

Trump cabinet officials voted in 2018 White House meeting to separate migrant children, say officials

WASHINGTON — In early May 2018, after weeks of phone calls and private meetings, 11 of the president’s most senior advisers were called to the White House Situation Room where they were asked, by a show-of-hands vote, to decide the fate of thousands of migrant parents and their children, according to two officials who were there.

Trump’s senior adviser, Stephen Miller, led the meeting and, according to the two officials, he was angry at what he saw as defiance by Department of Homeland Security Secretary Kirstjen Nielsen.

It had been nearly a month since then-Attorney General Jeff Sessions had launched the Trump administration’s “zero tolerance” policy, announcing that every immigrant who crossed the U.S. border illegally would be prosecuted, including parents with small children. But so far, U.S. border agents had not begun separating parents from their children to put the plan into action, and Miller, the architect of the Trump administration’s crackdown on undocumented immigrants, was furious about the delay.

Those invited included Sessions, Nielsen, Health and Human Services Secretary Alex Azar and newly installed Secretary of State Mike Pompeo, according to documents obtained by NBC News.

Nielsen told those at the meeting that there were simply not enough resources at DHS, nor at the other agencies that would be involved, to be able to separate parents, prosecute them for crossing the border and return them to their children in a timely manner, according to the two officials who were present. Without a swift process, the children would enter into the custody of Health and Human Services, which was already operating at near capacity.

Two officials involved in the planning of zero tolerance said the Justice Department acknowledged on multiple occasions that U.S. attorneys would not be able to prosecute all parents expeditiously, so sending children to HHS was the most likely outcome.

As Nielsen had said repeatedly to other officials in the weeks leading up to the meeting, according to two former officials, the process could get messy and children could get lost in an already clogged system.

Miller saw the separation of families not as an unfortunate byproduct, but as a tool to deter more immigration. According to three former officials, he had devised plans that would have separated even more children. Miller, with the support of Sessions, advocated for separating all immigrant families, even those going through civil court proceedings, the former officials said.

While “zero tolerance” ultimately separated nearly 3,000 children from their parents, what Miller proposed would have separated an additional 25,000, including those who legally presented themselves at a port of entry seeking asylum, according to Customs and Border Protection data from May and June 2018.

That plan never came to fruition, in large part because DHS officials had argued it would grind the immigration process to a halt. But after Sessions’ announcement that all families entering illegally would be prosecuted, the onus had fallen on DHS to act.

At the meeting, Miller accused anyone opposing zero tolerance of being a lawbreaker and un-American, according to the two officials present.

“If we don’t enforce this, it is the end of our country as we know it,” said Miller, according to the two officials. It was not unusual for Miller to make claims like this, but this time he was adamant that the policy move forward, regardless of arguments about resources and logistics.

No one in the meeting made the case that separating families would be inhumane or immoral, the officials said. Any moral argument regarding immigration “fell on deaf ears” inside the White House, said one of the officials.

“Miller was tired of hearing about logistical problems,” said one of the officials. “It was just, ‘Let’s move forward and staff will figure this out.'”

Frustrated, Miller accused Nielsen of stalling and then demanded a show of hands. Who was in favor of moving forward, he asked?

A sea of hands went up. Nielsen kept hers down. It was clear she had been outvoted, according to the officials.

In the days immediately following the meeting, Nielsen had a conversation with then-CBP Commissioner Kevin McAleenan inside her office at the Ronald Reagan Building, and then signed a memo instructing DHS personnel to prosecute all migrants crossing the border illegally, including parents arriving with their children.

So, separated families and children continue to suffer, much of the harm and trauma irreparable and life-defining. This “policy” was so clearly illegal and unconstitutional that DOJ attorneys conceded its unconstitutionality in Federal Court. 

However, in an ethics-free DOJ, those same lawyers falsely claimed that there was no such policy. Rudimentary “due diligence” on their part, required by professional ethics, would have revealed that their representations on behalf of corrupt institutional “clients” were false.

The article also confirms the complicity of Kevin “Big Mac  With Lies” McAleenan in gross, intentional human rights violations. Courtside exposed “Big Mac” long ago! 

While the victims continue to suffer, Miller, Sessions, Nielsen, Big Mac, and other cowards who planned and carried out these “crimes against humanity,” directed at some of the most vulnerable humans in the world, remain at large. Some, like Miller, actually remain on the “public dole.” Likely, so do the DOJ lawyers who unprofessionally defended and helped obscure this misconduct in Federal Court.

It’s also worth examining the role of U.S. Magistrate Judges and U.S. District Judges along the southern border, most of whom turned a blind eye to the transparent racial and political motives, not to mention the grotesque misallocation of public resources, driving Sessions’s “zero tolerance” misdirection of scarce prosecutorial resources from serious felonies to minor immigration prosecutions. 

As I’ve been saying, “Better Federal Judges for a better America!” And, better Federal Judges start with removal of the Trump regime as well as the ousting of “Moscow Mitch” and the GOP from Senate control. 

Will there ever be accountability? Our national soul and future might depend on the answer!

Had enough wanton cruelty, neo-Nazism, corruption, illegality, immorality, cowardice, lies, false narratives, racism, stupidity, and squandering of tax dollars on nativist schemes and gimmicks? Get motivated and take action to get our nation back on track to being that “City upon a Hill” that the rest of the world used to admire and respect!

Collectively, we were told to implement restrictive new policies, expressly designed to deter people from seeking refuge. The Migrant Protection Protocols, for example, resulted in more than 60,000 asylum seekers being sent to Mexico in 2019, after fleeing the extreme brutality of MS-13 and the 18th Street gang in Honduras, Guatemala and El Salvador. Left to live in squalor without any protection, they are preyed upon by cartels and gangs as they wait, sometimes months, for an elusive court date before an immigration judge.

The pandemic put refugees and asylum seekers in even more desperate straits, as the United States paused refugee resettlement. Many already interviewed and accepted for resettlement in the U.S. now live stateless at the margins of cities, towns and villages where they have no rights or legal status, or in overcrowded refugee camps. Around the world, in places including Jordan, Kenya and Bangladesh, refugee camps are bursting at the seams. People there are unable to practice social distancing, and soap and water are limited.

Meanwhile, at our borders, Customs and Border Protection has turned away thousands of vulnerable people since March, without due process. Some applicants showing symptoms of the coronavirus were deported with no regard for safety measures (such as testing), causing outbreaks in the countries from which they had fled. Others languish in crowded detention facilities, even though many of them pose no security threat and Immigration and Customs Enforcement has the discretion to release them. By law, children must be let out after 20 days of incarceration. But rather than release them with their parents, our government has presented these families with an agonizing choice: Either have their children released, indefinitely separated from their parents — or remain locked up together in these facilities, many of which have already witnessed coronavirus outbreaks.

Amid all this, in June, the administration proposed 161 pages of sweeping regulations that would gut asylum and refugee law. Certain provisions, for example, drastically narrow the definitions of persecution and torture; others raise certain burdens of proof to nearly unreachable standards and redefine what constitutes the protected grounds of political opinion and membership in a particular social group. Still others could disqualify applicants if they made a mistake on their tax filings, or took two or more layover flights on their way here. In July, the administration proposed yet another new policy, allowing the United States to deny asylum to applicants if they come from any country with an outbreak of a highly contagious disease. (Public health experts have said this would serve no legitimate public health purpose.) It’s difficult to see how anyone could qualify for protection under this tangle of new rules, once they’re implemented.

Years of tightening restrictions have made it harder to obtain a wide range of legal immigration benefits, causing applications to plummet and, with them, the user fees that fund U.S. Citizenship and Immigration Services operations. Now, the pandemic has placed our agency on the brink of bankruptcy, and 70 percent of our workforce faces an indefinite furlough unless Congress intervenes. Without emergency funding, only a skeleton crew will remain to administer America’s immigration services system — resulting in even greater backlogs in the processing of applications for benefits including asylum, green cards, work permits and citizenship.

Our nation has an ethical and legal responsibility to protect those who seek refuge here. Instead, we have expended vast resources on preventing people from entering the country and deporting people who are already here. If the current administration’s policies continue unchecked, there will no longer be a pathway for refugees to have a new beginning in the United States. Even if a different presidential administration tried to change course, I fear that it would take many years to reverse the damage and rebuild our capacity to protect refugees. Many people will lose their lives before then.

In the closing words of his farewell address, President Ronald Reagan described our country as a “shining city upon a hill”: “If there had to be city walls,” he said in 1989, “the walls had doors, and the doors were open to anyone with the will and the heart to get here.” That is still something most Americans believe in.

Why is this judicially-enabled retrogression to the “Hay-day of Jim Crow” acceptable in 21st Century America?

More than twice as many immigrants have died in the custody of Immigration and Customs and Enforcement this fiscal year than last after two detainees died this week. That brought this year’s total to 17, compared with eight deaths last year.

A 72-year-old Canadian man who had tested positive for the coronavirus died in ICE custody on Wednesday night at a Virginia hospital, the agency said Friday in a statement.

James Thomas Hill reported feeling shortness of breath to staff at an ICE detention facility in Farmville, Virginia, on July 10 and was admitted to Centra Southside Community Hospital before being transferred to Lynchburg General Hospital the following day, ICE said.

A COVID-19 test administered by hospital staff came back positive on July 11, the agency said.

Hill entered ICE custody on April 11 following his release from the Rivers Federal Correctional Institute in North Carolina after serving 13 years of a 26-year prison sentence for health care fraud and distributing a controlled substance, according to ICE. An immigration judge had ordered his removal on May 12, ICE said. At the time of his death, Hill was in ICE custody pending his removal to Canada, the agency said.

The agency said it had notified the Department of Homeland Security’s Office of Inspector General, the ICE Office of Professional Responsibility, the Canadian consulate and Hill’s next of kin. His death was first reported by BuzzFeed News.

A 51-year-old Taiwanese man died Wednesday afternoon at a Florida hospital after being a diagnosed with a “massive intercranial hemorrhage,” ICE said in a separate statement Thursday.

Kuan Hui Lee was found unresponsive at the Krome Service Processing Center in Florida on July 31 and taken to the Kendall Regional Medical Center.

  • Controversial Sen. Tom Cotton (R-Ark.) called slavery the nation’s “necessary evil” in a new interview published Sunday.
  • The senator told the Arkansas Democrat-Gazette that slavery was the evil ”upon which the union was built.”
  • He made the stunning comment while discussing how slavery should be taught in schools.
  • “We have to study the history of slavery and its role and impact on the development of our country because otherwise we can’t understand our country,” Cotton said. “As the Founding Fathers said, it was the necessary evil upon which the union was built.”
  • Cotton also noted that the “union was built in a way, as Lincoln said, to put slavery on the course to its ultimate extinction.”
  • Instead of portraying America as “an irredeemably corrupt, rotten and racist country,” the nation should be viewed “as an imperfect and flawed land, but the greatest and noblest country in the history of mankind,” he added.
  • Cotton delved into his twisted view of the history of slavery as he discussed his bill — the Saving American History Act of 2020 — that would cut off federal professional development funds from any school district that teaches a curriculum linked to the 1619 Project.
  • The 1619 Project — which refers to the year slaves were brought from Africa to colonial America — was a series of pieces by writers for the New York Times Magazine that examines the American history of slavery and its critical role in the nation’s founding.

Nikole Hannah-Jones, a Pulitzer Prize-winning Times reporter and director of the 1619 Project, blasted Cotton’s comments justifying slavery, “where it was legal to rape, torture and sell human beings for profit.” It’s “hard to imagine what cannot be justified if it is a means to an end,” she added.

So, Tommy, since you believe that slavery was necessary for America’s future prosperity and “goodness,” I assume that you are in the forefront of the movement to pay hefty reparations to the modern day ancestors of those who had to suffer for your White America to achieve greatness?

Cotton almost always speaks rubbish and racist BS. This is just another prime example. Of course, there is always a choice on whether or not to abuse, exploit, torture, and kill fellow humans. 

Undoubtedly, America as we know it was built on the minds, backs, suffering, misery, and uncompensated labor of enslaved African Americans. But, there were in fact in colonial and post-colonial America many individuals of various races who had the ability to farm their own land, practice their own crafts, trades, and professions, and engage in commerce that didn’t involve trafficking in human lives or the fruits of slave labor. Slavery represented a conscious choice by White Americans, not an inevitability that was unwillingly thrust upon them.

Surely, individuals like Washington, Jefferson, Madison, Monroe, and other slave-owning founding fathers who risked it all on the unlikely chance of winning a war against the British Empire, had the knowledge, ability, and creativity to have said “no to slavery.” They just lacked the moral courage as well as the self-confidence to believe in their own abilities to earn a living without exploiting others. 

It’s sad, true, but neither “unavoidable” nor “forgivable.” Indeed, the only ones qualified to “forgive” the sins of the founders would be those no longer with us — generations of enslaved African Americans who suffered so that the White Guys in power could build a better country for themselves. 

Cotton has no legitimate place in this debate. He should shut up, get off the public dole, and  develop some useful skills that would help all Americans toward a more just, equitable, and intellectually honest future as well as an understanding of the reality of past mistakes.

I have previously characterized Cotton as one of the most vile and dangerous public figures in America, with racism, ignorance, and willful falsity in his heat and mind. He just keeps proving my case!

As I predicted, the death of true courageous American hero Congressman John Lewis (whose briefcase Cotton wasn’t qualified to hold) was met by “crocodile tears” and the usual litany of disingenuous tributes by GOP politicos (other than Trump who simply made his pathetic “condolence” as brief as it was dishonest). But, now we get a real look at how the GOP “honors” Lewis and the African American community:

  • Not extending Voting Rights protections undermined by right-wing GOP politicos serving as Supreme Court Justices;
  • Dragging their feet on coronavirus relief while Trump bobbles the national response, communities of color are disproportionately adversely affected, and the GOP instead obsesses about providing unnecessary liability protections for their business buddies who promote unsafe conditions for their workers and customers;
  • Falsely trying to blame “Black Lives Matter” for protesting a broken justice system while Trump’s misallocated “stormtroopers” fan unrest and racial tensions;
  • Pretending not to hear as Trump sows more unrest by casting doubt on whether he will leave office if and when voted out by the people.

That’s the “real GOP.” A bunch of “not so closet” racists and misogynists who are scared silly that their White privilege finally might be “on the ropes” and that the real majority could not only triumph this Fall, as they did in 2016, but this time that majority might actually get the political power denied them last time.

This November, vote every GOP candidate out of office! Under Trump, and with folks like Cotton in the wings, the GOP has become the largest threat to our national security, health, unity, prosperity, humanity, and future as a democratic republic. Vote ‘em out, for a better America!

The only way the United States can remain the world’s most prosperous, powerful country is by embracing immigration. That’s the inescapable conclusion from a new study published on Tuesday in the Lancet that predicts the world’s population will peak far sooner than anticipated, and start shrinking before the end of this century.

There is, however, no guarantee that the US will embrace immigration, even to save itself. Domestic politics, currently inflamed by divisive nativist leaders, have turned immigration into a contested topic. A country that rose to historic heights of influence and prosperity by welcoming immigrants, is now led by a President who has weaponized the issue with unfathomable cruelty.

One example: At this moment, hundreds of migrant families held in detention facilities face the wrenching choice of whether to let their children be released to third parties, or stay together in detention. This awful decision comes as the result of court order last month that called for the children’s release in light of the coronavirus pandemic — and it is essentially a new version of the family separation policy that tore apart thousands of children from their parents earlier in the Trump administration.

Such heartless political measures flout America’s founding principles — but are also out of step with public opinion on immigration: an overwhelming majority of Americans — 77%, according to a recent 2020 Gallup poll- say it is good for the country. The prospect of falling birth rates predicted by study — from the Institute for Health Metrics and Evaluation at the University of Washington’s School of Medicine — may be a thumb on the scale in favor of more immigration. After all, businesses will need workers. Even the military will likely feel the pressure of contracting numbers of people of military age.

The new study shows how far off the mark earlier assumptions about exploding population growth fell. Some among you, my dear readers, may remember when intellectuals were gripped by the fear of a “Malthusian catastrophe,” fear that population growth would outpace our ability to feed ourselves. But it turns out that Thomas Robert Malthus, the 18th century economist and demographer, got it all wrong.

Not only did agricultural advances undercut his thesis, it turns out the world’s population will start contracting before long, with powerful economic, geopolitical and environmental implications.

The result will be increased friction over immigration, with the arguments of immigration advocates bolstered by demographers, economists and a business community anxious to see consumption increase and workers available.

The present may be blazing with the demagogues’ sturm und drang about keeping immigrants out. But the future belongs to the country that welcomes them.

Immigration is both an unstoppable human force and good for America. The sooner we end the current regime’s cruel and stupid White Nationalist policies and develop a robust, thoughtful, inclusive, realistic approach to legal immigration (including refugees), the better off we will be as a nation.

An immediate benefit would be a sharp reduction in the amount of resources and goodwill wasted on counterproductive and often both illegal and immoral restrictionist enforcement gimmicks. To keep what the BIA and the Administration are doing to our fellow humans in perspective, however, remember that:

  • Human Rights Watch studied the cases of more than 200 individuals who were returned to El Salvador by the Administration;
  • Of these, 138 were killed upon return;
  • Another 70 were “subjected to sexual violence, torture, and other harm, usually at the hands of gangs, or . . . went missing following their return;”

More Immigration Judges Leaving the Bench

The latest judge-by-judge data from the Immigration Courts indicate that more judges are resigning and retiring. Turnover is the highest since records began in FY 1997 over two decades ago. These results are based on detailed records obtained by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University under the Freedom of Information Act (FOIA) from the Executive Office for Immigration Review (EOIR) which administers the Courts.

During FY 2019 a record number of 35 judges left the bench. This is up from the previous record set in FY 2017 when 20 judges left the bench, and 27 judges left in FY 2018.

With elevated hiring plus the record number of judges leaving the bench more cases are being heard by judges with quite limited experience as immigration judges.

Currently one of every three (32%) judges have only held their position since FY 2019. Half (48%) of the judges serving today were appointed in the last two and a half years. And nearly two-thirds (64%) were appointed since FY 2017.

While the Court is losing many of its most experienced judges, the backlog of cases continues to balloon. It is now almost three times the level when President Trump assumed office.

Records continue to disappear in the latest data release for updated court records through the end of June 2020. The report provides the latest statement from EOIR Chief Management Officer Kate Sheehey about this matter.

Look folks, I’m not disputing that Susan B. Long and David Burnham of TRAC are smart people. I’m even willing to speculate that they are smarter than most of the folks still in so-called public service (that largely isn’t any more) in all three branches of our failing Government.

But, are they really that much smarter than Supreme Court Justices, Article III Federal Judges, and Legislators who have let this grotesquely unconstitutional, dysfunctional, and deadly Star Chamber masquerading as a “court system” right here on American soil unfold and continue its daily abuses right under their complicit noses? Or, do we have too many individuals in public office lacking both the human decency and moral courage to stand up against institutionalized racism, unnecessarily cruelty, corruption, and pure stupidity, all of which very clearly are prohibited by both the due process and equal protection clauses of our Constitution, not to mention the 13th and 15th Amendments. It’s not rocket science!

Enough with the Congressional and Court-enabled “Dred Scottification” of the other! That’s how we ended up with things like the “Chinese Exclusion Act” and “Jim Crow” and why we have an institutionalized racism problem now.

Instead of standing up for equal justice for all under the Constitution, the Supremes and Congress often have willingly been part of the problem — using the law knowingly and intentionally to undermine constitutionally required equal justice for all and an end to racism. And, we can see those same attitudes today, specifically in the Supremes’ ridiculously wrong, intellectually dishonest, and cowardly decisions “greenlighting” various parts of White Nationalist Stephen Miller’s bogus program of dehumanizing asylum seekers and immigrants of color. This is not acceptable performance from Justices of our highest Court!

We need better, more courageous, and more intellectually honest public officers in all three branches who are willing to stand up for individual rightshuman lives, and the common good over bogus right wing legal doctrines and inhumanity cloaked in legal gobbledygook. It won’t happen overnight. But, a better America starts with throwing a totally corrupt, cruel, and maliciously incompetent President and his GOP enablers out of every public office at every level of government this November.

Now that we are deep into protests over racism, inequality and police brutality — protests that I’ve come to see as a revisiting of Freedom Summer —  it is clear that Donald Trump sees the activation of white nationalism and anti-otherness as his path to re-election. We are engaged in yet another national conversation about race and racism, privilege and oppression.

But, as is usually the case, the language we used to describe the moment is lacking. We — the public and the media, including this newspaper, including, in the past, this very column — often use, consciously or not, language that shields anti-Black white supremacy, rather than to expose it and hold it accountable.

We use all manner of euphemisms and terms of art to keep from directly addressing the racial reality in America. This may be some holdover from a bygone time, but it is now time for it to come to an end.

Take for instance the term “race relations.” Polling organizations like Gallup and the Pew Research Center often ask respondents how they feel about the state of race relations in the country.

I have never fully understood what this meant. It suggests a relationship that swings from harmony to disharmony. But that is not the way race is structured or animated in this country. From the beginning, the racial dynamics in America have been about power, equality and access, or the lack thereof.

Protests, and even violence, have erupted when white people felt their hold on those things was threatened or when Black people — or Indigenous people, or Hispanics — rebelled against those things being denied.

So what are the relations here? It is a linguistic sidestep that avoids the true issue: anti-Black and anti-other white supremacy.

White Supremacy is at the core of Donald Trump and today’s GOP. It is willfully enabled by Chief Justice John Roberts and other Supreme Court Justices who refuse to acknowledge the obvious anti-Hispanic and anti-people of color motivations behind unconstitutional and inhuman immigration and asylum restrictions designed by notoriously outspoken neo-Nazi racist Stephen Miller. 

Likewise, the intellectually corrupt Supremes’ majority fails to prevent the GOP’s racist strategy of suppressing voting rights of African Americans and Latinos. The unconstitutionality of these schemes to deny the vote and dilute the political power of people of color has been crystal clear under our Constitution since the enactment of the 15th Amendment to the U.S. Constitution in 1870. 

You don’t need a Harvard law degree to figure this out. Just honesty, courage, and intellectual integrity — things that I once took for granted among Supreme Court Justices, but now see are sorely missing on today’s Court where extreme rightist ideology identified with white supremacy has replaced judicial qualifications as selection criteria when the GOP was in charge.

Ending white supremacy in America will require ousting Trump and the GOP and ending the GOP’s power to put more unqualified judges who are opposed to racial and social justice in America on the Federal Bench.
