Wonder whatever happened to the “gender-based regulations” that Biden ordered to be drafted by Executive Order issued shortly after taking office? At this point, given his “lobotomized/running scared/retrograde/Trumpy Lite” position on asylum seekers and immigrants’ rights, probably just as well that they died an unheralded bureaucratic death (just as similar assignments have in the last three Dem Administrations over a quarter century).
Outside of a few Immigration Judges, who, because they understand the issue and have worked with asylum-seeking women, would never be asked anyway, I can’t really think of anyone at DOJ who would actually be qualified to draft legally-compliant gender-based regulations!
GOP are misogynists. Dem politicos are spineless and can’t “connect the dots” between their deadly, tone-deaf policies and poor adjudicative practices aimed at women of color in the asylum system and other racist and misogynistic polities being pushed aggressively by the far right! While, thankfully, it might not “be 1864” in the Dem Party, sadly, inexplicably, and quote contrary to what Biden and Harris claim these days, it’s not 2024 either, particularly for those caught up in their deadly, broken, and indolently run immigration, asylum, and border enforcement systems!
Instead of listening to our two primary presidential contenders vie over which one is tougher on immigration, let’s consider reframing the debate for a meaningful immigration reform that benefits our nation instead of depriving it of resources wasted on ineffective enforcement policies:

Thanks, Craig, for highlighting the work of my friend and former Georgetown Law colleague Heidi Altman, Director of Policy at NIJC. Heidi is the embodiment of what real leadership, innovation, humane, creative thought on immigration and the border looks like. She stands in dramatic contrast to the pathetic fear mongering (Trump) and fear of standing up for values (Biden) “leadership” coming from our candidates and reflected in the failure of politicos of both parties to embrace humane, cooperative, beneficial solutions for those seeking asylum at the border.
Heidi is a particularly great representative and leadership role model for Women’s History Month.
I had additional thoughts on this podcast:
Better judges, not just more judges. To be effective and efficient, EOIR judges at both levels must be recognized experts in asylum, human rights, and due process who are not afraid to set positive precedents, grant protection to those who qualify under a properly generous interpretation of the law, simplify evidentiary requirements and state them in clear, practical terms, establish and enforce best practices, and steadfastly oppose the political abuse of the Immigration Courts as “deterrents” or as extensions of DHS enforcement. The failure of Garland to clean house at EOIR, particularly the BIA, and of Mayorkas to do likewise at the Asylum Office has been a national disaster driving much of the “disorder at the border.”
Invest in VIISTA Villanova and other innovative programs to expand pro bono and low bono representation.Seehttps://www1.villanova.edu/university/professional-studies/academics/professional-education/viista.html. Reach beyond lawyers and NGOs to train students, retirees, social justice advocates, and “ordinary citizens” who want to help by becoming “Accredited Representatives” for “Recognized Organizations” and represent asylum seekers before the AO and EOIR. The programs is top-notch, online, and “scalable.” The Biden Administration’s failure to tap into it and “leverage” it is another dramatic failure of leadership.
Better leadership needed in the Biden Administration. As we have seen over the last three years, all the great ideas (and there is a plethora of them) in the world are meaningless without the dynamic, courageous, effective leadership to make it happen! Garland, Mayorkas, the White House Domestic Policy Office, and the Biden Campaign are dramatic negative examples of folks who lack the hands-on expertise, courage, creativity, and skills to lead on effective administrative immigration reform. I endorse Heidi’s proposal to create a White House Task Force. But, without expert, dynamic, empowered leadership, that Task Force will be ineffective. (Take it from me, over 35-years in the USG, I was on lots of “task forces” and other “action/study groups” whose voluminous reports and well-meaning proposals went directly into a dusty file cabinet or paper shredder.) Think Julian Castro, Dean Kevin Johnson, Judge Dana Marks, Professor Karen Musalo, Beatriz Lopez, Professor Michele Pistone, Anna Gallagher, Camille Mackler, Professor Stephen Yale-Loehr, Heidi Altman, Alex Aleinikoff, Mary Meg McCarthy, Paula Fitzgerald, et al — any of these folks, or a combination, or other “battle tested experts” like them would be head and shoulders over the inept gang advising on and “implementing” (and I use this term loosely) immigration policy for the Administration and the campaign. Leadership counts! And, time’s a wasting to start fixing this asylum system before the election!
Acquiescence gets Dems the same place as activist racism. I “get” that the nativist border agenda now being shoved down our throats by both campaigns is driven by GOP fear-mongering and Dem acquiescence. That’s classic Jim Crow! I doubt that every White person south of the Mason-Dixon Line during my youth was overtly racist. Yet, a whole bunch of them were happy to acquiesce in segregation (and worse) because it served their political, social, or business purposes. For example, ”I’ve personally got nothing against Blacks, but if I hired one at my store all my business would go elsewhere.” In calling for “bipartisan” joining with the Trump-generated racist proposal to “close theborder,” Biden and many of his supporters are basically endorsing a lawless, cruel, anti-humanitarian program that couldn’t succeed if enacted. Does that he might be doing it as an act of “political strategy,” “shifting the blame,” or “one-upmanship,” rather than “genuine” racism, xenophobia, and hate, like Trump and MAGA nation, somehow make it more palatable? Not to me!
Stop the candidate’s negative campaigning. If Joe can’t think of anything better to say about human rights and the border than to point fingers at the GOP and try and match Trump’s cruelty, lawlessness, and stupidity on the issue, better he say nothing at all.
Don’t get suckered by “whataboutism.” Undoubtedly, there are those in our community genuinely concerned that helping asylum seekers resettle and succeed will deflect resources and attention from existing problems like homelessness and poverty. Nevertheless, few, if any, of my friends and acquaintances who have actually spent their lives, or substantial portions thereof, helping the less fortunate in our communities express this fear. They believe that that if we treat all of our fellow humans as humans, we can expand opportunities and economic activities across the board so that there will be enough for everyone. It’s aderivation of something we say every Sunday at the community church we attend: “All are welcome at Christ’s table.” Also, asylum seekers and other migrants disproportionately give back to communities, particularly low income communities, rural communities, or others in need. By contrast, many of those raising these fears are the same GOP folks who steadfastly want to cut meals for kids, slash after-school programs, defund proven-to-work programs that reduce poverty, and restrict or limit other existing aid programs. It’s not like these folks would “repurpose” any of the very limited funds spent on assisting migrants to helping the homeless or the less fortunate. No, they would almost certainly spend it on more deadly, yet ineffective walls, “civil” prisons, unnecessary tax cuts for the wealthy, and/or more counterproductive, wasteful, costly border militarization. Don’t get suckered by their “crocodile tears” for the poor and needy!
Contrary to the BS 💩 that is peddled every day by the presidential candidates, spineless politicos of both parties, and the mainstream media, the border is solvable with common sense, humane, innovative legal reforms. More cruel, wasteful, and essentially mindless enforcement and restriction is NOT the answer, nor will it ever be!
People all around the world look to the United States as a land of opportunity and safety. Every month, tens of thousands of people arrive at US border checkpoints and ask to be granted asylum. Over the last decade, the number of people showing up at the southern U.S. border seeking protection has increased five-fold to more than 200,000 every month. That huge increase has so overwhelmed the system that getting a final answer often takes years. There is bipartisan agreement that the asylum system is broken. How we fix the backlog, though, depends a lot on how we answer the question at the heart of today’s podcast episode: what is our obligation to asylum seekers? Are we responsible for taking these individuals in? We’ll be hearing from two previous asylum seekers about the challenges of seeking asylum in the United States, a writer who had an eye-opening experience learning how America’s asylum process differs from other countries, and two former immigration judges with differing perspectives on how we should implement asylum law in the United States. As we hear each of these perspectives, we’ll consider this question: what do we owe people who are no longer safe or able to prosper in the countries where they happen to have been born?

In this interview, Rev. Craig B. Mousin, an Adjunct Faculty member of DePaul University’s College of Law, Refugee and Forced Migration Studies Program, and the Grace School of Applied Diplomacy interviews Heidi Altman, the Policy Director of the National Immigrant Justice Center (www.immigrantjustice.org). Ms. Altman discusses a proposed rule that will effectively preclude most asylum-seekers from safely and effectively applying for asylum in the United States. She advocates for humanitarian asylum welcome. She previously served as the legal director for the Capital Area Immigrants’ Rights Coalition and was a Teaching Fellow in the immigration clinic at Georgetown University Law School.

Here are “my takeaways:”
Asylum seekers have a legal right, established by the Refugee Act of 1980 and international conventions, to seek asylum at our border or in the U.S., regardless of status and/or nationality;
The Trump and Biden Administrations have abrogated this right without legislation;
The Trump Administration’s anti-asylum actions and intentional dehumanization of asylum seekers was rooted in White Nationalist nativism;
Despite recognition during the 2020 campaign of the invidious motivation for Trump’s anti-asylum policies, the Biden Administration has retained, or even enhanced, the dehumanization and denial of rights to asylum seekers at the border;
Over the past two Administrations, acceptance of the basic rights and obligations of the U.S. toward asylum seekers, incorporated in the Refugee Act of 1980, has been eliminated or reduced to a superficial “shell” (“asylum in name only,” as some advocates have termed Biden’s latest proposed anti-asylum border policies);
By abandoning the framework set forth in the Refugee Act of 1980, the Trump and Biden Administrations have re-injected the ad hoc approach,disorder, nationality bias, and ideological preferences at the border that the Refugee Act of 1980 was specifically enacted to eliminate;
There is much under-appreciated support for welcoming, fairly treating, and helping refugees and asylum seekers among Americans in communities throughout our nation;
NGOs and experts have dozens of great ideas for restoring and improving the legal right to seek asylum in fair, humane, non-discriminatory ways which they have shared or are happy to share with the Biden Administration;
The Biden Administration to date has shown little if any interest in adopting and implementing better humanitarian solutions for asylum seekers at the border;
Both parties lack leaders with the integrity and courage to stand up for the legal and human rights of asylum seekers;
We must continue to discuss ways to break the cycle of dehumanization, cruelty, and scofflaw treatment of asylum seekers and replace it with enhanced humanitarian procedures and a welcoming culture, in accordance with the Refugee Act of 1980, the U.N. Convention and Protocol, and the very best traditions of our nation of immigrants.

Thanks Craig for speaking truth when so many are spreading false information and advocating trading human rights that aren’t ours to give away for “benefits” that should be conferred on their own merits with no “strings attached.”
Unhappily, even the normally reliable and sensible Greg Sargent @ WashPost is spouting some of this absolute nonsense! He speaks of indefinitely extending massive violations of legal and human rights (“Title 42”), prisons for asylum seekers (“processing centers”), and expedited dockets (“deportation railroads without due process”) as if they are “OK trade-offs” for so-called “immigration reform.”
Notably, there is nothing now stopping the Administration from processing more refugees outside the U.S., providing grants to innovative organizations like “VIISTA Villanova” for training more qualified pro bono asylum representatives without having to rely exclusively on law schools, replacing poorly qualified Asylum Officers and Immigration Judges with asylum and human rights experts, appointing a new expert BIA qualified to establish affirmative precedents to guide Asylum Officers, IJs, and lawyers on both sides in how to recognize, document, and grant asylum in accordance with the generous intent of the law and the U.N. Convention on which it is based, providing grants to NGOs for systemic resettlement of asylees and applicants away from the border, targeting and prosecutinghuman smugglers, and expeditiously removing those arriving at or near the border who can’t establish a “credible fear” of persecution.
That the Administration has failed to bring in the necessary visionary, dynamic, competent leadership to accomplish any of the foregoing, and thata Dem-controlled Congress has failed in its oversight responsibilities and to push the Administration to fulfill its legal obligations to asylum seekers is a question of competence and will, NOT the fault of asylum seekers and their advocates. Nor is it a basis to reduce the already unfairly and illegally compromised rights of asylum seekers
Craig basically echoes some of the themes I set forth this week in my “Dissenting Opinion!”
The John McCutcheon version of Woodie Guthrie’s song “Deportees” shows how deeply ingrained “Dred Scottification” is in our country’s often unconstitutional, impractical, and sometimes immoral approach to immigration enforcement.“De-personification” of “the other’” — treating them as numbers, statistics, even “beds” or “apps” without names, faces or rights — and making up vile myths and lies about them, all whileexploiting their labor — is still at the heart of the anti-American White Nationalist agenda!
Social justice activism is an important multi-disciplinary endeavor — here we see how law, education, religion, civics, history, broadcast journalism, performance art, music, technology, political science, economics, language, culture, & communication all work together to thwart hate and lies;
More undergraduate institutions need to be making these links and insisting that the true history of American Immigration — with all its triumphs and warts — becomes a staple of education;
Many of those tone-deaf (or worse) politicos pushing the far right agenda of hate, lies, and racism reflected in the defeated amendments are elitists masquerading as “bogus populists” who got the benefit of education at some of the top law schools and universities in the nation. Whatever happened to the teaching of basic legal ethics and responsibilities to society? The Jim Crow agendas of today differ little from those of the pre-civil rights era of the 20th Century. These are NOT debates between legitimate “differing viewpoints,” but essentially questions of truth vs. lies, hate v. tolerance, integration v. exploitation;
The White Nationalist Right is taking over school boards and local governance in the false name of “parents’ rights” — actually meaning the rights of far right parents to impose their minority religious doctrines and false social doctrines on others. The fight for social justice begins at the local level where where teaching of truth and legitimate debates are being drowned out by disgruntled, anti-democracy, empowered White Nationalist theocrats who claim they want liberty but actually are trying to impose autocracy and minority rule;
We just posted our latest podcast urging folks to email or call Congress to stop Title 42, “Do Not Let Summer Daze Turn Pretense Into Law: End Title 42.”
Title 42 is a total, disgraceful fraud that violates U.S. and international law, abuses (and sometimes kills) vulnerable refugees seeking to exercise legal rights, and turns immigration policy over to cartels and human smugglers
Shockingly, instead of standing up for due process, human rights, and the rule of law, horrible right-wing Federal Judges have gone along with this farce at the urging of GOP White Nationalist state AGs.
Ann is active in evaluation circles nationally. Her evaluation practice and podcast center on Georgia and its community-based social service organizations.
On the pod we make the following points:
(1) Advocacy is an important tactic to achieve social change goals.
(2) Strong advocacy is led by affected communities. Allies in the nonprofit and philanthropy sectors provide important support to community-led change.
(3) Elected officials need and want input from service providers in their districts. Whether you have lots of time for advocacy or only a very limited amount of time, your input can make a difference.
(4) Help is available for community organizations that want to investigate advocacy but are not sure what they are legally permitted to do. Bolder Advocacy, a program of Alliance for Justice, provides technical assistance and training.

Last Wednesday, I broke the news to Heather Cox Richardson that she was the most successful individual author of a paid publication on the breakout newsletter platform Substack.
Early that morning, she had posted that day’s installment of “Letters From an American” to Facebook, quickly garnering more than 50,000 reactions and then, at 2:14 a.m., she emailed it to about 350,000 people. She summarized, as she always does, the events of the day, and her 1,120 words covered a bipartisan vote on a spending measure, President Trump’s surprise attack on that bill, and a wave of presidential pardons. Her voice was, as it always is, calm, at a slight distance from the moment: “Normally, pardons go through the Justice Department, reviewed by the pardon attorney there, but the president has the right to act without consulting the Department of Justice,” she wrote. “He has done so.”
The news of her ranking seemed to startle Dr. Richardson, who in her day job is a professor of 19th century American history at Boston College. The Substack leader board, a subject of fascination among media insiders, is a long way from her life on a Maine peninsula — particularly as the pandemic has ended her commute — that seems drawn from the era she studies. On our Zoom chat, she sat under a portrait that appeared as if it could be her in period costume, but is, in fact, her great-great-grandmother, who lived in the same fishing village, population a bit over 600.
She says she tries not to think too much about the size of her audience because that would be paralyzing, and instead often thinks of what she’s writing as a useful primary document for some future version of her historian self. But there was no ignoring her metrics when her accountant told her how much she would owe in taxes this year, and, by extension, just how much revenue her unexpected success had brought. By my conservative estimate based on public and private Substack figures, the $5 monthly subscriptions to participate in her comments section are on track to bring in more than a million dollars a year, a figure she ascribes to this moment in history.
“We’re in an inflection moment of American politics, and one of the things that happens in that moment is that a lot of people get involved in politics again,” she said.
Many of those newly energized Americans are women around Dr. Richardson’s age, 58, and they form the bulk of her audience. She’s writing for people who want to leave an article feeling “smarter not dumber,” she says, and who don’t want to learn about the events of the day through the panicked channels of cable news and Twitter, but calmly situated in the long sweep of American history and values.
Dr. Richardson’s focus on straightforward explanations to a mass audience comes as much of the American media is going in the opposite direction, driven by the incentives of subscription economics that push newspapers, magazines, and cable channels alike toward super-serving subscribers, making you feel as if you’re on the right team, part of the right faction, at least a member of the right community. She’s not the only one to have realized that a lot of people feel left out of the media conversation. Many of the most interesting efforts in journalism in 2021, some of them nonprofit organizations inspired by last summer’s protests over racism, will be trying to reach people who are not part of that in-group chat. One new nonprofit, Capital B, plans to talk to Black audiences, while another well-regarded model is Detroit’s Outlier Media, which is relentlessly local and often delivered by text message. For Dr. Richardson’s audience, it’s an intimate connection. She spends hours a day answering emails from readers. She spent most of Saturday sending thank-you notes for Christmas presents.
The challenge for many of those efforts, and for nonprofit news organizations in general, has been reaching large numbers of people. Dr. Richardson, whose run of short essays began when she was stunned by the response to one she posted last September, has done that by accident, though she credits her huge audience of older women to the deepening gender gap in American politics.
“What I am doing is speaking to women who have not necessarily been paying attention to politics, older people who had not been engaged,” Dr. Richardson said. “I’m an older woman and I’m speaking to other women about being empowered.”
Dr. Richardson confounds many of the media’s assumptions about this moment. She built a huge and devoted following on Facebook, which is widely and often accurately viewed in media circles as a home of misinformation, and where most journalists don’t see their personal pages as meaningful channels for their work.

Dr. HCR is certainly a favorite at our house! Her writing is very “accessible” — you don’t have to be a scholar or an academic to understand her “info packed” daily letters.
She also illustrates the important role of history and the liberal arts at promoting critical thinking and informed analysis at all levels of our educational system.
“Conspiracy theories,” intentionally false narratives, myths, racial bias, inequality, and hatred all flourish in the dark.

Attorney General William P. Barr delivered a scathing critique of his own Justice Department Wednesday night, insisting on his absolute authority to overrule career staff, whom he said too often injected themselves into politics and went “headhunting” for high profile targets.
Speaking at an event hosted by Hillsdale College, a school with deep ties to conservative politics, Barr directly addressed the criticism that has been building for months inside the department toward his heavy hand in politically sensitive cases, particularly those involving associates of President Trump.
“What exactly am I interfering with?” he asked. “Under the law, all prosecutorial power is invested in the attorney general.”
Barr’s comments were remarkable, in that the head of the Justice Department catalogued all of the ways in which he thought his agency had gone astray over the years, and in its current formulation harms the body politic. Barr has drawn considerable criticism for intervening in criminal cases in ways that help benefit the president’s friends.
Barr said it was he, not career officials, who have the ultimate authority to decide how cases should be handled, and derided less-experienced, less-senior bureaucrats who current and former prosecutors have long insisted should be left to handle their cases free from interference from political appointees.
Barr said that argument, in essence, means “the will of the most junior member of the organization” would make decisions, but he insisted he would not “blindly” defer to “whatever those subordinates want to do.”
“Letting the most junior members set the agenda might be a good philosophy for a Montessori preschool, but it is no way to run a federal agency,” Barr said.
The attorney general, the nation’s top law enforcement official, spent much of the speech eviscerating the idea of the Justice Department as a place where nonpolitical career prosecutors should be left to decide how sensitive cases are resolved.

I’m sure this does wonders for morale at the DOJ! But, demoralizing all the career lawyers and pushing them out the door appears to be part of the program. After all, the regime initially tried to “buy out” the holdover members of the BIA. Morale at the Immigration “Courts” is already at an all-time low!
Career civil servants at the DOJ and elsewhere actually work for the people of the U.S., not personally for Billy, other political appointees, or the President. Government employees take an oath to uphold the Constitution, not of loyalty to the President, the AG, or any other political official.
Billy clearly has been running the Immigration “Courts” as a politically weaponized part of the regime’s White Nationalist, authoritarian, race-driven immigration enforcement agenda. Funny how long it has taken the overall legal community to see that Barr basically considers the entire legal system, including the Article III Courts, as just as subservient as the Immigration “Courts.” And, to date, the Supremes have done little to discourage that view.
He is carrying out a personal agenda of replacing representative democracy with an authoritarian state where everybody and everything is subservient to an all-powerful totally unconstitutional “Unitary Executive” (actually a bogus right-wing “invented concept” with no actual legitimate basis in American political history, as cogently “debunked” by Ayer in his podcast). That certainly makes him one of the two most dangerous men in America!
Billy did say one thing I agree with. Politicos, particularly hacks like Billy and Trump, can be held accountable at the ballot box. Indeed, given the feckless performance of the GOP Senate and the overall failure of the Federal Courts to stand up to tyranny, that appears to be the very last hope for our democracy.
Had enough of the Liar in Chief, Billy the Bigot, Moscow Mitch, & Co? Vote the GOP out of every public office at every level this Fall, while there is still a chance to save our democracy!

Apparently, “DHS brass” tried to intimidate them with some of the same dishonest “scare tactics” used to pick on foreign nationals. Didn’t work! Perhaps after three years of being immersed in the “toxic culture” of DHS, Cristina and Shaul recognized the attempts to use “muscle, deception, and baseless threats” for what they were.
This is merely the latest example of Trump’s leveraging of the powers of the presidency to avoid legal accountability. Over the past four years, he has deployed the Justice Department to try to stop a New York grand jury from conducting a criminal investigation into the president’s businesses; Congress from investigating his financial entanglements; and several litigants from requiring the president to divest his financial stake in hotels and businesses that create conflicts of interest — investments that may even violate the Constitution. Now, Trump is using a federal agency to try to ensure that he faces no consequences for — if Carroll’s account is true — lying about an incident that she describes as rape.
The legal theory that the Justice Department is pursuing now is also at odds with another theory that the department has advanced to help the president avoid accountability, in a case involving whether Trump can block critics on Twitter. In that instance, the department has argued that the president can block people on the social media site because his Twitter feed amounts to purely private speech, not official actions. That’s a bold claim — made bolder when the department insists that Trump’s comments about a private citizen, about an episode from the 1990s, constitute actions within the scope of his duties as president.
The goal is the same, though the methods vary: Protect Trump at all costs. It’s one thing for lawyers in private practice to pursue contradictory and outlandish tactics like these. It’s quite another for the Justice Department to do so, at taxpayers’ expense.

How timely! Just yesterday on Courtside, I gave Billy the Bigot the nod over Jeff “Gonzo Apocalypto” Sessions and “John the Con” Mitchell in the hotly contested race for “The Worst AG in Modern American History.”
I still think that Gonzo could have pulled it out if he had only been given some more time! His overt racism, misogyny, intellectual dishonesty, fraud, stupidity, bias, and “crimes against humanity” set a standard for morally corrupt officials that seemed unassailable until Billy the Bigot went into “full destructo mode.”
As someone who started working at the DOJ in 1973, I witnessed (if only from the crowd standing outside the Great Hall) the “voluntary departure” of Elliot Richardson following the “Saturday Night Massacre,” where he resigned rather than carry out President T. Dick Nixon’s inappropriate demand that he fire the Watergate Special Prosecutor. Could you imagine Billy the Bigot refusing any demand from “His Don,” no matter how illegal, unethical, and/or outrageous? When it comes to the history of Government corruption and the DOJ, I know what I’m talking about.
Heck, I even survived long enough to get “purged” myself by Ashcroft in 2003, during my “DOJ reincarnation.” So, I’m no stranger to the imperfections and shortcomings in the supposed “independence” of the DOJ.
Nevertheless, I heartily agree with Don Ayer that the dishonesty, deceit, bias, bigotry, racism, and scofflaw attitudes installed into DOJ operations by Gonzo and Billy are light years beyond prior abuses I have witnessed during my nearly five decades in the law.
Don Ayer, my former DOJ colleague and partner at Jones Day DC, confirms what I have been saying for a long time on Courtside about Billy the Bigot’s unconstitutional and unethical control of the Immigration Courts.
Listen to this podcast and ask yourself: “How could any foreign national, particularly an asylum seeker, non-Christian, or person of color get a fundamentally fair and impartial hearing before ‘judges’ selected, directed, evaluated, and governed by Billy?” If that’s not enough, if the foreign national does happen to win, Billy just unilaterally intervenes and changes the results, even in cases completed back in the Bush II Administration!
Obviously, this isn’t justice; to use Don Ayer’s term, this is “Banana Republic” authoritarian injustice.
So, how have Congress and the Roberts-led Supremes let Billy get away with this disgraceful unconstitutional mockery of everything our nation stands for? Good question with no happy answer.
During Watergate, it took a concerted effort by a bipartisan Congress, the Federal Courts including the Supremes, and independent lawyers and investigators working for the Watergate Special Prosecutor within the DOJ to bring about Nixon’s forced resignation in the face of inevitable impeachment and conviction.
By contrast, today’s GOP Senate and the GOP-appointed “JR Five” on the Supremes have shown themselves to be shameless toadies, sycophants, and enablers in the face of clearly abusive Executive overreach and tyranny. The post-Watergate ethical reforms, checks, and balances put in place by former GOP-appointed AG Ed Levi, cited by Don, have been completely dismantled in broad daylight by the Trump regime with no pushback from Congress or the Supremes. This serious, entirely preventable, deterioration and abandonment of the rule of law and ethical norms cuts across all three Branches of Government and threatens the very foundations of our democracy.
Assuming (by no means a certainty) that our nation puts it together this Fall to remove the Trump kakistocracy, we need a careful and thoughtful re-examination of the types of individuals we are rewarding with life-tenured judicial appointments and why those now on the bench, as a group, failed so miserably to uphold the Constitution, protect human dignity and decency, and thwart the outrageous scofflaw agenda of Trump and his cronies like Billy the Bigot and neo-Nazi Stephen Miller.
Don Ayer specifically mentions the outrageous “Wall Charade” where Trump illegally and unethically steamrolled legislation, the Constitution, the public purse, and common sense to divert money to his “Political Wall” using a patently bogus and fabricated “national security” pretext.
But, here’s the rest of the story: When Trump-owned Solicitor General Noel Francisco presented this “false claim” to the Supremes, disingenuously asserting a clearly fabricated “emergency” he got the JR Five to roll over! Instead of upholding the lower court’s correct injunction and referring Francisco to bar authorities for unethical conduct, they actually approved this farce, by a 5-4 “party line vote.” Of course, that spineless performance has greenlighted other racist-driven White Nationalist policies and an aura of impunity among the Trump regime kakistocracy.
Gee wiz, a Federal Court actually determined some time ago that DHS honchos Chad “Wolfman” Wolf and Ken “Cooch Cooch” Cuccinelli are both illegally serving in their current positions. But, in the “no consequences no accountability” atmosphere established by the Roberts Court, Cooch and Wolfie continue to abuse migrants with arrogant impunity. They obviously have no fear of accountability. Even if they got in trouble, Trump would simply run over the Constitution to pardon them.
As I constantly say, “it’s not rocket science.” There are scores of talented courageous lawyers out there in the private, NGO, and academic sectors who could have out-performed the “JR Five” in protecting our republic. Why are they stuck in the trenches rather than sitting on the Federal Benches?
When Congress and the Executive fail, the nation turns to the supposedly independent Article III Courts as democracy’s last defender. But, Roberts & Co. have been more than “MIA” — they have actively contributed to the downfall with outrageous derelictions of duty on voting rights, civil rights, and grotesque, unconstitutional “Dred Scottifiction” of migrants of color that actually harms, maims, and kills innocent humans almost every day.
Think that “Dred Scottification” couldn’t happen to you? Guess again! Don Ayer says all of our freedoms and democratic norms will be on the line if Billy and “His Don” get another four years to complete their destruction. Believe him!
This Fall, vote like your life depends on it! Because it does!
